                    Monsieur le président, notre Chambre a déjà voté ce texte et le Sénat l'a légèrement amendé. Ces amendements du Sénat portaient sur une extension de la notion de personne vulnérable:

- dans le cadre d'une situation de traitement dégradant;

- lorsque l'on attire ou utilise un mineur ou une personne qui est dans cette situation de dépendance ou de maltraitance;

- dans l'hypothèse de harcèlement;

- dans l'hypothèse d'abstention coupable.

Chaque point fait référence à un article du Code pénal.

Le Sénat, dans l'article 44, a modifié, ou complété en tout cas, la liste des infractions sur base desquelles les établissements d'utilité publique et les associations qui ont cela dans leur objet social pourront ester en justice.

Le texte a été approuvé par la commission à raison de neuf voix pour et quatre contre. Des amendements avaient été déposés, notamment par Mme De Wit. Je vois qu'elle les redépose et j'imagine qu'elle les explicitera.

                    Mijnheer de voorzitter, collega’s, de debatten werden al grondig gevoerd in de commissie. Ik wil enkel kort onze houding bij dit voorstel toelichten en uitleggen waarom we onze amendementen opnieuw indienen.

Een ding wil ik vooraf duidelijk stellen: het is voor ons geen enkel probleem, integendeel zelfs, om zwakkere personen te beschermen, ook tegen misbruiken door sekten of andere misbruiken. Wij zijn het dus absoluut eens met het doel dat die mensen onze bescherming verdienen. Onze fractie is er echter niet van overtuigd dat de voorliggende oplossing de beste is.

Wetgeving moet duidelijk zijn, coherent, consistent en eenvoudig. Kortom, zij moet rechtszekerheid bieden, een remedie tegen een kwaal. Wij vrezen dat deze remedie nieuwe kwalen zal veroorzaken. Ik verzin dit niet. Het was ook een opmerking van de Raad van State en van academici. Ik vrees dat de rechtspraktijk snel zal volgen. Er zijn verschillende aspecten die voorliggen. Enerzijds, zijn er de verzwarende omstandigheden die worden toegevoegd aan een reeks bestaande misdrijven. Op zich geen probleem daarmee, maar wij weten ook dat de procedure dermate zal vertragen dat dit niet altijd ten dienste zal zijn voor slachtoffers. Er zullen heel wat deskundigenonderzoeken nodig zijn.

Bijkomend, moeten we vandaag al vaststellen dat het ondanks de aanpassingen niet sluitend is. We hebben vandaag al het geval gehad van de vrouw die werd vrijgesproken van verkrachting van een meerderjarige. Ook aanranding was niet mogelijk, omdat die minderjarige minderbegaafd was. De wet beschermt die mensen niet. Er is dus al een lacune door deze werkwijze.

Een groter bezwaar betreft het nieuwe artikel 442quater, het autonoom misdrijf dat we nu invoeren. Opnieuw is het niet het beoogde doel waarmee we een probleem hebben, wel het middel. De terminologie is vaag en is nieuw, met heel wat termen die het strafrecht niet kent en dat zal aanleiding geven tot interpretatieproblemen.

Belangrijker en een zeer groot bezwaar van de Raad van State is dat er een zeer groot risico op samenloop met andere misdrijven is, zeker nu we daar overal de verzwarende omstandigheid hebben toegevoegd. De Raad van State zegt dat het voor de rechtszekerheid belangrijk is dergelijke samenloop te vermijden. We hebben dat risico verhoogd met deze wetgeving.

De complexiteit van het Strafwetboek wordt nodeloos verhoogd en dat dient de rechtszekerheid en de slachtoffers niet. Daarom hadden wij een amendement ingediend om wat door artikel 442quater werd beoogd, in te voegen in het reeds bestaande artikel 496, eerder dan een nieuw ingewikkeld artikel en een nieuw misdrijf in te voeren. Om die reden hebben wij deze amendementen vandaag opnieuw ingediend.

The discussions have already been thoroughly conducted in the committee. I just want to briefly explain our position on this proposal and explain why we are submitting our amendments again.

One thing I would like to clarify beforehand: it is not a problem for us, on the contrary, even to protect weaker persons, including against abuse by sectaries or other abuses. So we absolutely agree with the goal that these people deserve our protection. However, our group is not convinced that the present solution is the best.

Legislation must be clear, coherent, consistent and simple. In short, it must provide legal certainty, a cure for a disease. We fear that this remedy will cause new illnesses. I do not understand this. It was also a comment from the State Council and from academics. I am afraid that legal practice will follow soon. There are several aspects that exist. On the one hand, there are the aggravating circumstances that are added to a series of existing crimes. There is no problem in itself, but we also know that the procedure will slow so much that it will not always be at the service of the victims. A lot of expert studies will be needed.

Additionally, we must already note today that despite the adjustments, it is not conclusive. Today we have already had the case of the woman who was acquitted of rape of an adult. Attack was also not possible because the minor was less talented. The law does not protect those people. There is already a gap in this method.

A larger objection concerns the new article 442quater, the autonomous crime that we are now introducing. Again, it is not the intended goal with which we have a problem, but the means. The terminology is vague and is new, with a lot of terms that the criminal law does not know and that will give rise to interpretation problems.

More important and a very large objection from the State Council is that there is a very high risk of collusion with other crimes, especially now that we have added the aggravating circumstance everywhere there. The State Council says it is important for legal certainty to avoid such collusion. We have increased that risk with this legislation.

The complexity of the Criminal Code is increased unnecessarily and that does not serve the legal certainty and the victims. Therefore, we had submitted an amendment to incorporate what was intended by article 442quater into the already existing article 496, rather than introduce a new complicated article and a new crime. That is why we have submitted these amendments again today.

                    Monsieur le président, environ 30 000 Belges sont touchés par une maladie inflammatoire chronique intestinale (MICI), dont la maladie de Crohn et la colite ulcéreuse. Environ 15 000 personnes souffrent de la maladie de Crohn et 15 000 de colite ulcéreuse.

Ces maladies sont chroniques et incurables. Une fois installées, elles évoluent par poussées tout au long de la vie du patient. Elles sont aussi largement méconnues du grand public. Les symptômes sont socialement très handicapants, peut-être est-ce pour cela que nous n'avons parfois pas envie de les voir. Ces symptômes entraînent une non-reconnaissance des patients et de l'impact de ces maladies sur leur vie quotidienne.

Pour tenter de remédier à ce manque de reconnaissance, ce caractère handicapant de la maladie et son caractère chronique, diverses associations ont lancé en 2008 la campagne "Contrôlez Crohn". L'idée est de faire connaître la maladie au grand public et de générer une liste d'établissements en Belgique – magasins, restaurants, cafés – qui offrent gratuitement l'accès de leurs toilettes aux patients souffrant de cette maladie.

                    Le taux de réponse a été bon mais il n'est pas encore satisfaisant par rapport aux besoins et à la nécessité d'une reconnaissance sociale. Des associations belges ont de ce fait souhaité créer, un peu sur le modèle français, une Journée nationale dédiée aux maladies inflammatoires chroniques intestinales. L'objectif est d'informer et de sensibiliser le grand public sur ce type de maladies. Par ailleurs, ces associations de patients nous ont fait part d'autres types de difficultés qu'elles rencontrent et de leur désir d'avoir des aménagements dans certains aspects de leur vie quotidienne.

L'objectif initial de la résolution qui vous est soumise aujourd'hui était d'instaurer une Journée nationale des Maladies Inflammatoires Chroniques Intestinales en Belgique le 22 octobre. Comme nous sommes déjà le 20 octobre, une demande d'urgence a dû être introduite.

Le deuxième point de la résolution consistait à prendre contact avec les gouvernements régionaux et communautaires pour que cela se traduise par des actions concrètes d'information et de sensibilisation. Cette résolution a été discutée en commission de la Santé publique. Les représentants des différents partis ont eu l'occasion de s'exprimer à ce sujet. Deux séances se sont avérées nécessaires pour avoir l'avis de tout le monde.

Mes collègues de la N-VA ne sous-estiment pas ce que subissent quotidiennement les patients atteints de cette affection. Toutefois, ils émettent des doutes quant à l'utilité de la proposition étudiée. La N-VA soutient un modèle de soins de santé horizontal et non pas vertical et s'oppose à une vision où les soins sont organisés par affection. La N-VA a été rejointe dans ses objections par le Vlaams Belang.

Par contre, le PS et le sp.a qui soutenaient la proposition ont défendu l'idée qu'une Journée nationale de la maladie pouvait avoir un effet symbolique important en termes de revalorisation de ces personnes qui regrettent que leurs souffrances ne soient pas reconnues. Malgré le caractère symbolique que peut avoir une Journée nationale, cela nous semblait très important. Dès le départ, le groupe Écolo-Groen! a soutenu la résolution. J'ai d'ailleurs déposé des amendements en vue de la renforcer. Ceux-ci visaient à sensibiliser le secteur de l'horeca pour que celui-ci donne gratuitement l'accès aux toilettes à ces personnes.

Le deuxième amendement avait trait à la nécessité d'étudier la possibilité d'éviter toute entrave à l'emploi. Les personnes souffrant de MICI ne doivent pas faire l'objet d'une discrimination dans leur entreprise.

Le troisième amendement portait sur la question des assurances et visait à éviter que ces personnes ne fassent l'objet d'une discrimination en matière d'assurances, en particulier en ce qui concerne la prime d'assurance "pour solde restant dû".

Remarquons qu'il s'agit d'une résolution et non d'une proposition légale.

Cette précision étant faite, M. Damien Thiéry a fait part de sa réticence par rapport au dernier amendement précité estimant que la question des assurances devait être réglée dans le cadre d'un autre débat. Une loi a été votée pour éviter ce type de discrimination mais elle n'est pas encore d'application.

Même si nous comprenons le point de vue de M. Thiéry, mon groupe ainsi que d'autres ont soutenu les amendements qui avaient été déposés car nous estimions qu'il était important d'ajouter cette dimension à la résolution.

Le CD&V considérait que l'instauration d'une journée nationale n'était pas particulièrement intéressante dans la mesure où il privilégie une approche plus horizontale et plus générale des maladies chroniques. L'Open Vld a adopté la même position.

Finalement, même si certains partis étaient absents, la résolution a été votée par 7 voix pour et 2 abstentions.

Après m'être exprimée à titre de rapporteuse, je tiens à dire qu'en tant que membre d'Ecolo-Groen!, je confirme que mon groupe soutiendra cette proposition de résolution.

The response rate has been good but it is not yet satisfactory in relation to the needs and the need for social recognition. Belgian associations have therefore wanted to create, somewhat on the French model, a national Day dedicated to chronic inflammatory intestinal diseases. The aim is to inform and raise public awareness about this type of disease. In addition, these patient associations have told us about other types of difficulties they encounter and their desire to have adjustments in certain aspects of their daily lives.

The initial objective of the resolution presented to you today was to establish a National Day of Chronic Inflammatory Bowel Diseases in Belgium on 22 October. As we are already on October 20, an emergency request had to be introduced.

The second point of the resolution was to get in touch with regional and community governments so that this translates into concrete information and awareness-raising actions. This resolution was discussed in the Public Health Committee. Representatives of the various parties had the opportunity to speak on this subject. Two sessions were needed to get everyone’s opinion.

My N-VA colleagues do not underestimate what patients with this condition experience on a daily basis. However, they raise doubts about the usefulness of the proposal studied. N-VA supports a horizontal rather than vertical health care model and opposes a vision where care is organized by affection. The N-VA was joined in its objections by the Vlaams Belang.

On the other hand, the PS and sp.a who supported the proposal defended the idea that a National Day of Disease could have a significant symbolic effect in terms of revalorizing those people who regret that their suffering is not recognized. Despite the symbolic character that a National Day can have, it seemed to us very important. From the beginning, the Ecolo-Groen group! They supported the resolution. I have submitted amendments to strengthen it. These aimed to raise awareness in the horeca sector so that it gives free access to toilets to these people.

The second amendment concerned the need to examine the possibility of avoiding any obstacle to employment. People suffering from MICI should not be discriminated against in their company.

The third amendment addressed the issue of insurance and aimed to prevent such persons from being subject to discrimination in insurance, in particular with regard to the insurance premium “for remaining balance due”.

Note that this is a resolution and not a legal proposal.

With this clarification, Mr. Damien Thiéry expressed his reluctance to the last amendment mentioned above, believing that the issue of insurance should be settled in another debate. A law has been passed to prevent this type of discrimination, but it is not yet applied.

We understand the point of view of Mr. Thiéry, my group and others supported the amendments that had been submitted because we felt it was important to add this dimension to the resolution.

The CD&V considered that the establishment of a national day was not ⁇  interesting in that it favors a more horizontal and more general approach to chronic diseases. The Open Vld has taken the same position.

Finally, even though some parties were absent, the resolution was voted by 7 votes for and 2 abstentions.

After speaking as a rapporteur, I would like to say that as a member of Ecolo-Groen!, I confirm that my group will support this resolution proposal.

                    Mijnheer de voorzitter, collega’s, uit medeleven voor de vele ongemakken, het leed en de zorgen van patiënten die lijden aan de ziekte van Crohn en aan colitis ulcerosa draag ik vandaag dit lintje. Het is een teken van solidariteit met wie getroffen is door het chronisch inflammatoir darmlijden. Toch twijfel ik heel sterk aan de meerwaarde van onderhavig voorstel van resolutie.

Natuurlijk zijn wij allemaal solidair met chronische patiënten. Alleen hebben wij vragen bij de invoering van een nationale dag. Iedere ziekte heeft zijn ongemakken en als we voor iedere ziekte een nationale dag moeten uitroepen, dan hollen we iedere signaalfunctie uit. Dan betekenen al die dagen in de praktijk niets meer.

Er is nu al de Wereldkankerdag, de Wereldnierdag, de Werelddownsyndroomdag, de Wereldtuberculosedag, de Wereldparkinsondag, de Internationale dag voor veiligheid en gezondheid, Wereldastmadag, Internationale Fybromialgiedag, Wereldhepatitisdag, Wereldmultiplesclerosedag, Week van de Multiple Sclerose, Week van het hart, Internationale Alzheimerdag, Werelddovendag, Werelddag van de geestelijke gezondheidszorg, Internationale dag van de witte stok, Werelddiabetesdag enzovoort. Ik vraag mij af of die patiënten worden geholpen met een nationale dag.

De resolutie biedt geen meerwaarde voor de patiënten en al zeker niet voor het Parlement. Volgende week ligt er opnieuw een voorstel van resolutie in de commissie, deze keer voor hepatitispatiënten.

Chronische patiënten hebben nood aan een goede gezondheidszorg. Die voorziet in de juiste behandeling en de goede zorg, onafhankelijk van de aandoening waaraan iemand lijdt. Het is een horizontale gezondheidszorg, waar iedere patiënt toegang krijgt tot de zorg die men echt nodig heeft en niet zoals nu, een verticale gezondheidszorg, waarbij een zorg wordt georganiseerd per aandoening. Elke ziekte heeft wel een parlementslid dat zich op de voorgrond wil plaatsen.

Zo'n gezondheidszorg heeft de N-VA niet voor ogen. Wij streven naar een goede zorg voor alle patiënten, niet alleen voor de patiënten met chronisch inflammatoir darmlijden, maar ook voor de patiënten waarvoor geen nationale dag bestaat. Daarenboven moet het beleid worden bepaald door de verantwoordelijke overheid. Als het gaat om concrete informatie en sensibilisering, preventie dus, zoals hier gevraagd, dan is niet de federale overheid bevoegd, maar wel de Gemeenschappen. Wij vinden dat de nationale overheid zich niet mag moeien met een beleid waarover ze geen bevoegdheden heeft.

Niettegenstaande ons medeleven met de patiënten zullen wij onderhavig voorstel van resolutie niet steunen.

There is already World Cancer Day, World Kidney Day, World Down Syndrome Day, World Tuberculosis Day, World Park Day, International Day for Safety and Health, World Asthma Day, International Fibromyalgia Day, World Hepatitis Day, World Multiple Sclerosis Day, Multiple Sclerosis Week, Heart Week, International Alzheimer’s Day, World Dawn Day, World Mental Health Care Day, International White Stick Day, World Diabetes Day and so on. I wonder if those patients are helped with a national day.

The resolution provides no added value for patients and ⁇  not for Parliament. Next week there is another resolution proposal in the committee, this time for hepatitis patients.

Chronic patients need good health care. It provides appropriate treatment and proper care, regardless of the condition a person suffers from. It is a horizontal health care, where each patient has access to the care that one truly needs, and not as it is now, a vertical health care, where a care is organized by condition. Every disease has a member of parliament who wants to put himself at the forefront.

Such a health care does not have the N-VA in mind. We strive to provide good care for all patients, not only for patients with chronic inflammatory bowel disease, but also for those patients for whom there is no national day. In addition, the policy must be determined by the responsible authority. When it comes to concrete information and awareness, prevention, therefore, as requested here, it is not the federal government, but the Communities. We believe that the national government should not be bothered with a policy over which it has no competence.

Despite our sympathy for the patients, we will not support this resolution.

                    Mijnheer de voorzitter, collega’s, een grote groep mensen wordt getroffen door chronisch inflammatoir darmlijden. Jaarlijks worden er zowat 850 nieuwe patiënten gediagnosticeerd. Ik vind het wel bizar dat, ondanks die hoge cijfers, de twee belangrijkste aandoeningen, colitis ulcerosa of een ontsteking van de dikke darm en de ziekte van Crohn, een ontsteking die vooral aan de overgang van de dikke naar de dunne darm voorkomt, nauwelijks of niet bekend is bij het publiek. Meestal weet men ook niet dat er klachten zijn van echte aanvallen van diarree – dat wil zeggen dat men moet spurten naar het toilet en niet stappen naar het wc –, bloed bij de ontlasting, ernstige klachten over buikpijn tot vermoeidheid en koorts. Dat een groot deel van de patiënten hierdoor in een sociaal isolement terechtkomt, is nog minder geweten.

Volgens de experts en de patiëntenverenigingen komt de onwetendheid vooral door het veel te grote taboe in verband met die aandoeningen. De oorzaak is eigenlijk niet ver te zoeken, collega’s. Van kinds af wordt ons immers aangeleerd om niet over dat onderwerp te praten. Een kind wordt al vlug aangemaand dat niet te doen met de woorden dat dat vies is. Het is dus not done. Om die reden is het enorm moeilijk voor volwassenen om over het thema zonder enige schroom te praten. Het is enorm moeilijk om aan de collega’s of vrienden uit te leggen dat men niet mee uit kan winkelen of eten, omdat het te moeilijk is.

De patiëntenverenigingen en de experts hebben ons gevraagd om te helpen het taboe te doorbreken. Dat kan op een goede manier, namelijk door een nationale dag in te stellen.

Collega’s, ik vind de argumentatie van de heer Beuselinck om die reden heel zwak. Het is zwak om te zeggen dat alle chronisch zieken op een gelijke manier moeten worden behandeld. Een diabetespatiënt bijvoorbeeld heeft totaal andere verwachtingen dan iemand die aan de ziekte van Crohn lijdt. Een fibromyalgiepatiënt heeft ook andere noden.

Vandaar dat sp.a vandaag het voorliggende voorstel van resolutie steunt. Ik ben enorm blij dat wij hiervoor een meerderheid zullen halen in het Parlement.

Mr. Speaker, colleagues, a large group of people is affected by chronic inflammatory bowel pain. Approximately 850 new patients are diagnosed each year. I find it bizarre that, despite these high figures, the two main conditions, colitis ulcerosa or inflammation of the colon and Crohn’s disease, an inflammation that mainly prevents the transition from the colon to the small intestine, are hardly or not known to the public. Usually one is also unaware that there are complaints of real attacks of diarrhea – that is, that one should spur to the toilet and not step to the toilet –, blood at the stool, severe complaints of abdominal pain to fatigue and fever. The fact that a large proportion of patients thus end up in social isolation is even less conscious.

According to the experts and the patient associations, ignorance is mainly due to the too big taboo associated with these disorders. The reason is not far away, my colleagues. From childhood, we are taught not to talk about this subject. A child is promptly encouraged not to do with the words that it is dirty. So it is not done. For this reason, it is extremely difficult for adults to talk about the subject without any shame. It is extremely difficult to explain to colleagues or friends that one cannot go out shopping or eating because it is too difficult.

The patient associations and experts have asked us to help break the taboo. This can be done in a good way, namely by setting up a national day.

For this reason, I find Mr Beuselinck’s argument very weak. It is weak to say that all chronically ill people should be treated equally. For example, a diabetic patient has completely different expectations than someone who suffers from Crohn’s disease. A fibromyalgia patient also has other needs.

Therefore, sp.a today supports the present proposal for a resolution. I am very happy that we will get a majority in this Parliament.

Het betekent dus een enorme emotionele waarde voor die groep mensen dat zij zich eindelijk gesteund voelen wat betreft hun aandoening. Die steun krijgen zij al jaren niet. Het debat kan bovendien gevoerd worden op die dag. Er kan op die dag bijvoorbeeld informatie gegeven worden. Dat brengt mij tot het tweede luik.

Er bestaat voor die mensen sinds een aantal jaren al een pasje, maar blijkbaar is dat niet geweten. Op zo’n dag kan men de horeca en de overheidsinstellingen hieraan herinneren, om te vermijden dat betrokken patiënten moeten wachten op een evenement. Hun aandoening is voor bepaalde patiënten een reden om niet naar een optreden te durven gaan. Stel dat er aan de toiletten zes wachtenden voor hen staan en dat zij aan de toiletdame nog moeten uitleggen wat dat pasje inhoudt! Door dergelijke zaken komen zij in een sociaal isolement terecht.

Imagine that there are six people waiting in front of them at the toilets and that they still have to explain to the toilet lady what that pass means! These situations lead to social isolation.

Il a été dit que 30 000 Belges environ sont touchés par ce type d'infection. Ces maladies sont chroniques et incurables: une fois installées, elles évoluent tout au long de la vie du malade. Hélas, leurs causes exactes ne sont pas encore connues.

Malgré le nombre important de personnes atteintes par ces maladies, ces deux pathologies sont peu connues. Les symptômes sont socialement très handicapants et méconnus, ce qui entraîne une non-reconnaissance du patient et, de là, de l'impact de ces maladies sur la vie quotidienne, professionnelle et sociale.

Un des principaux symptômes de ces maladies est la diarrhée et Mme Detiège a parlé du tabou que constitue ce symptôme dans notre culture. Même pour les patients, il est difficile d'en parler librement.

Une autre difficulté consiste en l'inaccessibilité aux toilettes. Je remercie Mme Snoy d'avoir introduit son amendement pour améliorer la situation des malades grâce à cette demande adressée tant aux services publics qu'aux établissements de l'horeca ou aux grandes surfaces. Pour pouvoir sortir de chez eux et mener une vie sociale plus ou moins normale, les malades doivent pouvoir trouver des toilettes à tout moment et en tout lieu; c'est loin d'être le cas.

En 2008 déjà, certaines associations ont lancé la campagne contre la maladie de Crohn afin de sensibiliser le grand public et de générer une liste d'établissements en Belgique offrant l'accès gratuit à leurs toilettes.

It has been said that about 30,000 Belgians are affected by this type of infection. These diseases are chronic and incurable: once established, they evolve throughout the patient’s life. Unfortunately, their exact causes are not yet known.

Despite the large number of people with these diseases, these two pathologies are little known. The symptoms are socially highly disabled and unknown, resulting in a non-recognition of the patient and, therefore, the impact of these diseases on daily life, professional and social.

One of the main symptoms of these diseases is diarrhea and Ms. Detiège spoke of the taboo that this symptom constitutes in our culture. Even for patients, it is difficult to talk about it freely.

Another problem is the lack of access to the toilet. I thank Ms. Snoy for introducing her amendment to improve the situation of the sick through this request addressed both to public services and to the establishments of the horeca or to large surfaces. In order to be able to leave their home and lead a more or less normal social life, the sick must be able to find toilets at any time and anywhere; this is far from the case.

As early as 2008, some associations launched the Crohn disease campaign to raise public awareness and generate a list of establishments in Belgium offering free access to their toilets.

Une information massive, correcte et récurrente peut, à terme, briser les tabous qui entourent ces maladies et ainsi sortir les patients de l'isolement social. C'est pourquoi la présente proposition suggère d'instaurer le 22 octobre comme journée nationale.

Je porte, avec bon nombre de mes collègues, de manière symbolique le ruban mauve, qui est le signe choisi par les associations actives dans le domaine et qui permet de donner une visibilité à leur combat. Donc, mon groupe, bien entendu soutient la proposition qui est soumise. Je me réjouis aussi de constater au sein de notre assemblée une majorité pour soutenir ce combat et sensibiliser l'ensemble de notre population à ce phénomène social particulièrement difficile et handicapant.

Je suis assez sensibilisé aux maladies chroniques en règle générale. Comme je l'ai signalé en commission, je souscris pleinement à l'objectif poursuivi par Mme Snoy. Il s'agit en effet d'éviter une augmentation non fondée de la prime d'assurance pour le solde restant dû. Mais je souhaiterais aussi que cette préoccupation soit étendue à tous les malades chroniques. J'avais rappelé qu'une loi avait été votée le 21 janvier 2010. Elle modifie la loi du 25 juin 1992 sur le contrat d'assurance terrestre et atteint l'objectif poursuivi par Mme Snoy. Je sais qu'elle a été partiellement bloquée. C'est pourquoi je demande que ce texte, qui a fait l'objet d'une très longue réflexion en commission de l'Économie et qui vise à juste titre tous les patients chroniques, soit appliqué le plus rapidement possible.

Quoi qu'il en soit, évidemment, je soutiens sans réserve la proposition de résolution au bénéfice des patients atteints de cette maladie extrêmement invalidante.

I am quite sensitive to chronic diseases in general. As I pointed out in the committee, I fully support the objective pursued by Ms. Snoy. This is to avoid an unjustified increase in the insurance premium for the remaining balance due. But I would also like this concern to be extended to all chronic patients. I had recalled that a law had been passed on 21 January 2010. It amends the Law of 25 June 1992 on the Land Insurance Contract and achieves the objective pursued by Ms. Snoy. It was partially blocked. That is why I ask that this text, which has been the subject of a very long reflection in the Committee of Economy and which rightly targets all chronic patients, be applied as soon as possible.

In any case, of course, I firmly support the resolution proposal for the benefit of patients suffering from this extremely disabled disease.

                    Mijnheer de voorzitter, collega’s, mijn partij zal zich onthouden voor deze resolutie. Wij doen dit zeker niet omdat wij geen respect zouden hebben voor de patiënten, die trouwens in de zaal aanwezig zijn, maar wij vinden wat vandaag voorligt een gemiste kans is. Voor ons gaat het immers verder dan het uitroepen van een nationale dag.

Wanneer ik de aanvullende punten en de amendementen bij de resolutie bekijk, gaat het over pasjes en over horecagebruik. Het gaat ook over verzekeraars. Dat zijn misschien wel punten die belangrijk zijn, maar ik meen dat collega Seminara de juiste toon gezet heeft voor dit debat. Hij zei in de commissie dat de kosten per patiënt kunnen oplopen tot 3 000 euro per maand. Daar biedt deze resolutie geen antwoord op.

Er zijn nochtans antwoorden. Ik denk bijvoorbeeld aan de initiatieven van mijn partij ter zake: een uitbreiding van de sociale derdebetalersregeling, de integratie van het OMNIO-statuut in de verhoogde tegemoetkoming, het verlagen van bepaalde minimumdrempels voor de maximumfactuur, en ik kan zo nog een tijd doorgaan.

Dat zijn maatregelen die deze patiënten helpen. Mijn partij neemt die patiënten ernstig. Mijn partij helpt die mensen met de maatregelen die wij door het Parlement goedgekeurd willen zien. Ik hoop dan ook dat de collega’s onze initiatieven met evenveel enthousiasme zullen steunen.

Mijnheer de voorzitter, de collega’s vragen een overleg te starten met de Gemeenschappen. Ook daarvoor is deze resolutie niet nodig. De indienende partijen maken allemaal deel uit van de meerderheid in de regionale parlementen. Doe het dan niet via een resolutie in het federale Parlement, spreek erover met uw mensen in de regionale regeringen. Wij doen dat.

Mr. Speaker, the colleagues ask for a consultation with the Communities. This resolution is also not needed. All the submitting parties form part of the majority in the regional parliaments. Then do not do it through a resolution in the federal parliament, talk about it with your people in the regional governments. We do that.

Collega’s, met het voorliggende wetsontwerp komt de staatssecretaris tegemoet aan een nood, maar ik wens toch een kanttekening te maken. De manier waarop de staatssecretaris, in al zijn wijsheid, de structuur heeft uitgetekend – ik heb het specifiek over de indeling en de organisatie – zal bij de uitvoering van het wetsontwerp ook gevolgen hebben voor de communautaire verdeling. De term zegt het zelf: de communautaire binnenvaartvloot.

Vlaanderen is verantwoordelijk voor niet minder dan 80 % van het volume dat anno 2011 in België wordt gegenereerd. Vlaanderen heeft bovendien een zeer belangrijke rol te spelen in de productiviteit van de Brusselse haven.

Wij hebben daarstraks de problematiek van de NMBS aanhoord. Een van de maatregelen om het wegennet in ons land te ontlasten, is de promotie van de binnenvaart. De klemtoon die daarop wordt gelegd, is zeer terecht. Wanneer het gaat over beslissingsmacht, dan stel ik alleen vast dat Vlaanderen, dat toch in een zeer grote mate verantwoordelijk is voor de omzet op het vlak van de binnenvaart, onvoldoende inspraak heeft.

Collega’s, ik heb – dat vindt u ook terug in het verslag van de heer Wollants - in de commissie met zoveel woorden gezegd dat de staatssecretaris in het verleden blijk gaf van een meer activistische houding. Dat is natuurlijk een beetje een beladen term, zeker in communautaire overeenkomsten. Destijds heeft de staatssecretaris inderdaad steeds volgehouden dat wit wit is en zwart zwart, wat het Gewest ook zei en dat hij ging voor een overeenkomst volgens zijn visie. Dat heb ik niet meer teruggevonden in zijn motivatie. Meer nog, nu zegt hij dat men met dat plan naar hem gekomen is en dat was het. Dus wie vraagt, krijgt.

Het is ook mijn rol om hier de Vlaamse belangen te verdedigen. Ik verwijs naar de voorgestelde verhouding. Vlaanderen krijgt onvoldoende bestuursmandaten.

At that time, indeed, the Secretary of State has always insisted that white is white and black is black, whatever the Region said and that he went for an agreement according to his vision. I did not find it again in his motivation. Moreover, now he says that one came to him with that plan and that was it. So who asks, gets.

It is also my role to defend the Flemish interests here. I refer to the proposed relationship. Flanders have insufficient administrative mandates.

                    Mijnheer de voorzitter, mijnheer de staatssecretaris, collega’s, ik ga de hele discussie die we over dit wetsontwerp in de commissie hebben gevoerd niet overdoen, maar ik wil graag toelichten waarom N-VA dit wetsontwerp bij de stemming niet zal goedkeuren maar zal tegenstemmen.

Het wetsontwerp leest zoals het hoort. Een aantal zaken met betrekking tot de spoorwegveiligheid wordt geregeld. Er blijken echter toch een aantal addertjes onder het gras te zitten of het doet bij ons minstens de vraag rijzen of dit de beste manier is om dit te regelen.

Wij hebben twee specifieke opmerkingen.

Een eerste opmerking gaat over de oprichting van het begrotingsfonds. De staatssecretaris heeft volgens ons in de commissie geen afdoende antwoord kunnen geven op de vraag waarom specifiek voor een begrotingsfonds wordt gekozen. Volgens ons zijn de bedragen voor een dergelijke begrotingsfonds met betrekking tot de materie te klein.

De vraag was ook wat de inkomsten zullen zijn. Dat is ongeveer juist, maar wij hebben nog geen zicht op wat de uitgaven zullen zijn. Wij zijn dus bezig een fonds op te richten waarvan wij vandaag nog niet weten wat wij gaan doen en dus ook nog niet weten wat wij gaan uitgeven.

In die zin is het een moeilijke beslissing om dat geld in een begrotingsfonds te steken, want daarmee onttrekken wij dat eigenlijk ook aan de normale regels van de begroting.

Wij hebben ook grote bedenkingen bij het feit dat dit begrotingsfonds een onafhankelijk orgaan had moeten zijn. Hierdoor maken wij het alvast financieel afhankelijk van de FOD, terwijl wij er in eerdere wetsontwerpen ter zake voor hadden gekozen om dit onafhankelijk van de FOD te maken.

Daarom zijn wij ervan overtuigd dat er betere, transparantere en zuinigere manieren zijn om dit probleem op te lossen. Vandaar ook onze tegenstem.

Over mijn tweede bedenking met betrekking tot dit wetsontwerp zult u zich afvragen waar ik dat in godsnaam vandaan haal.

Ik zal u even het artikel voorlezen. Het klinkt onschuldig. In artikel 355, tweede lid van de wet van 20 juli 2006 houdende diverse bepalingen, ingevoerd bij wet van 23 december 2009, wordt het getal 200 door het getal 290 vervangen.

Mr. Speaker, Mr. Secretary of State, colleagues, I will not exaggerate the whole discussion we have held on this bill in the committee, but I would like to explain why N-VA will not approve this bill at the vote but will vote against.

The draft law reads as it should. Several issues related to railway safety are regulated. However, there still appear to be a number of adhesives under the grass or it makes us at least raise the question whether this is the best way to manage this.

We have two specific comments.

The first point concerns the creation of the budget fund. In our opinion, the State Secretary has not been able to give an adequate answer in the committee to the question of why a budget fund is selected specifically. In our opinion, the amounts for such a budget fund in relation to the matter are too small.

The question is also what the revenue will be. That is pretty much correct, but we do not yet have a vision of what the expenses will be. So we are setting up a fund in which we still don’t know what we’re going to do and therefore we don’t know what we’re going to spend.

In that sense, it is a difficult decision to put that money into a budget fund, because in doing so we actually withdraw that from the normal rules of the budget.

We also have great concerns about the fact that this budget fund should have been an independent body. As a result, we make it financially dependent on the FOD, while we had chosen to make it independent of the FOD in previous draft laws on the subject.

Therefore, we are convinced that there are better, more transparent and more cost-effective ways to solve this problem. Hence our opposition.

On my second consideration concerning this bill, you will wonder where I get that from.

I will read the article for you. It sounds innocent. In Article 355, paragraph 2, of the Act of 20 July 2006 on various provisions, introduced by law of 23 December 2009, the number 200 is replaced by the number 290.

Herinner u daarstraks onze discussie over de financiële toestand van de NMBS en de moeilijkheden die een poot binnen de groep alvast heeft om een beetje bij budget te geraken. Vroeger was al bepaald dat zij 200 miljoen buiten balans mochten toevoegen om budgettaire redenen. Er is effectief een investeringsdotatievermindering geweest en daartegenover stond destijds een toevoeging van een exploitatiedotatie van 10 miljoen gedurende 20 jaar. Vandaag wordt bepaald dat hier nog eens 90 miljoen bovenop wordt gedaan.

Ik heb de staatssecretaris in de commissie de volgende vraag gesteld: “Mijnheer de staatssecretaris, wat denkt u dat het gevolg zou zijn, mocht ik in mijn bedrijf een dergelijke operatie doorvoeren?” Mijnheer Schouppe, u herinnert zich waarschijnlijk wel uw antwoord. U heeft mij geantwoord: “U zou serieuze problemen hebben, mijnheer Vandeput.”

Ik zeg vandaag dat wij niet meewerken aan een operatie waarmee een normale mens serieuze problemen zou krijgen. Wij zullen dit wetsontwerp niet steunen. Wij stemmen tegen.

Je souhaiterais simplement insister sur celle qui concerne le financement de l'organe de régulation du secteur ferroviaire, l'autorité de contrôle. Les dispositions en projet prévoient qu'on demande à Infrabel et aux entreprises ferroviaires d'apporter leur contribution au financement de cette autorité de contrôle. Je voulais souligner qu'il y a là une anomalie à ne pas solliciter également le holding qui, vous le savez, gère les plus grandes gares de ce pays et perçoit à ce titre des redevances d'accès. Dans le fonctionnement et dans le financement de cette autorité de contrôle, il aurait donc été logique de le solliciter pour une meilleure solidarité dans la répartition des coûts, même si, je vous l'accorde, il ne s'agit pas ici de sommes extraordinaires.

Pour cette raison, et pour d'autres, nous nous abstiendrons.

Néanmoins, contrairement à mon collègue Vandeput, je me réjouis du fait que des dispositions ont été prévues pour qu'Infrabel puisse utiliser ses bénéfices pour maintenir son niveau d'investissement, malgré la baisse programmée des dotations d'investissement dans le contrat de gestion d'Infrabel pour 2011. Étant donné la situation actuelle, cela me semble être un élément tout à fait positif.

J'ajoute que cela ne nous exonère pas d'une réflexion plus large sur la structuration du groupe et sur la solidarité financière entre les entités. Cela nous ramène au débat de tout à l'heure concernant les mesures d'économies prises à la SNCB ces dernières heures.

I would just like to emphasize the one concerning the financing of the rail sector regulatory body, the supervisory authority. The provisions in the draft stipulate that Infrabel and railway undertakings are required to contribute to the financing of this supervisory authority. I wanted to emphasize that there is an anomaly to not also request the holding company which, you know, manages the largest stations in this country and receives access fees as such. In the operation and in the financing of this supervisory authority, it would therefore have been logical to request it for better solidarity in the distribution of costs, even though, I assure you, it is not a matter of extraordinary amounts.

For this reason, and for others, we will abstain.

Nevertheless, unlike my colleague Vandeput, I am pleased that arrangements have been made for Infrabel to use its profits to maintain its investment level, despite the planned reduction of investment appropriations in Infrabel’s management contract for 2011. Given the current situation, this seems to me to be a quite positive element.

I add that this does not exempt us from a broader reflection on the structure of the group and on financial solidarity between entities. This brings us back to the recent debate about the savings measures taken at the SNCB in recent hours.

Er is een mentaliteit van vertrouwen dat alles goed gaat en dat wat goed gaat bevestigd moet worden. Helaas, wanneer wij het hebben over de structuren van de NMBS – het gaat hier meer over Infrabel – moeten wij echter de nodige scepsis aan de dag leggen. U hebt uw antwoord al deels gegeven in de commissie. Misschien kunt u deze maatregelen vandaag met iets meer overtuiging motiveren. Als ik mij enkel moet baseren op de uitleg die ik in de commissie heb gekregen – ik heb mij intussen wat meer geïnformeerd over de motieven en over de mogelijke proporties die zoiets kan aannemen – meen ik dat ik wat gas zal moeten terugnemen met betrekking tot de positieve evaluatie die ik in de commissie heb gemaakt. Na de woorden die we daarstraks gehoord hebben, na het antwoord dat mevrouw Vervotte gegeven heeft op de vragen die gesteld werden over de maatregelen die bij de NMBS in het vooruitzicht worden gesteld en de bezorgdheid die het Parlement formuleert ten aanzien van de spoormaatschappij, kunnen we ons alleen verheugen dat de maatschappij, om de investeringen van de spoorwegen op peil te houden gedurende 2011, bereid is om 90 miljoen euro winst van voorafgaande jaren te gebruiken voor het investeringsfonds. We kunnen ons enkel gelukkig prijzen dat een dergelijke zaak in overweging wordt genomen.

De verhoging van het bedrag van 200 tot 290 miljoen euro door het omzetten van vroegere winsten in kapitaalsubsidies kan alleen bijdragen tot een verbetering van de kwaliteit van de spoorweginfrastructuur. We moeten dat eerder als een positieve aangelegenheid omschrijven dan als een aangelegenheid die aanleiding moet geven tot negatieve bemerkingen ten aanzien van de spoormaatschappij.

Het is evident dat wanneer die structuur er anders uit gaat zien, de dotatiestromen daaraan zullen moeten worden aangepast. Vandaag zijn 80 % van de kosten van de NMBS eigenlijk intra-Groep-kosten, hetzij voor Infrabel hetzij voor de Holding. Uiteraard zal in de nieuwe tekening moeten gekeken worden naar de historische schuld, welke kosten ten opzichte van de exploitatie waarheen verdeeld zullen worden en de investeringskosten.

Het is een belangrijk signaal dat de investeringen op peil moeten blijven. Dat zijn de zaken die vaak het minst zichtbaar zijn en soms is het aantrekkelijk om daaraan te raken. Ik ben blij dat we dit nu niet doen. Ik deel wat dat betreft 100 % uw visie. Indien we naar een andere structuur evolueren, zullen ook de dotatiestromen of wie wat krijgt, moeten herbekeken worden. Zo kunnen de accenten gelegd worden op inkomsten en uitgaven met betrekking tot de dienstverlening en naar wie dat gaat. Een groot deel van de kosten van de NMBS vandaag heeft uiteraard te maken met infrastructuur, waardoor Infrabel meer geld heeft. Dat biedt het voordeel dat we inderdaad investeringen kunnen doen, maar het is juist dat dit opnieuw zal moeten worden bekeken.

It is obvious that when that structure will look different, the donation flows will need to be adjusted to that.
