                    Monsieur le président, mes chers collègues, monsieur le premier ministre, il s'agit d'une proposition importante. En effet, elle se rapporte à un problème concret et sensible qui est l'aide que la collectivité, la société, les pouvoirs publics et l'ensemble du secteur de la santé peuvent apporter aux personnes, dont des enfants, qui souffrent de pathologies de nature psychiatrique ou comportementale. Il me semble donc que nous devions soutenir cette résolution dont l'initiative revient à Marie-Claire Lambert.

Cette initiative nous apparaît effectivement heureuse: elle tend à demander la mobilisation du pouvoir exécutif à l'égard d'un sujet touchant directement l'existence de certains de nos plus jeunes citoyens.

Cette proposition de résolution exigera sans nul doute une concertation avec les entités fédérées, et c'est en cela que l'exécution rapide de la résolution est quelque peu compromise. De fait, ce problème est multiple: il concerne la scolarité, la gestion des centres de santé mentale, la programmation des services K dans les hôpitaux, l'aide à la jeunesse, et j'en passe, c'est-à-dire des domaines dépendant d'instances différentes. Il importe de se baser sur une sincère concertation pour résoudre ce problème qui touche les enfants et les adolescents en souffrance et pour aider les professionnels du terrain qui les prennent en charge.

La proposition de résolution se penche sur la programmation, c'est-à-dire sur l'actualisation des critères de programmation des lits K, indispensable pour répondre au mieux et objectivement aux besoins de la population. Nous savons que la programmation des besoins en matière de santé est en permanente évolution. En pédopsychiatrie plus qu'ailleurs, l'actualisation des critères s'avère importante; je pense à la disponibilité des lits K, mais aussi à leur réelle affectation.

Mr. Speaker, Mr. Prime Minister, this is an important proposal. In fact, it refers to a concrete and sensitive problem that is the help that the community, society, public authorities and the whole health sector can provide to people, including children, who suffer from psychiatric or behavioral pathologies. Therefore, it seems to me that we should support this resolution, which is initiated by Marie-Claire Lambert.

This initiative seems to us indeed happy: it tends to call for the mobilization of the executive power with regard to a subject directly affecting the existence of some of our youngest citizens.

This resolution proposal will undoubtedly require consultation with the federated entities, and this is where the quick execution of the resolution is somewhat compromised. In fact, this problem is multiple: it concerns schooling, the management of mental health centers, the programming of K services in hospitals, youth assistance, and I pass, that is, areas that depend on different instances. It is important to rely on sincere consultation to solve this problem that affects suffering children and adolescents and to help the field professionals who take care of them.

The proposal for a resolution looks at programming, i.e. the updating of the programming criteria for K beds, indispensable to best and objectively meet the needs of the population. We know that the programming of health needs is constantly evolving. In pediatric psychiatry more than elsewhere, the updating of criteria is important; I think of the availability of K beds, but also of their actual allocation.

                    En effet, on constate que, bien souvent, des lits qui devraient être réservés à la pédopsychiatrie sont occupés par des adultes souffrant parfois d'autres pathologies. Des jeunes atterrissent parfois en psychiatrie adulte ou même dans des lits hospitaliers qui n'ont rien à voir avec la psychiatrie. Il existe donc une carence profonde dans la réponse à apporter à la demande de prise en charge et aux droits des enfants et des adolescents qui sont, de facto, limités - faute d'accueil adéquat. L'allongement des listes d'attente conduit à des prises en charge qui ne sont pas adaptées. L'urgence est donc grande.

Nous sommes également préoccupés par le manque de pédopsychiatres, imputable sans doute au manque de lieux de stage, mais aussi au caractère insuffisamment attrayant de l'activité. Vous savez que plusieurs professions médicales pâtissent des conditions d'exercice de la profession. Au-delà des quotas et des questions de numerus clausus se pose réellement le problème de l'adéquation entre l'offre et la demande dans plusieurs secteurs de la santé.

Pour optimiser la prise en charge pédopsychiatrique, nous devons aussi miser sur la mise en place de synergies hospitalières, qui existent déjà – notamment à Liège, madame Lambert -, mais il faut certainement encore améliorer la situation. Dans la province dont je suis issu, huit implantations hospitalières ont présenté un plan d'action en ce domaine. Ces infrastructures fédèrent leurs forces pour améliorer l'offre de soins psychiatriques à destination des enfants et des adolescents. Le but est de fournir un meilleur accueil, d'orienter les patients souffrant de maltraitances, de deuils familiaux, de tendances suicidaires, de troubles alimentaires, de phobies scolaires, etc. De nombreuses pathologies comportementales doivent être prises en compte. Il s'agit aussi, à terme, d'augmenter le nombre de lits K.

Enfin, le suivi post-hospitalier est extrêmement important. Il est important que des enfants continuent d'être suivis après une éventuelle hospitalisation, tant par le psychiatre que par l'ensemble de l'équipe. En termes de continuité des soins, il peut également être intéressant d'organiser une alternance entre les soins à domicile et l'hospitalisation. Nous devons y être attentifs.

Indeed, it is found that, very often, beds that should be reserved for pediatric psychiatry are occupied by adults sometimes suffering from other pathologies. Young people sometimes land in adult psychiatry or even in hospital beds that have nothing to do with psychiatry. There is therefore a profound deficiency in the response to the request for care and the rights of children and adolescents that are, de facto, limited – lack of adequate care. The lengthening of waiting lists leads to unsupported take-offs. The urgency is great.

We are also concerned about the lack of pediatric psychiatrists, probably due to the lack of places for internships, but also to the insufficient attractiveness of the activity. You know that many medical professions suffer from conditions for exercising the profession. Beyond the quotas and the numerus clausus questions, there really arises the problem of the adequacy between supply and demand in several health sectors.

In order to optimize pediatric psychiatric care, we must also focus on the establishment of hospital synergies, which already exist – especially in Liège, Mrs. Lambert – but the situation must ⁇  be improved. In the province I came from, eight hospital settlements have presented an action plan in this area. These infrastructures joined forces to improve the supply of psychiatric care for children and adolescents. The aim is to provide better reception, guide patients suffering from abuse, family mourning, suicidal tendencies, eating disorders, school phobias, etc. Many behavioral pathologies need to be taken into account. In the future, the number of K beds will also be increased.

After all, post-hospital follow-up is extremely important. It is important that children continue to be monitored after a possible hospitalization, both by the psychiatrist and by the entire team. In terms of continuity of care, it can also be interesting to organize an alternation between home care and hospitalization. We must be attentive to this.

                    Mijnheer de voorzitter, het voorstel van resolutie met betrekking tot de verbetering van de patiëntenzorg in de kinderpsychiatrie haalt een probleem aan dat de commissie voor de Volksgezondheid zowat elke legislatuur bekommert. Een coherente verdeling van de ziekenhuiszorg is zeker relevant. Ik zou ook durven pleiten voor een goede geografische spreiding, want bereikbaarheid inzake zorg voor kinderen is een belangrijk gegeven.

Met deze resolutie focussen wij ons op ziekenhuiszorg, maar ik denk dat wij ook aandacht moeten besteden aan een permanente opvolging en een goede begeleiding van de kinderen na hun ontslag. Die zorg op maat, die begeleiding en opvolging kan immers in belangrijke mate de instroom in de kinderpsychiatrie in ziekenhuizen doen afnemen. Ter zake verwijs ik graag naar de verklaringen van prof. Deboutte tijdens de vorige legislatuur. Verwijzend naar de projecten in het kader van artikel 107 van de ziekenhuiswet moet dit zeker een aandachtspunt worden en kunnen wij ook gaan kijken naar de impact op ziekenhuisopnames.

Terecht hebben enkele collega’s bij de besprekingen gewezen op de noodzaak van een goede samenwerking van de verschillende diensten over de grenzen heen van de diverse overheden. Het belang daarvan kan nauwelijks overschat worden. Ik denk dat de ervaringen die wij met die projecten opdoen ook een rol zullen moeten spelen bij eventuele aanpassingen van programmerings- en erkenningsnormen.

Ten slotte onderschrijf ik zeker de noodzaak naar wetenschappelijk onderzoek inzake de kinder- en jongerenpsychiatrie. Wat betreft de aantrekkelijkheid van het beroep van kinderpsychiater sluit ik mij dan ook graag aan bij het jarenlange pleidooi van mijn collega Maggie De Block. Om werk te maken van een herijking van de nomenclatuur waarbij prioriteit wordt verleend aan de herwaardering van de intellectuele akte. Die oproep zal trouwens niet alleen de kinderpsychiaters ten goede komen, maar alle specialisten die weinig technische prestaties hebben.

Mr. Speaker, the proposal for a resolution on improving patient care in pediatric psychiatry raises a problem that the Public Health Committee concerns almost every legislature. A coherent distribution of hospital care is ⁇  relevant. I would also dare to advocate for a good geographical distribution, because accessibility in childcare is an important fact.

With this resolution, we focus on hospital care, but I think we should also pay attention to permanent follow-up and good guidance of children after their dismissal. After all, this personalized care, that guidance and follow-up can significantly reduce the influx of child psychiatry in hospitals. I would like to refer to the statements of prof. Destroyed during the previous legislature. Referring to the projects within the framework of article 107 of the Hospital Law, this must ⁇  become a point of attention and we can also look at the impact on hospital admission.

In the discussions, several colleagues have rightly pointed out the need for good cooperation between the various services across the borders of the various governments. Its importance can hardly be overestimated. I think that the experience we gain with those projects will also have to play a role in any adjustments to programming and recognition standards.

Finally, I ⁇  support the need for scientific research on child and youth psychiatry. As for the attractiveness of the profession of child psychiatrist, I would therefore like to agree with the years-long plea of my colleague Maggie De Block. To work on a re-alignment of the nomenclature giving priority to the revaluation of the intellectual act. That call, by the way, will benefit not only the child psychiatrists, but all specialists who have little technical performance.

                    Monsieur le président, monsieur le premier ministre, chers collègues, en février dernier, j'ai déposé, avec d'autres collègues, la proposition de résolution qui vous est soumise aujourd'hui et qui a pour objet non seulement de relayer les préoccupations du terrain que je connais particulièrement bien mais aussi de répondre aux carences constatées dans le domaine de la prise en charge psychiatrique à l'hôpital des petits et jeunes patients.

La pédopsychiatrie, cette spécialité est un domaine des soins de santé encore malheureusement très confidentiel. Les jeunes concernés et leur entourage peinent à admettre, à reconnaître ces pathologies mentales qui, pour certaines, peuvent être lourdes, déroutantes, découlant parfois d'un handicap, d'une dépendance ou encore d'une délinquance.

C'est vrai, la maladie mentale d'un enfant ou d'un ado n'est évidente pour personne. Ce tabou explique peut-être les lacunes constatées dans la prise en charge de ces jeunes patients. Trop souvent encore, ceux-ci ne bénéficient pas de soins adéquats, par manque de lits K, comme cela a déjà été évoqué, faute de pédopsychiatres, faute encore de services pédiatriques adéquatement adaptés en soins psychologiques et en soins psychosociaux. Ces carences sont difficilement acceptables car elles peuvent handicaper parfois gravement l'avenir de ces jeunes enfants. Il est donc urgent de considérer avec réalisme et pragmatisme l'ampleur de ce problème, d'autant que la demande en la matière ne cesse de croître. À en croire diverses instances scientifiques, cette tendance ne faiblira pas.

Aujourd'hui, selon la quatrième enquête santé effectuée dans notre pays, près d'un jeune sur trois âgé entre 15 et 24 ans est en détresse psychologique. Toute détresse en la matière ne nécessite évidemment pas une prise en charge résidentielle. Cette prise en charge peut se faire au niveau de l'outreaching, de l'hospitalisation, des services d'urgence ou encore des consultations privées chez un pédopsychiatre. Le gouvernement sortant a mis l'accent, à juste titre, sur la prévention et la détection des problèmes psychiques ainsi que sur la qualité et la disponibilité de la prise en charge à domicile qui doit être privilégiée, surtout lorsqu'il s'agit d'un enfant.

Mr. Speaker, Mr. Prime Minister, dear colleagues, in February last year, I, together with other colleagues, submitted the proposal for a resolution which is submitted to you today and which is intended not only to relay the concerns of the field which I know ⁇  well but also to address the deficiencies found in the field of psychiatric care in the hospital of small and young patients.

Pedopsychiatry, this specialty is a health care area still unfortunately very confidential. The young people concerned and their surroundings struggle to admit, to recognize these mental pathologies that, for some, can be heavy, confusing, sometimes resulting from a disability, dependence or even a crime.

True, the mental illness of a child or adolescent is not obvious to anyone. This taboo may explain the gaps found in the care of these young patients. Too often yet, they do not receive adequate care, due to the lack of K beds, as has already been mentioned, due to the lack of pediatric psychiatrists, yet due to the lack of adequately adapted pediatric services in psychological care and psychosocial care. These deficiencies are hardly acceptable because they can sometimes seriously impair the future of these young children. It is therefore urgent to consider with realism and pragmatism the extent of this problem, especially since the demand for the matter continues to grow. According to various scientific instances, this trend will not diminish.

Today, according to the fourth health survey conducted in our country, ⁇  one in three young people between the ages of 15 and 24 are in psychological distress. Of course, any problem in this area does not require residential care. This care can be done at the level of outreaching, hospitalization, emergency services or even private consultations with a pediatric psychiatrist. The outgoing government has rightly emphasized the prevention and detection of mental problems as well as the quality and availability of home care that should be prioritized, especially when it comes to a child.

                    Il n'en demeure pas moins que l'offre hospitalière en pédopsychiatrie ne répond pas aux besoins des patients. Les professionnels du secteur souhaiteraient pouvoir y remédier. Un seul exemple: la province de Liège compte seulement 20 lits K pour les quelque 23 000 enfants et adolescents qui y vivent.

Avec ce texte, nous demandons au gouvernement d'évaluer la fragmentation et la répartition des soins hospitaliers en pédopsychiatrie afin que l'offre en la matière coïncide aux besoins de la population infanto-juvénile. Nous demandons également de faire évoluer cette offre et de la rendre beaucoup plus flexible. Mon intention est donc de garantir à chaque enfant et à chaque adolescent une prise en charge psychiatrique variée, adaptée à sa situation et à son état de santé, et surtout une prise en charge de qualité.

Je me réjouis que cette proposition de résolution ait été accueillie favorablement par l'ensemble de mes collègues de la commission Santé publique. Je les en remercie vivement.

                    Collega’s, het voorstel van resolutie dat vandaag voorligt, betekent een stap vooruit voor de zorg van kinderen die psychiatrische hulp nodig hebben. België kampt reeds lang met een tekort aan kinderpsychiaters. Verscheidene kinderpsychiaters luidden de noodklok. Volgens hen zijn er in ons land zo’n 300 psychiaters te kort. Het gevolg is dat er een enorm capaciteitsgebrek is, waardoor kinderen niet of te laat bij de psychiater terechtkunnen.

Een van de oorzaken van de schaarste aan kinderpsychiaters is dat er te weinig opgeleid worden. Met gemiddeld 12 per jaar redden wij het echt niet, zeker niet als een deel in Nederland aan de slag gaat. Naar schatting werken er in Nederland 25 tot 30 Belgische kinderpsychiaters. Volgens hen is het werk er gelijkaardig, maar men zou in Nederland niet alleen meer verdienen, maar ook – dit is belangrijker – zijn de multidisciplinaire teams er groter. In zo’n team werken zorgt ervoor dat men sterker staat om de nodige schifting te doen in de aanmeldingen voor crisisopvang. De doorverwijzingen voor opname kunnen daardoor worden beperkt.

Ondanks de inhaalbeweging die België de voorbije jaren deed, kan het zorgaanbod in de kinderpsychiatrie nauwelijks aan de vraag voldoen. Kinderpsychiaters maken in België daardoor dikwijls al te lange dagen. Door de onderbemanning werken zij ook onder enorm zware druk. In de hospitalen moeten zij, in tegenstelling tot in Nederland, zelf een groot deel van de schiftingen doen. Door de minimale administratieve ondersteuning leggen zij soms zelf het eerste telefonische contact.

Ondanks eerdere beleidskeuzes met de bedoeling onder andere het aantal ziekenhuisopnamen te verminderen – ik denk aan de effening van het pad voor zorgnetwerken – blijven er door de genoemde problemen lange wachtlijsten bestaan voor consulten.

Ik geef een aantal voorbeelden, die aantonen hoe schrijnend de situatie is. Voor een behandelopname kan de wachttijd oplopen tot meer dan 6 maanden. Urgente gevallen kunnen soms pas na 2 of 3 weken gezien worden. Crisisinterventie-units vangen wel veel op, maar die werken enkel kortdurend. Veel patiënten krijgen daardoor geen adequate vervolgzorg aangeboden.

Colleagues, the resolution proposal presented today represents a step forward in the care of children in need of psychiatric assistance. Belgium has long struggled with a shortage of child psychiatrists. Several child psychiatrists sounded the emergency bell. According to them, there are about 300 psychiatrists in our country. As a result, there is an enormous capacity shortage, which makes children unable or too late to go to the psychiatrist.

One of the reasons for the shortage of child psychiatrists is the lack of education. With an average of 12 per year, we really do not save it, ⁇  not if a part in the Netherlands is working. Working in such a team ensures that one is stronger in order to do the necessary shipment in the notifications for crisis response. The references for recording can therefore be restricted.

Despite the recruitment movement that Belgium has made in recent years, the supply of care in child psychiatry can hardly meet the demand. Children’s psychiatrists in Belgium therefore often have too long days. Because of the undercrew, they also work under extremely heavy pressure. In the hospitals, unlike in the Netherlands, they have to do a large part of the shipments themselves. Due to the minimal administrative support, they sometimes make the first telephone contact themselves.

Despite previous policy choices aimed, among other things, at reducing the number of hospitalizations – I think of easing the path for health networks – there are still long waiting lists for consultations due to these problems.

I will give a few examples, which demonstrate how terrible the situation is. For a treatment reception, the waiting time can be up to more than 6 months. Urgent cases can sometimes be seen only after 2 or 3 weeks. Crisis intervention units capture a lot, but they only work for a short period. Many patients do not receive adequate follow-up care.

                    Een gevolg van de wachtlijsten is dat sommige kinderen in België gedurende hun hele ziekteverloop geen psychiater zien of die bij een arts komen wanneer het al veel te laat is. De kinderen moeten soms echt al in een crisis zijn, vooraleer er ergens een plaatsje op de agenda kan worden vrijgemaakt. Belangrijk om te benadrukken, is dat het hier echt niet alleen gaat over kinderen met slaapstoornissen of opvoedingsproblemen. Eveneens belangrijk te vermelden, is dat kinderen met psychiatrische problemen die wel bij een arts geraken, door een gebrek aan K-bedden nog te vaak in bedden belanden van het type A, voor acuut volwassen psychiatrie. Ik hoop voor de meesten onder ons dat dat niet hun eigen kind overkomt, want ik kan mij inbeelden dat het als kind niet gemakkelijk is om bij volwassenen terecht te komen, laat staan voor hen die geestelijke gezondheidszorg nodig hebben.

Gezien het belang van een goede geestelijke gezondheidszorg is het capaciteitsgebrek eigenlijk een blaam voor ons Belgisch gezondheidszorgsysteem. Het is daarom belangrijk dat er een verandering komt in de perceptie over de psychiatrie in het algemeen en de kinderpsychiatrie in het bijzonder. Door het voorstel van resolutie vandaag goed te keuren, tonen wij dat de politieke wereld het taboe durft te doorbreken dat nog al te dikwijls rond die aandoeningen heerst. Langzaamaan ontstaat hierdoor ook een politieke visie op de kinderpsychiatrie.

De resolutie moet de voorzet betekenen voor de ontwikkeling van een goed beleidsplan op langere termijn. Door te durven te investeren in die jonge patiënten kan men de ouders en zeker het kind veel leed besparen.

A consequence of the waiting lists is that some children in Belgium do not see a psychiatrist during their entire course of illness or come to a doctor when it is already too late. Sometimes children really need to be in a crisis before somewhere on the agenda can be released. It is important to emphasize that this is really not just about children with sleep disorders or educational problems. It is also important to mention that children with psychiatric problems who reach a doctor, due to a lack of K-beds, too often end up in beds of type A, for acute adult psychiatry. I hope for most of us that this will not happen to their own child, because I can imagine that as a child it is not easy to reach out to adults, let alone for those who need mental health care.

Given the importance of good mental health care, the lack of capacity is actually a blame for our Belgian healthcare system. It is therefore important that there is a change in perception about psychiatry in general and child psychiatry in particular. By today approving the draft resolution, we demonstrate that the political world dares to break the taboo that too often prevails around these disorders. This gradually creates a political view of child psychiatry as well.

The resolution should be the precursor to the development of a good long-term policy plan. By daring to invest in those young patients, one can save the parents and ⁇  the child a lot of suffering.

                    Mijnheer de voorzitter, de N-VA was zeer verheugd over het initiatief om de kinderpsychiatrie op de agenda van dit Parlement te zetten. Ik sluit mij dan ook grotendeels aan bij wat de vorige sprekers reeds zegden, maar toch hebben wij een andere invalshoek dan de meeste anderen.

De huidige maatschappelijke context speelt hierbij een belangrijke rol. Er zijn heel veel nieuwsamengestelde gezinnen en er leven alsmaar meer gezinnen in de armoede en dus ook kinderen in de armoede.

Die nieuwe maatschappelijke situatie gaat gepaard met instabielere situaties en dat ziet men ook gereflecteerd in de steeds hogere nood aan kinderpsychiatrie. Belangrijk hierbij is ook dat men niet alleen kinderen helpt via acute of chronische kinderpsychiatrie, maar dat men hen helpt te functioneren binnen het kader waarin ze leven, namelijk de school en het gezin.

Daarbij is het belangrijk te vermelden dat het hier ook over bevoegdheden gaat die niet alleen de federale overheid betreffen, maar zeker ook de Gemeenschappen.

Het vroegtijdig opvangen van signalen en daarmee gepaard gaand het vroegtijdig ingrijpen is dan ook fundamenteel in de problematiek. Er kunnen hiervoor tal van organisaties worden ingeschakeld. Denk maar aan Kind en Gezin en de huisarts. Zij zijn ideaal geplaatst om de situatie van het gezin te kunnen inschatten.

De N-VA-fractie vond het ook belangrijk om een amendement toe te voegen waarin we vragen eindelijk werk te maken van de erkenning van de klinische psychologen. Kinderen en jongeren in de psychiatrie zijn beter af als het probleem multidisciplinair wordt aangepakt. De psychosociale zorg moet worden opgevoerd.

Dat amendement werd in de commissie unaniem goedgekeurd, waarvoor mijn dank aan alle collega’s in de commissie voor de Volksgezondheid. De toekomstige regering wordt met aandrang gevraagd om werk te maken van de erkenning van de klinische psychologen.

The current social context plays an important role in this. There are a lot of newly assembled families and there are more and more families living in poverty and therefore also children in poverty.

This new social situation is accompanied by more unstable situations and this is also reflected in the increasing need for child psychiatry. It is also important not only to help children through acute or chronic child psychiatry, but to help them function within the framework in which they live, namely school and family.

At the same time, it is important to mention that this also concerns powers that affect not only the federal government, but ⁇  also the Communities.

Early reception of signals and accompanying early intervention are therefore fundamental in the problemology. Many organizations can be involved. Think of the child and the family and the doctor. They are ideally placed to assess the situation of the family.

The N-VA group also found it important to add an amendment in which we ask to finally work on the recognition of clinical psychologists. Children and young people in psychiatry are better off if the problem is addressed multidisciplinary. Psychosocial care should be strengthened.

This amendment was unanimously approved in the committee, for which I thank all my colleagues in the committee for public health. The future government is urged to work on the recognition of clinical psychologists.

                    Mijnheer de voorzitter, collega’s, uiteraard is de patiëntenzorg in de kinderpsychiatrie dringend aan verbetering toe. Dat kan niemand ontkennen en niemand kan er bezwaar tegen hebben, zelfs niet op een moment dat er overal bespaard moet worden. Op federaal niveau lukt dat niet al te goed, maar men zal wel moeten. Ook in de gezondheidszorg zal men moeten besparen. Men mag hier dus zeker niet zijn bevoegdheden te buiten gaan.

Onze fractie is ervan overtuigd dat de verbetering van de patiëntenzorg in de kinderpsychiatrie enkel haalbaar is mits een betere coördinatie tussen alle actoren en diensten die met kinderpsychiatrie te maken hebben voor zowel de preventieve en de curatieve aspecten als de nazorg en de opvolging. Dat is enkel mogelijk door een doorgedreven homogenisering van de geestelijke gezondheidszorg op het niveau van de Gemeenschappen.

Wij staan met die idee trouwens niet alleen. Zelfs in het institutioneel akkoord voor een zesde staatshervorming voor een efficiëntere federale staat wordt de homogenisering van de preventieve gezondheidszorg respectievelijk geestelijke gezondheidszorg naar voren geschoven door een overheveling van de bevoegdheden naar de Gemeenschappen.

De Gemeenschappen hebben met specifieke problemen te kampen. Een van de grote problemen op het vlak van de geestelijke gezondheidszorg voor kinderen en jongeren, vooral in de grensstreek tussen Vlaanderen en Nederland, is het aanzienlijk gebrek aan kinderpsychiaters. De reden is eenvoudig. Een kinderpsychiater die een aantal kilometer verder naar het noorden, in Nederland, vaak in heel wat aangenamere omstandigheden dan in België gaat werken, wordt er met open armen ontvangen en kan heel wat meer verdienen. Daar kan vandaag op Vlaams niveau nog niet veel aan veranderd worden. Ook met de zesde staatshervorming, die nu wordt voorgesteld, zou men daar niet veel aan kunnen veranderen, want, geef toe, die staatshervorming is helemaal geen copernicaanse omwenteling, integendeel.

Our group is convinced that the improvement of patient care in pediatric psychiatry can only be achieved if better coordination between all actors and services involved in pediatric psychiatry for both the preventive and curative aspects as well as the follow-up and follow-up. This is only possible through a thorough homogenisation of mental health care at Community level.

We are not alone with this idea. Even in the institutional agreement for a sixth state reform for a more efficient federal state, the homogenisation of preventive health care and mental health care respectively is pushed forward by a transfer of powers to the Communities.

Communities face specific problems. One of the major problems in the field of mental health care for children and young people, especially in the border region between Flanders and the Netherlands, is the significant shortage of child psychiatrists. The reason is simple. A child psychiatrist who goes to work a few kilometers further north, in the Netherlands, often in much more pleasant conditions than in Belgium, is welcomed with open arms and can earn a lot more. Not much can be changed at the Flemish level today. Even with the sixth state reform, which is now being proposed, one could not change much on that, because, admit, that state reform is not a Copernican revolution at all, on the contrary.

                    Mijnheer de voorzitter, ik zal namens beide rapporteurs kort verslag uitbrengen. Dat hebben wij samen afgesproken. Het voorstel werd door mevrouw De Wit en mevrouw Smeyers van de N-VA-fractie geformuleerd en is mee ondertekend door de Open Vld-fractie. Voor het voorstel werd de urgentie gevraagd en verkregen.

Het voorstel wijzigt het Wetboek van strafvordering inzake de vervolging van bepaalde in het buitenland gepleegde misdrijven. Wij hebben er verschillende vergaderingen aan gewijd en wij hielden een uitgebreide hoorzitting met onder meer de federale procureur, de advocaten-generaal, vertegenwoordigers van het College van procureurs-generaal, een professor emeritus internationaal recht.

Wij hebben ook schriftelijk advies ingewonnen. Kortom, er is een ruime consultatie geweest, die uiteindelijk heeft geleid tot een aantal amendementen.

Waarover gaat het wetsvoorstel? Het wijzigt artikel 12 van de betrokken titel van het Wetboek van strafvordering, meer bepaald waar het gaat over de vervolging van “terroristische of bepaalde zwaarwichtige misdrijven” waarvan de verdachte tot nu alleen kan worden vervolgd wanneer hij in België wordt aangetroffen. Wij zijn ter zake dus afhankelijk van het beleid van strafvervolging van het land waar de verdachte effectief gevonden wordt, eer er tot vervolging kan worden overgegaan.

Omdat dit voor een aantal moeilijkheden zorgt, vooral voor twee categorieën van misdrijven – terroristische misdrijven en zwaarwichtige geweldmisdrijven – wil men tegemoetkomen aan de vraag van vooral slachtoffers om effectieve vervolging, ook wanneer de verdachte niet in België wordt aangetroffen.

Het voorstel werd eenparig aangenomen door de Kamercommissie, tot zover mijn verslag.

Ik wil ook in twee woorden zeggen dat onze CD&V-fractie dit voorstel mee steunt, onder meer omdat er in de hoorzitting twee problemen naar voren kwamen. Slachtoffers botsten tot nu toe op een justitiële muur wanneer zij informatie wilden over slachtofferbejegening. Zij wisten niet of er werd vervolgd, en dergelijke meer. De slachtoffers kregen ook het gevoel van straffeloosheid omdat België niet effectief kon optreden. Daarom steunt onze fractie dit voorstel.

I will present a brief report on behalf of the two rapporteurs. We agreed this together. The proposal was formulated by Mrs. De Wit and Mrs. Smeyers of the N-VA group and was signed by the Open Vld group. The urgency was requested and obtained.

The proposal amends the Code of Criminal Procedure concerning the prosecution of certain crimes committed abroad. We dedicated several meetings to it and we held an extensive hearing with, among others, the federal prosecutor, the lawyers-general, representatives of the College of prosecutors-general, a professor emeritus of international law.

We also received written advice. In short, there has been an extensive consultation, which eventually led to a number of amendments.

What is the bill on? It amends Article 12 of the relevant title of the Code of Criminal Procedure, in particular where it concerns the prosecution of “terrorist or certain serious crimes” of which the defendant can be prosecuted until now only if he is found in Belgium. We are therefore dependent on the policy of prosecution of the country where the suspect is effectively found before prosecution can be undertaken.

As this creates a number of difficulties, in particular for two categories of crimes – terrorist crimes and serious violent crimes – it aims to address the demand of especially victims for effective prosecution, even when the suspect is not found in Belgium.

The proposal was unanimously adopted by the Chamber Committee, to the extent of my report.

I would also like to say in two words that our CD&V group supports this proposal, in particular because two issues were raised during the hearing. Victims have so far collided on a judicial wall when they wanted information about victim relief. They did not know if there was persecution, and more like that. The victims also got the feeling of impunity because Belgium could not act effectively. That is why our group supports this proposal.

                    Monsieur le président, chers collègues, nous pouvons nous féliciter de fournir un nouveau moyen pour que les victimes de crimes graves commis à l'étranger soient mieux protégées et reconnues.

Le groupe PS s'est bien sûr inscrit dans cet effort tout en ayant à cœur de ne pas étendre les possibilités de poursuite à toutes les infractions, comme le préconisait M. Dive, chef de service de droit international humanitaire au SPF Justice, que nous avons auditionné. En effet, il convenait de se concentrer, comme ma collègue vient de le dire, sur les infractions les plus graves, comme les infractions terroristes ou celles ayant trait à la violation du droit international humanitaire. Désormais, les familles des victimes pourront déposer plainte lorsqu'un de leurs proches est victime d'infractions graves à l'étranger auprès d'un procureur du Roi, quitte à ce que celui-ci renvoie l'affaire au parquet fédéral.

Cette extension va également permettre que des jugements par défaut soient prononcés, donnant de cette manière une réponse à tout le moins judiciaire à la douleur des victimes. Toutefois, il fallait veiller à ne pas surcharger davantage les cours d'assises, compétentes en matière de droit international. Le ministre nous a bien confirmé que cette crainte n'était pas fondée.

Dans ce dossier qui ne voyait pas de courants idéologiques, on peut se féliciter du fait que notre parlement puisse travailler vite et bien sur une initiative parlementaire. La proposition fut présentée, des auditions furent menées, un dernier avis fut demandé suite à un doute et cette proposition fut votée en six séances de commission. Puissions-nous, à l'avenir, nous en inspirer, sans pour autant confondre vitesse et précipitation!

The PS group, of course, took part in this effort, while having the heart not to extend the prosecution possibilities to all offenses, as Mr. advocated. This extension will also allow for default judgments to be pronounced, thus giving a response to the pain of the victims at least judicial. However, it was necessary to take care not to overload the courts of assises, competent in matters of international law. The Minister confirmed that this fear was unfounded.

In this case that saw no ideological currents, we can be congratulated that our parliament can work quickly and well on a parliamentary initiative. The proposal was presented, hearings were conducted, a final opinion was requested following a doubt and this proposal was voted in six committee sessions. May we, in the future, be inspired by it, without confusing speed and precipitation!

                    Mijnheer de voorzitter, collega’s, gezien de hoorzittingen, gezien de zeer grondige debatten, zij het soms wat technisch, in de commissie, gezien de constructieve en snelle samenwerking in de commissie zoals net aangehaald door collega Özen en gezien de unanieme goedkeuring waarvoor meteen mijn oprechte dank aan iedereen, zal ik zeer kort zijn. Toch wil ik even het belang schetsen van deze kleine, maar toch belangrijke wetswijziging.

Wellicht nam u allen recent kennis van het schrijnende verhaal van de familie Lema. Joeri Lema, 34 jaar, werd in 2003 op zeer brutale wijze vermoord in Ecuador waar hij op reis was. Hij werd brutaal vermoord omwille van zijn bezittingen. Hij werd gewoon in de rivier gegooid. Gelukkig waren er getuigen en waren er foto’s van de daders. Dan zou men denken dat er iets kan gebeuren, maar niets was minder waar. In Ecuador deed Justitie niets, ondanks het feit dat de daders bekend waren. Men greep niet in, er was geen onderzoek en geen vervolging. De Belgische Justitie kon ook niets doen, omdat onze wetgeving een voorwaarde had in de voorgaande titel van het Wetboek van strafvordering dat bij zulke feiten in het buitenland gepleegd op Belgen, de daders ook in België moeten worden gevonden. Dat was nu eenmaal niet het geval. Wat men hoogstens kon doen, was wat druk uitoefenen, maar geen onderzoeksdaden stellen en geen aanhoudingsbevel uitvaardigen.

Die druk heeft in het geval van de familie Lema wel geholpen. Nu in 2011, heel recent, maar liefst acht jaar later, is er dan toch actie gekomen in Ecuador. Dat had zeker zo lang niet moeten duren.

De wet die hier vandaag voorligt, brengt daarin verandering. De voorwaarde dat daders ook in België moeten worden gevonden, vervalt voor dergelijke zware feiten. Door deze wetgeving kan de Belgische Justitie toch ingrijpen, indien de buitenlandse Justitie het niet doet. Het houdt een kleine technische ingreep in met een beperkte budgettaire weerslag, maar met een zeer grote impact voor de familie van slachtoffers zoals de familie Lema, maar ook nog vele anderen. Er zijn immers nog andere dossiers waarvoor er nog geen oplossing is en er nog geen vervolging is gekomen. Zij zijn nu niet meer afhankelijk van de goodwill van het buitenland en moeten geen acht jaar meer wachten op actie, terwijl de daders gekend zijn.

Uit de commissiebesprekingen bleek duidelijk dat alle leden, over de partijgrenzen heen, het belang van deze kleine wijziging inzagen. Nogmaals dank ik alle partijen voor hun constructieve medewerking en voor de goedkeuring van dit wetsvoorstel.

Then one would think that something could happen, but nothing was less true. In Ecuador, Justice did nothing, despite the fact that the perpetrators were known. There was no interference, no investigation and no prosecution. The Belgian Judiciary could also do nothing, because our legislation had a condition in the previous title of the Code of Criminal Procedure that in such acts committed abroad on Belgians, the perpetrators must also be found in Belgium. That was not the case. What one could mostly do was put some pressure, but not make investigative acts and not issue an arrest warrant.

That pressure has helped in the case of the Lema family. Now in 2011, very recently, eight years later, there has been action in Ecuador. It ⁇  should not have lasted so long.

The law presented here today brings a change in that. The condition that the perpetrators must also be found in Belgium expires for such serious acts. This legislation allows the Belgian Judiciary to intervene if the foreign Judiciary does not. It involves a small technical intervention with a limited budgetary impact, but with a very large impact on the family of victims such as the Lema family, but also many others. After all, there are other cases that have not yet been resolved and there has not yet been a prosecution. They are no longer dependent on the goodwill of the foreign country and do not have to wait eight more years for action, while the perpetrators are known.

The committee discussions clearly showed that all members, across party boundaries, realized the importance of this small change. Once again, I thank all parties for their constructive cooperation and for the approval of this bill.

Het gevoel van straffeloosheid en totale desinteresse van de samenleving is volgens mij voor de nabestaanden volkomen ondraaglijk.

Tijdens de hoorzittingen is niet alleen het nut van de oprichting van een federaal parket gebleken. Zij blijken bovendien de laatste jaren op een zeer actieve wijze te werk te gaan wanneer zij vaststellen dat dergelijk zware misdrijven in het buitenland worden gepleegd op Belgen. Wij moeten vaststellen dat door het opstarten van een opsporingsonderzoek zij heel dikwijls nuttige informatie kunnen verstrekken aan de nabestaanden. Daarenboven veroorzaken zij door hun actie heel dikwijls dat het strafonderzoek uiteindelijk toch de nodige versnelling krijgt zodat de daders kunnen worden gevat en bestraft.

Mijnheer de voorzitter, collega’s, in een aantal weliswaar uitzonderlijke gevallen is er in het buitenland manifest sprake van rechtsweigering of zijn er gewoon onvoldoende middelen ter beschikking om het strafonderzoek tot een goed einde te brengen. Precies in dergelijke situaties biedt dit wetsvoorstel een antwoord zodat de daders ook in België kunnen worden opgespoord, vervolgd en berecht. Dit is het sluitstuk dat de geloofwaardigheid van de werking van onze politie en onze Justitie versterkt. Dat is ook de reden waarom onze fractie dit wetsvoorstel heeft onderschreven en vandaag zal goedkeuren.

Mr. Speaker, colleagues, I don’t want to imagine the situation of parents who are told that their child was murdered abroad or was the victim of a terrorist attack and then remain without news for a day, five days, a week, several weeks, months and often years. In addition, those parents and family members must establish that no judicial action is underway and that society as such remains indifferent to what happened to their child or family member. The feeling of impunity and total disinterest of society is, in my opinion, completely unbearable for the relatives.

During the hearings, not only was the usefulness of establishing a federal prosecutor’s office demonstrated. Furthermore, in recent years, they have been very active in finding that such serious crimes are committed abroad in Belgium. We must note that by initiating an investigation they can very often provide useful information to the survivors. Moreover, through their actions, they very often cause the criminal investigation to eventually get the necessary acceleration so that the perpetrators can be caught and punished.

Mr. Speaker, colleagues, in some, although exceptional cases, there is a manifest denial of law abroad or there are simply insufficient resources available to bring the criminal investigation to a successful conclusion. It is precisely in such situations that this bill provides an answer so that the perpetrators can also be traced, prosecuted and tried in Belgium. This is the closing point that strengthens the credibility of the operation of our police and our Justice. That is also why our group has endorsed this bill and will adopt it today.

                    Mijnheer de voorzitter, collega’s, het voorliggende ontwerp werd ons overgezonden door de Senaat en werd besproken tijdens de commissievergaderingen van 12, 18 en 26 oktober 2011. Ik zal rapporteren over de eerste vergadering en de hoorzittingen. Daarna zal collega Rutten het verslag van mij overnemen.

De minister van Binnenlandse Zaken wijst bij haar inleidende uiteenzetting op de doelstelling van het ontwerp, met name de verlenging van de levensduur van de elektronische identiteitskaart van vijf naar tien jaar.

De minister merkt voorts op dat de eID uiteraard ook aan een aantal technische vereisten moet voldoen, die bovendien moeten gewaarborgd blijven bij een verlenging van de levensduur van de kaart.

Ook de drie overeenkomstsluitende partners die bij de eID betrokken zijn, moeten de nodige waarborgen kunnen bieden, aldus de minister. Het gaat om de firma Steria als bouwer voor de technische infrastructuur, de firma Zetes als kaartproducent en de erkende certificatiedienst Certipost.

De commissie beslist vervolgens om hoorzittingen te organiseren, waarbij de verantwoordelijke van de overheidsdienst Fedict zal worden gehoord, alsook de producent van de kaarten, Zetes.

De commissie wil zich immers vergewissen dat de nodige waarborgen kunnen worden geboden om het veilig gebruik van de eID bij de verlenging van de levensduur te garanderen.

Tijdens de hoorzitting verduidelijkt de heer Strickx de rol van Fedict als verantwoordelijke voor de implementatie van de e-governmentprojecten.

Hij wijst ook op de groeiende rol van de eID en de uitbreiding van verschillende overheidsdiensten naar een internetplatform, zoals Tax-on-web en e-Health.

Een kader creëren waarbij de geldigheid van de eID afhankelijk van de leeftijdsgroep kan worden aangepast, is voor de spreker een goede zaak. Hij is echter gekant tegen het optrekken van de maximale geldigheid van de eID van vijf naar tien jaar.

De belangrijkste argumenten hiervoor zijn de snelle technologische evolutie, waarbij de verlenging van de levensduur in feite een bevriezing van de technologische ontwikkeling van de kaart voor tien jaar zou betekenen.

Een tweede argument betreft de hoge onderhoudskosten. De verschillende versies van de kaart moeten immers gedurende tien jaar worden ondersteund op verschillende platformen.

Momenteel bedragen de onderhoudskosten over een periode van drie jaar ongeveer 850 euro. De verlenging tot tien jaar zou ongeveer een verdubbeling van die kostprijs betekenen.

Een derde argument betreft de hogere veiligheidsrisico’s, waarbij vooral de sleutellengte op de kaart van belang is, en dus ook het risico dat de sleutel gedurende tien jaar mogelijke aanvallen te verduren krijgt.

                    De commissie hoort vervolgens ook de heer Depoortere, als vertegenwoordiger van Zetes NV, de producent van de kaarten. De heer Depoortere wijst op de tegenstrijdige belangen die de firma heeft bij de verlenging van de levensduur, in het bijzonder omdat de firma daardoor haar omzet als het ware gehalveerd ziet. Hij wijst tevens op de technische risico’s die aan het ontwerp verbonden zijn. De verlenging van de levensduur van de kaart zal ongetwijfeld gevolgen hebben voor de kostprijs van de kaart en zal die zeker duurder maken, onder meer door hogere kwaliteitseisen en een langere garantie op het gebruik van de kaart.

Vervolgens komen de verschillende fracties aan het woord. De heer Dedecker heeft namens de N-VA-fractie diverse vragen bij het ontwerp, vooral over de kostprijs van de toekomstige kaarten, de veiligheid van de huidige kaart, de prognoses voor de nieuwe kaart en de technische aspecten die verbonden zijn aan de verlenging van de kaart, zoals het plaatsen van nieuwe sleutelparen op de kaart.

De spreker van de CD&V-fractie heeft belangrijke bedenkingen bij de voordelen van het ontwerp. Zij wijst op de vele negatieve bedenkingen die door de beide sprekers tijdens de hoorzittingen werden geuit. Zij vraagt zich ook af of er eigenlijk nog voordelen zijn aan de verlenging van de levensduur en hoeveel momenteel wordt geïnvesteerd in de ontwikkeling van nieuwe technologieën.

De heer Somers wijst voor de Open Vld-fractie op de duidelijke voordelen die volgens hem aan de verlenging van de kaart verbonden zijn. In de eerste plaats zal die, volgens de heer Somers, een aanzienlijke vermindering van de maatschappelijke kostprijs betekenen. De burger moet minder naar het gemeentehuis om een nieuwe kaart af te halen en moet maar om de tien jaar voor een nieuwe kaart betalen. Ook voor de gemeenten betekent het een aanzienlijke besparing op personeels- en werkingskosten. Daarnaast wijst de heer Somers op een studie van Computer Security and Industrial Cryptography die wel degelijk de mogelijkheid van een verlenging naar 10 jaar ziet, mits aan een bepaald aantal voorwaarden is voldaan.

De heer Thiébaut beaamt voor de PS de visie van de heer Somers met betrekking tot de lagere kostprijs voor de burger en de gemeentebesturen. Volgens hem is het trouwens de taak van de overheid om een evenwicht te zoeken tussen de veiligheidsaspecten verbonden aan de verlenging van de kaart, en de maatschappelijke kostprijs van de kaart.

In zijn repliek antwoordt de heer Strickx op vragen over de huidige kostprijs van het eID-project en de investeringen voor de ontwikkeling van nieuwe technologieën. Zo zou Certipost als meerkosten 3,5 miljoen euro voor de verlenging van de certificaten van vijf naar tien jaar vragen. De kostprijs van een kaart is nu 10 euro, terwijl die met een verlenging ongeveer 16 euro zal bedragen. De heer Strickx heeft geen weet van bugs in de huidige chips, maar hij wijst erop dat de verlenging van de levensduur de veiligheidsrisico’s doet toenemen.

De vertegenwoordiger van Fedict beaamt dat de verlenging een vermindering van de maatschappelijke kostprijs zou meebrengen, zowel voor de burger als voor de gemeenten. Er dient wel op gewezen te worden dat het plaatsen van nieuwe sleutelparen op de chip hoe dan ook in het gemeentehuis moet gebeuren. Daarvoor zal ook een verplaatsing van de burger nodig zijn. Fedict besteedt over een periode van drie jaar ongeveer een miljoen euro aan de technologische vernieuwing van de eID.

Also for the municipalities it means significant savings on personnel and operating costs. In addition, Mr. Somers points to a study of Computer Security and Industrial Cryptography that does see the possibility of extending to 10 years, provided that a certain number of conditions are met.

Mr Thiébaut expresses for the PS the vision of Mr Somers regarding the lower cost for the citizen and municipal authorities. According to him, it is, by the way, the task of the government to find a balance between the security aspects associated with the extension of the card, and the social cost of the card.

In his response, Mr. Strickx answers questions about the current cost of the eID project and the investments for the development of new technologies. For example, Certipost would require 3.5 million euros as additional costs for the extension of the certificates from five to ten years. The cost of a card is now 10 euros, while the one with an extension will be about 16 euros. Mr. Strickx has no knowledge of bugs in current chips, but he points out that extending the lifetime increases the security risks.

The representative of Fedict believes that the extension would bring a reduction in the cost of society, both for the citizen and for the municipalities. However, it should be noted that the placement of new key pairs on the chip must be done in the municipality house anyway. This will also require the displacement of citizens. Fedict will spend approximately one million euros over a three-year period on the technological renewal of the eID.

Ik herhaal kort de essentie aan van de uiteenzettingen van de heer Dedecker, de heer Thiébaut, mevrouw Dierick en de heer Somers, die ik een keer heb vervangen. Vandaar mijn rapporteurschap. Voor een meer extensief verslag verwijs ik naar het geschreven verslag.

De heer Dedecker van de N-VA was het eens met leeftijdsgebonden aanpassingen, voornamelijk met betrekking tot de 75-plussers, maar voor hem lagen de zaken in de categorie van 18 tot 75 jaar toch anders. Hij heeft daar gepleit voor een behoud van de periode op 5 jaar.

Hij verwees hiervoor naar de hoorzittingen, waar volgens hem uit bleek dat de voordelen niet opwegen tegen de nadelen.

Hij verwees ook naar de koppositie van België inzake innovatie in deze sector, die ingevolge de verlenging in gevaar dreigt te komen.

Hij trekt ook de vermindering van administratieve lasten in twijfel en zegt dat men wel nog om de vijf jaar naar het gemeentehuis zal moeten.

Ook de financiële lastenverlagingen zijn voor hem niet zuiver. Hij is van mening dat er toch hogere kosten zullen worden doorgerekend.

Bovendien zullen er tijdens een periode van tien jaar nieuwe applicaties kunnen worden ontwikkeld, wat kan leiden tot het naast elkaar bestaan van verschillende kaarten. Ook dat zou een impact op de kosten hebben.

De conclusie van de uiteenzetting van de heer Dedecker van de N-VA is dat de verlenging in de leeftijdscategorie van 18 tot 75 jaar niet opportuun is.

De minister antwoordde hierop dat de basiskostprijs van de kaarten momenteel 12 euro is, eventueel aangevuld met een gemeentelijke taks en dat die basiskostprijs niet zal veranderen.

De overgangsperiode bedraagt bovendien slechts vijf jaar. Dat wil zeggen dat twee versies van de kaarten dus maximaal vijf jaar naast elkaar kunnen bestaan.

De minister herhaalde ook dat de verlenging van de duurtijd van de kaarten er alleen kan komen nadat alle technische vragen zijn opgelost. Ze geeft ook aan dat de commissie zich over de opportuniteit zal moeten uitspreken, dat is de taak van de commissie, en geeft aan dat indien de nodige garanties aanwezig zijn, de verlenging van vijf naar tien jaar een belangrijke verhoging van het gebruiksgemak voor burgers betekent.

Hij voert aan dat de snelle technologische evolutie zowel een argument voor als een argument contra kan zijn. De CD&V-fractie uitte dan ook de bezorgdheid dat eerst de technische garanties moeten worden vervuld, vooraleer het wetsontwerp in werking kan treden. De minister heeft na de opmerking van mevrouw Dierick bevestigd dat het wetsontwerp inderdaad pas in werking zal treden nadat aan alle technische voorwaarden is voldaan.

Tot slot was er een uiteenzetting van de heer Bart Somers. Hij merkte op dat de kosten voor de lokale besturen voor de uitreiking van de kaarten en dus ook voor de besparing ter zake zelfs nog worden onderschat. De werkelijke besparing voor de gemeenten is allicht een veelvoud van de meerkosten voor de certificaten.

Tijdens de hoorzitting is gebleken dat de verlenging naar tien jaar wel degelijk realiseerbaar is. De minister heeft bovendien de nodige garanties gegeven dat eerst de technische kwesties zullen worden uitgeklaard.

Het voorstel is dus te verdedigen vanuit een zorg naar klantvriendelijkheid, enerzijds, en draagkracht van lokale besturen, anderzijds.

Met betrekking tot artikel 2 merkte de heer Somers op dat de machtiging aan de koning in het tweede lid niet restrictief mag worden geïnterpreteerd. Er kunnen kortere en langere periodes worden bepaald. De bepaling doet echter niets af aan andere beperkingen of machtigingen, die in andere wetten bestaan. De spreker verwijst als voorbeeld naar artikel 13, 1, van de vreemdelingenwet met verblijfstitels van beperkte duur.

Then followed an explanation by Mr Eric Thiébaut of the PS. He emphasized the importance of user-friendliness for citizens, which was originally also the intention of our colleagues in the Senate. During the hearing it was shown that the extension to ten years is indeed feasible. The Minister has also given the necessary guarantees that the technical issues will be clarified first.

The proposal is therefore to be defended from a concern for customer-friendliness, on the one hand, and the support of local governments, on the other.

With regard to Article 2, Mr. Somers noted that the authorization to the King in paragraph 2 should not be interpreted restrictively. Shorter and longer periods may be determined. However, the provision does not prejudice any other restrictions or permissions that exist in other laws. As an example, the speaker refers to Article 13, 1 of the Foreigners Act with residence permits of limited duration.

                    Mijnheer de voorzitter, collega’s, ik zou graag mijn uiteenzetting beginnen met een klein stukje nostalgie. Ik neem u dan ook graag mee terug in de tijd, in de duistere paarse tijden, naar een van de lichtpuntjes daar, het jaar 2005.

Ons land, en ook deze instelling, de Kamer, kreeg toen bezoek van niemand minder dan Bill Gates, de oprichter en toen ook nog CEO van Microsoft. De heer De Croo – hij is momenteel niet meer aanwezig – herinnert het zich ongetwijfeld nog; hij stelde de heer Gates gerust en zei dat hij deze keer geen taart in het gezicht zou krijgen.

Bill Gates kwam uiteraard niet naar hier voor onze uitstekende patisserie, neen, hij kwam voor heel andere zaken, hij wilde meer weten over onze elektronische identiteitskaart. België had toen immers de moedige beslissing genomen, als een van de weinigen in die tijd, om de elektronische identiteitskaart, die in 2003 ingevoerd werd, veralgemeend en versneld te gaan uitrollen. Burgers die nog een papieren identiteitskaart hadden die nog jaren geldig was, werden vervroegd naar het gemeentehuis geroepen om daar zo’n nieuwe elektronische kaart te gaan afhalen.

De heer Vanvelthoven is ondertussen helaas ook verdwenen, misschien vlucht hij wel voor dit punt, met pijn in het hart, want hij had toen de beslissing genomen om de burger vervroegd naar het gemeentehuis te sturen. Ik twijfel er niet aan, dat was een uitstekende beslissing, de heer Vanvelthoven deed dat niet om die burgers te pesten, uiteraard niet. Ik zie gegniffel, misschien twijfelt u daaraan, maar ik ben er zeker van, ik ben overtuigd van de goede beslissing van de heer Vanvelthoven, het was niet om de burgers te pesten.

Neen, dit was een signaal naar ontwikkelaars van applicaties dat op korte termijn, op heel korte termijn miljoenen mensen over dit stukje technologie zouden beschikken. Het was een signaal voor die applicatieontwikkelaars, dat zij op korte termijn een voldoende grote markt zouden hebben, zodat het loont om te gaan investeren in toepassingen.

Wij hebben dat zelf ook gedaan. Wij hebben zelf toen ook Tax-on-web ontwikkeld en hebben daarmee het heel goede voorbeeld gegeven. Die andere ontwikkelaars sprongen toen ook op de kar.

Wij kregen toen ook lovende woorden van Bill Gates. Hij zei zeer geïnteresseerd te zijn in de toepassingen van de eID, dat het een fantastische zaak was dat België op dit vlak een voortrekkersrol wilde spelen en dat hij er zeker van was dat andere landen zouden volgen.

Hij beloofde op dat moment ook dat zijn bedrijf, Microsoft, dé Amerikaanse gigant, de softwarereus wiens software op miljarden pc’s draaide, zijn software compatibel zou maken met dit stukje technologie, dit stukje technologie van dit kleine landje.

In fact, Belgium had then made the courageous decision, as one of the few at that time, to generalize and accelerate the deployment of the electronic identity card, which was introduced in 2003. Citizens who still had a paper identity card that was still valid for years were called early to the municipality house to get such a new electronic card there.

No, this was a signal to application developers that in the short term, in the very short term, millions of people would have this piece of technology. It was a signal to those application developers that they would have a sufficiently large market in the short term so it is worth investing in applications.

We have done it ourselves too. We have also developed Tax-on-web and have thus given a very good example. Those other developers also jumped on the car.

We also received praise words from Bill Gates. He said he was very interested in the applications of the eID, that it was a fantastic thing that Belgium wanted to play a leading role in this area and that he was sure that other countries would follow.

He also promised at that time that his company, Microsoft, the American giant, the software giant whose software ran on billions of PCs, would make his software compatible with this piece of technology, this piece of technology of this small country.

Het is ook jammer dat hier vandaag een andere minister ontbreekt, namelijk minister Van Quickenborne. Het is natuurlijk minister Van Quickenborne die verantwoordelijk is voor het beleid inzake e-gov. Hij heeft ook steeds de mond vol van vernieuwende technologieën, nieuwe technologieën die het leven van de burger gemakkelijker maken, die de werking van onze overheid efficiënter maken en op die manier de kostprijs voor de belastingbetaler drukken. Ik citeer even van zijn website: “Met een beetje creativiteit vervangt eID je portefeuille. Geen bankkaart, SIS-kaart, rijbewijs, huissleutel of toegangsbadge meer”.

Het is een heel mooie droom van de minister van dezelfde partij die deze droom vandaag op de helling plaatst en dit boeltje ten grave draagt. Als het tien jaar duurt voor we technologische vernieuwing uitrollen, dan zijn we niet langer interessant voor ontwikkelaars van applicaties. Wat zijn we met een verouderde technologie van tien jaar? Hoelang zal die meegaan? Wat kunnen we daarmee doen?

We zullen onze Europese koppositie inruilen voor een positie achter in het peloton. Andere Europese landen behouden hun vernieuwingsfrequentie van vijf jaar of zullen hun termijnen van tien jaar verlagen tot vijf jaar.

Waarom, collega’s? Waarom doen we dat? Voor een lastenverlaging? De burger die een keer in tien jaar een bezoek aan het gemeentehuis en de volle 17 euro uitspaart. Daarvoor doen we dat, daarvoor zetten we de hele boel op de helling. Meer nog, het is zelfs een ogenschijnlijke besparing. Het is geen echte besparing, zowel praktisch als financieel. De collega’s Dierick en Rutten hebben zonet een uitstekend verslag gebracht. Ze verwezen ook de naar de veiligheidsexpert COSIC. Die meldde dat de certificaten weliswaar tien jaar geldig zijn maar dat het om veiligheidsredenen aan te raden is om nieuwe certificaten te kunnen genereren op die bestaande kaart.

Ook financieel kunnen we daaraan twijfelen. Minister Turtelboom garandeert dat de prijs voor de burger 12 euro blijft, plus gemeentelijke toeslag. Ik heb het net in het verslag anders gehoord. Peter Strickx van Fedict stelt dat de prijs voor de federale overheid momenteel 10 euro bedraagt en zal worden opgetrokken naar 16 euro. Met andere woorden, als het federale niveau die kaarten aan de gemeenten blijft doorgeven voor 12 euro, dan maken wij daarop verlies. Dat zijn weer kosten op de kap van de belastingbetaler. Waar komen die kosten vandaan? Er zijn uiteraard duurdere kaarten die tien jaar meegaan. Die levensduur van tien jaar wordt gegarandeerd doordat een korting wordt gegeven, een soort verzekering, voor kaarten die er toch vervroegd uitvallen. Natuurlijk rekenen zij die kosten door, zij zijn geen liefdadigheidsinstelling.

Ook de certificaten worden duurder en de kans op aanvallen wordt groter. Tegen die kans zullen we ons ook moeten verzekeren, tegen een onvoorzienbare prijs. Criminelen zijn ook geen dommeriken. Ook een crimineel redeneert economisch en weet ook dat als de technologie tien jaar meegaat, hij zijn kosten kan afschrijven op tien jaar. Het is ook gemakkelijker om oude technologie aan te vallen dan nieuwe technologie. U weet ook dat de vernieuwingen snel gebeuren. De rekensnelheid verdubbelt elke achttien maanden. Ook de kosten voor het compatibel houden van nieuwe kaarten, momenteel 800 000 euro op last van Fedict, de federale overheidsdienst voor ICT, zullen een veelvoud worden.

Zoals collega Rutten uit het verslag heeft geciteerd, wist de medewerker van de minister in de commissie te zeggen dat er geen verschillende versies door elkaar zullen bestaan eens de oude kaarten van vijf jaar uitgefaseerd zullen zijn. Dat is nog eens een bevestiging van het stilzetten van de technologie: niet voor tien jaar, maar nog lang daarna steevast dezelfde versies blijven uitrollen, jaar na jaar. We zullen gewoon de boel stilzetten en niet meer innoveren met nieuwe technologieën: geen nieuwe types kaarten meer, geen vernieuwingen meer, geen betere dienstverlening meer. Dat is de kern van het verhaal.

De eID, dat stukje plastic met chip, is niet meer te vergelijken met de oude papieren identiteitskaart. Dit is een stuk technologie, een veilige sleutel tot een e-govplatform en binnenkort ook tot een e-healthplatform, en een hele waaier aan particuliere diensten.                     Monsieur le président, monsieur le premier ministre, chers collègues, le projet présenté aujourd'hui concerne l'ensemble des résidents de ce pays. D'une part, il va permettre de prolonger, comme on l'a déjà dit plusieurs fois depuis le début des débats, la validité des cartes électroniques de cinq à dix ans. Je précise ici – c'est important – que cela ne concerne que les cartes qui ne couvrent qu'une durée de séjour illimitée. Le texte ne porte pas sur les cartes qui couvrent un titre de séjour à durée limitée. D'autre part, il permet au gouvernement de moduler la validité de ces cartes en fonction de l'âge du détenteur.

En ce qui concerne l'allongement de la durée de validité de la carte électronique, cette initiative présente un attrait certain puisqu'il y aura une différence substantielle pour le porte-monnaie des citoyens, en faisant en sorte que celui-ci ne doive pas supporter le coût de la carte une fois tous les cinq ans mais une fois tous les dix ans. Vous me direz peut-être que ce n'est pas un coût exceptionnel. Je crois que l'on minimise très fort le coût de cette carte d'identité électronique. Il faut d'abord fournir une photo d'identité qui coûte entre 4 et 8 euros. Ensuite, il faut payer le document. Bien souvent, les communes demandent le coût de la carte d'identité mais aussi une taxe communale supplémentaire, de telle façon que, dans certaines communes, son coût monte jusqu'à 20 euros. Si vous ajoutez les frais liés au déplacement et la photo d'identité, le changement des cartes d'identité d'une famille de trois personnes revient pratiquement à 100 euros. Pour le portefeuille de la famille, aujourd'hui, cette dépense n'est pas si anodine que cela.

La proposition de loi permettra également de moduler la validité des cartes en fonction de l'âge des détenteurs, essentiellement pour les personnes âgées et les plus jeunes. C'est la raison pour laquelle le projet de loi à l'examen vise à permettre au gouvernement d'augmenter au-delà de dix ans la durée de validité des cartes électroniques de nos aînés, ce qui – c'est une évidence – leur facilitera énormément la vie; je pense, notamment, aux personnes qui sont "coincées" dans une maison de retraite.

Pour ce qui concerne les jeunes, le projet de loi vise à permettre au gouvernement de réduire la validité de leur carte électronique en vue d'une mise à jour plus rapide de certaines informations, comme la photo d'identité. En effet, entre douze et dix-huit ans, le visage d'un individu a tendance à changer sensiblement. Il est donc important qu'une donnée telle que la photo d'identité puisse être plus rapidement réactualisée.

En résumé, monsieur le président, monsieur le premier ministre, mesdames, messieurs les ministres, chers collègues, ce projet de loi vise à permettre une facilitation, une simplification administrative pour l'ensemble des résidents de ce pays et à réduire les coûts et les tracasseries administratives pour les citoyens et les communes. Autrement dit, il vise véritablement à alléger la charge qui pèse sur les citoyens et les communes et à améliorer, de manière générale, la délivrance des titres d'identité en collant véritablement aux réalités de la vie de tout un chacun.

C'est pour toutes ces raisons que mon groupe soutiendra ce texte qui – je tiens à le rappeler – avait été déposé, au Sénat, par le PS et le VLD.

It is for all these reasons that my group will support this text which – I want to remind you – had been deposited, in the Senate, by the PS and the VLD.

Ensuite, ce projet de loi vise à alléger la tâche des communes qui sont – les municipalistes qui se trouvent parmi nous le savent bien – déjà fortement mises à contribution. Ce projet constitue indéniablement une réelle avancée en termes de simplification administrative.

Ce projet n'est pas neuf. On en parle depuis 2009 au moins, mais pour des raisons d'obstacles techniques, ce parlement n'a pas eu l'occasion de travailler sur ce projet avant maintenant.

J'ai bien cerné les avantages qui sous-tendent ce texte en termes de réduction de coûts et de charges administratives tant pour les communes que pour les administrés, mais je reste dubitative quant à l'opportunité de voter ce texte dans la situation actuelle. En l'espèce, je pense notamment que, même s'il permet des aménagements par voie d'arrêté royal, le texte ne tient pas beaucoup compte des changements de physionomie inhérents à certaines catégories d'âge. En plus, le texte ne tient pas beaucoup compte de l'évolution de la technologie et des potentiels de nouvelles applications, au point de postposer son entrée en vigueur à un moment où le contexte technologique permettra d'avoir toutes les garanties nécessaires.

Une carte d'identité doit permettre au citoyen de s'identifier sans qu'il puisse n'y avoir le moindre doute à propos de son identité. La carte d'identité électronique, elle, est bien plus qu'un simple document d'identité. En Belgique, on l'utilise de plus en plus comme un moyen d'identification sécurisé dans un environnement électronique. La carte d'identité électronique est une clef essentielle pour un e-government sûr. De plus en plus de services publics développent un service en ligne donnant accès à des informations sensibles sur le plan de la vie privée comme Tax-on-web ou eHealth.

An identity card must allow the citizen to identify himself without the slightest doubt about his identity. The electronic identity card is much more than just an identity document. In Belgium, it is increasingly used as a secure means of identification in an electronic environment. The electronic identity card is an essential key for a secure e-government. More and more public services are developing an online service that gives access to privacy-sensitive information such as Tax-on-web or eHealth.

Pour effectuer ces opérations, la carte d'identité électronique contient un important composant technologique. Porter sa durée de validité à dix ans revient à geler cette technologie pendant dix années, ce qui pourrait avoir un impact négatif sur la flexibilité du produit. Toute évolution ultérieure liée à des facteurs externes, comme l'introduction d'un composant sans contact, de nouveaux dispositifs de sécurité ou une obligation européenne d'intégrer des données biométriques, entraînera un surcoût important en raison du rappel anticipé des cartes d'identité valables.

Enfin, d'après l'expert du Fedict, le fait de porter la durée de validité de la carte d'identité à dix ans entraîne également des risques pour la sécurité, car la période durant laquelle les attaques pourront être lancées sera portée à dix ans et les investissements criminels pourront être amortis sur dix ans au lieu de cinq ans. Il apparaît que les risques pour la sécurité s'accroissent de manière exponentielle pendant une plus longue période.

Pour toutes ces raisons, au contraire de mon groupe, j'ai pris la décision de m'abstenir sur le vote de ce texte.

This card allows you to communicate safely on the internet, both with public and private services, but also to engage in all kinds of transactions, because its holder is able to sign contractual type documents electronically. This means that the issues are important.

To perform these operations, the electronic identity card contains an important technological component. Bringing its validity to ten years is like freezing this technology for ten years, which could have a negative impact on the flexibility of the product. Any further developments related to external factors, such as the introduction of a contactless component, new security arrangements or a European obligation to integrate biometric data, will result in significant additional costs due to the early recall of valid identity cards.

Finally, according to the Fedict expert, the fact of extending the validity period of the ID card to ten years also involves security risks, as the period during which attacks can be launched will be extended to ten years and criminal investments can be amortized over ten years instead of five years. Security risks appear to increase exponentially over a longer period of time.

By spacing out card renewal every ten years, we also undermine the social control that occurs when citizens come to renew their identity documents and this is regrettable. The contacts between administrations and administrators are broken.

For all these reasons, unlike my group, I have decided to abstain from voting on this text.

Deze resolutie heeft eigenlijk vooral een signaalfunctie want wij kunnen niet in de plaats van Europa beslissen. Wij willen met deze resolutie onze eerste minister en zijn ministers in elk geval het signaal geven dat zij op Europees vlak al hun invloed aanwenden om tot een duurzame oplossing te komen. Men heeft maandag blijkbaar een overgangsregeling getroffen voor de komende twee jaar. Er is echter nog geen oplossing voor de periode na 2013. Wij vragen dat ook voor die periode een duurzame oplossing wordt gevonden. Wij kunnen enkel een oproep doen om daarvoor alle mogelijke invloed aan te wenden.

Het is natuurlijk een schande dat wij nog altijd voedselpakketten moeten bedelen aan mensen om te overleven. Het Europese programma voor de voedselhulp gaat over 400 000 ton voedsel dat wordt verdeeld via 240 voedselbanken. In Europa, en dus ook in België, is 41 % van de voedselpakketten afkomstig van dit Europese programma wat ongeveer 11 miljoen euro vertegenwoordigt. Indien dit zou wegvallen, moeten wij uiteraard zelf instaan voor de middelen op dat vlak.

Wij willen ook vragen dat de verdere afwikkeling van dat principeakkoord wordt opgevolgd. Ik heb begrepen dat het Poolse voorzitterschap dit verder zal finaliseren waarna het door de Raad moet worden bekrachtigd om vervolgens naar het Europees Parlement te gaan voor definitieve goedkeuring. Wij moeten ook trachten te komen tot een duurzame oplossing op Europees vlak voor de periode na 2013 zodat de voedselbedeling voor de armsten kan blijven bestaan.

In Europe, and therefore also in Belgium, 41% of food packages come from this European programme, which represents approximately 11 million euros. If this falls away, we must, of course, take care of the resources in that area.

We would also like to ask that the further settlement of that principle agreement be followed. I have understood that the Polish Presidency will further finalize this, after which it must be ratified by the Council and then go to the European Parliament for final approval. We must also strive to find a sustainable solution on a European level for the period after 2013 so that the food distribution for the poorest persists.

                    Monsieur le président, mesdames et messieurs les ministres, chers collègues, tout d'abord, permettez-moi de vous dire que je suis fière que la commission de la Santé publique ait pu adopter à la quasi-unanimité la proposition de résolution que mon groupe avait déposée en juillet, relative au régime de distribution de denrées alimentaires au profit des plus démunis dans l'Union européenne et cela, grâce à l'approche constructive de mes collègues. Je les en remercie.

Mais c'est aussi avec un sentiment partagé et amer que je vous présente aujourd'hui ce texte. En effet, l'Europe semble aujourd'hui pousser à son paroxysme l'idéologie de l'égoïsme, alors qu'elle n'a jamais eu autant besoin de solidarité. Mon groupe ne cesse de le dire dans les différents forums de cette assemblée: la solidarité est et sera le mot-clé pour trouver une issue à la crise actuelle. Une solidarité, certes, inter-étatique mais aussi une solidarité entre les individus, les Européens, qui est tout aussi essentielle.

Cette résolution se veut consensuelle puisqu'elle relaie la résolution commune adoptée par pratiquement tous les groupes politiques du Parlement européen, tant de droite que de gauche, sans pour autant perdre sa force symbolique. Il faut aussi montrer que notre assemblée soutient, plus que jamais, notre gouvernement avec force dans ce dossier qui, comme je vous le disais, symbolise la solidarité européenne. Il n'en reste pas moins fort et surtout d'actualité.

Nous le savons, cette solidarité de terrain est aujourd'hui menacée à la suite d'une décision de la Cour de Justice de l'Union qui a donné raison à six États membres. Celle-ci conteste la légalité du programme européen d'aide alimentaire aux plus démunis. La Commission a dû réduire le budget du régime européen de distribution alimentaire de 500 à 113 millions d'euros. Cette décision de justice ne remettait cependant nullement en cause le principe même de l'aide mais uniquement sa forme juridique.

L'Allemagne a aujourd'hui fait volte-face. "Nous serions prêts à une solution de transition pour les deux prochaines années, par égard pour les organisations caritatives", a annoncé la ministre de l'Agriculture, Ilse Aigner.

This resolution is consensual since it relays the joint resolution adopted by virtually all political groups in the European Parliament, both right and left, without yet losing its symbolic force. We must also show that our assembly supports, more than ever, our government with strength in this dossier that, as I told you, symbolizes European solidarity. It is not less important and especially topical.

We know that this ground solidarity is now threatened as a result of a judgment of the Court of Justice of the European Union which gave righteousness to six Member States. The European Union’s food aid program for the most disadvantaged. The Commission had to reduce the budget of the European food distribution scheme from 500 million euros to 113 million euros. This judgment, however, did not in any way question the very principle of the aid but only its legal form.

Germany has now turned its face. “We would be ready for a transitional solution for the next two years, with respect to charities,” said Minister of Agriculture Ilse Aigner.

Car, en échange, l'Allemagne réclame la suppression à terme du programme et va même plus loin, puisqu'elle affirme qu'en janvier 2014, il n'y aura plus de politique sociale à l'échelle européenne.

En fait, ce qui est en jeu derrière ce dossier, qui vient en aide à des millions d'Européens, est un aspect symbolique, mais ô combien essentiel, c'est la dimension sociale et la lutte contre la pauvreté dans notre Union. Il est inacceptable de sauver pour deux ans ce plan européen au bénéfice des plus démunis avant d'y mettre fin définitivement. Face à cette impossibilité de trouver une réponse technique, l'Europe nous apprend la façon dont on peut, à partir d'un problème juridique, menacer la sécurité alimentaire de plusieurs centaines de milliers de citoyens européens et ce, même si on déplace la menace de janvier 2012 à janvier 2014.

Je le rappelle une fois de plus, selon plusieurs associations caritatives, la baisse drastique de cette aide européenne pourrait priver au moins deux millions de citoyens européens d'une aide alimentaire capitale, ce qui constitue la moitié de l'aide alimentaire dont bénéficie la Belgique.

Nous ne voulons pas d'une Europe qui réagit aux problèmes des banques et ferme les yeux quant aux problèmes des citoyens européens. Nous ne voulons pas d'une Europe frileuse à taxer les spéculateurs, mais qui n'hésite pas à couper dans ses politiques sociales. Nous ne voulons pas non plus d'une Europe qui inscrit fièrement comme objectif de sa stratégie Europe 2020 la lutte contre la pauvreté et l'exclusion sociale mais qui, par une absence de volonté politique, jette le glas sur une de ses seules politiques sociales concrètes.

Comment justifier la position de certains États membres, qui désirent la fin des politiques sociales européennes, tout en adhérant à la stratégie Europe 2020? Pour nous, il s'agit d'un double discours dangereux. Même si nous saluons le rôle proactif joué par notre pays dans ce dossier, notamment par le biais de M. Courard et de Mme Laruelle, il s'agit de consolider l'accord de principe et de maintenir le financement de cette politique européenne pour 2012 et 2013, mais aussi et surtout, pour trouver une solution structurelle pour la période 2014-2020 en la dotant d'une base juridique solide et en conservant le plafond de 500 millions d'euros, de telle sorte que les personnes tributaires de cette aide alimentaire européenne ne souffrent pas de la pauvreté.

But, for my group, what is asked in exchange is simply unacceptable and, above all, incomprehensible. In fact, what is at stake behind this case, which comes to help millions of Europeans, is a symbolic aspect, but oh how essential it is the social dimension and the fight against poverty in our Union. It is unacceptable to save for two years this European plan for the benefit of the poorest before finally ending it. Faced with this impossibility of finding a technical answer, Europe teaches us how one can, from a legal problem, threaten the food security of several hundred thousand European citizens, even if we move the threat from January 2012 to January 2014.

According to several charitable associations, the drastic reduction of this European aid could deprive at least two million European citizens of a major food aid, which constitutes half of the food aid that Belgium benefits from.

We do not want a Europe that responds to the problems of banks and shuts its eyes on the problems of European citizens. We do not want a Europe that is frigid to tax speculators, but which does not hesitate to cut in its social policies. Neither do we want a Europe which proudly sets as its Europe 2020 strategy the goal of fighting poverty and social exclusion but which, by a lack of political will, throws the blade on one of its only concrete social policies.

How can we justify the position of some Member States, which want the end of European social policies, while adhering to the Europe 2020 strategy? For us, this is a dangerous double discourse. Even though we welcome the proactive role played by our country in this matter, ⁇  through Mr. Courard and Mrs Laruelle, it is about consolidating the principle agreement and ⁇ ining the financing of this European policy for 2012 and 2013, but also and above all, to find a structural solution for the period 2014-2020 by providing it with a solid legal basis and ⁇ ining the ceiling of 500 million euros, so that the persons dependent on this European food aid do not suffer from poverty.

                    Cela pour maintenir une dimension sociale concrète, essentielle à l'échelon européen. Une Europe sociale est possible, elle doit exister, elle doit se faire ressentir auprès des citoyens qui sont de plus en plus touchés par la crise économique et financière.

L'hiver arrive à grands pas et ce problème doit trouver une solution, tant sur le court terme que sur le long terme. Ce Fonds européen devra être pérennisé à son niveau actuel. Pour les socialistes, tant la solution juridique que la solution financière doivent être trouvées au niveau européen, en associant de manière constructive les États membres. Cela étant, si in fine aucune solution européenne ne peut être trouvée, il faudra envisager un plan bis pour financer cette aide alimentaire.

Au-delà des mots, l'Europe doit venir en aide à ses citoyens car ce sont eux, riches comme pauvres, qui la construisent. C'est maintenant qu'il faut créer un espace commun de solidarité, dont ce programme constitue un des piliers.

                    Monsieur le président, monsieur le premier ministre, dans le cadre du dossier d'aide aux plus démunis, le groupe MR se réjouit également du changement d'attitude de l'Allemagne et du compromis obtenu récemment au niveau européen. Ce compromis permet de sauvegarder au moins pour deux ans cette politique ô combien importante pour les plus pauvres de nos concitoyens.

Il importe toutefois de dire que ce n'est pas seulement un accord franco-allemand. Le président du Conseil a interrogé l'ensemble des représentants et ceux-ci ont marqué un accord verbal. Cet accord verbal sera officialisé lors du prochain Conseil européen de mi-décembre 2011. À cet égard, nous tenons à saluer le travail acharné de persuasion réalisé par Mme la ministre Laruelle, qui a permis, entre autres, d'aboutir dans ce dossier, ainsi que le soutien efficace du ministre Courard.

Il faut bien évidemment prendre acte du fait qu'une partie du texte de cette proposition de résolution a perdu de son intérêt compte tenu de l'accord obtenu au niveau européen. Toutefois, nous la soutiendrons en tenant compte de certains amendements que Mme Snoy présentera tout à l'heure. Ce texte comporte au moins deux éléments spécifiques auxquels il faut rester attentif. Le premier a trait à la solution apportée pour les années 2014 et suivantes. Vraisemblablement, l'accord actuel n'est pas clair à ce sujet et il convient dès lors de maintenir la pression pour aboutir à une pérennisation de cette politique, qui ne sera certes plus inscrite dans la PAC mais qui sera peut-être inscrite dans d'autres secteurs de l'Union européenne. Le deuxième élément concerne un amendement que nous avons déposé et qui a été adopté en commission, qui demande que les entités fédérées soient intégrées dans le mécanisme de solutions que la Belgique devra adopter.

Ces deux éléments méritent donc que nous votions ce texte malgré l'accord européen.

However, we will support it, taking into account some of the amendments that Ms. Snoy will submit soon. This text contains at least two specific elements to which you should pay attention. The first concerns the solution for 2014 and subsequent years. Probably, the current agreement is not clear on this subject and therefore pressure should be ⁇ ined to result in a perpetuation of this policy, which ⁇  will no longer be included in the CAP but which may be included in other sectors of the European Union. The second element concerns an amendment that we have submitted and which was adopted in a committee, which requires that the federated entities be integrated into the mechanism of solutions that Belgium will have to adopt.

These two elements deserve, therefore, that we vote this text despite the European agreement.

                    Monsieur le président, chers collègues, notre groupe a, dès le départ, apprécié la proposition de résolution. Nous avions également introduit une proposition de résolution que nous avons décidé de joindre à celle déposée par le PS.

Il est bien entendu évident que nous soutenons l'idée que l'aide alimentaire aux plus démunis doit absolument être préservée et poursuivie. Comme nos collègues, nous étions très inquiets suite à cette rupture qui avait des allures de catastrophe puisque, d'un seul coup, l'aide alimentaire en Belgique, mais aussi ailleurs, allait être réduite d'environ 80 %.

Il s'agissait donc d'agir au niveau européen, mais aussi de préparer une alternative et une compensation, si besoin, au niveau belge pour ne pas se laisser surprendre par l'hiver et éviter que les années à venir soient vraiment difficiles pour une série de personnes en situation de précarité.

Nous avons déposé des amendements en commission dont l'un a été retenu. Il s'agit d'un amendement portant sur l'aspect qualitatif de l'alimentation distribuée aux plus précarisés. C'est donc avec plaisir que nous avons reçu l'accord de nos partenaires pour demander qu'une attention particulière soit portée à la qualité nutritionnelle des aliments distribués et à leur caractère durable, en privilégiant les produits frais régionaux et de saison. Selon nous, tout le monde doit avoir accès, non seulement à une alimentation suffisante, mais aussi à une alimentation de qualité et saine à tout point de vue.

De plus, si on peut y gagner d'un point de vue environnemental en évitant de longs transports, c'est d'autant mieux.

Un autre de nos amendements portait sur la question du gaspillage alimentaire. Il nous semblait important de profiter de cette crise de l'aide alimentaire pour porter une attention sur des gaspillages structurels qui ont lieu dans la distribution et dans toute la filière alimentaire.

Nous aurions voulu qu'une demande soit introduite en vue de créer un groupe de travail au niveau fédéral chargé d'organiser une concertation avec la grande distribution et d'établir une coopération entre l'aide publique et l'aide privée de façon à éviter le grand gaspillage de vivres qui ne sont pas périmés et qui sont pourtant jetés.

It is therefore with pleasure that we have received the agreement of our partners to request that special attention be paid to the nutritional quality of distributed foods and their sustainability, prioritizing regional and seasonal fresh products. We believe that everyone should have access, not only to adequate nutrition, but also to quality and healthy food from all points of view.

Moreover, if you can gain from an environmental point of view by avoiding long transportation, it is all the better.

Another of our amendments addressed the issue of food waste. We found it important to take advantage of this food aid crisis to pay attention to the structural waste that occurs in distribution and throughout the food chain.

We would have wanted a request to be submitted for the creation of a federal working group to arrange a consultation with the major distribution and to establish a cooperation between public and private aid in order to avoid the large waste of food that is not expired and is nevertheless thrown away.

                    Cela éviterait le gaspillage, encore très important malheureusement, de vivres non périmés et pourtant jetés comme déchets. Nous continuerons donc à solliciter la mise en place d'un système poussant la grande distribution à céder ses vivres non périmés dont elle veut se débarrasser. Il faudra aborder ce système structurel.

Entre le vote en commission et aujourd'hui, un déblocage européen a eu lieu: l'Allemagne a changé d'avis et accepte de poursuivre l'aide pendant deux ans. Il nous apparaît dès lors que certains éléments de notre texte pourraient paraître inadéquats, voire périmés.

Ainsi, comme ce point est à l'ordre du jour du prochain Conseil, au début du mois de décembre, nous proposons de ne pas tenir compte des deux premiers amendements introduits.

En revanche, nous maintenons le troisième amendement, avec un accord quasi général de l'hémicycle, sur le fait que l'aide fédérale reste prévue, mais qu'en cas de non-accord au niveau européen, la même demande subsiste: que le budget fédéral compense une éventuelle perte de l'aide européenne. L'important, en ce moment, est que la solution qui intervient pour 2012 et 2013 ne nous empêche pas d'envisager le long terme: nous ne pouvons pas nous reposer sur un accord temporaire et admettre que, dans deux ans, tout s'arrête faute de financement de la part du budget agricole et que nous restions sans solution.

Notre objectif est de maintenir cette résolution dans toute sa validité et de trouver une solution à partir de 2014 pour la période s'étendant jusqu'en 2020. Il ne s'agira pas de s'y prendre au dernier moment: il est probable que le budget agricole ne jouera plus ce rôle; d'ailleurs, nous ne sommes pas non plus en faveur de la constitution de surplus et de stocks. Sans doute faudra-t-il nous tourner vers un autre budget européen pour assurer cette aide. C'est pourquoi nous aurons à réfléchir à une façon de la fournir.

Thus, since this point is on the agenda of the next Council, at the beginning of December, we propose not to take into account the first two introduced amendments.

On the other hand, we maintain the third amendment, with an almost general agreement of the hemisphere, on the fact that federal aid remains planned, but that in case of non-agreement at the European level, the same demand remains: that the federal budget compensates for any loss of European aid. The important thing, at this time, is that the solution that comes into effect for 2012 and 2013 does not prevent us from considering the long-term: we cannot rely on a temporary agreement and admit that, in two years, everything will stop due to the lack of funding from the agricultural budget and that we remain without solution.

Our goal is to maintain this resolution in its full validity and to find a solution from 2014 for the period extending until 2020. It will not be a matter of taking action at the last moment: it is likely that the agricultural budget will no longer play this role; in addition, we are also not in favor of the creation of surpluses and stocks. We will probably need to turn to another European budget to ensure this aid. Therefore, we will have to think about a way to provide it.

                    Mijnheer de voorzitter, het Vlaams Belang zal, net zoals in de commissie, wellicht als enige tegen deze resolutie stemmen.

Ik wil even onder de aandacht brengen dat men hieruit niet kan afleiden dat wij niet bekommerd zouden zijn om de ongeveer 116 000 mensen die in België nog afhankelijk zijn van voedselbanken.

Het wil ook niet zeggen dat wij tegen voedselbanken zijn, hoe graag wij ook zouden hebben dat daarop in een Westerse ontwikkelde maatschappij geen beroep meer zou moeten worden gedaan.

Wij zijn wel tegen het aanwenden van de Europese paraplu. In die zin was ik heel tevreden met het antwoord van mevrouw Laruelle op mijn vraag wat wij zouden doen met de Belgische voedselbanken indien Europa niet meer in die middelen zou voorzien. De minister had daarvoor een plan B en dat stemde mij heel gelukkig.

De betrokkenheid van Europa in deze is eigenlijk geschiedkundig gegroeid. De Europese Unie is in grote mate verantwoordelijk voor het landbouwbeleid en is als dusdanig ook verantwoordelijk geworden voor de voedseloverschotten.

Het doorsluizen van deze landbouwoverschotten naar voedselbanken was een win-winsituatie en tevens een gezonde vorm van solidariteit tussen de lidstaten.

De landbouwoverschotten namen af en de vraag naar voedselpakketten nam toe, met als gevolg dat er tekorten ontstonden, die dan weer werden aangevuld met financiële steun. Hier loopt het volgens ons mis.

Het uitdelen van voedselpakketten, interpersoonlijke solidariteit, moet zo dicht mogelijk bij de mensen gebeuren. Men moet de nood voelen om solidair te zijn en de hulp moet zo rechtstreeks mogelijk naar de behoeftigen gaan.

Dat is het mooie aan solidariteit. In het andere geval verzeilt men in instellingen en instituten waar men middelen die niet van hen zijn, overschrijft van de ene post naar de andere, waardoor er gewoonlijk ook heel wat middelen opgaan aan onkosten.

We are against the use of the European umbrella. In that sense, I was very satisfied with Mrs. Laruelle’s answer to my question what we would do with the Belgian food banks if Europe would no longer provide those resources. The minister had a plan B for that and I was very happy.

Europe’s involvement in this has actually grown historically. The European Union is largely responsible for the agricultural policy and as such has also become responsible for food surpluses.

The transfer of these agricultural surpluses to food banks was a win-win situation and also a healthy form of solidarity between Member States.

Agricultural surpluses decreased and demand for food packages increased, resulting in shortages, which were then supplemented by financial support. Here we think it goes wrong.

The distribution of food packages, interpersonal solidarity, should take place as close as possible to the people. One must feel the need to be solidary and the help must go as directly as possible to the needy.

That is the beauty of solidarity. In the other case, you are registered in institutions and institutions where you transfer resources that are not theirs from one post to another, which usually also involves a lot of resources in costs.

The European bureaucracy is too logical and money-consuming to meet these needs. Indeed, it is the national states and regions that must take care of the most needy.

                    Monsieur le président, madame la ministre, chers collègues, un accord est enfin intervenu lors du Conseil des ministres de l'Agriculture pour poursuivre pendant deux ans le financement du programme d'aide aux plus démunis grâce au budget issu de la Politique agricole commune. Il était temps! Ce programme est malheureusement encore indispensable pour un grand nombre de personnes. Cette aide européenne finance 50 % de l'approvisionnement des banques alimentaires et des associations qui aident les plus démunis.

Cet accord n'est valable que pour 2012 et 2013 mais il permet d'éviter une réduction immédiate et abrupte de l'aide alimentaire. Il s'agit donc d'un soulagement temporaire pour de nombreuses associations caritatives.

Mais quid pour 2014? Il y aura malheureusement encore des personnes démunies! Mon groupe insiste donc pour qu'une solution pérenne soit trouvée à partir de 2014. Des garanties doivent être apportées rapidement afin de rassurer les banques alimentaires et les associations.

Nous désirons soutenir fermement l'adoption d'une base juridique solide pour financer un programme d'aide alimentaire au niveau européen. Ce budget pourrait être supporté par la politique européenne de cohésion sociale. La résolution du Parlement européen et la proposition du commissaire européen aux Affaires sociales doivent donc être vraiment soutenues.

Pour conclure, mon groupe tient à rappeler l'importance de valoriser les invendus alimentaires et d'éviter le gaspillage. Cette idée ne figure pas dans cette proposition de résolution mais c'est une matière essentielle qu'il faut regarder de près. À cet effet, nous avons déposé une proposition de résolution à la Région wallonne puisque c'est à ce niveau de pouvoir que cela doit se discuter. Je vous invite à sensibiliser l'ensemble des partis pour adopter, avec nous, une démarche constructive à tous les niveaux de pouvoir afin de trouver une solution concernant les invendus alimentaires et le gaspillage.

The Council of Ministers of Agriculture has finally reached an agreement to continue for two years the financing of the program of aid to the most disadvantaged through the budget from the Common Agricultural Policy. It was time! Unfortunately, this program is still indispensable for a large number of people. This European aid funds 50% of the supply of food banks and associations that help the most disadvantaged.

This agreement is only valid for 2012 and 2013, but it avoids an immediate and abrupt reduction of food aid. This is a temporary relief for many charitable organizations.

But what for 2014? Unfortunately, there will still be poor people. My group therefore insists that a lasting solution should be found from 2014. Guarantees must be provided promptly to reassure food banks and associations.

We wish to strongly support the adoption of a strong legal basis for financing a food aid programme at European level. This budget could be supported by the European Social Cohesion Policy. The European Parliament resolution and the proposal of the European Commissioner for Social Affairs must therefore be truly supported.

To conclude, my group would like to recall the importance of valuing unsold foods and avoiding waste. This idea is not included in this resolution proposal, but it is an essential matter that needs to be looked at closely. For this purpose, we have submitted a proposal for a resolution to the Walloon Region since it is at this level of power that this must be discussed. I invite you to raise the awareness of all the parties to adopt, with us, a constructive approach at all levels of power in order to find a solution regarding unsold food and waste.

                    J'espère que le point sera inscrit à l'agenda de notre prochain Conseil européen du 13 décembre. Mais lundi, le président du Conseil a bien vérifié qu'il disposait d'une majorité qualifiée.

Je voudrais clarifier deux ou trois points. Aujourd'hui, nous ne menons pas une politique sociale! C'est bien ce qui pose le problème fondamental. Nous sommes dans le cadre de la politique agricole, dont une des mesures a un objectif social. C'est précisément ce que les six pays remettent en cause en prétextant qu'il ne s'agit plus d'un fondement de politique agricole mais d'un fondement social.

Pour 2014, reprenez les propos tenus en commission: j'ai toujours dit que la solution que l'on cherchait n'était pas une solution à 150 ans, mais pour deux ans. Aussi ne nous étonnons pas aujourd'hui que la solution envisagée le soit pour deux ans! Relisez les procès-verbaux des réunions de commission! Il a toujours été dit que l'on cherchait une solution pour deux ans. Pourquoi uniquement pour deux ans? Parce que pour la nouvelle phase de programmation, M. Barroso a déjà dit qu'il inscrirait cette politique non plus dans une politique agricole mais bien dans une politique sociale.

Il convient donc de rester attentif, de continuer à se battre pour l'inscrire dans la politique sociale. Je voudrais vous rassurer. Je ne connais pas la teneur des discussions franco-allemandes, seulement les résultats: cela nous permet de débloquer le dossier. Mais je peux en tout cas vous affirmer que la Belgique ne s'est pas du tout engagée à ne plus mener ce type de politique après 2014. Par contre, au Conseil européen des ministres de l'Agriculture, chacun s'accorde à dire qu'il ne doit plus s'agir d'une politique agricole, parce que nous n'avons plus de surplus, mais qu'il faut pouvoir la poursuivre au niveau d'une politique de cohésion sociale.

Enfin, je voudrais remercier le parlement de son implication dans ce dossier essentiel.

Zoals collega Somers al heeft aangehaald willen wij met dit voorstel een van de aanbevelingen van de bijzondere commissie Spoorwegveiligheid die werd opgericht naar aanleiding van het incident in Buizingen, in wetgeving omzetten. Een van de conclusies van die bijzondere commissie betrof immers de werking van de veiligheidsinstantie, de DVIS. De DVIS die moet toezien op de spoorwegveiligheid bleek volgens de conclusies uit het rapport onvoldoende ontwikkeld en over onvoldoende instrumenten te beschikken om zijn taak naar behoren uit te voeren. Het voorliggend wetsvoorstel wil dat verhelpen en de DVIS nieuwe instrumenten geven om daadwerkelijke te kunnen optreden.

Momenteel heeft de DVIS immers alleen de mogelijkheid om het certificaat of de vergunning van de infrastructuurbeheerder of van de spoorwegonderneming in te trekken, een sanctie die dikwijls niet in verhouding staat tot de vastgestelde tekortkomingen en daarom ook nog nooit werd gebruikt. Met dit wetsvoorstel krijgt de DVIS de mogelijkheid om bij een overtreding een administratieve sanctie op te leggen. Het wetsvoorstel voorziet daarom voor iedere mogelijke inbreuk op de veiligheidsvoorschriften, in een specifiek boetebedrag. Het is eigenlijk een beetje vergelijkbaar met de indeling van verkeersovertredingen op de weg. Er worden een aantal categorieën ingevoerd, van eerste, tweede en derde graad, naargelang het risicogedrag dat de overtreding inhoudt.

Wanneer spoorwegondernemingen of de infrastructuurbeheerder de regels niet naleven zullen zij hiervoor dan ook gepast bestraft kunnen worden, afhankelijk van de mate waarin de overtreding het leven van de reizigers en/of het personeel in gevaar brengt. Ik denk bijvoorbeeld aan concrete problemen zoals de seinvoorbijrijdingen of het geval waarbij vorig jaar een aantal keren iemand zonder vergunning een trein bestuurde. Gepaste bestraffing is op dat moment essentieel.

In de lijn van de grote eensgezindheid bij de conclusies en aanbevelingen van de bijzondere commissie Spoorwegveiligheid werd dit ook unaniem goedgekeurd in de commissie. Ik wil dan ook alle collega’s bedanken voor de constructieve behandeling van dit wetsvoorstel.

Mr. Speaker, I would like to explain what the present bill is about.

As colleague Somers has already cited, with this proposal we want to translate into legislation one of the recommendations of the special committee Railway Safety established following the incident in Buizingen. Indeed, one of the conclusions of that special committee concerned the functioning of the security authority, the DVIS. According to the conclusions of the report, the DVIS, which is responsible for monitoring railway safety, was insufficiently developed and had insufficient instruments to properly carry out its task. The present bill aims to remedy this and give the DVIS new instruments to act effectively.

In fact, at present, DVIS has only the possibility to withdraw the certificate or authorisation of the infrastructure manager or the railway undertaking, a sanction which is often disproportionate to the deficiencies identified and therefore never used. This bill gives the DVIS the possibility to impose an administrative sanction in the event of an infringement. The bill therefore provides for any possible breach of the safety rules, a specific fine amount. It is actually a bit similar to the classification of traffic offences on the road. A number of categories are introduced, of first, second and third degree, depending on the risk behavior involved in the infringement.

If railway undertakings or infrastructure managers do not comply with the rules, they will be subject to appropriate penalties, depending on the extent to which the infringement endangers the lives of passengers and/or staff. I think, for example, of concrete problems such as the signalling passes or the case where last year a number of times someone without a license was driving a train. Appropriate punishment is essential at this time.

In line with the great consensus in the conclusions and recommendations of the special committee Railway Safety, this was also unanimously approved in the committee. I would like to thank all colleagues for the constructive treatment of this bill.

Nous y serons attentifs, comme nous serons particulièrement vigilants quant à la correcte dotation du fonds budgétaire, qui doit permettre le fonctionnement de cette autorité de sécurité.

                    Mijnheer de voorzitter, collega’s, onze fractie steunt dit voorstel van resolutie volledig. Misschien zijn er soms wel andere klemtonen gelegd, maar over de essentie zijn wij het eens.

De discussie over de doeltreffendheid van de hulp is van groot belang. We verwachten eigenlijk wel dat ons land zich inzet opdat het vierde High Level Forum in Zuid-Korea een succes zou worden. Hiermee willen we ook het signaal geven dat we onze minister steunen om actief deel te nemen opdat het daar een succes zou worden.

Toch heeft CD&V ook een paar vragen en wil ze klemtonen leggen. Het is wel jammer dat de minister hier niet aanwezig is. In de commissie heeft de minister ons beloofd en hadden we eigenlijk zelfs afgesproken dat hij ons zou informeren over de afloop van de discussie en de gesprekken die hij maandag op Europees vlak heeft gehad. Hij zou ons ook informeren over het standpunt dat Europa zou innemen.

We hebben in de commissie ook het signaal gegeven dat het Parlement sterker zou moeten worden betrokken bij de voorbereiding van dergelijke internationale conferenties. Ook in de aanloop naar deze conferentie kon er beter overleg zijn geweest. Alleen al de vaststelling dat de Senaat gisteren een advies uitbracht over een standpunt van de Europese Commissie dat maandag werd besproken, verduidelijkt dat er betere coördinatie kon zijn geweest om de adviezen samen te brengen en op tijd samen te leggen om tot een Belgisch standpunt te komen.

Onze vraag is dat de minister en ons land de kans zouden benutten om in de toekomst dergelijke internationale conferenties beter voor te bereiden en de ngo’s daarbij te betrekken. Vanuit hun terreinkennis en ervaringen hebben zij een visie op de uitdagingen, de moeilijkheden en de opportuniteiten betreffende, onder meer, dit internationaal forum.

Qua voorbereiding is het dus een beetje een gemiste kans, maar we willen met deze resolutie in alle geval een breed gedragen mandaat geven om de conferentie mee te trekken en ervoor te zorgen dat ze een succes wordt.

Our question is that the Minister and our country should take advantage of the opportunity to better prepare such international conferences in the future and involve NGOs. Als hoofdindiener van deze resolutie wil ik mijn collega’s van de N-VA danken voor de amendementen, de verbetering van de tekst. Ik wil ook mijn collega van CD&V danken voor de verbeteringen die hij heeft aangebracht in de tekst. De collega’s van Groen! hebben, zoals verwacht, ook onze tekst verbeterd door meer nadruk te leggen op de klimaatverandering. De collega’s van liberale signatuur hebben een goede wijziging aangebracht, namelijk meer aandacht voor de lokale actoren in onze partnerlanden, zodat zij mee kunnen controleren of het ontwikkelingsgeld goed gebruikt wordt. J'insisterai sur divers points qui me tiennent à cœur dans l'efficacité de l'aide au développement. En effet, nous pensons qu'il s'agit d'un sujet capital. Il est fréquemment question du montant de cette aide au développement avec pour objectif d'atteindre 0,7 % du produit intérieur brut, mais l'efficacité est encore plus importante: il s'agit de voir si cette aide apporte aux pays bénéficiaires un progrès dans leur développement, en particulier dans un développement durable.

La première exigence contenue dans cette résolution est essentielle à nos yeux: insister sur la cohérence des politiques. Sans cette cohérence entre la politique de l'aide au développement et d'autres politiques qui produisent un impact extérieur à notre pays et à l'Europe, il ne servirait à rien de soutenir et financer des projets aussi louables, sociaux et environnementaux soient-ils. Nous visons ainsi les politiques, commerciale et agricole ou des investissements à l'étranger qui ne tiendraient pas compte de la capacité propre du pays à se développer et anéantiraient ainsi l'efficacité de l'aide.

Lors d'un forum de l'Union interparlementaire, nous avons pu entendre les représentants des ACP qui ont témoigné du fait que certains aspects de la politique commerciale européenne, en particulier l'obligation d'ouvrir leurs frontières à des importations, pouvaient anéantir toute l'efficacité des projets de développement agricole financés par l'aide au développement.

Nous savons aussi que certains aspects de la politique agricole commune peuvent engendrer des effets négatifs sur les possibilités de développement d'une agriculture paysanne dans les pays du Sud, étant donné que nos produits sont exportés à des prix tellement compétitifs qu'ils rendent non compétitifs les produits de l'agriculture locale.

I will emphasize several points that hold me to heart in the effectiveness of development aid. In fact, we think this is a major issue. The first requirement contained in this resolution is essential to our view: insist on policy coherence. Without this coherence between development aid policy and other policies that produce an external impact on our country and Europe, it would be useless to support and finance projects as praiseworthy, social and environmental as they may be. Thus, we target policies, trade and agriculture or foreign investment that would not take into account the country’s own capacity to develop and thus annihilate the effectiveness of aid.

At an Interparliamentary Union forum, we were able to hear ACP representatives testify that certain aspects of European trade policy, in particular the obligation to open their borders to imports, could undermine the full effectiveness of agricultural development projects financed by development aid.

We also know that certain aspects of the common agricultural policy can have negative effects on the opportunities for developing a peasant agriculture in the South, since our products are exported at so competitive prices that they make local agricultural products uncompetitive.

Nous voulons qu'elle soit appliquée et que l'on reste constamment vigilant par rapport à la cohérence de nos politiques.

Le deuxième point qui nous est cher est l'appropriation démocratique de l'aide. Les acteurs des pays bénéficiaires doivent pouvoir participer à l'utilisation de l'aide au développement, tant la population elle-même, ses représentants associatifs que ses représentants politiques. Puisque nous sommes ici, au parlement, je tiens aussi à dire à quel point nous attachons de l'importance à ce que les parlements nationaux et, en miroir, nos parlements puissent être associés à la programmation et à l'appropriation des flux d'aide, à la façon dont ils sont distribués et gérés. Nous avons d'ailleurs approuvé un amendement introduit par M. de Donnea sur la question de l'appropriation par les parlements nationaux.

Un troisième point qui nous tient à cœur est l'ancrage systématique des questions de genre, dont la défense du droit des femmes dans tous les projets d'aide au développement et une attention particulière aux femmes qui, dans beaucoup de pays et de sociétés, sont encore discriminées, n'ont pas de droit d'accès à la propriété, de droit d'accès à l'héritage et ne peuvent pas accéder non plus à une série de professions. Nous pensons qu'à tout moment, notre aide au développement doit porter une attention particulière au droit des femmes.

Enfin, nous avons introduit un amendement qui vise à faire prévaloir les objectifs de développement durable à un objectif pur et simple de croissance économique qui nous paraît important. En effet, on n'exporte pas une croissance économique qui soit non durable, qui exploite excessivement les ressources ou qui ne respecte pas les droits sociaux. On sait que certains acteurs dans l'aide au développement souhaitent aujourd'hui mettre l'accent particulièrement sur la croissance. Nous pensons qu'une croissance qui ne fait pas attention au long terme, aux générations futures et à la préservation des ressources est tout à fait inappropriée.

We also believe that investments made by some of our companies, whether they are agricultural investments in large monoculture or in the exploitation of mining and oil resources, can also cause many social problems, violations of human rights and thus annihilate the efforts made in the framework of our development aid precisely to respect a whole set of principles and consistency with sustainable development. This question of consistency is very important for us. We want Belgium to defend it at the Busan High-Level Forum. We want it to be implemented and to remain constantly vigilant regarding the consistency of our policies.

The second point that is dear to us is the democratic appropriation of aid. Actors in the beneficiary countries should be able to participate in the use of development aid, both the population itself, its association representatives and its political representatives. Since we are here in Parliament, I also want to say how much we attach to the importance that national parliaments and, in the mirror, our parliaments can be associated with the programming and appropriation of aid flows, with the way they are distributed and managed. We also approved an amendment introduced by Mr. Donnea on the question of appropriation by national parliaments.

A third point that keeps us at heart is the systematic anchoring of gender issues, including the defense of women’s rights in all development aid projects and a particular attention to women who, in many countries and societies, are still discriminated, have no right of access to property, right of access to inheritance and cannot access a range of professions. We believe that at all times, our development aid should pay special attention to women’s rights.

Finally, we introduced an amendment that aims to put the Sustainable Development Goals ahead of a purely economic growth goal that we consider important. We do not export economic growth that is unsustainable, that exploits resources excessively or that does not respect social rights. It is well known that some actors in development aid now want to put a particular emphasis on growth. We believe that growth that does not pay attention to the long-term, future generations and resource conservation is completely inappropriate.

Si nous voulons renforcer l'efficacité de l'aide, notamment de l'aide publique au développement, nous devons aussi renforcer la bonne gouvernance dans les pays que nous aidons. Une façon logique de renforcer la bonne gouvernance dans ces pays, c'est de renforcer la capacité des parlements de collaborer avec le gouvernement à la définition de l'affectation de l'aide, mais aussi au contrôle de son exécution.

En règle générale, nous avons tout intérêt à renforcer également, dans les pays en voie de développement que nous aidons, les structures étatiques qui contrôlent l'exécution des budgets et la régularité des comptes, en d'autres termes qui contrôlent l'honnêteté des gouvernements. En effet, dans la mesure où certains pays développent des organes de contrôle efficaces, des cours des comptes, des chambres d'auditeurs, quel que soit le nom, efficaces, cela signifie que nous pouvons également avoir davantage recours à l'aide budgétaire sectorielle ou générale.

L'aide budgétaire sectorielle ou générale est évidemment une façon d'injecter beaucoup plus rapidement des liquidités dans les économies que nous aidons en vue de les aider à avoir dans certains secteurs des politiques efficaces. Our resolution is fully in line with the Common Position of the European Union for the Fourth Forum on Aid Effectiveness, which was adopted by the Council on Foreign Affairs on 14 November. You find a lot of common points between our resolution and this common position of the Union.

If we want to increase the effectiveness of aid, including public development aid, we must also strengthen good governance in the countries we help. A logical way to strengthen good governance in these countries is to strengthen the capacity of parliaments to collaborate with the government in defining the allocation of aid, but also in controlling its implementation.

As a general rule, it is in our interest to also strengthen, in the developing countries we help, the state structures that control the execution of budgets and the regularity of accounts, in other words, that control the honesty of governments. Indeed, in so far as some countries develop effective control bodies, auditing courts, auditing chambers, whatever the name, effective, this means that we can also use more sectoral or general budgetary assistance.

Sectorial or general budgetary aid is obviously a way to inject much faster liquidity into the economies we help in order to help them have in certain sectors effective policies. What very often hampers European cooperation, either at the level of the Union or at the level of the States, is that public procurement procedures, decision-making procedures, when it comes to implementing concrete projects in one or another country, are often extremely heavy and extremely long. We are much less efficient when it comes to doing this than some emerging countries like China, India or Brazil.

Une étude qui vient d'être publiée par l'OCDE avance toute une série d'arguments qui visent à démontrer que les craintes que l'on a, par exemple, à l'égard de la présence de la Chine en Afrique, ne sont pas du tout fondées et que la plupart des reproches théoriques et procès d'intention que l'on peut faire à l'égard de ce pays se dégonflent. Et il en va de même pour les autres pays émergents.

Par conséquent, les risques que l'on croyait voir poindre à l'horizon ne sont pas fondés. Je pense ici, par exemple, à ceux qui disent que l'augmentation de la part des pays émergents dans l'aide entraînerait une augmentation de l'endettement, de la corruption, un relâchement en termes de gouvernance.

En tout cas, d'après une étude publiée dernièrement par l'OCDE – il s'agit d'une publication annuelle – concernant les perspectives économiques pour l'Afrique, tous ces spectres se sont, en quelque sorte, dégonflés.

Cela ne signifie pas que le risque est réduit à zéro, mais que, jusqu'à présent, les risques ne se sont pas matérialisés à la hauteur et à la mesure de ce que l'on pouvait craindre.

Pour rendre notre aide plus efficace, nous avons, selon moi, tout intérêt à lancer et à développer des opérations triangulaires avec une série de pays émergents qui sont déjà extrêmement actifs.

J'en arrive à ma troisième remarque.

I come to the second comment I wanted to make.

We have every interest in collaborating with emerging countries, in combining our efforts – I mean here, for example, with African countries that are our partners – rather than spending our time with disbelief or looking at them as a fain dog.

A study recently published by the OECD puts forward a series of arguments aimed at demonstrating that the fears we have, for example, about China’s presence in Africa, are not at all grounded and that most theoretical reproaches and intent trials that can be made against this country are fading away. The same goes for other emerging countries.

Therefore, the risks that were believed to be on the horizon are unfounded. I think here, for example, of those who say that increasing the share of emerging countries in aid would result in an increase in debt, corruption, a relaxation in terms of governance.

In any case, according to a study recently published by the OECD – this is an annual publication – on the economic prospects for Africa, all of these spectrums have somehow deflated.

This does not mean that the risk is reduced to zero, but that, so far, the risks have not materialized to the height and measure of what could be feared.

To make our aid more effective, I think we have every interest in launching and developing triangular operations with a number of emerging countries that are already extremely active.

I come to my third comment.

In my opinion, the aid will be even more effective as it is organized at the regional level in Africa.

L'Union africaine a très bien compris que c'est au travers d'une série d'organisations régionales décentralisées qu'il faut travailler si on veut renforcer l'efficacité des politiques de développement et affronter les vrais défis à l'échelle régionale ou continentale.

Quatrième remarque. Nous allons devoir tenir compte du fait que l'aide publique au développement n'est plus la principale source de financement du développement, et c'est notamment le cas en Afrique. De nouveaux acteurs interviennent. Il y a des fondations privées qui ont des budgets considérables, comme la Fondation Bill Gates qui intervient dans la lutte contre certaines maladies. Il y a également des fonds souverains de pays émergents. Il y a les opérations de troc, de la Chine ou d'autres pays, qui échangent du pétrole ou du cuivre contre la construction de routes, par exemple.

In order for aid to contribute to addressing the major challenges facing subregional groups in Africa, it must aim to strengthen regional structures. Epidemiological problems, health problems, climate problems – which do not know borders – or the problems of building large cross-regional infrastructures will not be solved by simply working country by country.

We need to help emerging regional organizations, which are increasingly strong in Africa. Indeed, the African Union has recognized a number of subregional organizations, such as the Economic Community of West African States or the East African Community, which are its pillars. The African Union has very well understood that it is through a series of regional decentralized organizations that we must work if we want to strengthen the effectiveness of development policies and address the real challenges at the regional or continental level.

Het is een belangrijke tekst voor een belangrijke conferentie. Eind deze maand wordt in Busan gesproken over de doeltreffendheid van hulp en ontwikkelingssamenwerking. Dat is een zeer belangrijk debat. Wanneer men zich wil buigen over de noodzaak en de opportuniteit van ontwikkelingswerk, is er immers een draagvlak nodig bij de publieke opinie. Accountability wint immers meer en meer terrein. Het is nodig rekenschap te geven voor de besteding van publieke middelen. De conferentie in Busan is daarin een zeer belangrijke stap.

Wij hebben ook een Belgische regering nodig die de actuele ontwikkelingen in de ontwikkelingssamenwerking ernstig neemt en die zich buigt over manieren om onze ontwikkelingssamenwerking doeltreffender te maken.

Ik heb bijzonder genoten van het betoog van collega de Donnea. Hij gaf al een aanzet tot de grote vragen waarover wij ons de komende maanden moeten buigen. De uitdagingen zijn enorm en de context is eigenlijk veranderd. Het is niet mijn bedoeling vandaag het debat te voeren, maar ik meen dat Busan en de komende begrotingsbesprekingen over de beleidsnota voor ontwikkelingssamenwerking belangrijk zullen zijn. Het federale Parlement moet zich uitspreken over de vraag of ontwikkelingssamenwerking nog zinvol is, en zo ja, hoe wij ze vorm zullen geven.

De afgelopen twee jaar hebben wij kunnen zien, vooral op budgettair vlak, dat de trend negatief is. Ons land heeft de doelstelling van 0,7 % niet gehaald, noch in 2010, noch in 2011. Integendeel, er is een neerwaartse trend.

The challenges are huge and the context has actually changed. It is not my intention to conduct the debate today, but I believe that Busan and the upcoming budget discussions on the policy note on development cooperation will be important. The Federal Parliament must decide whether development cooperation is still meaningful, and if so, how we will shape it.

Over the past two years, we have seen, especially on budgetary level, that the trend is negative. Our country has not achieved the target of 0.7%, neither in 2010, nor in 2011. On the contrary, there is a downward trend.

De wereld is sterk veranderd en, zoals collega de Donnea daarnet ook al heeft gezegd, er zijn nu andere partners op het terrein. Er zijn privéactoren en nieuwe landen zijn donor, de BRIC-landen bijvoorbeeld, die geen ontwikkelingslanden meer zijn, maar nieuwe donoren met een eigen manier om aan ontwikkelingssamenwerking te doen, wat ons, het oude Europa als het ware, voor een aantal uitdagingen plaatst. De manier waarop China aan ontwikkeling doet in een land als Congo, stelt ons voor een zeer groot aantal uitdagingen.

Het is moeilijk om nog conditionaliteit van ontwikkelingssamenwerking en van hulp op tafel te leggen, als een zeer groot land, met name China, zich weinig aantrekt van die conditionaliteit en zeer weinig voorwaarden oplegt aan een land als Congo. Het is ook maar de vraag of landen als China en Rusland evenveel waarde hechten aan begrippen als transparantie, ownership en wederkerigheid, als wij. Er gelden misschien andere spelregels, er gelden andere wetten.

Dus ik denk dat we de komende regeerperiode toch wel een fundamenteel debat moeten wijden aan ontwikkelingssamenwerking. Als ik me goed herinner, werd er in 2008 geprobeerd zo’n debat op te starten en heeft minister Charles Michel indertijd geprobeerd om een nieuwe basiswet internationale samenwerking tot stand te brengen. Daar is niet veel van terechtgekomen, maar ik mag toch verwachten dat de komende regering daar werk van zal maken.

It is difficult to put conditionality of development cooperation and aid on the table, as a very large country, especially China, attracts little of that conditionality and imposes very few conditions on a country like Congo. It is also a question of whether countries like China and Russia attach as much value to concepts such as transparency, ownership and reciprocity as we do. There may be different rules of the game, there may be different laws.

So I think we should devote a fundamental debate to development cooperation in the coming term. If I remember correctly, in 2008 there was an attempt to initiate such a debate and then Minister Charles Michel attempted to establish a new basic law of international cooperation. Not much of this has been done, but I can still expect the next government to work on that.

Nochtans moeten wij dat doen, niet alleen uit internationale solidariteit, maar ook omdat het in ons eigen belang is om kansen op ontwikkeling te bieden aan landen in het Zuiden. Wij worden dagelijks geconfronteerd met problemen zoals de instroom van klimaatvluchtelingen en van grote migratiestromen. Maar als wij elk land gelijke kansen op ontwikkeling geven, komt dat ook ten goede aan onze situatie hier in Europa.

Met budgetsteun als manier om aan ontwikkelingssamenwerking te doen, moeten wij wel opletten. Collega de Donnea sprak daarnet over de sectorale budgetsteun. Op het moment is het aandeel aan budgetsteun in onze ontwikkelingssamenwerking al bij al nog minimaal, vanwege onder andere de bekommernissen in verband met transparantie, goede besteding en controle en vanwege de vrees voor corruptie. Laten wij dus toch voorzichtig zijn als wij stappen willen zetten om de budgetsteun op te trekken.

Over de kwantiteit heb ik reeds gesproken. Hoe dan ook, als men – ik heb het ook gezegd in de commissie – een doeltreffende ontwikkelingssamenwerking tot stand wil brengen, moet die in de eerste plaats voldoende groot zijn met dus ook een voldoende groot budget. Wij halen dit jaar 0,57 % van het bbp, terwijl wij in 2010 reeds 0,7 % hadden moeten bereiken. Wij zullen zien wat de komende begroting ons brengt en wat de nieuwe regering zal beslissen inzake ontwikkelingssamenwerking.

Een ontwikkelingssamenwerking die zeer groot is in volume, kan worden tegengewerkt door een handelsbeleid dat net die kansen op ontwikkeling van landen in het Zuiden afremt, blokkeert. There is also a different budget climate. It is no longer obvious to spend a lot of money on development cooperation. However, we must do so, not only out of international solidarity, but also because it is in our own interest to provide development opportunities to countries in the South. We are faced daily with problems such as the influx of climate refugees and large migration flows. But if we give every country equal opportunities for development, it will also benefit our situation here in Europe.

With budget support as a way to do development cooperation, we must be careful. Collega de Donnea spoke about sectoral budget support. At the moment, the proportion of budget support in our development cooperation is already minimal, due, among other things, to concerns regarding transparency, good spending and control and due to the fear of corruption. So let us be careful if we want to take steps to reduce budget support.

I have already talked about quantity. In any case, if one wants to ⁇  an effective development cooperation – I have also said it in the committee – it must first be sufficiently large and therefore also a sufficiently large budget. This year we reach 0.57 % of GDP, while in 2010 we should have already reached 0.7 %. We will see what the next budget brings us and what the new government will decide on development cooperation.

I will conclude with a comment on coherence, which should also be discussed in the upcoming debate. It’s a bit of my horse. A development cooperation that is very large in volume can be countered by a trade policy that blocks just those opportunities for development of countries in the South. Therefore, please also provide the necessary incentives in trade policy and other areas to maximise development opportunities.

Ladies and gentlemen, I am not going further. We must have an absolute debate on the subject in our House in the coming months, but the debate will take place in other halls and at other times.

                    Monsieur le président, monsieur le premier ministre, mes chers collègues, le travail en commission des Relations extérieures, on l'a déjà dit, a été très constructif et nous pouvons nous en réjouir. C'est ainsi que nous avons pu ajuster certains aspects pour parvenir à un large compromis, tout en gardant l'essence de ce texte dont je suis cosignataire.

Notre assemblée aura ainsi défini vis-à-vis du gouvernement une position claire et forte, avec des nuances indispensables, qu'il pourra défendre lors du quatrième Forum de haut niveau sur l'efficacité de l'aide qui se tiendra à la fin du mois.

Comme je l'ai déjà dit en commission, une politique de développement durable et cohérente est, pour mon groupe, essentielle. Les Objectifs du Millénaire semblent ainsi plus que jamais devoir guider nos politiques, a fortiori dans un contexte qui engendre le repli sur soi. L'efficacité de cette aide est centrale et doit être renforcée, de même que sa cohérence à l'échelle internationale. Il nous faut insister sur son appropriation, de sorte que les pays bénéficiaires puissent assurer la gestion de leur propre développement en consultant tous les acteurs concernés.

À mes yeux de président du groupe de travail sur le Fonds belge de la sécurité alimentaire, et de manière générale dans nos travaux parlementaires, les objectifs que constituent l'éradication de la pauvreté, la défense des droits et la lutte contre les inégalités doivent orienter nos actes et nos politiques. Il s'agit de combattre plus efficacement et de manière cohérente l'inégalité et la pauvreté qui sont, hélas, toujours une réalité qui ne cesse de s'aggraver.

Des objectifs ambitieux et concrets doivent être poursuivis, notamment pour que les actions de notre coopération au développement – que je salue au passage – se concentrent sur des questions essentielles comme l'implication démocratique des acteurs pertinents des pays aidés, le développement de la société civile ou l'indispensable égalité des genres et la reconnaissance du rôle fondamental joué par les femmes.

Mr. Speaker, Mr. Prime Minister, my colleagues, the work in the Committee on Foreign Relations, as we have said, has been very constructive and we can look forward to it. This is how we have been able to adjust some aspects to reach a broad compromise, while retaining the essence of this text of which I am a co-signature.

Our Assembly will thus define a clear and strong position, with indispensable nuances, towards the Government, which it will be able to defend at the Fourth High-Level Forum on Aid Effectiveness that will be held at the end of the month.

As I have already said in the committee, a sustainable and coherent development policy is, for my group, essential. The Millennium Goals seem thus more than ever to have to guide our policies, a fortiori in a context that generates self-determination. The effectiveness of this aid is central and must be strengthened, as well as its international coherence. We must emphasize its appropriation, so that beneficiary countries can manage their own development by consulting all relevant stakeholders.

In my view as the Chairman of the Working Group on the Belgian Fund for Food Security, and generally in our parliamentary work, the objectives of poverty eradication, the defense of rights and the fight against inequalities must guide our actions and policies. It is about fighting inequality and poverty more effectively and consistently, which are, unfortunately, always a reality that is constantly worsening.

Ambitious and concrete objectives must be pursued, in particular to ensure that the actions of our development cooperation – which I welcome in the passage – focus on key issues such as the democratic involvement of relevant actors in the aided countries, the development of civil society or the indispensable gender equality and the recognition of the fundamental role played by women.

Mais cette résolution que nous allons adopter tient également compte d'un thème qui, vous le savez, me tient à cœur, à savoir celui de la sécurité alimentaire. La sécurité alimentaire sera de plus en plus un défi, mais surtout un impératif dans un monde toujours plus densément peuplé: pour 7 milliards d'habitants, 1 milliard souffre de famine et 1 décès dû à la malnutrition se produit toutes les quatre secondes.

Par ailleurs, le rôle du secteur privé à but lucratif s'avère également central dans le développement de la croissance économique, mais il se doit bien évidemment d'être régulé, notamment en interdisant, par exemple, le recours aux paradis fiscaux: le but est bien entendu d'arriver à un développement plein et durable au profit des populations locales en assurant une transparence maximale comme garant de l'efficacité de l'aide que nous devons continuer impérativement à apporter.

Cette transparence passera également par un renforcement de l'information de notre parlement et de la société civile afin de profiter des remarques et interrogations constructives de tout un chacun.

Enfin, l'efficacité et la cohérence de l'aide sont au centre du travail de coopération au développement. Aussi, les travaux de ce forum n'en seront que d'autant plus cruciaux, a fortiori en cette période de crise que d'aucuns pourraient prendre pour prétexte et restreindre, voire abandonner leur devoir de solidarité.

Car l'amélioration de la qualité de la vie de chacun, quel que soit son continent, est un devoir lui aussi de cohérence avec les valeurs les plus profondes qui nous animent.

But this resolution that we are going to adopt also takes into account a theme that, you know, holds me at heart, namely that of food security. Food security will become increasingly a challenge, but above all an imperative in an increasingly densely populated world: for 7 billion inhabitants, 1 billion suffer from hunger and 1 death due to malnutrition occurs every four seconds.

Furthermore, the role of the lucrative private sector is also central in the development of economic growth, but it must obviously be regulated, in particular by prohibiting, for example, the use of tax havens: the goal is of course to reach full and sustainable development for the benefit of local populations by ensuring maximum transparency as a guarantee of the effectiveness of the aid that we must imperatively continue to provide.

This transparency will also go through a boost of information from our Parliament and civil society in order to take advantage of everyone’s constructive comments and questions.

Finally, the effectiveness and consistency of aid are at the heart of development cooperation work. Therefore, the work of this forum will only be all the more crucial, a fortiori in this period of crisis that some might take as a pretext and restrict, or even abandon their duty of solidarity.

For the improvement of the quality of life of everyone, regardless of their continent, is also a duty of coherence with the deepest values that animate us.
