                    Monsieur le président, chers collègues, l'incident survenu en août 2008 sur le site de l'Institut national des Radioéléments (IRE) à Fleurus avait été immédiatement suivi d'une motion de la Chambre, une recommandation qui préconisait la mise sur pied d'une sous-commission Sécurité nucléaire.

La création de cette sous-commission témoignait de l'attention et de la volonté de notre parlement d'analyser, de proposer et d'assurer à l'IRE un niveau maximal de sûreté et de sécurité nucléaire et de radioprotection, ainsi qu'une meilleure communication à l'égard des riverains et de l'ensemble de nos concitoyens. Une des missions confiées à la sous-commission Sécurité nucléaire visait l'examen des aspects éventuellement non traités lors de la législature précédente, relatif à cet incident survenu à l'IRE en août 2008.

L'IRE est, rappelons-le, une institution de pointe en matière de médecine nucléaire par la production de radio-isotopes, notamment l'iode 131. Cette activité concerne tant la phase de diagnostic que celle du traitement de cancers. Il s'agit bien là non seulement d'un enjeu majeur de santé publique, mais aussi d'un enjeu de recherche et de développement pour l'avenir de notre pays.

Évidemment, l'importance du rôle et des missions de l'IRE ne modifie en rien l'exigence de sécurité des travailleurs et/ou des riverains du site. Même si des avancées ont été observées au niveau de l'IRE, des améliorations doivent encore être apportées.

La proposition de résolution dont nous traitons aujourd'hui vise donc non seulement la sécurité nucléaire, qu'il convient de maximiser, mais aussi l'amélioration et la transparence de la communication de l'IRE lors d'incidents.

Mr. Speaker, dear colleagues, the incident that occurred in August 2008 at the site of the National Institute of Radio Elements (IRE) in Fleurus was immediately followed by a motion of the House, a recommendation that advocated the establishment of a sub-commission Nuclear Security.

The creation of this subcommittee demonstrated the attention and willingness of our parliament to analyze, propose and ensure to the IRE a maximum level of nuclear security and nuclear security and radiation protection, as well as a better communication with respect to the neighbors and all our fellow citizens. One of the tasks entrusted to the Nuclear Safety Subcommittee was to examine aspects that may not have been addressed in the previous legislature, relating to this incident that occurred to the IRE in August 2008.

The IRE is a leading institution in nuclear medicine through the production of radioisotopes, notably iodine 131. This activity concerns both the diagnostic phase and the treatment of cancer. This is not only a major public health issue, but also a research and development issue for the future of our country.

Obviously, the importance of the role and missions of the IRE does not alter the safety requirement of workers and/or residents of the site. Although progress has been observed at the IRE level, improvements still need to be made.

The resolution proposal that we are discussing today is therefore aimed not only at nuclear security, which should be maximized, but also at improving and transparency of the IRE communication in case of incidents.

                    Mais si la proposition initiale avait le grand mérite de poser des questions adéquates et de souligner les manquements constatés suite aux différents incidents survenus ces dernières années à l'IRE, les considérants et les demandes qui étaient formulés ne pouvaient satisfaire complètement les attentes et les propositions des différents groupes.

C'est pourquoi les débats en sous-commission Sécurité nucléaire ont été intenses et passionnés, chacun souhaitant sincèrement avancer pour améliorer le texte initial déposé par Catherine Fonck et renforcer ainsi réellement et concrètement la sécurité et l'information en cas de crise.

À titre personnel et à l'instar de mes collègues, je me réjouis sincèrement du travail constructif qui a été réalisé, travail qui a permis d'améliorer la qualité, l'efficacité du texte en l'impliquant dans une réalité technique et technologique. Car si l'on souhaite souvent atteindre la perfection, il ne faut pas oublier que derrière toute proposition législative, il y a une réalité de terrain, une réalité scientifique et une réalité technologique.

Á titre d'exemple, deux points du dispositif initial entraient en contradiction. L'un de ces points évoquait l'obligation pour l'IRE de réduire ses émissions d'iode pour atteindre le niveau zéro. Un autre point évoquait l'obligation de réduire les limites autorisées d'émissions selon les avancées.

La nouvelle formulation contenue dans le texte définitif, à savoir "tendre vers le niveau d'émission zéro" permet donc de maintenir l'exigence de moins d'émissions, mais dans un cadre et une réalité technologique réaliste et évolutive.

Chers collègues, sous l'impulsion du président de la sous-commission Sécurité nucléaire dont je veux saluer ici l'action, nous avons opté pour le modèle du consensus qui nous permet de vous soumettre ce texte totalement amendé, qui rencontre les attentes de l'ensemble des groupes. Il a d'ailleurs été voté à l'unanimité en commission de l'Intérieur.

Cela permettra, j'en suis sûr, d'améliorer concrètement la sécurité, de clarifier et de coordonner la communication de l'IRE.

La vice-première ministre et ministre de l'Intérieur s'est d'ailleurs engagée à exécuter les recommandations formulées, ce dont je ne peux que me réjouir.

Pour des sujets aussi importants et qui me tiennent particulièrement à cœur, je me réjouis que la bonne volonté et l'implication de chacun et de chacune permette au parlement de jouer un rôle majeur dans cet enjeu qu'est l'amélioration de la sécurité nucléaire.

But while the initial proposal had the great merit of asking adequate questions and highlighting the shortcomings found following the various incidents that occurred in recent years at the IRE, the considerations and requests that were made could not fully satisfy the expectations and proposals of the various groups.

This is why the discussions in the Nuclear Safety Subcommittee were intense and passionate, each of whom sincerely wanted to move forward to improve the original text submitted by Catherine Fonck and thus effectively and concretely strengthen security and information in case of crisis.

Personally and like my colleagues, I sincerely welcome the constructive work that has been done, work that has helped to improve the quality, the effectiveness of the text by involving it in a technical and technological reality. For if one often wishes to ⁇  perfection, one must not forget that behind every legislative proposal, there is a ground reality, a scientific reality and a technological reality.

For example, two points of the original arrangement came into conflict. One of these points referred to the obligation for the IRE to reduce its iodine emissions to reach zero level. Another point was the obligation to reduce permitted emission limits according to progress.

The new formulation contained in the final text, namely “tending towards zero emission level” thus allows to maintain the requirement of less emissions, but within a framework and a realistic and evolving technological reality.

Dear colleagues, under the impulse of the chairman of the Nuclear Security Subcommittee whose action I want to welcome here, we have opted for the consensus model that allows us to submit to you this fully amended text, which meets the expectations of all the groups. It was unanimously voted in the House Committee.

This will, I am sure, enable concrete improvement of security, clarification and coordination of the IRE communication.

The Deputy Prime Minister and Minister of the Interior has also committed to implementing the recommendations made, which I can only welcome.

In matters of such importance and which are ⁇  close to my heart, I look forward to the fact that the good will and the involvement of each and every one allows Parliament to play a major role in this issue of improving nuclear security.

Ce texte a effectivement fait le consensus. Mais le consensus n'est pas l'objectif. L'objectif, c'est que les choses changent à l'IRE. Il serait intéressant que la ministre responsable en matière de sécurité nucléaire soit présente en séance pour ce débat. Elle pourrait entendre ce que les membres de la commission ont à lui dire. Ils ont travaillé sur ce thème. Á l'issue de nombreuses auditions, ils sont parvenus au résultat que nous présentons aujourd'hui et que nous allons voter tout à l'heure.

Un bon travail parlementaire se fait, en l'occurrence dans sa conclusion, en présence du ministre compétent. Je ne veux pas, par là, jouer la procédure, mais il me semble, et M. Ducarme acquiesce, qu'il serait particulièrement utile que Mme Milquet soit parmi nous.

                    Mijnheer de voorzitter, collega’s, ik zal het niet langer dan vijf minuten trekken, maar dit is toch belangrijk genoeg om even iets over te zeggen.

Ons land is tenslotte al meer dan eens op een brutale manier geconfronteerd met de gruwel van seksueel misbruik van kinderen. Denken wij maar aan de emblematische momenten van de Dutrouxaffaire en het misbruikschandaal in de Kerk. Onze collectieve afschuw daarvan, en de prioriteit die wij wensen te geven aan het voorkomen en bestrijden van seksueel misbruik van kinderen leidde onder meer tot het opnemen in onze Grondwet, in het jaar 2000, van een artikel dat de morele, lichamelijke, geestelijke en seksuele integriteit van kinderen bevestigt.

Dit verdrag van de Raad van Europa lijst in feite op wat een overheid allemaal moet doen om dat recht op seksuele integriteit ook effectief te waarborgen. Dit gaat bijvoorbeeld over het strafbaar stellen van daden van seksuele uitbuiting en seksueel misbruik. Daarin is het verdrag vrij gedetailleerd, bijvoorbeeld door een specifieke strafbaarstelling te vragen voor het contacteren van kinderen door volwassenen met het oog op seksuele uitbuiting via onder meer informatie- en communicatietechnologie. Bij dit laatste denken we dan aan chatsites, Facebook, enzovoort.

Het gaat ook over een efficiënte vervolging waarvoor het verdrag onder meer bepaalt dat regels in verband met beroepsgeheim niet in de weg mogen staan van een meldingsplicht van vermoedens van seksueel misbruik. Het gaat ook om preventieve maatregelen, waaronder het screenen van personen die een beroep willen uitoefenen dat regelmatig contact met kinderen vereist en het aanmoedigen van een preventiebeleid in de private sector zoals de ICT- of de toerismesector. Uiteraard heeft het verdrag bijzondere aandacht voor de slachtoffers – de kinderen zelf – onder meer door het voorschrijven van hulplijnen voor kinderen.

Het leidt geen twijfel dat België al voldoet aan het merendeel van de verplichtingen onder dit verdrag. Niettemin zal het nodig zijn om een grondige doorlichting uit te voeren van wetgeving en praktijk om ervoor te zorgen dat dit voor alle verplichtingen uit het verdrag geldt.

Het verdrag dateert van 2007. Een ratificatie in 2012 is dus nog niet zo ongelooflijk laat voor een gemengd verdrag dat door alle parlementen moet worden goedgekeurd. Er zijn toch al 17 landen die het verdrag vóór ons hebben geratificeerd. Het verdrag is ook al van kracht sinds 2010.

Mr. Speaker, colleagues, I will not draw it for more than five minutes, but this is important enough to say something about it.

After all, our country has faced the abomination of child sexual abuse more than once in a brutal way. Let us think of the emblematic moments of the Dutrouxa affair and the abuse scandal in the Church. Our collective disgust for it, and the priority we wish to give to preventing and combating sexual abuse of children, led, among other things, to the inclusion in our Constitution, in the year 2000, of an article that affirms the moral, physical, mental and sexual integrity of children.

This convention of the Council of Europe actually lists what a government must do all to effectively guarantee that right to sexual integrity. This includes, for example, the criminalization of acts of sexual exploitation and sexual abuse. In it, the Convention is quite detailed, for example, by calling for a specific punishment for adult contacts with children for the purpose of sexual exploitation through, among other things, information and communication technologies. In the latter, we think of chatsites, Facebook, and so on.

It also concerns effective prosecution, for which the Convention provides, among other things, that rules relating to professional secrecy should not preclude an obligation to report suspicions of sexual abuse. These include preventive measures, including screening of persons seeking to pursue a profession that requires regular contact with children and encouraging prevention policies in the private sector such as the ICT or tourism sector. Of course, the convention pays special attention to the victims – the children themselves – including by prescribing aid lines for children.

There is no doubt that Belgium already fulfils most of the obligations under this Convention. Nevertheless, it will be necessary to conduct a thorough review of legislation and practice to ensure that this applies to all obligations under the Treaty.

The treaty dates from 2007. A ratification in 2012 is therefore not so incredibly late for a mixed treaty that needs to be approved by all parliaments. There are 17 countries that have ratified the treaty before us. The treaty has also been in force since 2010.

                    Monsieur le président, je me réjouis effectivement de ce que nous puissions ratifier aujourd'hui cette Convention. C'était une des recommandations que j'avais souhaité voir introduites au sein de nos débats de la commission relative aux abus sexuels. En effet, cette Convention, en 2007 déjà, présentait tous les ingrédients pour nous permettre de suivre ces situations douloureuses, puisqu'on y parle de prévention, de sanctions, mais on y décrit aussi les moyens d'accompagner tant les victimes que les auteurs de ces abus. Il y a véritablement beaucoup de réflexions et de suggestions intéressantes à y trouver. C'est donc un vrai plaisir de savoir que la Belgique va ratifier, après d'autres pays européens, cette Convention.

                    Mijnheer de voorzitter, collega’s, de ratificatie van het protocol nr. 12 bij het Europees Verdrag voor de rechten van de mens behoeft enige bijkomende commentaar, om het belang ervan aan te duiden.

De Raad van Europa, die kort na de Tweede Wereldoorlog is opgericht, heeft, zoals u weet, als doel niet alleen het bewerkstelligen van een nauwere samenwerking tussen de Europese Staten, maar ook, zeker gezien de gruwelijkheden die tijdens de Tweede Wereldoorlog hebben plaatsgevonden, het beschermen van de mensenrechten.

Om de bescherming van de mensenrechten in Europa te bevorderen, werd door de Raad van Europa op 4 november 1950 het Europees Verdrag tot bescherming van de Rechten van de Mens en de fundamentele vrijheden gesloten. Het verdrag heeft betrekking op burgerlijke en politieke grondrechten. De rechten in dit verdrag worden toegekend aan eenieder die zich binnen de jurisdictie van een verdragsluitende partij bevindt. Aldus luidt artikel 1 van hert Europees Verdrag voor de rechten van de mens.

Sinds de jaren zestig zijn in de Raad van Europa studies gemaakt en voorstellen gedaan, om tot een verregaande bescherming tegen discriminatie te komen. Doordat er bijzonder veel signalen van een toename van antisemitisme, racisme en intolerantie in Europa waren, is ook de bescherming tegen rassendiscriminatie meer onder de aandacht gekomen.

Er is in oktober 1993 een topconferentie geweest, die heeft geleid tot de goedkeuring van een verklaring en van een actieplan ter bestrijding van xenofobie en ter bestrijding van intolerantie, antisemitisme en racisme. In het kader van het actieplan werd de Europese Commissie tegen Racisme en Intolerantie opgericht. Het is in deze commissie dat de tekst van protocol nr. 12 is voorbereid en uiteindelijk is ontwikkeld.

Op 1 april 2005 treden nieuwe non-discriminatiebepalingen onder het Europese Mensenrechtenverdrag in werking. Op die datum verkrijgt het protocol nr. 12 bij het EVRM rechtskracht in een aantal lidstaten van de Raad van Europa.

Ratification of the Protocol No. Article 12 of the European Convention on Human Rights requires some additional commentary, in order to point out its importance.

The Council of Europe, which was established shortly after the Second World War, as you know, aims not only to ensure a closer cooperation between the European States, but also, ⁇  given the atrocities that occurred during the Second World War, to protect human rights.

In order to promote the protection of human rights in Europe, the European Convention for the Protection of Human Rights and Fundamental Freedoms was concluded by the Council of Europe on 4 November 1950. The Convention deals with civil and political fundamental rights. The rights provided for in this Convention shall be granted to anyone who is within the jurisdiction of a Contracting Party. Article 1 of the European Convention on Human Rights.

Since the 1960s, studies and proposals have been made in the Council of Europe in order to ⁇  extensive protection against discrimination. As there were ⁇  many signs of an increase in anti-Semitism, racism and intolerance in Europe, protection against racial discrimination has also gained more attention.

There was a summit in October 1993 which led to the adoption of a declaration and an action plan to combat xenophobia and to combat intolerance, anti-Semitism and racism. The European Commission against Racism and Intolerance was established. It is in this committee that the text of Protocol No. 12 was prepared and eventually developed.

On 1 April 2005, new non-discrimination provisions under the European Convention on Human Rights came into force. At that date, the Protocol No. Article 12 of the ECHR has legal force in several Member States of the Council of Europe.

                    Het Europees Verdrag voor de Rechten van de Mens kende in artikel 14 reeds het fundamentele recht om gevrijwaard te blijven van discriminatie. Het verbod op discriminatie was echter niet van algemene aard maar gold alleen voor de rechten en vrijheden, voornamelijk burgerlijke en politieke rechten, die in het EVRM genoemd worden. Om deze beperking op te heffen ging de Raad van Europa in 2000 akkoord met een algemeen discriminatieverbod en dat is dus hetgeen in het protocol nr.12 is bepaald.

Het protocol legt aan de lidstaten een negatieve verplichting op, namelijk het algemeen verbod om individuen te discrimineren. Het artikel bevat geen positieve verplichting voor de lidstaten om maatregelen te treffen om alle gevallen van discriminatie van individuen te voorkomen of te bestrijden.

Het protocol is beperkt tot gevallen van discriminatie in de publieke sfeer, dus loutere privéaangelegenheden vallen er niet onder. Dit is uiteraard bedoeld om de verstrengeling te voorkomen met het recht van het individu op respect voor het privéleven, familie- en gezinsleven en bijvoorbeeld ook zijn woning, zijn correspondentie en andere.

Sinds de inwerkingtreding is het gemakkelijker om zaken over discriminatie voor te leggen aan het Europees Hof voor de Rechten van de Mens. Dat betekent dat dit protocol geen echte directe gevolgen heeft voor de interne Belgische rechtsorde maar potentieel wel voor de behandeling van eventuele zaken tegen België voor het Europees Hof.

Onze fractie meent dus dat het een zeer belangrijk signaal is, namelijk dat elke, en werkelijk elke, ongerechtvaardigde discriminatie een schending van de rechten van de mens inhoudt. Daarom heeft onze fractie opgeroepen in deze Kamer om dit protocol te ratificeren via de resolutie die op 20 juli 2011 is goedgekeurd en waaraan heel wat politieke fracties hebben deelgenomen. Het is ook door de toenmalige minister van Buitenlandse Zaken, de heer Vanackere, aanzien als een signaal om in lopende zaken verder te werken aan het ratificatieproces. Wij zijn hem dan ook dankbaar en zijn verheugd dat wij vandaag deze ratificatie kunnen voleindigen, binnen de grenzen in de resolutie die in deze Kamer is goedgekeurd, namelijk voor eind februari van dit jaar.

Article 14 of the European Convention on Human Rights already recognised the fundamental right to remain free from discrimination. However, the prohibition of discrimination was not of a general nature but only applied to the rights and freedoms, primarily civil and political rights, mentioned in the ECHR. In order to remove this restriction, the Council of Europe agreed in 2000 on a general prohibition of discrimination, which is thus what is stipulated in Protocol No 12.

The Protocol imposes a negative obligation on Member States, namely the general prohibition of discrimination against individuals. It does not contain a positive obligation for Member States to take measures to prevent or combat all cases of discrimination against individuals.

The Protocol is limited to cases of discrimination in the public sphere, so pure private matters are not covered. This is, of course, intended to avoid confusion with the right of the individual to respect for his private life, family and family life and, for example, also his home, his correspondence and others.

Since its entry into force, it has become easier to bring discrimination cases to the European Court of Human Rights. This means that this Protocol does not have real direct effects on the internal Belgian legal order but potentially on the treatment of any cases against Belgium before the European Court of Justice.

Our group thus considers that it is a very important signal, namely that every, and indeed every, unjustified discrimination constitutes a violation of human rights. That is why our group has called on this Chamber to ratify this protocol through the resolution adopted on 20 July 2011, in which a large number of political groups participated. It has also been seen by the then Minister of Foreign Affairs, Mr Vanackere, as a signal to continue working on the ratification process in ongoing matters. We are therefore grateful and delighted that we are able to complete this ratification today, within the limits of the resolution approved in this Chamber, namely by the end of February of this year.

Dat is ook het voorwerp geweest van resoluties in deze Kamer, goedgekeurd op 20 juli 2011. Het gaat met name om de ratificatie van het optioneel protocol bij het VN-verdrag tegen foltering en andere wrede, onmenselijke of onterende behandelingen of bestraffingen. Daarvoor zal de minister van Buitenlandse Zaken een instemmingdossier moeten ontvangen van de Federale Overheidsdienst Justitie. We gaan de minister van Justitie dus vragen om werk te maken van het instemmingsdossier.

De andere resolutie betrof de ratificatie van het optioneel protocol bij het VN-verdrag inzake economische, sociale en culturele rechten. Daarvoor dient de minister van Buitenlandse Zaken een instemmingsdossier te krijgen van de Federale Overheidsdienst Tewerkstelling. We zullen dus ook aan de minister van Werk vragen om werk te maken van dit instemmingsdossier zodat we deze twee andere belangrijke mensenrechtenstandaarden ook in ons land kunnen ratificeren, vaak vele jaren na de inwerkingtreding van deze protocollen.

Meer en meer ontpopt het Hof zich als een “gouvernement des juges”. Zo ondergraaft het de nochtans legitieme wetten en beleidsdaden van nationale parlementen en regeringen. Het Hof stelt zich in hun plaats. Dat is ongeoorloofd.

Ik herinner u aan de gezamenlijke verklaring van 47 lidstaten die hierover in april 2011 hun beklag hebben gemaakt bij het Europees Hof. Ik wijs u ook op de heldere versie van een eminent jurist, Marc Bossuyt, die wij nog kennen van het Hoog Commissariaat voor de Vluchtelingen en van het Grondwettelijk Hof. Niet de minste dus.

Onlangs heeft Vlaams Belang in de Kamer een resolutie ingediend – en die in overweging werd genomen – die de nefaste rol en het eigengereide optreden van het Europees Hof voor de Rechten van de Mens aanklaagt, en die het Europees Hof wil terugwijzen op dit vlak. Wij staan op dit punt zeker niet alleen.

Last but not least, dit Verdrag opent slinks een achterpoortje voor de Franstaligen om nog een rondje te draaien inzake het minderhedenverdrag, ten voordele van de Franstaligen in de Vlaamse Rand rond Brussel, en misschien in heel Vlaams-Brabant, of wie weet ver daarbuiten, in heel Vlaanderen.

Laat het duidelijk zijn, daartoe kan en mag het minderhedenverdrag niet dienen. Ik roep de Vlaamse partijen op: geef de Maingains, de Clerfayts en de Thiérys, en alle Franstaligen in hun politieke zog, niet de gelegenheid zich op basis van het minderhedenverdrag te vergelijken met Bretoenen of met Basken. Daarvoor dient het minderhedenverdrag niet.

Ik roep alle Vlaamse partijen, ook N-VA, op om de mensenrechten te respecteren voor wat zij zijn, om de mensenrechten hun scherpte te laten bewaren en er niet de strategie van de botte bijl van te maken, zoals vandaag weer eens gebeurt. Dan slaat men wonden in wat men wil beschermen en koesteren, namelijk de democratie en de vrije meningsuiting.

Mijnheer de voorzitter, collega’s, zonder schroom staan wij hier voor het linkse politiek correcte heir. Wij kijken iedereen recht in de ogen en zeggen krachtig en uit volle overtuiging neen tegen deze tekst.

The second reason is the extension of competence which is once again granted to the European Court of Human Rights. The Court is becoming more and more a “gouvernement des juges”. Thus, it undermines the yet legitimate laws and policies of national parliaments and governments. The Court is in their place. That is unlawful.

I would like to remind you of the joint declaration of 47 Member States that complained to the European Court of Justice in April 2011. I would also point out the clear version of an eminent lawyer, Marc Bossuyt, whom we still know from the High Commissioner for Refugees and the Constitutional Court. So not the least.

Recently, Vlaams Belang has submitted a resolution in the Chamber – and which has been taken into consideration – which accuses the nefaste role and the self-determined action of the European Court of Human Rights, and which the European Court wishes to reiterate in this regard. Last but not least, this Treaty opens a backdoor for the French speakers to turn another round on the minority treaty, for the benefit of the French speakers in the Flemish Rand around Brussels, and ⁇  throughout Flemish-Brabant, or who knows far beyond, throughout Flanders.

Let it be clear, the minority treaty cannot and should not serve this purpose. I call on the Flemish parties: give the Maingains, the Clerfayts and the Thiérys, and all French speakers in their political drive, not the opportunity to compare themselves with Bretons or Basks on the basis of the minority treaty. This is not the purpose of the minority treaty.

I call on all Flemish parties, including N-VA, to respect human rights for what they are, to let human rights maintain their sharpness and not make the strategy of the bone axle out of it, as is happening today again. Then we will wound what we want to protect and nurture, namely democracy and freedom of expression.

                    Collega’s, de tekst die wij vandaag willen ratificeren is het twaalfde protocol bij het Europees Verdrag voor de Rechten van de Mens. Ondertussen zijn er ook al een dertiende en veertiende protocol die ons land al eerder heeft geratificeerd. Het twaalfde protocol dateert al van het jaar 2000. Of we het dit jaar effectief ratificeren is nog niet zeker, want het ligt ook in het Vlaams Parlement al een tijdje stof te vergaren.

Het is eigenlijk niet duidelijk waarom het zo lang heeft geduurd voor wij hierover kunnen stemmen. Het zal zeker niet zijn omdat we hier allemaal de mening van de vorige spreker delen. Dit protocol kent geen nieuwe rechten toe aan de mensen op Belgisch grondgebied: het vergroot enkel de rechtsbescherming. Het gaat om de bevestiging van de gelijkheid voor de wet en van het verbod op discriminatie. Onder het Europees Verdrag voor de Rechten van de Mens bestond al een discriminatieverbod, maar dat was beperkt tot de uitoefening van de andere rechten in dat verdrag. Nu wordt dat losgekoppeld.

Dit betekent een grote uitbreiding van de werkingssfeer die vooral effect heeft op het sociaal-economische terrein: discriminatie in de werksfeer, discriminatie op de woningmarkt enzovoort, uiteraard de terreinen waarop discriminatie het meest voorkomt. Maar in België hebben wij dat protocol niet nodig om beschermd te zijn tegen discriminatie op die en andere gebieden: wij hebben diezelfde regel in de Grondwet, wij hebben een antidiscriminatiewetgeving, wij hebben de rechtstreekse werking van andere verdragsbepalingen zoals de mensenrechtenverdragen van de Verenigde Naties die dezelfde regel al bevatten en waarop burgers zich al konden beroepen voor Belgische rechtscolleges.

Wat dit protocol toevoegt is te situeren in het scenario waarin iemand die van oordeel is dat hij of zij het slachtoffer wordt van een discriminatie, geen gelijk krijgt bij de Belgische rechtscolleges.

                    Ce Protocole est un traité mixte qui devait recueillir l'assentiment de toutes nos assemblées parlementaires afin de pouvoir être ratifié. C'est désormais chose faite puisque notre assemblée était la dernière à devoir poser cet acte.

Le Protocole n° 12 à la Convention de sauvegarde des droits de l'homme et des libertés fondamentales vise à promouvoir l'égalité de tous par la garantie collective d'une interdiction générale de discrimination. Les dispositions actuelles de cette Convention sont de portée limitée du fait qu'elles interdisent la discrimination seulement lorsqu'elle s'applique à l'un des droits reconnus par la Convention. Le Protocole n° 12 lève cette limitation et garantit que personne ne peut faire l'objet d'une quelconque forme de discrimination par aucune autorité publique et sous aucun motif.

Pour rappel, le Protocole n° 12 est entré en vigueur le 1ᵉʳ avril 2005 dans les dix-huit pays qui l'ont déjà ratifié. Je pense entre autres à nos voisins, les Pays-Bas et le Grand-Duché de Luxembourg.

Bien que notre pays dispose déjà d'une loi mettant en œuvre le principe de non-discrimination de manière très avancée, la ratification de ce Protocole nous paraît fondamentale dès lors que le principe de non-discrimination tombe désormais sous la surveillance de la Cour européenne des droits de l'homme. C'est probablement là que les choses pourront changer. La règle générale de l'interdiction de discriminer contenue dans ce Protocole pourrait ainsi être invoquée, par exemple, et n'en déplaise à mon collègue de la N-VA, pour défendre les droits des minorités en Belgique en permettant notamment de combattre les discriminations linguistiques en matière d'enseignement ou dans bien d'autres domaines.

Cette ratification donnerait les leviers nécessaires afin de sanctionner des pratiques telles que celles qui ont été exercées par les autorités communales de Grimbergen, qui incitaient des citoyens à dénoncer toute personne qui s'exprimait dans l'espace public en une autre langue que le néerlandais. Je répète que ceci pourra être sanctionné à terme, ce qui nous semble fondamental compte tenu de la vision démocratique que la Belgique veut donner aux autres pays européens.

This Protocol is a mixed treaty that needed the approval of all our parliamentary assemblies in order to be ratified. This is now done because our assembly was the last to make this act.

Protocol No. 12 to the Convention for the Protection of Human Rights and Fundamental Freedoms aims to promote equality for all through the collective guarantee of a general prohibition of discrimination. The current provisions of this Convention are of limited scope because they prohibit discrimination only when it applies to any of the rights recognized by the Convention. Protocol No. 12 removes this limitation and guarantees that no one may be subject to any form of discrimination by any public authority and for any reason.

Protocol No. 12 entered into force on 1 April 2005 in the 18 countries that have already ratified it. I think of our neighbors, the Netherlands and the Grand Duchy of Luxembourg.

Although our country already has a law implementing the principle of non-discrimination in a very advanced way, the ratification of this Protocol seems to us essential since the principle of non-discrimination now falls under the supervision of the European Court of Human Rights. This is probably where things can change. The general rule of the prohibition of discrimination contained in this Protocol could thus be invoked, for example, and not unlikely to my colleague of the N-VA, to defend the rights of minorities in Belgium by allowing in particular to combat linguistic discrimination in teaching or in many other fields.

This ratification would provide the necessary leverage to sanction practices such as those exercised by the municipal authorities of Grimbergen, which incited citizens to denounce any person who spoke in the public space in a language other than Dutch. I repeat that this can be sanctioned in the long run, which seems to us fundamental given the democratic vision that Belgium wants to give to other European countries.

                    Les autorités flamandes d'autres communes de la périphérie adoptent des comportements plus ou moins similaires à ceux préconisés par les autorités de Grimbergen. Je pense plus spécifiquement à Overijse et à Hoeilaart, où on sait que des panneaux bilingues ont été suspendus par les autorités communales simplement parce qu'une inscription, même anglophone, y figurait. On peut comprendre que, sachant que des initiatives comme celles-là n'ont jamais été sanctionnées par le gouvernement flamand, ce projet de loi permettra de remettre les choses en place.

En parallèle avec cette ratification, il importe que le gouvernement mette rapidement en œuvre l'article 29 de la loi du 10 mai 2007 tendant à lutter contre certaines formes de discrimination en désignant ou en mettant rapidement en place un organe indépendant et impartial compétent pour les discriminations au motif de la langue.

Enfin, le gouvernement fédéral ainsi que ceux des entités fédérées devraient également poursuivre leurs efforts respectifs en ce qui concerne la lutte contre les discriminations en matière d'enseignement, dans les domaines de l'emploi et du logement, ainsi que celle contre le racisme, spécialement dans le discours politique, comme cela a encore été le cas dernièrement.

J'ose croire que le Protocole n° 12 sera un instrument juridique positif pour faire valoir auprès des citoyens de notre pays le droit à l'égalité et à la non-discrimination et le droit au respect de toutes les minorités, quelles qu'elles soient.

The Flemish authorities of other municipalities of the periphery adopt behaviors more or less similar to those advocated by the authorities of Grimbergen.
