Mijnheer de voorzitter, er is over dit wetsontwerp al heel veel gezegd in de commissie. Ik zal mij beperken tot de bespreking van ons amendement en zal een enkele bedenking maken.
Het is een heel goede zaak dat er prijsvergelijkingen worden uitgevoerd met de ons omringende landen van de geneesmiddelen die nog steeds in patent zijn. Wij zouden dat willen doortrekken naar geneesmiddelen die al off patent zijn. Alle geneesmiddelen, zowel de originele als de generieke, moeten op dezelfde manier behandeld worden. Mijn vrienden van de sp.a menen dat waarschijnlijk ook, want ik heb van collega Detiège gehoord dat wij niet de fout mogen maken om verschillende wegen te bewandelen voor geneesmiddelen onder octrooi en generieken. Ik kijk dus uit naar de reactie van de sp.a op dit amendement.
Wat de verplichte substitutie betreft, daarover hebben wij al in de commissie gesproken. Ik vind dat het amendement dat door de meerderheid werd ingediend een verbetering inhoudt van wat voorligt. De therapeutische vrijheid van de arts wordt daarin nog meer erkend. Als de arts in eer en geweten beslist dat er therapeutische redenen zijn om substitutie niet toe te laten, dan moet de arts de vrijheid hebben om dat te kunnen doen.
Ik heb wel een bedenking over de moduleerbare prijsdaling van 1,95 %. De fabrikanten kunnen die prijsdaling van 1,95 % moduleren over heel hun productgamma. Dat zou aanleiding kunnen geven tot concurrentievervalsing voor de generieken. Als bepaalde firma’s bij een aantal geneesmiddelen het percentage sterk zouden verhogen, dan krijgen de generische geneesmiddelen oneerlijke concurrentie. It is a very good thing that price comparisons are carried out with the surrounding countries of the medicines that are still in patent. We would like to extend that to medicines that are already off patent. All medicines, both original and generic, should be treated in the same way. My friends of the SPAA probably think so, because I have heard from colleague Detiège that we should not make the mistake of walking different paths for patented and generic medicines. As for compulsory substitution, we have already talked about this in the committee. I believe that the amendment submitted by the majority represents an improvement of what is ahead. If the doctor in honour and conscience decides that there are therapeutic reasons not to allow substitution, then the doctor should have the freedom to do so.
I have concerns about the modular price reduction of 1.95 %. Manufacturers can modulate that price reduction of 1.95 % across their entire product range. This could lead to distortion of competition for generics. If certain companies would increase the percentage of certain medicines significantly, the generic medicines would get unfair competition. In this provision, therefore, the price of the original and the generic medicinal product is disconnected, but in practice it will appear that the generic medicinal product will always have to continue to follow the price of the original, because one cannot afford that a generic medicinal product is more expensive than the original.

Monsieur le président, cet après-midi s'est tenue une réunion de la commission Santé publique. Un amendement à l'article 10 a été ajouté au présent projet de loi. La commission nationale médico-mutualiste est parvenue à un accord sur les mesures alternatives en vue de maîtriser les dépenses dans le secteur des médicaments le 30 janvier. Elle a ainsi proposé de nuancer le principe de la substitution en introduisant la possibilité, pour le prescripteur, d'invoquer une objection thérapeutique. Cette objection doit bien entendu être fondée sur des motifs sérieux. Le bien-fondé de l'objection thérapeutique pourra être contrôlé par le Service d'évaluation et de contrôle médicaux de l'INAMI et par le médecin conseil.
Pour que le Roi puisse étendre l'application de la substitution à d'autres classes de médicaments que ceux visés à l'article 11, l'avis de la commission nationale médico-mutualiste devra être demandé en sus de l'avis de la commission pour les médicaments déjà requis.
M. Bacquelaine est co-auteur de l'amendement et a indiqué ce que je viens de vous dire. Une discussion a eu lieu. M. Thiéry s'est dit dans un premier temps agréablement surpris par la volonté affichée par la ministre de garantir la concertation avec le secteur. Cependant, il devait tempérer cet enthousiasme dans la mesure où il avait reçu un courrier de la part de l'ABSyM et de Pharma.be dans lequel ces deux acteurs se disaient opposés au projet de loi, outre le fait qu'ils n'aient pas été consultés. La concertation doit cependant avoir lieu. La commission nationale médico-mutualiste ne semble pas être parvenue à forger une solution concertée en son sein.
Si Mme Snoy s'arrête aussi aux courriers précités, c'est plutôt pour se plaindre que ces acteurs, par une activité de lobby, tentent de faire modifier des mesures dans un sens qui leur est favorable. L'oratrice rappelle être en faveur du principe de la substitution et d'une régulation par l'autorité du comportement de prescription. Les limites décrites par l'article 10 tel qu'initialement adopté en commission lui paraissent judicieuses. Ce communiqué ne concerne pas seulement la substitution mais aussi d'autres questions connexes, comme les mesures volumiques et les inhibiteurs de pompes à protons. Quelles sont les mesures envisagées dans ce cadre par la ministre? L'intervenante s'oppose au 3° de l'amendement n° 1 car la capacité de régulation publique est abandonnée. Elle se demande si l'omission du mot "générique", s'agissant des substitutions visées, est volontaire.

Mme Detiège souscrit aux observations de la préopinante. La ministre a été à l'écoute des acteurs au sein de la Commission nationale médico-mutualiste. Il plaide pour une adoption rapide de la proposition de loi modifiant la loi relative à l'assurance obligatoire soins de santé et indemnités, coordonnée le 14 juillet 1994 en ce qui concerne la vente de médicaments bon marché, qu'il a déposée avec d'autres membres.

Mme Snoy soutient la volonté de la ministre de procéder à une concertation. Elle maintient cependant que la solution retenue est la suite d'une influence indue exercée par le secteur pharmaceutique et médical.
Les résultats des votes ont été les suivants. L'amendement a été adopté par 15 voix contre 1. L'article 10 tel qu'amendé a été adopté par 10 voix et 6 abstentions. L'ensemble du projet de loi ainsi amendé a été adopté par 10 voix et 6 abstentions.

Het is inderdaad belangrijk dat wij in ons land goedkopere geneesmiddelen hebben, en als het kan, zo goedkoop mogelijk. Dat is de reden waarom onze partij de generieken altijd zal stimuleren. Die producten moeten zo efficiënt mogelijk op de markt gebracht worden, tegen zo laag mogelijke prijzen.
Ik heb in de commissie getracht uit te leggen hoe het vandaag werkt in ons land. De terugbetaling van geneesmiddelen gebeurt op RIZIV-niveau in de Commissie voor de Terugbetaling van Geneesmiddelen (CTG) volgens een bepaalde procedure.
Binnen de sector was er indertijd een discussie hoe wij ervoor konden zorgen dat wanneer er nieuwe producten op de markt kwamen, zij zo snel mogelijk terugbetaald konden worden. Daarom heeft men een aantal jaren geleden beslist twee groepen geneesmiddelen op de markt te brengen: originele geneesmiddelen en generieke geneesmiddelen.
De originele geneesmiddelen volgen de gewone procedure. Dat wil zeggen dat er internationale vergelijkingen plaatsvinden en dat de kwaliteit wordt afgewogen. Dat is een enorm lange procedure. De generieken volgen een versnelde procedure. Dat is logisch, want zij worden buiten patent geproduceerd.
Ik heb er toen voor gewaarschuwd die commissie meer werk te geven omdat dit een vertraging kan teweegbrengen voor het op de markt brengen van generieken. Dan komt er minder concurrentie, waardoor de prijzen van de originelen hoog blijven. Om de markt gezond te houden, is het belangrijk dat de versnelde procedure versneld blijft. I then warned that committee to give more work because this could cause a delay in the marketing of generics. Then there will be less competition, which keeps the prices of the originals high. In order to keep the market healthy, it is important that the accelerated procedure remains accelerated. If you charge the commission with extra work, you create a problem.
I find it very dangerous to say that prices must always be compared. Belgium can market more expensive medicines than others, but bear in mind that they do not compare apples with pears. It is quite possible that for a particular condition the refund in Spain is much wider than the refund in Belgium, thus the price setting is done in a different way.
On the RIZIV level, by the way, for years there has been a commission that does nothing but price comparisons, but then cluster-based. This means that both the price of the originals and that of the generics is considered in group. Examples are proton pump inhibitors and cholesterol reducers. For this purpose, it is considered group-by-group at what price these medicines can be placed on the market optimally.

Mevrouw de minister, de opdracht is groot. Er moest 180 miljoen euro worden gevonden. U bent daarin geslaagd op een vrij evenwichtige manier zowel voor de merkengeneesmiddelen als voor de generieke geneesmiddelen. De amendementen die wij vorige week hebben goedgekeurd, hebben nogmaals bevestigd dat het belangrijk is het evenwicht te bewaren.
Verwijzend naar de uiteenzetting van de heer Beuselinck en van mevrouw Detiège, moet ik toegeven dat ik ook problemen heb met bepaalde zaken. Ik denk bijvoorbeeld aan de generische PPI’s die 80 % van de markt uitmaken, hoewel ze duidelijk veel duurder zijn dan in onze buurlanden. Wel, volgens mij moeten deze in bepaalde systemen moeten worden opgenomen en ook in prijs verlagen. Het moet de bedoeling zijn om de patiënt zo weinig mogelijk te doen betalen. Door het evenwicht in de maatregelen slagen wij daar ook in.
Wij zijn ook voorstander van het maken van dergelijke prijsvergelijkingen. Mevrouw de minister, ik hoop dus dat u ter zake behalve de mededelingsplicht ook zult overleggen met de sector, zoals u hebt beloofd. Ik heb mijn connecties op het veld. Het betreft een maatregel die door heel veel mensen, ook door de artsen, op een erg positieve manier wordt ervaren.
U weet ook —en het is geen geheim — dat mijn partij al twintig jaar voorstander is van het voorschrift op stofnaam, ook bij substituties. In die zin waren wij dan ook heel aangenaam verrast met wat in de teksten stond over antibiotica en antimycotica, met name dat wij de desbetreffende maatregelen zouden kunnen doorvoeren. Wij hebben de voorbije dagen ook de communicatie van artsen ter zake mogen vaststellen. Het amendement dat thans voorligt, is een jammer iets. Het is immers deels een terugkomen op, wat niet betekent dat wij tegen de therapeutische vrijheid van de arts zouden zijn. Mevrouw de minister, met het oorspronkelijk voorstel hadden artsen wel de mogelijkheid om te beslissen welke bestanddelen, welke dosissen en welke manier van toediening zij voorschrijven. Er waren zelfs al uitzonderingen mogelijk op het vlak van nevenwerkingen en van allergieën.
Ik heb gemerkt dat het amendement er nog het therapeutische bezwaar aan toevoegt, waarmee wij op zich geen probleem hebben, al hoop ik dat het op een correcte manier wordt gebruikt.

In that sense, we were very pleasantly surprised at what the texts said about antibiotics and antimycotics, in particular that we could implement the corresponding measures. We have also been able to establish the communication of doctors on this subject in recent days. The amendment that is presented now is a pity. After all, it is partly a return to, which does not mean that we would be against the therapeutic freedom of the doctor. Mrs. Minister, with the original proposal, doctors were allowed to decide which ingredients, which doses and which method of administration they would prescribe. There were even possible exceptions in terms of side effects and allergies.
I have noticed that the amendment adds to it the therapeutic objection, with which we have no problem in itself, although I hope that it is used in the correct way.

Cela permet de concilier l'objectif budgétaire, auquel nous souscrivons évidemment, et un principe fondamental de l'exercice médical, qui est la notion de liberté de prescription.
Bien entendu, nous accordons la possibilité à l'exercice du droit de substitution dans la délivrance des médicaments – antibiotiques et antimycotiques -, mais dans certaines limites. Il doit notamment s'agir de traitements aigus. Le texte initial ne prévoyait qu'une seule exception, à savoir l'allergie. Cela me paraissait franchement insuffisant. En ce qui concerne l'amendement d'aujourd'hui, Mme Burgeon a bien expliqué les raisons de notre opposition. Vorige week hadden we nochtans in commissie een serieus debat over de vraag hoe we een en ander konden verbeteren. De minister heeft toen geantwoord dat er overleg zou worden gepleegd met de commissie artsen-ziekenfondsen. Dat is in mijn ogen een erkend orgaan, dat heel goede opmerkingen meegeeft. Daarom vind ik het vandaag voorliggende amendement zelfs goed; het geeft een meerwaarde aan heel de discussie over substitutie.
Ik volg mevrouw Muylle ter zake niet helemaal. Zij zegt al sinds twintig jaar voorstander te zijn van substitutie. Ik ben spijtig genoeg al even lang afgestudeerd en, naar ik mij herinner, ging het altijd over substitutie, ja of nee. Het is goed dat we het debat vandaag op de agenda hebben durven te zetten. Nog beter is dat we rekening houden met terechte opmerkingen. Stel dat een arts echt een therapeutisch bezwaar heeft, wat om verschillende redenen kan. Ik heb zelf ooit patiënten gezien die echt wel een placebo-effect nodig hadden. Zo kwam een dame elke week om vermoxpillen, waarvan ik dacht dat zij toch niet jarenlang wormen kon hebben. Maar de arts zei dat ze die pillen wel degelijk nodig had. Men moet nu eenmaal rekening houden met de mening van een arts in een bepaald dossier.
Ik geef misschien een grappig voorbeeld, maar het gaat over de essentie: een arts moet altijd kunnen afwegen wat hij doet met patiënt A of B. Men kan vragen hebben bij de gegrondheid van de redenen. Welnu, er is wel in bescherming voorzien. Een arts kan inderdaad de keuze maken om niet in het systeem van substitutie te stappen en dus consequent het duurdere geneesmiddel voorschrijven. Welnu, er is toch het patiëntendossier. De minister heeft ons de garantie gegeven dat men grondige redenen moet geven waarom er een therapeutisch bezwaar is om het goedkopere geneesmiddel af te leveren. Het RIZIV kan dat opvragen voor controle. Als dat afwijkingen vaststelt, kan het zelfs sancties op grond van artikel 703 opleggen.

Even better is that we take into account legitimate comments. Suppose a doctor really has a therapeutic objection, which can be for several reasons. I have seen patients who really needed a placebo effect. So a lady came every week for vermox pills, which I thought she could not have worms for years. But the doctor said she really needed those pills. One must take into account the opinion of a doctor in a particular file.
I may give a funny example, but it is about the essence: a doctor should always be able to weigh what he does with patient A or B. You may have questions about the justification of the reasons. Well, there is protection provided. A doctor can indeed make the choice not to enter the system of substitution and thus consistently prescribe the more expensive medication. Well, there is the patient file. The Minister has given us the guarantee that one must provide thorough reasons why there is a therapeutic objection to deliver the cheaper medicine. The RIZIV can request that for control. If it identifies derogations, it may even impose sanctions under Article 703.
I do not see the problem. There will be, for all certainty, an evaluation to see if there may be doctors bypassing the present proposal. We have already received the guarantee from the Minister that it will effectively apply the sanctions.

Chers collègues, reconnaissons que les acteurs de la santé ont pris leurs responsabilités. Ils sont arrivés à un consensus sur ce point. C'est important.
Avec l'amendement de ce jour, on en arrive à une réelle plus-value, à la fois sur la liberté thérapeutique et sur le respect de cette liberté thérapeutique, également sur la responsabilité du médecin en tant que prescripteur. On évite d'entrer dans un système qui opposerait pharmaciens et médecins, ce qui serait le pire dans un système où tous les acteurs de la santé jouent chacun leur rôle.

Iedereen heeft de urgentie aanvaard en deze week stond het aan de agenda van de commissie voor de Binnenlandse Zaken. Vandaag kan het wetsvoorstel al in de plenaire zitting worden behandeld.
De inhoud is zeer eenvoudig. De dotaties die via de Kamer worden gegeven aan de politieke partijen zouden niet worden geïndexeerd in 2012 en 2013. Dit moest dringend gebeuren omdat er in maart 2012 een indexering zal plaatsvinden. Het is de bedoeling eenzelfde regeling voor de Senaat uit te werken zodat die operatie voor 2012 en 2013 een besparing van circa 1 miljoen euro zal opleveren.
Iedereen in de commissie heeft dit voorstel gesteund omdat iedereen van oordeel is dat dit het goede voorbeeld is dat moet worden gegeven door de politici.
Ik kan misschien nog een kleine kanttekening maken namens de N-VA. Wij steunen dit voorstel. Wij betreurden dat het voorafgaand niet werd meegedeeld aan alle partijen omdat het toch alle partijen aanbelangt. De discussie over de pensionering van de parlementsleden werd wel opengetrokken. Bien entendu, je ne peux que saluer la décision légitime de ce parlement de ne pas indexer, durant les deux années à venir, les montants qui sont alloués aux partis politiques. C'est une décision, somme toute, naturelle, vu la situation économique de notre pays.
Cependant, je ne pourrai pas soutenir la présente proposition pour une raison toute simple: les sommes allouées aux partis politiques sont tout simplement indécentes. En effet, en 2012, plus de 10 millions d'euros d'argent public seront gracieusement offerts aux partis politiques de cette assemblée. C'est tout simplement scandaleux et insensé! De plus, cet argent est souvent gaspillé alors qu'il pourrait être utilisé pour des projets sociaux, pour améliorer, par exemple, le quotidien de nos concitoyens. Imaginez tout ce que l'on peut faire avec 10 millions d'euros!
Au lieu de cela, cet argent sert à assurer le train de vie souvent dispendieux des partis politiques et à garantir le sacro-saint clientélisme dont nous sommes les spécialistes en Belgique.
Vous ne le savez peut-être pas mais, avant de créer mon propre parti qui, je le rappelle, tente de rivaliser avec les mastodontes de ce Parlement, sans toucher le moindre argent public, j'ai été, pendant longtemps, membre du MR. Vous l'aurez compris, je suis fondamentalement opposé aux montants versés aux partis, au système des dotations tel qu'il existe aujourd'hui et qui, selon moi, est profondément inégalitaire, permettant aux grands partis de toujours gagner plus d'argent et d'ainsi concurrencer illégalement tout nouveau mouvement populaire qui tente de naître au sein de la société.

Cependant, j'entends déjà les critiques; sachez que ce n'est pas la jalousie qui parle à cette tribune. Sincèrement, je suis fier de ne pas toucher de dotation. Je suis fier que mon parti se batte pour tenter de faire entendre sa voix sans toucher le moindre euro. C'est important de le rappeler. Chaque jour, nous essayons de faire des sacrifices et de trouver des solutions pour effectuer un travail de qualité, même si vous ne le jugez pas comme tel, sans dépenser le moindre argent public.
Tous les partis devraient en faire autant. Ce serait positif pour tous, et avant tout pour les finances de notre pays. Tous les jours, le MLD se bat dans cette assemblée en reproduisant le combat de David contre Goliath. Nous sommes fiers des résultats que nous obtenons malgré les circonstances.
