Monsieur le président, chers collègues, la problématique de l'écart salarial est arrivée en discussion à la Chambre grâce au dépôt de plusieurs propositions de loi. Celles-ci ont été examinées par le comité d'avis pour l'Émancipation sociale.
Une proposition de loi émanait de Mmes Becq et Fonck, une autre de Mme Detiège, une autre de Mme Déom, une autre encore de Mmes Fonck et Becq, toutes relatives à l'écart salarial entre les femmes et les hommes. Elles visaient à traiter les discriminations, à ventiler les rubriques du bilan social en instituant un rapport et un plan pour l'égalité des chances entre les femmes et les hommes.
Diverses propositions de résolution avaient aussi été déposées. Finalement, le comité d'avis a décidé de travailler sur base de propositions de loi. Il a organisé des auditions, dont je ne vous donnerai pas le rapport complet ici. Je me contenterai de vous citer les personnes que nous avons eu l'occasion d'entendre, qui ont en grande partie justifié la proposition de loi que nous voterons aujourd'hui.
Parmi les personnes entendues, la ministre de l'Emploi et de l'Égalité des chances, la représentante de l'Institut pour l'égalité des femmes et des hommes, les représentants de la FGTB et de la CSC, les représentants de la FEB, de l'UCM et de l'UNIZO, la représentante du ministère de l'Égalité des chances du Grand-Duché de Luxembourg, le représentant de l'Onderzoeksinstituut voor Arbeid en Samenleving de la KUL, le Nederlandstalige Vrouwenraad et le Conseil des femmes francophones de Belgique, ainsi que les représentants de la Banque-Carrefour.
Suite à toutes ces auditions, la solution était de coordonner les diverses propositions et de s'accorder sur un texte commun. La proposition de loi que nous voterons est donc bien le fruit d'un travail collectif. D'ailleurs, on n'en attendait pas moins pour un tel sujet.
Cette proposition présente quatre nouvelles mesures. Premièrement, certaines rubriques du bilan social devront être ventilées en fonction du genre. Deuxièmement, la différence de rémunération et la classification de fonctions neutres sur le plan du genre doivent devenir des thèmes permanents de la concertation sociale, avec la mise en place d'une procédure de contrôle auprès du SPF Emploi. Troisièmement, les entreprises occupant en moyenne au moins 50 travailleurs devront remettre tous les deux ans un rapport sur la structure de rémunération de l'entreprise. Enfin, les entreprises pourront décider de manière facultative de désigner un médiateur parmi les membres du personnel.
Ensuite, les différents avis de la FEB, de la Commission de la protection de la vie privée et des syndicats ont été pris en compte lors de la dernière réunion du comité d'avis, le 15 février, ce qui a permis de voter lors de cette séance.
Le vote en commission des Affaires sociales s'est déroulé la semaine dernière. Et aujourd'hui, nous nous retrouvons pour le vote en séance plénière.

Mr. Speaker, dear colleagues, the problem of the wage gap came into discussion in the House thanks to the submission of several bills. These were reviewed by the Opinion Committee for Social Emancipation.
One bill came from Ms. Becq and Fonck, another from Ms. Detiège, another from Ms. Deom, another from Ms. Fonck and Becq, all related to the wage gap between women and men. They aimed to address discrimination, to ventilate the social balance sheets by establishing a report and a plan for equal opportunities between women and men.
Several resolutions were also submitted. Finally, the opinion committee decided to work on the basis of legislative proposals. He organized hearings, of which I will not give you the full report here. I will only cite the people we have had the opportunity to hear, who have largely justified the bill we will vote today.
Among the persons heard were the Minister of Employment and Equal Opportunities, the representative of the Institute for Gender Equality, the representatives of FGTB and CSC, the representatives of FEB, UCM and UNIZO, the representative of the Ministry of Equal Opportunities of the Grand Duchy of Luxembourg, the representative of the Onderzoeksinstituut voor Arbeid en Samenleving of the KUL, the Nederlandstalige Vrouwenraad and the French-speaking Women Council of Belgium, as well as representatives of the Bank-Carrefour.
Following all these hearings, the solution was to coordinate the various proposals and agree on a common text. The bill we will vote for is the result of collective work. At the same time, there was no less expectation for such a topic.
This proposal introduces four new measures. First, certain sections of the social balance sheet will have to be divided according to gender. Second, the difference in remuneration and the classification of gender-neutral functions must become permanent topics of social consultation, with the establishment of a control procedure with the SPF Employment. Third, companies with an average of at least 50 employees will have to submit a report on the company’s remuneration structure every two years. Finally, companies will be able to optionally decide to appoint a mediator among staff members.
Then, the different opinions of the FEB, the Privacy Protection Commission and the trade unions were taken into account at the last meeting of the opinion committee on 15 February, which allowed voting at this session.
The vote in the Social Affairs Committee took place last week. Today we meet for the vote in the plenary session.

Je voudrais remercier tous les collègues qui ont collaboré à cette proposition, à savoir Mmes Detiège, Déom, Becq, De Block et Genot, qui en sont les coauteurs, ainsi que le seul homme qui nous a soutenues – je ne dirais pas supportées! – pendant ces débats, M. Clarinval.
Voici qui conclut ce rapport, monsieur le président. J'ai essayé d'être assez brève et je tenterai de l'être tout autant pour la présentation de la position de mon groupe que j'aborde à présent.
L'écart salarial n'est pas un mythe. Le dernier rapport de l'Institut pour l'égalité des hommes et des femmes, publié le 21 février 2012, montre que l'écart salarial sur base du salaire horaire reste de 10 %. Et encore, ce chiffre ne doit pas faire oublier que, selon les statuts, de plus grandes différences existent: 25 % pour les employés, 17 % pour les ouvriers dans le secteur privé. C'est donc une inégalité persistante qu'il convient de combattre.
Pour notre groupe, il était essentiel d'agir à trois niveaux. Tout d'abord, au niveau interprofessionnel, il faut que la classification des fonctions neutres sur le plan du genre devienne un thème permanent de la concertation sociale. Ensuite, au niveau sectoriel, les commissions paritaires doivent être soutenues dans ces démarches de concertation sociale. Enfin, au niveau des entreprises, nous demandons l'obligation de publier un rapport annuel et un plan d'égalité des chances ainsi que de modifier le bilan social. Nous avons activement collaboré à l'élaboration de la proposition de loi et nous la soutenons pleinement.
J'aurais souhaité rappeler que les objectifs du travail étaient de respecter un équilibre afin de prendre des mesures efficaces pour des avancées réelles, pour plus de transparence au niveau des différences de salaires, pour éviter du surcharger les entreprises dans la mesure du possible – et nous y avons veillé –, pour garantir le respect de la vie privée et pour assurer une cohérence avec les législations qui existaient déjà en matière de concertation sociale et de lutte contre les discriminations.
Finalement, il faut souligner que cette proposition reprend également différentes recommandations au niveau européen. D'ailleurs, les conclusions du Conseil européen du 6 décembre 2010 invitent les États membres à prendre des mesures en vue d'assurer une plus grande transparence dans les salaires et de promouvoir la classification neutre des fonctions. Des mesures comme les nôtres sont prises dans d'autres pays européens, notamment en Suède ou en France.
Nous votons aujourd'hui une nouvelle loi qui est un pas sur le chemin de l'égalité des hommes et des femmes. Il reste néanmoins du chemin à parcourir. Le cdH continuera à être attentif à d'autres défis: l'amélioration de la conciliation entre la vie de famille et le travail, la lutte contre le plafond de verre, le travail précaire ou encore les stéréotypes.

This is the conclusion of this report, Mr. President. I have tried to be short enough and I will try to be short enough for the presentation of the position of my group that I am addressing now.
The wage gap is not a myth. The latest report of the Institute for Gender Equality, published on 21 February 2012, shows that the wage gap based on hourly wage remains 10%. Furthermore, this figure must not forget that, according to the statutes, there are greater differences: 25% for employees, 17% for workers in the private sector. This is a persistent inequality that must be combated.
For our group, it was essential to act on three levels. First, at the interprofessional level, the classification of gender-neutral functions must become a permanent theme of social consultation. Then, at the sectoral level, parity committees should be supported in these steps of social concertation. Finally, at the business level, we demand the obligation to publish an annual report and a plan for equal opportunities as well as to modify the social balance sheet. We have actively collaborated with the draft law and we fully support it.
I would like to recall that the objectives of the work were to maintain a balance in order to take effective measures for real progress, for greater transparency in terms of wage differences, to avoid overloading companies as far as possible – and we have ensured this –, to guarantee privacy and to ensure coherence with existing legislation on social concertation and anti-discrimination.
Finally, it should be noted that this proposal also includes various recommendations at European level. In addition, the conclusions of the European Council of 6 December 2010 call on Member States to take measures to ensure greater transparency in wages and to promote the neutral classification of functions. Measures like ours are being taken in other European countries, ⁇ in Sweden or France.
Today we vote on a new law that is a step on the road to equality between men and women. However, there is still a path to go. The CDH will continue to be attentive to other challenges: improving the conciliation between family life and work, the fight against the glass ceiling, precarious work or even stereotypes.

Mijnheer de voorzitter, geachte collega’s, het is vandaag Internationale Vrouwendag. Het is evident dat de N-VA gendergelijkheid belangrijk vindt. Ook de N-VA wil gelijk loon voor gelijk werk. Werknemers die dezelfde job doen, moeten hetzelfde loon krijgen. Dat staat buiten kijf. Een verschil in verloning op basis van het geslacht is onaanvaardbaar. Dat moet duidelijk zijn.
Ik wil erop wijzen dat België het met betrekking tot de loonkloof niet zo slecht doet. In een recent rapport van de OESO stond dat België het derde beste land is, na Noorwegen en Hongarije.
Uiteraard is 8,9 % voor ons nog steeds te veel, maar het bewijst dat de situatie niet dramatisch is.
Bovendien veroorzaken tal van factoren de verschillen in verloning, onder meer op het vlak van werkgelegenheid, de individuele onderhandelingen met de werkgever, of nog de opleidingen die vrouwen volgen en zelfs het culturele rollenpatroon. Zo werken vrouwen meer dan mannen in zachte sectoren, waar de lonen lager liggen. Ze werken meer deeltijds met minder kans op een carrière en bij loonsonderhandelingen spelen voor hen vaak andere prioriteiten mee zoals de combinatie werk-gezin.
Vaak dwingen externe factoren vrouwen om niet voluit voor hun carrière te gaan. Dat is wat moet veranderen. Dat kunnen we niet realiseren met onderhavig wetsvoorstel. Daarvoor is een mentaliteitswijziging nodig en dat moet groeien.
Het wetsvoorstel grijpt slechts op een klein aantal factoren in en zal dus een kleine bijdrage leveren tot het dichten van de loonkloof. Zelfs nadat de tekst is goedgekeurd, zullen de loonsverschillen blijven bestaan. We mogen dus niet de illusie creëren dat het voorstel alles oplost.
Aan de totstandkoming van het wetsvoorstel zijn heel wat werkzaamheden voorafgegaan. Er werden hoorzittingen in het Adviescomité voor de Maatschappelijke Emancipatie georganiseerd. De N-VA heeft er steeds op aangedrongen dat ook de werkgevers hier zouden worden gehoord, zodat wij een evenwichtig en genuanceerd verhaal zouden krijgen. Uit die werkzaamheden kwam het voorliggend wetsvoorstel voort.
Het voorstel bevat voor ons twee aanbevelingswaardige maatregelen. Ten eerste, om de loonkloof aan te pakken, moet ze eerst in kaart worden gebracht. Daarom worden de loongegevens op de sociale balans naargelang van het geslacht gesplitst. De overheid krijgt hiermee per bedrijf een beter zicht op de verschillen. De N-VA is voorstander van die gegevensverzameling.

Today is International Women’s Day. It is obvious that the N-VA considers gender equality important. The N-VA also wants equal pay for equal work. Employees who do the same job should get the same salary. That is out of doubt. A difference in remuneration based on gender is unacceptable. That must be clear.
I would like to point out that Belgium is not doing so bad with regard to the wage gap. A recent OECD report stated that Belgium is the third best country, after Norway and Hungary.
Of course, 8.9% is still too much for us, but it proves that the situation is not dramatic.
In addition, many factors cause the differences in remuneration, including in terms of employment, individual negotiations with the employer, or even the training programmes that women attend and even the cultural role pattern. For example, women work more than men in soft sectors, where wages are lower. They work more part-time with less chances of a career and in salary negotiations often play for them other priorities such as the combination work-family.
Often, external factors force women not to fully advance their careers. That is what needs to change. This cannot be achieved with this bill. This requires a change in mentality and that needs to grow.
The bill only addresses a small number of factors and will therefore make a small contribution to cutting the wage gap. Even after the text has been approved, wage differences will continue to exist. Therefore, we must not create the illusion that the proposal will solve everything.
A lot of work has been done before the draft law. Hearing was organised in the Advisory Committee for Social Emancipation. The N-VA has always insisted that the employers should also be heard here, so that we would get a balanced and nuanced story. From this work, the present legislative proposal emerged.
The proposal contains two recommended measures for us. First, in order to address the wage gap, it must first be mapped. Therefore, the salary data on the social balance is divided according to gender. This gives the government a better view of the differences between companies. The N-VA is in favour of this data collection.

Ten tweede wordt de loonkloof een vast thema in het sociaal overleg. Ook dat juichen wij toe. Het is in de eerste plaats de taak van de sociale partners te waken over correcte loonsystemen.
Waarmee wij wel een probleem hebben, is de aanstelling van een bemiddelaar die verantwoordelijk wordt voor de klachtenbehandeling. Bedrijven hebben immers al genoeg personen in huis die die taak kunnen opnemen, bijvoorbeeld de personeelsverantwoordelijke, de vakbondsafgevaardigde of de vertrouwenspersoon. Zij zijn zeer goed geplaatst om dergelijke klachten aan de directie door te geven.
De invoering van de maatregel is misschien vrijblijvend, maar het is duidelijk dat in de praktijk de druk om een bemiddelaar aan te stellen, groot zal zijn. Het betekent een extra taakbelasting voor de bedrijven en een lastenverhoging voor onze ondernemers. Zelfs het ACV erkent dat de bemiddelaar het normale overleg over loon- en arbeidsvoorwaarden vaak dreigt te doorkruisen. Het lijkt ons veeleer te gaan om een symboolfunctie zonder echte meerwaarde. Daar heeft het dossier echt geen nood aan.
De N-VA wil echter constructief omgaan met het wetsvoorstel. Wij zullen dan ook opnieuw ons amendement indienen om de artikels over de bemiddelaar uit het voorstel te schrappen. In dat geval willen wij het voorstel gerust steunen. Indien die artikels niet geschrapt worden, zullen wij ons onthouden bij de stemming over het wetsvoorstel.
Uiteraard moet gelijk werk gelijk beloond worden, dat is evident. De historische strijd voor gendergelijkheid verdient echter beter dan dat op een symbolische datum een symbolisch wetsvoorstel wordt goedgekeurd. Echte gendergelijkheid begint immers bij de mentaliteit en bij de houding van de betrokken mannen en vrouwen tegenover elkaar.

Secondly, the wage gap becomes a fixed topic in social consultation. We also congratulate this. It is primarily the task of the social partners to monitor correct wage systems.
What we have a problem with is the appointment of a mediator responsible for the handling of complaints. After all, companies already have enough people at home who can take that job, such as the HR manager, the trade union representative or the trust person. They are very well placed to pass such complaints to the management.
The introduction of the measure may be non-binding, but it is clear that in practice the pressure to appoint a mediator will be great. It means an additional task burden for the companies and an increase in the burden for our entrepreneurs. Even the ACV acknowledges that the mediator often threatens to cross the normal consultation on wage and working conditions. It seems to us rather to be a symbol function without real added value. The file does not really need that.
However, the N-VA wants to deal constructively with the bill. We will therefore submit our amendment again to remove the articles on the mediator from the proposal. In that case, we would gladly support the proposal. If these articles are not deleted, we will abstain at the vote on the bill.
Equal work must be equally rewarded, that is obvious. However, the historical struggle for gender equality deserves better than approving a symbolic bill on a symbolic date. True gender equality begins with the mentality and attitude of the men and women concerned towards each other.

Monsieur le président, monsieur le ministre, chers collègues, l'égalité salariale entre les femmes et les hommes, c'est une question récurrente. On en parle depuis longtemps en Belgique mais aussi aux niveaux européen et international. En parler, c'est bien; agir, c'est encore mieux!
Aujourd'hui, pour la première fois depuis un certain nombre d'années, une proposition concrète, destinée à combattre de manière effective l'écart salarial entre les femmes et les hommes de notre pays, est soumise au vote de notre assemblée. Bien sûr, le principe de l'égalité entre les hommes et les femmes et, en particulier, celui de l'égalité salariale, est défendu depuis des décennies. Bien sûr, les initiatives législatives en la matière ont déjà vu le jour et, heureusement, des progrès ont été réalisés. Cependant, comme cela a déjà été dit, l'écart salarial entre les hommes et les femmes persiste et on ne peut le tolérer. Ce texte est donc une avancée importante que nous attendions, ainsi que beaucoup de femmes, depuis longtemps.
Le comité Émancipation sociale que je préside a ainsi décidé, voici un peu plus d'un an maintenant, de rendre un avis d'initiative concernant justement cette problématique de l'écart salarial entre les femmes et les hommes à l'attention de la commission des Affaires sociales. En fait, il faut le dire, des propositions de mon groupe, le PS, mais également d'autres groupes étaient déjà sur la table. Il s'agissait vraisemblablement d'une évidence pour bon nombre d'entre nous de devoir travailler sur ce thème. Il fallait évidemment aboutir mais aboutir à une proposition qui ait du sens et qui puisse être un véritable levier pour supprimer cet écart salarial sans évidemment bloquer le développement économique de nos entreprises.
J'insiste sur le fait que ce texte est véritablement le fruit d'un travail collectif. En qualité de cosignataire du texte et surtout de présidente du comité Émancipation sociale, je voudrais remercier l'ensemble des groupes politiques qui ont participé de manière tout à fait constructive au débat. Le projet aujourd'hui sur la table n'est pas un compromis mou. Il est fort et sera, je l'espère, efficace. Encore une fois, merci à tous les membres du comité Émancipation sociale.
Nos réunions furent nombreuses. Nous avons procédé à de nombreuses auditions et nous y sommes arrivés. Même si on a quelque peu accéléré la cadence sans dénaturer la qualité, ce travail aboutissait un jeudi en séance plénière. Le 8 mars de cette année tombait un jeudi. Au-delà de l'efficacité, c'était une symbolique importante de voir aboutir ce texte aujourd'hui.
Comme on l'a rappelé, même si nous ne sommes pas un mauvais élève sur le plan européen – je ne dirai pas que la Belgique est un bon élève car tant qu'il y aura un écart salarial, on ne sera pas bon –, même si les chiffres diffèrent selon les études et les méthodes de calcul, même si certains essaient de nous faire croire que cette problématique n'existe pas ou est limitée, l'écart salarial entre les hommes et les femmes est et reste une réalité.
La part de cet écart salarial qui ne peut pas être expliquée de manière objective est aussi une réalité!
La discrimination salariale fondée uniquement sur le sexe persiste. Le principe "à travail égal, salaire égal", déjà consacré en 1957 par le Traité de Rome, n'est lui par contre toujours pas une réalité et ce, plus d'un demi-siècle plus tard. C'est inacceptable!
Les conséquences pour les femmes de l'inégalité salariale sont immédiates en termes de sommes perçues à la fin du mois mais elles se manifestent également tout au long de leur vie. Les femmes sont ainsi injustement exposées à un risque de pauvreté accru pendant leur vie active mais aussi au moment de leur retraite puisque leur pension sera calculée sur la base de ce qu'elles ont gagné pendant leur vie active et sera donc, de facto, moins élevée.
Les derniers chiffres sont éloquents. En moyenne en Belgique, un homme perçoit 950 euros de pension. C'est encore trop peu mais la moyenne pour une femme est de 650 euros. Personne ne sait vivre aujourd'hui avec cette somme!
Selon les chiffres déjà rappelés, l'écart salarial varie entre 10 % et 23 % sur la base d'un salaire annuel brut, tous secteurs confondus et indépendamment de la durée de travail. L'écart est encore plus élevé si l'on tient compte du seul secteur privé et si l'on prend en compte les fameux avantages extralégaux que sont les voitures de fonction, les gsm, les ordinateurs, etc.
Nous avons dès lors décidé de mener nos travaux dans la lignée des conclusions de la Conférence sur l'écart salarial qui s'est tenue lors de la présidence belge de l'Union européenne, fin 2010. Nous avons également suivi une série de recommandations formulées par l'Institut pour l'égalité des femmes et des hommes. Quand le gouvernement a annoncé, dans son accord de gouvernement, vouloir s'attaquer à la problématique, nous avons mis les bouchées doubles car nous savions que nous serions soutenus.
Comme je l'ai déjà dit, ce texte ne fera pas disparaître l'écart salarial du jour au lendemain. Il y a encore énormément de choses à faire pour concilier vie privée et vie professionnelle.
Mais, j'en suis convaincue, il permettra assurément de le diminuer en le cernant mieux encore. En effet, il devrait entraîner une mise en œuvre plus effective de la législation existante, une responsabilisation encore plus importante des partenaires sociaux et des entreprises, mais aussi une plus grande transparence des salaires. Cela ne sera évidemment possible qu'avec le concours de chacun et grâce à la complémentarité des mesures proposées, à savoir la ventilation par genre de certaines données du bilan social, y compris les fameux avantages extra-légaux, l'évaluation du caractère neutre des classifications de fonctions élaborées par les commissions paritaires, l'obligation pour les employeurs d'effectuer une analyse de leur structure de rémunération avec un plan d'action à la clé si des inégalités sont constatées, en vue de les gommer et, enfin, la possibilité de désigner un médiateur au sein de l'entreprise.
Voilà autant de mesures pour lesquelles nous avons jugé bon d'impliquer chaque niveau de concertation sociale, le niveau interprofessionnel, le niveau sectoriel et celui de l'entreprise.
Je voudrais également réaffirmer que ces mesures, notamment celle relative à l'obligation pour l'employeur d'effectuer une analyse de la structure salariale n'entraîneront pas une charge de travail supplémentaire considérable. Je ne dis pas qu'il n'y en aura pas du tout, mais elle ne sera, en tout cas, pas énorme puisque cette mesure s'applique aux entreprises d'au moins 50 travailleurs. À ce niveau, les chiffres existent. Cela a été répété lors des auditions auxquelles nous avons procédé. Le but est de mettre ces chiffres en exergue ou en lumière afin d'impulser un véritable dialogue au sein même des entreprises.
En conclusion, j'espère que nous franchirons, aujourd'hui, un nouveau pas important en matière de promotion de l'égalité entre les femmes et les hommes. Plus que jamais, en cette période de rigueur, de difficultés budgétaires pour chacun d'entre nous, il est indispensable que les femmes et les hommes soient égaux en termes d'indépendance économique, aujourd'hui et à l'avenir.

The equality of pay between women and men is a recurring issue. This has been discussed for a long time in Belgium but also at the European and international levels. Talking about it is good; acting is even better!
Today, for the first time in a number of years, a concrete proposal, intended to effectively combat the gender pay gap in our country, is subject to the vote of our assembly. Of course, the principle of equality between men and women and, in particular, that of equal pay, has been defended for decades. Of course, legislative initiatives in this area have already been made and, fortunately, progress has been made. However, as has already been said, the gender pay gap persists and cannot be tolerated. This text is therefore an important advance that we, as well as many women, have been waiting for for a long time.
The Social Emancipation Committee which I preside over has thus decided, a little more than a year now, to issue an opinion on its own initiative concerning precisely this problem of the gender pay gap to the attention of the Social Affairs Committee. In fact, it must be said, proposals from my group, the PS, but also other groups were already on the table. It was probably an obvious for many of us to have to work on this topic. Obviously, it was necessary to succeed but to succeed in a proposal that makes sense and can be a real lever to remove this wage gap without obviously blocking the economic development of our companies.
I insist on the fact that this text is truly the fruit of collective work. As a co-signatory of the text and above all as chairman of the Committee on Social Emancipation, I would like to thank all the political groups who participated in a very constructive way in the debate. The project on the table today is not a soft compromise. He is strong and will, I hope, be effective. Thank you again to all members of the Social Emancipation Committee.
Our meetings were numerous. We did a lot of auditions and we got there. Even though we accelerated the rate somewhat without distorting the quality, this work ended in a Thursday plenary session. The 8th of March fell on a Thursday. Beyond the effectiveness, it was an important symbol to see this text come to fruition today.
As recalled, even if we are not a bad student on the European level – I will not say that Belgium is a good student because as long as there is a pay gap, we will not be good – even if the figures differ according to studies and calculation methods, even if some try to make us believe that this problem does not exist or is limited, the pay gap between men and women is and remains a reality.
The proportion of this wage gap that cannot be explained objectively is also a reality!
Wage discrimination based solely on gender persists. The principle "equal work, equal wage", already enshrined in 1957 by the Treaty of Rome, is, however, still not a reality, and this, more than half a century later. This is unacceptable!
The consequences for women of wage inequality are immediate in terms of amounts received at the end of the month but they also manifest throughout their lifetime. Women are therefore unjustly exposed to an increased risk of poverty during their working life but also at the time of their retirement since their pension will be calculated on the basis of what they earned during their working life and will therefore, de facto, be lower.
The latest figures are eloquent. On average in Belgium, a man receives 950 euros of pension. It is still too little, but the average for a woman is 650 euros. No one can live with that money today.
According to the figures already recalled, the wage gap varies between 10% and 23% on the basis of a gross annual wage, all sectors confused and regardless of working time. The gap is even greater if one takes into account only the private sector and if one takes into account the famous extra-legal advantages such as utility cars, GSM, computers, etc.
We have therefore decided to continue our work in line with the conclusions of the Conference on Pay Gap held during the Belgian Presidency of the European Union in late 2010. We also followed a series of recommendations from the Institute for Gender Equality. When the government announced, in its government agreement, that it wanted to address the problem, we put the double blows because we knew we would be supported.
As I said before, this text will not eliminate the pay gap from day to day. There is still a lot to be done to reconcile private and professional life.
But, I am convinced, it will ⁇ allow to reduce it by cutting it even better. In fact, it should lead to a more effective implementation of existing legislation, an even greater accountability of social partners and ⁇ , but also a greater transparency of wages. This will obviously only be possible with the contribution of each and thanks to the complementarity of the proposed measures, namely the gender segregation of certain data from the social balance sheet, including the well-known extra-legal benefits, the assessment of the neutral character of the classifications of functions developed by the parity committees, the obligation for employers to carry out an analysis of their remuneration structure with a key action plan if inequalities are found, in order to overcome them and, finally, the possibility of appointing a mediator within the company.
These are so many measures for which we found it appropriate to involve every level of social consultation, the interprofessional level, the sectoral level and the level of the company.
I would also like to reaffirm that these measures, in particular that relating to the obligation for the employer to carry out an analysis of the wage structure, will not result in a considerable additional workload. I’m not saying there will be no one at all, but it will, in any case, not be enormous since this measure applies to companies of at least 50 workers. At this level, the numbers exist. This was repeated during the hearings we conducted. The aim is to highlight or highlight these figures in order to drive a true dialogue within the companies themselves.
In conclusion, I hope that today we will take another important step in promoting equality between women and men. More than ever, in this period of rigour, budgetary difficulties for each of us, it is indispensable that women and men are equal in terms of economic independence, now and in the future.

Het is inderdaad niet toevallig dat we hier vandaag voor de bespreking en de stemming staan. Omdat we over de verschillende fracties heen hebben gezegd dat we dit tot een goed einde willen brengen en hier graag vandaag in de plenaire vergadering over willen kunnen stemmen, slagen we er vandaag in met een afgerond voorstel hier te staan. Dit voorstel, gemaakt met de inspanningen en inbreng uit de verschillende fracties, beoogt vooral het bestrijden van de fameuze loonkloof. Inzake de loonkloof is er heel wat discussie over de cijfers, maar uit onderzoek blijkt toch dat het over de verschillende sectoren heen zou gaan over 10 %. In de privésector bedraagt de loonkloof op basis van de bruto-uurlonen bij bedienden 25 %, bij arbeiders 17 % en bij statutaire ambtenaren is de loonkloof quasi onbestaande. Dat is een belangrijk aspect om mee voorop te stellen, naast het feit dat meer dan een derde van de vrouwen financieel afhankelijk is van het inkomen van haar huisgenoten. Bij mannen is dat één op tien. Het is relevant om te stellen dat het inkomen van vrouwen, ook wanneer dit te maken heeft met de inspanningen en het werk dat ze doen, dichter moet liggen bij dat van mannen.
De loonkloof is toe te schrijven aan talrijke en complexe factoren. Ik denk aan tewerkstelling in verschillende sectoren of de keuze voor deeltijds werk. Vierenveertig procent van de vrouwen kiest voor deeltijds werk tegenover 9 % bij de mannen. Verder is er werkonderbreking voor zorgtaken, maar ook de ongelijke waardering van mannelijke en vrouwelijke taken, en zelfs ook ongelijk loon voor een zelfde takenpakket. Since we have said across the various political groups that we want to bring this to an end and that we would like to vote on it today in the plenary session, we succeed today in presenting a rounded proposal here. This proposal, made with the efforts and contributions of the various groups, aims primarily to combat the famous wage gap. With regard to the wage gap, there is a lot of discussion about the figures, but research shows that it would be over 10% across the different sectors. In the private sector, the wage gap based on gross hourly wages for employees is 25 %, for workers 17 % and for statutory officials, the wage gap is virtually nonexistent. This is an important aspect to be emphasized, in addition to the fact that more than one-third of women are financially dependent on the income of their householdmates. For men, this is one in ten. The difficult combination of work and family remains one of the major causes of women’s financial dependence.
We believe that the fight against this wage gap is a matter of fairness, but it is also of great importance for women’s economic independence, not only during the period they work, but indeed, as colleague Déom has cited, up to the amount of pension. After all, we must conclude that the consequences of an incomplete career and a low salary also have consequences on the amount of pension women receive. The pension gap is not up to 10%, but up to 23%. Nearly 60 % of women who are entitled to retirement claim less than EUR 1 000 per month. Retired women are five times more likely to fall below the poverty line.

Dit zijn voldoende redenen om te zeggen dat wij er effectief belang bij hebben dat deze loonkloof zo klein mogelijk wordt.
De eerste initiatieven dateren van heel lang geleden. Ik verwijs naar toenmalig minister Miet Smet uit onze partij – toen nog CVP –, die in 1994 reeds aandacht vroeg en acties ondernam om bij de functieclassificaties en de waardering van jobs de aandacht te trekken op het feit dat men een andere waardering had voor jobs die door vrouwen werden uitgeoefend dan voor jobs die door mannen werden uitgeoefend. Er waren verschillende campagnes, gedragscodes en sectorale systemen om de functiewaardering op een andere manier te organiseren.
Daarom hebben wij vanuit onze fractie veel aandacht willen geven aan de functieclassificatie, het onderhandelen, de sociale partners en de loononderhandelingen waaraan zij moeten meehelpen. Samen met de collega’s van de Senaat hebben wij in 2009 een voorstel ingediend om maatregelen te nemen om de loonkloof te dichten.
Wij vinden deze zaken terug in het voorstel van vandaag, waarbij wij het in eerste instantie belangrijk vonden om de loonkloof zichtbaar te maken. Wij hebben er effectief voor gepleit om de sociale balans transparant te maken, want het is een publiek document en het is gekoppeld aan de jaarrekening. Het is ook een gevalideerd document doordat het een jaarverslag is.
Wij hebben ervoor gepleit om de gegevens die in het jaarverslag komen over de lonen uit te splitsen in gegevens over mannen en gegevens over vrouwen, waarbij het niet enkel om het basisloon gaat maar waarbij duidelijk gemaakt wordt welke sociale voordelen men gekregen heeft. We advocate for a social balance, which will enable objective data to make averages and comparisons within sectors and between sectors, to look at the reasons for this inequality and to enable further monitoring.
The preparation of a two-year analysis report will also contribute to bridging that gap and will provide the opportunity to develop further action programmes.

Monsieur le président, chers collègues, en cette Journée mondiale de la Femme, nous ne pouvions rêver d'un meilleur timing pour examiner en séance plénière cette proposition de loi qui vise à réduire l'écart salarial entre les hommes et les femmes.
Avant d'aborder la proposition de loi déposée sur nos bancs, je souhaite évoquer quelques chiffres. L'écart salarial entre les hommes et les femmes, calculé sur la base d'un salaire horaire brut, s'élève à 10 %, tous secteurs confondus. Ce chiffre général dissimule cependant de grandes différences de statut. Ainsi, dans le secteur privé, il est de 25 % chez les employés et de 17 % chez les ouvriers. Plus les salaires en jeu sont importants, plus l'écart salarial croît. Une des causes de cette différence résulte du fait que les femmes travaillent beaucoup plus souvent à temps partiel que les hommes.
Plusieurs propositions de loi étaient sur la table du parlement et ont été discutées. Nous avons travaillé de nombreux mois au sein du comité d'avis pour l'Émancipation sociale en vue de peaufiner un texte commun. La proposition qui nous est soumise aujourd'hui est le fruit d'un compromis.
Au cours des discussions, le MR a insisté sur l'importance du respect de la concertation sociale. Nous avons demandé leur avis aux partenaires sociaux. Nous avons également rappelé l'importance du respect et de la protection de la vie privée. En effet, nous avions exprimé des inquiétudes quant à la fonction de médiateur. Pour cette question et bien d'autres, nous avons tenu compte dans nos amendements de l'avis de la Commission de la protection de la vie privée.
Au fil des débats, le texte a grandement évolué. Nous pouvons relever les améliorations suivantes. Premièrement, les PME sont exclues de son champ d'application.
Deuxièmement, la rédaction du rapport d'analyse a été simplifiée. La proposition de départ prévoyait plusieurs rapports, dont une évaluation. Nous avons supprimé les doublons en ne prévoyant que la rédaction d'un seul rapport.
Troisièmement, les délais prévus ont été adaptés et correspondent désormais mieux à la réalité vécue.
Quatrièmement, le rôle du médiateur a été précisé. Ainsi, son indépendance a été rappelée, de même que la nécessité de prendre un arrêté royal déterminant ses compétences et aptitudes ainsi que les règles déontologiques qu'il devra respecter. La protection contre le licenciement a été supprimée. De plus, le recours au médiateur est devenu une simple possibilité, et plus une obligation. Enfin, la flexibilité de la mise en œuvre de la loi est garantie.
Cinquièmement, la Commission de la protection de la vie privée rendra un avis conforme sur l'arrêté royal déterminant les compétences, aptitudes et règles de déontologie du médiateur. La force juridique d'un avis conforme est supérieure à un simple avis.
Sixièmement, dans un souci de respect de la vie privée, les risques d'identification du travailleur ont été minutieusement cadrés et limités afin de garantir l'anonymat et le caractère confidentiel des données.
Enfin, septièmement, nous pouvons nous réjouir d'avoir pu obtenir l'introduction d'une procédure comply or explain, dans le cadre d'éventuelles sanctions qui seraient infligées aux commissions paritaires.
Je ne reviendrai pas ici sur la mesure concernant le bilan social, pour laquelle le MR avait proposé une solution alternative, plus adéquate à nos yeux et moins contraignante pour les entreprises, via la fiche Trillium. Cette solution n'a malheureusement pas été suivie par les membres de la commission alors qu'elle aurait permis une grande simplification administrative. Je le regrette, mais j'espère que les partenaires sociaux reviendront sur cette possibilité ultérieurement.
Chers collègues, avant de terminer, il importe de dire qu'au-delà des mesures proposées, qui encadrent les relations de travail, la lutte contre l'écart salarial est un débat sociétal dont les causes dépassent le monde de l'entreprise. En effet, pour combattre de manière efficace et durable l'écart salarial, nous devons aussi mieux adapter et multiplier les structures d'accueil des enfants, travailler sur les mentalités, promouvoir des comportements égalitaires, mieux informer les enfants et les parents des métiers d'avenir.
Nous devrons également prendre des mesures de soutien aux familles afin de permettre une conciliation plus aisée de la vie privée et de la vie professionnelle, telle que la déductibilité des frais de garde, les horaires adaptés, les titres-services, etc.
Par ailleurs, nous parlons beaucoup de l'écart salarial des salariés, mais très peu de celui des indépendants. Pourtant, ce phénomène est bien présent également, contre lequel il nous faudra aussi lutter. Cela fera sans doute l'objet d'un débat ultérieur.
En guise de conclusion, je tiens à remercier l'ensemble des collègues qui ont travaillé sur ce sujet. Ce fut parfois compliqué, car ce débat est passionnant, parfois passionné, mais l'esprit constructif de tout un chacun a permis d'aboutir favorablement. Je tenais à le souligner ce soir.

Over the course of the discussions, the text has evolved considerably. We can see the following improvements. First, SMEs are excluded from its scope.
Secondly, the drafting of the analysis report has been simplified. The initial proposal provided for several reports, including an evaluation. We have removed duplicates by providing only the writing of a single report.
Thirdly, the scheduled deadlines have been adjusted and now correspond better to the reality experienced.
Fourth, the role of the Ombudsman has been clarified. Thus, his independence was recalled, as well as the need to make a royal decree determining his competences and aptitudes as well as the deontological rules he will have to respect. The protection against dismissal has been removed. Furthermore, the use of a mediator has become a mere possibility, and more a duty. Finally, flexibility in the implementation of the law is guaranteed.
Fifth, the Privacy Protection Commission will issue a consistent opinion on the Royal Decree determining the Ombudsman’s competence, skills and ethical rules. The legal force of a conforming opinion is greater than a simple opinion.
Sixth, in order to respect privacy, the risks of identifying the employee have been carefully framed and limited in order to guarantee the anonymity and confidentiality of the data.
Finally, seventh, we can be pleased to have been able to obtain the introduction of a compliance or explanation procedure, as part of possible sanctions that would be imposed on parity committees.
I will not return here to the measure concerning the social balance sheet, for which the MR had proposed an alternative solution, more appropriate in our eyes and less binding for companies, via the Trillium file. This solution was unfortunately not followed by the members of the committee although it would have enabled a great deal of administrative simplification. I regret this, but I hope that social partners will review this possibility later.
Dear colleagues, before concluding, it is important to say that beyond the proposed measures, which frame the working relations, the fight against the wage gap is a social debate whose causes go beyond the business world. In fact, in order to effectively and sustainably combat the pay gap, we must also better adapt and multiply the childcare structures, work on mentalities, promote equal behaviors, better inform children and parents of future professions.
We will also need to take measures to support families in order to make it easier to reconcile private and professional life, such as deductibility of custody fees, adapted schedules, service titles, etc.
In addition, we talk a lot about the wage gap among employees, but very little about that of the self-employed. However, this phenomenon is also present, which we will also have to fight against. This will probably be the subject of further discussion.

Collega’s, vandaag is het Internationale Vrouwendag en wordt de eerste staking van vrouwen herdacht, gericht tegen de slechte arbeidsomstandigheden in de textielindustrie. Deze staking was het begin van een lange strijd tegen de vrouwendiscriminatie. De voorbije jaren zijn er dan ook al heel wat onbegrijpelijke en onaanvaardbare drempels weggewerkt. Ter herinnering haal ik er enkele aan om te tonen van hoever we eigenlijk komen.
In 1948 kregen vrouwen stemplicht op parlementair niveau. Zij mochten zich voor het eerst verkiesbaar stellen. De periode dat gehuwde vrouwen op het niveau van het burgerlijk recht werden gelijkgesteld aan ontvoogde minderjarigen is voorbij. De tijd dat moeders niet bij de doop van hun pasgeboren kind mochten zijn omdat ze onrein waren, ligt gelukkig ook achter ons. Vrouwen die kiezen voor het BOM-moederschap zijn niet meer verplicht om hun eigen kind te adopteren.
Ook op het vlak van tewerkstelling is er gelukkig enorm veel veranderd. Lange tijd werden vrouwen niet geacht te werken, tenzij eventueel in de periode tussen hun schooltijd en hun huwelijk. Gelukkig is deze situatie fel verbeterd Het aantal vrouwen dat vandaag in de arbeidsmarkt stapt is een flink stuk hoger dan in de naoorlogse periode. De scholingsgraag is verhoogd en de kwaliteit van de arbeid is verbeterd.
Er zijn met andere woorden veel goede dingen gerealiseerd, maar het wetsontwerp dat we nu bespreken toont aan dat nog steeds niet alle discriminaties zijn weggewerkt.
Het wetsvoorstel dat heel veel voorafgaand werk heeft gevraagd zou er echt niet gekomen zijn zonder de goede samenwerking tussen de verschillende meerderheidspartijen en met de steun van Ecolo-Groen. Ik wil al die mensen opnieuw bedanken omdat het punt vandaag op de agenda staat.

Dat verdrag stelt letterlijk dat arbeid van gelijke waarde gelijk beloond moet worden en dat het geslacht op geen enkele manier een criterium mag zijn bij de vaststelling van het loon. De bedoeling in die periode was eigenlijk het probleem van de goedkope vrouwenarbeid aan te pakken.
De krachtlijnen werden spijtig genoeg door de patroons afgezwakt. Er werd – houd u vast – door hen gewezen op het laag rendement van de vrouwelijke arbeidskrachten, op de internationale concurrentie – de Belgische loonkosten zouden te hoog zijn – en op het feit dat de vrouw geen kostwinner was.
De vrouwenbeweging vroeg daarom reeds in de jaren ‘50 om een systeem van functiekwalificaties te gebruiken om loonverschillen aan te tonen. Toen al werd de moeizame opstelling van functieclassificaties door werkgevers als excuus aangevoerd om de invoering van een gelijke bezoldiging te vertragen.
Gelukkig was de arbeidersbeweging veel positiever. Voor hen was niet alleen de rechtvaardigheid een argument, maar ook de wegvallende loonconcurrentie tussen mannen en vrouwen.

The Treaty of Rome was signed in 1957. That convention literally states that work of equal value must be equally remunerated and that gender must in no way be a criterion in determining wages. The intention at that time was actually to address the problem of cheap female labor.

Depuis plus de cent ans, les féministes dénoncent l'inégalité de rémunération. Dès sa fondation en 1919, l'OIT pointait l'écart salarial entre les hommes et les femmes. C'est donc un combat qui dure depuis longtemps. Tout le monde a en tête le slogan des ouvrières de la FN: "À travail égal, salaire égal". Malheureusement, ce n'est toujours pas le cas!
On aurait pu croire que lorsque les femmes accéderaient à l'éducation, cet écart fondrait. De nos jours, les femmes étudient, même mieux que les hommes, et malgré cela, l'écart salarial existe toujours.
On le sait, cette différence a diverses causes. L'écart salarial a diminué, mais pas de manière définitive. Par exemple, entre 2000 et 2005, celui-ci s'est creusé à nouveau.
Par conséquent, attendre que cet écart disparaisse ne fonctionne pas. Il faut donc agir. Il ne s'agit pas seulement de l'interdire – la discrimination est interdite depuis de nombreuses années et l'écart salarial persiste –, il faut se doter d'autres outils.
Les causes sont diverses. La première est peut-être le jeu de l'offre et de la demande. Manifestement, de nombreux employeurs préfèrent encore le travail des hommes. Les femmes travaillent beaucoup dans des secteurs où les rémunérations sont moins fortes. Il suffit de penser à des secteurs très utiles comme l'aide aux personnes où les femmes sont sur-représentées. Dans certains postes, on a encore trop tendance à ne pas confier de responsabilités aux femmes. Il y a également une sur-représentation des femmes dans le travail à temps partiel.
Même quand on enlève tous ces éléments, l'écart salarial persiste. C'est la raison pour laquelle il fallait agir. Nous nous sommes donc réunis pendant plus d'un an. On aurait presque pu craindre de ne pas y arriver. Enfin, il y a eu un accord dans lequel chacun a pu se retrouver. J'avoue que cela fait plaisir!
Ce texte reprend différents aspects. Dans le champ de la concertation, au niveau interprofessionnel, au niveau des secteurs ou au niveau de l'entreprise, patrons et syndicats travaillent, discutent et avancent sur cette thématique. Au niveau individuel, on a fait en sorte que la médiation et les plaintes puissent avancer de manière plus efficace. Nous espérons qu'avec cet arsenal, nous pourrons voir les choses évoluer.
En cette Journée de la Femme, je me réjouis du vote de ce texte à une très large majorité. Mais il y a d'autres domaines dans lesquels les femmes restent des victimes majeures. Au niveau des mesures prises en matière de crédit-temps, 84 % de ces crédits-temps sont choisis par les femmes car ce sont elles qui assument le plus gros des responsabilités familiales; dès lors, ces mesures vont les toucher tout particulièrement.
Quand on voit les mesures prises en matière de chômage, la dégressivité va toucher de plein fouet les cohabitants. Et ce sont à nouveau les femmes qui vont en être les victimes, arrivant au niveau de ce que les associations de femmes appellent un forfait ridiculement bas.
Elles seront évidemment touchées par les mesures relatives aux pensions. Elles le sont déjà: à l'heure actuelle, 33 % des pensionnés mais 59 % des pensionnées perçoivent une pension de moins de 1 000 euros. Les mesures visant à raboter les assimilations vont bien sûr faire souffrir en premier les femmes.
En 2007, ce parlement s'était réjoui du vote de la loi sur le gender mainstreaming. Il s'agit d'examiner l'impact différencié d'une nouvelle législation sur les hommes et les femmes. Malheureusement, cette loi de 2007 a bien du mal à s'imposer dans la pratique. On l'a vu au moment du débat sur les pensions lorsqu'on a interrogé le ministre des Pensions, on l'a vu lorsqu'on a pris des mesures en matière d'emploi et qu'on a interrogé la ministre de l'Emploi, on le voit régulièrement lorsqu'on discute des notes de politique générale des différents ministres: on oublie ce fameux volet gender mainstreaming. Cinq ans plus tard, cette loi n'est toujours pas appliquée.

Even when all these elements are removed, the pay gap persists. That is why we had to act. We have been together for more than a year. We could almost fear not being able to do so. Finally, there was an agreement in which everyone could find themselves. I must confess that it is a pleasure!
This text contains various aspects. In the field of consultation, at the interprofessional level, at the level of sectors or at the level of the company, patrons and trade unions work, discuss and advance on this theme. At the individual level, mediation and complaints can be progressed more effectively. We hope that with this arsenal, we can see things evolve.
On this Women’s Day, I look forward to the vote of this text by a very large majority. But there are other areas where women remain the major victims. Slechte arbeidsomstandigheden, lage lonen en lange werktijden in de textielindustrie waren meer dan een eeuw geleden de strijdpunten van de vrouw, emancipatie en het begraven van de seksediscriminatie de doelen. Die povere werkomstandigheden van de vrouw behoren ondertussen tot een ander tijdperk, maar de loonkloof tussen mannen en vrouwen is nog steeds realiteit. Ik ben dan ook tevreden dat op deze plenaire vergadering, net op deze symbolische dag, over een wetsvoorstel zal worden gestemd ter bestrijding van de loonkloof.

Sinds jaren wordt het dossier van de loonkloof behandeld in de adviescommissies Gelijke Kansen van Kamer en Senaat. Sinds jaren duikt het telkens op bij de bespreking van de beleidsnota’s. Ook de sociale partners hebben doorheen de jaren heel wat acties ondernomen om de naleving van het principe van een gelijk loon voor mannen en vrouwen te verkrijgen. Ondanks alle engagementen was de vooruitgang op het terrein echter beperkt.
Het is dan ook lovenswaardig dat een aantal Parlementsleden heeft samengewerkt om een voorstel van wet op te stellen inzake de strikte aanpak van de loonkloof tussen vrouwen en mannen.

De factoren die de loonkloof bepalen, zijn onderhand bekend. Een gedeelte van de loonkloof kan worden verklaard door de horizontale segregatie. Zo kiezen vrouwen vaak voor welzijnssectoren en minder voor welvaartssectoren waar de lonen hoger liggen. Ook de verticale segregatie speelt een rol. Vrouwen worden namelijk meer tewerkgesteld in lagere, uitvoerende of ondersteunende functies, jobs die minder goed worden betaald, jobs die geen extralegale voordelen bieden.
De meeste studies komen tot de conclusie dat een deel van het loonverschil te wijten is aan de functieclassificatiesystemen en systemen om functies te beschrijven. Zij leiden immers vaak tot onderwaardering van typisch vrouwelijke functies. Ook het negeren van vrouwelijke eigenschappen leidt tot het onderwaarderen van de lonen van werkneemsters. Het is onder meer aan deze problematiek dat het wetsvoorstel probeert te werken door actie te stimuleren op het niveau van het interprofessioneel en sectoraal overleg.
Tijdens de onderhandelingen over de akkoorden moet het thema van de loonkloof op de agenda worden geplaatst, moet over maatregelen worden onderhandeld en zullen in het bijzonder de functieclassificatiesystemen genderneutraal moeten worden gemaakt. Essentieel is dat op ondernemingsniveau meer loonklooftransparantie wordt afgedwongen. Door een aantal gegevens in de sociale balans per geslacht op te splitsen, krijgen wij een beter inzicht in de gender- en loonkloofsituatie in ondernemingen.

The factors that determine the wage gap are well known. Part of the wage gap can be explained by the horizontal segregation. For example, women often choose welfare sectors and less for welfare sectors where wages are higher. Vertical segregation also plays a role. In fact, women are more employed in lower, executive or supporting positions, jobs that are less well paid, jobs that do not offer extra-legal benefits.
Most studies conclude that part of the pay gap is due to the function classification systems and systems to describe functions. After all, they often lead to underestimation of typically female functions. Ignoring female traits also leads to underestimating the wages of female workers. Among other things, it is on this issue that the bill seeks to work by stimulating action at the level of interprofessional and sectoral consultation.

Die vrouwen worden vandaag bovenmatig gestraft door de huidige regering met haar besparende maatregelen. Ik hoop dat dat binnenkort wordt gecorrigeerd, want ook hiermee pakt men het probleem van de loonkloof aan. Ook voor dat front moet er aandacht zijn. These women are now excessively punished by the current government with its austerity measures. I hope that this will be corrected soon, because this also addresses the problem of the wage gap. Attention should also be paid to this front. One cannot, on the one hand, assert that it is necessary to work on different fronts and to submit the present bill, while on the other hand, on other fronts, one makes it much more difficult for those women and those families.

Mijnheer de voorzitter, leden van de regering, collega’s, wij hebben onderhavig wetsontwerp besproken op 15 februari van dit jaar. Minister De Crem heeft in zijn algemene inleiding gezegd dat er voor hem drie belangrijke elementen in het wetsontwerp naar voren komen.
Ten eerste is er de nieuwe manier van rekruteren. Het departement hoopt met de nieuwe classificatiemethode meer laaggeschoolden binnen te halen.
Ten tweede wordt de beroepsprocedure bij de aanwerving afgeschaft, omdat die dan zonder voorwerp is.
Ten derde wordt nu vooraf gezegd dat tatoeages of piercings die gevaar kunnen opleveren bij militaire operaties, niet kunnen.

In een aantal bepalingen kan onze fractie zich echter niet vinden. Ik heb die al kort aangehaald in de commissie. Ik maak van de gelegenheid gebruik om daarbij wat toelichting te geven. Een eerste bepaling waarmee onze fractie een probleem heeft, is de bepaling in artikel 4 van het ontwerp. Het artikel heeft tot doel te kunnen afwijken van de algemene regel die een wervingssessie aan een bepaald taalstelsel bindt. De bedoeling is dat er in uitzonderingen kan worden voorzien door het openen van een vacature zonder dat een taalstelsel wordt vastgesteld, wanneer er een bijzondere werving dient te gebeuren waarbij een zeer specifieke behoefte moet worden ingevuld en het behoren tot een bepaald taalstelsel ondergeschikt is aan de technische hoedanigheden.
Het voorstel luidt als volgt: “De minister mag zich evenwel onthouden het taalstelsel van de vacatures van een wervingssessie van de bijzondere werving te bepalen indien hij oordeelt dat het beperkte aantal vacatures van deze sessie het rechtvaardigt.” Onze fractie kan het voorstel tot wijziging principieel misschien wel steunen, gezien de nood aan een specifieke functie, maar u moet toch toegeven, mijnheer de minister, dat de bepaling voor precedenten kan zorgen die vragen oproepen. U gaf in uw toelichting een aantal voorbeelden waarvoor de wijziging gebruikt zou kunnen worden, zoals geneesheer-specialist en muzikant, maar eigenlijk zijn de functies totaal niet afgelijnd. In principe kan de wijziging, volgens de wettekst, voor alle functies worden toegepast.
Mijnheer de minister, wij willen u nog het voordeel van de twijfel geven, maar u blijft natuurlijk niet eeuwig minister van Landsverdediging.

De eerlijkheid gebiedt ons om te zeggen dat onze fractie iets minder vertrouwen heeft in een eventuele Franstalige opvolger. Hierbij rijst de vraag wat het criterium is op basis waarvan een minister oordeelt of de situatie zo’n uitzondering wel rechtvaardigt. Dat staat nergens gedefinieerd. De openstelling van een vacature zonder dat het taalstelsel wordt vastgesteld, vormt een uitzondering. Zo staat het in uw toelichting, maar dat vinden we niet terug in de wettekst. Wij dienen in de commissie dus een amendement in waarin wordt bepaald dat de minister in voorkomend geval zijn oordeel schriftelijk dient te motiveren en voor advies dient voor te leggen aan de Vaste Commissie voor Taaltoezicht, die belast is met de controle op het gebruik der talen bij het leger.
Een tweede opmerking betreft artikel 7. Met het betreffende artikel wenst u het wervingsveld uit te breiden. Als eerste wijziging wenst u artikel 8 van de basiswet, dat handelt over de hoedanigheid van kandidaat-militair, aan te passen. De formulering waarin staat dat een kandidaat-militair Belg moet zijn of burger van een lidstaat van de Europese Unie, zou worden gewijzigd in “Belg zijn of burger van een andere lidstaat van de Europese Economische Ruimte of van de Zwitserse Bondsstaat”. De Raad van State haalt hieromtrent aan dat die bepaling niet verenigbaar is met artikel 10, tweede lid van de Grondwet. Dat lid bepaalt dat alleen Belgen tot de burgerlijke en militaire bedieningen benoembaar zijn. De Grondwet beperkt dus de toegang tot de krijgsmacht tot personen met de Belgische nationaliteit. Zoals ik u reeds heb gezegd, heeft de Raad van State hierop in het verleden ook al gewezen, onder meer in 2002 en in 2006, naar aanleiding van de wijziging van de wet betreffende het statuut van de militairen van het actief kader van de krijgsmacht.
Om het ontwerp dat nu voorligt uit te voeren, zou u in principe eerst de Grondwet moeten aanpassen. Maar wat zegt u? U zegt: ach, die Grondwet, wat is dat eigenlijk? Wij volgen de Raad van State niet en voeren de bepalingen in die wij willen. U legt het advies van de Raad van State dus simpelweg naast zich neer.
Uw voorganger, Kamervoorzitter Flahaut, deed in 2007 bij de wijziging van de wet betreffende het statuut van de militairen hetzelfde. Ook hij legde het advies van de Raad van State naast zich neer. Onze fractie diende toen een amendement in. Wij zullen dat dadelijk opnieuw doen, net als in de commissie, want wij zijn consequent. Wat blijkt? Mijnheer de minister, u diende in 2007 ook een amendement in en volgde toen dus wel de Raad van State. U diende identiek hetzelfde amendement in als het Vlaams Belang.

Wat deze bepaling betreft, zullen wij ons amendement ook opnieuw indienen. Nogmaals vragen wij om de woorden waarvan sprake weg te laten. Bijgevolg vragen wij om uitsluitend personen met de Belgische nationaliteit toe te laten tot de krijgsmacht. Ter zake verschillen wij trouwens van mening met de andere oppositiepartij, de N-VA.

Dit zou gebeuren op advies van het stafdepartement Inlichting en Veiligheid, enerzijds op basis van de lijst van sollicitanten en anderzijds op basis van de ledenlijst van extremistische bewegingen. Een dergelijk lidmaatschap zou, zo motiveert u in uw ontwerp, in conflict zijn met de rechten en plichten van elke militair. De persoon in kwestie mag zich niet inlaten met enige werkzaamheid die in strijd is met de Grondwet en met de wetten van het Belgische volk.
Tijdens de commissie heb ik hieromtrent volgende bijkomende inlichtingen gevraagd. Welke zijn deze extremistische bewegingen? Bestaat hiervan toch een lijst? In het verleden werd dit door de ministers van Justitie steeds ontkend of werd daaromtrent rond de pot gedraaid. Op een vraag van onze fractie in een vorige legislatuur werd door de toenmalige minister van Justitie uitgelegd hoe het begrip extremisme precies moet worden gedefinieerd. Het antwoord luidde als volgt, en ik citeer uit de vragen en antwoorden van 12 februari 2001: “Het begrip extremisme wordt als volgt opgevat: racistische, xenofobe, anarchistische, nationalistische, autoritaire of totalitaire opvattingen of bedoelingen, ongeacht of deze van politieke, ideologische, confessionele of filosofische aard zijn.”
Collega’s, u hebt het goed gehoord, het betreft nationalistische opvattingen ongeacht of deze van politieke aard zijn. Ik heb toen gevraagd of dit ook het lidmaatschap van een politieke partij betreft die het Belgische regime bedreigt. U hebt mij aangeraden deze vraag te stellen aan uw collega, de minister van Justitie, mevrouw Turtelboom. Dit heb ik gisteren gedaan. Mijnheer de voorzitter, mijnheer de minister, collega’s, het voorliggend wetsontwerp is in wezen zeer goed. Het kan een oplossing bieden voor het huidige tekort aan kandidaat-vrijwilligers, de soldaten dus, zeker in Vlaanderen. Met het wetsontwerp wil Defensie specifiek voor die sollicitant-vrijwilliger een betere en efficiëntere werving invoeren. Het zogenaamde psychometrisch model is meer op competenties gericht dan op het pure intellectueel potentieel van de sollicitant. Dat is een goede zaak. Dat is ook door alle fracties in de commissie benadrukt.
In principe zou ik vandaag zelfs niet interveniëren. Uit nieuwsgierigheid ging ik toch eens kijken in het verslag van de commissie voor de Justitie van gisteren. Collega Ponthier heeft het al aangehaald dus ik vrees voor u dat ik een klein beetje in herhaling zal vallen. Ik doe het toch, omdat de screening van sollicitanten op lidmaatschap van zogenaamde extremistische bewegingen een heel pertinente discussie is. Als we het wetsontwerp lezen, zien we op het eerste gezicht weinig problemen. Er staat als voorwaarde waaraan de sollicitant moet voldoen het volgende: "In voorkomend geval mag er geen negatief veiligheidsadvies gegeven zijn door het stafdepartement Inlichtingen en Veiligheid, ADIV, afgeleverd op basis van een veiligheidsverificatie overeenkomstig de wet van 11 december 1998" enzovoort.
Op zich is er dus niet meteen een probleem, maar in uw memorie van toelichting staat zeer expliciet dat Defensie voor de screening van sollicitanten de lijst van sollicitanten naast de lijst van bestaande extremistische bewegingen gaat leggen. Dat roept al wat meer vragen op. Wij hebben het daarover ook al gehad in de commissie, en ik heb u toen gevraagd welke die bewegingen zijn. Dat zou ik graag weten. U verwees toen naar uw collega van Justitie en naar het Comité I. Uiteraard zullen wij onze mensen de vraag aldaar laten stellen.
In haar antwoord op de mondelinge vraag van collega Ponthier zegt minister Turtelboom zeer duidelijk dat die lijsten bestaan en dat ze ingevolge de privacywetgeving niet bij de screening van kandidaat-militairen kunnen worden gebruikt, en dat de lijst alleen bestemd is voor doeleinden van de burgerlijke politie. Daarbij stel ik mij heel wat vragen, mijnheer de minister.
Volgens mij zijn er twee mogelijkheden. Minister Turtelboom zegt dat wat u in uw memorie van toelichting bij uw wetsontwerp opneemt, onwettig is. Ofwel weten u en Defensie niet dat deze praktijk die – laten wij eerlijk zijn – al jaren aan de gang is, niet wettig is en dan moet de memorie van toelichting minstens worden aangepast aan de realiteit en aan de wettelijkheid. Ofwel weten u en Defensie wel dat wat u voorstelt onwettig is en dan betreedt u de weg van de onwettigheid.
Mijnheer de minister, het is het een of het ander. Ik stel voor om dit wetsontwerp terug te trekken en het opnieuw in de commissie ter bespreking voor te leggen, zodra u in de regering overeenstemming hebt bereikt over wat wel en niet wettig is.

In her response to the oral question of colleague Ponthier, Minister Turtelboom says very clearly that those lists exist and that they cannot be used in the screening of candidate-military candidates under the privacy legislation, and that the list is intended only for the purposes of the civil police. I think there are two possibilities. Minister Turtelboom says that what you include in your memorandum of explanation with your bill is illegal. Or you and Defence do not know that this practice, which – let us be honest – has been ongoing for years, is not legal and then the memory of explanation must at least be adapted to the reality and to the legality. Verder wordt een bepaling toegevoegd die toelaat te vermijden dat een sollicitant zich op de dag van zijn inlijving aanmeldt met tatoeages of piercings die een gevaar opleveren bij het gebruik van militaire uitrusting en materieel of die afbreuk zouden kunnen doen aan de eer of waardigheid van de staat als militair.
Dan zijn er een aantal specifieke vragen die door mevrouw Ponthier en de heer Maertens naar voren zijn gebracht. Ik zou het eerst willen hebben over het lidmaatschap van extremistische bewegingen, waarnaar mevrouw Ponthier en de heer Maertens hebben verwezen. Veiligheid, orde en tucht zijn bij deze beschouwingen centraal gebleven. U zult het met mij eens zijn dat er geen extremisme kan geduld worden in de rangen van de Belgische Defensie. Mevrouw Turtelboom, de collega van Justitie, heeft gisteren in de commissie voor de Justitie een aantal antwoorden ter zake gegeven. Ik zal vandaag enkele bijkomende beschouwingen maken die daarbij aansluiten.
Er bestaat verwarring omtrent lijsten. Voor alle duidelijkheid, Defensie zal zich niet baseren op lijsten van Binnenlandse Zaken die opgesteld zijn voor doeleinden van bestuurlijke politie. Anderzijds informeren inlichtingendiensten zich in het raam van hun opdrachten uiteraard over organisatie, organiseren en organisaties en over doelstellingen en activiteiten van extremistische groeperingen en hun leden. Dat is waar het hier om draait. Ik heb geen enkele behoefte om daarover verwarring te laten bestaan. Wat het kennisnemen van geclassificeerde informatie betreft, dien ik te verwijzen naar de wettelijke regelingen die ter zake bestaan. Wat de ingewonnen adviezen betreft, verwijs ik naar het parlementair dossier dat we ten overvloede hebben kunnen bespreken in de commissie.
De nieuwe bepaling inzake sollicitanten bij Defensie houdt rekening met het advies van de afdeling Wetgeving van de Raad van State die de rechtsgrond, de bevoegdheid en de voorafgaandelijk te vervullen formaliteiten heeft onderzocht en ook met de bescherming van de persoonlijke levenssfeer, zoals deze wordt gewaarborgd in artikel 8 van het Europees Verdrag tot Bescherming van de Rechten van de Mens en in ons nationaal recht.

Gelet op haar specifieke opdracht en de gebruikelijke vergadermodus is deze Senaatscommissie het geschikte forum om de uitvoering van deze nieuwe bepaling op te volgen. Ik verwijs naar de uitzonderingsbepalingen in de privacywetgeving die u niet onbekend zullen zijn.
Ik herhaal mijn voorstellen met betrekking tot de extremistische bewegingen, die ik in de commissie voor de Landsverdediging naar voren heb gebracht, hoewel ik meen te mogen zeggen dat deze binnen Defensie geen onoverkomelijk probleem vormen, noch wat aanwezigheid betreft, noch wat kwalificatie betreft.

Ik kan wel iets zeggen dat niet in de commissie werd aangehaald. We hebben wel gesproken over het psychometrische model. Ik wil enige zaken toevoegen met betrekking tot de afschaffing van de beroepsprocedure tegen een beslissing tot toewijzing van een vacature.

De niet-Belgen, burgers van de Europese Unie, vertegenwoordigen historisch 2 tot 4 % van de sollicitanten. Wat het vertrek tijdens de vorming betreft, wordt sinds 2004 een gemiddelde van 55 % vastgesteld voor de kandidaten die niet-Belg zijn, terwijl het globale gemiddelde 43 % bedraagt. Daar het een beperkte populatie betreft, is het gevaarlijk om hieruit conclusies te trekken of enige extrapolatie te maken.
