Mijnheer de voorzitter, collega’s, enkele weken geleden, bij de voorstelling van de verkeersonveiligheidsstatistieken van 2011, heb ik al aangekaart dat elke week in ons verkeer ongeveer vijftien mensen sterven. Vijftien mensen per week. We kunnen dat cijfer niet genoeg herhalen en moeten er meer en meer bij stilstaan.
Handhaving is de essentiële sleutel om te komen tot veiliger verkeer, samen met natuurlijk alle andere mogelijke inspanningen. Handhaving moet uiteraard ook gevolgd worden door een geloofwaardige afhandeling van de boetes. Dat is het onderwerp van het voorliggende wetsontwerp. Het is essentieel dat opgelegde boetes ook effectief worden betaald, zo niet dreigt het hele draagvlak voor de afhandeling van boetes onderuit te worden gehaald. Er mag absoluut geen gevoel van straffeloosheid ontstaan. Iedereen moet op dezelfde voet behandeld worden. Een boete krijgen is een boete betalen!
Niet alleen is een boete een boete, een overtreding is ook een overtreding. De niet-betaalde minnelijke schikkingen zorgen momenteel voor ongeveer 25 % van de werklast bij de politieparketten. Vandaar de beslissing van sommige parketten om kleine overtredingen niet langer te vervolgen en te seponeren. Dan krijgt men situaties waarbij in het ene gerechtelijk arrondissement, bijvoorbeeld, overtredingen tot 137 kilometer per uur worden geseponeerd, terwijl dat in een ander arrondissement tot pakweg 127 kilometer per uur is. Dit brengt een vorm van discriminatie met zich mee van de ene burger ten opzichte van de andere, wat erg gevaarlijk is voor het draagvlak van ons handhavingsbeleid. Daarnaast is het essentieel dat politierechtbanken hun zittingscapaciteit kunnen reserveren voor zaken die echt belangrijk zijn. Het kan, bijvoorbeeld, niet dat in Antwerpen meer dan de helft van de 25 000 tot 30 000 dossiers, die jaarlijks door de politierechtbank worden verwerkt, over niet-betaalde boetes gaat. Dat zijn eenvoudige boetes waarover weinig discussie bestaat en die objectief zijn vastgesteld, bijvoorbeeld door snelheidscamera’s. De rechtbanken hebben belangrijkere zaken. Mr. Speaker, colleagues, a few weeks ago, at the presentation of the 2011 road safety statistics, I already noted that every week about fifteen people die in our traffic. Fifteen people per week. We cannot repeat that number enough and we need to keep up with it more and more.
Enforcement is the essential key to getting to safer traffic, along with, of course, all other possible efforts. Enforcement must of course also be followed by a credible handling of the fines. This is the subject of the present draft law. It is essential that imposed fines are also effectively paid, otherwise the entire support for the handling of fines is not threatened to be reduced. There should be no sense of impunity. Everyone should be treated on the same foot. Getting a penalty is paying a penalty!
Not only is a penalty a penalty, a breach is also a breach. Unpaid friendly settlements currently account for approximately 25 % of the workload at the police offices. Hence the decision of some parquets to no longer prosecute and suspend minor offences. In one judicial district, for example, offences are seized up to 137 kilometers per hour, while in another district it is up to 127 kilometers per hour. This entails a form of discrimination between one citizen and another, which is very dangerous for the support of our enforcement policy. An offence is an offence and should in no way depend on the place where it was committed.
In addition, it is essential that police courts can reserve their seating capacity for matters that are really important. For example, it cannot be that in Antwerp, more than half of the 25 000 to 30 000 cases processed annually by the police court are about unpaid fines. These are simple fines that have little discussion and are objectively determined, for example by speed cameras. The courts have more important cases. I think, for example, of driving under the influence of alcohol, accidents with dead or injured, driving despite degradation and so on. The released capacity should enable faster handling of these important files. The current bill is a good step forward.

Wij menen evenwel dat er nog meer nodig is. Er ligt nog meer werk op de plank, mijnheer de staatssecretaris.
U heeft deze morgen ook aangekondigd dat recidive op een betere manier zal worden aangepakt. Ik wil van de gelegenheid gebruikmaken om de vraag op te werpen of heel het systeem van de onmiddellijke inning niet aan een evaluatie toe is. Wanneer een onmiddellijke inning of een minnelijke schikking wordt betaald – ofwel spontaan, ofwel in een vroeger systeem na dagvaarding en in het nieuwe systeem via een bevel tot betaling –, is de overtreder vrij van iedere verdere vorm van strafvordering. Steeds meer ontstaat de indruk dat bestuurders van verkeersovertredingen vooral via die onmiddellijke inningen hun boetes afkopen en de boetes verder geen sturend effect meer hebben op het rijgedrag.
Ik denk dat wij drie specifieke gevallen voor ogen moeten houden waarin korter op de bal zou moeten worden gespeeld.
Ten eerste, de recidivegevallen. Als iemand veelvuldig wordt betrapt op verkeersinbreuken rijst de vraag of hij aan iedere verdere vorm van strafvordering kan blijven ontsnappen. Als die persoon elke keer opnieuw zijn onmiddellijke inning plichtsgetrouw betaalt, dan heeft het parket geen enkel element om die recidive vast te stellen en kan het dit niet op een goede manier aanpakken.
Een tweede geval vormen de alcoholovertredingen. Alcoholovertredingen tot 1,5 promille kunnen worden geregeld via onmiddellijke inning of minnelijke schikking. Ik vraag mij af of het geoorloofd is dat iemand met 1,5 promille in het bloed iedere verdere strafvordering kan ontlopen door het betalen van een simpele geldboete en dat de betrokkene in dergelijke gevallen niet kan worden veroordeeld tot, bijvoorbeeld, een verval van het recht tot sturen. Er moet worden bekeken of de wetgever dit echt voor ogen had bij het uittekenen van het systeem van de onmiddellijke inning.
Een derde element is de specifieke behandeling van de beginnende bestuurders. Zoals u weet, zijn beginnende bestuurders, de eerste twee jaar nadat zij hun rijbewijs hebben behaald, onderworpen aan strengere boetes en moeten zij eventueel hun rijopleiding opnieuw volgen als zij tijdens die termijn van twee jaar een zware overtreding begaan. First, the recurrence cases. If a person is frequently caught on traffic infringements, the question arises whether he can continue to escape any further form of criminal action. If that person repairs his immediate inning every time again, the parket has no element to establish that recidive and can not deal with it properly.
The second case is alcohol violations. Alcohol violations up to 1.5 promile can be settled through immediate inning or amicable settlement. I wonder whether it is lawful that a person with 1.5 promille in the blood can escape any further criminal action by paying a simple fine and that the person concerned in such cases cannot be condemned to, for example, an expiration of the right to send. It is necessary to examine whether the legislator really had this in mind when outlining the system of immediate collection.
A third element is the specific treatment of beginner drivers. As you know, new drivers are subject to harder penalties during the first two years after obtaining their driving license, and they may be required to resume their driving training if they commit a serious breach during that two-year period. If such infringements are automatically handled through immediate collection or amicable settlement, there also arises the problem that the parquet has no sight of them and that these measures for beginners in many cases are a fairly empty box.
I therefore think that there are a number of reasons to look further at the whole system of fines, the way of working with immediate invoices and friendly settlements.

Niemand betaalt graag boetes, maar wij gaan ervan uit dat de meeste boetes billijk zijn. Er bestaat in dit land een draagvlak voor het opleggen van die boetes. Boetes worden ook vaak gehanteerd wanneer men vaststelt dat er zich ineens een sterke verhoging voordoet van bepaalde verschijnselen, snelheid of dronkenschap, bijvoorbeeld. Boetes zijn een veel gekozen instrument.
Wij hebben vastgesteld dat vorig jaar het aantal verkeersongevallen ernstig is toegenomen. Ik ben dus een beetje verwonderd dat er de voorbije jaren een beleid werd gevoerd op basis van onvolledige cijfers die men niet kan interpreteren. Wat dat betreft, zijn preventie en bestraffing aan mekaar verbonden.
Ik wil enig voorbehoud maken bij het beleid zoals dat tot op heden werd gevoerd. Men zegt dat die boetes nu eenmaal doorgevoerd zijn en dus moeten worden betaald, maar er is de voorbije jaren toch enige moeheid opgetreden.
Het gaat om diverse redenen. Het gaat, bijvoorbeeld, om mensen die geen parkeerticket hebben. Daarbij is er dan nog de discussie of de boete daarvoor wel door een firma mag worden geïnd en in welke mate de verbalisant toegang mag hebben tot de gegevens van de eigenaar van de wagen.
Als wij die moeheid om te betalen bekijken, is men nu eindelijk tot inzicht gekomen. Om tot een snellere en efficiëntere inning te komen, was er jammer genoeg zowel een wetsontwerp als een wetsvoorstel nodig, een initiatief van Open Vld in de Senaat.
Het is toch vreemd dat het initiatief van het Parlement moet komen om daartoe over te gaan, terwijl dat al heel lang een pijnpunt was. Wat heeft de regering ervan weerhouden om al veel vroeger over te gaan tot die efficiënte inning? Het is vreemd dat men nu pas het licht heeft gezien.
Ik zeg niet dat wij moeten oproepen om zo veel mogelijk boetes te betalen, maar als men boetes uitschrijft, lijkt het mij logisch dat die efficiënt worden geïnd. Wij hebben hier een overheid die heel efficiënt belastingen kan innen, maar blijkbaar was dat tot op heden niet mogelijk voor boetes.

Wanneer het gaat over de inning en het opleggen van die boetes doet er zich een zeer bizar fenomeen voor. Eerst en vooral stel ik inzake het opleggen van die boetes vast dat het merendeel van die boetes door de Vlamingen wordt betaald. Zijn de Vlamingen zoveel crimineler? Misschien vinden sommigen dat, en dan kijk ik naar de collega’s van het FDF. Wanneer wij het hebben over de betaling van boetes, is er echter een duidelijke scheeftrekking. Als wij bekijken van waar de middelen voor het verkeersboetefonds juist komen – ik kijk naar de cijfers voor 2010 –, dan stellen wij vast dat 83 % van de geïnde boetes uit Vlaanderen komt, niet uit Wallonië, want daar is het maar een klein percentage.
Collega’s, hoe zou dat komen? Ik meen dat dit niet zozeer heeft te maken met het criminele rijgedrag. Als wij kijken naar het aantal verkeersslachtoffers zijn de stijgingen immers vooral te situeren in Wallonië. Er is in elk geval geen correlatie met het aantal boetes dat in Vlaanderen werd geïnd. Mevroux de voorzitter, mijnheer de staatssecretaris, collega’s, deze wettekst over het betalingsbevel gaf in de commissie voor de Infrastructuur aanleiding tot weinig opmerkingen. De behandeling ervan is vlug gegaan. De tekst was voorafgaandelijk dan ook lange tijd doorwrocht in de Senaat, waar ook het advies van de Raad van State werd ingewonnen. Ik wil hier nog eens uitdrukkelijk mijn collega Martine Taelman vernoemen, de indienster van het oorspronkelijke wetsvoorstel.
Collega’s, dit wetsvoorstel heeft een dubbel doel, ten eerste, voorkomen dat verkeersboetes onbetaald blijven en, ten tweede, het ontlasten van onze politieparketten en politierechtbanken.
In dit kader wil ik nog eens duidelijk stellen dat voor Open Vld het beter innen van de verkeersboetes een belangrijk item is, maar dat dit ook geldt voor het beter innen van de gerechtelijke boetes, de boetes opgelegd door correctionele rechtbanken en door de hoven van beroep.
Daarom blijven wij ook op die andere nagel kloppen, met name een betere inning van de gerechtelijke boetes. Ik wil ertoe oproepen om te waken over de duidelijkheid van de op te stellen teksten, opdat overtreders goed zullen begrijpen op welke manier zij bezwaar kunnen aantekenen.
Ten derde, er wordt ook niet geraakt aan de bevoegdheid van het parket, dat nog altijd autonoom zal beslissen of er al dan niet een minnelijke schikking wordt voorgesteld.
Last but not least biedt deze wettekst een antwoord op het actuele systeem dat kaduuk is wegens het toenemend aantal onmiddellijke inningen dat niet op een behoorlijke manier verwerkt kan worden door de politie en het parket. Dit betreft een oproep aan u, mijnheer de staatssecretaris, om in het debat over het verkeersveiligheidsplan dat wij woensdag na de paasvakantie zullen voeren, ook aandacht te hebben voor de problematiek van onmiddellijke inningen en minnelijke schikkingen. De vraag is of dit tegenwoordig niet in te veel gevallen mogelijk is.
Ik wil eraan toevoegen dat de gerechtelijke behandeling van verkeerszaken heel wat minpunten heeft. Ik denk, bijvoorbeeld, aan het feit dat een politierechter die een straf uitspreekt en die weliswaar beschikt over het strafregister van de overtreder, daarop niet kan terugvinden of een eerder opgelegde straf daadwerkelijk werd uitgevoerd. Mevrouw de voorzitter, beste collega’s, het wetsontwerp zet een Europese richtlijn van 25 mei 2009 om in Belgisch recht. Het is een richtlijn die betrekking heeft op de voorwaarden voor toegang en verblijf van onderdanen van derde landen met het oog op een hooggekwalificeerde baan in ons land of in een land van de Europese Unie.
De invoering van een Europese blue card naar het voorbeeld van de green card in de VS streeft ernaar de komst van hoogopgeleide werknemers naar de EU-lidstaten en hun verblijf op het EU-grondgebied te vereenvoudigen.
Die blauwe kaart zal door alle lidstaten worden uitgereikt aan alle hoogopgeleide werknemers die de voorwaarden van de richtlijn vervullen, en verleent de werknemers veel rechten, ook op het vlak van mobiliteit.
De kaart beantwoordt aan een uniform Europees model en geldt als verblijfsvergunning en werkvergunning. Dat is een primeur, die past in het kader van de single permit die Europa heeft ingesteld.
De kaart geldt voor 13 maanden en kan eenmaal voor dezelfde periode worden verlengd. Gedurende die periode is een zekere controle van de activiteiten van de werknemer mogelijk. Als de werknemer bijvoorbeeld van werkgever wil veranderen, moet die laatste bij het bevoegde Gewest een nieuwe aanvraag tot tewerkstelling indienen.
Na een periode van 2 jaar ontvangt de hoogopgeleide werknemer een blue card die 3 jaar geldig zal zijn. Na 5 jaar kan de houder van een blauwe kaart aanspraak maken op het statuut van langdurig ingezetene en een permanent verblijf verwerven. Het wetsontwerp bevat een aantal afwijkende regels met betrekking tot hooggekwalificeerde werknemers om de voordelige bepalingen van beide statuten in stand te houden.
De houder van een Europese blauwe kaart die het statuut van langdurige ingezetene na 5 jaar verwerft, kan 2 jaar naar zijn land van herkomst terugkeren. De reden daarvoor is om de effecten van braindrain en brainwaste in het land van oorsprong te beperken.
De Gewesten zullen zich moeten onthouden van een actieve werving van werknemers uit ontwikkelingslanden met een tekort aan arbeidskrachten. Wij moeten een ethisch wervingskader creëren waarbinnen een beleid kan worden gevoerd om in sleutelsectoren zoals de gezondheidszorg en het onderwijs in derde landen, vaak ontwikkelingslanden, geen schade te berokkenen.
De blue card kan ook worden ingetrokken of niet meer worden vernieuwd als de voorwaarden van het statuut van de hooggekwalificeerde werknemer niet meer vervuld zijn. Dat kan als hij langdurig werkloos is, in het geval van fraude, als hij een gevaar voor de openbare orde is of indien zijn bestaansmiddelen niet toereikend zijn voor het onderhoud van zijn familieleden.

The draft law transposes a European Directive of 25 May 2009 into Belgian law. It is a directive concerning the conditions of entry and residence of third-country nationals for the purpose of a highly qualified job in our country or in a country of the European Union.
The introduction of a European blue card following the example of the green card in the U.S. aims to simplify the arrival of highly qualified workers to the EU Member States and their stay on the EU territory.
That blue card will be issued by all Member States to all highly qualified workers who meet the conditions of the Directive, and gives workers a wide range of rights, including in the field of mobility.
The card corresponds to a uniform European model and is valid as a residence permit and work permit. This is a primeur, which fits within the framework of the single permit that Europe has established.
The card is valid for 13 months and can be renewed once for the same period. During this period, a certain control of the employee’s activities is possible. For example, if the employee wants to change an employer, the latter must submit a new application for employment to the competent Region.
After a period of 2 years, the highly qualified employee receives a blue card that will be valid for 3 years. After 5 years, the holder of a blue card can claim the status of long-term resident and acquire a permanent residence. The bill contains a number of deviating rules regarding highly qualified workers in order to maintain the favourable provisions of both statutes.
A European Blue Card holder who acquires the status of long-term resident after 5 years can return to his country of origin for 2 years. The reason for this is to limit the effects of braindrain and brainwashing in the country of origin.
The Countries will have to refrain from actively recruiting workers from developing countries with labor shortages. We need to create an ethical recruitment framework within which policies can be carried out in order to avoid harm in key sectors such as healthcare and education in third countries, often developing countries.
The blue card may also be withdrawn or ceased to be renewed if the conditions of the status of the highly qualified worker are no longer met. This may be the case if he is long-term unemployed, in case of fraud, if he is a threat to public order or if his means of subsistence are insufficient for the maintenance of his family members.
If the statute is revoked or refused, the employer will also be informed first, so that he does not run the risk of illegally employing his employee.
The directive, which combines residence and work permit for the first time, is a first step in an evolution that is likely to expand in the future. Since 2004, Europe has been working on developing a guided migration policy that takes into account the current and future needs of national labour markets. Such policies are seen as a key factor in strengthening the knowledge economy and economic development in Europe, in particular competitiveness and economic growth.

Wij voegden daar onmiddellijk aan toe dat het aantrekken van nieuwe gastarbeiders, ook al zijn ze hooggeschoold, onvermijdelijk zou leiden tot een toename van de gezinsmigratie, de volgmigratie zeg maar. Het gevaar bestaat daarbij dat deze volgmigranten overwegend zullen terechtkomen in een situatie van netto-ontvangers van onze sociale zekerheid.
De kans is dus verre van denkbeeldig dat de totale inwijking die met arbeidsmigratie gepaard gaat, voornamelijk ongeschoold van aard zal zijn en derhalve een belasting zal vormen voor onze reeds beproefde overheidsfinanciën.

In tegenstelling tot de gezinshereniging wordt niet met zoveel woorden geëist dat er maatregelen moeten worden genomen inzake de toelating van hooggekwalificeerde arbeidsmigranten. Dat is ons algemeen principe. Ik heb ze voor u in de commissievergadering al verduidelijkt.
De richtlijn is er en dus moet ze in Belgische nationale wetgeving worden omgezet. Krachtens artikel 23 van de richtlijn moeten de lidstaten uiterlijk tegen 19 juni 2011 de nodige wettelijke en bestuursrechtelijke bepalingen in werking doen treden om aan de richtlijn te voldoen. De Belgische overheid is dus opnieuw al enige tijd in gebreke.
Wat ons in dezen verder bezighoudt, is de vraag op welke manier de richtlijn in Belgische wetgeving is omgezet en of de Belgische wetgever de in de richtlijn zelf ter beschikking gestelde instrumenten heeft gebruikt om de richtlijn zo strikt mogelijk om te zetten. In de commissie heb ik u proberen aan te tonen dat de Belgische wetgever dat niet heeft gedaan. Er zitten opnieuw veel gaten in. Opnieuw bespeur ik geen ommekeer in het immigratiebeleid. Past het niet in het politieke spel? Past het niet voor de politieke families? Ik weet het niet. In elk geval kan ik maar vaststellen dat men de richtlijn niet strikt heeft uitgevoerd en dat men daarin redelijk ver is gegaan.

What concerns us further here is the question of how the directive has been transposed into Belgian law and whether the Belgian legislature has used the instruments made available by the directive itself to transpose the directive as strictly as possible. In the committee I have tried to show you that the Belgian legislature did not do that. There are many holes again. Again, I do not see any reversal in immigration policy. Does this not fit into the political game? Is it not appropriate for political families? I do not know. In any case, I can only conclude that the Directive has not been strictly implemented and that it has gone fairly far.

Met name de wijze waarop de Belgische regering, als indiener van het wetsontwerp, al dan niet van deze discretionaire beleidsvrijheid gebruikmaakt, heeft aanleiding gegeven tot onze vele amendementen, die wij ook al in de commissie hebben verdedigd en toegelicht.
Ik zal proberen in een zestal punten onze fundamentele kritiek mee te geven. Wij hebben die dus ook in amendementen omgezet.
Ten eerste, krachtens artikel 6 van de richtlijn staat het de lidstaten vrij het aantal onderdanen van derde landen te bepalen dat zij op grond van de richtlijn op hun grondgebied toelaten, met het oog op een hooggekwalificeerde baan. In uw wetsontwerp wordt ervoor gekozen om geen maximum vast te stellen. U motiveert die keuze ook op geen enkele manier.
Ten tweede, artikel 4 van het wetsontwerp bepaalt inzake de gezinshereniging voor de houder van een Europese blauwe kaart dat, indien het gezin al gevormd of opnieuw gevormd is in een andere lidstaat van de Europese Unie, de gezinshereniger niet het bewijs moet leveren van een voldoende huisvesting en dat inzake de vereiste stabiele, regelmatige en toereikende bestaansmiddelen, ook rekening wordt gehouden met de persoonlijke middelen van het overkomende gezinslid. De richtlijn, mevrouw de staatssecretaris, verplicht geenszins tot die vrijstelling. Ik verwijs daarvoor naar artikel 19 van de richtlijn.
Ten derde, in het bij artikel 13 van het wetsontwerp ingevoegde artikel 61/27 van de vreemdelingenwet wordt geëist dat de aanvrager een geneeskundig getuigschrift voorlegt waaruit blijkt dat hij niet is aangetast door een van de ziektes die in de bijlage van de vreemdelingenwet zijn opgesomd, alsook een uittreksel uit het strafregister of een gelijkwaardig document, waaruit blijkt dat hij niet veroordeeld werd wegens misdaden of wanbedrijven van gemeen recht, uitgereikt door het land van herkomst of door het land van zijn laatste verblijfplaats.
Paragraaf 1, tweede lid echter, mevrouw de staatssecretaris, bepaalt dat wanneer het onmogelijk is om deze documenten voor te leggen, de minister, of de Dienst Vreemdelingenzaken, de vreemdeling "rekening houdend met de omstandigheden” desalniettemin kan machtigen “om in België te verblijven met het oog op het uitoefenen van een hooggekwalificeerde baan”.

The Directive requires Member States to issue a European Blue Card to third-party nationals who meet the conditions laid down in the Directive and for whom there is no reason for refusal, and to guarantee the holders of such a European card the rights arising from that status.
However, in a number of ways, the Directive gives Member States a freedom of choice when completing the European blue card system. In particular, the way in which the Belgian government, as the proposer of the bill, uses or does not use this discretionary political freedom has given rise to our many amendments, which we have already defended and explained in the committee.
I will try to express our fundamental criticism in a number of points. We have also put them into amendments.
In the first place, under Article 6 of the Directive, Member States are free to determine the number of third-country nationals to be admitted on their territory pursuant to the Directive, in order to obtain a highly qualified job. In your draft law it is chosen not to set a maximum. You do not motivate that choice in any way.
Secondly, Article 4 of the draft law provides for family reunification for the holder of a European blue card that, if the family has already been formed or re-formed in another Member State of the European Union, the family reunifier is not required to provide proof of sufficient housing and that, as regards the required stable, regular and sufficient means of subsistence, the personal resources of the surviving family member are also taken into account. The directive, Mrs. Secretary of State, does not in any way require that exemption. In this regard, I refer to Article 19 of the Directive.
Third, Article 61/27 of the Foreign Act, added to Article 13 of the draft law, requires the applicant to submit a medical certificate showing that he has not been affected by any of the diseases listed in the Annex to the Foreign Act, as well as an extract from the criminal register or an equivalent document showing that he has not been convicted for crimes or misconduct of common law, issued by the country of origin or by the country of his last residence.
Paragraph 1, second paragraph, however, states that when it is impossible to submit these documents, the Minister, or the Service Vreemdelingen Affairs, the foreigner "taking into account the circumstances" can nevertheless authorize "to stay in Belgium for the purpose of exercising a highly qualified job".

In de memorie van toelichting wordt bepaald dat deze uitzondering het mogelijk maakt een hooggekwalificeerde werknemer die slechts licht werd veroordeeld toch een verblijfsmachtiging te verstrekken. Mevrouw de staatssecretaris, de richtlijn bevat geen verplichting om een dergelijke uitzondering te maken.
In de ontwerptekst is er evenmin een verwijzing naar het begrip “lichte veroordeling”. Los van de vraag wat onder “lichte veroordeling” moet worden verstaan, vind ik dat u hier de deur opnieuw openzet. Ook dat artikel hebben wij vanzelfsprekend geamendeerd. Ons amendement werd trouwens gesteund door andere collega’s.
Ik kom tot mijn vierde punt van fundamentele kritiek. Artikel 11, eerste lid van de richtlijn bepaalt dat de lidstaten uiterlijk binnen een termijn van 90 dagen moeten beslissen over een aanvraag tot het verkrijgen van de Europese blauwe kaart, en dat de nationale wetgeving van de betrokken lidstaat de eventuele gevolgen bepaalt van het uitblijven van die beslissing binnen de 90 dagen. Artikel 14 van het wetsontwerp handhaaft inderdaad de maximale beslissingstermijn van 90 dagen, maar bepaalt dat de machtiging tot verblijf moet worden toegekend indien geen enkele beslissing werd genomen na het verstrijken van die termijn.
Mevrouw, in plaats van het uitblijven van een beslissing te beschouwen als een stilzwijgende goedkeuring laat de richtlijn de mogelijkheid het gelijk te stellen met een stilzwijgende weigering. De Belgische wetgever heeft er blijkbaar voor gekozen de afwezigheid van een beslissing binnen de vastgelegde termijn gelijk te stellen met een goedkeuring. Ik vind dat eerlijk gezegd niet meteen een forse omkering van uw migratie- en asielbeleid.
Ik kom tot mijn vijfde punt van kritiek. Artikel 16 van het wetsontwerp maakt geen gebruik van de mogelijkheid die artikel 9, derde lid, aanhef en d) van de richtlijn aan de lidstaten biedt, om de Europese kaart in te trekken of te weigeren te verlengen "wanneer de houder van een Europese blauwe kaart sociale bijstand vraagt, op voorwaarde dat de betrokken lidstaat hem daarover van tevoren passende schriftelijke informatie heeft verstrekt". Dit kan uiteraard wel in aanmerking genomen worden als mogelijkheid om de Europese blauwe kaart in te trekken of te weigeren ze te verlengen, indien de houder niet beschikt over voldoende bestaansmiddelen ten behoeve van zichzelf of zijn gezinsleden, om te voorkomen dat zij ten laste van de openbare overheden vallen.

Article 11(1) of the Directive provides that Member States must decide on an application for the European Blue Card within 90 days at the latest, and that the national law of the Member State concerned shall determine the possible consequences of failing to make that decision within 90 days. Article 14 of the draft law ⁇ ins the maximum decision-making period of 90 days, but stipulates that a residence permit must be granted if no decision was taken after the expiry of that period.
Instead of considering the absence of a decision as a silent approval, the directive allows the possibility to equate it with a silent refusal. The Belgian legislature has apparently chosen to equate the absence of a decision within the specified deadline with an approval. To be honest, I do not think that is an immediate reversal of your immigration and asylum policy.
I come to my fifth point of criticism. Article 16 of the draft law does not make use of the possibility provided to Member States by Article 9(3) (d) of the Directive to withdraw or refuse to renew the European card "when the holder of a European blue card requests social assistance, provided that the Member State concerned has provided him with appropriate written information in advance". This can, of course, be taken into account as a possibility to withdraw the European Blue Card or refuse to renew it, if the holder does not have sufficient means of subsistence for himself or his family members, in order to avoid falling at the expense of public authorities.

Mevrouw de staatssecretaris, het verdient wat ons betreft aanbeveling om in geval van een beroep op sociale bijstand voor die Europese sociale kaart het verblijfsrecht automatisch te beëindigen. Wij hebben dan ook in die zin een amendement ingediend in de commissie dat wij hier opnieuw indienen.
Ik kom tot mijn zesde punt. Hoewel de toegevoegde omzettingstabel die wij in de commissie hebben gekregen het anders liet uitschijnen, werd geen gebruikgemaakt van de door artikel 8, vijfde lid van de richtlijn geboden mogelijkheid om een aanvraag voor die Europese blauwe kaart af te wijzen indien tegen de werkgever naar nationaal recht, dus naar Belgisch recht, een sanctie is uitgesproken voor zwartwerk en/of illegale tewerkstelling.
Dames en heren, wij kunnen nog een tijdje doorgaan. Wij kunnen hier al die artikelen fileren. Onze partij heeft in totaal 13 amendementen ingediend. Mocht deze regering ooit de wil hebben gehad om een duidelijk en stringenter migratiebeleid te voeren, dan had zij deze amendementen, of althans een aantal ervan, in de commissie met een ruime meerderheid goedgekeurd. Het is echter anders gelopen. Geen enkele partij vond de amendementen zelfs de moeite waard om te bespreken. Een ander migratiebeleid mag blijkbaar niet in deze constellatie van de federale politiek. Het is goed dat dit ook eens aan de oppervlakte is gekomen.
Het Vlaams Belang zal dit wetsontwerp in elk geval niet goedkeuren, om verschillende redenen. De meest fundamentele reden is dat u niet eens gebruikmaakt van de mogelijkheden opgenomen in de Europese richtlijn om de Europese blauwe kaart beperkend in te voeren. Zowel qua aantal als qua gevolgen mist men steeds opnieuw de mogelijkheid om eindelijk het begin van een trendbreuk in het migratiebeleid te realiseren. Het zal in elk geval niet met ons zijn.

It is good that this has come to the surface.
The Flemish Interest will not approve this bill in any case, for various reasons. The most fundamental reason is that you do not even make use of the possibilities contained in the European Directive to introduce the European Blue Card restrictively. Both in terms of numbers and consequences, the opportunity to finally realize the beginning of a trend break in migration policy is repeatedly missed. At least it will not be with us.

Mijnheer de voorzitter, collega’s, het voorliggend wetsontwerp is globaal bekeken goed. Het is de omzetting van een Europese richtlijn. Eigenlijk vereenvoudigt men de toegang tot de arbeidsmarkt voor hooggekwalificeerde arbeidskrachten. Men heeft eindelijk aandacht voor actieve migratie in plaats van voor de gebruikelijke initiatieven, zoals wij hier steeds gewoon zijn, rond regularisatie en passieve migratiekanalen.
De reactie van de sp.a verbaast mij evenwel. Niet alleen wordt hier een verblijfsmachtiging gegeven op grond van een blauwe kaart, maar men regelt hier ook de gezinshereniging. Dat betekent dat iemand die valt onder de categorie hooggeschoold en hoogtechnologisch personeel, zijn gezin kan meebrengen. Men regelt meteen ook het statuut van langdurig ingezetene. Men heeft het hier over derdelanders en men kijkt alleen naar de braindrain van de derde wereld.
Wij moeten ons in Europa realiseren dat er een demografische winter op ons afkomt. De vergrijzing is in heel Europa een trend en die trend is ook hier van belang. Wij moeten ermee rekening houden dat wanneer wij ons sociaal model in stand willen houden, er arbeidsplaatsen moeten ingevuld worden en dat wij moeten openstaan voor migratie, voor actieve migratie en de migratie die wij zelf willen.
In het wetsontwerp staan een aantal toelatingscriteria die heel algemeen zijn opgesteld en voor iedereen gelden, zoals een geldig reisdocument en een ziektekostenverzekering. Er zijn ook een aantal specifieke voorwaarden, waaronder een arbeidsovereenkomst voor hooggekwalificeerde banen; men moet bruto 50 000 euro per jaar verdienen om van dit statuut te kunnen genieten.
Wij begrijpen echter niet dat er een uitzondering wordt gemaakt op twee algemene criteria die voor iedereen gelden. Elke vreemdeling die binnenkomt moet wel degelijk een medisch attest voorleggen waaruit blijkt dat hij niet besmet is met ziektes die op een lijst zijn vermeld, bijvoorbeeld tbc, en hij moet een bewijs van goed gedrag en zeden voorleggen, waaruit blijkt dat hij geen onderdaan is die gevaarlijk kan zijn voor onze openbare orde. Voor de vreemdeling die de blauwe kaart krijgt, kan deze uitzondering wel gemaakt worden. Dat begrijpen wij niet, want die vreemdeling kan bijvoorbeeld aan tbc lijden, of kan een crimineel zijn.
Daarom hebben wij een amendement ingediend waarvan wij hopen dat alle aanwezigen het zullen beoordelen zoals wij het wetsontwerp hebben beoordeeld, namelijk op inhoud en kwaliteit. Wij steunen het wetsontwerp. Collega's, wij hopen dat ons amendement ook uw steun zal kunnen genieten.

The present bill is generally considered good. It is the transposition of a European Directive. In fact, it simplifies access to the labour market for highly qualified workers. At last, attention has been given to active migration instead of the usual initiatives, as we are used to here, around regularization and passive migration channels.
I am surprised by the reaction of the SP. Not only is a residence permit granted here on the basis of a blue card, but it also regulates family reunification. This means that anyone who falls under the category of highly qualified and high-tech staff can bring his family with him. It also regulates the status of long-term resident. We are talking about third-country citizens, and we are only looking at the brainstrain of the third world.
We must realize in Europe that we are facing a demographic winter. Aging is a trend throughout Europe and this trend is also relevant here. We must bear in mind that if we want to maintain our social model, jobs must be filled and that we must be open to migration, to active migration and to the migration we want.
The draft law sets out a number of admission criteria that are very general and apply to everyone, such as a valid travel document and a health insurance. There are also a number of specific conditions, including an employment contract for highly qualified jobs; one must earn gross €50 000 per year in order to enjoy this status.
However, we do not understand that there is an exception to two general criteria that apply to everyone. Every foreigner who enters must present a medical certificate showing that he is not infected with diseases listed, such as tuberculosis, and he must present proof of good conduct and morals, showing that he is not a citizen who can be dangerous to our public order. For the foreigner who receives the blue card, this exception can be made. We do not understand that, because that stranger can, for example, suffer from tuberculosis, or can be a criminal.
Therefore, we have submitted an amendment which we hope that all present will assess it as we have assessed the bill, namely in terms of content and quality. We support the bill. We hope that our amendment will also benefit from your support.

Monsieur le président, madame la secrétaire d'État, chers collègues, pour l'Union européenne, les thèmes de l'immigration et de la mobilité des travailleurs font partie des grands défis posés par la mondialisation, des défis qui peuvent d'autant mieux être surmontés si les États membres agissent ensemble dans le cadre d'une politique globale, équilibrée et cohérente, qui prend sur elle d'aborder tous les effets du phénomène des migrations.
La directive européenne dont il est question aujourd'hui fait partie de l'ensemble des mesures prises par l'Europe dans le but de faire de l'Union européenne l'économie de la connaissance la plus compétitive et dynamique du monde. Elle a pour but, moyennant le respect d'un certain nombre de conditions, d'attirer et de conserver une main-d'œuvre hautement qualifiée provenant des pays tiers. C'est cette directive que le projet de loi aujourd'hui soumis à nos votes transpose.
Au MR, nous nous en réjouissons, d'autant plus qu'au cours des derniers mois, la Belgique a principalement porté son attention sur l'immigration passive. Ce projet de loi va nous permettre de stimuler une immigration active et c'est une très bonne chose! Le MR souhaite depuis longtemps l'ouverture assumée d'un canal légal de migration économique. Nous pensons que la migration économique permettrait d'aider à combler les besoins de notre marché du travail et de lutter contre le travail illégal. Nous considérons qu'une immigration économique bien pensée est un atout pour nos économies, mais aussi un facteur de développement tant pour l'Europe que pour les pays du Sud.
Le projet que nous allons voter s'inscrit pleinement dans cette vision; c'est pourquoi nous le soutiendrons. Dans notre pays comme ailleurs se fait sentir, depuis un bon moment, la nécessité de mettre au point une véritable politique de migration économique. Qu'il s'agisse de répondre au manque de main-d'œuvre dans les métiers à haute qualification ainsi que dans les métiers en pénurie ou de pourvoir au vieillissement démographique et au déséquilibre entre les parts d'actifs et d'inactifs sur le marché du travail, tous les indicateurs vont dans le sens de la migration économique.
Nous devons donc attirer chez nous des travailleurs étrangers qui possèdent certaines compétences. Or, avec ses nombreuses législations nationales, l'Europe a été, jusqu'à présent, moins attractive que les États-Unis, le Canada ou l'Australie. L'Europe apparaît trop souvent aux travailleurs étrangers comme un ensemble morcelé et complexe. C'est pourquoi la directive Blue Card, qui simplifie les procédures d'admission et de combinaison d'autorisation de séjour et de permis de travail est une excellente initiative que nous ne pouvons que valider et encourager.
Cela étant, malgré l'avancée que permettra la nouvelle réglementation, nous devrons être attentifs à la problématique du risque de fuite des cerveaux ou du gaspillage des compétences. Nous devrons également veiller à ce que s'établissent correctement les indispensables partenariats avec les autorités régionales. Nous serons vigilants en la matière.

For the European Union, the issues of immigration and labour mobility are among the major challenges posed by globalization, challenges that can be better overcome if the Member States act together in the framework of a comprehensive, balanced and coherent policy that takes on addressing all the effects of the migration phenomenon.
The European Directive is part of a set of measures taken by Europe to make the European Union the most competitive and dynamic knowledge-based economy in the world. It aims, subject to a number of conditions, to attract and retain a highly qualified workforce from third countries. It is this directive that is transposed into the bill submitted to our vote today.
In the MR, we are delighted with this, especially since in recent months, Belgium has focused its attention primarily on passive immigration. This bill will allow us to stimulate active immigration and that is a very good thing! The MR has long sought the assumed opening of a legal channel of economic migration. We believe that economic migration would help to meet the needs of our labour market and combat illegal labour. We consider well-thought-out economic immigration to be an asset for our economies, but also a development factor for both Europe and the countries of the South.
The project we are going to vote for is fully in line with this vision, which is why we will support it. In our country as well as elsewhere it has been felt, for a long time, the need to develop a real economic migration policy. Whether it is addressing the shortage of workforce in high-skilled and shoreless professions or addressing the aging population and the imbalance between the share of active and inactive persons on the labour market, all indicators go in the direction of economic migration.
Therefore, we must attract foreign workers who possess certain skills. However, with its many national legislations, Europe has so far been less attractive than the United States, Canada or Australia. Europe too often appears to foreign workers as a fragmented and complex whole. This is why the Blue Card Directive, which simplifies the procedures for admission and combining residence and work permits, is an excellent initiative that we can only validate and encourage.
This being said, despite the progress that the new regulation will allow, we will have to be attentive to the problem of the risk of brain leakage or the waste of skills. We will also need to ensure that the necessary partnerships with regional authorities are properly established. We will be vigilant on this.

Une des grandes nouveautés apportées par ce projet est la création d'une autorisation unique – la carte bleue – qui servira à la fois de titre de séjour et de permis de travail aux personnes hautement qualifiées qui viennent travailler dans notre pays pour une durée minimale d'un an avec un salaire annuel brut d'au moins 50 000 euros par an.
Le travailleur recevra un titre de séjour de plus de trois mois et pourra travailler en toute légalité dans notre pays. Après cinq ans de séjour sur notre territoire, il pourra obtenir le statut permanent de résident de longue durée. Les membres de sa famille bénéficieront d'un délai de traitement raccourci de maximum quatre mois. Ce délai pourra cependant être prolongé, mais à une seule reprise et pour une période de trois mois, lorsque le caractère complexe du dossier le nécessitera.
Toutefois, madame la secrétaire d'État, nous avons une remarque fondamentale. Á l'instar de ma collègue Karin Temmerman, je voudrais attirer votre attention sur le fait que la fuite des cerveaux dans les pays tiers doit faire l'objet d'une grande vigilance, fuite qui pourrait être stimulée avec cette directive. En fait, si l'on voulait vraiment aider ces pays, il faudrait faire l'inverse et les inciter à garder leurs travailleurs hautement qualifiés afin que ces derniers apportent leur participation à la construction de leur pays. Il y a dans ce projet quelque chose d'un peu illogique. C'est la rançon de ce texte.
Cela dit, je voudrais profiter de cette occasion pour vous reposer les deux questions que je vous ai déjà soumises en commission. Ainsi, une concertation sur ce texte a-t-elle eu lieu avec les Régions, qui sont compétentes pour ce qui concerne la délivrance des titres de travail?
Par ailleurs, que se passera-t-il quand un travailleur hautement qualifié voudra procéder à un regroupement familial si sa famille n'était pas encore constituée lors de son arrivée sur notre territoire?
Voilà, madame la secrétaire d'État, chers collègues, les quelques remarques que je souhaitais faire.
Comme je l'ai dit au début de mon intervention, malgré les quelques réserves que j'ai exprimées, mon groupe soutiendra le projet de loi dont il est question.

Like my colleague Karin Temmerman, I would like to draw your attention to the fact that brain leakage in third countries must be subject to great vigilance, leakage which could be stimulated with this directive. In fact, if we really wanted to help these countries, we would have to do the opposite and encourage them to keep their highly skilled workers so that they can contribute to the construction of their country. There is something somewhat illogical in this project. This is the ransom of this text.
That being said, I would like to take this opportunity to rest on the two questions I have already submitted to you in the commission. So, has a consultation on this text taken place with the Regions, which are competent for the issue of labour titles?
Furthermore, what happens when a highly qualified worker wishes to proceed with a family reunification if his family was not yet constituted when he arrived on our territory?
Here are the few remarks I would like to make.

Het is belangrijk voor de ontwikkeling van onze economie, omdat het duidelijk is dat de toekomstige economische ontwikkeling van de Unie en ook van ons land vooral in de kenniseconomie ligt en in mindere mate in handenarbeid en industrieel-economische sectoren.
Voor die laatste sectoren moeten we vooral zorgen dat wij ook de huidige arbeidsreserve en de werklozen maximale kansen op tewerkstelling geven. Daarnaast moeten wij er rekening mee houden dat wij naast werklozen in eigen land ook te maken hebben met het vrije verkeer van werknemers binnen de EU. Daarvan hebben wij nog niet alles gezien, dit loopt nog volop. Het afgelopen jaar zijn veel werknemers uit Polen naar ons land gekomen. Ook bij de nieuw toegetreden lidstaten zien wij een toename. Ik denk dat het belangrijk is dat wij dat mee in rekening nemen.
De discussie in de commissie ging ook over de mogelijke nadelige gevolgen van dergelijke Europese richtlijn, met name de gevolgen voor de landen zelf. Is er eventueel sprake van een braindrain of wijst alles zich op termijn uit en kan een circulaire migratie ook positieve effecten hebben voor de landen van herkomst?
Wij mogen niet blind zijn voor problemen, maar wij maken deel uit van een geglobaliseerde wereld en wij zien dat mensen uiteraard altijd op zoek zijn naar een betere toekomst. Bepaalde hoger opgeleiden zullen naar het Westen komen, terwijl andere mensen noden zullen invullen in die landen van ontwikkeling. Wij kunnen ook kijken welke vormen van ondersteuning wij vanuit ons land kunnen bieden aan dergelijke landen. Dat is toch belangrijk.
Wij merken ook dat hoger opgeleiden in eigen land te weinig mogelijkheden hebben. Er zijn soms ook te veel hoger opgeleiden die niet allemaal aan werk geraken in eigen land. Die mensen kunnen wij zeker gebruiken, bijvoorbeeld bij knelpuntberoepen, vooral omdat wij een uitbreiding hebben in onze kenniseconomie.

For these latter sectors, we must especially ensure that we also give the current labour reserve and the unemployed maximum opportunities for employment. In addition, we must take into account that in addition to the unemployed in our home country, we also have to deal with the free movement of workers within the EU. We haven’t seen all of this yet, this is still going on full. Over the past year, many workers from Poland have come to our country. We also see an increase in the newly joined Member States. I think it is important that we take that into account.
The discussion in the committee also focused on the possible adverse consequences of such European directive, in particular the consequences for the countries themselves. Is there a potential brain-train, or is everything outlined in the long run and can circular migration also have positive effects for the countries of origin?
We must not be blind to problems, but we are part of a globalized world and we see that, of course, people are always looking for a better future. Certain higher educated people will come to the West, while other people will fulfill needs in those developing countries. We can also look at the forms of support we can offer from our country to such countries. That is important.
We also notice that higher-educated people in their own country have too few opportunities. Sometimes there are too many higher educated people who do not all get to work in their own country. We can ⁇ use those people, for example, in cumbersome professions, especially because we have an expansion in our knowledge economy.

Wij moeten zorgen voor een win-winsituatie voor iedereen, niet alleen voor ons maar ook voor de landen van herkomst.
De gevolgen van de invoering van de blue card zullen op termijn moeten worden geëvalueerd. Zitten wij juist met onze reactie? Kunnen wij ervoor zorgen dat er geen braindrain is? Kunnen wij ervoor zorgen dat die landen er ook beter van worden en niet alleen onze arbeidsmarkt?
Wij zullen ook moeten bekijken wat dit voor Europa zal opleveren. De mensen uit derde landen die naar Europa komen, ook als ze vandaag naar Frankrijk, Spanje of Engeland gaan, zullen na 5 jaar het statuut van langdurig ingezetene hebben. Dat betekent dat ze automatisch ook het recht krijgen om naar een andere lidstaat te verhuizen, inclusief België. Wij zullen er op Europees niveau over moeten spreken en erover moeten waken dat dit geharmoniseerd verloopt.
Wij zagen dat een aantal mensen uit Spanje, Portugal en Griekenland nu al naar ons land komt. Die landen worden immers het zwaarst door de crisis getroffen. Ook de mensen uit derde landen die daar al 5 jaar wonen, komen dan naar ons land.
Er zal een belangrijke bijdrage aan de Gewesten moeten worden gevraagd. Zij worden bevoegd voor de toekenning van de arbeidscriteria. De Gewesten zullen in de toekomst zelf de arbeidscriteria kunnen bepalen en een arbeidsvergunning kunnen geven. Uiteraard blijven wij bevoegd voor de verblijfsvergunning, maar zij mogen bepaalde voorwaarden opleggen, zoals dit mogelijk maken voor bepaalde beroepscategorieën.
Dat is een positief effect. Men kan daarmee een beleid uitstippelen op maat van de noden en de behoeften van een Gewest. Dit moet uiteraard in relatie met het land van herkomst gebeuren.
Tot slot wil ik ervoor pleiten dat wij moeten afstappen van het utilitaire idee dat de mensen hier alleen komen werken voor een korte periode, voor bijvoorbeeld zes maanden. Dat zal soms het geval zijn, maar voor mensen die hier een langere periode komen werken, moeten wij ervoor zorgen dat zij zich op zeer korte termijn in ons land kunnen integreren en de taal leren. Wij moeten ervoor zorgen dat zij mee zijn en dat hun gezin en kinderen zich maximaal in onze samenleving kunnen integreren. Het zal een opdracht voor de Gemeenschappen zijn om daarvan verder werk te maken.

In the future, the regions will be able to determine the working criteria themselves and to issue a work permit. Of course, we remain competent for the residence permit, but they may impose certain conditions, as permitted for certain occupational categories.
This is a positive effect. Thus one can draw out a policy tailored to the needs and needs of a Region. This must be done in relation to the country of origin.
Finally, I would like to advocate that we should step away from the utilitarian idea that the people here come to work alone for a short period, for example for six months. That will sometimes be the case, but for people who come here to work for a longer period, we must ensure that they can integrate in our country and learn the language in the very short term. We must ensure that they are involved and that their families and children can integrate as much as possible into our society. It will be a task for the Communities to carry out further work on this.

I understand the concerns of the colleagues about a possible brainstrain; we must follow the phenomenon properly and act cautiously in this regard.
Mr. Logghe has received a more than good explanation, not only here on the six amendments, but also in the committee on the seven other amendments. I will not repeat it.
Circular migration should be possible in the future. The transposition of the Directive provides a good impetus for this, as it provides the possibility of returning to the country of origin.
