Mevrouw Pas had amendementen ingediend om de Brusselse Vlamingen te waarborgen. Daartoe had zij liever dat de Nederlandstalige Belgen die in het buitenland vertoeven, zich zouden kunnen inschrijven in de kiesomschrijving Brussel. Dat zou de mogelijkheid tot een gekozene binnen Brussel optimaliseren.
Dat waren de belangrijkste wijzigingen ten opzichte van het oorspronkelijk voorstel.
De vergadering heeft zich daarover gebogen en is uiteindelijk bij de oorspronkelijke tekst gebleven, op één klein amendement na dat door de acht partijen werd ingevoerd. Het gaat om het amendement waarmee rekening werd gehouden met een aantal opmerkingen van de Raad van State, onder andere over het gegeven dat de invoeringsdatum samenvalt met de Europese verkiezingen.
Het geheel werd goedgekeurd met twaalf stemmen voor en vijf onthoudingen.

Mijnheer de voorzitter, ik wens iedereen een goede morgen. Het had inderdaad een goede ochtend kunnen zijn. Aanvankelijk dacht ik dat het een goed wetsvoorstel was, maar bij nader inzien is het dat niet echt.
De vereenvoudiging van de procedure van het stemrecht voor Belgen in het buitenland is een goed idee. Wij hebben er zelf ook al concrete voorstellen voor ingediend, maar – ik ga meteen naar de kern van het debat – waarom ook niet voor de deelstaatparlementen?
Heel Vlaanderen vraagt ernaar. In alle programma’s van alle Vlaamse partijen staat dat de Vlamingen in het buitenland niet alleen voor het federaal Parlement maar ook voor het Vlaams Parlement moeten kunnen stemmen. Sommige partijen gaan daar heel ver in. Open Vld stuurde zelfs Patricia Ceysens naar New York om er een afdeling op te richten van Open Vld. Men wil blijkbaar het binnenlands succes naar het buitenland exporteren. Mevrouw Ceysens zei in New York: ‘Er wonen veel Vlamingen met stemplicht in New York. Vlaamse kiezers in het buitenland worden wel eens verwaarloosd, maar zij moeten nog altijd hun stem uitbrengen. Open Vld is van plan actief campagne te voeren in het geval van verkiezingen.’
Daarna volgde een fel pleidooi voor deelname aan de federale en de Vlaamse verkiezingen vanuit het buitenland. Tot spijt van onder andere mevrouw Rutten is mevrouw Ceysens daarna ook uit New York teruggekeerd.

Op 5 december 2011 organiseerde “Vlamingen in de Wereld” een forum in het Vlaams Parlement, met de naam “De vergeten Vlaamse provincie.” Dat ging over regionaal stemrecht vanuit het buitenland. De aanwezige vertegenwoordigers en Parlementsleden van alle Vlaamse partijen hebben daar duidelijk en unaniem allen te kennen gegeven fel voorstander te zijn van de uitbreiding van het stemrecht voor Belgen in het buitenland, ook voor deelstaatverkiezingen. Nog geen zes maanden geleden werden die plechtige verklaringen gedaan. Men zou dan denken dat men vandaag niet het tegenovergestelde kan doen van wat men zes maanden geleden in het Vlaams Parlement plechtstatig heeft beloofd. Dan onderschat u de intellectuele soepelheid en de principiële wendbaarheid van sommige collega’s.
Waarom willen wij dat men vanuit het buitenland stemrecht kan uitoefenen voor de deelstaatparlementen? Daar zijn verschillende redenen voor.
Ten eerste, wij leven in een federaal land, wat wil zeggen dat het Vlaams Parlement op gelijke voet staat met het federaal Parlement. Die logica zit trouwens vervat in de Grondwet. Als men Belgen in het buitenland stemrecht toekent voor de federale verkiezingen, moet dat logischerwijze ook gelden voor de deelstaatverkiezingen. Ofwel voor iedereen en alle parlementen, ofwel voor niemand.
Ten tweede, dit kan volgens mij ook discriminerend zijn, of is dat zelfs. Ik bespaar u de technische discussie uit de vorige zittingsperiode in de commissie voor de Binnenlandse Zaken in het kader van het toekennen van stemrecht aan Belgen in het buitenland. Het betrof een lange juridische discussie of Belgen in het buitenland niet vielen onder stemplicht in plaats van stemrecht. Er werd gezegd dat het stemplicht moet zijn, omdat er anders discriminatie ontstaat tussen de Belgen in het binnenland en de Belgen in het buitenland: de Belgen in het binnenland hebben dan stemplicht en de Belgen in het buitenland hebben dan stemrecht.

On 5 December 2011, “Flamings in the World” organized a forum in the Flemish Parliament, entitled “The forgotten Flemish province.” The representatives present and parliamentarians of all Flemish parties have clearly and unanimously expressed their strong support for the extension of the voting right for Belgians abroad, including for state elections. I spare you the technical discussion from the previous parliamentary period in the Committee on Home Affairs in the context of granting voting rights to Belgians abroad. It was a long legal debate about whether Belgians abroad did not fall under voting obligation instead of voting rights. Een derde argument voor het toekennen van het stemrecht aan Belgen in het buitenland voor de deelstaatparlementen, is dat de bevoegdheden van de deelstaatparlementen precies aan de besognes van die Belgen raken.
Ik geef enkele concrete voorbeelden. De Vlaamse overheid heeft bijvoorbeeld een specifiek budget voor culturele activiteiten in het buitenland. De Vlamingen in het buitenland willen daarover ook iets te zeggen hebben.
De Vlamingen in het buitenland vragen dat zij mee zouden kunnen spreken over de organisatie van Vlaams onderwijs in het buitenland. Zij willen, naar het voorbeeld van Duitsland met die Deutsche Schulen, en ook Groot-Brittannië en Frankrijk, ook Nederlandstalig onderwijs in het buitenland.
Het zijn precies de deelstaten die vooral bezig zijn met die bevoegdheden, met die thema’s die de Belgen in het buitenland aanbelangen en dus willen de Vlamingen in het buitenland meespreken en een democratische stem krijgen in het kapittel.
Tot slot, waarom de uitbreiding van het stemrecht voor Belgen in het buitenland voor de deelstaatverkiezingen? Het antwoord is in functie van de eenvoud en de transparantie. Deze regering, aangevuld met Groen en Ecolo, wil zorgen voor samenvallende verkiezingen.
Dan zal de regering aan de Belgen in het buitenland moeten uitleggen dat zij voor de verkiezingen voor het federaal Parlement en voor de deelstaatparlementen, die op een en dezelfde dag vallen, maar gedeeltelijk stemrecht hebben. Naast de Vlaamse partijen zijn ook Ecolo en zeker de MR grote voorstanders van de uitbreiding van het stemrecht voor Belgen in het buitenland naar de deelstatenverkiezingen. Toch zit dat vandaag niet in het voorliggende wetsvoorstel.
Alle Vlaamse partijen zijn voorstander, ook aan Franstalige kant wordt het ruim gedragen, maar toch staat dit niet in het wetsvoorstel. Waarom niet, kan men zich dan afvragen. Dat is een antwoord dat wij hier vaak moeten geven: de PS wil het niet. Daarom staat het niet in het wetsvoorstel. Als de PS het niet wil, krijgen de Franstaligen het niet en dan krijgen ook de Vlamingen het niet. Dat is duidelijk. Als het tegen het belang is van de PS maar voor het belang van Vlamingen en Franstaligen, dan is het snel beslist in dit land. Het belang van de PS gaat boven alle andere belangen.
Waarom is de PS daar dan tegen? Als men een analyse van het stemgedrag van de Belgen in het buitenland in 2007 maakt, ziet men dat er 120 000 stemmen in het buitenland zijn uitgebracht.
Twee vaststellingen kunnen worden gemaakt. Ten eerste, de verhouding 60 % Vlamingen en 40 % Franstaligen is in het buitenland volledig invers. Er zijn 70 % Franstaligen en 30 % Nederlandstaligen. Dat is een normale evolutie. In de 19ᵈᵉ eeuw was dat anders, maar het is nu eenmaal zo dat de migratie in economisch minder presterende gebieden altijd groter zal zijn. Dat scheelt een slok op de borrel. Voor de federale verkiezingen kan dat 1 tot 2 zetels schelen. Hier liggen dus 1 tot 2 zetels voor het grijpen.

Dat kan de PS echter niet terugdraaien. Voor de federale zetels en de federale verkiezingen is er momenteel al stemrecht voor Belgen in het buitenland. De PS kon een en ander dus niet terugdraaien.
Voor de deelstaatverkiezingen liggen echter verhoudingsgewijs nog meer zetels op tafel. De winst van de MR kan dus nog veel groter worden. Verwikkeld in een concurrentiestrijd tussen PS en MR om de Waalse dominantie kunnen deze zetels natuurlijk een belangrijke rol spelen.
En dus: ce que PS veut, Dieu le veut. Eigenlijk was de oplossing echter simpel. Mijnheer Bacquelaine, de oplossing was heel simpel. Indien de PS niet wil dat de Franstaligen vanuit het buitenland niet voor het Waals Parlement kunnen stemmen – tant pis, zou men dan denken: Elk zijn democratie; tant pis –, geef dan de bevoegdheden aan de deelstaten zelf. De logica zou zijn de deelstaten constitutieve autonomie te geven, zodat Vlaanderen en Wallonië, elk voor zich, zelf over de organisatie van de eigen verkiezingen in binnen- en buitenland kunnen beslissen.
Constitutieve autonomie is ook een zaak die alle Vlaamse partijen voorstaan. Het is ook een zaak waarover bij de communautaire onderhandelingen tijdens de regeringsvorming overeenstemming was. Ze was geen enkel probleem.
Wat nu in de Senaat echter op tafel ligt in naam van constitutieve autonomie, is heel beperkt. Zij zorgt er ook voor dat de deelstaatparlementen absoluut niet voor de organisatie van de eigen verkiezingen bevoegd worden. De deelstaatparlementen mogen niet over de eigen verkiezingen en dus ook niet over stemrecht van Belgen in het buitenland beslissen.
Opnieuw merken wij hier een sterk staaltje van de PS-dominantie over dit land en over zes miljoen Vlamingen. De PS gunt het de Franstaligen niet en dus gunt ze het ook niet aan de Vlamingen. In het andere geval zouden de Franstaligen immers misschien wel eens een voorbeeld aan de Vlamingen kunnen nemen en het Vlaamse voorbeeld volgen. Dus blokkeert de PS alles.
Aldus wordt nogmaals duidelijk dat de Vlamingen een ketting aan hun been hebben waaraan een grote gevangenisbol hangt. Bedoelde gevangenisbol is de PS. Het is een gevangenisbol die ons en zes miljoen Vlamingen in hun doen en laten remt. Onderhavig dossier illustreert voormelde stelling ten voeten uit.
Ik zou dus aan de Vlaamse partijen maar ook aan de MR en Ecolo willen vragen om voor één keer die ketting met de grote gevangenisbol door te knippen en ons voor één keer van voornoemde gevangenisbol te verlossen, wat heel eenvoudig kan.

The state parliaments are not allowed to decide on their own elections and therefore not on the right to vote of Belgians abroad.
Again, we notice here a strong piece of PS dominance over this country and over six million Flemish. The PS does not give it to the French speakers and therefore does not give it to the Flamings. In the other case, the French speakers might take an example from the Flemish and follow the Flemish example. So the PS blocks everything.
Thus it becomes clear once again that the Flammers have a chain at their legs to which a large prison ball hangs. The prison ball is the PS. It is a prison ball that inhibits us and six million Flammers in their doing and letting. The present file illustrates the aforementioned statement.
I would therefore like to ask the Flemish parties as well as the MR and Ecolo to cut through that chain with the large prison ball for one time and to free us for one time from the aforementioned prison ball, which can be very simple.

Collega’s van de MR, dat kan dankzij uw eigen wetsvoorstel. De collega’s Daniel Bacquelaine, Corinne De Permentier, François-Xavier de Donnea, Denis Ducarme, Jacqueline Galant en Charles Michel zelf hebben een wetsvoorstel ingediend dat stemrecht toekent aan Belgen in het buitenland, ook voor de deelstaatverkiezingen. Dat wetsvoorstel dienen wij in als amendement op het voorliggende wetsvoorstel. Het is waarschijnlijk de eerste keer in de geschiedenis dat ik een wetsvoorstel van de MR indien. Ik zal het ongetwijfeld ook bij deze ene keer houden, maar als het gaat over het verdedigen van de belangen van de Vlamingen dan zijn wij voor niets beschaamd, ook niet voor het indienen van wetsvoorstellen van de MR.
Dit is eigenlijk de enige manier om de absurditeit weg te werken die zich bij samenvallende verkiezingen in onder meer 2014 zal voordoen. Het is absoluut niet uit te leggen dat Belgen in het buitenland op een en dezelfde dag zouden kunnen stemmen voor het federale Parlement, maar bijvoorbeeld niet voor het Vlaams Parlement. Het voorliggende wetsvoorstel wordt verkocht als een maatregel om het allemaal eenvoudiger en transparanter te maken, maar in de praktijk zal het er gewoon voor zorgen dat alles ingewikkelder wordt. Men zal aan Belgen in het buitenland immers moeten uitleggen dat zij maar een stukje stemrecht hebben.
Als u ons amendement, van N-VA en MR uiteraard, niet goedkeurt dan maakt u het Vlaams Parlement ondergeschikt aan het federale Parlement. Dit druist vanzelfsprekend in tegen elke federale logica. Als u ons amendement niet goedkeurt dan hebben wij voortaan een belangrijk federaal Parlement, waarvoor iedereen vanuit het buitenland kan stemmen, en de kleine parlementaire broertjes, de pagadderparlementen, waarvoor vanuit het buitenland niemand kan stemmen. Een beetje zoals het kinderparlement. Als u ons amendement niet goedkeurt dan degradeert u het Vlaams Parlement tot het ondergeschikte parlement, ondergeschikt aan het federale Parlement. Als u ons amendement niet goedkeurt, moet u mij eens vertellen hoe u ooit nog uw belofte hard zult maken met betrekking tot de toekenning van stemrecht aan Belgen in het buitenland voor de deelstaatverkiezingen. Geen constitutieve autonomie en ook in dit wetsvoorstel kent u dat vanuit dit federale niveau niet toe. Hoe zult u waarmaken wat u zes maanden geleden nog heeft beloofd?

Mijnheer de voorzitter, collega’s, misschien lijkt dit voorstel niet meteen het meest sexy voorstel in de rij van voorstellen die in het raam van de hervorming waarin we voorzien hebben, naar voren komt maar het is toch niet onbelangrijk. Ik meen dat u zich er ook van bewust bent, net als de andere collega’s, dat dit voorstel rond stemrecht in het buitenland uiteindelijk een objectivering van de inschrijving om te gaan stemmen en van de plaats waar men gaat stemmen invoert.
Die verdere objectivering is onmiskenbaar een belangrijke stap. Waarom? Omdat het een aanpassing is van de wetgeving voor stemrecht van Belgen in het buitenland voor de federale verkiezingen. Het is echter zeker ook een belangrijk element sinds de versoepeling die er in 2002 is gekomen. Voordien was er stemrecht voor Belgen in het buitenland dat echter zeer beperkt werd ingevoerd. Er kwam een versoepeling van de regeling in 2002, met als gevolg dat er zich op dat moment effectief zo’n 114 000 Belgen in het buitenland inschreven om te gaan stemmen. In 2007 waren dat er 122 000, veel minder in 2010 omwille van de procedure daarnaast.
We stelden echter tegelijkertijd vast dat een kwart van die ingeschreven Belgen in het buitenland werden meegeteld in de kieskring Brussel-Halle-Vilvoorde. Dat leidde er bijvoorbeeld in 2003 toe dat al die stemmen meegeteld werden in het kanton Lennik, met als gevolg dat men dacht dat de verfransing in die regio heel sterk verder was toegenomen. Het uiteindelijke effect was dat ook de zetelverdeling gewijzigd werd. Op dat moment hebben uiteindelijk in heel de regio Halle-Vivoorde ook de burgemeesters – ik kijk naar collega Michel Doomst – gereageerd en gesteld dat het niet kon dat op die manier de vooral Franstalige stemmen uit het buitenland werden meegenomen in een Vlaamse regio. Toen is er effectief een verdere stap gezet en werden die stemmen niet meegeteld in Lennik.
Vandaag zetten we een verdere stap in het objectiveren van de stemmen van mensen die in het buitenland gevestigd zijn omdat zij daadwerkelijk moeten aantonen dat zij een objectieve band creëren met de gemeente waar zij zich laten inschrijven.

Le groupe PS se réjouit de cette mesure importante de simplification administrative, qui devrait pérenniser le vote de nos compatriotes qui le souhaitent, même en cas d'élections législatives anticipées tout en garantissant la sécurité du vote. Il s'agit à nos yeux d'une avancée démocratique significative.
Désormais, une fois la loi entrée en vigueur, il suffira au Belge vivant à l'étranger, qui choisit le vote en personne ou par procuration, de s'inscrire une seule fois sur la liste des électeurs et son inscription sera pérennisée pour autant qu'il vote à chaque scrutin. Il ne devra donc plus, comme actuellement, se réinscrire lors de chaque élection avec le risque de voir des difficultés pratiques se dresser contre l'exercice du droit de vote, notamment en cas d'élections anticipées, comme ce fut le cas en 2010 où le nombre d'électeurs avait fortement diminué par rapport aux élections de 2007.
Par ailleurs, pour le PS, il était également important de déterminer les critères objectifs de rattachement à une commune de vote, ces critères étant liés à sa vie en Belgique ou à celle de ses parents. Comme tout citoyen vivant en Belgique et qui vote obligatoirement dans la commune de son domicile, il était normal pour le Belge vivant à l'étranger de déterminer, de façon objective, la commune et donc la circonscription dans laquelle son vote sera comptabilisé. Il s'agissait d'un impératif d'équité de l'élection et ainsi de ne plus permettre au Belge établi à l'étranger de déterminer la commune de rattachement de son choix, sans aucun lien objectif avec celle-ci.
Parallèlement à l'objectif de facilitation du vote des Belges à l'étranger par des mesures de simplification administrative, il était essentiel pour le PS de continuer à garantir la sécurité du vote. Il s'agissait, en effet, d'éviter à tout prix que la pérennisation du vote ne crée des situations où des bulletins de vote auraient été envoyés dans la nature. Car contrairement à la tenue des registres d'état civil en Belgique, permettant de savoir si une personne est décédée ou a déménagé, la mise à jour des registres consulaires dépend uniquement des informations transmises par le citoyen lui-même. Les consulats ne savent pas, a priori, si le Belge inscrit sur la liste a changé de pays, d'adresse ou encore est décédé.
Si l'on n'imposait pas au Belge qui a fait le choix du vote par correspondance de confirmer son inscription quelques semaines avant les élections, ce qui permet ainsi de confirmer son existence et son adresse, des bulletins seraient envoyés à de mauvaises adresses ou à de mauvais destinataires. La situation est la même pour le Belge qui n'a pas voté à l'élection précédente: le consulat ne sait, a priori, pas pourquoi il ne l'a pas fait. Est-ce une violation délibérée de l'obligation de vote? Est-ce parce qu'il a déménagé ou que la convocation ne lui est pas parvenue ou est-ce encore parce qu'il est décédé?

Et la proposition à l'examen va dans ce sens.
Rappelons que, nonobstant le prescrit de la Constitution au terme duquel le vote pour les élections législatives fédérales est obligatoire, les Belges résidant à l'étranger se sont longtemps trouvés dans l'impossibilité juridique de s'acquitter de cette obligation. En fait, ils ont dû attendre les élections du 13 juin 1999 pour pouvoir participer effectivement à un scrutin fédéral. Cependant, à l'époque, les formalités administratives étaient extrêmement lourdes. En fait, en 1999, seuls 20 Belges ont effectivement pu prendre part à ce scrutin.
La loi du 7 mars 2002 a réduit le nombre de formalités. C'est ainsi qu'en 2003, le vote de 114 000 Belges a été enregistré et que 122 000 votes ont été comptabilisés en 2007. Le nombre de votants a, quant à lui, baissé très fortement lors des élections de 2010 qui étaient des élections anticipées.
Malgré cette amélioration évidente, la nouvelle législation souffre encore de lourdeurs administratives qui compliquent inutilement la tâche démocratique de nos expatriés. Pour le candidat électeur, la principale formalité administrative réside dans l'obligation de renouveler, lors de chaque scrutin, sa demande d'inscription.
Cette obligation de renouveler systématiquement la demande d'inscription sur les listes est inexplicable dans la mesure où cette formalité n'est pas requise pour les Belges résidant en Belgique. Elle s'explique d'autant moins qu'en vertu de l'article 180 du Code électoral, l'obligation de vote s'impose à tous les Belges répondant aux conditions de l'électorat et inscrits dans les registres de la population tenus dans les postes diplomatiques ou consulaires de carrière belges à l'étranger. L'incohérence est d'autant plus manifeste que la deuxième inscription apparaît superfétatoire puisque les Belges inscrits dans les postes consulaires et diplomatiques sont, par principe, connus des autorités. Ce système a montré toutes ses limites lors des dernières élections législatives, en 2010, où nos concitoyens résidant à l'étranger ont rencontré des difficultés évidentes pour participer à ce scrutin puisque sur les 122 000 Belges expatriés qui avaient voté en 2007, ils n'étaient plus que 42 000 trois ans plus tard à accomplir leur devoir électoral.
Des plaintes par courrier nous ont été adressées et les difficultés rencontrées par les Belges résidant à l'étranger ont été largement médiatisées. Ces plaintes font état de carences en matière d'information et de la procédure spécifique mise en place dans le cadre de l'organisation des élections anticipées étant donné les délais de dissolution et les délais de convocation des électeurs. Beaucoup de nos compatriotes se sont plaints de ne pas avoir pu être dûment informés par les autorités compétentes des formalités à entreprendre pour leur réinscription en qualité d'électeur. La distribution tardive des bulletins de vote par correspondance a également été mise en cause. Qu'il s'agisse de dysfonctionnements liés à l'organisation des élections ou de problèmes liés à la transmission de l'information, il est évident que ces carences ne permettent pas un exercice normal du droit de vote pour nos compatriotes établis à l'étranger et expliquent un taux de participation particulièrement faible.
Dans le cadre des négociations institutionnelles de l'automne 2011, nous avons voulu que l'on traite cette question et que l'on simplifie le système de vote des Belges résidant à l'étranger. Pour le Mouvement réformateur, il s'agissait d'un point essentiel. Cet accord est aujourd'hui traduit dans la loi, ce dont nous nous réjouissons.
La nouvelle loi facilite tout d'abord cette étape d'inscription puisque les formulaires d'inscription seront automatiquement envoyés aux Belges résidant à l'étranger dès la publication de la loi au Moniteur belge. C'est donc immédiatement applicable. Ce même formulaire sera par ailleurs proposé aux Belges qui s'établissent à l'étranger lorsqu'ils s'inscrivent sur les registres consulaires. Enfin, ce formulaire sera disponible sur simple demande: il conviendra pour l'électeur de renseigner la commune belge à laquelle il peut être rattaché selon les critères subsidiaires de la loi et de retourner le formulaire au poste.

Complaints were sent to us by mail and the difficulties encountered by Belgians residing abroad were widely mediated. These complaints refer to shortcomings in information and the specific procedure established in the context of the organisation of early elections given the deadlines for dissolution and the deadlines for the calling of voters. Many of our compatriots complained that they could not be properly informed by the competent authorities of the formalities to be undertaken for their re-registration as voters. The late distribution of mailed voting bulletins was also challenged. Whether it is malfunctions related to the organization of elections or problems related to the transmission of information, it is clear that these deficiencies do not allow a normal exercise of the right to vote for our compatriots established abroad and explain a ⁇ low participation rate.
As part of the institutional negotiations in autumn 2011, we wanted to address this issue and to simplify the voting system for Belgians residing abroad. For the Reform Movement, this was an essential point. This agreement is now translated into the law, which we are delighted with.
The new law facilitates first of all this registration step as registration forms will be automatically sent to Belgians residing abroad as soon as the law is published in the Moniteur belge. It is therefore immediately applicable. The same form will also be offered to Belgians who settle abroad when they register in the consular registers. Finally, this form will be available on simple request: it will be appropriate for the voter to inform the Belgian municipality to which he may be attached according to the subsidiary criteria of the law and to return the form to the office.

Mais l'avancée la plus significative est bien évidemment que, contrairement à la situation actuelle qui impose de devoir se réinscrire comme électeur lors de chaque élection législative, la nouvelle procédure prévoit la pérennisation de l'inscription. Nous voulons donc prolonger la réforme actuelle de nos propositions relatives au droit de vote des Belges à l'étranger pour les élections européennes pour ceux qui résident en dehors des pays de l'Union, puisque les autres ont déjà ce droit de vote aux élections européennes.
Il nous paraît nécessaire et logique, dans le cadre d'un système fédéral, de remédier à cette lacune et d'octroyer le droit de vote aux expatriés pour l'élection des conseils et des parlements des entités fédérées. En effet, pour nous, les Belges résidant à l'étranger ont un intérêt manifeste et doivent se voir reconnaître un droit de participer au choix des élus et donc au façonnage des options politiques préfigurant la destinée des Régions et des Communautés dont ils relèvent.
Demain encore davantage qu'aujourd'hui dans le cadre de la sixième réforme de l'État transférant de nouvelles compétences aux Régions et Communautés, il nous paraît essentiel que le droit de vote des Belges résidant à l'étranger concerne aussi les entités fédérées, les Régions de ce pays, au moment où on leur donne davantage de pouvoir.
Il n'y a, pour nous, aucune distinction à pratiquer sur ce plan entre, d'une part, les élections législatives et les élections visant la composition des parlements des Communautés et Régions ainsi que pour le Parlement européen. Nous soutiendrons donc à l'avenir toute initiative, la nôtre notamment, pour faire en sorte que ce droit de vote soit effectivement confié aux Belges résidant à l'étranger pour l'élection des parlements des Régions: Flandre, Wallonie et Bruxelles.

Indeed, for us, the Belgians residing abroad have a manifest interest and must be recognized a right to participate in the election of the elected and therefore in the shaping of political options prefiguring the fate of the Regions and Communities to which they belong.
Tomorrow even more than today in the framework of the sixth state reform transferring new competences to the Regions and Communities, it seems to us essential that the voting right of the Belgians residing abroad also concerns the federated entities, the Regions of that country, at the time when they are given more power.
There is, for us, no distinction to be made in this regard between, on the one hand, the legislative elections and the elections concerning the composition of the parliaments of the Communities and Regions and for the European Parliament. We will therefore in the future support any initiative, our own in particular, to ensure that this right of vote is effectively conferred on the Belgians residing abroad for the election of the parliaments of the Regions: Flanders, Wallonia and Brussels.

Onze fractie is tevreden dat in het kader van de jongste staatshervorming ook een oplossing gevonden is voor het stemrecht van Belgen in het buitenland.
Het eerste probleem wordt opgelost door de verplichte herinschrijving bij elke verkiezing te schrappen. De inschrijving als kiezer moet slechts één keer gebeuren. De inschrijving voor de eerstvolgende verkiezing geldt ineens voor alle volgende federale parlementsverkiezingen.
Het tweede probleem, de vrije keuze van de gemeente van inschrijving, wordt opgelost zoals de Raad van State eerder heeft gesuggereerd, namelijk door objectieve criteria te koppelen aan de plaats van inschrijving.
Er zijn vier objectieve criteria – ik som ze op in volgorde van voorrang –: ten eerste, de gemeente waar men het laatst was ingeschreven, ten tweede, de gemeente van de geboorteplaats, ten derde, de gemeente waar vader of moeder in het bevolkingsregister ingeschreven staat, ten vierde, de gemeente waar een verwante tot de derde graad ingeschreven staat.

Die eerste stap, het eerste voorstel dat hier in de Kamer besproken wordt, is ook belangrijk, omdat het een einde betekent aan jarenlang immobilisme sinds 2007 door communautaire strubbelingen. Ik ben dan ook heel blij dat we vandaag het debat in de Kamer kunnen starten en een streep trekken onder een geschiedenis van immobilisme, die ons land zwaar heeft getroffen.
Heel wat belangrijke dossiers waar het Parlement aan moet werken, zijn blijven liggen. Vandaag zien we dat er een conferentie is in Rio, twintig jaar na de eerste. Nooit is er zoveel aandacht gegaan naar de belangrijke problemen die daar aan de orde worden gebracht en ook in België gevolgen zullen hebben. De voorbije vijftien jaar hebben we altijd gekeken naar onze interne staatshouding, naar het splitsen van BHV, naar een verdere staatshervorming. Vele andere problemen zijn blijven liggen. Ik hoop dat we vandaag, bij de aanvang van onze besprekingen, eindelijk een hoofdstuk kunnen afsluiten, zodat het Parlement zich bezig kan houden met de echte problemen van onze maatschappij.

Mijnheer de voorzitter, ik heb zopas mevrouw Becq horen verklaren dat voorliggend wetsvoorstel niet het meest sexy voorstel is van alle wetsvoorstellen die de zesde Staatshervorming vorm geven. Ik weet niet of de benaming “sexy” goed gekozen is voor alle wetsvoorstellen die wij nog ter bespreking voorgelegd zullen krijgen. Het is alleszins geen goede benaming voor alle voorstellen die vandaag nog op de agenda staan.
Het is wel een van de minder erge voorstellen. Er komen nog veel ergere voorstellen op ons af. Indien mevrouw Becq dat bedoelde met haar woorden, dan kan ik haar daarin wel volgen.
Wij hebben er uiteraard niets op tegen dat de stem- en stemopnemingswijze met voorliggend voorstel worden verbeterd. Dat objectieve criteria zullen bepalen in welke gemeente in dit land de in het buitenland verblijvende kiezer zich mag inschrijven, was ook dringend nodig.
Door de nefaste gevolgen van andere onderdelen van de allesbehalve sexy Staatshervorming stelt het Vlaams Belang echter andere, objectieve criteria voor de inschrijving voor. Ik zal er zo dadelijk dieper op ingaan.
Eerst wou ik echter even inpikken op wat de heer Weyts zopas vertelde.
Ik begrijp de bekommernis van de leden van de N-VA, met name dat voorliggend wetsvoorstel de in het buitenland verblijvende landgenoten voor verkiezingen van deelstaatparlementen geen stemrecht wordt verleend. Het is enkel voor de federale parlementsverkiezingen dat met voorliggend wetsvoorstel stemrecht wordt toegekend aan kiezers die in het buitenland verblijven.
De amendementen die de N-VA-leden daartoe indienen, komen aan de genoemde bekommernis tegemoet en zullen een en ander federaal regelen. Zij lijken mij echter niet echt een ideale oplossing. Het zou immers de bevoegdheid van de deelstaatparlementen zelf moeten zijn om de inschrijving te regelen.
Mijnheer Weyts, u hebt in de discussie heel wat documenten aangehaald waarin de constitutieve autonomie al dan niet zou staan. Er is echter een document waarvan de leden van sp.a, CD&V en de N-VA zeker zouden moeten weten dat de constitutieve autonomie erin is opgenomen. De bepaling staat namelijk in uw eigen, Vlaamse regeerakkoord.
In uw Octopusnota, die een bijlage bij uw Vlaams regeerakkoord is, is de allereerste zin: “Ten eerste vragen wij een grotere, constitutieve autonomie.”
Alle Vlaamse regeringspartijen zijn het over voormelde bepaling eens. Ik vraag mij dan ook af waarom u hier scherpe verwijten aan CD&V maakt, terwijl u in de Vlaamse regering niet even hard tegen uw coalitiepartner roept, om uw eigen regeerakkoord te kunnen uitvoeren. In de Vlaamse regering blijft u loyaal tegenover CD&V, die u hier grote verwijten maakt. In het Vlaams Parlement stemt u belangenconflicten tegen de voorliggende Staatshervorming weg, wegens uw loyauteit aan CD&V. U stemt er zelfs de hoorzittingen met de magistraten, waar u hier luid om roept, weg. U doet zulks allemaal uit loyauteit aan dezelfde CD&V.
Enige consequentie in het luid roepen is toch wel gepast. Ik vraag mij, eerlijk gezegd, af wat u in de Vlaamse regering zit te doen, behalve moskeeën openen en moskeeën subsidiëren. U zit er alleszins niet om er de Vlaamse eisen te realiseren. Zoveel is duidelijk.

Tijdens de bespreking van onderhavig wetsvoorstel in de commissie heeft onze fractie vier amendementen ingediend. Wij zullen die vandaag herindienen. Die amendementen hebben allemaal hetzelfde doel: de toewijzing van de stemmen die door de landgenoten in het buitenland worden uitgebracht, aan het Brussels Hoofdstedelijk Gewest. Wij willen die regeling om een van de groteske onevenwichten die veroorzaakt worden door de onzuivere splitsing van de kieskring BHV, een beetje te compenseren. Ik verklaar mij nader.
Vanaf volgende week zullen wij in de commissie voor de Herziening van de Grondwet de splitsing grondig bespreken. Welnu, de Brusselse Vlamingen betalen het gelag voor de onzuivere splitsing van de kieskring Brussel-Halle-Vilvoorde. In de voorstellen voor de kieswethervorming inzake Brussel-Halle-Vilvoorde is elk evenwicht zoek. In plaats van rekening te houden met het bestaan van twee evenwichtige gemeenschappen in Brussel, wordt de minst talrijke groep, de Vlamingen, politiek uitgeschakeld. De Brusselse Vlamingen worden electoraal volledig opgegeven.
De splitsing van de kieskring Brussel-Halle-Vilvoorde voor de Kamerverkiezingen wordt bewust op zodanige wijze doorgevoerd dat het voortaan uitgesloten is dat de Brusselse Vlamingen nog een of twee zetels van de 15 Brusselse zetels in de Kamer kunnen behalen. In tegenstelling met de verkiezingen voor het Hoofdstedelijk Gewest, Europa en de Senaat, wordt er voor de Kamer niet in taalgesplitste lijsten voorzien en wordt het de partijen bovendien uitdrukkelijk verboden hun lijsten te verbinden. Elke vorm van apparentering of poolvorming wordt uitgesloten. Daardoor zullen alle Nederlandstalige lijsten onder de kiesdrempel vallen. Het wordt dus onmogelijk om in Brussel nog een Nederlandstalige als Kamerlid te verkiezen.
Concreet verliezen de Vlaamse partijen daardoor twee Kamerzetels aan de Franstaligen. Alle 15 Kamerleden uit Brussel zullen daardoor tot de Franstalige taalgroep behoren, ondanks het feit dat meer dan 10 % van de Brusselse kiezers voor een Nederlandstalige lijst stemt. Het wordt op die manier een puur symbolische stem. De Vlaamse Brusselaars worden op die manier gewoonweg politiek gelyncht. De traditionele partijen in de Vlaamse regering staan erbij en kijken ernaar. De meerderheidspartijen hebben, naar aanleiding van de besprekingen in de Senaat, nochtans ook zelf moeten toegeven dat een Vlaamse gekozene in Brussel er wellicht niet meer in zit.
De mensen zitten niet te wachten op een ideologische sterilisatie, op een eenheidslijst, maar uit de reacties op de oproep van Wouter Beke bleek sowieso duidelijk dat een Vlaamse eenheidslijst niet direct aan de orde is. Het gevolg zal dan ook zijn dat een aantal Vlaamse politieke partijen enkele kandidaten op allicht onverkiesbare plaatsen van de lijsten van hun Franstalige evenknie zal willen posteren.

Het is onaanvaardbaar dat al die buitenlanders in de toekomst enkel nog vertegenwoordigd zullen zijn door Franstalige politici. Daarom vinden wij het ook niet meer dan logisch dat alle stemmen die door landgenoten vanuit het buitenland worden uitgebracht in de toekomst toegewezen zullen worden aan het Brussels Hoofdstedelijk Gewest. Brussel en de daarmee verbonden internationale instellingen en functies zijn voor veel landgenoten immers nog het enige bindmiddel met ons land. Ze hebben vaak veel meer binding met Brussel dan met de gemeente waar men het laatst verbleef of waar men geboren is en al zeker dan met de gemeente waar vader, moeder of een verwant in de derde graad is ingeschreven zoals in het voorliggend wetsvoorstel voorzien.
Ongeveer 40 % van de stemmen in het buitenland worden door Vlamingen uitgebracht. Als men die toevoegt aan het Brussels Hoofdstedelijk Gewest, dan zal men het Nederlandstalige kieskorps in Brussel met enkele tienduizenden stemmen uitbreiden. Op die manier wordt de kans toch weer wat groter dat de Vlaamse partijen in Brussel de kiesdrempel kunnen halen zodat de Vlamingen in hun eigen hoofdstad tenminste politiek kunnen overleven.

Contrairement à d'autres pays – d'ailleurs, la France vient de vivre cette expérience à l'occasion des élections législatives –, la Belgique n'a pas fait le choix de créer une ou plusieurs circonscriptions électorales à l'étranger. Nous avons plutôt souhaité définir des critères objectifs de rattachement entre ces Belges de l'étranger et les communes auprès desquelles ils seraient autorisés à s'inscrire. C'est un peu comme un retour aux sources, un retour au bercail.
L'avancée essentielle réside dans le fait qu'une fois que ces Belges seront inscrits, ils le resteront. Finies les formalités fastidieuses qui souvent découragent à utiliser ce droit de vote. Cette obligation systématique de réinscription à chaque élection, c'est du passé. C'est fini! Cette mesure est une véritable avancée!
De même, on retrouve des avancées dans les modalités d'exercice du droit de vote et de dépouillement.
Enfin, je pense qu'il faut aussi souligner le fait que ce système n'enlève rien au caractère obligatoire du vote, qui est maintenu à l'égard des Belges à l'étranger. Une fois qu'ils auront fait le choix de cette inscription, ils auront à assumer ce devoir électoral.
Cela étant, nous considérons que ce que nous allons probablement voter demain est une étape importante, mais que ce n'est qu'une première étape pour les droits électoraux des Belges à l'étranger. Comme d'autres, nous voulons aller plus loin et nous voulons aussi étendre ce droit aux scrutins régionaux. Nous souhaitons aussi que les résidents belges hors de l'Union européenne puissent participer au scrutin européen. J'espère qu'il ne faudra pas attendre une éventuelle nouvelle réforme de l'État pour y parvenir.
Je considère que ceci est une première étape. Je considère que l'ensemble des groupes qui constituent ce Parlement devraient voter ce texte. Je pense qu'une unanimité peut être envisagée. Finally, I think it should also be emphasized that this system does not remove anything from the mandatory character of voting, which is ⁇ ined with regard to Belgians abroad. Once they have made the choice of this inscription, they will have to assume this electoral duty.
That being said, we consider that what we are likely to vote for tomorrow is an important step, but that it is only a first step for the voting rights of Belgians abroad. Like others, we want to go further and we also want to extend this right to regional scrutiny. We also hope that Belgian residents outside the European Union can participate in the European elections. I hope that we will not have to wait for a possible new reform of the state to ⁇ this.

Mijnheer de voorzitter, collega’s, wij staan hier vandaag aan het begin van de behandeling van een hele reeks wetsvoorstellen die een gevolg zijn van een politiek akkoord tussen acht partijen die een tweederdemeerderheid in deze Kamer hebben. Het is een politiek akkoord en het eerste waarvan wij, als politieke partijen, ons moeten vergewissen, is of dit wetsvoorstel een correcte en juiste invulling geeft aan wat politiek werd afgesproken. Zo werkt de politieke democratie nu eenmaal. Men maakt een politiek akkoord en men probeert dan de juiste juridische invulling te geven aan dit politieke akkoord. Wij moeten daarop eenduidig antwoorden dat dit wetsvoorstel een juiste invulling geeft aan dat wat werd afgesproken in het communautaire akkoord tussen de acht politieke partijen die een tweederdemeerderheid in dit Parlement hebben. Dat is de essentie van een politiek akkoord.
Is dit wetsvoorstel over het stemrecht voor Belgen in het buitenland volmaakt of compleet? Hadden er nog andere dingen in moeten staan? Uiteraard! Elke partij heeft over elk thema – wij zullen dit in alle zestien wetsvoorstellen kunnen vaststellen – een bredere visie dan wat in het wetsvoorstel staat. Dat is nu eenmaal een politiek akkoord. Het gaat over het afsluiten van een politiek akkoord met de verschillende partijen om te komen tot een basistekst waar iedereen achter kan staan. Achter dit wetsvoorstel kan een groot deel van het Parlement zich scharen want de oppositiepartijen hebben zich beperkt tot een onthouding. Zij zijn het met andere woorden in principe eens met de wijze waarop het stemrecht voor Belgen in het buitenland wordt vergemakkelijkt en geobjectiveerd door te bepalen waar zij zich kunnen inschrijven en waar zij kunnen deelnemen aan de verkiezingen. Door zich te onthouden, hebben zij zich akkoord verklaard met het principe maar zij vinden het iets te weinig. Zij hadden er andere dingen willen aan toevoegen.
Het wetsvoorstel heeft inderdaad een aantal objectieve criteria toegevoegd waarmee wij bijzonder blij zijn omdat zij in het verleden tot een aantal fundamentele scheeftrekkingen hebben geleid. Ik denk dan bijvoorbeeld aan het kanton Lennik waar in 2004 alle Belgen uit het buitenland aan toe werden gevoegd. Dit leidde plotseling tot een taalverhouding en een verhouding tussen politieke partijen die helemaal geen weerspiegeling was van de bevolkingssituatie ter plaatse. Ook het toenmalige toevoegen van alle Belgen uit het buitenland aan het kiesarrondissement Brussel-Halle-Vilvoorde zal nu op een andere manier gebeuren. Men zal kijken naar de geboorteplaats, de verblijfplaats, de familieband tot de derde graad. Er zijn dus objectieve gegevens die een spreiding van de Belgen in het buitenland over het hele land tot gevolg zal hebben.

Onze partij is er voorstander van om ook stemrecht te geven aan Belgen in het buitenland voor verkiezingen op de andere niveaus. Wij gaan zelfs verder. Men moet hier ophouden met telkenmale het argument naar voren te schuiven dat dit wel in het akkoord van Vollezele stond, want die tekst is niet bekend. In het verslag aan de Koning van 17 oktober 2010, zo werd mij daarnet nog bevestigd, staat dat niet. Dat element hadden de onderhandelaars dus al laten vallen. Zij hadden gemerkt dat er daarover geen politiek akkoord mogelijk was.
Mijnheer Weyts, u had in Vollezele aan uw vriend Di Rupo, die u zo graag eerste minister zag worden en waarvoor u alles over had, al gezegd dat u dat element zou laten vallen omdat de heer Di Rupo dat niet graag had. Draai vandaag de zaken dus niet om.
Ik wens te spreken over de essentie van het voorliggend voorstel. Elke politieke partij kan achter die essentie staan, ook uw partij, mijnheer Weyts. Het zou u sieren, mocht u volmondig ja zeggen aan dit voorstel, in plaats van telkenmale nieuwe tegenargumenten te zoeken, zoals een kaakslag voor de Vlamingen, waardoor u kunt wijzen op wat er niet wordt binnengehaald!
Ons standpunt is zeer duidelijk. Laten wij, met de Vlaamse partijen en met de MR, onze vrienden ervan overtuigen dat in de toekomst elk politiek niveau zelf zijn verkiezingen kan regelen. Daar staan wij achter.

Cependant, il me semble important de montrer à la Flandre qu'en Wallonie aussi, des partis défendent l'autonomie constitutive des entités fédérées, sans, il est vrai, vouloir la scission du pays ni le confédéralisme. Comprenez bien que de nombreux Wallons ne veulent pas de la séparation du pays car ils refusent de vivre sous la dictature socialiste. Imaginez un peu notre vie en République socialiste de Wallonie! Ce serait un véritable enfer!
Afin de conserver l'unité du pays, il est temps d'opter pour un réel fédéralisme abouti qui respecte les entités fédérées parce que le fédéralisme au profit d'une Communauté, comme c'est le cas de la minorité francophone de la périphérie bruxelloise ou le fédéralisme au profit d'un parti, le Parti Socialiste, ne peut plus perdurer.
Mon parti défend une vision réaliste et progressiste de notre fédéralisme. C'est vrai, nous voulons continuer à vivre ensemble mais nous voulons aussi que tous les citoyens de ce pays aient les mêmes droits et que toutes les entités fédérées soient respectées. Malheureusement, en refusant de répondre favorablement aux demandes de la majorité flamande, les partis politiques surtout francophones détruisent petit à petit notre pays et son unité.
Tout comme je crois qu'il faut supprimer les avantages qui sont octroyés à une minorité dans les communes à facilités du pays, je suis persuadé qu'il faut aussi opter pour l'autonomie constitutive des entités fédérées. En ce sens, je soutiendrai bien entendu l'amendement déposé par la N-VA, qui démontre, une fois de plus, l'hypocrisie des partis francophones et, en premier lieu, manifestement du MR.
En ce sens, je félicite véritablement l'initiative de la N-VA qui met vraiment le MR devant ses responsabilités. Les partis francophones que j'ai l'habitude de fréquenter sont en effet très forts pour raconter des bobards à la population! Une fois qu'il faut choisir entre les idées et les postes ministériels, ils renient très souvent leurs belles promesses pour répondre aux sirènes du pouvoir! Ce système a fonctionné pendant des années. C'est vrai! J'en veux pour preuve le nombre de sièges socialistes dans cette assemblée! Si on refuse de voir cette réalité, je crains pour l'avenir de notre pays. On l'a suffisamment répété, les partis au pouvoir sont informés de cette situation, à eux d'en tenir compte ou de jouer à la politique de l'autruche. En tout cas, il faudra assumer. Si on n'écoute pas l'avis de la majorité, même si elle vient de Flandre, il faudra en payer les conséquences plus tard et il ne faudra pas pleurer quand la Belgique ne pourra plus continuer à exister.

Il est normal que, dans ces conditions, vous ne soyez pas opposé à l'instauration de l'autonomie constitutive avec tout ce que cela peut entraîner.
Essayer de faire croire, aujourd'hui, qu'avec l'autonomie constitutive, vous souhaitez mettre fin à la prétendue discrimination qui existait entre les élections fédérales et régionales, c'est bien trouvé! Goed gevonden! Mais chacun sait que ce n'est pas vrai. J'en veux pour preuve que, comme je l'ai déjà signalé, lorsque vous avez déposé des propositions de loi sur le sujet, vous n'avez pas évoqué cet aspect.
Cela dit, je voudrais réagir, monsieur le président, par rapport à des éléments qui se trouvent dans l'avis du Conseil d'État et qui doivent, selon moi, figurer au rapport comme étant la position défendue par le gouvernement, sur la base des propositions de loi à l'examen.
Deux questions sont posées par le Conseil d'État, questions auxquelles il est fondamental de donner les réponses les plus détaillées et les plus précises possible.
En ce qui concerne la situation des électeurs qui n'ont pas voté, il est important de préciser que la proposition de loi vise, notamment, à pérenniser l'inscription comme électeur dans une commune. À cet effet, elle prévoit que l'inscription comme électeur vaudra désormais pour l'élection législative qui se déroulera à partir du premier jour du quatrième mois suivant le dépôt du formulaire d'inscription ainsi que pour toutes les élections législatives fédérales ultérieures. En d'autres termes, le Belge n'est plus obligé de se réinscrire comme électeur à chaque élection, sauf s'il n'est plus immatriculé dans le poste diplomatique ou consulaire en question, il n'a pas voté lors de l'élection précédente ou il a choisi de voter par correspondance lors des précédentes élections et n'a pas confirmé son mode de vote dans le délai prévu. Dans ces trois hypothèses, il appartiendra aux Belges de l'étranger de remplir à nouveau un formulaire de demande d'inscription comme prévu à l'article 181bis, § 1er.
Pour rappel, dans le système actuel, l'électeur de l'étranger doit se réinscrire lors de chaque élection. Dans le système qui est proposé et qui a fait l'objet d'un accord (la sixième réforme de l'État), il ne doit plus se réinscrire pour autant qu'il ait effectivement rempli son devoir électoral.

It can therefore be understood that, in your opinion, everything should be transferred to the federal parliaments. The vote of the Belgians abroad... even the word “Belgians” annoys you! It is normal that, under these conditions, you are not opposed to the establishment of constitutive autonomy with all that can result.
Trying to make you believe, today, that with constitutive autonomy, you want to end the alleged discrimination that existed between the federal and regional elections, that is well found! Good found ! But everyone knows that this is not true. I mean as proof that, as I have already pointed out, when you submitted bills on the subject, you did not address this aspect.
That being said, I would like to react, Mr. Speaker, with regard to elements that are found in the opinion of the State Council and which, in my opinion, should be included in the report as being the position defended by the Government, on the basis of the bill proposals under consideration.
Two questions are asked by the State Council, questions to which it is fundamental to give the most detailed and accurate answers possible.
Regarding the situation of voters who have not voted, it is important to clarify that the bill aims, in particular, to perpetuate the registration as a voter in a municipality. For this purpose, it provides that registration as a voter will now be valid for the legislative election that will take place from the first day of the fourth month following the filing of the registration form, as well as for all subsequent federal legislative elections. In other words, the Belgian is no longer obliged to re-register as a voter in each election, unless he is no longer registered in the diplomatic or consular post in question, he has not voted in the previous election or he has chosen to vote by correspondence in the previous elections and has not confirmed his way of voting within the scheduled time. In these three cases, it will be up to the Belgians abroad to again fill out a form of application for registration as provided for in article 181bis, § 1er.
As a reminder, in the current system, the voter from abroad must re-register at each election. In the proposed and agreed system (the sixth state reform), he must no longer re-register as long as he has effectively fulfilled his electoral duty.

Dans la mesure où les Belges résidant à l'étranger, dès lors qu'ils remplissent leur devoir électoral, ne seront plus astreints, à l'instar des Belges résidant sur le territoire national, à exercer une quelconque formalité préalable pour encore être invités à voter, la proposition ne paraît pas devoir susciter des objections au regard des articles 10 et 11 de la Constitution, puisqu'elle tend non pas à créer de nouvelles différences de traitement qui, au demeurant, n'avaient pas, dans les avis précédents de la section législation du Conseil d'État, été critiquées, mais bien à les réduire.
Il subsiste, certes, une différence de traitement entre les électeurs belges résidant à l'étranger qui n'ont pas accompli leur devoir électoral et ceux résidant sur le territoire national. "Seuls les premiers doivent accomplir", pour reprendre les termes du Conseil d'État, "une démarche volontaire pour être reconduits dans leur statut d'électeur d'une élection à l'autre".
Il convient de relever, à nouveau, que dans le régime actuel, tout Belge résidant à l'étranger est soumis à cette formalité d'inscription à chaque élection, qu'il ait ou non satisfait à son obligation de vote lors de l'élection précédente. Il convient également de relever, ainsi que l'a récemment rappelé la Cour européenne des droits de l'homme au terme d'une analyse approfondie du droit et pratiques internationaux, "qu'aucune convention internationale n'interdit de soumettre à l'exercice du droit de vote à l'étranger à des restrictions et à traiter différemment les électeurs de l'étranger des résidents".
Au demeurant, ces différences de traitement subsistant exclusivement parmi les Belges n'ayant pas rempli leur devoir électoral lors de l'élection précédente, cela est objectivement justifié et n'est pas disproportionné par rapport à l'objectif poursuivi. Le fait de supprimer la mention d'une inscription d'un électeur dans cette commune ne prive nullement ce dernier du droit de vote. Il a simplement l'obligation de se réinscrire comme électeur. Et il peut se réinscrire à tout moment de sorte que, contrairement à ce qu'écrit le Conseil d'État, le droit de vote de l'intéressé n'est nullement privé de toute effectivité.
Il paraît, en outre, largement exagéré d'écrire que l'électeur qui n'a pas fait usage de son droit de vote voit sa qualité d'électeur soumise à des difficultés concrètes de mise en œuvre, dès lors que la seule difficulté qui ait existé jusqu'alors dans le régime du droit commun est réduite drastiquement en sollicitant un formulaire pour partie prérempli et à le renvoyer et à le remettre au poste consulaire de carrière.
À cet égard, il est intéressant de rappeler que, dans son rapport de 2010 sur le vote à l'étranger, la Commission de Venise a insisté sur le fait qu'"il est tout à fait légitime de demander aux électeurs de l'étranger de s'inscrire sur un registre pour pouvoir voter, même si l'inscription est automatique pour les résidents". Lorsqu'un électeur n'a pas pris part au vote, l'administration ne dispose d'aucun moyen pour savoir si cette abstention résulte d'une négligence ou si la convocation est parvenue à une mauvaise adresse ou encore si l'intéressé a quitté le pays sans s'inscrire dans un autre registre consulaire. Les postes diplomatiques ou consulaires de carrière ne transmettent pas aux Belges inscrits sur leurs registres le formulaire de demande d'inscription en qualité d'électeurs lorsqu'ils n'ont pas répondu au courrier visé à l'article 180septies lors des dernières élections législatives et ne se sont pas réinscrits en temps utile pour exercer leur droit de vote lors des dernières élections législatives.

En effet, ainsi que l'a rappelé la Cour constitutionnelle, à l'égard de l'électeur à l'étranger, les autorités belges ne disposent pas de moyens permettant de vérifier s'il est toujours établi et s'il est encore en vie à l'époque de l'élection. La justification est donc identique à la précédente.
La demande de confirmation du vote par correspondance intervenant peu de temps avant l'élection tend à minimiser ce risque de fraude et n'implique pas pour l'intéressé une formalité disproportionnée au regard de l'objectif poursuivi et des principes en cause puisqu'elle participe à assurer la régularité des élections.
De la même manière, la Cour constitutionnelle a ainsi déjà admis que l'obligation de confirmer une procuration qui, à défaut, ne serait plus valable est un moyen qui permet d'atteindre l'objectif, de ne pas permettre qu'un mandataire puisse voter alors que le mandant n'est plus établi à l'étranger, n'est plus en vie ou n'a pas manifesté son intention de maintenir le mandat qu'il a donné de voter en son nom.
Aucune des dispositions de l'article 2, § 5, n'exige des formalités ou des démarches qui seraient disproportionnées par rapport à cet objectif.

The request for confirmation of voting by correspondence occurring shortly before the election tends to minimize this risk of fraud and does not imply for the interested party a formality disproportionate in relation to the aim pursued and the principles in question, since it contributes to ensuring the regularity of the elections.
Similarly, the Constitutional Court has already admitted that the obligation to confirm a proxy that, otherwise, would no longer be valid is a means that allows to ⁇ the objective of not allowing a representative to vote while the representative is no longer established abroad, is no longer alive or has not expressed its intention to maintain the mandate he gave to vote on his behalf.

De afdeling Wetgeving van de Raad van State heeft in haar vorige advies zelf de risico’s van de stemming per briefwisseling benadrukt.
