De belangrijkste wijzigingen die werden aangebracht, gaan over een vereenvoudiging van het statuut. Het aanvangskapitaal dat voor het verkrijgen van een vergunning voor een instelling voor elektronisch geld is vereist, wordt verlaagd. Het wordt ook mogelijk om andere bedrijfswerkzaamheden uit te oefenen, die niet noodzakelijk met de uitgifte van elektronisch geld verband houden. Bovendien wordt de vrijstelling, die in de vorige richtlijn reeds was opgenomen, herzien.
Het tweede wetsontwerp wijzigt artikel 36/22 van de wet van 22 februari 1998. Het wetsontwerp regelt de instelling van een beroep bij de Raad van State, overeenkomstig de versnelde procedure tegen bepaalde beslissingen van de Nationale Bank van België.
Aldus rond ik mijn algemene toelichting af.
Collega’s, bij de algemene bespreking waren er uiteenzettingen van Veerle Wouters van N-VA, van Carl Devlies van CD&V, van Georges Gilkinet van de Ecolo-Groen-fractie en van Josy Arens van cdH.
Mevrouw Veerle Wouters, die straks ongetwijfeld nader op haar opmerkingen zal ingaan, merkte op dat de erg technische redactie van deze wetgeving het nauwelijks mogelijk maakt om de maatschappelijke betekenis en de toch wel erg ruime draagwijdte van dit wetsontwerp toe te lichten.
De heer Carl Devlies verwoordde de tevredenheid van zijn fractie over de wetsontwerpen. Met de omzetting van de richtlijn worden volgens hem marktspelers nu eindelijk gelijke voorwaarden opgelegd. Ook komt er een grotere soepelheid en wordt de rechtszekerheid voor de sector bevorderd. Tegelijkertijd zal het wetsontwerp leiden tot een daling van de administratieve lasten voor ondernemingen, wat niet onbelangrijk is.
De heer Arens wil dat ook over de digitale kloof wordt gewaakt. Er moet over worden gewaakt dat de kloof niet zou toenemen. Hij wijst tegelijkertijd ook op de mogelijke, positieve gevolgen voor rurale gebieden, die bijvoorbeeld met het sluiten van bankkantoren worden geconfronteerd.
De heer Gilkinet richtte zich, na het stellen van een aantal technische vragen, op de koninklijk besluiten die tot de uitvoering van deze wetsontwerpen moeten leiden.
Na het antwoord van de vice-eersteminister ging de commissie over tot de artikelsgewijze bespreking. Er volgden uiteenzettingen van mevrouw Wouters en de heer Gilkinet en antwoorden van aanvankelijk de vice-eersteminister en nadien van de staatssecretaris van Ambtenarenzaken.
Voor details over de artikelsgewijze bespreking verwijs ik graag naar het schriftelijk verslag.
Tot slot heeft de regering naar aanleiding van dit wetsontwerp eveneens amendementen ingediend die op het statuut van de beroepskredieten betrekking hebben. Met haar amendementen wil de regering het tijdelijk uitstappen uit het statuut van het beroepskrediet gemakkelijker maken, mits betaling van een uitstapprijs aan de Staat.
Na advies van de Raad van State en de bespreking in de commissie werden de amendementen overeenkomstig het advies van de Raad van State aangepast en goedgekeurd.
Opnieuw verwijs ik voor de nadere inhoudelijke en procedurele opmerkingen naar het schriftelijk verslag.

The main changes that have been made are about simplifying the statute. The initial capital required to obtain an authorisation for an electronic money institution shall be reduced. It will also be possible to carry out other business activities that do not necessarily relate to the issuance of electronic money. In addition, the exemption, already included in the previous directive, is being revised.
The second bill amends Article 36/22 of the Law of 22 February 1998. The draft law regulates the appeal to the Council of State, in accordance with the accelerated procedure against certain decisions of the National Bank of Belgium.

Colleagues, at the general discussion there were presentations by Veerle Wouters of N-VA, by Carl Devlies of CD&V, by Georges Gilkinet of the Ecolo-Groen group and by Josy Arens of CDH.
Mrs. Veerle Wouters, who will undoubtedly discuss her comments later, noted that the very technical drafting of this legislation makes it hardly possible to explain the social significance and the yet very broad scope of this draft law.
Mr Carl Devlies expressed his group’s satisfaction with the bills. With the transposition of the Directive, he believes that market players will finally be given equal conditions. It will also increase flexibility and promote legal certainty for the sector. At the same time, the bill will lead to a decrease in the administrative burden for companies, which is not insignificant.
Mr. Arens also wants to overcome the digital divide. We must be careful that the gap does not increase. At the same time, he also points out the potential positive consequences for rural areas, which are facing, for example, the closure of bank offices.
Mr Gilkinet, after asking a number of technical questions, focused on the royal decrees that should lead to the implementation of these draft laws.
Following the reply of the Deputy Prime Minister, the committee proceeded to the article-by-article discussion. The following were presentations by Ms. Wouters and Mr. Gilkinet and answers from the Deputy Prime Minister and subsequently from the State Secretary of Public Affairs.

Finally, following this draft law, the Government also submitted amendments relating to the statute of professional loans. With its amendments, the Government aims to facilitate the temporary withdrawal from the status of the professional credit, provided that payment of an exit fee to the State.
Following the opinion of the State Council and the discussion in the committee, the amendments were adjusted and approved in accordance with the opinion of the State Council.

Mijnheer de voorzitter, mijnheer de minister, collega’s, in plaats van met kleingeld op zak te lopen, kan men ook met een elektronische geldbeugel op stap gaan. Op de Belgische markt zijn de meest gekende merknamen van zo’n elektronische geldbeugel PingPing, Hipay en Proton. Het betaalsysteem Proton wordt uitgegeven door de kredietinstellingen, maar het houdt op te bestaan in 2014 omdat het aantal transacties dat via Proton verloopt, al een aantal jaren in dalende lijn ligt. Elektronische geldbeugels kennen dan ook een zeer beperkt succes in Europa. België heeft met PingPing en Hipay slechts twee vergunde instellingen voor elektronisch geld.
Om de ontwikkeling van de uitgifte van elektronisch geld te stimuleren, voorziet de richtlijn e-Money in een aantal wijzigingen die in het voorliggend wetsontwerp nauwgezet worden omgezet. Met de vernieuwde richtlijn wenst de Europese wetgever de ontwikkeling van de markt voor elektronisch geld te stimuleren, maar dat alles toch met behoud van een passende bescherming voor de consument.
Om elektronisch geld te mogen uitgeven, hebben de instellingen in principe voorafgaand een vergunning nodig. Het statuut en het toezicht op de instellingen voor elektronisch geld zal niet langer afgestemd worden op het stelsel van de kredietinstellingen, maar wel op dat van betalingsinstellingen. Dat neemt echter niet weg dat de Nationale Bank van België toezicht blijft uitoefenen op een gezond en voorzichtig beleid met een passende risicobeheersing van die instellingen.
Om het contant geld te beschermen dat de consument aan een uitgever van elektronisch geld betaalt in ruil voor elektronisch geld, dient die uitgever dat contant geld op een afzonderlijke rekening aan te houden, zodat bij een faillissement van de uitgever van elektronisch geld, de schuldeisers geen aanspraak kunnen maken op dat contant geld. Instellingen voor elektronisch geld mogen evenmin kredieten verlenen uit de geldmiddelen die zij ontvangen of aanhouden voor de uitgifte van elektronisch geld. Kredietverlening door die instellingen wordt echter wel mogelijk, want dat moet de winstgevendheid van die instellingen vergroten en dus meer uitgevers voor elektronisch geld aantrekken. Kredieten aan consumenten vallen nu dan ook onder de bescherming van de wet op het consumentenkrediet.
Om de uitgifte van elektronisch geld op te starten, zal voortaan dan ook minder aanvangskapitaal vereist zijn. Voor het verkrijgen van de vergunning zal het volstaan om over een maatschappelijk kapitaal van 350 000 euro te beschikken in plaats van de huidige 1 miljoen euro.

Mr. Speaker, Mr. Minister, colleagues, instead of running with small money on the pocket, one can also go on with an electronic money bag. On the Belgian market, the most well-known brands of such an electronic money bag are PingPing, Hipay and Proton. The Proton payment system is issued by the credit institutions, but it ceases to exist in 2014 because the number of transactions that run through Proton has been declining for several years. Electronic money bags are therefore very limited in success in Europe. With PingPing and Hipay, Belgium has only two licensed institutions for electronic money.
In order to stimulate the development of the issuance of electronic money, the e-Money Directive provides for a number of amendments that will be thoroughly implemented in the present draft law. With the revised Directive, the European legislator aims to stimulate the development of the electronic money market, but all this with the preservation of an adequate protection for consumers.
In order to be able to issue electronic money, institutions in principle need a prior authorisation. The statute and supervision of electronic money institutions will no longer be aligned with the system of credit institutions, but with that of payment institutions. However, the National Bank of Belgium continues to supervise a sound and prudent policy with adequate risk management of those institutions.
In order to protect the cash money that the consumer pays to an issuer of electronic money in exchange for electronic money, that issuer should keep that cash money on a separate account so that in the event of a bankruptcy of the issuer of electronic money, the creditors cannot claim that cash money. Electronic money institutions shall not grant credit from the funds they receive or hold for the issuance of electronic money. However, lending by those institutions becomes possible, as this should increase the profitability of those institutions and thus attract more issuers of electronic money. Consumer loans are now protected by the Consumer Credit Act.
In order to initiate the issuance of electronic money, less initial capital will be required. To obtain the authorisation, it will be sufficient to have a corporate capital of 350 000 euros instead of the current 1 million euros.

Om de consument voldoende te beschermen, moet het kapitaal wel permanent gehandhaafd blijven.
Ten slotte kan de Nationale Bank van België een vrijstelling verlenen aan een uitgever van elektronisch geld, indien het uitstaande bedrag aan elektronisch geld beperkt blijft tot 5 miljoen euro en de elektronische geldbeugel zelf maximaal 150 euro bedraagt.
In de commissie heb ik echter nog eens gewezen op het gevaar dat instellingen onder de radar van het toezicht kunnen blijven, indien zij elektronische geldbeugels tot maximaal 150 euro uitgeven, met daaraan gekoppeld een krediet tot 200 euro. In dat geval is de consument een heel stuk minder beschermd omdat dan de wet op het consumentenkrediet nog slechts gedeeltelijk van toepassing is. Niettemin zijn wij toch van mening dat de richtlijn en dit wetsontwerp een voldoende evenwicht vinden tussen de belangen van de uitgevers van elektronisch geld, enerzijds, en de belangen van de consument, anderzijds.
De toekomst zal moeten uitwijzen of het succes van de uitgifte van elektronisch geld door de nieuwe richtlijn en deze wet nu groter zal worden en, vooral, of het ook een veilig succes zal zijn. Laat ons geen misverstanden creëren: dit gedeelte van het wetsontwerp geniet de goedkeuring van onze fractie. U weet echter dat bij ons daarna meestal een “maar” volgt.
Die “maar” betreft dit keer een hele bundel amendementen die door de regering met betrekking tot het beroepskrediet is ingediend.
Die amendementen voorzien, mits de betaling van een bijzondere bijdrage, in een tijdelijke uitstapregeling voor kredietverenigingen uit het net van het beroepskrediet en uit het toepassingsgebied van de wet op het openbaar krediet. Tot nu toe dienen kredietverenigingen die uit het net van het beroepskrediet wensen te stappen een afzonderlijke aanslag te betalen van 34 % op de reserves opgebouwd tot 1994. Die afzonderlijke aanslag is dan ook een compensatie voor het fiscaal gunstige regime dat die kredietverenigingen in het verleden hebben genoten.
Zelfs wanneer zij uit het net van het beroepskrediet stappen, blijven die kredietverenigingen wel nog onderworpen aan zeer belangrijke beperkingen die opgelegd zijn door de wet op het openbaar krediet. Die beperkingen zijn de volgende: ze moeten de rechtsvorm van een coöperatieve vennootschap met beperkte aansprakelijkheid behouden, ze moeten het bedrag van de dividenden beperken, in geval van vereffening moet het vereffeningsoverschot betaald worden aan het Participatiefonds en zijn ook de mogelijkheden tot herstructurering beperkt tot de tot het net van het beroepskrediet behorende verenigingen.

The future will have to show whether the success of the issuance of electronic money by the new directive and this law will now be greater and, above all, whether it will also be a safe success. Let us not create misunderstandings: this part of the bill enjoys the approval of our group. You know, however, that after us usually follows a “but”.
That “but” this time concerns a whole bundle of amendments submitted by the government regarding the professional loan.
Those amendments provide, subject to the payment of a special contribution, for a temporary withdrawal arrangement for credit associations from the net of professional credit and from the scope of the Public Credit Act. Until now, credit associations wishing to withdraw from the net of professional credit have to pay a separate fee of 34 % on the reserves accumulated until 1994. That separate charge is therefore a compensation for the tax favourable regime that those credit associations have ⁇ in the past.
Even when they exit the net of professional credit, these credit associations remain subject to very significant restrictions imposed by the Public Credit Act. Those limitations are as follows: they must retain the legal form of a limited liability cooperative, they must limit the amount of the dividends, in case of liquidation the liquidation surplus must be paid to the Participation Fund and also the possibilities of restructuring are limited to the associations which are part of the net of the professional loan.

Indien men deze voorwaarden niet naleeft en wanneer zij uit het toepassingsgebied van de wet op het openbaar krediet treden, moeten deze kredietverenigingen de opgebouwde reserves, de herwaarderingsmeerwaarden, de voorzorgsfondsen voor toekomstige risico’s en het overgedragen positieve of negatieve resultaat aan het Participatiefonds betalen.
De beperking op het dividend en de verplichting tot het betalen van het vereffeningsoverschot of het equivalent daarvan wanneer een kredietvereniging de wet op het openbaar krediet niet naleeft, vinden vooral hun oorsprong in het sociaal oogmerk van deze wet. Bovendien gaat het in feite slechts om vier kredietverenigingen, met name BKCB, het Onderling Beroepskrediet, het Antwerps Beroepskrediet en Crédit Professionel du Hainaut. BKCB en Onderling Beroepskrediet zijn eigendom van de Franse vennootschap Caisse Fédérale du Crédit Mutuel du Nord-Europe. Het Antwerps Beroepskrediet werd vorig jaar overgenomen door de groep Ackermans & van Haaren. Het aandeelhouderschap van het Crédit Professionel du Hainaut is moeilijk te achterhalen, maar ik stel wel vast dat de gouverneur van Henegouwen hier wel bestuurder van is.
Dit alles brengt mij tot het volgende punt. Niet alleen ligt die bijzondere bijdrage een stuk lager dan vandaag, evenmin kunnen wij ons van de indruk ontdoen dat deze bijzondere bijdrage ook nog eens op maat is geschreven. The limitation of the dividend and the obligation to pay the liquidation surplus or the equivalent thereof when a credit association does not comply with the law on public credit, have primarily their origins in the social purpose of this law. Shareholders knew, and still know today, and know in advance that the return on their capital is or will be limited. Now the government offers the credit associations the opportunity to temporarily escape these restrictions, and all this on the condition of payment of a special contribution which is only a fraction of the accumulated reserves, thus a lot lower than the current contribution. Thus, it rewards the shareholders of these credit associations, who knew well and knew that they normally never claim to those reserves.
In addition, it is actually only four credit associations, in particular BKCB, the Onderling Beroepskrediet, the Antwerp Beroepskrediet and Crédit Professionel du Hainaut. BKCB and Onderling Occupational Credit are owned by the French company Caisse Fédérale du Crédit Mutuel du Nord-Europe. The Antwerp Professional Credit was acquired last year by the group Ackermans & van Haaren. The shareholding of the Crédit Professionel du Hainaut is difficult to find out, but I am certain that the governor of Henegouwen is the manager of this.
All this brings me to the next point. Aandeelhouders hebben dus geen recht op 150 % maar op slechts 100 % van het gestort kapitaal waarop zij een beperkt dividendrendement ontvangen. Wanneer zij echter achtergestelde leningen uitgeven, kunnen zij gemakkelijk de dividendbeperking omzeilen. Wij vragen ons dan ook af waarom de ontwijking van die beperkingen via de bijzondere bijdrage door de regering wordt beloond. Dat staat immers in schril contrast met het beleid dat deze regering voert ten aanzien van belastingplichtigen die soms proberen de hoge belastingdruk te ontwijken maar daar dan wel voor vervolgd worden.
Uit de analyse van de jaarrekening van 2011 blijkt bovendien dat enkel het Onderling Beroepskrediet een achtergestelde lening heeft uitgegeven. De berekeningsbasis wordt dus aangepast ten voordele van het Onderling Beroepskrediet. Op basis van die jaarrekening komen wij tot de bevinding dat het OBK geen bijzondere bijdrage zal moeten betalen aan de Staat wanneer het nu uitstelt. Dat is toch heel vreemd.
Dat brengt mij bij mijn voorlaatste punt van kritiek. De bijzondere bijdrage is een zoveelste eenmalige begrotingsmaatregel waardoor de regering structurele besparingen weer wat verder voor zich uit kan schuiven. Om louter begrotingstechnische redenen moet de 102 miljoen euro van deze bijzondere bijdrage niet aan het Participatiefonds gestort worden maar wel aan de Staat. Bij een betaling aan het Participatiefonds zou het bedrag immers niet worden opgenomen in de consolidatierekening van de begroting.
Ten slotte, mijnheer de minister, op aandringen van collega Almaci – die vandaag jammer genoeg verontschuldigd is – en mij heeft de commissie er uiteindelijk toch mee ingestemd om het advies van de Raad van State te vragen. U moet het met mij eens zijn dat het advies van de Raad van State bijzonder nuttig bleek te zijn. De oorspronkelijke amendementen die door uw regering werden ingediend, zonder advies van de Raad van State, waren zo opgesteld dat zelfs kredietverenigingen vanaf 2014 uit het toepassingsgebied van de wet op het openbaar krediet zouden kunnen treden zonder betaling van een vereffeningoverschot. Minister Vanackere, wij dringen er nogmaals op aan dat de regering tijdig advies aan de Raad van State zou vragen. Wanneer men amendementen indient in de commissie moet dat advies erbij zitten, zeker en vast wanneer het een bundel amendementen betreft die in feite een zelfstandig wetsontwerp vormen en absoluut niets te maken hebben met originele wetsontwerp.

We ask ourselves why the avoidance of these restrictions is rewarded through the special contribution of the government. Furthermore, the analysis of the financial statements of 2011 shows that only the Onderling Beroepskredit issued a disadvantaged loan. The calculation base is therefore adjusted in favor of the Intermediate Occupational Credit. On the basis of that annual report, we come to the conclusion that the OBK will not have to pay any special contribution to the State when it is now postponing. That is very strange.
This brings me to my last point of criticism. The special contribution is another one-off budget measure that allows the government to push structural savings a little further. For purely budgetary reasons, the €102 million of this special contribution should not be paid to the Participation Fund but to the State. In the event of a payment to the Participation Fund, the amount would not be included in the consolidation account of the budget.
Finally, Mr. Minister, on the insistence of colleague Almaci – who today, unfortunately, has been apologized – and me, the committee eventually agreed to seek the opinion of the State Council. You must agree with me that the State Council opinion proved to be ⁇ useful. The original amendments submitted by your government, without the advice of the State Council, were drawn up in such a way that even credit associations from 2014 could step out of the scope of the Public Credit Act without paying a liquidation surplus. Minister Vanackere, we once again urge the Government to consult the State Council in a timely manner. When submitting amendments to the committee, that opinion must be accompanied, ⁇ and firmly when it is a bundle of amendments that in fact constitute an independent draft law and have absolutely nothing to do with the original draft law.

Mijnheer de minister, collega’s, het oorspronkelijke wetsontwerp had tot doel een Europese richtlijn in nationale wetgeving om te zetten. De richtlijn heeft de bedoeling het rechtskader van instellingen voor elektronisch geld te herzien.
Daar hadden wij niets op tegen, ware het niet dat de regering van de gelegenheid gebruikmaakt, of beter gezegd misbruik maakt om via een amendement een heel andere problematiek erbij te sleuren, namelijk een nieuwe regeling betreffende de kredietverenigingen uit het net van het beroepskrediet. Dat heeft natuurlijk niets te maken met de Europese richtlijn. De problematiek van de kredietverenigingen uit het net van het beroepskrediet had de regering perfect in een apart wetsontwerp kunnen gieten, maar dan viel het waarschijnlijk te sterk op dat het amendement alleen maar moest dienen om de begrotingsopmaak te helpen.
De budgettaire impact van het amendement bedraagt, zegge en schrijve, 102 miljoen euro op jaarbasis. Het is een eenmalige maatregel, waarvan de opbrengst niet in het Participatiefonds terechtkomt, maar rechtstreeks ten goede komt aan de begroting. Dat is de ware teneur van het wetsontwerp dat nu wordt besproken. Zoals wij in de afgelopen weken hebben kunnen zien, is de regering hopeloos op zoek naar nieuwe inkomsten. Onderhavig gecamoufleerde amendement op het wetsontwerp moest meehelpen om het gat van het begrotingstekort te dichten op de kap van de kredietinstellingen.
Dat is dan ook de reden waarom het Vlaams Belang zal tegenstemmen.

The original draft law was intended to transpose a European directive into national legislation. The Directive aims to revise the legal framework for electronic money institutions.
We had nothing against this, if it were not that the government would take advantage of the opportunity, or rather abuse it to attract, through an amendment, a very different problem, namely a new regulation concerning the credit associations from the net of professional credit. This has nothing to do with the European Directive. De collega’s die onze werkzaamheden in de commissie voor het Bedrijfsleven of de subcommissie voor de Nucleaire Veiligheid volgen, weten dat zowat elk commissielid een stokpaardje heeft. Voor collega Clarinval is dat de federale bijdrage, voor collega Wollants is het een nieuwe kerncentrale, voor mij is dat de CANVEK.
Wat voorligt, behandelt een heel belangrijke thematiek. Hopelijk wordt onderhavig voorstel van resolutie niet zoals vele andere resoluties die snel stof vergaren en weinig politieke aandacht trekken.
Het gaat over een van de eerste dossiers, die ik in het Parlement mocht opvolgen. Op woensdag 10 november 2010 bleek na een antwoord van minister Magnette op een parlementaire vraag dat er een ernstig probleem was inzake het beleid van nucleaire export in ons land. Er zijn de ruzies, de communautaire geschillen en de oorlog tussen het Vlaamse Gewest en de federale overheid met klachten tot bij het Grondwettelijk Hof over wetgeving inzake nucleaire export. De Vlaamse regering zegt eigenlijk dat de federale regering zich te veel bemoeit met haar business. Dat mag men in dit geval letterlijk nemen. De regionale diensten, in het bijzonder de Vlaamse diensten, willen vooral exporteren. Zij bekijken het door een economische bril. Het boeltje moet opbrengen. Vandaar een klacht bij het Grondwettelijk Hof, die de klacht overigens heeft vernietigd. Vlaanderen is in het ongelijk gesteld. Arresten van het Grondwettelijk Hof zijn belangrijk in ons land.
In november 2010 bleek ook dat er nieuwe export plaatsvond naar Iran. Ik ben geen specialist in de internationale politiek, maar ik weet genoeg om te weten dat Iran en nucleair materiaal niet goed bij elkaar passen. In de subcommissie voor de Nucleaire Veiligheid hebben we een aantal parlementaire discussies gehad. Het dossier viel enkele keren van tafel en werd er telkens weer opgelegd. Twee jaar later kwam er dan een resolutie. Elke vooruitgang moeten we appreciëren. De tekst die voorligt, is een eerbaar politiek compromis. Tijdens die processie van Echternach hebben wij enkele punten voorgesteld, die niet in de resolutie zijn opgenomen. Een meerderheid is echter wel opgenomen.

Collega’s, het voorliggende eerzame compromis is natuurlijk een mijlpaal in de politieke geschiedenis, maar wij hopen echt dat er nog belangrijkere stappen ondernomen worden. Daarvoor kijken wij naar u, mijnheer de staatssecretaris. Wanneer het gaat over proliferatie en internationale veiligheid, is alleen het beste goed genoeg.
Bij het Internationaal Atoomenergieagentschap, waar België een zeer slecht imago heeft inzake nucleaire export, maakt men zich echt niet druk of een beslissing genomen wordt door Rudy Demotte, Kris Peeters of Melchior Wathelet. Dat er internationale transporten naar Iran plaatsvinden, is niet goed voor de internationale geloofwaardigheid van ons land. Als u niet snel de aanbevelingen implementeert die het Parlement na twee jaar debat geformuleerd heeft, is het slechts een kwestie van tijd voor wij opnieuw met zo’n dossier geconfronteerd worden.
Het dossier van november 2010 is niet het eerste dossier, er zijn er eerdere geweest. Ik doe een oproep tot actie. In plaats van de risee kan België een modelland zijn, met een strikte, rechtvaardige wetgeving inzake nucleaire export. Dat is een opdracht voor u, mijnheer de staatssecretaris.

Monsieur le président, je souhaite intervenir brièvement puisque j'ai été le rapporteur du groupe de travail. J'entends M. Calvo; effectivement, nous avons travaillé dans des conditions optimales pour arriver à une décision et à des recommandations précises et pratiques. Cet aspect des choses a manifestement été la ligne directrice des membres du groupe de travail; il convient de les en remercier.
En cette matière, il y avait d'abord des procédures pénales sur lesquelles nous n'avions pas prise, celles-ci étant couvertes par le secret des procédures judiciaires. Par ailleurs, les rapports de la CANPAN sont confidentiels. Il nous fallait donc travailler en fonction de la mission qui avait été confiée par la commission de l'Intérieur pour assurer et prolonger les recommandations de la sous-commission de la Sécurité nucléaire approuvées par notre séance plénière du 29 avril 2010; de plus, il fallait également optimaliser les procédures d'autorisation préalable d'exportation.
Une série de propositions est formulée ici par le groupe de travail et reprise par la commission de l'Intérieur. Je me permets d'insister sur quelques aspects. Le groupe de travail a entendu de nombreuses personnes dont les avis ont été particulièrement intéressants et éclairants; nous avons entendu tant les membres de la CANPAN que ceux des douanes et accises, du ministère des Affaires étrangères et de la Sûreté de l'État.
Ces auditions nous ont permis de mieux cerner la problématique, d'autant que la matière est maintenant exclusivement de compétence fédérale. La Cour constitutionnelle a précisé la chose, tout en sachant que les Régions ont été associées à nos travaux. En effet, nous avons pris contact avec les trois parlements régionaux pour leur demander d'informer notre sous-commission des travaux qu'ils auraient entrepris concernant la matière. Le rapport débouche sur une série de recommandations qui visent à sensibiliser en amont toutes les entreprises susceptibles d'être exportatrices, par des sessions d'information obligatoires, et à veiller à communiquer toutes les données à la CANPAN, qui est la commission-clé dans cette procédure.
Dans ce cadre, si le gouvernement prend les choses à cœur – il le fera, j'en suis persuadé – nous éviterons les incidents connus par le passé. Mais cela n'empêche pas que ces incidents doivent continuer à nous intéresser et à nous préoccuper, puisque nous savons que des poursuites pénales et des procédures judiciaires pourraient être enclenchées. Et peut-être, au travers de ces procédures, découvrirons-nous d'autres problématiques qui ont été ignorées.
En conclusion, monsieur le président, chers collègues, je dirais donc que ce dossier, comme tous les dossiers "sécurité", est un dossier qu'on ne ferme jamais. C'est le type de dossier que l'on ouvre et sur lequel on progresse; de plus, au fur et à mesure des informations, il faut reconstruire et prolonger les mesures à prendre.

A series of proposals are formulated here by the working group and taken over by the Interior Committee. Let me emphasize a few aspects. The working group heard many people whose opinions were ⁇ interesting and enlightening; we heard both members of CANPAN and those of Customs and Accises, the Ministry of Foreign Affairs and State Security.
These hearings allowed us to better understand the problem, especially since the matter is now exclusively of federal competence. The Constitutional Court clarified the matter, while knowing that the Regions have been associated with our work. Indeed, we contacted the three regional parliaments to ask them to inform our subcommittee of the work they would have undertaken on the matter. The report results in a series of recommendations aimed at raising awareness in advance for all companies likely to be exporting companies, through mandatory information sessions, and to ensure that all data is communicated to CANPAN, which is the key commission in this procedure.
In this context, if the government takes things to heart – it will do, I am convinced – we will avoid the incidents known in the past. But this does not prevent these incidents from continuing to be of interest and concern to us, since we know that criminal prosecution and judicial proceedings could be launched. And maybe, through these procedures, we will discover other problems that have been ignored.
In conclusion, Mr. Speaker, dear colleagues, I would say that this file, like all "security" files, is a file that is never closed. This is the type of file that is opened and on which progress is made; moreover, as information becomes available, it is necessary to reconstruct and extend the measures to be taken.

Dat is een continu proces waarbij dit Parlement, als federale poot van die meerledigheid, moet toezien dat deze complexiteit niet leidt tot slecht bestuur of tot reglementaire dwalingen.
Mijnheer Calvo, als u hier verontwaardigd komt wezen om die complexiteit, over het feit dat niet alles perfect is, dan zit u hier op de verkeerde plaats, dan moet u boeken schrijven over Utopia. Ik zit in het Parlement om zaken te veranderen. Ik zit hier om samen met u bijvoorbeeld de subcommissie Nucleaire Veiligheid op te richten, om samen met collega George het waakzame oog te blijven. Ik zal niet ontkennen dat u de luis in de pels bent van menig minister en ons als collega-parlementslid vaak verblijdt met uw snedige opmerkingen.
Collega’s, ik ben blij dat de karikatuurmolen van de heer Calvo even is gestopt en dat hij de zin heeft ingezien van deze consensusresolutie, die, voor alle duidelijkheid, samen met de andere collega’s van de oppositie is goedgekeurd.
Ik zei het reeds, het gaat over het afdwingen van een rigoureuze opvolging, de dissectie van de complexe adviesketting die de CANVEK is, want in dat adviesorgaan vindt overleg plaats tussen de douane, de Staatsveiligheid en de exportlicentieverlenende overheden in Vlaanderen en de andere Gewesten en regio’s.
Met deze resolutie sluiten wij aan bij het sterker integreren van onze non-proliferatieverplichtingen. Er is ook een sterkere internationale samenwerking, die wij reeds zien ontstaan en waarbij onze regering zich moet inschrijven om, inderdaad mijnheer Calvo en mijnheer George, koploper te zijn wanneer het op non-proliferatie en nucleaire veiligheid aankomt.
De collega’s hebben een aantal thema’s uitgelicht. Uiteraard moet er tot een compromis worden gekomen. Persoonlijk wil ik wijzen op de vraag aan de regering om verduidelijking aangaande het controlemechanisme voor de zogenaamde dualuserproducten. Dat zijn producten die geen militaire of veiligheidsbekommernissen zouden moeten teweegbrengen, maar die met manipulaties of foutieve aanwending alsnog in een militair complex aangewend kunnen worden.
