Mijnheer de voorzitter, collega’s, de Vlaams Belangfractie heeft een wetsvoorstel ingediend tot wijziging van de wet van 5 augustus 1992 op het politieambt, meer bepaald, wat de controle betreft die de politie in onze ogen zou moeten uitvoeren inzake schoolverzuim. Ik kom hier vandaag toch even mijn spijt uitdrukken over het feit dat de andere partijen, hoewel zij ons voor een stuk gelijk gaven, alleszins wat de beweegredenen voor het voorstel betreft, geweigerd hebben het voorstel mee goed te keuren.
Ik kan verwijzen naar een partijgenoot van u, mijnheer de voorzitter, namelijk de Brusselse minister-president Vervoort. Hij had het over het gigantische probleem in Brussel, waar tienduizenden jongeren rondlopen zonder enige toekomst of in alle geval zonder een maatschappelijk te verantwoorden toekomst. Die minister-president zei dat niet zomaar. Hij zei dat, omdat veel van die jongeren geen diploma behaald hebben, geen tweede landstaal kennen en op de arbeidsmarkt dus nauwelijks een kans maken.
Als men geen kansen heeft op de arbeidsmarkt, dan weet men zo ongeveer wat er gebeurt. In het minst slechte geval belandt men in de werkloosheidsstatistieken, moet men bedelen om een leefloon of, erger, begeeft men zich min of meer in de criminele sector van het zwartwerk, drugs dealen en nog veel erger. De jongste tijd komt er zelfs bij dat veel van die jongeren zich bekeren tot de fanatieke islam en dus zaken uithalen die hier in de voorbije weken en maanden al vele keren zijn besproken.
Wij hadden dus het goede idee – dat beaamden alvast sommige collega’s van andere partijen – om jeugdcriminelen, moedelozen en nofuturejongeren min of meer te dwingen om het normale pad te bewandelen. De jeugdcriminaliteit in Brussel, alsook in andere grootsteden, en zelfs steeds vaker in de kleinere steden, moet dringend een halt worden toegeroepen.
Een van de redenen is inderdaad het spijbelen. Wanneer men van de maatschappelijke weg af geraakt, komt dat onder meer door het spijbelen. Veel studies tonen aan dat er een band bestaat tussen de toename van de criminaliteit en het spijbelen. Het is dus in onze ogen noodzakelijk om de jongeren van de straat te houden en hun via het onderwijs een zekere toekomst en een perspectief te bieden.

Mr. Speaker, colleagues, the Flemish Interest Group has submitted a bill amending the law of 5 August 1992 on the police office, in particular, as regards the control that the police should perform in our eyes regarding school failure. Today, however, I come here to express my regret for the fact that the other parties, although they gave us some equality, have refused to approve the proposal in all respects as to the motives for the proposal.
I can refer to one of your party partners, Mr. President, namely the Brussels Prime Minister-President Vervoort. He spoke about the gigantic problem in Brussels, where tens of thousands of young people walk around without any future or at least without a socially responsible future. The Prime Minister did not say that simply. He said that because many of these young people have not obtained a diploma, do not know a second language and therefore hardly have a chance on the labour market.
If you do not have opportunities in the labour market, you know about what is happening. In the least bad case, one ends up in the unemployment statistics, one must beg for a living wage or, worse, one enters more or less into the criminal sector of black work, drug deals and much worse. In recent times, many of these young people convert to fanatical Islam and thus bring out matters that have been discussed here many times in the last weeks and months.
So we had the good idea – that officials had already some colleagues from other parties – to force youth criminals, immorals and no-future youths more or less to walk the normal path. Youth crime in Brussels, as well as in other major cities, and even more frequently in smaller cities, must urgently be stopped.
One of the reasons is indeed the spotting. When one falls away from the social path, it comes, among other things, through spotting. Many studies show that there is a link between the rise in crime and spoofing. So, in our eyes, it is necessary to keep young people out of the streets and provide them with a certain future and perspective through education.

Zo niet raken ze verstrikt in het web van bendes en, erger, salafisten en dergelijke meer. Wij menen trouwens dat leraren en zelfs ouders of opvoeders niet altijd of zelfs moeilijk bij machte zijn om te controleren of de aanwezigheid van jongeren op de scholen al dan niet gerechtvaardigd is. Daarom pleiten wij ervoor met het wetsvoorstel om de politiediensten de bevoegdheid te verlenen om het schoolspijbelen te controleren.
Ik zie het ook in mijn stad: jongeren, tieners die schoolplichtig zijn en een beetje lusteloos rondlopen in het centrum van de stad en daar al dan niet dingen uitsteken die het licht eigenlijk niet mogen zien. Dat komt dus nogmaals voort uit het verzuimen van die schoolplicht. Die correlatie tussen criminaliteit en spijbelen is wel degelijk bewezen.
Wij willen dus voldoende bevoegde politieambtenaren het recht en de plicht geven om een proces-verbaal van ongerechtvaardigde afwezigheid op te stellen. Dat proces-verbaal zou dan worden doorgestuurd, na een eerste waarschuwing, naar een kinderbijslagfonds, dat dan de nodige maatregelen kan nemen, want kinderbijslag kan natuurlijk alleen worden uitgekeerd wanneer men aan zijn schoolplicht voldoet.
Tijdens het debat in de commissie, dat ik zelf niet kon bijwonen wegens verplichtingen in de commissie voor de Landsverdediging, kwamen toch ook een paar sprekers van andere partijen aan het woord. De heer Bart Somers van Open Vld zei dat het wetsvoorstel inderdaad een ernstig maatschappelijk probleem ter discussie stelt en dat de maatschappij inderdaad bezorgd moet zijn om jongeren die continu spijbelen. Hij wees erop dat hun toekomstkansen, zoals ik reeds zei, zwaar gehypothekeerd worden, dat ze geen diploma zullen halen, dat ze geen kansen zullen hebben op de arbeidsmarkt. Dat is allemaal waar. En dan plots zei de heer Somers dat het wetsvoorstel geen goed instrument is, omdat wij moeten zorgen voor een integrale en inclusieve aanpak, alleen het woordje duurzaam ontbrak nog, dat is nochtans fel in de mode, waarbij het onderwijsveld, de ouders, de preventieve sector en, indien nodig, de politie worden ingeschakeld.

And then suddenly Mr. Somers said that the bill is not a good tool, because we must ensure an integrated and inclusive approach, only the word sustainable was missing yet, which is nevertheless fierce in fashion, involving the field of education, parents, the preventive sector and, if necessary, the police.

Het is typisch voor de Open Vld dat ze probeert een graantje mee te pikken aan de rechterzijde maar dan toch, als het erop aankomt, de linkse thesis aanhangt. Idem voor CD&V bij monde van mevrouw Slegers. Zij zegt dat er inderdaad een problematiek van spijbelen is. Ze is ook voorstander van de integrale aanpak. Dit probleem bestaat al vele jaren. Ik wacht op de integrale aanpak van al die partijen die al jaren in de regering zitten, zowel in de Vlaamse als in de federale.
Tussen haakjes, mevrouw Slegers vond het leuk om zich te distantiëren van het wetsvoorstel omdat de sanctionering van inbreuken op de schoolplicht een geregionaliseerde materie is. Tot nader orde is de politie in dit land niet gefederaliseerd. Wij kunnen dus moeilijk wetsvoorstellen indienen om de politie opdrachten te geven in het Vlaams Parlement. Dat is een rare redenering van CD&V, wellicht bedoeld om zich niet al te fel te hoeven uitspreken over de gegrondheid van dit voorstel.
Het is spijtig dat men zulks niet aanvaardt. Wij hopen op licht in de duisternis. Hopelijk beseffen sommigen nog dat spijbelen harder dan ooit moet worden aangepakt omdat het nu eenmaal een van de belangrijkste oorzaken is van de grote problemen met onze jongeren in de grootsteden en steeds vaker ook in de provinciesteden.

Mijnheer de voorzitter, collega’s, ik zal mijn verslag over de bespreking van het wetsontwerp tot wijziging van bepaalde artikelen van de basiswet van 12 januari 2005 betreffende het gevangeniswezen en de rechtspositie van de gedetineerden kort houden. Er wacht ons immers waarschijnlijk nog een lange namiddag. Niettemin wil ik het volgende meegeven.
Voorliggend wetsontwerp is er gekomen naar aanleiding van verschillende gijzelnemingen en incidenten in de gevangenissen. Het is mede op vraag van het gevangenispersoneel en in samenspraak met de vakbonden ingediend.
De wet wordt op een aantal punten aangepast. Voor wie het interesseert, geef ik de aanpassingen heel graag mee.
Het karakter van de penitentiaire arbeid wordt verduidelijkt. Meer bepaald wordt gesteld dat het ter zake niet over een arbeidsovereenkomst in de zin van de wet op de arbeidsovereenkomsten gaat. Er komt een wettelijke basis die het voor de administratie van de instelling mogelijk maakt de door de gedetineerde veroorzaakte schade te verhalen op gelden die de instelling aan de gedetineerde is verschuldigd.
De gevallen van fouille worden uitgebreid. Ik heb het over de fouillering op het lichaam.
Er is ook nog een aanpassing en uitbreiding van de tuchtregels, zoals de verzwaring van de tuchtstraf in geval van gijzelneming, met een vereenvoudiging van de procedure.
Tijdens de debatten in de commissie is er bijwijlen een pittig debat geweest. De discussies hebben zich in het bijzonder toegespitst op, enerzijds, de penitentiaire arbeid en het statuut ervan en, anderzijds, op de uitbreiding van de fouillering op het lichaam. Voor de concrete teksten en uiteenzettingen verwijs ik heel graag naar het schriftelijke verslag.
Mijnheer de voorzitter, indien u het mij toestaat, wil ik meteen het standpunt van onze fractie uiteenzetten.

I will hold my report on the discussion of the bill amending certain articles of the Basic Law of 12 January 2005 on the prison system and the legal status of detained short-term persons. There is probably a long afternoon ahead of us. Nevertheless, I would like to communicate the following.
The current bill came following various hostage-taking and incidents in prisons. It was also submitted at the request of the prison staff and in consultation with the trade unions.
The law is being amended on a number of points. For those who are interested, I would like to share the adjustments.
The nature of the penitentiary work is clarified. More specifically, it is stated that it is not a labour contract within the meaning of the Law on Labour Contracts. A legal basis shall be established that enables the administration of the institution to recover the damage caused by the detainee from funds owed by the institution to the detainee.
Cases of investigation are being extended. I am talking about the search on the body.
There is also an adjustment and extension of the disciplinary rules, such as the aggravation of the disciplinary penalty in case of hostage-taking, with a simplification of the procedure.
During the discussions in the committee, there was occasionally a bitter debate. The discussions have ⁇ focused on, on the one hand, the penitentiary work and its status and, on the other hand, on the extension of the search on the body. Collega’s, ik denk dat niemand enig bezwaar tegen de voorliggende maatregelen kan hebben, in die zin dat zij alle tot doel hebben om de veiligheid van het gevangenispersoneel te versterken. Dat is een belangrijk aspect. Wij hebben het wetsontwerp dan ook gesteund.
Wel moet een en ander nog verder worden uitgeklaard, aangepast of opgemerkt.
Ten eerste, het wetsontwerp bepaalt duidelijk dat er bij penitentiaire arbeid geen sprake is van een arbeidsovereenkomst, maar het blijft tot nader order nog altijd onduidelijk hoe dergelijke arbeid moet worden gezien, mevrouw de minister. U hebt die niet gespecificeerd en verwijst alleen maar naar KB’s, de basiswet en de European Prison Rules.
Wat is daar cynisch aan? Er wordt verwezen naar de basiswet, maar net dat artikel waarnaar men verwijst, is nog niet eens in werking. Als men ter verduidelijking naar een wettekst verwijst die nog niet van kracht is geworden, heeft men een probleem.
Dat brengt mij meteen tot het belangrijkste punt van kritiek, mevrouw de minister. Wij zullen vandaag een belangrijke wet aanpassen, een wet die nog niet volledig in werking is getreden. De basiswet dateert van 2005 en is dus acht jaar oud en die is vandaag nog altijd niet uitgevoerd.
Ik vind dat een verschrikkelijk pijnpunt in de rechtsstaat, die de onze toch zou moeten zijn. Ik vind dat bijna schandalig.
Wanneer ik terugkijk naar de discussie in de commissie, begrijp ik ook dat de wet niet wordt uitgevoerd en men dat niet klaar krijgt. Men verwijst naar het budget, maar ik denk dat er meer aan de hand is waarom er beslissingen worden uitgesteld of slechts fragmentarisch worden uitgevoerd, namelijk omdat er in de regering geen eensgezindheid is.

Colleagues, I think that no one can object to the measures in question, in the sense that they all aim to strengthen the safety of prison personnel. This is an important aspect. We supported the bill.
However, some things need to be further clarified, adjusted or noted.
First, the draft law clearly stipulates that there is no employment contract in the case of penitentiary work, but it remains unclear how such work should be viewed, Mrs. Minister. You have not specified them and only refer to KBs, the Basic Law and the European Prison Rules.
What is cynical about that? There is a reference to the Basic Law, but just that article to which it is referred is not even in effect. If, for clarification, one refers to a legislation that has not yet entered into force, one has a problem.
This brings me immediately to the most important point of criticism, Mrs. Minister. Today we will amend an important law, a law that has not yet fully entered into force. The Basic Law dates from 2005 and is therefore eight years old and it is still not implemented today.
I think that is a terrible pain point in the rule of law, which should be ours. I find that almost scandalous.
When I look back on the discussion in the committee, I also understand that the law is not implemented and it is not completed. It refers to the budget, but I think there are more reasons why decisions are delayed or are only implemented fragmentarily, namely because there is no consensus in the government.

Dat hebben wij mogen vaststellen bij de bespreking van onderhavig wetsontwerp. Als ik mij de discussies over de lichaamsfouillering voor de geest haal en de opmerkingen en vragen die ter zake door de CD&V- en de cdH-fracties werden gesteld, denk ik dat dat wel iets zegt over de samenhorigheid in de regering.
Het waren trouwens terechte opmerkingen. Er moet inderdaad een broos evenwicht worden bewaard. Dit moet juist worden bepaald: wat kan en wat niet, wat is praktisch haalbaar. Dat is een heel belangrijk aspect. Hoe ver gaan we met die fouillering elke keer wanneer iemand in en uit de gevangenis komt, bezoek krijgt of ondervraagd wordt? Problematisch was dat de memorie van toelichting iets anders stelde dan de wetsartikelen, ook iets wat symptomatisch begint te worden voor de regering.
Er kon daarover in de commissie geen compromis worden bereikt tussen de meerderheidspartijen, zelfs in die mate dat de leden van CD&V en cdH zich op dat punt hebben onthouden en er zelfs een onthouding is gevolgd van sommigen van de meerderheid op het gehele wetsontwerp.
Ik keek uit naar de debatten daarover vandaag en was benieuwd naar wat de betrokken fracties vandaag zouden doen en naar hun standpunten. Ik zie echter dat collega De Clerck, die zich daarmee in de commissie heeft beziggehouden, er vandaag niet is.
Ik wil de collega’s en de leden van de meerderheid toch meegeven dat men op het terrein niets heeft aan die discussies als men de wet niet aanpast of conform de wet handelt. Maak goede wetteksten, kom overeen. Profilering is een zaak, maar goede wetteksten is een ander en net daarvoor zijn wij hier vandaag. Dat is het enige wat wij van de regering vragen.
Ik denk dat wij een verkeerde weg zijn ingeslagen bij de recentste wetteksten en wetsontwerpen. Desondanks, mevrouw de minister, menen wij dat het ontwerp voor de veiligheid van het personeel wel degelijk een stap vooruit betekent en kunnen wij er wel onze goedkeuring aan geven.

Si les objectifs des modifications proposées sont louables, mon groupe votera ce texte sans enthousiasme. Nous regrettons vivement que, huit ans après le vote de la loi qui reconnaissait, enfin, des droits et des statuts aux personnes qui subissent une peine de prison, certaines dispositions ne soient toujours pas entrées en vigueur. Mon groupe craint également que les modifications proposées, loin d'offrir plus de sécurité, remettent en cause un certain nombre d'avancées consacrées par la loi de 2005. Il est pourtant essentiel de trouver, en cette matière, un équilibre entre les devoirs des détenus et leurs droits, entre la sécurité et les conditions de travail des agents pénitentiaires et le statut des détenus, entre la sanction que doit subir le détenu et le maintien de la dignité humaine et de conditions de vie décentes au sein de la prison.
Le projet de loi aborde différentes thématiques. Je ne reviendrai que sur quelques-unes d'entre elles. Premièrement, ce projet vise à revoir les systèmes de fouille à corps. Cette mesure est particulièrement intrusive et doit être limitée au maximum. Si la sécurité dans les prisons est fondamentale que ce soit pour les gardiens, la société ou les détenus, il faut veiller à ce que les impératifs de sécurité ne mettent pas à mal les droits fondamentaux.

Ces tristes événements ne sont, malheureusement, qu'une illustration du malaise sévissant dans les établissements pénitentiaires et de l'insécurité tant pour les gardiens que pour les détenus, mais ce n'est pas nouveau.
Ce n'est un secret pour personne: la prison peut s'avérer constituer un monde brutal. La violence entre détenus, vis-à-vis des agents pénitentiaires, l'influence néfaste des délinquants lourds face à des détenus peut-être débutants ou plus faibles, l'introduction d'appareils de communication, d'armes ou d'éléments servant à les fabriquer, le trafic et la consommation de drogue constituent des phénomènes qu'il ne convient certes pas d'occulter.
La volonté de réaliser des incarcérations dans le respect de la dignité humaine constitue également un objectif pour tous.
L'état des bâtiments des prisons n'est pas satisfaisant; on le sait aussi et il faut y remédier. C'est pourquoi a été entrepris par le Masterplan toute une dynamique en ce sens. Le chantier demande du temps et donnera des résultats, mais malheureusement pas dans l'immédiat.
D'autres initiatives ont été prises ou seront prises à plus court terme pour retirer certaines personnes des prisons et ainsi réserver davantage la prison aux seuls délinquants les plus dangereux pour la société et pour lesquels la prison représente la réponse la plus adéquate. Je pense notamment au récent projet autorisant la libération conditionnelle sous bracelet électronique. Dans la même ligne, l'instauration – au même titre que les travaux d'intérêt général – d'une sanction autonome sous la forme d'un bracelet électronique doit être possible.
Il est primordial, pour mon groupe et moi-même, que la réponse pénale apportée par la société aux atteintes qui lui sont portées corresponde à une véritable réflexion sur la pertinence de l'échelle répressive et sur l'échelle de la valeur que sous-tend ce choix.

In particular, I think of the recent project allowing the conditional release under electronic bracelet. In the same line, the establishment – as well as works of general interest – of an autonomous penalty in the form of an electronic bracelet must be possible.
It is of paramount importance, for my group and for myself, that the criminal response provided by society to the offenses that are brought to it corresponds to a genuine reflection on the relevance of the repressive scale and on the scale of the value underlying this choice.

Concrètement, la durée de sanction "privation de cantine, des visites, de bibliothèque et de sport" augmente de 15 à 30 jours au maximum. Par ailleurs, cela permettra d'infliger la cellule d'isolement pendant 9 jours au lieu de 3 actuellement. Cette mesure me paraît également complètement proportionnée à la problématique que représentent les moyens irréguliers de communication, notamment et principalement les gsm. C'est en effet un moyen souvent utilisé pour faire entrer de la drogue, organiser des évasions, etc.

Mevrouw de minister, de basiswet inzake de rechtspositie van de gedetineerde wordt vandaag aangepast na overleg met de cipiersvakbonden. Daar zijn wij niet rouwig om. Het is een relatief klein gedeelte van de wet dat wordt aangepast en volgens ons moeten er nog heel wat andere zaken in die wet gewijzigd worden. Ik zal mij vandaag in elk geval beperken tot het bestek van wat u in uw wetsontwerp hebt gezet. Een groot deel van de wet is trouwens nog niet in werking. Een heel aantal artikelen is nog niet in werking getreden. Naar mijn aanvoelen zijn die uiteindelijk ook niet werkbaar omdat men in die wet is uitgegaan van een verkeerd begrip, met name de detentieschade die uitsluitend mag opgelopen worden door een gedetineerde. Men heeft geprobeerd de ideale wereld in die wet te gieten maar die moet dan op het terrein, in de gevangenissen zelf, vertaald worden, met alle gevolgen van dien. Een gevolg daarvan is dat een groot deel van die wet niet in werking is getreden, wat zeker ook te maken heeft met de infrastructuur in een groot deel van de Belgische gevangenissen.
Maar goed, mevrouw de minister, wij beperken ons vandaag tot het gedeelte waartoe u zich beperkt hebt. Wij zijn er gematigd positief over. Wat de arbeid van de gedetineerde betreft maak ik toch even de kanttekening dat er nog steeds geen definitie van wordt gegeven. Het gaat natuurlijk vooral over de naaktfouilleringen. Dat is de reden waarom ik daarnet zei dat wij gematigd positief zijn over dit wetsontwerp. Ik grijp daarvoor terug naar een actie die ikzelf heb ondernomen, samen met Vlaams Belangparlementsleden uit Limburg. In december 2009 zijn wij met een aantal parlementsleden en medewerkers naar de gevangenis getrokken. Wij hadden een aantal honden meegenomen die geschikt waren om als drugshond te worden ingezet in de gevangenis. Dit was in feite een ludieke actie. Uiteraard mochten die beesten niet mee binnen. De beesten van het Vlaams Belang mochten wel binnen in de gevangenis, de parlementsleden althans.
Wij werden daar rondgeleid en door cipiers onderricht over hoe de fouilleringen – een gewone fouillering, een naaktfouillering en een onderzoek aan het lichaam – plaatsvinden. Wij mochten na afloop van onze actie trouwens de gevangenis ook buiten, mevrouw de minister.
Zes dagen na ons bezoek krijg ik twee oproepen van cipiers met de mededeling dat een gedetineerde was gestorven ten gevolge van het innemen van een drugcocktail in de gevangenis. Het ging om een mengeling van twee drugs die hem fataal was geworden. Niemand kan ons dan ook beschuldigen van tafelspringerij. Wij hebben toen ook op dit vlak een prangend probleem onder de aandacht gebracht.

Er moet een wetsdokter bijkomen. Tegen de tijd dat het zover is en de wetsdokter in de gevangenis arriveert, is de vogel gaan vliegen, hoewel dat op dat vlak misschien een iets te plastische uitdrukking is. In elk geval is het element van het misdrijf tegen dan al lang verstopt of weggegooid.
Wij moeten ons dus ook eens goed in de rol van de cipiers en niet alleen in de rol van de gedetineerden proberen in te leven, wanneer een naaktfouillering plaatsvindt en zaken worden vastgesteld, die alleen via een onderzoek van het lichaam kunnen worden ontdekt.
Mevrouw de minister, in zekere zin wil ik vandaag aangeven dat een dergelijke naaktfouillering nog niet ver genoeg gaat. Het is goed dat de maatregel wordt veralgemeend. Ik hoop ook dat in de commissie niet te veel twijfel is gezaaid. Madame la ministre, votre projet de loi poursuit des objectifs tout à fait compréhensibles et louables: sécuriser les prisons, sécuriser les agents pénitentiaires face aux détenus qui sont parfois dans des situations qui les poussent à l'extrême. Tout ceci est important et doit faire l'objet de nos soins attentifs.
En ce qui concerne la fouille, dans votre texte, vous nous proposez de passer d'une procédure, qui permet au directeur de la prison de considérer qu'une fouille est nécessaire quand il l'estime utile, à une procédure systématisée. L'objectif poursuivi est de rationaliser les procédures de fouille, de les rendre moins lourdes au plan administratif, de lutter contre l'introduction de choses que l'on n'a pas à y retrouver comme des armes, des téléphones portables ou de la drogue. La fouille peut être, en certaines circonstances, une occasion unique pour éviter de telles situations. Mais fallait-il passer de ce régime de décision du directeur à celui qui est proposé aujourd'hui? La fouille sera systématique chaque fois qu'un détenu entre à la prison, chaque fois qu'un détenu a reçu des visites sans vitre de séparation, chaque fois qu'il a été placé dans une cellule sécurisée ou une cellule de punition ou lorsque le directeur estime que des indices permettent de croire que la fouille des vêtements ne suffira pas.
Ce que nous visions en adoptant la loi de principes de 2005, à savoir veiller au nécessaire équilibre entre sécurité et humanité, n'est-il pas en voie d'être mis à mal et, peut-être, rompu?
En commission de la Justice, mon collègue Georges Dallemagne qui me représentait a souhaité s'abstenir sur ce point précis marquant par là le sentiment de notre groupe.
En ce qui me concerne, je m'interroge sur la praticabilité de cette fouille à nu systématique. Ne va-t-on pas faire pire que mieux? Si dans un premier temps, cette mesure pourra susciter chez les gardiens un sentiment de renforcement de leur sécurité, ne risquent-ils pas, au fil du temps, au regard des démarches qui en découlent, d'abandonner cette fouille? Finalement, ce texte qui aura suscité beaucoup d'émois sera-t-il réellement efficace et praticable sur le terrain?
Par ailleurs, comme vous le savez, certains s'interrogent sur la compatibilité de cette disposition avec la Convention européenne des droits de l'homme. Nous risquons peut-être des recours, des sanctions. Madame la ministre, il faudra donc que, sur cet aspect, le texte fasse l'objet d'un suivi et d'une évaluation très sérieuse et rapide quant à son efficacité, considération faite du but poursuivi.
J'en arrive ainsi au deuxième point que je souhaitais aborder, à savoir l'aide sociale. En ce qui me concerne, j'aurais souhaité que l'on introduise une disposition particulière dans le texte. En effet, au-delà de l'aide sociale classique, il y a l'aide sociale individualisée pour ce que l'on appelle les achats cantine, et pour lesquels certains CPAS, notamment ceux qui ont une prison sur leur territoire, sont aujourd'hui assez régulièrement condamnés. Ne faudrait-il pas inscrire, dans la loi, une disposition avec laquelle votre prédécesseur Stefaan De Clerck semblait d'accord lorsqu'il fut interrogé par les parlementaires, prévoyant que cette obligation incombe au SPF Justice de manière générale mais aussi à chaque direction de prison, puisque le travail des détenus et son organisation devraient permettre de faire face à ces obligations? Votre attitude, à cet égard, paraît un peu plus réservée que celle de votre prédécesseur.
Au cours du long débat que nous avons eu en commission des points de vue relativement différents se sont opposés dans la mesure où cette situation n'est pas explicitée dans la loi. J'ai le sentiment, madame la ministre, qu'à court terme, lorsque les CPAS seront encore sollicités, ils ne manqueront pas de mettre à la cause votre SPF de manière à faire préciser les conditions par la magistrature, à défaut pour nous de l'avoir fait. Je le regrette, mais je pense que ce sera la solution.
Ce n'est pas parce que nous sommes dans une majorité que nous ne pouvons pas exprimer nos états d'âme. Cela étant, notre groupe, sauf peut-être à une exception près, accordera son soutien à votre projet de loi.

De voorliggende wet is van bijzonder belang, zowel op economisch vlak – zij heeft immers impact op heel wat sectoren – als op juridisch vlak, gezien het grote aantal gedingen die te maken hebben met overheidsopdrachten.
Het is het sluitstuk van de omzetting van de Europese richtlijn 2007/66/EG. Een groot gedeelte werd vier jaar geleden al omgezet bij wet van 23 december 2009. Enkele weken geleden werden in het Parlement teksten voorgelegd om de kroon op het werk te plaatsen en de grote zekerheid te garanderen voor zowel overheden als aanbieders.
Het is niet mijn gewoonte om de discussies uit de commissie over te doen in de plenaire vergadering, maar wij hebben in de commissie een heel boeiende en inhoudelijk goede discussie gehad waarbij echter een aantal zaken moet worden opgemerkt.
Vooreerst hebben wij grote bedenkingen bij het tijdstip van indiening en de snelheid waarmee de wet in werking zou moeten treden. Er wordt het Parlement voorgehouden dat de wet al op 1 juli 2013 moet in werking treden.
Ik herinner u aan het grote belang van de wet dat ik zonet heb aangehaald. Aanbestedende overheden en bedrijven die willen inschrijven op aanbestedingen krijgen slechts heel korte tijd om zich aan te passen aan en conform te maken met de nieuwe wet.

Given the importance of the present bill, I would like to briefly explain our voting behavior.
The law in question is of particular importance, both on the economic level – it affects many sectors – and on the legal level, given the large number of cases relating to public procurement.

Er zijn onnoemelijk veel juridische gedingen over aanbestedingen, wat ons sterkt in de overtuiging dat deze wet technisch-juridisch 100 % waterdicht moet zijn. Door het ontbreken van een rapport van de Raad van State is dat voor ons echter geen zekerheid.
Deze wet is nodig. Of ze dan ook voor 1 juli 2013 in werking moet treden is nog maar de vraag. Het kan ook enkele maanden later. In de commissie hebben we om een advies van de Raad van State gevraagd maar het Parlement heeft dat niet gewild. Wij zullen niet vervelend doen met de vraag om dat alsnog te doen. De wet is nodig en belangrijk al vrezen we dat de werkwijze voor gaten heeft gezorgd.

Avant tout, j'aimerais vous expliquer en quelques mots les objectifs de la proposition, à savoir les dispositions en termes de motivations, d'informations et de voies de recours en matière de marchés publics et de certains marchés de travaux de fournitures et de services dans les secteurs classiques, dans les secteurs spéciaux et dans les marchés de la Défense et de la sécurité.
Nous intégrerons donc ces dispositions dans l'ensemble de la législation qui formera la nouvelle loi sur les marchés publics et entrera en vigueur – cela a été précisé – dès le 1ᵉʳ juillet 2013.
Les remarques de forme que j'ai retenues sont au nombre de trois.
La première concerne le reproche lié à la présence d'un ministre en commission. Je tiens à souligner la présence ici du secrétaire d'État pour la défendre et je l'en remercie.
La deuxième remarque est de savoir pourquoi nous avions pris la décision de rédiger une proposition de loi et non un projet de loi. Comme je viens de le sous-entendre, il s'agissait d'une urgence pour son entrée en vigueur. Par ailleurs, faut-il rappeler que nous avons vécu 540 jours sans gouvernement alors qu'il fallait absolument intégrer les voies de recours pour que la loi devienne complète et soit d'application dès le 1ᵉʳ juillet.

Je me permettrai, chers collègues, de vous lire la conclusion de cette analyse: "À la lecture combinée des dispositions des différentes directives, il apparaît qu'il y a finalement quatre possibilités de dérogation dans les deux systèmes. Trois d'entre elles sont utilisées dans la proposition de loi. Dans l'économie de la directive relative aux secteurs spéciaux, la quatrième possibilité de dérogation pour les marchés basés sur un accord-cadre est reprise dans la première. Het zou namelijk veel handiger zijn als men de bepalingen inzake fraudebestrijding die met elkaar verband houden, ook samen zou houden in plaats van die te verspreiden over diverse opeenvolgende wetsontwerpen, die vervolgens ook nog eens door het Parlement gejaagd worden. Dat kan de eenheid van interpretatie absoluut niet bevorderen.
Die eenheid van interpretatie kan nog veel moeilijker worden bewaard als men een wetsontwerp als hetgeen voorligt, met zijn 14 artikelen, dan nog over vier of vijf verschillende commissies verspreidt. Uit de verslagen van de verschillende commissies blijkt wel dat er een grote samenhang was tussen de besprekingen in al die commissies. Wij hebben daar ook zelf toe bijgedragen. Ook al belet de bevoegdheidsverdeling over de verschillende commissies dit niet, wij vragen om samenhangende bepalingen voortaan in één wetsontwerp in te dienen.
Vorige week hebben wij hier in de plenaire vergadering het wetsontwerp houdende diverse fiscale en financiële bepalingen besproken, waardoor in het bijzonder in het fiscaal strafrecht het begrip “ernstige fiscale fraude” wordt ingevoerd. In het voorliggende wetsontwerp wordt nog eens datzelfde begrip geïntroduceerd, nu in de preventieve witwaswetgeving, het strafrecht en het vennootschapsrecht. Het vervelende is dat de invulling van het begrip “ernstige fiscale fraude” in de memorie van toelichting in beide wetsontwerpen niet helemaal gelijkluidend is.

U bent dan ook terecht voorstander van een bijvoeglijke lezing van deze witwasindicatoren. U treedt daarmee minister Onkelinx niet langer bij, want zij beschouwde dit als een autonome interpretatie van deze indicatoren. Mijnheer de staatssecretaris, hierdoor treedt u de zienswijze bij van de toenmalige minister van Financiën, de heer Reynders.
Duidelijkheid ter zake is zeer belangrijk en daar zorgt u ook voor, mijnheer de staatssecretaris. Met een verbreding van het toepassingsveld inzake de meldingsplicht is het belangrijk dat dit duidelijk wordt. Wij vrezen dat er een gevoelige vermeerdering zal komen van vaak niet noodzakelijk bruikbare meldingen bij de CFI. Ik weet trouwens niet of het ontbreken van kwalitatieve meldingen de efficiëntie zal verhogen. Zoals u weet, kijk ik graag naar wat de cijferberoepen de laatste tijd al allemaal om de oren geslagen hebben gekregen. Ook hier weer blijkt dat zij steeds meer zaken moeten melden, maar dat kost die mensen tijd en geld. Hopelijk zullen de verkregen resultaten van die meldingen ook nog kwalitatief zijn.

Het gaat hier niet om kleine criminelen. Ik ben dan ook blij dat de meerderheid mij hierin gevolgd is. Door artikel 7 wordt dit absoluut voorkomen. Daar dank ik u voor.
Omdat wij steeds constructief oppositie willen voeren, vraag ik de meerderheid het probleem van de strafrechtelijke aansprakelijkheid van de handelaren en dienstverstrekkers die melding doen aan de CFI, te willen overwegen. Een van uw vorige antifraudemaatregelen, mijnheer de staatssecretaris, was de invoering van meldingsplicht aan de CFI in hoofde van handelaren en dienstverstrekkers wanneer de beperking in betaling op contanten tot 5 000 euro niet wordt nageleefd. In dat geval moeten zij melding doen van een feit waarvoor zij hoofdelijk mee veroordeeld kunnen worden tot betaling van een strafrechtelijke geldboete. Ten slotte kan eenieder die een belang kan aantonen ook nog eens de gerechtelijke ontbinding vorderen.
Ik heb dan ook naar aanleiding van de bespreking van uw beleidsnota gevraagd naar de handhaving en toepassing van deze sancties, die toch wel bestaan. Ik ga ervan uit dat uw beleid gesteund is op feiten en ik vind het dan ook heel jammer dat er nergens melding wordt gemaakt van de resultaten van uw onderzoek.
Vier maanden geleden suggereerde ik dan ook om de fiscus op te dragen om systematisch de vennootschappen die drie jaar geen jaarrekening neerleggen te laten ontbinden. De fiscus zou dan niet alleen het belang van de overheid dienen maar van eenieder die met zulke lakse vennootschappen in contact komt.
De vraag is dan ook waarom u deze lakse vennootschappen niet gewoon opkuist. Deze procedure blijkt te tijdrovend, maar in plaats van deze procedure te verbeteren laat u nu het ondernemingsnummer doorhalen bij de Kruispuntbank van Ondernemingen. De Raad van State merkt ook terecht op dat op die manier de KBO-databank op onvolkomen wijze de juridische realiteit nog kan weerspiegelen.

Mijnheer de staatssecretaris, ik rond af, door te vragen dat u, indien u nog met nieuwe fraudemaatregelen naar buitenkomt, ze in één wetsontwerp zou willen bundelen, zodat wij een en ander als één geheel kunnen interpreteren. À l'heure où chaque citoyen doit consentir des efforts, il est intolérable que certains fraudent, que certains ne déclarent pas leurs revenus ou les plans dans les paradis fiscaux. L'impôt éludé par les fraudeurs est supporté par l'ensemble des autres contribuables. L'absence de fraude pourrait permettre d'abaisser le niveau d'impôt de l'ensemble de la population.
Depuis la commission d'enquête fiscale, mon groupe a été proactif sur ce sujet. J'en veux pour preuve de belles avancées, par exemple la levée du secret bancaire au sujet de l'una via également.

It will no longer be necessary to face international money laundering to punish tax fraud.
I hear some grinding teeth against the principle of equality and the adage that crimes and crimes must be defined with precision by law and that the penalties that are associated with them is a primary principle. Certainly ! But my group would like that as much jurisprudence, as much forecasting, as much predictability and as much precaution be taken in matters of fighting terrorism or in other matters in which the risks of infringing on privacy are high.
If, for some, the collection of information on the data of a bank account constitutes a breach of privacy and if they evoke this breach when it comes to the fight against major tax fraud, this is not the case for my group, nor is it the case for the Constitutional Court. De Cel voor Financiële Informatieverwerking (CFI) zal na de goedkeuring van deze wetswijziging ook het witwassen van geld voortkomend uit ernstige fiscale fraude die helemaal niet georganiseerd is, kunnen aanpakken. Het gaat dan om fraude die door de grote bedragen als ernstig kan worden beschouwd. Gezien ernstige fraude voortaan volstaat voor een melding, zonder dat ze georganiseerd is, zal de pakkans ook stijgen.
Toch wenst CD&V het volgende te benadrukken. Het invoeren van vereenvoudigde begrippen is toe te juichen, in zoverre ze inderdaad strekken tot meer duidelijkheid. Tijdens de besprekingen in de commissie voor de Justitie werd deze wetswijziging wat geminimaliseerd, als zou het enkel gaan om het weglaten van het woordje “en” in de notitie “ernstige en georganiseerde fiscale fraude”. Laten we echter niet vergeten dat de draagwijdte van het begrip hiermee aanzienlijk wordt uitgebreid, waardoor de in dit domein reeds ontwikkelde rechtsspraak niet altijd meer het nodige houvast zal bieden. Onze fractie heeft zich dan ook reeds in de commissie voor Justitie uitgesproken tegen het behoud van de zinsnede “al dan niet georganiseerd” die enkel een verwijzing naar het vroegere begrip inhoudt maar de facto niets wezenlijks toevoegt. Bovendien kan deze zinsnede er, ons inziens, toe leiden dat de rechter meent zich over het al dan niet georganiseerd karakter te moeten uitspreken terwijl dit slechts een mogelijke indicatie van de ernst is. De staatssecretaris heeft bevestigd dat deze zinsnede in feite kon worden weggelaten maar pleitte toch voor het behoud ervan. We vinden dit nog steeds jammer.
Ook betreuren wij – dit echter eerder terzijde – de gevolgde werkwijze in diverse commissies waardoor het debat in elke commissie werd beperkt. Wij betreuren dan ook de verwarring die er gezaaid is door tijdens de besprekingen te verwijzen naar werkzaamheden in andere commissies waarvan men inhoudelijk natuurlijk niet op de hoogte was op dat moment.
Voor een goed begrip, wij zijn voorstander van de verruiming van de actieradius van de fiscale fraudebestrijding. Met dit ontwerp wordt gevolg gegeven aan de aanbevelingen van de financiële actiegroep ter bestrijding van het witwassen van geld maar ook aan de aanbevelingen van de parlementaire commissie inzake grote fiscale fraude. Om die reden zullen wij ook met dit ontwerp instemmen. Wij zijn echter evenzeer voorstander van duidelijke wetgeving die de actoren op het veld in staat stelt deze verruiming om te zetten in concrete daden. De complexiteit van fiscale fraude noopt effectief tot een zekere mate van flexibiliteit in de wetgeving maar flexibiliteit mag nooit ten koste gaan van legaliteit. Wij verbinden er ons dan ook toe deze problematiek verder op te volgen en waar nodig wetgevend bij te sturen.

For this reason, we will also agree with this draft. However, we are equally in favour of clear legislation that enables the actors in the field to turn this enlargement into concrete actions. The complexity of tax fraud effectively requires a certain degree of legislative flexibility, but flexibility should never be at the expense of legality. We are therefore committed to further monitoring this issue and, where necessary, to provide legislative updates.

Le projet de loi présente de nombreuses mesures que je qualifierais de pragmatiques. On ne crée pas de nouvelles structures se superposant à d'autres, qui se court-circuiteraient et s'avéreraient, au final, inutiles. Au contraire, le gouvernement se montre terre à terre. Il utilise des instruments déjà mis en place, les affine, les précise et les étend quand cela est nécessaire.
Il est un point essentiel à soulever, c'est que, par ce texte, le gouvernement démontre sa maîtrise des éléments connexes à la fraude fiscale. Il a compris que la fraude fiscale ne concerne pas uniquement les personnes qui veulent éluder illicitement l'impôt. Elle touche aussi malheureusement les réseaux mafieux et terroristes qui mettent en place des mécanismes destinés à blanchir leur argent.
Je félicite donc le gouvernement de prendre à bras-le-corps ce problème et de faire preuve d'une plus grande sévérité. La modification de la loi du 11 janvier 1993 permettra un élargissement significatif de son champ d'application par une extension de la définition de la fraude fiscale. Plus de situations seront visées et plus d'infractions seront sanctionnées. En outre, cela permet aussi de nous conformer aux décisions du Groupe d'Action Financière (GAFI), ce qui est souhaitable et nécessaire dans l'optique d'une coopération internationale efficace.
Dans la nouvelle définition de la fraude fiscale, le degré d'organisation devient un des critères de sa gravité sans être nécessairement requis pour la qualifier. Therefore, I congratulate the government to take this problem hand in hand and to demonstrate greater severity. The amendment of the Act of 11 January 1993 will allow for a significant expansion of its scope by extending the definition of tax fraud. More cases will be targeted and more violations will be punished. In addition, this also allows us to comply with the decisions of the Financial Action Group (FATF), which is desirable and necessary in the perspective of effective international cooperation.
In the new definition of tax fraud, the degree of organization becomes one of the criteria for its severity without necessarily being required to qualify it. Thus, once this amendment is adopted, the Financial Information Processing Unit will also be able to address money laundering resulting from serious tax fraud that has no degree of organization but which, for example due to the importance of fraudulent amounts, can be classified as serious.

Cela constitue un durcissement manifeste de la législation, auquel je ne peux que souscrire avec l'ensemble du Mouvement réformateur. De même, la disposition prévoyant l'interdiction pour les marchands de métaux précieux de réaliser des transactions en espèces pour un montant supérieur à 5 000 euros, ramené dans quelques mois à 3 000 euros, ne peut être accueilli qu'avec satisfaction. Ce type d'opérations ne pourra plus s'effectuer sans trace et la lutte contre le blanchiment s'en trouvera renforcée. Il s'agit d'une modification législative simple qui ne coûte rien ou si peu, et qui, à n'en pas douter, sera très efficace.
Le projet de loi renforce également l'échange d'informations entre la Cellule de traitement des informations financières, d'une part, et l'auditorat du travail, le service d'information et de recherche sociale ainsi que le ministre des Finances, d'autre part. On le sait, en matière de lutte contre la fraude, la collecte de l'information mais surtout son croisement est d'une importance cruciale. Le gouvernement l'a bien compris, comme le prouve ce projet de loi. À nouveau, il s'agit d'une mesure qui coûte peu mais qui améliorera de manière importante la performance de l'administration et la lutte contre la fraude.
Par ailleurs, le texte de loi colle aux réalités d'aujourd'hui, puisqu'il vise et lutte contre notamment la vente de métaux comme le cuivre, un fléau que de nombreux navetteurs connaissent bien et qui fait perdre des millions d'euros à la SNCB. En rendant la revente plus compliquée, on diminue ce que l'on pourrait qualifier d'attractivité du vol.
Dans le cadre de la confection du budget 2013, le gouvernement a décidé qu'en ce qui concerne les sociétés qui n'ont pas respecté pendant trois années l'obligation de dépôt de leurs comptes annuels auprès de la Banque nationale de Belgique, le service de gestion de la BCE procédera à la radiation de la société en question en son sein, ceci pour éviter les reprises frauduleuses par des groupes que l'on peut définir comme mafieux.
Monsieur le secrétaire d'État, chers collègues, le projet présente une batterie de mesures à exécuter au plus vite. C'est en tout cas la volonté du Mouvement réformateur, au nom duquel je réaffirme le plein et entier soutien à l'égard de la lutte contre la fraude fiscale. Cette lutte doit continuer à se renforcer dans les mois à venir. Il en va d'un impératif budgétaire mais aussi d'un impératif de justice et d'équité.

Furthermore, the text of the law fits with today’s realities, since it targets and fights against, in particular, the sale of metals such as copper, a plague that many shippers know well and which causes the SNCB to lose millions of euros. By making the resale more complicated, we reduce what could be called the attractiveness of the flight.
As part of the preparation of the 2013 budget, the Government has decided that in the case of companies that have not fulfilled for three years the obligation to submit their annual accounts to the National Bank of Belgium, the management department of the ECB will proceed with the deletion of the company in question within it, in order to avoid fraudulent retracements by groups that can be defined as mafia.
Mr. Secretary of State, dear colleagues, the project presents a battery of measures to be implemented as soon as possible. This is, in any case, the will of the Reform Movement, in whose name I reaffirm my full and full support for the fight against tax fraud. This struggle should continue to intensify in the coming months. This is a budgetary imperative but also an imperative of justice and equity.

Samen met enkele collega’s, zoals trouwens ook gebleken is uit het verslag, heb ik kunnen vaststellen dat de grote fraudesystemen, onder andere bij buitenlandse betaalde forfaitaire belastingen en kasgeldvennootschappen, die destijds in de commissie werden onderzocht, veeleer te maken hebben met georganiseerde criminaliteit, maar veraf staan van de kruimelfraude van ondernemers, bij wie economische activiteit en werkgelegenheid nog altijd de belangrijkste drijfveren zijn.
Ik ben mij ervan bewust dat de grote fraudesystemen effectief moeten worden aangepakt, want zij scheppen een ondernemingsklimaat waarbij concurrentie eigenlijk niets te maken heeft met de producten die geleverd worden of met de dienstverlening, maar wel alles met degene die het laagst durft in te zetten op fiscale ethiek. Dergelijke fraudesystemen zijn van een totaal ander allooi. Zij rechtvaardigen ook een andere aanpak en regelgeving.
Evenwel moet de regelgeving proportioneel zijn, voorbeeldig en ook uitvoerbaar, en moet ze aanleiding geven tot een rechtszekere en gelijke toepassing. In het verleden heb ik al herhaaldelijk gezegd wat ik nu herneem. Of het nu gaat over de preventieve witwaswetgeving, over de toepassing van de una-viawetgeving, over de verruimde toepassing van de minnelijke schikking of over de repressieve aanpak via het strafrecht, de burger heeft recht op nauwkeurigheid, duidelijkheid en voorspelbaarheid.

However, I have already expressed my concern in the committee about the violation of the principle of legality in criminal matters, the violation of the Constitution and the European Convention on Human Rights, all based on the same principles.

De fraudebestrijding is een doelstelling die wij uiteraard onderschrijven; laat daarover alstublieft geen enkel misverstand bestaan. Dat u de fiscale fraude en de witwaspraktijken wilt aanpakken, is geheel terecht en daarvoor hebt u onze steun. Als u dat echter wilt doen, mijnheer de staatssecretaris, dan moet u dat goed doen en dan moet u dat met de juiste middelen doen. Ik vrees — ik sta duidelijk niet alleen met die vrees — dat daar net het schoentje knelt. De N-VA is er alleszins niet van overtuigd dat uw aanpak de juiste is.

Dat is in het bijzonder het geval in het strafrecht, mijnheer de staatssecretaris, want daar is er iets heel specifieks, met name het legaliteitsbeginsel. Collega Van Cauter gaf het daarnet al terecht aan, daar geldt nog iets meer. Het strafrecht vraagt nog net iets meer.

You do that in various laws and lawsbooks. For Justice it is about the articles of the confiscation declaration and the healing or laundering. I am referring to Article 505. This definition should also be added.
Serious tax fraud is a very broad concept, actually a container concept. We can say what we want here, but the people on the ground must continue with it. That is what it is about. They must fulfill your intentions and your purpose. If one wants to effectively tackle tax fraud on the ground and establish a proper functioning, it is essential that one knows well what should be understood under serious tax fraud. What does it hold in? What is the definition? What should we understand under it?
This is especially the case in criminal law, Mr. Secretary of State, because there is something very specific, in particular the principle of legality. Colleague Van Cauter has rightly stated that, there is something more. Criminal law requires more.
Therefore, I dare point out the judgment of the Council of State on this subject. The State Council does not say that it is contrary to the principle of legality, but is cautious. In the Justice Committee we waited with the treatment until we knew what was said in the Finance Committee because it was so important for us to know what was the outcome of the debate so that the violins could be voted. Je vous dirai simplement que le groupe cdH soutiendra ce projet de loi parce qu'il vise à améliorer la législation afin de lutter plus efficacement contre le blanchiment et la fraude fiscale même si, comme certains collègues l'ont déjà dit, cela ne doit pas non plus devenir une chasse aux sorcières.
Il s'agit ici de mettre la législation belge en conformité avec les standards internationaux tels que définis par le Groupe d'action financière (GAFI). Le champ d'action de la Cellule de traitement des informations financières sera donc étendu à la fraude fiscale grave, y compris quand celle-ci ne peut être qualifiée d'organisée. Suivant les recommandations de ce groupe pour lutter contre le blanchiment, le projet instaure l'obligation d'identification pour toute personne qui achète et paie des matériaux précieux en espèce afin d'assurer un suivi optimal et ainsi éviter tout risque de blanchiment, particulièrement dans cet important secteur des métaux précieux qui ont une grande valeur sur les marchés internationaux.
Ce projet de loi, au travers de la ministre de l'Intérieur, accorde aussi une attention particulière à un phénomène qui a pris de l'ampleur durant ces dernières années. Les vols des câbles sont en constante augmentation depuis quatre ans. De 290 vols en 2009, nous sommes passés à 1 362 en 2012, principalement en raison de la hausse du cours du cuivre. Cette criminalité occasionne des dégradations surtout sur les voies de chemin de fer, avec des conséquences nuisibles pour les navetteurs en termes de ponctualité. Il faut savoir que cela représente une moyenne de plus de 3 heures de retard par jour. Face à ce phénomène, les mesures proposées, par Mme Milquet, dans le titre IV du projet de loi, visent à permettre de lutter plus efficacement contre ces vols, notamment au travers d'actions de contrôle.
Monsieur le secrétaire d'État, permettez-moi de vous féliciter ainsi que le gouvernement pour les avancées importantes réalisées par ce projet de loi. Comme je l'ai déjà dit, notre groupe soutiendra ce projet.

This bill, through the Minister of the Interior, also pays special attention to a phenomenon that has gained scale in recent years. Theft of cables has been steadily increasing for four years. From 290 flights in 2009, we rose to 1,362 in 2012, mainly due to the rise in the price of copper. This crime causes deterioration especially on railways, with adverse consequences for shippers in terms of punctuality. It should be noted that this represents an average of more than 3 hours of delay per day. In the face of this phenomenon, the measures proposed by Ms. Milquet in Title IV of the bill are aimed at enabling a more effective fight against these thefts, in particular through control actions.

Om die diefstallen te bestrijden, werd een identificatieverplichting ingevoerd bij aankoop in contanten van oude en edele metalen door schroothandelaars en handelaars in edele metalen, zeg maar juweliers. Op die manier kan achteraf de identiteit van de dief of de heler gemakkelijk opgespoord worden.
Omdat de plaag van de koperdiefstallen echt niet onder controle te houden is, werd met het voorliggend nieuw wetsontwerp ook een verbod ingevoerd op de betaling in contanten van de aankoop van gerecycleerde koperkabels bij de schroothandelaars. Dat is een goede maatregel. Voor de handelaars in edele metalen wordt een beperking ingevoerd op de betaling in contanten tot 5 000 euro wanneer zij goederen aankopen.
Naast de verplichtingen bij aankoop, zullen schroothandelaars en juweliers door het voorliggend wetsontwerp hun klanten ook moeten identificeren bij de verkoop van oude en edele metalen voor een bedrag van meer dan 500 euro, betaald in contanten. Die maatregel draagt niets bij tot het bestrijden van de diefstallen van oude en edele metalen. Geen enkele dief of heler is immers geïnteresseerd in de aankoop van nieuwe juwelen. Als hij al geïnteresseerd is, dan is dat om ze te stelen. Aan juweliers verplichten om de identiteit van hun klanten te noteren wanneer die in contanten betalen, is in dat opzicht dan ook overbodig.
Omdat de identificatieverplichting wordt toegevoegd aan de regels om de diefstallen in de edele metalen te bestrijden, verwijst de memorie van toelichting eigenlijk naar de strijd tegen het witwassen van geld. Wie de sector van de juweliers een beetje kent, weet dat het witwassen van geld niet gebeurt door de aankoop van nieuwe juwelen.

Wie echter een ring van 550 euro koopt voor zijn echtgenote of zijn vriendin, moet zich laten registreren. Bovendien is een contante betaling bij de aankoop van duurdere juwelen heel onpraktisch en indien het verboden wordt boven 500 euro, moet het dus via bankkaarten. De limieten van de bankkaart voorzien dikwijls niet in het bedrag van betaling, omdat men per dag niet meer dan bijvoorbeeld 2 500 euro mag uitgeven. Om al die redenen hebben wij een amendement ingediend in de commissie om de verplichting volledig te schrappen.
De meerderheid is daaraan niet helemaal tegemoetgekomen, maar heeft gelukkig ingezien dat de voorgestelde maatregel inderdaad veel te ver ging. Collega Bart Somers stelde voor om een uitzondering te maken voor afgewerkte juwelen en horloges. Collega Wouters vroeg zich af of de verkoop van eretekens, medailles en insignes in edelmetaal of de verkoop van antieke voorwerpen waarin zilver verwerkt is, dan ook onder die identificatieverplichting valt. Ze wees erop dat in de definitie van edelmetalen het begrip “sieraden” veel ruimer is dan afgewerkte juwelen. Collega Somers was het hiermee eens en heeft de tekst van amendement nummer zes dan ook in die zin verbeterd.

Ten eerste, de identificatieverplichting is de basis van de preventieve witwaswet, waardoor die beter op punt staat. De staatssecretaris achtte het niet nodig om ook de geboorteplaats te registreren. Nochtans komt het voor dat personen met eenzelfde, veelvoorkomende voor- en familienaam, bijvoorbeeld Maria Peeters of Jos Janssens, bovendien op dezelfde dag geboren zijn. Het is bijgevolg raadzaam om ook de geboorteplaats te registreren. Voor alle duidelijkheid, ik heb hier niet gezegd dat elke Maria Peeters of Jos Janssens een witwasser is, ik wijs er hier alleen op dat naam en geboortedatum onvoldoende zijn om hen uniek te identificeren.
Een tweede reden waarom de maatregel beter past in de preventieve witwaswet, is omdat er bij een eventuele inschrijving van de identificatiewet in onderhavige wettekst niets gebeurt met de gegevens. La fraude fiscale est devenue un thème politique; je m'en réjouis. Il en est beaucoup plus question qu'auparavant. À présent, il faut agir. C'est pourquoi, très régulièrement, nous vous relançons sur ces recommandations qui ne sont pas encore d'application.
En tout cas, vous pouvez compter sur notre groupe pour soutenir toutes les propositions allant dans le sens de ce qui avait été recommandé par cette commission d'enquête. Ce sont de telles réussites qui nous poussent à nous montrer fiers de travailler dans un parlement, c'est-à-dire quand nous nous donnons la capacité d'aller au bout des choses. Mais, entre parenthèses, ce ne fut pas le cas dans toutes les commissions que nous avons mises en place.
Par contre, vous rencontrerez aussi chez nous un grand sens critique par rapport aux demi-mesures, par rapport aux recommandations qui ne sont pas mises en œuvre, par rapport au manque de réactions vis-à-vis de nouvelles formes de fraude fiscale.
Pour ce qui concerne le texte qui nous est soumis aujourd'hui, comme je vous le disais en commission, je confirme que vous pourrez compter sur les voix des treize parlementaires écologistes de ce parlement pour avancer. En effet, selon nous, la définition future des mécanismes de fraude qui peuvent déclencher des enquêtes, l'assouplissement de cette décision est une bonne chose. Les dispositifs précis mis en œuvre vis-à-vis de nouvelles formes de fraude ou de trafic de métaux précieux nous semblent conformes à l'objectif à viser: nous adapter à de nouvelles formes de criminalité.
Vous me permettrez néanmoins, monsieur le secrétaire d'État, de relever cinq points d'insatisfaction ou plutôt cinq défis, avec l'espoir de constater des réactions à leur égard et des réponses aux questions que nous continuons de nous poser.
Le premier point ne vous concerne pas vous uniquement, mais le gouvernement dans son ensemble; je souhaite donc que vous vous en fassiez le relais.

With regard to the text that is submitted to us today, as I told you in the committee, I confirm that you can count on the votes of the thirteen parliamentary ecologists of this parliament to move forward. Indeed, in our opinion, the future definition of fraud mechanisms that can trigger investigations, the easing of this decision is a good thing. The precise arrangements implemented against new forms of fraud or trafficking in precious metals appear to us to be consistent with the objective to be achieved: to adapt to new forms of crime.
However, you will allow me, Mr. Secretary of State, to raise five points of dissatisfaction or rather five challenges, in the hope of seeing reactions to them and answers to the questions that we continue to ask ourselves.
The first point concerns not only you, but the government as a whole; so I would like you to take a look at it.

Hier encore, avec ma collègue Meyrem Almaci, nous interrogions le ministre des Finances sur un dossier bien précis qui concerne une banque française, BNP Paribas, dont l'État belge est le premier actionnaire, qui organise un trafic de chèques à partir de pays d'Afrique via sa filiale à Monaco. Heureusement, les journalistes maintiennent la pression et découvrent chaque jour de nouveaux dossiers. Si l'on veut être crédible dans l'objectif de lutte contre la fraude, il faut commencer par ces institutions bancaires. Il faut que notre pays joue un rôle de pointe. J'avoue que je suis assez fatigué de ces arguments selon lesquels nous ne serions plus concurrentiels et que nous ne pouvons pas évoluer tout seul. Quand il y a des banques à participation publique, il faut les faire évoluer.
J'en arrive au deuxième point. Nous avons, au niveau de notre administration fiscale et des organismes chargés de lutter contre la fraude, des travailleurs particulièrement motivés. Ce sont des enquêteurs fiscaux qui ont été à l'origine de la commission d'enquête que j'ai abordée en introduction à cette intervention. Comme vous, je l'espère, je suis à leur écoute et ils se plaignent régulièrement du manque de coordination et du manque d'écoute de leur réalité.

I come to the second point. We have ⁇ motivated workers at the level of our tax administration and anti-fraud agencies. These are tax investigators who have been at the origin of the commission of inquiry that I addressed in introduction to this intervention. Like you, I hope, I’m listening to them and they regularly complain about lack of coordination and lack of listening to their reality.

C'est une question que je vous ai posée en commission, à la suite de l'interview du président de la CTIF (Cellule de traitement des informations financières) au journal L'Echo voici quelques semaines. Vous m'avez répondu être très attentif à cette question, ce dont je ne doute pas, mais je me dois d'être le relais de ce souci. Nous percevons une absence d'écoute envers ceux qui se démènent dans le cadre de leur fonction pour combattre la fraude et qui ne se sentent pas toujours soutenus comme ils devraient l'être, tant par leur hiérarchie que par le gouvernement. Je vous demande donc d'y veiller plus que jamais.
Je voudrais souligner un troisième élément, qui me semble paradoxal à l'heure où l'on dit que la lutte contre la fraude fiscale est prioritaire et où la Commission européenne cite un chiffre de 1 000 milliards d'euros d'absence de recettes pour l'ensemble des États membres. Pour la Belgique, ce manque à gagner s'évalue à 13 milliards – voire à un montant supérieur, selon d'autres études. C'est la diminution des moyens du SPF Finances. Quand nous posons cette question, on nous répond que les services d'élite ont été renforcés. La lutte contre la fraude fiscale doit disposer d'outils informatiques performants et doit être dotée d'une capacité d'analyser des dossiers en profondeur ainsi que de possibilités d'aller sur le terrain – y compris en dehors des heures de bureau. Nous avons créé la Cellule de lutte contre les paradis fiscaux en début d'année. C'est le cas dans la lutte contre le dumping social. Là aussi, la publication des arrêtés est imminente.
La coordination sur le terrain devient là aussi très importante, ainsi que la coordination européenne. Nous ne faisons qu'une partie. Je partage votre avis selon lequel l'existence d'un agenda détaillé est une bonne chose pour aboutir à des décisions.

Er is onduidelijkheid over wat de definitie inhoudt en over de vraag op welke manier zij moet worden toegepast. Zelfs binnen de eigen coalitie is het ontwerp onvoldragen. De juiste weg die nu moet worden gevolgd, is het ontwerp naar de commissie terugsturen en een en ander voor eens en voor altijd goed uitklaren.
U verklaart immers zelf dat u geen te strakke definitie wil. De rechters moeten ze kunnen invullen en interpreteren, waar ik u nog in zekere zin in kan volgen. U haalt hetzelfde argument echter ook aan voor uw criterium van proportionaliteit. U weet wel: het betekent dat de dag van de fraude wordt bekeken in verhouding tot het totale vermogen van de betrokkene.
Ik kom terug tot mijn voorbeeld. U werpt op dat de rechter de definitie maar moet invullen en bekijken hoe ernstig de fraude is. De rechter heeft echter nooit twee dezelfde zaken om te vergelijken. Hij heeft één zaak voor hem liggen. Er is de sukkelaar met zijn fraude van 1 000 euro op een eigen vermogen van 5 000 euro, zijnde een vijfde, wat heel groot is. In een andere zaak, in een andere kamer, in een andere rechtbank of in een ander arrondissement staat iemand anders met een fraude van ook 1 000 euro, maar met een eigen vermogen van 500 000 euro, waardoor de fraude dus slechts peanuts is. Het gaat immers slechts om een klein percentage. Het ene geval zal ernstig zijn, omdat het subjectieve criterium van proportionaliteit wordt weerhouden. Het andere geval zal om die reden niet ernstig zijn.
Het voorgaande is het probleem. U kan een dergelijke beslissing niet aan de rechter overlaten. Het criterium is te subjectief en geeft aanleiding tot ongelijkheid. De grote ondernemer zal met zijn fraude wegkomen en de kleine ondernemer niet. Een dergelijke maatregel geeft aanleiding tot klassenjustitie. Naar mijn mening zal net u zulks willen vermijden.
Dat is één aspect. De beslissing zomaar vrijelijk aan de interpretatie van de rechtbanken overlaten, is niet de juiste manier om volgen.
Ik heb nog een bemerking.
De praktijk moet met het ontwerp voort. Ik hoor de heer Van der Maelen mooi uiteenzetten hoe wij onze achterstand aan het inhalen zijn met het papier hier. Ik wil echter wel eens zien hoe het treintje in de praktijk bolt. Het bolt achteruit.
Immers, hoe zullen de betrokkenen de wet in godsnaam toepassen? Wat zullen zij in de praktijk immers doen? Zij zullen naar de debatten kijken, omdat een en ander niet duidelijk is. U verwijst voor de definitie naar de memorie van toelichting. Zij zullen naar de memorie kijken. Wat zullen zij in de memorie lezen? In de ene memorie zullen zij lezen dat de indicatoren meetellen, terwijl zij in de andere memorie zullen lezen dat de indicatoren geen criterium zijn. De wet geeft geen definitie. Zij moeten het dus uitzoeken, wat een probleem is. In de ene memorie staat dat het bijna verzwarend is, terwijl in de andere memorie staat dat het een essentieel bestanddeel is, om van een misdrijf te spreken.
Hoe moeten zij met een dergelijke uitleg in godsnaam voort? Ik heb echt schrik dat inhalen van de achterstand in de praktijk helemaal niet het geval zal zijn, wat de bezorgdheid is die hier vandaag in de Kamer naar voren wordt gebracht. Wij krijgen een wet voorgelegd die geen definitie geeft, wat een keuze is. De onderliggende documenten – de memories maar ook de debatten – geven tot op vandaag echter geen uitsluitsel ter zake.

After all, how will those involved apply the law in hell? What will they do in practice? They will look at the debates, because some things are not clear. Na de goedkeuring door het Vlaams Parlement, een paar maanden geleden al, en de Senaat, telkens met een gemotiveerde onthouding van het Vlaams Belang, is het nu aan ons om ons uit te spreken over het UNESCO-verdrag betreffende de bescherming en de bevordering van de diversiteit van cultuuruitingen.
Ik steek niet weg dat ik een dubbel gevoel heb bij dit verdrag. Het is eigenlijk een tweesnijdend zwaard. Deze in se goede tekst kan niet los worden gezien van het kader van het Belgische samenlevingsverband of eerder het naast-elkaar-levingsverband.
Natuurlijk is het een goede zaak dat de artikelen 5, 6 en 8 een instrument vormen over hoe de culturele goederen en diensten als dragers van identiteit en waarden van een heel speciale aard een uitzondering op het algemene vrijhandelsprincipe krijgen.
Op die manier wordt het recht van staten erkend om specifieke cultuuruitingen op hun eigen grondgebied te erkennen en te bevorderen en ontsnappen ze, het zou er nog moeten bijkomen, aan de logica van vrijhandelsverdragen.
Op die manier kan de dreigende verdringing van kleine culturen en talen zoals het Fries, het Baskisch, het Catalaans, het Bretoens, het Romaans, het Occitaans, ik noem alleen de Europese, door dominante culturen worden tegengegaan en kan voor culturele goederen de facto een vorm van protectionisme worden ingeroepen.
Dit is de bedoeling van het verdrag. Goed zo.
De artikelen 7, 11 en 14 leggen op het vlak van culturele uitingen en de verspreiding en de beleving ervan een aantal doelstellingen voor minderheden voor. Op zich is ook hier niets mis mee, maar binnen de Belgische context, een context waarmee we helaas nog enige tijd rekening moeten houden, zou en zal deze verwijzing naar minderheden met een aan zekerheid grenzende waarschijnlijkheid in conflict komen met de vigerende indeling van het grondgebied in taalgebieden.

Articles 7, 11 and 14 set a number of objectives for minorities in the field of cultural expressions and their dissemination and experience. Het feit dat de Franstalige Gemeenschap heeft geweigerd in te stemmen met het opmaken en indienen van een interpretatieve verklaring bij dit verdrag spreekt natuurlijk ook boekdelen. Een dergelijke verklaring zou immers betekenen dat dit verdrag enkel een interstatelijke uitwerking heeft en onschadelijk is voor intern Belgisch gebruik. Dit was blijkbaar te veel gevraagd voor onze Franstalige landgenoten. Dan mag de Vlaamse regering wel de memorie van toelichting inroepen als gezagsargument, waaruit dan zou moeten blijken – zoals werd gezegd in het Vlaams Parlement – dat er minder risico is op een mogelijk Franstalig misbruik dan wordt aangenomen, maar als ik zie in welke dossier Vlaanderen zich zo al laat ringeloren dan ben ik daar allerminst zeker van.
Dat is dan ook de reden waarom onze fractie, ondanks een in se goed verdrag, zich zal onthouden.

That is why our group, despite an in itself good treaty, will abstain.
