Mijnheer de voorzitter, mijnheer de minister, collega’s, eerst en vooral wil ik de afwezige rapporteur, de heer Balcaen, danken voor zijn degelijk verslag en voor zijn bereidheid om een verslag uit te brengen over dit wetsvoorstel, dat het jammer genoeg niet heeft gehaald in de commissie.
Ik hoop echter de plenaire vergadering alsnog te kunnen overtuigen van het nut en de noodzaak van de goedkeuring van voorliggend wetsvoorstel.
De bezorgdheid van dit wetsvoorstel is ingegeven door een koninklijk besluit dat reeds in 1998 werd genomen in verband met het rijbewijs. Dat koninklijk besluit stelt dat een kandidaat voor het rijbewijs die het Frans, noch het Nederlands, noch het Duits machtig is het theoretisch examen mag afleggen, bijgestaan door een tolk.
Er wordt zelfs de mogelijkheid geboden om de theoretische examens te organiseren in een andere taal dan het Frans, het Nederlands of het Duits. Het koninklijk besluit biedt ook de mogelijkheid om het praktisch rijexamen af te leggen met de hulp van een tolk.
Voorliggend wetsvoorstel wil dit koninklijk besluit bekritiseren omdat ons inziens het afleggen van het rijexamen door middel van een tussenpersoon niet compatibel is met de veiligheid op de openbare weg. Een tolk, dan nog gesteld dat hij te goeder trouw is en de kandidaat niet bewust of onbewust bijstaat bij het oplossen van de vragen, kan een goede vertaling geven, maar tegelijkertijd bepaalde nuances, de context of belangrijke details vergeten of in de onmogelijkheid verkeren deze over te brengen. Het gebruik van een tolk verkleint derhalve een goede beoordeling van de kennis van de kandidaat van de Wegcode.
Een laatste opmerking, die echter niet van minder belang is, heeft betrekking op artikel 30 van de Grondwet, dat bepaalt dat afwijkingen op de taalwetgeving enkel via wet kunnen worden ingevoerd. In voorliggend geval is de afwijking geregeld via een koninklijk besluit, wat derhalve tegen de Grondwet indruist. Met dit wetsvoorstel wensen wij dit te herstellen.
Tijdens de bespreking in de commissie werd onder meer gewezen op het standpunt van de Vlaamse regering. Men zou kunnen denken dat de Vlaamse regering er belang aan hecht dat men bij het afleggen van het rijexamen een van de drie landstalen machtig zou zijn. De Vlaamse regering is die mening echter niet toegedaan. Zij streeft naar een eenvoudig taalgebruik bij het theoretisch en het praktisch rijexamen en meent dat de instructies van de examinator niet van die aard zijn dat nuances of interpretaties een grote rol spelen. Ik betwist dat ten stelligste.
Met betrekking tot het feit dat de wijzigingen aan de taalwetgeving in strijd zijn met de Grondwet, wil ik verwijzen naar de bespreking in de commissie. Blijkbaar heeft ook de N-VA er geen probleem mee dat de taalwetgeving niet werd gerespecteerd, dat die taalwet via een koninklijk besluit werd gewijzigd en niet via een gewone wet.

However, I hope to continue to convince the plenary session of the usefulness and necessity of the adoption of the present bill.
The concerns of this bill have been raised by a royal decree already in 1998 concerning the driving license. That Royal Decree stipulates that a candidate for a driving license who is not competent in French, Dutch, or German may take the theoretical examination, assisted by an interpreter.
There is even the possibility to organize theoretical exams in a language other than French, Dutch or German. The Royal Decree also provides the possibility of passing the practical driving exam with the assistance of an interpreter.
The present bill aims to criticize this Royal Decree because, in our view, passing the driving exam through an intermediary is incompatible with safety on public roads. An interpreter, then even assuming that he is in good faith and the candidate does not consciously or unconsciously assist in solving the questions, can give a good translation, but at the same time forget certain nuances, the context or important details or find themselves in the impossibility to convey them. The use of an interpreter therefore diminishes a good assessment of the candidate’s knowledge of the Road Code.
A final note, however, which is not less important, relates to Article 30 of the Constitution, which provides that derogations from the language legislation can only be introduced by law. In the present case, the derogation is regulated by a royal decree, which is therefore contrary to the Constitution. With this bill, we want to repair this.
During the discussion in the committee, among other things, the position of the Flemish government was pointed out. One might think that the Flemish government attaches importance to the fact that one would be able to pass the driving exam in one of the three national languages. However, the Flemish government did not accept this opinion. She strives for a simple language use in the theoretical and practical driving examination and considers that the instructions of the examiner are not of such nature that nuances or interpretations play a major role. I strongly dispute that.
With regard to the fact that the amendments to the language legislation are contrary to the Constitution, I would like to refer to the discussion in the committee. Apparently, the N-VA also has no problem with the fact that the language legislation was not respected, that that language law was amended by a royal decree and not by an ordinary law.

Mijnheer de voorzitter, mijnheer de minister, collega’s, het is hier al dikwijls gezegd dat wij een probleem hebben met de verkeersveiligheid. België is echt wel een slechte leerling op het gebied van de verkeersveiligheid.
Wij doen het in vergelijking met onze buurlanden niet goed. Zo ligt het aantal verkeersdoden in België 50 % hoger dan in Nederland en Groot-Brittannië, en 25 % hoger dan in Frankrijk en Duitsland.
Ook al tellen wij heel veel doden op onze autowegen, wij zijn blijkbaar op de goede weg, want er is een verbetering. Wij hopen dat die verbetering zich doorzet.
In 2012 was er een sterke afname van het aantal verkeersdoden en het aantal weekendongevallen, maar we zijn nog lang niet waar we moeten zijn. Zo waren er in 2012 750 doden, maar dat was eigenlijk de doelstelling voor 2010. Blijkbaar halen we onze vooropgestelde doelstellintgen nooit. De volgende doelstelling is maximaal 630 doden tegen 2015. Laten we het erover eens zijn dat elke dode er een te veel is. Onze doelstelling zou dan ook nul doden moeten zijn.
De verbetering is te danken aan verschillende factoren. Er is een betere samenwerking tussen de politie, Justitie, de politici, de organisaties, de automobielsector en de overheden. Ook een betere infrastructuur speelt een rol. Maar het kan natuurlijk nog altijd beter.

Voorts controleert de politie sinds kort veel meer en staat de aanpak van recidivisten boven aan haar lijstje. Wij hebben de hogere boetes voor het rijden onder invloed en het rijden zonder gordel goedgekeurd. Er is ook de technologische verbetering in de automobielsector. Wij hebben ook de trajectcontrole, al is dat wel een bevoegdheid van de Gewesten. Dat alles leidt tot een verbetering van de verkeersveiligheid.
Maar, collega’s, zoals reeds gezegd, we zijn er nog lang niet en elke maatregel die wij kunnen nemen om de verkeersveiligheid te verbeteren, moeten wij dan ook met beide handen aanpakken. Vandaar ook onderhavig voorstel om de geldboetes na een verkeersovertreding te vervangen door een verval van het recht tot sturen, dus het intrekken van het rijbewijs voor een bepaalde periode. De geldboete was immers niet evenredig met de duur van de intrekking. Met het voorstel verlengen wij de intrekking van het rijbewijs van één maand naar één jaar of van minimaal acht dagen naar één maand.
Dat is opnieuw een signaal dat wij de verkeersveiligheid ernstig nemen. Het zal een bijkomend ontradend effect hebben. Wij geven de politierechter een extra wapen in handen. Hij kan oordelen dat de intrekking van het rijbewijs een betere sanctie is en hij kan voortaan die zwaardere sanctie opleggen. De sanctie is eerlijker ten opzichte van de andere regels en, nogmaals, ze is een krachtige stimulans om de overtreder, als hij de geldboete niet kan betalen, toch een straf te kunnen opleggen.

This is another sign that we take road safety seriously. It will have an additional disruptive effect. We give the police judge an extra weapon in the hands. He may consider that the withdrawal of the driver’s license is a better sanction, and he may now impose that heavier sanction. The sanction is fairer compared to the other rules and, again, it is a powerful incentive to impose a penalty on the offender, if he cannot pay the fine.

De geldboete kan lager dan het wettelijk minimum zijn, ingeval iemand kan aantonen niet over voldoende financiële middelen te beschikken. Er bestaat ook een mogelijkheid van uitstel en van opschorting. Bovendien zijn er de stelsels van werkstraffen en rijvaardigheidscursussen, waarop vaak een beroep wordt gedaan, in het bijzonder voor jonge bestuurders.
Ik beklemtoon dat even, omdat sommigen opwierpen dat de wetswijziging mogelijk tot een soort klassenjustitie zou leiden.
Het vervangend verval moet dus in de eerste plaats worden gezien als een stok achter de deur voor wie zijn of haar boete niet wil betalen. De stok moet echter voldoende groot zijn, wil hij effect hebben. In addition, there are the systems of work penalties and driving skills courses, which are often used, especially for young drivers.
I emphasize that for a moment, because some argued that the law change would possibly lead to some sort of class justice.
The replacement default must therefore be seen first and foremost as a stick behind the door for those who do not want to pay their fine. However, the stick must be sufficiently large, if it wants to have an effect. With this proposal, we want to take a small step towards a closing sanctions policy in which there is no room for criminals.
Therefore, we hope that the present proposal, as in the committee, will be able to count on a large majority in the House.

Monsieur le président, chers collègues, messieurs les ministres, avant d'ouvrir la discussion sur cette proposition de loi que j'ai portée avec beaucoup de conviction ces derniers mois en commission de la Santé, permettez-moi d'en rappeler l'origine.
Durant l'été 2011, notre commission a consacré deux réunions à la problématique de l'indépendance des experts médicaux. Ces experts, dont les décisions contribuent à la sécurité de notre système sanitaire, à la fiabilité des dispositifs de pharmacovigilance, sont depuis quelques années placés sous le feu des critiques.
Beaucoup de questions se posent. L'indépendance des experts consultés dans le cadre du choix du vaccin contre la grippe A H1N1 était-elle garantie? Comment se fait-il que des prothèses défectueuses aient pu être implantées si longtemps chez des patients? Est-ce seulement en raison de l'état des connaissances scientifiques que le bisphénol A n'a été qualifié que très récemment de perturbateur endocrinien? Ces questions et bien d'autres sont venues sur la table.
Comme vous pouvez le constater, lorsqu'il s'agit d'évaluer ou de réévaluer la balance bénéfice-risque des médicaments, des dispositifs médicaux ou encore de certaines substances à risque comme le chlore utilisé dans les piscines ou les engrais, il est évident que les autorités compétentes doivent prendre un maximum de précautions pour s'assurer que les experts intervenant dans ce cadre ne sont pas influencés par les firmes qui développent ces mêmes produits.
Si lors des auditions organisées en commission durant l'été, auxquelles je viens de faire référence, nous avons pu constater que certaines instances, comme le KCE ou encore le Conseil supérieur de la Santé, avaient développé en interne des procédures strictes visant, d'une part, à identifier les intérêts de leurs experts et, d'autre part, à écarter les conflits d'intérêts potentiels, il n'en était pas de même pour d'autres instances.
S'il est vrai qu'au fil des années, des progrès ont été réalisés, ils peuvent notoirement, de manière réelle ou supposée, se révéler encore aujourd'hui insuffisants. Aussi, en déposant ce texte, j'ai souhaité que le législateur donne un signal clair aux citoyens. Toutes les instances intervenant dans le domaine de la santé, de l'assurance-maladie, de la chaîne alimentaire et de l'environnement devront se convertir à la lutte pour la transparence et contre les conflits d'intérêts.

Mr. Speaker, dear colleagues, gentlemen ministers, before opening the discussion on this bill which I have carried with great conviction in recent months in the Health Committee, let me remind you of its origin.
During the summer of 2011, our committee devoted two meetings to the problem of the independence of medical experts. These experts, whose decisions contribute to the safety of our health system, to the reliability of pharmacovigilance devices, have been placed under the fire of criticism for several years.
Many questions arise. Was the independence of the experts consulted in the selection of the H1N1 influenza A vaccine guaranteed? How could defective prostheses have been implanted in patients for so long? Is it only because of the state of scientific knowledge that bisphenol A was only very recently classified as an endocrine disruptor? These and many other questions are on the table.
As you can see, when it comes to evaluating or re-evaluating the benefit-risk balance of medicines, medical devices or certain hazardous substances such as chlorine used in pools or fertilizers, it is clear that the competent authorities must take the utmost precautions to ensure that the experts involved in this context are not influenced by the companies that develop the same products.
While during the committee hearing during the summer, to which I have just referred, we were able to find that certain instances, such as the KCE or the Higher Health Council, had internally developed strict procedures aiming, on the one hand, to identify the interests of their experts and, on the other hand, to exclude potential conflicts of interests, the same was not the case for other instances.
While it is true that progress has been made over the years, it may notoriously, in a real or supposed way, prove to be still inadequate today. So, in submitting this text, I wanted the legislator to give a clear signal to the citizens. All bodies involved in the fields of health, health insurance, food chain and the environment will have to turn to the struggle for transparency and against conflicts of interest.

Mais, évidemment, l'équilibre n'est pas aisé. Il ne s'agit pas de stigmatiser les experts, de se priver du recours à l'expertise externe qui se justifie par la nécessité de se trouver les meilleurs spécialistes, riches de leurs connaissances et de leur expertise, et ce qu'ils soient attachés au secteur privé ou au secteur public. Aussi ce texte est-il l'aboutissement d'importants travaux d'évaluation et de débats avec les acteurs concernés.
Pour ce qui est de l'indépendance des experts, j'ai proposé de systématiser les déclarations d'intérêt et de prévoir des sanctions adéquates. Cette obligation vaut pour tout expert, interne ou externe, tout comme pour les dirigeants des instances visées, par exemple. Voilà qui devrait permettre d'améliorer considérablement la transparence des décisions.
Concernant le contenu de cette déclaration, nous estimons qu'elle doit être la plus large possible. Aussi seront notamment visés les liens familiaux de l'expert concerné.
À plusieurs reprises durant les débats a été évoquée la possibilité de créer une instance de centralisation des données, un super conseil de l'expertise, chargé du recueil de ces données, de leur contrôle et de la gestion in fine des liens d'intérêt déclarés. De l'avis quasi-unanime des membres de la commission et des institutions consultées, cette option est rapidement apparue comme étant non opérationnelle. Par ailleurs, il est plus responsabilisant pour les autorités concernées de gérer et contrôler ces déclarations, d'évaluer ces intérêts déclarés et ainsi lever tout risque de conflit d'intérêts sous peine de voir la décision prise ou l'avis rendu frappé de nullité, par exemple.
En plus de l'obligation de disposer d'un règlement d'ordre intérieur, d'un code de déontologie et d'un système de gestion des conflits d'intérêts, le tout rendu accessible au public, ces instances devront également instituer un comité dont la composition, elle aussi rendue publique, sera arrêtée par le Roi.
Ce comité aura en charge, d'une part, de veiller à ce que chaque expert prétendant participer aux travaux de l'instance concernée a rempli et actualisé sa déclaration d'intérêts; d'autre part, d'analyser cette déclaration pour identifier les potentiels conflits d'intérêts et, enfin, de statuer sur la participation de cet expert aux travaux, à la délibération et au vote. But, of course, the balance is not easy. It is not about stigmatizing experts, depriving oneself of the recourse to external expertise which is justified by the need to find the best specialists, rich in their knowledge and expertise, and whether they are attached to the private sector or to the public sector. Also, this text is the result of important evaluation work and discussions with relevant actors.
As regards the independence of experts, I have proposed to systematize the declarations of interest and provide for appropriate penalties. This obligation applies to any expert, internal or external, as well as to the heads of the aforementioned bodies, for example. This should significantly improve the transparency of decisions.
Regarding the content of this statement, we believe that it should be as broad as possible. In particular, the family ties of the expert concerned will be addressed.
On several occasions during the debates, the possibility of creating a data centralization instance, a super council of expertise, responsible for collecting these data, controlling them and managing in fine the declared interests. From the almost unanimous opinion of the members of the committee and the institutions consulted, this option quickly appeared to be non-operative. Furthermore, it is more accountable for the relevant authorities to manage and control these statements, to evaluate those declared interests and thus eliminate any risk of conflict of interest in the face of seeing the decision taken or the notice made void, for example.
In addition to the obligation to have an internal regulation, a code of ethics and a system for the management of conflicts of interest, all made accessible to the public, these instances will also have to establish a committee whose composition, also made public, will be determined by the King.
This committee will be responsible, on the one hand, to ensure that each expert claiming to participate in the work of the relevant body has completed and updated its declaration of interests; on the other hand, to analyze that declaration to identify potential conflicts of interests and, finally, to decide on the participation of that expert in the work, deliberation and vote. Decisions taken by the committee shall be motivated.

J'en viens à la transparence des décisions, autre mesure importante permettant de garantir l'accès à l'information et ainsi donner sa pleine mesure au principe de participation des citoyens aux prises de décisions. L'ordre du jour des réunions de travail, les décisions prises et surtout le nom des experts y ayant contribué devront, là encore, être rendus publics.
Certains parlementaires craindraient que les arrêtés d'exécution nécessaires à l'effectivité de cette proposition de loi comportent encore des interstices, dans lesquels tel ou tel acteur risquerait de s'engouffrer. À cet égard, je répondrai qu'il ne faut pas se lancer dans une grande chasse aux sorcières, mais surtout – et cela ne vous surprendra guère – que j'ai totale confiance en la ministre qui sera chargée de la rédaction de ces arrêtés.
Pour conclure, je réaffirme haut et fort que l'objectif de cette proposition de loi est clair et incontournable. Il convient de renforcer la confiance des citoyens dans notre système décisionnel en matière de santé, d'environnement et de sécurité de la chaîne alimentaire. Cette proposition de loi repose sur trois piliers fondamentaux, à savoir la lutte contre les conflits d'intérêts, la transparence de l'information et des décisions, et la légitimité des décisions prises.
J'espère de tout cœur, monsieur le président, chers collègues, qu'une très large majorité soutiendra ce texte qui a pour ambition d'inculquer une culture et des obligations nouvelles en matière de transparence et d'éthique.

In this regard, I will answer that we should not embark on a great witch hunt, but above all – and this will not surprise you – that I have full confidence in the minister who will be responsible for drafting these orders.
To conclude, I reaffirm loudly and strongly that the purpose of this bill is clear and unavoidable. Citizens’ confidence in our decision-making system on health, environment and food chain safety should be strengthened. This bill is based on three fundamental pillars, namely the fight against conflicts of interest, the transparency of information and decisions, and the legitimacy of decisions taken.
I sincerely hope, Mr. Speaker, dear colleagues, that a very broad majority will support this text, which has the ambition to inculcate a new culture and new obligations in terms of transparency and ethics.

Uit de hoorzitting is immers naar voren gekomen dat alle instanties reeds eigen procedures hebben om belangenconflicten te vermijden, maar dat die procedures sterk variëren, wat niet ten goede komt aan de transparantie waarop elke burger, patiënt of niet, recht heeft.
Deze instanties nemen beslissingen of geven advies in verschillende domeinen zoals het gezondheidsbeleid, over terugbetalingen, over verzekeringsmateries en over voedselveiligheid. Zij kunnen dus een grote impact hebben op het welzijn van de burgers. Het uitwerken van een uniforme standaardprocedure met één deskundigenraad is, met het oog op die specifieke domeinen, waarbij men vaak een beroep moet doen op internationale experts, dan ook niet realistisch.
Daarom creëren wij met dit wetsvoorstel een kader waarbinnen de afzonderlijke organisaties kunnen werken met hun eigen procedures inzake conflictbeheer, opgesteld binnen het daartoe opgerichte eigen comité. Het werken met specialisten en experts maakt precies dat er binnen dat wettelijk kader ademruimte moet blijven. Voor ons was het dan ook belangrijk dat bij het opstellen van de belangenverklaring de indirecte belangen beperkt bleven tot deze van de aanverwanten in de eerste graad. Zo niet wordt het in de praktijk bijna onmogelijk om in bepaalde expertisedomeinen mensen tewerk te stellen die geen indirecte banden hebben met gelijkaardige instanties of bedrijven. Het gaat immers vaak om een kleine groep van specialisten die contracten van bepaalde duur afsluiten met bedrijven of instanties binnen een welbepaald domein.
Om diezelfde reden is het goed dat de verslagen van de besprekingen niet openbaar worden gemaakt. Wij vrezen immers dat daardoor, bewust of niet, het gedrag van de experts zou worden beïnvloed: soms worden uitspraken minder scherp gesteld of worden ervaringen bij andere opdrachtgevers niet gedeeld als men weet dat iedereen de verslagen zal kunnen nalezen.

These bodies make decisions or give advice in various areas such as health policy, on refunds, on insurance matters and on food safety. Thus, they can have a significant impact on the well-being of citizens. The establishment of a uniform standard procedure with a single panel of experts is therefore not realistic in the light of those specific domains, where international experts are often required.
Therefore, with this bill we create a framework within which individual organizations can work with their own conflict management procedures, prepared within the own committee set up for this purpose. Working with specialists and experts makes precisely that within that legal framework there must remain breathing space. It was therefore important for us that, when drawing up the declaration of interests, the indirect interests remained limited to those of relatives in the first degree. Otherwise, it becomes almost impossible in practice to employ in certain areas of expertise people who do not have indirect links with similar bodies or companies. After all, it is often a small group of specialists who conclude contracts of certain duration with companies or bodies within a defined domain.
For the same reason, it is good that the reports of the discussions are not made public. We fear that, consciously or unconsciously, this would affect the behavior of the experts: sometimes statements are made less sharp or experiences with other clients are not shared if one knows that everyone will be able to read the reports.
The disclosure of the agenda, the members attending the meeting and the decisions taken provides sufficient transparency for us, as all confidential information, of any nature, will never be made public.

A last point that is important to us is the gradual approach of the committee. L'actualité nous rappelle sans cesse l'importance de l'indépendance de l'expertise scientifique, de l'impartialité des experts et de la nécessaire transparence à ce sujet. Citons le cas du Mediator, distribué en France et retiré du marché en 2009, qui a suscité de sérieuses critiques et des réformes profondes au niveau du fonctionnement de l'Agence des médicaments de ce pays.
Le groupe MR accorde beaucoup d'importance aux avis pris en matière de santé publique dans le respect du principe de l'indépendance et de l'impartialité, ce qui conduit à une décision de haute qualité dans l'intérêt des patients.
L'objectif de la présente proposition de loi est de tendre vers plus de transparence et donc de crédibilité dans les décisions prises en matière de santé.
Au cours des débats, il a été signalé à maintes reprises qu'il importait de travailler avec les meilleurs spécialistes disponibles tout en écartant toute suspicion à propos d'éventuels conflits d'intérêts. C'est la raison pour laquelle nous avons instauré l'obligation d'une déclaration d'intérêts générale.
Mais la proposition de loi vise également à instaurer de la souplesse. Toutes les instances en matière de soins de santé traitent de sujets très divergents selon leur méthode de travail et leur domaine de compétence et d'expertise. Il importait, nous semble-t-il, que chaque instance puisse établir son propre système de gestion de conflits d'intérêts. Chaque instance, chaque institution doit pouvoir gérer les conflits d'intérêts potentiels d'une personne et décider de son implication au débat et au vote puisqu'elles sont les mieux placées pour juger, en tenant compte du contexte spécifique du dossier analysé.
Par ailleurs, l'existence d'un lien d'intérêt ne signifie pas forcément conflit d'intérêts. Ce n'est pas parce qu'un expert présente un intérêt que ce dernier est de nature à pouvoir constituer un conflit d'intérêts, c'est-à-dire influencer les conclusions des instances pour en tirer un intérêt direct ou indirect.
Il ne s'agit donc pas de diaboliser, bien au contraire! La Belgique est un petit pays qui possède un pôle d'experts restreint, mais de haute qualité. Nous devons toujours pouvoir compter sur eux. Assurer de la transparence, renforcer la crédibilité, rechercher plus d'indépendance dans les décisions prises en matière de santé publique, voilà les objectifs que nous nous étions assignés tout en construisant un cadre juridique souple pour y parvenir, en évitant de paralyser inutilement les instances.
Voilà, monsieur le président, madame la ministre, chers collègues, les différentes remarques que je souhaitais faire dans le cadre de ce débat.

But the proposal also aims to introduce flexibility. All healthcare institutions deal with very different topics according to their working method and their area of competence and expertise. It seemed to us that it was important that each instance could establish its own system for managing conflicts of interest. Each instance, each institution must be able to manage a person’s potential conflicts of interest and decide on his/her involvement in the debate and voting as they are best placed to judge, taking into account the specific context of the case analyzed.
The existence of an interest relationship does not necessarily mean a conflict of interest. It is not because an expert has an interest that the expert is able to constitute a conflict of interest, that is, to influence the conclusions of the instances in order to draw a direct or indirect interest.
This is not about demonizing, quite the opposite! Belgium is a small country with a limited but high-quality expert pool. We must always be able to count on them. Ensuring transparency, enhancing credibility, seeking more independence in public health decisions – these are the goals we set ourselves while building a flexible legal framework to ⁇ this, avoiding unnecessary paralysis of the instances.
Here, Mr. Speaker, Mr. Minister, Ladies and Gentlemen, are the various comments I would like to make in the context of this debate.

Monsieur le président, madame la ministre, chers collègues, je suis heureuse que vous soyez là car le thème de l'indépendance de l'expertise en matière de santé publique, mais aussi en matière d'environnement et de sécurité alimentaire, nous tient fort à cœur.
Permettez-moi un petit manque de modestie en début d'exposé car c'est Ecolo-Groen qui a apporté ce sujet à la Chambre en demandant des auditions. La commission nous a suivis. C'est sur la base de ces auditions que deux propositions de loi ont été déposées, la nôtre et celle de Mme Lambert.
Pourquoi cette loi? Des collègues ont déjà évoqué les différents scandales qui ont émaillé l'actualité depuis 2009 en raison de problèmes causés par des médicaments au sujet desquels la pharmacovigilance n'avait pas été appliquée. Ils avaient causé des effets secondaires graves mais le secret était de mise et des comités d'experts avaient été remis en question pour leur manque d'indépendance par rapport à l'industrie pharmaceutique.
On a connu la gestion de la pandémie de la grippe H1N1 qui avait déjà posé problème au niveau de l'OMS dans la mesure où, subitement, la définition de pandémie avait été modifiée. On a alors cru à une pandémie extrêmement grave. Sur la base d'avis d'experts qui n'étaient pas tous sans intérêt, on s'est précipité sur des vaccins qu'on a achetés massivement. Après coup, ils se sont pourtant révélés moins utiles que prévu.
En raison de ces dysfonctionnements et de ces problèmes de gouvernance, l'opinion publique a commencé à remettre en cause la légitimité de l'expertise scientifique, de celle des institutions de soins et de santé.
Nous poursuivons ici les mêmes objectifs: non pas jeter l'opprobre sur les experts ni leur faire des procès d'intention mais mieux légitimer leur travail et leurs avis et donc les décisions politiques prises sur la base de ces avis. En tout cas, nous partageons ces objectifs. La question est de savoir comment les atteindre.
Je voudrais aussi citer la Cour des comptes de l'Union européenne qui a gravement remis en cause le fonctionnement des agences européennes, aussi bien l'Agence européenne de sécurité alimentaire, l'Agence européenne des médicaments, que l'Agence européenne des produits chimiques.

The management of the H1N1 influenza pandemic has already been a problem at the WHO level because the definition of pandemic has suddenly been changed. It was then believed to be an extremely serious pandemic. Based on the opinions of experts who were not all uninterested, we rushed to vaccines that we purchased massively. Afterwards, however, they turned out to be less useful than expected.
Due to these dysfunctions and governance problems, public opinion has begun to question the legitimacy of scientific expertise, that of healthcare and health institutions.
We pursue the same objectives here: not to cast reproach on experts or to make them intent trials but to better legitimize their work and their opinions and therefore the political decisions taken on the basis of these opinions. We share these objectives. The question is how to reach them.
I would also like to cite the Court of Auditors of the European Union which has seriously questioned the functioning of the European agencies, both the European Food Safety Agency, the European Medicines Agency, and the European Chemicals Agency.

La Cour nous dit fin 2012 qu'aucune des Agences concernées ne gère adéquatement les conflits d'intérêts et elle recommande des réformes en leur sein. Elle recommande également d'établir des politiques et procédures qui assurent que les conflits d'intérêts soient traités selon un standard comparable dans les Agences des États membres. Il y a donc clairement, au niveau européen, une demande pour que tout le monde se rejoigne dans une même façon de gérer les conflits d'intérêts. La Cour recommande aussi un cadre européen de régulation. Je pense que ce cadre européen de régulation des conflits d'intérêts va arriver.
Les auditions que nous avons menées en juin 2011 ont permis aux députés d'écouter les représentants des plus importantes institutions de santé belges sur leurs pratiques concernant la gestion des déclarations d'intérêts et des conflits d'intérêts. Il en ressort que chaque institution auditionnée (INAMI, KCE, Conseil supérieur de la Santé, Agence fédérale des médicaments) fonctionne à sa façon et dispose de ses propres règles en matière de déclarations d'intérêts. Ainsi, dans la Commission de remboursement des médicaments de l'INAMI, alors même que les déclarations d'intérêts sont déposées, l'abstention lors des débats est plutôt rare en cas de conflit d'intérêts. Le représentant de l'INAMI nous disait que, jusqu'à présent, personne n'a quitté la salle de réunion au moment du vote sur le dossier, personne n'a été démis en cas de violation du règlement d'ordre intérieur. Vous voyez donc qu'ils reconnaissent eux-mêmes ce que je peux appeler une non-gestion des conflits d'intérêts. On peut dès lors se demander à quoi servaient ces déclarations d'intérêts demandées aux experts, d'autant plus qu'elles ne sont toujours pas rendues publiques aujourd'hui.
Dans les autres institutions auditionnées, le conflit d'intérêts était géré au cas par cas. Beaucoup de personnes auditionnées estiment qu'il est impossible d'éviter l'existence de ces conflits d'intérêts car l'expertise est très fréquemment acquise grâce à des contacts ou des études réalisés avec le secteur privé.
Il est également ressorti de ces auditions qu'une harmonisation de la procédure des déclarations d'intérêts et de la gestion des conflits serait souhaitable. Cette harmonisation de la déclaration était souhaitée par quasiment toutes les institutions auditionnées.

It also recommends that policies and procedures be established to ensure that conflicts of interest are handled according to a comparable standard in the agencies of the Member States. There is therefore clearly, at European level, a demand for everyone to join in the same way of managing conflicts of interest. The Court also recommends a European regulatory framework. I believe that this European framework for regulating conflicts of interests will come about.
The hearings we conducted in June 2011 allowed MEPs to listen to representatives of the leading Belgian health institutions about their practices regarding the management of declarations of interests and conflicts of interest. It follows that each institution audited (INAMI, KCE, Higher Health Council, Federal Medicines Agency) operates in its own way and has its own rules for declarations of interest. Thus, in the INAMI Drug Repayment Commission, even when interest declarations are filed, abstinence during debates is rather rare in case of conflict of interest. The INAMI representative told us that, so far, no one has left the meeting room at the time of the vote on the file, no one has been dismissed in case of violation of the rules of procedure. So you see that they themselves recognize what I can call a non-management of conflict of interest. It is therefore possible to ask why these declarations of interest requested by experts were used, especially since they are still not made public today.
In the other audited institutions, the conflict of interest was handled on a case-by-case basis. Many people interviewed believe that it is impossible to avoid the existence of such conflicts of interest because expertise is very often acquired through contacts or studies conducted with the private sector.
The hearings also showed that harmonisation of the procedures for declarations of interests and conflict management would be desirable. This harmonisation of the statement was desired by almost all the audited institutions.

Je souhaiterais que vous la rendiez exécutoire plus rapidement, sinon cela me paraîtrait un peu dangereux. Cela donne une idée du temps que le gouvernement se donne pour appliquer une proposition de loi qui comporte déjà énormément de failles. De surcroît, la majorité s'en remet constamment au Roi pour décider de la manière dont sera élaborée la déclaration d'intérêts, de son caractère public éventuel ou encore de l'instance qui la conservera.
Il est également frappant que l'on ne trouve, dans la proposition, aucune définition explicite de l'objectif poursuivi. Il s'agit de réduire, de minimiser les possibilités de conflit d'intérêts, mais cela ne figure nulle part dans le texte. C'est pourquoi, monsieur le président, nous déposons un amendement qui précise qu'est visée la réduction des conflits d'intérêts dans chaque comité d'avis qui sera amené à éclairer les décisions politiques.

The following criticism concerns the absence of a superior council of expertise. In other words, no instance will control or harmonize the work of others. Each body will therefore handle conflicts of interest within itself. In this case, and I ask the authors of this text, what will the change be made?

Door verordening nr. 44/2009 worden in het wetsontwerp ook de handelaars en de casino’s die biljetten verstrekken via geldautomaten, aan die verplichting onderworpen. Al die instellingen staan dan ook in voor de kwaliteit van de geldomloop. Versleten en beschadigde biljetten en muntstukken worden door hen uit omloop genomen.
Omdat die materie hoofdzakelijk bij Europese verordening en besluit van de Europese Centrale Bank wordt geregeld, komt het de lidstaten enkel toe om doeltreffende, evenredige en afschrikkende sancties uit te vaardigen voor de instellingen die de verplichting tot inlevering niet nakomen. Dat is dan ook het doel van het voorliggend wetsontwerp. The same acts against the same person may be prosecuted only once and punished with a criminal sanction, as referred to in Article 6 of the European Convention for the Protection of Human Rights. These can be both criminal sanctions and administrative sanctions of a criminal nature, all in accordance with the case-law of the European Court of Human Rights.

Wij zijn dus blij dat de tekst in het Nederlands nu gecorrigeerd is en dat er geen misverstanden meer kunnen ontstaan.
Waarom de una via van het Sociaal Strafwetboek? Mijnheer de minister, u zei dat het kredietinstellingen zijn die onder het Europees recht vallen. Men gaf voorrang aan een administratieve weg. Elles peuvent recourir au remboursement de capital des actionnaires, scinder la société en deux entités distinctes, faire des apports d'universalités ou de branches d'activités ou encore réduire leur capital. Ces opérations peuvent avoir pour impact la diminution du gage commun de leurs créanciers.
La loi fournit aux créanciers de ces sociétés dont la créance n'est pas encore échue diverses mesures structurelles de protection. Il apparaît cependant que ces protections légales ne sont pas ou difficilement applicables aux créanciers qui disposent d'une créance contestée par la société dans le cadre d'un procès.
Les mécanismes actuels sont les suivants: la constitution d'une sûreté sur la base de l'actuel article 684 du Code des sociétés; le mécanisme de solidarité prévu par l'article 686 du Code des sociétés; l'action paulienne qui permet aux créanciers d'attaquer en leur nom les actes accomplis par leurs débiteurs en fraude; l'action en responsabilité des dirigeants pour faute de gestion ou encore, l'action en nullité.
Malheureusement, force est de constater que vu les interprétations de la jurisprudence et de la doctrine abondante, aucun des mécanismes légaux existants ne permet aux créanciers d'une créance contestée devant un tribunal ou encore en cours d'arbitrage, créance dont le montant peut être très élevé, de garantir de manière conservatoire le paiement effectif de ladite créance. Face à cette impossibilité, les auteurs de la présente proposition de loi ont estimé qu'une intervention du législateur était nécessaire pour protéger les droits des créanciers titulaires d'une créance faisant l'objet d'un procès ou en cours d'arbitrage dans les situations où les aménagements légaux du capital de la société ont pour conséquence un affaiblissement du gage commun des créanciers.

They may use the repayment of capital of shareholders, split the company into two separate entities, make contributions of universals or branches of activities or even reduce their capital. These transactions may have an impact on the reduction of the joint liability of their creditors.
The law provides for the creditors of those companies whose claim has not yet expired various structural protective measures. However, it appears that these legal protections are not or hardly applicable to creditors who have a claim challenged by the company in a lawsuit.
The current mechanisms are as follows: the constitution of a security on the basis of the current article 684 of the Corporate Code; the solidarity mechanism provided for by article 686 of the Corporate Code; the Paulian action that allows creditors to attack on their behalf the acts committed by their debtors in fraud; the action in liability of managers for lack of management or even, the action in nullity.
Unfortunately, it must be noted that, given the interpretations of the case-law and the abundant doctrine, none of the existing legal mechanisms allows creditors of a claim contested before a court or still under arbitration, a claim whose amount may be very high, to guarantee in a conservative manner the effective payment of the said claim. In the face of this impossibility, the authors of this bill considered that legislative intervention was necessary to protect the rights of creditors holding a claim under trial or arbitration in situations where the legal adjustments of the capital of the company result in a weakening of the joint liability of creditors.

De cette manière, un premier contrôle par le juge ou l'arbitre sera déjà effectué.
En ce qui concerne l'octroi d'une sûreté, tout créancier dispose du droit de demander une sûreté à son débiteur en vue de garantir le paiement de sa créance. Si un accord entre les deux parties n'est pas possible, c'est alors le juge qui est appelé à trancher le litige. La proposition de loi ne fait qu'appliquer ce principe, en donnant une base légale aux créanciers titulaires de dettes résultant d'une réclamation contre la société scindée, introduite en justice ou par voie d'arbitrage.
En pratique, ce créancier va demander à la société, qui reste son débiteur, de lui consentir une garantie. Si cette dernière refuse, le créancier aura alors la possibilité de réclamer cette sûreté devant le juge, qui appréciera l'apparence de droit dont il dispose, c'est-à-dire dans quelle mesure sa prétention quant à la créance est susceptible d'être fondée. Ce n'est que dans cette mesure qu'il autorisera l'octroi d'une sûreté. En cas de doute, il peut très bien refuser purement et simplement.
Ce contrôle du juge au moment de la demande de sûreté est complété par celui effectué dès l'audience par le juge amené à trancher le litige relatif à la dette ou dès la réunion d'installation lorsque l'on recourt à l'arbitrage.
En ce qui concerne le mécanisme de solidarité, il s'agit exactement de la même démarche: donner une base légale au juge ou à l'arbitre amené à trancher le litige sur le bien-fondé de la dette, pour condamner solidairement le cas échéant les deux entités issues d'une scission de la société. Ce n'est évidemment qu'au moment où il y a condamnation au paiement de la dette que le mécanisme de solidarité jouera son rôle. Lorsque la décision sur le bien-fondé de la dette sera passée en force de chose jugée, elle sera alors considérée comme certaine et exigible et les dispositions actuelles du Code des sociétés en matière de solidarité et de sûreté lui seront applicables.
C'est durant la phase précédant ce moment, qui peut malheureusement être assez longue compte tenu des lenteurs du système judiciaire actuel, que le créancier de bonne foi dont la dette est contestée en tout ou en partie ne dispose d'aucun mécanisme de préservation de ses chances d'être payé.

If the latter refuses, the creditor will then have the possibility to claim this security before the judge, who will assess the appearance of right of his disposal, i.e. to what extent his claim regarding the claim is likely to be founded. It is only to this extent that it will allow the granting of security. In case of doubt, he can very well refuse purely and simply.

Enfin, ces mécanismes sont préventifs et ne freinent ni ne handicapent la modification prévue par la société: la scission ou la diminution de capital. Ils permettent simplement au créancier de bonne foi de se prémunir contre les opérations juridiques effectuées en fraude de leurs droits, ce qui leur est impossible dans l'état actuel de la jurisprudence. Ils n'empêcheront en rien une cession d'activité. En effet, en matière de cession d'activité, que ce soit dans le cadre de la continuité des entreprises ou non, il est d'usage courant que le vendeur garantisse son acheteur sur le passif et les litiges en cours de la personne morale cédée.
Je sais que ceci peut paraître un peu technique mais cette proposition de loi est très concrète et je tiens à remercier très chaleureusement mes collègues de la majorité, MM. Henry, Tuybens, Wilrycx, George et Mme Dierick pour leur soutien au travers de la cosignature de la présente proposition. Je remercie également mes collègues Destrebecq et Marghem pour leur cosignature. Cette proposition de loi ne coûte un euro à personne! Wij kunnen het in onze beschaafde westerse maatschappij niet veroorloven dat de exploitatie van bedelarij en prostitutie wordt toegelaten.
Niettemin hebben wij een aantal bedenkingen bij dit wetsontwerp. Wat zal de uitwerking zijn in de praktijk? Als wij op basis van deze wet een goed vonnis verkrijgen, hoe zal dat dan uitgevoerd kunnen worden tegen, bijvoorbeeld, een Roemeense bende? Zelfs al slaagt men erin om bepaalde geldboetes in te vorderen, wat zal dat verbeteren aan de toestand van diegene waarover het hier gaat, met name de bedelaar?

Laten wij even teruggaan in de tijd. In 1993 werd de wet op de landloperij en de bedelarij afgeschaft. Men ging immers uit van een ander uitgangspunt, waarbij men de bedelaar niet langer als een misdadiger beschouwde maar als een slachtoffer, die nieuwe kansen moest krijgen en moest worden geïntegreerd in de maatschappij.

It was then stated that it was intended that the police would conduct as many checks on the beggarry as possible, with the aim of identifying and thereby discovering structures. However, after several years, there were no accurate figures and little information was available. These noble goals have thus proved to be somewhat an empty box.
On the ground — an ordinary city visit to Gent or Brussels makes this already clear — one notices that the beggarship continues to thrive. A working group focused on Brussels was set up, but the problem should not be shifted, of course. If it was resolved in one city, it is not intended to spread to other cities. There needs to be a global approach.
Let us go back in time. In 1993 the law on land looting and begging was abolished. In fact, a different principle was adopted, in which the beggar was no longer considered a criminal but a victim, to be given new opportunities and to be integrated into society.

Uit parlementaire vragen en antwoorden kon ik opmaken dat het al dan niet opnieuw strafbaar stellen van bedelarij voor de minister van Justitie afhankelijk is van wat de werkgroep besluit. We kunnen ons echter niet van de indruk ontdoen dat er steeds meer stemmen opgaan in de richting van het opnieuw strafbaar stellen. Er gaan ook stemmen op voor het Nederlands model. Daar werkt men met verplichte zorgtrajecten, waarbij opvang opgelegd wordt voor bedelaars. Op die manier kan men wie hier illegaal verblijft, beter opsporen en terugsturen.
Kortom, er is werk aan de winkel. Ik hoop dat de regering de tijd vindt om daarover een ontwerp op te stellen. Zo niet moet het Parlement over de partijgrenzen heen bereid zijn om daarvan ernstig werk te maken, willen wij ervoor zorgen dat het probleem niet vaker de kop opsteekt.

In short, there is work in the store. I hope the government finds the time to come up with a draft. If Parliament does not have to be willing to work seriously across party boundaries, we want to ensure that the problem does not rise more often.

U weet dat wij drie wijzigingen aanbrengen.
Een eerste wijziging betreft wat men de “decemberregeling” noemt. Zij heeft betrekking op de overgangsjaren 2013 tot 2015, dus de periode waarin wij de leeftijd- en loopbaanvoorwaarden verstrengen.
In principe worden de leeftijd- en loopbaanvoorwaarden toegepast die van kracht zijn in het jaar dat iemand met pensioen gaat. Voor wie in december verjaart, is dat dus in de maand januari van het daaropvolgende jaar. Dit principe zou ertoe leiden dat wie tijdens de overgangsjaren in december verjaart, aan strengere voorwaarden zou moeten voldoen dan wie in november verjaart. Om deze onbillijke gevolgen te vermijden, werd bepaald dat wie in december verjaart, aan de voorwaarden van december zal moeten voldoen. De decemberregeling wordt dan ook voor de lange loopbaan ingevoerd.
Het tweede element waarover dit ontwerp gaat, is het feit dat wij samen met de sociale partners hebben beslist dat de hervorming geen impact mag hebben op werknemers die al in een procedure van vervroegde uittreding zaten. Nu wordt een aanvullende regeling getroffen voor werknemers die ten tijde van de pensioenhervorming al in een systeem van vervroegde uittreding zaten. Het derde element waarover dit ontwerp gaat, is de beslissing dat periodes van activiteit bij de pensioenberekening meer moeten doorwegen dan bepaalde periodes van inactiviteit. Normaal wordt het pensioen berekend op een jaarloon van 51 092 euro. Voor de periodes van inactiviteit die in de pensioenopbouw minder zwaar zullen doorwegen, zal de berekening gebeuren op een fictief jaarloon, dat tot 22 189 euro beperkt is.

The pension capital is used to bridge the period between retirement and the age of sixty.
Such an arrangement could be adopted until 1 January 2010. Therefore, the age and career conditions of the employees concerned will not be postponed. Indeed, if they were to postpone, the workers concerned would have no income during the period between reaching the age of sixty and the age at which they could retire under the tightened conditions for early retirement.
The third element of this draft is the decision that periods of activity should weigh more in the calculation of pensions than certain periods of inactivity. The pension is calculated at an annual salary of 51,092 euros. For the periods of inactivity that will be less heavy in the pension buildup, the calculation will be made on a fictitious annual salary, which is limited to €22,189.
To avoid favoring high incomes over low incomes, the calculation of pensions will be proportionalized.
