De stapel van documenten die hier ligt, beslaat nog maar de helft van de staatshervorming. De andere helft ligt ondertussen in de Senaat. De stapel is voor ons mede de reden om resoluut voor het confederalisme te gaan.
Laten we stoppen met de huidige onzin, die ertoe leidt dat wij, Vlamingen, altijd veel geld op tafel moeten leggen. In ruil krijgen wij dergelijke stapels papier met de overdracht van stukjes en brokjes bevoegdheden naar de deelstaten.
De zesde staatshervorming is een pijnlijk hoogtepunt en een bitter toonbeeld van de klassieke systematiek van de staatshervorming van de voorbije decennia. De Vlamingen vragen altijd meer bevoegdheden. De Franstaligen zeggen altijd neen en zijn demandeurs de rien. Uiteindelijk gaan de Franstalige partijen toch schoorvoetend mee, in ruil voor een grote zak Vlaams geld. De Vlamingen krijgen in ruil stukjes en brokjes bevoegdheden, vastgelegd in dergelijke stapels papier, wat het geheel gewoon nog complexer, nog ontransparanter, nog inefficiënter en nog duurder maakt. Na verloop van tijd komt er opnieuw de vraag van Vlaamse zijde naar bijkomende stappen in de staatshervorming, gelet op het feit dat het geheel dermate inefficiënt is. Opnieuw gaan de Franstaligen na enige tijd akkoord in ruil voor extra Vlaams geld en geven zij opnieuw stukjes en brokjes bevoegdheden, die het spel opnieuw complexer, ontransparanter, inefficiënter en duurder maken.

Die staatshervorming is eigenlijk de echte en enige fundamentele besparingsoperatie, die de regering-Di Rupo doorvoert. Men schuift de factuur gewoon door.
De Vlaamse regering heeft zich daar zelf eens over gebogen en heeft bekeken wat de zesde staatshervorming haar zal kosten van 2014 tot 2019. Het is een nogal eenvoudig beeld. Uit de tabellen wordt duidelijk dat voor de Vlamingen in de volgende regeerperiode van vijf jaar de factuur van de staatshervorming oploopt tot 7,8 miljard euro. Dat geld loopt de Vlaamse regering mis door de zesde staatshervorming en door de nieuwe financieringswet. De volgende Vlaamse regering, die na het spaarzame beleid van de afgelopen jaren eigenlijk geld zou moeten kunnen uitgeven aan economische impulsen, onderwijs, de aanpak van de wachtlijsten en aan personen met een handicap, zal een besparingsregering zijn in plaats van een sociale-uitgavenregering, en dat allemaal met de warme groeten van de belastingregering-Elio Di Rupo.

Voor de liefhebbers van het genre heb ik ook nog de schematische weergave waarop bij elke bevoegdheid staat aan welk niveau zij wordt overgedragen. Dat kan naar de Gewesten zijn, naar de Gemeenschappen, of een stukje naar de Gewesten of Gemeenschappen. Het is interessante lectuur voor de liefhebbers. Het is het resultaat van het bundeltje dat daar ligt. Het is geen schematische voorstelling van de actuele situatie, maar van de verhoging van de reeds bestaande complexiteit. Het komt eigenlijk neer op het complexer maken van de complexiteit.
Ik heb zelfs nog niet gesproken over de Senaat, maar mij beperkt tot de materiële bevoegdheden. Ik neem het voorbeeld van telecommunicatie. De bevoegdheid ter zake gaat naar de Gemeenschappen: de inhoudelijke en technische aspecten van audiovisuele en auditieve mediadiensten, eigenlijk een herformulering van de bestaande regeling. Toch blijft er een deel federaal, namelijk de mededelingen van de federale regering. Er gaat ook een stuk naar het Brussels Hoofdstedelijk Gewest, hoewel de federale overheid daar bevoegd blijft voor audiovisuele en auditieve mediadiensten. Die bevoegdheid gaat niet naar de Gemeenschappen, maar blijft federaal.
Een ander voorbeeld is toerisme. Toerisme wordt overgeheveld van de Gemeenschappen naar de Gewesten, maar de Gemeenschappen kunnen wel nog subsidies geven voor toeristische infrastructuur. De vraag is dan of de Gewesten ook nog subsidies kunnen geven voor toeristische infrastructuur. Daar hebben wij geen antwoord op gekregen. Dat weet zelfs staatssecretaris Verherstraeten niet. Het zal voor lange tijd een onbeantwoorde vraag blijven.

Vervolgens kom ik tot de gezondheidszorg en de hulp aan personen. Dat is pas ingewikkeld, want dat gaat alle kanten uit, heen en weer, zowel naar de Gewesten als naar de Gemeenschappen als naar het federaal niveau en met tussenperiodes. Bepaalde stukken gaan naar de Gemeenschappen en andere stukken naar het federaal niveau, maar er gaan ook stukken naar het Brussels Hoofdstedelijk Gewest, met een aparte regeling. De heer Moureaux zegt daarover dat 90 % van de gezondheidszorg en bijstand aan personen federaal blijft. Van de stukken die naar de Gemeenschappen gaan, blijven sommige deelstukken federaal. Er zijn tal van uitzonderingen op uitzonderingen, waarop ik straks nog terugkom.
Door dergelijke regelingen ontstaan er natuurlijk zotternijen. Zo gaan de bevoegdheden inzake de mobiliteitshulpmiddelen voor mindervaliden naar de Gemeenschappen, maar de regels voor de toelagen aan de mindervaliden zelf blijven op federaal niveau.
De ouderenzorg is daar nog een voorbeeld van. Oh triomf, Vlaanderen wordt bevoegd voor de ouderenzorg. Vlaanderen wordt weliswaar bevoegd voor bejaarden die thuis wonen en thuiszorg krijgen, maar als die bejaarden thuis ziek worden en thuis verpleging nodig hebben, dan gaat het om een federale bevoegdheid. Het bed opmaken van die bejaarde gebeurt dus door een Vlaamse verpleegster, maar het meten van de temperatuur van die bejaarde gebeurt door een federale verpleegster, want dan gaat het om thuisverpleging. Als die bejaarde vervolgens niet langer thuis kan blijven, maar naar een rusthuis moet, dan wordt hij terug voorwerp van een Vlaamse bevoegdheid, want rusthuizen zijn een Vlaamse bevoegdheid. Als die bejaarde in dat rusthuis echter ziek wordt en naar het ziekenhuis moet, dan wordt hij weer voorwerp van een federale bevoegdheid, behalve als men leunt tegen de muur van het ziekenhuis. De muren van een ziekenhuis zijn namelijk Vlaamse bevoegdheid, terwijl de medische apparatuur federale bevoegdheid is. Voor de zekerheid krijgen de Gemeenschappen federale schoonmoeders, namelijk het Rekenhof en het RIZIV. Voorontwerpen en voorstellen van decreet in die branche moeten immers eerst naar het Rekenhof en zijn onderhevig aan verplichte adviezen van het RIZIV. Indien een decreet een negatieve impact heeft op de federale begroting, dan volgt er verplicht overleg. Ofwel volgt daarop een akkoord tussen de regeringen, ofwel geeft de federaal bevoegde minister een akkoord. Uiteindelijke wil dat zeggen dat een federaal veto blijft bestaan.

VDAB en RVA blijven dus twee naast elkaar werkende, en soms elkaar tegenwerkende organisaties. Het is een verspilling van tijd, geld en energie. Het federale niveau blijft ook bevoegd voor structurele verminderingen voor de werkgeversbijdragen, voor de verminderingen van de werknemersbijdragen en voor de verminderingen van de werkgeversbijdragen in functie van de eigen kenmerken van de werkgever of de activiteitensector. De vraag is dan wat is significant, wat is algemeen belang. Wie weet het? In de Senaat wist Bert Anciaux het. Hij zei dat hij het wist, maar Servais Verherstraeten antwoordde dat Anciaux het niet wist want niemand weet het. Het Grondwettelijk Hof zal het weten. Het Grondwettelijk Hof zal uiteindelijk beslissen wat significant is en wat algemeen belang is. Men heeft dus besloten om niet te beslissen. Dat was de beslissing van deze federale meerderheid, aangevuld door de vrienden van Groen.
Energie en Leefmilieu gaan naar de Gewesten. Dat moet natuurlijk voor de groenen ook heel bevattelijk zijn. Rampenfonds, afvalstoffen, nettarieven en openbare distributie van gas gaan naar de Gewesten. Er blijft ook een heel stuk federaal. Radioactief afval blijft federaal, dat is niet zo belangrijk. Afval van dierlijke oorsprong – een gevaar voor de gezondheid – en ontplofbare stoffen blijven federaal.
Dan hebben we nog heel de imbroglio rond de elektriciteitsnetwerken en de tarieven van netwerken met een transmissiefunctie, die worden uitgebaat door dezelfde beheerder als het transmissienet. Ook dat blijft federaal.
De grootste zotternij, substitutiemechanisme inzake klimaatdoelstellingen, blijft federaal.
Ik kan nog lang doorgaan. Misschien nog een: mobiliteit en verkeer. Vlaanderen wordt bevoegd voor het verkeer, behalve voor de verkeersregels. De zaken die er werkelijk toedoen, de verkeersregels, worden niet overgedragen. Vlaanderen wordt wel bevoegd voor de regels voor het plaatsen van de verkeersborden, maar niet voor de regels voor het plaatsen van de verkeersborden aan bewaakte spooroverwegen en militaire wegen.

De Gewesten kunnen eveneens zelf onteigenen, ook op basis van eigen regels. De Gemeenschappen kunnen in Brussel onteigenen op basis van Brusselse gewestelijke regels. Voor de modale Vlaming wiens huis wordt onteigend wil dat eigenlijk zeggen dat naargelang de overheid die hem onteigent, een andere regelgeving van toepassing is. Men krijgt dan een andere prijs voor de eigendom die wordt onteigend, voor dezelfde grond. Dat is dus totale zotternij.
Dan heb ik het nog niet gehad over de samenwerkingsakkoorden. Er zitten ook nog eens in totaal 27 samenwerkingsakkoorden in. Dat wil dus zeggen dat er nog 27 keer moet worden onderhandeld alvorens een instelling of een bevoegdheid wordt overgedragen. Dat wil natuurlijk ook zeggen dat de Vlamingen opnieuw zullen moeten betalen net zoals we dat moeten doen hebben voor de overdracht van de plantentuin van Meise. Dat heeft meer dan 10 jaar geduurd. Dat gebeurde ook via een samenwerkingsakkoord en het zou direct worden geregeld. Meer dan 10 jaar heeft het geduurd, om dan uiteindelijk nog prijzen te gaan betalen en opnieuw te gaan onderhandelen over de overdracht waarvoor al betaald was. Dat zit hier dus 27 keer in.
Waarom al die zotternij, wie wordt daar nu beter van? Het maakt het complexer, inefficiënter en duurder. Ik heb gisteren op een studiedag zelfs gehoord dat de heer Verherstraeten heeft aangekondigd dat er nog een volgende staatshervorming komt. De grootste voorstanders van de zesde staatshervorming zeggen dus al dat er een zevende staatshervorming komt. Qua illustratie dat dit niet perfect is, kan dat tellen.

Dat werd gedaan door de acht partijen die hebben onderhandeld over de voorliggende staatshervorming en deze hebben uitgevoerd. Het heeft inderdaad twee jaar geduurd. Die twee jaar en de teksten die de heer Weyts bij zich had, bewijzen hoe groot de staatshervorming is.
Aan grote veranderingen en vooral staatshervormingen is het eigen dat er kritiek is. Men kan bijna zeggen dat hoe zwaarder de kritiek is, hoe groter de verandering. Dat was ook zo in 1970 met de eerste grote staatshervorming, destijds met vader Eyskens, die toen eerste minister was. In zijn memoires zegt de heer Eyskens dat hij werd verweten een verrader te zijn en de Vlaamse belangen te hebben uitverkocht. Uiteindelijk hebben de staatshervorming van 1970 en de daaropvolgende hervormingen ervoor gezorgd dat Vlaanderen is kunnen worden wat het nu is, met name een van de rijkste regio’s in Europa.
Ook nu is er kritiek op en discussie over de omvang van de staatshervorming: is zij groot genoeg? Dat is echter een steriele discussie.
Ik zal twee soorten argumenten meegeven, die voor ons doorslaggevend waren om de staatshervorming te steunen.
Ten eerste, er zijn een aantal politieke argumenten. Het eerste politiek argument is dat deze staatshervorming duidelijk uitvoering geeft aan de Octopusnota die door de Vlaamse regering, samen met de N-VA, is onderschreven. Dat is een heel duidelijk politiek argument.
Ten tweede, de voorliggende staatshervorming kan worden getoetst aan de Vlaamse resoluties die in 1999 werden goedgekeurd, ook door het Vlaams Parlement. De voorliggende staatshervorming komt tegemoet aan die Vlaamse resoluties.

This was done by the eight parties that negotiated the current state reform and implemented it. It actually took two years. Those two years and the texts that Mr. Weyts had with him prove the greatness of the state reform.
Major changes and especially state reforms are characteristic of being criticized. One can almost say that the heavier the criticism, the greater the change. This was also the case in 1970 with the first major state reform, at the time with Father Eyskens, who was then Prime Minister. In his memoirs Mr. Eyskens says that he was accused of being a traitor and of having sold out the Flemish interests. Ultimately, the state reform of 1970 and the subsequent reforms enabled Flanders to become what it is today, especially one of the richest regions in Europe.
Even now there is criticism and debate about the extent of the state reform: is it large enough? This is a sterile discussion.
I will give two kinds of arguments, which for us were decisive in supporting the state reform.
First, there are some political arguments. The first political argument is that this state reform clearly implements the Octopusnota, which was signed by the Flemish government, together with the N-VA. This is a very clear political argument.
Secondly, the current state reform can be tested on the Flemish resolutions that were adopted in 1999, also by the Flemish Parliament. The current state reform is in line with these Flemish resolutions.

The first resolution addresses a number of general principles. It calls for a delegation of powers that provides for coherent powers packages.
At that point, we are not on the same wavelength. We believe this is an important step in making a number of competence packages coherent. Naar onze mening worden er nu ook in het justitiebeleid belangrijke stappen gezet, namelijk vooral in het vervolgingsbeleid, dat samen met het zorgbeleid één coherent pakket wordt, waardoor coördinatie kan plaatsvinden. Mijnheer Weyts, u hebt zelf de verschillende aspecten daaromtrent opgenoemd. Voor u is het niet voldoende, maar wij zullen daar met de volgende Vlaamse regering gevolg en uitwerking aan kunnen geven.
Collega’s, daarom zullen wij deze staatshervorming steunen. Daartoe heb ik zonet politieke argumenten gegeven die voor ons voldoende zijn, maar niet voor u, leden van de N-VA. Dat is nu eenmaal de politieke discussie.
Ik heb ook nog een aantal gezagsargumenten. Immers, als men het met politieke argumenten niet haalt, dan grijpt men best terug naar gezagsargumenten. Het beste kan ik verwijzen naar vooraanstaande Vlaamse politici die er uitspraken over hebben gedaan.
Zo wil ik citeren uit een interview in De Standaard van 2 maart 2013 met Jan Peumans. Mijnheer de voorzitter, u kent Jan Peumans toch ook? In dat interview zegt Jan Peumans: “Na de volgende staatshervorming zullen wij voor 35 miljard eigen bevoegdheden hebben. Dat is meer dan het federaal staatsbudget. Je kan niet ontkennen dat er grote vooruitgang geboekt is.” Jan Peumans; een gezagsargument, voor wat het waard is.

Je serai brève car voilà longtemps qu'au sein de cette assemblée mais surtout dans tous les lieux politiques de Belgique, cette sixième réforme de l'État est discutée et analysée, suscitant parfois des craintes. Cependant, c'est aussi une opportunité – c'est ainsi qu'il faut la considérer – de réorganisation, d'amélioration de compétences de matières et de gestion par les entités fédérales et fédérées.
Ce que j'ai envie de dire aujourd'hui au nom de mon groupe Ecolo, membre du groupe Ecolo-Groen qui s'est joint aux négociations pour aboutir à cette sixième réforme de l'État, c'est que la préoccupation majeure qui était de préserver les outils de financement de la solidarité et d'organisation de cette solidarité entre les citoyens a été respectée. C'était un élément capital dans ces négociations.
Ce socle étant posé, un transfert des compétences s'est effectivement organisé pour permettre des politiques cohérentes entre les matières déjà transférées aujourd'hui et les nouvelles matières transférées. Ce sont des cohérences qui apparaissent et apparaîtront de manière relativement évidente en matière d'emploi, notamment au niveau de l'autonomie fiscale renforcée et attribuée aux Régions mais aussi – et il faudra évidemment veiller à ce qu'il en soit ainsi – des modes de financement à destination des entrepreneurs, des aides à la mobilité et des fameuses allocations APA à destination des personnes handicapées âgées.
L'autre dimension importante à nos yeux du contenu de cette sixième réforme de l'État, c'est l'octroi de l'autonomie constitutive à la Région bruxelloise mais également à la Communauté germanophone mettant ainsi fin à une inégalité entre les entités fédérées.
Au-delà de ces transferts et de ces autonomies accordées aux entités fédérées, la sixième réforme prévoit également de renforcer et d'institutionnaliser les accords de coopération, les décrets conjoints, autant d'outils qui permettront aux différentes entités fédérées de travailler ensemble sur des compétences croisées, où chacune peut avoir autorité et ce au service des citoyens, dans le cadre des missions publiques qui dépendent de ces différentes entités.

The other important dimension in our view of the content of this sixth state reform is the granting of constitutive autonomy to the Brussels Region but also to the German-speaking Community, thus ending an inequality between the federated entities.
Beyond these transfers and autonomies granted to federal entities, the Sixth Reform also envisages strengthening and institutionalizing cooperation agreements, joint decrees, tools that will allow the different federal entities to work together on cross-competences, where each can have authority and that at the service of citizens, within the framework of public missions that depend on these different entities.

Mais cette nouvelle réforme doit surtout être ramenée à sa juste dimension. Je n'ai jamais cru et je ne croirai jamais au "grand soir", celui où, d'un geste, on efface tous les maux pour se plonger dans la béatitude. Je ne crois pas qu'aujourd'hui, nous scellions une paix communautaire. Je crois qu'aujourd'hui, nous nous donnons ce qui nous semble constituer les meilleurs moyens de progresser dans le bon sens.
Aujourd'hui, nous avons autant besoin de fierté que d'humilité: la fierté de croire en nos forces, en nos chances et l'humilité de savoir que tout reste à faire.
Cette réforme est surtout une promesse. La promesse que, si les bons choix sont posés, les choses iront mieux pour les citoyens, les familles et les entreprises. En effet, l'enjeu n'est que là: donnons-nous cette fois les instruments utiles pour réussir le redressement économique du pays et de ses Régions? Nous sommes une majorité institutionnelle à penser que c'est le cas, sereinement, avec le souci constant d'éviter la logique du pire dont nous avons été si proches voilà à peine deux ans.
Pour le MR, cette réforme est efficace et juste. Ce sont les seules qualités que nous voulions lui accorder. Efficace parce que la répartition des compétences méritait certainement une refonte, que les constructions empiriques lui avaient refusée jusqu'ici. Il existait une certaine poésie sans doute dans le schéma institutionnel imaginé depuis 1970, mais il était temps d'ouvrir le chapitre d'une plus grande maturité fédérale.
Cette maturité, comme dans la vie personnelle, se distingue par la notion de responsabilité. Comme nous l'avons dit dans le débat sur la loi spéciale de financement, via le mécanisme de répartition des moyens financiers, nous avons conforté dans la structure de l'État fédéral l'importance de la notion de responsabilité pour les divers niveaux de pouvoir, dans l'exercice des compétences dont ils ont la charge.
C'est vrai, jusqu'ici, il restait problématique que certains niveaux de pouvoir reçussent des moyens financiers sans lien avec l'efficacité des politiques déployées. Désormais, chacun devra se prendre pleinement en charge: c'est bien le sens de la responsabilité politique.

We are an institutional majority who think that is the case, serenely, with the constant concern to avoid the logic of the worst of which we have been so close just two years ago.
This reform is effective and fair. These are the only qualities we want to give him. Effective because the distribution of skills ⁇ deserved a redesign, which the empirical constructions had so far denied. There was ⁇ some poetry in the institutional scheme imagined since 1970, but it was time to open the chapter of greater federal maturity.
This maturity, as in personal life, is distinguished by the notion of responsibility. As we said in the debate on the Special Financing Law, through the mechanism of allocation of financial resources, we have reinforced in the structure of the federal state the importance of the notion of responsibility for the various levels of power, in the exercise of the powers of which they are charged.
It is true, until now, it has remained problematic that certain levels of power receive financial means unrelated to the effectiveness of the policies deployed. From now on, everyone will have to take full responsibility: this is the sense of political responsibility.

Cette même logique se retrouve nécessairement dans le volet "Transfert de compétences" de la réforme. On veut aujourd'hui donner aux différents niveaux de pouvoir des leviers pour assumer leurs choix. En matière d'emploi, par exemple, on ne pourra plus se cacher derrière un partage des compétences pour rejeter ou nier sa responsabilité.
Cette réforme est également juste. En effet, on n'a pas assez dit, durant la crise politique de 2010, à quel point on a joué avec nos fondamentaux politiques, à quel point les partis politiques ont été en tension quant au rôle qu'ils ont fait jouer à nos piliers institutionnels.
La démocratie a, en fait, tenu par ajustement, par le fait accompli, diront même certains. Je pense, pour ma part, que le vrai moteur a été davantage le dialogue, pas tellement le dialogue entre les partis qui ont écrit l'accord, mais à un certain dialogue politique avec les citoyens. C'était une véritable crise. Elle a abîmé un peu plus l'image du politique. Mais, au bout du compte, on a perçu un large et profond soulagement, dans la société en général, au moment de sa résolution.
La réforme est devenue juste parce qu'elle a été acceptée. Elle a du reste permis – il faut le répéter, aujourd'hui, même un an après le vote des premiers textes – de consacrer, une fois encore, dans les textes, les droits des différentes minorités de ce pays. On a conforté l'idée que la majorité est légitime dans ses aspirations, mais aussi que la minorité a droit au respect, ce qui est nécessaire, quand il s'agit d'une réforme; c'est une question d'équilibre.
Monsieur le président, chers collègues, ma collègue, Kattrin Jadin, évoquera plus précisément, tout à l'heure, au nom de mon groupe, la question de la Communauté germanophone.
Pour ma part, je souhaiterais parler également de la réforme du Sénat. En effet, toucher au bicaméralisme n'est pas neutre. De plus, chacun sait ici que tout ce qui touche à la démocratie parlementaire mérite la plus grande attention. Cette réforme a des effets directs sur notre assemblée. Nous l'envisageons positivement. Le travail parlementaire, au niveau de la Chambre, va sans doute gagner en densité. Cela doit contribuer à revaloriser notre institution.
Selon moi, lors des dernières réformes, le Sénat n'avait pas reçu une place lui permettant de dynamiser le bicaméralisme. Or, ce dernier n'a de sens que s'il dynamise la démocratie. Il n'a pas de sens s'il se contente au mieux de dupliquer et au pire de ralentir. Même si la photographie n'est pas complètement juste – je veux faire droit aux réels apports du Sénat durant ces dernières années dans un certain nombre de grands débats –, c'est surtout comme cela que le système à deux têtes est aujourd'hui perçu. Mr. Speaker, dear colleagues, my colleague, Kattrin Jadin, will discuss the question of the German-speaking Community more specifically, as soon as possible, on behalf of my group.
I would also like to talk about the reform of the Senate. In fact, touching bicameralism is not neutral. Furthermore, everyone here knows that everything related to parliamentary democracy deserves the utmost attention. This reform has direct effects on our assembly. We look at it positively. Parliamentary work, at the level of the House, will surely gain in density. This should contribute to revitalizing our institution.
In my opinion, during the last reforms, the Senate had not been given a place to enable it to dynamize bicameralism. However, the latter only makes sense if it dynamizes democracy. It makes no sense if it is content at best to duplicate and at worst to slow down. Even though photography is not entirely fair – I want to make up for the actual contributions of the Senate in recent years in a number of major debates – it is mostly how the two-headed system is perceived today. On n'écrira même pas sur le fronton au-dessus de cette tribune la date du jour à côté des autres grandes dates de l'histoire de Belgique. On doit, me semble-t-il, avoir cette humilité-là.
Mais on doit aussi avoir la fierté de croire que l'on peut écrire l'histoire, celle du quotidien des gens. On peut l'écrire, alors qu'il y a deux ans, beaucoup en auraient douté. Beaucoup, y compris dans cet hémicycle, auraient voulu que ce ne soit pas le cas, préférant le gouffre du chaos à l'horizon de la réforme.
Le Mouvement réformateur – cela ne vous étonnera pas – a fait le choix de la réforme parce que c'est elle qui ouvre les perspectives et parce que c'est elle qui construit l'avenir. Nous voterons donc la sixième réforme de l'État, animés du sens des responsabilités.

Deux années seulement pour boucler cet ensemble de réformes colossales. Scission de la circonscription électorale de Bruxelles-alHal-Vilvorde, réforme des arrondissements judiciaires, réforme du système électoral, réforme du système bicaméral, réforme portant sur les dotations royales et j'en passe, pour enfin arriver à cet avant-dernier volet consacré au transfert de compétences.
Pour la première fois dans l'histoire institutionnelle de la Belgique, le centre de gravité va se déplacer de l'État fédéral vers les Régions et les Communautés.
Les Communautés et les Régions reçoivent de nouvelles compétences afin de pouvoir mener des politiques plus ciblées et adaptées à leur réalité économique et sociale. Il s'agit principalement des domaines suivants: l'emploi, les allocations familiales, la santé et l'aide aux personnes.
Ce transfert de matières à caractère social est très délicat pour les francophones car il ne s'agissait pas de détricoter la sécurité sociale. Ce compromis accorde à la fois la volonté de stabiliser notre pays, exprimée en Wallonie et à Bruxelles, et les souhaits de changements profonds exprimés en Flandre.
Cette réforme de l'État constitue un compromis entre les deux grandes Communautés.
Tout d'abord en ce qui concerne l'emploi, le groupe socialiste se réjouit du maintien au fédéral des règles relevant du droit du travail et de la sécurité sociale, de même que des dispositifs de concertation sociale ainsi que de la politique salariale. Par exemple, l'instrument de la convention collective du travail reste au fédéral. En revanche, les Régions pourront demain, en vue de créer de l'emploi, décider de réduire le coût du travail pour certaines catégories de travailleurs et ce, dans les entreprises ayant leur siège d'exploitation sur leur territoire. Les Régions pourront encore décider librement de renforcer les aides à l'emploi pour certaines catégories de chômeurs plus présentes sur leur marché de l'emploi.
Les partis de la majorité institutionnelle se sont efforcés, dans un esprit de consensus, de donner à la Wallonie, à Bruxelles et à la Flandre les moyens de mener une politique plus proche des citoyens.

This transfer of materials of a social character is very delicate for French speakers because it was not about spoiling social security. This compromise grants both the will to stabilize our country, expressed in Wallonia and Brussels, and the wishes for profound changes expressed in Flanders.
This reform of the state is a compromise between the two major communities.
First of all, in terms of employment, the Socialist Group welcomes the federal maintenance of labour law and social security rules, as well as arrangements for social consultation and wage policy. For example, the instrument of the collective labour agreement remains to the federal. On the other hand, the Regions will be able tomorrow, in order to create jobs, to decide to reduce the cost of labour for certain categories of workers, in companies having their headquarters in their territory. Regions will still be free to decide to increase employment aid for certain categories of unemployed people who are more present on their labour market.
The parties of the institutional majority have strived, in a spirit of consensus, to give Wallonia, Brussels and Flanders the means to conduct a policy closer to the citizens.

Encore un point de satisfaction pour mon groupe: les cotisations sociales restent prélevées au fédéral pour assurer une solidarité entre tous les Belges. J'ajouterai encore qu'une longue période transitoire est prévue pour garantir la continuité des prestations.
Pour en venir aux matières de la santé et de l'aide aux personnes, 90 % des compétences liées à la santé resteront fédérales. Le groupe socialiste se félicite du maintien de la solidarité interpersonnelle. Les cotisations sociales restent prélevées au niveau national de façon à assurer une solidarité entre tous les Belges.
Il s'agit de maintenir telle qu'elle existe actuellement cette solidarité interpersonnelle, qui implique l'égalité d'accès pour tous aux soins de santé remboursés en garantissant le libre choix du patient, conformément au principe européen de la libre circulation des personnes. Le patient paiera le même montant pour un même produit ou une même prestation, quel que soit l'endroit en Belgique où ce soin lui est prodigué.
En d'autres termes, rien ne changera en matière de remboursement des consultations chez le médecin, de politique des médicaments, de coût du séjour hospitalier.
Jusqu'à présent, les entités fédérées agréaient et inspectaient les maisons de repos, alors que le fédéral les finançait. Pour plus de cohérence, les entités fédérées disposeront désormais de la compétence complète en matière d'accueil des personnes âgées. Elles pourront l'adapter aux réalités locales.
Je note encore avec satisfaction que ce sont désormais les entités fédérées qui octroieront les aides à la mobilité des personnes handicapées.
Les institutions de santé mentale, maisons de soins psychiatriques, habitations protégées relèveront également des entités fédérées.
Enfin, ces entités fédérées qui étaient déjà partiellement compétentes en matière d'infrastructures hospitalières le deviendront désormais complètement. Ce sont bien les bâtiments abritant les hôpitaux qui seront transférés, mais les soins dans les hôpitaux continueront à relever intégralement du fédéral.
Je note encore avec satisfaction l'élaboration d'un plan régional de mobilité contraignant pour les communes et la répartition des compétences entre communes et Régions en matière de propreté.
Nous sommes aujourd'hui devant une étape qui restructure de manière fondamentale l'État fédéral. La mise en œuvre de la sixième réforme de l'État sera un travail de longue haleine. Je plaide donc pour que l'ensemble des protagonistes, en ce compris ceux qui songeraient déjà à une septième réforme de l'État, laissent du temps au prochain gouvernement pour effectivement mettre en œuvre sa présente réforme. À défaut, le pays risque de connaître une grande instabilité qui sera néfaste à l'ensemble des concitoyens.

I still note with satisfaction that it is now the federal entities that will grant the mobility aid for persons with disabilities.
Mental health institutions, psychiatric care homes, protected homes will also be federated entities.
Finally, those federated entities that were already partially competent in the field of hospital infrastructure will now become fully competent. It is the buildings housing the hospitals that will be transferred, but the care in the hospitals will continue to be covered entirely by the federal.
I still note with satisfaction the development of a binding regional mobility plan for municipalities and the distribution of cleaning competence between municipalities and regions.
Today we are facing a stage that fundamentally restructures the federal state. The implementation of the Sixth State Reform will be a long-term work. I therefore plead that all the protagonists, including those who would already think of a seventh state reform, give time to the next government to effectively implement its present reform. Otherwise, the country risks experiencing a great instability that will be detrimental to all fellow citizens.

La réforme soumise au vote va plus loin dans cette représentation des entités fédérées; le Sénat sera véritablement un lieu de rencontre pour les Communautés et Régions. Demain, le Sénat ne sera plus la chambre de réflexion qu'elle était, notamment sur les questions éthiques. Je pense particulièrement aux avancées qu'a engrangées le Sénat en matière de dépénalisation partielle de l'avortement, d'euthanasie, de lutte contre la traite des êtres humains ou encore à la reproduction médicalement assistée. Bref, des lois fondamentales dans la vie de tout un chacun et qui servent d'inspiration et de modèles dans de nombreux autres pays. Cette compétence devra cette fois être reprise par notre assemblée. Demain, le Sénat sera composé à 84 % d'élus issus des parlements des entités fédérées. Il s'agit de garantir la participation des parlements des Communautés et des Régions à l'organisation et au fonctionnement de l'État fédéral. Nos entités fédérées auront ainsi la possibilité de peser sur le débat relatif à la structure de l'État.
Cette étape est importante car elle signifie que nous entrons dans un véritable fédéralisme doté d'une Chambre des Communautés et des Régions. Aujourd'hui, le compromis sur la table a toutes les chances de réussir, à condition que le futur Sénat utilise effectivement les compétences mises à sa disposition. Il deviendra ce que les sénateurs de demain en feront. Les sénateurs garderont une possibilité d'initiative qui ne débouchera pas nécessairement sur un résultat normatif mais qui traitera de problèmes de société transversaux ayant un impact sur les Communautés et les Régions.
J'ajouterai qu'avec le transfert de nouvelles compétences aux entités fédérées, le centre de gravité va se déplacer pour la première fois de l'État fédéral vers les Régions et les Communautés.
Mon groupe voudrait également rendre hommage à la qualité du travail fourni par les fonctionnaires du Sénat. Je pense notamment aux services des commissions, d'évaluation de la législation, de traduction, des affaires juridiques, du compte rendu, etc. Ils ont permis d'alimenter les discussions, de mener des débats de qualité lors de l'examen des textes législatifs et d'améliorer et de rendre cohérentes des formulations utilisées, et j'en passe.

In short, there are fundamental laws in everyone’s life that serve as inspiration and models in many other countries. This time it will have to be taken over by our assembly. Tomorrow, the Senate will be composed of 84 percent of elected members from the parliaments of the federal entities. It is about ensuring the participation of the Parliaments of the Communities and Regions in the organization and functioning of the federal state. Our federated entities will thus have the opportunity to weigh on the debate concerning the structure of the state.
This step is important because it means that we are entering a true federalism with a Chamber of Communities and Regions. Today, the compromise on the table has every chance of succeeding, provided that the future Senate effectively uses the skills made available to it. It will become what the senators of tomorrow will do. Senators will retain an opportunity for initiative that will not necessarily lead to a normative outcome but that will address transversal societal problems that impact the Communities and Regions.
I will add that with the transfer of new powers to federal entities, the center of gravity will move for the first time from the federal state to the Regions and Communities.
My group would also like to pay tribute to the quality of the work provided by Senate officials. I think in particular of the services of committees, evaluation of legislation, translation, legal affairs, reporting, etc. They helped fuel discussions, conduct quality debates when reviewing legislative texts and improve and make coherent the formulations used, and I pass.
