Vandaag lezen wij opnieuw dat het Brusselse parket een achterstand heeft van maar liefst 296 dossiers die op de drempel van verjaring staan en die negen kansen op tien niet zullen leiden tot berechting van diegenen die de constructies hebben opgezet, maar ook – en dat is toch niet onbelangrijk – zullen zij niet leiden tot het innen, door de Belgische Staat, van de terechte directe of indirecte belastingen, van btw of belastingen.
Inzake dat innen heb ik aan het eind van mijn betoog tegen minister Reynders gezegd dat, indien elke burger, indien elke vennootschap, indien elke rechtspersoon in het juiste tijdvak de juiste belasting of de juiste btw of de juiste rechten zou betalen, er verdomd veel ruimte zou zijn voor fundamentele lastenverlaging. Er is een fiscale achterstand van 32 miljard. U moet weten dat wij binnenkort een begroting zullen goedkeuren waarbij de ontvangsten voor 1 jaar iets meer dan 90 miljard euro bedragen. Dan spreken wij van maar liefst een derde van ’s lands middelen voor een jaar die op een of andere wijze niet kunnne worden geïnd.
Daarom zeggen wij als Open Vld duidelijk dat wij moeten nagaan waarom dat misloopt, en waarom wij – ondanks het werk van vele ambtenaren die dag in dag uit trachten te weten te komen waarom wie wat heeft opgezet, en ook tot resultaten komen – er niet in slagen juridisch de weg te bewandelen om die mensen te bestraffen. Dat is de essentie van de zaak.

Today we read again that the Brussels Prosecutor’s Office has a lag of as many as 296 files that are on the threshold of obsolescence and that nine chances out of ten will not lead to the trial of those who set up the structures, but also – and that is not insignificant – they will not lead to the collection, by the Belgian State, of the rightful direct or indirect taxes, of VAT or taxes.

Monsieur le président, chers collègues, notre Chambre va adopter, à une très large majorité semble-t-il, la création d'une commission d'enquête parlementaire sur les grands dossiers de fraude fiscale. C'est évidemment un signal très fort que nous pouvons donner en ces temps où le monde financier peut donner l'impression de "tourner fou" et où les scandales se succèdent à un rythme soutenu.
Pour le PS, l'objectif de cette commission d'enquête est très clair; elle doit d'abord permettre de déceler les failles d'un système qui ont permis les grandes fraudes (KBC, quotités forfaitaires, etc.) et surtout permettre au parlement d'adopter des mesures pour renforcer la lutte contre la grande fraude et d'empêcher que de tels scandales puissent se reproduire.
Pour mon groupe, il faut à la fois renforcer la lutte contre la fraude fiscale et défendre un impôt juste, l'un ne va pas sans l'autre. Le fait de tirer les leçons du passé devrait nous aider à renforcer les moyens pour lutter efficacement et effectivement contre la fraude.
Je salue tout particulièrement le ralliement de certains groupes à cette proposition qui avait été déposée en début de législature par les verts et les socialistes et qui s'était vue refuser l'urgence en son temps. Ce ralliement s'est opéré voici 15 jours, dans une certaine urgence et par une étrange procédure qui, in fine, nous permet d'avancer.
Je voudrais attirer l'attention de la Chambre sur le caractère particulier d'une commission d'enquête. Il ne s'agit pas de jouer aux apprentis sorciers ou aux chevaliers blancs. Il faudra faire preuve de prudence, de rigueur et d'honnêteté intellectuelle. Une commission d'enquête comme celle-ci, avec un objectif aussi ambitieux que de traquer et lutter contre la fraude fiscale doit s'assigner une obligation de résultat. Parce que lutter efficacement contre la fraude, c'est récupérer des montants énormes, que nous pourrons réinjecter dans l'intérêt général.
Nous devrons donc profiter de cette commission d'enquête pour tirer au clair ce qui s'est passé dans le traitement de certaines affaires mais aussi élargir notre réflexion dans une approche plus globale et plus constructive. Cette commission devrait être l'occasion de voir comment d'autres pays organisent la lutte contre la fraude et de comparer les modes d'action en termes de pouvoir et de moyens des administrations fiscales. Elle devrait permettre d'objectiver au mieux l'ampleur de la fraude fiscale en Belgique et, à cet égard, nous devrons sans aucun doute faire appel à des experts et à des chercheurs universitaires. Elle devrait également nous permettre de voir comment le département des Finances lutte contre les paradis fiscaux.
Monsieur le président, chers collègues, mon groupe, qui était cosignataire de la proposition dès le mois de juillet, soutiendra bien évidemment son adoption et surtout il veillera à ce que cette commission puisse atteindre l'objectif ambitieux qu'elle s'assigne: renforcer la lutte contre la grande fraude fiscale qui grève le budget public et qui, par conséquent, nuit à l'intérêt général.

Mr. Speaker, dear colleagues, our House will, it seems, adopt, by a very large majority, the creation of a parliamentary commission of inquiry on major cases of tax fraud. This is obviously a very strong signal that we can give in these times when the financial world can give the impression of “going crazy” and where scandals succeed at a sustained pace.
For the PS, the objective of this commission of inquiry is very clear; it must first allow to detect the weaknesses of a system that allowed major fraud (KBC, flat-rate quotas, etc.) and above all allow Parliament to adopt measures to strengthen the fight against large-scale fraud and to prevent such scandals from happening again.
For my group, we must both strengthen the fight against tax fraud and defend a fair tax, one does not go without the other. Learning from the past should help us strengthen the means to fight fraud effectively and effectively.
I especially welcome the joining of some groups to this proposal, which had been submitted at the beginning of the legislature by the Greens and the Socialists and which had been denied the urgency at its time. This rally took place 15 days ago, in a certain urgency and by a strange procedure that, in the end, allows us to move forward.
I would like to draw the House’s attention to the special nature of an investigation committee. It’s not about playing witch learners or white knights. There must be prudence, rigour and intellectual honesty. An investigation committee such as this, with an ambitious goal as tracking and combating tax fraud, must assign itself a result obligation. Because fighting fraud effectively means recovering huge amounts, which we will be able to re-inject in the general interest.
We will therefore have to take advantage of this commission of inquiry to clarify what happened in the handling of certain cases but also to expand our reflection into a more comprehensive and more constructive approach. This committee should be an opportunity to see how other countries organize the fight against fraud and to compare the ways of action in terms of power and resources of the tax administrations. It should enable us to objectivize as much as possible the extent of tax evasion in Belgium and, in this regard, we will undoubtedly need to call on experts and academic researchers. It should also allow us to see how the Department of Finance fights against tax havens.
Mr. Speaker, dear colleagues, my group, which was co-signatory of the proposal since July, will obviously support its adoption and above all will ensure that this committee can ⁇ the ambitious objective it assigns itself: to strengthen the fight against the large tax fraud that strikes the public budget and which, consequently, is detrimental to the general interest.

Mijnheer de voorzitter, collega's, wij zijn erover verheugd dat onderhavig wetsvoorstel vandaag ter stemming ligt. Wij zijn heel tevreden met de grote steun die het voorstel kreeg in de commissie voor de Financiën, waar het met unanimiteit werd goedgekeurd. Eigenlijk is dat ook logisch. De onderzoekscommissie is echt broodnodig – de feiten bewijzen het – en komt zeker geen moment te laat.
Ongeveer een jaar geleden trok een aantal speurders en fraude-experts aan de alarmbel. Ze werden gesteund door een aantal politici van diverse partijen. Ik denk dat ik mag verwijzen naar de heer de Donnea die de tekst ook mee heeft ondertekend en die als voorzitter van de commissie voor de Financiën het dossier zeer genegen was. Dankzij zijn steun werd het voorstel goedgekeurd. Ik wil hem en alle collega's die hem en de commissie hebben gesteund, bedanken.
De aanklacht van de speurders was dat de voorbije 15 jaar heel wat grote fiscale dossiers niet tot een goed einde zijn gebracht. Belangrijke dossiers verjaarden. Belangrijke dossiers dreigen de komende jaren te verjaren. Vaak zijn het dossiers waar het onderzoek al heel duidelijke resultaten heeft opgeleverd, maar die niet in de laatste fase, namelijk voor de rechtbank, geraken.
De politici kennen de dossiers. De pers kent de dossiers. De bevolking kent ze. Iedereen kent de fraudedossiers goed. Ze kregen en krijgen heel wat aandacht. De situatie is echt wraakroepend, onaanvaardbaar en onrechtvaardig. Het is vooral ook een grote aanslag op de Staatskas.
Vanmorgen konden wij inderdaad in De Tijd lezen wat de situatie in Brussel is, het arrondissement waar het probleem wellicht het grootst is. Daar zijn 296 grote fiscale onderzoeksdossiers. De vraag is dan hoeveel kleine fiscale dossiers er zijn. Er zijn meer dan 1.474 kartonnen dozen. De achterstand is gigantisch. Er is 10 man personeel om die dossiers in eindvorderingen om te zetten en ze voor de rechtbank te brengen. Dat is werkelijk onmogelijk. Wij kunnen het niet tolereren, zeker niet als Parlement, en daarom komt de onderzoekscommissie echt op tijd.
Wat zullen wij doen? Wij moeten onderzoeken hoe het komt dat die grote dossiers van fiscale fraude met een sisser aflopen. Wat loopt er mis? Waar komen de vertragingen vandaan? Waarom kunnen hardwerkende speurders – heel wat speurders werken dagdagelijks gemotiveerd en keihard om die dossiers voor Justitie klaar te maken – hun werk niet beloond zien door een proces voor de rechtbank? Het werkt voor velen ook demotiverend. Daarmee moeten wij ook rekening houden.
De strijd tegen grootschalige fiscale fraude is de jongste jaren mislukt. Het Parlement heeft nu een unieke kans om die mislukking aan een heel ernstig en diepgaand onderzoek te onderwerpen. Die kans moeten wij grijpen. Wij moeten onze verantwoordelijkheid nemen. De bevolking verwacht dat ook van het Parlement. Terecht pikken de mensen het niet dat zij dagdagelijks veel belastingen betalen, terwijl grote fraudeurs er uiteindelijk met een verjaring vanaf komen.

About a year ago, a number of detectives and fraud experts drew the alarm bell. They were supported by a number of politicians from various parties. I would like to thank him and all the colleagues who have supported him and the committee.
The accusation of the investigators was that in the last 15 years a lot of large tax files have not been brought to a good end. Eliminate important files. Important files threaten to be outdated in the coming years. Often it is cases where the investigation has already produced very clear results, but which have not reached the final stage, namely before the court.
Politicians know the files. The press knows the files. The people know them. Everyone knows the fraud files well. They received and receive a lot of attention. The situation is truly revengeful, unacceptable and unfair. It is also a major attack on the state treasury.
This morning we could indeed read in De Tijd what the situation is in Brussels, the district where the problem is probably the biggest. There are 296 major tax investigation files. The question then is how many small tax files there are. There are more than 1,474 cardboard boxes. The backwardness is enormous. There are 10 man staff to turn those files into final claims and bring them before the court. That is really impossible. We cannot tolerate it, ⁇ not as Parliament, and that is why the investigation committee really comes on time.
What shall we do? We need to examine why these large files of tax fraud end up with a sisser. What is going wrong? Where do the delays come from? Why can hard-working detectives – a lot of detectives work daily motivated and hard to prepare those files for Justice – not see their work rewarded by a trial in court? It also works demotivating for many. This must also be taken into account.
The fight against large-scale tax fraud has failed in recent years. Parliament now has a unique opportunity to subject this failure to a very serious and in-depth investigation. We must seize this opportunity. We must take our responsibility. People expect that from Parliament. Rightly, people don’t think they pay a lot of taxes on a daily basis, while big fraudsters end up getting rid of them with a limitation.

Ik denk dat het belangrijkste is dat de commissie na twaalf maanden een stevig rapport kan afleveren. Dat stevig rapport moet een pak aanbevelingen bevatten om de strijd tegen de fiscale fraude in de toekomst opnieuw aan te gaan, ditmaal efficiënt en doeltreffend, zodat de fraudejagers ook werkelijk worden beloond voor hun harde werk en fraudeurs ook kunnen worden bestraft voor hun antisociaal gedrag. Dat is voor ons het allerbelangrijkste.
Het zal dan aan het Parlement en de regering zijn om de aanbevelingen om te zetten in daden. Het zal niet alleen de taak zijn van de staatssecretaris die bevoegd is voor de strijd tegen de fiscale fraude, maar ook van de minister van Justitie die moet ingrijpen op het gerechtelijke niveau, alsook van de minister van Financiën. Ook voor die laatste zullen waarschijnlijk een pak aanbevelingen komen. Eigenlijk is het de grote verantwoordelijkheid en een belangrijke taak voor heel de regering.
Ik onderstreep het vandaag: het is niet de bedoeling van de commissie om een heksenjacht te organiseren of uitspraken te doen over het feit of er al dan niet sprake is van fiscale fraude. Dat is de taak niet. Wat wij moeten doen, is de disfuncties blootleggen en aanbevelingen doen, zodat ze in de toekomst niet meer kunnen gebeuren.
Mijnheer de voorzitter, ik hoef u niet te vertellen dat de voorbije crisis het vertrouwen van de burger in onze democratie zwaar heeft geschonden. Ik ben dan ook blij dat over de grenzen heen van meerderheid en oppositie ons wetsvoorstel wordt gesteund. Een halt toeroepen aan de mistoestanden bij de fraudebestrijding, het kan een begin zijn van het herstel van het vertrouwen van de burger in de overheid. Wij hopen dan ook dat het voorstel hier in de plenaire vergadering unaniem zal worden goedgekeurd.

I think the most important thing is that the committee can deliver a solid report after twelve months. That solid report should contain a set of recommendations to re-enter the fight against tax fraud in the future, this time efficiently and effectively, so that fraud hunters are also truly rewarded for their hard work and fraudsters can also be punished for their antisocial behavior. That is the most important thing for us.
It will then be up to Parliament and Government to turn the recommendations into action. It will not only be the task of the Secretary of State responsible for the fight against tax fraud, but also of the Minister of Justice who must intervene at the judicial level, as well as of the Minister of Finance. Also for the latter will probably come a pack of recommendations. In fact, it is the great responsibility and an important task for the entire government.
I emphasize it today: it is not the intention of the committee to organize a witch hunt or to make statements on whether or not there is a tax fraud. That is not the task. What we need to do is expose the dysfunctions and make recommendations so that they cannot happen again in the future.
Mr. Speaker, I do not have to tell you that the past crisis has seriously undermined the public’s confidence in our democracy. I am therefore pleased that across the boundaries of majority and opposition our bill is supported. Calling for an end to the misstatements in the fight against fraud can be the beginning of restoring the citizen’s trust in the government. We hope that the proposal will be unanimously approved here in the plenary session.

Monsieur le président, je rappelle que le débat de ce jour a débuté, il y a quelques semaines, à l'occasion de la discussion relative aux intérêts notionnels, au cours duquel se posait la fameuse question "Fraude ou pas?" En tout cas, l'exposé du gouverneur de la Banque nationale était très clair.
Le MR est particulièrement fier de soutenir et d'approuver l'initiative qui, c'est vrai, n'était pas la nôtre au départ, mais que nous avons considérée comme extrêmement positive. En effet, la création de la commission d'enquête sur les grands dossiers de fraude fiscale permettra de continuer à crédibiliser le fait que l'impôt est essentiellement civique. C'est une chose importante et je remercie d'ailleurs M. Van Hecke qui vient de souligner l'intervention, à la hussarde certes, du président de la commission des Finances, M. François-Xavier de Donnea, qui a conduit à la mise en place aujourd'hui de la commission.
Je rappelle également que le ministre des Finances lui-même, Didier Reynders, lors du débat sur les intérêts notionnels, avait appelé de ses vœux la mise en place de cette commission d'enquête. Dès lors, il sera extrêmement intéressant que chacun des groupes politiques compose cette commission de personnes qui s'investiront totalement dans la réalisation et dans les résultats de cette commission.
Je voudrais rappeler que nous évoluons dans un contexte d'inquiétude. Nous avons évoqué tout à l'heure l'économie "casino". Nous nous souviendrons de la grande affaire Lernout & Hauspie, de la problématique du Lichtenstein, pour laquelle j'avais posé une question visant à savoir si des noms belges étaient déjà connus à ce sujet-là. J'espère que nous recevrons prochainement les informations en la matière. Nous passons malheureusement à côté de toute une série de paradis fiscaux qui existent dans les îles Caïman et autres lieux magiques.
Je le rappelle, payer un impôt est un acte important, civique. Car si le MR veut - c'est une priorité - diminuer le taux de l'impôt, en même temps, celui qui est soumis à l'impôt doit le payer. Il y a un parallélisme entre les deux. Et nous voulons absolument que les citoyens paient leurs impôts, même s'ils doivent en payer moins et commencent moins vite à les payer. Comme l'a rappelé le ministre des Finances, on commence en Belgique à payer des impôts à partir d'un revenu annuel de 6.400 euros. C'est-à-dire que les gens qui ont droit à obtenir des aides mazout paient déjà des impôts, ce qui est totalement paradoxal. C'est ce que nous voulons absolument changer.

Paying taxes is an important, civic act. Because if the MR wants - this is a priority - to lower the tax rate, at the same time, the one subject to tax must pay it. There is a parallel between the two. And we absolutely want citizens to pay their taxes, even if they have to pay less and start paying them less quickly. As the Minister of Finance recalled, taxation in Belgium begins from an annual income of 6,400 euros. That is, people who are entitled to oil aid already pay taxes, which is totally paradoxical. Velen zijn er absoluut van overtuigd dat de kleine garnalen worden gevangen en de grote vissen het net ontglippen. Dat ondermijnt uiteraard onze rechtsstaat en het vertrouwen in Justitie. Grote, spraakmakende dossiers die niet tot een goed einde zijn gekomen tonen dit aan. Ongelijke toepassing van de fiscale wetgeving in ons land bevestigt zulks ook. Laten wij eerlijk zijn, ook de complexiteit van onze fiscale wetgeving die al te vaak en te snel wijzigt, creëert rechtsonzekerheid.
Ik denk dan ook dat de parlementaire onderzoekscommissie op haar plaats is. Zij heeft tegelijk een beperkte opdracht in het licht van sommige andere parlementaire onderzoekscommissies die hier werden opgericht, maar ook een ruime opdracht. Ze moet oorzaken vaststellen en aanbevelingen formuleren. Moet onze wetgeving worden aangepast? Hoe kunnen we belastingontwijking voorkomen? Hoe kunnen we de actoren, niet alleen belastingplichtigen maar ook de grote accountantskantoren die hen bijstaan, de administratie en de justitie verder responsabiliseren? How can we further responsibility the actors, not only the taxpayers but also the large accounting firms that assist them, the administration and the judiciary? How can we identify faster? How can we prosecute more efficiently? Especially, how can we recover more of what has been unleashed?
In fact, this proposal fits perfectly in the spirit of our government agreement which states that the taxation and collection of taxes in our country must be done correctly and equally. Therefore, I think that, apart from this parliamentary initiative, this government should continue with what has been agreed. The college of directors of social tax police and judicial services under the leadership of a ministerial committee should be established and all resources should be used to have adequate controls over the country.

The second task is to identify problems relating to detection and prosecution. The third task is to inform the competent public authorities at Finance and at the court. And finally, the fourth task is to map fraud-sensitive business sectors.
Third, I would like to say that the problem – which will not surprise you – has been followed by us for a long time. We have already made a number of suggestions to improve the fight against large-scale tax fraud.

Op dat moment zijn de sporen nog warm en heeft het gerecht voor de grote dossiers de mogelijkheid om, met de instrumenten die het ter beschikking heeft, de waarheid en de achtergrond te achterhalen.
Dat zal ons eerste voorstel en onze eerste aanbeveling zijn.
Een tweede verschilpunt wanneer wij België vergelijken met Duitsland, Nederland en Frankrijk is het volgende. Wanneer in voornoemde landen – neem in Nederland de FIOD – na drie maanden onderzoek fraude wordt vastgesteld en men beslist om het dossier in de gerechtelijke filière te stoppen, verlenen ambtenaren-specialisten van de FIOD – te vergelijken met onze BBI – bijstand om het dossier snel en grondig aan te pakken, weliswaar onder de leiding en de verantwoordelijkheid van de onderzoeksrechter of de parketmagistraat.

Die studies bestaan in die drie landen. Ze bestaan zelfs in de Verenigde Staten. Op basis daarvan wordt een beleid uitgetekend, dat meestal in eerste orde – dat zal ons tweede voorstel ter zake zijn – wordt vertaald in de creatie van een speciale taskforce binnen het ministerie van Financiën om alle knowhow met betrekking tot fiscale paradijzen samen te brengen en een soort van antibeleid te formuleren.
Collega's, ik weet dat dit een ambitieuze agenda is. Ik verwijs naar wat de heer Verherstraeten daarnet heeft gezegd. If we want a credible State and good governance, then it is our duty to make progress in this area as quickly as possible and as far as possible.

On aurait pu imaginer la réticence de certains devant la mission qui sera confiée à cette commission en partant du principe que, peut-être, elle se contenterait d'examiner des situations antérieures et de pointer du doigt des responsabilités politiques, des responsabilités administratives, des responsabilités judiciaires. Il aurait été dommage d'en rester à ce stade et de ne voir dans cette commission qu'un pugilat ou un moyen de régler des comptes avec le passé.
Le fait que l'ensemble des partis soutiennent la proposition en examen me laisse penser que, s'il s'agira effectivement d'examiner voire de décortiquer ces antécédents, l'objectif sera surtout de mettre en œuvre, demain, de véritables règles de procédure qui nous permettront de lutter efficacement contre cette grande fraude fiscale.
Ce sera aussi l'occasion de déceler les besoins en hommes et en matériels nécessaires au SPF Finances pour pouvoir travailler correctement, mais aussi de voir si suffisamment de moyens matériels et humains sont donnés à la justice pour suivre efficacement les dossiers éventuellement mis au jour. Le moment est venu, sur le plan politique, de prendre les responsabilités qui sont les nôtres et ainsi faire preuve, dans des délais raisonnables, sans précipitation, dans le souci du respect des droits de la défense, d'une véritable efficacité dans la lutte contre la grande fraude fiscale.
La commission permettra ainsi de réaliser l'un des objectifs du gouvernement, à savoir la lutte contre cette grande fraude fiscale qui est finalement préjudiciable à l'ensemble des politiques que nous voulons mettre en œuvre dans ce pays. Nous devrons donc travailler concrètement et parallèlement au gouvernement pour l'aider dans sa tâche. C'est à ces conditions et dans cette perspective que le cdH s'associera au travail de cette commission.

The time has come, politically, to assume the responsibilities that are ours and thus demonstrate, within reasonable timeframes, without rush, in the interest of respecting the rights of defence, a real effectiveness in the fight against large tax fraud.
The commission will thus enable one of the objectives of the government to be achieved, namely the fight against this large tax fraud that is ultimately detrimental to all the policies we want to implement in this country. So we will have to work concrete and parallel with the government to help it in its task. It is under these conditions and in this perspective that the CDH will associate itself with the work of this commission.

Je parle de conciliation mais aussi de médiation et je crois que dans cette Chambre, nous avons tous fait beaucoup d'efforts pour faciliter l'usage de la conciliation ou de la médiation, ce qui n'est pas tout à fait la même chose.
Le fait d'obliger le juge de paix à tenter une conciliation en matière locative était une bonne mesure et cela doit, à notre sens, continuer.
L'objet des propositions de loi était sans doute de réfléchir à mieux rencontrer les objectifs poursuivis dans le cadre de la conciliation obligatoire devant le juge de paix. Je suis convaincu que le système actuel, s'il est bon dans son principe, a pour défaut principal d'allonger la procédure, ce qui, en définitive, et contrairement à ce que certains pourraient penser, est préjudiciable aux parties mais peut-être et surtout au locataire lui-même puisqu'il est, la plupart du temps, la partie qui est en position de faiblesse dans ce genre de dossiers.
Je constate que le texte proposé maintient, d'une part, l'obligation de la tentative de conciliation par le juge de paix, juge de proximité par excellence, et, d'autre part, évite l'écoulement d'un délai trop long avant la solution du litige, longueur qui est préjudiciable à tous, comme je l'ai dit.

The object of the bills was probably to think about better meeting the objectives pursued in the context of compulsory conciliation before the peace judge. I am convinced that the current system, if it is good in its principle, has the main defect of prolonging the procedure, which, ultimately, and contrary to what some might think, is detrimental to the parties but ⁇ and above all to the tenant himself since it is, most of the time, the party that is in a position of weakness in this kind of cases.
I find that the proposed text ⁇ ins, on the one hand, the obligation of attempting conciliation by the peace judge, nearby judge by excellence, and, on the other hand, avoids the passage of a too long period before the settlement of the dispute, length which is detrimental to all, as I said.

Mijnheer de voorzitter, mijnheer de minister, collega’s, volgens de meest recente, sociaaleconomische enquête van 2001 telt ons land 30,5% huurders. Het overgrote deel van de woningen in ons land wordt dus door eigenaars bewoond, waarover wij alleen maar blij kunnen zijn. Eigendom van een woning is immers een factor van persoonlijke ontplooiing en laat ook een versterking van de sociale cohesie toe. Een eigen woning is ook een belangrijke pensioenpijler. Eigenaars hoeven immers geen uitgaven voor de huur van een woning te doen. Zij kunnen de uitgespaarde middelen voor hun levensonderhoud aanwenden. Met andere woorden, een eigen woning draagt bij tot bestaanszekerheid en is vaak het beste spaarplan voor de toekomst.
Toegang tot eigendom voor zoveel mogelijk mensen moet dan ook prioritair blijven op de verschillende beleidsniveaus. De uitdaging bestaat erin om een aanbod aan betaalbare en kwaliteitsvolle woningen te garanderen, zodat elk gezin, ongeacht de samenstelling ervan en ongeacht de financiële draagkracht, behoorlijk kan worden gehuisvest.
Een woonhuis kostte de eerste helft van 2007 gemiddeld 157.200 euro. Voor een villa diende bijna het dubbele te worden betaald. Appartementen gingen voor 163.000 euro van de hand. Sinds 1975 is de gemiddelde verkoopprijs van een woonhuis verachtvoudigd, terwijl het algemene prijsniveau over voornoemde periode slechts met factor 3 toenam. Gedurende de voorbije 30 jaar zijn huizen dus meer dan dubbel zo snel als de prijzen van de overige producten in waarde gestegen.
Hoe ook wordt geprobeerd om meer mensen een eigendom te laten verwerven, het woningeigenaarschap zal nooit voor iedereen zijn weggelegd. Onze fractie is dan ook van oordeel dat, behalve het stimuleren en ondersteunen van het eigenaarschap, ook de huurders veel bescherming en ondersteuning verdienen. Het armoederisico van huurders is hoger. De huurders vormen ongetwijfeld ook vaak een kwetsbaardere groep.
Wij zijn ervan overtuigd dat een overheveling van de huurwetgeving naar de Gewesten noodzakelijk is om een globaal, doelmatig en geïntegreerd woon-, grond-, milieu- en pandenbeleid mogelijk te maken dat met de specifieke, feitelijke situatie en behoeften in elk Gewest rekening houdt. Dat kan zowel huurders als eigenaars enkel maar ten goede komen.
Ook de gerechtelijke procedure in huurzaken, zeker voor woningen die tot hoofdverblijf dienen, verdient een specifieke aanpak.
Onze fractie is dan ook verheugd dat vandaag een wetsvoorstel ter stemming voorligt dat de bestaande, voorafgaande, verplichte verzoeningspoging in huurzaken op een efficiëntere manier wil aanpakken. Het voorliggende voorstel houdt een evenwicht tussen, enerzijds, zij die van oordeel zijn dat de verplichte verzoeningspoging volledig moet worden afgeschaft en, anderzijds, zij die pleiten voor het behoud van voornoemde poging.
De invoeging in 2002 van artikel 1344septies van het Gerechtelijk Wetboek had een dejuridisering van de huurgeschillen tot doel.

The challenge is to guarantee a supply of affordable and quality housing so that every family, regardless of their composition and regardless of their financial capacity, can be properly housed.
A residential home cost an average of 157,200 euros in the first half of 2007. For a villa it was almost double paid. Apartments were sold for 163,000 euros. Since 1975, the average selling price of a residential house has eightfolded, while the general price level over the aforementioned period only increased by factor 3. In the last 30 years, houses have increased in value more than twice as fast as the prices of other products.
No matter how many attempts are made to get more people to acquire property, home ownership will never be for everyone. Our group therefore believes that, in addition to stimulating and supporting ownership, the tenants also deserve a lot of protection and support. The poverty risk of tenants is higher. Unfortunately, tenants are often a more vulnerable group.
We are convinced that a transfer of the rental legislation to the regions is necessary to enable a global, efficient and integrated housing, land, environment and property policy that takes into account the specific, actual situation and needs in each Region. This can only benefit both tenants and owners.
The judicial proceedings in lease cases, especially for houses serving as the main residence, also deserve a specific approach.
Our group is therefore pleased that today a bill for vote proposes that the existing, prior, mandatory reconciliation attempt in rental matters should be addressed in a more efficient way. The present proposal ⁇ ins a balance between, on the one hand, those who believe that the mandatory attempt to reconcile should be completely abolished and, on the other hand, those who advocate the preservation of the aforementioned attempt.

Vermits de verzoeningspoging losstaat van de inleiding van de zaak ten gronde, liggen er vaak 6 tot 7 weken tussen de verzoeningspoging en de behandeling van de zaak ten gronde. Dat is kostbare tijd, die vaak alleen maar achterstallen laat oplopen en leidt tot een verslechtering van de al broze verhouding tussen verhuurder en huurder.
Enkel in de gevallen waarin de huur via sociale verhuurkantoren tot stand is gekomen, blijken de cijfers wat beter te zijn. De sociale verhuurkantoren begeleiden de huurders, zetten hen ertoe aan naar de zitting te gaan en een betalingsplan overeen te komen en uit te voeren.
Wij zijn van oordeel dat het van maatschappelijk belang is dat er maximaal wordt gestreefd naar het uitwerken van minnelijke oplossingen voor menselijke conflicten, zeker inzake wonen, een elementair recht voor het menselijk welzijn. Het voorkomen van lange en dure rechtsplegingen, een positieve beïnvloeding van huurder en verhuurder is voordelig voor alle betrokken partijen. De bemiddelingsidee is bovendien een zeer essentiële hefboom in de preventie van uithuiszetting.
In de gevallen waarin geen verzoening mogelijk is of de verweerder verstek laat, lijkt het ons echter opportuun dat de vrederechter zich op dezelfde zitting of kort nadien ook reeds kan uitspreken over de grond van de zaak. Dat is de grote verdienste van het voorliggende wetsvoorstel. Er gaat geen tijd verloren, de huurachterstallen lopen niet verder op en de vredegerechten worden minder belast. Op de inleidende zitting tracht de vrederechter ambtshalve de partijen te verzoenen, doch wanneer dat niet lukt, kan de zaak onmiddellijk ten gronde worden behandeld op een enkele zitting. Dat betekent geen bijkomend tijdsverlies en toch blijft de verzoeningspoging bestaan. OCMW's zijn terecht van oordeel dat ze in een vroeger stadium betrokken willen worden bij problemen zoals de betaling van huurgelden. Hoe vroeger zij op de hoogte zijn, hoe beter zij de huurder kunnen begeleiden en tot een oplossing met de verhuurder kunnen trachten te komen. Dat is een terechte verzuchting. Wij hebben de diverse verenigingen van steden en gemeenten en afdelingen van OCMW's dan ook gevraagd op welke manier de wetgever hieraan tegemoet kan komen. Daarnaar is al verwezen door de heer Giet. Ik denk dat op dat vlak in de toekomst nog heel wat werk op de plank ligt. Elke begeleiding die ertoe kan leiden dat mensen niet verdrinken in huurachterstallen en het woonrecht voor een gezin wordt gegarandeerd, verdient immers ondersteuning.

After all, any guidance that can lead to people not drowning in rented backstalls and guaranteeing the right to live for a family deserves support.

Ik denk daarbij aan manifest insolvabele huurders en aan huurders die met de noorderzon zijn verdwenen.
Collega's, Open Vld met collega De Padt als hoofdindiener, heeft tijdens een vorige legislatuur als eerste partij een wetsvoorstel ingediend om de verplichte verzoening te wijzigen. Ons voorstel hield aanvankelijk vast aan twee stappen, een eerste stap in raadkamer en een tweede stap, in geval van niet-verzoening, in openbare zitting, evenwel met een onmiddellijke doorstroming in geval van niet-verzoening.
In de commissie bleek een meerderheid – ook PS en sp.a – zich te scharen achter een volledige afschaffing van de verzoening in raadkamer. Wij hebben ons bij die meerderheid aangesloten.
Het voorstel van collega's Schrijvers en Terwingen werd tijdens de bespreking in de commissie geamendeerd, onder andere op het vlak van het toepassingsgebied. Ik zal op dat punt niet in herhaling vallen. De amendering gebeurde om tekstueel echt duidelijk te maken – en dus misverstanden op het terrein te vermijden – dat het de bedoeling is dat de vrederechter die op een openbare zitting vaststelt dat hij er niet in slaagt te verzoenen, de zaak onmiddellijk ten gronde behandelt. Het is niet de bedoeling dat hij de behandeling ten gronde uitstelt naar een volgende zitting.
Intussen is er al kritiek gekomen op het voorstel, onder andere van de VVSG. Men heeft daarnaar al verwezen. Volgens de VVSG zou dit voorstel ervoor zorgen dat de OCMW's minder goed op de hoogte zullen zijn van de huurproblemen.
Volgens ons is het precies het omgekeerde. Voortaan zullen alle huurzaken, behalve degene die in verzoening overeenkomstig artikel 731 worden opgeroepen, onmiddellijk ten gronde worden opgeroepen en zal het OCMW telkens worden verwittigd als de uithuiszetting wordt gevraagd.

In the committee, a majority – including PS and sp.a – appeared to support a complete abolition of conciliation in the council chamber. We joined that majority.
The proposal of colleagues Schrijvers and Terwingen was amended during the discussion in the committee, including in terms of the scope of application. I will not repeat this point. The amendment was made in order to really make clear textually – and thus to avoid misunderstandings in the field – that it is intended that the peace judge who determines at a public session that he fails to reconcile, immediately deals with the case on the ground. He is not intended to postpone the treatment to a next session.
There has been criticism of the proposal, among others from the VVSG. This has already been mentioned. According to the VVSG, this proposal would make the OCMWs less aware of the rental problems.
In our opinion, it is exactly the opposite. From now on, all lease matters, except those called for reconciliation in accordance with Article 731, shall be immediately recalled and the OCMW shall be notified whenever the uithuiszetting is requested.

On peut même affirmer que l'obligation de conciliation a eu des effets pervers rendant les procédures plus longues et plus coûteuses. En effet, la conciliation n'a de sens que dans l'hypothèse où toutes les parties au litige sont prêtes au compromis de manière volontaire. Si une seule d'entre elles est présente ou si une d'entre elles campe sur ses positions, il devient vain de vouloir tenter une conciliation. Il arrive même, dans certains litiges relatifs à des arriérés de loyer, que certains locataires de mauvaise foi jouent de cette faculté procédurale pour allonger dilatoirement la procédure et creuser encore ainsi le passif à charge de leur bailleur.
Il faut aussi constater – ce point est particulièrement important – les retards inadmissibles des greffes de justice de paix pour fixer les appels en conciliation. Ainsi, à titre d'exemple, une demande formulée à la justice de paix du quatrième canton de Liège en date du 23 janvier 2008 n'a fait l'objet d'un avis de fixation que le 5 mars pour l'audience du 21 mars, soit deux mois plus tard. Motif invoqué par le greffe: un manque de personnel. En attendant, le propriétaire est pris en otage et voit son préjudice s'accroître de deux mois.
L'effet indirect et hautement préjudiciable de telles pratiques pour la majorité des locataires de bonne foi consiste en l'instauration d'une certaine méfiance dans le chef des propriétaires qui seront tentés – ou qui le sont déjà – de durcir leurs conditions de location ou de ne plus louer leur bien, tout cela au détriment des personnes économiquement faibles et à la recherche d'un logement.
Déjà lors de l'élaboration de la loi-programme de 2002, certaines craintes avaient été émises et ont été confirmées dans la pratique. C'est pourquoi le MR a toujours soutenu la position selon laquelle le législateur devait corriger le tir et supprimer les effets pervers des mesures ainsi adoptées.

Il est évident que les magistrats ainsi que les avocats, professionnels et responsables, encourageront le recours au règlement amiable du litige, conciliation ou médiation, s'il semble qu'une telle issue est possible.
A fortiori, le juge de paix, juge de proximité par excellence, a pour mission première dans tout litige de rapprocher tant que faire se peut le point de vue des parties litigantes quand cette possibilité existe. Toute autre modification qui viserait à maintenir le recours systématique à une conciliation préalable conserverait les mêmes inconvénients que la procédure actuelle: longueur, coût et inefficacité.
Avec mes collègues, Marie-Christine Marghem et Jean-Luc Crucke, nous sommes particulièrement satisfaits que le principe de la suppression de l'obligation de conciliation obligatoire en matière de contentieux locatif ait été voté avec un très large consensus par les membres de la commission de la Justice. Giet et lui dire que le groupe MR est également ouvert, comme d'autres groupes en on fait état ou vont en faire état, à la discussion en commission de la Justice de propositions visant à essayer de mieux répondre aux préoccupations d'un certain nombre de personnes qui, en raison des circonstances de la vie, rencontrent un problème de logement.
On peut évidemment parler de la proposition que j'ai déposée avec ma collègue, Mme Marghem, visant à donner aux CPAS un rôle plus proactif en la matière. Il y a là des choses importantes à faire sans pour autant entraîner des frais trop élevés. On pourrait également parler d'une proposition de Mme Lalieux, dans le cadre du lancement des procédures, lorsqu'il y a notification par le greffe des requêtes ou encore lorsque les huissiers citent, afin que soit joint au document introductif de la procédure un document reprenant les noms et coordonnées des associations auxquelles une aide pourrait être sollicitée, que ce soit par un locataire ou un propriétaire.
Je ferai encore référence à une proposition de M. Landuyt souhaitant permettre, notamment dans le cadre des procédures devant les juges de paix, que les associations de défense des locataires puissent aider des locataires. Comme il le sait, je le lui ai précisé en commission de la Justice que, si cette proposition était examinée, je souhaiterais qu'un amendement, que je déposerai en temps voulu, prévoie que les associations de défense des propriétaires puissent également intervenir dans ce type de procédure.
Je voudrais dire à M. Landuyt que le fait de permettre à des associations d'intervenir – comme c'est le cas avec les syndicats qui interviennent devant les juridictions du travail – pourrait amener les avocats à poser des questions quant à l'opportunité de l'intervention d'autres associations devant d'autres juridictions et dans certains types de contentieux. Die vaststelling is op zich correct. Er zijn inderdaad problemen gerezen die onaanvaardbaar zijn in de praktijk. De wijzigingen die nu worden voorgesteld zijn echter heel drastisch en hebben toch wel ernstige gevolgen in de huurprocedure.
Wij mogen niet vergeten dat het een procedure is waarmee de meeste mensen ooit worden geconfronteerd. Daarnet zijn de cijfers genoemd. Ongeveer 30% van de mensen huurt. De kans is reëel dat mensen ooit met die procedure worden geconfronteerd.
De verplichte verzoening wordt afgeschaft en wordt vervangen door een poging tot verzoening die zal gebeuren op de zitting ten gronde door de vrederechter.
Deze essentiële wijziging zal drie belangrijke gevolgen hebben.
Ten eerste, de beslotenheid van de verzoeningszitting bij de vrederechter wordt verlaten. Ten tweede, bij de verzoening toen die gebeurde in de raadkamer waren de huurders vaak vergezeld van mensen die hen begeleiden, van de huurderorganisaties, om hen bij te staan in die procedure. Dat is een mogelijkheid die bestaat in verzoeningsprocedures in de raadkamer en geen aanleiding geeft tot problemen.
Wanneer wij nu de verzoeningspoging gaan verplaatsen naar een zitting in openbare zitting, zal het onmogelijk worden dat huurders worden bijgestaan door vertegenwoordigers van organisaties. Dat is absoluut geen goede zaak. Misschien zullen er wel eens vrederechters zijn die het wel zullen toelaten, maar principieel zal dit niet toegelaten zijn. Er zullen ook veel vrederechters of advocaten van verhuurders zich daartegen verzetten. Dat is een heel belangrijk gevolg van het wetsvoorstel dat nu wordt voorgelegd.
Ten derde, doordat de verzoening wordt verschoven naar de procedure ten gronde en plaatsvindt in openbare zitting, spreekt men niet langer, wanneer een akkoord wordt bereikt, over een proces-verbaal van verzoening zoals in de raadkamer, maar zal dit worden geacteerd in een akkoordvonnis.
Er komt dus een vonnis, een echte uitspraak. Dat wil zeggen dat er een regeling moet worden getroffen over de gerechtskosten, waaronder bijvoorbeeld de rechtsplegingvergoeding. De rechtsplegingvergoeding is recent fors gestegen en kan in huurzaken makkelijk oplopen tot 400 à 750 euro. Second, when the reconciliation took place in the council chamber, the tenants were often accompanied by people who accompanied them, from the tenant organizations, to assist them in that procedure. This is a possibility that exists in conciliation procedures in the council chamber and does not give rise to problems.
If we now move the attempt to reconcile to a public session, it will become impossible for tenants to be assisted by representatives of organizations. That is absolutely not a good thing. Maybe there will be peace judges who will allow it, but in principle this will not be allowed. There will also be many peacekeepers or lawyers of tenants opposing this. This is a very important consequence of the bill that is now being submitted.
Third, because the reconciliation is shifted to the substantive procedure and takes place in public hearing, when an agreement is reached, one no longer speaks of a process-verbal of reconciliation as in the council chamber, but this will be acted in an agreement judgment.
So there is a verdict, a real verdict. That is to say, there must be arrangements on the costs of the court, including, for example, the judicial fee. Monsieur le président, chers collègues, je prends également la parole dans ce dossier. Ces derniers jours, on m'a demandé d'où venait l'initiative et si elle provenait d'un lobby quelconque. Non! Cette initiative vient de la pratique. Ceux qui fréquentent les justices de paix, ceux qui lisent la doctrine en la matière se sont vite rendu compte des écueils de la législation précédente, à savoir la lenteur de la procédure et le retard souvent inutile de la procédure. Ces problèmes ont été soulevés non seulement par les avocats mais aussi par la doctrine. Il ne s'agit donc absolument pas d'un camp contre l'autre, les propriétaires contre les locataires. Dès lors, il était temps d'évaluer cette conciliation obligatoire.
Deuxième chose, je me rends compte qu'il y a, ces jours-ci, une confusion dans la presse et dans l'opinion publique. On ne supprime pas la tentative de conciliation devant le juge de paix. Le juge de paix est même tenu de la faire. Il y a donc obligation pour le juge de paix de tenter une conciliation. On supprime la conciliation obligatoire dans une procédure séparée mais on ne supprime pas le devoir du juge de paix de tenter cette conciliation.
Certes, il n'y a pas de sanction. Dans ces matières-là, comme dans beaucoup d'autres, il n'y a pas de sanction sur cette attitude et je prends pour exemple les litiges devant le tribunal du travail où la tentative de conciliation est toujours obligatoire. Évidemment, j'ose espérer que les juges de paix respecteront la loi et la proposition de loi qui nous est soumise aujourd'hui.
J'en viens à la troisième difficulté d'interprétation. Je comprends l'action des associations de locataires depuis quelques semaines qui, d'une part, nous interpellent en disant ne pas avoir été consultées et qui, d'autre part, craignent de ne plus avoir de place dans ce genre de procédure. Je suis moins pessimiste que ces associations elles-mêmes. Un des intervenants a bien précisé que, pour le moment, le rôle des organisations qui défendent en général les locataires est important. Selon les justices de paix, leur présence pour accompagner le locataire varie souvent et – je le reconnais – c'est un peu la personnalité du juge de paix qui fait droit à ces demandes des associations d'accompagner leur client.
Je crois qu'il faudra un jour statuer dans le Code judiciaire sur la place et le rôle des organisations en général du droit d'ester ou du droit d'accompagner. Beaucoup de propositions de loi sur le rôle des associations sont depuis bien longtemps déposées, que ce soit dans cette matière-là ou dans d'autres matières. En particulier dans cette matière-ci, le législateur ferait œuvre utile de poursuivre la discussion. Je ne crois pas que ce soit le principe même de la suppression de la conciliation obligatoire qui fasse problème maintenant; c'est plutôt l'accompagnement de certaines personnes par des associations qui travaillent bien. Il est vrai que la législation actuelle laisse à désirer et que, dans la plupart des cas, la conciliation obligatoire ne fait qu'allonger la procédure. Of course, there is no punishment. In these matters, as in many others, there is no sanction for this attitude and I take for example the disputes before the labour court where the attempt of conciliation is always mandatory. Obviously, I dare to hope that the peace judges will respect the law and the bill that is submitted to us today.
I come to the third difficulty of interpretation. I understand the action of tenant associations for a few weeks, which, on the one hand, interpell us by saying that they have not been consulted and who, on the other hand, fear that they will no longer have a place in this kind of procedure. I am less pessimistic than these associations themselves. One of the speakers clarified that, at the moment, the role of organisations that generally defend tenants is important. According to the peacekeepers, their presence to accompany the tenant often varies and – I acknowledge it – it is somewhat the personality of the peacekeeper that makes right to these requests of the associations to accompany their client.
I believe that one day it will be necessary to decide in the Judicial Code on the place and the role of organisations in general of the right to be or the right to accompany. Many legislative proposals on the role of associations have been filed for a long time, whether in this matter or in other matters. Particularly in this matter, the legislator would do useful work to continue the discussion. I do not believe that it is the very principle of the abolition of compulsory conciliation that makes a problem now; rather it is the accompaniment of certain people by associations that work well. It is true that current legislation leaves much to be desired and that, in most cases, compulsory conciliation only prolongs the procedure. This is not good for the landlord or the owner.

Ondertussen bleef de huurwet gedurende negen maanden voor probleem na probleem zorgen. Degenen die ze veroorzaakten, bleven doodleuk zeggen dat zij ideologisch gelukkig waren met de bestaande huurwet. Ik kan u echter een pak mensen opnoemen die niet gelukkig zijn met de huidige gang van zaken.
Ten eerste, de huurders vangen bij de banken bot of worden geconfronteerd met extra kosten die ze niet hadden verwacht, zodat ze uiteindelijk geen huurwaarborg kunnen sluiten.
Ten tweede, de banken moeten vandaag willens nillens en blijkbaar zonder enige deftige confrontatie of consultatie en zeker zonder een duidelijk algemeen akkoord gratis krediet verstrekken voor het geven van een huurwaarborg. Het is niet voor niets dat zij gezamenlijk een proces bij het Grondwettelijk Hof hebben aangespannen.
Ten derde, de gemeenten worden geconfronteerd met een onuitvoerbare opdracht om de verplichte affichering van de huurprijs te controleren en te behoeden.
Ten vierde, de verhuurders geven stelselmatig de pijp aan Maarten. Ik wil toch even in herinnering brengen dat de huurmarkt, die nu al met 18,4% aandelen in het aantal woningen in Vlaanderen te krap is, nog verder inkrimpt.
Administratieve lasten, het spook van de fiscale bestraffing – waarom anders hebt u de verplichte registratie in deze wet gestoken – en een gebrek aan bescherming zijn hier niet vreemd aan. Dit alles, terwijl een rapport van de KUL in opdracht van het departement Woonbeleid voor een ondersteunend aanbodbeleid voor de Vlaamse private huurmarkt pleit. Het is dan ook een zegen dat dit wetsonderdeel in de toekomst Vlaamse materie wordt.
Ondertussen is het onze verdomde plicht om de bestaande anomalieën weg te werken. Laten wij immers eerlijk zijn: het afschaffen van de verplichte verzoeningsprocedure is de spreekwoordelijke pleister op het houten been. Laten wij niet omheen de hete brij draaien. Wij lossen het fundamentele probleem niet op, want het grootste aantal betwistingen voor een vrederechter gaat om wanbetalers. 15.000 dossiers per jaar moeten voor de vrederechter worden beslecht. Naar schatting lopen verhuurders op die manier jaarlijks ongeveer 20 miljoen euro mis, vooral door de homehoppers. Ik heb het dan niet over mensen die bonafide in de problemen komen en op die manier een gesprek aanbinden met hun verhuurder. Ik heb het over de homehoppers die er een sport van maken om nooit te betalen. Dat is trouwens een uitwas van de paarse rechtenmaatschappij die verplichtingen maar al te graag onder de mat schoof.

Daarom heeft men blijkbaar bij de meerderheid verkozen om alleen dat probleem aan te pakken, helaas. Het was dan ook echt nodig dat men het zou aanpakken. Wat heeft men dan gedaan? Men heeft in feite de bijna dwanggedachte die in de procedure was gestoken, weggewerkt door middel van de voorstellen van diverse collega’s uit de meerderheidspartijen. Daar kunnen wij mee leven. Dat is een zeer goede eerste stap, uiteraard. De dwangideeën van de PS worden eruit gehaald en men komt tot een meer normale regeling, waarbij het kind gelukkig niet met het badwater wordt weggegooid. Het zou uiteraard spijtig zijn wanneer men de hele verzoeningsprocedure, de poging om de huurgeschillen te beperken, die moet blijven bestaan en waarover iedereen het eens is, in de kiem zou smoren. Daar is iedereen het over eens. Daarom zullen wij het voorstel uiteraard steunen.
Wij betreuren echter, zoals ook aangehaald door vorige collega, dat de federale wetgever – het Parlement had hierin zijn zeg, vooraleer er een regering was gevormd – niet de kans te baat neemt om schoon schip te maken met die wetgeving en om met een propere lei naar de federalisering van het thema te gaan. Dat is een gemiste kans. We hopen dat het Parlement de eer aan zichzelf houdt en de toelating krijgt van de regering om schoon schip te maken met de huurwetgeving om ervoor te zorgen dat die wordt gezuiverd van alle erin vervatte anomalieën. Wij waren in dezen socialer dan de socialisten, in die zin dat wij in ons voorstel hadden voorgesteld om de verzoening nog verplicht te maken, maar wanneer dit niet lukte, de zaak onmiddellijk naar de vrederechter, zetelend ten gronde, te verzenden.
Wij waren namelijk van oordeel, in tegenstelling tot een aantal andere partijen in dit halfrond, dat een discussie of een overleg in een raadkamer soms nog wel kan leiden tot bepaalde oplossingen. Dit voorstel werd door geen enkele partij gesteund, niet door de sp.a, noch door de PS, noch door andere partijen. Ik meen dat wij hier een kans hebben gemist om de sociaalvoelendheid op dat vlak te veruiterlijken.
Wij hebben tijdens de vorige legislatuur dat wetsvoorstel ingediend, ervan uitgaande dat dit de middenweg kon zijn en de consensus die kon worden gevonden tussen de toenmalige meerderheidspartijen om het op die manier op te lossen. Het werd niet aanvaard. Wij betreuren dat een beetje. Het is een vaststelling, mijnheer de voorzitter, dat de liberalen soms, en misschien veelal, socialer zijn dan de socialisten.

Premièrement, je peux comprendre sons souhait de défendre les locataires de la manière la plus ardente. Mais dans le cadre de la mise en œuvre d'une législation en matière de baux à loyer, il faut assurer un équilibre entre les uns et les autres. Relativement à la conciliation obligatoire, il ressort de la pratique, comme l'ont dit de nombreux intervenants, qu'un déséquilibre s'est créé, probablement en raison d'un mauvais fonctionnement, notamment de certaines justices de paix qui ont fixé beaucoup trop tardivement des appels en conciliation. La pratique a montré également que peu de personnes cherchaient cette conciliation.
Deuxième remarque, nous sommes bien conscients que certaines personnes éprouvent en Belgique des problèmes à se loger et qu'en raison des circonstances de la vie, par exemple la perte de leur emploi, elles peuvent se retrouver dans l'impossibilité de payer leur loyer. Certaines situations peuvent être dramatiques et conduire à des gestes épouvantables tels le suicide de ce couple en région liégeoise.
Seulement, à un moment donné, en cas de non-paiement de loyer, on arrivera immanquablement avec ou sans conciliation obligatoire à une résiliation du bail et une expulsion par le juge de paix, dans un souci d'équilibre entre les droits des uns et des autres. Comme je l'ai dit dans mon intervention et comme nous devrons en rediscuter prochainement, il faut que les CPAS interviennent de manière plus décidée en la matière. Rappelons que les CPAS sont avertis des expulsions à deux moments: lors de l'introduction de la procédure car il y a obligation de mentionner dans la requête, dans la citation, que celles-ci vont être transmises au CPAS mais aussi lorsque l'huissier signifie le jugement, moment où le CPAS est une nouvelle fois averti. À Liège, pour avoir recueilli des chiffres, on constate malheureusement que la plupart des CPAS ne font rien. Rares sont ceux qui agissent, surtout en milieu rural.
Il faut dès lors compléter la législation, le Code judiciaire. C'est pourquoi Mme Marghem et moi-même avons introduit une proposition de loi. J'espère que quand nous en discuterons en commission, M. Landuyt mettra autant d'ardeur qu'aujourd'hui à faire en sorte que les personnes qui en ont tant besoin reçoivent l'aide des CPAS, aient droit à une intervention de leur part.

Tijdens de bespreking in de commissie voor de Justitie kwam de discussie aan bod of het hier al dan niet gaat om een uitleggingswet. Verder werd vanuit diverse zijden benadrukt dat het ontwerp niet intervenieert in de contractuele vrijheid van partijen.
Het ontwerp werd met 12 stemmen voor en 1 onthouding goedgekeurd.

Article 587 of the Civil Code regulates this situation by imposing the obligation of the fruit consumer on the sole owner at the end of the fruit use to return an equal amount of goods of the same quality and value or the estimated value.
Article 587 therefore gives the fruit consumer the choice to return the goods in kind or their value. However, it does not specify how the value of the goods should be calculated. The fruit consumer can therefore choose between the value at the beginning or at the end of the fruit consumption. This possibility opens the door to real speculation for the benefit of the fruit user.
This draft law aims to solve that problem and thus only permits either the return of the goods in nature or their value at the time of the return. In French law, a similar solution has been chosen.
During the discussion in the committee for justice, the discussion arose as to whether or not this is an interpretation law. Furthermore, it was emphasized from various sides that the draft does not interfere with the contractual freedom of the parties.
