(…) de la peine de mort est une évidence. C'est une réalité en Belgique comme dans 133 pays du monde, mais il reste aujourd'hui 64 pays et territoires qui maintiennent la peine de mort et d'autres qui envisagent de la réhabiliter dans certaines circonstances exceptionnelles.
Il est pourtant prouvé, depuis de nombreuses années maintenant, qu'il n'y a pas de lien entre la peine de mort et le taux de criminalité. La peine capitale constitue un simulacre brutal et vengeur de justice, comme le rappelle très bien le secrétaire général du Conseil de l'Europe, Terry Davis.
Il est donc important pour nous que notre pays, qu'une démocratie comme la Belgique montre l'exemple et la voie à suivre, notamment aux pays en transition vers la démocratie. La Belgique a depuis 1996, date de l'abolition officielle de la peine de mort, ratifié un bon nombre de protocoles internationaux allant tous dans la même direction: celle de l'abolition universelle de la peine de mort.
Le Parlement européen a lui adopté une résolution appelant à l'instauration d'un moratoire universel sur les exécutions capitales. Et le Conseil de l'Europe a, pour sa part, pu proclamer le 10 octobre "Journée européenne contre la peine de mort", et ce, malgré la seule opposition polonaise. Enfin, l'Assemblée des Nations Unies lui a emboîté le pas puisqu'une résolution appelant à un moratoire sur les exécutions, en vue d'une abolition totale de la peine de mort, a été adoptée le 18 décembre dernier.
En 2006, 1.591 prisonniers ont été exécutés dans 25 pays à travers le monde. C'est pour nous inacceptable. C'est pourquoi il faut encourager chaque initiative destinée à abolir la peine de mort et c'est pourquoi la reconnaissance officielle par la Belgique de la date du 10 octobre comme Journée contre la peine de mort est un pas important.
Je me réjouis que cette proposition de résolution ait été adoptée à l'unanimité en commission des Relations extérieures. Je compte sur vous, chers collègues, pour qu'il en soit de même lors de cette séance plénière.

Intervention outside of the micro
The death penalty is obvious. This is a reality in Belgium as in 133 countries around the world, but today there are still 64 countries and territories that maintain the death penalty and others that consider rehabilitating it under certain exceptional circumstances.
However, it has been proven, for many years now, that there is no link between the death penalty and the crime rate. The death penalty constitutes a brutal simulacre and revenge of justice, as the Secretary-General of the Council of Europe, Terry Davis, recalls very well.
It is therefore important for us that our country, that a democracy like Belgium shows the example and the path to follow, especially to countries in transition to democracy. Belgium has since 1996, date of the official abolition of the death penalty, ratified a number of international protocols all going in the same direction: that of the universal abolition of the death penalty.
The European Parliament adopted a resolution calling for a universal moratorium on executions. And the Council of Europe, for its part, was able to proclaim October 10 as "European Day Against the Death Penalty", despite only Polish opposition. The United Nations Assembly passed a resolution calling for a moratorium on executions, with a view to a total abolition of the death penalty, was adopted on December 18.
In 2006, 1.591 prisoners were executed in 25 countries around the world. This is unacceptable for us. This is why every initiative aimed at abolishing the death penalty must be encouraged and that is why the official recognition by Belgium of the date of 10 October as the Day against the death penalty is an important step.
I am pleased that this proposal for a resolution was adopted unanimously in the Committee on Foreign Relations. I count on you, dear colleagues, that it will be the same during this plenary session.

Mijnheer de voorzitter, collega’s, afwezige leden van de regering, ik zal de vorige spreker moeten ontgoochelen. Zij vroeg ons dit voorstel unaniem goed te keuren maar mijn fractie zal dat alvast niet doen. Mijn fractie zal zich onthouden. Ik wil toch even uitleggen op basis van welke redenering wij tot die conclusie gekomen zijn.
Eerst en vooral moet ik u bekennen dat wij het beu zijn om dagelijks geconfronteerd te worden met “de dag van iets”. Ik heb hier deze namiddag, zonder om het even wat te consulteren, heel even gewoon een beroep gedaan op mijn geheugen om u te vertellen welk soort dagen wij hier allemaal beleven in dit land. Er is de dag van de armoede, de dag van de democratie, de dikketruiendag, de dag van de vrouw, de dag van de myelo, de dag van het park, de dag van het openbaar vervoer, de dag over psoriasis, de dag van de fiets, de dag van de verdraagzaamheid, de dag tegen racisme, de dag voor aids, de dag van de vrede, de dag van de derde wereld, de autovrije zondag, de dag tegen homofobie en de dag van de derde leeftijd. Er zijn er nog veel meer. Ik neem mij voor, waarde collega’s, om eerlang een voorstel van resolutie in te dienen voor het invoeren van de dag van de gewone dag. Alleen al daarom beginnen wij echt sceptisch aan de behandeling van zo’n voorstel.
Ten tweede, waarde collega’s, zal niemand kunnen ontkennen dat wij inzake criminaliteit en inzake bestraffing van criminaliteit wel andere prioriteiten hebben dan het goedkeuren van zo’n vrome – het woord is niet te sterk – tekst die misschien heel mooi klinkt, maar voor het overige niets betekent en die vooral – neem het mij niet kwalijk –, wanneer men hem vergelijkt met de dagelijkse realiteit van de politiek, ook van dit land, bijzonder hypocriet is. Ik hoor jullie allemaal graag voorstellen om een dag tegen de doodstraf in te richten en die af te stemmen op de Europese dag tegen de doodstraf en, waarom niet, een werelddag tegen de doodstraf. Dat is allemaal heel mooi maar tegelijk laten wij toe dat de Olympische Spelen dit jaar plaatsvinden in een land dat als het ware de olympische kampioen is in het uitvoeren van doodstraffen.

I would like to hear all of you proposes to establish a day against the death penalty and to align it with the European day against the death penalty and, why not, a world day against the death penalty. That’s all very nice, but at the same time we allow this year’s Olympic Games to take place in a country that is the Olympic champion in executing the death penalty.

Volgens Amnesty International zou China zich veroorloven ongeveer 10.000 doodstraffen per jaar uit te voeren. Daarmee is het liedje bovendien niet uit. Wij mogen ons niet verzetten tegen de Olympische Spelen en wij mogen daar wel kritisch over zijn maar vooral niet te luid. Mijnheer de voorzitter, beste collega’s, ik ben een beetje laat voor het verslag maar ik wou toch nog de collega’s bedanken die in de commissie hebben meegewerkt om deze resolutie in de commissie unaniem goed te keuren. Ik denk dat wij vandaag wel een heel belangrijk signaal geven.
Wij zullen straks hopelijk – het Vlaams Belang heeft al aangekondigd dat het zich zal onthouden – toch wel een belangrijk signaal geven aan de rest van Europa. Wij gaan 10 oktober erkennen als de internationale dag tegen de doodstraf.
Collega’s, het allereerste voorstel dat ik hier indiende toen ik pas verkozen was, betrof het inschrijven in onze Grondwet van de afschaffing van de doodstraf. Dat is ondertussen gebeurd en ik ben er eigenlijk nog altijd heel fier op dat wij dat als land verankerd hebben uit vrees dat andere partijen het misschien opnieuw willen invoeren. Dit zal dan toch zeer moeilijk zijn, mijnheer Van den Eynde.
Er is veel meer aan de hand met dit. De internationale dag tegen de doodstraf kan ons helpen om andere landen ervan te overtuigen die wrede praktijken niet meer toe te passen. Op dit ogenblik is er een debat in verschillende landen gaande over het al dan niet afschaffen van de doodstraf. Een aantal landen heeft recent beslist om de doodstraf af te schaffen. Ik denk daarbij onder andere aan Gabon, Zuid-Korea en Oezbekistan.
Onze steun aan die internationale dag kan ons helpen. Ik denk dat wij een voortrekkersrol moeten spelen in die strijd. Het Handvest van de grondrechten heeft het daarover in artikel 2. Daar staat dat iedereen het recht heeft op leven, niemand wordt tot de doodstraf veroordeeld of terechtgesteld.
Collega’s, als liberalen voeren wij een strijd om die doodstraf wereldwijd af te schaffen. Wij denken dat een sanctie nemen door iemand het leven te ontnemen, door iemand ter dood te veroordelen, niet kan in deze 21ˢᵗᵉ eeuw. Sommigen zeggen dat het behouden van de doodstraf de daders afschrikt om wreedheden te plegen. Wij zien allemaal, collega’s, dat dit helemaal niet werkt. Erger nog, wij zien dat de evolutie van de medische apparatuur ons tot de conclusie doet komen dat sommige mensen die eigenlijk…
Voorzitter, het is echt heel moeilijk spreken op deze manier. Ik heb soms echt de indruk dat ik beter in de cafetaria kan gaan spreken dan hier in het Parlement.

Colleagues, the very first proposal I submitted here when I was just elected concerned the inscription in our Constitution of the abolition of the death penalty. That has happened in the meantime and I am actually still very proud that we have anchored it as a country out of fear that other parties might want to reintroduce it. This will be very difficult, Mr. Van den Eynde.
There is much more going on with this. The International Day Against the Death Penalty can help us to persuade other countries to stop using these cruel practices. Currently, there is a debate in several countries about abolishing or not abolishing the death penalty. A number of countries have recently decided to abolish the death penalty. I think of Gabon, South Korea and Uzbekistan.
Our support for that International Day can help us. I think we should play a leading role in this struggle. The Charter of Fundamental Rights refers to this in Article 2. It states that everyone has the right to life, no one is sentenced to death or executed.
Colleagues, as liberals, we are fighting to abolish this death penalty worldwide. We think that taking a sanction by taking someone’s life, by sentencing someone to death, cannot be done in this 21st century. Mijnheer de voorzitter, collega’s, zoals ik de vorige keer al zei, het is dankzij het puike optreden van de dienst Naturalisaties - ere wie ere toekomt - dat het dikke naturalisatieboek van 3.336 dossiers – vandaag valt er wellicht weer een af en als wij aan dit tempo blijven doorgaan, zullen er binnenkort niet veel meer overblijven – nog altijd in de schuif van de Koning ligt. Zo kunnen wij dus inderdaad nog via een reparatiewet verder onheil voorkomen. Mocht dat niet het geval zijn, dan weten wij dat wij nergens staan. Het fameuze artikel 23, de vervallenverklaring, functioneert namelijk niet. Het heeft nooit gefunctioneerd en het zal in de toekomst ook niet functioneren.
Zonder ten gronde over de inhoud van dit dossier te spreken, mijnheer de voorzitter, collega’s, wil ik toch enkele feiten op een rijtje zetten.
Het is dankzij informatie van het Vlaams Belang dat de bal aan het rollen is gegaan. Het is uw dienaar die de dienst Naturalisaties op de hoogte heeft gebracht van een mogelijk probleem. De dienst Naturalisaties heeft contact genomen met het parket van Brussel, dat, om het zacht uit te drukken, uit de lucht viel. Men hoorde het in Keulen donderen. Het is de dienst Naturalisaties die, met bijkomende informatie, daarna contact nam met het parket van Dendermonde, dat slechts over summiere, niet-recente informatie beschikte.
Pas na diepgaander onderzoek is de echte toedracht van de feiten bekendgeraakt. In dit verband wil ik toch even verwijzen naar mijn betoog op 24 april jongstleden, toen die dikke naturalisatieturf, waarin ook de betrokkene steekt, ter stemming lag. Mijnheer de voorzitter, collega’s, ik stel voor dat u die tekst er nog eens op naleest. Ik wees toen namelijk op het grote probleem bij een verhuis van een aanvrager van de nationaliteit. Dan loopt het helemaal fout. Niemand weet nog van iets. De parketten zijn dan als kippen zonder kop. Het loopt dus grondig mis bij de parketten. Er is geen enkele coördinatie. Er is geen enkele communicatie. Er is geen centraal register. Paars-groen en paars hebben er een puinhoop van gemaakt. Het is maar de vraag hoe en op welke termijn die rechtgezet kan worden door deze regering. Ik vrees er alvast voor.
Mijnheer de voorzitter, collega’s, de Kamercommissie treft in het concrete dossier geen schuld. De commissieleden hebben een oordeel geveld op basis van een tekort aan informatie, te wijten aan de parketten. De partijen van paars-groen uit het verleden en deze regering dragen wel een bijzonder grote verantwoordelijkheid. Ik hoop dan ook dat de commissieleden die het hart op de juiste plaats hebben, hun respectieve partijtoppen ervan kunnen overtuigen dat er bijzonder veel werk aan de winkel is.
Er moet dringend werk worden gemaakt van een centraal register, van een efficiënte coördinatie en communicatie tussen de parketten en binnen de parketten. Bovenal, mijnheer de voorzitter, collega’s, moet de snel-Belgwet worden aangepast, en wel drastisch. Dat is de essentie van de zaak. Het mag dus niet bij verkiezingsbeloftes blijven. The Naturalisations service contacted the parquet of Brussels, which, to put it gently, fell from the air. They heard it thunder in Cologne. It is the service Naturalisaties which, with additional information, then contacted the parquet of Dendermonde, which only had summary, non-recent information.
Only after a thorough investigation is the true significance of the facts revealed. In this context, I would like to refer, however, to my speech on 24 April last year, when that thick naturalization turf, which also includes the person concerned, was put to the vote. Mr. Speaker, I suggest that you repeat this text. In fact, I pointed out the big problem in the case of a resettlement of a applicant of the nationality. Then it goes completely wrong. No one knows anything yet. Parquets are like chickens without a head. Therefore, it is completely wrong with the parks. There is no coordination. There is no communication. There is no central register. Purple-green and purple have made a mess out of it. It is only a question of how and in what time this can be corrected by this government. I am afraid of it.
