Monsieur le président, chers collègues, la commission des Affaires sociales s'est réunie les 11 et 17 juin derniers pour examiner le projet de loi portant des dispositions diverses en relation avec les matières dont elle a à traiter, en l'occurrence un volet Affaires sociales et Santé publique et un volet Emploi.
Pour le volet Affaires sociales proprement dit, le projet de loi soumis contient deux chapitres. Un premier chapitre intitulé "Allocations familiales" concerne les articles 93 et 94. L'article 94, qui évoque les règles de perception des allocations familiales, dispose et ce, à la demande de l'ONAFTS, que lorsque l'identité de l'allocataire n'est pas clairement établie, ce soit l'attributaire, c'est-à-dire celui qui ouvre le droit aux allocations familiales pour l'enfant, qui les perçoit, l'objectif recherché étant d'éviter toute suspension du droit aux allocations familiales.
Cet article a suscité le même commentaire de la part de plusieurs commissaires, à savoir quelles personnes étaient visées par cette disposition. Et la ministre des Affaires sociales de répondre au travers d'exemples concrets qu'étaient visés tant les allocataires de l'Union européenne que ceux hors Union.
Le deuxième chapitre, intitulé "Maribel social" concerne les articles 95 et 96. La disposition vise à abroger l'ancien Fonds pour les hôpitaux et les maisons de soins psychiatriques et ce, en faveur d'un seul et unique Fonds Maribel social, compétent pour tous les employeurs du secteur public, l'objectif recherché étant de clarifier la législation.
Pour le volet Santé publique, le chapitre 2, qui concerne les articles 98 à 102, intitulé "Cotisations et contributions sur le chiffre d'affaires des spécialités pharmaceutiques", modifie le régime d'exonération et de réduction des cotisations pharmaceutiques dont peuvent bénéficier les firmes qui développent la recherche ou qui réduisent leurs dépenses en marketing en ce que, d'une part, il limite à six ans ces mesures de réduction et ce, au motif que la Commission européenne les considère comme des aides de l'État et, d'autre part, en ce que l'exonération promise aux sociétés qui commercialisent des dérivés stables de sang ne pourra être tenue au motif que la Commission européenne juge discriminatoire la distinction faite entre donneurs bénévoles et donneurs rémunérés.

Mr. Speaker, dear colleagues, the Social Affairs Committee met on 11 and 17 June to examine the bill containing various provisions in relation to the subjects it has to deal with, in this case a section Social Affairs and Public Health and a section Employment.
For the Social Affairs component itself, the draft law submitted contains two chapters. A first chapter, entitled ‘Family allowances’, relates to Articles 93 and 94. Article 94, which refers to the rules of collection of family allowances, provides that, at the request of the ONAFTS, only when the identity of the allocator is not clearly established, it is the allocator, that is, the one who opens the right to family allowances for the child, who receives them, the aim sought being to avoid any suspension of the right to family allowances.
This article sparked the same comment from several Commissioners, namely, which persons were covered by this provision. And the Minister of Social Affairs to respond through concrete examples that were targeted both the allocators of the European Union and those outside the Union.
The second chapter, entitled "Maribel social", relates to Articles 95 and 96. The provision aims to abolish the former Fund for Hospitals and Psychiatric Care Houses and this, in favor of a single Social Maribel Fund, competent for all employers in the public sector, with the aim of clarifying the legislation.
For the Public Health component, Chapter 2, which relates to Articles 98 to 102, entitled "Cotations and contributions on the turnover of pharmaceutical specialties", modifies the regime of exemption and reduction of pharmaceutical contributions from which companies that develop research or reduce their marketing expenses can benefit, in that, on the one hand, it limits these reduction measures to six years, on the grounds that the European Commission considers them as state aid and, on the other hand, in that the exemption promised to companies that market stable blood derivatives cannot be held on the grounds that the European Commission considers discriminatory the distinction made between volunteer donors and paid donors.

Mme De Block (Open Vld), M. Bonte (sp.a+Vl.Pro) et M. Bultinck (Vlaams Belang) s'inquiètent de ces modifications et questionnent la ministre sur ce qu'il est prévu de faire au terme des six ans, puisque pour les dérivés sanguins, la ministre a d'emblée évoqué une nouvelle disposition non sélective à prendre en concertation avec la Commission européenne. La ministre souhaite élaborer un autre régime qui puisse être agréé par la Commission européenne, sachant que le régime actuel vaut jusqu'en 2011.
Le chapitre 8, intitulé "Modification de la loi du 6 août 1990, relative aux mutualités et aux unions nationales des mutualités", concerne les articles 151 à 153. Il s'agit de modifications techniques à la suite de l'intégration des petits risques dans l'assurance obligatoire des travailleurs indépendants.
Pour le surplus, c'est-à-dire pour les chapitres 9 et 10, soit les articles 154 à 162, je renvoie au rapport écrit, s'agissant de dispositions techniques.
Les articles dont question ont tous été adoptés par 12 voix et une abstention, sauf l'article 98 qui a été adopté par 11 voix et 2 abstentions.
Pour le volet Emploi, il s'agissait d'examiner les articles 83 à 92 repris dans quatre chapitres. Le premier chapitre, intitulé "Accidents de travail", consacre les articles 83 à 86. Les articles 83 à 85 concernent les employeurs en défaut d'assurance et visent à ce que, lorsqu'un employeur est non assuré, l'accord conclu entre la victime d'un accident de travail et le Fonds des accidents de travail soit imposable à l'employeur, l'objectif étant d'éviter que les contestations formulées par l'employeur en défaut d'assurance ne conduisent à une révision de l'accord d'indemnisation.
L'article 86 concerne la rémunération des mousses et accorde aux mineurs d'âge et aux apprentis, en cas d'accident de travail à bord d'un navire, une indemnité égale à celle obtenue s'ils avaient été, au moment des faits, majeurs ou en fin de contrat d'apprentissage.
Le premier article purement technique du chapitre 2, intitulé "Dispositions diverses", est l'article 87 qui concerne les conventions collectives relatives aux groupes à risque. L'obligation de l'article 190, § 2, alinéa 2 est supprimée dans un souci de simplification administrative. Cette suppression de la référence aux groupes à risque est, selon M. Bonte (sp.a+Vl.Pro), préoccupante. Il craint que la position de ceux qui, dans le cadre des négociations syndicales, plaident en faveur des efforts pour ces groupes en soit affaiblie. Pour éviter cet effet non souhaitable de l'article 87, il dépose un premier amendement visant sa suppression. Cet amendement sera rejeté.
Les articles 88 à 91 concernent le secteur du diamant et visent à modifier la loi du 12 avril 1960 portant création d'un fonds de compensation interne pour le secteur du diamant, en fixant un montant maximum annuel de cotisation.

The articles in question were all adopted by 12 votes and one abstention, with the exception of Article 98, which was adopted by 11 votes and 2 abstentions.
For the Employment section, it was to examine Articles 83 to 92 in four chapters. The first chapter, entitled "Working Accidents", consists of Articles 83 to 86. Articles 83 to 85 relate to employers who are not insured and aim to ensure that, when an employer is not insured, the agreement concluded between the victim of a work accident and the Working Accident Fund is taxable to the employer, with the aim of avoiding that disputes made by the employer who is not insured lead to a revision of the compensation agreement.
Article 86 relates to the remuneration of mousses and grants minors and apprentices, in the event of a work accident on board a ship, compensation equal to that obtained if they were, at the time of the facts, major or at the end of a learning contract.
The first purely technical article of Chapter 2, entitled "Different Provisions", is Article 87, which relates to collective agreements relating to risk groups. The obligation of Article 190, § 2, paragraph 2 is deleted in order to simplify administrative procedures. This removal of the reference to the risk groups is, according to Mr. Bone (sp.a+Vl.Pro) is a serious problem. He fears that the position of those who, within the framework of trade union negotiations, advocate efforts for these groups will be weakened. In order to avoid this undesirable effect of Article 87, it deposits a first amendment aimed at its deletion. This amendment will be rejected.
Articles 88 to 91 relate to the diamond sector and aim to amend the law of 12 April 1960 establishing an internal compensation fund for the diamond sector by fixing an annual maximum amount of contribution.

L'article 91 prévoit, en outre, des amendes administratives applicables aux différents acteurs de l'industrie ou du commerce du diamant.
Par voie d'amendement, émanant de M. Prévot (cdH) et consorts, l'insertion au chapitre 2 de trois articles nouveaux 91.1, 91.2, 91.3 consacrant des avantages non récurrents liés aux résultats pour les travailleurs intérimaires suscite chez M. Gilkinet (Écolo-Groen!) mécontentement et désapprobation quant la méthode de travail adoptée qu'il qualifie d'incohérente et peu démocratique. La ministre de l'Emploi souligne que ces dispositions visent à assurer une égalité de traitement entre les travailleurs intérimaires et les travailleurs permanents.
M. Bonte (sp.a+Vl.Pro) dépose dans la foulée un second amendement visant à insérer les articles 91.1 et 91.2 nouveaux relatifs à l'exonération du bonus de l'emploi de l'impôt des personnes physiques et des modalités y afférentes.
L'article 92, qui vise à octroyer une prime de reprise de travail à tout chômeur et non plus exclusivement au chômeur âgé, repris dans le chapitre 3, a suscité de nombreuses réactions de la part des commissaires. M. Bonte (sp.a+Vl.Pro), Mme Smeyers (CD&V - N-VA) et M. Vercamer (CD&V - N-VA) qui parlent à tour de rôle de confusion, s'interrogent d'une manière générale sur la question de savoir si la prime de reprise de travail se substitue ou se superpose à la prime de mobilité.
Confusion encore sur le titre du chapitre lui-même erronément intitulé "Complément de mobilité de garde d'enfants"; il conviendra de lire "Complément de mobilité et de garde d'enfants". À ce sujet Mme Reuter (MR) préconise une augmentation du nombre de places d'accueil plutôt que de prévoir une prime pour les familles monoparentales. Quant à Mme De Maght (LDD), qui qualifie la mesure à l'examen d'inefficace et d'irréfléchie, elle dépose un amendement visant à supprimer l'article en projet, amendement qui sera rejeté. La ministre de l'Emploi rétorque que cette prime ouvre diverses perspectives qui seront débattues lors de la Conférence interministérielle prévue le 14 juin.
M. Bonte (sp.a+Vl.Pro) dépose un amendement n° 3 visant à insérer un chapitre 4 nouveau comprenant les articles 92.1, 92.2 et 92.3 intitulé "Renforcement du bonus à l'emploi", amendement qui sera rejeté.

Je souhaiterais en effet intervenir brièvement – une fois n'est pas coutume – sur quelques éléments qu'il nous paraît important de relever à l'occasion de ce débat relatif à des amendements apportés au projet.
Le premier point concerne le fonds d'impulsion pour la médecine générale.
L'amendement vise à réécrire une base légale du fonds Impulseo pour préciser son objectif et répondre à une remarque fondamentale du Conseil d'État.
Partant du constat que la médecine générale doit impérativement faire l'objet d'une attention particulière, de nombreux orateurs se sont déjà exprimés en séance plénière à ce sujet.
Le fonds Impulseo a été créé pour stimuler les médecins généralistes à exercer ou à continuer d'exercer la médecin générale. Ainsi Impulseo I est né et a consisté en une intervention pour l'encouragement de l'installation de jeunes médecins généralistes ou une intervention pour l'installation de médecins généralistes dans des zones prioritaires ou à faible densité médicale.
Impulseo II est sur les rails. Il consistera en une intervention à l'attention des médecins généralistes qui sont regroupés et qui souhaitent développer ensemble un appui logistique, une aide administrative.
Enfin, Impulseo III pourra, avec cette nouvelle base légale, être envisagé par exemple au profit des médecins généralistes travaillant seuls.
Nous voulons saluer cet objectif politique global de soutien à la médecine générale qui est, à nos yeux, indispensable au maintien d'une médecine de proximité accessible et de qualité. Que ce soit dans les zones rurales, dans les quartiers difficiles mais aussi de manière plus générale, l'attractivité de la médecine générale doit rester une préoccupation constante.

I would indeed like to speak briefly – once it is not customary – on a few points that we consider important to highlight during this debate on amendments to the draft.
The first point concerns the Impulse Fund for General Medicine.
The amendment aims to rewrite a legal basis for the Impulseo Fund to clarify its purpose and respond to a fundamental comment from the State Council.
Based on the conclusion that general medicine must necessarily be the subject of special attention, many speakers have already expressed themselves in plenary session on this subject.
The Impulseo Fund was created to encourage general practitioners to practice or continue to practice general practitioner. Thus Impulseo I was born and consisted of an intervention to encourage the installation of young general physicians or an intervention for the installation of general physicians in priority areas or low medical density.

En second lieu, je souhaiterais aborder le report de l'entrée en vigueur de la loi du 21 avril 2007 désignant les représentants des infirmières à domicile à la commission de convention infirmiers-organismes assureurs.
Le groupe MR est conscient des difficultés liées à la mise en œuvre de cette loi, mais est aussi conscient du fait que, pour faire appliquer cette loi, il faut une volonté politique, madame la ministre. Depuis plus de vingt ans, la problématique de la représentativité des infirmières, et des infirmières indépendantes en particulier, fait l'objet de nombreuses discussions. Si la question de la représentativité au sein de la commission de convention se pose, c'est justement, quoi qu'en disent certains, que la composition actuelle ne correspond pas suffisamment au paysage infirmier. C'est la raison pour laquelle le Mouvement réformateur plaide pour que tout soit mis en œuvre afin de respecter enfin la loi votée sous la précédente législature.
Pour terminer, madame la ministre, je souhaiterais attirer votre attention sur un courrier que nous avons reçu du Conseil national de l'Ordre des pharmaciens sur la disposition en projet, visant à garantir la continuité des soins pharmaceutiques et l'obligation de participation au service de garde imposé à toutes les officines pharmaceutiques. Le Conseil national de l'Ordre des pharmaciens souhaite ne pas être écarté du processus d'élaboration des règles relatives au service de garde.
Pouvez-vous, madame la ministre, nous confirmer que vous associerez l'Ordre des pharmaciens lors de l'élaboration de cette réglementation?

Secondly, I would like to address the postponement of the entry into force of the law of 21 April 2007 appointing the representatives of nurses at home to the nurses-insurance organizations convention committee.
The MR group is aware of the difficulties associated with the implementation of this law, but is also aware of the fact that, to enforce this law, political will is needed, Mrs. Minister. For more than twenty years, the problem of representativity of nurses, and independent nurses in particular, has been the subject of many discussions. If the question of representativity within the convention committee arises, it is precisely, whatever some say, that the current composition does not correspond sufficiently to the nursing landscape. That is why the Reform Movement pleads for everything to be implemented in order to finally respect the law passed in the previous legislature.
Finally, Mrs. Minister, I would like to draw your attention to a letter we received from the National Council of the Order of Pharmacists on the proposed provision, aimed at guaranteeing the continuity of pharmaceutical care and the obligation to participate in the custody service imposed on all pharmaceutical offices. The National Council of the Order of Pharmacists wishes not to be disengaged from the process of developing the rules relating to the custody service.
Can you, Mrs. Minister, confirm to us that you will associate the Order of Pharmacists with the drafting of this regulation?
The MR Group wants you to take a firm commitment in this regard. You know, as with other subjects in the sector, we give priority attention to the consultation of field actors.

Volgende week, op 14 juli, gaat normaal gezien een interregionale banenconferentie van start, waarbij de interregionale mobiliteit een belangrijk aandachtspunt zal zijn. Toch moeten wij hier vandaag al een wet goedkeuren die eigenlijk carte blanche geeft aan de minister van Werk, van wie wij allemaal weten, Vlaamse collega’s, met welke ideeën zij speelt, als zij het heeft over de bevordering van de interregionale mobiliteit. Ik verwijs hierbij naar haar concrete invulling van de door haar gesuggereerde mobiliteitspremies.
Ik heb het vorige week nog gezegd tijdens het vragenuurtje in de Kamer, zelfs de partijen die in de kranten hevig van leer trokken tegen deze mobiliteitspremie – ik heb het in het bijzonder over de collega’s van CD&V - N-VA – hebben in de comissie, mijnheer Vercamer, eigenlijk hun zegen aan de minister al gegeven. Met een eenvoudig KB kan zij de zaak operationeel maken, volgens haar eigen inzichten.
Mijnheer Vercamer, ik had graag ook uw collega van de N-VA, mevrouw Smeyers, aangesproken, maar waarschijnlijk is zij nog onder de indruk van de uitbrander die zij zopas heeft gekregen van de fractievoorzitter van CD&V, de heer Verherstraeten, in het kader van een ander dossier. Ik had mij graag rechtstreeks tot haar gericht, want vorige week hebben wij hier tijdens het vragenuurtje gesproken over het rapport van de Sociaal-Economische Raad van Vlaanderen, die een aantal aanbevelingen had gedaan in het kader van de interregionale banenconferentie van 14 juli. Daaruit bleek dat de SERV helemaal niet was gewonnen voor een federaal gestuurde politiek, met premies allerhande om de interregionale mobiliteit, waarover dezer dagen zoveel te doen is, te vergroten.
Ik zal de argumenten van de Sociaal-Economische Raad niet herhalen, maar het ging meer bepaald over meer taalopleidingen, een beter vervoersaanbod van en naar de bedrijventerreinen en, vooral, een beter onthaal voor de Waalse werknemers in Vlaamse bedrijven.
Bovendien, collega’s, is er een belangrijk sociaaleconomisch luik – zo zou het tenminste moeten zijn – in de communautaire onderhandelingen, die nu aan de gang zijn en binnen 14 dagen hun beslag zouden moeten krijgen. De arbeidsmarkt – dat is een van jullie stokpaardjes – zou daarbij worden geregionaliseerd. Dat hebben vele partijen voor de verkiezingen althans aan de Vlaamse kiezers beloofd.

I said last week during the questioning hour in the Chamber, even the parties that in the newspapers heavily learnt against this mobility premium – I spoke in particular about the colleagues of CD&V – N-VA – have in the committee, Mr. Vercamer, actually already given their blessing to the minister. With a simple KB, she can make the matter operational, according to her own insights.
Mr. Vercamer, I would have liked to have addressed your colleague of the N-VA, Mrs. Smeyers, too, but she is probably still impressed by the burner she has just received from the group chairman of CD&V, Mr. Verherstraeten, in the context of another file. I would like to address her directly, because last week we spoke here during the questionnaire about the report of the Social and Economic Council of Flanders, which had made a number of recommendations within the framework of the interregional job conference of 14 July. This showed that the SERV was not at all won for a federal-led policy, with premiums of all kinds to increase interregional mobility, which these days has so much to do.
I will not repeat the arguments of the Socio-Economic Council, but it was more specifically about more language training, a better transport offer from and to the business areas and, above all, a better welcome for the Wallish workers in Flemish companies.
Furthermore, colleagues, there is an important socio-economic gap – at least it should be – in the Community negotiations, which are now underway and should be filled within 14 days. The labour market – which is one of your puppets – would be regionalized. That was promised by many parties before the elections, at least to the Flemish voters.

Collega’s van de CD&V en vooral van de N-VA, ik ga er dan ook van uit dat jullie ja-stem in de commissie een vergissing was, dat jullie min of meer om de tuin werden geleid en door de minister werden misleid door de manier van werken tijdens de behandeling van de wet houdende diverse bepalingen.
Immers, collega’s, u zal het moeten toegeven. De N-VA oppert dat zij zich tijdens de stemming van de beleidsbrief van de minister van Werk, uitdrukkelijk omwille van de mobiliteitspremie, heeft onthouden. Trouwens, leden van de N-VA, mevrouw Smeyers verklaarde dat hier nog vorige week tijdens de plenaire vergadering. Anderzijds keurt u tezelfdertijd de wet goed die de minister de volmacht geeft om de mobiliteitspremies volgens haar eigen inzichten, die voor Vlaanderen nefast zijn, te realiseren. Daardoor rijst op zijn minst een probleem van geloofwaardigheid.
Collega’s, ik kijk dan ook met veel belangstelling uit naar uw stemgedrag later deze avond.
Ik zou trouwens graag de minister, die intussen is toegekomen, willen vragen hoe het overleg met de gewestelijke collega’s is verlopen.
Mevrouw de minister, tijdens de vergadering van de commissie voor de Sociale Zaken op 17 juni 2008 kondigde u immers aan dat u de week nadien gesprekken met uw regionale collega’s zou voeren. Wat was het resultaat van voornoemde gesprekken? Het resultaat zou mij bijzonder interesseren.
Collega’s, in ieder geval zullen wij met veel overtuiging tegenstemmen. Voor ons is het voorliggende ontwerp immers niet alleen een voorafname op de communautaire besprekingen en gesprekken die nu lopende zijn of lopende zouden moeten zijn. Wij wensen evenmin een blanco cheque te geven aan een minister die van zichzelf zegt dat zij op de ideale positie zit om een regionalisering van de arbeidsmarkt tegen te houden.
Collega’s, in plaats van een regionalisering van delen van het arbeidsmarktbeleid zullen wij nu een federale recuperatie goedkeuren. Dat is niet de ideale weg en strookt niet met de beloftes die wij aan de Vlaamse kiezer hebben gedaan.

This leads to at least a credibility problem.

During the meeting of the Social Affairs Committee on 17 June 2008, you announced that you would have talks with your regional colleagues the week after. What was the outcome of the aforementioned discussions? The result would be of particular interest to me.
In any case, we will vote against it with great conviction. For us, the present draft is not merely an advance of the community discussions and discussions that are now ongoing or should be ongoing. Nor do we want to give a blank cheque to a minister who says of himself that he is in the ideal position to stop a regionalization of the labour market.
Colleagues, instead of a regionalization of parts of labour market policy, we will now approve a federal recovery. This is not the ideal path and does not comply with the promises we made to the Flemish voters.

Monsieur le président, chers collègues, dans le cadre de ces lois portant des dispositions diverses, je voudrais souligner deux aspects.
Le premier est la mise en place d'un système d'avantages non récurrents liés aux résultats pour les entreprises publiques autonomes. Ce point mérite d'être relevé parce qu'il revêt une importance capitale: il répond à une attente légitime des travailleurs. À l'heure où l'on tente de responsabiliser les dirigeants des entreprises publiques en liant leurs rémunérations à la réalisation d'objectifs, une mesure similaire pour les travailleurs était nécessaire. Ce sont en effet les travailleurs de nos entreprises publiques qui, depuis des décennies, rendent un service important à une population tout entière. Ils sont souvent très attachés à leur métier et se sentent reconnus dans l'exercice d'une fonction au service de nos concitoyens. Ils participent aussi chaque jour à la bonne santé financière des poids lourds de notre économie que sont notamment le Groupe SNCB, La Poste ou Belgacom. Leur octroyer un avantage financier lorsque l'entreprise engrange des bénéfices, comme c'est actuellement le cas, et atteint des résultats objectifs n'est que la concrétisation du remerciement qui leur est dû pour les efforts qu'ils ont dû fournir, notamment pour améliorer les performances de toutes ces entreprises publiques.
En conséquence, mon groupe et moi-même ne pouvons que nous réjouir d'une telle disposition qui permettra certainement à nos entreprises publiques de rester un des éléments fondamentaux de notre économie nationale.
Un deuxième point qui a retenu mon attention, dans le cadre de ces lois portant des dispositions diverses, est la création du Secrétariat polaire. Dans le contexte de l'année polaire internationale 2007-2008, la Belgique a mandaté l'International Polar Foundation (IPF) pour concevoir et construire la nouvelle station de recherche antarctique belge "Princesse Elisabeth Antarctica". Vitrine technologique et projet emblématique pour la promotion d'une meilleure compréhension des changements climatiques, la station Princesse Elisabeth donnera une visibilité sans précédent à l'engagement des citoyens et des entreprises belges.

In the context of these laws containing various provisions, I would like to highlight two aspects.
The first is the establishment of a system of non-recurring performance-related benefits for autonomous public enterprises. This point deserves to be highlighted because it is of paramount importance: it responds to a legitimate expectation of the workers. At a time when attempts to empower managers of public enterprises by linking their wages to the achievement of objectives, a similar measure for workers was needed. It is indeed the workers of our public enterprises who, for decades, have rendered an important service to an entire population. They are often very attached to their profession and feel recognized in the exercise of a function in the service of our fellow citizens. They also participate every day in the good financial health of the heavyweights of our economy such as the SNCB Group, La Poste or Belgacom. Giving them a financial advantage when the company generates profits, as is currently the case, and achieves objective results is only the concrete realization of the gratitude due to them for the efforts they have had to provide, in particular to improve the performance of all these public enterprises.
As a result, my group and myself can only welcome such a provision that will ⁇ allow our public enterprises to remain one of the fundamental elements of our national economy.
A second point that has caught my attention, within the framework of these laws with various provisions, is the creation of the Polar Secretariat. In the context of the International Polar Year 2007-2008, Belgium has mandated the International Polar Foundation (IPF) to design and build the new Belgian Antarctic research station "Princess Elisabeth Antarctica". Technological showcase and emblematic project for promoting a better understanding of climate change, the Princess Elizabeth resort will give unprecedented visibility to the commitment of Belgian citizens and ⁇ .

Il s'agit d'une réalisation majeure pour la Belgique et pour la communauté scientifique internationale. Les techniques mises en œuvre comprennent le recyclage des eaux usées ainsi que l'utilisation de technologies de construction sophistiquées et le recours exclusif aux sources d'énergies renouvelables. L'objectif est d'atteindre l'efficacité énergétique et de réduire les émissions de gaz à effet de serre pour contribuer à la sauvegarde de notre environnement. Cette station permettra des expérimentations dans différents domaines de recherche comprenant la météorologie, la sismographie, la glaciologie, le magnétisme terrestre, la concentration d'aérosols.
Le réchauffement climatique est clairement dans l'actualité et la récente conférence de Bali a mis les pays devant leurs responsabilités, avec un calendrier pour obtenir un consensus sur les actions à mener dans l'après Kyoto.
La connaissance du climat, la modélisation des impacts du réchauffement global, la définition des actions correctives à mettre en place reposent en grande partie sur les résultats de la recherche et des observations dans les régions polaires.
La Belgique a une longue tradition polaire et elle est un des signataires fondateurs du Traité Antarctique. Nous nous trouvons, depuis le 1ᵉʳ mars dernier, dans la quatrième année polaire internationale.
Les équipes de conception et de construction de la station sont l'exemple même de l'esprit de solidarité qui anime le projet. On y retrouve de nombreux exemples de collaboration exemplaire: public, public/privé, militaire, régions belges, et autres pays. La réponse du public lors de l'inauguration de l'exposition de la station à Tour & Taxis est tout aussi significative.
Une grande partie des citoyens sont conscients de la situation et veulent s'impliquer dans la lutte contre le réchauffement climatique. Même certains sceptiques peu concernés par le sujet reconnaissent une valeur à cette initiative.
Le projet livre un message d'action et d'espoir, un message d'optimisme raisonné qui démontre qu'il est possible d'atteindre des buts ambitieux.

Unique in its design and operation, this Princess Elizabeth station will be the first zero-emission scientific station built in Antarctica. Global warming is clearly in the news and the recent Bali conference has put countries ahead of their responsibilities, with a timetable to reach consensus on actions to be taken in post-Kyoto.
Climate knowledge, modeling of the impacts of global warming, and defining corrective actions to be implemented are largely based on the results of research and observations in polar regions.
Belgium has a long polar tradition and is one of the founding signatories of the Antarctic Treaty. On March 1st, we have entered the fourth International Polar Year.
The design and construction teams of the station are the very example of the spirit of solidarity that animates the project. There are many examples of exemplary collaboration: public, public/private, military, Belgian regions, and other countries. The public response at the opening of the station exhibition at Tour & Taxis is equally significant.
A large proportion of citizens are aware of the situation and want to get involved in the fight against global warming. Even some sceptics not concerned with the subject recognize a value to this initiative.
The project delivers a message of action and hope, a message of reasoned optimism that demonstrates that it is possible to ⁇ ambitious goals.

Monsieur le président, nous avons eu l'occasion d'échanger des propos au sujet des différents articles concernant la santé au sein de la commission. Je ne reviendrai pas sur ces différentes interventions, à part sur le point suivant. Vous savez que, dans les projets de loi portant des dispositions diverses, nous travaillons toujours trop vite et avec de nombreux articles situés au milieu d'autres. Parfois, il est donc nécessaire de prendre du recul pour entendre ce que nous disent les personnes issues du terrain. Par ailleurs, nous nous trouvons dans un contexte politique dans lequel les propositions et les projets de loi isolés ont peu de chance de parvenir en phase finale des travaux parlementaires. Nous le voyons depuis plusieurs mois déjà.
Madame la ministre, après le vote des articles en commission, nous avons été interpellés par l'Ordre des pharmaciens. Je ne suis pas particulièrement adepte du formalisme avec des organismes tels que les ordres. Néanmoins, et M. Flahaux en a dit un mot tout à l'heure également, leur argumentation est la suivante. Aujourd'hui, c'est le Conseil national de l'Ordre des pharmaciens qui gère l'organisation des gardes des officines pharmaceutiques et qui en établit les règles et les principes. Parmi cet ensemble de mesures se trouvait un chapitre relatif aux droits d'auteur, sur lequel il est inutile que je m'exprime très longuement, puisqu'il a finalement été décidé en commission, sur proposition de la majorité, de simplement retirer intégralement ce chapitre des dispositions diverses.

Nous avons donc déposé en commission un amendement sur la copie privée.

Zelfs het gewraakte voluntarisme van de vorige premier is weer helemaal terug, alhoewel nu in de vorm van blind optimisme. Of wat moeten we denken van een premier, een eerste minister, die meent dat hij tegen 15 juli zowel nieuwe sociale als economische maatregelen kan afdwingen, een energiebijdrage van Suez-Electrabel zal verkrijgen, de diplomatieke verhoudingen met Congo zal herstellen en meteen ook eventjes de communautaire problemen zal oplossen? Het schouwspel dat wij eerder hebben gezien bij de vraag rond asiel binnen de meerderheid, doet alvast niet al te veel fraais vermoeden.
Na al die zaken – die lijst is helemaal niet exhaustief – zien we vandaag opnieuw een door de vroegere CD&V o zo gehaat relict uit het verleden terugkeren: de vuilbakwetten. De vuilbakwetten, waarover zowel de heer Verherstraeten, die hier nu zit, als de heer De Crem, die nu minister is, in het verleden zoveel ophef maakten. De heer De Crem heeft in 2002 zelfs een wetsvoorstel ingediend om de regering te verplichten geen programmawetten meer voor te schotelen aan het Parlement, omdat zij steeds meer werden vervuild door maatregelen die er niet in thuishoorden.
Ik weet het wel, het voorliggende wetsontwerp houdende diverse bepalingen, deel I, is stricto sensu geen programmawet, maar zij is wel een vergaarbak van de meest uiteenlopende maatregelen, gaande van matrozen tot auteursrecht.

Ditmaal geen dringende bepalingen, maar net als bij de programmawet een amalgaam van maatregelen. Een amalgaam van maatregelen waarbij de Raad van State voor verschillende ervan een advies heeft uitgebracht, letterlijk om ze uit de vuilnisbakwet te halen. Op die manier zouden ze kunnen worden ondergebracht in een afzonderlijk wetsontwerp met een opschrift dat aansluit bij de inhoud ervan. Dat laat toe om de wetten zelf degelijk te bespreken en tegemoet te komen aan het principe van goed bestuur en respect voor de democratie, zodat een duidelijk, helder en transparant parlementair debat kan worden gevoerd.
De kritiek van de Raad van State betreft onder andere de bepalingen van hoofdstuk 5 over de slapende rekeningen. Dit platform voor de opslag van patiëntengegevens maakt immers gebruik van het Rijksregisternummer en er bleven nog heel wat vragen over de garantie op bescherming van de privacy van burgers. Bovendien werden de artsen noch de patiëntenverenigingen geconsulteerd. Wat ons betreft, is het onaanvaardbaar dat een dergelijke tekst, met zo’n impact op het leven van burgers en met dergelijke verstrekkende ethische gevolgen überhaupt in een wet houdende diverse bepalingen zit.
Collega’s, een regering is er om te regeren en de oppositie is er om oppositie te voeren. Dat is het basisbeginsel van een parlementaire democratie. Deze regering heeft blijkbaar besloten dat regeren niet meer van belang is. Wat moeten wij anders denken van de hele saga over de auteursrechten? Reeds jaren vraagt de sector om een verduidelijking van de regels en om een betere en meer uitgebreide reglementering, onder andere van de vergoeding voor het thuiskopiëren. De regering werkt zelfs samen met de sector om in het najaar tot een nieuwe wetgeving rond auteursrechten en beheersvennootschappen te komen. Toch schrijft zij in haar wetsontwerp houdende diverse bepalingen, deel I, een hoofdstuk over de auteursrechten in, dat niet werd besproken met de betrokkenen, dat niet door de sector wordt gedragen en dat de thuiskopie ook niet behandelt. The government is even working with the industry to come up with a new legislation on copyright and management companies in the autumn. Nevertheless, in its draft law containing various provisions, part I, it enters a chapter on copyright, which has not been discussed with the interested parties, which is not carried out by the sector and which does not deal with the home copy. However, the industry strongly opposes this proposal.

Wij vinden het als groenen onze taak over het schaarse wetgevende werk van deze verlamde regering te waken. Wij hadden niet eens veel discussie nodig om de meerderheidspartijen in de commissie alweer tegen elkaar te zien strijden. Omdat de hoogdringende vraag naar een betere regeling voor de thuiskopie niet in het hoofdstuk stond, hebben wij zelf een amendement ingediend dat de sector uit de nood kon helpen. Maar, zoals mijn voorganger, de heer Henry, daarnet al aangaf: dat amendement werd niet aanvaard door de meerderheid.
Wat zien wij wel? De PS en MR namen de tekst over en dienden die daarna in als wetsvoorstel. Il faut le faire! Met de aanpak en de voorstelling van onderhavige wet op de diverse bepalingen heeft de regering alvast een kans laten schieten. Opnieuw en opnieuw en opnieuw! Laten wij hun vandaag een duidelijk signaal geven. Ik zie dat het u niet interesseert, en dat hebben wij ook gezien in de commissies. Ik merk hoezeer u last hebt van geheugenverlies. We consider it as Greens to guard our duty over the scarce legislative work of this paralyzed government. It is time for some more good practices in Parliament. With the approach and presentation of this law on the various provisions, the government has already given a chance. Again and again and again! Monsieur le président, tout d'abord, sur le fond, je voudrais faire une remarque au sujet du volet "Emploi" des dispositions diverses. En l'occurrence, Mme Lecomte a très bien rappelé dans son rapport que j'ai souhaité introduire un amendement – je remercie mes collègues de m'avoir suivi dans cette démarche – pour répondre à une demande du Conseil central de l'économie et du Conseil national du Travail. Ils avaient souhaité qu'on puisse prendre les mesures nécessaires en concertation avec les organisations représentées au sein de la commission paritaire pour le travail intérimaire, pour assurer un traitement similaire des travailleurs intérimaires et des travailleurs "permanents" en matière d'avantages non récurrents liés aux résultats. C'était une demande aussi légitime que formulée de longue date, à laquelle il était important que cette assemblée puisse répondre. L'occasion de le faire a été trouvée dans les dispositions diverses.
Pour rappel, les avantages non récurrents sont liés aux résultats collectifs d'une entreprise établis sur la base de critères objectifs. Ils sont octroyés par l'employeur pour un montant maximal de 2.200 euros par an sur lesquels seule une cotisation patronale de 33% du montant est due, ce qu'il est important de souligner. Le travailleur bénéficiant de ces avantages non récurrents ne doit pas payer la moindre cotisation de sécurité sociale sur ceux-ci.
Dès que cette assemblée aura adopté ces dispositions proposées par amendement, les travailleurs intérimaires seront sur un pied d'égalité avec les travailleurs "permanents" de l'entreprise souhaitant faire appel à leurs services en termes d'avantages non récurrents liés aux résultats. Cette dernière informera la société d'intérim des modalités pratiques de l'octroi de ces avantages et dès qu'ils rempliront les conditions de l'octroi d'avantages équivalents, les intérimaires en bénéficieront dans la même mesure et au même titre qu'un travailleur ordinaire. C'est une amélioration sensible voulue par le secteur. C'est un signe que les contrats d'intérim sont davantage que des pis-aller comme on a parfois tendance à les présenter. Au contraire, la classe politique devrait porter plus d'attention à ce secteur et lui apporter son soutien.

Or, dramatiquement, les statistiques montrent toujours que les intérimaires sont plus souvent victimes d'accidents du travail que n'importe quelle autre catégorie de travailleurs. Mijnheer de voorzitter, collega’s, ik wil dieper ingaan op de artikelsgewijze bespreking van het wetsontwerp dat vandaag ter stemming voorligt. Via artikel 88, voorheen artikel 92, mobiliteitstoeslag en kinderopvangtoeslag, is het vandaag blijkbaar de bedoeling van de regering om de geografische mobiliteit te bevorderen. Hiervoor wordt dan ook een enveloppe uitgetrokken van 5 miljoen euro en dit om de mobiliteit van werkzoekenden te verhogen, onder meer in het raam van activering en hervorming.
De twee aangehouden redenen, namelijk activering en hervorming, zijn zeer belangrijk. Vandaag blijkt immers dat het huidige systeem voor de toekenning van deze premies weinig succes kent. In praktijk werden er 28 mobiliteitstoeslagen en 273 kinderopvangtoeslagen betaald in 2007. Het voorstel dat vandaag ter tafel ligt is een omvorming van de jaarlijkse eenmalige premie naar een maandelijkse toelage.
Begrijpe wie begrijpen kan, want de kinderopvang is een gewestelijke materie. Komt het dan niet ook de Gewesten toe om in een premie te voorzien indien deze zo noodzakelijk is?
Er wordt gepleit voor de regionalisering van de arbeidsmarkt. Wat wordt het nu? Regionalisering van de arbeidsmarkt? Uit dit voorstel blijkt immers een herfederalisering.
De minister heeft nochtans zelf voorgesteld om op 14 juli eerstkomende met betrekking tot de problematiek in het raam van de mobiliteitspremie een overleg te organiseren met de Gewesten. Ik stel mij dan de vraag waartoe dit overleg dient als de minister er onmiddellijk in de commissie op laat volgen dat dit in feit een federale materie is, dat zij voor deze premies kan en zal beslissen door middel van een KB, dat zij dus de consultatie van de Gewesten gaat doen zonder enigerlei waarde en dat zij daarmee blijkbaar geen rekening gaat houden in uitvoering van de wet die vandaag ter stemming voorligt.

Voorts geeft de minister aan dat de mobiliteit van de werkloze werkzoekende zowel intraregionaal als interregionaal moet worden verbeterd. Uit de toelichting blijkt dat het voorliggend artikel niets te maken heeft met werkhervatting maar alles met het belonen van bepaalde werksituaties binnen afgebakende criteria. We kunnen dus stellen dat de voorgestelde maatregel van de regering ondoordacht en inefficiënt is en daarenboven ook nog discriminerend. De voorgestelde doelstelling in het bijzonder het bevorderen van de flexibiliteit van de werkloze werkzoekende via mobiliteit en kinderopvang moet, ons inziens, worden bereikt door het invoeren van andere maatregelen vooral op het vlak van de fiscaliteit. We gaan er dan ook van uit dat onze collega’s van de N-VA ons voorstel om dit artikel te schrappen zeker gaan volgen. Dat wat betreft de mobiliteitstoelage en de kinderopvangtoeslag.
Wat de kinderbijslag betreft, artikel 92, voorheen artikel 94, zet dit de deur open voor sociale fraude. Er is onvoldoende garantie dat indien vooralsnog zou blijken dat de identiteit van de bijslagtrekkende moeder niet kan worden bewezen omdat het gaat om een frauduleuze aanvraag van kinderbijslag de gestorte sommen kunnen worden teruggevorderd van de rechthebbende die ze in toepassing van de wijziging die vandaag wordt voorgesteld, zou kunnen ontvangen. Het houdt ook een risico in voor de bijslagtrekkende moeder. Het is niet ondenkbaar dat een moeder op het ogenblik waarop ze haar identiteit wel kan bewijzen omwille van familiale, sociale of culturele redenen deze aanvraag niet meer schriftelijk kan, wil of zelfs durft ondertekenen. Met andere woorden, het risico bestaat dat de financiële afhankelijkheid van een moeder-nieuwkomer – want daarvoor is het voorstel uiteindelijk bedoeld – wordt versterkt door de voorgestelde wijziging.
De minister stelt dus vandaag dat de administratieve diensten – dat heeft zij ook bevestigd in de commissie – aan deze problematiek niet kunnen tegemoetkomen. Vandaar dat het voorstel via deze wet houdende diverse bepalingen moet worden aangepast. Wij pleiten uiteraard voor een goede besteding van overheidsmiddelen. Collega Van de Velde heeft daar ook al dikwijls op gehamerd. Dat is zeer belangrijk, zelfs noodzakelijk. Ik denk dat het hier dan ook meer op zijn plaats zou zijn als er een reorganisatie komt van de dienst. Met alle respect voor de inspanningen die deze mensen vandaag leveren maar als de minister vandaag bevestigt dat er een probleem is om aan die zaken tegemoet te komen voor mensen die hun identiteit niet kunnen bewijzen, dan heeft het zeer weinig zin om die wet vandaag aan te passen. Het is dan in feite de administratie die een beetje moet bijsturen waar het kan om aan die problematiek tegemoet te komen. Wat ons betreft, is ook dit artikel overbodig. Wij pleiten er dan ook voor om zowel artikel 88 als artikel 92 weg te laten in het wetsontwerp dat ter stemming voorligt.

It also poses a risk for the supporting mother. It is not unthinkable that when a mother can prove her identity for family, social or cultural reasons, she is no longer able, willing or even daring to sign this application in writing. In other words, there is a risk that the financial dependence of a mother-newcomer – for this is the ultimate purpose of the proposal – will be reinforced by the proposed amendment.
The Minister thus argues today that the administrative services – which she has also confirmed in the committee – cannot address this problem. Therefore, the proposal must be amended through this law containing several provisions. We advocate for the proper use of public funds. Colleague Van de Velde has also often hammered on this. This is very important, even necessary. I think it would be more appropriate here if there is a reorganization of the service. With all respect for the efforts these people make today but if the minister today confirms that there is a problem in addressing those issues for people who cannot prove their identity, then it makes very little sense to amend that law today. It is then, in fact, the administration that needs to guide a little where it can address this problem. This article is also superfluous. We therefore advocate for the removal of both Article 88 and Article 92 in the draft law that is put to the vote.

Il aurait été déraisonnable de faire entrer en vigueur ces lois votées sous la précédente législature sans y mettre les conditions humaines et matérielles nécessaires.
La deuxième porte sur les assistants paroissiaux. Le projet de loi prévoit d'augmenter de 40 unités les assistants paroissiaux, sans solution définitive quant à leur cadre.
À titre personnel, je regrette que ce projet de loi ne donne pas une solution définitive. Le Conseil d'État a attiré notre attention à juste titre sur le fait qu'il fallait leur donner un cadre et arrêter le cadre extinctif qui existe actuellement pour cette fonction. Le ministre a déclaré que ce serait pour le budget de l'année prochaine.

Mijn laatste punt betreft de terbeschikkingstelling, waarover vroeger de regering besliste en waarover nu de strafuitvoeringsrechtbanken beslissen. Het is een belangrijke maatregel, die bepaalt dat niet langer de minister bevoegd is om over de terbeschikkingstelling uitspraak te doen. De strafuitvoeringsrechtbanken zullen dat nu doen.

The real reason will be another reason. I suspect it is mainly for financial reasons. The current government has insufficient budgets to implement important legislation intended during the current legislature. Be honest to admit that too. Then say that there are no budgets, but don’t come up with drogreads, such as having to evaluate and equip first.
My last point concerns the disposal, which was previously decided by the government and now is decided by the criminal enforcement courts. It is an important measure, which stipulates that the Minister is no longer competent to decide on the dispatch. The criminal enforcement courts will now do so.
Mr. Minister, that the proposed measure is also delayed for so many years, is truly illogical. First, it is – it was also admitted – about very few people. Second, it is also illogical. Almost all of them are long-term sentenced, who must appear before the criminal enforcement courts today. These courts are already competent for long-term sentences.
At the end of the term, a detainee who has been sentenced, for example, to seven, eight or ten years of imprisonment and is completely exhausted will appear again before the Criminal Enforcement Court every year. After ten years, that same court will notify him that it is no longer competent to make his disposal. For the deployment he is referred back to the Minister, while the entire file has already been handled by the Criminal Enforcement Court.

Nog een uitstel en u hoefde het niet in de wet diverse bepalingen in te schrijven, maar ik kom er hier vandaag graag op terug, want het moet worden vermeld als het zogenaamde paradepaardje van het zogenaamde justitiebeleid van deze zogenaamde regering: het gevangeniswezen. Dat is in feite het strafste uitstel van allemaal, collega’s. Ik formuleer een eerste tussenbesluit, mijnheer de minister. Wat betreft de wet interne rechtspositie gedetineerden, handelt u alleen maar naar de geest ervan, die stelt dat de gevangene een bepaald – zeer ruim – comfort moet hebben, en ook in uw visie, net zoals in die van uw voorgangster, ligt de nadruk niet op een correcte strafuitvoering, maar wel op een strafbeperking en een strafverzachting. De 626 extra personeelsleden, waarvan slechts 79 penitentiaire beambten, die u zult inzetten, worden niet aangewend voor de verhoging van de celcapaciteit. De nieuwe personeelsleden zullen dus niet in nieuwe gevangenissen worden tewerkgesteld en evenmin meer gedetineerden moeten kunnen opvangen, of niet voorzien in meer beveiliging in instellingen waar er meer gedetineerden op één cel kunnen. Nee, dat is allemaal niet aan de orde.
Ik zei daarstraks al in mijn repliek op uw antwoord naar aanleiding van enkele opmerkingen van collega’s, dat volgens de Inspectie van Financiën uw meerjarenplan op losse schroeven staat. Budgettair gezien kunnen wij dus oordelen dat het plaatje lang niet naar behoren is ingevuld.
Het gevolg van het uitstel is straffeloosheid alom. Voor een misdrijf als de niet-betaling van alimentatie kan het rijbewijs worden ingetrokken. Dat is een idee uit het Verenigd Koninkrijk. Ik heb de minister in dat verband al vaker ondervraagd en hem de suggestie aan de hand gedaan. Ook het intrekken van het paspoort is een gelijkaardig idee.
Met het intrekken van het rijbewijs als louter op zich staande sanctie zou echter wel eens kunnen worden gelachen, vooral wanneer bijvoorbeeld in Molenbeek of Anderlecht tegen jongeren wordt gedreigd dat hun rijbewijs zal worden ingetrokken, indien zij nog eens een paar agenten in elkaar slaan.
Wij vragen ons af wat de volgende, draconische CD&V-sanctie zou kunnen zijn. Misschien is het wel het intrekken van het verzekeringsbewijs van een voertuig. Ik weet het niet, maar ik vrees dat de maatregel vooral in Anderlecht en Molenbeek op hoongelach zal worden onthaald.
In elk geval moeten wij vaststellen dat de huidige minister van Justitie een ontstellend gebrek aan daadkracht aan de dag legt. Hij neemt zijn toevlucht tot uitstel.
"Gouverner, c‘est prévoir", luidt de spreuk. In dit geval is het echter: "Gouverner, c’est reporter".
Collega’s, het voorgaande is slecht bestuur en een gebrek aan respect voor wat de kiezer aan de huidige coalitie, zeker aan CD&V - N-VA, heeft opgedragen.
Een bijkomende, cynische vaststelling, die ik u niet wil onthouden, zou kunnen zijn dat het nationaal veiligheidsplan, dat inmiddels in de steigers werd gezet, van 2008 tot 2011 loopt. U, mijnheer de minister, stelt de meeste maatregelen in het plan tot na 2011 uit. Het zou dus tot 2011 in feite het nationaal onveiligheidsplan moeten worden genoemd. Immers, ook onder de huidige minister zal de rechterlijke macht en zullen rechters straffen opleggen waarvan ze afvragen of ze wel zin hebben en ooit effectief zullen worden uitgevoerd. De wetgevende macht, met name de parlementsleden hier, zitten er voor spek en bonen bij. Elke, mondelinge vraag kan door de huidige minister worden gecounterd door het antwoord: “We zijn ermee bezig. Geduld alstublieft.” Het beeld van de minister die verantwoording moet afleggen, is in feite een testbeeld gedurende de komende jaren.
De regering tracht de oppositie te sussen, enerzijds, door het feit dat de data van uitstel uiterste vervaldata zouden zijn. De vraag is wat wij daarmee zijn. Kunnen wij dat geloven? Excuseer mij, collega’s, maar de commissie voor de Justitie krijgt daardoor het karakter van wat in Nederland een “klootjesdrogerij” of seminarie wordt genoemd. Wij kunnen luisteren naar wat de minister aan tussentijdse rapporten voorschotelt. Uiteindelijk moet hij echter in 2011 op zijn beleid worden afgerekend. Hij stelt de meeste maatregelen tot 2012 uit. Afgerekend worden kan op die manier dus niet, noch door de kiezer noch door de oppositie.
Wij vragen van de minister dus geen voorafgaande verontschuldigingen. Wij vragen hem integendeel af te zien van zijn nefaste uitstelpolitiek en dus ook minstens werk te maken van een aantal kortetermijnmaatregelen, zeker op het vlak van de strafuitvoering. De Vlaamse auteur Walter Van den Broeck zou zeggen: “Schat, kan je niet sneller walsen, want ze spelen een tango.”

Het is belangrijk dat er eerst voldoende representativiteit blijkt, dat er een maatschappelijk belang naar voren kan worden geschoven, dat de godsdienst of de levensbeschouwing reeds een tijd in ons land gevestigd is en voldoende volgelingen heeft en dat er geen enkele activiteit wordt ontwikkeld tegen de maatschappelijke orde.

Dat is een zeer fundamenteel debat maar die poging is een achttal jaren geleden al eens ondernomen, rond het jaar 2000. Er was een groot aantal bezwaren, ook omwille van de privacy. Men moest zich kenbaar maken en zich als aanhanger van een bepaalde godsdienst bekend maken bij bijvoorbeeld de fiscale diensten. Eigenlijk doen burgers dat niet graag. Alles is in evolutie. Ook in een mensenleven kunnen verschillende levensbeschouwingen of opvattingen in evolutie zijn. Daarom is de gedwongen keuze waar u dan voor staat in die tijd geen haalbare kaart gebleken. Wij zaten toen weliswaar in de oppositie.
Dan de parochieassistenten en de toch wel fundamentele bemerking van de Raad van State in verband met het uitdovend karakter van het aantal parochieassistenten. Er zijn er nu 310 erkend. Wij voorzien er 40 meer in deze wet houdende diverse bepalingen. Dit blijft echter een uitdovend karakter houden en dat is niet echt praktisch voor het parochiaal leven in ons land. Wij weten dat heel veel taken, pastorale en sociale, door deze mensen worden opgenomen. Dit is echter een zeer moeilijke taak om te organiseren. Meer fundamenteel ging de Raad van State er echter van uit dat het de subsidiërende overheid niet toekomt om te bepalen wie de bepaalde posten mag opnemen. Eigenlijk doen we dat nu wel, specifiek ten aanzien van de katholieke kerk. Wij zeggen dat gewone leken niet in functie kunnen treden, functies die nochtans vacant zijn op dit ogenblik binnen ons wettelijk kader voor de katholieke kerk. Wij beletten dus een normale evolutie aan de basis van de verschillende parochies.
Ik denk dat we ook moeten bekijken of dit absoluut geen budgettaire meerkosten zou betekenen. Virtueel wordt op dit moment 80% van het budget voor de eredienst opgenomen door de katholieke kerk maar er is slechts 48% van het kader ingevuld. De vraag om ook leken die functies te kunnen laten opnemen betekent dus absoluut geen budgettaire meerkosten. Integendeel, het gaat misschien om een stabilisatie van een bepaalde neergang waarvan we dan wel de oorzaken kennen.

We zullen nagaan hoe we, voor de straffen minder dan drie jaar, gradueel die wet in werking zullen laten treden; hoe we het aantal mensen onder elektronische toezicht zullen uitbreiden; hoe we zullen proberen om voor de geïnterneerden kwaliteitsvol de wet in werking te stellen, hetgeen ook capaciteit veronderstelt, zowel extern, intramuraal als ambulant. It is never nice if the application of a law should be postponed. However, anyone who looks at them serenely knows that we can’t help but try to implement those laws gradually. That is the only way to finally bring credibility into the penalty enforcement policy. So I think we can say with a safe conscience that this must happen. 2011-2012 is not the expiration date when everything should come into effect. It is the final date, the date on which the last acts of that legislation must be implemented. Over the years, we will already implement the law systematically.

Dat wetsontwerp bestaat niet uit drie, maar uit vier artikelen. In totaal beslaat het document nog geen tien pagina’s. Het is een beetje zoals met het klimaatbeleid; er komt niet veel uit en als er dan toch iets uitkomt, is het weinigzeggend.
De reden waarom wij hierover moeten stemmen, is niet omdat dit een geniaal idee zou zijn van de bevoegde minister, maar omdat het gaat over de uitvoering van een beslissing die werd genomen in het Overlegcomité. Het Overlegcomité heeft verschillende keren vergaderd over het probleem van het nationaal allocatieplan. Er waren twee problemen. Ten eerste, de Europese Commissie heeft aan België gevraagd om een bijkomende inspanning te leveren om extra te reduceren. Ten tweede, wij werden geconfronteerd met de vraag van ArcelorMittal om extra rechten te kunnen krijgen voor twee hoogovens in Luik – om de ene op te starten en de andere open te houden.

Binnenkort is het reces. Ik heb vernomen dat wij alleen nog volgende week zullen mogen stemmen. Er is niets ingediend en dat zal dus ook niet gebeuren. Daarrond zal niks gebeuren en wellicht zullen in september, oktober of november alle politieke partijen weer elkaar over de voeten moeten struikelen om te zeggen hoe schandalig het is dat de elektriciteitsprijzen stijgen, omdat er eventueel een doorrekening is van gratis emissierechten en dat de regulator moet worden versterkt. Daarover zullen wij het allemaal eens zijn, maar wij zullen moeten vaststellen dat er fundamenteel niets wordt gedaan om het allemaal te voorkomen. In dit geval voeren wij een aspectje uit van het akkoord in het Overlegcomité, terwijl er wordt gewacht voor het andere aspect waaraan federaal iets moest worden gedaan, namelijk een bijkomende impact op de elektriciteitsprijzen vermijden. Waarschijnlijk is dat wachten op Godot.
Ten gronde over het ontwerp. Destijds werd die heffing in het leven geroepen in een programmawet met als bedoeling het federale aankoopbeleid voor emissierechten te financieren. U hebt het handig proberen te verdoezelen door een schijnbaar inhoudelijke uitleg. Die inhoudelijke uitleg is er dus niet. Die maatregel is er gekomen om de Staatskas te stijven en die maatregel wordt vandaag afgeschaft, vooral om Electrabel te plezieren, Electrabel dat nergens nog taksen wil.

De afschaffing van die heffing komt ook niet echt op een onverdacht moment. Vorige week heeft de Ministerraad besloten emissiekredieten en hot air aan te kopen. In dit geval gaat het over de aankoop van hot air in Hongarije. Men heeft dus eigenlijk besloten om het federale aankoopbeleid niet meer te focussen op CDM-kredieten of op JI-kredieten, maar om eigenlijk te kiezen voor een onduurzame, onecologische weg door te kiezen voor de aankoop van hot air. Indertijd is overeengekomen dat hot air kon op twee voorwaarden, ten eerste als er onvoldoende CDM-kredieten en JI-kredieten waren en ten tweede als er onvoldoende geld zat in het Kyotofonds. Natuurlijk, als men het Kyotofonds eerst leegmaakt of de middelen ervan vermindert om vervolgens een excuus te hebben om hot air aan te kopen, dan is het gemakkelijk.
Wanneer we dat beginnen op te tellen, dan is onderhavig ontwerp, al zou het er onschuldig uitzien, zeker niet zo onschuldig.

Volgens mij heeft het er wel mee te maken, want het geld voor die emissiekredieten moet wel ergens vandaan komen. U hebt dus geen visie. U bent wel aan het onderhandelen. Ik heb van de eerste minister mogen vernemen dat u het nog altijd bent die onderhandelt over de 250 miljoen. U hebt daar wel mooie ideeën over en met de woorden daarvan ben ik het absoluut eens. Ik vrees echter dat ze niet zullen worden neergeschreven in wetten. Ik stel vast dat u geen duurzame visie hebt op de financiering van het klimaatbeleid.
Om al die redenen, gelet op de krakkemikkige motivering, die inhoudelijk geen steek houdt, gelet op het feit dat het onduidelijk is waarvoor dat geld is gebruikt, gelet op het feit dat het onduidelijk is of er op dit moment ergens geld staat te slapen op een rekening dat niet mag worden gebruikt, gelet op het ontbreken van een duurzame visie op de financiering van het klimaatbeleid, zullen de groenen zich dan ook onthouden bij de stemming over onderhavig ontwerp.
