                    Monsieur le président, madame la ministre, chers collègues, l'origine de ce projet de loi remonte à quelques années déjà, à l'époque où quatre chirurgiens, jugés incompétents par leurs pairs, avaient été reconnus in fine aptes à exercer leur spécialité par le ministre de la Santé publique, sur un avis favorable du Conseil supérieur qui agissait comme un organe de recours. Cette situation particulièrement préoccupante mettait à mal la confiance des patients dans la formation des médecins spécialistes auxquels ils se confient.

À l'époque, avec mon collègue le sénateur Jacques Brotchi, nous avons essayé de faire toute la lumière sur ce problème et nos constats ont été les suivants. De 1994 à 2004, sur quatorze candidats spécialistes que la chambre d'agréation de chirurgie avait refusé de reconnaître aptes à exercer leur spécialité de manière autonome, onze avaient reçu un avis positif du Conseil supérieur. L'avis négatif des commissions d'agréation n'était suivi en moyenne par le Conseil supérieur que dans 20% des cas.

Indéniablement, on ne tenait pas assez compte des avis des commissions d'agréation en dépit du fait qu'elles sont les plus à même d'évaluer sur le terrain les qualités des candidats médecins spécialistes. En effet, elles sont composées de médecins actifs et donc toujours au courant des derniers développements de leur spécialité. Le Conseil supérieur était composé de vingt-huit médecins généralistes et de vingt-quatre médecins spécialistes qui souvent n'étaient plus en activité. Il s'ensuit par exemple que les capacités d'un chirurgien étaient évaluées par une instance de cinquante-deux médecins parmi lesquels ne siégeaient que quatre chirurgiens dont certains n'exerçaient même plus d'activité.

Il faut également soulever que, lorsque le Conseil supérieur s'écartait des décisions prises par les commissions d'agréation, il ne motivait pas ses décisions en fonction des considérations soulevées par lesdites commissions.

Tout cela nous a conduit au projet de loi qui nous est soumis aujourd'hui et qui est important car il est de nature à assurer et à maintenir une médecine de qualité dans notre pays. Bien que certains changements soient déjà intervenus en 2004 pour améliorer la communication entre les commissions d'agréation et le Conseil supérieur, le texte en projet a l'avantage d'aller encore plus loin et d'offrir un appui juridique aux commissions et au Conseil supérieur pour que les décisions soient dûment motivées, tant sur le fond que sur la forme.

Les deux médecins spécialistes externes qui sont prévus par le projet de loi permettront d'éclairer le débat par leur expérience dans leur domaine spécialisé qui est soumis à leur analyse. Ces experts, actifs dans leur spécialité, pourront expliquer les points forts et les faiblesses de chaque candidat au vu des derniers développements de la médecine.

Mr. Speaker, Mrs. Minister, dear colleagues, the origin of this bill dates back a few years already, at the time when four surgeons, deemed incompetent by their peers, had been recognized in fine apt to exercise their specialty by the Minister of Public Health, on a favorable opinion of the Superior Council which acted as an appeal body. This ⁇  worrying situation undermined the confidence of patients in the training of the specialized physicians they trust.

At the time, together with my colleague Senator Jacques Brotchi, we tried to give full light on this problem and our findings were as follows. From 1994 to 2004, out of fourteen specialists candidates whom the Surgery Accreditation Chamber had refused to recognize as apt to exercise their specialty autonomously, eleven had received a positive opinion from the Supreme Council. The negative opinion of the accreditation committees was followed on average by the Superior Council only in 20% of cases.

Undoubtedly, the opinions of the approval committees were not sufficiently taken into account despite the fact that they are the most able to evaluate on the ground the qualities of candidates specialized physicians. Indeed, they are composed of active doctors and therefore always aware of the latest developments in their specialty. The Supreme Council was composed of twenty-eight general physicians and twenty-four specialized physicians who often were no longer active. It follows, for example, that the abilities of a surgeon were evaluated by an instance of fifty-two doctors, among whom only four surgeons were seated, some of whom were not even more active.

It should also be pointed out that, when the Supreme Council deviated from decisions taken by the accreditation committees, it did not motivate its decisions based on the considerations raised by those committees.

All this has led us to the bill that is submitted to us today and which is important because it is capable of ensuring and ⁇ ining quality medicine in our country. Although some changes have already been made in 2004 to improve communication between the accreditation committees and the Superior Council, the draft text has the advantage of going even further and offering legal support to the committees and the Superior Council so that decisions are duly motivated, both in substance and in form.

The two external specialist doctors that are provided by the bill will enable to illuminate the debate by their experience in their specialized field that is subject to their analysis. These experts, active in their specialty, will be able to explain the strengths and weaknesses of each candidate in light of the latest developments in medicine.

                    Une bonne manière aussi de s'assurer que le candidat est apte à exercer son métier est de prévoir que 75% des membres du Conseil supérieur devront rester actifs dans leur discipline respective. Les avancées médicales sont telles à l'heure actuelle et tellement rapides qu'il est évidemment nécessaire d'être sur le terrain pour comprendre les enjeux tant au niveau de la formation du candidat qu'au niveau de sa compétence technique.

Voilà, monsieur le président, madame la ministre, très chers collègues, les différentes remarques que je souhaitais formuler. Ce projet sur l'initiative du sénateur Jacques Brotchi me semble être une avancée intéressante dans la garantie de la compétence des praticiens auxquels les patients confient leur santé et parfois même leur vie.

Ik dank de regering omdat zij aangaande een moeilijke passage over fiscaal overdraagbare verliezen, die via een amendement werd voorgesteld, ermee instemde om de werkzaamheden gedurende een week op te schorten om de zaak na te gaan en om vervolgens het wetsontwerp te wijzigen via een amendement van de regering. Ik dank de regering voor die inspanning die leidde tot het opstellen van een goede tekst die quasi unaniem werd goedgekeurd in de commissie voor de Financiën en de Begroting.

                    Monsieur le président, je suis étonnée qu'il n'y ait pas eu de rapport car nous avions convenu en commission de spécifier certaines choses, vu la complexité juridique du dossier. Tout cela se trouve dans le rapport écrit mais je pense qu'il aurait été important de le redire ici.

Il y a plusieurs problèmes dans ce projet. En matière d'immigration, quand on parle d'expulsion, on avance, on travaille, on se rend compte, on voyage. Mais quand on parle d'asile, on travaille beaucoup moins. Quand il s'agit d'améliorer l'accueil de personnes qui ont besoin d'aide, la ministre Turtelboom est beaucoup moins active. Et quand il s'agit de régularisation, il n'y a plus personne.

Pour nous, il y a clairement un déséquilibre dans la politique d'immigration menée par ce gouvernement.

Quel était le petit problème juridique sur lequel nous avons achoppé en commission? La difficulté était que dans un article, on prévoyait que si la ministre ne donne pas de réponse à la demande de transit dans le délai imparti, le transit s'effectue tranquillement. Dans l'article suivant, on dit que si la ministre ne donne pas de suite, le transit ne peut pas s'effectuer parce qu'il y a un risque de traitement inhumain et dégradant. On utilise deux expressions très proches l'une de l'autre pour dire dans un cas qu'on accepte le transit et que dans un autre, on refuse le transit. Cela nous paraît problématique au niveau juridique. Pas mal de collègues m'ont dit, dans les travées, mais malheureusement pas publiquement, qu'ils trouvaient cela bizarre et discutable d'un point de vue juridique.

En commission, nous avons terminé la discussion en disant que nous acterions dans le rapport que "ne donne pas suite" ne veut pas dire la même chose que "ne donne pas de réponse". Je trouve cela un peu léger.

Une autre question qui n'a pas vraiment reçu de réponse en commission est celle de savoir qui constate le fait qu'il y a un risque de traitement inhumain et dégradant.

Mr. Speaker, I am surprised that there was no report because we had agreed in a committee to specify certain things, given the legal complexity of the case. All this is in the written report, but I think it would have been important to repeat it here.

There are several problems in this project. In terms of immigration, when we talk about expulsion, we move forward, we work, we realize, we travel. But when we talk about asylum, we work much less. When it comes to improving the reception of people in need of help, Minister Turtelboom is much less active. And when it comes to regularization, there is no one anymore.

For us, there is clearly an imbalance in the immigration policy carried out by this government.

What was the small legal problem we stumbled upon in the commission? The difficulty was that in one article, it was provided that if the minister does not respond to the transit request within the specified time, the transit is carried out peacefully. In the following article, it is said that if the minister does not follow up, the transit cannot be carried out because there is a risk of inhuman and degrading treatment. Two very close expressions are used to say in one case that one accepts the transit and in another one refuses the transit. This is problematic at the legal level. Not many colleagues have told me, in the travees, but unfortunately not publicly, that they find this strange and disputable from a legal standpoint.

As a committee, we ended the discussion by saying that we would act in the report that “do not follow” does not mean the same thing as “do not answer”. I find this a bit light.

Another question that has not really been answered in the committee is the question of who constitutes the fact that there is a risk of inhuman and degrading treatment.

                    Mijnheer de voorzitter, artikel 4 geeft eigenlijk tijdslimieten weer waarbinnen de federale overheid bevoegd is om te beslissen, meer bepaald 48 uur. Ik stel voor om er nog eens 48 uur bij te voegen. In artikel 5 wordt bepaald dat een weigering onverwijld moet worden meegedeeld.

                    Mijnheer de voorzitter, collega’s, het voorliggend wetsontwerp is misschien technisch van aard, maar het regelt toch een aantal belangrijke zaken inzake gezondheidszorg. Daarom breng ik een korte rapportering.

Het eerste deel omvat het verbeteren van de toegankelijkheid van de geneeskundige verzorging. Dat is een belangrijke prioriteit voor deze regering. Zo worden er inzake het vervoer van zieken een viertal verbeteringen voorgesteld. Ook voor het dringend vervoer per ambulance wordt een wettelijk kader gecreëerd om tussen te komen in de kosten. Er worden een aantal technische verbeteringen voorgesteld in het kader van de integratie van de kleine risico’s en van het sociaal statuut van de zelfstandigen in verband met een verplichte verzekering geneeskundige verzorging. Er zijn ook een aantal verbeteringen aan de wet op de maximumfactuur.

Een belangrijk hoofdstuk is dat over de hervorming van de herwaardering van het statuut van de adviserend-geneesheer. Dit is ingegeven vanuit de vaststelling dat 40% van de ongeveer 280 adviserend-geneesheren momenteel ouder is dan 50 jaar. Men zal dus genoodzaakt zijn om de komende jaren een belangrijke inspanning te leveren voor de noodzakelijke vervanging. De regering wil die functie aantrekkelijker maken door de opdrachten te updaten, door voldoende ondersteuning te geven en het statuut financieel te herwaarderen.

Voorts wordt er een Hoge Raad van de Geneesheren-Directeurs ingesteld. Het wetsontwerp voert ook een aantal voorrangsregels in voor de inschrijving van personen ten laste van de titularis in het eengemaakte stelsel van de verplichte verzekering gezondheidszorg voor zelfstandigen en werknemers.

De samenstelling van de Nationale Raad voor Verpleegkundigen, na de goedkeuring van dit ontwerp wordt dat de Federale Raad, wordt aangepast, waardoor de vertegenwoordiging van de verpleegkundigen beter wordt geregeld.

Voorts is er nog een luik over het beroep van hulpverlener-ambulancier. Met dit ontwerp wil de regering het beroep beschermen en definiëren en een wettelijk kader creëren voor de aan die functie gekoppelde activiteiten.

Wij hebben daarover een bespreking gehad in de commissie.

De heer Gilkinet hield een pleidooi voor meer overleg met de artsen over de hervorming van het statuut van adviserend-geneesheer en het dreigend artsentekort. Hij diende hieromtrent amendementen in, maar die werden niet aangehouden.

De heer Bultinck stelde zich vragen bij de dubbele rol van de enerzijds adviserend en anderzijds controlerend geneesheer.

Mevrouw Becq onderstreepte het belang van de regeling voor de tussenkomst in de reiskosten voor ziekenvervoer, maar vroeg ook aandacht voor specifieke situaties zoals co-ouderschap, een problematiek die door de minister werd erkend en in welk verband zij openstaat voor oplossingen.

Mevrouw Musin beklemtoonde de versterking van de solidariteit in de verzekering geneeskundige verzorging door de afschaffing van de bijdragen voor bepaalde categorieën gepensioneerden en weduwen.

Het amendement van mevrouw Maya Detiège en mevrouw Christine Van Broeckhoven, toegelicht door de heer Hans Bonte, was onderwerp van discussie maar werd niet aangehouden. Het amendement betrof de afschaffing van de ereloonsupplementen voor tweepersoonskamers en de beperking ervan tot 100% van de verbintenistarieven voor de eenpersoonskamers.

Mr. Speaker, colleagues, the present bill may be of a technical nature, but it still regulates a number of important healthcare matters. Therefore, I will provide a brief report.

The first part includes improving the accessibility of medical care. This is an important priority for this government. Four improvements are proposed in the transport of sick persons. Also for the urgent transport by ambulance, a legal framework is created to intervene in the costs. A number of technical improvements are proposed in the context of the integration of small risks and of the social status of self-employed persons in connection with a compulsory health insurance. There are also some improvements to the law on the maximum invoice.

An important chapter is that on the reform of the revaluation of the status of the adviser-physician. This is motivated by the finding that 40% of the approximately 280 counseling physicians are currently over 50 years old. Therefore, one will be forced to make a significant effort in the coming years for the necessary replacement. The government wants to make that position more attractive by updating the assignments, providing adequate support and revaluing the status financially.

Furthermore, a High Council of Medical Masters Directors will be established. The draft law also introduces a number of priority rules for the registration of persons in charge of the titularis in the unified system of compulsory health insurance for self-employed persons and workers.

The composition of the National Council of Nurses, after the approval of this draft, the Federal Council, is adjusted, thereby better regulating the representation of the nurses.

Furthermore, there is a loophole on the profession of emergency service provider-ambulancer. With this draft, the Government aims to protect and define the profession and create a legal framework for the activities linked to that function.

We had a discussion on this in the committee.

Mr Gilkinet pleaded for more consultation with the doctors on the reform of the status of counseling physician and the threatening medical shortage. He submitted amendments, but they were not held.

Mr. Bultinck questioned the dual role of the counseling and control physician on the one hand.

Mrs Becq emphasized the importance of the scheme for the intervention in the travel costs for hospital transport, but also asked for attention to specific situations such as co-parenthood, a problem recognized by the Minister and in which context she is open to solutions.

Ms. Musin emphasized the strengthening of solidarity in medical care insurance by abolishing the contributions for certain categories of pensioners and widows.

The amendment of Mrs. Maya Detiège and Mrs. Christine Van Broeckhoven, explained by Mr. Hans Bonte, was the subject of discussion but was not held. The amendment concerned the abolition of the honorary salary supplements for double rooms and its limitation to 100% of the commitment rates for single rooms.

                    De minister gaf aan deze problematiek genegen te zijn maar te kiezen voor overleg om zo geleidelijk te komen tot een duurzaam resultaat.

Mevrouw Lecomte vroeg in het kader van de nieuwe taken van de adviserend-geneesheren aandacht om bij de uitoefening van die taken het principe van de therapeutische vrijheid van de zorgverstrekkers te respecteren. Er werd dienaangaande door de meerderheidspartijen een amendement ingediend dat werd aangehouden.

Mevrouw De Block ging in op de rol van de adviserend-geneesheren en onderstreepte het belang van het overleg ter zake tussen de adviserend-geneesheren, de verzekeringen en de bedrijfsartsen.

Het wetsontwerp werd uiteindelijk aangenomen met 12 stemmen voor en 2 onthoudingen.

                    Monsieur le président, madame la ministre, chers collègues, une loi portant des dispositions diverses est toujours un texte législatif quelque peu indigeste. Celui dont nous avons débattu en commission de la Santé publique, et qui nous est soumis aujourd'hui, est structuré de manière à ce que les dispositions proposées rencontrent trois objectifs clairs et précis.

Ces objectifs renforcent les fondations de notre système de soins de santé, à savoir l'amélioration de l'accessibilité, le renforcement de la bonne gouvernance et la consolidation de la qualité des prestataires et de leurs prestations.

J'illustrerai ces lignes directrices par quelques mesures phares.

La première a trait aux montants de référence. Les différences de tarif que peuvent appliquer les hôpitaux pour des prestations médicales et chirurgicales pourtant standards et fréquentes sont, pour le moins, injustifiées, mais surtout injustifiables. Le système mis en place en 2002 visant à sanctionner financièrement et a posteriori les hôpitaux ayant des pratiques anormalement coûteuses ne fonctionne pas. La volonté de la ministre de répondre à ce problème doit être soulignée, d'autant que cette pénalisation financière ne peut être taxée de bête et méchante. En effet, grâce aux modifications proposées, chaque hôpital aura la possibilité, en cours d'année, de corriger le tir grâce au système de "feedback" désormais prévu.

Une autre modification importante vise à l'intégration, dans le système de comparaison de ces montants de référence, des examens préopératoires effectués en ambulatoire.

Ces mesures permettront de lutter efficacement contre les disparités tarifaires non justifiées qui – rappelons-le – se font au détriment des patient et grèvent anormalement le budget des soins de santé.

J'en arrive ainsi à un autre élément emblématique de ce projet: la base légale qui va enfin permettre à l'INAMI de récupérer les primes versées à un prestataire conventionné qui, malgré ses obligations, ne respecte pas les tarifs fixés dans la convention.

Mr. Speaker, Mrs. Minister, dear colleagues, a law with various provisions is always a somewhat indigest legislative text. The one we discussed in the Public Health Committee, and which is submitted to us today, is structured in such a way that the proposed provisions meet three clear and precise objectives.

These goals strengthen the foundations of our healthcare system, namely improving accessibility, strengthening good governance and consolidating the quality of service providers and their services.

The first concerns reference amounts. The tariff differences that hospitals may apply for standard and frequent medical and surgical services are, at least, unjustified, but above all unjustified. The system established in 2002 to penalize financially and a posteriori hospitals with abnormally expensive practices does not work. The Minister’s willingness to address this problem must be emphasized, especially since this financial penalty cannot be taxed as beast and evil. In fact, thanks to the proposed changes, each hospital will have the possibility, during the year, to correct the shot through the "feedback" system now planned.

Another significant change is the inclusion of pre-operative outpatient examinations in the comparison system for these reference amounts.

These measures will effectively combat unjustified tariff disparities that – remember – are at the expense of patients and abnormally strike the healthcare budget.

I thus arrive at another iconic element of this project: the legal basis that will finally allow INAMI to recover the premiums paid to an agreed provider who, despite its obligations, does not comply with the tariffs set in the agreement.

Cette mesure se mettra en place au moyen de la certification de ces professionnels auxquels incombera également une obligation de maintenance des appareils. Les patients disposeront ainsi d'instructions fiables relatives à leur utilisation.

Toujours dans ce souci de garantir et d'accroître la sécurité du patient, et tout en ayant à cœur de protéger les prestataires, le projet va entraîner d'importantes modifications dans la profession des secouristes ambulanciers. En la réglementant et, surtout, en déterminant précisément les actes de ces personnes, la ministre entend offrir une sécurité juridique aux secouristes ambulanciers – sécurité dont ils ne bénéficient pas aujourd'hui, ce qui peut leur être évidemment préjudiciable. Cette disposition a fait l'objet de très longs débats en commission.

Pour mon groupe, il est cependant clair que, vu l'importance et la particularité de cette profession – faut-il rappeler que ces personnes agissent en situation d'urgence et souvent de manière non négligeable? –, il importe qu'elle soit reconnue et encadrée. Il ne faut pas oublier que cette mesure renforcera non seulement la sécurité juridique de ces professionnels, mais contribuera aussi à la sécurité du patient.

Enfin, s'agissant de la profession d'infirmière, quelques dispositions visent à adapter le Conseil national de l'art infirmier, qui est d'ailleurs renommé "Conseil fédéral". L'adaptation de ce Conseil à la situation actuelle de la profession en question mérite d'être soulignée.

By regulating it and, above all, by precisely determining the acts of these persons, the minister intends to offer legal certainty to ambulance rescuers – security that they do not enjoy today, which can be obviously harmful to them. This issue has been the subject of long debates in the committee.

For my group, however, it is clear that, given the importance and peculiarity of this profession – should we remember that these people act in an emergency situation and often in a manner not negligible? It is important that it is recognized and encapsulated. It should not be forgotten that this measure will not only strengthen the legal certainty of these professionals, but will also contribute to the safety of the patient.

Finally, with regard to the profession of nurse, some provisions aim to adapt the National Council of Nursing Art, which is also renamed "Federal Council". The adaptation of this Council to the current situation of the profession in question deserves to be emphasized.

De minister stelt voor om de financiering van de centra voor menselijke erfelijkheid in België te wijzigen van de huidige financiering, die een vergoeding voorziet per verstrekking, naar een globale tussenkomst via een overeenkomst. Daartoe wenst de minister het artikel 22 van de gezondheidswet aan te vullen met een bepaling 18°, die luidt dat er overeenkomsten zullen worden gesloten met de centra voor menselijke erfelijkheid, die erkend zijn op basis van de criteria bepaald door Koning, voor verstrekkingen die uitgesloten worden van tegemoetkoming via de nomenclatuur van geneeskundige verstrekkingen bedoeld onder artikel 35, en die zeer specifiek betrekking hebben op erfelijke aandoeningen. Volgens de minister krijgt het Verzekeringscomité van het RIZIV de gepaste instrumenten om tussenbeide te komen in de kosten voor die complexe materie.

Mevrouw de minister, hoewel ik begrip heb voor uw zorg om het budget voor de volksgezondheid niet onbeperkt en oncontroleerbaar te belasten door een zeer sterke toename in genetische testen, maak ik mij toch zorgen over de vaagheid van de formulering van de toegevoegde bepaling. Laat mij dat even toelichten.

Momenteel worden de centra voor menselijke erfelijkheid enerzijds met een subsidie vergoed en anderzijds met een forfait, dat gelimiteerd is per staalafname en een ereloon per verstrekking voor de counseling – het genetisch advies – door een genetisch adviseur.

The article covers the financing of the centers for human heredity. It is a new amendment that has not been submitted to the committee.

The Minister proposes to change the financing of the centres for human heritage in Belgium from the current financing, which provides for a fee per provision, to a global intervention through an agreement. At present, the centers for human heredity are compensated, on the one hand, by a subsidy and, on the other hand, by a fixed fee, which is limited by steel decomposition and an honorary fee per provision for the counseling – the genetic counseling – by a genetic counselor.

In de toelichting bij het wetsvoorstel zegt de minister dat door de zeer snelle evolutie in de medische genetica, een deelgebied van de geneeskunde, het voor de verplichte zorgverzekering steeds moeilijker wordt om tijdig en gepast tegemoet te komen aan de vele nieuwe prestaties, omdat de procedures voor het realiseren van nieuwe nomenclaturen lang zouden duren. Het gaat ook hier heel specifiek om vaak zeldzame, maar zeer specifieke verstrekkingen. The translation by the genetic counselor of this yet very complex matter is not easy. It is not easy to explain that to a patient, who is usually a leech, let alone to the relatives who are at risk, let alone to the treating doctor. Even in the training of doctors today still very little attention is paid to knowledge about genetics. In Belgium, there is no specialization in medical genetics.

                    Het federaal Kenniscentrum voor Gezondheidszorg heeft een onderzoek uitgevoerd, specifiek over de organisatie en de financiering van de genetische diagnostiek in België. Dat onderzoek werd afgerond en gerapporteerd in 2007. Er werd een aantal vaststellingen gedaan. De eerste vaststelling is dat er op vandaag geen effectieve beperking is in het aantal uitgevoerde en aangerekende genetische testen. De enige beperking kan komen van de geneticus die mee gaat bepalen wanneer een test wordt uitgevoerd, of van de genetici in de medisch-genetische centra, ofwel via de medisch-genetische raad. Er is geen beperking op het aantal testen. Dat is enerzijds goed natuurlijk, omdat er meer en meer testen beschikbaar worden en dat deze genetische testen natuurlijk dienen als dienstverlening aan onze samenleving. Toch stelt men vast dat de geneticus daar niet altijd een correcte rol in speelt. Ik kom daar straks op terug.

Er is reeds coördinatie wat betreft het genetisch testen: er zijn afspraken tussen verschillende centra om te vermijden dat een aantal testen in elk centrum wordt aangeboden, zeker toch voor degene die zeldzamer worden toegepast. Waarom worden genetische testen nu betaald per test? Genetische testen vormen de dag van vandaag in medisch-genetische centra de grootste bron van inkomsten. Die bron van inkomsten wordt ook gebruikt om het voortraject te verzorgen, wat betekent onderzoek te doen naar nieuwe genetische testen en naar nieuwe aandoeningen. Dat maakt ook dat het volume van het aantal genetische testen in België op een of andere manier toch een beetje hoger wordt gehouden dan in principe strikt noodzakelijk is.

De tweede vaststelling is dat het counselen, het geven van het genetisch advies, te laag wordt vergoed door het RIZIV. Er is een te lage terugbetaling voor dit genetisch advies door de genetische adviseurs. Dat betekent dat het uitvoeren van de genetische testen meestal dan ook veel hoger ligt dan in principe het genetisch advies zelf. Het betreft een financiële verliespost. Genetisch advies betekent in principe dat men met een patiënt en familieleden soms toch een uur of twee uur in gesprek is. Er worden geen specifieke complexe ingrepen of behandelingen toegepast: het is een gesprek tussen patiënt en familieleden met de genetisch adviseur.

The Federal Knowledge Centre for Healthcare has conducted a study, specifically on the organization and financing of genetic diagnostics in Belgium. This study was completed and ⁇  in 2007. A number of conclusions were made. The first finding is that there is currently no effective limitation in the number of genetic tests performed and charged. The only limitation may come from the geneticist who will decide when a test is carried out, or from the geneticists in the medical-genetic centers, or through the medical-genetic board. There is no limit on the number of tests. That is, on the one hand, very natural, because more and more tests are available and that these genetic tests naturally serve as a service to our society. However, it is noted that the genetic does not always play a proper role in this. I will return to that later.

There is already coordination with regard to genetic testing: there are arrangements between different centers to avoid a number of tests being offered in each center, ⁇  for those that are used more rarely. Why are genetic tests now paid per test? Genetic testing is today the largest source of income in medical-genetic centers. That source of income is also used to provide for the advance, which means doing research on new genetic testing and on new diseases. This also means that the volume of the number of genetic tests in Belgium is somehow kept a little higher than is strictly necessary in principle.

The second finding is that the counseling, giving the genetic advice, is compensated too low by the RIZIV. There is too low reimbursement for this genetic advice by the genetic advisors. This means that the performance of the genetic tests is usually much higher than the genetic counseling itself. This is a financial loss. Genetic counseling, in principle, means that a patient and family members are sometimes in conversation for an hour or two. No specific complex interventions or treatments are applied: it is a conversation between the patient and family members with the genetic counselor.

                    Het is dus een langdurig contact tussen de arts en de patiënt. Het wordt laag terugbetaald en er wordt maar een zeer beperkt aantal genetische adviezen per zitting uitgebracht. Het genetisch advies is nochtans een van de meest prioritaire taken van een medisch-genetisch centrum, vooral in de toekomst, omdat men de genetische aanleg voor levensbedreigende en zware chronische aandoeningen steeds meer zal kunnen opsporen. Het belang van het genetisch advies zal in de toekomst blijvend toenemen. Ik denk bijvoorbeeld aan het maken van een genetisch risicoprofiel voor alzheimerdementie, maar bijvoorbeeld ook een genetisch risicoprofiel voor diabetes en andere ziekten die met de vergrijzing gepaard gaan.

Er zijn vandaag in België al websites waar individuen en artsen genetische tests kunnen aanvragen. Die tests worden meestal in het buitenland uitgevoerd. Door gebruik te maken van dit aanbod omzeilt men het medisch-genetisch advies. Er bestaan ook zelftestkits voor DNA. Men omzeilt daarmee opnieuw het medisch-genetisch advies. Nochtans is juist het medisch-genetisch advies door een expert heel belangrijk voor de begeleiding van patiënten en familie.

Het huidige artikel 10, en de huidige formulering die werd toegevoegd door de minister onder 18, maakt geen enkele keuze in de besteding van de geldstromen naar die centra. Men zou dit beter wettelijk vastleggen en grote beleidslijnen aanhouden, omdat er dan meer aandacht en geld zou gaan naar het genetisch advies, met anderzijds een inperking van het uitvoeren van de genetische tests zelf, want het uitvoeren van die genetische tests kan men vandaag met robotica doen, op grote platformen, met grote aantallen. De prijzen zijn zeer laag, veel lager dan de prijzen die vandaag worden aangerekend. Vandaag wordt de prijs van die genetische tests kunstmatig hoog gehouden. Een DNA-test, bijvoorbeeld, kost per test, per sample, 300 euro.

Gezien de sterke toename in de uitgaven voor de genetische diagnostiek heeft de overheid meer informatie nodig of heeft de overheid meer recht op informatie dan de huidige bestaande jaarrapporten. So it is a long-term contact between the doctor and the patient. It is lowly repaid and only a very limited number of genetic advice is issued per session. However, genetic counseling is one of the most priority tasks of a medical-genetic center, especially in the future, as one will be able to detect the genetic predisposition for life-threatening and serious chronic diseases more and more. The importance of genetic counseling will continue to increase in the future. For example, I think of creating a genetic risk profile for Alzheimer’s dementia, but also, for example, a genetic risk profile for diabetes and other diseases associated with ageing.

There are already websites in Belgium where individuals and doctors can request genetic tests. These tests are usually carried out abroad. By taking advantage of this offer, one bypasses the medical-genetic advice. There are also self-test kits for DNA. In this way, medical-genetic advice is once again bypassed. However, precisely the medical-genetic advice by an expert is very important for the guidance of patients and family.

The current article 10, and the current formulation added by the minister under 18, does not make any choice in spending the cash flows to those centers. It would be better to fix this legally and maintain large policies, because then there would be more attention and money going to the genetic counseling, with on the other hand a restriction of performing the genetic tests themselves, because performing those genetic tests can be done today with robotics, on large platforms, with large numbers. The prices are very low, much lower than the prices charged today. Today, the price of these genetic tests is kept artificially high. A DNA test, for example, costs per test, per sample, 300 euros.

Given the sharp increase in genetic diagnostics spending, the government needs more information or has more rights to information than the current existing annual reports. It is important to know how the funds are used and how they are distributed across the different categories, on the one hand the genetic advice and, on the other hand, the genetic tests and possibly the global subsidy of the center itself.

Niet alle informatie is beschikbaar. Ze wordt ook niet beschikbaar gesteld, ook niet voor het rapport waarnaar ik al verwees. Er zou ook veel meer ruimte voor transparantie moeten zijn.

Daartoe zijn gestandaardiseerde, jaarlijkse, publieke rapporten met een complete lijst van alle, uitgevoerde tests alsook van andere activiteiten per centrum vereist. Het is ook belangrijk om aan te geven hoeveel tests werden gedaan en hoeveel genetische adviezen werden uitgebracht.

Dat betekent in principe dat voor elk, medisch-genetisch centrum een aparte boekhouding zou moeten worden opgesteld. Op die manier kan voornoemde, aparte boekhouding, die rechtstreeks met genetische tests en genetisch advies te maken heeft, ook apart in het financiële verslag van het centrum worden opgenomen, zodat er een duidelijk onderscheid wordt gemaakt tussen de genetische dienstverlening, enerzijds, en het wetenschappelijk onderzoek dat in een dergelijk centrum wordt uitgevoerd, anderzijds.

Mijn amendement stelt voor om aan bepaling 18, die door minister Onkelinx werd toegevoegd en zoals ze ons uit het wetsvoorstel bekend is, een aantal alinea’s toe te voegen die mijn net geuite bezorgdheid reflecteren. Het gaat over de mogelijkheid dat het genetisch advies nog meer onder druk zou komen. De toevoegingen komen ook ten voordele van de genetische tests zelf.

Mijn voorstel tot toevoeging van voornoemde twee leden of alinea’s staat in de rondgedeelde tekst. Het betekent dat ik vraag dat in de overeenkomsten die met de medisch-genetische centra zullen worden gesloten, kan worden voorzien in de betaling van een tegemoetkoming die de kosten van de genetische tests dekt en die ook de kosten van een medisch-genetisch advies dekt. In de overeenkomsten worden ook de omstandige modaliteiten vastgelegd, volgens dewelke voornoemde tegemoetkoming wordt toegekend.

De minister stelt volgens het voorstel het jaarbedrag van de tegemoetkomingen op grond van door de Koning bepaalde criteria vast. Bedoelde criteria houden inzonderheid rekening met de kostefficiëntie en de kwaliteit van de testprocedure en met de kwaliteit van het complexe, medisch-genetische advies.

Elk centrum stelt vervolgens volgens door de Koning bepaalde criteria jaarlijks een rapport op met een financieel verslag en met de complete lijst van alle, uitgevoerde tests alsook van de andere activiteiten per centrum en hun volume.

Het voorgaande is de strekking van mijn amendement.

It is about the possibility that genetic counseling would be further pressured. The additions also come to the benefit of the genetic tests themselves.

My proposal for the addition of the two aforementioned members or paragraphs is included in the rounded text. It means that I ask that the agreements to be concluded with the medical-genetic centers may provide for the payment of a compensation that covers the costs of the genetic tests and that also covers the costs of medical-genetic advice. The agreements shall also specify the circumstantial modalities according to which the aforementioned benefit is granted.

According to the proposal, the Minister shall establish the annual amount of the benefits on the basis of criteria determined by the King. Those criteria shall take into account, in particular, the cost-efficiency and quality of the test procedure and the quality of the complex medical-genetic advice.

Each centre shall then, according to the criteria determined by the King, annually prepare a report with a financial report and with the complete list of all the tests carried out as well as of the other activities per centre and their volume.

The above is the purpose of my amendment.

Wij hebben daarvoor in België nog geen concrete opleiding, dat weet u. In de ons omringende landen bestaat dit wel.

Het is een heel complexe materie en als men het advies zou beperken in tijd en aantal dan komt men in een situatie waarbij mensen in onze samenleving geconfronteerd worden met zeer technologische informatie over een potentieel erfelijk risico en het feit dat zij niet weten wat zij met deze informatie moeten aanvangen. Men kan nu genetische tests laten doen via andere wegen, buiten het medisch-genetisch centrum om.

Het is dan ook belangrijk dat men, bij het uitwerken van dit voorstel, het niet aan de medisch-genetische centra gaat overlaten om als enige te bepalen of het geld naar medisch-genetisch advies dan wel naar genetische tests moet gaan. We weten immers dat medisch-genetische centra vandaag een groot gedeelte van dit geld gebruiken voor het ondersteunen van wetenschappelijk onderzoek. Dit is een belangrijke kritiek. Ik zeg niet dat zij geen wetenschappelijk onderzoek mogen doen, maar ik ben bezorgd over het verlies van het belang van het medisch-genetisch advies aan de mensen in onze samenleving, zeker nu wij het DNA volledig in kaart kunnen brengen.

                    Mijnheer de voorzitter, mevrouw de minister, collega’s, het gaat zoals gebruikelijk bij een wetsontwerp van diverse bepalingen inderdaad over diverse bepalingen. Toch zijn er heel wat belangrijke hoofdstukken die met belangrijke aspecten van de gezondheidszorg te maken hebben. Vandaar dat ik kort wens te reflecteren over een en ander.

Eerst en vooral, vind ik het belangrijk en ook verstandig dat alles wat aanvankelijk in het voorontwerp stond over de zogenaamde nofaultregeling, de foutloze aansprakelijkheidsregeling bij medische schade, uit het ontwerp is gelicht en dat daarover een apart ontwerp zal komen, zodat wij dat belangrijke thema na de studie van onder andere de financiering op een goede manier kunnen bespreken. Ik meen dat dat absoluut de beste keuze is. Alleen, mevrouw de minister, zullen wij in de gaten moeten houden dat de foutloze aansprakelijkheidswet normaal, met vertraging, uitwerking krijgt op 1 januari 2009 en dat wij die wet opnieuw zullen moeten uitstellen, zodat wij de tijd krijgen - dat zal vermoedelijk in het voorjaar zijn – om het wetsontwerp te bespreken.

De punctuele reacties hebben wij in de commissie kunnen geven. Ik beperk mijn interventie dus tot een aantal grote punten.

Ik meen, mevrouw de minister, dat wij dringend een aantal belangrijke debatten moeten houden over capita selecta uit de gezondheidszorg, onder meer over de verpleegkunde. U hebt trouwens zelf een plan aangekondigd om de aantrekkelijkheid van het beroep te verhogen. Wij zullen dat plan binnenkort in de Kamer moeten bespreken. Dat zal een goede gelegenheid zijn om over een aantal dingen te spreken. Bijvoorbeeld, hoever moeten wij in de verpleegkunde gaan inzake de bijzondere beroepstitels? Inzake de bijzondere beroepsbekwaamheden moeten wij erover waken dat wij niet te ver gaan, zodat wij niet een te gespecialiseerde verpleegkunde krijgen. Daardoor zouden wij heel wat polyvalentie verliezen in de basisverpleegkunde. Wij zullen dat naar aanleiding van uw plan ongetwijfeld nog bespreken.

Wij willen ook zeker spreken over de opleiding. Die is verschillend. In Wallonië duurt de opleiding 4 jaar, in Vlaanderen duurt zij eigenlijk maar 3 jaar en bestaan er mogelijkheden om via wat men noemt de voortgezette opleiding, de vierdegraadsopleiding, verpleegkundige te worden. Wij wensen absoluut dat daaraan niets verandert en dat wij in de verpleegkunde nog steeds A2-verpleegkundigen en A1-verpleegkundigen behouden. Zij hebben soms andere verantwoordelijkheden. A1-verpleegkundigen stromen gewoonlijk door naar het middenkader en nemen verantwoordelijke taken, terwijl wij precies A2-verpleegkundigen nodig hebben voor de basiszorg.

By the way, you have announced a plan to increase the attractiveness of the profession. We will have to discuss this plan in the Chamber soon. This will be a good opportunity to talk about a number of things. For example, how far should we go in nursing with regard to special professional titles? With regard to the special professional skills, we must be careful not to go too far, so that we do not get too specialized nursing. As a result, we would lose a lot of polyvalence in basic nursing. We will undoubtedly discuss this following your plan.

We also want to talk about training. It is different. In Wallonia, the training takes 4 years, in Flanders it actually takes only 3 years and there are opportunities to become a nurse through what is called the continuing training, the fourth degree training. We absolutely wish that nothing changes and that we still retain A2 nurses and A1 nurses in nursing. Sometimes they have other responsibilities. Het was toch een beetje ambetant dat wij ter zake geen advies van de Nationale Raad zelf konden verkrijgen, omdat die op dat ogenblik, al meer dan een jaar, niet meer bestond. Wij konden hem daarin dus niet betrekken.

Daarom heb ik toch een aantal bedenkingen, die wij zullen moeten evalueren in de toekomst. Ten eerste, de basisverpleegkundigen moeten voldoende vertegenwoordigd blijven in de Nationale Raad voor Verpleegkunde. Het is ook belangrijk dat in de Nationale Raad voor Verpleegkunde voldoende vertegenwoordigers van zowel de A1-opleiding als van de A2- opleiding zitting hebben. Het is dan ook positief dat nu ook de zorgkundigen zullen vertegenwoordigd zijn in de Nationale Raad voor Verpleegkunde.

Van belang is tevens dat in de raad voldoende de sectoren gedifferentieerd en vertegenwoordigd zijn en aan bod kunnen komen, zoals de sector van de ziekenhuizen, die anders is dan de sector van de thuisverpleging. Thuisverpleegkundigen zullen totaal andere zorgen hebben, zullen een andere kijk hebben op het beleid, vanuit hun specifieke invalshoek, dan verpleegkundigen die werken in de ouderenzorg, in rust- en verzorgingstehuizen. Het is belangrijk dat er daar een goed evenwicht wordt bewaard, ook in de toekomst, in de Nationale Raad, zodat zij ook aan bod kunnen komen.

Mevrouw de minister, er moet ook een goede verdeling komen tussen enerzijds beroepsorganisaties voor verpleegkundigen en anderzijds vakorganisaties. Het is nu nog niet duidelijk hoe dat zal gebeuren. Kortom, de syndicale tak moet daar ook in kunnen aanwezig zijn.

Bij ons leeft een beetje de vrees dat de Nationale Raad te veel deelnemers zal tellen. Een raad met te veel deelnemers werkt dan niet meer soepel of niet goed. Dan bestaat het gevaar dat er te veel zaken worden gedelegeerd naar een kleinere groep, zeg maar het bureau van de Nationale Raad, met mogelijk een democratisch verlies tot gevolg. Het is beter dat men een werkbare raad installeert met een afgewogen aantal deelnemers, die goede adviezen kan geven en het beleid op het vlak van verpleegkunde terdege ondersteunt.

Home nurses will have completely different concerns, will have a different view of the policy, from their specific perspective, than nurses working in the elderly care, in rest and care homes. It is important that there is a good balance there, also in the future, in the National Council, so that they can also be addressed.

There should also be a good distribution between, on the one hand, professional organisations for nurses and, on the other hand, trade organisations. It is not yet clear how this will happen. In short, the trade union branch should also be able to participate in this.

There is a little fear that the National Council will count too many participants. A board with too many participants then does not work more smoothly or not well. Then there is the danger that too many affairs will be delegated to a smaller group, say the Bureau of the National Council, possibly resulting in a democratic loss. It is better to set up a working board with a balanced number of participants, who can give good advice and properly support the policy in the field of nursing.

Op de vraag hoe dat statutair moet worden uitgewerkt, krijgen we van de minister duidelijk het antwoord dat het verder met de betrokkenen kan worden bekeken, samen met de minister van Binnenlandse Zaken.

Een tweede hoofdstuk handelt over de deontologie. Het ontwerp gaat over de zogenaamde provinciale geneeskundige commissies die een uitgebreide tuchtrechtelijke bevoegdheid krijgen ten aanzien van de zorgverstrekkers met een strafregister, die dus strafbare feiten zouden hebben gepleegd en wier visum afgepakt moet kunnen worden. Wij hebben daarbij de bemerking gemaakt dat wij er wel begrip voor kunnen opbrengen dat een regeling nodig is. Dat is een lacune. We hebben alleen gevraagd op te letten, omdat de geneeskundige commissies nu al overbelast zijn. Wanneer zullen ze dat nog kunnen doen? Bovendien is het voor de geneeskundige commissies die tot op heden niet echt repressief, tuchtrechtelijk optraden, nieuw dat zij nu ook die bevoegdheid krijgen. We hebben met de minister een akkoord gemaakt dat het debat in de toekomst toch zal moeten worden verbreed tot de hervorming van de Orde van geneesheren en tot het installeren van een hoge raad voor deontologie inzake gezondheidszorgberoepen. Ik denk dat we dan, te gepasten tijde, het debat in die context opnieuw zullen moeten voeren.

Een derde hoofdstuk ging over de screening en de opsporing van ziekten, wat nauw samenhangt met preventie. Vandaar de voortdurende bemerkingen over de bevoegdheden. Preventie behoort tot de bevoegdheden van de Gemeenschappen. Mevrouw de minister, wij komen hierop ongetwijfeld terug tijdens de bespreking van het Kankerplan waar preventie, opsporing en profylaxis een belangrijk onderdeel van vormt. Wij hebben in de commissie de opmerking gegeven dat men de screening in nauw overleg met het curatieve aspect moet organiseren. Men moet daarvoor de Gemeenschappen afstemmen op het federaal niveau en vice versa. Dat is een materie voor de interministeriële conferenties, opdat het preventie- en profylaxisbeleid dat door de Gemeenschappen moet worden gevoerd, zo goed en efficiënt mogelijk kan worden afgestemd.

The second chapter deals with deontology. The draft concerns the so-called provincial medical commissions, which are given extensive disciplinary powers with respect to the healthcare providers with a criminal register, who thus would have committed criminal offences and whose visas must be able to be seized. In this context, we have noted that we can understand that a regulation is necessary. That is a gap. We have only asked to be careful, because the medical commissions are already overloaded. When will they be able to do that? Furthermore, it is new for the medical commissions, which so far did not act really repressively, disciplinary, that they now also have that power. We have agreed with the Minister that the debate in the future will nevertheless need to be extended to the reform of the Order of Physicians and to the establishment of a high council for deontology on health care professions. I think we will then, at a suitable time, have to resume the debate in that context.

A third chapter focused on the screening and detection of diseases, which is closely related to prevention. Hence the constant remarks on the powers. Prevention is within the competence of the Communities. Mrs. Minister, we will undoubtedly return to this during the discussion of the Cancer Plan where prevention, detection and prophylaxis are an important part of it. We have noted in the committee that the screening should be organized in close consultation with the curative aspect. To do this, the Communities must be aligned to the federal level and vice versa. This is a matter for the interministerial conferences, so that the prevention and prevention policies to be conducted by the Communities can be coordinated as well as effectively as possible.

Ook op dit punt heeft de minister gezegd dat we daarover in de toekomst ten gronde moeten blijven debatteren. We moeten ook nagaan hoe we tot de beste kostprijs kunnen komen inzake geneesmiddelen, in eerste instantie voor de patiënt, maar ook voor de ziekteverzekering, en dit door middel van prijs-volumecontracten, openbare aanbestedingen en het beheersen en vergelijken van prijzen.

Vandaar dat ook groepsgewijze herzieningen en individuele herzieningen belangrijk zijn. We hebben daaraan verder gewerkt. We staan erachter. We moeten tot een uitzuivering komen op vlak van het geneesmiddelenbeleid zodat we zoveel mogelijk overbodige geneesmiddelen kunnen bannen.

Die wet bestaat al vijf of zes jaar, maar werd nog niet toegepast. Wij hebben beslist dat wij ons wat dat betreft niet zullen baseren op het referentiejaar 2003, maar op het jaar 2006, omdat zulks tot een beter systeem zal leiden. Dat is belangrijk.

Ik herhaal, namens onze fractie, dat wij niet alleen voor een malussysteem zijn waarbij outliers, degenen die uitgaven doen die niet te verantwoorden zijn binnen ziekenhuizen, dat niet alleen zouden moeten terugbetalen, maar dat degenen die goed presteren, hun best doen en een goed beleid voeren, de mogelijkheid zouden hebben om als instantie of ziekenhuis beloond te worden met een incentive. Een soort bonus/malussysteem dus. Dat debat moeten we in de toekomst verder openhouden.

Tot slot is er ook gesproken over supplementen in de ziekenhuizen. Vooral voor de collega’s van de sp.a wil ik wijzen op het belang van het feit dat thans opnieuw wettelijk zal worden bepaald dat supplementen niet meer kunnen worden gevraagd in twee- of meerpersoonskamers. Dit is belangrijk voor de nieuwe bewindsploeg. Zoals u weet is er ooit een tijd geweest, voor wij einde de jaren ’90 in de oppositie geraakten, waarin wij zelfs wettelijk hebben bepaald dat er slechts zeer beperkte ereloonsupplementen konden worden gevraagd in eenpersoonskamer. Wij hebben dat toen gedaan met de heer Vermassen en de heer Lenssens zaliger. Jammer genoeg hebben wij moeten ondervinden dat minister Vandenbroucke toen die regeling heeft afgeschaft omdat hij de handen vrij wilde hebben om tot een akkoord te komen tussen artsen en ziekenfondsen. We hebben dat altijd betreurd. We hebben in de oppositietijd altijd weer een amendement ingediend om dat terug te kunnen afschaffen. Nu is dit gebeurd. U wilt nu verder gaan. Er werden amendementen in die zin ingediend, maar laten wij alstublieft al blij zijn dat wij dit nu hebben bereikt. Wij zullen later wel zien hoe wij op dat vlak verdere stappen kunnen zetten.

Cette loi que nous votons aujourd'hui présente plusieurs avancées selon nous, notamment sur l'accès aux soins de santé. Je citerai surtout celles qui nous tiennent à cœur.

Tout d'abord, pour ce qui concerne les MENA, nous sommes vraiment heureux de voir réparé un oubli de la loi précédente qui permettra que les enfants des mineurs non accompagnés puissent également avoir accès aux soins de santé.

L'extension ou la création de prestations remboursables est également à souligner, puisqu'elle allégera la facture des familles lors de maladies lourdes. Je prends ici comme exemple le remboursement des trajets domicile-hôpital pour les enfants qui souffrent d'un cancer.

Un autre chantier en cours est le renforcement de l'intégration des petits risques indépendants dans l'assurance soins de santé. Je soulignerai également le rétablissement des règles de priorité pour l'inscription d'une personne à charge. Cela a le mérite de clarifier la situation des personnes à charge et cela rejoint notamment un projet que nous avions cosigné à l'époque. Nous savons que les aménagements dans ce domaine doivent encore se poursuivre. Nous saluons les différentes modifications techniques de cette loi qui soutiennent ce statut des indépendants.

Le dépistage – nous en avons déjà parlé – est un levier important contre la maladie et, dans ce domaine, un nouveau mécanisme de financement permet aux autorités de l'assurance soins de santé de conclure des conventions avec les Communautés pour le paiement d'une intervention. Nous avions au départ souhaité un système de forfait. Finalement, après les différentes discussions, les modalités de paiement prévues par arrêté royal ont permis – nous le pensons – de satisfaire Communautés et État fédéral et de donner aussi de la transparence au mécanisme.

En ce qui concerne les mutuelles, une mesure nous paraissait particulièrement intéressante: l'interdiction de distribuer des cadeaux lors d'une affiliation. Cela laisse ainsi la grande liberté de choix aux citoyens sur le rôle véritable que doit tenir la mutuelle.

Un débat sur le statut du médecin-conseil et sur l'élargissement de ses compétences a eu lieu en commission. Nous en avons parlé à plusieurs reprises. D'une part, cette mesure est un plus parce qu'elle renforce l'attractivité de la profession mais, d'autre part, nous avons bien entendu les inquiétudes du secteur médical au sujet de l'accès aux données. Ces inquiétudes ont d'ailleurs entraîné une limitation de ces accès.

Enfin s'est posée la question d'un possible double rôle du médecin-conseil, à la fois conseilleur et contrôleur. À ce sujet, tout comme pour d'autres projets de loi santé, il nous semble essentiel que cette mesure se vive sur le terrain en confiance avec les prestataires de santé, notamment les généralistes. Nous souhaitons, madame la ministre, qu'une évaluation soit faite après l'application du projet.

This law, which we vote today, presents several advances, in particular on access to health care. In particular, I would like to mention those that are very important to us.

First of all, with regard to the MENA, we are really happy to see fixed a forgetting of the previous law that will allow children of unaccompanied minors to also have access to health care.

The extension or creation of reimbursable benefits is also to be emphasized, as it will ease the family’s bill in serious illnesses. I take here as an example the refund of home-hospital journeys for children who suffer from cancer.

Another ongoing work is the strengthening of the integration of small independent risks into healthcare insurance. I will also emphasize the restoration of the priority rules for the registration of a dependent person. This has the merit of clarifying the situation of the dependants and this joins in particular a project that we had co-signed at the time. We know that improvements in this area need to continue. We welcome the various technical changes to this law that support this status of independent workers.

Screening – we have already talked about it – is an important lever against disease and, in this area, a new funding mechanism allows health insurance authorities to conclude agreements with the Communities for the payment of an intervention. At first, we wanted to have a package. Finally, after the various discussions, the payment arrangements provided by the Royal Decree allowed – we think – to satisfy Communities and Federal State and also to give transparency to the mechanism.

With regard to mutual partnerships, one measure seemed ⁇  interesting to us: the prohibition of distributing gifts during an affiliation. This leaves the citizens a great freedom of choice over the real role that the mutual must play.

A debate on the status of the counseling doctor and on the expansion of his competences took place in the committee. We have talked about this several times. On the one hand, this measure is a plus because it increases the attractiveness of the profession but, on the other hand, we have clearly understood the concerns of the medical sector regarding access to data. These concerns have resulted in a limitation of such access.

Finally, the question arose of a possible double role of the doctor-advisor, both counselor and controller. In this regard, as in other health law projects, it seems to us essential that this measure is lived on the ground in trust with healthcare providers, especially generalists. We would like to make an evaluation after the implementation of the project.

En effet, la loi en modifie la composition car il y a de plus en plus de diversité de titres dans le monde infirmier. Cette adaptation devrait permettre une meilleure représentation.

Nous savons tous qu'un cadastre des professions médicales est en cours. Nous attendons qu'il nous donne une meilleure image de ce qui existe pour encore mieux réaménager la représentativité dans ce Conseil. Au sujet du chapitre 10 de ce projet de loi qui étend notamment la composition du Conseil fédéral de l'art infirmier, nous réitérons nos remarques quant aux articles en projet. S'il est clair que le Conseil de l'art infirmier doit représenter au mieux la profession de l'art infirmier en ce qu'il associe de manière équilibrée les praticiens généralistes et les praticiens spécialisés, il nous paraît également légitime que les praticiens de l'art infirmier à domicile y soient aussi bien représentés que les infirmières hospitalières, cette absence de parité entre l'hospitalier et l'ambulatoire étant régulièrement dénoncée par les associations.

De même, il nous apparaît que pour être tout à fait équilibré, ce Conseil doit prendre en compte de manière équitable la pratique de l'art infirmier salariée et indépendante. Comprenez-moi bien: il ne s'agit pas de cloisonner la pratique de l'art infirmier mais bien de s'assurer que les différentes pratiques, qu'elles soient ambulatoires, hospitalières, généralistes, spécialisées, salariées ou indépendantes soient correctement représentées dans un intérêt bien compris de faire prévaloir la réalité de terrain particulière à chacune.

Pour continuer dans l'examen de ce projet, l'article 61 mérite d'être souligné. Il vise à permettre un usage à grande échelle d'attestations électroniques pour l'octroi aux enfants handicapés de droits supplémentaires dans l'assurance obligatoire. C'est une avancée majeure en direction de la simplification administrative que nous tenions à mettre en évidence.

Nous appuyons aussi sans réserve les articles 67 à 75 qui visent à accorder aux commissions médicales provinciales les moyens d'exécuter les missions qui leur sont légalement confiées. Pour le Mouvement réformateur, et contrairement à certaines déclarations entendues sur d'autres bancs, l'action des commissions médicales provinciales est importante. Elles bénéficient d'un ancrage local par le biais des praticiens. De par les contacts qu'elles entretiennent avec l'Ordre et les informations collectées au sein de la province, leur action est optimisée. Pour les missions de contrôle et de surveillance, par exemple, la gestion de l'information en direct est évidemment d'un intérêt supérieur à l'action forcément passive d'un organe central éloigné, tel un ministère comme certains le souhaitaient – nécessairement moins en prise avec les réalités de terrain. De surcroît, leur raison d'être trouve un écho favorable supplémentaire auprès des infirmiers et des kinésithérapeutes qui ne disposent pas encore d'un ordre, puisqu'elles assurent des missions en rapport avec ces deux professions, principalement sur le plan de la vérification des diplômes.

Il nous apparaît donc que les articles en projet sont de nature à pérenniser l'action des commissions médicales provinciales, ce dont nous nous réjouissons.

Voici, monsieur le président, madame la ministre, chers collègues, les différentes remarques que le groupe MR souhaitait apporter au cours de ce débat. Je vous remercie de votre attention.

                    Mijnheer de voorzitter, mevrouw de minister, collega’s, onzekerheid, het is het gevoel dat vandaag bij vele gezinnen overheerst. Onzekerheid over de spaarcenten, over de koopkracht, over het pensioen, over het werk en over de toekomst. Zekerheid, dat is wat de mensen vandaag, meer dan ooit, nodig hebben en zeker op het vlak van sociale zekerheid. Zekerheid dat mensen hun factuur voor medische zorg kunnen betalen, zekerheid over de erelonen van artsen en andere zorgverstrekkers, zekerheid dat zij toegang hebben tot een kwalitatieve gezondheidszorg. Deze zekerheid kost geld.

De sp.a is dan ook tevreden dat de regering voldoende middelen in de gezondheidszorg wil investeren. Onze partij beseft dat er elke dag gevochten moet worden om de groeinorm van 4,5% te vrijwaren. Het evenwicht is echter zeer fragiel en daar waar de budgetten dreigen te ontsporen, moet er worden ingegrepen. Vandaar ook dat mevrouw Van Broeckhoven en ikzelf vandaag opnieuw drie amendementen indienen.

De uitgaven voor geneesmiddelen swingen opnieuw de pan uit en ingrijpen dringt zich spijtig genoeg opnieuw op. De oorzaken zijn reeds lang gekend. Er is het fenomeen van de vergrijzing waarbij iedereen volgens mij blij is dat de mensen ouder worden. Anderzijds is er de komst van nieuwe technologieën, wat ook goed is, en de nieuwe, maar toch wel zeer dure geneesmiddelen.

Voor 2009 is deze regering daarom op zoek naar 120 miljoen euro binnen het geneesmiddelenbudget. Er zijn twee uitschieters. Ik zal ze niet allemaal in detail behandelen want dat is heel veel werk. Het gaat voornamelijk om de klasse 1 en de weesgeneesmiddelen. Dat de geneesmiddelen van klasse 1 betreft, wil ik wel opmerken dat daar veel grondiger werk moet worden gemaakt van het aanpakken van de enantiomeren, de combinatieproducten, producten die heel fel gelijken op producten van klasse 1 maar het eigenlijk niet waard zijn om bij die groep te worden gerekend.

Wat de weesgeneesmiddelen betreft, is het nodig – ik heb er daarnet nog met mevrouw Avontroodt over gesproken – dat wij eens bekijken hoe wij die groep geneesmiddelen, die een enorme impact hebben op het budget, zullen aanpakken. Er zijn uitspraken van onder meer professor Dupont die zei dat er te weinig wetenschappelijk onderzoek is. Anderzijds zijn er de opmerkingen van experts die zeggen dat er meer moet worden geïnvesteerd. Ik denk dat wij een goed kader zullen moeten creëren omdat dit een enorme impact heeft op het budget.

Een tweede vaststelling van enorme uitgaven inzake geneesmiddelen betreft de ziekenhuissector. Het aandeel ziekenhuizen gaat ruim de 30% voorbij binnen de globale uitgaven voor geneesmiddelen. Het kende in 2007 een groei van 8%. De groei in de open officina bedroeg daarentegen maar 5%.

Uncertainty about savings rates, about purchasing power, about retirement, about work and about the future. Security, that is what people today, more than ever, need, and ⁇  in terms of social security. Assurance that people can pay their medical care bills, assurance on the honorary salaries of doctors and other healthcare providers, assurance that they have access to quality health care. This security costs money.

The Sp.a is therefore satisfied that the government is willing to invest sufficient funds in health care. Our party recognizes that every day must be fought to maintain the growth rate of 4.5%. However, the balance is very fragile and where the budgets are threatening to disrupt, there must be intervention. Therefore, Ms. Van Broeckhoven and I submit three amendments again today.

The spending on medicines is swinging out again and intervention is unfortunately pressing up again. The causes have long been known. There is the phenomenon of ageing in which, I think, everyone is happy that people are getting older. On the other hand, there is the arrival of new technologies, which is also good, and the new, but still very expensive medicines.

For 2009 this government is therefore looking for 120 million euros within the pharmaceutical budget. There are two shooters. I will not deal with them all in detail because that is a lot of work. This includes class 1 and orphan medicines. As regards class 1 medicinal products, I would like to point out that there needs to be done much more thorough work of dealing with the enantiomers, the combination products, products that are very similar to class 1 products but are actually not worthy to be counted in that group.

As regards the orphan medicines, it is necessary – I have just talked about it with Mrs Avontroodt – that we look at how we will deal with that group of medicines, which have a huge impact on the budget. There are statements from, among others, Professor Dupont who said there is too little scientific research. On the other hand, there are the comments of experts who say that more needs to be invested. I think we will need to create a good framework because it has a huge impact on the budget.

A second determination of huge spending on medicines concerns the hospital sector. The share of hospitals exceeds more than 30% of global spending on medicines. In 2007 it saw a growth of 8%. Growth in the open officina, on the other hand, was only 5%.

Vandaar dat het mij toch wel van het hart moet dat het bizar is dat vooral de generieke sector getroffen wordt door de maatregelen die nu voorliggen. Met mogelijke prijsdalingen tot meer dan 10% op generieke geneesmiddelen, kan men er niet naast kijken. Ik weet, structurele maatregelen zijn absoluut nodig, maar dan op de eerste plaats voor de echte oorzaken van de budgetproblemen.

Het voorstel om de percentages van het objectief goedkoop voorschrijven op te trekken, is daarom naar mijn mening wel een goede maatregel, een maatregel waar ik reeds vroeger herhaaldelijk voor gepleit heb.

Maar tegelijk ben ik ook bezorgd. Met het eerste amendement van sp.a voegen we een zin toe in oorspronkelijk artikel 19, het huidig artikel 16. De procedure voor het aanzetten van artsen tot goedkoop voorschrijven van geneesmiddelen, dreigt door dat artikel namelijk te worden vertraagd. De percentages van goedkope voorschriften die nu in de wet zijn vastgelegd, zullen als voorstel van beslissing aan de Ministerraad moeten worden voorgelegd. Dat is dan nog slechts mogelijk na advies van de nationale commissie Geneesheren-ziekenfondsen of de nationale commissie Tandheelkundigen-ziekenfondsen, wat een remmend effect zal hebben op het voorschrijven van goedkopere, evenwaardige geneesmiddelen. Om een vertraging, dus een afzwakking, van de procedure te voorkomen, is het aangewezen om aan de nieuwe adviesprocedure een strikte timing op te leggen.

Wat ik waardeer, is dat minister Onkelinx de geneesmiddelenuitgaven in de ziekenhuizen probeert aan te pakken. Het is wel een beetje een schoorvoetende start, want de voorgestelde maatregel zal wel iets afpingelen van het ziekenhuisforfait, maar ver zal de maatregel niet dragen, vrees ik. These expenditure relate exclusively to the innovative pharmaceutical sector. This will only be possible after the opinion of the national committee of physicians-patient funds or the national committee of dentists-patient funds, which will have an inhibitory effect on the prescription of cheaper, equivalent medicines. In order to avoid a delay, i.e. a weakening, of the procedure, it is appropriate to impose a strict timing on the new advisory procedure.

What I appreciate is that Minister Onkelinx tries to address the drug spending in hospitals. It is a bit of a scourge-feeding start, because the proposed measure will somewhat offset the hospital fee, but far away the measure will not bear, I fear. However, I think there are some possibilities to further increase the spending of hospitals, especially when it comes to medicines.

Het is ook heel belangrijk dat wij weesgeneesmiddelen kunnen blijven terugbetalen. Er moet echter wel worden nagegaan waar kan worden bijgestuurd.

In die zin is het soms schrijnend wat huisartsen in werkgroepen opmerken. Als zij bijvoorbeeld aan patiënten generische middelen voorschrijven en de patiënten gaan daarna naar een ziekenhuis, komen zij vaak terug met een merkgeneesmiddel. Die tendensen komen voor. In die zin zou ik extra aandacht willen voor, waar mogelijk, een bijsturing van het beleid op dat vlak.

Bekijken wij immers even het gemiddelde. Ik heb cijfers gekregen. In termen van eenheden en bedragen stellen wij vast dat de generische middelen op dit ogenblik 2,7% en 1,9% halen, wat echt minimaal is. In die zin zou ik willen dat wordt bekeken hoe het voorschrijven van generische middelen, ook in de ziekenhuizen, kan worden gestimuleerd.

Ik weet ook dat er specialisaties zijn waar men niet anders kan. Het budget dat vrijkomt, kan echter opnieuw in innovatie of in weesgeneesmiddelen worden geïnvesteerd. Er zijn verschillende mogelijkheden die kunnen worden bekeken.

Ik zou willen afronden met mijn derde amendement, ook over de ziekenhuisfinanciering. De heer Goutry haalde al aan dat de kwestie een oud zeer is. Het verhaal gaat spijtig genoeg al jaren mee. De ziekenhuizen willen opnieuw meer geld. Iedereen heeft dat in de kranten kunnen lezen. Het is een vraag die herhaaldelijk opduikt.

Wat ik belangrijk vind – ik denk dat de meeste collega’s dezelfde mening zijn toegedaan –, is dat het voornoemde een enorm en ernstig probleem met zich brengt. De extra middelen die voor het ziekenhuisbudget nodig zijn, worden immers nog steeds via de supplementen aan de patiënt aangerekend of doorgerekend. Op die manier worden alle instrumenten om de gezondheidszorg voor de betrokkenen betaalbaar te houden, zoals OMNIO en de maximumfactuur, ondergraven. Supplementen worden nergens meegeteld, zodat de patiënten er zelf en zonder hulp van de ziekteverzekering voor moeten opdraaien.

Verschillende studies tonen aan dat de patiënt al voor 28% van de ziektekosten in ziekenhuizen, zoals remgelden en supplementen, moet opdraaien. Op dat vlak hebben wij echt het plafond bereikt.

Het amendement, het nieuwe artikel 5, 1 – in plaats van het nieuwe artikel 8/1 -, strekt ertoe dat er voor twee- en meerpersoonskamers geen supplementen meer mogen worden aangerekend. Bovendien leggen wij voor eenpersoonskamers een duidelijke limiet op. In eenpersoonskamers moeten de ereloonsupplementen duidelijk worden geplafonneerd. Dat geldt voor alle artsen, ongeacht of zij al dan niet geconventioneerd zijn. De supplementen worden tot 100% van de verbintenistarieven beperkt.

I also know that there are specialties where one cannot do otherwise. However, the budget released can be re-invested in innovation or in orphan medicines. There are several possibilities that can be considered.

I would like to conclude with my third amendment, also concerning the funding of hospitals. Mr. Goutry has already stated that the issue is a very old one. The story has, unfortunately, been going on for years. Hospitals want more money. Everyone can read that in the newspapers. It is a question that arises repeatedly.

What I find important – I think most of my colleagues have the same opinion – is that the aforementioned causes a huge and serious problem. After all, the additional resources needed for the hospital budget are still charged or transferred to the patient through the supplements. This undermines all instruments to keep health care affordable for those concerned, such as OMNIO and the maximum invoice. Supplements are not included, so patients must pay for them themselves and without the help of the health insurance.

Several studies show that the patient already has to pay for 28% of the medical costs in hospitals, such as brake fees and supplements. We have really reached the ceiling.

The amendment, the new article 5, 1 – instead of the new article 8/1 – aims to ensure that no supplements can be charged for double and multi-person rooms. In addition, we set a clear limit for single rooms. In single rooms, the honorary salary supplements must be clearly plafoned. This applies to all doctors, regardless of whether they are conventional or not. The supplements are limited to 100% of the commitment rates.

Je voudrais, tout d'abord, évoquer la question des hôpitaux et dire que nous soutenons les modifications des dispositions relatives aux montants de référence. En effet, il est important de connaître, au préalable, la fourchette de prix dans laquelle se situe le coût d'une opération. Si tel n'est pas le cas – cette information m'a été donnée par des responsables d'hôpitaux que j'ai eu l'occasion de rencontrer – et si le médecin a été payé, lesdits responsables ne disposent pas d'outil pour corriger un écart de paiement par exemple. Par ailleurs, il est préférable d'avoir, au préalable, une idée des frais auxquels on s'expose et de pouvoir s'organiser en connaissance de cause. En outre, j'estime que le fait de ne prendre en considération que des écarts significatifs a plus de sens que de tenter de récupérer quelques centaines de milliers d'euros dans les hôpitaux. Ce genre de procédé ne constitue en rien un guide de bonnes pratiques.

Monsieur le président, suite aux échanges qui viennent d'avoir lieu, j'ai le sentiment que nous sommes arrivés à un moment où il va falloir revoir quasiment complètement la gestion et l'organisation des hôpitaux, ce en lien avec la présence de spécialistes dans ces derniers ou dans des structures privées, avec les praticiens hospitaliers et la première ligne, avec les suppléments d'honoraires demandés, mais aussi les pratiques privées exercées dans le cadre des hôpitaux. J'attire l'attention sur le fait qu'il ne s'agit pas d'une pratique propre à la Belgique. Pour le moment, les chirurgiens font grève en France. Ils ne donnent pas de renseignements quant aux opérations qu'ils pratiquent parce qu'ils refusent de participer au paiement du matériel ou de l'infrastructure mis à leur disposition par l'hôpital pour assurer leurs pratiques effectuées à titre privé.

Selon moi, il y a absence de transparence, de critères de fonctionnement, de comptes clairs. C'est ainsi que l'on arrive à des situations où des actes privés sont effectués grâce à des investissements consentis par les hôpitaux. C'est la raison pour laquelle j'estime que cette problématique va devoir être revue en profondeur. Le travail en la matière est important et cette loi ne règlera pas tous les problèmes.

J'en viens ainsi à la question des médicaments. Nous ne pouvons que soutenir le renforcement des dispositions visant à permettre une augmentation de la consommation des médicaments génériques et des médicaments les moins chers.

Il est évident qu'à chaque fois, on a tendance à se dire que les mesures prises ne sont pas suffisantes car on voudrait promouvoir plus largement les médicaments et surtout mieux maîtriser la façon dont est estimé le coût d'un médicament, et son remboursement. En outre, il existe un véritable problème en matière de maîtrise des informations ainsi que des messages envoyés aux prestataires de soins en matière de médicaments.

I would like, first of all, to address the issue of hospitals and to say that we support changes to the provisions on reference amounts. Indeed, it is important to know, in advance, the price range within which the cost of an operation is located. If this is not the case – this information was given to me by hospital managers whom I had the opportunity to meet – and if the doctor was paid, the said managers do not have the tool to correct a pay gap, for example. Furthermore, it is better to have, in advance, an idea of the costs to which one is exposed and to be able to organize in knowledge of cause. In addition, I consider that considering only significant deviations makes more sense than trying to recover a few hundred thousand euros in hospitals. This type of procedure is in no way a guide of good practices.

Mr. Speaker, following the recent exchanges, I feel that we have arrived at a time when it will be necessary to review almost completely the management and organization of hospitals, in connection with the presence of specialists in the latter or in private structures, with the hospital practitioners and the first line, with the supplements of fees requested, but also the private practices exercised in the context of hospitals. I would like to point out that this is not a practice specific to Belgium. Surgeons are currently on strike in France. They do not provide information about the operations they carry out because they refuse to participate in the payment of the equipment or infrastructure made available to them by the hospital to ensure their practices carried out on a private basis.

In my opinion, there is a lack of transparency, operating criteria, clear accounts. This is how we come to situations where private acts are carried out through investments made by hospitals. That is why I believe that this issue will need to be reviewed in depth. The work in this area is important and this law will not solve all problems.

So here comes the issue of medicines. We can only support the strengthening of the provisions aimed at increasing the consumption of generic drugs and the cheapest medicines.

It is obvious that every time, one tends to say that the measures taken are not sufficient because one would like to promote medicines more widely and above all to better control how the cost of a medication is estimated, and its refund. In addition, there is a real problem in controlling information as well as messages sent to drug care providers.

                    Je l'avais déjà dit lorsque nous avons discuté de ce projet mais je trouve que nous ne sommes pas allés suffisamment loin dans la transmission des informations sur les médicaments qui seraient données par des personnes indépendantes travaillant pour le ministère de la Santé publique et non pas pour des sociétés privées.

Il faut reconnaître que certains acteurs du secteur ne reçoivent l'information sur les médicaments que via les délégués et que ces derniers sont fort présents dans les cabinets et dans les hôpitaux. Il reste une spontanéité du geste liée à leur place historique.

En revanche, je voudrais insister encore sur un amendement que nous avons redéposé concernant la composition du Conseil national de l'art infirmier. Ma collègue Isabelle Durant le déposera également au Sénat la semaine prochaine.

J'ai entendu les différents intervenants. Ils ont repris, d'une certaine manière, les préoccupations que j'avais exprimées en commission en précisant qu'il était important que les personnes qui représentent les infirmiers et infirmières dans ce Conseil national soient le reflet des différentes manières de travailler – je ne parle pas de statut salarié ou indépendant. Travailler au domicile avec le réseau et des partenaires est une manière très différente que de travailler en hôpital où il y a une pratique bien réglée au sein d'une équipe ou même que de travailler en maisons résidentielles pour personnes âgées, ce qui est encore différent. J'avais insisté en commission pour que la loi intègre une représentation de ces différentes catégories.

Par ailleurs, durant les débats en commission, une crainte a surgi. Si chaque spécialisation était représentée par deux membres, on risquait de se retrouver avec un nombre trop important de délégués.

Nous avons modifié l'amendement que nous avions présenté en commission et nous vous proposons aujourd'hui que les différentes associations d'infirmiers travaillant à domicile, en résidentiel et en hôpital – tant les généralistes que les spécialistes – soient représentées de manière équitable. Nous proposons de limiter le nombre des représentants de cette commission à douze.

It must be acknowledged that some actors in the industry receive information about medicines only through delegates and that these delegates are strongly present in offices and hospitals. There remains a spontaneity of the gesture linked to their historical place.

On the other hand, I would like to insist again on an amendment that we have put forward regarding the composition of the National Council of Nursing Art. My colleague Isabelle Durant will also submit it to the Senate next week.

I listened to the various speakers. They took, in a way, back the concerns I had expressed in the committee, stating that it was important that the people who represent the nurses and nurses in this National Council be the reflection of the different ways of working – I’m not talking about employment or self-employed status. Working at home with the network and partners is a very different way than working in a hospital where there is a well-established practice within a team or even working in residential houses for older people, which is even different. I had insisted in commission that the law incorporates a representation of these different categories.

During the debate in the committee, a fear arose. If each specialization was represented by two members, there would be a risk of getting too many delegates.

We amended the amendment we had submitted in the committee and today we propose that the different associations of nurses working at home, residential and hospital – both generalists and specialists – be equally represented. We propose to limit the number of representatives of this commission to twelve.

Les autres amendements touchent aux nouvelles missions confiées aux médecins-conseils. Je ne m'étendrai pas sur le sujet: mon collègue Gilkinet s'exprimera sur ce point.

Je tiens simplement à mettre en évidence un élément qui me perturbe dans ces modifications de missions. Il s'agit de la confusion pour le patient. Dans sa mission de contrôle, un médecin-conseil incarne à lui seul la médecine du travail et j'estime que cet aspect n'a pas été suffisamment valorisé ni développé. Une visite chez le médecin-conseil sert surtout à constater si l'on est vraiment malade ou si l'on pourra préserver son statut d'incapacité, d'invalidité, et autres. Lui attribuer davantage des missions de conseil et de vérificateur du bien-fondé et/ou de l'efficacité des soins fournis engendre une confusion de rôles. On sait aussi que certains médecins-conseils utilisent la relation sympathique pour essayer de piéger certains malades; ce n'est pas sain. C'est pourquoi j'aurais préféré que l'on prenne le temps d'y réfléchir, avec l'ensemble des partenaires dont les médecins, les médecins-conseils et les autres.

Monsieur le président, je laisse le soin à mon collègue de poursuivre sur ce thème.

In his control mission, a doctor-consultant alone embodies labor medicine and I consider that this aspect has not been sufficiently valued or developed. A visit to the counseling doctor primarily serves to see if one is really sick or if one can preserve his status of disability, disability, and others. Assigning him more of the counseling and verification tasks of the well-founded and/or efficiency of the care provided creates a confusion of roles. It is also known that some counseling doctors use sympathetic relationship to try to trap some sick; this is not healthy. That is why I would have preferred that one took the time to think about it, with all the partners including doctors, counseling doctors and others.

                    Monsieur le président, madame la ministre, comme je vous l'ai dit en commission, si nous soutenons la plupart des mesures que prévoit cette loi portant des dispositions diverses et qui élargissent des droits à la sécurité sociale ou qui apportent d'utiles corrections techniques, il subsiste à nos yeux quelques problèmes fondamentaux dans ce texte. Principalement, comme l'a dit Mme Gerkens, ils se rapportent à la réforme annoncée du rôle des médecins-conseils et leur interaction avec les médecins généralistes. Madame la ministre, nous pensons que ces dispositions auraient dû faire l'objet d'un traitement particulier, mais j'y reviendrai.

Parmi les nouveautés du texte que nous avons examiné en commission des Affaires sociales, je souligne la dimension positive de mesures comme l'ouverture du droit au remboursement des soins de santé aux mineurs non accompagnés (les MENA), l'élargissement du remboursement des frais de trajet entre le domicile et l'hôpital, la suppression de cotisations pour certains pensionnés indépendants à la carrière incomplète ou encore l'amélioration de l'accès au maximum à facturer pour les enfants handicapés. Nous avons soutenu en commission les articles concernés de même que les multiples modifications techniques apportées dans différents textes.

En revanche, madame la ministre, nous regrettons la suppression par amendement déposé par le gouvernement des articles 5, 6 et 7 du projet de loi initial, qui prévoyaient des améliorations relatives à l'accès au maximum à facturer. Il paraît que vous reviendrez nous présenter des textes encore meilleurs. J'en prends bonne note, même si je sais qu'avec ce gouvernement – peut-être plus qu'avec tout autre – un tiens vaut mieux que deux tu l'auras. En tout cas, nous étudierons vos futurs projets en la matière.

Nos principales questions ont trait aux réformes proposées quant au statut et au rôle futurs des médecins-conseils. Vous avez présenté en commission la revalorisation financière des médecins-conseils comme une réponse à la difficulté de trouver des candidats à cette fonction importante. Comme je vous l'ai dit, il me semble que vous prenez le problème par le mauvais bout. La difficulté de trouver des médecins – principalement en milieu rural ou populaire – provient du numerus clausus et du nombre insuffisant de médecins disponibles sur le marché, si je puis m'exprimer ainsi.

Mr. Speaker, Mrs. Minister, as I said to you in a committee, if we support most of the measures provided for in this law which contain various provisions and which extend rights to social security or which bring useful technical corrections, we consider that there remain some fundamental problems in this text. Mainly, as Ms. Gerkens said, they relate to the announced reform of the role of counseling physicians and their interaction with general physicians. We think these provisions should have been subject to a special treatment, but I will return to it.

Among the novelties of the text that we examined in the Social Affairs Committee, I highlight the positive dimension of measures such as the opening of the right to reimbursement of health care to unaccompanied minors (the MENA), the extension of the reimbursement of travel costs between home and hospital, the abolition of contributions for some self-employed pensioners with incomplete careers or the improvement of the maximum access to billing for children with disabilities. We supported in committee the articles concerned as well as the multiple technical modifications made in various texts.

On the other hand, Mrs. Minister, we regret the removal by amendment deposited by the Government of Articles 5, 6 and 7 of the original bill, which provided for improvements concerning access to the maximum to be billed. It is said that you will come back to present us even better texts. I take a good note of it, even though I know that with this government – ⁇  more than with any other – one of yours is better than two you will have it. In any case, we will study your future projects in this area.

Our main questions relate to the proposed reforms regarding the status and future role of counseling physicians. You presented in a committee the financial revaluation of physicians-advisors as a response to the difficulty of finding candidates for this important position. As I said, it seems to me that you are taking the problem from the wrong end. The difficulty of finding doctors – mainly in rural or popular environments – comes from the numerus clausus and the insufficient number of doctors available on the market, if I can express myself so.

                    Ici, au contraire, vous allez aggraver le problème en creusant l'écart salarial entre les médecins-conseils et les autres, ceux qui sont actifs dans les maisons médicales, dans l'aide à la jeunesse, dans les consultations pour nourrissons voir les médecins généralistes. C'est une fuite en avant qui ne résout en rien les problèmes de manque de forces de travail dans les secteurs de la santé.

Cependant, le plus fondamental en la matière, madame la ministre, c'est que vous apportez des modifications dans la relation entre les médecins-conseils et les médecins généralistes sans avoir informé ou consulté ces derniers.

Désormais, si votre texte est adopté tout à l'heure, les médecins-conseils auront pour rôle notamment d'exercer un rôle de conseil de première ligne pour les patients. De même, ils auront aussi à jouer un rôle en matière de réinsertion socioprofessionnelle. Nous pensions que c'était le rôle du médecin généraliste que d'exercer ces missions de conseil. Comment, dorénavant, les missions du médecin généraliste et du médecin-conseil vont-elles s'articuler? Nous ne le savons pas! Nous voterons le texte et nous verrons comment il sera reçu.

Les représentants des médecins généralistes, que ce soit le GBO ou l'ABSyM, ont d'ailleurs réagi à votre texte, par voie soit de communiqué, soit de courrier en regrettant à tout le moins une absence de concertation. C'est une réforme qui démarre donc sur de mauvaises bases, dès lors qu'elle suscite de l'incompréhension et peut-être demain de la résistance d'acteurs importants dans le monde médical.

La sagesse aurait peut-être voulu, madame la ministre, que vous preniez le temps d'informer, de consulter, d'ajuster si nécessaire ou à tout le moins de convaincre. Les aspects de la réforme proposée nous apparaissent positifs, comme le rôle d'accompagnement des dispensateurs de soins qui est désormais attribué au médecin-conseil.

Madame la ministre, je vous avais proposé en commission de prendre un peu de temps pour réaliser cette consultation, pour vous donner l'occasion d'améliorer ce texte et de convaincre. Malheureusement, la majorité ne nous a pas suivis dans l'amendement que nous avions déposé en ce sens. Le temps qui s'est écoulé depuis nos discussions en commission aura peut-être fait son effet. C'est la raison pour laquelle nous redéposons nos amendements visant à un retrait des articles n°s 27 à 31, en tout cas si je me réfère à l'ancienne version du texte, ce qui vous permettrait de reprendre le dossier avec le recul nécessaire. Si ces amendements n'étaient pas soutenus par une majorité soucieuse de l'avis des médecins généralistes comme acteurs de première ligne en matière de santé, nous serions malheureusement contraints de nous abstenir sur ce texte.

Representatives of general practitioners, whether the GBO or the ABSyM, have also reacted to your text, either by communication or by mail, regretting at least a lack of consultation. It is a reform that therefore begins on bad bases, since it causes misunderstanding and ⁇  tomorrow resistance from important actors in the medical world.

Wisdom might have desired, Madam Minister, that you take the time to inform, consult, adjust if necessary, or at least convince. The aspects of the proposed reform seem positive to us, such as the role of accompanying the care providers which is now assigned to the counseling physician.

Mr. Minister, I had proposed you in the committee to take a little time to conduct this consultation, to give you the opportunity to improve this text and convince you. Unfortunately, the majority did not follow us in the amendment we had submitted in this direction. The time that has passed since our discussions in the committee may have made its effect. That is why we are re-deposing our amendments aiming at the removal of Articles 27 to 31, in any case if I refer to the old version of the text, which would allow you to resume the file with the necessary retreat. If these amendments were not supported by a concerned majority of the opinion of general practitioners as leading actors in health matters, we would unfortunately be forced to abstain on this text.
