Monsieur le président, chers collègues, nous ne sommes pas débordés par le travail législatif au point de ne pas prendre le temps de discuter des propositions de loi inscrites à l'ordre du jour. Puisqu'il n'y en a qu'une aujourd'hui, profitons de l'occasion.
Je remercie Mme le rapporteur de l'excellent rapport de nos travaux présenté à l'Assemblée, travaux portant sur la justice à rendre envers des mineurs. Monsieur le ministre de la Justice, cette assemblée et le Sénat ont souvent discuté de la question du droit des jeunes et du type de procédures qu'il faut activer face à des mineurs délinquants qui sont aussi souvent des mineurs en danger, qui méritent une attention particulière mais pour lesquels la société doit réagir quand des faits délictueux sont commis.
La commission de la Justice ne s'est pas penchée cette fois sur une réforme fondamentale du droit de la protection de la jeunesse, ce débat ayant déjà eu lieu dans notre Assemblée sous la précédente législature. Je reste d'ailleurs convaincu que la réforme qui est intervenue, même si elle constitue une bonne base, sera amenée dans les mois et les années à venir à être revue et sans doute corrigée, tant est que se multiplient aujourd'hui les faits de violence commis par des mineurs, y compris des faits graves.
Je remercie les membres de la commission de la Justice pour le travail fourni à l'occasion de l'examen de la proposition de loi que j'avais déposée et qui vise à régler le problème des mineurs renvoyés devant les cours d'assises et plus particulièrement la discrimination qui a été relevée dans l'arrêt n° 49/2008 du 13 mars 2008 par la Cour constitutionnelle. Celle-ci reprochait au législateur d'avoir prévu qu'en cas de renvoi d'un mineur délinquant vers le tribunal correctionnel ou une chambre spécialisée de ce dernier, ce mineur se retrouvait devant des magistrats ayant une formation particulière en droit de la jeunesse, alors qu'un mineur renvoyé en cour d'assises est jugé par des magistrats professionnels dont il ne peut être sûr qu'ils ont suivi une formation spécialisée.
Une des manières de résoudre cette discrimination était d'adopter cette loi en commission de la Justice pour qu'au moins deux membres de la cour d'assises devant laquelle est renvoyé un mineur aient suivi une formation spécifique en droit de la jeunesse. Le ministre, par son représentant en commission, a souligné que cette formation était en réalité une formation interne à la magistrature, d'une quinzaine ou une vingtaine d'heures.

Mr. Speaker, dear colleagues, we are not overwhelmed by legislative work to the point of not taking the time to discuss legislative proposals on the agenda. Since there is only one today, let’s take advantage of the opportunity.
I thank the Rapporteur for the excellent report of our work presented to the Assembly, work on justice to be rendered to minors. Mr. Minister of Justice, this assembly and the Senate have often discussed the issue of youth rights and the type of procedures to be activated in the face of minor offenders who are also often minors in danger, who deserve special attention but for which society must react when criminal acts are committed.
The Justice Committee did not consider this time a fundamental reform of the youth protection law, this debate having already taken place in our Assembly during the previous legislature. I remain convinced that the reform that has taken place, even if it constitutes a good basis, will be brought in the coming months and years to be reviewed and undoubtedly corrected, so much as the acts of violence committed by minors, including serious acts, are now multiplying.
I thank the members of the Justice Committee for the work provided on the occasion of the examination of the bill I had submitted and which aims to resolve the problem of minors returned before the court of sitting and in particular the discrimination that was highlighted in the judgment no. 49/2008 of 13 March 2008 by the Constitutional Court. It reproached the legislator for having provided that in the case of referral of a minor delinquent to the correctional court or a specialized chamber of the latter, that minor was found before magistrates with special training in youth law, while a minor returned to the court of assises is judged by professional magistrates whom it cannot be certain that they have completed specialized training.
One way to resolve this discrimination was to adopt this law in the Justice Committee so that at least two members of the court of assises to which a minor is sent have completed a specific training in youth law. The Minister, through his representative in the commission, stressed that this training was in reality an internal training in the magistracy, of about fifteen or twenty hours.

La faisabilité pratique de la proposition n'engendrera pas, selon moi, de grandes difficultés et l'objectif pourra être atteint. Lorsqu'on fait œuvre législative, il faut toujours se demander si la mesure que l'on apporte n'occasionnera pas trop de complications dans le fonctionnement de la Justice. En l'occurrence, les éléments matériels apportés par le ministre me rassurent. Je suis convaincu que cette mesure est tout à fait praticable et qu'elle permettra non seulement un meilleur fonctionnement de la Justice mais qu'elle apportera des éclaircissements particuliers aux magistrats de la cour d'assises qui sont amenés à juger des mineurs. Je remercie donc une nouvelle fois l'ensemble des formations démocratiques qui ont apporté leur appui à la proposition de loi en question.

The practical feasibility of the proposal will not, in my opinion, create great difficulties and the objective can be achieved. When making legislative work, we must always ask ourselves whether the measure we take will not cause too many complications in the functioning of Justice. In this case, the material elements provided by the Minister reassure me. I am convinced that this measure is entirely feasible and that it will not only enable a better functioning of Justice but that it will bring special clarifications to the magistrates of the Court of Assises who are brought to judge minors. I would like to thank once again all the democratic formations that have supported the bill in question.
