                    Mevrouw de voorzitter, collega’s, de commissie voor de Volksgezondheid heeft dit wetsontwerp en dit wetsvoorstel besproken tijdens haar vergadering van 10 februari laatstleden. Zowel het ontwerp als het voorstel hebben tot doel te voorzien in een structurele financiering van palliatieve zorgequipes voor kinderen. In deze financiering dient voorzien te zijn tegen het einde dit jaar. Het ontwerp, dat eerder in de Senaat unaniem werd goedgekeurd, werd ook in onze commissie eenparig aangenomen.

                    Mevrouw de voorzitter, het verheugt mij dat vandaag een belangrijk wetsontwerp door de Kamer zal worden goedgekeurd. Het wetsontwerp zorgt er immers voor dat de palliatieve thuiszorg voor kinderen voortaan structureel wordt gesubsidieerd. Tot dusver hingen de thuiszorgteams af van projectsubsidies en giften. België is met zijn aanbod van palliatieve zorg voor kinderen al jaren toonaangevend, maar onze initiatieven bestonden alleen maar bij de gratie van steun voor goede doelen.

Vandaag wordt eindelijk overheidssteun gegarandeerd. Ik wil iedereen eraan herinneren dat het wetsontwerp dat vandaag wordt goedgekeurd aanvankelijk een bicameraal voorstel was. Het gaat om een parlementair initiatief, met als hoofdindieners Myriam Vanlerberghe en Marleen Temmerman in de Senaat, en ikzelf, als hoofdindienster in de Kamer. Voor een keer werkte de Senaat vlugger dan de Kamer. Met mijn sp.a-collega’s als drijvende kracht werd het initiatief in de Senaat eenparig aangenomen.

Gezien het belang van het voorstel – het wetsontwerp heeft immers als doel voor 31 december 2009 bij KB de structurele financiering te realiseren – heb ik mij, samen met mijn collega’s en mede-indieners, achter het wetsontwerp geschaard. Het wetsontwerp is immers identiek aan het wetsvoorstel van mijzelf, mevrouw Katia della Faille, Mia De Schamphelaere, Yvan Mayeur en Marie-Martine Schyns. De goedkeuring van ons wetsvoorstel zou de procedure vertragen om een structurele financiering te krijgen. De reden daarvoor is dat ons instituut complex werkt en het voorstel nog eens ter bespreking naar de Senaat zou moeten terugkeren.

Het verheugt mij enorm dat er ook in de Kamercommissie geen twijfel over bestond dat het voorstel een belangrijke vooruitgang betekent voor de palliatieve zorg in ons land. Vanaf vandaag weten de teams die instaan voor de thuiszorgprojecten – het eerste initiatief bestaat al sinds de jaren ’80 – dat zij niet meer moeten afhangen van steun voor goede doelen en pensenkermissen. Dat is een goede zaak vermits de bestaande equipes goede resultaten kunnen voorleggen. Drie op vier terminaal zieke kinderen, die bijvoorbeeld door de Leuvense en Gentse ploegen worden begeleid, sterven thuis in plaats van in het ziekenhuis. De teams begeleiden zorgverleners, de patiëntjes zelf en de ouders.

I am pleased that today a major bill will be approved by the House. The draft law ensures that palliative home care for children will be structurally subsidised. So far, home care teams depended on project subsidies and donations. Belgium has been the leader in its offer of palliative care for children for years, but our initiatives were only in the grace of support for good causes.

Government aid is finally guaranteed. I would like to remind everyone that the bill that is approved today was initially a bicameral proposal. It is a parliamentary initiative, with Myriam Vanlerberghe and Marleen Temmerman as chief ministers in the Senate, and myself, as chief minister in the Chamber. For one time, the Senate worked faster than the Chamber. With my sp.a. colleagues as the driving force, the initiative was unanimously adopted in the Senate.

Given the importance of the proposal – the draft law, in fact, aims at implementing structural financing by KB by 31 December 2009 – I, together with my colleagues and co-contributors, backed the draft law. In fact, the bill is identical to the bill of mine, Ms Katia della Faille, Mia De Schamphelaere, Yvan Mayeur and Marie-Martine Schyns. The adoption of our bill would delay the procedure for obtaining structural funding. The reason for this is that our institute works complexly and the proposal should be returned to the Senate for discussion again.

I am very pleased that there was no doubt in the Chamber Committee that the proposal represents a significant progress for palliative care in our country. From today on, the teams responsible for the home care projects – the first initiative exists since the 1980s – know that they no longer need to rely on support for charities and pens. This is a good thing as the existing teams can present good results. Three out of four terminally ill children, who are accompanied, for example, by the Leuven and Ghent teams, die at home rather than in the hospital. The teams accompany care providers, the patients themselves and the parents.

                    Ze zorgen ook voor de verstrekking en de uitlening van specifieke zorgmiddelen die niet voorradig zijn in de apotheek of bijvoorbeeld de uitleendiensten van het ziekenfonds. Ze voorzien ook in speciale antidecubitusmatrassen voor kinderen, aangepaste beademingsmiddelen, enzovoort.

Die teams krijgen vandaag eindelijk definitief de zekerheid dat zij financieel worden ondersteund. Ik wil daarom nogmaals mijn collega’s, en natuurlijk ook minister Onkelinx, bedanken voor het steunen van dit initiatief.

                    Mevrouw de voorzitter, mijnheer de minister, collega’s, uiteraard steunen wij het wetsontwerp, dat oorspronkelijk een wetsvoorstel was in de Senaat en een wetsontwerp is geworden, zeker omdat het handelt over palliatieve zorg, wat altijd onze belangstelling zal wegdragen en zal blijven wegdragen, dat is essentieel.

Het enige dat ik daarover wil zeggen, is dat wij natuurlijk moeten opletten dat wij niet te veel in een doelgroepenbeleid belanden en niet te veel kleine dingetjes maken die dan soms aanleiding geven tot te complexe regelgevingen, omdat ze te veel op één bepaalde groep zijn gefocust, maar wij steunen het en wij zullen het blijven steunen.

Ik doe toch een oproep om daaraan, liefst kamerbreed, verder te werken. Er liggen in de commissie verschillende teksten neer over palliatieve zorg. Wij zouden erin moeten slagen om tot één grote tekst te komen die kan worden gedragen door de verschillende fracties, zodat wij vanuit het Parlement een oproep kunnen doen aan de uitvoerende macht, aan de regering. Dat zou dan ook een beetje in uitvoering zijn van het evaluatieplan dat is opgemaakt door de evaluatiecel Palliatieve Zorgen. Daarin vraagt men om op diverse terreinen in meer middelen te voorzien, zowel voor de thuiszorg als voor de intramurale palliatieve zorgen. Mits een stappenplan, mits een financieel plan, wellicht een meerjarenplan, dat is vastgelegd zodat wij weten waar wij uitkomen, kunnen wij dan systematisch verder werken aan een betere uitbouw van de palliatieve zorg.

In die zin wil ik even die bedenking erbij maken, maar uiteraard zullen wij het voorstel steunen.

It calls for more resources in various areas, both for home care and for intramural palliative care. As long as there is a step plan, as long as there is a financial plan, maybe a multi-year plan, which is established so that we know where we are coming from, we can then systematically continue to work on a better development of palliative care.

In that sense, I would like to make a few remarks, but of course we will support the proposal.

                    Mevrouw de voorzitter, collega’s, uiteraard zal ook de Vlaams Belang-fractie het voorliggende wetsvoorstel steunen. Wij zullen uiteraard dezelfde houding aannemen als de houding die wij in de commissie hebben aangenomen.

Ik neem met tevredenheid akte van het standpunt van mijn goede CD&V-collega Luc Goutry. Hij kondigt aan dat wij straks aan een kamerbreed voorstel van resolutie zullen werken. Ik hoop dat zulks inderdaad Kamerbreed zal kunnen gebeuren en dat niet het kleine spelletje zal worden gespeeld.

Wij hopen bijgevolg dat het feit dat als eerste agendapunt een voorstel van resolutie vanwege het Vlaams Belang met betrekking tot palliatieve zorgen ter tafel ligt, geen rem zal zijn op het feit dat iedereen ervoor is gewonnen om van de betrokken sector werk te maken.

Ik hoop dat de behandeling kamerbreed kan gebeuren. De sector is te belangrijk – daarover zijn wij het allen eens – om rond het onderwerp in kwestie kleine, politieke spelletjes te spelen.

Uiteraard zullen wij het voorstel, zoals het nu voorligt, als eerste stap in de goede richting goedkeuren. Niettemin willen wij de komende weken veel verder gaan dan wat hier nu voorligt.

I hope that the treatment can be done across the room. The sector is too important – we all agree on this – to play small, political games around the subject in question.

Of course, we will adopt the proposal, as it is now presented, as a first step in the right direction. Nevertheless, we want to go much further in the coming weeks than what is predicted here now.

                    Mijnheer de voorzitter, mijnheer de eerste minister, heren minister, collega’s parlementsleden, wij gaan vandaag stemmen over een belangrijk wetsontwerp tot wijziging van een aantal bepalingen in het statuut van onze militairen. De Open Vld-fractie staat volledig achter dit wetsontwerp omdat het tegemoetkomt aan de noden van onze militairen in een moderne krijgsmacht.

Zonder nogmaals alle wijzigingen te willen opsommen is het belangrijk om vandaag bij een aantal punten stil te staan. Ten eerste weten we allemaal dat ons Belgisch leger hoofdzakelijk in internationaal verband opereert tijdens militaire operaties. Het ontwerp waarover we vandaag gaan stemmen, omtrent de Engelse taal voor onze militairen, is natuurlijk cruciaal. Voldoende kennis van het Engels volgens de NAVO-normen is geen overbodige luxe.

Ten tweede, mijnheer de minister, de voornaamste uitdaging die de komende jaren en maanden voor u ligt, is het personeelsbeleid van onze krijgsmacht. We hebben in de commissie al heel vaak tegen elkaar gezegd dat we moeten waken over voldoende instroom van jonge krachten in onze krijgsmacht en ook over voldoende uitstroom. We willen onze krijgsmacht immers afslanken. De rechtszekerheid inzake het ontslag en de verbreking van indienstneming is heel belangrijk voor ons.

Mijnheer de minister, zoals u al verschillende keren hebt gezegd, het streefcijfer van 37.725 militairen en burgers, zoals vastgelegd onder minister Flahaut in de politieke oriëntatienota en in het strategisch plan voor de modernisering van de Belgische krijgsmacht, zal vóór 2015 worden behaald, zelfs zonder bijkomende inspanningen. Uiteraard zullen we erover moeten waken dat we ieder jaar genoeg jonge krachten aantrekken.

Door de huidige economische crisis heb ik heel veel reacties op de vacatures vastgesteld. Laten we hopen dat de economie terug aantrekt en dat de economische crisis snel achter ons ligt. Dan zullen we onze beste jongeren ervan moeten overtuigen om in dienst van het vaderland te treden.

De veiligheidssituatie wijzigt en de economische markt wijzigt. Wat het personeelsbeleid betreft, moeten wij heel duidelijk maken waar we onze krijgsmacht zien binnen vijftien jaar. Hoeveel militairen willen we, met welke taken, welk ambitieniveau en welke uitrusting? Dat is van cruciaal belang. Voor ons is het personeelsbeleid heel belangrijk zoals ik daarstraks heb gezegd.

U hebt al gezegd dat we binnenkort in de commissie eindelijk het infrastructuurplan zullen behandelen. Voor ons is het personeel het dierbaarste bezit van de krijgsmacht. Dat personeel heeft voor ons recht op duidelijkheid. Zij moeten weten welke kazernes open blijven en welke kazernes zullen sluiten op welke termijn. Vandaar dat ik u vraag om tijdig de wijzigingen te communiceren die zouden gebeuren in het infrastructuurplan dat nog onder minister Flahaut werd goedgekeurd.

The Open Vld faction fully supports this bill because it meets the needs of our military in a modern military force.

Without wanting to list all the changes again, it is important to stop today on a few points. First, we all know that our Belgian army operates mainly in international relations during military operations. The design we are going to vote on today, about the English language for our military, is of course crucial. Adequate knowledge of English according to NATO standards is not an unnecessary luxury.

Second, Mr. Minister, the main challenge that lies ahead of you in the coming years and months is the personnel policy of our military forces. We have repeatedly told each other in the committee that we must watch for sufficient inflow of young forces into our military force and also for sufficient outflow. We want to reduce our military force. The legal certainty regarding dismissal and termination of employment is very important for us.

Mr. Minister, as you have said several times, the target of 37,725 soldiers and civilians, as set under Minister Flahaut in the political orientation note and in the strategic plan for the modernization of the Belgian military force, will be achieved before 2015, even without additional efforts. Of course, we will have to take care to attract enough young forces every year.

Due to the current economic crisis, I have identified a lot of reactions to the vacancies. Let us hope that the economy will pull back and that the economic crisis will soon be behind us. Then we will have to persuade our best young people to enter into the service of the motherland.

The security situation changes and the economic market changes. When it comes to personnel policy, we need to make it very clear where we see our military force in fifteen years. How many soldiers do we want, with what tasks, what level of ambition and what equipment? This is of crucial importance. For us, personnel policy is very important, as I said later.

You have already said that we will finally deal with the infrastructure plan in the committee soon. For us, staff is the most precious asset of the military force. That staff has the right to clarity for us. They need to know which barracks will remain open and which barracks will close at what time. Therefore, I ask you to communicate in a timely manner the changes that would take place in the infrastructure plan that was still approved under Minister Flahaut.

                    De legergemeenschap heeft absoluut het recht om op tijd te weten wat van haar wordt verwacht.

De continuïteit binnen de krijgsmacht is voor ons ook belangrijk. De Open Vld-Kamerfractie vraagt om heel snel werk te maken van het gemengde loopbaanconcept dat al in het voorjaar van 2007 in beide Kamers werd goedgekeurd. We verschillen af en toe een beetje van mening, maar enkel via het gemengd loopbaanconcept kunnen we samen werken aan een jonge, inzetbare en goede krijgsmacht die nodig is om de vele internationale opdrachten aan te kunnen.

Het oriëntatiepunt staat centraal in het hele debat. Ik zie dat geen enkele militair in geen enkel professioneel leger, waar ook ter wereld, zijn hele leven in dienst blijft. Er is een uitstroom naar de privé of naar andere overheidsdiensten. Ook in België zijn we op de goede weg, maar dan moeten we daar verder werk van maken.

Nog twee belangrijke punten. Open Vld hecht veel belang aan het gemoderniseerd tuchtstatuut voor alle categorieën van militairen, dat vanzelfsprekend moet worden aangepast aan de noden van onze tijd, aan de behoefte van onze organisatie en aan de persoonlijke vrijheden die in een democratische rechtsstaat voor alle burgers gelden. Open Vld wil absoluut dat hiervan een punt wordt gemaakt. Er bestaat een hoge nood aan een coherent, aangepast tuchtstatuut.

Tot slot, het leger en de belastingbetaler investeren in dure en doorgedreven vormingen van onze militairen, en maar goed ook, aangezien militairen zich naar mijn mening blijvend moeten kunnen bijscholen, zoals burgers dat kunnen. Dat aanbod moet er zijn. Wanneer wij militairen de kans geven om zich bij te scholen en dure vormingen te volgen, dan moeten zij uiteraard tekenen voor een goede rendementsperiode binnen onze krijgsmacht. Ik ben heel blij, mijnheer de minister, dat u op dat vlak de nodige rechtszekerheid creëert, en dat de militairen die zich hebben bijgevormd maar voortijdig willen weggaan, deze kosten terugbetalen aan de Belgische Staat. Dat is fair play. Dat is nodig om het krappe budget van Landsverdediging op peil te houden. Het is goed dat het voor alle militairen wordt doorgevoerd.

Mijnheer de minister, ik wens u veel succes met de uitvoering van dit wetsontwerp. U krijgt alvast de steun van de Open Vld-Kamerfractie.

The military community has the absolute right to know in time what is expected of it.

The continuity within the military force is also important to us. The Open Vld Chamber Group calls for very rapid work on the mixed career concept that was already approved in the spring of 2007 in both Chambers. We differ somewhat from time to time, but only through the mixed career concept can we work together on a young, employable and good military force needed to cope with the many international assignments.

The orientation point is central to the whole debate. I see that no soldier in any professional army, anywhere in the world, remains in service all his life. There is an outflow to the private or to other public services. We are also on the right track in Belgium, but then we need to work on that further.

Two other important points. Open Vld attaches great importance to the modernized disciplinary status for all categories of military personnel, which, of course, must be adapted to the needs of our time, to the needs of our organization and to the personal freedoms that in a democratic rule of law apply to all citizens. Open Vld definitely wants to make this a point. There is a high need for a coherent, adjusted discipline status.

Finally, the military and the taxpayers are investing in expensive and advanced formations of our soldiers, and well too, since, in my opinion, soldiers should be able to continue their training permanently, as civilians can. That offer must be there. When we give soldiers the opportunity to graduate and attend expensive formations, they must, of course, sign a good period of yield within our military force. I am very pleased, Mr. Minister, that you are creating the necessary legal certainty in this area, and that the soldiers who have re-formed but want to leave prematurely reimburse these costs to the Belgian State. That is fair play. This is necessary to keep the tight budget of Land Defense at the level. It is good that it is implemented for all military personnel.

I wish you much success with the implementation of this bill. You will receive the support of the Open Vld-Kamerfraction.
