Le texte comprend également une série de définitions nouvelles, par exemple la définition de ce que l'on entend par frais ordinaires ou frais extraordinaires. Le texte permet au juge de contraindre les parents à ouvrir un "compte enfant" sur lequel doivent être versées les contributions alimentaires. Je ne serai pas plus longue car chacun désire intervenir pour faire valoir son idée personnelle dans ce travail collectif. En tout cas, je me réjouis du climat qui a régné dans cette commission sans oublier que, pour modifier quelques dispositions du Code civil pour calculer des contributions alimentaires, un travail collectif d'un an et demi a été nécessaire dans une chambre et que ce texte sera probablement évoqué par le Sénat. Des acteurs judiciaires apporteront vraisemblablement des observations. En effet, il me revient que le Conseil supérieur de la Justice prépare un avis sur le sujet qui sera rendu dans quelques jours
Si nous n'avons pas opté pour une méthode, une grille de calcul, par exemple la grille Renard, la grille du magistrat Wustefeld, la grille d'une association familiale (La Ligue des familles ou le Gezinsbond), c'est parce qu'aucune des grilles ne parvenait aux mêmes résultats, aucune des grilles ne reprenait des éléments identiques pour calculer les contributions alimentaires. Par conséquent, il importe d'affiner le travail.
Je termine par une note de droit comparé. Nous sommes un des seuls pays en Europe, voire dans le monde, à ne pas encore avoir légiféré en la matière. Nous avons un Code civil, qui comprend une ligne sur les contributions alimentaires, laquelle stipule que les parents doivent contribuer, même après leur séparation et leur divorce, à l'éducation et à l'entretien de leurs enfants. Mais dans quasi tous les pays qui ont retenu notre attention, des barèmes, des tables indicatives, des éléments de calcul ou des commissions viennent en aide soit à l'exécutif, soit au judiciaire pour effectuer ce genre de calcul.

If we did not opt for a method, a calculation grid, for example the Grid Renard, the Grid of Magistrate Wustefeld, the Grid of a family association (The League of Families or Gezinsbond), it is because none of the grids achieved the same results, none of the grids took back identical elements to calculate food contributions. I will conclude with a note of comparative law. We are one of the only countries in Europe and even in the world that have not yet legislated on this subject. Mevrouw de voorzitter, collega’s, mijnheer de staatssecretaris, tijdens de voorbije legislatuur hebben wij als wetgever ingegrepen in de verblijfsregeling van kinderen wiens ouders niet meer samenleven door de begrippen “gelijk verdeeld verblijf” en “ongelijk verdeeld verblijf” in het Burgerlijk Wetboek in te schrijven. Ook nu treden wij op inzake de berekening van de onderhoudsgelden voor de bedoelde kinderen.
Mevrouw de voorzitter van de subcommissie, het werk ter zake is telkens vooral in de subcommissie Familierecht gedaan. Voornoemde subcommissie is een kleine commissie van negen leden, die ik hier speciaal begroet. Ook de staatssecretaris heeft ons telkens met zijn aanwezigheid vereerd, waarvoor wij hem danken.
Collega’s, wat zijn vandaag de problemen inzake de onderhoudsgelden? Er zijn verschillende problemen. Ik zal mij echter beperken tot het opsommen van een viertal problemen.
Naar het eerste probleem heeft mevrouw Nyssens al verwezen. Vandaag moeten wij het vooral doen met artikel 203 van het Burgerlijk Wetboek, dat heel beknopt het volgende bepaalt: “De ouders dienen naar evenredigheid van hun middelen te zorgen voor de huisvesting, het levensonderhoud, het toezicht, de opvoeding en de opleiding van hun kinderen.” Voornoemde paragraaf uit het genoemde artikel 203 is de enige richtlijn en kapstok op grond waarvan het onderhoudsgeld wordt overeengekomen of op grond waarvan het onderhoudsgeld in onze vonnissen of arresten wordt bepaald.
Collega’s, tijdens de hoorzittingen die wij hebben gehouden, werd algemeen geopperd dat voornoemd artikel veel te beknopt en te onduidelijk is. Ik verwijs onder andere naar wat de eerste voorzitter van het hof van beroep van Mons, de heer Franeau, ter zake heeft verklaard.
Het gevolg van het voornoemde, heel beperkte artikel is tweeërlei. Er is, ten eerste, de versnipperde aanpak bij onze rechters. Sommige rechters hanteren immers de methode-Renard, terwijl andere rechters de methode van de Gezinsbond hanteren. Ook worden er nog andere, door advocaten uitgewerkte methodes gebruikt. Wij hebben de advocaten in kwestie in de subcommissie ook gehoord. Nog andere rechters hebben hun eigen methode, die zij telkens in hun eigen vonnissen toepassen. Weer andere rechters beperken zich in hun vonnissen tot één zin, die meestal op het volgende neerkomt: “Rekening houdende met de financiële draagkracht van de ouders en met de kosten van het kind, wordt het onderhoudsgeld op – bijvoorbeeld – 150 euro per maand bepaald.”
De bedragen voor de onderhoudsgelden die op voornoemde manier worden uitgesproken, kunnen in gelijkaardige situaties verschillen, waarop professor Senaeve ons heel duidelijk heeft gewezen.

During the last legislature, we, as legislators, intervened in the residence arrangement of children whose parents no longer coexist by entering the concepts “equally distributed residence” and “inequally distributed residence” into the Civil Code. We are also taking action on the calculation of maintenance payments for those children.
The work on this subject is mainly done in the Family Law Subcommittee. The above-mentioned subcommittee is a small committee of nine members, which I especially welcome here. The Secretary of State also honored us with his presence, for which we thank him.
Colleagues, what are the problems with maintenance payments today? There are various problems. However, I will limit myself to listing four problems.
The first issue has already been mentioned by Ms. Nyssens. Today, we have to do this in particular with Article 203 of the Civil Code, which very briefly states: “Parents shall provide, in proportion to their resources, for the housing, subsistence, supervision, education and training of their children.” The aforementioned paragraph from the aforementioned Article 203 is the only directive and capstone under which the maintenance is agreed or under which the maintenance is determined in our judgments or judgments.
Colleagues, during the hearings we held, it was generally criticized that the aforementioned article is too concise and too vague. I refer, inter alia, to what the first chairman of the Court of Appeal of Mons, Mr Franeau, has stated in this regard.
The result of the aforementioned, very limited article is dual. First, there is the fragmented approach of our judges. Some judges use the Renard method, while other judges use the Family Alliance method. There are also other methods developed by lawyers. We have also heard the lawyers in question in the subcommittee. Other judges have their own method, which they use in their own judgments. Other judges limit themselves in their judgments to one sentence, which usually consists of the following: “Taking into account the financial support of the parents and the expenses of the child, the maintenance is determined to – for example – 150 euros per month.”
The amounts for maintenance payments expressed in the aforementioned manner may vary in similar situations, which Professor Senaeve has clearly pointed out to us.

Een tweede gevolg van dit beknopte artikel 203 is een onvoldoende motivering voor de ouders, voor de onderhoudsplichtigen of de onderhoudsgerechtigden. We hebben daarover onder andere nog eens de eerste voorzitter van het hof van beroep van Mons gehoord. Hij heeft gezegd, ik citeer uit het verslag: “Vandaag nog stellen bepaalde rechtbanken de onderhoudsbijdrage dusdanig vast, dat de betrokken ouders onmogelijk kunnen begrijpen welke redenering erachter zit”. Als voorbeeld gaf de spreker ons een vonnis van een bepaalde jeugdrechtbank waarbij een vader een onderhoudsbijdrage werd opgelegd van 500 euro per maand in de eerste periode, 375 euro per maand in de tweede periode, en dan plots maar 200 euro per maand zonder verdere uitleg.
Dat is een eerste probleem: de beknoptheid van artikel 203 van het Burgerlijk Wetboek.
Een tweede probleem: zowel in de overeenkomsten als in de vonnissen – in rechtspraak dus – wordt de laatste tijd een onderscheid gemaakt tussen de gewone kosten die worden betaald met het onderhoudsgeld, en de buitengewone kosten. Gewone en buitengewone kosten zijn begrippen die op het veld worden gebruikt en waarmee de ouders vandaag moeten werken, maar die in onze wetgeving niet gekend zijn.
Buitengewone kosten geven vandaag vooral aanleiding tot enorm veel discussie, vooral als het begrip niet werd gedetailleerd in het vonnis of in de overeenkomst. Ik verwijs bijvoorbeeld naar een schoolrekening: is dat al dan niet een buitengewone kostenfactor? Daarover zijn er ellenlange discussies, er worden procedures over gevoerd, dat is dus een tweede belangrijk probleem.
Een derde probleem: het gelijk verdeeld verblijf. Dat werd in de vorige legislatuur als een van de mogelijke verblijfsregelingen ingevoerd. Het betekent dat de kinderen even veel bij de ene ouder als bij de andere verblijven. Maar wat met de kosten? Wie betaalt de schoolrekeningen? Wie ontvangt de kinderbijslag? Moet er een kinderrekening worden geopend? Zo zijn er nog tal van vragen.
Een vierde probleem dat ik hier kort wil aanhalen, gaat over de niet-betaling van het onderhoudsgeld. Ook al gaat onderhoudsgeld voor alles en moet men er altijd eerst voor zorgen dat men het onderhoud van zijn kinderen kan betalen nog voor hypothecaire leningen en andere kosten, toch stellen we vandaag vast dat heel veel onderhoudsgelden ofwel laattijdig ofwel niet worden betaald. Dat is een belangrijke vaststelling waar wij als wetgever ook iets moesten aan doen. Vandaag is het zo dat loondelegatie mogelijk is. Men kan de rechter vragen om bij de bron – de werkgever, de instelling die de uitkering uitbetaalt – het onderhoudsgeld te innen. Dat is een mogelijkheid, maar geen must: de rechter is soeverein in het al dan niet toekennen van die loondelegatie.

Extraordinary costs today are ⁇ a source of great debate, especially if the concept was not detailed in the judgment or in the agreement. I refer, for example, to a school bill: is it or not an extraordinary cost factor? There are long discussions about this, procedures are being carried out, which is a second important issue.
A third problem: the equally distributed residence. This was introduced in the previous legislature as one of the possible residence arrangements. It means that the children stay with one parent as much as with the other. But what about the costs? Who pays the school bills? Who receives child allowance? Should a child account be opened? There are so many questions.
A fourth issue that I would like to briefly address here concerns the non-payment of maintenance. Even though maintenance goes for everything and one must always first make sure that one can pay the maintenance of their children even for mortgage loans and other expenses, yet today we note that a lot of maintenance is either late or not paid. This is an important conclusion that we as legislators had to do something about. Today, wage delegation is possible. You can ask the court to collect the maintenance from the source – the employer, the institution that pays the benefit – the maintenance. That is a possibility, but not a must: the judge is sovereign in granting or not granting that wage delegation.

Wat is de oplossing die wij in de subcommissie Familierecht en de commissie voor de Justitie hebben gevonden? Ik overloop de vier problemen en de oplossingen die wij hebben uitgewerkt.
Ten eerste, voor het vaststellen van de onderhoudsgelden hebben wij de objectivering van de onderhoudsgelden in het leven geroepen. Dat wil zeggen dat de rechter verplicht melding moet maken van een achttal elementen of parameters die hij of zij heeft afgetoetst en op basis waarvan hij de kinderalimentatie heeft bepaald.
U kunt zich afvragen welke elementen of parameters dat precies zijn. Wat moet de rechter aftoetsen? Ik som de belangrijkste parameters op.
Wat zijn de inkomsten van beide ouders? Het is verplicht dit af te toetsen en te vermelden in het vonnis.
Wat zijn de kosten van het kind? Zijn er bijzondere of gewone kosten voor dat kind? Wat zijn de gemiddelde kosten van het kind?
Hoe is de verblijfsregeling van het kind geregeld? Verblijft het evenveel bij de ene als bij de andere ouder of ligt de verhouding anders?
Wat is het bedrag van de kinderbijslag of van de andere voordelen die aan het kind of de kinderen wordt uitbetaald?
Dat is de objectivering die wij met deze wet in het leven willen roepen.
Ik meen dat dit nieuwe artikel 1321 van het Gerechtelijk Wetboek niet alleen voor de rechters, maar ook voor de partijen een zekere discipline zal vereisen die er vandaag niet altijd is. Ik verwijs naar hetgeen we in de hoorzittingen hebben gehoord van niet alleen professoren, maar ook van magistraten, met name dat het vandaag in rechtszaken heel vaak voorkomt dat de stukken die men voorlegt onvolledig zijn, dat de stukken in verband met de inkomsten achterhaald zijn, dat rechters soms tussenvonnissen moeten maken om de partijen te verplichten duidelijkheid te scheppen over de financiële situatie van de ouders of over de precieze inkomsten, zoals bijvoorbeeld de kinderbijslag die het kind geniet.
Ik ben ervan overtuigd, en ik waarschuw daar ook voor, dat er na het goedkeuren van deze wet een zekere discipline – die er vandaag niet is – zal moeten zijn.
Ten tweede, ik verwijs vooral naar de hoorzitting met de voorzitter van de Nederlandse werkgroep Alimentatienormen, de heer Luiten. Collega Nyssen heeft gezegd dat wij onder de indruk waren van hetgeen hij ons vertelde. Na die hoorzittingen zijn wij in consensus tot het besluit gekomen dat er op vandaag in België geen ideaal berekeningsmodel bestaat, zoals dat in Nederland wel het geval is.
Een belangrijke nuance is dat het Nederlandse model er is gekomen vanuit de magistratuur en niet vanuit de wetgever. De Nederlandse magistraten hebben zich samengezet en hebben een berekeningsmodel uitgewerkt die elke Nederlandse rechter vandaag toepast.

What is the solution we found in the Family Law Subcommittee and the Justice Committee? I will discuss the four problems and the solutions we have developed.
First, for the purpose of determining the maintenance payments, we have introduced the objectivation of the maintenance payments. That is to say, the court is obliged to indicate a number of eight elements or parameters that he or she has tested and on the basis of which he or she has determined child maintenance.
You may wonder which elements or parameters are exactly. What should the judge check? I have the most important parameters.
What is the income of both parents? It is obliged to check this and mention it in the judgment.
What are the costs of the child? Are there any special or ordinary costs for that child? What is the average cost of the child?
How is the child’s residence arrangement arranged? Does it live in the same amount with one parent as with the other parent or is the relationship different?
What is the amount of the child allowance or other benefits paid to the child or children?
This is the objectivation that we want to bring to life with this law.
I think that this new article 1321 of the Judicial Code will require a certain discipline, not only for the judges, but also for the parties, which is not always there today. I refer to what we have heard in the hearings not only from professors but also from magistrates, in particular that today in court proceedings it is very frequent that the documents submitted are incomplete, that the documents relating to the incomes are outdated, that judges sometimes have to make interim judgments to require the parties to make clear about the financial situation of the parents or about the precise incomes, such as the child allowance that the child enjoys.
I am convinced, and I also warn, that after the adoption of this law, there will have to be a certain discipline – which is not there today.
Secondly, I refer mainly to the hearing with the Chairman of the Dutch Working Group Alimentatiennormen, Mr. Luiten. Colleague Nyssen said that we were impressed by what he told us. After those hearings, we came to a consensus conclusion that today in Belgium there is no ideal calculation model, as is the case in the Netherlands.
An important nuance is that the Dutch model came from the magistracy and not from the legislature. The Dutch magistrates have joined together and developed a calculation model that every Dutch judge applies today.

In België hebben wij geen ideaal berekeningsmodel waar de hele magistratuur zich achter schaart. In die zin hebben wij ons met deze wet eigenlijk beperkt tot het oprichten van een commissie die aanbevelingen moet opstellen voor de begroting inzake de kinderalimentatie.
Ik richt mij wat dit punt betreft tot de staatssecretaris. Open Vld heeft van bij het begin van de discussie gezegd tamelijk huiverig te staan tegenover een vast berekeningsmodel dat alle rechters moeten hanteren. Daardoor zouden zij verworden tot rekenmachines. Ik herinner u eraan, geachte staatssecretaris, dat u in de subcommissie voor het Familierecht hebt gezegd dat er in twee stappen zal worden gewerkt. U zei dat als deze wet, met de objectivering van de onderhoudsgelden, goed werkt, de evaluatiecommissie misschien niet nodig zal zijn en men zich kan beperken tot het verder toepassen en het aftoetsen van die elementen.
U zei, en ik citeer: “In de eerste plaats moeten de magistraten ertoe worden verplicht hun beslissingen omstandiger met redenen te omkleden. Dat alleen al zou een hele stap vooruit betekenen. Vervolgens moet de evaluatiecommissie nagaan of de nieuwe wet goed werkt, enerzijds, en de diverse berekeningmethodes evalueren, anderzijds”. Maar de afspraak die wij hebben gemaakt, is dat als de objectivering goed werkt, de evaluatiecommissie niet moet zoeken naar een ideaal berekeningsmodel.
Dat is de eerste oplossing die door deze wet wordt geboden.
De tweede oplossing, voor het probleem van de gewone en buitengewone kosten, is dat wij erin geslaagd zijn definities in de wet in te schrijven van wat gewone kosten zijn. Dat was een veeleer gemakkelijke definitie. Moeilijker was te definiëren wat buitengewone kosten zijn. In eenvoudige woorden gezegd zijn dat kosten die niet met het gewone onderhoudsgeld kunnen worden betaald.

This is the first solution provided by this law.
The second solution, for the problem of ordinary and extraordinary costs, is that we have managed to enter into the law definitions of what are ordinary costs. That was a rather easy definition. It was more difficult to define what extraordinary costs are. In simple words it is said that costs that cannot be paid with the regular maintenance allowance.
I will again take the example of the school account, which has different costs. Ordinary reception and soup, for example, are ordinary costs, but sea classes or forest classes, for which the parent must pay 100 euros or more, can be extraordinary costs. These two definitions are now included in the law.
The third problem is the equally distributed accommodation and the arrangement of costs: who pays what costs for the children? With this legislative amendment, the principle of child accounting is entered into the law. The court may require the parties to open an account on behalf of the children on which each of the parents has authority.

De rechter kan ook bepalen wat er allemaal op die rekening moet komen: de kinderbijslag, eventueel de onderhoudsbijdrage van elk van beide ouders, andere voordelen. De rechter kan ook de verhouding bepalen volgens de welke de kosten tussen de ouders worden verdeeld.

Hij kan het niet meer toestaan, hij moet het toestaan.
De ratio legis is de volgende. In de strafwet staat letterlijk dat iemand die twee maanden onderhoudsgeld achterstallig is, strafbaar is. Naar analogie van de strafwet moet de loondelegatie, die vandaag reeds bestaat als een mogelijkheid, een verplichting worden zodra men twee maanden of langer onderhoudsgeld achterstallig is.

Lorsqu'il y a des enfants, outre les problèmes relatifs à leur hébergement, la question des contributions alimentaires est l'une des principales pommes de discorde. Si à cette période déjà troublée viennent s'ajouter des conflits quant au montant de ces contributions alimentaires, les difficultés s'amoncellent, d'autant plus que ces questions dépassent de loin le moment du divorce ou de la séparation pour se prolonger pendant des années.
Depuis longtemps, le montant des contributions alimentaires est une source potentielle d'incompréhension et de division, comme mes collègues l'ont dit précédemment. Quand il s'agit de veiller aux besoins des enfants, on pourrait s'attendre à ce que tous les parents contribuent volontairement – et je dirais même sans compter. Malheureusement, la réalité est tout autre, surtout lorsque des inégalités et des incompréhensions entourent la fixation de ces contributions.
En effet, l'une des raisons invoquées aux non-paiements hélas nombreux des contributions alimentaires est le manque de compréhension et de transparence dans la fixation de ces montants. Il était donc plus que temps de trouver le moyen d'objectiver le calcul de ces contributions alimentaires. En visant plus de cohérence, de clarté, de transparence et d'uniformité dans les décisions de justice, l'objectif est aussi d'obtenir une plus grande adhésion des parents et donc des paiements effectifs, principalement pour le bien-être des enfants.
La proposition de loi dont nous discutons aujourd'hui répond à ce souci d'objectivation. Comme l'a dit Mme Nyssens, celle-ci a été précédée de nombre d'auditions et d'un travail de réflexion considérable. Je tiens à souligner le travail commun de tous les partis démocratiques dans la rédaction finale du texte qui nous est proposé. Dans le sillage de ce travail commun, le groupe PS soutient activement cette proposition. À l'instar des interventions en commission, je voudrais insister sur quelques points.

A divorce or separation is always a painful time for families or former spouses, but also for children. Once the couple has made the official and definitive decision to separate, everything is obviously not settled. When there are children, in addition to the problems related to their accommodation, the issue of food contributions is one of the main apples of discord. For a long time, the amount of food contributions has been a potential source of misunderstanding and division, as my colleagues have said earlier. When it comes to taking care of children’s needs, one could expect all parents to contribute voluntarily – and I would even say without counting. Unfortunately, the reality is quite different, especially when inequalities and misunderstandings surround the fixation of these contributions.
Indeed, one of the reasons invoked for the unfortunately numerous non-payment of food contributions is the lack of understanding and transparency in the fixing of these amounts. It was therefore more than time to find a way to objectively calculate these food contributions. By aiming for greater coherence, clarity, transparency and uniformity in judicial decisions, the goal is also to ⁇ greater parental support and thus effective payments, primarily for the well-being of children.
The bill we are discussing today responds to this concern of objectivation. As Ms. Nyssens said, this was preceded by numerous hearings and considerable reflection work. I would like to emphasize the joint work of all democratic parties in the final drafting of the text that is proposed to us. Following this joint work, the PS Group actively supports this proposal. As with the interventions in the committee, I would like to emphasize a few points.

On sait que les méthodes de calcul existantes donnent, pour une même situation, des résultats très différents. Les auditions l'ont d'ailleurs prouvé. Il ne fallait donc pas que le nouveau projet pérennise le projet existant auquel nous voulions justement remédier. Nous soutenons dès lors le choix qui a été fait de laisser la possibilité au Roi de fixer un mode de calcul destiné à favoriser la mise en œuvre des recommandations de la Commission des contributions alimentaires qui, comme nous l'avons déjà dit, est un outil tout à fait nouveau créé par le présent texte et qui s'inspire notamment de l'exemple des Pays-Bas.
Ensuite, au vu du principe d'indépendance du juge et de la nécessité de pouvoir s'adapter à la spécificité de chaque situation, nous avons répété qu'il ne nous semblait pas adéquat d'imposer au magistrat des critères et/ou une méthode contraignante dont il ne pourrait absolument pas s'écarter. Nous avons préféré établir des critères de référence et donner la possibilité à la Commission de faire des recommandations, critères de référence ou recommandations dont le magistrat pourra toujours s'écarter moyennant une motivation spéciale. C'est un apport du nouveau texte.
Il est intéressant de constater qu'il y a eu un parallèle avec le travail réalisé sous la précédente législature dans le cadre du projet de loi sur l'hébergement alterné égalitaire. On a finalement suivi le même type de philosophie: la fixation de critères et l'obligation d'une motivation spéciale pour une meilleure compréhension.
Je souhaiterais également insister sur les mesures transitoires qui sont souvent oubliées. Or, c'est souvent le plus difficile dans ce type de matière. Ces nouvelles dispositions s'appliqueront évidemment à toute nouvelle demande introduite après l'entrée en vigueur de la loi. Toute procédure introduite avant l'entrée en vigueur de la loi et toute décision non coulée en force de chose jugée seront aussi régies par les nouvelles mesures. Lorsque des nouvelles circonstances, indépendantes de la volonté des parties, modifient sensiblement leur situation ou celle des enfants, une demande de modification d'une contribution alimentaire définitivement fixée préalablement à l'entrée en vigueur de la loi sera considérée comme une nouvelle demande et sera donc soumise aux nouvelles règles du texte qui nous est proposé aujourd'hui. Nous souhaitions qu'un maximum de familles puisse bénéficier de cette nouvelle loi qui nous semble être véritablement une avancée dans les critères et vers une meilleure transparence.

I would also like to emphasize transitional measures that are often forgotten. However, this is often the most difficult thing in this type of matter. These new provisions will obviously apply to any new application submitted after the entry into force of the law. Any proceedings initiated before the entry into force of the law and any decision not brought in force of thing judged shall also be governed by the new measures. When new circumstances, independent of the will of the parties, significantly change their situation or that of the children, a request for modification of an alimentary contribution definitively fixed before the entry into force of the law will be considered as a new request and will therefore be subject to the new rules of the text proposed to us today. We wished that as many families as possible could benefit from this new law which seems to us to be a real step forward in the criteria and towards greater transparency.

Het voorstel dat is uitgewerkt, probeert in een aantal aspecten tegemoet te komen aan die maatschappelijke vragen, aan het gebrek aan transparantie, een gevoel van willekeur, het niet-meegroeien van de bijdragen van de kosten die een opgroeiend kind met zich meebrengt.
Ook op basis van de amendering aangebracht door onze fractie zijn wij bijzonder blij met dit gehele voorstel, dat hopelijk een grotere objectivering van de onderhoudsbijdrage voor kinderen met zich zal meebrengen.

Er zijn ook de aanbevelingen voor de begroting van de kosten en de vaststelling van de bijdragen. There are also recommendations for budgeting costs and fixing contributions. They can serve as a lead in the negotiation, for example of divorce with mutual consent, and they also support the magistrates in the formation of their judgment. Thus, we hope to ⁇ more uniformity and legal certainty in practice.

Il y a d'abord eu le combat entre 1999 et 2003 pour la création d'un service de créances alimentaires visant à garantir le paiement de ces créances et à pouvoir les recouvrer. C'était l'un des premiers combats menés par les organisations de femmes depuis une quarantaine d'années.
Quand on s'est préoccupé du paiement et du respect d'une décision de justice concernant le paiement d'une créance d'un des parents vers l'autre, on s'est rendu compte très rapidement qu'il était également important de maîtriser et de comprendre l'estimation du montant de ces créances pour dépasser le sentiment d'injustice qui habitait celui qui devait les payer.
Avec ma collègue Marie-Thérèse Coenen, j'ai organisé pendant quelques années des rencontres avec des pères, des mères, des organisations féministes et des organisations devant travailler avec les parents en instance de séparation, avec des juges. On ne remerciera d'ailleurs jamais assez le juge Franeau mais aussi Roland Renard car même si nous n'avons pas opté pour sa méthode, ce monsieur a fait avancer les choses; il s'est battu pour l'objectivation du calcul des créances alimentaires dès le milieu des années '80.

La loi sur le divorce vise à améliorer et à accélérer la procédure de séparation. Or, selon nous, toutes les questions relatives aux créances et à la prise en compte du suivi, de l'éducation, de l'entretien des enfants ne peuvent être traitées au même rythme prévu pour une séparation. Il nous semblait donc important d'intégrer ces questions dans le débat.
En outre, une étude a notamment été demandée, en 2006, à l'Université de Liège en vue d'évaluer la méthode Renard. Mais ce n'est que quand nous avons entamé nos travaux, il y a environ un an, que nous avons eu accès aux résultats des études effectuées et que nous avons pu entamer nos travaux sur l'objectivation du calcul des créances alimentaires.
Le texte de loi qui résulte des travaux qui ont été effectués et des auditions qui ont eu lieu ne propose pas, contrairement à mon souhait, le recours à une méthode identique pour l'ensemble des magistrats. Mais les représentants de la magistrature ont fait savoir clairement qu'ils ne voulaient pas qu'on leur impose une méthode afin de préserver leur liberté d'appréciation. It was therefore important for us to incorporate these issues into the debate.
In addition, a study was requested, in particular, in 2006, from the University of Liège in order to evaluate the Renard method. But it was only when we started our work, about a year ago, that we had access to the results of the studies carried out and that we were able to start our work on the objectivation of the calculation of maintenance claims.
The text of the law resulting from the work that has been carried out and the hearings that have taken place does not, contrary to my wish, propose the use of an identical method for all magistrates. But the representatives of the judiciary made clear that they did not want a method to be imposed on them in order to preserve their freedom of judgment. This concern has been broadly expressed by the members of Parliament.
In my opinion, the amalgamation is excessive. Indeed, there are actually ways to work and methods can be developed and can be the subject of consensus. That said, a good method of course includes the freedom of judgment of the magistrates.

C'est la raison pour laquelle Ecolo-Groen! a cosigné, et donc soutiendra, l'amendement qui résultait des travaux que nous avons menés. Il n'y a pas de méthode imposée mais il y a imposition d'une motivation de la décision du juge, qui doit stipuler à la fois la nature et le montant des facultés de chacun des parents, le relevé des frais ordinaires et la manière dont ils sont évalués et la définition et la nature des frais extraordinaires.
En ce qui concerne ce dernier élément, monsieur le secrétaire d'État, j'aimerais que les choses soient claires. Nous essayons, dans les articles de la proposition, de bien préciser ce que représente une dépense extraordinaire, c'est-à-dire une dépense exceptionnelle, nécessaire ou imprévisible, liée à des circonstances exceptionnelles. Je me souviens que nous avons cité en commission ces éléments crispants qui sont utilisés aujourd'hui par les parents pour considérer si une dépense est exceptionnelle ou pas. Je citerai par exemple les camps de vacances ou les classes vertes.

Un autre élément positif de cette proposition qui fait que nous la soutiendrons, même en l'absence d'une méthode imposée aux magistrats, est la mise en place de la Commission des Contributions alimentaires. Parmi ses missions, il y a l'évaluation et l'élaboration de recommandations pour les frais estimés nécessaires pour assurer l'hébergement, l'entretien, la santé, la surveillance, l'éducation, la formation, l'épanouissement des enfants et donc la fixation des contributions. Si elle constate que les nouveaux dispositifs prévus n'éliminent pas les variations arbitraires des montants des contributions, cette commission aura l'obligation d'élaborer de manière collective entre les magistrats qui la composeront, une méthode ou de meilleurs outils de référence qui deviendraient alors obligatoires pour les juges.

Il est nécessaire de disposer du rassemblement du montant des créances, de savoir à quoi elles correspondent, de savoir si elles sont payées ou non, de connaître les jugements, les critères pris en compte pour les revaloriser, les modifier. Il faut un lien entre toutes ces données et le service des créances alimentaires, qui est souvent dépourvu de données et qui ne peut intervenir que lorsqu'on fait appel à ses services. Il existe des outils en la matière qui peuvent mener à une meilleure efficacité.

Enfin, je vous interpelle – et je m'interpelle moi-même ce faisant – sur le point suivant. Nous avons introduit dans cette proposition de loi la possibilité du compte enfant. Il s'agit d'une pratique existante spontanée, sur la base d'accords entre parents qui décident de verser les allocations familiales sur un compte commun et s'arrangent pour l'utiliser. Cela fonctionne quand les parents sont en accord autour d'un projet d'éducation et dans la répartition des frais.
Dans notre proposition, nous prévoyons qu'à la demande d'un des deux parents, le juge peut imposer la mise en place de ce compte. C'est le juge qui déterminera quelle somme devra y être versée, quand, à quelles dépenses elle sera utilisée, comment contrôler son utilisation et comment combler le déficit éventuel de ce compte.
En ce qui concerne les familles qui ont de faibles revenus, si vous vous souvenez de notre première audition concernant l'évaluation de la méthode Renard par l'Université de Liège, un des éléments mis en évidence était qu'en cas de parent seul, avec de faibles revenus, avec l'hébergement prioritaire ou majoritaire de l'enfant, l'argent de la créance alimentaire et les revenus de cette personne sont mélangés dans la vie quotidienne. On ne sait donc pas distinguer ce qui est consacré à l'enfant et ce qui est consacré à la famille dont l'enfant fait partie.
Dès lors, avec le dispositif mis en place par le biais de la proposition, je me demande si nous allons préserver malgré tout l'autonomie du parent qui héberge l'enfant dans l'organisation de la vie quotidienne et de l'utilisation de cet argent. Ne risquons-nous pas de mettre en difficulté ces familles monoparentales à faibles revenus? Si tel devait être le cas, ne devrions-nous pas prendre des dispositions permettant de garantir cette autonomie et de ne mettre en place ce compte que s'il y a consentement des deux parents?
Je vous interroge. Je n'ai pas la réponse à cette question.
J'ai été interpellée car je me suis dit qu'on risquait d'entrer dans une logique de contrôle si le système ne devait pas marcher. Comme on l'a répété lors de toutes nos discussions, le compte enfant ne fonctionne qu'en cas d'accord et de confiance entre les parents. On peut imaginer que le juge n'imposera pas un tel compte s'il n'y a pas cette relation entre les parents; toutefois, on ne maîtrise pas cette décision.
Si la relation se dégrade, on risque d'avoir un outil de contrôle et peut-être de paralysie qui sera utilisé par l'un des parents contre l'autre alors que cet argent est nécessaire dans la vie quotidienne de la famille et donc de l'enfant pour lequel cet argent est versé.

Are we not at risk of putting these low-income single-parent families in trouble? If this is the case, should we not make arrangements to guarantee that autonomy and to set up that account only with the consent of both parents?
I ask you. I do not have the answer to this question.
I was arrested because I thought I was at risk of entering a control logic if the system didn’t work. As repeated in all our discussions, the child account only works if agreed and trusted between parents. It can be imagined that the judge will not impose such an account if there is no such relationship between parents; however, this decision is not controlled.
If the relationship deteriorates, one risks having a tool of control and ⁇ paralysis that will be used by one of the parents against the other while this money is needed in the daily life of the family and therefore of the child for whom this money is paid.

Monsieur le secrétaire d'État, je sais que vous y travaillez et que nous pourrons éventuellement bientôt assister à la mise en place d'une telle structure, même si ce sera long et difficile.
Je tiens vraiment à remercier M. Renard et l'ensemble des magistrats qui, avant que nous ne fassions ces travaux, se sont mis d'accord entre eux autour d'une ou de plusieurs méthodes pour essayer d'objectiver, se méfiant de leur propre capacité à parfois prendre des décisions sans les motiver suffisamment, notamment sur la base d'a priori et d'un manque de maîtrise lorsqu'on est face à des personnes en difficulté. Monsieur le président, mes chers collègues, le texte dont nous débattons aujourd'hui est l'aboutissement d'un long travail de concertation entre les différents groupes politiques et également les professionnels du terrain.
Cette proposition de loi entend remédier à une difficulté concrète rencontrée par bon nombre de parents qui se séparent: l'incompréhension et, partant, la difficulté à accepter les décisions de justice qui établissent la participation financière de l'un ou l'autre dans les frais d'éducation et d'entretien des enfants communs. En effet, certains magistrats rendent des décisions brèves et laconiques, contenant peu ou pas du tout d'explications sur le raisonnement qu'ils ont suivi pour aboutir à la condamnation du parent à tel ou tel montant de part contributive.
Le justiciable doit, selon nous, bénéficier d'une justice claire et équitable, ce qui implique qu'il est en droit d'attendre du magistrat qu'il rende une décision motivée et compréhensible par lui. C'est d'autant plus important qu'en la comprenant, il sera plus enclin à l'appliquer spontanément. On évite ainsi la lourdeur et la pénibilité d'une exécution forcée de ces décisions. En ces matières qui touchent directement l'intérêt des enfants, les querelles et discussions ne sont profitables à personne et certainement pas à ceux-là même dont on veut organiser l'entretien et l'éducation, c'est-à-dire les enfants.
Cette pratique fort regrettable de certains magistrats a rendu une intervention législative nécessaire. La question à se poser était de savoir dans quelle mesure le législateur pouvait ou devait intervenir. Les textes de base qui sont à l'origine de cette réforme proposaient que le montant de la part contributive soit déterminé en fonction d'un coefficient de proportionnalité à appliquer, sauf situation particulière, aux ressources cumulées des parents, en fonction de l'âge et du nombre des enfants.
Ce coefficient de proportionnalité devait être déterminé par le Roi. En d'autres termes, les auteurs des textes de base entendaient inscrire dans le Code civil belge le choix d'une méthode de calcul de parts contributives dans les frais relatifs aux enfants communs que les parents peuvent mutuellement se réclamer lorsqu'ils sont séparés.
De nombreuses et riches auditions ont été organisées et d'intéressants débats s'en sont suivis. La conclusion qui s'est imposée à tous au terme de ces discussions est qu'aucune méthode de calcul actuellement pratiquée dans les différents arrondissements judiciaires du pays, ou existante et non encore pratiquée dans ces arrondissements, n'est apte à servir de modèle universel. Aucune en effet ne permet de répondre aux spécificités de toutes les situations familiales.
Pour répondre à une intervention de tout à l'heure, il me paraît très difficile de trouver deux situations rigoureusement identiques. On demandait une uniformisation des décisions de justice et un montant identique dans tous les arrondissements pour la personne bénéficiaire ou condamnée, s'il s'agit des mêmes circonstances: l'évidence n'est souvent qu'une apparente identité de situations, très différentes dans la réalité.

This bill aims to address a concrete difficulty encountered by many separating parents: the misunderstanding and, therefore, the difficulty of accepting judicial decisions that establish the financial participation of one or another in the costs of education and maintenance of the common children. Indeed, some magistrates make short and laconic decisions, containing little or no explanation whatsoever on the reasoning they followed to result in the condemnation of the parent to this or that amount of contributive share.
The justiciable must, in our view, benefit from a clear and equitable justice, which implies that he is entitled to expect the magistrate to make a reasoned and understandable decision. This is all the more important because by understanding it, he will be more inclined to apply it spontaneously. This avoids the gravity and painfulness of forced execution of these decisions. In these matters that directly affect the interests of children, quarrels and discussions are not beneficial to anyone and ⁇ not to those themselves whose conversation and education is intended to be organized, that is, children.
This very regrettable practice of some magistrates has made legislative intervention necessary. The question to be asked was to what extent the legislator could or should intervene. The basic texts that led to this reform proposed that the amount of the contributive share be determined on the basis of a proportionality coefficient to be applied, except in particular circumstances, to the cumulative resources of the parents, according to the age and the number of children.
This coefficient of proportionality was to be determined by the King. In other words, the authors of the basic texts intended to include in the Belgian Civil Code the choice of a method for calculating the contribution shares in the costs relating to the common children that parents can claim to each other when they are separated.
Many and rich hearings were held and interesting discussions followed. The conclusion that has been imposed on all at the end of these discussions is that no calculation method currently practiced in the various judicial districts of the country, or existing and not yet practiced in these districts, is suitable to serve as a universal model. None of them can meet the specifics of all family situations.
In response to a recent intervention, I find it very difficult to find two rigorously identical situations. They demanded a uniformization of judicial decisions and an equal amount in all districts for the beneficiary or convicted person, if it is the same circumstances: the evidence is often only an apparent identity of situations, very different in reality.

Pour le groupe MR, il était évident que le législateur ne devait pas poser le choix, forcément arbitraire, d'une méthode parmi d'autres, faisant fi des inconvénients de la méthode choisie et des avantages de celles que l'on délaisse. Chaque méthode comporte des avantages et des inconvénients.
L'important pour mon groupe et moi-même était de préserver l'autonomie des magistrats. Celle-ci constitue, selon nous, une garantie de répondre au mieux à la situation particulière de chaque famille tout en rencontrant l'attente légitime du justiciable qui veut comprendre la décision de justice qui lui est imposée.
Je suis particulièrement heureuse que cette prudence ait guidé les collègues de la sous-commission de la Famille et de la commission Justice ainsi que vous, monsieur le secrétaire d'État, pour finalement aboutir à une réforme en deux phases.
Dans la première phase, le juge sera tenu d'indiquer, dans la décision, différents éléments de nature à éclairer celle-ci comme, par exemple, la nature et le montant des facultés (faculté financière, matérielle, morale) du père et de la mère, les frais ordinaires et extraordinaires relatifs aux enfants qu'ils ont en commun, les modalités d'hébergement et la contribution en nature de chacun des parents.
Certaines notions ont, par la même occasion, été définies – ce qui n'était pas le cas auparavant –, afin de réduire les divergences d'appréciation qu'elles pouvaient entraîner dans les décisions de justice. Le juge doit enfin indiquer dans la décision la manière dont il a pris en compte les différents éléments mentionnés dans la décision fixant le montant de la fameuse part contributive. En organisant le raisonnement du magistrat et en lui imposant de répondre à certaines questions objectives, on tend vers une plus grande objectivité dans le choix des critères pris en considération et dans la manière dont ils sont examinés, tout en sauvegardant la marge de manœuvre et l'autonomie intellectuelle du magistrat dans sa décision pour apporter une solution sur mesure à chaque situation familiale.
Il est tout à fait possible que cette première étape permette déjà de répondre aux critiques contre le système actuel et incite la majorité des juges à mieux élaborer leur jugement en cette matière. Cela serait d'ailleurs une belle victoire et l'intervention du législateur pourrait ainsi s'arrêter. En effet, il n'est pas productif que ce dernier fasse des réformes dans le simple but de réinventer l'eau chaude et pour le plaisir de faire de la prose législative. Il ne faut pas négliger le fait que les magistrats connaissent de façon très éprouvée toutes ces questions et y répondent au quotidien avec la jurisprudence et le savoir-faire qui est le leur.

I am ⁇ pleased that this prudence has guided the colleagues of the Family Subcommittee and the Justice Commission, as well as you, Mr. Secretary of State, to ultimately lead to a two-phase reform.
In the first phase, the judge will be required to indicate, in the decision, various elements of the nature and amount of the faculties (financial, material, moral) of the father and mother, the ordinary and extraordinary expenses relating to the children they have in common, the modalities of accommodation and the contribution in kind of each of the parents.
Certain concepts have, on the same occasion, been defined – which was not the case before – in order to reduce the differences in assessment that they could result in judicial decisions. Finally, the judge must indicate in the decision how he has taken into account the various elements mentioned in the decision fixing the amount of the famous contributive part. By organizing the reasoning of the magistrate and imposing on him to answer certain objective questions, it tends to be more objective in the choice of the criteria taken into account and in the manner in which they are examined, while safeguarding the margin of manoeuvre and intellectual autonomy of the magistrate in his decision to bring a tailor-made solution to each family situation.
It is quite possible that this first step already allows to respond to criticism against the current system and encourages the majority of judges to better elaborate their judgment on this matter. This would be a great victory and the intervention of the legislator could thus be stopped. Indeed, it is not productive for the latter to make reforms for the mere purpose of reinventing hot water and for the pleasure of making legislative prose. It should not be neglected the fact that magistrates know in a very proven way all these questions and answer them on a daily basis with the jurisprudence and know-how that is theirs.

Toutefois, si cette mesure s'avérait insuffisante pour susciter un changement de mentalité dans le chef des magistrats peu coopératifs – et il y en a encore –, le texte soumis au vote propose, à terme, une seconde phase, à savoir la création d'une Commission des Contributions alimentaires. Cette réforme a également été l'occasion de prendre des dispositions qui peuvent paraître moins fondamentales en termes de principe mais qui, en termes d'efficacité pour les justiciables, auront un impact significatif. J'en citerai quelques-unes.
- La délégation de somme qui est accordée automatiquement par le juge à tout créancier d'aliment lorsque le débiteur d'aliment s'est soustrait à son obligation de paiement des aliments en tout ou en partie, pendant deux termes, c'est-à-dire deux mois, consécutifs ou non, au cours des douze mois qui précèdent la demande.
- L'indexation automatique de la part contributive et de sa liaison à l'indice des prix à la consommation ou de la possibilité pour le juge et les parties d'adapter automatiquement cette part contributive à toute autre référence, qui ne serait donc pas l'indice des prix à la consommation.
- La possibilité d'anticiper des circonstances ou des événements significatifs à l'occasion desquels, dans l'intérêt de l'enfant, le juge peut, à la demande d'une des parties, décider de l'augmentation de plein droit de la contribution alimentaire et d'en faciliter le débat judiciaire ultérieur sur l'évolution de cette contribution.
- L'exécution provisoire de plein droit de la décision sur la contribution alimentaire pour ceux qui oublieraient de la demander.
- La possibilité pour le juge, à la demande d'une partie, d'ordonner l'ouverture d'un compte bancaire spécial sur lequel la contribution alimentaire sera versée. Dans ce cas, les modalités relatives aux apports et aux retraits sur ce compte sont également déterminées par le magistrat.
En conclusion, j'estime qu'il s'agit d'une réforme qui a été réfléchie et concertée dans l'intérêt direct du justiciable et qui contient la souplesse nécessaire à son succès.

However, if this measure proved insufficient to provoke a change of mindset in the head of the non-cooperative magistrates – and there are still others – the text submitted to vote proposes, in the long run, a second phase, namely the creation of a Food Contributions Commission. This committee will be tasked with formulating recommendations for the assessment of the costs resulting from the application of Article 203, §1 of the Civil Code, i.e. the costs of maintenance and education of children and the fixing of the contribution of each parent, in accordance with Article 203bis of the Civil Code.
On the basis of the recommendations that would be issued by this committee, the King may determine a model calculation method that the magistrate shall apply, except to specifically justify why this method is not appropriate for the family whose situation he regulates. We inspired ourselves for this from the method chosen when drafting the altered hosting law: indicating a model while leaving escapes that will then have to be duly motivated.
This reform has also been an opportunity to adopt provisions that may seem less fundamental in terms of principle but which, in terms of effectiveness for the justifiable, will have a significant impact. I will cite a few.
- Delegation of sum that is automatically granted by the judge to any food creditor when the food debtor has waived his obligation to pay the food in whole or in part, for two terms, i.e. two months, consecutive or not, during the twelve months preceding the application.
The automatic indexation of the contributing share and its link to the consumer price index or the possibility for the judge and the parties to automatically adjust that contributing share to any other reference, which would therefore not be the consumer price index.
The possibility of anticipating significant circumstances or events in which, in the best interests of the child, the judge may, at the request of one of the parties, decide on the full increase of the maintenance contribution and facilitate the subsequent judicial debate on the evolution of that contribution.
The provisional enforcement of the decision on the maintenance contribution for those who would forget to apply for it.
- The possibility for the judge, at the request of a party, to order the opening of a special bank account on which the maintenance contribution will be paid. In this case, the arrangements relating to contributions and withdrawals to this account are also determined by the magistrate.
In conclusion, I believe that this is a reform that has been thought out and coordinated in the direct interest of the justifiable and that contains the flexibility necessary for its success.

Mijnheer de voorzitter, collega's, voor alle duidelijkheid, het Vlaams Belang staat positief tegenover deze voorliggende wetswijziging.
In de eerste plaats omdat er richtsnoeren in de wet zijn opgenomen, in plaats van dictaten aan het adres van de rechter om het onderhoudsgeld te betalen, omdat het hulpmiddelen zijn in plaats van dwingende tarieven. Ik denk dat wij op dat punt de juiste weg zijn ingeslagen want de rechter is tenslotte geen rekenmachine.
Ook de installatie van een Commissie voor onderhoudsbijdragen vinden wij een positieve zaak. De opening van de kindrekening, de definitie van de buitengewone kosten, het is hier allemaal aangehaald. Dit is inderdaad een stap in de goede richting.
Het Vlaams Belang wil wel een belangrijke en kritische kanttekening maken bij de wetgeving die wij vandaag stemmen. Het gaat niet inhoudelijk over de wetgeving zelf, maar het maatschappelijke kader waarbinnen zij moet worden geplaatst. Wij blijven er namelijk op hameren dat het huwelijk is uitgehold en dat het statuut van het huwelijk ook is uitgevlakt in deze samenleving. Dat leidt tot allerhande maatschappelijke mistoestanden. Zij zijn misschien niet altijd zichtbaar of rechtstreeks in verband te brengen met een aantal zaken die zich voordoen in de samenleving, maar wij blijven in elk geval de uitholling van het huwelijk als instituut, als hoeksteen van onze samenleving betreuren.
Deze filosofie van de meerderheid van de partijen in dit halfrond, waarvan wij dus duidelijk afwijken, en de weg die men wil inslaan, heeft uiteraard ook zijn repercussies op de echtscheidingswetgeving. Het huwelijk is een eenzijdig opzegbaar contract geworden waarin de ene partner zich vrij makkelijk kan ontdoen van de andere partner dankzij de nieuwe echtscheidingswetgeving. Wij hebben recent in de pers gezien dat de echtscheiding met onderlinge toestemming, de zogenaamde EOT, sterk onder druk is komen te staan en wij vinden dat nog altijd de meest beschaafde wijze van beëindiging van het huwelijk.
De meest recente wetswijziging op het vlak van echtscheiding, namelijk de ontbinding van het huwelijk op grond van onherstelbare ontwrichting, maakt maatregelen als een kindrekening meer dan ooit noodzakelijk. Men kan zich namelijk inderdaad makkelijk ontdoen van de partner. Het huwelijk is een eenzijdig opzegbaar contract, maar daarmee zijn nog geen oplossingen aangereikt voor de kinderen en voor alle repercussies die een echtscheiding met zich meebrengt. Daarom doet men nu het omgekeerde: partners kunnen heel vlug van mekaar scheiden en in een nieuw gezin stappen, maar daarmee is de oude relatie nog niet volledig in een goede plooi gevallen voor de kinderen en de financiële afhandeling.
De echtscheiding is helaas steeds meer een rechtsfiguur geworden die dient om het individu te bevrijden van een contract in plaats van het beperken van de schade die het uiteenvallen van een gezin met zich meebrengt. Echtscheiding is niet langer op dat laatste gericht. Dat deze wetgeving daaraan wil verhelpen, vinden wij een positieve zaak. Dat deze wetgeving echter moet worden goedgekeurd, zet onze argumenten alleen maar kracht bij. Voor alle duidelijkheid: wij stemmen voor.

Therefore, the opposite is now done: partners can very quickly separate from each other and enter into a new family, but with it, the old relationship has not yet fully fallen into a good fold for the children and the financial settlement.
Unfortunately, divorce has increasingly become a legal figure that serves to free the individual from a contract rather than limiting the damage that the break-up of a family implies. Divorce is no longer aimed at the latter. That this legislation seeks to remedy this, we find a positive thing. However, the fact that this legislation needs to be adopted only adds strength to our arguments. To be clear, we vote for.

Monsieur le président, chers collègues, je me permets d'intervenir à présent au nom du cdH, puisque je suis déjà intervenue en qualité de rapporteur. Bien évidemment, le cdH se réjouit du vote de ce texte. Nous avions déjà déposé cette proposition sous la précédente législature.
Je tiens à répéter que je suis signataire de cette proposition de même que mon collègue Christian Brotcorne. C'est important parce que M. Brotcorne est avocat et plaide souvent devant la cour d'appel de Mons. Or, ce sont les magistrats de la cour d'appel de Mons, MM. Franeau et Wustefeld notamment, qui ont mis les premiers au point un système de calcul et des outils pouvant aider les magistrats à calculer les contributions alimentaires. Par conséquent, associer mon collègue Christian Brotcorne est extrêmement important dans le cadre de cette discussion.
Ce texte constitue une avancée. Il était grand temps de la faire. En effet, nous étions un des seuls pays européens, voire mondiaux, à avoir un vide juridique en la matière, à l'exception d'une phrase dans le Code civil. En amont de cette proposition de loi, il existe la loi sur le divorce et d'autres techniques pour trouver un accord que le recours au juge, à savoir la médiation. Bien entendu, la nouvelle loi sur le divorce mérite une évaluation. Déjà en sous-commission Droit de la famille, nous avons commencé, il y a plusieurs semaines, l'évaluation sur des points de procédure; il conviendra également de la faire sur le contenu.
Le nombre des procédures de médiation doit absolument être augmenté de même que celui des procédure d'ordre extrajudiciaire car, en la matière, trouver des accords simplifie non seulement la tâche du magistrat, mais surtout la paix des familles.
Ce texte n'alourdit pas démesurément la tâche des magistrats, puisqu'en cas d'accord des parties sur les montants, le juge ne devra pas motiver et appliquer la série des outils mis à sa disposition via la proposition de loi. Celle-ci favorise donc les accords.
Monsieur Landuyt, j'ignore si vous avez bien compris l'objectif de la réforme. Nous avons opté pour un système de motivation et de transparence des décisions et avons renvoyé à l'Exécutif non pas pour se départir de la matière, mais parce que nous sommes convaincus que l'exemple hollandais est probant. Vous auriez dû nous accompagner, monsieur Landuyt, en Hollande pour constater combien le fonctionnement en la matière y est efficace. Ten tweede, de voorliggende wettekst is een heel goede samenvatting van de betere rechtspraak in de bedoelde materie. Op dat vlak is het een verdienste dat ter zake een standstill wordt geïnstalleerd. Ik deel zelfs de gedachte dat er een commissie moet zijn die probeert een lijn te krijgen in de bepaling van het onderhoudsgeld en die probeert een berekeningswijze vast te leggen of uit de rechtspraak te distilleren. Bij de opzegvergoedingen in het arbeidsrecht is zulks gebeurd, zonder dat er een commissie moest worden opgericht.
Mijn opmerking is tweeërlei.
Ten eerste, het is niet de eerste keer, maar qua wetgevingstechniek is het niet goed dat bijvoorbeeld in het Gerechtelijk Wetboek een volledige werkwijze en manier van aanpak van het probleem letterlijk wordt vertaald. Het Gerechtelijk Wetboek was oorspronkelijk het wetboek van de procedures voor het beslechten van geschillen. Het is niet bedoeld om politieke afspraken in een wettekst neer te schrijven. Daarmee is nog geen wet geschreven zoals vroeger, in de goede, oude tijd, wetten werden gemaakt.
Ten tweede, niet alleen om te bewijzen dat ik niet enkel het verslag maar ook de desbetreffende wettekst lees, wil ik het volgende meegeven.
Nu staat in de wettekst dat een rechter zal moeten motiveren waarom hij in voorkomend geval afwijkt van de berekeningswijze, zoals ze door de Koning is opgesteld. Het voorgaande staat letterlijk in de wettekst.
Heel precies wordt via de voorliggende tekst in artikel 1322 ingeschreven dat er een commissie komt die een en ander zal bekijken. Op het einde wordt geschreven dat de Koning aan de commissie zelfs nog berekeningsformules zal suggereren, teneinde haar werk te vergemakkelijken.
Echter, in een vorig artikel van de voorliggende tekst staat dat de rechter met de door de Koning opgestelde berekeningswijze rekening moet houden.
Ik herhaal mijn basisopmerking. De titel van de wettekst is misleidend. In de voorliggende tekst wordt het onderhoudsgeld niet geobjectiveerd. In de voorliggende wettekst wordt aan de Koning een volmacht gegeven om een dergelijke richtlijn op te stellen.

Now in the text of the law it is stated that a judge will have to justify why he deviates from the calculation method, as established by the King. The above is literally in the legislation.
It is precisely written in article 1322 that a committee will be established that will examine all things. At the end it is written that the King will even suggest to the committee calculation formulas, in order to facilitate her work.
However, in an earlier article of the present text it is stated that the judge must take into account the method of calculation established by the King.
I repeat my basic comment. The title of the bill is misleading. In the present text, the maintenance fee is not objectivized. The present legislation gives the King a power to draw up such a directive.

Quand nous avons travaillé sur la loi de 1965, nous avons dépensé beaucoup d'énergie pour arriver à ce que le juge motive ses décisions afin que les personnes en face de lui, les comprennent mieux. Certains trouvent peut-être que ce n'est pas nécessaire car ils considèrent que le juge le fait d'office mais, dans les faits, ce n'est pas toujours le cas. Ce n'est donc pas un luxe.

In het raam van de wet van december 2008 werden de uitvoeringsbesluiten die overigens aan u voorgelegd werden voor nazicht, toegezonden aan de Raad van State voor advies. Het advies wordt verwacht uiterlijk op 9 juli. Na het advies worden de ontwerpen eventueel aangepast en onmiddellijk gepubliceerd. Er is overigens een zeer constructief overleg geweest tussen mijn medewerkers en de sector, onder meer Pharma.be en Bio.be. Deze koppels gaan akkoord met de modaliteiten van erkenning, vigilantie en kwaliteitscontrole die worden voorgesteld.
Het FAGG zal zijn dispositief voor de uitvoering van de wet klaar hebben einde oktober 2009. In elk geval voorziet het ontwerp van KB in de algemene normen, het behoud van de erkenningen en overgangsbepalingen waardoor bedrijven op een vlotte wijze een voorlopige en naderhand definitieve erkenning kunnen bekomen. Het ontwerp van KB dat de algemene erkenningsvoorwaarden bepaalt, voorziet erin dat bestaande structuren die reeds een activiteit uitoefenden, vanaf de inwerkingtreding van de wet een voorlopige erkenning zullen verkrijgen. De instellingen die reeds erkend zijn, zullen hun erkenning behouden tot deze een einde neemt en zullen nadien voorlopig worden erkend. Dit betreft in essentie de weefselbanken.
Anderzijds is ook in een regeling voorzien voor de instellingen die nu niet zijn erkend omdat hun activiteit momenteel niet gereglementeerd is. Indien deze een activiteit uitoefenden de laatste drie maanden voor de publicatie in het Belgisch Staatsblad van de wet van december 2008, zullen zij ook voorlopig worden erkend vanaf de inwerkingtreding van de wet.
Er zullen dus in principe geen structuren zijn die hun activiteit zullen moeten stopzetten, direct na de inwerkingtreding van de wet.
