Mevrouw de minister, collega’s, ik wil onderstrepen dat wij met onze fractie heel duidelijk tegen gedwongen huwelijken zijn en, zoals wij in het verleden hebben bewezen, ook tegen schijnhuwelijken. Dat is een fundamentele aantasting van de rechten van de mens. Zeker vandaag, op de Internationale Vrouwendag, past het te zeggen dat vrouwen daar vaak het slachtoffer van worden, dat dit onder geen enkel beding geaccepteerd kan worden en dat daar uiteraard tegen opgetreden moet worden. Het is trouwens volledig in strijd met de Universele Verklaring van de Rechten van de Mens, de aanbeveling van het comité van ministers van de Raad van Europa en andere internationale instanties.
Wij weten dat het probleem van de gedwongen huwelijken zich ook vandaag nog voordoet, ook in België. Ik heb dat reeds eerder aangeklaagd in dit Parlement, samen met de schijnhuwelijken en ook de misbruiken die er zijn op het vlak van gezinshereniging. Ik heb daarover altijd gezegd dat het zaken zijn waar geen taboe over mag bestaan. Dat zijn zaken die men moet aanpakken en waarover men moet spreken want er vallen te veel slachtoffers.
Wij zijn ons dus terdege van het probleem bewust. Maar wat stellen wij wel vast?
Ten eerste, het gedwongen huwelijk kan in België wel al worden bestraft aan de hand van andere strafbaarheidstellingen van verboden gedragingen waaruit dat huwelijk voorkomt, onder meer fysiek of psychisch geweld, verkrachting, bedreigingen. Ook de Raad van State merkt op dat gedwongen huwelijken eigenlijk al op die manier bestraft kunnen worden.
Ten tweede, vorig jaar is – onder meer door het wetsvoorstel van CD&V – de wet goedgekeurd ter bestraffing van schijnhuwelijken. Nu, die wet vermeldt ook heel uitdrukkelijk dat schijnhuwelijken die tegelijkertijd gedwongen huwelijken zijn – dus als er ook dwang mee gepaard gaat – bestraft kunnen worden. In die wet vindt men uiteraard een antwoord op gedwongen huwelijken die tegelijkertijd een schijnhuwelijk zijn en waar de partner de bedoeling heeft te huwen, met dwang in dat geval, met het oog op het bekomen van een verblijfsvergunning.

This is a fundamental violation of human rights. Especially today, on the International Women’s Day, it is appropriate to say that women often become the victims of this, that this cannot be accepted under any conditions and that it must, of course, be opposed. It is, by the way, completely contrary to the Universal Declaration of Human Rights, the recommendation of the Committee of Ministers of the Council of Europe and other international bodies.
We know that the problem of forced marriages still exists today, including in Belgium. I have already accused this in this Parliament, along with the hypocrisy and also the abuses that exist in the field of family reunification. I have always said that these are things about which there should be no taboo. These are issues that must be addressed and discussed because there are too many victims.
We are therefore fully aware of the problem. But what do we fix?
First, forced marriage can already be punished in Belgium on the basis of other penalties of prohibited conduct resulting from that marriage, including physical or psychological violence, rape, threats. The State Council also notes that forced marriages can actually be punished in this way.
Second, last year – among other things by the bill of CD&V – the law was passed to punish hypocritical marriages. Now, that law also specifies very explicitly that hypocritical marriages which are simultaneously forced marriages—that is, if they are accompanied by coercion—can be punished. That law is, of course, a response to forced marriages which are simultaneously a false marriage and in which the partner intends to marry, with coercion in that case, in order to obtain a residence permit.

Ook die wet is er al en biedt mogelijkheden tot bestraffing. Burgerrechtelijk kan de nietigheid van een gedwongen huwelijk ook worden herkend en kan een gedwongen huwelijk nietig worden verklaard. Het is alleen zo dat vandaag die termijn van 6 maanden na het huwelijk veel te kort is. Wij hadden dan ook liever gezien dat in die procedure de termijn zou worden verlengd. Op die manier had men de bestaande wet kunnen behouden en had men enkel de periode moeten verlengen.
De vraag is ook wat het met de voorliggende wet gaat worden op het terrein. Hoe moeten de parketten en de rechters hiermee omgaan? Enerzijds is er deze wet in het strafrecht en anderzijds is er de wet van 12 januari 2006 die de zaak sanctioneert via de vreemdelingenwet. Mevrouw de minister, ik heb nog een vraag aan u. Is het de bedoeling dit uit de vreemdelingenwet te halen aangezien men nu zal kunnen optreden tegen iedereen en niet alleen tegen huwelijken waarin sprake is van vreemde partners. Heel wat gedwongen huwelijken kunnen ook plaatsvinden met partners die Belg zijn. Wij stellen ook daar een tekortkoming vast en wij weten niet wat er op het terrein zal worden beslist.
Ik kom tot de cijfers. Mevrouw de minister, ik had u een paar weken geleden de cijfers gevraagd – ik heb ze ook ontvangen - omdat wij hebben vastgesteld dat de wet van vorig jaar op het terrein nog tot geen enkele veroordeling heeft geleid. Ik heb de volledige lijst ontvangen. U geeft ook cijfers aan van parketten die onderzoeken leiden naar schijnhuwelijken. Dat dit gebeurt, is evident want dat gebeurde al vóór de wet van vorig jaar tot stand kwam. Ik stel bijvoorbeeld vast dat er geen cijfers zijn over Dinant, Antwerpen, Turnhout, Tongeren en Oudenaarde. En dit terwijl ik u al had gezegd dat alleen al in de stad Antwerpen in 2006 122 dossiers waren afgekeurd. Dit cijfer werd bevestigd door het parket. Mijn concrete vraag is hoeveel veroordelingen er zijn geweest op basis van de wet die vorig jaar werd goedgekeurd.

Hoe komt dat? Ik heb al signalen gekregen van de mensen op het terrein. De parketten beschikken niet over de nodige middelen. Ik denk dat ze nog moeten versterkt worden voor het werk dat op hen afkomt. In Antwerpen en Gent zijn de aantallen zeer hoog. Het verwondert mij trouwens dat er in Charleroi, toch een grote stad, slechts een dossier is waarin een onderzoek werd opgestart. Dat is vrij eigenaardig, die grote verschillen tussen de ene stad en de andere. Blijkbaar hechten niet elk parket of elk gemeentebestuur daaraan evenveel belang. Wij vinden dat bestaande wetten eerst en vooral moeten worden uitgevoerd. Daarmee heeft men een instrument om gedwongen huwelijken die schijnhuwelijken zijn, aan te pakken. Men moet ook gebruikmaken van de wetten die er zijn. Zomaar nieuwe wetten goedkeuren om ons geweten te sussen, is iets waaraan wij niet mee willen doen.
Nog twee punten. Ten eerste stellen wij vast dat in het voorliggende en goed te keuren voorstel het gebrek aan wilskracht wordt verheven tot een absolute grond van nietigheid. Dat wil zeggen dat niet enkel een of beide partners de nietigheid kunnen inroepen omdat het een gedwongen huwelijk was, maar dat ook buitenstaanders dit kunnen. Wij begrijpen dat dit moet kunnen in het geval dat de persoon zelf het niet durft. Vermits het echter een absolute grond van nietigheid is, kan het zelfs zijn dat bijvoorbeeld bij een gedwongen huwelijk – er zijn er – na tien of twintig jaar en wanneer de partners zich daarbij hebben neergelegd, toch nog iemand anders kan beslissen dat het een gedwongen huwelijk was en dat het nietig moet worden verklaard. Dan hebben de partners zelf niet meer de mogelijkheid het huwelijk verder te zetten.
Een tweede belangrijke bedenking bij dit ontwerp is dat zelfs de dader, degene die dwang heeft uitgeoefend om het huwelijk af te sluiten, ook dit element kan inroepen en de nietigverklaring kan eisen voor een gedwongen huwelijk.

Two more points. First, we note that in the present and to be approved proposal the lack of willpower is elevated to an absolute ground of nullity. This means that not only one or both partners can invoke the nullity because it was a forced marriage, but that outsiders can also do so. We understand that this should be possible in the event that the person himself does not dare. However, if it is an absolute ground of nullity, it may even be that, for example, in a forced marriage – there are – after ten or twenty years and when the partners have engaged in it, yet someone else can decide that it was a forced marriage and that it must be declared null. Then the partners themselves no longer have the possibility to continue the marriage.
A second important consideration in this draft is that even the perpetrator, the one who has exercised coercion to conclude the marriage, can also invoke this element and claim the annulment for a forced marriage.

Mevrouw de minister, het blijft onduidelijk welke wet zal worden toegepast. Zal de wet-Onkelinx, die hier thans voorligt, of de wet die wij vorig jaar hebben goedgekeurd, worden ingeroepen? Zijn er afspraken over welke wet wanneer wordt toegepast? Dat blijft onduidelijk.
Daarom is de voorliggende wet niet het juiste antwoord op de problematiek die zeker en vast moet worden bestreden. Om die reden zullen wij ons ook onthouden.

As stated above, I am normally not in favour of signal or symbol legislation, but in this case the exception confirms the rule. By the way, it is not just about signals or symbols; in my opinion, there is indeed a deterrent effect against the perpetrators. It is also a fundamental human right that is being violated. It is not just a punitive provision, it is about human rights that are violated and in this case it is therefore very important that this law is passed.

Opgelet, wij zijn ook niet te vlug tevreden. Wij vinden ook dat er verder moet worden gegaan, mevrouw de minister. Problemen moeten bij de bron worden aangepakt. In dit land worden inderdaad gedwongen huwelijken en schijnhuwelijken gesloten. Dat is niet hetzelfde. Wanneer het om schijnhuwelijken gaat, is er echter vaak dwang bij betrokken. Dat zal ieder weldenkend mens wel weten.
Ten tweede, ook voor het probleem van de partnerkeuze in het land van herkomst moeten we aandacht hebben, een probleem dat minder aangepakt wordt door het wetsontwerp. Een significant deel van de gedwongen huwelijken wordt in de landen van herkomst gesloten. Dat pijnpunt kan allicht minder door het wetsontwerp worden opgevangen. Ik moet verwijzen naar een aantal studies in de provincie Limburg met betrekking tot huwelijken in de landen van herkomst. De keuze van de huwelijkspartner bij Turkse en Marokkaanse mensen gebeurt voor meer dan 75% in het land van herkomst. Daar zijn zeker en vast tal van gedwongen huwelijken bij. Dat is een eerste vaststelling.
Een tweede vaststelling, die onlangs in Limburg werd gemaakt – ik raad al degenen die aan politieke correctheid houden, aan de vingers in de oren te steken –, handelt over de seksuele activiteit bij jongeren. Een onderzoek wees uit dat allochtone jongens heel wat meer seksuele activiteit aan de dag leggen dan autochtone jongens. Ik heb het dan over de –18-jarigen. Anderzijds houden allochtone meisjes zeer sterk aan hun maagdelijkheid. Ik respecteer dat uiteraard. Dat zal niet altijd een bewuste keuze zijn. Iedereen moet zich daarvan bewust zijn. Het is niet aan ons om een uitspraak te doen over de keuze van een of meerdere partners, als het over de allochtone gemeenschap gaat. Het gaat ten slotte over de vrije keuze van de mens.

In het andere geval krijgt de overheid het probleem niet onder controle en blijven de vreemdelingen in grote, geïsoleerde en gesegregeerde gemeenschappen op ons grondgebied aanwezig.
Het politieke antwoord op het machogedrag binnen de moslimcultuur moet inderdaad ook nog worden gegeven, alsook op de gelijkheid van man en vrouw, die in onze samenleving alleszins moet worden gewaarborgd. De wetgever zal dus ook de partnerkeuze met mensen in het thuisland aan banden moeten leggen.
Paars heeft tot nu toe daarvoor niet het lef gehad. Desalniettemin vinden wij dat het voorliggende wetsontwerp moet worden gesteund. Het is immers een stap in de goede richting. Wij weten dat het een heel slecht signaal zou zijn – zeker op deze dag, collega’s – om het voorliggende wetsontwerp niet volmondig goed te keuren, wat het Vlaams Belang dan ook zal doen.

Dit wetsontwerp werd ingediend met als doel het artikel, dat handelt over de verpakkingsheffing op drankverpakkingen, te herschrijven en aan te passen in de zin van het gevelde arrest.
Op een vraag van collega Devlies heeft de staatssecretaris, de heer Jamar, geantwoord dat het arrest van het Arbitragehof van 11 januari 2007 geen enkele budgettaire impact zal hebben, omdat de betrokken sectoren hun betalingen niet hebben gestaakt. Dit wetsontwerp is een nieuwe episode in het feuilleton, het slechte feuilleton of het paarse feuilleton van de drankverpakkingsheffingen. Het is een verhaal van mislukkingen, misleidingen van het Parlement en van de bevolking, misprijzen voor de instellingen, voor het Arbitragehof, voor de Raad van State en vooral van 300 miljoen euro op jaarbasis aan bijkomende belastingen. Concreet betekent dit 10 cent per liter of bij 6 flessen van anderhalve liter in plastiek verpakking betekent dat 1 euro. De kernvraag blijft – en de minister zal daar dadelijk graag op antwoorden, veronderstel ik – waar de milieubalans is voor die wetgeving? Welke wetenschappelijke studies ondersteunen die regeringsbeslissing?
Wat is het onderscheid tussen herbruikbare en niet-herbruikbare drankverpakkingen? Op welke basis wordt nu het tarief van de herbruikbare verpakkingen bepaald? Is dat op basis van het feit dat de wetgeving erin voorziet dat een fles 7 keer hergebruikt moet worden om als herbruikbaar beschouwd te worden? Indien dat zo is, verwijs ik toch naar de bemerkingen die door de sector worden gemaakt. De biersector bijvoorbeeld stelt dat een fles gemiddeld 30 keer hergebruikt wordt. Een bierfles wordt in principe dus 30 keer opnieuw gebruikt. In de watersector gebeurt dat 15 keer. Mevrouw de minister, ik had daarover graag wat toelichting gekregen.
Voorts verwijs ik naar de bemerkingen van de Raad van State, die uiteraard op een lijn liggen met de inhoud van de verschillende arresten van het Arbitragehof. Als essentie wordt daarin gesteld dat er onvoldoende wordt aangetoond dat het grondwettelijke gelijkheidsbeginsel wordt gerespecteerd. Ik vraag u om aan te tonen dat ter zake het grondwettelijke gelijkheidsbeginsel gerespecteerd wordt.
Bovendien merkt de Raad van State op dat er geen enkele toespeling aanwezig is op de algemene milieubalans.

For example, the beer industry states that an average bottle is reused 30 times. A beer bottle is reused 30 times. In the water sector this happens 15 times. I would have liked to have some explanation on this.
In addition, I refer to the observations of the Council of State, which are of course in line with the content of the various judgments of the Court of Arbitration. In essence, it argues that there is insufficient evidence that the constitutional principle of equality is respected. I ask you to show that the constitutional principle of equality is respected in this regard.
Furthermore, the State Council notes that there is no allocation to the overall environmental balance.

Zo wordt een verpakkingsheffing van 10 eurocent per liter ingevoerd voor dranken die verpakt zijn in individuele en dus eenmalige verpakkingen. Dan komt natuurlijk de truc met het konijn. Voor de herbruikbare verpakkingen was er vroeger een vrijstelling. Daar wordt nu dus van afgestapt. Men gaat ervan uit dat de herbruikbare verpakkingen tot zevenmaal gebruikt worden. Juist in die verhouding van een zevende zit de grote truc. Voor bierflessen bijvoorbeeld is de algemene praktijk dat deze tot dertigmaal kunnen hergebruikt worden. Dat wil zeggen dat het gebruik van glazenflessen voor de consument duurder zal worden terwijl het juist de bedoeling zou moeten zijn om herbruikbare flessen te promoten en te stimuleren en dus niet bijkomend te belasten.
Het hele dossier is bovendien een lijdensweg geworden van rechtsonzekerheid waarbij de inwerkingtreding meerdere malen is uitgesteld. Bovendien werd het tarief van de verpakkingsheffing ook meerdere malen gewijzigd, wat natuurlijk zijn effect op de omzet van waters en frisdranken van de middenstand niet gemist heeft, zeker niet in de grensstreken, mevrouw de minister.
Iedere zinnige regering die oog heeft voor goed bestuur met kwalitatieve wetgeving en die administratieve vereenvoudiging als beleidsprioriteit heeft, een regering die koopkrachtverhoging en een goeddraaiende economie tot zijn belangrijkste prioriteiten of beleidsprioriteiten maakt, zou moeten inzien dat er geen goede kant meer is aan deze wetgeving.
