Monsieur le président, chers collègues, sauf imprévu, dans une heure ou deux, nous aurons définitivement voté une dérogation à la loi qui interdit la publicité commerciale pour le tabac et les produits du tabac. C'est évidemment une dérogation limitée dans le temps comme vous le savez, jusqu'en juillet 2005, limitée aussi puisqu'elle ne s'applique que pour une manifestation d'importance mondiale par an et par région.
Finalement, ce fut un an d'affrontements et de présence permanente du sujet dans les médias. Un an durant lequel le Grand Prix de Francorchamps et Francorchamps lui-même sont devenus les symboles d'une lutte pour le développement régional. A ceux qui reprocheraient aux auteurs des propositions, notamment à moi en l'espèce, d'avoir machiavéliquement organisé un combat douteux sur ce sujet, je voudrais quand même à rappeler certains faits.
Initialement, lors de la première proposition, le débat était loin d'atteindre le niveau paroxystique auquel il est arrivé depuis un certain nombre de mois. De bonne foi, nous, les auteurs de la proposition - essentiellement Jean-Marie Happart et moi—même puisque nous étions ensemble au Sénat -, avions cru à l'époque qu'une dérogation de quelques jours par an, pendant deux ou trois ans au maximum, pour permettre la tenue d'une manifestation aussi importante pour la région que le Grand Prix de Francorchamps, ne mettait pas en cause la volonté partagée par tous de lutter conte les méfaits du tabac.
Je vous avoue avoir été très surpris, à la fois du refus total de toute ouverture et de l'extraordinaire agressivité manifestée dès le début à l'égard de cette proposition. Pour simplifier, je dirais que si, à l'époque, cette dérogation avait été admise, on se trouverait aujourd'hui avec un Grand Prix où, certes, les voitures arboreraient des sigles de cigarettiers, du moins celles qui sont sponsorisées, mais où, par l'effet de la loi elle-même, la publicité aurait été réduite graduellement comme elle aurait dû l'être jusqu'en 2005. Cette publicité se faisant beaucoup plus discrète, personne n'aurait, me semble-t-il, constaté une augmentation du nombre des fumeurs, parce que la Formule 1 aurait été présente à la télévision deux heures par an, le dimanche après-midi et une heure par an, éventuellement, aux essais du samedi, le tout, pendant trois ans.
Si on avait voté la proposition il y a un an, l'affaire serait passée quasiment inaperçue et les candidats fumeurs ne se seraient certainement pas sentis confortés dans leur vice, si tant est que fumer soit un vice, par cette ouverture de 3 jours par an pour la publicité tabac. Au contraire, c'est peut-être le débat qui a eu lieu depuis un an qui a renforcé la volonté des fumeurs de continuer dans cette voie.
Comme je l'ai dit, le camp de la prohibition s'est raidi, donnant à ceux qui soutenaient Francorchamps pour des raisons économiques, l'occasion de faire de cet événement l'élément essentiel du développement économique de la région. On sait que cette question était très présente en Wallonie.
Elle a d'ailleurs été présente pendant la campagne électorale, avec les résultats politiques que l'on connaît. Les majorités ont changé et nous voilà par conséquent avec la proposition de loi, votée hier au Sénat. Elle est encore plus réduite dans le temps, puisqu'elle courait initialement jusqu'en 2006 et que nous avons simplement respecté la directive européenne qui propose juillet 2005. Il n'y a donc pas de volonté de dépasser ce que tous les autres pays admettent et la directive a d'ailleurs été votée par le Parlement européen.
Je vais maintenant répondre assez rapidement à quelques questions. Premièrement, je m'étonne du fait que l'on ait considéré que la loi de 1997 qui interdit la publicité pour le tabac était intangible. Il est incroyable de faire systématiquement référence à cette loi en disant: "elle a été votée, il ne faut pas y toucher". J'estime que toute loi doit évoluer en fonction des événements. Hier encore, nous avons voté une loi sur la compétence universelle qui modifie la loi initiale de 1993, laquelle avait d'ailleurs fait l'objet, me semble-t'il, de deux ou trois modifications. J'ai participé à ces débats au Sénat pendant près d'un an. Ces modifications étaient voulues parce qu'un certain nombre d'éléments montraient - à tort ou à raison, je ne reviens pas là-dessus - que son utilisation n'était pas acceptable.

Initially, during the first proposal, the debate was far from reaching the paroxystic level it has reached for a number of months. In good faith, we, the authors of the proposal – essentially Jean-Marie Happart and I – even since we were together in the Senate – had believed at the time that a derogation of a few days a year, for a maximum of two or three years, to allow the holding of a demonstration as important for the region as the Grand Prix of Francorchamps, did not challenge the shared will of all to fight against the harm of tobacco.
I confess to you that I was very surprised, both by the total rejection of any openness and the extraordinary aggressiveness manifested from the beginning with regard to this proposal. To simplify, I would say that if, at the time, this derogation had been admitted, we would find ourselves today with a Grand Prix where, of course, the cars would bear signs of cigarette cars, at least those that are sponsored, but where, by the effect of the law itself, advertising would have been gradually reduced as it should have been until 2005. This advertisement becomes much more discrete, no one would, I think, have seen an increase in the number of smokers, because Formula 1 would have been present on television two hours a year, Sunday afternoon and one hour a year, eventually, on Saturday trials, all, for three years.
If the proposal had been voted a year ago, the case would have gone almost unnoticed and the smoking candidates would ⁇ not have felt comforted in their vice, if so that smoking is a vice, by this opening of 3 days a year for tobacco advertising. On the contrary, it may be the debate that has taken place for a year that has strengthened the willingness of smokers to continue on this path.
As I said, the prohibition camp has stepped up, giving those who supported Francorchamps for economic reasons the opportunity to make this event an essential element of the region’s economic development. We know that this issue was very present in Wallonia.
It was also present during the election campaign, with the political outcomes that we know. The majorities have changed and here we are, therefore, with the bill, voted yesterday in the Senate. It is even shorter in time, since it was initially running until 2006 and that we have simply complied with the European directive that proposes July 2005. There is therefore no willingness to go beyond what all other countries admit and the directive has been voted by the European Parliament. by
I will now answer quite quickly a few questions. First, I am surprised that the 1997 law that prohibits tobacco advertising was considered intangible. It is incredible to systematically refer to this law by saying, “It has been voted, you must not touch it.” I believe that every law should evolve according to events. Yesterday again, we voted a law on universal jurisdiction that amends the original law of 1993, which, in fact, had been the subject of, I think, two or three amendments. I participated in these debates in the Senate for almost a year. Collega, het is toch vrij gek dat precies zes jaar geleden een overgrote meerderheid van de traditionele partijen in het Parlement, waaronder ook alle huidige Franstalige regeringspartijen, de PS en de toenmalige PRL, deze wet met enthousiasme heeft goedgekeurd, terwijl zij nu plots deze wet naar de verdoemenis willen sturen. Dat is toch een klein beetje absurd, vindt u niet? Het is nu absurd of het was toen absurd, maar in elk geval absurd.

Mais enfin, monsieur, votre argument n'est pas sérieux, je vous ai dit que l'entorse portait sur trois jours dans l'année.
Cependant, je pourrais pousser l'analyse plus loin. J'ai dit en commission que notre législation présentait un problème. Très souvent, nous adoptons une position extrême dans toute une série de débats et nous votons des lois qui ne laissent place à aucune possibilité de dérogation d'aucune sorte car nous sommes naturellement persuadés qu'elles ne seront pas appliquées de cette manière. Je donnais l'exemple notamment de la législation qui limite considérablement les endroits où l'on peut fumer dans les cafés et les restaurants. Les médias ne cessent de donner des indications selon lesquelles la loi n'est pas respectée. De toute évidence, on ne va pas envoyer un gendarme ou un policier dans chaque café ou chaque restaurant pour vérifier si la loi a été respectée. C'est cela le mal belge! On vote une série de législations extrêmes qui, bien entendu, ne seront pas appliquées.
Pendant un an, certains ont cru de bonne foi que cela ne s'appliquerait pas à la Formule 1 et qu'un arrangement serait possible. Mais on ne trouve pas d'arrangement avec les avocats internationaux. On ne trouve pas un arrangement avec des personnes qui prennent connaissance du texte de la loi et qui précisent - cela a été dit récemment dans "l'Equipe" par Max Mosley, un des grands dirigeants de la Formule 1 - que les écuries de Formule 1 ont des contrats avec des cigarettiers. Comme la Belgique interdit la publicité sur le tabac, ils respectent la loi belge et, par conséquent, ne participent pas. C'est la position logique, cohérente, juridique prise par les instances internationales, leurs avocats et autres.
Nous nous sommes trouvés évidemment en position difficile car beaucoup ont essayé, même au niveau de la Région wallonne, de trouver des formules d'arrangement pour un jour ou deux. Voici un an, j'ai dit qu'on ne trouverait pas d'arrangement parce qu'il s'agit de problèmes juridiques. On ne nous a pas crus à l'époque. C'est une erreur et à présent, on se rend compte que la modification de la loi est la condition nécessaire, mais certes pas suffisante, à l'organisation d'une manifestation d'importance mondiale. Je ne parle pas spécialement du Grand Prix de Francorchamps. Il peut s'agir de tout autre chose.
La deuxième question a trait au caractère communautaire du problème. Je sais bien que certains de mes collègues ont avancé que c'était le cas. Non, ce n'est pas un problème communautaire. La loi vaut pour tout le monde, Flandre et Wallonie. La Flandre n'aime pas les sports moteurs et de moins en moins, nous le savons bien. Cependant, la Flandre a un grand rallye international, le rallye d'Ypres, auquel j'ai assisté quelques fois. Ce n'est pas la faute des Wallons s'il a été décidé que le rallye d'Ypres serait en quelque sorte rétrogradé au rang d'un rallye d'importance moyenne alors que l'Allemagne, à moins de 150 kilomètres de chez moi à Liège, a obtenu une manche du championnat du monde des rallyes où les voitures, comme tout le monde le sait, sont sponsorisées par les fabricants de cigarettes. Zolder, à tort ou à raison, pourrait aussi bénéficier d'une organisation d'importance mondiale. Je ne vais pas vous expliquer en détail les diverses compétitions automobiles actuellement soutenues par les cigarettiers.
Nous, en effet, nous avons estimé que Francorchamps devait être sauvé et que le Grand Prix devait avoir lieu. C'est d'autant moins un problème communautaire que le VLD nous a soutenus dès le départ, avec une position très claire. Il a rappelé que la loi est fédérale et que, par conséquent, la Flandre et la Wallonie font ce qu'elles veulent. Seuls les Wallons le souhaitent pour l'instant, et pas les Flamands. Nous n'avons aucune raison de bloquer les Wallons dans leur volonté de favoriser le développement économique de la région. Je tiens à remercier le VLD de nous avoir toujours aidés, même à quelques semaines des élections, à un moment où les sensibilités sont à vif. J'ai constaté avec plaisir que le coup de main apporté par le VLD aux francophones ne leur a pas créé de problèmes en Flandre, bien au contraire si j'en juge par les excellents résultats qu'ils ont engrangés.
Troisième question: on nous a dit aussi que ce n'était pas la peine de voter cette loi car c'est quand même fichu. Non, ce n'est pas fichu! C'est la condition nécessaire. La porte est ouverte et il faut s'y engouffrer. Et ce n'est plus alors le problème du fédéral mais celui d'autres autorités. C'est le problème de ceux qui, comme moi, s'intéressent à cette question. Bien sûr, il faut aller voir l'autorité internationale, il faut la rencontrer, la convaincre et il y a toute une série de possibilités à cet égard: 2004, 2005 avec prolongation et contrat, etc. Nous verrons bien. En tout cas, s'il n'y a pas de dérogation, il n'y aura même pas de négociation sur le Grand Prix.
Quatrième question: on a parlé du financement alternatif. C'est évidemment une erreur considérable. Il ne s'agit pas d'une matière comme la sécurité sociale, il n'y a pas de financement alternatif. En effet, la question n'est pas de trouver de l'argent pour organiser le Grand Prix, la question est de savoir si on respecte ou non les contrats passés au plan international entre les grandes marques de cigarettes, d'une part, et les écuries, d'autre part. A moins que vous me disiez que vous avez trouvé quelque part dans le budget de l'Etat ou de la Région 1 milliard pour Ferrari, autant pour Mac Laren ou pour BMW, ce dont je me réjouirais. Mais je crois que poser la question, c'est évidemment y répondre.
Les contrats existent et, bien entendu, c'est cela qui bloque fondamentalement. Ce n'est pas quelques centaines de millions qu'il faut donner - comme je l'ai entendu de quelques collègues Ecolo au Sénat - à M. Ecclestone pour qu'il soit gentil avec nous. Cela ne signifie rien. C'est une image d'Epinal, c'est une image débile car c'est ne pas connaître l'organisation de la Formule 1 que d'inventer ce genre d'arguments. Il y a des contrats et nous devons les respecter. Si nous ne les respectons pas, la Formule 1 ira ailleurs!
On nous parle aussi de mondialisation. Le grand mot est lâché! Chers collègues, la question n'est pas là. Nous avons une majorité de Grands Prix en Europe actuellement, c'est vrai. Nous savons aussi qu'il y a des Grands Prix qui se dessinent, par exemple à Bahreïn, qui sort du sable, et à Shanghai où le circuit est en construction. Il est vrai que la Formule 1, comme tous les sports d'ailleurs, s'internationalise. Je voyais récemment les propositions de M. Verbruggen dans le domaine du cyclisme qui disait que tout devait être réorganisé car on ne pouvait plus rester uniquement en Europe et qu'un certain nombre de pays, comme le Qatar, devaient bénéficier de la présence de nos grandes vedettes qui se sont illustrées au Tour de France ou dans les classiques. Tout le monde s'internationalise, c'est bien évident mais il y a 17 Grands Prix et la question est de savoir quels sont les Grands Prix européens qui vont tomber. Quand on est huit ou neuf et quand un ou deux Grands Prix tombent, ne pas respecter les règles de la fédération internationale, c'est se mettre tout de suite hors-jeu. Il faut savoir que parmi ceux qui décident des calendriers, il y a de nombreux représentants des circuits. Vous n'allez quand même pas vous imaginer que ces représentants-là vont nous soutenir! Ils nous mettent une main sur l'épaule et de l'autre, ils nous enfoncent un poignard dans le dos. C'est parfois comme cela en politique. C'est normal, car ils n'ont aucune raison de considérer qu'il faut essayer de sauver Francorchamps. Ceux qui sont en difficulté, comme le Grand Prix de Hongrie, le Grand Prix d'Imola ou d'autres, se frottent les mains à l'idée que Francorchamps s'exclue d'office du débat qui doit aboutir à l'exclusion de un ou deux Grands Prix. Voilà la difficulté que nous rencontrerions sans la dérogation à la loi.
Tout cela fait beaucoup de bruit pour rien. Je vous avoue que je n'ai pas lu tous les éditorialistes, mais dans les journaux francophones, on faisait état d'éditorialistes flamands qui avaient sorti des titres assez étonnants: "Francorchamps, du pain et des jeux". Je ne comprends pas cette attitude car, dans cette optique, on pourrait alors aussi supprimer le Festival de Werchter en Flandre, les commerces ou les cafés à la mer ou le Tour de Flandre. Ce sont aussi du pain et des jeux qui attirent les gens. Tout cela n'est pas sérieux, les Wallons ne peuvent pas accepter ce type d'agressivité bornée et délibérée. La Formule 1 à Francorchamps, ce n'est pas du pain et des jeux, c'est un élément du développement touristique de la région qui, par ailleurs, possède des richesses culturelles, historiques et d'autres valeurs économiques. C'est un tout qui fait que cette région a envie d'exister. La Formule 1 et le développement du circuit constituent un élément fondamental de l'ensemble. Chacun choisit les armes qu'il possède pour assurer son propre développement, c'est cela aussi la loyauté fédérale.
Finalement, je dirais qu'il y a eu beaucoup de bruit et de fureur, beaucoup de changements politiques aussi pour une demande bien simple qui, pour nous, ne remettait pas en cause la lutte contre le tabagisme mais qui mettait en avant des impératifs économiques importants face à la toute légère atteinte à la loi que constitue cette dérogation de trois jours.
Le Grand Prix aura-t-il lieu en 2004? Je ne sais pas, on a perdu un an et on ne nous a pas attendus. Depuis un an, de nouveaux Grands Prix se sont concrétisés à l'extérieur et le Grand Prix d'Imola, en difficulté, a été soutenu, non seulement par Ferrari mais surtout par le gouvernement italien qui a massivement expliqué qu'Imola ne pouvait pas "sauter".
Que demandons-nous? Comme nous le faisons depuis un an, nous demandons simplement d'être au moins sur la même ligne de départ que les autres. Ensuite, la qualité de notre circuit, de l'environnement, de notre "know-how" en général fera le reste.
Si le Grand Prix n'a pas lieu, l'opposition au projet sera satisfaite car il n'y aura pas de dérogation à la loi. S'il se fait en 2004 ou en 2005, il y aura bien sûr un très léger coup de canif dans la loi, mais en face, il y aura la population de la Région wallonne qui attend cet événement, qui en vit en partie au niveau économique et social grâce aux retombées sur les petites organisations sportives, culturelles et autres, une population dont le dynamisme se renforce par la tenue d'événements comme le Grand Prix de Formule 1, comme les Francofolies de Spa qui ensemble attirent des centaines de milliers de spectateurs. Unless you told me that you found somewhere in the state or regional budget 1 billion for Ferrari, so much for Mac Laren or for BMW, which I would look forward to. Contracts exist and, of course, this is what fundamentally blocks. It is not a few hundred million that must be given – as I have heard from some Ecolo colleagues in the Senate – to Mr. Ecolo. Ecclestone to be kind to us. This does not mean anything. It’s an image of Epinal, it’s a weak image because it’s not knowing the organization of Formula 1 that to invent such arguments. There are contracts and we must comply with them. If we do not respect them, Formula 1 will go elsewhere!

It is true that Formula 1, like all other sports, is becoming internationalized. I have recently read the proposals of Mr. Verbruggen in the field of cycling who said that everything had to be reorganized because one could no longer remain only in Europe and that a number of countries, such as Qatar, should benefit from the presence of our great stars who have illustrated themselves in the Tour de France or in the classics. Everyone internationalizes, this is obvious, but there are 17 Grand Prix and the question is which European Grand Prix will fall. When you are eight or nine and when one or two Grand Prix falls, not complying with the rules of the international federation, it is immediately out of play. It should be known that among those who decide on calendars, there are many representatives of the circuits. You will not even imagine that these representatives will support us! They put one hand on our shoulder and the other, they put a fist in our back. Sometimes this is the case in politics. This is normal, because they have no reason to consider trying to save Francorchamps. Those who are in trouble, such as the Grand Prix of Hungary, the Grand Prix of Imola or others, rub their hands on the idea that Francorchamps excludes himself by office from the debate that should lead to the exclusion of one or two Grand Prix. This is the difficulty we would encounter without the derogation from the law.

Will the Grand Prix be held in 2004? I don’t know, we lost a year and we didn’t wait. For a year, new Grand Prix have been realised outside and the Grand Prix of Imola, in difficulty, has been supported, not only by Ferrari but above all by the Italian government that massively explained that Imola could not "hop".
What do we ask? As we have been doing for a year, we simply ask to be at least on the same starting line as the others. Then, the quality of our circuit, the environment, our “know-how” in general will do the rest.

Mijnheer de voorzitter, geachte collega's, het moet duidelijk zijn dat CD&V altijd gekant is geweest tegen iedere versoepeling van de wetgeving op tabaksreclame en tabaksproducten. Wij willen onze consequente houding blijven aannemen, zeker ten aanzien van schadelijke, carcinogene producten. Hiertoe hebben wij uiteraard gegronde redenen. Die zijn gekend, en die blijven onverminderd. Ten eerste gaat het hier over gezondheidsbelangen die nooit of te nimmer mogen worden opgeofferd aan economische belangen. Het opnieuw toelaten van tabaksreclame zou een totaal foutief signaal betekenen waardoor roken meer aanvaardbaar zou kunnen worden in onze maatschappij. Onze strategie bestaat er integendeel in om aan preventie en ontrading te doen. Dat zijn twee cruciale sleutelwoorden.
Wij moeten ook vaststellen dat men met het probleem bleef aanmodderen en dat het steeds vooruit werd geschoven. In vijf jaar wet-Vanvelthoven werden nooit de nodige voorzorgen genomen om een Grote Prijs Formule 1 van Spa-Francorchamps te kunnen laten doorgaan zonder tabaksreclame. Dat zijn vijf verloren jaren geweest. Dit is in tegenstelling tot andere massamanifestaties waar wel aanpassingen zijn gebeurd en waar wel naar alternatieve financiering is gezocht. Het mogelijk verdwijnen van de Grote Prijs van Francorchamps gewoon toeschrijven aan een verbod op de tabaksreclame is voor ons een drogreden. De echte reden is de mondialisering van de autosport, mijnheer Monfils. Dat is wel de echte reden omdat andere landen, vooral in het Oosten, zo graag die Grand Prix willen organiseren. De twee nieuwe Grand Prix, namelijk die van China en van Bahrein, wijzen er eigenlijk op dat de grote bons Ecclestone de toekomst van de Formule 1 niet in Europa, maar in het Oosten ziet liggen.
Collega's, CD&V wil niet liever dan dat het goed gaat met de economie. Dat geldt ook voor de Waalse regio. Het recente verleden heeft echter aangetoond dat bij uitstel en bij het dichterbij komen en bereiken van de deadline de problemen gewoon niet opgelost geraken en dat er totaal niets voorbereid wordt inzake een alternatieve financiering. Ik zou hier durven zeggen dat wij a fortiori en met het oog op de komende regionale verkiezingen een opbod verwachten van de Franstalige partijen. Ik vind dat ook logisch. Het is echter zeker geen klimaat voor een duurzame oplossing. Het biedt ook geen perspectief voor de afschaffing van de tabaksreclame.
Ik kom nu tot de werking in de commissie. Dit moet mij echt van het hart. Het betreffende wetsvoorstel werd in de commissie goedgekeurd, dat tot daar aan toe. Dit is echter het eerste politieke dossier waarmee ik en samen met mij ook nog enkele andere neofieten hier in deze Kamer geconfronteerd worden. Juist dit dossier wordt dan binnengehaald met een wisselmeerderheid. Het Waalse front doet het met de hand en spandiensten van de Vlaamse meerderheidspartijen. Dat belooft voor wat komt. Collega's, dat belooft.
We rekenen erop dat er met evenveel haast en enthousiasme zal worden gereageerd op andere communautaire dossiers die van echt belang zijn voor de Vlaamse macro-economische ontwikkelingen. Ik denk hier onwillekeurig aan de verdeling van de emissiedoelstellingen over de Gewesten versus de leefbaarheid van de moderne, maar energie-intensieve Vlaamse industrie. Deze is vooral geconcentreerd langs het Albertkanaal in de Kempen en uiteraard ook in het Antwerpse havengebied.
In al deze aangelegenheden, waaraan duizenden jobs vasthangen, mogen wij ook een soort van federale loyaliteit verwachten. Hiermee haal ik de vorige spreker even aan.
Collega's, wat met grote trom werd aangekondigd, met sp.a als voortrekker van een Europese regelgeving, zakt nu allemaal als een klein kaartenhuisje in elkaar. De mensen zeggen mij dat de prijs die vader Vanvelthoven moet betalen om zijn zoon staatssecretaris te maken — de uitholling van zijn wet en paradepaard — wel erg hoog is. Dat vertrouwen de mensen mij toe. Erger is dat de sp.a haar eigen principes verloochent. Erger is dat de groenste regering ooit capituleert. Zij profiteert van het verdwijnen van Agalev om het uitstel door te drukken.
Geachte collega's, in de commissie stemde onze fractie ook tegen het artikel 3 betreffende het Fonds ter bestrijding van het tabaksgebruik. Het Fonds is een uitstekende zaak, laat dat duidelijk zijn. Laat daar zeker geen twijfel over bestaan. Eerst en vooral moet echter werk worden gemaakt van een samenwerkingsakkoord tussen de federale overheid en de Gemeenschappen over een globale vermindering van het tabaksgebruik. U kan het allen lezen in het voorstel dat op de tafels ligt. Nu staat er: "Het samenwerkingsakkoord van ...". Dat is geen degelijk legistiek werk. Zodra het samenwerkingsakkoord een feit is — en alleen dan — zal de uitvoering van het akkoord met de oprichting van het antitabaksfonds meer dan onze volle steun genieten.
Mijnheer de minister, wij verwachten ook een initiatief en een duidelijk, krachtig signaal van de Belgische regering om de jaarlijkse toelage van 1 miljard euro van de Europese Commissie aan de tabaksteelt ongedaan te maken. Wij verwachten minstens dat ze deze transfers in vraag stelt.
Mijnheer de voorzitter, collega's, we hoorden en voelden het al meer in dit halfrond: in België zijn late LSP-regeringen aan de macht. U weet wel, in de jaren tachtig waren de LSP-cursussen — Leading Success People — bijzonder in trek. De strijdkreet van deze superpositivo's was: be positive, don't be negative. De schijn was hier belangrijker dan de realiteit. Elk negatief geluid was doemdenkerij. We weten inmiddels wat met die LSP-adepten is gebeurd. Velen kwamen opgebrand in de psychiatrie terecht. Anderen hebben hun bedrijf opgelicht of ten gronde gericht. De meest gehaaiden waarschuwen nu in boeken tegen de LSP-risico's.
Op gevaar af aan dit "tsjakaa-gevoel" ten onder te gaan, wil ik toch drie dingen noemen die je jezelf en de anderen zeker moet toewensen, namelijk gezondheid, vreugde en vrienden. Om dit te realiseren, geef ik nog een suggestie. Heden is het mogelijk, dankzij het koninklijk besluit van de 9de van de vorige maand om ondanks het reclameverbod voor geneesmiddelen in ons land op ruime schaal publiciteit te maken voor tabaksontwennende geneesmiddelen. Laat de Grand Prix-organisatoren zich op deze markt begeven en alles wordt koek en ei. Zo eenvoudig is mijn verhaal. Ik dank u.

That is the real reason because other countries, especially in the East, like to organize that Grand Prix. The two new Grand Prix, namely that of China and Bahrain, actually indicate that Ecclestone’s big bonuses see the future of Formula 1 not in Europe, but in the East.

Monsieur le président, monsieur le ministre, chers collègues, je ne vais pas ressasser l'ensemble du débat qui a déjà eu lieu à de multiples reprises et encore en commission de la Justice, il y a quelques jours. Je voudrais simplement attirer l'attention sur le fait que, depuis les premières discussions en commission au parlement, j'ai l'impression que nous sommes plutôt dans une phase de réparation.
Je m'explique. Durant la première commission de la Justice à laquelle j'ai assisté, on nous a demandé de faire passer la prescription des crimes non correctionnalisables de dix à quinze ans, proposition qui avait été déposée antérieurement par le CD&V et qui n'avait pas été adoptée.
On vient de changer la loi de compétence universelle, qui a été intégrée dans le Code pénal. Nous avons donc modifié une loi d'avril 2003; or, nous sommes seulement en juillet 2003.
On va certainement modifier également cet après-midi le régime de l'octroi des licences en matière d'exportation d'armes, modification d'une loi de mars 2003.
Et ici, nous allons voter une nouvelle fois — pour mon grand bonheur tout de même! — sur l'exception de la publicité tabac à Francorchamps. J'espère que nous aurons aussi d'autres dossiers à étudier qui, eux, porteront sur le futur!
En ce qui concerne Francorchamps, comme je l'ai dit en commission, je voudrais simplement insister aujourd'hui sur le mot "proportion". Deux intérêts sont clairement mis en jeu ici: l'intérêt de santé publique et l'intérêt économique, lié au prestige de la région de Francorchamps. Or, l'intérêt de santé publique ne sera pas atteint et nous le savons très bien. Nous savons pertinemment que si le Grand Prix n'a pas lieu à Francorchamps, il se déroulera ailleurs avec la publicité tabac, que ce soit à Sepang, à Bahreïn ou ailleurs. On sait dès lors que l'intérêt de santé publique, le souhait tout à fait légitime de protéger principalement les jeunes contre les publicités pour le tabac, ne sera pas atteint!
On sait que la seule manière d'atteindre cet objectif est d'avoir une vision globale forte et à un niveau international. C'est dans ce sens qu'a été votée la directive qui entrera en vigueur en 2005 et qui interdira toute forme de publicité pour le tabac dans l'ensemble de l'Union européenne.
On doit également investir dans la prévention. Cette proposition de loi va dans le sens d'une prévention plus globale, clairement et bien financée et permettant de s'attaquer aux vrais problèmes. Mais cet objectif de santé publique ne sera pas atteint avant 2005 et il ne le sera pas avec cette interdiction totale de publicité pour le tabac, même lors des événements internationaux.
A côté de cet intérêt de santé publique, il y a l'intérêt économique et le prestige de toute une région. Là, c'est chiffrable, d'autant qu'on a déjà vécu des années sans Grand Prix de Formule 1. C'est direct. André Frédéric a cité en commission des chiffres tout à fait exacts qui montrent l'importance de l'impact économique résultant de l'absence du Grand Prix sur une région.
Il y a donc deux intérêts, deux objectifs à atteindre. L'un des deux, celui de santé publique, ne sera pas atteint, mais on peut tout de même essayer d'en maintenir un: l'intérêt économique de l'ensemble d'une région et le prestige conféré par ce Grand Prix de Francorchamps. C'est pour cela que la possibilité de maintenir jusqu'en 2005 la publicité pour le tabac lors des événements internationaux est tout à fait proportionnée et permet de ne pas confronter ces événements à une situation de concurrence déloyale. C'est d'ailleurs la solution qui avait été adoptée par la Cour d'arbitrage, dans son arrêt selon lequel une solution proportionnée rendant admissible l'absence de publicité pour le tabac dans les événements internationaux doit être trouvée sur un plan multinational. Le projet de loi qui nous est soumis permet, en fait, de faire la balance entre, d'une part, les intérêts économiques de plusieurs régions et, d'autre part, l'atteinte la plus minime possible à l'interdiction justifiée par des impératifs de santé publique. En l'occurrence, seule cette balance d'intérêt public garantira réellement l'efficacité de la démarche poursuivie en matière de santé publique.
L'argumentaire du Parti socialiste est le même depuis des mois. Je tenterai donc d'en brosser la synthèse la plus rapide possible:
1. Le projet de loi autorise la publicité pour les produits du tabac jusqu'au 31 décembre 2005 à la suite de la nouvelle directive européenne mais sous de strictes conditions, à savoir l'organisation d'un événement sportif de niveau mondial. Je souligne que, depuis le 25 juin, la publication par la FIA du calendrier 2004 émet l'hypothèse du retour en Belgique de ce Grand Prix de Francorchamps à la date du 29 août. Il reste évidemment encore à la FIA à formaliser ce calendrier dans les semaines qui viennent et à inscrire à côté de la date du 29 août le nom de la Belgique et de Francorchamps en particulier.
2. Les conséquences sur l'économie locale wallonne et flamande sont importantes. le secteur de la distribution et l'horeca sont les principaux concernés, même si le Grand Prix représente une activité directe d'une semaine. Le chiffre d'affaires annuel pour les commerçants de la région du circuit et par conséquent, le niveau de l'emploi dans ces entreprises, sont largement conditionnés par cette épreuve.
A titre d'information, je voudrais vous rappeler un certain nombre de chiffres. Malgré des études indélicates ou mal menées, à mes yeux, les retombées pour la région oscilleraient autour de 15 à 20 millions d'euros par an, dont 8 millions pour l'horeca en province de Liège.
Il est également prouvé que les retombées économiques dépassent le cadre de la Région wallonne - on tient les documents par centaines à votre disposition - puisque des hôteliers de la province du Limbourg, de la région brugeoise ont déclaré, par écrit, être intéressés, parce qu'ils bénéficiaient également de l'affluence de spectateurs durant la semaine du Grand Prix et il n'y a pas que le secteur horeca, on le sait. Une quarantaine d'entreprises flamandes qui ont une activité directe sur le circuit ont été répertoriées.
3. Je me dois de revenir sur l'argument fondamental suivant: interdire toute publicité en faveur du tabac sur les voitures qui tournent à Francorchamps, tandis que l'on autorise une délocalisation sur un quelconque circuit, dans les Emirats, en Russie ou en Chine, avec cette même publicité à l'écran, visible par tous les jeunes qui n'ont pas les moyens de s'offrir l'entrée au Grand Prix de Formule 1, aurait un effet nul et un résultat identique en ce qui nous concerne.
4. La directive européenne qui voulait imposer à tous les pays de l'Union européenne de proscrire toute publicité pour le tabac, à partir du 1er octobre 2006 se voit annulée par la Cour de justice. La nouvelle directive prévoit l'interdiction de la publicité à partir de 2005. Nous ne désirons donc que nous aligner sur cette directive, ni plus ni moins.
On a souvent parlé des retombées économiques pour les entreprises de la région, mais on doit souligner aussi qu'un nombre important d'associations, qu'elles soient sportives ou culturelles, vivent et parviennent à équilibrer leur budget annuel parce qu'elles travaillent dans le cadre de ce Grand Prix. Les collègues bourgmestres de l'arrondissement de Verviers et de la région de Francorchamps connaissent aussi les difficultés des finances locales, puisqu'en matière de taxe, le manque à gagner s'élève à 513.000 euros pour Stavelot et à 300.000 euros pour Malmédy.
J'en termine, monsieur le président, monsieur le ministre. Le Grand Prix de Formule 1 et le circuit de Francorchamps jouissent d'une renommée internationale et revêtent une importance capitale, non pour l'image des produits du tabac, mais pour celle de la Belgique et de la région. Le Grand Prix est une vitrine pour notre pays dans le monde entier. Il faut savoir qu'un milliard de personnes suivent ce Grand Prix en direct, ce qui en fait un des événements les plus médiatisés du monde.
Enfin, monsieur le ministre, le projet prévoit la création d'un fonds de lutte contre le tabagisme. Nous nous en réjouissons bien évidemment et nous considérons qu'il est capital de concrétiser l'attribution des crédits à ce fonds dès 2004, pour qu'il puisse être opérationnel.
En conclusion, monsieur le président, monsieur le ministre, je me réjouis que ce débat ait lieu dans un climat serein, un peu moins passionné voire moins passionnel et peut-être même moins passionnant qu'il y a quelques mois. Je me réjouis que le vote qui interviendra tout à l'heure nous donnera l'occasion de redonner l'espoir à toute une région et de redorer notre image à l'étranger, grâce au retour dès 2004, du Grand Prix de Formule 1 à Francorchamps.

Comme vient de le dire notre collègue, c'est un transvasement permanent de gens qui vont d'une région à une autre pour assister à un grand événement sportif.
Comment n'a-t-on pas encore compris cela dans ce pays?
Le monde du sport se réjouit aujourd'hui: le sport n'a pas seulement une vocation sociale, il n'a pas seulement une vocation d'intégration et de multiculturalité, le sport se base aussi sur de grands événements.
Je félicite et je remercie tous ceux qui ont été à la base de la révision de cette loi, au MR, au Parti socialiste, au VLD et au cdH également. M. Wathelet ne m'étonne pas, il est de la région. Ils ont compris qu'il fallait revoir cette loi et revenir à l'essentiel. Nous avons le droit aussi, dans ce pays, d'avoir des grands événements. Au sujet du Grand Prix de Francorchamps, j'aimerais rappeler une fois de plus, même si cela fait mal à certains, que c'est à la demande expresse des écolos qu'en 1997, le Parlement fédéral votait une loi interdisant toute publicité pour le tabac à l'occasion du Grand Prix de Francorchamps, anticipant ainsi l'application d'une directive européenne qui, à l'époque, ne devait prendre cours qu'en 2006. Notre pays, d'habitude si peu empressé d'inscrire dans ses lois une décision du Parlement européen, voulait se distinguer en manifestant un excès de zèle peu commun. Cette loi nationale fut soutenue en son temps, il faut aussi le rappeler, par les députés Ecolo bien entendu mais aussi par le PS, par le PSC et par le PRL. Cette même année 1997, j'intervenais en séance plénière du Parlement européen à Strasbourg, pour défendre la survie des Grands Prix de Formule 1 en Europe, tout en reconnaissant bien sûr la nocivité du tabac.
Mais voilà... Devant la levée de bouclier de ceux qui vivent de Francorchamps, de ceux qui aiment la Formule 1, de ceux qui savent que s'il n'y a plus de Grand Prix en Belgique, il y en aura ailleurs, en dehors de l'Union européenne, et qu'ils seront sponsorisés par la publicité pour le tabac, craignant une sanction des électeurs, les parlementaires socialistes, libéraux et socio-chrétiens francophones se sont ravisés et tentèrent, fin 2002, de faire passer une nouvelle loi abrogeant celle qu'ils avaient eux-mêmes votée cinq ans plus tôt. Trop tard, le mal était fait.
Alors, nous assistâmes dans cette Chambre à un spectacle hallucinant. Les élus PS, sans lesquels tout cela ne serait jamais arrivé, supplièrent leurs frères du sp.a, lesquels ont aujourd'hui perdu leur langue, de soutenir le report de la loi de 1997. On eut même droit à un spectacle tout à fait désopilant donné par leur chef de groupe, M. Eerdekens, dans le style de De Funès, qui tentait de séduire par une flatterie assez grotesque les élus du CD&V, leur rappelant, je cite, "qu'il n'avait pas oublié tout le bon travail qu'ils avaient fait ensemble", avant que le PS ne leur préfère les libéraux. On entendit le chef de groupe du MR, le docteur Bacquelaine, s'emporter contre "l'intégrisme des Verts". Mais le clou de la représentation nous fut offert par Ecolo dont la porte-parole nous assura qu'elle ferait tout pour ressusciter Francorchamps et termina son oraison par ces paroles désormais historiques: "Francorchamps oui, le tabac non!"
J'eus moi-même droit à des manoeuvres de séduction, menées par des élus de partis autoproclamés démocratiques qui osèrent sauter par-dessus le cordon sanitaire pour me demander poliment, très poliment, comment j'allais voter. J'ai voté bien entendu comme en 1997, en faveur de Francorchamps, et je pense d'ailleurs, qu'on soit pour, comme certains de mes amis flamands, ou qu'on soit contre, que l'important est de ne pas changer d'avis.
