Monsieur le président, chers collègues, madame la ministre, je pense que les propositions de loi en matière de médiation étaient un pas important pour lutter contre l'arriéré judiciaire.
Cela étant, la commission de la Justice a examiné les différentes propositions de loi au cours de dix réunions (14 janvier, 17 mars, 31 mars, 20 avril, 4 mai, 18 mai, 26 mai, 1 er juin, 8 juin et 15 juin). Trois propositions de loi ont été exposées.
La première est reprise au document 0327/001. Selon M. Fournaux, auteur principal de la proposition de loi, la médiation doit être généralisée à toutes les matières. A cette fin, il convient d'en régler les principes généraux dans le Code judiciaire. Effectivement, la médiation est un processus de concertation volontaire entre parties en conflit, géré par un tiers indépendant qui facilite la communication et tente d'aider les parties à élaborer elles-mêmes une solution nouvelle.
1. La présente proposition de loi procède à l'insertion dans le Code judiciaire d'une septième partie intitulée "La médiation", visant à articuler la médiation avec les autres instruments de droit judiciaire, notamment le titre exécutoire. Le choix de l'insertion d'une nouvelle partie se fonde sur la volonté de rendre la médiation applicable à toutes les matières et pas seulement les matières familiales.
2. Les lignes de force de la présente proposition de loi sont les suivantes. D'abord, la médiation trouve à s'appliquer à tout conflit, à l'exception des matières d'ordre public. Ensuite, la médiation est un processus volontaire. Toutefois, si un contrat contient une clause de médiation préalable, la mise en oeuvre matérielle de cette clause est une obligation de résultat. Par contre, l'aboutissement du processus de médiation est une obligation de moyen. Les parties peuvent à tout moment mettre fin à cette procédure.
3. Le statut du médiateur. Les auteurs de la proposition estiment que l'avocat ou le notaire ne doit pas détenir le monopole de la médiation. Le médiateur doit toutefois pouvoir réunir un certain nombre de garanties d'honnêteté, de probité, de qualification, d'expérience, d'indépendance et d'impartialité. Le médiateur doit donc être majeur, ne pas avoir fait l'objet d'une condamnation pour atteinte à l'honneur, à la probité et aux bonnes moeurs, posséder la qualification requise pour la nature du litige, justifier d'une formation et d'une expérience adaptées à la politique de la médiation et présenter des garanties d'indépendance et d'impartialité.
4. Les compétences du médiateur. Il n'a pas de pouvoir d'instruction, mais il peut, avec l'accord des parties, s'entourer de spécialistes susceptibles de l'éclairer sur les aspects techniques qui lui échappent.
5. Le secret professionnel et la confidentialité. Le médiateur est bien entendu tenu au secret professionnel, conformément à l'article 458 du Code pénal. Les tiers qu'il entend doivent respecter le caractère confidentiel de la médiation. Sauf accord des parties, les contestations du médiateur et les déclarations qu'il recueille ne peuvent être ni produites ni invoquées dans la suite de la procédure ou dans le cadre d'une autre instance.
6. La proposition de loi organise deux types de médiation: la médiation volontaire et la médiation judiciaire. L'auteur de la proposition de loi a détaillé la procédure de ces deux types de médiation et je renvoie à cet égard au rapport écrit.
Dans la deuxième proposition de loi, document 51 669/001, Mme Marie-Christine Marghem, auteur principal de la proposition, fait observer que le coût et la lenteur des procédures judiciaires sont les deux maux récurrents qui affectent le fonctionnement de la machine judiciaire, pour la plus grande insatisfaction des parties.
Lors d'un procès, le justiciable a également de plus en plus l'impression qu'il n'est pas maître de son affaire. Dans une société de plus en plus individualiste, le moindre conflit peut déboucher sur un procès. La possibilité de discuter de ce conflit et de trouver une solution commune est de plus en plus improbable. C'est dans ce contexte que la procédure de médiation constitue une piste de réflexion particulièrement intéressante. Les intéressés exposent leur litige à une personne, un médiateur, qui les incite à en discuter. Cette personne présente les affaires objectivement et sous un jour nouveau, en dehors de la situation conflictuelle et ne statue pas sur le fond du litige. Les parties sont elles-mêmes invitées à chercher une solution à leur problème, avec l'aide d'une personne qui ne fait pas partie du pouvoir judiciaire.
La procédure de médiation n'est pas une nouveauté dans notre système judiciaire. En fait, la médiation en matière familiale existe déjà et porte ses fruits. Cette méthode n'est toutefois pas encore bien connue des justiciables. Par l'insertion d'un nouveau chapitre dans le Code judiciaire, les auteurs proposent dès lors d'étendre la possibilité de médiation qui existe déjà pour les dossiers familiaux à tous les litiges qui peuvent naître dans le domaine civil, commercial ou social. L'intervenante souligne que la médiation n'est pas obligatoire dans le système prévu par la proposition. Elle ne peut être imposée par le juge, on ne peut donc recourir à la médiation que moyennant le consentement de toutes les parties. La médiation peut être demandée et appliquée à tout moment, tant en première instance qu'en appel, aussi longtemps que la cause n'a pas été mise en délibéré. Le but est bien de laisser la plus grande latitude possible en ce qui concerne le choix du médiateur.
Il va sans dire que les avocats et les notaires, qui sont familiarisés avec le droit, peuvent être désignés comme médiateurs. La proposition ne réserve cependant pas cette fonction à ces seuls groupes de juristes. D'autres personnes physiques peuvent également être désignées, pour autant qu'elles puissent prouver qu'elles sont qualifiées pour la nature du litige, qu'elles disposent de l'expérience pratique qui les rend aptes à remplir cette mission de médiation et que leur indépendance est suffisamment garantie. Le juge peut néanmoins faire des suggestions aux parties en ce qui concerne les qualités du médiateur recherché.
La médiation est placée sous le signe de la confidentialité. Le médiateur est tenu par l'obligation de secret au sens de l'article 458 du Code pénal. Seule une contrainte de temps est prévue, étant donné qu'un délai de trois mois est fixé pour arriver à un accord. Dès que le médiateur a terminé sa mission, avec succès ou non, il informe le magistrat en charge du dossier. Lorsque la cause est à nouveau examinée en audience, les parties peuvent, sur la base des conclusions communes, demander au juge de prendre acte de l'accord qu'elles ont conclu, soit sur l'ensemble du litige, soit sur certains points de celui-ci. Le juge conférera une force exécutoire à l'accord.
Enfin, Mme Marghem fait observer qu'en ce qui concerne le coût de la procédure, les parties demandent préalablement au médiateur ce que coûtera la médiation.

Ensuite, nous arrivons à l'exposé introductif de Mme Onkelinx, vicepremière ministre et ministre de la Justice.
La ministre a indiqué qu'un des objectifs du gouvernement — repris dans la déclaration gouvernementale et plus spécifiquement dans le plan Themis pour une administration rapide de la Justice — consiste précisément à octroyer une base légale à la médiation. Il est important de créer un mécanisme qui permette aux citoyens de résoudre leurs litiges sans intervention judiciaire ou, du moins, par une intervention réduite au minimum indispensable.
Cela concerne les litiges de faible importance mais aussi ceux qui entraînent une grande tension pour leurs protagonistes. Chercher ensemble une solution offrira davantage de garanties pour l'avenir. Les parties ne couperont pas les ponts, chercheront ensemble de manière constructive une solution qui leur apporte à chacune satisfaction. Le sentiment de frustration qu'éprouve la partie perdante d'un procès est ainsi évité. Pour réaliser cet objectif, il est cependant indispensable de pourvoir la médiation des garanties juridiques essentielles. Les parties doivent pouvoir se fier à la compétence technique, à l'indépendance et à l'impartialité de la personne qui essayera de les conseiller. Elles doivent avoir la garantie qu'elles pourront parler dans un espace privilégié de confidentialité. Les informations échangées lors de la médiation doivent rester confidentielles, même si à l'issue de la médiation aucun accord n'est intervenu et qu'une suite judiciaire s'avère inévitable. Néanmoins, dans un évident souci d'économie de procédure, certaines mesures d'instruction doivent pouvoir être utilisées au cours d'une procédure judiciaire ultérieure. La ministre pense notamment aux expertises dans les litiges de construction.
Le caractère volontaire de la médiation favorisera considérablement l'exécution spontanée de l'accord négocié par les parties. Il subsistera malheureusement toujours certaines hypothèses dans lesquelles il sera nécessaire de recourir à une procédure d'exécution forcée. Il est donc essentiel de prévoir une transformation simple et performante de l'accord de médiation en titre exécutoire.
Si les parties ne parviennent pas à un accord, leur situation juridique ne doit pas souffrir de leur choix d'avoir d'abord voulu trouver une solution consensuelle. Il est important que les éventuels délais de prescription auxquels seraient soumises les parties soient suspendus pendant le temps de la médiation. Par ailleurs, la médiation ne peut en aucun cas être utilisée comme un procédé dilatoire. Des passerelles simples doivent exister entre la médiation et la procédure contentieuse. Ces principes sont des conditions nécessaires pour une procédure de médiation ou de conciliation opérationnelle.
La ministre précise que le débat doit tenir compte de la loi de février 2001 sur la médiation familiale. Il serait possible et préférable, semble-t-il, de profiter de l'occasion pour rassembler dans un code de règles uniques les principes applicables à la médiation en général, sans pour autant perdre de vue les spécificités propres à chaque type de médiation.
La ministre pense qu'en matière de formation et de reconnaissance des médiateurs, il serait bien plus efficace et cohérent de créer un institut de la médiation à l'échelon fédéral ou une commission fédérale de la médiation au sein du SPF Justice.
Cette commission serait composée de représentants des acteurs de la médiation et serait chargée de l'agréation et de la formation des médiateurs. La ministre est convaincue de la nécessité de garantir tant les compétences techniques des médiateurs que leurs qualités d'écoute et de gestion des conflits. Ces qualités devront être démontrées lors d'une procédure d'agréation et s'accompagner d'une formation continue pendant la période d'exercice des fonctions de médiateur.
Une distinction entre les deux types de médiation (la médiation volontaire et celle qui intervient au cours d'une procédure judiciaire) en deux chapitres distincts et complémentaires garantira la clarté nécessaire et permettra que la médiation dans toutes ses déclinaisons fasse l'objet d'une seule et même loi. Cette approche est un facteur de sécurité juridique. Dans le même ordre d'idées, la sécurité juridique justifie également que la médiation fasse l'objet d'une nouvelle septième partie du Code judiciaire pour lui accorder une place distincte, sur un pied d'égalité avec la procédure civile de l'arbitrage.
L'accès à la justice au sens large est une des priorités de la ministre. Elle veillera donc à ce que les plus démunis aient accès à la médiation. La ministre a pris l'initiative de consulter de nombreux praticiens de la médiation ainsi que des institutions spécialisées. Leurs observations ont été mises à disposition. Les travaux de la commission devront être guidés par ailleurs par les instruments européens déjà existants, soit deux recommandations de 1998 et de 2001, ainsi que par le code de conduite pour les médiateurs, en cours d'élaboration à l'échelon européen.
Enfin, les auditions. Deux séances ont été consacrées par la commission aux auditions d'éminents experts. Une première réunion a permis l'audition de magistrats: M. Christian De Vel, premier président de la cour d'appel d'Anvers, M. Marc de le Court, premier président de la cour d'appel de Bruxelles, Mme Katherine Allegaert, conseillère à la cour d'appel d'Anvers, et M. Henri Funck, président du tribunal du travail à Bruxelles. Je renvoie à mon rapport écrit pour le contenu de ces auditions.
Une seconde réunion a permis l'audition de professionnels ayant une expérience en matière de médiation: M. Patrick Van Leynseele, avocat à l'ordre des barreaux francophones et germanophones, M. Hans Van Houtte, professeur à la KUL Leuven, M. Hugo Leman, avocat à l'ordre des barreaux néerlandophones, Mme Marie-Anne Bastin, avocat, membre du Brussels Business Mediation Center, ainsi que M. Michel Gonda, avocat et Mme Monique Stroobants, médiatrice. Je renvoie également à mon rapport écrit pour le contenu de ces auditions mais je profite de ce rapport pour remercier toutes ces personnes qui ont permis d'éclairer les travaux de la commission de la Justice.
Je laisse à ma collègue Mme Van der Auwera le soin de poursuivre l'exposé de ce rapport avec le point 2 relatif à la procédure et le point 3 relatif à la discussion et au vote.

Mr. Speaker, Mr. Speaker, Mr. Speaker, Mr. Speaker, Mr. Speaker, I think that the proposed mediation legislation was an important step in the fight against judicial backwardness.
The Justice Committee examined the various bills during ten meetings (14 January, 17 March, 31 March, 20 April, 4 May, 18 May, 26 May, 1 June, 8 June and 15 June). Three bills were submitted.
The first is referred to in document 0327/001. According to M. Fournaux, the principal author of the bill, mediation should be generalized to all matters. For this purpose, the general principles should be set out in the Judicial Code. Mediation is a process of voluntary consultation between parties in a conflict, managed by an independent third party that facilitates communication and tries to help the parties develop a new solution themselves.
1 of 1. The present bill introduces in the Judicial Code a seventh part entitled "Mediation", aimed at articulating mediation with the other instruments of judicial law, in particular the enforceable title. The choice to include a new part is based on the desire to make mediation applicable to all matters and not only family matters.
2 of 2. The strength lines of this bill are as follows. Mediation is applicable to all conflicts, except in matters of public order. Mediation is a voluntary process. However, if a contract contains a pre-mediation clause, the material implementation of that clause is an outcome obligation. The completion of the mediation process is an obligation of means. The parties may terminate this procedure at any time.
3 of 3. Status of the Ombudsman. The authors of the proposal believe that the lawyer or notary should not hold the monopoly of mediation. However, the mediator must be able to bring together a number of guarantees of honesty, probity, qualification, experience, independence and impartiality. The mediator must therefore be major, not have been the subject of a conviction for infringement of honor, probity and good morals, possess the qualification required for the nature of the dispute, justify a training and experience appropriate to the policy of mediation and present guarantees of independence and impartiality.
4 of 4. Competence of the Ombudsman. He has no power of instruction, but he may, with the agreement of the parties, surround himself with specialists capable of educating him on the technical aspects that escape him.
5 of 5. professional secrecy and confidentiality. The mediator is naturally bound to professional secrecy, in accordance with Article 458 of the Criminal Code. Third parties hearing must respect the confidential nature of mediation. Unless the parties agree, the contestations of the mediator and the statements he collects cannot be produced or invoked in the aftermath of the proceedings or in another instance.
6 of 6. The bill provides two types of mediation: voluntary mediation and judicial mediation. The author of the bill detailed the procedure for these two types of mediation and I refer to the written report in this regard.
In the second bill, document 51 669/001, Ms. Marie-Christine Marghem, principal author of the proposal, notes that the cost and slowness of judicial proceedings are the two recurring evils that affect the functioning of the judicial machine, for the greatest dissatisfaction of the parties.
During a trial, the defendant also increasingly has the impression that he is not the master of his affair. In an increasingly individualist society, the slightest conflict can lead to a trial. The possibility of discussing this conflict and finding a common solution is increasingly unlikely. In this context, the mediation procedure is a ⁇ interesting way of thinking. Interested parties expose their dispute to a person, a mediator, who encourages them to discuss it. This person presents matters objectively and in a new day, outside of the conflicting situation and does not decide on the substance of the dispute. The parties themselves are invited to seek a solution to their problem, with the help of a person who is not part of the judiciary.
The mediation procedure is not a new thing in our judicial system. In fact, mediation in family matters already exists and bears its fruits. However, this method is not yet well known to the justiciables. By inserting a new chapter in the Judicial Code, the authors therefore propose to extend the possibility of mediation that already exists for family cases to all disputes that may arise in the civil, commercial or social sphere. The speaker stresses that mediation is not mandatory in the system provided for in the proposal. It cannot be imposed by the judge, so mediation can only be used with the consent of all the parties. Mediation may be requested and applied at any time, both in first instance and in appeal, as long as the case has not been deliberated. The aim is to leave as much width as possible with regard to the choice of mediator.
It goes without saying that lawyers and notaries, who are familiar with the law, can be designated as mediators. However, the proposal does not reserve this function only to these groups of lawyers. Other natural persons may also be designated, provided that they can prove that they are qualified for the nature of the dispute, that they have the practical experience that makes them capable of carrying out the mediation task and that their independence is sufficiently guaranteed. However, the judge may make suggestions to the parties regarding the qualities of the mediator sought.
Mediation is under the sign of confidentiality. The mediator is bound by the obligation of secrecy within the meaning of Article 458 of the Criminal Code. Only a time limit is provided, as a three-month period is set to reach an agreement. As soon as the mediator has completed his task, successfully or not, he informs the magistrates in charge of the case. When the case is re-examined in hearing, the parties may, on the basis of common findings, request the judge to take note of the agreement they have concluded, either on the whole of the dispute or on certain points of the dispute. The judge will give an enforceable force to the agreement.
Finally, Ms. Marghem points out that as regards the cost of the proceedings, the parties ask the mediator in advance how much mediation will cost.

Then we arrive at the introductory exhibition of Ms. Onkelinx, Deputy Prime Minister and Minister of Justice.
The Minister pointed out that one of the Government’s objectives – recognised in the Government Declaration and more specifically in the Themis Plan for a Rapid Administration of Justice – is precisely to provide a legal basis for mediation. It is important to create a mechanism that allows citizens to resolve their disputes without judicial intervention or, at least, by intervention reduced to the necessary minimum.
This applies to litigations of small importance but also those that cause great tension for their protagonists. Searching together for a solution will provide more guarantees for the future. The parties will not cut the bridges, they will look together in a constructive way for a solution that brings them to each satisfaction. The feeling of frustration experienced by the losing part of a trial is thus avoided. To ⁇ this objective, however, it is essential to provide the mediation with the essential legal guarantees. The parties must be able to rely on the technical competence, independence and impartiality of the person who will try to advise them. They must have the guarantee that they will be able to speak in a privileged space of confidentiality. The information exchanged during mediation must remain confidential, even if no agreement has been reached after the mediation and a judicial follow-up is inevitable. However, due to an obvious concern for procedural economy, certain measures of instruction must be able to be used in subsequent judicial proceedings. The Minister considers in particular the expertise in construction disputes.
The voluntary nature of mediation will greatly facilitate the spontaneous execution of the agreement negotiated by the parties. Unfortunately, there will still be certain cases in which it will be necessary to resort to a forced enforcement procedure. It is therefore essential to provide for a simple and efficient transformation of the mediation agreement into enforceable title.
If the parties do not reach an agreement, their legal situation must not be affected by their choice of having first wanted to find a consensus solution. It is important that any limitation periods to which the parties would be subject are suspended during the mediation period. Furthermore, mediation cannot in any case be used as a dilatory procedure. Simple gateways must exist between mediation and litigation. These principles are necessary conditions for an operational mediation or conciliation procedure.
The Minister specifies that the debate must take into account the February 2001 law on family mediation. It would be possible and preferable, it seems, to take the opportunity to gather in a single code of rules the principles applicable to mediation in general, without, however, losing sight of the specificities of each type of mediation.
The Minister believes that in terms of training and recognition of mediators, it would be much more efficient and consistent to create a federal mediation institute or a federal mediation commission within the SPF Justice.
This committee would be composed of representatives of mediation actors and would be responsible for the approval and training of mediators. The Minister is convinced of the need to guarantee both the technical skills of mediators and their skills of listening and conflict management. These qualities must be demonstrated during an accreditation procedure and accompanied by continuous training during the exercise of the functions of mediator.
A distinction between the two types of mediation (voluntary and judicial mediation) in two separate and complementary chapters will ensure the necessary clarity and enable mediation in all its declines to be subject to a single law. This approach is a factor of legal certainty. In the same order of ideas, legal certainty also justifies that mediation is the subject of a new seventh part of the Judicial Code to give it a separate place, on an equal footing with the civil procedure of arbitration.
Access to justice in the broad sense is one of the ministry’s priorities. It will ensure that the most disadvantaged have access to mediation. The Minister took the initiative to consult numerous mediation practitioners as well as specialized institutions. Their observations have been made available. The work of the committee will also need to be guided by existing European instruments, namely two recommendations from 1998 and 2001, as well as by the Code of Conduct for Mediators, which is being developed at European level.
Finally the hearings. Two sessions were dedicated by the committee to the hearings of prominent experts. A first meeting allowed the hearing of magistrates: Mr. Christian De Vel, First President of the Court of Appeal of Antwerp, Mr. Marc de le Court, first president of the Brussels Court of Appeal, Ms. Katherine Allegaert, adviser to the Court of Appeal of Antwerp, and Mr. Henri Funck, President of the Labour Court in Brussels. I refer to my written report for the content of these hearings.

Mijnheer de voorzitter, mevrouw de minister, geachte collega's, CD&V heeft samen met de heren Fournaux, Wathelet en Giet en mevrouw Milquet een wetsvoorstel in verband met bemiddeling ingediend dat heeft geleid tot de tekst waarover hier vandaag wordt gestemd in de plenaire vergadering van de Kamer.
Onze partij heeft, zoals u weet, steeds de voorkeur gegeven aan een minnelijke oplossing van geschillen waarbij rechtzoekenden zelf deel hebben aan het oplossen van de conflicten die hen tegenover elkaar stellen, veeleer dan dit te delegeren naar gerechtelijke instanties waarop ze weinig vat hebben. De wet inzake de bemiddeling van familiezaken van 19 februari 2001 die een initiatief was van CD&V getuigt hiervan. Omdat deze wet steeds werd gedragen door het hele Parlement, hebben wij steeds betreurd dat de uitvoeringsbesluiten van deze wet er nooit zijn gekomen, hoewel de wet reeds 2,5 jaar van kracht is.
De wettekst die vandaag ter stemming voorligt is een globale tekst die toepasbaar is op alle aangelegenheden en die ook rekening houdt met de aanpak van familiale geschillen. Wij menen dat het een goede zaak is dat in het Gerechtelijk Wetboek een deel wordt ingevoegd dat specifiek de bemiddeling behandelt. Rechtzoekenden die een conflict willen beëindigen, of het nu voor, tijdens of na een gerechtelijke procedure is, zullen hiervoor duidelijke regels kunnen terugvinden in het Gerechtelijk Wetboek. Zij zullen in onderlinge overeenstemming een bemiddelaar kiezen zonder dat hiervoor enige voorwaarde moet zijn vervuld en die gewoon als onafhankelijke derde de communicatie tussen partijen vergemakkelijkt en hen ertoe brengt tot een oplossing te komen. Dat wordt ook in een akkoord gegoten en kan vervolgens door de rechter worden gehomologeerd. Zij kunnen ook in het kader van een gerechtelijke procedure op eigen initiatief of op suggestie van de rechter ervoor opteren een beroep te doen op een erkende bemiddelaar die aan specifieke vereisten moet voldoen en die erkend wordt door een federale bemiddelingscommissie. Ook de minst gegoeden die rechtsbijstand genieten, kunnen zich wenden tot een bemiddelaar voor de oplossing van hun conflicten.
Wij zijn ervan overtuigd dat bemiddeling kan leiden tot een snellere en minder conflictueuze oplossing die de betrokken partijen tot grotere tevredenheid stemt. Wij hopen dan ook ten zeerste en willen hierop aandringen dat de minister van Justitie er snel werk van maakt om de nodige uitvoeringsbesluiten te nemen en de nodige budgetten vrij te maken opdat de wet ten volle in werking zou kunnen treden.

Mr. Speaker, Mrs. Minister, dear colleagues, CD&V, together with Mr. Fournaux, Wathelet and Giet and Mrs. Milquet, submitted a bill on mediation that led to the text which is being voted here today in the plenary session of the Chamber.
As you know, our party has always preferred an amicable settlement of disputes in which prosecutors themselves participate in the settlement of the conflicts that confront them with each other, rather than delegating this to judicial bodies to which they have little control. The law on mediation in family matters of 19 February 2001 which was an initiative of CD&V testifies to this. Since this law has always been carried by the whole Parliament, we have always regretted that the implementing decisions of this law have never arrived, although the law has already been in force for 2.5 years.
The legislation to be voted today is a global text that applies to all matters and also takes into account the handling of family disputes. We believe it is a good thing to include a section in the Judicial Code that specifically deals with mediation. Applicants who wish to end a conflict, whether it is before, during or after a judicial procedure, will be able to find clear rules for this in the Judicial Code. They shall choose, by mutual agreement, a mediator without any condition to be met and who, simply as an independent third party, facilitates communication between the parties and leads them to reach a solution. This is also poured into an agreement and can then be homologated by the judge. They may also choose, on their own initiative or on the suggestion of the judge, to resort to a recognised mediator who must meet specific requirements and is recognised by a federal mediation commission. Even the least beneficial persons who receive legal assistance can turn to a mediator for the resolution of their conflicts.
We believe that mediation can lead to a faster and less conflictful solution that satisfies the parties involved. We therefore deeply hope and wish to insist that the Minister of Justice will work swiftly to take the necessary implementing decisions and release the necessary budgets so that the law can enter into full force.

Monsieur le président, madame la ministre, je ne vais pas reprendre l'ensemble des choses qui ont déjà été dites mais je vais me borner à relever l'un ou l'autre point.
Tout d'abord, je voudrais souligner la manière positive dont se sont déroulés nos travaux en commission. Il est agréable, pour un jeune parlementaire, de pouvoir travailler de cette façon dans le cadre de l'analyse d'une proposition de loi. L'ensemble des discussions ont été fructueuses et intéressantes, chacun ayant pu échanger ses points de vue dans le respect mutuel des opinions.
Ensuite, je voudrais également souligner que nous sommes restés dans le cadre d'une proposition de loi qui contient comme élément principal la volonté des parties. C'est véritablement la volonté des parties, la volonté dont elles vont faire preuve pour trouver un accord qui sera le moteur de cette médiation. A chaque moment, les parties peuvent décider d'entrer dans une médiation, avant ou pendant une procédure judiciaire. A chaque moment, ces mêmes parties peuvent dire "stop" si elles estiment que la médiation n'est pas le meilleur moyen d'aboutir. Le respect mutuel et la volonté des parties sont les éléments de base pour avancer dans le cadre de cette médiation.
Je dois toutefois relever, dans cette proposition de loi, deux petits motifs d'insatisfaction. Le premier concerne la formation et les critères auxquels doivent répondre certains médiateurs. Ce point a fait l'objet de quelques débats au sein de la commission. Nous pensons qu'il aurait été plus opportun de garantir un certain nombre de critères de sélection quant au médiateur, même dans la médiation volontaire. En effet, nous estimons que le métier de médiateur ne s'improvise pas; c'est la raison pour laquelle, il aurait fallu un minimum de garantie de compétences et d'expérience, un minimum de garantie quant au respect du code de bonne conduite pour les médiateurs, que ce soit dans le cadre d'une médiation agréée, d'une médiation judiciaire ou également d'une médiation volontaire.
Le deuxième motif d'insatisfaction, c'est que nous aurions préféré que, dans le cadre du protocole de médiation, puissent être mentionnés certains éléments, notamment le juge compétent et la durée maximale de la médiation.
Cependant, je ne vais pas m'étendre sur ces points qu'il ne convient pas de trop souligner pour ne pas cacher l'avancée législative qui est aujourd'hui sur la table et qui va permettre de créer ce cadre pour la médiation. C'est dans le coeur même du Code judiciaire qu'est insérée cette mention, ce qui est tout à fait positif. Dans n'importe quelle médiation "civile", j'insiste sur ce dernier mot, les médiations vont pouvoir démarrer. Le cadre juridique est prêt.
Aussi, j'ai envie de lancer un appel à l'ensemble des justiciables, des acteurs de la justice: "Utilisez cette procédure, recourez à la médiation!". C'est plus rapide, moins coûteux et cela permet aux parties de se mettre autour d'une table, de se parler, de dialoguer et de dégager un accord qui peut être un véritable motif de satisfaction pour chacun. Pour toutes ces raisons, il faut promouvoir la médiation, faire en sorte que ce cadre législatif ne reste pas vide. C'est un moteur qui doit, non pas remplacer la justice, mais l'aider dans son activité.

Mr. Speaker, Mr. Minister, I will not repeat all of the things that have already been said, but I will limit myself to raise one or the other point.
First of all, I would like to highlight the positive way in which our work in the committee has been conducted. It is pleasant, for a young parliamentary, to be able to work this way as part of the analysis of a bill. All discussions were fruitful and interesting, each having been able to exchange views in mutual respect of opinions.
Then, I would also like to emphasize that we remained within the framework of a bill that contains as the main element the will of the parties. It is truly the will of the parties, the will they will demonstrate to find an agreement that will be the engine of this mediation. At any time, the parties may decide to enter mediation, before or during a judicial proceedings. At any time, the same parties can say “stop” if they feel that mediation is not the best way to ⁇ a result. Mutual respect and the will of the parties are the basic elements for advancing in this mediation.
However, I must highlight, in this bill, two small reasons for dissatisfaction. The first concerns the training and the criteria that certain mediators must meet. This issue has been the subject of a number of discussions in the committee. We believe that it would have been more appropriate to guarantee a number of selection criteria for mediator, even in voluntary mediation. Indeed, we believe that the profession of mediator is not improvised; that is why, there would have been a minimum guarantee of skills and experience, a minimum guarantee regarding compliance with the code of good conduct for mediators, whether in the context of an approved mediation, judicial mediation or also voluntary mediation.
The second reason for dissatisfaction is that we would have preferred that, within the framework of the mediation protocol, certain elements could be mentioned, in particular the competent judge and the maximum duration of the mediation.
However, I will not extend on those points that should not be too highlighted in order not to hide the legislative advance that is now on the table and which will allow to create this framework for mediation. It is in the very heart of the Judicial Code that this mention is inserted, which is quite positive. In any “civil” mediation, I insist on this last word, mediations will be able to start. The legal framework is ready.
Also, I want to make an appeal to all the justiciable, the actors of justice: "Use this procedure, resort to mediation!". This is faster, less expensive, and it allows the parties to sit around a table, talk, dialogue and reach an agreement that can be a real reason for satisfaction for everyone. For all these reasons, it is necessary to promote mediation, to ensure that this legislative framework is not left empty. It is a motor that must not replace justice, but help it in its activity.

Mijnheer de voorzitter, mevrouw de minister, collega's, vandaag ligt een belangrijk wetsvoorstel voor met betrekking tot het burgerlijk procesrecht.
Dat wetsvoorstel is belangrijk omdat bemiddeling zou moeten bijdragen tot de komst van een nieuwe cultuur bij Justitie. Bemiddeling legt een stuk verantwoordelijkheid bij de rechtzoekende. Hoewel men in België nu nog voor het kleinste probleem naar de rechter stapt om diens oordeel te horen en daarna nog tweemaal in beroep te gaan, is er toch stilaan een evolutie merkbaar, in andere delen van de wereld evenwel sneller dan in ons land. Die evolutie naar een nieuwe cultuur houdt in dat de rechtzoekende zelf het heft in handen neemt en zelf mee zoekt naar een oplossing voor zijn probleem. Dat is ook voor de rechtzoekende een betere oplossing, omdat de beslechting van het geschil samen wordt gezocht en voor die rechtzoekende gemakkelijker aanvaardbaar is, wat tot gevolg heeft dat ze beter uitvoerbaar wordt en dat de partijen minder gefrustreerd zijn. Dat wetsvoorstel kan hopelijk als een katalysator fungeren om die evolutie in België te versnellen.
Een tweede reden waarom dit een belangrijk wetsvoorstel is, is dat het een belangrijk hulpmiddel kan zijn in de strijd tegen de gerechtelijke achterstand. Tijdens de vorige legislatuur is het met betrekking tot die achterstand helaas niet mogelijk gebleken om tot een grondige hervorming van het Gerechtelijk Wetboek over te gaan, hoewel er een ontwerp klaar lag. Dat voorstel heeft de VLD opnieuw ingediend. Men heeft er nu echter voor gekozen om stapje voor stapje verder te gaan. Een eerste stapje is de bemiddeling gebleken. Het is te hopen dat de bemiddeling ertoe kan bijdragen om de instroom naar de rechtbanken te verminderen.
Een wettelijke regeling was nodig. Hoewel de reglementering voor vrijwillige bemiddeling zo beperkt mogelijk moet zijn — ik verwijs dan naar de woorden van professor Vanhoutte: "Bemiddeling is de oudste vorm van recht spreken. Deze voorouderlijke vorm van geschillenbeslechting mag dus niet aan een overdadige reglementering worden onderworpen" —, is het ook noodzakelijk dat er duidelijkheid is. Het kan immers niet dat bepaalde magistraten zich ongemakkelijk zouden voelen bij de bemiddeling, waardoor een positieve evolutie en meer gebruik van de bemiddeling zou worden tegengehouden.
Het wetsvoorstel is "beperkt", zowel naar vorm als naar inhoud, hoewel het voor een volledig scala aan problemen kan worden gebruikt, niet alleen voor de bemiddeling in familiezaken, zoals in 2001. Er zijn natuurlijk waarborgen voor de onpartijdigheid en de geheimhoudingsplicht, maar de formaliteiten zijn minimaal. Een aangetekende brief en een bemiddelingsprotocol volstaan om tot de eigenlijke bemiddeling over te gaan. Het uiteindelijk akkoord kan snel gehomologeerd worden via een procedure op eenzijdig verzoekschrift. Bovendien blijft het mogelijk voor de partijen om zelf eender wie te kiezen als bemiddelaar, zolang die zelf maar bekwaam is om een overeenkomst aan te gaan, niet minderjarig is en niet aan een gerechtelijk raadsman is toegevoegd.
Er kan alleen maar aanspraak worden gemaakt op rechtsbijstand indien men een erkend bemiddelaar aanduidt. De partijen hebben dus op alle vlakken zelf een grotere verantwoordelijkheid bij de vrijwillige bemiddeling. Dat is essentieel. De regeling voor vrijwillige bemiddeling moet alleen maar een kader scheppen. Belangrijk is echter dat een snelle uitvoerbaarverklaring mogelijk wordt. Het veld heeft daarop steeds gewezen in de bespreking. Dit ligt met dit wetsvoorstel dus ook voor.
Bovendien is het juist de sterkte van de vrijwillige bemiddeling om, los van verstikkende regels, in gezamenlijk overleg het geschil op te lossen en uitvoerbaar te krijgen. Ook de procedure met betrekking tot de gerechtelijke bemiddeling is relatief eenvoudig en voldoende soepel, al moeten de bemiddelaars hier wel erkend zijn.
Dit wetsvoorstel heeft volgens de VLD veel potentieel. Ook de wet van 19 februari 2001 betreffende de procedure gebonden bemiddeling in familiezaken was veelbelovend, maar jammer genoeg weten we allemaal wat er daarmee gebeurd is. Omwille van het uitblijven van de uitvoeringsbesluiten is er niets gebeurd.
In haar algemene beleidsnota wenste de minister van Justitie dat het koninklijk besluit betreffende de bemiddeling in familiezaken zo snel mogelijk in werking kon treden. Wij hopen dan ook dat, nu het Parlement een globale regeling heeft goedgekeurd, de minister haar wens in vervulling zal doen gaan en dat dit wetsvoorstel eens het wet geworden is, niet jaren moet wachten voor het in werking kan treden op het terrein.
Er moet immers nog een federale bemiddelingscommissie worden samengesteld waarin vertegenwoordigers van de bemiddelaars zullen zetelen, die het beroep van advocaat noch dat van notaris uitoefenen. Hierbij is het aangewezen dat niet een of twee bepaalde verenigingen als de vertegenwoordiging van de bemiddelaars worden beschouwd en in de commissie zullen zetelen. Het zal geen gemakkelijke taak zijn om in een juiste vertegenwoordiging van bemiddelaars te voorzien. Wij zullen er echter op toezien dat dit tot een goed einde wordt gebracht, maar vooral dat het niet weer eindeloos duurt alvorens deze regeling van kracht is. In afwachting hiervan steunt de VLD dit voorstel ten volle.

Mr. Speaker, Mrs. Minister, colleagues, today we have an important bill on civil procedure law.
This bill is important because mediation should contribute to the arrival of a new culture in Justice. Mediation imposes a part of responsibility on the applicant. Although one in Belgium now goes to the court for the slightest problem to hear its judgment and then appeal twice, there is still gradually a noticeable evolution, in other parts of the world however faster than in our country. That evolution to a new culture implies that the right-seeker himself takes the heft in his hands and himself seeks a solution to his problem. This is also a better solution for the applicant, as the settlement of the dispute is sought together and is more acceptable for that applicant, resulting in better enforceability and less frustration for the parties. That bill may hopefully serve as a catalyst to accelerate that evolution in Belgium.
A second reason why this is an important bill is that it can be an important tool in the fight against judicial lag. During the previous legislature, unfortunately, it was not possible to proceed to a thorough reform of the Judicial Code in relation to this downturn, although a draft was ready. This proposal was submitted again by the VLD. However, it has now been decided to go step by step further. The first step was mediation. It is hoped that mediation can help reduce the influx to the courts.
A legal arrangement was needed. Although the regulation for voluntary mediation should be as limited as possible — I refer to the words of Professor Vanhoutte: “Mediation is the oldest form of right speaking. This ancestral form of dispute settlement must therefore not be subject to excessive regulation” — it is also necessary that there be clarity. Indeed, it is not possible that certain magistrates would feel uncomfortable with mediation, which would hinder a positive evolution and increased use of mediation.
The bill is "limited", both in form and content, although it can be used for a full range of issues, not just for family mediation, as in 2001. There are, of course, guarantees for impartiality and confidentiality, but the formalities are minimal. A registered letter and a protocol of mediation are sufficient to proceed to the actual mediation. The final agreement can be quickly homologated through a unilateral petition procedure. Furthermore, it remains possible for the parties to choose any person as mediator, as long as he is only competent to conclude an agreement, is not a minor and has not been added to a judicial counsel.
Legal aid can only be claimed if a recognised mediator is appointed. The parties have a greater responsibility for voluntary mediation in all areas. That is essential. The voluntary mediation scheme should only provide a framework. However, it is important that a quick declaration of enforceability is possible. The field has always pointed to this in the discussion. This is also the case with this bill.
Furthermore, it is precisely the strength of voluntary mediation to resolve the dispute in joint consultation and make it enforceable, apart from suffocating rules. The procedure for judicial mediation is also relatively simple and sufficiently flexible, although mediators must be recognised here.
This legislative proposal has, according to the VLD, a lot of potential. The law of 19 February 2001 on procedural mediation in family matters was also promising, but unfortunately we all know what happened with it. Because of the absence of the implementing decisions, nothing happened.
In its general policy note, the Minister of Justice wished that the Royal Decree concerning family mediation could come into force as soon as possible. We therefore hope that, once the Parliament has approved a global arrangement, the Minister will fulfill his wish and that this bill, once it has become the law, does not have to wait years before it can enter into force on the ground.
In fact, a federal mediation committee will still need to be established, consisting of representatives of the mediators, who exercise neither the profession of lawyer nor that of notary. It is noted that not one or two specific associations are considered to represent the mediators and will sit in the committee. It will not be an easy task to provide for an adequate representation of mediators. However, we will ensure that this is completed, but above all that it does not last indefinitely before this arrangement comes into force. Until then, the VLD fully supports this proposal.

Monsieur le président, madame la vice- première ministre, chers collègues, il est inutile de souligner l'importance de la proposition que nous examinons aujourd'hui en séance plénière. Cela fait de nombreuses années que l'on insiste, de tous les côtés, sur la nécessité de faciliter l'accès à la justice en donnant une base légale à un mode alternatif de résolution des conflits.
Avant toute chose, je voudrais me réjouir de l'excellente collaboration entre le parlement et l'exécutif. La ministre de la Justice a apporté toute sa détermination pour que le texte, originellement d'initiative parlementaire, aboutisse dans les meilleurs délais. La commission a également pu bénéficier de l'expérience de terrain accumulée par les spécialistes.
Le fruit de ces collaborations me semble être un texte très satisfaisant. En cette matière, il était essentiel de ne pas légiférer de manière trop précise, et partant, trop restrictive, mais bien de fixer un cadre général propice au développement de la médiation. Dès lors, une certaine souplesse était indispensable. La volonté d'édicter des règles minimales a été le fil rouge de toute cette réforme.
Néanmoins, dans un souci d'efficacité, certaines règles essentielles doivent être imposées par la loi: 1. Déjà à l'heure actuelle, la médiation est évidemment possible sans aucun cadre légal. 2. Certaines lois permettent aux magistrats de recourir à la médiation dans certains domaines bien précis. C'est le cas notamment de la médiation familiale. Mais très vite après le vote de la loi sur cette médiation familiale, il a été question de généraliser la médiation à l'ensemble des matières dans lesquelles les parties peuvent transiger. C'est ce que nous faisons aujourd'hui en insérant une nouvelle partie 7 du Code judiciaire qui constitue le droit commun de la médiation, qu'elle ait lieu avant ou pendant une procédure judiciaire.
La médiation doit être considérée comme un mode supplémentaire de dialogue. Elle n'est pas un moyen - j'y insiste - de privatiser la justice ni même peut-être de lutter contre l'arriéré judiciaire, mais elle est un nouvel espace de dialogue. Elle doit nécessairement s'exercer dans un esprit d'ouverture et permettra de résoudre les litiges de manière tout aussi satisfaisante que nos juridictions.
La recherche d'une solution acceptée par les deux parties réduira assurément le traumatisme inhérent à chaque procédure contentieuse. La justice doit toujours départager des prétendants antagonistes et ne peut donner raison aux uns sans donner tort aux autres, donc sans infliger légitimement de la douleur. Dès lors, ceux qui la subissent critiqueront toujours la justice, parce qu'il est plus facile de maudire son juge que d'admettre que l'on a tort. Cette critique est d'autant plus vive qu'on ne fait généralement connaissance avec la justice que dans des circonstances douloureuses qui nous poussent à nous y rendre pour faire respecter nos droits.
La médiation, processus consensuel par excellence, n'encourt pas pareille critique. En outre, la recherche d'une solution négociée offrira davantage de garanties pour l'avenir. Ainsi, les parties chercheront ensemble, de manière constructive, une solution qui apportera à chacune satisfaction ou limite à tout le moins leur frustration.
Le caractère négocié de l'accord accroîtra nécessairement son exécution spontanée puisqu'il est communément admis que l'on respecte plus facilement une solution que l'on a négociée plutôt que ce qui nous est imposé. Si l'on peut penser que, d'une manière générale, les protagonistes respecteront l'accord intervenu, il apparaît néanmoins nécessaire de prévoir une procédure d'exécution. C'est la raison pour laquelle nous avons prévu une transformation simple et souple de l'accord à titre exécutoire.
Nous devons également veiller à ce que la médiation ne puisse être utilisée de manière dilatoire et à ce que la possibilité d'entamer ou de reprendre une procédure judiciaire soit maintenue. En d'autres termes, la médiation doit répondre aux souhaits des parties.
Je voudrais également m'arrêter quelques instants sur le rôle que devra jouer le médiateur. Certes, certains préfèreront toujours que ce soit le juge qui tranche le conflit. Dès lors, le rôle de la justice étatique reste essentiel. Le rôle du médiateur est différent de celui du juge. Il sera d'aider les parties à élaborer elles-mêmes, en toute connaissance de cause, une entente équitable qui respecte les besoins de chacun des protagonistes. A cet égard, on n'insistera jamais assez sur l'importance de la formation continue et de la valorisation de l'expérience nécessaire pour jouer efficacement le rôle de médiateur. A ce titre, la formation continue est un gage fondamental de qualité des médiateurs. Nous espérons par ailleurs que la Commission fédérale de médiation, chargée de la formation et de l'agréation, soit rapidement mise sur pied.
Avant de conclure, monsieur le président, je souhaite faire deux observations.
1. La modification du Code judiciaire que nous allons opérer constitue une première étape importante. Mais nous savons tous que les textes légaux ne suffisent pas et qu'il est nécessaire que cette réforme s'accompagne d'un changement de mentalité auprès de tous les acteurs concernés. Comme je le soulignais déjà devant cette Chambre, lors du débat sur la médiation familiale, nous devons convaincre l'ensemble des acteurs du monde judiciaire de faire preuve de plus d'audace. Il faut que la médiation ne soit plus considérée comme une curiosité procédurale mais comme une solution possible aux problèmes rencontrés par les justiciables. Ce changement de mentalité devra indubitablement s'accompagner d'une campagne d'information touchant plus spécialement les groupes sociaux les plus vulnérables quant à l'existence même de la médiation. En effet, c'est un lieu commun de constater que la pauvreté et la marginalisation trouvent en grande partie leur source dans le défaut d'information, notamment quant aux droits que l'on peut faire valoir. Je voudrais donc, madame la ministre, me faire insistant à cet égard.
2. Si la réforme que nous allons voter tout à l'heure constitue, à n'en pas douter, une avancée non-négligeable en matière de l'accès à la justice qu'est en droit d'attendre tout citoyen, nous devons être conscients qu'un certain nombre d'améliorations doivent encore trouver une concrétisation rapide. Mr. Speaker, Mrs. Deputy Prime Minister, dear colleagues, it is unnecessary to emphasize the importance of the proposal that we are discussing today in the plenary session. For many years, it has been insisted on all sides on the need to facilitate access to justice by providing a legal basis for an alternative way of resolving conflicts.
First of all, I would like to welcome the excellent collaboration between Parliament and the Executive. The Minister of Justice has made every effort to ensure that the text, originally of parliamentary initiative, comes into effect as soon as possible. The committee was also able to benefit from the field experience accumulated by the specialists.
The fruit of this collaboration seems to me to be a very satisfying text. In this regard, it was essential not to legislate too precisely, and therefore too restrictive, but rather to establish a general framework conducive to the development of mediation. Therefore, some flexibility was essential. The desire to enact minimum rules was the red thread of all this reform.
Nevertheless, in order to be effective, certain essential rules must be imposed by law: 1. Mediation is already possible without any legal framework. 2 of 2. Some laws allow magistrates to use mediation in specific areas. This is ⁇ the case with family mediation. But very soon after the vote of the law on this family mediation, it was a matter of generalizing mediation to all matters in which the parties can transact. This is what we are doing today by inserting a new Part 7 of the Judicial Code that constitutes the common law of mediation, whether it takes place before or during a judicial procedure.
Mediation should be seen as an additional form of dialogue. It is not, I insist, a way to privatize justice, or ⁇ even to fight against judicial backwardness, but it is a new space for dialogue. It must necessarily be exercised in a spirit of openness and will enable disputes to be resolved as satisfactorily as our jurisdictions.
Searching for a solution that is accepted by both parties will ⁇ reduce the trauma inherent in each litigation procedure. Justice must always separate pretending antagonists, and it cannot give righteousness to some without giving wrong to others, and therefore without legitimately inflicting pain. Therefore, those who suffer it will always criticize justice, because it is easier to curse its judge than to admit that one is wrong. This criticism is all the more vivid, since we generally make acquaintance with justice only in painful circumstances that drive us to go there to make respect for our rights.
Mediation, a consensual process by excellence, does not encounter such criticism. In addition, the search for a negotiated solution will offer more guarantees for the future. Thus, the parties will seek together, constructively, a solution that will bring to each satisfaction or limit at least their frustration.
The negotiated character of the agreement will necessarily increase its spontaneous execution since it is commonly accepted that one respects more easily a solution that has been negotiated rather than what is imposed on us. Although it can be thought that, in a general way, the protagonists will respect the agreement reached, it appears nevertheless necessary to provide for an enforcement procedure. That is why we have planned for a simple and flexible transformation of the agreement to be executable.
We must also ensure that mediation cannot be used in a delaying manner and that the possibility of initiating or resuming judicial proceedings is ⁇ ined. In other words, mediation must meet the wishes of the parties.
I would also like to stop for a moment on the role that the mediator should play. Certainly, some will always prefer that it be the judge who resolves the conflict. Therefore, the role of the state justice remains essential. The role of the mediator is different from that of the judge. It will be to help the parties to elaborate themselves, in full knowledge of the cause, a fair agreement that respects the needs of each of the protagonists. In this regard, there will never be enough emphasis on the importance of continuous training and the appreciation of the experience necessary to effectively play the role of mediator. As such, continuous training is a fundamental guarantee of mediators’ quality. We also hope that the Federal Mediation Commission, which is responsible for training and approval, will soon be established.
Before concluding, Mr. Speaker, I would like to make two observations.
1 of 1. The amendment of the Code of Criminal Procedure is an important first step. But we all know that legal texts are not enough and that it is necessary that this reform be accompanied by a change of mindset among all relevant actors. As I already pointed out before this Chamber, in the debate on family mediation, we must convince all the actors in the judicial world to demonstrate more boldness. Mediation must no longer be seen as a procedural curiosity but as a possible solution to the problems encountered by the prosecutors. This change of mindset will undoubtedly have to be accompanied by an information campaign that specifically affects the most vulnerable social groups regarding the very existence of mediation. In fact, it is a common place to see that poverty and marginalization are largely caused by the lack of information, in particular regarding the rights that can be claimed. I would like to emphasize in this regard.
2 of 2. If the reform that we are about to vote on is, without a doubt, a non-negligible advance in the access to justice that every citizen is entitled to expect, we must be aware that a number of improvements still need to be realized quickly. I know I can trust you in this regard. This includes simplifying the judicial language.
It is therefore in the hope that this reform, as well as so many others that are found in your general policy note, will soon be effective, that the PS group will vote unfailingly in favour of this text.

Monsieur le président, madame la ministre, mes chers collègues, je m'en voudrais de répéter tout ce que les précédents collègues vous ont déjà expliqué, en long et en large, sur la médiation, ses bienfaits et les espoirs qui fondent notre proposition de loi telle qu'arrêtée aujourd'hui par le parlement.
Je voudrais simplement, de façon spontanée, attirer votre attention sur quelques points. Tout d'abord, il s'agit au départ d'une initiative parlementaire, reprise en commission de la Justice et soutenue par la ministre comme étant un élément essentiel dans l'accès à la justice, cela vient d'être dit par M. Giet. En effet, la médiation constitue à nos yeux une alternative intéressante à d'autres modes de résolution de conflits que sont la procédure au sens traditionnel, la conciliation par un juge et l'arbitrage tel que pratiqué dans les matières commerciales.
J'ajouterai que la médiation familiale est un embryon de ce que nous voudrions élargir à toutes les matières. C'est précisément ce que cette proposition de loi qui vous est soumise vous propose de faire.
Dans les éléments essentiels, je vois, de mon point de vue - et cela a déjà été dit par les uns et les autres, mais j'ai envie de le rappeler quand même -, que c'est suffisamment extraordinaire comme mode de résolution d'un conflit d'essayer d'institutionnaliser une façon de faire radicalement différente de celles utilisées habituellement. D'ordinaire, c'est l'affrontement, même en conciliation, entre deux thèses opposées.
Ici, ce qui est proposé, c'est une façon de "trianguler", c'est-à-dire de mettre un tiers extérieur aux parties en "triangulation" avec elles de façon qu'au lieu de s'affronter, elles essaient de trouver ensemble une solution et de se l'approprier. Comme elles l'auront trouvée conjointement, il n'y aura ni gagnant ni perdant. En tout cas, cette optique du gain ou de la perte du procès sera beaucoup moins vive, la solution sera sans doute mieux acceptée et mieux appliquée dans l'avenir.
Cela diminuera, bien entendu, le cours du débat qui amène à la solution dans le temps. Cela en diminuera aussi le coût puisque si cela va plus vite, on peut espérer que cela coûtera moins cher. Au niveau de l'exécution également, si la solution est appropriée ou appartient à chacune des parties qui a participé activement à son avènement, il y aura automatiquement, on peut l'espérer, des frais d'exécution moindres ou inexistants.
L'accès à la justice, dans ce qu'il peut avoir de rebutant pour un justiciable, le fait que des institutions prennent à sa place des décisions qui sont imposées, le fait que cela coûte cher, que cela prenne du temps; tous ces aspects seront gommés, espérons-nous, à travers une alternative comme celle de la médiation.
Le deuxième élément sur lequel je voulais insister est la confidentialité. C'est radicalement différent de ce qui se passe dans les procédures judiciaires traditionnelles. Ici, il s'agit d'une parenthèse dans la résolution d'un conflit et tous les documents, les dires seront considérés comme confidentiels mais pouvant, de l'accord des parties, être produits ultérieurement dans une procédure ou dans une autre situation.
On disait toujours, et je l'ai appris en classe comme tous les juristes qui sont présents dans cet hémicycle, que le procès civil était l'affaire des parties par rapport au procès pénal, qui est conduit par l'office du procureur du Roi. Je pense qu'à travers ce système mis en place par la proposition de loi, ce sera d'autant plus et d'autant mieux l'affaire des parties. Et elles pourront, grâce à cette possibilité qui leur est donnée, s'approprier complètement leur problème et y trouver la solution qu'elles estiment adéquate.
Ma troisième et dernière remarque concerne la communication relative à ce nouveau processus de résolution de conflits. On sait qu'aux Pays-Bas, en Grande-Bretagne ou au Canada, ce sont des méthodes qui sont utilisées de façon beaucoup plus large qu'en Belgique. Culturellement, ces populations sont beaucoup plus aptes ou, en tout cas, ont rencontré plus tôt cette façon de procéder. On peut constater que sur le vieux continent, à tout le moins pour ce qui concerne la France et la Belgique, nous sommes toujours dans une façon de réfléchir qui est fondée sur l'affrontement de deux thèses opposées. Il y aura lieu, pour qu'il y ait une utilisation très large de ce mode de résolution de conflits tant avant, pendant qu'après le procès, qu'on puisse communiquer un maximum à tous les niveaux, que ce soit ici à la Chambre, dans les tribunaux, les maisons de justice, auprès des ordres professionnels, etc., afin que ce procédé soit bien connu et que la médiation familiale qui en constitue l'embryon et le point de départ ne soit pas vue comme la seule possibilité de médiation dans notre système judiciaire mais qu'au contraire, tant les justiciables que les magistrats, n'aient aucune crainte d'y recourir de façon habituelle.
Monsieur le président, madame la ministre, chers collègues, après ces remarques que j'ai essayé de condenser au maximum pour éviter les répétitions nocives à la diligence de nos travaux, j'ajouterai que le groupe MR ne peut que souscrire entièrement à cette proposition de loi. En effet, en 1999 déjà; le MR avait déposé une proposition de loi visant à introduire dans notre système judiciaire une médiation plus large que la médiation familiale, qui est arrivée ensuite en 2001. Le vote d'aujourd'hui permet en quelque sorte de clôturer un dossier ouvert depuis cinq ans. Il permettra — je l'espère — d'entrer dans une nouvelle ère de résolution des conflits pour l'ensemble des citoyens. Je peux conclure en affirmant que mieux vaut une bonne médiation qu'un long procès. Je citerai la parole d'un auteur de théâtre, philosophe qui disait ceci: "il importe avant tout d'apprendre à se mettre d'accord". C'est la procédure qui permettra le mieux à l'ensemble de nos concitoyens d'apprendre à se mettre d'accord.

Mr. Speaker, Mrs. Minister, dear colleagues, I would like to repeat all that the previous colleagues have already explained to you, in length and wide, about mediation, its benefits and the hopes that underpin our bill as adopted today by Parliament.
I would just like to spontaneously draw your attention to a few points. First of all, it is the beginning of a parliamentary initiative, taken back in the Justice Committee and supported by the Minister as an essential element in access to justice, this has just been said by Mr. by Giet. Mediation is an interesting alternative to other forms of dispute resolution such as the procedure in the traditional sense, the conciliation by a judge and the arbitration as practiced in commercial matters.
I will add that family mediation is an embryo of what we would like to extend to all subjects. This is precisely what this proposed bill proposes you to do.
In the essential elements, I see, from my point of view - and this has already been said by some, but I want to recall it anyway - that it is sufficiently extraordinary as a way of resolving a conflict to try to institutionalize a way of doing radically different from those used normally. Usually, it is the confrontation, even in conciliation, between two opposing theories.
Here, what is proposed is a way of "triangulating", that is, putting a third outside the parties in "triangulation" with them so that instead of confronting each other, they try to find together a solution and appropriate it. As they find it together, there will be neither winner nor loser. In any case, this perspective of the gain or loss of the trial will be much less vivid, the solution will probably be better accepted and better applied in the future.
This will, of course, decrease the course of the debate that leads to the solution in time. This will also reduce the cost because if it goes faster, one can hope that it will cost less. Also at the level of execution, if the solution is appropriate or belongs to each of the parties that have actively participated in its occurrence, there will automatically, one can hope, lower or nonexistent execution costs.
Access to justice, in what it may have to reject for a justiciable, the fact that institutions take in its place the decisions that are imposed, the fact that it is expensive, that it takes time; all these aspects will be tackled, hopefully, through an alternative such as that of mediation.
The second element I wanted to emphasize is confidentiality. This is radically different from what happens in traditional judicial proceedings. Here, it is a parenthesis in the resolution of a conflict and all documents, the statements will be considered confidential but may, with the agreement of the parties, be produced later in one procedure or in another situation.
It was always said, and I learned in the classroom as all the lawyers who are present in this homicide, that the civil trial is the affair of the parties in relation to the criminal trial, which is conducted by the office of the King’s Prosecutor. I think that through this system established by the bill, it will be the more and the better the affair of the parties. And they will be able, thanks to this possibility that is given to them, to fully appropriate their problem and find the solution that they consider appropriate.
My third and last comment concerns the communication on this new process of conflict resolution. It is known that in the Netherlands, Great Britain or Canada, these are methods that are used much more widely than in Belgium. Culturally, these populations are much more fit or, in any case, have encountered this way of proceeding earlier. It can be seen that on the old continent, at least as far as France and Belgium are concerned, we are still in a way of thinking that is based on the confrontation of two opposing theses. It will be necessary, so that there is a very broad use of this mode of conflict resolution so long before, while after the trial, that one can communicate as much as possible at all levels, whether here in the Chamber, in the courts, in the houses of justice, in the professional orders, etc., so that this procedure is well known and that the family mediation which constitutes its embryo and the starting point is not seen as the only possibility of mediation in our judicial system but that, on the contrary, both the judicial and the magistrates, have no fear of resorting to it in the usual way.
Mr. Speaker, Mrs. Minister, dear colleagues, after these remarks, which I have tried to condens as much as possible to avoid repetitions harmful to the diligence of our work, I will add that the MR group can only fully subscribe to this bill. Indeed, in 1999 already; the MR had filed a bill aiming to introduce in our judicial system a broader mediation than family mediation, which came later in 2001. Today’s vote enables somehow to close a case that has been open for five years. It will allow – I hope – to enter a new era of conflict resolution for all citizens. I can conclude by stating that a good mediation is better than a long trial. I will quote the words of a theatre writer, a philosopher who said this: "It is important first of all to learn to agree." This is the procedure that will best enable all our fellow citizens to learn to agree.

Monsieur le président, madame la ministre, chers collègues, je serai bref car beaucoup de choses ont déjà été dites aujourd'hui, toutes plus intéressantes les unes que les autres, et je ne crois pas nécessaire de tout redire. Je voudrais apporter quelques précisions peut-être ou en tout cas la participation d'un élu de la majorité à ce sujet important.
D'abord, madame la ministre, je l'ai déjà fait ce matin en conférence de presse mais je tiens à vous remercier dans cet hémicycle de votre collaboration et d'avoir respecté le rôle et le travail des parlementaires et de ceux et celles qui les avaient précédemment aidés à travailler et à déposer un texte que j'oserais qualifier de crédible au départ.
On l'a dit, cette proposition émane d'abord du Parlement et elle a donné lieu à l'organisation d'un colloque auquel ont pu participer beaucoup de nos collègues et au cours duquel, madame la ministre, vous avez soutenu les parlementaires qui l'ont organisé et géré. M. le président de la Chambre doit être remercié lui aussi car ce colloque avait pu être organisé grâce au soutien matériel, technique et financier de la Chambre des représentants.
Dans nos discours, nous avons tous dit, surtout il y a quelques années, qu'il fallait impérativement réformer la Justice. Finalement, chacun avait sa ou ses solutions et disons-le, cela pouvait aller parfois dans tous les sens. On a souvent parlé des moyens à conférer à la Justice pour se réformer, en se braquant souvent sur les seuls moyens financiers. Comme vous l'avez dit vous-même à de très nombreuses reprises, on ne peut pas changer ce paquebot énorme qu'est la Justice sans moyens financiers. Le gouvernement a d'ailleurs fait ce qu'il fallait ces dernières années et ces derniers mois pour refinancer la Justice. Cependant, réformer la Justice, ce n'est pas seulement une question de "fric", de moyens financiers; c'est aussi parfois dans la méthode de gestion et par des procédures nouvelles qu'on peut innover et contribuer à la réforme de la Justice et à la résorption de l'arriéré judiciaire.
Comme je l'ai dit ce matin, je ne suis pas un spécialiste de ces matières, je ne suis d'ailleurs pas membre de la commission de la Justice mais si j'ai voulu modestement contribuer à cette proposition de loi, c'est tout simplement parce que j'ai trop souvent vu, en ma qualité d'entrepreneur, des dossiers s'enliser dans les dédales judiciaires. Cet enlisement générait à son tour des conséquences désastreuses pour toutes les parties à la cause. Il arrivait et il arrive encore trop souvent aujourd'hui que même la personne qui gagne une procédure ne soit pas satisfaite du résultat parce que le délai nécessaire pour obtenir gain de cause a généré lui-même des coûts qui annihilent parfois le gain possible du procès. C'est de cette justice là dont les citoyens ne veulent plus, cette justice qui n'apparaît pas, dans les faits, efficace.
Hormis les lenteurs et les coûts liés à la Justice, on a aussi parlé de l'accès à la Justice, notamment pour les plus démunis. Je suis de ceux qui sont convaincus que la médiation permettra de diminuer les coûts en contribuant à assurer un meilleur accès à la Justice. La médiation évitera aussi le recours trop fréquent au juge, l'idée étant dans le chef du citoyen qu'il faut toujours que quelqu'un vienne résoudre le problème à sa place sans qu'il puisse contribuer lui-même à la solution. Je suis convaincu que, pour résoudre les difficultés que je viens de citer, la médiation peut être un outil intéressant, comme il existe d'ailleurs dans d'autres pays; ma collègue Marie-Christine Marghem a fait référence au Canada. C'est un des modèles que j'ai le plus surveillé car il me semble avantageux; de plus, il colle assez bien à ce qui est proposé par la commission de la Justice aujourd'hui. A cet égard, j'ajoute que c'est une première en Europe qu'un parlement vote un tel texte.
Disons aussi que, depuis des années déjà, certains avocats pratiquaient, en Belgique, la médiation, mais sans filet. Aujourd'hui, comme l'a dit M. Wathelet très justement, c'est aussi l'officialisation d'une méthode de résolution des conflits, officialisation qui sera intégrée dans un cadre juridique qui sécurisera la démarche des uns et des autres.
En ce qui concerne les avantages de la médiation, il faut relever qu'il y aura moyen d'aller beaucoup plus vite et que ce sera moins coûteux. De plus, il y a également l'élément relatif à la responsabilisation du citoyen, élément sur lequel je tiens à insister. Le citoyen n'est plus la personne qui subit la résolution d'un conflit par des tiers (magistrats, spécialistes du droit); il en devient lui-même acteur. En termes de mode culturel pour appréhender ce que peut être la Justice dans un pays démocratique comme le nôtre, c'est un changement considérable.
Madame la ministre, vous nous avez informés ce matin de votre volonté de mettre en oeuvre la communication aux citoyens de ce nouveau mode de résolution des conflits. A ce propos, je voudrais attirer votre attention sur la nécessité d'informer le citoyen et de le convaincre que le premier avantage de la médiation, c'est le fait qu'il devient lui-même acteur de la résolution d'un conflit et qu'il ne doit plus subir "l'outil" judiciaire, parfois avec toutes les difficultés que cela peut générer. J'oserai dire que le résultat auquel la commission est arrivée me semble excellent. En effet, et c'était l'élément de charpente le plus important et consacré dans la proposition de loi, on parle aussi bien de la médiation volontaire que de celle qu'on qualifie de judiciaire. Et cette médiation volontaire peut être homologuée par un juge, ce qui lui confère évidemment une force, une crédibilité nettement plus importante que ce qui existe actuellement dans les médiations opérées de manière volontaire, "sans filet", comme je l'ai déjà dit.
La proposition est aussi excellente par le fait que le rôle et les qualités du médiateur sont excellemment bien précisés et autorisent en même temps une certaine souplesse. Comme entendu ce matin, ni titre ni diplôme: c'est la question de la qualité d'hommes et de femmes susceptibles de devenir médiateurs qui est consacrée. C'est en effet un art d'organiser une médiation et de parvenir à un résultat.
Merci donc, madame la ministre, pour ce travail. Je voudrais également remercier tous mes collègues de la commission de la Justice qui ont géré cet important chantier. Le travail a été important, mais le résultat excellent.
Je voudrais remercier également M. le doyen de la faculté de droit de l'Université de Liège qui a beaucoup contribué l'écriture de la proposition de loi initiale. Je remercie en outre les associations d'avocats médiateurs qui ont aussi énormément contribué à l'écriture de cette première proposition de loi.
Je souhaite donc vous remercier tous et toutes et je suis convaincu que, sur le plan démocratique et dans cette fameuse réforme de la Justice, nous marquons aujourd'hui une étape très importante pour tous les citoyens de notre pays.

As it has been said, this proposal came first from Parliament and it gave rise to the organization of a conference at which many of our colleagues were able to participate and during which, Mrs. Minister, you supported the parliamentarians who organized and managed it. by Mr. The chairman of the House must also be thanked for having been able to organize this conference thanks to the material, technical and financial support of the House of Representatives.
In our speeches, we all said, especially a few years ago, that it was imperative to reform the Justice. Eventually, everyone had their own or their own solutions and, say it, it could sometimes go in every direction. We have often talked about ways to give justice to reform itself, often relying only on financial means. As you have said yourself many times, you cannot change this huge passenger ship that is Justice without financial means. The government has done what was necessary in recent years and in recent months to refinance justice. However, reforming the judiciary is not only a matter of “fric”, of financial means; it is also sometimes in the method of management and through new procedures that one can innovate and contribute to the reform of the judiciary and to the resorption of judicial backwardness.
As I said this morning, I am not a specialist in these matters, I am not a member of the Justice Committee, but if I wanted to modestly contribute to this bill, it is simply because I have too often seen, in my capacity as an entrepreneur, files slipping into the judicial deals. This enclosure, in turn, generated disastrous consequences for all parties to the cause. It happened and it still happens too often today that even the person who wins a procedure is not satisfied with the result because the time required to obtain cause gain has itself generated costs that sometimes annihilate the possible gain of the trial. It is from this justice that the citizens no longer want, that justice that does not appear, in the facts, effective.
In addition to the slowness and costs associated with justice, we also talked about access to justice, especially for the most disadvantaged. I am one of those who are convinced that mediation will reduce costs by helping to ensure better access to justice. Mediation will also avoid the too frequent appeal to the judge, the idea being in the head of the citizen that it is always necessary that someone come to solve the problem in his place without being able to contribute himself to the solution. I am convinced that, in order to solve the difficulties I have just mentioned, mediation can be an interesting tool, as it exists in other countries; my colleague Marie-Christine Marghem referred to Canada. It is one of the models that I have most monitored because it seems to me advantageous; moreover, it fits pretty well with what is proposed by the Justice Committee today. In this regard, I add that it is the first time in Europe that a parliament votes on such a text.
Let us also say that, for years already, some lawyers practiced, in Belgium, mediation, but without a net. Today, as Mr. Wathelet very correctly, it is also the officialization of a method of conflict resolution, officialization that will be integrated into a legal framework that will secure the approach of one and the other.
Regarding the benefits of mediation, it should be noted that there will be a way to go much faster and that it will be less expensive. In addition, there is also the element relating to the citizen’s accountability, an element on which I would like to insist. The citizen is no longer the person who is subject to the resolution of a conflict by third parties (magistrates, legal specialists); he himself becomes an actor in it. In terms of cultural fashion to understand what justice can be in a democratic country like ours, this is a considerable change.
Mr. Minister, you informed us this morning of your willingness to implement the communication to citizens of this new way of resolving conflicts. In this regard, I would like to draw your attention to the need to inform the citizen and convince him that the first advantage of mediation is the fact that he himself becomes the actor of the resolution of a conflict and that he no longer has to suffer the “tool” judicial, sometimes with all the difficulties that this can generate. I would dare to say that the result that the commission has reached seems to me excellent. Indeed, and this was the most important and consecrated element of the draft law, we speak of both voluntary mediation and that which is called judicial. And this voluntary mediation can be homologated by a judge, which obviously gives it a strength, a much greater credibility than what currently exists in mediations operated voluntarily, “without a net”, as I have already said.
The proposal is also excellent by the fact that the role and qualities of the mediator are excellently well specified and at the same time allow for some flexibility. As heard this morning, neither title nor diploma: it is the question of the quality of men and women likely to become mediators that is consecrated. It is an art to organize a mediation and to ⁇ a result.

Je voudrais simplement signaler que cette voie de résolution des conflits est à privilégier. Elle est bonne, comme l'ont dit les intervenants, pour les justiciables. C'est une procédure moins onéreuse, plus rapide et par laquelle tout le monde est gagnant. En fait, il n'y a ni gagnant ni perdant puisque la procédure est initiée sur une base volontaire. Cette procédure doit également être privilégiée parce qu'elle va peser pour la diminution de l'arriéré judiciaire dont nous avons tant besoin dans la situation actuelle de notre justice.
M. Giet m'a interpellée, tout comme M. Fournaux, sur la campagne à mener pour que cette voie puisse être adoptée par nos concitoyens. Je peux donc dire que dès après l'arrêté royal qui doit mettre sur pied la commission fédérale d'agréation des médiateurs, nous lancerons une campagne vis-à-vis des professionnels de la justice, notamment les magistrats et les avocats, ainsi qu'une campagne plus large pour avertir nos concitoyens qu'il existe dorénavant une autre méthode de résolution des conflits que le recours à la justice.
Voilà, monsieur le président, ces quelques mots pour remercier encore le parlement pour son travail extrêmement constructif. En effet, à partir de propositions de loi, avec l'aide de l'administration de la Justice, nous aboutissons à un projet bien ficelé et qui sera bien compris sur le terrain, puisque des spécialistes sont venus nous aider à constituer une loi qui était véritablement attendue depuis de nombreuses années par les justiciables.

Er wordt vandaag immers een Wetboek internationaal privaatrecht voorgesteld. Op die manier wordt komaf gemaakt met de alomverspreide, oude en onvolledige teksten inzake internationaal privaatrecht.
Tijdens de commissievergaderingen werd door menigeen beklemtoond dat voor veel rechtenstudenten internationaal privaatrecht een gekend buisvak was. Ook voor nieuwe rechtenstudenten zal dit wetboek een aanzienlijke oplossing zijn. Reeds in 1996 gaf toenmalig minister van Justitie Stefaan De Clerck een Belgische groep professoren officieel de opdracht een allesomvattend wetboek op te stellen. Er werd daaraan al die jaren zeer hard gewerkt en het resultaat mag er zijn. Men is erin geslaagd een goed leesbaar en toch relatief beknopt wetboek te maken dat wordt gekenmerkt door een grote transparantie, door de structuur en de samenhang van de uitgeschreven regels, door de moderniteit van de regeling en door de internationalistische geest ervan.
Er was inderdaad dringend nood aan de invoering van een reeks beginselen om de zaken te regelen van familierecht, verbintenissenrecht en handelsrecht die met het buitenland en met het buitenlands recht te maken hebben. Het klein aantal rechtsregels waarover we beschikken, is niet alleen sterk verspreid over allerhande wetteksten, maar veel bepalingen zijn bovendien verouderd en creëren meer problemen dan ze oplossen.
De rechters en administratieve overheden hebben nood aan een referentiekader en aan duidelijkheid inzake een aantal delicate vragen. Het Wetboek internationaal privaatrecht heeft de verdienste tal van onzekerheden weg te werken voor veel in België verblijvende vreemdelingen, voor veel Belgen die administratieve akten uit het buitenland met zich meebrengen of die te maken krijgen met een buitenlands vonnis.
De CD&V-fractie is dan ook verheugd met het resultaat en zal het wetsontwerp steunen.

Mr. Speaker, Mrs. Minister, colleagues, today is a very important day for those dealing with international private law. Today, a Code of International Private Law is being proposed. In this way, the widespread, old and incomplete texts on international private law are eliminated.
During the committee meetings, many people emphasized that for many law students international private law was a well-known tube field. For new law students, this code will also be a significant solution. In 1996, then Minister of Justice Stefaan De Clerck officially commissioned a group of Belgian professors to draw up a comprehensive code. It has been worked very hard all those years and the result may be there. It has succeeded in creating a well-readable and yet relatively concise code characterized by great transparency, by the structure and coherence of the rules issued, by the modernity of the regulation and by its internationalist spirit.
There was indeed an urgent need to introduce a set of principles to regulate the matters of family law, bond law and commercial law relating to foreign and foreign law. Not only is the small number of legal rules available to us widely spread across all sorts of legal texts, but many provisions are also outdated and create more problems than they solve.
Judges and administrative authorities need a reference framework and clarity on a number of sensitive issues. The Code of International Private Law has the merit of eliminating numerous uncertainties for many foreigners residing in Belgium, for many Belgians who carry administrative acts from abroad or who face a foreign judgment.
The CD&V group is therefore pleased with the result and will support the bill.

Monsieur le président, madame la ministre, chers collègues, le présent projet vise à instaurer dans notre ordre juridique un Code de droit international privé, qui régit, dans une situation présentant un élément d'extranéité, la compétence des juridictions belges, la détermination du droit applicable et les conditions d'efficacité en Belgique des décisions judiciaires et des actes étrangers en matières civiles et commerciales. Actuellement, les dispositions du droit international privé sont fixées dans des textes épars, anciens et désuets. Pour ce qui concerne la détermination du droit national applicable, par exemple, on les retrouve principalement dans les termes très généraux de l'article 3 du Code civil dont la formulation date de 1804. La plupart des solutions sont donc aujourd'hui d'origine jurisprudentielle, ce qui comporte l'avantage d'une adaptation aux évolutions sociologiques, mais aussi l'inconvénient d'une insécurité juridique.
Dans ce contexte, l'objectif principal de ce projet consiste à donner une vision globale et cohérente d'un ensemble de règles qui affectent un nombre croissant de citoyens et d'entreprises. Ensuite, par le fait de la globalisation de l'approche, le projet tend à assurer une transparence de la règle de droit dans les situations privées internationales. Le texte proposé trouve son origine dans une proposition de loi déposée au Sénat et est le résultat de 10 années de travail.
Dans le cadre de la discussion générale en commission de la Justice, l'ensemble des intervenants ont d'ailleurs souligné la qualité du travail réalisé par le Sénat et ont insisté pour que ce projet soit rapidement adopté.
En ma qualité de rapporteur, pour le surplus, monsieur le président, je me permets de renvoyer au rapport écrit établi par les services de notre assemblée. A cet égard, d'ailleurs, la réforme étant d'une telle ampleur, je ne peux qu'inviter le lecteur en quête d'informations à consulter également les rapports des travaux réalisés au Sénat.
Je voudrais maintenant vous faire part très brièvement de quelques commentaires plus particuliers du groupe socialiste concernant le projet qui nous est soumis, aujourd'hui. Ce projet constitue sans nul doute un événement d'une extrême importance. En effet, ce n'est pas tous les jours que notre assemblée examine un code. A ce titre, je voudrais une fois encore, au nom du groupe socialiste, insister sur la qualité du travail accompli par nos collègues du Sénat.
Ce projet constitue un ensemble lisible, cohérent et structuré; trois éléments particulièrement importants dans une matière aussi complexe et qui a un impact sur le quotidien de centaines de milliers de Belges et d'étrangers vivant en Belgique ou y menant leur activité professionnelle et de Belges résidant à l'étranger.
Je voudrais d'ailleurs particulièrement souligner l'intérêt des solutions parfois innovantes retenues dans le domaine familial. Ces solutions tentent, dans une matière sensible et importante pour les citoyens, de coller à l'évolution de la société et donc à la réalité des relations, via un objectif de proximité plutôt que d'avoir recours à des abstractions ou fictions juridiques. Dans ce contexte, l'application plus large du droit belge pour les familles résidant en Belgique est certainement un élément important d'intégration juridique, sociale et culturelle.
La solution préconisée quant à la problématique de la répudiation est une solution de compromis équilibré. En effet, s'il est indispensable de remettre en cause le caractère abject de cette procédure, il est tout aussi inadmissible, au nom de l'application pure et dure de la théorie des droits de l'homme, que la victime de cet acte, à savoir la femme, soit doublement victimisée.
En ouvrant la possibilité — comme le fait l'article 57 du projet — de reconnaître cet acte en Belgique sous un certain nombre de conditions strictes et cumulatives, le texte évite cette double sanction. D'une part, sanction par la répudiation et, d'autre part, sanction par l'impossibilité éventuelle de refaire sa vie, de prendre un nouveau départ en se remariant avec un homme sans doute plus respectueux des droits de celle qui l'accompagne. Cet article — comme les autres d'ailleurs — illustre bien le caractère moderne du texte qui nous est présenté. L'adoption de ce texte sera un superbe cadeau pour les deux cents ans du Code civil.

Mr. Speaker, Mrs. Minister, dear colleagues, this draft aims to introduce in our legal order a Code of International Private Law, which governs, in a situation with an element of extraneity, the competence of the Belgian courts, the determination of the law applicable and the conditions for the effectiveness in Belgium of judicial decisions and foreign acts in civil and commercial matters. Currently, the provisions of international private law are fixed in separate, old and outdated texts. As regards the determination of the applicable national law, for example, they are found mainly in the very general terms of Article 3 of the Civil Code, the wording of which dates back to 1804. Most of the solutions are therefore today of jurisprudential origin, which has the advantage of an adaptation to sociological developments, but also the disadvantage of legal uncertainty.
In this context, the main objective of this project is to provide a comprehensive and coherent vision of a set of rules that affect an increasing number of citizens and ⁇ . Then, by the fact of the globalization of the approach, the project tends to ensure transparency of the rule of law in international private situations. The proposed text originates in a bill submitted to the Senate and is the result of 10 years of work.
As part of the general discussion in the Justice Committee, all the speakers also highlighted the quality of the work carried out by the Senate and insisted that this project be promptly adopted.
As a rapporteur, for the surplus, Mr. Speaker, I allow myself to refer to the written report prepared by the services of our assembly. In this regard, in addition, since the reform is of such an extent, I can only invite the reader in search of information to also consult the reports of the work carried out in the Senate.
I would now like to present to you very briefly a few more specific comments of the Socialist Group concerning the project that is presented to us today. This project is undoubtedly an event of great importance. Indeed, it is not every day that our assembly examines a code. As such, I would like to once again, on behalf of the Socialist Group, emphasize the quality of the work done by our Senate colleagues.
This project constitutes a legible, coherent and structured whole; three especially important elements in such a complex subject that has an impact on the daily life of hundreds of thousands of Belgians and foreigners living in Belgium or conducting their professional activity there and of Belgians residing abroad.
I would like to emphasize in particular the importance of sometimes innovative solutions held in the family area. These solutions attempt, in a sensitive and important matter for citizens, to stick to the evolution of society and therefore to the reality of relationships, through an objective of proximity rather than resorting to abstractions or legal fiction. In this context, the wider application of Belgian law to families residing in Belgium is ⁇ an important element of legal, social and cultural integration.
The recommended solution to the problem of repudiation is a balanced compromise solution. Indeed, while it is indispensable to question the abject nature of this procedure, it is equally unacceptable, in the name of the pure and harsh application of the theory of human rights, that the victim of this act, namely the woman, be doubly victimized.
By opening up the possibility — as does Article 57 of the draft — to recognize this act in Belgium under a number of strict and cumulative conditions, the text avoids this double sanction. On the one hand, punishment by repudiation and, on the other hand, punishment by the possible impossibility to restore his life, to take a new start by re-marrying with a man probably more respectful of the rights of the one who accompanies him. This article — like the others — illustrates the modern character of the text that is presented to us. The adoption of this text will be a wonderful gift for the two hundred years of the Civil Code.

Mijnheer de voorzitter, ik zal het niet hebben over het volledige gedeelte van het internationaal privaatrecht omdat collega Liesbeth Van der Auwera, die trouwens verslaggever was, het daarover al had. Ik wil het wel hebben over een specifiek artikel, te weten artikel 57 dat de erkenning in België van de verstoting in bepaalde omstandigheden behandelt.
Verstoting moet principieel worden afgewezen. Die vorm van huwelijksontbinding gaat immers in tegen het principe van gelijkheid tussen mannen en vrouwen, tegen diverse internationale verdragen en tegen de Grondwet waarin de gelijkheid van mannen en vrouwen staat ingeschreven. Verstoting is en blijft volgens mij ook in strijd met de openbare orde en de rechten van de verdediging, alsook met de rechten van de vrouw.
Dit wordt zo bepaald in het wetsontwerp. Het wetsontwerp legt inderdaad de principiële verwerping van de verstoting vast en laat enkel verstoting toe wanneer aan zeer strikte cumulatieve voorwaarden voldaan is. Ik heb daarbij evenwel de volgende bedenkingen. Daders en slachtoffers van verstoting worden in het wetsontwerp van de regering op dezelfde manier behandeld. Dat kan volgens mij niet en in dat verband verwijs ik naar de situatie in Frankrijk waar verstoting niet wordt erkend, zelfs niet wanneer het gaat om verstoting van partners die er op het moment van de verstoting woonden terwijl de verstoting bijvoorbeeld in Marokko werd uitgesproken tussen onderdanen van een ander land. Zelfs in dat geval keurt Frankrijk verstoting niet goed en dienaangaande is er een uitspraak van het Hof van Cassatie.
Wij gaan blijkbaar verder. Daders — in de meeste gevallen gaat het over mannen, maar dat laat ik even in het midden — zouden in België volgens mij geen erkenning van de verstoting mogen aanvragen. Dat recht moet worden voorbehouden aan het slachtoffer — in de meeste gevallen de vrouw — omdat zij het slachtoffer is van een eenzijdige verstoting. Voor alle duidelijkheid, een verstoting is iets helemaal anders dan een gewone echtscheiding. Bij een verstoting blijft een vrouw "hangend"; zij is getrouwd, noch gescheiden. Zij kan dan niet trouwen met iemand in het buitenland, mocht zij dat wensen, omdat zij zogezegd nog niet gescheiden is. Dat is een probleem. Daarom kan dat recht in zeer specifieke gevallen wel worden voorbehouden, maar alleen op vraag van het slachtoffer, dus de vrouw. Zoniet, riskeert de vrouw vaak tweemaal het slachtoffer te worden: eerst omdat zij een verstoting moet ondergaan en nog eens omdat zij bijvoorbeeld niet in de mogelijkheid verkeert om opnieuw te huwen. Volgens artikel 57 van het wetsontwerp moet worden nagegaan of de verstoting wel degelijk op ondubbelzinnige wijze en zonder dwang werd aanvaard door de vrouw, maar ik meen dat het niet altijd mogelijk is om dat na te gaan, zeker wanneer zij bijvoorbeeld vergezeld wordt door haar ex-echtgenoot die haar onder morele druk kan zetten. Ik denk dat die vrouwen niet altijd de mogelijkheid of de moed zullen hebben achteraf naar een rechter te stappen om hem te zeggen dat zij eigenlijk niet akkoord gingen met de verstoting.
Trouwens, ik sta niet alleen met die kritiek. De Raad van State zegt: "Artikel 57 is geen garantie voor de afwezigheid van dwang. Het is veel beter om te zeggen dat het in strijd is met de openbare orde". Ook de Raad van State vraagt dus om de verstoting niet te erkennen.
Ik meen dat verstoting in België niet mag worden erkend, behalve op vraag van het slachtoffer of degene tegen wie de verstoting is uitgesproken. Het gaat bijna altijd over vrouwen en ik denk dat hun belang daar voorop moet staan. Als ik zou vasthouden aan een volledige en principiële afwijzing, zou dit betekenen dat zij niet kunnen huwen. Wij mogen hen geen twee keer slachtoffer laten worden.
Ik wil ook verwijzen naar het advies van het Adviescomité Gelijke Kansen van de Senaat. Een van de adviezen is dat de erkenning van de verstoting binnen een aantal strikt beperkte voorwaarden moet voorbehouden blijven aan de verstoten vrouw als slachtoffer. Dit staat letterlijk in punt 4 van het verslag. Ook het Centrum voor Gelijkheid van Kansen en voor Racismebestrijding zegt dat verstoting in principe niet kan, tenzij het belang van de vrouw het uitgangspunt is: zij mogen geen twee keer het slachtoffer zijn. Op dat punt zijn er nog wijzigingen nodig aan dit artikel. Al het overige keuren wij mee goed, dat is geen probleem.
Ik zal mijn amendement niet indienen, omdat ik niet voor onnodige vertraging van het geheel wil zorgen. Ik weet immers dat hieraan hard werd gewerkt. Wel vraag ik de minister om met mijn opmerking rekening te houden. Het voorstel moet nog naar de Senaat en de collega's in de Senaat kunnen dit in overweging nemen en het aanpassen. Ik hoop dat dit zo kan worden opgelost, anders moet ik klaarstaan met een nieuw wetsvoorstel. Ik zal mij onthouden, maar mijn fractie zal het wel mee goedkeuren.

Even in that case, France does not approve rejection and there is a ruling from the Court of Cassation.
Apparently we are going on. Daders — in most cases it is men, but I leave it in the middle — should not, in Belgium, according to me, be allowed to apply for recognition of the distortion. That right should be reserved for the victim — in most cases the woman — because she is the victim of unilateral rejection. For all clarity, a divorce is something completely different from a regular divorce. In the case of a displacement, a woman remains “hanging”; she is married, not separated. She cannot then marry someone abroad, if she wishes, because she is said to have not yet divorced. That is a problem. That right can therefore be reserved in very specific cases, but only at the request of the victim, i.e. the woman. Otherwise, the woman often risks to become the victim twice: first, because she has to undergo a mutilation and again, for example, because she is unable to re-marry. According to Article 57 of the draft law, it is necessary to verify whether the rejection was indeed accepted in an unambiguous manner and without coercion by the woman, but I believe that it is not always possible to verify that, especially when, for example, she is accompanied by her ex-husband who may put her under moral pressure. I think these women will not always have the opportunity or the courage to subsequently go to a judge to tell him that they did not actually agree with the rejection.
I am not alone with this criticism. The State Council says: “Article 57 is not a guarantee for the absence of coercion. It is much better to say that it is contrary to public order.” Therefore, the State Council also demands not to recognize the rejection.
In my view, in Belgium, punishment should not be recognised, except at the request of the victim or of the person against whom the punishment was issued. It’s almost always about women and I think their interests should be at the forefront. If I would stick to a complete and principled rejection, it would mean that they cannot marry. We must not let them be victims twice.
I would also like to refer to the opinion of the Advisory Committee for Equal Opportunities of the Senate. One of the opinions is that the recognition of the rejection should remain reserved to the rejection woman as a victim under a number of strictly limited conditions. This is literally stated in point 4 of the report. The Centre for Equality of Opportunities and for Combating Racism also says that distortion in principle cannot, unless the interests of women are the starting point: they must not be the victim twice. There are still amendments needed to this article. Everything else is accepted, that is no problem.
I will not submit my amendment, because I do not want to make an unnecessary delay of the whole. I know that this has been worked hard. I ask the Minister to take my comments into account. The proposal has yet to be passed to the Senate and the colleagues in the Senate can consider it and adjust it. I hope this can be resolved, otherwise I will have to prepare a new bill. I will abstain, but my group will approve.

Monsieur le président, madame la ministre, chers collègues, le présent projet de loi tente d'établir un Code de droit international privé. Il a été déposé au Sénat sous forme de proposition de loi par l'ensemble des groupes démocratiques mais a été rédigé à la demande du ministre de la Justice, en 1996, par un groupe de professeurs d'université qu'il faut aujourd'hui remercier, tout particulièrement les professeurs Fallon et Erauw qui ont été présents tout au long des débats en commission.
Ce nouveau Code rassemble les règles qui permettent de déterminer la compétence des autorités nationales pour connaître d'une affaire privée de caractère international, de désigner le droit national applicable à l'affaire et de déterminer les conditions dans lesquelles une décision judiciaire étrangère ou un acte authentique étranger peut recevoir effet en Belgique.
Le groupe MR est particulièrement satisfait de voir aboutir ce travail dont l'élaboration du texte date de plusieurs années. Le droit international privé prend en effet une importance accrue dans notre société qui prône la circulation des biens et des personnes, qui s'internationalise et qui, souvent, voit les relations entre ces personnes se complexifier.
Nous avons pu mesurer l'importance que présente la codification d'une matière dont le champ d'application est vaste. Le droit international privé concerne des matières diverses: droit des personnes (divorce, filiation, adoption, transmission du nom, obligations alimentaires), les règles relatives à la nationalité, à la propriété intellectuelle, le régime applicable aux biens volés, aux relations contractuelles, aux relations de travail, les dispositifs réglant la situation des personnes morales. Cette énumération n'est qu'exemplative mais elle permet de prendre conscience de l'importance et de l'ampleur du projet de loi qui nous est soumis aujourd'hui.
Actuellement, les dispositions du droit international privé sont fixées dans des textes épars, anciens et partiels. Il était donc indispensable non seulement de codifier mais aussi d'harmoniser et de réactualiser certaines de ces dispositions.
Le Code rencontre principalement trois objectifs.
Le premier est un objectif de transparence. Cet objectif, poursuivi par le rassemblement en un seul Code de dispositions dispersées, par la clarification des règles existantes — par exemple suite à l'évolution jurisprudentielle, le prescrit de l'article 3 du Code civil ne correspondait plus à sa signification — et par la simplification de la formulation des règles. Par ailleurs, en Europe, il n'y a plus que la Belgique, la France et le Luxembourg qui n'aient pas adopté ce type de Code.
Le deuxième objectif est l'adaptation à l'évolution. Le Code prend en compte l'évolution jurisprudentielle des textes datant de Napoléon. Il faut aussi adapter les règles déterminant le droit applicable aux situations nées de la circulation internationale des biens et des personnes. Le rapport de législation nationale avec la nationalité a changé, il est de plus en plus facile de changer de nationalité, on déroge plus souvent à son caractère permanent. De plus, il n'y a plus systématiquement d'unité de nationalité au sein d'une même famille.
C'est également l'occasion d'adapter la loi à l'évolution des valeurs fondamentales.
Le troisième objectif est un objectif d'ouverture internationale. Un code permet d'assurer une reconnaissance de droits régulièrement acquis à l'étranger et force le praticien à considérer l'applicabilité éventuelle d'un droit étranger.
Je voudrais également mettre en exergue plusieurs thèmes abordés qui méritent une attention particulière et qui présentent un caractère novateur.
Le facteur de résidence habituelle est certainement le critère le plus nouveau qui soit introduit dans notre code. Il n'est cependant pas neuf si l'on considère l'évolution des textes, notamment à l'échelon international, ce critère s'imposant progressivement en regard de celui de la nationalité. Ce facteur de résidence habituelle répond à l'objectif de modernité. Le concept de résidence habituelle se détermine par l'utilisation de données essentiellement factuelles, telles que l'établissement durable, le centre de vie ou la volonté de s'établir durablement — à ne pas confondre avec le critère de domiciliation. Ce facteur de résidence habituelle est donc appelé à jouer un rôle majeur comme facteur de rattachement dans la détermination du droit applicable. Il donne au juge une certaine liberté d'interprétation, dans l'application de la règle, à une variété importante de cas concrets. Cela méritait d'être souligné.
Ensuite, je souhaiterais dire un mot sur la question de la reconnaissance en Belgique d'un acte de répudiation, établi valablement à l'étranger, question qui a suscité de longs débats au Sénat. La solution qui nous a été soumise par le Sénat a rencontré notre soutien. Il nous semble en effet raisonnable de ne pas exclure toute reconnaissance d'un acte de répudiation de manière ferme. Notre législation se doit de permettre de donner effet à une répudiation lorsque, au moment de l'acte, la relation de couple ne présentait aucun rattachement avec l'Etat belge et à condition que la femme accepte la dissolution du mariage sous cette forme. Cette solution permet d'éviter qu'une femme victime de répudiation ne doive aujourd'hui encore introduire une procédure en divorce au cas où elle souhaiterait voir son mariage dissous.
Je souhaiterais revenir sur la question du mariage entre deux personnes du même sexe. La solution adoptée prévoit que si une disposition de la loi nationale des époux ou de l'un d'eux interdit le mariage de même sexe, l'application de ces dispositions doit être écartée pour autant que l'un des époux ait la nationalité d'un Etat ou réside habituellement sur le territoire d'un Etat qui permet un tel mariage. Il me semble nécessaire de rappeler qu'un mariage entre deux personnes de même sexe en vertu de cet article pourra ne pas être reconnu dans certains Etats étrangers. Il est dès lors indispensable d'informer dûment les personnes concernées des effets d'un tel mariage par rapport au droit international privé. J'ai aussi un petit regret à exprimer sur la forme et non sur le fond de cette matière. J'estime qu'il aurait été souhaitable d'attendre l'adoption du présent code pour appliquer cette règle. En d'autres termes, il aurait été préférable de mettre les circulaires en conformité avec la loi et non l'inverse.
Enfin, une petite remarque en matière d'adoption. Certaines dispositions du Code présentent des complexités qui pourront apparaître au service d'adoption comme, par exemple, la question - évoquée en commission - de la reconnaissance en Belgique d'un acte d'aptitude à adopter valablement obtenu à l'étranger.
Il me semblerait nécessaire que le ministère de la Justice assure, après l'entrée en vigueur de ce projet de loi, un soutien au service d'adoption qui rencontrerait des difficultés d'application pratiques.
En conclusion, monsieur le président, madame la ministre, chers collègues, nous estimons que les solutions adoptées apportent les clarifications souhaitables et expriment l'orientation politique adaptée aux besoins et aux valeurs de la société. Je me permettrai ici de reprendre la conclusion du professeur Fallon: "On peut constater le souci de favoriser autant que possible, en matière familiale, une intégration juridique des étrangers vivant en Belgique et, en matière économique, une clarification de nature à favoriser la sécurité des transactions commerciales".
C'est pour l'ensemble de ces raisons et parce que le Code qui a été adopté à l'unanimité est clair, précis et moderne que le MR soutiendra ce projet de loi.

It was submitted to the Senate as a bill by all the democratic groups but was drafted at the request of the Minister of Justice, in 1996, by a group of university professors to whom today we must thank, especially the professors Fallon and Erauw who were present throughout the committee debates.
This new Code brings together the rules for determining the jurisdiction of national authorities to deal with a private case of international character, to designate the national law applicable to the case and to determine the conditions under which a foreign judicial decision or a foreign authentic document may take effect in Belgium.
The MR group is ⁇ pleased to see the outcome of this work whose elaboration of the text dates back several years. International private law takes on an increasing importance in our society which advocates the movement of goods and persons, which internationalizes and which often sees the relations between these persons become more complex.
We were able to measure the importance of codifying a matter with a wide scope of application. International private law concerns various subjects: the right of persons (divorce, filiation, adoption, transmission of name, maintenance obligations), the rules relating to nationality, intellectual property, the regime applicable to stolen property, contractual relations, employment relations, the arrangements governing the situation of legal persons. This listing is only exemplary but it makes us aware of the importance and extent of the bill that is submitted to us today.
Currently, the provisions of international private law are fixed in separate, old and partial texts. It was therefore indispensable not only to codify but also to harmonise and update some of these provisions.
The Code has three main objectives.
The first is the goal of transparency. This objective, pursued by bringing together in a single Code dispersed provisions, by clarifying existing rules – for example, following the evolution of jurisprudence, the prescribed of Article 3 of the Civil Code no longer corresponded to its meaning – and by simplifying the formulation of the rules. In Europe, only Belgium, France and Luxembourg have not adopted this type of Code.
The second objective is adaptation to evolution. The Code takes into account the jurisprudential evolution of the texts dating from Napoleon. It is also necessary to adapt the rules determining the law applicable to situations arising from the international movement of goods and persons. The relationship of national legislation with citizenship has changed, it is increasingly easier to change citizenship, more frequently deviating from its permanent character. Moreover, there is no longer systematic unity of nationality within the same family.
It is also an opportunity to adapt the law to the evolution of fundamental values.
The third goal is an objective of international openness. A code ensures recognition of rights regularly acquired abroad and forces the practitioner to consider the possible applicability of a foreign law.
I would also like to highlight several topics addressed that deserve special attention and have an innovative character.
The usual residence factor is ⁇ the newest criterion introduced in our code. However, it is not new if one considers the evolution of texts, especially at the international level, this criterion being gradually imposed over that of nationality. This usual residence factor meets the objective of modernity. The concept of habitual residence is determined by the use of essentially factual data, such as the permanent establishment, the centre of life or the will to settle permanently — not to be confused with the criterion of domicile. This habitual residence factor is therefore called to play a major role as a linking factor in determining the applicable law. It gives the judge some freedom of interpretation, in the application of the rule, to a significant variety of concrete cases. This was worth emphasizing.
Next, I would like to say a word on the question of the recognition in Belgium of an act of repudiation, validly issued abroad, a question that has caused long debates in the Senate. The solution that has been submitted to us by the Senate has met our support. Indeed, it seems to us reasonable not to rule out any recognition of an act of repudiation in a firm manner. Our legislation must be able to give effect to a repudiation when, at the time of the act, the couple relationship did not present any connection with the Belgian State and provided that the woman accepts the dissolution of the marriage in this form. This solution prevents a woman victim of repudiation from still having to initiate a divorce procedure if she wishes to see her marriage dissolved.
I would like to return to the issue of marriage between two persons of the same sex. The adopted solution provides that if a provision of the national law of spouses or one of them prohibits same-sex marriage, the application of those provisions shall be excluded provided that one of the spouses is a national of a State or resides habitually in the territory of a State that allows such marriage. It seems to me necessary to recall that a marriage between two persons of the same sex under this article may not be recognised in certain foreign States. It is therefore essential that the persons concerned are duly informed of the effects of such marriage in relation to international private law. I also have a little regret to express on the form and not on the substance of this matter. I think it would have been desirable to wait for the adoption of this Code to apply this rule. In other words, it would have been better to put the circles in compliance with the law and not vice versa.
Finally, a few words about adoption. Certain provisions of the Code present complexities that may appear at the adoption service such as, for example, the question - discussed in a committee - of the recognition in Belgium of an act of aptitude to adopt validly obtained abroad.
It seems to me necessary that the Ministry of Justice, after the entry into force of this bill, provide support to the adoption service that would encounter practical implementation difficulties.
In conclusion, Mr. Speaker, Mrs. Minister, dear colleagues, we believe that the solutions adopted bring the desired clarifications and express the political orientation adapted to the needs and values of society. I will here allow myself to resume Professor Fallon’s conclusion: “We can see the concern of favouring, as far as possible, in family matters, a legal integration of foreigners living in Belgium and, in economic matters, a clarification of the nature of favouring the security of commercial transactions.”
It is for all these reasons and because the Code that has been adopted unanimously is clear, precise and modern that the MR will support this bill.

Mijnheer de voorzitter, mevrouw de minister, collega's, laat ik alvast zeggen dat dit een erg belangrijke tekst is voor de practici. Velen onder ons hebben ooit cursussen recht gevolgd en het vak internationaal privaatrecht was niet bepaald een vak waarvan studenten droomden om er examen over af te leggen omdat iedere vorm van codificatie ontbrak. Het is daaraan dat we vandaag een oplossing geven.
Ik denk dat het belangrijk is, ere wie ere toekomt, om hier vanop deze tribune nogmaals te herhalen dat dit werk het gevolg is van een commissie van experts, waaronder de professoren Erauw en Fallon die hier aanwezig zijn en een aantal andere experts die hieraan jarenlang gewerkt hebben. Ze hebben ook uitvoerig contact gehad met de administraties die deze wet zullen moeten toepassen. Nadien is dit reeds doorwrochte werk opnieuw door de Senaat uitvoerig behandeld met grondige discussies rond de meest heikele punten. Het is een zodanig belangrijk en dringend ontwerp, niet in de betekenis dat als het morgen niet goedgekeurd wordt er een ramp ontstaat, maar waarnaar de vraag vanuit de praktijk zo enorm is, dat enige spoed hierin belangrijk is. Vandaar dat we er in de Kamer voor gekozen hebben om het grondige en zeer uitvoerige werk van de Senaat niet over te doen. We hebben ons beperkt tot een klassieke, normale behandeling van het ontwerp zonder te veel te proberen het werk van de Senaat over te doen.
Ik denk dat er een artikel in het ontwerp staat — mevrouw Lanjri heeft er al op gewezen — waar je lang over kan blijven discussiëren. Het gaat over het fameuze artikel 57 dat in zekere mate een vorm van erkenning van de verstoting met zich meebrengt. Het is toch nuttig om even te herinneren aan de genese van de tekst die vandaag word voorgelegd.
Oorspronkelijk werd in de tekst die aan de Senaat werd voorgelegd een poging gedaan om wat in de rechtspraak tot dan toe werd erkend, hetzij in onze rechtspraak, hetzij in een aantal tendensen die ook in het buitenland konden worden vastgesteld, gestalte te geven. Daarop is in de Senaat veel kritiek gekomen, juist omdat het eigenlijk een te grote erkenning van de verstoting tot gevolg zou hebben. De Senaat heeft in zijn wijsheid geoordeeld die tekst grondig te wijzigen.
Wat staat er nu in de tekst? Paragraaf 1 zegt heel duidelijk dat de verstoting in principe in België niet erkend wordt. Dat is een nieuwigheid die de Senaat heeft ingevoerd in vergelijking met de oorspronkelijke tekst. Het is ook dat algemene principe dat in de praktijk door bijvoorbeeld ambtenaren van de burgerlijke stand normaal gezien moet worden toegepast. Wie zich met een akte van verstoting aanmeldt bij een ambtenaar van de burgerlijke stand zal normaal gezien als antwoord krijgen dat dit niet kan en dat dit in het Belgische recht niet erkend wordt.
Alleen is het in de specifieke problematiek van het internationaal privaatrecht zo dat je door een combinatie van juridische techniciteit soms toch een aantal rechtsgevolgen moet kunnen geven aan akten waar we op zich wel enig twijfels bij hebben. De Senaat heeft een formulering gevonden waarbij in een zeer beperkt aantal gevallen de principiële weigering van de ambtenaar van de burgerlijke stand doorbroken kan worden als men een aantal zaken als bewijs aandraagt.
Het gaat dan om gevallen waarin men op het moment van de verstoting geen enkele vorm van band had met een land waar de verstoting niet aanvaard werd en waarbij ook de nodige garanties worden geboden dat, in tegenstelling tot de klassieke verstoting, de vrouw met deze ontbinding van het huwelijk op ondubbelzinnige wijze en zonder enige dwang in aanvaarding is. Het is duidelijk, en dat is ook één van de redenen waarom ik dit nog even kom beklemtonen, dat de bewijslast voor die afwezigheid van dwang en die ondubbelzinnige aanvaarding van de verstoting door de vrouw ligt bij diegene die het vraagt en dat men niet zomaar de plano mag gaan aannemen dat, omdat er één of ander vaag document is, die aanvaarding er is.
Er zijn nog andere waarborgen in de tekst opgenomen, de algemene waarborgen wanneer het tegen de rechten van de verdediging zou zijn, wanneer er een of andere vorm van openbare orde in het gedrang zou zijn. Ook om die redenen kan men weigeren. Bovendien stelt men nog eens dat alleen in die gevallen waarin er in het land van oorsprong een homologatie en erkenning van een rechter is er een mogelijke erkenning van de verstoting in België kan gebeuren. Dat is niet in alle landen waar de verstoting wordt gebruikt. Met name in de Aziatische landen komt er geen rechter tussen. Al die gevallen zijn dus uitgesloten.
Met andere woorden, wij worden hier geconfronteerd met een tekst die in ik zou zeggen 99% van de gevallen de verstoting geen enkel rechtsgevolg geeft naar Belgisch recht. De enige reden waarom er een uitzondering instaat is juist om aan een aantal mensen die het slachtoffer zijn van een verstoting een juridisch middel te geven om een aantal rechtsgevolgen in België te laten goedkeuren.
Wij worden natuurlijk geconfronteerd met de vraag — mevrouw Lanjri heeft dat zeer correct geformuleerd — of de tekst zoals die nu voorligt al dan niet nog moet verfijnd worden om het onderscheid te maken tussen, aan de ene kant, een slachtoffer dat zich hierop beroept en, aan de andere kant, de man die destijds de verstoting heeft gedaan. Nu, wij zouden natuurlijk snelsnel die tekst hebben kunnen aanpassen, maar ik denk dat de juiste formulering daarvan toch wel een debat met zich meegebracht zou hebben dat het hele debat dat men in de Senaat gevoerd heeft over de verstoting opnieuw zou dreigen te laten voeren. Hoewel het een belangrijk debat is, zowel maatschappelijk als juridisch, denk ik dat ook het belang van het geheel van dit ontwerp noodzaakt dat we proberen hiermee vooruit te gaan. Dat neemt niet weg dat indien in de Senaat, hetzij naar aanleiding van de bespreking die men opnieuw zal moeten voeren over dit verhaal, hetzij aan de hand van een wetsvoorstel dat men zou maken om meer specifiek dit gegeven te verfijnen, diegenen die destijds deze consensus tot stand hebben gebracht zouden concluderen dat het nog moet verfijnd worden, ik mij alleszins wil engageren om, indien daartoe in de Kamer ook verder werk nodig zou zijn, dat zo spoedig mogelijk en liefst parallel met de inwerkingtreding van dit ontwerp tot een goed einde te laten komen. Ik denk echter dat de correcte juridische formulering van zo'n element niet zo gemakkelijk is. Er is een probleem van hoe men dat perfect moet gaan formuleren. Het belang van het ontwerp als dusdanig noodzaakt echter ook dat we hier vandaag over kunnen stemmen.

I think there is an article in the draft — Ms. Lanjri has already pointed out — that you can continue to discuss for a long time. It is about the famous article 57 which, to a certain extent, involves a form of recognition of the denial. It is useful, however, to recall for a moment the genesis of the text presented today.
Initially, in the text submitted to the Senate, an attempt was made to give shape to what was recognised in the jurisprudence until then, either in our jurisprudence or in a number of trends that could also be established abroad. This has received a lot of criticism in the Senate, precisely because it would actually result in too much recognition of the rejection. The Senate has in its wisdom decided to amend this text thoroughly.
What is now in the text? Paragraph 1 states very clearly that the extortion is in principle not recognised in Belgium. This is a novelty that the Senate has introduced in comparison with the original text. It is also that general principle that in practice must normally be applied by, for example, civil servants. Those who register with an act of disqualification with an official of the civil status will normally be answered that this cannot be done and that this is not recognised in Belgian law.
It is only in the specific problemology of international private law that through a combination of legal technique, you sometimes have to be able to give a number of legal consequences to acts in which we in themselves have some doubts. The Senate has found a formulation in which in a very limited number of cases the principle refusal of the official of the civil stand can be broken by presenting a number of matters as evidence.
These are cases in which, at the time of the dissolution, there was no form of connection with a country where the dissolution was not accepted and which also provide the necessary guarantees that, unlike the traditional dissolution, the wife with this dissolution of the marriage is accepted in an unambiguous manner and without any coercion. It is clear, and that is also one of the reasons why I will emphasize this for a moment, that the burden of proof for that absence of coercion and that unambiguous acceptance of the rejection by the woman lies with the one who asks it, and that one cannot simply assume that, since there is one or another vague document, that acceptance is there.
Other safeguards are included in the text, the general safeguards when it would be contrary to the rights of defence, when some form of public order would be compromised. You can also refuse for these reasons. In addition, it is repeatedly stated that only in those cases where there is a homologation and recognition by a judge in the country of origin there can be a possible recognition of the disposal in Belgium. This is not the case in all countries where the discharge is used. Especially in the Asian countries there is no judge between. All these cases are therefore excluded.
In other words, we are here confronted with a text that in I would say 99% of the cases the distortion does not give any legal effect under Belgian law. The only reason why an exception exists is precisely to give a number of persons who are victims of a distortion a legal remedy to have some legal effects approved in Belgium.
We are, of course, confronted with the question — Ms. Lanjri has formulated this very correctly — whether or not the text as it now presents needs to be refined to distinguish between, on the one hand, a victim who invokes it and, on the other hand, the man who at the time committed the reproach. Now, of course, we could have quickly adjusted that text, but I think the correct formulation of it would have brought about a debate that would threaten to cause the whole debate that has been held in the Senate about the rejection to take place again. While it is an important debate, both social and legal, I think that the importance of the whole of this draft also requires that we try to move forward with this. It does not matter that if in the Senate, either following the discussion that will be held on this story again, or by means of a bill to be made to more specifically refine this given, those who at that time have achieved this consensus conclude that it still needs to be refined, I would like to undertake, if further work would be needed for this purpose in the Chamber, that as soon as possible and preferably in parallel with the entry into force of this draft, a good ending be made. However, I think that the correct legal formulation of such an element is not so easy. There is a problem with how to formulate it perfectly. However, the importance of the design as such also requires that we can vote on it today.

Vous ne le savez peutêtre pas, mais ce code a l'aval de l'ensemble des professeurs de droit international privé de Belgique. Les professeurs Erauw et Fallon ont de nouveau suivi tous les travaux en commission de la Justice de la Chambre.
Nous disposons d'un texte de très grande qualité, fruit d'un accord entre le parlement, qui avait déposé les proposions initiales à l'aide des professeurs d'université, et le gouvernement avec son administration, qui a formulé les quelques amendements qui lui semblaient indispensables pour que le texte soit parfait. C'est ce que l'on demande aujourd'hui au parlement de voter: un code. Cette situation ne se présente pas tous les jours. C'est donc un grand jour, me semble-t-il.
