Mijnheer de voorzitter, mevrouw de minister, collega's, het gaat hier vandaag over een nieuwe wet die eigenlijk een vervanging is van de oude wet betreffende de handelsvestigingen van 1975, die later werd aangepast in 1976. Volgens ons is deze wet dringend aan herziening toe, want deze wet voldeed niet meer aan de huidige commerciële noden en zeker niet meer aan het huidige consumptiepatroon. In tegenstelling tot wat sommigen beweren heeft deze wet in het verleden juist tot de leegloop van stadskernen geleid. Het is dus niet zo dat de vorige wet de stadskernen heeft beschermd en de huidige wet deze leegloop van de stadskernen zou bevorderen. Integendeel zelfs. Deze wet heeft heel wat voordelen. Ik zou die in vier verschillende punten willen opsommen.
Ten eerste, is er meer transparantie en duidelijkheid. Ten tweede, worden er kortere, maar vooral ook striktere termijnen toegepast. Ten derde, biedt deze wet een grotere rechtszekerheid. Ten vierde, zullen we een grotere autonomie krijgen voor de gemeenten.
In de eerste plaats kom ik op de transparantie en de duidelijkheid. Vroeger werd gehandeld in bruto-oppervlakten, wat vaak tot verwarring leidde. Nu heeft men duidelijk geopteerd voor nettooppervlakten. De netto-verkoopoppervlakte telt nu als enig criterium. Ook is het zo dat bij ontstentenis van een beslissing van een college een stilzwijgende vergunning wordt gegeven als binnen de toegestane termijnen geen antwoord wordt gegeven. Ook dit creëert dus duidelijkheid voor de aanvrager.
Vroeger was het grondgebied onderverdeeld in verschillende zones — zone 1, zone 2, enzovoort — met allemaal een verschillende toepassing. Ook dat was niet goed voor de transparantie. Nu heeft men beslist om die zones af te schaffen voor alle oppervlakten. Voor alle aanvragen hanteert men hetzelfde criterium, of men nu in het centrum of buiten het centrum is gevestigd.
Ook is hier in een vereenvoudigde procedure voorzien voor uitbreidingen die, ten eerste, niet meer dan 20% bedragen van de oorspronkelijk vergunde toekenning, met een maximum van 300 vierkante meter en, ten tweede, voor verhuizingen binnen de gemeente als het gebeurt binnen een straal van 1.000 meter. Hiervoor dient alleen een eenvoudige verklaring te worden afgeleverd bij het college van burgemeester en schepenen. Dit volstaat om deze uitbreiding of verhuizing te kunnen uitvoeren.
Ten tweede, zijn er kortere en striktere termijnen. Het is ook heel belangrijk voor de investeerder dat hij duidelijk weet hoe hij zijn investeringen moet plannen. Als hij een aanvraag doet en er geen specifieke vergunning wordt gegeven — als er dus een afwezigheid van beslissing is — krijgt hij toch een vergunning. Hij weet dus perfect wanneer hij met zijn investering kan aanvangen en wanneer hij zijn vergunning al dan niet kan krijgen.
Ten derde, is er een grotere rechtszekerheid. In de bestaande wet was geen beroepsprocedure mogelijk als er een negatieve beslissing was van het sociaal-economisch comité. Welnu, collega Lano, collega Van Campenhout en ikzelf hebben destijds een voorstel ingediend waarin wij vroegen om een beroepsprocedure mogelijk te maken in de bestaande wet, maar aangezien deze wet daarin al heeft voorzien is ons voorstel eigenlijk zonder voorwerp geworden en hebben wij ons voorstel uiteraard ingetrokken. Vandaag is dus te allen tijde een beroep mogelijk, ook als er een negatieve beslissing is. Uiteindelijk zal men dan terechtkomen bij het interministerieel comité dat hierin een beslissing zal nemen.
Ten vierde, de autonomie van de gemeenten. De gemeentebesturen zijn verplicht om de zes jaar verantwoording af te leggen bij de kiezer en zullen op dit punt zeker rekening houden met de kiezer, alsook met de lokale middenstand. De gemeentebesturen zullen proberen te vermijden dat beslissingen worden genomen die nefast zijn voor de eigen middenstand en een leegloop van de stadskernen kunnen veroorzaken. Integendeel, de gemeenten zullen erop toezien dat stadskernen versterkt worden en er geen overhaaste beslissingen worden genomen die slecht zijn voor de ontwikkeling van de eigen gemeente.
Wat dit punt betreft, heeft de VLD volledig vertrouwen in de responsabilisering die aan de gemeenten gegeven wordt. We zullen erop toezien dat zij zich aanpassen aan de structuurplannen die zullen opgemaakt worden. Tegen 2007 moet elke gemeente een structuurplan hebben uitgewerkt. Er worden zones voorbehouden voor kleine handelszones. Het zal niet anders kunnen dan dat nieuwe investeringen toegelaten worden in de zones die erkend zijn als kleine handelszones. De autonomie van de gemeenten zal, mijns inziens, leiden tot een grotere responsabilisering. We kunnen echter niet anders dan vaststellen dat omwille van de huidige wet er zeer rare dingen gebeurd zijn in de grensgebieden. België is bijna een groot grensgebied. We krijgen concurrentie van over de grenzen heen. Overal in de periferieën van ons land ontstaan grote ketens die als het ware een aanval doen op de koopkracht van onze Belgische consument. Heel wat Belgen kopen in het buitenland en worden er geholpen door buitenlandse werknemers.
Met de nieuwe wet wil de VLD de zelfstandige ondernemer de kans geven om te groeien, dynamisch te zijn en zich te verweren tegen de buitenlandse concurrentiekracht en de grote ketens. Een zelfstandig ondernemer die kan groeien en zich specialiseren, is veel beter gewapend, ook tegen de grote ketens.
Er wordt beweerd dat deze nieuwe wet de grote ketens bevoordeelt. De meeste dossiers die in het verleden geweigerd werden, zijn allemaal met betrekking tot bedrijven die wensten uit te breiden, maar hierin belemmerd werden. Met deze nieuwe wet willen we de bedrijven slagkracht en mogelijkheid tot groei en specialisatie geven. Op die manier helpen we mee aan de groei van de tewerkstelling.
We moeten ervoor zorgen dat de koopstroom van België naar het buitenland opnieuw gekeerd kan worden en de buitenlandse consument gemotiveerd wordt om in ons land te kopen. Iedereen kent de situatie van Kortrijk. Het stadscentrum van Kortrijk is bijna volledig leeggelopen ten gevolge van de ontwikkelingen in Rijsel. Hetzelfde merken we in andere grensgebieden.
Voor de VLD is het duidelijk dat deze trend gestopt moet worden. Met deze nieuwe wet bieden we aan onze eigen ondernemers en handelaars de mogelijkheid om zich tegen die trend te wapenen. We zijn grote voorstanders van deze wet en zullen ze volmondig goedkeuren.

First of all, I want to talk about transparency and clarity. In the past, it was traded in gross surfaces, which often led to confusion. Now we have clearly opted for net surfaces. The net sales area now counts as the only criterion. In the absence of a decision of a college, a silent authorisation is granted if no response is given within the allowed deadlines. This also creates clarity for the applicant.
In the past, the territory was divided into different zones—zone 1, zone 2, and so on—all with different applications. This was also not good for transparency. Now it has been decided to eliminate those zones for all surfaces. All applications are subject to the same criteria, whether they are located in the centre or outside the centre.
Also here is a simplified procedure provided for expansions which, first, do not exceed 20% of the originally granted grant, with a maximum of 300 square meters and, secondly, for movements within the municipality if it takes place within a radius of 1,000 meters. For this, only a simple statement must be delivered to the College of Mayor and Creators. This is enough to be able to carry out this extension or relocation.
Second, there are shorter and stricter deadlines. It is also very important for the investor that he knows clearly how to plan his investments. If he submits an application and no specific authorisation is granted — if there is a lack of decision — he still receives an authorisation. He thus knows perfectly when he can start with his investment and when he can get his license or not.
Third, there is greater legal certainty. In the existing law, no appeal procedure was possible if there was a negative decision of the Social and Economic Committee. Well, colleague Lano, colleague Van Campenhout and myself at the time submitted a proposal in which we requested to make an appeal procedure possible in the existing law, but since this law has already provided for this, our proposal has actually become without object and we have naturally withdrawn our proposal. Today, therefore, an appeal is possible at any time, even if there is a negative decision. Eventually, the interministerial committee will take a decision.
Fourth, the autonomy of the municipalities. The municipal governments are obliged to report to the voter for the six years and will at this point ⁇ take into account the voter, as well as the local middle-state. The municipal governments will try to avoid making decisions that are detrimental to their own middle-state and can cause an emptiness of the city centers. On the contrary, the municipalities will ensure that city nuclei are strengthened and no hasty decisions are made that are bad for the development of their own municipality.
On this point, the VLD has full confidence in the responsibility given to the municipalities. We will ensure that they adapt to the structural plans that will be drawn up. By 2007 each municipality must have drawn up a structural plan. There are areas reserved for small trade zones. It will only allow new investments in the zones recognized as small trade zones. The autonomy of the municipalities will, in my opinion, lead to greater responsibility. However, we cannot help but conclude that because of the current law, very strange things have happened in the border areas. Belgium is a large border area. We have competition across borders. Everywhere in the periphery of our country, large chains arise that as if attack the purchasing power of our Belgian consumers. A lot of Belgians buy abroad and are helped by foreign workers.
With the new law, the VLD aims to give the independent entrepreneur the opportunity to grow, be dynamic and defend itself against foreign competitiveness and large chains. A self-employed entrepreneur who can grow and specialize is much better armed, even against the big chains.
It is claimed that this new law benefits the large chains. Most of the files that were rejected in the past were all related to companies who wanted to expand but were hindered in doing so. With this new law, we want to give the companies impact power and opportunity for growth and specialization. In this way, we contribute to the growth of employment.
We must ensure that the purchase flow from Belgium to abroad can be reversed and the foreign consumer is motivated to buy in our country. Everybody knows the situation of Courtois. The city center of Kortrijk has been almost completely empty as a result of the developments in Rijsel. We see the same in other border areas.
For the VLD, it is clear that this trend must be stopped. With this new law, we offer our own entrepreneurs and traders the opportunity to arm themselves against this trend. We are strong supporters of this law and will fully approve it.

De heer Lenssen mag dan nog zeggen dat de grensgemeenten het goed vonden dat de buitenlandse bedrijven zouden worden aangetrokken, omdat het de tewerkstelling zou verhogen. Ik heb daarover mijn twijfels.

Ik maak me ernstig zorgen over de betrouwbaarheid van deze meerderheid en ik vraag me af wat ons in de toekomst te wachten staat.
Het vierde punt inzake de techniciteit. Iedereen onderschrijft de regionalisering van de wet. Deze idee is niet van gisteren, die leeft al jaren bij CD&V en ook bij Unizo. Ik herhaal dat dit opgenomen is in de nota van de formateur en dat dit tot op vandaag door de partijen die onderhandelen aan de Vlaamse tafel goedgekeurd is. Ten tweede, mevrouw Pieters heeft volkomen gelijk als ze zegt dat u iets verder moet kijken dan uw neus lang is. Ikea bijvoorbeeld is louter verkoop. De productie gebeurt ergens anders. Ik wil bewijzen dat die wet niet toepasbaar is. De uiteindelijke beslissingsbevoegdheid, collega's, ligt bij de gemeenten. Dan mag u nog pleiten voor de autonomie van de gemeenten, maar de gemeenten zijn vandaag de dag niet uitgerust om dergelijke beslissingen te nemen. Wanneer dergelijke bedrijven naar hier komen, is het voor hen het gemakkelijkste om een kleine gemeente uit te kiezen om hun dossier erdoor te drukken. De gemeenten hebben geen kader; de gemeenten hebben nog altijd geen ruimtelijke structuurplannen en er is de verregaande impact op de omgeving en op de omliggende gemeenten. Buiten het feit dat zij dankzij mevrouw Gerkens het dossier kunnen gaan inkijken in de gemeenten waar het dossier wordt behandeld, ben ik ervan overtuigd dat de gemeenten vandaag de dag niet de capaciteit hebben om die bevoegdheid in handen te nemen.
Het lijkt op een vereenvoudiging, maar de versoepelingen die in de wet zijn ingeschreven, laten de facto gewoon alle remmen los en de politisering is in de nieuwe regelgeving ingebouwd. Wij zijn daarvan honderd procent overtuigd. De samenstelling van de comités kan niet anders dan daartoe leiden.
De heer Lenssen zegt dat de termijnen korter worden. Inderdaad, ik zal het als een verbetering beschouwen dat de termijnen korter worden, maar hoeveel mensen hebben in de hoorzitting gezegd dat die termijnen niet haalbaar zijn? Kunt u aan een gemeente, een provincie of een comité een termijn van twintig dagen opleggen? Het duurt soms vijf tot zes dagen voordat de brieven zijn geopend in de gemeenten. U kunt dat niet waarmaken.
Ten slotte, wij pleiten er al jaren voor dat het aan een stedenbouwkundige vergunning zou worden gekoppeld, dat de bevoegdheid zou worden geregionaliseerd en dat milieuvergunningen, stedenbouwkundige aanvragen en sociaal-economische machtigingen één pakket zouden worden. Dat zou de zaken vergemakkelijken, maar dat vraagt inderdaad een regionalisering. Jullie staan daarachter in Vlaanderen, maar hier zult u dat boycotten.
Ten slotte is er de ernstige kritiek van de Raad van State. Blijkbaar hebt u rekening gehouden met de kritiek van de Raad van State op uw amendement, maar wordt er geen rekening gehouden met de grondige kritiek van de Raad van State op de stilzwijgende fictieve vergunning.
Ik kom — voor de tweede keer, mijnheer de voorzitter — tot mijn besluit. De regering mist volharding en techniciteit. De regering mist vooral visie. Mij kan het niet schelen, maar er is geen enkel amendement van mij aanvaard. U doet maar wat u wil, maar ik zal ze één voor één opnieuw indienen. Dan kunnen jullie nog het plezier ondervinden ze één voor één weg te stemmen.
Ik betreur wel dat de meerderheid de tekst in de commissie op een arrogante manier heeft doorgedrukt en, op de heer Lenssen na, een complete stilzwijgendheid aan de dag heeft gelegd. Men heeft geen enkele inhoudelijke opmerking gemaakt en geen enkel amendement ingediend. Ik kan mij niet voorstellen dat wij, toen we deel uitmaakten van de meerderheid, nooit amendementen hadden op wetsontwerpen van de meerderheid. Ik noem dat slaafs en kruiperig. Het woord dat Unizo in de mond neemt, woordbreuk, is terecht. U bent verwittigd. Als u op ons een beroep doet, zullen wij de wet herzien.
Het is een slechte wet, vol met anomalieën. U wilt het niet zien en wilt niet horen! CD&V wacht de programmawet af. Op dat ogenblik zullen we moeten vaststellen dat de correctie vele maanden later komt.
Ik vraag me af wat de burger daarover denkt en vooral, collega's van de VLD, wat de middenstander ervan denkt!

Finally, there is the serious criticism of the State Council. Apparently you have taken into account the State Council’s criticism of your amendment, but the State Council’s thorough criticism of the silent fictitious license is not taken into account.

Monsieur le président, madame la ministre, mes chers collègues, deux remarques préalables.
Première remarque, j'ai entendu Mme Pieters et M. Tant parler de "corruption politique". Je sais qu'en toute matière, il faut laisser parler les orfèvres, mais je rappellerai simplement que l'histoire de la Belgique est truffée de collusions entre le CVP, devenu CD&V, et de grandes organisations économiques et sociales. Je pourrais rappeler une série d'exemples en la matière, mais là n'est pas le débat.
Deuxième remarque, je suis frappé, pour ne pas dire stupéfait, par le mépris affiché par Mme Pieters vis-à-vis des communes et des pouvoirs communaux. Sans doute Mme Pieters connaît-elle mieux les communes gérées par le CD&V. Elle a donc peut-être de bonnes raisons de penser qu'elles sont incapables de prendre leurs responsabilités. Pour ma part, je dirais que, pour beaucoup de municipalistes, cette loi est une véritable bouffée d'oxygène, un appel à la responsabilité et que les municipalistes responsables sont, eux, prêts à prendre leurs responsabilités.
Cette loi-cadenas de 1975 s'est avérée tout à fait néfaste pour l'ensemble des implantations commerciales dans notre pays et pour permettre un bon aménagement du territoire. Je rappellerai que c'est depuis cette loi que les villes ont été vidées de leurs structures commerciales, que les périphéries ont parfois empêché le développement de villes et de centres urbains. Il y a donc toutes les raisons de se réjouir de la révision de cette loi et que l'on sorte de l'arbitraire qui a prévalu pendant tant d'années. Que l'on sorte aussi de l'opacité qui a régné sur le tissu socioéconomique pendant tant d'années et qui a fait que finalement plus personne ne prenait ses responsabilités en la matière, qu'on ne savait plus qui décidait réellement. Chacun connaît dans sa région plus d'un exemple, à propos desquels on peut s'interroger quant à la règle de droit. Il était temps de revoir cette législation. Cette révision de la loi nous sortira de l'opacité, des réseaux occultes qui décidaient très souvent en la matière et donnera une plus grande part de responsabilité aux communes et aux municipalités. Voilà qui me paraît tout à fait logique quand on sait le lien qui unit toutes les implantations commerciales et le bon aménagement du territoire.
C'est typiquement une matière qui doit revenir aux communes, dans le cadre de l'organisation de leur territoire et de la vie quotidienne des gens concernés par des implantations commerciales, ainsi que par le maintien des petits commerçants dans leur commune. Je sais que, pour beaucoup, les municipalistes sont les avocats des associations de commerçants et d'indépendants dans leur commune: ils sauront donc à cet égard prendre leurs responsabilités.
Je sais qu'ils sauront aussi donner la possibilité à ces petits commerçants, à ces indépendants, de voir parfois plus loin, d'étendre leur activité commerciale, ce qui permettra à chacun de se développer et de développer l'activité économique dans sa sphère de distribution ou d'activité commerciale.
Sortir de l'opacité, sortir de l'arbitraire, donner davantage de pouvoirs aux municipalités, cela m'apparaît être la trame du projet de loi que nous allons voter aujourd'hui. Je pense que les bourgmestres et les conseils communaux sauront prendre leurs responsabilités en la matière.
Je rappelle que la loi qui nous est proposée aujourd'hui prévoit une possibilité de recours. Ce n'était pas toujours le cas auparavant, loin de là. Beaucoup de décisions ont été prises contre l'avis des collèges et conseils communaux, contre l'avis des associations locales de commerçants et ce, à de multiples reprises. Nous avons maintenant une possibilité, pour chacun, d'exprimer ses droits en matière de recours, d'être auditionné et de voir son avis pris en considération avant que la commune, le collège et le bourgmestre donnent effectivement leur autorisation en matière d'implantation.
Le délai de péremption de 4 ans en matière d'autorisation est peutêtre un peu long. Nous aurions souhaité qu'il soit plus court. En effet, si, par exemple, la personne qui a demandé l'autorisation ne réalise pas son investissement tout de suite, les communes risquent d'avoir des terrains inutilisés pendant un certain temps. Il y aurait peut-être là matière à revoir les choses mais je dis toujours que la meilleure façon d'empêcher la réalisation d'un projet, c'est d'exiger qu'il soit parfait. Celui-ci ne l'est sans doute pas mais c'est une grande avancée par rapport à la situation que nous connaissions précédemment.
Madame la ministre, le groupe MR votera ce projet parce qu'il offre plus de transparence en la matière et qu'il permet aussi une véritable simplification.

There might be stuff to review things, but I always say that the best way to prevent a project from being accomplished is to require it to be perfect. This may not be the case, but it is a big step forward compared to the situation we knew before.
Mr. Minister, the MR group will vote on this project because it offers more transparency in the matter and it also allows for a real simplification.

U hoeft daar niet op in te gaan als het iemand anders was, collega Lenssen. U moet zich daar niet onmiddellijk door aangesproken voelen. Ik had even de indruk dat hij Verhofstadt al aan het bellen was om te zeggen dat het erdoor was. De collega's van de VLD zeiden: "Georges, we gaan stemmen", maar in feite moesten ze geroepen hebben: "Georges, we moeten stemmen". De VLD moest stemmen. Collega Lenssen heeft de amendementen moeten intrekken. Dat zei hij ook in de commissie. "Ik moet mijn amendement intrekken". Maar van wie moest hij die intrekken? Van de Raad van State? De Raad van State wees de weg en zei dat men, om deugdelijk wetgevend werk te leveren, om deugdelijk te legifereren, een bijzondere wet moest goedkeuren. Neen, de wet moest ne varietur gestemd worden, behoudens dat kleine amendementje dat nog net goedgekeurd is in de commissievergadering eerder deze week. De wet moet goedgekeurd worden, nagenoeg ne varietur, zoals ze oorspronkelijk was ingediend. De weg die de Raad van State heeft gewezen hebben we dus niet gevolgd. Ik heb inderdaad de brief van de heer Hanot van Décathlon niet nodig, maar het blijft toch een frappant gegeven dat dergelijke brieven in het verleden geschreven zijn en dat men blijkbaar geen enkel tegenargument kan ontwikkelen tegen dergelijke correspondentie. Ook voor mij — men kan mij daar vanuit CD&V-hoek van overtuigen — hebben hier een aantal machinaties gespeeld, zeker wanneer ik zie hoe de genese van dit wetgevend initiatief is verlopen.
Met de oorspronkelijke tekst — en daar wil ik toch de nadruk opleggen, zowel ten opzichte van de rapporteur, de heer Hove, als ten aanzien van collega Pieters — ging het Vlaams Blok niet akkoord. Wij kantten ons tegen die oorspronkelijke tekst en daarom zullen wij vandaag ook tegen stemmen. Collega Pieters had daarstraks vermeld dat zowel CD&V als de groenen tegen deze Ikea-wet zoals ze genoemd wordt gekant zijn. Wel, het Vlaams Blok blijft daar ook tegen gekant, tegen de oorspronkelijk ingediende tekst en tegen de tekst die hier vandaag ter tafel ligt en die nagenoeg dezelfde is. Waar wij op een gegeven moment wel in konden meegaan, dat was natuurlijk toen de hoorzittingen achter de rug waren en de amendementen werden ingediend. Wij konden wel meegaan op de weg die toen ingeslagen werd.
Ik kreeg de indruk dat rekening zou worden gehouden met de opmerkingen van de Raad van State om de regionalisering te bewerkstelligen. De Raad van State sprak zich uit zoals wij verwachtten. Het werd geen snelle procedure, maar het had wel nog een efficiënte procedure kunnen worden door naar de opmerkingen van de Raad van State te luisteren, door amendementen in te dienen die UNIZO en Febelhout tegemoet kwamen. Al het werk dat wij in de commissie hebben geleverd, alle intense zittingen die daaraan werden gewijd, werden allemaal in een ruk van tafel geveegd in een commissievergadering. De amendementen die waren ingediend werden van tafel geveegd. De mondelinge vragen en interpellaties van de meerderheid werden allemaal ingetrokken. Het moest plotseling bijzonder snel gaan.
Natuurlijk rijzen dan vragen. Uiteraard vraagt men zich dan af wie en wat hierachter zit. Het antwoord is heel duidelijk, denk ik. Wij moeten niet verder zoeken. Ik zal de discussie niet heropenen over de sp.aschepenen van Gent die met luide stem verkondigen dat er een grote vestiging komt en dat er wetgevend wet aan te pas zal komen. Ik zal evenmin de discussie heropenen over lobbyisten die te vinden zijn in de hoek van bedrijven die vandaag zijn genoemd.
Dit kan alleen maar een oekaze worden genoemd, anders weet ik niet wat ik hier de voorbije vijf jaar heb ervaren. De oekaze van vandaag kan alleen maar doordat iemand aan de top dit erdoor wilt jagen. Al het constructieve werk wordt immers in een ruk van tafel geveegd. Ik weet niet wie u nog zult kunnen overtuigen van het tegendeel. Dit is vandaag nog in de media gekomen. Ik denk dat iedereen ervan overtuigd is dat met een hakbijl werd tekeergegaan in het parlementair werk en dat de werkzaamheden van het Parlement werden gekortwiekt.
Over de vraag of wij het hoogste orgaan in dit land zijn, hoeven wij al lang geen boompje meer op te zetten. In de commissie is nogmaals bewezen dat dit niet het geval is. Jammer, want de regionalisering voor handelsoppervlakten van meer dan 2.000 m² had in Vlaanderen wel een andere koerswending kunnen nemen. Dan had iedereen in Vlaanderen, misschien ook de KMO's, met een geruster hart en een geruster gemoed die wetgeving tegemoet gezien. Dan zou op Vlaams niveau een beleid kunnen worden gevoerd dat nauwer aansluit bij de KMO's, bij de kleine zelfstandigen, bij de kleine handelskernen. Dat is nu niet meer het geval.
Inderdaad, collega Lenssen, in de loop van de besprekingen heb ik ook gezegd dat het niet slecht is dat we in het Parlement de koopkracht verankeren. Dat was echter wel in de optiek dat, wanneer Vlaanderen zijn eigen beleid zou kunnen voeren, men wel eens meer zou nadenken en nauwer zou aansluiten bij de geest van de kleinhandel voor de grote handelsoppervlakten. Bovendien vermoedde ik toen — alles wees erop — dat de gemeenten ook niet meer bevoegd zouden zijn.
Dat is het tweede luik. De gemeenten worden nu bevoegd en voor 100 of 200 bijkomende arbeidsplaatsen zullen kleinere gemeenten wel eens durven marcheren op het bijna-bevel van een grote onderneming, waarvan het vermogen van alleen al de lokale vestiging vaak groter is dan het budget van sommige van die kleinere gemeenten.
Het ging dus de goede kant uit, maar op een gegeven moment werd alles van tafel geveegd. Drie fractievoorzitters boden zich dan ook nog plots aan bij de eindstemming. Dat is nog een extra argument om aan te tonen dat de wet er inderdaad moest worden doorgejaagd en dat in Vlaanderen geen beleid zou kunnen of mogen worden gevoerd.
Mijnheer Lenssen, ik heb zelf het argument van de grensstreken aangehaald, zoals de grensstreek Kortrijk-Rijsel of de grensstreek Tongeren-Maaseik, die voor mij al dichter bij huis ligt. Zoals ik al zei, kon ik meegaan in de verankering van de koopkracht. De kers op de taart is er echter niet gekomen. Met de wetgeving die we nu hebben, zal de koopkracht op lange termijn ook verminderen. Ik ben er immers van overtuigd — ik verwijs naar de argumenten die mevrouw Pieters en de heer Tant ook hebben aangehaald — dat de koopkracht op lange termijn zal verminderen, omdat de werkgelegenheid helemaal niet zal stijgen. Dat zal helemaal niet zo zijn. Hoogstens kan er een verschuiving plaatsvinden van de kleinhandel naar de grote distributie. Of dat netto arbeidsplaatsen zal opleveren, daarvan ben ik niet overtuigd, integendeel.

The municipalities now become competent and for 100 or 200 additional jobs, smaller municipalities will sometimes dare to march on the near-command of a large enterprise, whose assets of the local branch alone are often greater than the budget of some of those smaller municipalities.
So it went in the right direction, but at some point everything was wiped off the table. Three group chairmen subsequently presented themselves at the final vote. That is another additional argument to demonstrate that the law should indeed be pursued and that in Flanders no policy could or should be carried out.
Mr Lenssen, I myself have cited the argument of the border regions, such as the border region Kortrijk-Rijsel or the border region Tongeren-Maaseik, which for me is closer to home. As I said, I could go along in the anchoring of purchasing power. However, the cherry on the cake did not come. With the legislation we have now, purchasing power will also decrease in the long term. In fact, I am convinced — I refer to the arguments also cited by Ms. Pieters and Mr. Tant — that purchasing power will decrease in the long term, because employment will not increase at all. It will not be so at all. At most, a shift can take place from the retail to the large distribution. Whether that will generate net jobs, I’m not convinced of that, on the contrary.

Van het buitenland naar het binnenland? Ik ben daar niet zozeer van overtuigd. Het buitenland is ons trouwens op die punten al voor geweest. Misschien en hoogstens komen we op het niveau van het buitenland. Op lange termijn vrees ik echter voor het teloorgaan van arbeidsplaatsen in plaats van het creëren van arbeidsplaatsen. Op een gegeven moment zal men in een paar gemeenten wel de indruk hebben dat er een bepaald aantal arbeidsplaatsen bijkomen. Wat er echter verloren gaat in de sector van de kleinhandel en van de zelfstandigen, zal langzaamaan versplinteren en verdampen. Dat zal men niet onmiddellijk vaststellen. Wanneer echter de netto cijfers naast elkaar zullen worden gelegd, ben ik ervan overtuigd dat niet de koopkracht primeert, maar de werkgelegenheid en dat die werkgelegenheid naar beneden zal worden gehaald.
Ik heb de heer Lano nog een uitvoerig pleidooi horen houden. Misschien deed hij dat als vertegenwoordiger van het gild van de kleine zelfstandigen uit West-Vlaanderen. Eerlijk gezegd komt zijn pleidooi me niet geloofwaardig over.
Collega's, veel was reeds gezegd door vorige sprekers. Ik stel dat het half werk is, bijgevolg slecht werk. Misschien krijgt het nog een staartje voor het Arbitragehof. Ik meen te weten dat UNIZO de procedure wil aanhangig maken, omdat die van oordeel is dat er woordbreuk werd gepleegd.
Ik leg nu reeds de bal in het kamp van CD&V die gesteld heeft dat deze wet er niet zal komen, zeker zijnde dat zij tot de regering toetreedt. Indien CD&V in de regering inbreekt, wens ik de partij nu reeds aan haar woord te houden, want de VLD heeft voor de zoveelste keer — niet mijn woorden maar die van UNIZO — woordbreuk gepleegd.
Hert Vlaams Blok zal dus tegen het ontwerp stemmen.

I already put the ball in the camp of CD&V who has stated that this law will not come, being sure that it will join the government. If CD&V breaks into the government, I would like the party to keep its word already, because the VLD has once again – not my words but those of UNIZO – committed a word breach.
Hert Vlaams Blok will therefore vote against the draft.

Monsieur le président, chers collègues, une chose me vexe principalement dans le processus d'élaboration du texte de ce projet de loi modifiant la loi sur les implantations commerciales. Les discussions et les travaux ont été menés à la hussarde, alors que déjà sous la législature précédente, il existait un projet de loi qui ressemblait à celui-ci mais était encore plus mauvais. Sous la précédente législature, nous avions des mois pour en discuter. Le groupe Ecolo-Agalev avait notamment déposé de nombreux amendements et les discussions engagées à cette époque pouvaient laisser supposer une amélioration du projet.
Déjà sous le précédent gouvernement, le premier ministre avait insisté pour que ce projet soit voté rapidement, ce qui a échoué alors. Cette fois, on retrouve le même texte avec quelques améliorations techniques, alors que le contexte laissait espérer des discussions intéressantes et sérieuses, des amendements ayant été déposés tant par l'opposition que par la majorité. Nous avions procédé à des auditions qui avaient mis en évidence des éléments positifs et négatifs. Tout était bien en place pour mener des débats intéressants. Or, de nouveau, nous nous trouvons dans une situation où il faut adopter un projet de loi en renonçant à toute amélioration, même des améliorations techniques et parfois juridiques, pour aboutir finalement à un projet qui ne convainc personne, même si certains se croient obligés de dire qu'ils vont adopter ce projet de loi parce qu'il représente une avancée.
Mon intervention sur le projet sera structurée de la manière suivante. D'une part, la loi actuelle dite "cadenas" n'était pas bonne. Elle amenait des décisions qui, soit ne respectaient pas les communes, soit aboutissaient à des autorisations dont on se demandait sur quels critères elles se basaient. Il fallait à la fois la moderniser, la simplifier et la rendre plus transparente.
Par rapport à cela, il fallait effectivement effectuer un travail.
Le projet de loi en discussion comporte des éléments positifs, le plus important étant, selon moi, l'audition des parties par le Comité national. Je pense notamment à l'audition des communes voisines pour des projets d'implantations commerciales d'envergure. Les délais ont été raccourcis et une simplification des procédures est également prévue. Tous ces éléments sont intéressants.
Le projet qui nous est soumis aujourd'hui fait l'objet principalement de deux grosses critiques de notre part
1. Il n'intègre pas suffisamment, dans les critères, la prise en compte des conséquences sur la mobilité dans la commune qui fait l'objet d'un projet d'implantation ainsi que dans les communes voisines. Cet élément est, selon moi, catastrophique. La ministre dira certainement que, devant tenir compte de la localisation des projets d'implantation, il sera forcément tenu compte de l'influence sur la circulation et la mobilité. Je me permets d'ores et déjà de lui répondre que, pour ma part, je n'en suis pas convaincue. En effet, aujourd'hui, la localisation est déjà prise en compte, pourtant cela n'implique pas forcément la prise en considération de la mobilité. Voilà, je le répète, un des éléments négatifs de ce projet.
2. Si je peux accepter le fait que l'on donne plus d'autonomie et plus de responsabilités aux communes, je partage l'analyse selon laquelle l'ensemble des communes n'a pas la possibilité de pouvoir gérer des dossiers relatifs à l'implantation de commerces de 400 à 1.000 m2, ce qui implique toute une série d'incidences et de conséquences économiques en matière de concurrence entre les commerces et sur l'emploi. Selon moi, je le répète, toutes les communes ne disposent pas des moyens nécessaires pour examiner ces dossiers de manière approfondie. Il faut également savoir qu'il existe une concurrence entre les communes. Outre le fait qu'elles ne sont pas toutes en mesure de prendre des décisions en la matière, chacun sait — je suis originaire de la région de Liège — que certaines communes offrent des conditions plus favorables à une grande surface qui désire s'installer pour l'inciter à ne pas s'implanter sur le territoire de la commune voisine. Quand les conséquences en termes de mobilité dérangent cette dernière plutôt qu'elle-même, c'est encore mieux.
On connaît de tels phénomènes. D'une certaine façon, cela fait partie des mécanismes humains, donc aussi des mécanismes politiques. Je pense qu'une vision supracommunale est nécessaire pour la gestion correcte d'une région et de sous-régions, en lien avec des projets de développement économique, en lien avec les acteurs économiques présents sur ce territoire. Ce projet de loi donne une autonomie totale, sans avoir la garantie que les moyens seront donnés aux communes ni s'assurer d'une vision plus globale.
Pour moi, ces éléments sont les plus négatifs de ce projet. A aucun moment, on n'a pu réellement approfondir le débat parce que les parlementaires de la majorité ont retiré leurs amendements et que la ministre a refusé des amendements, sauf un petit amendement que j'ai introduit - qui a été réduit à sa portion congrue, mais j'en suis quand même satisfaite -, tendant à imposer, pour que les communes voisines puissent demander à être entendues, qu'elles soient informées du projet et que la commune qui introduit le projet d'implantation avertisse ses voisines de son intention.
Ainsi, en commission, nous nous sommes retrouvés comme deux ronds-de-flanc, sans pouvoir confronter nos arguments. Ce qui m'énerve dans ce débat, c'est qu'on dise que l'ancienne loi, dite loicadenas, n'a pas permis de sauvegarder l'ensemble des petits commerces existants, de développer des structures commerciales plus importantes là où cela aurait dû se faire ou, au contraire, a permis des excès, et qu'il faut donc arrêter de critiquer le nouveau projet mis sur la table! Comme s'il était interdit de quitter un vieux projet qui n'est plus bon pour le remplacer par un meilleur. Le fait de s'opposer à un projet ne signifie pas pour autant qu'on veuille garder le statu quo!
Je pense aussi que, dans la réflexion et la discussion, il aurait été intéressant d'examiner les choses de manière plus approfondie et plus globale. Les structures commerciales et les modes de production comme de consommation changent. C'est vrai que beaucoup de petits commerces ou de commerces moyens disparaissent aujourd'hui, mais ce n'est pas du tout en raison de la loi-cadenas. Et ce n'est pas une autre loi qui pourra les sauver. Simplement, certains commerçants n'ont peut-être pas ou plus la capacité de s'adapter à des évolutions de marché.
Puisqu'on parle d'une loi sur les implantations commerciales avec la volonté d'aboutir à un tissu commercial diversifié, il aurait été intéressant de se demander ce qu'on pouvait faire pour encourager des lieux de commerce diversifiés et étudier les possibilités permettant d'aboutir à une politique de développement et d'évolution des pratiques commerciales.
Par ailleurs, je ne veux pas non plus défendre à 100% l'ensemble des associations des commerçants qui, parfois, se sentent abusivement menacés. J'ai pu le constater récemment à Liège. Je raconte cette anecdote pour démontrer que je ne suis pas une "anti-Décathlon" à 100%. Dans un quartier abandonné par les commerces, Décathlon a introduit un projet d'implantation. L'association de commerçants de Liège et du quartier s'y est opposée avec beaucoup de virulence, craignant que les commerces d'articles de sport doivent fermer leurs portes après cette installation. Dans la négociation, il a été mis en évidence que la clientèle visée n'était pas la même, que les petits commerçants avaient la possibilité d'orienter leur commerce de manière plus spécifique. En réalité, ce Décathlon installé à Liège a ramené la vie dans le quartier et a permis l'ouverture, dans la même zone, d'autres petits commerces de type horeca.
J'estime que cette matière peut être abordée avec un esprit ouvert qui ne se limite pas à la défense des "petits" ou des "grands" et en voulant les opposer. On peut l'examiner dans une optique de diversité commerciale. Cela signifie — ce point est particulièrement important pour les écologistes — une diversité de produits, une diversité de modes de production et une diversité de la qualité des produits mis sur le marché.
Quand j'observe la manière dont ces politiques sont parfois gérées, je crains réellement qu'en privilégiant les implantations commerciales de moyennes et grandes surfaces, sans prendre en compte la globalité du territoire, on se retrouve avec des structures commerciales drainant des produits uniformes — on trouve la même chose quasiment dans tous les magasins —, ne tenant pas compte des modes de production et de leur lieu de production.
D'une part, on vote ici des règles et des résolutions demandant le respect du commerce équitable; on demande que des règles soient élaborées sur les qualités et les normes de produits. Mais, d'autre part, on facilite parfois l'installation de magasins vendant des produits ne correspondant pas du tout à ces critères mais qui peuvent être vendus moins chers et donner ainsi l'illusion que les intérêts du consommateur sont pris en compte.
Pour moi, la question de l'emploi reste un mystère. Il est vrai qu'une grande surface engage forcément plus de personnel qu'un petit commerce ou qu'une PME. Mais on sait aussi que, lorsque cette implantation se fait mal, sans tenir compte de la structure commerciale existant dans la commune et dans les communes voisines, on crée des conditions pour que d'autres commerces ou PME ferment leurs portes et donc, effectivement, on perd des emplois. Il est toujours difficile de savoir ce qui, finalement, a été le plus positif. A-t-on créé des emplois ou en a-t-on supprimé? Cette réflexion-là doit pouvoir être faite pour chaque situation particulière. On doit pouvoir déterminer à quel type de besoins répond l'existence d'un commerce et à quel type de travailleurs on fait appel lorsqu'on défend tel ou tel projet.
Je suis particulièrement frustrée vu les discussions et le résultat du travail. En effet, j'espérais que l'on aurait pu avoir une vraie discussion, une vraie innovation, la vraie création d'un outil qui aurait permis d'avoir une vision de développement économique global et qui aurait intégré la défense de la diversité des lieux de vente, de la diversité et de la qualité des produits, d'une gestion de mobilité, d'un respect de la qualité de vie et d'un maintien de vie économique, sociale et culturelle dans les villes et les villages car la présence de commerces, c'est cela aussi!
Je suis d'autant plus frustrée qu'à Liège, par exemple, nous avons entamé une politique sur la sécurité dans les villes à partir des femmes; les commerçants nous disent d'ailleurs que les femmes sont les premiers acheteurs dans les commerces. Tous les plans qui existent en Europe mais aussi aux Etats-Unis et au Canada pour essayer de créer de la sécurité dans les villes de manière positive intègrent les femmes et les commerçants, ces derniers étant à la fois des acteurs qui peuvent être des relais pour les personnes se sentant en insécurité, des lieux qui créent la sécurité parce qu'ils créent le passage et la vie, mais également des personnes qui, le soir, quand il n'y a plus d'habitants, grâce à leurs vitrines et à leurs éclairages économiques, peuvent maintenir une convivialité et une nouvelle assurance dans les villes.
C'est tout cela que j'avais envie d'évoquer autour de ce projet de loi et c'est de tout cela dont j'ai été privée.
En conclusion, en réfléchissant à tout cela, quand le gouvernement nous dit qu'il peut prendre en compte toutes les dimensions du développement durable sans les Verts, je me rends compte que ce n'est pas vrai.

Mr. Speaker, dear colleagues, one thing is mainly in the process of drafting the text of this bill amending the Law on Commercial Settlements. Discussions and work were carried out at the hussard, while already under the previous legislature, there was a bill that resembled this one but was even worse. During the previous legislature, we had months to discuss this. The Ecolo-Agalev group, in particular, had submitted numerous amendments and the discussions initiated at that time could suggest an improvement of the project.
Already under the previous government, the prime minister had insisted that this project be voted quickly, which then failed. This time, we find the same text with some technical improvements, while the context gave hope for interesting and serious discussions, amendments having been submitted both by the opposition and by the majority. We had conducted hearings that highlighted both positive and negative aspects. Everything was in place for an interesting discussion. Now, again, we find ourselves in a situation where it is necessary to adopt a bill by renouncing any improvement, even technical and sometimes legal improvements, to eventually result in a project that convinces no one, even though some feel obliged to say that they will adopt this bill because it represents an advance.
My intervention on the project will be structured as follows. On the one hand, the current law called "cadenas" was not good. It brought about decisions that either did not respect the communes, or resulted in authorizations of which one wondered on what criteria they were based. It had to be modernized, simplified and made more transparent.
In this regard, there was indeed a job to be done.
The bill under discussion contains positive elements, the most important being, in my opinion, the hearing of the parties by the National Committee. I think in particular of the hearing of neighboring municipalities for large-scale commercial settlement projects. The deadlines have been shortened and procedures are also planned to be simplified. All these elements are interesting.
The project presented to us today is mainly the subject of two major criticisms on our part.
1 of 1. It does not sufficiently include, in the criteria, the consideration of the consequences on mobility in the municipality that is the subject of a project of settlement as well as in neighboring municipalities. This element is, in my opinion, catastrophic. The Minister will ⁇ say that, before taking into account the location of the deployment projects, it will necessarily be taken into account the influence on traffic and mobility. I now allow myself to answer him that, for my part, I am not convinced of it. Indeed, nowadays, location is already taken into account, but this does not necessarily imply mobility. This, I repeat, is one of the negative aspects of this project.
2 of 2. If I can accept the fact that more autonomy and more responsibilities are given to municipalities, I share the analysis that all municipalities do not have the possibility to manage files relating to the establishment of ⁇ of 400 to 1,000 m2, which involves a whole series of impacts and economic consequences in terms of competition between ⁇ and on employment. In my opinion, I repeat, not all municipalities have the necessary means to examine these files in depth. It should also be noted that there is competition between municipalities. In addition to the fact that not all of them are able to make decisions in this matter, everyone knows — I am from the Liège region — that some municipalities offer more favourable conditions for a large area that wishes to settle in order to encourage it not to settle on the territory of the neighboring municipality. When the consequences in terms of mobility disturb the latter rather than itself, it is even better.
We know of such phenomena. In a way, it is part of human mechanisms, therefore also political mechanisms. I think that a supra-communal vision is necessary for the correct management of a region and sub-regions, in connection with projects of economic development, in connection with the economic actors present in that territory. This bill gives total autonomy, without having the guarantee that the resources will be given to the communes or ensuring a more comprehensive vision.
For me, these are the most negative elements of this project. At no time was it really possible to deepen the debate because the parliamentarians of the majority withdrew their amendments and the minister refused amendments, except for a small amendment that I introduced – which was reduced to its congruent portion, but I am still satisfied with it – tending to impose, so that neighboring municipalities can request to be heard, that they are informed of the project and that the municipality that introduces the project of installation warns its neighbors of its intention.
Thus, in commission, we found ourselves as two round-of-flanks, without being able to confront our arguments. What annoys me in this debate is that it is said that the old law, called loicadenas, did not help to safeguard the whole of existing small ⁇ , to develop larger commercial structures where it should have been done or, on the contrary, allowed excesses, and that therefore we must stop criticizing the new project put on the table! As if it was forbidden to leave an old project that is no longer good to replace it with a better one. The fact that you oppose a project does not mean that you want to keep the status quo!
I also think that in the reflection and discussion, it would have been interesting to look at things in a deeper and more comprehensive way. Commercial structures and modes of production and consumption are changing. It is true that many small or medium-sized shops are disappearing today, but this is not at all due to the law-cadenas. And there is no other law that can save them. Simply put, some traders may not or may not have the ability to adapt to market changes.
Since we are talking about a law on commercial settlements with the desire to result in a diversified trade tissue, it would have been interesting to wonder what can be done to encourage diversified trade places and to study the possibilities for leading to a policy of development and evolution of commercial practices.
Furthermore, I also do not want to defend 100% all the associations of traders who, sometimes, feel abusively threatened. I saw it recently in Liège. I’m telling this anecdote to prove that I’m not a 100% anti-Decathlon. In a neighborhood abandoned by shops, Decathlon introduced a deployment project. The association of merchants of Liège and the neighborhood opposed it with great virulence, fearing that sports goods stores should close their doors after this installation. In the negotiation, it was highlighted that the target customer base was not the same, that small merchants had the opportunity to orient their trade in a more specific way. In fact, this Decathlon installed in Liège brought life back to the neighborhood and allowed the opening, in the same area, other small shops of horeca type.
I believe that this matter can be approached with an open mind that is not limited to defending the "small" or "big" and wanting to oppose them. It can be viewed from a perspective of commercial diversity. This means – this point is ⁇ important for environmentalists – a diversity of products, a diversity of production modes and a diversity of the quality of products placed on the market.
When I observe how these policies are sometimes managed, I really fear that by privileging the commercial settlements of medium and large surfaces, without taking into account the totality of the territory, we find ourselves with commercial structures draining uniform products — we find the same thing almost in all stores — without taking into account the modes of production and their place of production.
On the one hand, there are rules and resolutions calling for respect for fair trade; there are rules for product qualities and standards. But, on the other hand, it is sometimes facilitated the installation of stores selling products that do not meet these criteria at all but that can be sold cheaper and thus give the illusion that the interests of the consumer are taken into account.
The issue of employment remains a mystery. It is true that a large area necessarily employs more personnel than a small business or a SME. But we also know that when this settlement is bad, without taking into account the commercial structure existing in the municipality and in the neighboring municipalities, conditions are created for other ⁇ or SMEs to close their doors and therefore, effectively, jobs are lost. It is always difficult to know what, in the end, was the most positive. Have jobs been created or eliminated? This reflection must be able to be made for each particular situation. One must be able to determine what kind of needs the existence of a trade meets and what kind of workers are called upon when defending this or that project.
I am ⁇ frustrated with the discussions and the outcome of the work. In fact, I hoped that we could have a real discussion, a real innovation, the real creation of a tool that would have allowed to have a vision of global economic development and that would have integrated the defense of the diversity of places of sale, the diversity and the quality of products, of a management of mobility, of a respect for the quality of life and a maintenance of economic, social and cultural life in the cities and villages because the presence of shops, that is also!
I am all the more frustrated that in Liège, for example, we started a policy on safety in cities from women; merchants tell us that women are the first buyers in shops. All the plans that exist in Europe but also in the United States and Canada to try to create security in cities in a positive way integrate women and merchants, the latter being both actors who can be relays for people who feel insecure, places that create security because they create the passage and life, but also people who, in the evening, when there are no more inhabitants, thanks to their vitrines and their economic lighting, can maintain conviviality and a new insurance in the cities.

In conclusion, reflecting on all this, when the government tells us that it can take into account all dimensions of sustainable development without the Greens, I realize that this is not true.

Mijnheer de voorzitter, ik heb uw onuitgesproken wens begrepen. Mevrouw de minister, collega's, ik had eigenlijk niet meer de bedoeling nog het woord te voeren. Vermits sommigen het zonlicht op klaarlichte dag nog loochenen over de inleiding tot de bespreking, de indiening van het ontwerp, het sudderen ervan, de mislukte eerste bespreking enzovoort, wilde ik toch even een paar precieze feiten in herinnering brengen.
Het ontwerp is inderdaad, mevrouw Pieters, hangende in de commissie sinds maart van dit jaar. Dat ontwerp is lange tijd onbesproken gebleven om duistere redenen. In elk geval heeft een eerste bespreking ons geleerd dat vooreerst op de banken van MRcollega's minstens twijfel bestond over de opportuniteit van de tekst die voorlag. Het was geen toeval dat collega Jeholet, een man die in onze commissie zeer behoorlijk gefunctioneerd heeft, een reeks amendementen indiende die juridische correcties voorstonden maar in hoofdorde de geest, de filosofie van het ontwerp wilden sturen. De MR bleek hierbij in elk geval meer zorg te hebben voor de effecten van dit wetsontwerp over de grote handelsvestigingen op de kmo's en de kleine zelfstandigen dan de VLD. Dat was de filosofie van waaruit de heer Jeholet opereerde, het is jammer dat ze niet volgehouden is. U zal mij niet tegenspreken, collega De Meyer, als ik mij even tot u mag richten, wanneer ik luisterend naar uw overwegingen, vragen en suggestie minstens twijfel bespeurde over de opportuniteit van deze tekst.
Het is in elk geval waar dat men in de eerste periode niet in staat bleek te zijn om de politieke families in voldoende getale te mobiliseren om de tekst te kunnen bespreken. Ik wilde even in herinnering brengen dat er lange tijd geen eensgezindheid was in de meerderheid om hier de hand aan de ploeg te slaan. Dat is op een bepaald ogenblik plots veranderd.
Dat neemt niet weg, neem ik aan, dat er heel veel terughoudendheid blijft bestaan, collega's van de SP. Van de PS ben ik iets minder zeker, maar zeker is dat ook bij de MR zo.
Mijnheer de voorzitter, het zal ook niet de eerste keer zijn in de loop van deze legislatuur dat een meerderheid van de meerderheid eigenlijk niet akkoord gaat met de tekst, maar hem toch goedkeurt. Daar zijn mooie voorbeelden van. Er is het voorbeeld, mijnheer de voorzitter, van de kieswetgeving, waarvan u eerst had gezworen dat die niet door de beugel kon. Ik heb het over de invoering van de provinciale kiesdistricten. Toen het hier op tafel lag, heeft u het mee goedgekeurd, waarbij u ook zeer nadrukkelijk heeft laten verstaan dat een goed deel van de eenvoudige parlementsleden — welke dat dan zijn, weet ik niet — niet akkoord gingen maar nu eenmaal de familie moesten volgen.
Mijnheer de voorzitter, het doet een beetje pijn om dan na de verkiezingen te moeten horen hoe dit systeem inderdaad op geen enkele manier deugde. Ik dacht dat verantwoordelijke parlementairen ook de verantwoordelijkheid moeten opnemen voor wat ze mee beslist hebben, a fortiori voor wat ze mee goedgekeurd hebben. Het geven van commentaar achteraf is voor in het café eenmaal de zaken hun beloop hebben gekend. Hier hebben wij echter een andere verantwoordelijkheid. Het is mijn innige overtuiging op basis van heel concrete ervaringen dat ook in dit geval een meerderheid binnen de meerderheid eigenlijk niet akkoord gaat of minstens twijfels heeft.
Ik zwijg nog over het feit — dat moet ik per se vermelden — dat dit wetsontwerp lange tijd voor de bevoegde minister niet hoogdringend was. Zij heeft met de voorzitter van de commissie de afspraak gemaakt dat liefst en bij voorrang werk zou worden gemaakt van de wet op de auteursrechten. Voor haar was dit ontwerp helemaal niet dringend. Dientengevolge hoort men als plichtsgetrouw voorzitter van een commissie — als ik dat even van mezelf mag zeggen — af en toe een aantal afspraken te maken over de prioriteit van de punten die moeten worden besproken.
Een goede veertien dagen geleden, mijnheer de voorzitter, na ruggespraak met de minister die gezegd had dat voor haar de auteursrechten een absolute prioriteit waren, na de commissie geconsulteerd te hebben en te hebben gehoord dat iedereen er akkoord mee ging om dat ontwerp inzake auteursrechten eerst af te handelen, kwamen wij aan de dag waarop die agenda in de praktijk moest worden omgezet. Toen moesten wij meemaken dat inderdaad tussen de soep en de patatten, tussen de vragen in, plots de heer Lano van de VLD het woord nam en zei: wij willen per se een agendawijziging. Een goede verstaander heeft natuurlijk maar een half woord nodig: als de meerderheid iets wil, kan men proberen daar inhoudelijke argumenten tegenover te stellen, maar dan moet men het debat ook mogelijk maken.
Collega's, dat debat is in de commissie niet mogelijk geweest. De tekst moest en zou zo snel mogelijk goedgekeurd worden. De oorspronkelijke timing was trouwens dat hij vorige week hier in de plenaire vergadering moest goedgekeurd worden en dat hij nog deze week in de Senaat moest worden goedgekeurd. De grote vraag is: waarom plots die haast? Heeft iemand daarvoor een verklaring? Wat zijn de echte argumenten om tot deze acceleratie te komen? Men heeft in de commissie gezegd, collega's, dat er een akkoord was tussen de leden van de meerderheid van die commissie. Ik ben zo vrij te zeggen dat dit niet waar is. Trouwens, toen ik de commissieleden in de ogen heb gekeken — vanuit de voorzitterszetel kan men dat iets gemakkelijker — heb ik wel degelijk vastgesteld dat daarover geen akkoord was gesloten tussen de fracties van de meerderheid, maar dat er wel een zeer nadrukkelijke richtlijn was vanwege de eerste minister. Niemand moet het ons kwalijk nemen dat wij dan de vraag stellen waarom dat eigenlijk zo is. Waarom is dat wetsontwerp plots zo enorm belangrijk geworden? Ik ga daar niet veel woorden meer aan besteden — of eigenlijk moet ik zeggen: aan vuil maken, want dat zou een gepaster uitdrukking zijn in deze. Mevrouw Pieters en de heer Schoofs hebben voldoende de reële argumenten aangehaald. Er is onder meer Décathlon. Dat is de schrijver van de tekst. Durft u te zeggen dat het niet waar is? De tekst is van Décathlon. Hier het zonlicht komen loochenen hoeft dus niet.
Wij proberen te luisteren naar wat er gezegd wordt en te lezen wat er gepubliceerd wordt. Vraag is of dat in de feiten waar zal zijn. Zullen de systemen van besluitvorming goed functioneren? Mevrouw de minister, u hebt daartoe niet op alle punten de waarborgen ingebouwd. Het advies van de Raad van State op de initiële tekst was voldoende duidelijk. U vergeet dat de basis op grond waarvan het college van burgemeester en schepenen de afweging moet maken om een vestiging al dan niet toe te laten, in de oorspronkelijke tekst stond.
U hebt ze er nadien, u totaal ten onrechte beroepend op het advies van de Raad van State, uitgehaald. Dat beroep op de Raad van State is ten onrechte omdat de negatieve kritiek van de Raad van State geen betrekking had op de argumenten, de normen, de wegingen, de criteria op grond waarvan de beslissing moet worden genomen, maar wel gebaseerd op de overweging dat aan de colleges geen motivatieplicht moet worden opgelegd, want die hebben ze al. Er geldt een algemene, wettelijke verplichting die de gemeentelijke organen ertoe houdt om, als zij een beslissing nemen, die ook te motiveren.
Mevrouw de minister, u hebt gezegd — ik hoop dat het zo in het verslag staat, want ik heb het niet meer nagelezen — dat hoe dan ook van de colleges verwacht wordt dat zij dezelfde criteria zullen gebruiken in de motivering van een beslissing als die die gebruikt moeten worden door de commissie, het sociaal-economisch comité, dat terzake een advies moet uitbrengen. Dat staat in elk geval niet in de tekst.
Als het uw oprechte mening is, wat ik tot nader order wil aannemen, dat de weging op grond daarvan moet gebeuren, wat belet u dan, tenzij de koppigheid gebaseerd op het feit dat het amendement van CD&V was, om dat ook in de tekst in te schrijven? U zegt dat het in de wet staat, en meer in het bijzonder met betrekking tot de tekst over het sociaal-economisch comité. Dat klopt.
Collega's, de meesten onder u hebben wel iets te maken met het lokale niveau, het gemeentelijke niveau. U weet dat ook daar voor sommige besluitvormingsprocedures adviezen ingewonnen moeten worden. Wie een bouwvergunning wil, moet in een belangrijk aantal gevallen, vooral in een agrarische gemeente, een voorafgaand advies krijgen van Stedenbouw. Stedenbouw moet vaste criteria hanteren om dat advies tot stand te brengen en te bezorgen aan de gemeenten. Wie durft staande te houden dat de gemeenten, in casu de colleges van burgemeester en schepenen, diezelfde criteria moeten hanteren wanneer zij uiteindelijk de bouwvergunning toestaan of weigeren?
Dat is niet zo. Mevrouw de minister, als u dat wilt, moet u het in de tekst stipuleren. Op dat punt zou u wel voor een aantal verrassingen kunnen komen te staan. Ik blijf erbij dat de tekst op andere punten van een vrij bedenkelijke juridische kwaliteit is. Mevrouw Pieters, ik vrees inderdaad dat er nog een paar programmawetten nodig zullen zijn om hier en daar de nodige technische en andere bijsturingen te doen.
Ten tweede, ik richt mij in het bijzonder tot de collega's die in Vlaanderen worden verkozen. Ik hoor hier al vijftien tot twintig jaar zeggen dat de motor van de economische ontwikkeling in Vlaanderen onze KMO's zijn. Niet de grote bedrijven, maar wel de kleine en middelgrote ondernemingen zijn de motor. Niemand spreekt mij tegen. Welnu, aan al de kleine en middelgrote ondernemingen wordt een slechte dienst bewezen. U kiest nadrukkelijk voor de grote handelsvestigingen, dit ten nadele van de kleintjes. Wie dat loochent, loochent het zonlicht.
Collega's van de VLD, ik wil u geruststellen. De goedkeuring van die tekst, aangenomen dat hij niettegenstaande zijn juridische mankementen ook door de Senaat geraakt, zal in definitieve vorm geen bloedbad aanrichten. Daarin kunt u gerust zijn. Hij zal er wel toe leiden dat hier en daar aan een verhoogd tempo kleine handelszaken en KMO's zullen verdwijnen. Men zal het nauwelijks merken. De mensen die daarachter zitten, hebben immers ook nog het probleem van een zekere fierheid. Zij lopen niet met hun problemen te koop en zullen dus in stilte verdwijnen. Dat zal de grote inbreng zijn van degenen, en ik richt mij hierbij in het bijzonder tot de VLD'ers in deze assemblee, die beweren de KMO's en de zelfstandigen een warm hart toe te dragen. Ik wens u veel succes. Als u echter eerlijk bent, kunt u niet anders dan beamen dat de kleine en middelgrote ondernemingen het in meer of mindere mate moeilijker zullen hebben om zich staande te houden tegenover de grote handelszaken.
Ik zwijg dan nog over een aantal neveneffecten. Ik moet daarover niet veel meer zeggen. Ik ben nogal geneigd om de mensen die de sectoren goed kennen te geloven als het gaat over de tewerkstelling omdat ze het beter kennen wellicht of in elk geval beter dan een parlementair als ik. Ik ga ervan uit dat als zij daarover iets zeggen, en dat hebben ze gedaan tijdens de hoorzitting, ze toch wel weten waarover ze spreken.
Mevrouw Gerkens, u hebt volkomen gelijk. Wij zijn het eens over de stadskernversterking. Men meent nu vanuit de federale en de Vlaamse overheid een grootstedenbeleid te moeten voeren om de kernen leefbaar te houden. U kan toch niet anders dan zeggen dat dit daarop volkomen haaks staat. Men zegt hier de wacht aan aan de handelszaken die zich nog proberen staande te houden in stedelijke agglomeraties of men maakt het ze in elk geval moeilijker.
Mevrouw Gerkens, het mobiliteitsprobleem is hier nog niet besproken, maar wel in de commissie. Collega's, u weet het toch allemaal. Men moedigt eerst de mensen aan om opnieuw in de stad te gaan wonen. Men heeft goede redenen om dit soort beleid te voeren. De aantrekkelijkheid van de grote stad is dat men daar alles bij de hand heeft of totnogtoe nog heeft. Ik vrees echter dat dit door deze wet eerder zal verminderen dan versterkt zal worden. De kleine en middelgrote winkels in de grootsteden zullen minder aanbod hebben. Mijnheer De Padt, u zegt dat het niet waar is. Het is wel waar.
Collega Lenssen heeft het voorbeeld van Kortrijk ten tonele gevoerd. Mijnheer de voorzitter, ik heb het voordeel gehad om een aantal jaren les te geven in Kortrijk. Ik heb die stad leren kennen. Die stad heeft een tijdlang een zeer levendig niet alleen middenstandsleven, maar ook levendige "shoppingstreets" gehad. Het was een van de eerste steden waar men die benaming heeft gebruikt. De stad bruiste van activiteit en dynamiek.
Het is in de loop van de jongste jaren anders geworden. Ik hoop dat men inderdaad het tij kan doen keren, mevrouw Pieters. Men doet daarvoor bewust inspanningen. De federale overheid maakt het echter netto veeleer iets moeilijker. Als Kortrijk wat zijn shopping streets betreft achteruit is geboerd, houdt dit verband met de oprichting van een aantal groothandelszaken in de periferie in de stad. Tijdens een van de eerste besprekingen in de commissie heeft de heer Lenssen een amendement ingediend, mede ondertekend door zowat alle politieke families, zeker van Vlaamse zijde. Men wou deze aangelegenheid regionaliseren. Het Gewest moest, zeker voor de grote handelsvestigingen, een serieuze zeggingskracht verkrijgen. In samenspraak heeft de commissie dan beslist om het advies van de Raad van State te vragen. De Raad van State heeft gezegd dat dit niet via deze tekst kon worden gerealiseerd, wat natuurlijk juist is. Het is immers een van de vaste regels dat in het kader van een gewone wet niet via amendering een wijziging kan worden aangebracht aan de bijzondere wet, omdat daarvoor een bijzondere meerderheid vereist is. Het advies van de Raad van State kwam terug, maar viel net samen met het moment waarop de heer Verhofstadt zijn instructies had gegeven. Het amendement ging dus terug naar af. Dat is een eerste vaststelling.
Mevrouw Pieters, aan de andere kant van de straat, zoals u het noemt, werd ondertussen al onderhandeld op basis van een tekst, waarin de regionalisering is ingeschreven. Uw onderhandelaars hebben wellicht nu — of zullen dat binnen afzienbare tijd doen — hun goedkeuring gegeven aan die tekst. Zij gaan er dus mee akkoord dat op korte termijn een en ander moet worden bijgestuurd op het vlak van de staatshervorming en de bevoegdheidsverdeling. Dat is zo, als ik ze hoor spreken, want de communautaire problemen zullen zij uiteraard geen vier jaar voor zich uit kunnen schuiven. De bevolking zou het ons trouwens bijzonder kwalijk nemen, wanneer alle traditionele families dure eden zweren over het feit dat een en ander op het vlak van de staatshervorming en de bevoegdheidsverdeling moet worden bijgestuurd, om dienvolgens vier jaar te wachten.
Dat kunnen wij ons niet veroorloven. Dus is het bijzonder schizofreen om snel bij het eerste teken de amendementen in te trekken in de plaats van, zoals wij dat gedaan hebben met een amendement van mevrouw Pieters, te zoeken naar een alternatieve piste. Alles werd meteen opgeborgen. Dit moest volgens de richtlijn van Verhofstadt nu, op korte termijn, worden goedgekeurd want er werd een en ander aan de vrienden beloofd, nietwaar? Dit is ook voor een stuk de oorzaak van het onbegrip bij de bevolking, met betrekking tot het gevoerde beleid. De mensen verstaan het niet dat men hier wit zegt en aan de andere kant van de straat zwart. U hebt toch allemaal gezegd dat de mensen het verschil tussen die niveaus niet kennen. Naar aanleiding van de verkiezing heb ik dat overal, vooral vanwege de meerderheid, horen beweren. Tot op grote hoogte is dat waar. De vraag is wie daarvoor aansprakelijk is. Men klutst alles door elkaar qua kandidaturen en mandaten enzovoort en dan veronderstelt men nog dat de kiezer het verschil ertussen kent. Daarover zal ik echter niet verder uitweiden.
Mijn vraag is: waarom die haast in godsnaam? Er was toch wel even de tijd om te zien of we deze kwestie niet konden regelen via een overdracht van bevoegdheid — waarvan ik denk dat men daar niets op tegen heeft ten zuiden van de taalgrens. Wat belet u dan in godsnaam om op dat punt door te gaan? Waarom? U verwijst naar de grotere autonomie van de gemeenten.
