Mijnheer de voorzitter, mevrouw de minister, mijnheer de minister, collega's, de commissie voor de Infrastructuur heeft in twee gewone vergaderingen en een aanvullende vergadering na terugzending door de plenaire vergadering, de onder haar bevoegdheid ressorterende artikelen van het wetsontwerp besproken. Voor het luik BIAC, Belgocontrol en Infrabel, onder voogdij van minister Vande Lanotte, betrof het de artikelen 36 tot 38. Ze hadden betrekking op de overdracht van het Pensioenfonds van BIAC en de herstructurering van de pensioenverplichtingen van Belgocontrol. De koninklijke besluiten ter uitvoering ervan worden bekrachtigd. De artikelen 39 tot 40 van het ontwerp slaan op de deconsolidatie van Infrabel ingevolge een opmerking van het Instituut voor de Nationale Rekeningen. Er waren amendementen ter verfijning. Collega Van den Bergh stelde de vraag of over het eerste amendement het advies van de Raad van State was ingewonnen, waarop de minister bevestigend antwoordde.
Voor het luik spoorvervoer en luchtvaart onder de verantwoordelijkheid van minister Landuyt, wat de artikelen 41 tot 48 betrof, duidde de minister dat de regulerende overheid voor het spoorvervoer Infrabel is. Voor het luchtverkeer zijn dat BIAC op economisch vlak en Belgocontrol — zo vernamen we — op technisch vlak. Door deze entiteiten de mogelijkheid te geven retributies te ontvangen wordt voorzien in de financiering van de door hen verzorgde controle op de naleving van de regelgeving terzake. Ik stelde toen aangaande de artikelen met betrekking tot luchtvaart, vragen naar de taken die de entiteiten zouden toebedeeld worden, vooral ook over de verhouding tussen de entiteiten, over de manier waarop de minister de onafhankelijkheid van de regulatoren zou garanderen, over het geplande budget en personeel en over de opmerkingen van de Raad van State. Collega Lavaux van het cdH wenste te vernemen onder welke overheidsdienst de in de artikelen bepaalde regulatoren zouden ressorteren, hoe de leden zouden worden gerekruteerd, wat het geplande budget was, hoe hun onafhankelijkheid zou worden gegarandeerd en of de instantie al dan niet overtredingen zou kunnen verbaliseren. De minister antwoordde hierop dat de onafhankelijkheid van de regulerende overheden zou worden gegarandeerd door de wijze waarop ze door de gebruikers gefinancierd worden. Hij was het niet eens met de analyse dat het om een belasting zou gaan, gezien de heffing in verhouding zou staan tot een bepaald gebruik.
Daarmee was ik het niet eens, mee gesteund door de opmerkingen van de Raad van State. De minister verwees ook naar het Fonds voor de Universele Dienstverlening en stelde dat de werkingskosten en eventuele extra taken het voorwerp zouden moeten uitmaken van het beheerscontract met de Belgische Staat. Ten slotte wees hij erop dat het in de memorie vastgestelde bedrag van 175.000 euro berekend werd op grond van wat de economische regulering op de luchthaven van Brussel-Nationaal zal kosten. Dat zal dan moeten worden teruggevorderd van de sector. Dan is er het gedeelte BIPT, onder verantwoordelijkheid van minister Verwilghen. Het gaat hier over de artikelen 65 en 66 van het ontwerp. Er is een arrest geweest van 14 juli 2004 van het Arbitragehof, dat stelt dat op gebied van de elektronische communicatie er een technologische convergentie optreedt tussen telecommunicatie, een federale bevoegdheid, enerzijds en anderzijds, media, een gemeenschapsbevoegdheid. Daardoor dringt overleg met de deelentiteiten zich op. De nieuwe invulling van artikel 14 van de wet op de regulator zal gebeuren via het ontwerp, dat zegt dat het BIPT zijn taken inzake de overlappende bevoegdheden pas kan uitvoeren na het sluiten van een samenwerkingsakkoord. Welnu, tot 31 december 2005 kan het BIPT zijn bevoegdheden zonder samenwerkingsakkoord uitoefenen. Nadien is het een noodzaak.
Collega Bellot van de MR vroeg zich af of het samenwerkingsakkoord met de Vlaamse regering al een feit was. Ik wees toen zelf op de eis van Vlaanderen om de goedkeuring inzake het samenwerkingsakkoord te koppelen aan de mogelijkheid van het BIPT om effectief als etherpolitie tegen de stoorzenders op te treden. De minister wees erop dat er een akkoord is met alle Gemeenschappen aangaande de tekst van het samenwerkingsakkoord en dat het noodzakelijk is dat de Gemeenschappen tot een akkoord zouden komen omtrent de coördinatie van de frequentieplannen, wil het BIPT effectief zijn taak als etherpolitieagent kunnen uitoefenen. De minister zegt dat het BIPT reeds kan optreden tegen stoorzenders op basis van de telecommunicatiewet, zonder evenwel uitspraak te doen over de toegekende vergunningen. Ook moet nog worden onderzocht wie de taak van ombudsdienst voor omroepactiviteiten via de kabel, altijd al een van mijn bezorgdheden, op zich kan nemen.
Wat de bijsturing van de wet op de elektronische communicatie betreft inzake het deel van minister Van den Bossche, gaat het over artikel 68 van het ontwerp. Het gaat over een aanvulling van artikel 107 van de zogenaamde Telecomwet. Deze wet moet worden aangevuld met een lid dat het mogelijk maakt pestoproepen naar nooddiensten waarvan de nummers gratis toegankelijk zijn te bestrijden. Het gaat om de teleonthaalcentra, Child Focus, het Antigifcentrum en de Zelfmoordpreventie. Deze nummers ontvangen een groot percentage kwaadwillige oproepen van kinderen, perverten, grappenmakers die de lijnen overbelasten en de vrijwilligers demotiveren.
In de commissie gaf ik te kennen dat de doelstellingen van de minister zeker te steunen waren maar ik stelde wel vragen bij de keuze voor een wetswijziging in plaats van een koninklijk besluit zoals eerder aangekondigd. Ik vroeg me af of er terzake een nieuw advies was van de Privacycommissie vermits deze instantie in het verleden met uitzondering voor het Antigifcentrum voor de identificatie van de oproepende lijn door de bovenvermelde diensten een negatief advies had gegeven. Ik stelde ook de vraag waarom in de lijst de Kindertelefoondienst niet was opgenomen vermits er in het verleden sprake van was geweest. Ik vroeg me eveneens af wat de meerwaarde is van dit nieuwe lid ten opzichte van de reeds bestaande procedures ter blokkering van pesttelefoons via het gerecht en de ombudsdienst. Ik heb eveneens een reeks informatief-technische vragen gesteld en vragen van maatschappelijke aard. Hoe zal de anonimiteit worden gegarandeerd of misbruik worden uitgesloten? Waarom wordt er niet automatisch doorgeschakeld van de pesttelefoons naar de nooddiensten die wel identificatie mogen doen? Hoe zullen al deze nummers voor iedereen toegankelijk worden gemaakt zonder onderscheid te maken tussen pestbellers die in bepaalde gezinssettings kunnen voorkomen en misbruiken zonder medeweten van andere gezinsleden indien er van eenzelfde telefoonlijn wordt gebruikgemaakt binnen een gezin.
Op de hele reeks vragen antwoordde de minister dat het nooit de bedoeling was geweest de regeling via KB te verankeren. Wel zal er een KB worden uitgevaardigd betreffende de identificatie van de oproepers. Minister Van den Bossche stelde dat het advies van de Privacycommissie nooit toegespitst is geweest op het probleem van de kwaadwillige oproepen. De minister gaf aan akkoord te gaan met de door mij voorgestelde toevoeging van de Kindertelefoondiensten aan de lijst in het wetsontwerp.
De minister achtte de doorschakeling van de pestoproepen naar de reeds bestaande noodnummers die over een identificatiemogelijkheid beschikken, niet aangewezen vanwege de vrees ze te overbelasten.
Ik diende dan ook een amendement in verband met de toevoeging van de kindertelefoondiensten in. Dat werd aanvaard.
Ten slotte besprak onze commissie nog enkele artikelen aangaande het communicatienetwerk ASTRID. Dat is het radiocommunicatiesysteem van de hulp- en veiligheidsdiensten. Het betreft hier meer bepaald de artikelen 69 tot 71. De discussie ging er vooral over welke rol ASTRID bekleedt met betrekking tot de nieuwe telecommunicatiewet en aan welke artikelen ASTRID al dan niet moet onderworpen worden om efficiënt operationeel te kunnen zijn.
Ook plaatst men in de telecommunicatiewet ASTRID in de lijst van de organisaties die prioriteit moeten krijgen bij herstellingen. Tijdens de bespreking in de commissie stelde ik enkele vragen bij het karakter sui generis van ASTRID. De draagwijdte en de betekenis hiervan zijn voor mij onduidelijk. Daarom had ik volgende vragen. Ik denk dat die vragen zeer pertinent bleken wanneer wij nu zien wat de recente evaluatie van het communicatienetwerk ASTRID heeft opgeleverd. Er werd reeds enorm veel geïnvesteerd, maar er zijn toch vragen, die steeds actueler worden.
Zo vroeg ik toen ook reeds in de commissie wat er wordt bedoeld met het gegeven dat een bepaald netwerk openbaar noch niet-openbaar is. Wat moet men zich daarbij voorstellen? Wat is dan eigenlijk de toepasselijke wetgeving terzake?
Waarom wordt het ASTRID-netwerk ook onttrokken aan het principe van site sharing? Waarom kan het de infrastructuur niet voor een stuk enten op die van andere operatoren? Waarom kunnen ook geneesheren die gebruik wensen te maken van de semafoniediensten, niet terecht bij ASTRID?
Collega Bellot van de MR vroeg zich af waar de semafoniegebruikers na de stopzetting van de dienst door Belgacom terecht zullen kunnen. Hij stelde tevens de vraag of ASTRID ook deels commercieel zou mogen werken. De minister wees erop dat de voorliggende artikelen het resultaat zijn van besprekingen tussen ASTRID, het BIPT en verschillende beleidscellen. ASTRID wordt uitgesloten van universele dienstverplichtingen.
Niet alle artikelen die worden opgesomd zijn van toepassing op het ASTRID-netwerk. Het laatste richt zich op een bepaalde doelgroep — de hulp- en veiligheidsdiensten — en is dus niet discriminatoir, zo zei de minister.
De minister wees er ook op dat men geen infrastructuur deelt met gewone operatoren omwille van de veiligheid, wegens het zogezegde detectiegevaar. Voor een stuk heeft het ook te maken met de bedrijfszekerheid bij pannes.
De geneesheren zouden op termijn eventueel wel kunnen gebruikmaken van de semafoondiensten van ASTRID, wat toch niet onbelangrijk is wanneer Belgacom daarmee stopt.
Alle artikelen — in sommige gevallen gewijzigd via goedgekeurde amendementen — werden door de commissie aangenomen. Het geheel werd eveneens aangenomen.

Mr. Speaker, Mrs. Minister, Mr. Minister, colleagues, the Infrastructure Committee discussed, in two ordinary meetings and an additional meeting after being returned by the plenary session, the articles of the draft law falling within its competence. For the section BIAC, Belgocontrol and Infrabel, under the auspices of Minister Vande Lanotte, it concerned Articles 36 to 38. They involved the transfer of the Pension Fund from BIAC and the restructuring of the pension obligations of Belgocontrol. The royal decrees for their implementation shall be ratified. Articles 39 to 40 of the draft refer to the deconsolidation of Infrabel following an observation from the Institute for National Accounts. There were amendments for refinement. Collega Van den Bergh asked whether the State Council’s opinion had been obtained on the first amendment, to which the Minister answered affirmatively.
For the rail and air transport section under the responsibility of Minister Landuyt, as regards Articles 41 to 48, the Minister stated that the regulatory authority for rail transport is Infrabel. For air traffic, that is BIAC on the economic level and Belgocontrol — as we knew — on the technical level. By enabling these entities to receive remuneration, it shall provide for the financing of the control of compliance with the regulations concerned. I then raised questions regarding the articles relating to aviation, about the tasks that would be assigned to the entities, especially also about the relationship between the entities, about how the Minister would guarantee the independence of the regulators, about the planned budget and staff and about the comments of the State Council. Collega Lavaux of the CDH wanted to know under which public service the regulators specified in the articles would fall, how the members would be recruited, what the planned budget was, how their independence would be guaranteed and whether the agency could or could not verbalize violations. The Minister responded that the independence of the regulatory authorities would be guaranteed by the way they are financed by the users. He disagreed with the analysis that it would be a tax, given that the tax would be proportionate to a particular use.
I disagree with this, supported by the comments of the State Council. The Minister also referred to the Fund for Universal Service and stated that the operating costs and any additional tasks should be the subject of the management contract with the Belgian State. Finally, he pointed out that the amount set out in the memorandum of 175,000 euros was calculated on the basis of what the economic regulation at the Brussels National Airport will cost. This will have to be recovered from the sector. Then there is the section BIPT, under the responsibility of Minister Verwilghen. Articles 65 and 66 of the draft. There has been a judgment of 14 July 2004 of the Arbitration Court, which states that in the field of electronic communications there is a technological convergence between telecommunications, a federal jurisdiction, on the one hand and on the other, media, a community jurisdiction. Therefore, consultation with the participating entities is urgent. The new completion of Article 14 of the Regulator Act will take place through the draft, which states that the BIPT can perform its tasks regarding the overlapping powers only after the conclusion of a cooperation agreement. Now, until 31 December 2005, the BIPT may exercise its powers without a cooperation agreement. Then it is a necessity.
Collega Bellot of the MR wondered if the cooperation agreement with the Flemish government was already a fact. I myself then pointed out Flanders’ demand to link the approval of the cooperation agreement to the BIPT’s ability to act effectively as an ether police against the transmitters. The Minister pointed out that there is an agreement with all the Communities on the text of the cooperation agreement and that it is necessary that the Communities reach an agreement on the coordination of the frequency plans in order for the BIPT to be able to effectively perform its role as an ether-police agent. The Minister says that the BIPT can already act against transmitters on the basis of the telecommunications law, without however making a ruling on the licenses granted. It is also necessary to investigate who can take on the role of Ombudsman for cable broadcasting activities, which has always been one of my concerns.
As regards the updating of the Electronic Communications Act regarding the part of Minister Van den Bossche, it is about Article 68 of the draft. It is a supplement to Article 107 of the so-called Telecom Law. This law should be supplemented with a member that allows to combat emergency calls to emergency services whose numbers are free access. These include the telephone call centers, Child Focus, the Antigue Center and the Suicide Prevention. These songs receive a large percentage of malicious calls from children, perverted, joke makers who overload the lines and demotivate the volunteers.
In the committee, I stated that the ministry’s objectives were ⁇ to be supported, but I asked questions when choosing a law change rather than a royal decree as previously announced. I wondered if there was a new opinion from the Privacy Commission on this subject as this body in the past had given a negative opinion, with the exception of the Antigue Centre for the identification of the calling line by the aforementioned services. I also asked why the Children’s Telephone Service was not included in the list since it had been mentioned in the past. I also wondered what the added value of this new member is compared to the already existing procedures to block bullying phones through the court and the Ombudsman’s service. I also asked a series of information technology questions and questions of a social nature. How will anonymity be guaranteed or abuse excluded? Why not automatically switch from the bullying phones to the emergency services that can do identification? How will all these numbers be made accessible to everyone without distinguishing between bullies that may occur in certain family settings and abuse without the knowledge of other family members if the same telephone line is used within a family.
On the whole series of questions, the Minister replied that it had never been intended to anchor the scheme through KB. However, a KB will be issued regarding the identification of the callers. Minister Van den Bossche stated that the opinion of the Privacy Commission has never been focused on the problem of malicious calls. The Minister agreed to the addition of the Child Telephone Services to the list in the draft law.
The Minister considered the transfer of the emergency calls to the already existing emergency numbers that have an identification capability not appropriate due to the fear of overloading them.
Therefore, I submitted an amendment concerning the addition of child telephone services. That was accepted.
Finally, our committee discussed several articles on the communications network ASTRID. This is the radio communication system of the emergency and security services. This is the case in Articles 69 to 71. The discussion was mainly about the role of ASTRID in relation to the new telecommunications law and to which articles ASTRID should or should not be subject to in order to be efficiently operational.
The Telecommunications Act also puts ASTRID on the list of organizations that should be given priority in repairs. During the discussion in the committee, I asked a few questions about ASTRID’s sui generis character. The scope and significance of this is unclear to me. So I had the following questions. I think those questions proved very relevant when we now see what the recent evaluation of the communications network ASTRID has delivered. There has already been an enormous amount of investment, but there are still questions that are becoming more and more current.
So I asked already in the committee what is meant by the fact that a certain network is neither public nor non-public. What should we imagine here? What is the applicable legislation on this subject?
Why is the ASTRID network also withdrawn from the principle of site sharing? Why can’t it compare the infrastructure to that of other operators? Why do doctors who wish to make use of the semaphone services not be able to go to ASTRID?
Collega Bellot of the MR wondered where the semaphony users will be able to go after the termination of the service by Belgacom. He also asked whether ASTRID could also be partly commercial. The Minister pointed out that the present articles are the result of discussions between ASTRID, the BIPT and various policy cells. ASTRID is excluded from universal service obligations.
Not all the articles listed are applicable to the ASTRID network. The latter is targeted at a specific target group — the emergency and security services — and therefore is not discriminatory, the minister said.
The Minister also pointed out that no infrastructure is shared with ordinary operators for security reasons, due to the so-called detection danger. For a part, it also has to do with business security in panes.
The doctors would eventually be able to use ASTRID’s semaphone services in the future, which is not irrelevant if Belgacom stops using them.
All articles — in some cases amended through approved amendments — were adopted by the committee. The whole was also adopted.

Monsieur le président, madame la ministre, monsieur le ministre, chers collègues, la commission de l'Intérieur a examiné les articles 9 à 18 de ce projet de loi au cours de ses réunions des 15, 22 et 28 juin 2005. Une séance supplémentaire a eu lieu le 7 juillet après le dépôt du rapport.
Lors de la première réunion, M. Patrick Dewael, vice-premier ministre et ministre de l'Intérieur, commente l'article 9 en projet. Dans ce contexte, il est rappelé que l'article 486 de la loi-programme du 27 décembre 2004 visait à regrouper dans la loi organique appropriée les différents fonds budgétaires de la police fédérale qui trouvaient leur origine dans diverses réglementations légales.
En raison d'une erreur administrative, la date d'entrée en vigueur de cet article a cependant été "oubliée". L'article 9 en projet répare cette erreur et fixe la date d'entrée en vigueur de la réglementation au 30 avril 2002 en ce qui concerne le fonds pour prestations contre paiement et au 31 décembre 2004, la date de publication en ce qui concerne les deux autres fonds.
Ensuite, le ministre passe en revue les articles 10 à 13 en projet.
Ces articles modifient la loi du 15 avril 1994 relative à la protection de la population et de l'environnement contre les dangers résultant des rayonnements ionisants et relative à l'Agence fédérale de contrôle nucléaire (AFCN).
Les infractions à cette législation et à ses arrêtés d'exécution sont aujourd'hui punies en temps de paix d'une amende de 1.000 à 1.000.000 et d'un emprisonnement de trois mois à deux ans ou de l'une des ces peines seulement. Les seules sanctions pénales sont cependant rapidement apparues comme insuffisantes pour la mise en place d'une politique criminelle efficace dont le but ultime est de conduire l'exploitant à améliorer la sécurité et la protection contre les rayonnements ionisants au sein de son entreprise.
Pour remédier à ces insuffisances, on a tout d'abord instauré la possibilité de donner à l'auteur de l'infraction un avertissement. Mais l'efficacité de l'avertissement dépend aussi des suites qui seront données à son non-respect. Il est dès lors proposé de mettre en place un système d'amendes administratives comme c'est déjà le cas dans d'autres législations. Le système proposé par l'Agence est un système prévu sui generis pour les spécificités duquel je renvoie à mon rapport écrit.
Les montants des amendes administratives sont nettement inférieurs à ceux des amendes pénales. Le seuil minimal est divisé par dix. Ces montants apparaissent plus adéquats pour sanctionner les infractions de moindre importance.
Dans le cadre de la discussion générale, un échange de vues a eu lieu entre M. Willy Cortois et M. Patrick Dewael pour lequel je renvoie à mon rapport écrit.
Les articles 9 à 13 n'ont en outre donné lieu à aucune discussion dans le cadre de la discussion article par article.
Lors de la deuxième réunion, le gouvernement présente les amendements n° 3 et n° 4 qui tendent à remplacer l'article 10 de la loi du 31 décembre 1963 sur la protection civile.
M. Patrick Dewael, vice-premier ministre et ministre de l'Intérieur, expose succinctement le contenu de la réglementation.
En vertu de l'article 10 de la loi précitée du 31 décembre 1963, le gouverneur de province fixe la quote-part que les communes-centres de groupe doivent payer pour participer aux frais des services d'incendie, conformément aux normes déterminées par le ministre.
En vertu du même article, les communes protégées doivent payer une redevance annuelle aux communes-centres de groupe, redevance qui est également fixée par le gouverneur de province conformément aux normes déterminées par le ministre. Cette redevance est calculée selon la formule fixée à l'article 8 de l'arrêté royal du 10 octobre 1997 modifiant un arrêté ministériel du 10 octobre 1977.
Ce système de répartition des frais des services d'incendie a toutefois donné lieu à plusieurs plaintes. Pour le gouvernement, le législateur doit donc ancrer le système existant en vue d'éviter toute atteinte au système de financement des services d'incendie.
C'est pourquoi le projet de loi vise à confirmer, sauf bien entendu à l'égard des procédures en cours, le pouvoir des gouverneurs de province pour toutes les décisions qu'ils ont prises dans le passé et, pour le futur, à mettre en place un système qui ne pourra plus être contesté. Le système préconisé prévoit donc, sauf pour les procédures en cours avant l'entrée en vigueur de la nouvelle loi, une rétroactivité au 1 er janvier 1977. M. Dirk Claes et moi-même nous sommes interrogés sur les raisons du dépôt de cet amendement à ce moment précis.
Mme Annick Saudoyer souhaite avoir confirmation que l'amendement a été déposé en raison du dépôt d'un certain nombre de recours auprès du Conseil d'Etat et qu'il reprend, sans le modifier, le texte de l'arrêté ministériel du 10 octobre 1977.
M. Patrick Dewael précise que l'amendement tend à confirmer le système actuel de répartition des frais des services d'incendie. Ce système implique que délégation soit donnée aux gouverneurs de province, en vertu de l'arrêté ministériel du 10 octobre 1977, en vue de fixer la quote-part annuelle des communes.
Dès 1997, l'Etat a été condamné à verser des indemnités. On estima, à l'époque, que l'arrêté ministériel concerné n'avait aucune base légale, si bien que les décisions prises sur cette base étaient illégales et avaient, en tant que telles, porté préjudice aux communes.
Cette situation a été régularisée par la modification de l'article 10 de la loi du 31 décembre 1963 apportée, avec effet rétroactif, par la loi du 15 janvier 1999 portant des dispositions budgétaires et diverses.
Ce système est aujourd'hui contesté par les communes d'Andenne, de Dinant, d'Harelbeke et de Peer.
Dans leur recours auprès du Conseil d'Etat, elles arguent que la délégation contenue dans l'arrêté ministériel susmentionné est trop large et, ce faisant, contraire à la loi du 31 décembre 1963 sur la protection civile.
L'annulation de cet arrêté ministériel par le Conseil d'Etat aurait pour effet de permettre aux communes de récupérer, devant un tribunal ordinaire, leur quote-part des cinq dernières années avec toutes les conséquences budgétaires qui s'ensuivraient. L'amendement reprend le texte de l'arrêté ministériel en y ajoutant le contrôle du ministre qui a l'Intérieur dans ses attributions.
Au sujet des articles 14 à 16 du projet de loi, M. Christian Dupont, ministre de la Fonction publique, de l'Intégration sociale, de la Politique des grandes villes et de l'Egalité des chances, rappelle qu'il s'agit d'une adaptation technique des articles 43 et 43ter des lois sur l'emploi des langues en matière administrative coordonnées le 18 juillet 1966, en fonction des remarques émises par la Commission permanente de contrôle linguistique.
Cette modification est nécessaire pour adapter le cadre linguistique à partir des plans de personnel établis sur la base des enveloppes de personnel.
Ensuite, le ministre souligne que les articles 17 et 18 du projet de loi visent à améliorer les dispositions relatives aux sanctions administratives, à la suite des premières constatations découlant de l'application de la loi du 7 mai 2004 modifiant la loi du 8 avril 1965 et la nouvelle loi communale, ainsi que la loi du 17 juin 2004 modifiant la nouvelle loi communale qui avait réformé le système des sanctions administratives communales.
En général, ces améliorations sont pratiques ou procédurales. Certaines portent sur l'application du système aux contrevenants mineurs.
Pour ce qui concerne les améliorations pratiques et procédurales, je renvoie à mon rapport écrit.
En ce qui concerne les améliorations touchant à l'application du système aux contrevenants mineurs, le ministre précise que la loi actuelle présente des lacunes lorsque le contrevenant est un mineur de plus de seize ans. Ainsi, il n'était pas prévu de dispositions en matière de responsabilité civile puisque les parents n'étaient pas appelés à la cause. Le projet de loi propose d'associer les parents à toutes les étapes de la procédure et de leur permettre, à l'instar de ce qui est prévu pour les mineurs, d'interjeter appel contre une décision du tribunal de la jeunesse infligeant une mesure de protection autre qu'une amende.
Par ailleurs, en ce qui concerne les mineurs de moins de seize ans, l'abrogation par la loi de quatre infractions du titre X du livre II du Code pénal conduisait à ce que les mineurs profitent d'une impunité totale en l'absence de loi pénale et dans la mesure où les sanctions administratives ne peuvent pas être infligées à cette catégorie d'âge.
Ces infractions sont donc rétablies dans le texte en projet. Il s'agit des cas d'atteinte à la vie des animaux, de bruit ou de tapage nocturne, de dégradations volontaires de clôtures et de voies de fait.
Ces articles entrent par ailleurs dans la liste des infractions susceptibles de sanctions administratives par les communes pour les plus de 16 ans et les majeurs, en cas d'inertie de deux mois du parquet.
Dans le cadre de la discussion générale, M. Jean-Claude Maene (PS) dit approuver les mesures en projet. Il se réjouit en particulier de celles qui concernent les sanctions administratives.
M. Charles Michel (MR) dit croire en l'intérêt d'un système efficace permettant aux communes de lutter de manière adéquate contre les incivilités.
Toutefois, l'intervenant souligne que, lorsque le système des sanctions administratives communales est entré en vigueur, il y a quelques mois, les communes ont été très rapidement confrontées à un tel nombre de problèmes pratiques qu'une loi de réparation s'est avérée indispensable.
M. Michel souligne notamment l'importance des mesures en projet en ce qui concerne les mineurs. Celles-ci comblent en effet une série de lacunes juridiques.
Certaines questions restent toutefois sans réponse pour l'intervenant et notamment le cas des graffitis. La matière est-elle ou non repénalisée? Dans la négative, les mineurs restent-ils dans l'impunité? Dans l'affirmative, les majeurs sont-ils toujours passibles de sanctions administratives?
Un très long échange de vues opposera M. Michel et M. Dupont autour de ces questions. Je renvoie à mon rapport écrit pour le détail de cet échange.
En substance, la réponse du ministre est que les articles repénalisés suffisent à couvrir la matière des tags et qu'étant inclus dans la liste des matières passibles de sanctions administratives, ils peuvent être appréhendés par les communes pour sanctionner les majeurs et les mineurs de plus de 16 ans.
La réponse ne convainc pas M. Michel pour qui les tags sur les bâtiments publics ainsi que sur les immeubles privés, hormis les clôtures, commis par des mineurs de moins de 16 ans demeureront impunis.
M. Joseph Arens (cdH) attire l'attention sur les nombreuses difficultés — parfois insurmontables — que les petites communes éprouvent pour appliquer le système des sanctions administratives.
Mme Katrien Schryvers (CD&V) déplore tout d'abord que le vicepremier ministre et ministre de l'Intérieur n'ait pas été associé à la discussion, d'une part, et que l'avis de la commission de la Justice n'ait pas été demandé dans cette matière, d'autre part.
Elle souscrit par ailleurs à la ratio legis des sanctions administratives en tant que telles.
Pour l'intervenante, la mise en oeuvre de cette initiative a toutefois été tellement chaotique qu'une loi de redressement est déjà nécessaire, deux mois à peine après la mise en oeuvre du système.
Vu le nombre de difficultés posées par la législation initiale, Mme Schryvers craint que les modifications proposées ne puissent pas sauver le système.
Elle souhaite que les communes puissent disposer d'un instrument qui leur permette d'agir énergiquement.
Dans ce cadre, elle estime que des auditions permettraient d'évaluer les problèmes existants et que la législation améliorée répondrait ainsi de manière optimale aux besoins réels qui se font jour sur le terrain.
Cette proposition est relayée par M. Claes qui détaille en outre un certain nombre de problèmes précis d'applicabilité pour les administrations communales.
M. Willy Cortois (VLD) propose qu'en janvier 2006 le ministre fournisse un relevé des communes qui ont intégré le système. En juin 2006, le gouvernement devrait alors soumettre un rapport d'évaluation décrivant les résultats à la fois de ses efforts et de ceux des communes en la matière.
M. Christian Dupont rappelle que la loi initiale et les modifications de celle-ci ont toujours été le résultat d'un consensus. Il indique par ailleurs qu'il ressort de la pratique que les parquets ne poursuivent plus un certain nombre d'infractions, ce qui ne manque pas d'engendrer un sentiment d'impunité.
Souhaitant réagir à cette situation, un certain nombre de communes, pour la plupart petites, ont demandé avec insistance que les modifications à l'examen soient apportées afin de pouvoir disposer des moyens nécessaires pour leur lutte contre les nuisances.
Le ministre passe ensuite en revue les mesures que prendra le gouvernement dans ce cadre: - Ce dernier élaborera un modèle de règlement qui pourra être uniformisé au niveau de la zone de police. Ce document comportera notamment une liste des infractions passibles de sanctions administratives. - Les fonctionnaires chargés de constater les faits seront formés dans les écoles de police. Les différentes écoles de police commenceront à dispenser ces formations dans le courant du mois de septembre 2005.
En réplique, M. Charles Michel a prolongé ses questions relatives aux tags ainsi qu'à l'économie générale de la loi, notamment en ce qu'elle traite du cumul de qualifications.
J'ai souhaité, quant à moi, savoir si un membre du personnel Calog de niveau 1 peut être désigné comme fonctionnaire habilité à infliger la sanction.
M. Joseph Arens demande, en rapport avec les graffitis, que l'on prête également attention à l'endommagement d'habitations privées.
Mme Katrien Schryvers (CD&V) constate que, pour le traitement civil, l'action en dommages et intérêts d'une infraction qui, sur le plan pénal, a fait l'objet d'une sanction administrative communale, la balle se trouve dans le camp de la victime.
Etant donné que cette situation ne correspond pas au sens de la justice du citoyen, il serait sans doute préférable de n'autoriser une sanction administrative qu'après que les dommages ont été réparés.
M. Christian Dupont estime qu'il y a trop peu de distance entre le fonctionnaire de police qui constatera le fait et le personnel Calog qui devrait agir en fonctionnaire responsable de la sanction. En tout cas, cette question sera réglée par arrêté royal, de telle sorte qu'une marge de réflexion subsiste.
Il ajoute que l'article 17, 6° proposé règle la question du concours d'une infraction non administrative qui peut être réprimée par une sanction pénale et pour laquelle une sanction administrative est également prévue en vertu d'un règlement communal.
M. Joseph Arens attire l'attention sur le fait qu'en vertu de la loi précitée du 17 juin 2004, l'arrêté-loi du 29 décembre 1945 portant interdiction d'inscriptions sur la voie publique a également été abrogé. D'après l'Union des villes et communes de Wallonie, cet arrêté-loi constituait le seul fondement juridique permettant de poursuivre effectivement les tags sur les habitations privées. Cela signifierait que, dorénavant, les graffitis ne pourront donner lieu qu'à une sanction administrative communale. Si c'est le cas, l'intervenant insiste pour que cet arrêté-loi soit rétabli sous l'une ou l'autre forme.
Le collaborateur de la vice-première ministre et ministre de la Justice précise que l'arrêté-loi du 29 décembre 1945 vise uniquement les inscriptions donnant sur la voie publique.
Il réaffirme, par contre, les articles rétablis du Code pénal permettant de poursuivre toutes les formes de graffitis. En effet, les articles 545 et 563, 2° du Code pénal traitent respectivement de la destruction volontaire et de la dégradation volontaire des clôtures urbaines et rurales. Il s'agit d'une notion large pouvant parfaitement s'appliquer aux graffitis sur des immeubles. L'article 559, 1° du même Code traite de l'endommagement volontaire des immeubles.
M. Charles Michel confirme que ces dispositions peuvent à son sens être utilisées, mais ne visent pas tous les cas de figure. Par exemple, elles ne visent pas les cas de tags sur les immeubles publics ou privés en dehors des portes et clôtures.
Filip Anthuenis (VLD) souligne que l'on ne dispose aujourd'hui d'aucun moyen permettant de régler le problème des nuisances publiques. Il propose dès lors, en tout état de cause, d'adopter les mesures à l'examen et de compléter celles-ci, le cas échéant, si la pratique montre que cela s'impose.
Le ministre Dupont confirme que tous les problèmes ne peuvent être réglés en même temps et demande aux membres d'accomplir au moins ce pas dans la bonne direction.
Dans le cadre de la discussion des articles, les articles 14 à 16 ne donnent lieu à aucune discussion.
M. Mohammed Boukourna et consorts présentent un amendement qui tend à remplacer dans le texte français de l'article 17, 6° en projet les mots "délit pénal" par les mots "infraction pénale". M. Christian Dupont considère que l'amendement est pertinent.
Les articles 9 et 10 sont successivement adoptés à l'unanimité.
L'article 11 ainsi que les articles 49 à 64 du nouveau chapitre VII de la loi du 15 avril 1994 relative à la protection de la population et de l'environnement contre les dangers résultant des rayonnements ionisants et relative à l'Agence fédérale de contrôle nucléaire sont successivement adoptés à l'unanimité.
Les articles 12 et 13 sont adoptés à l'unanimité.
Aux articles 13bis (nouveau) et 13ter (nouveau), les amendements n° 3 et n° 4 du gouvernement sont successivement adoptés par 13 voix et 3 abstentions.
Les articles 14 et 15 sont adoptés par 11 voix et 1 abstention.
L'article 16 est adopté par 12 voix et 1 abstention.
A l'article 17, l'amendement n° 2 de Charles Michel et de moi-même est rejeté par 8 voix contre 2 et 3 abstentions. L'amendement n° 1 de M. Mohammed Boukourna et consorts est adopté à l'unanimité. Cet article ainsi modifié et corrigé est ensuite adopté par 8 voix contre 2 et 3 abstentions.
L'article 18 est adopté par 8 voix contre 2 et 3 abstentions.
L'ensemble des articles soumis à la commission tels qu'ils ont été modifiés et corrigés sont adoptés par 10 voix et 4 abstentions.
Un amendement déposé par Mme Magda De Meyer et consorts après le dépôt du rapport a été approuvé par la commission à l'unanimité, lors de sa réunion du 7 juillet 2005. Il vise à réintroduire dans le Code pénal l'intitulé du titre 10 du Code pénal auquel le projet initial faisait référence à plusieurs reprises.

However, criminal sanctions alone quickly appeared to be insufficient for the implementation of an effective criminal policy whose ultimate goal is to drive the operator to improve safety and protection against ionizing radiation within its enterprise.
In order to remedy these deficiencies, the possibility of giving the offender a warning was first introduced. But the effectiveness of the warning also depends on the consequences that will be given to its non-compliance. It is therefore proposed to introduce a system of administrative fines as is already the case in other legislations. The system proposed by the Agency is a sui generis system for which I refer to my written report.
The amounts of administrative fines are significantly lower than those of criminal fines. The minimum threshold is divided by 10. These amounts appear to be more appropriate to punish minor offences.
During the meeting, an exchange of views was held between Mr. Willy Cortois and Mr. Patrick Dewael, for whom I refer to my written report.
Furthermore, Articles 9 to 13 did not give rise to any discussion within the framework of the article-by-article discussion.

This system implies that delegation is given to provincial governors, pursuant to the Ministerial Decree of 10 October 1977, in order to fix the annual quota of communes.
Since 1997, the state has been obliged to pay compensation. At that time, it was estimated that the ministerial decree concerned had no legal basis, so that the decisions taken on that basis were illegal and had, as such, caused damage to the municipalities.
This situation was regularized by the modification of article 10 of the law of 31 December 1963 brought, with retroactive effect, by the law of 15 January 1999 concerning budgetary and various provisions. by
This system is now contested by the communes of Andenne, Dinant, Harelbeke and Peer.
In their appeal before the Council of State, they argue that the delegation contained in the aforementioned ministerial decree is too broad and, by doing so, contrary to the Law of 31 December 1963 on Civil Protection.
The cancellation of this ministerial decree by the State Council would have the effect of allowing the municipalities to recover, before an ordinary court, their share of the last five years with all the budgetary consequences that would follow. The amendment takes back the text of the ministerial decree by adding to it the control of the Minister who has the Interior in his attributions.
Articles 14 to 16 of the draft law. Christian Dupont, Minister of Public Service, Social Integration, Politics of Large Cities and Equal Opportunities, recalls that this is a technical adaptation of Articles 43 and 43ter of the laws on the use of languages in administrative matters coordinated on 18 July 1966, according to the observations issued by the Permanent Commission for Language Control.
This modification is necessary to adapt the linguistic framework from the staff plans established on the basis of the staff envelopes.
Subsequently, the Minister stresses that Articles 17 and 18 of the bill aim to improve the provisions relating to administrative sanctions, following the first findings arising from the application of the law of 7 May 2004 amending the law of 8 April 1965 and the new municipal law, as well as the law of 17 June 2004 amending the new municipal law that had reformed the system of municipal administrative sanctions.
In general, these improvements are practical or procedural. Some concern the application of the system to minor offenders.
As for practical and procedural improvements, I refer to my written report.
Regarding improvements in the application of the system to minor offenders, the minister specifies that the current law has gaps when the offender is a minor over the age of sixteen. Thus, there were no provisions on civil liability since the parents were not called to the case. The bill proposes to involve parents at all stages of the proceedings and to allow them, as for minors, to appeal against a judgment of the youth court imposing a protection measure other than a fine.
Furthermore, in the case of minors under the age of sixteen, the abrogation by law of four offences of Title X of Book II of the Criminal Code resulted in minors enjoying total impunity in the absence of a criminal law and to the extent that administrative sanctions cannot be imposed on this age group.
These violations are therefore re-established in the draft text. These include cases of damage to the life of animals, noise or nocturnal taping, voluntary degradation of fences and factual roads.
These articles are also included in the list of offences subject to administrative sanctions by the municipalities for those over 16 years of age and the major, in case of two-month inertia of the prosecutor's office.

by Mr. Joseph Arens (cdH) draws attention to the many – sometimes insurmountable – difficulties that small municipalities face in applying the system of administrative sanctions.
Ms. Katrien Schryvers (CD&V) regrets, first, that the Deputy Prime Minister and Minister of the Interior were not involved in the discussion, on the one hand, and that the opinion of the Justice Committee was not sought in this matter, on the other.
It also subscribes to the ratio legis of administrative sanctions as such.
For the speaker, however, the implementation of this initiative has been so chaotic that a recovery law is already needed, just two months after the implementation of the system.

Volgens de memorie van toelichting heeft die bepaling de bedoeling ervoor te zorgen dat de RSZ niet gebonden is door de inzake inkomstenbelasting afgesloten akkoorden of genomen beslissingen betreffende de eigen kosten van de werkgever of de kwalificatie van de inkomsten.
Het begrip "beslissing" heeft daarbij een zeer brede draagwijdte. De discussies over de kosten eigen aan de werkgever hebben bijvoorbeeld betrekking op forfaitaire kostenvergoedingen waarvan niet meteen duidelijk is of het inderdaad om kosten eigen aan de werkgever gaat, dan wel om een verdoken bezoldiging.
Het is mij niet duidelijk welke minister vragende partij is om beslissingen omtrent kosten eigen aan de werkgever niet langer tegenstelbaar te beschouwen aan de RSZ. Die kosten zijn niet belastbaar in hoofde van de werknemer en worden evenmin als loon voor de berekening van de sociale zekerheidsbijdragen aangemerkt.
Hoe zal de regering uitleggen dat hetzelfde begrip voor de belastingen alsmede voor de sociale zekerheid anders moet worden toegepast? Mevrouw of mijnheer de minister, misschien kunt u daar zo dadelijk toch wat verduidelijking over geven.
Discussies over de kwalificatie van inkomsten vindt men in de personenbelasting op meerdere vlakken terug. Het komt wel meer voor dat belastingplichtigen een inkomen als divers inkomen kwalificeren, terwijl de fiscus van mening is dat het baten uit een winstgevende activiteit zijn.
Er kan eventueel ook discussie zijn of een inkomen als onroerend, roerend of als beroepsinkomen moet worden aangemerkt. Ik verwijs naar artikel 37 van het Wetboek van inkomstenbelastingen.
We moeten ernstige vragen stellen over de mogelijke perverse effecten van een dergelijke bepaling. Artikel 113 van het wetsontwerp beperkt zich tot het akkoord tussen administratie en belastingplichtigen en eenzijdige beslissingen vanwege de taxatieambtenaren. Het gaat hier niet om rechterlijke beslissingen. Zal artikel 113 van dit wetsontwerp niet tot meer betwistingen leiden bij Financiën om zo uiteindelijk een rechterlijke beslissing uit te lokken? Immers, in het geval een belastingplichtige tegen een beslissing van de taxatieambtenaar bezwaar aantekent en de zaak uiteindelijk voor de burgerlijke rechtbank komt, kan de beslissing van de taxatieambtenaar worden vernietigd. Stel dat ondertussen een rechtszaak wordt ingeleid voor de arbeidsrechtbank. Gaat de rechter die zetelt in de arbeidsrechtbank de zaak moeten aanhouden totdat de fiscale rechtszaak definitief is beslecht? Hoe kan anders de arbeidsrechtbank weten of de beslissing van de taxatieambtenaar de rechterlijke beslissing doorstaat? Krijgen we hiermee een variant op "le criminel tient le civil en état"?
Het is dan ook betreurenswaardig dat de memorie van toelichting zo karig is met uitleg. De circulaire die in bijlage bij het verslag wordt gevoegd, zegt nog minder dan de memorie van toelichting. Voor de rechtszekerheid is het ongezond dat zowel de rechtsonderhorigen als de administratie worden overgelaten aan hun verbeelding. Ik veronderstel dat minister Demotte op die vragen zal antwoorden.

Discussions about the qualification of income can be found in the personal tax in several areas. However, it is more common for taxpayers to qualify income as diversified income, while the tax authority considers the profits from a lucrative activity.
There may also be discussion whether an income should be considered as immovable, movable or occupational income. Article 37 of the Income Tax Code.
We must ask serious questions about the possible perverse effects of such a provision. Article 113 of the draft law is limited to the agreement between administration and taxpayers and unilateral decisions due to the taxation officers. This is not about judicial decisions. Will Article 113 of this bill not lead to more disputes in Finance to ultimately trigger a court decision? After all, in the event that a taxable person objects to a decision of the taxation officer and the case eventually goes to the civil court, the decision of the taxation officer can be annulled. Suppose that in the meantime a lawsuit is initiated before the Labour Court. Will the judge sitting in the Labour Court have to hold the case until the tax case is finally settled? Evenwel werd door het Hof van Cassatie bij arrest van 2 februari 2004 bepaald dat de bewijslast niet bij de werkgever, maar wel bij de RSZ ligt. In die omstandigheden is de RSZ er absoluut niet op uit geconfronteerd te worden met fiscale rulings waarbij bepaalde vergoedingen op fiscaal gebied als een "vergoeding van kosten eigen aan de werkgever" worden geduid. Het artikel zal de RSZ toestaan bij zijn bewijsvoering elke verwijzing naar fiscale akkoorden zonder meer af te wijzen. De vraag is evenwel of de rechter zich daarbij zal neerleggen.
Het stilzwijgen waarmee de bepaling wordt ingevoerd, toont nogmaals aan hoe groot het wantrouwen is in de tweede paarse regering. Het wantrouwen dat nu bestaat in de regering, zal in de toekomst onder meer door die wetsbepaling worden ingebakken in de administraties zelf, terwijl precies de sociale en fiscale fraudebestrijding een goede samenwerking vereist tussen beide departementen.
Met artikel 113 van het ontwerp schept de regering meer rechtsonzekerheid voor de werkgevers en de werknemers. Een dergelijke bepaling leidt dan ook tot meer procedures voor de rechtbanken.
Het kan ook anders. Misschien kunnen de excellenties hier aanwezig, eens een kijkje nemen bij onze noorderburen. In Nederland werd op 24 juni 2004 een wet goedgekeurd, de wet administratieve lastenverlichting en de vereenvoudiging in sociale verzekeringswetten. Die wet wordt gedefinieerd als de wet-WALVIS. Door die wet geldt nog maar een loonbegrip voor de fiscus en de sociale zekerheid. Dat is een enorme vereenvoudiging voor zowel werkgevers en werknemers als voor de overheid. In Nederland raamt men dat door de wet-WALVIS de administratieve lasten voor werkgevers op het gebied van premieheffing en loonbelasting met 196 miljoen euro per jaar dalen. Zij is van toepassing vanaf 1 januari 2005.
In antwoord op mijn mondelinge vraag van 14 juli 2004 in de commissie voor de Sociale Zaken bracht minister van Sociale Zaken Demotte drie beslissingen in herinnering die door de Ministerraad in Gembloers werden genomen inzake de problematiek van loon en sociale wetgeving. Ik citeer minister Demotte: "Ten eerste, er komt een herziening van de wet van 12 april 1965 betreffende de bescherming van het loon. De herziening houdt verband met de wijziging van de toestand sinds het opstellen van voormelde wet. De wet dateert van bijna 40 jaar geleden en moet het hoofd bieden aan de engineering die ontwikkeld wordt om socialezekerheidsbijdragen te vermijden. De herziening zal in overleg met de sociale partners geschieden.
"Ten tweede, in de sociale zekerheid moet het begrip `loon' verduidelijkt worden om een einde te maken aan de meningsverschillen die op sommige momenten vastgesteld zijn tussen enerzijds, de inningorganismen van de sociale zekerheid en anderzijds, de inspectiediensten.
Die toestand berokkent iedereen schade. Tegen eind 2004 moet een overleginstantie worden opgericht die alle betrokken diensten zal verzamelen. Ten derde moeten de begrippen in fiscale wetgeving en socialezekerheidswetgeving geharmonieerd worden." Minister Demotte vervolgt: "Zoals u kunt vaststellen, heeft de regering de goedkeuring van een wet door het Nederlandse Parlement niet afgewacht om de problematiek te beslechten. De FOD's Sociale Zekerheid en Werk werden met een voorbereidend onderzoek belast, wat geschiedt in samenwerking met de sociale partners. Op dit ogenblik kan ik geen concrete timing mededelen binnen dewelke het voorbereidend werk afgerond zal zijn. Indien het nodig is, kan op deze problematiek later nog worden teruggekomen."
In mijn repliek heb ik de minister gewezen op het feit dat ik enerzijds overtuigd ben van zijn goede intenties maar anderzijds ook mijn twijfels heb over zijn daadkracht vermits hij in feite uitsluitend verwijst naar een toekomstig onderzoek. Ik heb dan ook verwezen naar de studie die professor Van Istendael reeds in 1998 publiceerde in het liber amicorum voor professor Roger Blanpain, uitgegeven bij die Keure. Vanaf bladzijde 589 worden daar de resultaten gebracht van een studie over sociaal en fiscaal loon. Professor Van Istendael kwam tot de duidelijke conclusie dat het principieel en praktisch mogelijk is om tot een gemeenschappelijk begrip van bezoldigingen te komen, wat zou toelaten de heffingsgrondslag voor die verzekeringsbijdrage identiek te maken in het belastingsrecht en in de sociale zekerheid. Dat zou een enorme vereenvoudiging zijn, zowel voor de sociale bijdragen voor werknemers als voor de personenbelasting. In de discussie over de hervorming van de financiering van de sociale zekerheid is het goed te weten dat die mogelijkheid principieel en praktisch binnen bereik is.
Nog geen jaar na de verklaringen van minister Demotte in de commissie, stellen we vast dat het Parlement uitgenodigd wordt om een bepaling goed te keuren die totaal de tegenovergestelde richting uitgaat. De administratieve lasten voor de bedrijven worden niet verminderd, integendeel. Evenmin wordt een rechtszeker kader voor ondernemers en werknemers gecreëerd. Men moet dan ook niet verwonderd zijn dat het ondernemingsvertrouwen maand na maand vermindert en dat deze regering in hoofde van de ondernemers een duidelijk onvoldoende krijgt. Voor een regering die bij haar start in 2003 van jobcreatie een absolute prioriteit maakte, is dit duidelijk opnieuw een voorbeeld van een contraproductieve maatregel. It’s hard to figure out what the government’s intentions are. Probably the reason is the tax rulings. The silence with which the provision is introduced once again shows how great the mistrust is in the second purple government. The mistrust that exists now in the government will in the future be embedded, among other things, by that legislative provision in the administrations themselves, while precisely the fight against social and fiscal fraud requires good cooperation between the two departments.
With Article 113 of the draft, the government creates more legal uncertainty for employers and workers. Such a provision therefore leads to more proceedings before the courts.
It can also be different. Per ⁇ the excellences present here, take a look at our northern neighbors. In the Netherlands, on 24 June 2004, a law was adopted, the law on administrative burden relief and the simplification in social insurance laws. That law is defined as the law-WALVIS. This law only applies a wage concept for the tax and social security. This is a huge simplification for both employers and employees and for the government. In the Netherlands, it is estimated that the law-WALVIS will reduce the administrative burden for employers in the field of premium taxation and wage tax by 196 million euros per year. It shall apply from 1 January 2005.
In response to my oral question of 14 July 2004 in the Social Affairs Committee, Minister of Social Affairs Demotte recalled three decisions taken by the Council of Ministers in Gembloers on the problem of wages and social legislation. I quote Minister Demotte: "First, there is a revision of the law of 12 April 1965 on the protection of wages. The revision relates to the change in the situation since the drafting of the aforementioned law. The law dates back almost 40 years ago and is designed to cope with the engineering being developed to avoid social security contributions. The review will be carried out in consultation with the social partners.
Secondly, in social security, the concept of ‘wage’ needs to be clarified in order to eliminate the differences of opinion that have at times been established between, on the one hand, the social security collection bodies and, on the other hand, the inspection services.
This situation causes harm to everyone. By the end of 2004, a consultative body should be established to gather all relevant services. Third, the concepts in tax legislation and social security legislation must be harmonised." Minister Demotte continues: "As you can see, the government has not waited for the approval of a law by the Dutch Parliament to resolve the problem. The FOD’s Social Security and Labour were charged with a preparatory survey, which is done in collaboration with the social partners. At the moment, I cannot announce a concrete timing within which the preparatory work will be completed. If necessary, this issue can be addressed later.”
In my replica, I pointed out to the Minister that, on the one hand, I am convinced of his good intentions but, on the other hand, I also have my doubts about his effectiveness as he in fact only refers to a future investigation. I have therefore referred to the study that Professor Van Istendael already published in 1998 in the liber amicorum for Professor Roger Blanpain, published at the Keure. Parmi les dispositions diverses de ce projet de loi, certaines visent à encourager et à soutenir la production d'électricité à partir des éoliennes offshore. J'approuve cet objectif. Néanmoins, j'estime — les acteurs de la production d'énergie renouvelable partagent d'ailleurs cet avis — que le projet de loi, tel qu'il est formulé, introduit une discrimination entre l'éolien offshore et les autres sources d'énergie renouvelables, notamment l'éolien onshore.
J'avais introduit un amendement qui a été rejeté en commission. Je l'introduis à nouveau en séance plénière en argumentant de manière plus complète.
Mon amendement vise à rendre les dispositions de l'article 54, § 3 valables pour toutes les installations d'énergies renouvelables. En commission, on m'avait opposé l'argument que les énergies renouvelables faisaient partie des compétences régionales tandis que l'offshore relevait de la compétence fédérale. Selon cet argument, il fallait se limiter à ce secteur de l'énergie. Or, cela me semble faux puisque le débat d'aujourd'hui porte sur une disposition tarifaire.
Qu'en est-il exactement? Le projet qui nous est soumis instaure un mécanisme permettant de compenser l'imprévisibilité de la production d'électricité à partir de l'énergie éolienne offshore. Si le producteur ne peut pas respecter la quantité qu'il avait prévue pour alimenter le réseau, le projet prévoit une marge de tolérance de 30% avant de le pénaliser. Cette disposition n'est pas régionale; elle est fédérale. Elle intervient dans la structure tarifaire de l'électricité. Il n'y a donc pas de raison pour que cette marge de tolérance octroyée à l'électricité produite par l'éolien offshore ne soit pas applicable aux autres modes de production d'électricité tout autant imprévisibles. Le 19 novembre 2004, le secteur de l'énergie renouvelable — EDORA pour les producteurs wallons et bruxellois, ODE Vlaanderen pour les producteurs flamands — a transmis aux ministres du gouvernement fédéral une note leur demandant d'appliquer ce mécanisme de tolérance à tout le secteur, en raison de la difficulté de prédire correctement la quantité d'électricité qui sera fournie.
En décembre 2004, cette note était présentée à M. Vertessen, conseiller du ministre Verwilghen qui a reconnu l'existence du problème, sans apporter de réponse, à l'époque.
Dans un avis du 27 avril 2004, le conseil général de la CREG reconnaissait également ce problème et son impact négatif sur le fonctionnement du marché de l'électricité. Il demandait donc que des mesures soient prises.
Ce sujet est sur la table depuis plus d'un an maintenant. Jusqu'à présent, aucune disposition n'a été prise. Le projet de loi qui nous est soumis aujourd'hui n'apporte une réponse que pour l'électricité éolienne produite à partir des éoliennes offshore.
Je viens ainsi d'éliminer l'argument selon lequel il s'agit d'une compétence régionale.
Le ministre a également avancé comme argument qu'il s'agit de technologies nouvelles beaucoup plus performantes. Toutefois, leur caractère novateur rend la prédiction de production plus difficile, ce qui pourrait entraîner des problèmes de rentabilité.
A cet égard, je me suis renseignée auprès des producteurs. Il apparaît que la rentabilité d'une éolienne est directement dépendante de la production qui, elle-même, dépend du dimensionnement des machines, de la vitesse et de la qualité du vent. Seuls les courants éoliens s'écoulant de façon laminaire peuvent être convertis en énergie utile par une éolienne. Par conséquent, toute surface de rugosité freinant le vent ou provoquant des turbulences en diminue la qualité. C'est la raison pour laquelle il est intéressant de placer des éoliennes en mer puisque le vent y est plus régulier et de qualité plus constante. Cela tend à une plus grande stabilité et à une plus grande prévisibilité de la production offshore.
Le grand éloignement des éoliennes par rapport à la côte complique la maintenance et réduit la disponibilité des éoliennes, ce qui a pour conséquence d'en diminuer le rendement mais, en tout cas, cela ne touche pas la prévisibilité de la production. Or, la marge de tolérance porte sur la prévisibilité et non sur quantité de production. La prévisibilité ne dépend pas du type de turbine ou de son emplacement mais de la performance des outils de prédiction du vent. Ces outils existants, utilisés tant pour la production onshore qu'offshore, sont les mêmes.
Les principales différences technologiques entre les éoliennes onshore et offshore concernent les fondations et les matériaux utilisés pour résister aux courants et à la corrosion due au sel - ce qui n'a rien à voir avec la manière de produire, de capter le vent et de transformer cette énergie en électricité -, la ventilation et le refroidissement de la nacelle et la nécessité de prévoir, à l'intérieur de l'éolienne, des équipements permettant de protéger les travailleurs qui assurent la maintenance des éoliennes en mer. Sur le principe de fonctionnement, il n'existe aucune différence. Rien ne peut donc justifier cette différence de traitement.
Outre les éoliennes onshore et offshore, il est clair que cette mesure devrait également concerner l'électricité produite à partir des panneaux solaires photovoltaïques et les micro-centrales hydroélectriques qui, elles aussi, connaissent des imprévisibilités plus grandes au niveau de la quantité d'électricité qu'elles vont pouvoir envoyer dans le réseau.
Mon amendement relatif à cette marge de tolérance, s'il reconnaît le caractère positif de celle-ci, vise à permettre une différence de 30% entre ce qui est annoncé et ce qui est produit avant qu'il y ait pénalité, mais cela doit être applicable à l'ensemble des sources d'énergies renouvelables.
Je ne sais pas si un doute subsiste au sujet de la compétence régionale ou fédérale pour cette matière. Mais si on reprend le dispositif fédéral, l'article 5 de l'arrêté royal du 11 octobre 2002 relatif aux obligations de service public dans le cadre du marché de l'électricité ainsi que l'article 317 de l'arrêté royal du 19 décembre 2002 établissant un règlement technique pour la gestion du réseau de transport de l'électricité et l'accès à celui-ci prévoient une plage de tolérance relative à l'équilibre, au bénéfice des énergies renouvelables et des unités de cogénération.
Dans le même ordre d'idées, l'article 5, §7 de l'arrêté royal du 4 avril 2001 établissant la structure tarifaire du gestionnaire de réseau national de transport d'électricité dispose que: "En ce qui concerne les unités de production d'électricité utilisant des énergies renouvelables de prédictibilité limitée", les tarifs des services auxiliaires "contiennent un coefficient de réduction permettant de refléter les caractéristiques du parc total de ces unités regroupées par type d'énergie".
Tous ces éléments indiquent que le projet en examen introduit une discrimination par rapport à la législation belge et européenne.
Je voudrais également faire une remarque au sujet de l'augmentation du montant et de la durée de rachat de l'électricité éolienne offshore par Elia qui est prévue dans le projet d'arrêté et qui est motivée par la nécessité de mieux refléter les coûts de production de ces installations.
Il est curieux que le gouvernement fédéral refuse d'adapter de la même manière et pour les mêmes raisons les montants de rachat de l'électricité produite par les installations onshore comme elle le fait pour les autres modes de production de l'électricité, cela est d'autant plus curieux qu'il y a une demande des Régions, notamment de la Région bruxelloise et de la Région wallonne qui sont particulièrement visées par les autres modes de production d'électricité.
Une nouvelle fois, le fait de prévoir un prix de rachat minimum pour la production d'électricité verte relève de la compétence fédérale et non de la compétence régionale. Mon amendement vise à rectifier cet état de choses.
Enfin, les producteurs d'électricité verte craignent un déséquilibre du marché.

Ils craignent qu'un afflux massif de certificats verts, favorisés par les dispositions du présent projet de manière discriminatoire, ne perturbe l'équilibre des trois marchés, bruxellois, flamand et wallon. Au minimum, il conviendrait d'établir une coopération, une coordination entre le fédéral et les Régions de manière à anticiper et prévoir la quantité qui sera mise sur le marché.
Apparemment, il n'a été réalisé aucune analyse sur l'impact négatif potentiel des dispositions de ce projet. D'après, l'information à ma disposition, la réunion du Comité de concertation entre le fédéral et les Régions a tout au plus convenu de la nécessité d'un accord de coopération préalable à l'harmonisation des mécanismes de certificats verts.
Nous voilà donc face à des dispositions nécessaires pour soutenir l'offshore. D'ailleurs, fondamentalement, je n'ai aucun problème en ce qui concerne la canalisation. Cependant, cela a été réalisé sans tenir compte des autres producteurs, peut-être pour plaire à certains publics, peut-être en n'ayant confiance qu'en la Région flamande et la région côtière, dans le chef de M. Verwilghen et peut-être dans celui de M. Vande Lanotte. En tout cas, ce projet est discriminatoire: j'aimerais vraiment que le parlement prenne la peine de réexaminer soigneusement cet article et l'amendement que je redépose actuellement.

Among the various provisions of this bill, some aim to encourage and support electricity generation from offshore wind turbines. I agree with this objective. Nevertheless, I believe — the actors in the production of renewable energy share this view — that the bill, as it is formulated, introduces a discrimination between offshore wind power and other renewable energy sources, in particular onshore wind power.
I introduced an amendment that was rejected in the committee. I introduce it again in the plenary session, arguing in a more comprehensive way.
My amendment aims to make the provisions of Article 54, § 3 applicable to all renewable energy installations. As a committee, I was opposed to the argument that renewable energies were part of the regional competence, while the offshore was part of the federal competence. According to this argument, we should limit ourselves to this energy sector. However, this seems to me wrong since today’s debate is about a tariff provision.
What exactly is it? The project that is submitted to us establishes a mechanism to compensate for the unpredictability of electricity production from offshore wind energy. If the producer cannot meet the quantity he had planned to power the grid, the project provides a tolerance margin of 30% before penalizing it. This provision is not regional; it is federal. It is part of the electricity tariff structure. There is therefore no reason why this tolerance margin granted to electricity produced by offshore wind turbines is not applicable to other equally unpredictable modes of electricity production. On 19 November 2004, the renewable energy sector — EDORA for Wallon and Brussels producers, ODE Vlaanderen for Flemish producers — sent a note to the federal government ministers asking them to apply this tolerance mechanism to the entire sector, due to the difficulty of correctly predicting the amount of electricity to be supplied.
In December 2004, this note was presented to Mr. Vertessen, adviser to Minister Verwilghen who acknowledged the existence of the problem, without providing a response, at the time.
In its opinion of 27 April 2004, the CREG General Council also acknowledged this problem and its negative impact on the functioning of the electricity market. He called for measures to be taken.
This issue has been on the table for over a year now. So far, no provisions have been taken. The bill that is submitted to us today provides an answer only for wind power produced from offshore wind turbines.
I just removed the argument that this is a regional competence.
The minister also advanced as an argument that these are much more efficient new technologies. However, their innovative nature makes production prediction more difficult, which could lead to profitability problems.
In this regard, I consulted with the producers. It appears that the profitability of a wind turbine is directly dependent on production, which itself depends on the dimensioning of the machines, the speed and the quality of the wind. Only wind currents flowing laminarily can be converted into useful energy by a wind turbine. Therefore, any rough surface that brakes the wind or causes turbulence decreases its quality. This is why it is interesting to place wind turbines at sea since the wind is more regular and of a more constant quality. This tends toward greater stability and greater predictability of offshore production.
The large distance of the wind turbines from the coast complicates maintenance and reduces the availability of wind turbines, resulting in reduced yield but, in any case, this does not affect the predictability of production. However, the margin of tolerance concerns predictability and not quantity of production. Predictability does not depend on the type of turbine or its location but on the performance of wind prediction tools. These existing tools, used for both onshore and offshore production, are the same.
The main technological differences between onshore and offshore wind turbines concern the foundations and materials used to withstand currents and salt corrosion – which has nothing to do with how to produce, capture the wind and convert this energy into electricity – the ventilation and cooling of the wind turbine and the need to provide, inside the wind turbine, with equipment to protect workers who ensure the maintenance of offshore wind turbines. On the principle of operation, there is no difference. Nothing can justify this difference in treatment.
In addition to onshore and offshore wind turbines, it is clear that this measure should also concern electricity produced from photovoltaic solar panels and micro-hydroelectric power plants, which, too, experience greater unpredictability in terms of the amount of electricity they will be able to send into the grid.
My amendment on this margin of tolerance, if it recognises the positive character of it, aims to allow a 30% difference between what is announced and what is produced before there is a penalty, but this must apply to all renewable energy sources.
I do not know if there is any doubt about the regional or federal competence in this matter. However, if the federal arrangement is taken, Article 5 of the Royal Decree of 11 October 2002 on public service obligations in the context of the electricity market and Article 317 of the Royal Decree of 19 December 2002 establishing a technical regulation for the management of the electricity transmission network and access to it provide for a range of tolerance relating to the balance, the benefit of renewable energies and cogeneration units.
In the same order of ideas, Article 5, §7 of the Royal Decree of 4 April 2001 establishing the tariff structure of the national transmission system operator provides that: "In respect of electricity production units using renewable energies of limited predictability", the tariffs for auxiliary services "contain a reduction coefficient allowing to reflect the characteristics of the total parc of these units grouped by type of energy".
All of these elements indicate that the draft under consideration introduces a discrimination against Belgian and European legislation.
I would also like to make a comment on the increase in the amount and duration of the purchase of offshore wind power by Elia which is envisaged in the draft decision and which is motivated by the need to better reflect the production costs of these installations.
It is curious that the federal government refuses to adapt in the same way and for the same reasons the repurchase amounts of electricity produced by onshore installations as it does for other modes of production of electricity, this is all the more curious that there is a demand from the Regions, in particular the Brussels Region and the Walloon Region which are ⁇ targeted by the other modes of production of electricity.
Again, the fact of providing for a minimum purchase price for the production of green electricity falls within the federal and not regional competence. My amendment aims to correct this situation.
Green electricity producers fear a market imbalance.

Apparently, there has been no analysis of the potential negative impact of the provisions of this project. Based on the information at my disposal, the meeting of the Consultation Committee between the Federal and the Regions agreed at the maximum on the need for a prior cooperation agreement to the harmonisation of green certificate mechanisms.
Therefore, we are facing necessary provisions to support offshore. Basically, I don’t have any problems with channeling. However, this was accomplished without taking into account other producers, ⁇ to please some audiences, ⁇ by trusting only the Flemish Region and the coastal region, in the head of Mr. In the midst, and ⁇ in the midst. by Lanotte. Mijnheer de voorzitter, heren ministers, collega's, ik voer het woord over het hoofdstuk Energie in het ontwerp van wet houdende diverse bepalingen. Ik heb een paar bemerkingen vooraf. Opvallend is dat de elektriciteitswet nog maar pas goedgekeurd is in de Kamer en er worden nu al belangrijke toevoegingen en wijzigingen aan de wet aangebracht. Bovendien is er geen overleg geweest met de Gewesten, alweer niet, mijnheer de minister. De minister is de Gewesten blijkbaar niet zo genegen. Ten slotte valt te betreuren dat dergelijke belangrijke beslissingen verdronken worden in een wet met diverse bepalingen.
In het wetsontwerp worden drie belangrijke aangelegenheden geregeld, de regeling voor offshore windmolens, het degressief elektriciteitstarief voor grote en energie-intensieve bedrijven en de mogelijkheid tot beroep tegen de beslissingen van de CREG. Mijnheer de voorzitter, ik zou vooraf willen opmerken dat tijdens de besprekingen in verband met energie in de commissie niemand, maar dan ook niemand van de meerderheid ook maar iets heeft gezegd. Niemand van de meerderheid vond het nuttig of nodig om aan het debat deel te nemen. Energiedossiers zijn weliswaar technisch, maar ze raken de portemonnee van de mensen en de concurrentiepositie van de bedrijven. Wat inzake energie opgenomen is in de wet, zal opnieuw onze elektriciteit niet goedkoper maken, wel integendeel.
In het wetsontwerp krijgt wat ik noem de deal van Gembloux zijn wettelijke basis. Ik noem het de deal van Gembloux, omdat toen drie dossiers aan elkaar werden gekoppeld, ten eerste de gas- en de elektriciteitswet, ondertussen reeds goedgekeurd, en ten tweede de financiële regeling voor het offshore windmolenpark C-Power. Ondertussen weten we dat er een tweede consortium een domeinconcessie vraagt. Ten derde gaat het om het degressief elektriciteitstarief voor grote en energie-intensieve bedrijven. Minister Vande Lanotte wou de gas- en elektriciteitswet niet goedkeuren als ook het dossier van C-Power niet samen werd geregeld. Minister Verwilghen gaf toe en kreeg als beloning het degressief tarief voor bedrijven. Misschien is dat een van de redenen voor de passiviteit van de meerderheid tijdens de besprekingen in commissie. De constructie is in evenwicht: iedereen is bediend.
Ten eerste, wat de offshore windmolenparken betreft, zeewindmolens moeten fors gesubsidieerd worden om rendabel te zijn. Wat wordt er bepaald? Een eerste belangrijke bepaling is dat de zeekabel die de Thorntonbank met het vasteland verbindt, voor een derde zal betaald worden door de elektriciteitsverbruikers met een maximum van 25 miljoen euro gespreid over vijf jaar. Er komt een regeling voor groenestroomcertificaten, uit te werken bij koninklijk besluit, waarbij voor twintig jaar de garantie gegeven wordt dat de minimumwaarde van de groenestroomcertificaten 107 euro per megawattuur zal bedragen. De financiële sanctie die normale producenten van elektriciteit moeten betalen voor verschillen tussen wat ze aankondigen te zullen produceren en wat ze effectief produceren, wordt voor de zeewindmolens fors afgezwakt. Eigenlijk betekent het dat het evenwicht tussen de aangekondigde productie en de effectieve productie verlaten wordt.
Op deze manier wordt ook het streven naar evenwicht tussen productie en afname verbroken. Mijnheer de minister, ik heb dit ook in de commissie gezegd: ik vind dit een bijzonder gevaarlijke piste.
Deze productieafwijking geldt trouwens ook voor nieuwe producenten, ongeacht de aard van de energie, als ze minder dan 10% vertegenwoordigen op de markt. Ik zou willen zeggen dat voor windenergie een productieafwijking eventueel nog te verdedigen valt, maar zeker niet voor om het even welke nieuwe energieproductie, wat ook de aard van de energie is. Ik vind dit een bijzonder belangrijk punt, omdat men hier echt raakt aan een bestaand evenwicht. Het nieuwe systeem van productieafwijking kan leiden tot verstoringen van de energievoorzieningen. Zowel een overproductie in functie van de afname of een onderproductie in functie van de afname kunnen stroomonderbrekingen tot gevolg hebben, waarvan consumenten en bedrijven de dupe kunnen zijn. Beide situaties hebben zich reeds voorgedaan en konden al vaker op het nippertje afgewend worden. Ik vind de piste van productieafwijking een bijzonder risicovolle piste. Het risico van stroomonderbreking wordt op deze manier geïnstalleerd; het wordt via een wet geïnstalleerd.
Ook de Raad van State heeft terzake trouwens een opmerking gemaakt en stelt in zijn advies dat, ik citeer: "Het verdient aanbeveling eerst de regel van het na te streven evenwicht tussen de injecties en afnames van elektrisch vermogen in de regelzone in de wet op te nemen, waarna bepalingen kunnen worden opgenomen betreffende de tolerantiemarge en waarin de Koning de mogelijkheid wordt geboden om in afwijkingen te voorzien op die marge".
Hier worden die productieafwijkingen in de wet geregeld, hier wordt het risico van stroomonderbrekingen met alle bijbehorende risico's voor de gebruikers, voor de gezinnen, voor de bedrijven, in de wet geïnstalleerd.
Ik heb daarnaast nog een aantal bedenkingen. Een. Wie investeert of wil investeren in zeewindenergie, vraagt zekerheid. Die zekerheid moet kunnen worden geboden. Men zal niet investeren in windenergie als er geen zeker juridisch kader is, naast een zeker politiek kader. Mijnheer de minister, we kunnen de kostprijs van zeewindmolenparken toch ook niet terzijde laten liggen, want iedereen betaalt tenslotte mee. Als we de kabel buiten beschouwing laten en de balancing cost niet meerekenen en dus alleen rekening houden met de kostprijs van de groene stroomcertificaten, leert een kleine berekening ons het volgende. De subsidie van 107 euro per megawattuur via de groene stroomcertificaten komt neer op een subsidie van 0,1 euro per kilowattuur. Ter vergelijking, een kilowattuur elektriciteit uit een kerncentrale of uit een Stegcentrale kost ongeveer 0,04 euro.
Het is evident dat er inspanningen moeten worden geleverd om onze elektriciteitsproductie te verduurzamen. Ook wij zijn voorstander van hernieuwbare energie, ook wij zijn voor windenergie. Het punt is of dit project een kostenefficiënt antwoord is.
Anders gezegd. Kunnen de milieudoelstellingen niet op een goedkopere manier worden gehaald? Dit is, mijns inziens, de vraag die we moeten kunnen en durven te stellen. Zijn de zeewindmolens een te duur prestigeproject?
Ten tweede, volgens mij is er onduidelijkheid in verband met de financiële regeling bij intrekking of stopzetting van het project na de inwerkingtreding. Dat er bepalingen zijn opgenomen in de wet over mogelijke stopzetting doet vermoeden dat dit risico niet onbestaand is en men zich wil indekken. De hoge maatschappelijke kosten zouden wel eens snel — zo vrezen sommigen — tot ontnuchtering kunnen leiden.
De zeewindmolens krijgen via dit wetsontwerp en via de regeling van de groene stroomcertificaten een voordeelregeling ten opzichte van windmolens aan land. Mevrouw Gerkens is hierop uitvoerig ingegaan. Zal dit geen oneerlijke concurrentie met zich brengen? Zeewindmolens zijn een federale materie. Windmolens te lande zijn een Gewestbevoegdheid. Er is duidelijk geen overleg geweest, mijnheer de minister. Dit is des te jammer, nu blijkt dat deze materie duidelijk een gemengde materie is en de federale wetgeving het risico inhoudt dat men discriminerend zal optreden inzake het beleid dat de regels kan invoeren inzake landwindmolens. Ik geef een paar voorbeelden. De voordeelregeling voor de zeewindmolens kan gevolgen hebben voor het regionale groene stroombeleid en de regionale certificatenpolitiek. Dat heeft ook mevrouw Gerkens gezegd. De productieafwijking en de tolerantiemarge gelden alleen voor zeewindmolens, niet voor windmolens op het land. Het kan toch niet dat over dergelijke verregaande bepalingen geen overleg is met de Gewesten. Dit is op termijn moeilijkheden zoeken.
Ten vierde, de stimulansen voor zeewindmolens moeten door iedereen, ook door de bedrijven, worden betaald. Voor alle bedrijven komt er een extra heffing op elektriciteit bij. Zonder bijkomende maatregelen zal het voordeel van de degressieve tarieven voor de bedrijven — waar ik straks op terugkom — grotendeels opnieuw verloren gaan in de mate dat de Thorntonbank operationeel wordt, wat nog niet voor morgen is maar wellicht vanaf 2007.
Het ontwerp bepaalt expliciet dat de meerprijs ingevolge de subsidiëring van de zeewindmolens niet groter mag zijn dan de vermindering die de bedrijven genieten tengevolge van de degressieve tarieven. In de toelichting geeft de regering aan dat vanaf 2008 een budgettaire versterking van het degressief tarief noodzakelijk zal zijn om de meerkost van het windmolenpark te compenseren.
Daarmee geeft de regering toe dat de kostprijs van de subsidiëring van de zeewindmolens hoog oploopt en in de toekomst nog hoger zal oplopen.
Ten slotte heb ik nog een idee, mijnheer de minister, een suggestie. De vraag kan gesteld worden of de Thorntonbank en andere niet genaamde maritieme banken ook niet voor andere energieproductie of -opslag kunnen worden gebruikt. Er is een studie van de KU Leuven van 1975, die toen voorstelde om van de Thorntonbank omwille van zijn ligging in zee en ver van de kust een polyvalent energie-eiland te maken of te creëren, met bijvoorbeeld LNG-aanleg, bijvoorbeeld een kerncentrale — dat werd toen in die studie gezegd — en met windmolens. Dat polyvalent energie-eiland kan ook nuttig zijn om de met offshore-activiteiten gepaard gaande kosten te spreiden en af te schrijven. Ik denk dat het een idee is dat nog eens opnieuw onderzocht wordt wat de mogelijkheden zijn van een polyvalent energie-eiland op de Thorntonbank, maar ook op andere maritieme banken.
Ik kom op een tweede punt uit het ontwerp terug, met name het degressief tarief voor de grote en energie-intensieve bedrijven. Die maatregel werd al beloofd op de superministerraad van Gembloux in januari 2004. De invoeringsdatum zou 1 juli 2004 zijn.
Het probleem voor de bedrijven is de federale bijdrage op de kilowattuur die geheven wordt ter financiering van andere fondsen, zoals het sociaal fonds, het Kyoto-fonds, de CREG, de OCMWmaatregelen inzake stookolie, het nucleair passief enzovoort. Die federale bijdrage doet de prijs van elektriciteit oplopen voor de individuele verbruiker, maar ook voor de bedrijven.
Aan de bedrijven werd in januari 2004 beloofd dat hun federale bijdrage geplafonneerd zou worden vanaf 1 juli 2004. Maar op de Ministerraad van maart 2004 in Raversijde werd duidelijk dat de invulling en toepassing van dat systeem toch niet zo eenvoudig waren als gedacht. De toepassing van het mechanisme werd bijgevolg uitgesteld tot 1 juli 2005. Nu wordt, via een amendement door de regering ingediend op het ontwerp, de toepassing nog maar eens uitgesteld tot 1 oktober, tot groot ongenoegen natuurlijk van de bedrijven, die wel blij zijn dat het er uiteindelijk komt, maar die toch lang hebben moeten wachten op de uitvoering van de belofte.
De plafonnering zelf van de federale bijdrage voor bedrijven die meer dan 20 megawattuur verbruiken en het degressief tarief, is positief. Het is beloofd en het moet uitgevoerd worden. Voor energieintensieve bedrijven is energie een serieuze en belangrijke kostenfactor geworden.
De verminderde inkomsten, als gevolg van de invoering van het degressief tarief, worden echter gecompenseerd door, ik citeer: "een verhoging van de accijns op diesel ten bedrage van 7 euro per 1.000 liter in 2005, 14 euro per 1.000 liter in 2006 en 21 euro per 1.000 liter vanaf 2007." Mocht dit niet voldoende zijn, dan kan een bijkomende financiering gevonden worden via een accijns op steenkool, cokes en bruinkool. Als dat dan nog onvoldoende zou zijn, dan wordt een gedeelte van de vennootschapsbelasting herbestemd.
Mijnheer de minister, wij hebben het reeds gezegd en ik herhaal het nog maar eens, voor ons is het onaanvaardbaar dat de gewone dieselrijder de factuur betaalt voor de grote bedrijven. De liberalisering van de elektriciteitsmarkt wordt volledig afgewimpeld op de gewone man of vrouw. Hij of zij moet de federale energiebijdrage betalen, want wij betalen die allemaal en bovendien betalen wij een tweede keer op het ogenblik dat wij tanken aan het tankstation. Het is ook niet de professionele dieselrijder die zal betalen, het is de gewone man of vrouw, die de auto gebruikt om naar het werk te gaan, om boodschappen te doen, om weekenduitstappen te doen, om kinderen naar school te brengen, enzovoort. Mijnheer de minister, een degressief tarief voor energie-intensieve bedrijven: ja. Financiering door dieselrijders: neen.
Ik wens dit des te meer te benadrukken nu uit een studie van de VAB blijkt dat nergens in Europa de brandstofprijzen aan de pomp het voorbije jaar zo sterk gestegen zijn als in België. Dit is het rechtstreekse gevolg van de accijnsverhogingen die ingevoerd werden sinds 2003. België is inzake dieselprijs het duurste land van alle onderzochte landen. Dit maakt, om het met de woorden van Luk Van der Kelen op de opiniebladzijde van Het Laatste Nieuws van vanmorgen te zeggen: "België kan vandaag gelden als het land met de hoogste druk inzake personenbelasting, de hoogste BTW, de hoogste energiefactuur, de hoogste telefoonkosten, de hoogste sociale lasten, nu ook de hoogste dieselprijs en aan de top inzake benzine."
Om het degressief tarief te kunnen invoeren, werd de wijze van inning van de federale bijdrage gewijzigd. Voortaan zal de federale bijdrage rechtstreeks worden betaald door de eindafnemers — de verbruikers, zijnde gezinnen en de bedrijven — aan de leveranciers, voor elke kilowattuur die zij van het net afnemen voor eigen gebruik. Dit is een vereenvoudiging waar wij achter kunnen staan, mijnheer de minister, maar de verdere procedure is nog hopeloos ingewikkeld, want deze federale bijdrage, die iedereen betaalt, wordt gestort in een fonds.
Dat fonds moet dan op zijn beurt de andere fondsen financieren: het Fonds voor de CREG, het Fonds voor het nucleair passief, het Fonds voor Kyoto enzovoort. Jaarlijks moet men voor elk van die fondsen de noden en behoeften vastleggen. De behoefte van de CREG wordt bijvoorbeeld jaarlijks opnieuw vastgelegd. Die noden moeten daarna worden overgebracht naar dat fonds. Dan pas kan worden vastgelegd wat de federale bijdrage zal zijn. Mijnheer de minister, ik vrees dat men zal vastlopen. De timing zal hopeloos in de war geraken. En wij zullen, zoals wij al vaker hebben moeten doen, beslissingen moeten nemen met terugwerkende kracht.
Nog een punt waarvoor ik vaker opkom, ik betreur dat er geen overleg meer is in de sector. Vroeger werden beslissingen bijvoorbeeld inzake tarieven genomen door het controlecomité. In het controlecomité waren de diverse actoren aanwezig. In het controlecomité werden op basis van een maatschappelijke consensus en met zorg voor de werkgelegenheid de tarieven vastgelegd voor particulieren en bedrijven. Er was kritiek op het controlecomité. Nu is er evenwel helemaal geen overleg meer. Het is de minister of de Ministerraad die beslist. Wij hebben dringend opnieuw nood aan een intersectoraal energieoverleg.
Ik kom tot mijn derde punt, de beroepsmogelijkheden tegen de CREG. Mijnheer de minister, wij zijn voor de invoering van beroepsmogelijkheden tegen de CREG, maar de wijze waarop die werden ingevuld, heeft onze goedkeuring niet. De bedoeling van het wetsontwerp is te komen tot snelle, werkbare, duidelijke en wettige beroepsprocedures. De vraag is of dat het geval zal zijn in de praktijk. Wij hebben daar zo onze vragen bij.
Ten eerste, de invoering van een specifieke procedure in de sector wijst in feite ook op het gebrekkig functioneren van de klassieke algemene procedure, die in onze wetgeving is ingeschreven, namelijk de procedure via de Raad van State. In plaats van de algemene werking van ons rechtssysteem te verbeteren, voert men nu een uitzonderingsprocedure in voor een bepaalde sector. Indien de voorkeur voor het hof van beroep is ingegeven door de lange duur van de gewone procedures bij de Raad van State — dat hebt u gezegd in de commissie —, kon dan niet worden volstaan door in het wetsontwerp inzake beroepsprocedures een bepaling in te voeren die de Raad van State verplicht de zaak volgens de procedure in kort geding te behandelen en die de procedure aan dezelfde termijnen van orde onderwerpt.
Ten tweede, het wetsontwerp stelt in bepaalde gevallen een interventie van de Raad voor de Mededinging in het vooruitzicht, namelijk voor de maatregelen waarbij beslissingen van de CREG marktverstorend of belemmerend kunnen zijn. Ook hierbij heb ik diverse vragen en bedenkingen.
De procedure bij de Raad voor de Mededinging is een procedure ex post. Deze instantie treedt in principe niet preventief op maar pas nadat een of meerdere ondernemingen zich daadwerkelijk schuldig hebben gemaakt aan anticoncurrentiepraktijken. Mijnheer de minister, beschikken de dienst en de Raad over de nodige expertise om in dit specifieke domein van energie te kunnen optreden? Ik vrees van niet. Ik weet bijna zeker dat dit niet het geval is.
De vraag is hoe u dit zult oplossen. Een mogelijkheid zou bijvoorbeeld kunnen zijn dat personeel van de CREG wordt overgeheveld naar de dienst Mededinging. Waarom niet? Men ontneemt de CREG bevoegdheden en de CREG zou dus met minder personeel en minder budgetten kunnen toekomen. Zou dit een piste kunnen zijn om de dienst voor de Mededinging te versterken met expertise op het vlak van energie? We mogen immers niet vergeten dat het hier gaat om een zeer specifieke materie waarvoor de dienst en de Raad op dit ogenblik niet zijn uitgerust. Ik verneem dus graag van u hoe u dit probleem van mensen en middelen bij de Raad voor de Mededinging zult oplossen.
De vraag is ook of de procedure voor de Raad voor de Mededinging een snellere afhandeling van de dossiers met zich zal brengen. Ik heb alle redenen om daaraan ernstig te twijfelen. In het wetsvoorstel wordt aan de Raad voor de Mededinging zelfs geen enkele termijn opgelegd. Hoe kunt u dan op dit ogenblik beweren dat dit een snellere en efficiëntere procedure zou zijn dan nu het geval is?
Is er in het wetsontwerp geen sprake van discriminatie ten nadele van de CREG? Volgens ons is er wel degelijk discriminatie tussen enerzijds de CREG en anderzijds de netbeheerders, vervoersondernemingen en marktoperatoren. Terwijl deze laatsten eventuele onwettige beslissingen van de CREG kunnen laten rechtzetten via een versnelde beroepsprocedure, biedt het wetsontwerp inzake de beroepsprocedure de CREG echter niet de mogelijkheid om via een versnelde beroepsprocedure de eventueel onwettige beslissingen, afspraken of gedragingen van netbeheerders, vervoersondernemingen en marktoperatoren aan te vechten. Mijnheer de minister, wij hebben daarover gediscussieerd tijdens de bespreking van de gas- en elektriciteitswet. Over deze wet werd onlangs gestemd. We hebben er toen op gewezen dat het feit dat u opnieuw het begrip reële kosten invoerde, tot een explosie van onkosten zou leiden waarvan de consument en de bedrijven het gelag zouden moeten betalen. Wij waren toen van mening dat de opening naar het mogen doorrekenen in de tarieven van alle reële kosten, kostprijsverhogend zou werken. Niemand die het toen begreep of wou begrijpen of ons argument steunde.
Mijnheer de minister, nu hebben we al een eerste bewijs. Alle honoraria voor advocaten kunnen in de reële kosten opgenomen worden. De processen kunnen beginnen. U en ik zullen dit betalen.
Ik kom tot mijn conclusie, mijnheer de minister. De beroepsprocedures tegen de CREG zullen, vrezen wij, niet leiden tot snellere en efficiëntere procedures. Ze zullen kostenverhogend zijn en aldus de kostprijs van onze energie zeker verhogen.
Ik kom tot mijn besluit over het geheel van de bepalingen inzake energie. CD&V zal zich onthouden bij de bepalingen inzake energie.

It is remarkable that the Electricity Act has just been approved in the House and there are already important additions and amendments to the law. In addition, there has been no consultation with the West, again not, Mr. Minister. The minister is apparently not so affectionate to the regions. Finally, it is regrettable that such important decisions are drowned in a law with various provisions.
The draft law addresses three key issues, the regime for offshore windmills, the degressive electricity tariff for large and energy-intensive companies and the possibility of appeal against the decisions of the CREG. Mr. Speaker, I would like to point out in advance that during the energy-related discussions in the committee, no one, but no one of the majority, said anything. None of the majority found it useful or necessary to participate in the debate. Energy records are technical, but they affect people’s wallets and the competitive position of companies. What energy is included in the law will not make our electricity cheaper again, but on the contrary.
In the bill, what I call the Gembloux deal gets its legal basis. I call it the Gembloux deal because at that time three files were linked together, first the Gas and Electricity Act, in the meantime already approved, and second the financial arrangement for the offshore wind farm C-Power. Meanwhile, we know that a second consortium is asking for a domain concession. Third, the degressive electricity tariff for large and energy-intensive companies. Minister Vande Lanotte did not want to approve the gas and electricity law if the C-Power file was not arranged together. Minister Verwilghen admitted and received as a reward the degressive rate for companies. Per ⁇ that is one of the reasons for the passivity of the majority during the discussions in committees. The construction is balanced: everyone is served.
First, as regards offshore windmills parks, sea windmills need to be heavily subsidized to be profitable. What is determined? A first important provision is that the sea cable that connects the Thorntonbank with the mainland will be paid for a third by the electricity consumers with a maximum of 25 million euros spread over five years. There will be a scheme for green power certificates, to be developed by royal decree, giving for 20 years the guarantee that the minimum value of green power certificates will be 107 euros per megawatt hour. The financial penalty that normal electricity producers must pay for differences between what they announce they will produce and what they actually produce is greatly eased for the sea windmills. In fact, it means that the balance between announced production and effective production is abandoned.
In this way, the quest for balance between production and decrease is also broken. Mr. Minister, I also said this in the committee: I find this a ⁇ dangerous track. Their

Second, I believe that there is uncertainty regarding the financial arrangement when the project is withdrawn or discontinued after its entry into force. The fact that provisions are included in the law on possible discontinuation suggests that this risk is not non-existent and one wants to cover itself. The high social costs could soon, as some fear, lead to discouragement.
Through this bill and through the system of green electricity certificates, the sea windmills are granted a preferential scheme over windmills on land. Ms. Gerkens has discussed this in detail. Will this not lead to unfair competition? Sea windmills are a federal matter. Windmills to land are a district competence. There was no discussion, Mr. Minister. This is even more unfortunate, now that it turns out that this matter is clearly a mixed matter and the federal legislation presents the risk of discriminatory action with regard to the policy that can introduce the rules on land windmills. I give a few examples. The preferential scheme for sea windmills may affect the regional green power policy and the regional certification policy. This was also said by Mrs. Gerkens. The production deviation and the tolerance margin apply only to sea windmills, not to windmills on land. However, it is not possible that such extensive provisions are not consulted with the Regions. This is looking for difficulties in the long run.
Fourth, the incentives for sea windmills must be paid by everyone, including the companies. For all companies, an additional electricity tax will be added. Without additional measures, the benefit of the degressive rates for companies — which I will return to later — will largely be lost again to the extent that the Thorntonbank becomes operational, which is not until tomorrow but probably from 2007.
The draft explicitly stipulates that the surplus price resulting from the subsidisation of the sea windmills should not be greater than the reduction that the undertakings benefit from the degressive rates. In the explanatory note, the Government indicates that from 2008 a budgetary reinforcement of the degressive rate will be necessary to compensate for the surplus cost of the wind farm.
With this, the Government acknowledges that the cost of subsidizing the sea windmills is rising high and will rise even higher in the future.
Finally, I have another idea, Mr. Minister, a suggestion. The question can be raised whether the Thorntonbank and other non-named maritime banks can also be used for other energy production or storage. There is a study by the KU Leuven of 1975, which then proposed to make or create from the Thorntonbank, because of its location in the sea and far from the coast, a versatile energy island, for example with LNG facilities, for example a nuclear power plant — which was then said in that study — and with windmills. That versatile energy island can also be useful in spreading and depreciating the costs associated with offshore activities. I think it’s an idea to re-examine the possibilities of a polyvalent energy island on the Thorntonbank, as well as on other maritime banks.
I will return to a second point from the draft, in particular the degressive rate for large and energy-intensive companies. That measure was already promised at the superminister council of Gembloux in January 2004. The date of introduction would be 1 July 2004.
The problem for the companies is the federal contribution on the kilowatt-hour charged to finance other funds, such as the Social Fund, the Kyoto Fund, the CREG, the OCMW measures on fuel oil, the nuclear passive and so on. That federal contribution raises the price of electricity for the individual consumer, but also for the companies.
The companies were promised in January 2004 that their federal contribution would be plafoned from 1 July 2004. But at the Council of Ministers in March 2004 in Raversijde it became clear that the implementation and application of that system was not as simple as thought. The application of the mechanism was therefore postponed until 1 July 2005. Now, through an amendment submitted by the government to the draft, the application is once again postponed until 1 October, to great dissatisfaction of course of the companies, who are glad that it will eventually come, but who have yet to wait long for the implementation of the promise.
The ceiling itself of the federal contribution for companies consuming more than 20 megawatts and the degressive rate is positive. It is promised and it must be carried out. For energy-intensive companies, energy has become a serious and important cost factor.
However, the reduced income, as a result of the introduction of the degressive rate, is compensated by, I quote: "an increase in the excise on diesel in the amount of 7 euros per 1,000 liters in 2005, 14 euros per 1,000 liters in 2006 and 21 euros per 1,000 liters from 2007." If that is not enough, then a part of the corporate tax will be redefined.
Mr. Minister, we have already said it and I repeat it again, for us it is unacceptable that the ordinary diesel driver pays the invoice for the big companies. The liberalization of the electricity market is completely offset to the ordinary man or woman. He or she must pay the federal energy contribution, because we pay them all, and in addition we pay a second time at the moment we refuel at the gas station. It is also not the professional diesel driver who will pay, it is the ordinary man or woman, who uses the car to go to work, to shop, to make weekend trips, to bring children to school, and so on. A degressive rate for energy-intensive companies: yes. Financing by diesel drivers: no.
I would like to emphasize this even more now that a study by the VAB shows that nowhere in Europe the fuel prices at the pump have increased so sharply in the past year as in Belgium. This is a direct consequence of the excise tax increases introduced since 2003. Belgium is the most expensive country of all the countries surveyed in terms of diesel prices. In the words of Luk Van der Kelen on the opinion page of Het Laatste Nieuws van vanmorgen: “Belgium can be considered today as the country with the highest pressure in terms of personal tax, the highest VAT, the highest energy invoice, the highest telephone costs, the highest social burden, now also the highest diesel price and at the top in terms of gasoline.”
In order to introduce the degressive rate, the method of collecting the federal contribution was changed. From now on, the federal contribution will be paid directly by the end customers — consumers, households and ⁇ — to the suppliers, for every kilowatt-hour they take from the grid for their own use. This is a simplification that we can support, Mr. Minister, but the further procedure is still hopelessly complicated, because this federal contribution, which everyone pays, is deposited in a fund.
That fund must then, in turn, finance the other funds: the CREG Fund, the Nuclear Passive Fund, the Kyoto Fund, and so on. Each year, the needs and needs of each of these funds should be identified. For example, the need for the CREG is re-established annually. These needs should then be transferred to that fund. Only then can be determined what the federal contribution will be. Mr. Minister, I am afraid that they will be stuck. The timing will be hopelessly confused. And we will, as we have repeatedly had to do, have to make decisions with retroactive force.
Another point that I am referring to more often, I regret that there is no more consultation in the sector. In the past, decisions on tariffs, for example, were made by the control committee. In the control committee, the various actors were present. In the control committee, on the basis of a social consensus and with a concern for employment, the rates for individuals and companies were fixed. There was criticism of the control committee. However, there is no longer any consultation. It is the Minister or the Council of Ministers who decides. We urgently need an intersectoral energy consultation again.
I will come to my third point, the prospects against the CREG. Mr. Minister, we are in favour of the introduction of appeals against the CREG, but the way they were completed does not have our approval. The purpose of the draft law is to establish fast, operable, clear and legal appeal procedures. The question is whether this will be the case in practice. We have our questions to this.
First, the introduction of a specific procedure in the sector actually also indicates the malfunctioning of the classic general procedure, which is registered in our legislation, namely the procedure through the Council of State. Instead of improving the overall functioning of our legal system, we are now introducing an exemption procedure for a particular sector. If the preference for the Court of Appeal is motivated by the long duration of the ordinary proceedings at the State Council — which you have said in the committee — it could not be sufficient to introduce in the draft law on appeal proceedings a provision which obliges the State Council to deal with the case according to the short-term procedure and which subjects the procedure to the same deadlines.
Second, in certain cases, the draft law provides for an intervention by the Competition Council, namely for the measures in which decisions of the CREG may be market distortions or obstacles. I also have several questions and concerns.
The procedure before the Competition Board is an ex post procedure. This authority does not, in principle, act preventively but only after one or more undertakings have actually committed anti-competition practices. Do the Ministry and the Council have the necessary expertise to act in this specific field of energy? I am afraid of not. I am almost sure that this is not the case.
The question is how you will solve this. One possibility could be, for example, that CREG staff is transferred to the Competition service. Why not ? The CREG is deprived of the powers and the CREG could thus be accomplished with fewer staff and fewer budgets. Could this be a way to strengthen the Competition Service with energy expertise? After all, we must not forget that this is a very specific matter for which the Service and the Council are not currently equipped. I would therefore like to hear from you how you will solve this problem of people and resources at the Competition Council.
The question is also whether the procedure before the Competition Board will lead to a faster handling of the files. I have every reason to seriously doubt this. You remember the Coca-Cola dossier that we have thoroughly questioned you in the committee. What are we fixing? The legislation does not even impose a deadline on the Competition Council. How can you now claim that this would be a faster and more efficient procedure than it is now?
Is there no discrimination in the draft law to the detriment of the CREG? In our view, there is indeed discrimination between, on the one hand, the CREG and, on the other hand, the network operators, transport companies and market operators. However, while the latter could remedy any unlawful decisions of the CREG through an accelerated appeal procedure, the draft law on the appeal procedure does not provide the CREG with the possibility to appeal through an accelerated appeal procedure against any unlawful decisions, agreements or behaviors of network operators, transport companies and market operators. However, network operators, transport companies and market operators, as well as the CREG, can make decisions that can have a significant impact on the liberalization of the gas and electricity market. Therefore, there is no reason to grant an accelerated appeal procedure to the network operators, transport companies and market operators and not to the CREG.
So I come to the lawyer’s fees. The network operators may include all actual costs in their electricity price.
Mr. Minister, we discussed this during the discussion of the Gas and Electricity Act. This law was recently voted. We then pointed out that the fact that you reintroduced the concept of real costs would lead to an explosion of costs for which consumers and ⁇ would have to pay the fee. We were then of the opinion that the opening to being allowed to account for in the rates of all real costs would work cost-price-increasing. No one who understood it or wanted to understand or supported our argument.
We already have the first evidence. All fees for lawyers can be included in the actual costs. The processes can begin. You and I will pay for this.
I come to my conclusion, Mr. Minister. The appeal procedures against the CREG, we fear, will not lead to faster and more efficient procedures. They will be cost-increasing and thus ⁇ increase the cost of our energy.
I come to my decision on the whole of the provisions on energy. CD&V will abstain from the provisions on energy.

Il est assez surprenant d'avoir des études et des conclusions différentes. De plus, bien que les acteurs du onshore et autres aient essayé de vous contacter et de négocier avec vous ces plages de tolérance depuis novembre 2004, vous avez pris une décision uniquement pour un des acteurs, pas pour les autres et ce, sans que ceux-ci ne soient pris en compte.
De même, vous modifiez les conditions du marché. Dans un tel cas, une concertation, une action commune doit être menée avec les Régions et les acteurs du marché, ne serait-ce que pour que chacun des acteurs puisse survivre et se développer correctement.
Je ne suis donc pas du tout satisfaite par vos réponses et je vous invite vivement à rencontrer les acteurs du renouvelable autres que l'offshore, pour qu'ils soient entendus et pour que des corrections et des correctifs puissent être apportés à ce qui sera probablement adopté aujourd'hui.
