Mijnheer de voorzitter, mevrouw de minister, collega's, eerst en vooral wens ik de rapporteur te danken voor zijn zeer degelijk verslag. Ik denk dat de eerlijkheid ook gebiedt om te stellen dat de ontwerpen die hier vandaag in de plenaire zitting worden behandeld op hun tijd komen. In 1998 werden we geconfronteerd met de problematiek van de grondwettelijke bezwaren waardoor de wet op de VI is opgekomen die deels heel veel heeft kunnen opvangen.
Ik denk dat het een goede zaak is dat wij als wetgever een onderscheid maken tussen het ogenblik van de feiten, het ogenblik van de beoordeling van de feiten en het ogenblik waarop een delinquent wordt beoordeeld tijdens zijn strafuitvoering. Een dader kan ten goede — soms misschien ook ten kwade maar we hopen vaak ten goede — evolueren en met die positieve evolutie dient rekening te worden gehouden. Ik denk dat dit ontwerp dan ook in voortzetting van de wet van 1998 tracht die beoordeling meer te individualiseren. Het feit dat de slachtoffers hier een belangrijke rol krijgen en met meer respect zullen worden behandeld kunnen wij alleen toejuichen. Mevrouw de minister, u weet dat wij op sommige vlakken liever andere keuzes hadden gemaakt. Wij vrezen eigenlijk toch enigszins dat deze ontwerpen onder een slecht gesternte zullen starten. Ik kom dadelijk tot wat wij essentieel vinden met betrekking tot die ontwerpen.
Het essentiële wat ons betreft, is dat we vertrekken met zes strafuitvoeringsrechtbanken, dus een per ressort, net zoals er vandaag de dag zes commissies VI zijn.
Mevrouw de minister, u weet dat de commissie-Holsters eigenlijk een strafuitvoeringsrechtbank per provincie suggereerde. Wij weten dat ook u, voortgaande op de suggestie van de commissie-Holsters, dat idee genegen was. Maar op het niveau van de regering werd u teruggefloten door de minister van Begroting, waardoor de zes strafuitvoeringsrechtbanken werden gehandhaafd.
Voor die zes strafuitvoeringsrechtbanken is er een totaal budget extra van 464.000 euro. Dat aantal rechtbanken met slechts dat extra budget, dat is de achillespees van heel het ontwerp.
De commissie VI, die ons toch zeer nuttige adviezen heeft gegeven en die ook onze besprekingen inhoudelijk heeft kunnen spekken, citeer ik even: "Uit het verslag van de commissie voor de Justitie van de Senaat blijkt dat de regering jaarlijks 464.000 euro extra budgetteert voor de oprichting en de werking van de strafuitvoeringsrechtbank. Deze budgettaire gegevens maken hard wat ook ten overvloede uit de tussenkomsten van de minister van Justitie in de senaatscommissie blijkt, namelijk dat er evenveel strafuitvoeringsrechtbanken zijn voorzien als er nu CVI's zijn, dus zes. De minister lijkt zich terdege bewust van de problematiek van de werklast, want zij verwijst nog naar de kennisgeving van de Ministerraad van 25 maart 2005, waar bepaald is dat het aantal kamers kan verhoogd worden. Maar duidelijk is dat de regering vooropstelt met zes strafuitvoeringsrechtbanken te zullen starten en slechts daarvoor is er budget voorzien.
Gelet op artikel 50 van het ontwerp, dat bepaalt dat de wet in werking treedt ten laatste achttien maanden na haar bekendmaking in het Belgisch Staatsblad," — ondertussen is dat, na amendering, vierentwintig maanden — "en het niet voorzien van middelen voor meer dan zes strafuitvoeringsrechtbanken, lijkt dat scenario minstens voor de twee eerste jaren vast te liggen en, naar ervaring leert, waarschijnlijk nog wel heel wat langer.
Zes strafuitvoeringsrechtbanken is evenwel voorspelbaar volstrekt onvoldoende, gelet op de uitgebreide bijkomende bevoegdheden in het ontwerp van de externe rechtspositie gedetineerde. Thans zijn de zes CVI's bevoegd voor de vervroegde vrijstelling van veroordeelden die meer dan drie jaar gevangenisstraf ondergaan en die Belg zijn of vreemdeling met een verblijfstitel voor ons land. Dit gaat om ongeveer 10% van alle vervroegde vrijstellingen.
In de toekomst komen alleen al qua vervroegde vrijstellingen de actueel voorlopige invrijheidsstellingen daarbij — dit is voor straffen tot en met drie jaar — en de voorlopige invrijheidsstellingen met het oog op de verwijdering uit het land, die samen 90% van alle vervroegde vrijstellingen uitmaken.
Naast dit veelvoud aan dossiers vervroegde vrijstelling komen nog eens de al dan niet toekenning van de beperkte detentie en het elektronisch toezicht onder de bevoegdheid van de strafuitvoeringsrechtbank".
Met andere woorden, zes is ruim onvoldoende. Laten we even naar de cijfers kijken waarin we gegrasduind hebben tussen de commissiebesprekingen in. Wat leren ons de cijfers van de commissie-CVI's? De zes CVI's hebben in 2004 1.674 beslissingen genomen. Dat komt neer op 279 beslissingen per commissie per jaar. Als men met magistraten van die commissie spreekt, dan blijkt dat zij daar voltijds mee zijn belast. Dat lijkt mij ook evident. 280 dossiers voorbereiden, adviezen en verslagen lezen, de pleidooien aanhoren, de conclusies doornemen, stukken doornemen, en dan nog nadenken en een vonnis vellen in zeer delicate materies. Dit is geen klein werk waarbij over een dag ijs wordt gegaan. Om die reden zijn er 279 beslissingen per jaar per commissie.
Waar gaan wij naartoe als beide ontwerpen wet worden? In de omzendbrief van januari 2005, die de voorlopige invrijheidstelling regelt voor straffen van minder dan 6 maanden, is sprake van onmiddellijke invrijheidstelling. Over hoeveel dossiers gaat het? De minister antwoordde dat het gedurende een termijn van 11,5 maand ging om 809 dossiers. Als ik dat extrapoleer naar een jaar dan kom ik uit op 840 gevallen waarbij de veroordeelden tot nu onmiddellijk in vrijheid komen terwijl ze vanaf nu allemaal een dossier zullen krijgen.
Ik heb de cijfers uit het jaarverslag van de penitentiaire administratie van 2001. Voor 1999 betroffen de voorlopige invrijheidstellingen voor straffen lager dan drie jaar 4.223. In 2005 waren er voor elektronisch toezicht 277 beslissingen. Daar zullen een hoop herroepingen bij zijn maar dit zal het aantal niet beperken tot 277 vonnissen. Als we navraag doen en men extrapoleert de cijfers komt men uit op ongeveer 1500 dossiers op jaarbasis.
Voor beperkte detentie en halve vrijheid gaat het om 770 dossiers en voor de voorlopige invrijheidstelling met het oog op verwijdering uit het land om 205 dossiers.
Collega's, ik heb de optelsom gemaakt. Zonder herroepingen komen we op 5.475 dossiers uit, met herroepingen naar rato van 1.500 komen we uit op 6.698 dossiers. Ik ga terug naar de situatie van nu met de commissies VI: 1.674 dossiers op jaarbasis met zes magistraten die voltijds belast zijn. Dat betekent dan ofwel een verviervoudiging, ofwel vermenigvuldigd met 3,27. Misschien is het aantal herroepingen op die 1.500 ruim ingeschat, maar er zullen er zeker zijn: daarover zullen we het met zijn allen wel eens zijn. Neem het gemiddelde, dan betekent het dat er meer dan 3,5 keer meer dossiers voor de strafuitvoeringsrechtbanken zullen komen.
Met welke omkadering gebeurt het dan? Met evenveel! Een magistraat nu, een magistraat daarna. Het parket krijgt inderdaad één personeelslid extra voor het parketsecretariaat, maar zal een pak meer werk krijgen, vermits het ook gedeeltelijk belast wordt met de follow-up van dossiers. Voor de strafuitvoeringsrechtbanken zelf zijn er een griffier en een beambte. Wat is de situatie nu bij de commissie VI? Er is een secretaris/secretaresse en een beambte. Dat is evenveel. Men zal dus 3,5 keer meer dossiers doen met knal hetzelfde aantal mensen!
Collega's, dat vraagt om problemen.
Uit de hoorzittingen in de Senaat is duidelijk gebleken dat de justitiehuizen vrezen voor werkoverlast.
Mevrouw de minister, u hebt in uw begroting 2006 inderdaad 3,6% meer budget ingeschreven voor de justitiehuizen, wat 16 extra personeelsleden vertegenwoordigt. Waarvoor dient deze 3%? Zij dient niet voor de strafuitvoeringsrechtbanken. Deze 3% extra was reeds voorzien voor problemen die voor de justitiehuizen nu al op het terrein rijzen.
Collega's, ik verwijs naar het justitiehuis van Dendermonde, waar de beslissingen van de commissies VI niet of nauwelijks worden opgevolgd bij gebrek aan vrouw- of mankracht. Dendermonde staat, wat dat betreft, niet alleen. Het heeft het alleen gedeeltelijk durven uiten.
Bijgevolg wordt er 3,5 keer meer werk gevraagd met net hetzelfde volk. Welnu, dat is vragen om problemen.
Wat zegt de Hoge Raad voor de Justitie daarover? "Het implementeren van wetten, zonder garanties inzake de haalbaarheid, leidt regelrecht tot een verdere aantasting van het vertrouwen van de burger in Justitie en tot ontevredenheid bij de actoren van Justitie. Voorlopig starten met zes strafuitvoeringsrechtbanken zal onmiddellijk leiden tot overbelasting en gerechtelijke achterstand. Het is absoluut noodzakelijk dat er bijkomende werkingsmiddelen komen en een verhoging van het aantal magistraten."
Wat zeggen Erdman en de Leval in hun "Justitiedialogen", die interessant waren en jammer genoeg teloor zijn gegaan? "De publicatie van een tekst moet worden vermeden, wanneer de tenuitvoerlegging niet verzekerd is, omdat de uitvoeringsbesluiten niet klaar zijn of omdat de budgettaire middelen niet beschikbaar zijn. Een aankondiging die niet door een onmiddellijke tenuitvoerlegging wordt gevolgd, brengt de norm in diskrediet."
Dat zal hier het geval zijn. Gesprekken met mensen op het terrein leren ons dat het voorgestelde systeem zal crashen. Wij hebben al in zovele domeinen wachtlijsten. Welnu, wij zullen ook in de justitiehuizen wachtlijsten krijgen, met alle gevaren vandien.
Zullen de magistraten, die de persoonlijkheidskwaliteiten hebben om dergelijk werk te doen dat specifieke eigenschappen en persoonlijkheidskenmerken vereist, zich nog wel kandidaat stellen wanneer zij weten dat zij straks zoveel werk zullen krijgen dat zij het niet gedaan zullen krijgen en dat zij op hun kop zullen krijgen van de actoren die voor hun zetel zullen terechtkomen om te pleiten, omdat zij veel te lang hebben moeten wachten of omdat de zaak opnieuw moet worden uitgesteld wegens overbelasting van de rol? De wet schrijft nochtans voor dat de zaak maar één keer mag worden uitgesteld. Ik vrees dat door die overbelasting en de wachttijden, ook ten nadele van de slachtoffers, deze rechtbanken de facto verplicht zullen worden om louter formalistische beoordelingen te maken. Er is niet alleen de problematiek van de capaciteit op het niveau van de strafuitvoeringsrechtbanken zelf. Ik vrees dezelfde problemen met betrekking tot de capaciteit inzake het elektronisch toezicht. Op dit ogenblik slaagt deze regering er niet in haar eigen regeerakkoord te respecteren en 1.000 elektronische toezichten op jaarbasis te realiseren. In 2005 haalde zij er 277.
Dit ontwerp dat in de mogelijkheid voorziet dat strafuitvoeringsrechtbanken een gevangenisstraf kunnen omzetten in elektronisch toezicht, kan er alleen toe leiden dat er meer elektronisch toezicht zal komen. Wat zal er gebeuren indien daarvoor onvoldoende capaciteit voor bestaat? Wat rechtvaardigt ons om meer vertrouwen te hebben in deze regering dat het wel in orde zal komen als ze haar eigen regeerakkoord op dit punt niet kan respecteren?
Meer nog, CD&V vreest zelfs voor de capaciteit in de gevangenissen. We weten dat de gevangenissen overbevolkt zijn. We weten dat dit geen probleem van gisteren of vandaag is maar reeds langer aansleept en fenomenaal veel geld kost. Voor dit laatste hebben we begrip.
Ik neem het voorbeeld van de voorlopige invrijheidstellingen voor gevangenisstraffen van minder dan zes maand, de 809 dossiers zoals de ministers zegt op 11,5 maanden of 840 dossiers op jaarbasis. Ingevolge de rondzendbrief kwamen deze personen nooit in de gevangenis terecht. Voortaan zullen ze hoe dan ook in de gevangenis terechtkomen, wellicht voor korte duur. Er dient hoe dan ook een beslissing genomen te worden. Met de lange wachtlijsten en rechtsachterstand op het niveau van de strafuitvoeringsrechtbanken in het vooruitzicht, zou het wel eens kunnen dat de 809 uiteindelijk lang zullen moeten wachten vooraleer vrij te komen en de duurtijd dat ze wel in de gevangenis verbleven langer zou kunnen uitvallen, met alle gevolgen van dien voor de capaciteit. De minister heeft terecht gesteld dat de rondzendbrief van 2005 vervalt. Ik vrees evenwel dat door deze ontwerpen ook in de gevangenissen capaciteitsproblemen zullen opduiken.
Collega's, CD&V zou andere keuzes hebben gemaakt, enerzijds inzake het arbitraire onderscheid in functie van de duurtijd van de straf, drie jaar of meer. We weten dat dit zijn inspiratie voor een stuk vindt in de wet op de VI's. Heel het ontwerp is daar, mijns inziens, voor een stuk op gebouwd. Dit heeft ertoe aanleiding gegeven dat dit ontwerp minder transparant is dan het had kunnen zijn. Het criterium van een straf van meer of van minder dan drie jaar zal heel onderscheiden regimes teweegbrengen. Denk maar aan de tegenaanwijzingen. Voor een gevangenisstraf van minder dan drie jaar is de kans op recidive niet opgenomen bij de contra-indicaties.
Hoewel studies aantonen dat recidive voornamelijk voorkomt bij veroordeelden met kortere straffen, is de kans op recidive niet als contra-indicatie opgenomen voor de straffen van minder dan drie jaar. Er is geen sociaal reclasseringsplan bij straffen van minder dan drie jaar, zoals dat wel het geval is bij straffen van meer dan drie jaar. De tijdsvoorwaarden zijn anders. Bij straffen van meer dan drie jaar verschijnt men voor een multidisciplinaire strafuitvoeringsrechtbank, terwijl dat bij straffen van minder dan drie jaar alleen voor een alleenzetelend magistraat is, die bijgevolg geen beroep kan doen op de multidisciplinariteit. Nochtans zijn ook dossiers met straffen van minder dan drie jaar - en ik denk dat we het allemaal daarmee eens zijn - soms zeer complex en is het daar soms wel aangewezen beroep te kunnen doen op die multidisciplinariteit.
Ik begrijp dat het een kwestie is om zo efficiënt mogelijk te proberen te werken. Wat dat betreft, had de commissie-Holsters echter nuttige suggesties. Als bijvoorbeeld de gevangenisdirecteur, het openbaar ministerie en de gedetineerde akkoord gaan - en wij voegen eraan toe dat het slachtoffer hierbij kan worden betrokken en dat ook zijn stem wordt gehoord -, zou men perfect kunnen zeggen dat het alleen door een strafuitvoeringsrechter wordt gehomologeerd. Men doet dat echter niet.
De commissie-Holsters heeft nog een ander voorbeeld gegeven. Als er een negatief advies van de directeur is, de gedetineerde wil een VI en gaat niet akkoord met het voorstel van de directeur en het openbaar ministerie en er is een discussie louter over de bijzondere voorwaarde, dan is het evident dat de multidisciplinariteit op haar plaats is en men onmiddellijk voor een rechtbank komt in plaats van voor een alleenzetelend rechter.
Wij betreuren het dat de suggesties van de commissie-Holsters, door de oppositie vertaald in amendementen, niet mee in overweging werden genomen.
Ook de commissie VI, die toch heel wat ervaring heeft, zegt dat de regeling in artikel 11, waarbij wordt gesteld dat alle dossiers betreffende vrijheidsberovende straffen waarvan het uitvoerbaar gedeelte drie jaar of minder bedraagt, zouden worden behandeld door een alleenzetelende rechter, een delictgericht denken impliceert, terwijl het uitwerken van een reclassering toekomstgericht en ondersteunend moet zijn.
Als we onderhavige ontwerpteksten vergelijken met de wet op de VI's, zien we dat er ook nuanceverschillen zijn waarvoor we moeten opletten.
De wet-Lejeune, een schitterende wet die België op het vlak van justitie op de wereldkaart heeft gezet, stelt dat het een gunst is of was. Ook de wet op de VI's voorzag erin. We zien nu dat in de wet "kunnen" veranderd wordt in "wordt toegekend".
Ik wens in deze zaak niet te polemiseren. Er is inderdaad "het wordt toegekend" in artikel 25 maar er is ook het artikel 28 dat voorwaarden geeft en het artikel 40 dat bijzondere voorwaarden geeft. Ook bij de strafuitvoeringsmodaliteiten geldt het.
Maar we kunnen niet ontkennen dat er een nuanceverschil is. Ik zou niet de term "subjectief recht" willen gebruiken want die is onvolledig, maar "voorwaardelijk subjectief recht".
Vroeger bij de wet op de VI's en daarvoor bij de wet-Lejeune had, als men in orde was met de tijdsvoorwaarden, als er geen contraindicaties waren, als alle adviezen positief waren zowel van de directeur als van de minister als van het personeelscollege, de minister - nu de commissie VI's - de mogelijkheid appreciatiebevoegdheid en opportuniteitsafwegingen te maken.
Ik denk dat dat goed is. Denk maar eens aan dossiers waar men inderdaad aan alle voorwaarden voldoet, maar waar de feiten en de dader-as-such zulk een commotie hebben teweeggebracht in heel onze samenleving, dan vinden wij dat er inderdaad opportuniteitsafwegingen mogen zijn naast het terechte respect voor de positieve persoonlijkheidsevoluties van de gedetineerde. Die zullen er nu veel minder zijn. De strafuitvoeringsrechtbanken zullen beperkt zijn door de wet en door de voorwaarden van artikel 28 en artikel 40. Als de gedetineerde aan die voorwaarden voldoet, dan moet men toekennen.
Risicoloos zal men nooit zijn. Een recent voorbeeld uit de pers heeft dat ook geleerd. Ik vind dat we niemand met de vinger kunnen en mogen wijzen. Een risicoloze samenleving bestaat niet. Maar we moeten wel zo voorzichtig mogelijk zijn. Hier moet het dubbele, zelfs het meervoudige voorzichtigheidsprincipe kunnen spelen.
Ik denk aan een dossier dat in de pers geweest is, het dossier Martin, waarover ik vorige week een vraag gesteld heb in de commissie voor de Justitie. Het dossier-Martin beoordelen in het kader van de wet op de VI's van 1998 of straks in de tekst van dit ontwerp, zal iets heel anders zijn.
Het is mijn overtuiging dat in dit dossier mevrouw Martin gemakkelijker kan, ik zeg niet gemakkelijker zal, vrijkomen dan in de wet op de VI's, precies omdat er geen opportuniteitsafweging meer is en omdat in de wet op de VI's de contra-indicaties ruimer zijn dan de contra-indicaties die er op dit ogenblik in de tekst van het ontwerp zijn. Gelukkig collega Malmendier is uw amendement aanvaard. Het is een goed amendement, het is ook de reden waarom wij het hebben goedgekeurd. Ik was evenwel liever nog verder gegaan en, wat de contra-indicaties betreft, had gewoon de kopie genomen van de wet van 1998.
Dat ging nog iets verder. Het risico is er en we moeten dat in ogenschouw nemen.
Het is een goede zaak dat de slachtoffers een belangrijke rol krijgen bij de beslissing over vervroegde invrijheidstelling of bij die over de strafuitvoeringsmodaliteiten. Het ontwerp komt daar voor een groot stuk aan tegemoet. Het zal zelden voorkomen dat een oppositiepartij een wetsvoorstel indient dat voor sommige aspecten minder verreikend is dan het ontwerp van de regering. Ik geef dat eerlijk toe. De bekommernis waarom wij minder ver gingen, was wel de realiteit van het budget. Zijn er wel de manschappen voor om dat allemaal perfect uit te voeren? Als men een wet maakt, moet men die ook op het terrein kunnen realiseren. Een wet is geen vodje papier; een wet is geen intentieverklaring; een wet creëert rechten en die moeten gerespecteerd worden! Het is goed dat we verder gaan en de slachtoffers van alle misdrijven niet alleen horen, maar hun ook informatie geven. Dan moet men daarvoor wel voorzien in de nodige middelen en mankracht. Wie a zegt, moet ook b durven te zeggen.
Collega's, u weet dat wij er niet mee akkoord kunnen gaan dat de slachtoffers zich burgerlijke partij moeten stellen en dat een burgerlijke partijstelling ontvankelijk en gegrond moet zijn verklaard, alvorens zij recht op informatie hebben en kunnen gehoord worden. Waarom niet? De burgerlijke partijstelling heeft doorheen de geschiedenis altijd een andere invulling gehad dan het verkrijgen van informatie of het gehoord worden. Het werd altijd gelieerd aan het verkrijgen van een vergoeding. Nu gaat u aan dat begrip nog een andere definitie geven en op het terrein zullen de slachtoffers er onvoldoende kennis van hebben. Indien men hier voet bij stuk wenst te houden, zal het een pak informatiecampagnes vereisen. Niet alleen wij zeggen dat, maar ook de heer Pierre Rans dat.
Ik keer even terug naar de discussie in de commissie over de vereiste dat het slachtoffer zich niet enkel burgerlijke partij moet stellen, maar dat die burgerlijke partijstelling ontvankelijk en gegrond moet zijn vooraleer hieraan recht op informatie of recht om te worden gehoord kan worden ontleend. Dat zal problemen opleveren op het terrein, daar heb ik in de commissie al op gewezen.
Ten eerste, wat als het slachtoffer van een ernstig misdrijf volledig vergoed is en geen enkel argument meer heeft om zich burgerlijke partij te stellen? Misschien wenst die dan toch geïnformeerd te blijven en gehoord te worden, maar er is geen belang en de burgerlijke partijstelling zal ongegrond worden verklaard, indien ze überhaupt gesteld wordt, aangezien de schade vergoed is.
Ten tweede, wat doet men met een burgerlijke partij die nagenoeg vergoed is en voor het resterende kleine bedrag niet de kosten van de burgerlijke partijstelling wil doen, vermits het straks meer zal kosten dan het oplevert, in de veronderstelling dat die niet voor rechtsbijstand is verzekerd?
Welnu, ook hij riskeert in de kou te staan, niet gehoord te worden of niet geïnformeerd te worden.
Inzake de problematiek waarnaar ik verwees, wanneer de strafrechter zich reeds heeft uitgesproken over de straf, maar zich nog niet heeft uitgesproken noch over de ontvankelijkheid, noch over de grond van de burgerlijke vordering, van de burgerlijke partijstelling, — ik ben blij dat professor Franchimont, wanneer hem daaromtrent advies werd gevraagd, de stellingname die ik heb geopperd, niet heeft uitgesloten — dan zit men hoe dan ook met problemen.
Ik ben het niet eens met de visie van de professor, die ik overigens zeer waardeer en wiens kennis ik uiteraard alom prijs, wanneer hij stelt dat dat probleem zich inderdaad kan voordoen, maar dat dan kan worden teruggevallen op artikel 2c, namelijk dat men in de onmogelijkheid verkeerde om zich burgerlijke partij te stellen. Dat artikel handelt daarover namelijk niet. Dat artikel gaat wel over gevallen wanneer een partij zich in de materiële onmogelijkheid bevindt om zich burgerlijke partij te stellen, of wanneer hij om kwetsbare of emotionele redenen niet in de mogelijkheid is geweest zich burgerlijke partij te stellen, maar slaat niet op de casus waarnaar wij verwezen hebben. Collega's, dat zal rechtsonzekerheid teweegbrengen, daar waar de wet op de VI's met de vereisten van het belang — het slachtoffer moet belang bewijzen — eigenlijk reeds in een drempel had voorzien die ons inziens juist was en die rechtsspraak had doen ontwikkelen. Collega's, de slachtoffers krijgen rechten. Terecht.
Maar niet alle slachtoffers hebben rechten gekregen in dit ontwerp. De slachtoffers van geïnterneerde daders staan niet in het ontwerp. Wij betreuren dat. We hebben dat ook als eerste gesignaleerd. Wij noteren en nemen er ook akte van dat we in de commissie, met goedkeuring van de minister, afspraken hebben gemaakt, dat daaromtrent een wetsvoorstel ingediend zal worden dat hoogdringend zal worden behandeld in de commissie voor de Justitie. In het licht van de afspraken die er daaromtrent zijn gemaakt, wil ik het volgende suggereren. Dat vergt dat wij daarover na het paasreces onmiddellijk samenkomen met de collega's die daaraan willen werken om een gezamenlijke tekst op te stellen, zodat die kan worden afgewerkt vóór het zomerreces en in werking kan treden samen met het huidige ontwerp, opdat de slachtoffers van geïnterneerde daders een gelijke behandeling krijgen ten opzichte van andere slachtoffers.

The essential thing for us is that we are leaving with six criminal enforcement courts, i.e. one per jurisdiction, just as today there are six committees VI.
Mrs. Minister, you know that the Holster Commission actually suggested a criminal enforcement court by province. We know that you too, based on the suggestion of the Holsters committee, were pleased with that idea. But at the government level you were flooded back by the Minister of Budget, thus ⁇ ining the six criminal enforcement courts.
For these six criminal enforcement courts, there is an additional total budget of 464,000 euros. That number of courts with only that extra budget, that is the Achillespees of the whole draft.
I quote the Committee VI, which has given us very useful advice and which has also been able to analyze our discussions in terms of content: “From the report of the Committee for Justice of the Senate it is clear that the government annually adds 464,000 euros to the establishment and operation of the Penal Execution Court. These budgetary data make hard what is shown in abundance from the interventions of the Minister of Justice in the Senate Committee, namely that there are as many criminal enforcement courts as there are now CVIs, i.e. six. Preparing 280 dossiers, reading opinions and reports, listening to the pleas, reviewing the conclusions, reviewing pieces, and then thinking and making a judgment on very delicate subjects. This is not a small job that goes ice over a day. For this reason, there are 279 decisions per year per committee.
Where will we go if both bills become laws? In the circulation letter of January 2005, which regulates the provisional release for sentences of less than 6 months, there is a question of immediate release. How many files are it? The Minister replied that over a period of 11.5 months, 809 files were involved. If I extrapolate that to a year, I come up with 840 cases in which the convicted so far are immediately released while from now on they will all get a file. Their
I have the figures from the Annual Report of the Penitentiary Administration of 2001. For 1999, the provisional release sentences for sentences less than three years affected 4,223. In 2005, there were 277 decisions on electronic surveillance. There will be a lot of withdrawals, but this will not limit the number to 277 sentences. If we inquire and extrapolate the figures, we come up with about 1500 files on an annual basis.
In the case of limited detention and semi-liberation there are 770 files and in the case of the provisional release for removal from the country there are 205 files.
Ladies and gentlemen, I have made the calculation. Without withdrawals we come out on 5,475 files, with withdrawals to a ratio of 1,500 we come out on 6,698 files. I go back to the current situation with the committees VI: 1,674 files on an annual basis with six full-time magistrates. This means either a quadruple or multiplied by 3,27. Per ⁇ the number of recalls on those 1,500 has been widely estimated, but there will be certainty: we will all agree on this. Take the average, then it means that there will be more than 3.5 times more files before the criminal enforcement courts.
With what transformation does it happen? With equal amount! A judge now, a judge then. The prosecutor’s office will indeed receive one additional staff member for the prosecutor’s secretariat, but will get a lot more work, as it is also partially charged with the follow-up of files. For the criminal enforcement courts themselves, there is a secretary and an official. What is the situation in the Committee VI? There is a secretary/secretary and an official. That is equal. Thus, one will do 3.5 times more files with the same number of people!
That requires problems.
The hearings in the Senate clearly showed that the judiciary houses are afraid of workload.
In fact, in your 2006 budget you entered 3.6% more budget for the judiciary houses, which represents 16 additional staff members. What is this 3% for? It does not serve before the criminal enforcement courts. This 3% extra was already provided for problems that arise for the judiciary houses already on the ground.
Colleagues, I refer to the House of Justice of Dendermonde, where the decisions of the committees VI are not or hardly followed due to lack of female or male strength. Dendermonde is, in this regard, not alone. It has only partially dared to express it.
As a result, there is 3.5 times more demand for work with exactly the same people. Well, that’s questions about problems.
What does the High Court of Justice say about this? “The implementation of laws, without guarantees of feasibility, rightly leads to a further undermining of the citizen’s trust in Justice and to dissatisfaction among the actors of Justice. Provisional launch with six criminal enforcement courts will immediately lead to overload and judicial lag. It is absolutely necessary that there are additional means of action and an increase in the number of magistrates."
What do Erdman and the Leval say in their "Justice Dialogues", which were interesting and unfortunately disappeared? This will be the case here. Conversations with people on the ground teach us that the proposed system will crash. We already have waiting lists in so many areas. Well, we will also get waiting lists in the courts, with all the dangers going on.
Will the magistrates, who have the personality qualities to do such work that requires specific qualities and personality traits, still candidate themselves when they know that they will soon get so much work that they will not get it done and that they will get on their heads of the actors who will come to their seat to defend because they have had to wait too long or because the case needs to be postponed again because of the overload of the role? However, the law stipulates that the case can be postponed only once. I am afraid that this overload and the waiting times, even to the detriment of the victims, will de facto compel these courts to make purely formalist assessments. There is not only the problem of capacity at the level of the criminal enforcement courts themselves. I fear the same problems with regard to electronic surveillance capacity. At the moment, this government fails to respect its own government agreement and realize 1,000 electronic surveillances annually. In 2005, it reached 277.
This draft, which provides for the possibility for criminal enforcement courts to convert a prison sentence into electronic surveillance, could only lead to more electronic surveillance. What will happen if there is insufficient capacity? What justifies us to have more confidence in this government that it will be okay if it cannot respect its own government agreement at this point?
Moreover, CD&V even fears about the capacity in prisons. We know that prisons are overcrowded. We know that this is not a problem of yesterday or today, but it has been drawing for a long time and costs phenomenally a lot of money. For the latter we have understanding.
I take the example of the provisional release orders for imprisonment sentences of less than six months, the 809 dossiers as the ministers say at 11.5 months or 840 dossiers on an annual basis. According to the circular letter, these persons never went to jail. From now on, they will go to jail anyway, ⁇ for a short period of time. In any case, a decision must be made. With the long waiting lists and right-wing backwardness at the level of the penalty enforcement courts in the forecast, it would be possible that the 809 would eventually have to wait a long time before being released and the length of time they were in prison could be longer, with all the effects of this on capacity. The Minister has rightly stated that the circular letter of 2005 expires. However, I fear that these designs will also create capacity problems in prisons.
Colleagues, CD&V would have made other choices, on the one hand, as regards the arbitrary distinction depending on the duration of the sentence, three years or more. We know that this finds its inspiration for a piece in the law on the VI's. The whole design is, in my opinion, built on it for a piece. This has resulted in this design being less transparent than it could have been. The criterion of a sentence of more than or less than three years will result in very different regimes. Think of the contraindications. For a sentence of imprisonment of less than three years, the likelihood of recurrence is not included in the contraindications.
Although studies show that recurrence mainly occurs in convicts with shorter sentences, the likelihood of recurrence is not included as a contraindication for sentences of less than three years. There is no social reclassification plan for sentences of less than three years, as is the case for sentences of more than three years. Time conditions are different. For sentences of more than three years, one appears before a multidisciplinary criminal enforcement court, whereas for sentences of less than three years, that appears only for a single-seat magistrates, who therefore cannot invoke multidisciplinarity. However, cases with sentences of less than three years – and I think we all agree with that – are sometimes very complex and it is sometimes appropriate to invoke that multidisciplinarity.
I understand that it is a matter of trying to work as efficiently as possible. In this regard, however, the Holsters committee had useful suggestions. If, for example, the prison director, the prosecutor’s office and the detainee go through an agreement – and we add that the victim can be involved in this and that his voice is also heard – one could perfectly say that it is only homologated by a criminal enforcement judge. However, it is not done.
The Holsters Committee gave another example. If there is a negative opinion from the director, the detainee wants a VI and disagrees with the proposal of the director and the public prosecutor and there is a discussion merely about the special condition, then it is evident that multidisciplinarity is in place and one immediately comes to a court instead of a single-seated judge.
We regret that the suggestions of the Holsters committee, translated by the opposition into amendments, were not taken into account.
Also the Committee VI, which has a lot of experience, says that the arrangement in Article 11, which stipulates that all cases relating to deprivation of liberty sentences whose enforceable part is three years or less, would be handled by a single judge, implies a delict-oriented thinking, while the preparation of a reclassification must be forward-looking and supportive.
If we compare the present draft texts with the law on the VIs, we see that there are also nuance differences that we should pay attention to.
The law-Lejeune, a magnificent law that has put Belgium on the world map in the field of justice, states that it is or was a favor. The law on the VI’s also provided for it. We now see that in the law "can" is changed to "be granted".
I do not want to polemize on this matter. There is indeed "it is granted" in Article 25, but there is also Article 28 that gives conditions and Article 40 that gives special conditions. This also applies to punishment procedures.
But we cannot deny that there is a nuance difference. I would not like to use the term "subjective right" because it is incomplete, but "conditionally subjective right".
Previously with the law on the VIs and previously with the law-Lejeune, if one was in order with the time conditions, if there were no contraindications, if all opinions were positive both of the director and of the minister and of the staff college, the minister - now the committee VIs - had the possibility to make appreciation authority and opportunity considerations.
I think that is good. Think of cases where one indeed fulfils all conditions, but where the facts and the perpetrator-as-such have caused such a commotion throughout our society, then we find that there can indeed be opportunity considerations in addition to the justified respect for the positive personality variations of the detained. Now they will be much less. Penal enforcement courts shall be restricted by law and by the conditions laid down in Articles 28 and 40. If the detainee meets these conditions, then it must be granted.
You will never be risky. A recent example from the press has also taught that. We can and should not point to anyone with the finger. There is no risk-free society. But we must be as cautious as possible. Here, the double, even the multiple precautionary principle should be able to play.
I think of a dossier that has been in the press, the Martin dossier, about which I asked a question in the Justice Committee last week. Reviewing the file-Martin under the Act on the VIs of 1998 or later in the text of this draft, will be something very different.
It is my conviction that in this file Mrs. Martin can more easily, I say not more easily, release than in the law on the VI's, precisely because there is no more opportunity consideration and because in the law on the VI's the contraindications are wider than the contraindications that are currently in the text of the draft. Thankfully, Mr Malmendier, your amendment was accepted. It is a good amendment, which is also the reason why we approved it. I would have, however, preferred to go even further and, as far as the contraindications are concerned, had simply taken the copy of the 1998 law.
That went a little further. The risk is there and we must take that into account.
It is a good thing that victims are given an important role in deciding on early release or on the terms of execution. The design meets a great deal of this. It will rarely happen that an opposition party submits a bill that is less far-reaching in some aspects than the government’s draft. I honestly admit that. The concern why we went less far was the reality of the budget. Are the men ready to do all this perfectly? If you make a law, you must be able to implement it on the ground. A law is not a piece of paper; a law is not an intention statement; a law creates rights and they must be respected! It is good that we go ahead and not only hear the victims of all crimes, but also give them information. For this, the necessary resources and manpower must be provided. Whoever says a, must also dare to say b.
Colleagues, you know that we cannot agree that the victims must make a civil party and that a civil party statement must be declared admissible and justified before they have the right to information and can be heard. Why not ? Thro ⁇ history, the bourgeois party-position has always had a different fulfillment than obtaining information or being heard. It has always been linked to obtaining compensation. Now you are going to give that concept another definition and on the ground the victims will have insufficient knowledge of it. If one wants to keep this foot by foot, it will require a bunch of information campaigns. Not only we say that, but also Mr. Pierre Rans.
I will return for a moment to the discussion in the committee on the requirement that the victim must not only present itself as a civil party, but that that civil party position must be acceptable and justified before it can be derived from the right to information or the right to be heard. This will create problems in the field, which I have already pointed out in the committee.
First, what if the victim of a serious crime is fully compensated and no longer has any argument to stand for a civil party? Per ⁇ he will still want to be informed and heard, but there is no interest and the civil party position will be declared unfounded, if it is ever made, since the damage has been reimbursed.
Secondly, what does one do with a civil party which is almost remunerated and does not want to pay for the remaining small amount the costs of the civil party setting, since it will later cost more than it brings, assuming that it is not insured for legal assistance?
Well, he too risks standing in the cold, not being heard or not being informed.
Regarding the problem that I referred to, when the criminal judge has already ruled on the penalty, but has not yet ruled on the admissibility, nor on the basis of the civil claim, of the civil party, — I am pleased that Professor Franchimont, when he was asked for advice on this matter, did not exclude the position that I have challenged — then one is in trouble anyway.
I disagree with the view of the professor, whose knowledge, of course, I greatly appreciate, when he states that that problem can indeed occur, but that it can then be recalled on Article 2c, namely that one was mistaken in the impossibility of establishing itself as a bourgeois party. This article is not about this. However, that article deals with cases where a party finds itself in the material impossibility to become a civil party, or when he has not been able to become a civil party for vulnerable or emotional reasons, but does not refer to the case to which we have referred. Colleagues, this will create legal uncertainty, where the law on the VI’s with the requirements of the interest — the victim must prove the interest — had actually already provided a threshold that we thought was correct and had developed that jurisprudence. The victims have rights. and right.
But not all victims have been given rights in this design. The victims of interned perpetrators are not included in the design. We regret that. We also signaled this first. We note and also take note that we have made agreements in the committee, with the approval of the minister, that a bill will be submitted in this regard, which will be treated urgently in the Committee for Justice. In the light of the agreements made in this regard, I would like to suggest the following. This requires us to meet immediately after the Easter holiday with our colleagues who want to work on it to prepare a joint text so that it can be completed before the summer holiday and can come into force together with the current draft, so that the victims of interned perpetrators are treated equally with other victims.
The entry into force of the law will have to wait longer. We also understand for a bit how this happens. Therefore, I would like to propose you to draw up a temporary circular on this subject, to instruct the courts and prosecutors already to give the option and the possibility to hear victims already, as far as possible, even if it might only be for the serious crimes.
I would like to point out a few problems in this regard: concerning the authority of the priest; concerning the composition of the recruitment and evaluation committee, which consists of two senior officials of the FOD Justice and in which the high council had observations in relation to independence; concerning the fact that the duration of the assessors and the magistrates is temporary and cannot always be extended as in the case of juvenile judges and investigative judges. Monsieur le président, madame la vice- première ministre, chers collègues, combien de discours, combien de notes de politique générale, combien de cartes blanches dans les médias, combien de prises de position de professeurs d'université, de magistrats, de criminologues ont-ils appelé de leurs voeux la création d'un tribunal d'application des peines?
Je voudrais aussi rappeler que l'idée de créer un tel tribunal en Belgique se trouvait déjà dans l'avant-projet de loi de Code pénal du commissaire royal Robert Legros, publié il y a déjà plus de vingt ans. Beaucoup de temps s'est écoulé depuis lors. Trop, diront certains. Il y a longtemps que l'on attendait — et à juste titre — un transfert massif du contrôle de l'exécution des peines du pouvoir exécutif vers le pouvoir judiciaire.
Ceci est fait aujourd'hui et on ne peut que se féliciter, madame la vice-première ministre, de la détermination avec laquelle vous avez porté les deux projets qui nous sont soumis aujourd'hui. Enfin, nous allons remplacer les mots par des actes et vous êtes la première ministre à réussir cette performance.
Mes remerciements vont aussi aux membres de la commission Holsters. Cette commission d'experts, présidée par M. Holsters, a été mise en place par un arrêté royal du 27 juin 2000. Elle avait reçu pour tâche de préparer un avant-projet de loi sur trois thèmes: la fixation de la peine, le statut juridique externe des détenus et les tribunaux d'application des peines. Elle a effectué un travail remarquable, au terme duquel elle a déposé, en mai 2003, un rapport final.
Lorsque l'idée d'un tribunal d'application des peines a été lancée, le caractère éventuellement anticonstitutionnel de cette création a été invoqué au motif que l'exécution des peines revient au pouvoir exécutif et non au pouvoir judiciaire qu'incarne par définition un tribunal. C'est une de ces querelles où les juristes s'épuisent en vain. Pour ma part, je me félicite que vous ayez choisi d'en faire une prérogative judiciaire. Après tout, c'est le juge qui décide d'accorder ou non un sursis à un condamné. Ce qu'il peut faire au moment du prononcé du jugement, pourquoi ne pourrait-il pas le faire par la suite?
L'enjeu est de taille. Il s'agit de rendre au pouvoir judiciaire les compétences qui sont les siennes. C'est lui qui peut adapter la peine à l'évolution de la situation du condamné et ce, dans le cadre d'un débat contradictoire qui permet l'exercice des droits de la défense, ce qui est fondamental à nos yeux.
Le tribunal d'application des peines prendra la forme d'une juridiction pluridisciplinaire pour ce qui est des condamnations de plus de trois ans. Ceci permettra assurément de favoriser la circulation du savoir entre la pratique de terrain et la fonction juridictionnelle. Nos magistrats ne sont sûrement pas assez impliqués dans le suivi des condamnations. Il est important que le travail du magistrat professionnel soit enfin éclairé par des personnes de terrain qui prépareront et qui préparent déjà aujourd'hui le détenu à sa réinsertion.
Je ne rentrerai pas davantage dans la technicité du projet. Je crois à cet égard que la voie choisie par le gouvernement est juste. Il y a eu énormément de débats au Sénat ainsi qu'à la Chambre et il ne faut pas les recommencer ici. Nous avons décidé en majorité et, selon moi, nous avons posé les bons choix.
Quant au droit de l'exécution des peines, il a été longtemps un droit à construire auquel il convenait de s'atteler afin de remédier à l'opacité qui entoure la matière. A l'heure actuelle, les modalités d'exécution des peines, comme on l'a déjà rappelé, ne sont pas réglées par une loi, ni même par des arrêtés mais bien par des circulaires causant une insécurité juridique.
Je ne vais pas passer en revue l'ensemble des mesures réglées par le projet que sont l'interruption de l'exécution de peines, la détention limitée, la surveillance électronique, la libération conditionnelle car les conditions imposées me paraissent rencontrer un équilibre entre réinsertion et protection de la société.
Qu'on le veuille ou non, les peines privatives de liberté sont limitées et il y aura toujours un moment où il faudra remettre le justiciable en liberté. Préparer la réinsertion et développer les alternatives à l'emprisonnement constituent des démarches indispensables.
En offrant au détenu la possibilité de se réinsérer socialement au travers des mesures telles que la détention limitée ou la surveillance électronique, le système pénal belge trouve sa place dans la tradition humaniste de la peine et c'est important.
En donnant une véritable place à la victime, en termes de reconnaissance et d'information, au travers des différentes procédures, les textes dont nous débattons aujourd'hui instituent un véritable équilibre indispensable et positif entre les différents acteurs d'un procès. Nous nous réjouissons, comme d'autres l'ont fait ou le feront, des mesures qui ont été prises en faveur des victimes. Je pense notamment aux mesures prévoyant une meilleure information et préparation des victimes tout au long de l'exécution de la peine, ainsi qu'aux possibilités de formuler des contre-indications par rapport aux différentes formes et modalités d'exécution de la peine.
En conclusion, monsieur le président, je souhaiterais émettre deux considérations.
Tout d'abord, un premier pas a été réalisé avec l'adoption, dans le courant de l'année 2004, du texte relatif au statut juridique interne des détenus. A cette époque, nous avions déjà souligné que cette réforme devait nécessairement être complétée par les textes dont nous débattons aujourd'hui. Les deux textes qui nous sont soumis complètent ce vaste chantier, et c'est heureux. Madame la ministre, nous n'avons pas dû attendre longtemps. Gageons que, conjugués à l'amélioration du statut juridique interne des détenus, ces textes pourront contribuer à un plus grand respect des droits de la personne condamnée et à un meilleur fonctionnement de notre système pénitentiaire.
Ensuite, si la réforme que nous allons voter tout à l'heure constitue à n'en pas douter une avancée non négligeable, il sera néanmoins indispensable, comme M. Verherstraeten vient de le rappeler, que des moyens suffisants accompagnent cette réforme afin que celle-ci trouve une concrétisation rapide. Je sais que nous pouvons vous faire confiance à cet égard, madame la ministre.
C'est donc avec conviction que nous voterons en faveur de ces deux projets de loi.

I also want to thank the members of the Holsters Commission. The Committee of Experts, chaired by Mr. Holsters, was established by a royal decree of 27 June 2000. It was assigned to prepare a preliminary draft law on three themes: the fixation of the sentence, the external legal status of the detainees and the courts of enforcement of the sentences. She did a remarkable job, after which she submitted, in May 2003, a final report.
When the idea of a court for the enforcement of penalties was launched, the possible unconstitutional nature of this creation was invoked on the grounds that the enforcement of penalties belongs to the executive power and not to the judicial power that per definition embodies a court. This is one of those disputes where lawyers are exhausted in vain. I am pleased that you have chosen to make it a judicial prerogative. After all, it is the judge who decides whether or not to grant a suspension to a convicted person. What he can do at the time of the judgment, why could he not do it later?
The issue is large. It is about giving the judiciary the powers that are its own. It is he who can adapt the punishment to the evolution of the situation of the convicted person and this, within the framework of a contradictory debate that allows the exercise of the rights of defence, which is fundamental in our view.
The penalty enforcement court will take the form of a multidisciplinary court for convictions of more than three years. This will ⁇ facilitate the circulation of knowledge between the field practice and the judicial function. Our judges are probably not sufficiently involved in the follow-up of convictions. It is important that the work of the professional magistrate is finally enlightened by field people who will prepare and who are already preparing the detainee for his reintegration.
I will not go into the technical aspects of the project. In this regard, I believe that the path chosen by the government is right. There have been a lot of debates in the Senate and in the House and it should not be repeated here. We decided by a majority and I think we made the right choices.
As for the right of execution of penalties, it has long been a right to be built upon which it was appropriate to draw attention in order to remedy the opacity surrounding the matter. Currently, the terms of execution of penalties, as has already been recalled, are not regulated by a law, not even by arrests, but rather by circulars causing legal uncertainty.
I will not overlook all the measures regulated by the project which are the interruption of the execution of penalties, limited detention, electronic surveillance, conditional release because the conditions imposed appear to me to meet a balance between reintegration and protection of society.
Whether you like it or not, the sentences of deprivation of liberty are limited and there will always be a time when the justiciable must be released. Preparing for reintegration and developing alternatives to imprisonment are indispensable steps.
By offering the detainee the opportunity to reintegrate socially through measures such as limited detention or electronic surveillance, the Belgian criminal system finds its place in the humanist tradition of punishment and that is important.
By giving a real place to the victim, in terms of recognition and information, through the various procedures, the texts we discuss today establish a true indispensable and positive balance between the different actors of a trial. We welcome, as others have done or will do, the measures that have been taken in favor of the victims. I think in particular of measures providing for better information and preparation of victims throughout the execution of the sentence, as well as the possibility of formulating contraindications in relation to the different forms and modalities of execution of the sentence.
In conclusion, I would like to make two considerations.
First, a first step was taken with the adoption, in the course of 2004, of the text on the internal legal status of detainees. At that time, we had already emphasized that this reform must necessarily be complemented by the texts we are discussing today. The two texts that are submitted to us complete this vast construction project, and this is pleasant. The Minister did not have to wait long. Let us assume that, coupled with the improvement of the internal legal status of detainees, these texts can contribute to a greater respect for the rights of the convicted person and to a better functioning of our prison system.
Then, if the reform that we are going to vote just now is undoubtedly a not negligible advance, it will nevertheless be indispensable, like Mr. Verherstraeten has just recalled that sufficient resources are accompanied by this reform so that it finds a quick realization. I know we can trust you in this regard, Mrs. Minister.

Mijnheer de voorzitter, collega's, mevrouw de minister, uit de vele wijze levenslessen die ik intussen al 22 jaar geleden gekregen heb van mijn retoricaleraar, is er één die mij wellicht altijd zal bijblijven. Hij gaf ons mee dat wij altijd het vermogen moeten behouden om ons te verwonderen, om ons oprecht te verbazen over hetgeen er allemaal in de wereld rondom ons gebeurt en om te vermijden dat we door de routine, de sleur en de eeltvorming op onze zintuigen, alles zomaar normaal vinden.
Welnu, ik ben verwonderd. Ik ben bijzonder verbaasd. Ik sta eigenlijk versteld dat een zo belangrijke en revolutionaire wet als deze, die een zodanig ingrijpende wijziging van de wet-Lejeune inhoudt, zo langdurig en zo intensief door de media onder de mat kan worden geborsteld. Het lijkt wel of men angst heeft om de burger te informeren en om de burger ervan in kennis te stellen dat het land binnenkort opgezadeld zit met een nieuw wereldrecord, met het meest lakse, het meest soepele en meest verregaande vrijlatingsbeleid voor criminelen ter wereld.
De "democratuur" waarin we vandaag in dit land leven, laat zich kenmerken door een terreur van politiek correct denken. Wie daar durft tegen ingaan, wordt in de hoek gezet en afgeschilderd als een marginaal. Hij wordt zo hard mogelijk doodgezwegen, omdat men nu eenmaal schrik heeft van de bevolking, omdat men de bevolking niet vertrouwt. De mensen zouden wel eens kwaad kunnen reageren. De kiezer zou wel eens een stevig pak rammel kunnen uitdelen aan de politieke klasse mocht die weten hoezeer hij vandaag bij de bok gezet wordt, hoezeer de beloften die enkele jaren geleden werden gedaan vandaag schaamteloos begraven worden, hoe het gegeven woord aan de kiezer hier vandaag zonder de minste scrupules en zonder de minste gêne gebroken wordt. In 2003, collega's, behaalde het kartel sp.a-spirit een gigantische overwinning. Het linkse kartel kreeg toen bijna een kwart van de kiezers achter zich en haalde bijna zoveel als het historisch resultaat dat het Vlaams Belang in 2004 zou halen. Eén van de speerpunten van de sp.a tijdens die verkiezingscampagne, was het zware engagement van Fidel Stevaert — de man die zich vorig jaar naar het grote voorbeeld van zijn vriend Castro liet kronen tot de levenslange onverkozen leider van Limburg — dat er een fundamentele ommekeer zou komen in het vrijlatingsbeleid. Op minder dan een maand voor de verkiezingen van 18 mei 2003 wendde Steve Gratis de steven en plaatste hij de afschaffing van de wet-Lejeune boven aan de politieke agenda. Dat was een koerswending van formaat, want de socialisten waren tot op dat moment de herauten geweest van de vervroegde invrijheidstelling. Met Stevaert zou het allemaal veranderen. Ik citeer uit Het Laatste Nieuws van 24 april 2003, minder dan een maand voor de verkiezingen op 18 mei 2003: "Elke gevangene heeft het recht op de juiste strafmaat", zegt Stevaert, "waarvan hij weet dat hij ze tot de laatste dag moet uitzitten. Zodra die straf bepaald is, moet je daarop niet meer beknibbelen. De familie van een slachtoffer begrijpt zo'n strafvermindering niet. Leg het maar eens uit. Uw kind wordt vermoord en de dader krijgt negen jaar, maar na drie jaar komt hij weer vrij omdat hij zich goed gedraagt."
Fidel Stevaert ging nog verder. Hij kopieerde schaamteloos het programma van het toenmalige Vlaams Blok. Straffen moeten niet alleen onverkort worden uitgevoerd, er kan bovendien een tweede strafmaat aan toegevoegd worden, als gevangenen bepaalde voorwaarden, zoals goed gedrag, niet vervullen. Dat is dus strafverzwaring bij slecht gedrag. Wij schuiven dat al jaren naar voren.
Dan komt het toppunt. "De sp.a was de laatste jaren toch radicaal tegen een aanpassing van de wet-Lejeune?", vroeg een journalist van Het Laatste Nieuws. Mijnheer Gratis antwoordde: "Dit was de SP, ik ben voorzitter van de sp.a., met de a van anders. Als men de sp.a vandaag verwijt dat ze dit thema heeft verwaarloosd, dan zeg ik: laat de volgende minister van Justitie een sp.a'er zijn, dan wordt dit voorstel uitgevoerd. Bij de sp.a luisteren de ministers naar hun voorzitter." Dat was een citaat van Steve Stevaert.
Collega's, de voorbije maanden had de sp.a de kans om te sleutelen aan de wet-Lejeune, om de wet te verstrengen en om onsamendrukbare straffen in te voeren. Bovendien hadden ze een rode minister. Als de sp.a dus echt had gewild, dan had ze de wet kunnen verstrengen. Vandaag gebeurt echter precies het tegenovergestelde. De wet wordt lakser dan ooit, met de volle steun van de sp.a-parlementsleden. U maakt dus niet alleen uw beloften niet waar, u maakt het bovendien nog veel erger. Daarvoor bestaat een naam, mijnheer Casaer, het is kiezersbedrog van het zuiverste water. Zelden heb ik parlementsleden zo flagrant en zo opvallend hun engagement zien inslikken. Uw beloften van 2003, mijnheer Casaer, waren dus niet meer dan platte, ordinaire leugens. Uw beloften, waarmee u in 2003 de verkiezingen hebt gewonnen, waren grove en gore volksverlakkerij.
De wet op de externe positie van de gedetineerden, die hier vandaag wordt besproken, is ronduit schandelijk, in de eerste plaats door de onverantwoorde uitbreiding van het penitentiair verlof en de uitgangsvergunning. In de toekomst zullen ze allebei deel uitmaken van het standaardregime van elke gedetineerde. De veroordeelden zullen er, tenzij in uitzonderlijke gevallen, een afdwingbaar recht op hebben dat automatisch hernieuwd wordt, in tegenstelling tot vandaag. Nu zijn dergelijke verloven terecht een gunst voor wie zich behoorlijk gedraagt, echt bereid is tot reïntegratie en werk maakt van de vergoeding van de slachtoffers.
Hetgeen op til is, is in elk geval volmaakt in tegenstelling met de huidige omzendbrief inzake penitentiair verlof, waarin duidelijk het gunstkarakter wordt benadrukt.
Ik citeer uit die omzendbrief: "Dit verlof wordt slechts verleend aan de veroordeelden van wie men verwacht dat ze geen misbruik zullen maken van die gunst en wier aanwezigheid in het milieu waarin ze het verlof zullen doorbrengen, de publieke opinie niet in beroering brengt. De toekenning van het verlof", aldus de actuele omzendbrief, "wordt nooit beschouwd als een recht waarop de gedetineerde aanspraak kan maken. Het kan slechts het resultaat zijn van een individuele beslissing van de hogere overheid, genomen in het kader van de behandeling. Het systeem sluit elk automatisme uit."
Dat is de huidige omzendbrief, die tot op vandaag werkt, maar met het terechte gunstkarakter van vandaag wordt dus voorgoed gebroken. Erger nog, de gevangenen krijgen al recht op het verlof 12 maanden vooraleer ze in aanmerking komen voor vervroegde invrijheidstelling. Ik herhaal: 12 maanden.
Vanaf vandaag is dat slechts 3 maanden vooraf. In de praktijk betekent de nieuwe wet dat de overgrote meerderheid meteen op penitentiair verlof zal mogen of meer dan 80% van alle veroordeelden, met name al degenen die minder dan 3 jaar effectief hebben gekregen. Zij zullen op penitentiair verlof mogen zodra ze veroordeeld zijn, zodra ze de gevangenis binnenwandelen. Zij hebben meteen en automatisch recht op penitentiair verlof, tenzij in welbepaalde de omstandigheden. Als cadeau na een veroordeling kan dat toch wel tellen.
De wet is ronduit schandelijk, omdat ze, ten tweede, de veiligheidskleppen afbreekt waarmee de voorwaardelijke invrijheidstelling nu nog kan worden tegengehouden. Vandaag kan het personeelscollege van de gevangenis — meer dan terecht trouwens — een vrijlating blokkeren. Dat kan trouwens meermaals na mekaar als men van oordeel is dat de vrijlating onverantwoord is.
Die verantwoordelijkheid voor het personeel, die noodzakelijke inspraak, verdwijnt voortaan, zonder dat dat zelfs maar beargumenteerd werd. Er werd geen enkel argument van de minister naar voren geschoven: het is niet onderzocht en er is geen falen van de inspraak van het personeelscollege aangetoond. Integendeel, het schijnt behoorlijk te werken. Toch moet het verdwijnen. Het gevangenispersoneel zal in de toekomst enkel nog worden gehoord als de gedetineerde dat zelf vraagt, met andere woorden, als het in zijn eigen voordeel speelt en niet als er gewaarschuwd zou kunnen worden voor bijvoorbeeld zijn gevaarlijkheid. Op die manier maakt men het personeel van de gevangenis onverantwoordelijk.
Er is zelfs geen enkele wettelijke garantie dat er een advies van de psychosociale dienst van de gevangenis in zijn vrijlatingsdossier zal zitten, ondanks de krachtige waarschuwing van de Vlaamse leden van de vrijlatingscommissies. Daarmee wordt opnieuw ruimte geschapen voor een paraplupolitiek, de zo gehekelde paraplupolitiek in de commissie-Dutroux, waarbij alle betrokkenen de verantwoordelijkheid voor de mislukking op een ander konden afschuiven. Door de hele wet maakt men de psychosociale dienst van de gevangenis onverantwoordelijk.
Ten derde, deze wet is ronduit schandelijk. Voor het gros van de veroordeelden - voor meer dan 80% van de gestraften met een straftijd tot drie jaar - verdwijnt het onderscheid tussen primair gestraften en recidivisten. Vandaag is het onderscheid in de wetLejeune heel gekend en heel duidelijk. Primair gestraften kunnen vrijkomen na een derde van de straf en recidivisten na twee derde. Dit fundamentele onderscheid van de wet-Lejeune wordt voor de overgrote meerderheid van de gedetineerden voor altijd weggeslagen. Dit belangrijke ontradende signaal van de wetgever aan recidivisten — dat zij zwaarder zullen behandeld worden dan anderen — wordt definitief onderuit gehaald.
Ik weet wel dat men zal zeggen dat het in de praktijk nu reeds zo is, omdat Verwilghen - de voorganger van deze minister - dat zo bij omzendbrief had ingevoerd. Wij hebben Verwilghen in de plenaire nog ondervraagd hierover op 18 januari 2001. In die zitting eindigde zijn antwoord als volgt: "Ik beklemtoon dat deze maatregel alleen wordt ingevoerd om aan de tijdelijke piek in de maand december - december 2000 - te verhelpen". Het was toen duidelijk een noodmaatregel en die tijdelijke noodmaatregel van toen wordt nu definitief.
Sterker nog, Verwilghen kondigde toen extra waakzaamheid aan ten opzichte van deze recidivisten. Ik citeer opnieuw: "Het plegen van vier-, vijf- of zesmaal dezelfde feiten is een manifeste contraindicatie". Precies deze stok achter de deur valt vandaag eveneens weg, want voor gestraften onder drie jaar straf is het risico op recidive helemaal geen tegenaanwijzing meer om een veroordeelde binnen te houden. Dat wordt afgeschaft.
Dan komen we aan de vierde reden waarom deze wet zo schandelijk is. De mogelijkheden voor de nieuwe strafuitvoeringsrechtbank om de criminelen binnen te houden, worden drastisch ingeperkt. Het is de uitdrukkelijke bedoeling van deze minister en van de meerderheidspartijen - zo staat het ook in de toelichting bij dit wetsontwerp - om voortaan in zoveel mogelijk gevallen een voorwaardelijke invrijheidstelling toe te kennen. De vrijlatingen zullen dus nog versneld en vervroegd worden, waar het vandaag al zo erg is en we hebben reeds het meest lakse vrijlatingsbeleid van WestEuropa.
Deze wet is alleen maar ingegeven door de wens om de overbevolking van de gevangenissen tegen te gaan en alllerminst door de zorg voor de bescherming van de maatschappij. Ook op dit vlak is de wet revolutionair.
Vandaag kunnen de vrijlatingscommissies overgaan tot de invrijheidstelling, maar die invrijheidstelling kan - zo stelt de huidige wet letterlijk - alleen worden verleend indien tegelijk aan een hele reeks voorwaarden wordt voldaan. Met de nieuwe wet wordt alles omgedraaid. In de toekomst wordt de invrijheidstelling door de strafuitvoeringsrechtbank toegekend. Ze moet dus worden toegekend, tenzij er tegenaanwijzingen zijn.
De voorwaardelijke invrijheidstelling verliest dus haar gunstkarakter en wordt wel degelijk een afdwingbaar, subjectief recht. De beleidsmarge voor de strafuitvoeringsrechter wordt veel kleiner dan de marge die de actuele vrijlatingcommissies hebben.
Ook het aantal tegenaanwijzingen wordt sterk ingeperkt. De persoonlijkheid van de gedetineerde en zijn gedrag tijdens de detentie zijn hierbij van geen tel meer. Sterker nog - ik heb het zojuist reeds aangehaald -, bij de veroordeelden tot drie jaar speelt het gevaar voor recidive op geen enkele wijze meer mee, alleen nog wanneer er een manifest risico is voor de integriteit van derden.
De Vlaamse leden van de actuele vrijlatingcommissies, die een heel omstandig en heel uitvoerig degelijk advies hebben gegeven, een vernietigend advies voor de wet trouwens, zijn zeer scherp in hun advies. Zij waarschuwen: "Een notoir oplichter met extreem hoog gevaar voor recidive, maar die kan aantonen dat hij in zijn behoefte kan voorzien, kan geen VI worden geweigerd indien zijn straf maximaal drie jaar is." Dat kan toch wel tellen!
Ook voor de tot meer dan drie jaar veroordeelden is er een sterke versoepeling. De vrijlating kan alleen worden tegengehouden bij het risico van het plegen van nieuwe ernstige strafbare feiten. Wanneer men dus met zekerheid weet dat de gedetineerde zich vanuit de gevangenis aan het voorbereiden is op het plegen van gewone of minder ernstige strafbare feiten, is de stafuitvoeringsrechtbank verplicht om die zware crimineel, iemand die veroordeeld is tot meer dan drie jaar effectief, vrij te laten. Dat is gewoon onvoorstelbaar.
Veel is echter niet genoeg. Wanneer de delinquenten recidiveren en nieuwe zware misdrijven begaan, kunnen vandaag de commissies hen terugroepen. Zij kunnen de vrijlating dan herroepen. Ook dat wordt echter onderuitgehaald, want zoiets zou ingaan tegen het zogenaamde vermoeden van onschuld. Een herroeping van die vrijlating is pas mogelijk na een nieuwe veroordeling en pas nadat die veroordeling in kracht van gewijze is gegaan.
De wereldvreemdheid van paars kent dus geen grenzen. Wij hebben dat fameuze vermoeden van onschuld enkele weken geleden nog gehoord in de zaak-Erdal. Vandaag horen wij het opnieuw. De paarse regering heeft het zogeheten vermoeden van onschuld misbruikt om Erdal te laten lopen, om Erdal in de brousse te laten verdwijnen. In de toekomst zal dat vermoeden aangewend worden om recidiverende criminelen, zelfs al zijn ze op heterdaad betrapt, zelfs al heeft iedereen gezien dat ze wel degelijk dat misdrijf hebben begaan, uit de gevangenis weg te houden.
Collega's, dat is een ongehoord schandaal! U zult daarvoor heel veel protest van de bevolking krijgen. De bescherming van de criminelen weegt voor paars duidelijk veel zwaarder door dan de bescherming van de samenleving.
Zo belanden wij bij de vijfde reden waarom de wet zo ronduit schandelijk is. De bestaande waarborgen voor de bescherming van de samenleving worden op de helling gezet, bijvoorbeeld inzake de seksuele delinquenten, waarvoor na Dutroux een belangrijke verscherping van de wetgeving was doorgevoerd.
Behandeling en begeleiding van seksueel delinquenten als verplichte voorafgaande voorwaarde aan de vrijlating is weggelaten. Die zijn niet langer verplicht. Seksueel delinquenten worden net zoals mensenhandelaars — vandaag is het nog verboden — in de toekomst niet langer uitgesloten voor de versnelde vrijlating, nog sneller dan een derde, onder elektronisch toezicht. Ook dat mogen seksueel delinquenten nu genieten. Blijkbaar zijn dat soort misdrijven niet langer een prioriteit en zijn ze niet meer zo ernstig als enkele jaren geleden.
Bijzonder gortig ten slotte is het wegvallen van de eenparigheidsregel voor de strafuitvoeringsrechtbank. Ook dat was een waarborg om al te lichtzinnige en onverantwoorde vrijlatingen te voorkomen en om de samenleving te beschermen. Bij veroordelingen tot 10 jaar of meer of bij gedetineerden die minder dan de helft van de straf hebben uitgezeten, geldt vandaag nog altijd dat de rechter en zijn twee assessoren unaniem de vrijlating moeten beslissen. Die vereiste valt definitief weg. De twee sociale assessoren, die helemaal geen jurist hoeven te zijn, kunnen voortaan zonder probleem hun wil opleggen aan de magistraat. Begrijpe wie kan!
Ten slotte belanden we bij de top of the bill, de rode kers op de taart van minister Onkelinx, de grootste schande uit het hele ontwerp. Alle korte gevangenisstraffen, alle straffen tot 1 jaar effectief zullen in de toekomst door de strafuitvoeringsrechtbank kunnen omgezet worden in korte werkstraffen van misschien een paar uur, een paar tientallen uur of heel uitzonderlijk 300 uur, het absolute maximum. Het is de zoveelste poging van paars om korte gevangenisstraffen in de praktijk niet uit te voeren, zelfs al heeft de eerste rechter uitdrukkelijk geoordeeld dat de werkstraf niet op zijn plaats is. De eerste rechter heeft alle mogelijke instrumenten: van een boete over een opschorting en een voorwaardelijke straf tot een alternatieve straf. De veroordeelde kan hiertegen in beroep gaan. Indien de rechter in beroep ondanks al die mogelijkheden toch een gevangenisstraf uitspreekt, ook al is ze maar kort, zijn daar duidelijk redenen voor en moet men dat respecteren. Dat is elementair in een rechtstaat. Dan nog vindt de minister van Justitie dat de rechter het verkeerd voor heeft en zich vergist heeft en bijgevolg de straf ongedaan gemaakt moet worden. Daar komt het op neer! De straf wordt ongedaan gemaakt. Gevangenisstraffen van minder dan 1 jaar worden door de strafuitvoeringsrechter ongedaan gemaakt en omgezet in een belachelijke allerminst afschrikwekkende werkstraf.
Dat u aan een dergelijke dwaasheid uw goedkeuring heeft gegeven, collega's, vindt het Vlaams Belang werkelijk immoreel. U haalt de rechtsstaat onderuit. U haalt de strafrechter onderuit. U maakt van de strafrechter een bloempot. U zegt gewoon dat de strafrechter onbekwaam is om te oordelen, dat u en de strafuitvoeringsrechter het veel beter weten. Het is werkelijk een schandaal van formaat dat zoiets door juristen op papier wordt gezet.
Mijnheer Casaer, wij hebben uitvoerig gezocht, maar nergens in de beschaafde wereld hebben wij een wetgeving gevonden die zo laks is als de draak die morgen zal worden goedgekeurd. Ons land zal binnenkort niet alleen de meest lakse nationaliteitswetgeving ter wereld hebben; ons land zal bovendien ook de meest lakse vrijlatingwetgeving ter wereld hebben, dankzij Laurette Onkelinx en haar trouwe slippendragers van sp.a, MR en VLD.
Het is dan ook onwaarschijnlijk leugenachtig dat de huidige minister van Justitie, in reactie op de terechte petitie van de VZW "Ouders van een Vermoord Kind", via haar kabinet durfde beweren dat het vrijlatingbeleid zou worden verstrengd omdat gevaarlijke gekken, die voor de tweede maal in hun leven levenslang krijgen, immers pas na 16 jaar in plaats van na 14 jaar zouden mogen vrijkomen.
Mevrouw de minister, wat was dat een vreselijk signaal naar de betrokken ouders! In plaats van hen te verzekeren dat monsterachtige figuren, genre Fourniret en Dutroux, naar Nederlands voorbeeld echt levenslang zouden kunnen krijgen en tot aan het eind van hun dagen achter de tralies zouden blijven, zegt u dat zelfs dergelijke gruwelachtige personen na verloop van amper 16 jaar — dan nog als ze zich in de situatie van recidive bevinden — zullen mogen vrijkomen en terecht mogen komen in de voorgestelde, waanzinnige vrijlatingcarrousel.
Op deze manier wordt alle vertrouwen in de rechtsstaat weggenomen. U legt vandaag de basis voor een justitie die meer dan ooit onbegrepen zal zijn, voor een justitie die botst met het rechtvaardigheidsgevoel en voor een justitie die opnieuw zal leiden tot grote woede en verontwaardiging bij de slachtoffers. De voorliggende wet is niets anders dan een keiharde mokerslag in het gezicht van de slachtoffers van criminaliteit.
Mijnheer Malmendier, het is dus bijzonder ontluisterend dat een partij als MR, die zich zo heeft geprofileerd als de voortrekker van de rechten van de slachtoffers, zich vandaag gedraagt als het makke schoothondje van de beschermengel van de criminelen, Laurette Onkelinx.
Het Vlaams Belang kan vandaag niet anders dan een plechtige oproep lanceren aan alle strafrechtmagistraten in ons land. Als de politiek de samenleving niet langer wil beschermen, dan kunnen alleen de rechters dat nog doen. Als de politici de bevolking in de steek laten, dan zijn de rechters de laatste strohalm. Wij richten ons dan ook tot de dames en heren magistraten.
Dames en heren magistraten, wij vragen u om de voorliggende wet goed te lezen en er de passende conclusies uit te trekken, met name door veel zwaarder te straffen dan u vandaag doet. Als u wil dat de crimineel voor u daadwerkelijk in de gevangenis belandt, geef hem dan een straf die hoger is dan één jaar effectief. Als u wil dat de recidivist in de toekomst langer de binnenkant van de gevangenis ziet, geef hem dan ook automatisch een dubbel zo zware straf. Als u wil dat de crimineel voor u niet meteen kan genieten van penitentiair verlof, geef hem dan een celstraf die hoger is dan drie jaar.
Als u van oordeel bent dat de crimineel voor u een celstraf van minstens drie jaar verdient, bedenk hem dan met een celstraf van negen jaar. Als u van oordeel bent dat de crimineel voor u een celstraf van vijf jaar verdient, bedenk hem dan met een celstraf van vijftien jaar. Als u van oordeel bent dat de crimineel een celstraf van tien jaar verdient, bedenk hem dan met een celstraf van dertig jaar.
Heren en dames magistraten, de slachtoffers van criminelen en de hele bevolking rekenen op u.

A presumption of innocence, to remain in the application of this law.
Mr. Speaker, colleagues, Mrs. Minister, from the many wisdom life lessons I have received from my rhetorical lecturer 22 years ago, there is one that may always be remembered by me. He told us that we must always retain the ability to be amazed, to truly be amazed at what is happening in the world around us, and to avoid finding everything normal through the routine, the slurry and the eardrum forming on our senses.
Well, I am surprised. I am ⁇ surprised. I am actually astonished that such an important and revolutionary law as this, which involves such a profound amendment of the law-Lejeune, can be so long and so intensely brushed under the mat by the media. It seems that one is afraid to inform the citizen and to inform the citizen that the country is soon filled with a new world record, with the loosest, most smooth and most extensive release policy for criminals in the world.
The “democracy” in which we live today in this country is characterized by a terror of politically correct thinking. Anyone who dares to oppose it is placed in the corner and depicted as a marginal. He is silenced to death as hard as possible, because one is afraid of the people, because one does not trust the people. People might react badly. The voter would ⁇ be able to distribute a solid pack of rammel to the political class if they knew how much he is put at the box today, how much the promises made a few years ago are buried without shame today, how the word given to the voter here today without the slightest scruples and without the slightest embarrassment is broken. In 2003, colleagues, the sp.a-spirit cartel achieved a giant victory. The left-wing cartel then got almost a quarter of the voters behind it and got almost as much as the historic result that the Flemish Interest would get in 2004. One of the highlights of the sp.a during that election campaign was the heavy commitment of Fidel Stevaert — the man who last year crowned himself after the great example of his friend Castro to the lifelong unelected leader of Limburg — that there would be a fundamental reversal in liberation policy. Less than a month before the May 18, 2003 elections, Steve Gratis turned the steven and placed the abolition of the Lejeune Act at the top of the political agenda. That was a change of format, because the socialists had been the originators of the early liberation. With Stevaert, everything would change. I quote from The Last News of April 24, 2003, less than a month before the elections on May 18, 2003: "Every prisoner has the right to the appropriate penalty," says Stevaert, "of which he knows that he must sit them out until the last day. Once that punishment is determined, you should no longer grumble on it. The family of a victim does not understand such a reduction in punishment. Just put it out. Your child will be murdered and the perpetrator will be given nine years, but after three years he will be released because he behaves well."
Fidel Stevaert went even further. He copied shamelessly the program of the then Flemish Bloc. Punishments should not only be executed without reduction, but a second punishment may also be added if prisoners do not meet certain conditions, such as good conduct. This is punishment for bad behavior. We have been pushing this forward for years.
Then comes the top. “Did the Sp.a. have been radical in recent years against an adaptation of the law-Lejeune?” asked a journalist of Het Laatste Nieuws. Mr. Gratis replied: "This was the SP, I am the chairman of the sp.a., with the a of other. If one blames the SPAA today for neglecting this topic, then I say: let the next Minister of Justice be a SPAA, then this proposal will be implemented. At the sp.a, the ministers listen to their chairman.” – Steve Stevaert
Colleagues, in the past few months, the Sp.A. has had the opportunity to turn to the law-Lejeune, to tighten the law and to introduce uncompromising penalties. In addition, they had a red minister. If the SP had really wanted, then it could have tightened the law. Today, however, the exact opposite is happening. The law is becoming louder than ever, with the full support of the sp.a. parliamentarians. So not only do you fail to fulfill your promises, you also make it much worse. There is a name for this, Mr. Casaer, it is voter deception of the purest water. Rarely have I seen Members of Parliament swallow their commitment so flagrantly and so strikingly. So your 2003 promises, Mr. Casaer, were nothing more than flat, ordinary lies. Your promises, with which you won the 2003 elections, were rough and gorgeous peopleship.
The law on the external position of the detainees, which is discussed here today, is purely shameful, primarily due to the irresponsible extension of the penitentiary leave and the initial permit. In the future, they will both be part of the standard regime of each detainee. Condemned persons, except in exceptional cases, will have an enforceable right to it that is automatically renewed, unlike today. Now such licenses are rightly a favour for those who behave properly, are truly willing to reintegrate and work to compensate the victims.
In any case, what is at hand is perfect, in contrast to the current circulation letter on penitentiary leave, which clearly emphasizes the character of favour.
This leave is granted only to those convicted persons from whom it is expected that they will not abuse that favor and whose presence in the environment in which they will spend the leave does not disturb the public opinion. The granting of the leave, according to the current circulation letter, “is never considered a right to which the detainee can make a claim. It can only be the result of an individual decision of the higher government, taken as part of the treatment. The system excludes any automation.”
That is the current circulation letter, which works to this day, but with the rightful favour character of today is thus forever broken. Worse, prisoners are already entitled to leave 12 months before they are eligible for early release. I repeat: 12 months.
From now on, this is only 3 months in advance. In practice, the new law means that the overwhelming majority will be allowed to go on imprisonment leave immediately or more than 80% of all convicts, especially all those who have received less than 3 years effectively. They will be entitled to prison leave as soon as they are convicted, as soon as they enter the prison. They are entitled immediately and automatically to prison leave, except in specific circumstances. As a gift after a conviction, it can count.
The law is absolutely shameful, because, secondly, it breaks down the safety valves that still allow the conditional release to be stopped. Today, more than rightly, the prison staff college can block a release. This can, by the way, be repeatedly repeated if one considers that the release is irresponsible.
That responsibility for the staff, that necessary involvement, disappears from now on, without even being argumented. No argument from the Minister was put forward: it was not examined and there was no failure of the involvement of the staff college demonstrated. On the contrary, it seems to work quite well. Yet it must disappear. The prison staff will in the future only be heard if the detainee asks, in other words, if it plays in its own advantage, and not if it could be warned, for example, of its danger. This makes prison staff irresponsible.
There is even no legal guarantee that there will be an opinion from the psychosocial service of the prison in its release file, despite the strong warning of the Flemish members of the release commissions. This again creates room for a paraplopolitics, the so-called paraplopolitics in the Commission-Dutroux, in which all stakeholders could shift the responsibility for the failure to another. The whole law makes the psychosocial service of the prison irresponsible.
Third, this law is absolutely shameful. For the majority of those convicted – for more than 80% of those convicted with a sentence of up to three years – the distinction between primary convicted and recidivists disappears. Today, the distinction in the lawLejeune is very well known and very clear. Primary punishments can be released after one-third of the sentence and recidivists after two-thirds. This fundamental distinction from the law-Lejeune is for the vast majority of the detainees forever eliminated. This important deterrent signal from the legislator to recidivists — that they will be treated more severely than others — is finally overthrown. Their
I know that it will be said that in practice it is already so, because Verwilghen – the predecessor of this minister – had introduced it in a circulation letter. We have questioned Verwilghen in the plenary on this subject on 18 January 2001. In that session, his answer concluded as follows: "I emphasize that this measure is introduced only to remedy the temporary peak in the month December - December 2000 -". It was then clearly an emergency measure and that temporary emergency measure of then becomes now definitive.
In fact, Verwilghen then announced additional vigilance towards these recidivists. I quote again: "Committing four, five or six times the same facts is a manifest contraindication." It is precisely this stick behind the door that also falls away today, because for sentenced under three years of punishment, the risk of recidive is no longer an indication to keep a convicted inside. This will be abolished.
Then we come to the fourth reason why this law is so shameful. The possibilities for the new Criminal Enforcement Court to detain the criminals are drastically limited. It is the express intention of this minister and of the majority parties – as is stated in the explanation to this bill – to grant a conditional release in as many cases as possible from now on. The release will therefore be accelerated and anticipated, where it is already so bad today and we already have the most loose release policy in Western Europe.
This law is only inspired by the desire to counter the overpopulation of prisons, and at least not by the concern for the protection of society. In this regard, the law is revolutionary. Their
Today, the release committees can proceed to the release, but this release can – as the current law literally states – be granted only if a whole set of conditions are met at the same time. With the new law, everything is reversed. In the future, the release will be granted by the Criminal Enforcement Court. It should therefore be granted, unless there are contraindications.
The conditional release thus loses its favourable character and becomes indeed an enforceable, subjective right. The policy margin for the criminal enforcement judge will be much smaller than the margin that the current release commissions have.
The number of contraindications is also severely limited. The personality of the detainee and his behavior during detention are no longer of consideration. In fact – I have just cited it – in the case of those convicted up to three years, the risk of recurrence is in no way more relevant, only if there is a manifest risk to the integrity of third parties.
The Flemish members of the current release commissions, who have given a very thorough and very comprehensive sound advice, a destructive advice for the law by the way, are very sharp in their advice. They warn: “A notorious scammer with an extremely high risk of recidive, but who can demonstrate that he can meet his needs, cannot be denied VI if his sentence is up to three years.”
Also for those sentenced to more than three years there is a strong relief. Release may only be suspended if there is a risk of committing new serious criminal offences. If, therefore, it is known with certainty that the detainee is preparing from prison to commit ordinary or less serious criminal offences, the court of execution is obliged to release that serious criminal, a person who has been sentenced to more than three years of effectiveness. That is simply unimaginable.
However, much is not enough. When the offenders recur and commit new serious crimes, today the commissions can recall them. They can revoke the release. However, this is also underestimated, because such a thing would go against the so-called presumption of innocence. A revocation of that release is only possible after a new conviction and only after that conviction has entered into force.
The world strangeness of purple therefore knows no boundaries. We heard that famous presumption of innocence a few weeks ago in the Erdal case. Today we hear it again. The purple government has abused the so-called presumption of innocence to let Erdal run, to let Erdal disappear in the bush. In the future, this presumption will be used to keep recurring criminals out of prison, even if they are caught on the other hand, even if everyone has seen that they have actually committed that crime.
This is an unheard of scandal! You will get a lot of protest from the public. The protection of criminals clearly weighs much heavier for purple than the protection of society.
So we end up with the fifth reason why the law is so purely shameful. The existing safeguards for the protection of society are sloping, for example with regard to sexual offenders, for which after Dutroux a significant tightening of the legislation was implemented.
Treatment and accompaniment of sexual offenders as a mandatory precondition for release has been omitted. They are no longer mandatory. Sexual offenders will no longer be excluded from accelerated release, even faster than a third, under electronic surveillance, in the future, just like traffickers — today it is still forbidden. Sexual offenders can also enjoy this. Apparently, such crimes are no longer a priority and are no longer as serious as they were a few years ago.
Particularly gorgeous, finally, is the removal of the unanimity rule for the criminal enforcement court. This was also a guarantee to prevent too lighthearted and irresponsible releases and to protect society. For convictions of up to 10 years or more, or for detainees who have served less than half of the sentence, it still applies today that the judge and his two assistants must unanimously decide the release. This requirement is finally removed. The two social assistants, who do not have to be a lawyer at all, can now easily impose their will on the magistrate. Understand who can!
Finally, we end up at the top of the bill, the red cherry on Minister Onkelinx’s cake, the biggest shame from the entire design. All short prison sentences, all sentences up to 1 year effective will in the future be converted by the penalty enforcement court into short working sentences of maybe a few hours, a few dozen hours or very exceptionally 300 hours, the absolute maximum. It is another attempt by purple to not execute short prison sentences in practice, even though the first judge has explicitly ruled that the work penalty is not in place. The first judge has all possible instruments: from a penalty for a suspension and a conditional penalty to an alternative penalty. The convicted may appeal against it. If, despite all these possibilities, the court of appeal still imposes a prison sentence, even if it is only a short sentence, there are clear reasons for this and this must be respected. This is fundamental in a rule of law. Furthermore, the Minister of Justice considers that the judge was wrong and made a mistake and consequently the sentence must be cancelled. That’s where it comes down! The punishment is repealed. Prison sentences of less than one year are repealed by the criminal enforcement judge and converted into a ridiculous work sentence that is not deterrent.
That you have given your approval to such a foolishness, colleagues, the Flemish Interest thinks it is truly immoral. You are undermining the rule of law. You are bringing down the criminal judge. You make the criminal judge a flower pot. You simply say that the criminal judge is incapable of judging, that you and the criminal enforcement judge know it much better. It is really a scandal of format that such a thing is put on paper by lawyers.
Mr. Casaer, we have searched extensively, but nowhere in the civilized world we have found a legislation that is as lax as the dragon that will be approved tomorrow. Our country will soon not only have the most lax nationality laws in the world; our country will also have the most lax release laws in the world, thanks to Laurette Onkelinx and her loyal slippers of sp.a, MR and VLD.
It is therefore unlikely to be false that the current Minister of Justice, in response to the legitimate petition of the VZW "Parents of a Murdered Child", through her cabinet dared to claim that the release policy would be tightened because dangerous fools, who for the second time in their lives receive lifetime, after all, could only be released after 16 years instead of after 14 years.
What a terrible signal to the parents! Instead of assuring them that monstrous figures, the genre of Fourniret and Dutroux, by the Dutch example, could truly get a lifetime and remain behind the rails until the end of their days, you say that even such gruesome persons, after just 16 years — then even if they are in the situation of recidive — will be allowed to release and be sentenced to the proposed, crazy release carousel.
In this way, all confidence in the rule of law is taken away. Today you lay the foundation for a justice that will be more incomprehensible than ever, for a justice that collides with the sense of justice, and for a justice that will once again lead to great anger and indignation among the victims. The present law is nothing but a tough bullshit in the face of the victims of crime.

Néanmoins, il conviendrait dans un second temps de confier à une juridiction non seulement l'exécution des mesures privatives de liberté mais également les autres types de peines et mesures telles que la probation, la peine de travail, le sursis et la défense sociale. C'est, je l'espère, le prochain défi auquel nous serons confrontés.
Deuxièmement, en ce qui concerne les victimes, il faut noter, comme l'intitulé du projet amendé le souligne d'ailleurs expressément, qu'il s'agit non seulement d'un projet relatif au statut juridique externe des détenus mais également aux droits reconnus à la victime dans le cadre des modalités d'exécution de la peine privative de liberté. Le projet fournit en effet un système d'information et de prise en compte des intérêts de la victime lors de l'exécution de la peine du condamné. Ce système est globalement positif.
Il faut reconnaître que le texte a été quelquefois amendé dans un sens positif à la Chambre — M. Malmendier y a contribué — et il prévoit désormais que la victime est entendue dans la procédure en révocation, suspension ou révision des modalités d'exécution de la peine si cette procédure est due au non-respect des conditions imposées dans l'intérêt de la victime et que le ministère public peut réagir lorsque le condamné met gravement en péril l'intégrité tant physique que psychique des tiers.
Il intègre aussi le projet de loi n° 1319 en complétant l'obligation de motivation du juge par une obligation d'information générale de toutes les parties à la procédure pénale de l'exécution de la peine privative de liberté prononcée et des éventuelles modalités d'exécution de la peine, ainsi que par une obligation d'information spécifique à l'égard de la partie civile sur la possibilité d'être entendue au sujet des conditions qu'il convient d'imposer dans son intérêt. It must be acknowledged that the text has sometimes been amended in a positive way in the House — Mr. Malmendier contributed to this — and now provides that the victim is heard in the proceedings for revocation, suspension or revision of the terms of execution of the sentence if this proceedings are due to non-compliance with the conditions imposed in the victim’s interest and that the public prosecutor can react when the convicted person seriously endangers the physical and psychological integrity of third parties.
It also incorporates Bill No. 1319 by supplementing the obligation of motivation of the judge by a general obligation to inform all parties to the criminal proceedings of the execution of the sentence of deprivation of liberty pronounced and of the possible modalities of execution of the sentence, as well as by a specific obligation to inform the civil party about the possibility of being heard about the conditions to be imposed in its interest. These elements are favorable to victims and have been incorporated in the draft law on the external legal status of detainees. Ce critère "peine de trois ans" est-il adéquat? La Commission de libération conditionnelle et le Conseil supérieur ont soulevé nombre de réticences à ce sujet. Il y a des peines de moins de trois ans où la personnalité de la personne condamnée est plus problématique que dans d'autres.
J'ignore s'il existe un lien entre l'exécution de la peine et la peine en tant que telle, celle à laquelle on a été condamné. Mon objection est identique à celle soulevée par le Conseil supérieur et la Commission des libérations conditionnelles.
Cela signifie aussi que le juge unique assumera environ 90% de la charge des dossiers contre 10% seulement pour les tribunaux d'application des peines. L'exemple le plus fondamental à mes yeux est la récidive. Je rappelle la proposition faite par la commission Holsters, à savoir que seules les modalités sur lesquelles s'accordent toutes les parties seraient tranchées par le juge unique, toutes les autres situations devant être tranchées de manière multidisciplinaire. C'était peut-être une approche plus proportionnée avec un coût probablement supérieur, mais elle le valait.
En ce qui concerne la violation du principe de la chose jugée en cas de décision du juge d'application des peines qui vise à remplacer des peines privatives de liberté en peines de travail, le sujet, madame la ministre, a fait l'objet d'un important débat en commission. Indépendamment de toutes les avancées que présente ce projet en faveur des victimes, la communication des décisions concernant les modalités d'exécution de la peine aurait pu être élargie, lorsque la victime en a fait la demande. En effet, pourquoi la victime n'est-elle pas informée en ce qui concerne les permissions de sortie présentant un caractère périodique — nous en avons parlé en commission — ou encore lorsque le condamné s'est soustrait à l'exécution de la peine ou de la mesure. Nous aurions encore pu approfondir ce point, même s'il y a déjà une avancée importante en la matière.
Le projet n'a pas inclus le volet "internement". Madame la ministre, vous vous êtes engagée à ce qu'une discussion sur ce volet ait lieu; je m'en réjouis! Nous avions déposé un certain nombre d'amendements en ce sens au moment de la discussion, qui n'ont pas pu être acceptés.
Enfin, en ce qui concerne le statut et le mandat des assesseurs et des juges d'application des peines, j'aurais peut-être privilégié une présentation par la commission de nomination et de désignation du Conseil supérieur. Le comité de sélection aurait dû au moins être composé d'un de ses membres assesseurs, par exemple. Il aurait également été important de ne pas limiter leur mandat à huit ans mais de prévoir un caractère renouvelable, à l'instar d'autres fonctions de magistrats assesseurs devant d'autres tribunaux.

The best proof of this is that it is the court of the bottom that chooses whether it is a work penalty or a prison penalty. This is the best demonstration that it is a decision that is made at the moment the judge decides on the substance, and not an execution of the sentence. Then we revert to the discussion that we had and on which we disagree!
The fourth element to which I would like to return concerns the provisions providing for a specific competence for the minister in terms of granting provisional release following a prison overpopulation. These provisions have been removed. This was already removed in the Senate, following an amendment by Ms. Nyssens. This is positive and I can only rejoice!
The fifth aspect concerns the victims. Regardless of any progress made in this project in favour of victims, the communication of decisions concerning the manner of execution of the sentence could have been extended, when the victim has made a request. Indeed, why is the victim not informed about periodic exit permits — we talked about it in the committee — or when the convicted person withdrew from the execution of the penalty or measure. We could have further deepened this point, even though there is already a significant progress in this area.
The project did not include the section "internationalization". Mr. Minister, you have committed to having a discussion on this aspect; I look forward to it! We had submitted a number of amendments in this direction at the time of the discussion, which could not be accepted.
Finally, as regards the status and mandate of the counselors and judges of punishment enforcement, I might have preferred a presentation by the Supreme Council Nomination and Appointment Committee. The selection committee should at least be composed of one of its advisory members, for example. It would also have been important not to limit their mandate to eight years but to provide for renewable character, like other functions of assistant magistrates before other courts.
The General Assembly could also have intervened for the appointment of judges for the execution of sentences. I would have wanted to look at all these elements in the project. They are not included in it, but that does not take away its positive character.
I actually have some reluctance: the work penalty, of which we have been talking again, the crucial part of the three years, the way to inform the victim. I would also like to go deeper into some points. Nevertheless, this project is positive; it is a legitimate expectation that has existed for a long time. Dat is het hele terrein in verband met de strafuitvoering.
Wanneer wij in het begin van de legislatuur in de commissie hebben gediscussieerd over de volgorde waarin een aantal thema's kon worden besproken, herinner ik mij dat er een debat was wat men eerst moest doen. Moet men eerst het voorstel-Dupont inzake de interne rechtspositie behandelen, moet men eerst de resultaten van de commissie-Holsters implementeren of moet men eerst de maatregelen voor de geïnterneerden bespreken? Dat was het debat dat op een van de eerste vergaderingen van onze commissie werd gevoerd.
Ik stel tot mijn vreugde vast dat wij vandaag toch al aan het tweede luik van dat drieluik toe zijn. Globaal bekeken zal dit een belangrijke verbetering zijn van de situatie inzake de strafuitvoering. Laat ons eerlijk zijn, al diegenen onder u die ooit als advocaat gepleit hebben, vroeger of nu, weten dat strafuitvoering altijd een nogal ambigu verhaal is geweest waarvan velen zelfs niet het ABC kenden, met als gevolg heel wat onduidelijkheid en heel wat problemen voor de betrokken mensen.
Als ik het dan toch over het ruimer kader heb, ga ik ineens over een kleiner onderdeel iets zeggen. Die amendementen zijn uiteindelijk niet aangehouden, vooral omdat het niet evident is om het in dit ontwerp in te schrijven. Ik wil nu nog op een beperkt aantal elementen uit het debat ingaan.
Ik beschouw een eerste zeer algemeen element. Sommigen willen de indruk geven alsof wij met onderhavig ontwerp, samen met het geheel van het beleid dat de meerderheid voert in verband met gevangenisstraf, strafrechterlijk beleid of strafuitvoering, een beleid voeren dat het laxisme zou bepleiten en alsof wij er alles aan doen om zo weinig mogelijk mensen in de gevangenis op te nemen en zo weinig mogelijk mensen tot veroordelingen te laten komen. Dat is het achterliggende beeld dat door sommige collega's geschapen wordt.
Ik wil dat beeld toch even rechtzetten aan de hand van de concrete cijfers. Wie alle cijfers bekijkt die hij kan vinden, ziet dat de afgelopen jaren helemaal niet een sfeer gecreëerd is of een situatie van straffeloosheid ontstaan is, van geen vervolging of van het niet opleggen van straffen. Wie de evolutie van de strafuitspraken volgt, — dit is natuurlijk geen verdienste of gebrek van een politieke meerderheid, maar wel een verhaal dat het geheel van de rechterlijke macht betreft — ziet toch dat inzake criminele straffen het aantal zwaargestraften — ik vergelijk de cijfers van 2003, de recentste die ik heb, met die van bijvoorbeeld 1999 — steeds stijgt. Meer mensen worden veroordeeld tot een levenslange gevangenisstraf. Meer mensen worden veroordeeld tot straffen van twintig tot dertig jaar.
Bij de correctionele straffen ziet men dezelfde evolutie. Als men de vergelijking maakt tussen de periode van 1994 tot 1999 en de laatste vier jaar, dan ziet men dat gevangenisstraffen van 6 maanden tot 1 jaar van 1.603 in de eerste periode zijn gestegen naar 2.072 in de laatste periode. Dat is een stijging met 25%. Straffen van 1 tot 3 jaar zijn gestegen van 1.045 naar 1.250, of een stijging met 20%. Bij de straffen van 3 tot 5 jaar is ook een stijging waar te nemen met 7%. Daarbovenop komt nog dat er bij de straffen van 10 tot 15 jaar een stijging is met 400%. Het gaat weliswaar over kleine aantallen maar het algemene beeld is toch duidelijk: er wordt vandaag in onze samenleving strenger gestraft dan vroeger.
Ik heb het dan nog niet eens gehad over de werkstraffen. Deze straffen werden ingevoerd in 2002. Vroeger bestonden deze straffen niet. In 2002 werden er 528 werkstraffen uitgesproken, in 2003 waren er al 3.174 en in 2004 5.052. Als wij dit allemaal samen leggen, kan ik alleen maar tot de conclusie komen dat men vandaag in onze samenleving strenger straft, repressiever is dan de voorgaande jaren. Dat uit zich ook in de cijfers met betrekking tot de gevangenissen. Ik heb er de cijfers even bijgehaald. Het aantal opsluitingen evolueerde van 14.538 in 1999 naar 15.735 in 2004. Het aantal aanhoudingsmandaten evolueerde van 9.200 naar 10.484. De totale gevangenispopulatie is eveneens gestegen naar zowat 9.500, komende van een beduidend lager aantal.
Waarom geef ik die cijfers? Ik wil van op dit spreekgestoelte toch eens iets duidelijk maken. Wetgeving goedkeuren waarin naast de externe rechtspositie ook de interne rechtspositie van gedetineerden in een kader wordt gegoten dat een normale democratie en rechtsstaat waardig is, en hetzelfde proberen te doen voor interneringen heeft niet als motief te komen tot een samenleving waarin om het even welk gedrag zomaar kan passeren zonder dat het kan worden bestraft. Het is integendeel onze bekommernis om er ook in die moeilijke materie voor te zorgen dat de rechtsstaat overeind blijft.
Een tweede element waarover ik het even wil hebben, is de discussie over een gunst versus een recht. Als men de teksten bekijkt, zou men kunnen vaststellen dat het vroeger een mogelijkheid was terwijl het nu een recht is. Ik ben blij dat collega Verherstraeten daarbij een nuance heeft aangebracht. Ik wil die nuance nog iets verder uitwerken. Men verwart gunst met willekeur.
Het is helemaal niet zo dat de mensen die de vrijheid hebben om te oordelen of een bepaald geval wel of niet onder een van die maatregelen kan vallen, een soort vogelpik kunnen spelen en zeggen: mijnheer of mevrouw, uw gezicht staat mij niet aan en om die reden beslis ik u wel of niet een bepaalde gunst toe te kennen. Ook voor een aantal aspecten van die gunsten geldt motiveringsplicht. De voorwaardelijke invrijheidstelling gebeurt sinds de vroegere wet van 1998 onder de controle van het Hof van Cassatie, een controle waar ook gretig gebruik van gemaakt wordt. U moet maar eens op het internet kijken naar een aantal uitspraken van het Hof van Cassatie in dat verband. Er valt zo'n zestigtal voorbeelden van uitspraken in cassatie terzake, waarin telkens opnieuw argumenten naar voren worden gebracht inzake de mate waarin wel of niet aan de motiveringsplicht voldaan is, te noemen.
Het Hof van Cassatie - ik zeg dat eerlijk - is terughoudend met het verbreken van die beslissingen. Dat is zonder enige twijfel zo. Maar het is toch ver van louter een verhaal van: daar is een commissie en die commissie doet haar goesting, die beslist gewoonweg eender wat.
Ik wil een kleine tussenwerping maken. Men verwijst hier gemakkelijk naar het voorbeeld van Nederland. Als men het Nederlandse voorbeeld aanhaalt, moet men natuurlijk het hele Nederlandse voorbeeld aanhalen. In Nederland bestond het tot voor kort dat, wanneer men een voorwaardelijke invrijheidstelling toepaste, dat in feite een onvoorwaardelijke invrijheidstelling was. I consider a first very general element. Some want to give the impression that with this draft, together with the whole policy of the majority in relation to imprisonment, criminal justice policy or execution, we are pursuing a policy that would advocate laxism and as if we are doing everything we can to get as few people in prison and to get as few people condemned as possible. This is the underlying image created by some colleagues.
I would like to correct this picture with the concrete figures. Whoever looks at all the numbers he can find, sees that in recent years there has been no atmosphere at all or a situation of impunity, of no persecution or of not imposing penalties. Whoever follows the evolution of the punishment sentences — this is of course not a merit or a lack of a political majority, but a story concerning the whole of the judiciary — sees, however, that in criminal penalties the number of heavy penalties — I compare the figures of 2003, the most recent I have, with those of, for example, 1999 — is constantly increasing. More people are sentenced to life imprisonment. More people are sentenced to sentences from twenty to thirty years.
With the correctional penalties, we see the same evolution. If you compare the period from 1994 to 1999 and the last four years, you can see that imprisonment sentences from 6 months to 1 year have increased from 1,603 in the first period to 2,072 in the last period. Dat zijn de gevallen waarbij men in Nederland inderdaad gebruikmaakt van dat soort van onsamendrukbare straffen. Die gevallen zijn uitzonderlijk, dus laten we ook eens spreken over de grote meerderheid van de dossiers.
Ten tweede, het aspect van de slachtoffers is natuurlijk een tweesnijdend zwaard. Ik zit daar zelf ook een beetje mee. Aan de ene kant is er een duidelijke vraag om slachtoffers te betrekken bij de strafuitvoering en hen niet zomaar te confronteren met de mogelijkheid dat ze op een mooie zondagvoormiddag over de Meir lopen en diegene die hun iets heeft aangedaan, op straat tegenkomen, zonder dat ze zelfs maar beseffen dat die persoon in vrijheid is gesteld. Aan de andere kant is er een risico dat wanneer men de slachtoffers op een bepaald ogenblik betrekt in de strafuitvoering, dat pijnlijke wonden opentrekt. Daar is geen kant-enklare oplossing voor. Als er al een oplossing voor bestaat, dan denk ik dat die oplossing te zoeken is in alle mechanismen van herstelbemiddeling en van het permanente contact met de slachtoffers om te proberen het verwerkingsproces van deze mensen op een goede manier te ondersteunen. Ik denk dat dat essentiëler is dan datgene waarop u doelt.
Een derde element dat ik onder uw aandacht wil brengen, is volgens mij de essentie van dit verhaal. Dit verhaal is er een waarin wij in de volgorde van de machten in dit land proberen om inzake de strafuitvoering een ander pad te bewandelen dan in het verleden. Wij verminderen de macht van de uitvoerende macht, wij verminderen de macht van de regering, wij verminderen de macht van de minister en de FOD Justitie, en dat ten voordele van twee categorieën. Enerzijds geven wij meer macht aan de rechterlijke macht, die overigens al zeer lang vraagt om inzake strafuitvoering meer betrokken te zijn en niet te worden geconfronteerd met een uitvoerende macht die, zeker inzake korte gevangenisstraffen, te veel de neiging heeft om datgene wat de rechterlijke macht beslist naast zich neer te leggen. Anderzijds maken wij ook de politiek in het algemeen en het Parlement in het bijzonder machtiger inzake de strafuitvoering. Wij geven onszelf de verantwoordelijkheid om het debat over de algemene voorwaarden en de algemene criteria inzake de strafuitvoering weg te halen van de verantwoordelijke minister en daarover in het Parlement te stemmen.
In de volgende jaren zullen wij merken dat collega's telkens opnieuw voorstellen zullen indienen; de ene om strenger te zijn en de andere om zwakkere voorwaarden te formuleren. Steeds opnieuw zal er een politiek debat zijn over de strafuitvoering en de voorwaarden en normen die in onze samenleving gelden. Dat element, samen met het opkuisen van een hele reeks administratieve richtlijnen, onzichtbare, ontransparante maatregelen inzake strafuitvoering, vervangen door een systeem waarbij het voor iedereen, zelfs een leek, duidelijk kan zijn wat de essentie van de strafuitvoering is, is de verdienste van dit ontwerp. Ik denk dat de kritieken die hier en daar worden geformuleerd het niet zullen halen van de verdiensten van dit ontwerp.
Men heeft kritiek geformuleerd over de misschien te beperkte budgettaire middelen. Ik geef toe dat dit een aandachtspunt is. De heer Verherstraeten maakt de materiële denkoefening van x aantal dossier, vermenigvuldigd met y. Ik denk dat het niet zo lineair is. Het ene dossier is het andere niet. On the other hand, we also make politics in general and Parliament in particular more powerful in terms of the execution of penalties. We give ourselves the responsibility to remove the debate on the general conditions and the general criteria for the execution of penalties from the responsible minister and to vote on it in Parliament.

Monsieur le président, madame la vice-première ministre, chers collègues, je suis à l'origine des deux plus importantes pétitions adressées à notre assemblée depuis la création de notre pays. La première fut remise en décembre 1992 et demandait à ce que de dangereux criminels ne soient plus libérés. La deuxième fut remise en octobre 1996 et demandait l'application de peines pédagogiques, de même que l'instauration de peines incompressibles, ces dernières afin de démontrer aux victimes l'importance du préjudice qu'elles avaient subi et que celui-ci était pris en compte. Pourtant, en 1985 déjà, le commissaire royal Robert Legros faisait la première proposition formelle pour instaurer le tribunal d'application des peines. En 1997, la commission d'enquête parlementaire Dutroux, Nihoul et consorts s'était ralliée à cette notion et précisait d'emblée que le tribunal d'application des peines devrait être chargé en tout cas de tous les aspects et modalités de l'application des peines, y compris la libération conditionnelle.
À la fin de la précédente législature, l'obstacle majeur à l'instauration d'un tribunal d'application des peines a été levé. En effet, l'article 157 de la Constitution a été revu et son alinéa 4 prévoit désormais "(qu')il y a des tribunaux d'application des peines dans les lieux déterminés par la loi" et que cette dernière "règle leur organisation, leurs attributions, le mode de nomination de leurs membres et la durée des fonctions de ces derniers".
Le projet de loi qui se trouve sur nos bancs aujourd'hui vise à répondre à deux critiques fondamentales du système actuel. L'exécution des peines privatives de liberté souffre d'un déficit légal. Si ce n'est la liberté conditionnelle ou la libération provisoire pour raisons médicales, aucune forme de modalité d'exécution de la peine privative de liberté ou de libération anticipée n'est régie par la loi mais bien par une série impressionnante de circulaires ministérielles. La situation actuelle ne présente donc pas une sécurité juridique suffisante.
Comme l'indique la commission Holsters dans son rapport final, la Belgique se trouve donc dans une situation paradoxale: seules la libération conditionnelle et la libération provisoire pour raisons médicales font l'objet d'une réglementation légale alors que toutes les autres modalités d'exécution de la peine, quantitativement beaucoup plus importantes, sont réglées exclusivement par des circulaires ministérielles.
Il est primordial de faire figurer de façon précise dans une loi les différentes modalités d'exécution de la peine privative de liberté, leurs conditions d'admissibilité et leurs effets. La loi en projet crée une meilleure protection des détenus, de la société et des victimes. Elle intègre également la reconnaissance des droits des victimes.
Au jour d'aujourd'hui, l'exécution des peines privatives de liberté traduit une répartition contestable des compétences entre le pouvoir exécutif et le pouvoir judiciaire. En vertu du principe de séparation des pouvoirs, le pouvoir exécutif n'est pas compétent pour renoncer à exécuter les peines prononcées par le pouvoir judiciaire, ni à en modifier fondamentalement leur durée et leur nature. C'est à une instance judiciaire que revient cette compétence. Le pouvoir judiciaire est seul compétent pour modifier la nature ou la durée de la peine initialement prononcée. Il convient donc de donner une base légale au statut juridique externe des détenus, de créer une instance judiciaire chargée de se prononcer sur l'octroi d'une modalité d'exécution d'une peine privative de liberté.
Mais répondre à ces deux critiques fondamentales à l'encontre des règles actuelles d'exécution des peines privatives de liberté ne suffit pas. Pour mon groupe politique et pour moi-même, le statut externe du détenu doit se placer dans une logique de justice réparatrice. Ce principe implique d'une part que la victime ne peut être mise à l'écart de l'exécution des peines. Si elle le souhaite, elle doit être informée du déroulement de la peine et doit pouvoir être entendue pour ce qui la concerne. D'autre part, le condamné doit être mis dans la possibilité de réparer le dommage causé par l'infraction. Ce principe implique également la responsabilisation et la participation du condamné. Il doit devenir acteur de sa détention, mais aussi de sa préparation à la sortie de prison.
C'est ici que la loi relative au statut juridique interne des détenus prend tout son sens. C'est aussi la raison pour laquelle, j'ai insisté pour que l'attitude du condamné à l'égard des victimes des infractions qui ont donné lieu à sa condamnation soit intégrée dans les contreindications à prendre en considération pour l'octroi d'une modalité d'exécution de la peine.
Le projet de loi relatif au statut juridique externe des détenus améliore les droits des victimes dans le cadre des modalités d'exécution des peines. La victime qui le souhaite doit pouvoir participer au processus d'exécution de la peine et être informée du déroulement de l'exécution de celle-ci.
Il en va de l'accès pour la victime, mais aussi pour l'auteur, à une justice réparatrice ou, plus précisément, à une justice restauratrice. Cette fixation légale du rôle de la victime dans toute la procédure pénale jusqu'à l'exécution de la peine prononcée est d'une importance primordiale. C'est pourquoi durant les travaux de la commission, j'ai accordé une attention toute particulière au statut de la victime.
Tout d'abord, il convenait, à mon sens, de modifier l'intitulé du projet de loi. En effet, ce dernier ne concerne pas seulement le statut juridique externe du détenu, mais aussi les droits reconnus aux victimes, eu égard aux modalités d'exécution des peines privatives de liberté. Certes, cette modification est symbolique, mais les victimes doivent savoir que des droits leur ont été accordés. Les intervenants à tous les stades de l'exécution de la peine doivent le savoir aussi, tout comme l'auteur.
Le projet initial déposé au Sénat était en net retrait par rapport à la définition de la notion de victime et en comparaison de la situation actuelle en matière de libération conditionnelle. Après des débats constructifs, vous avez accepté d'étendre la notion de victime. Dès lors auront le statut de victime au sens de ce projet de loi: la personne physique dont l'action civile est déclarée recevable et fondée; la personne qui était mineure au moment des faits et pour laquelle le représentant légal ne s'est pas constitué partie civile; enfin, la personne qui n'a pas pu se constituer partie civile par suite d'une situation d'impossibilité matérielle ou de vulnérabilité.
En ce qui concerne ces deux dernières catégories, le juge d'application des peines appréciera si elles ont un intérêt direct et légitime. Cette restriction vise à établir un équilibre entre responsabilité des victimes et extension de leurs droits dans le cadre de l'exécution des peines privatives de liberté.
Toutefois, j'espère que le critère choisi n'est pas trop restrictif. Nous verrons dans la pratique si certaines victimes restent sur le côté, et s'il convient d'aménager des mesures afin qu'elles aient quand même leur mot à dire en bout de course au sujet de l'exécution des peines.
Le mérite de cette définition est de ne plus opérer de distinction entre les victimes en fonction de la nature des faits qui leur ont causé un dommage. Il est, en effet, essentiel que chaque victime, telle que définie par le projet, puisse être informée et entendue si elle le souhaite. La ventilation des droits des victimes selon la nature des faits n'est pas pertinente et risque d'entraîner une victimisation secondaire.
Désormais, en fonction de la modalité d'exécution de la peine, les victimes seront informées et entendues selon leur souhait. Il conviendra de veiller à ce qu'un réel accompagnement et soutien leur soient assurés. Idéalement, cet accompagnement devrait commencer dès l'accueil au sein des commissariats de police jusqu'au prononcé de la peine.
Ensuite, la victime doit être préparée à une sortie éventuelle de l'auteur de l'infraction. Elle doit également être préparée à un contact éventuel que les maisons de justice prendront avec elle pour l'informer qu'elle peut être entendue par le juge ou par le tribunal de l'application des peines.
À ce propos, je comprends et j'accepte, dans une certaine mesure, les considérations pragmatiques qui ont conduit les auteurs du projet à prévoir la possibilité d'organiser les audiences du tribunal de l'application des peines dans l'enceinte de la prison. Mais je tiens à nouveau à insister sur la nécessité impérieuse d'améliorer l'accueil des victimes au sein des prisons. L'accueil qui leur est réservé à l'heure actuelle est inadmissible.
Je vous livre à ce sujet le témoignage suivant. C'est la victime qui parle.
"Dans le cadre de la demande de libération conditionnelle introduite par un des assassins de mon fils, j'ai été convoqué, à ma demande, afin de pouvoir m'exprimer devant la commission de libération conditionnelle. Cette rencontre a eu lieu le 23 mars 2006 à 14.15 heures, à la prison de et à Arlon.
Je me suis présenté à 14.00 heures à la porte principale de la prison. Après avoir décliné mon identité et fait référence à ma convocation, j'ai pu franchir le pas de la première porte.
J'ai ensuite sonné à la deuxième porte pour avoir accès au sas d'entrée où j'ai été pris en charge par le planton au service des entrées. À la demande du préposé de service, j'ai remis, comme stipulé sur ma convocation, ma convocation accompagnée de ma carte d'identité.
Le préposé de service m'a fait savoir que, si j'étais en possession d'un gsm, je devais le lui remettre jusqu'au moment de ma sortie. Ensuite, on m'a demandé de me positionner dans un carré rouge et de regarder la caméra afin de prendre une photo.
Ayant écarté l'ensemble des objets métalliques, je suis passé par le portique de sécurité; celui-ci a déclenché un signal d'alerte laissant présumer que j'étais en possession d'un objet insolite. Il s'agissait de mon agenda électronique. L'agent de sécurité m'a demandé ce que c'était comme appareil; je l'ai allumé pour le lui montrer. Il a directement émis des réserves quant à la possibilité de pouvoir le prendre à l'intérieur de l'établissement pénitentiaire.
Afin de ne pas commettre d'erreur, il a demandé au directeur de la prison et celui-ci a émis un avis négatif sans autre explication. Comme mon agenda contenait un résumé des différents points que je souhaitais présenter devant la commission de libération conditionnelle, je ne souhaitais nullement m'en séparer. L'agent de sécurité m'a donné le choix entre entrer sans mon agenda ou renoncer à participer à l'audience prévue. J'ai choisi de quitter les lieux. Je précise qu'aucun écrit ne m'a été remis par le directeur de la prison ni pour confirmer sa décision de refus de me laisser emporter mon PDA, ni pour confirmer que j'ai répondu à ladite convocation. Voilà en quelques mots ce que j'ai vécu.
Je voudrais, dans un premier temps, exprimer mon humiliation ainsi que ma désapprobation. En agissant de la sorte, j'estime que le respect de la victime est bafoué. Je comprends très bien que des mesures de sécurité soient nécessaires mais je pense qu'il y a confusion entre une personne qui se présente comme quelqu'un qui rend visite à un détenu et une victime qui demande à s'exprimer, voire à émettre ses doléances devant une commission ayant choisi et défini de se réunir avec elle. J'ai pensé être incarcéré et non pas être invité pour être entendu.
En conclusion, je pense que le vécu de cette journée ne peut satisfaire le respect auquel toute victime directe ou indirecte a droit. Je demande que la rencontre de l'auteur et de la victime devant la commission de libération soit prévue dans un environnement plus convivial pour toutes les parties concernées.
Je souhaiterais plus d'équité en ce qui concerne les droits de l'auteur des faits demandant une réinsertion dans la société et les droits de la victime demandant une réinsertion dans la vie."
Le témoin dont je vous ai cité le vécu a fait plus de 200 kilomètres dans l'espoir de pouvoir s'exprimer et a été obligé de prendre une journée congé.

Je salue également l'information qui sera délivrée à la victime par le juge du fond lors du prononcé de la peine. Désormais, le juge prononcera une peine privative de liberté, il informera les parties des modalités d'exécution de cette peine et il aura également l'obligation d'informer la partie civile des possibilités d'être entendue dans le cadre de l'exécution de la peine au sujet des conditions qui doivent être imposées dans son intérêt. J'aurais souhaité qu'il soit également confié au juge du fond la mission d'indiquer à la partie civile qu'il lui est possible de prendre contact avec les maisons de justice si elle souhaite obtenir une information approfondie concernant les modalités d'exécution de la peine privative de liberté qui a été prononcée.
Le prononcé de la peine doit être l'occasion, pour la partie civile, d'être informée de l'existence de cet interlocuteur privilégié dans le cadre de l'exécution des peines privatives de liberté. On m'a répondu qu'à ce stade de la procédure, la victime a déjà connaissance de l'existence des maisons de justice et qu'un accompagnement et un soutien doivent déjà avoir été donnés dans le cadre de la procédure pénale mais doivent également avoir lieu dans le cadre de l'exécution de la peine. Idéalement, cela doit effectivement être le cas. Je resterai cependant très vigilant quant à la mise en application de ces mesures.
Pour ce qui concerne la possibilité pour la victime d'être entendue dans le cadre de la révocation de la suspension et de la révision de la modalité d'exécution des conditions en cas de non-respect par le condamné, je suis également satisfait d'avoir été entendu. Le projet de loi prévoyait que la victime était informée mais pas entendue. A la suite de ma remarque, le projet a été amendé et prévoit que la victime sera non seulement informée mais également entendue par le juge ou par le tribunal de l'application des peines sur les conditions imposées dans son intérêt.
Même satisfaction en ce qui concerne l'arrestation provisoire ordonnée par le procureur du Roi. Le projet initial prévoyait que si le condamné mettait gravement en péril l'intégrité physique de tiers, le procureur du Roi pouvait ordonner l'arrestation provisoire. Le projet amendé par la commission étend la protection des tiers et donc des victimes à la mise en péril de l'intégrité physique et psychique. Cette précision est importante. Pensons au condamné qui harcèle la victime. Dimanche dernier encore, un témoignage d'une victime harcelée par un auteur de faits était diffusé lors de l'émission "Controverse".
Mon groupe se réjouit également d'avoir été entendu en ce qui concerne l'octroi du congé pénitentiaire. Le projet de loi initial prévoyait que la décision d'octroi d'un congé pénitentiaire était renouvelée de plein droit chaque trimestre. Ce système proposé ne permettait pas au ministre d'adapter les conditions posées au congé pénitentiaire sans qu'il y ait non-respect de ces conditions. Ce système manquait de souplesse.
En effet, de nouvelles contre-indications peuvent apparaître sans qu'il y ait non-respect des conditions. Il se peut également que la situation du condamné évolue favorablement. Ces circonstances doivent pouvoir être rencontrées par une décision adaptée du ministre.
Par conséquent, mon groupe a proposé de reprendre la proposition de la commission Holsters telle qu'elle reprend la réglementation actuelle. La première demande de congé sera soumise au ministre de la Justice pour décision. En cas de décision positive et sauf disposition contraire expresse, l'accord portera non seulement sur le premier congé mais également sur les congés suivants et ce, jusqu'au terme de la détention. La décision sortira cependant ses effets pour chaque nouveau congé seulement si le congé précédent peut être considéré comme réussi et si le directeur n'a relevé aucune nouvelle contre-indication.
Dans le cadre de cette procédure, un congé sera considéré comme réussi lorsque le détenu aura satisfait aux critères objectifs suivants: réintégrer l'établissement à temps, ne pas revenir en état d'ivresse, ne pas avoir causé d'incident pendant le congé ou au cours du retour, avoir passé le congé à l'adresse indiquée et avoir respecté les conditions qui lui auront été imposées individuellement. Pourront constituer de nouvelles contre-indications tous les faits, circonstances ou événements survenus ou portés à la connaissance des directeurs de prison depuis le dernier congé et qui sont de nature à compromettre la possibilité ou l'opportunité de le renouveler, par exemple des problèmes relationnels ou un nouveau milieu d'accueil, un nouvel état du détenu, un refus de libération conditionnelle, une tentative d'évasion, etc. En cas d'échec du congé ou de contreindication récente, une nouvelle demande de congé devra être adressée au ministre de la Justice, accompagnée d'un rapport détaillé relatif à l'incident ou à la contre-indication.
Il va de soi que cette nouvelle procédure ne dispense pas le personnel de continuer à consacrer toute son attention à la préparation de chaque congé. Cette même attention sera requise lors de l'accueil de chaque détenu rentrant de congé et lors de l'appréciation après coup de ce congé.
En prévoyant que la décision d'octroi d'un congé pénitentiaire est renouvelée de plein droit à chaque trimestre et en prévoyant qu'une adaptation des conditions n'est possible qu'en cas de non-respect des conditions particulières, le projet de loi s'écartait de la réglementation actuelle et faisait preuve de moins de souplesse. Aucune adaptation n'était possible en cas d'évolution des conditions, des circonstances ou du détenu sans qu'il y ait pour autant violation des conditions particulières.
Pour clore ce chapitre, je me permets de revenir sur l'amendement 165 à l'article 49 que j'ai retiré suite à l'explication donnée par la ministre de la Justice au sujet de l'avis personnel donné par un psychiatre et qui sera requis lors de la procédure de libération conditionnelle et de l'évaluation du risque de récidive de condamnés pour des infractions particulièrement graves. En effet, aux dires d'un expert psychiatre expérimenté, il est tout à fait possible de prévoir avec certitude la récidive de certains individus, alors que la garantie de la non-récidive est évidemment impossible à établir.
Les deux projets que nous nous apprêtons à voter aujourd'hui constituent donc une avancée incontestable. Toutefois, il ne s'agit que d'un premier pas. En effet, il conviendra dans un second temps de confier à une juridiction non seulement l'exécution des mesures privatives de liberté mais aussi celle des autres types de peines et de mesures comme la probation, la peine de travail, le sursis et la défense sociale.
Les initiatives législatives comme celles-ci n'ont un sens que s'il existe une certitude que les moyens financiers seront débloqués pour en assurer la praticabilité. Lors de la discussion en commission de la Justice, il est clairement apparu que l'application de ces projets entraînera un surcoût important à plusieurs niveaux.
Bien sûr, les commissions de libération conditionnelle disparaîtront au profit du juge ou du tribunal; des moyens budgétaires pourront donc être transférés. Néanmoins, il faudra veiller aussi au financement des maisons de justice et des assistants de justice dont le travail est extrêmement important puisque c'est sur celui-ci que repose véritablement le suivi de l'exécution de la peine.
Il faudra donc, madame la ministre, être très attentifs à cette question.
En guise de conclusion, je voudrais vous faire part de quelques réflexions personnelles et formuler moi-même une réponse aux deux pétitions que j'ai citées au début de mon intervention.
Bon nombre de nos concitoyens s'insurgent contre les droits qui sont reconnus aux coupables de toute sorte. Pire, pour les petits délits, on ne leur applique même plus la punition pourtant prononcée. Il arrive de plus en plus souvent que les faits commis soient classés sans suite parce que trop peu importants par rapport à ce que coûte leur poursuite. Pour les faits les plus graves, la justice condamne parfois à de lourdes peines, qui ne sont cependant souvent exécutées que pour une partie qui paraît insignifiante.
Il semble que, pour ce qui concerne la punition, notre société ait perdu l'étalon de référence par rapport auquel elle prend ses décisions. La punition a-t-elle perdu son sens? Ne servirait-elle qu'à reporter les problèmes à plus tard? La bonne réponse se trouveraitelle dans la mise à l'écart définitive des délinquants selon la gravité des faits? Et faudrait-il punir plus sévèrement les autres?
A mon avis, la question est mal posée. Ne faut-il pas se demander à quoi doit servir une punition? En ce qui me concerne, la punition n'a de sens que si elle indique à celui qui la subit que son comportement n'est pas accepté et que, s'il souhaite retourner à la vie en société, il doit en changer.
Ce n'est que lorsque la justice est convaincue que le puni a compris le sens de sa punition qu'une période d'essai sous conditions peut être envisagée. Le bon étalon serait la volonté de réparer le mal qu'il a fait. Dans ce sens, la peine incompressible perd le sien.
Pour beaucoup de condamnés, la prison perd le sien aussi. Pour d'autres, malheureusement, elle reste l'unique rempart contre les récidives, quitte à devoir recourir à la loi sur la protection sociale. Il s'agit ici d'une extrême minorité de nos concitoyens.
En ce qui concerne les victimes, je vous soumets le constat que j'ai fait après quatorze années d'expérience personnelle.
Le plus grand tort qu'un homme peut se faire, c'est d'en haïr un autre. Il en oublie de s'aimer, il infecte l'amour qu'il a pour les autres hommes, il connaît l'enfer et il l'alimente.
Nous avons le devoir de sortir les victimes de cela au lieu de les y conforter en leur laissant croire que la souffrance de l'auteur peut leur apporter un quelconque réconfort. Et tant pis pour ceux qui vivent sur le dos de la vindicte populaire et qui n'hésitent pas à instrumentaliser les victimes pour le faire!
Mon groupe et moi-même voterons en faveur de ce projet avec la conviction d'avoir fait oeuvre de justice restauratrice, offrant une véritable sortie à la culture de la haine et de la violence.

Mr. Speaker, Mrs. Deputy Prime Minister, dear colleagues, I am at the origin of the two most important petitions addressed to our assembly since the creation of our country. The first was delivered in December 1992 and demanded that dangerous criminals should no longer be released. The second was delivered in October 1996 and demanded the application of pedagogical penalties, as well as the introduction of incompressible penalties, the latter in order to demonstrate to the victims the importance of the damage they had suffered and that this was taken into account. In 1985, Royal Commissioner Robert Legros made the first formal proposal for the establishment of a court for the execution of sentences. In 1997, the parliamentary commission of inquiry Dutroux, Nihoul et consorts had joined this notion and specified from the outset that the court of enforcement of penalties should be responsible in any case for all aspects and modalities of the enforcement of penalties, including conditional release.
At the end of the previous legislature, the major obstacle to the establishment of a penalty court was removed. In fact, Article 157 of the Constitution has been revised and its paragraph 4 now provides "(that) there are courts of application of penalties in the places determined by the law" and that the latter "regulates their organization, their attributions, the mode of appointment of their members and the duration of the duties of the latter".
The bill that is on our banks today aims to respond to two fundamental criticisms of the current system. The execution of prison sentences suffers from a legal deficit. Except for conditional freedom or provisional release for medical reasons, no form of manner of execution of the penalty deprivation of liberty or early release is governed by the law but rather by an impressive series of ministerial circulars. The current situation does not provide sufficient legal certainty.
As the Holsters Commission points out in its final report, Belgium is therefore in a paradoxical situation: only the conditional release and the provisional release for medical reasons are the subject of legal regulation while all other modalities of execution of the sentence, quantitatively much more important, are regulated exclusively by ministerial circulars.
It is of paramount importance that in a law the various modalities for the execution of the imprisonment, their conditions of eligibility and their effects are clearly stated. The draft law creates better protection for detainees, society and victims. It also includes recognition of the rights of victims.
Today, the execution of prison sentences reflects a disputable division of powers between the executive power and the judiciary. Under the principle of separation of powers, the executive power is not competent to renounce the execution of penalties imposed by the judiciary or to fundamentally change their duration and nature. This competence belongs to a judicial authority. The judicial authority alone is competent to change the nature or duration of the sentence initially imposed. It is therefore appropriate to provide a legal basis for the external legal status of detainees, to create a judicial instance responsible for deciding on the granting of a modality for the execution of a depriving of liberty sentence.
But responding to these two fundamental criticisms against the current rules for the execution of prison sentences is not enough. For my political group and for myself, the external status of the detainee must be placed in a logic of reparative justice. This principle implies, on the one hand, that the victim cannot be excluded from the execution of sentences. If she wishes to do so, she must be informed of the course of the sentence and must be able to be heard in matters concerning her. On the other hand, the convicted person must be placed in the possibility of repairing the damage caused by the offence. This principle also involves the accountability and participation of the convicted. He must become an actor in his detention, but also in his preparation for his release from prison.
This is where the law on the internal legal status of detainees takes its full meaning. This is also why I insisted that the attitude of the convicted person towards the victims of the crimes that led to his conviction should be included in the contraindications to be taken into consideration for the granting of a modality of execution of the sentence.
The draft law on the external legal status of detainees improves the rights of victims in the framework of the terms of execution of sentences. The victim who wishes to do so must be able to participate in the execution process and be informed of the progress of the execution.
This includes access for the victim, but also for the perpetrator, to reparative justice or, more specifically, to restorative justice. This legal determination of the victim’s role throughout the criminal proceedings until the execution of the sentence is of paramount importance. Therefore, during the work of the committee, I paid special attention to the status of the victim. by
First of all, I think it was appropriate to change the title of the bill. In fact, the latter concerns not only the external legal status of the detainee, but also the rights recognized to the victims, with regard to the modalities of execution of imprisonment sentences. Certainly, this change is symbolic, but victims should know that rights have been granted to them. Participants at all stages of the execution of the sentence must also know this, as well as the perpetrator.
The initial draft submitted to the Senate was in clear departure from the definition of the concept of victim and in comparison to the current situation in terms of conditional release. After constructive discussions, you agreed to extend the notion of victim. Therefore, they will have the status of victim within the meaning of this bill: the natural person whose civil action is declared admissible and founded; the person who was a minor at the time of the facts and for whom the legal representative did not constitute a civil party; finally, the person who could not constitute a civil party due to a situation of material impossibility or vulnerability.
With regard to the latter two categories, the sentencing judge will assess whether they have a direct and legitimate interest. This restriction aims to establish a balance between the responsibility of victims and the extension of their rights in the context of the execution of prison sentences.
However, I hope that the criterion chosen is not too restrictive. We will see in practice whether some victims remain on the side, and whether measures should be arranged so that they still have their word to say at the end of the race about the execution of the sentences.
The merit of this definition is to no longer make a distinction between victims based on the nature of the facts that caused them harm. It is, indeed, essential that every victim, as defined by the project, can be informed and heard if they wish. The separation of victim rights according to the nature of the facts is not relevant and may result in secondary victimization.
From now on, depending on the manner of execution of the sentence, the victims will be informed and heard as they wish. It will be necessary to ensure that real support and support is provided to them. Ideally, this accompaniment should start from the reception in the police offices until the sentence is pronounced. by
Then the victim must be prepared for a possible exit from the offender. She must also be prepared for any possible contact that the houses of justice will take with her to inform her that she can be heard by the judge or the court of execution of the sentences.
In this regard, I understand and accept, to a certain extent, the pragmatic considerations that led the authors of the project to provide for the possibility of organizing the hearings of the court of the application of sentences in the prison area. But I would like to reiterate the urgent need to improve the reception of victims in prisons. The reception that is reserved for them at the moment is unacceptable.

“As part of the request for conditional release submitted by one of my son’s murderers, I was summoned, at my request, in order to be able to speak before the conditional release commission. This meeting took place on 23 March 2006 at 14.15 a.m., in the prison of and in Arlon.
I presented myself at 14.00 at the main door of the prison. After declining my identity and referring to my calling, I was able to cross the step of the first door.
I then ringed at the second door to get access to the entrance gate where I was taken care of by the planton at the entrance service. At the request of the head of service, I delivered, as stipulated on my call, my call accompanied by my identity card.
The service officer told me that if I was in possession of a GSM, I would have to give it to him until the moment of my departure. Then I was asked to position myself in a red square and look at the camera in order to take a picture. by
Having separated all the metal objects, I passed through the security portico; it triggered a warning signal suggesting that I was in possession of an unusual object. It was my electronic agenda. The security officer asked me what it was like a device; I turned it on to show it to him. He directly expressed reservations regarding the possibility of being able to take him inside the penitentiary establishment. by
In order not to make a mistake, he asked the prison director and he issued a negative opinion without further explanation. Since my agenda contained a summary of the various points that I wanted to present before the Commission on Conditional Release, I wished in no way to separate myself from them. The security officer gave me the choice between entering without my schedule or giving up attending the scheduled hearing. I chose to leave the place. I specify that no letter has been delivered to me by the director of the prison nor to confirm his decision of refusing to let me take my PDA, nor to confirm that I have responded to the aforementioned call. Here is, in a few words, what I have experienced.
First of all, I would like to express my humiliation and disapproval. In doing so, I feel that the respect of the victim is undermined. I understand very well that security measures are necessary, but I think that there is confusion between a person who presents himself as someone who visits a prisoner and a victim who asks to speak out, or even to issue his complaints before a commission that has chosen and defined to meet with her. I thought I was imprisoned and not invited to be heard. by
In conclusion, I think that the experience of this day cannot satisfy the respect to which any direct or indirect victim is entitled. I request that the meeting of the perpetrator and the victim before the release commission be planned in a more friendly environment for all interested parties.
I would like more equity with regard to the rights of the perpetrator who asks for reintegration into society and the rights of the victim who asks for reintegration into life.”
The witness whose experience I have quoted has traveled more than 200 kilometers in the hope of being able to speak and was forced to take a day off.

I also welcome the information that will be delivered to the victim by the judge of the main proceedings when the sentence is delivered. From now on, the judge will pronounce a sentence of deprivation of liberty, inform the parties of the manner of execution of that sentence and will also have the obligation to inform the civil party of the possibilities of being heard in the context of execution of the sentence about the conditions to be imposed in its interest. I would have wished that the judge of the main proceedings should also be entrusted with the task of indicating to the civil party that it is possible for him to contact the houses of justice if he wishes to obtain in-depth information concerning the modalities for the execution of the sentence depriving of liberty which has been issued.
The pronouncement of the sentence shall be an opportunity for the civil party to be informed of the existence of this privileged interlocutor in the context of the execution of the sentences depriving of liberty. I was answered that at this stage of the proceedings the victim is already aware of the existence of the houses of justice and that accompaniment and support must already have been provided in the context of the criminal proceedings but must also take place in the context of the execution of the sentence. Ideally, this should actually be the case. However, I will remain very vigilant on the implementation of these measures.
As regards the possibility for the victim to be heard in the context of the revocation of the suspension and the revision of the modality of fulfillment of the conditions in the event of non-compliance by the convicted person, I am also pleased that I was heard. The draft law stipulated that the victim was informed but not heard. Following my remarks, the draft was amended and provides that the victim will not only be informed but also heard by the judge or the court of the application of penalties on the conditions imposed in his interest.
The same satisfaction with regard to the provisional arrest ordered by the Procurator of the King. The initial draft provided that if the convicted person seriously endangered the physical integrity of third parties, the King's prosecutor could order the provisional arrest. The draft amended by the commission extends the protection of third parties and therefore victims to the threat of physical and psychological integrity. This precision is important. Think of the convict who harasses the victim. Last Sunday, a testimony of a victim harassed by a perpetrator was broadcast during the show "Controverse".
My group is also pleased to have been heard regarding the granting of imprisonment leave. The original bill stipulated that the decision to grant a prison leave was renewed in full every quarter. This proposed system did not allow the Minister to adjust the conditions laid for prison leave without non-compliance with these conditions. This system lacks flexibility.
In fact, new contraindications can appear without non-compliance with the conditions. It is also possible that the situation of the convicted develops favorably. These circumstances must be able to be met by an appropriate decision of the Minister.
Therefore, my group proposed to take back the Holsters Commission proposal as it takes back the current regulation. The first application for leave will be submitted to the Minister of Justice for decision. In the event of a positive decision and unless expressly provided otherwise, the agreement will not only cover the first leave but also the following leave, and this, until the end of the detention. However, the decision will only take effect for each new leave if the previous leave can be considered successful and if the director has not raised any new contraindications.
Within the framework of this procedure, a leave shall be considered successful when the detainee has fulfilled the following objective criteria: reintegrate to the establishment in time, do not return into intoxication, have not caused an incident during the leave or during the return, have spent the leave at the address indicated and have fulfilled the conditions that have been imposed on him individually. Any facts, circumstances or events that have occurred or brought to the knowledge of the prison directors since the last leave and that are of the nature to compromise the possibility or the opportunity to renew it, for example relationship problems or a new environment of reception, a new condition of the detainee, a refusal of conditional release, an attempt to escape, etc. In case of failure of leave or recent contraindication, a new leave application must be addressed to the Minister of Justice, accompanied by a detailed report on the incident or contraindication.
Of course, this new procedure does not exempt staff from continuing to devote all their attention to the preparation of each leave. The same attention shall be required in the reception of each detainee returning from leave and in the after-examination of that leave.
By providing that the decision to grant a prison leave is fully renewed every quarter and by providing that an adaptation of the conditions is possible only in case of non-compliance with the particular conditions, the bill deviated from the current regulation and showed less flexibility. No adaptation was possible in the event of changes in conditions, circumstances or the detainee without there being, however, a violation of the special conditions.
To close this chapter, I would like to return to Amendment 165 to Article 49, which I withdrew following the explanation given by the Minister of Justice regarding the personal advice given by a psychiatrist and which will be required during the procedure for conditional release and the assessment of the risk of recurrence of convicted persons for ⁇ serious offences. Indeed, according to an experienced expert psychiatrist, it is quite possible to predict with certainty the recurrence of certain individuals, while the guarantee of non-recurrence is obviously impossible to establish.
The two projects we are about to vote today are therefore an undeniable advance. However, this is only a first step. In fact, it will be appropriate in a second time to entrust to a court not only the execution of the measures depriving of liberty but also that of other types of penalties and measures such as probation, labour penalty, suspension and social defense.
Legislative initiatives like these only make sense if there is certainty that the financial resources will be unlocked to ensure their feasibility. During the discussion in the Justice Committee, it was clear that the implementation of these projects will result in a significant surplus cost at several levels.
Of course, conditional release commissions will disappear for the benefit of the judge or the court; therefore, budget resources can be transferred. Nevertheless, it will also be necessary to take care of the financing of the houses of justice and of the assistants of justice whose work is extremely important since it is on it that truly rests the monitoring of the execution of the sentence.
Therefore, the Minister must be very attentive to this issue.
In conclusion, I would like to give you some personal reflections and formulate myself a response to the two petitions that I cited at the beginning of my speech.
Many of our fellow citizens are insurgent against the rights recognized to the culprits of all kinds. Worse, for smaller crimes, they are not even punished anymore. It happens more and more often that the acts committed are classified without succession because they are too insignificant compared to the cost of pursuing them. For the most serious facts, justice sometimes condemns to heavy penalties, which, however, are often executed only for a part that seems insignificant.
It seems that, in terms of punishment, our society has lost the benchmark standard against which it makes its decisions. Has the punishment lost its meaning? Would it only serve to postpone the problems for later? Would the correct answer be in the definitive separation of offenders according to the gravity of the facts? Should others be punished more severely?
In my opinion, the question is misplaced. Shouldn’t we ask ourselves what a punishment is for? As far as I am concerned, punishment only makes sense if it indicates to the person who suffers it that his behavior is not accepted and that, if he wishes to return to life in society, he must change it. by
It is only when the judiciary is convinced that the punished has understood the meaning of his punishment that a trial period under conditions can be considered. The good standard would be the willingness to repair the evil he has done. In this sense, incomprehensible punishment loses its own.
For many convicts, the prison also loses its own. For others, unfortunately, it remains the only fence against recurrences, even if they have to resort to the Social Protection Act. This is an extreme minority of our fellow citizens.
As for the victims, I submit to you the conclusion I made after fourteen years of personal experience. by
The greatest mistake a man can do to himself is to hate another. He forgets to love himself, he infects the love he has for other men, he knows hell and he feeds it.
We have the duty to bring the victims out of this instead of comforting them by letting them believe that the suffering of the author can bring them some kind of comfort. And so much woe to those who live on the back of popular vengeance and who do not hesitate to instrumentalize the victims to do so!
My group and I will vote in favour of this project with the conviction that we have done the work of restorative justice, offering a real way out to the culture of hatred and violence.

Mijnheer de voorzitter, mevrouw de vice-eerste minister, collega's, ik zal proberen zo kort mogelijk te zijn en niet in technische details te vervallen. Ik denk dat we in de commissie lang en breed hebben gedebatteerd over de verschillende aspecten van de twee wetsontwerpen die voorliggen. Ik merk uit de betogen, zowel in de commissie als vandaag, dat alle fracties op een na de uitgangspunten en de grote principes van deze wetsontwerpen delen.
Wat voor ons belangrijk is, is dat er duidelijkheid komt en dat er via de strafuitvoeringsrechtbanken een vorm van objectivering zal komen die ook belangrijk is. Er worden nu regels vastgelegd. De volgende jaren zal het aan de strafuitvoeringsrechtbanken zijn om die toe te passen en terzake een eigen toepassing en jurisprudentie te ontwikkelen. Dat is voor ons van groot belang.

Ces projets qui ont d'ailleurs d'abord été examinés au Sénat — tant le projet sur le statut externe des détenus que celui sur le tribunal d'application des peines — ont fait l'objet d'un examen en profondeur. De nombreux amendements ont été acceptés. La Chambre a réellement joué un rôle majeur dans un dossier qui est attendu sur le terrain depuis de nombreuses années.
Comme certains l'ont déjà fait aujourd'hui, je rappelle à nouveau qu'un des intérêts de ces deux projets est de conférer enfin une base juridique légale au statut externe des condamnés. Ces projets concernent donc les aspects extra-muros, comme par exemple les modalités relatives à l'interruption de la peine ou aux libérations anticipées. Un cadre légal était nécessaire car ce statut externe est pour le moment sous la coupe d'une multitude de directives, de circulaires, de notes vertes. Or, dans une matière aussi sensible et difficile, cette situation est contraire à la sécurité juridique.
Par ailleurs, je voudrais aborder trois points.
Premièrement, en ce qui concerne la répartition des compétences matérielles entre le ministre et le tribunal d'application des peines, soyons clairs: à l'exception du congé pénitentiaire et des permissions de sortie, les différentes modalités d'exécution de la peine seront désormais octroyées par le juge de l'application des peines ou par le tribunal d'application des peines en fonction de la durée de la peine, supérieure ou inférieure à trois ans.
Pourquoi avoir conservé une différenciation dans le traitement des peines de moins de trois ans et celles de plus de trois ans? Nous avons voulu continuer à participer à une solution plus souple et plus réalisable. Ainsi, les petites peines ne seront pas traitées par un tribunal composé d'un magistrat et de deux assesseurs mais par un magistrat unique. Cette solution nous permet de croire que le système sera gérable.
Mais ce qui est plus intéressant à dire ici, c'est qu'à l'avenir le pouvoir judiciaire va recevoir une nouvelle compétence. A la suite d'une demande du terrain, sur une proposition du gouvernement lui-même, on dessaisit l'exécutif d'une part de ses compétences. C'est une bonne chose qui comporte un double bénéfice: assurer une sécurité juridique aux différentes formes de libération et permettre une meilleure cohérence générale. Un des grands avantages, je le dis et je le répète, est de donner une capacité nouvelle au pouvoir judiciaire: sécurité juridique, lisibilité et cohérence.
Le deuxième point sur lequel je voulais intervenir est celui des droits des victimes.
Oui, nous avons oeuvré pour une meilleure prise en charge du droit des victimes. Même le titre a été revu sur proposition de M. Malmendier. Je ne reviendrai pas sur la définition de la victime, nous en avons étendu la notion. Il ne s'agit pas simplement des victimes qui se sont constituées partie civile.
Ces victimes, si elles le souhaitent bien évidemment, seront désormais informées de l'octroi des modalités d'exécution de la peine, comme par exemple un congé pénitentiaire. Elles seront informées des conditions qui les concernent lors de l'octroi d'une libération conditionnelle et seront, si elles en expriment le souhait, entendues par le tribunal de l'application des peines sur les remarques qu'elles ont à formuler au sujet des conditions qui les concernent directement et qui peuvent être imposées à l'auteur pour sa libération.
Lors de cette audition, elles pourront être assistées par une association d'aide aux victimes ou même représentées par leur avocat, si le fait de se présenter devant le tribunal en question constitue une épreuve trop difficile. De plus, les contre-indications qui seront examinées par les autorités judiciaires avant l'octroi d'une libération conditionnelle concerneront également aussi bien le risque que le libéré importune la victime que son attitude à l'égard de la victime de l'infraction.
Il paraît donc tout à fait légitime d'affirmer que ce projet de loi étend les droits reconnus aux victimes et qu'il constitue un véritable bond en avant.
Cela dit - le témoignage de M. Malmendier nous pousse à le dire -, il ne suffit pas et vous l'avez vous-même reconnu, monsieur le président, de voter de beaux textes. Encore faut-il qu'ils soient exécutés avec l'humanisme nécessaire, avec la prise en compte des drames humains vécus par les personnes. Je suis furieuse et scandalisée par le témoignage de M. Malmendier. Je l'ai dit et je le ferai: nous allons travailler aussi sur la base de circulaires pour aménager la manière dont les victimes seront accueillies et accompagnées vers le tribunal d'application ou le juge des peines. Sinon, ces victimes subissent en quelque sorte une double peine: d'abord, elles sont victimes de l'infraction, du délit du crime, ensuite, elles sont victimes d'un certain mépris. Cela, nous ne pouvons évidemment l'accepter. Le troisième et dernier point que je voulais aborder concerne la libération conditionnelle. On le sait bien, la libération conditionnelle est un élément essentiel de notre arsenal législatif en matière d'exécution des peines depuis 1888. Le projet dont nous débattons se fonde sur le principe qu'une libération conditionnelle peut être accordée à toute personne se trouvant dans les conditions de temps prévues par la loi, en tenant compte de contre-indications qui doivent être évaluées de manière précise et rigoureuse et prises en considération dans la décision.
Autrement dit, comme plusieurs intervenants l'ont rappelé, le projet n'organise pas le droit à la libération conditionnelle, ce serait faux de le prétendre, mais il exclut l'arbitraire. Ce sont des termes que M. Borginon a développés. On essaie d'exclure l'arbitraire mais on n'organise pas un droit à la libération conditionnelle, comme Mme Lalieux l'a également rappelé. Je ne vais pas revenir sur les peines incompressibles: je crois que M. Malmendier, avec son humanisme trempé dans une expérience douloureuse, a donné la meilleure réponse possible à ceux qui, tout au long des travaux de la commission, ont choisi la voie du poujadisme. Je n'y reviendrai pas et je reprendrai à mon compte les termes utilisés par M. Malmendier.
Je voudrais rappeler que pour la protection de la société, contre les récidives, la libération conditionnelle est un instrument fondamental. Il faut se dire qu'un jour ou l'autre, peut-être même à fond de peine, ces personnes sortiront. Dès lors, il faut préparer cette sortie. Comment les y prépare-t-on? Non pas par une réduction des peines — ce que n'est pas la libération conditionnelle, à la différence du système hollandais, comme M. Borginon a eu raison de le dire — mais avec une libération sous contrôle, sous conditions, sous contraintes; une libération qui peut être reportée en cas d'infraction aux conditions mises à la signature de l'accord pour cette libération. C'est aussi important pour la réintégration de la personne dans la société, qui a intérêt à préparer cette réintégration, que pour la société elle-même, afin de contrer la possibilité de la récidive.
C'est pourquoi il me semble important que cette notion de libération conditionnelle soit bien comprise par la population.
J'en terminerai en disant que j'espère qu'avant la fin de cette année civile, les tribunaux et les juges d'application des peines existeront. Je me permets, à cet égard, de remercier la commission Holsters qui a travaillé pendant de très nombreuses années. Il y avait la commission Dupont pour tout ce qui concerne le domaine pénitentiaire et le statut interne des détenus et il y a la commission Holsters pour ce qui concerne le statut externe et le tribunal d'application des peines.
Avec le vote de ces deux projets qui sont à l'ordre du jour, nous aurons fait un travail tout à fait essentiel pour un nouveau droit des personnes qui sont impliquées dans un procès, y compris les victimes, monsieur Malmendier: les victimes se voient enfin reconnues dans leur douleur et dans la nécessité de se reconstruire. C'est la raison pour laquelle la notion de justice restauratrice, vous l'avez dit, est également présente en filigrane de tous ces projets.

A legal framework was needed because this external status is currently under the cut of a multitude of directives, circles, green notes. However, in such a sensitive and difficult matter, this situation is contrary to legal certainty.
In addition, I would like to address three points.
First, as regards the distribution of material powers between the Minister and the Penal Court, let us be clear: with the exception of prison leave and exit permits, the different modalities of execution of the penalty will now be granted by the Penal Court or the Penal Court according to the duration of the penalty, greater or less than three years.
Why is there a difference in the treatment of sentences of less than three years and those of more than three years? We wanted to continue to participate in a more flexible and more feasible solution. Thus, small sentences will not be dealt with by a court composed of a magistrate and two counselors but by a single magistrate. This solution allows us to believe that the system will be manageable.
But what is more interesting to say here is that in the future the judiciary will receive a new competence. Following a land request, on a proposal from the government itself, the executive was denied part of its powers. This is a good thing that carries a double benefit: providing legal certainty to the different forms of release and enabling better overall coherence. One of the great advantages, I say and repeat, is to give a new capacity to the judiciary: legal certainty, legibility and consistency.
The second issue I would like to address is the rights of victims.
Yes, we have worked for a better handling of the rights of victims. The title has also been revised on the proposal of Mr. by Malmendier. I will not go back to the definition of the victim, we have expanded the notion of the victim. It’s not just the victims who have become civilian part.
These victims, if they obviously wish to do so, will now be informed of the granting of the modalities for the execution of the sentence, such as a prison leave. They shall be informed of the conditions which concern them when granting a conditional release and shall, if they express their wish, be heard by the Court of Application of the Penalties on the remarks which they have to make concerning the conditions which concern them directly and which may be imposed on the author for his release.
During this hearing, they may be assisted by a victim support association or even represented by their lawyer, if the fact of appearing before the court concerned constitutes a too difficult test. Furthermore, the contraindications that will be examined by the judicial authorities before granting a conditional release will also concern both the risk that the released person affects the victim and his attitude towards the victim of the offence.
It therefore seems quite legitimate to say that this bill extends the rights recognized to victims and that it constitutes a real leap forward.
This is the testimony of Mr. Malmendier urges us to say this – it is not enough and you have acknowledged it yourself, Mr. Speaker, to vote on beautiful texts. They must still be executed with the necessary humanism, taking into account the human dramas experienced by people. I am angry and scandalized by the testimony of mr. by Malmendier. I said it and I will do it: we will also work on the basis of circulars to arrange how victims will be welcomed and accompanied to the court of enforcement or the judge of sentences. Otherwise, these victims suffer in some way a double punishment: first, they are victims of the offence, the offence of the crime, then they are victims of some contempt. This, of course, cannot be accepted. The third and last point I wanted to address is the conditional release. As is well known, conditional release is an essential element of our legislative arsenal on execution of sentences since 1888. The project we are discussing is based on the principle that conditional release can be granted to any person who is within the time conditions provided by law, taking into account contraindications that must be evaluated accurately and rigorously and taken into account in the decision.
In other words, as several speakers have recalled, the draft does not organize the right to conditional release, it would be wrong to claim it, but it excludes the arbitrary. These are the words that Mr. Borginon has developed. We try to exclude arbitrary but we do not organize a right to conditional release, as Ms. Lalieux also recalled. I will not return to the incompressible punishments: I believe that Mr. Malmendier, with his humanism immersed in a painful experience, gave the best possible response to those who, throughout the work of the commission, chose the path of Pujadism. I would like to remind you that for the protection of society, against recurrences, conditional liberation is a fundamental instrument. That is why I think it is important that this notion of conditional release is well understood by the population.
I will conclude by saying that I hope that before the end of this calendar year, the courts and judges of punishment enforcement will exist. In this regard, I would like to thank the Holsters Commission, which has worked for many years. Monsieur le président, madame la ministre, mes chers collègues, le projet de loi soumis à votre vote présente des points très positifs pour le personnel administratif des greffes et secrétariats de parquet que je m'empresse de souligner d'emblée, tout comme la plus grande uniformité dans l'organisation de ce statut et une plus grande clarté entre les différents grades qui sont assimilés aux grades généraux de la Fonction publique, tant au niveau des conditions de nomination que des modalités de promotion, de mobilité et de délégation à des fonctions supérieures. Il est effectivement temps que l'organisation du personnel administratif des greffes et des parquets voie les mesures négociées dans le cadre du protocole signé en avril 2003 se concrétiser.
Cependant, il est à déplorer que le dialogue sur la profession de greffier et de secrétaire de parquet n'ait pu avoir lieu, tant sur la forme que sur le fond de cette question. Notre groupe avait été en effet interpellé par des représentants de ces professions, que ce soit dans le cadre de l'ASBL Ceneger que par le SLFP Ordre judiciaire ou encore spontanément par des greffiers et secrétaires acteurs de terrain. Il est apparu clairement que ces derniers avaient des doutes et des inquiétudes par rapport à la reconnaissance de leur statut professionnel, à savoir le classement dans le niveau A. Pour les greffiers, s'ajoute à cette inquiétude celle de la représentation officielle de leur fonction lors d'éventuelles négociations ou dans les négociations qui sont déjà intervenues. Mon collègue Wathelet y a fait référence tout à l'heure.
Ces préoccupations ne sont pas neuves. Mme la ministre a clairement exposé ses choix: réserve du statut A pour les greffiers/secrétaires en chef et greffiers/secrétaires chefs de service ainsi que volonté de reconnaître un statut syndical aux greffiers.
Ces questions prennent donc un aspect particulier dans le cadre du présent projet de loi. En effet, la logique sous-tendant ce choix de statut pour les greffiers se dessine, à savoir que les autres greffiers, les greffiers de terrain, doivent dès lors être désormais considérés comme du personnel de niveau B, correspondant à l'ancien niveau 2+. Or, dans le contexte du protocole 249, les négociations menées n'ont pas visé les greffiers ni le personnel de niveau A. Cette question, leur a-t-on répété, serait débattue plus tard. Dans cette optique, on peut comprendre la crainte des greffiers, mais également des secrétaires de parquet de voir ce projet actuel et les mesures prises aujourd'hui avoir des conséquences directes ou indirectes sur leur profession. Notre préoccupation en commission a donc été de nous assurer que les inquiétudes légitimes d'une profession, dont nous avons toujours estimé le rôle prépondérant dans l'exercice d'une bonne justice, trouvent écho dans le débat parlementaire; c'est encore ce souci qui nous anime aujourd'hui.
Face aux préoccupations de nos concitoyens, notre tâche d'élus n'est pas de les ignorer mais de chercher à les apaiser en leur donnant des réponses. Ces réponses, madame la ministre, nous les avons cherchées en vous interrogeant sur la portée du projet de loi qui, selon la lecture que nous en avons faite, semble avoir des implications pour les greffiers et les secrétaires de parquet, alors qu'ils étaient censés ne pas être visés par ce dernier. La démonstration de la mauvaise compréhension que nous aurions pu avoir du texte, madame la ministre, si vous aviez estimé utile d'y procéder, aurait sans aucun doute eu raison de nos doutes et nous nous serions inclinés devant la sagesse de votre raisonnement. Malheureusement, cela n'a pas été votre choix, dans des circonstances que nous déplorons vivement; aucune réponse constructive ne nous a été donnée, le débat lui-même étant étouffé dans l'oeuf.
C'est donc déçus de cette absence de débat mais conscients de l'importance de ce nouveau statut pour le personnel des greffes et secrétariats de parquet, et afin de ne pas retarder plus encore la mise en oeuvre de la modernisation attendue depuis les négociations entamées en 2002, que nous voterons ce projet.
Toutefois, notre mouvement restera très attentif à ce que le débat sur le statut des greffiers et secrétaires de parquet ait lieu et que la reconnaissance de leur fonction soit à la hauteur des tâches et responsabilités qu'ils assument. Récemment, dans votre réponse à une interrogation parlementaire, vous avez mentionné que les tâches confiées aux greffiers ne nécessitaient pas, selon vous, la détention d'un diplôme universitaire, que l'exigence d'un tel diplôme vous paraissait démesurée, de sorte que, comme seuls les détenteurs d'un diplôme universitaire peuvent être repris dans le niveau A, les greffiers se voyaient de facto classés dans le niveau B.
Cette approche nous semble être en totale contradiction avec celle précédemment défendue. En effet, nous vous rappelons que le protocole 249 — qui fonde votre projet — est le fruit d'un accord équilibré qui prévoyait expressément, en vertu d'une pondération de fonctions basée sur la méthodologie Compass, que la fonction de secrétaire était suffisamment lourde pour être classée dans le niveau A. Cette pondération est justifiée par une description de la fonction dont les tâches ont été estimées dignes de ce niveau.
Cette analyse, axée sur le contenu de la fonction qui en conditionne le classement dans les différents niveaux — et non l'inverse —, peut être reprise pour les fonctions de greffier dont les responsabilités, vous me l'accorderez, sont au moins aussi lourdes que celles des secrétaires de parquet. Les extensions régulières des compétences dévolues aux greffes qui nécessitent des connaissances et/ou une expérience universitaire ou analogue, ainsi que la recommandation du Conseil de l'Europe en matière de déchargement des tâches des magistrats vers leurs collaborateurs directs, greffiers et secrétaires et, enfin, l'exemple de nos voisins européens où le niveau universitaire ou équivalent est exigé pour les greffiers et secrétaires, plaident en faveur de ce raisonnement.
Nous vous appelons donc, madame la ministre, à mettre tout en oeuvre pour reprendre les négociations avec ces professions essentielles pour le fonctionnement correct des institutions judiciaires et à prendre en compte leur revendication d'intégration au sein du niveau A.

It is indeed time for the organisation of the administrative staff of the greens and prosecutors to see the measures negotiated in the framework of the protocol signed in April 2003 come to fruition.
However, it is regrettable that the dialogue on the profession of secretary and secretary of prosecution could not take place, both on the form and on the substance of this question. Our group had indeed been arrested by representatives of these professions, either as part of the ASBL Ceneger or by the SLFP Judicial Order or even spontaneously by field actors and secretaries. It was clear that the latter had doubts and concerns regarding the recognition of their professional status, namely the classification in level A. For the secretaries, to this concern is added that of the official representation of their office during possible negotiations or in the negotiations that have already taken place. These concerns are not new. The Minister clearly stated her choices: reservation of status A for chief secretaries/chief secretaries and chief secretaries/chief secretaries of service as well as the willingness to recognize a trade union status for chief secretaries.
These questions therefore take a particular aspect within the framework of this bill. Indeed, the logic underlying this choice of status for registered officers is drawn, namely that the other registered officers, the field registered officers, must therefore now be considered as level B personnel, corresponding to the former level 2+. However, in the context of Protocol 249, the negotiations conducted were not aimed at secretaries or level A personnel. This question, it has been repeated to them, would be discussed later. In this perspective, we can understand the fear of the secretaries, but also of the prosecutor’s secretaries, of seeing this current project and the measures taken today have direct or indirect consequences on their profession. Our committee concern has therefore been to ensure that the legitimate concerns of a profession, which we have always regarded as the preeminent role in the exercise of good justice, find echo in the parliamentary debate; it is still this concern that drives us today.
Faced with the concerns of our fellow citizens, our task as elected citizens is not to ignore them but to seek to calm them by giving them answers. These answers, Mrs. Minister, we sought them by asking you about the scope of the bill which, according to the reading we have made of it, seems to have implications for the secretaries and the secretaries of the prosecution, while they were supposed to not be targeted by the latter. The demonstration of the misunderstanding that we might have had of the text, Mrs. Minister, if you had considered it useful to proceed, would undoubtedly have been reasonable for our doubts and we would have bowed before the wisdom of your reasoning. Unfortunately, this was not your choice, under circumstances that we deeply regret; no constructive response has been given to us, the debate itself being stifled in the egg.
It is therefore disappointed by this absence of debate but aware of the importance of this new status for the staff of the transplants and prosecutor's secretaries, and in order not to delay further the implementation of the modernization expected since the negotiations started in 2002, that we will vote on this draft.
Nevertheless, our movement will remain very attentive to ensure that the debate on the status of prosecutors and prosecutors takes place and that the recognition of their function is at the level of the tasks and responsibilities they assume. Recently, in your reply to a parliamentary question, you mentioned that the tasks entrusted to the secretaries did not require, in your opinion, the possession of a university degree, that the requirement for such a degree seemed to you excessive, so that, as only holders of a university degree can be taken back into level A, the secretaries were de facto classified in level B.
This approach seems to us to be in total contradiction with the one previously defended. In fact, we remind you that Protocol 249 – which is the foundation of your project – is the result of a balanced agreement that expressly provided, under a function weight based on the Compass methodology, that the secretary’s position was heavy enough to be classified in level A. This weighting is justified by a description of the function whose tasks were deemed worthy of this level.
This analysis, focused on the content of the function which conditiones its classification in the different levels – and not vice versa – can be repeated for the functions of secretary whose responsibilities, you will grant me, are at least as heavy as those of prosecutor secretaries. The regular extension of the competences assigned to hospitals that require knowledge and/or academic or similar experience, as well as the recommendation of the Council of Europe regarding the discharge of the duties of magistrates to their direct collaborators, secretaries and secretaries and, finally, the example of our European neighbors where the academic level or equivalent is required for secretaries and secretaries, advocate for this reasoning.
We therefore call on you, Mrs. Minister, to make every effort to resume negotiations with these professions essential for the proper functioning of the judicial institutions and to take into account their claim to integrate within level A.
