Monsieur le président, madame et monsieur les ministres, chers collègues, le cdH n'apportera pas son soutien à cette proposition de loi. Au nom de mon groupe, je souhaite vous faire part très brièvement de quelques-unes de nos motivations. Nous estimons en effet qu'il importe de sauvegarder la cohésion et l'indépendance de l'armée. Un militaire se doit avant tout de se préparer à sa mission essentielle: défendre la Nation et servir le gouvernement. Permettre aux militaires d'exercer une activité politique risque de compromettre la cohésion de l'armée ainsi que son efficacité.
Quant à l'argument développé dans la proposition de loi relative à la limitation des droits politiques des militaires, nous n'en partageons pas le fondement. Il est fait référence au respect des principes constitutionnels, auxquels nous sommes très attachés, d'égalité et de non-discrimination à l'égard de la communauté militaire. Nous estimons qu'il ne s'agit pas de limitation ni de restriction des droits politiques à l'égard de la communauté militaire, qu'il ne s'agit pas non plus de méfiance à son égard mais le fait d'appartenir à l'armée est un fait objectif qui est la justification de la différence de traitement. Il n'est donc pas porté atteinte à un droit fondamental et l'actuel article 15 de la loi portant règlement de discipline des Forces armées ne viole pas la Constitution.
Je souhaite rappeler à cet égard que, dans son avis rendu le 20 mars 2006, le Conseil d'État rappelle que, dans le passé, la Cour d'arbitrage a estimé que l'interdiction générale faite aux membres du cadre actif de la gendarmerie de "manifester publiquement leurs opinions politiques et de se livrer à des activités politiques" était justifiée, et ce à la lumière de l'objectif consistant à "garantir un service de police efficace dont l'impartialité soit incontestable au bénéfice des autorités et des citoyens en vue de protéger le bon fonctionnement de la démocratie." Il en est de même pour nous, entre autres pour les militaires.
Monsieur le président, madame et monsieur les ministres, chers collègues, voilà quelques éléments qui justifieront notre vote de tout à l'heure.

A military must first of all prepare for its essential mission: to defend the nation and serve the government. As for the argument developed in the bill on the limitation of the political rights of military personnel, we do not share the basis. It refers to respect for the constitutional principles, to which we are very attached, of equality and non-discrimination with respect to the military community. We believe that this is not a limitation or restriction of political rights towards the military community, nor is it a suspicion towards it, but the fact of belonging to the military is an objective fact that is the justification of the difference in treatment. Therefore, there is no violation of a fundamental right and the current article 15 of the law regulating the discipline of the Armed Forces does not violate the Constitution.
I would like to remind in this regard that, in its opinion of 20 March 2006, the Council of State recalls that, in the past, the Court of Arbitration has considered that the general prohibition made to members of the active staff of the gendarmerie to “publicly express their political opinions and engage in political activities” was justified, in the light of the objective of “guaranteeing an effective police service whose impartiality is undeniable to the benefit of authorities and citizens in order to protect the proper functioning of democracy.”

Collega's, de militairen hebben net als alle andere burgers politieke rechten, dachten wij, maar het blijkt dat die sterk beknot zijn. Via deze wetswijziging zal er inderdaad enige ruimte worden gegeven aan de militairen, al is het niet wat wij hadden gewild.
Ik wil duidelijk zijn: ik zal het wetsvoorstel goedkeuren. Maar ik had verder willen gaan. Ik vind niet dat wij militairen minder rechten moeten geven dan gewone burgers. Waarom niet? Omdat het in alle buurlanden wel kan: in Duitsland, Nederland, Frankrijk kan men zelfs in het Parlement zetelen als militair. Ik zie dus niet in waarom wij hier in het kleine België een uitzondering moeten maken om een of andere reden.
Ik kan dus geen victorie staan kraaien, maar ik leg mij erbij neer omdat inderdaad de eerste verkiezingen de gemeenteraadsverkiezingen zullen zijn en het zeker een stap in de goede richting is.
Het wetsvoorstel heeft op zich laten wachten omdat het in de commissie nogal in de diepte werd besproken. Wij hebben er enkele serieuze fouten uitgehaald. Ik weet dat de minister ons eeuwig dankbaar zal zijn omdat wij hebben verhinderd dat het in feite onmogelijk werd gemaakt voor militairen om op te komen voor de Parti Socialiste.
Oorspronkelijk was er bepaald dat men niet zou mogen kandideren voor partijen die hun overheidssubsidie waren kwijtgeraakt. Wij vonden dat onrechtvaardig. De Parti Socialiste is al eens gestraft geweest, en wij vonden dat dit geen twee keer moest gebeuren. Wij hebben gezegd dat dit niet mocht en dat wij niet wilden dat zulks in de wet werd ingeschreven.
Gelukkig heeft de Raad van State ons daarin gelijk gegeven. Wij hebben wel geen bedankbrief gekregen, maar ik neem aan dat men toch enige sympathie voor ons zal krijgen. Dat was dus zeker een goede wijziging.
Er is dan een tweede amendement gekomen — dat blijkbaar ook op de keukentafel was geschreven want het bevatte enkele detailfouten, maar uiteindelijk hebben wij nu een aanvaardbaar compromis om, zoals ik heb gezegd, collega's, deze eerste stap te zetten. Ik hoop, collega's, - vooral u, mevrouw Vautmans — dat u het met mij eens bent dat nog maar een eerste stap is.

The bill has been delayed because it has been discussed in the committee quite in depth. We made some serious mistakes. I know that the Minister will be eternally grateful to us because we have prevented that it was in fact made impossible for soldiers to stand up for the Socialist Party.
Initially it was stipulated that party candidates who had lost their state subsidy would not be eligible. We found this unfair. The Socialist Party has already been punished, and we felt that this should not happen twice. We have said that this could not be done and that we did not want that to be written in the law.
Fortunately, the State Council has given us the right. We have not received a thank you letter, but I assume that we will receive some sympathy for us. That was definitely a good change.
Then came a second amendment — which apparently was also written on the kitchen table because it contained some detailed errors, but ultimately we now have an acceptable compromise to, as I said, colleagues, take this first step. I hope, colleagues, and especially you, Mrs. Vautmans, that you agree with me that this is only a first step.

Hoe komt het dat er na tien jaar eindelijk beweging in gekomen is? In Limburg durf ik dan zeggen: dat komt door de Limburgse koppigheid. Minister Marino Keulen heeft op Vlaams niveau de nodige wijzigingen aangebracht in het gemeentedecreet, waardoor die functies eigenlijk opengesteld werden voor de militairen. Wij wijzigen vandaag het tuchtreglement, zodanig dat de Vlaamse militairen die dat wensen, toch kunnen opkomen bij de verkiezingen, binnenkort, in oktober. Het is een hele stap voorwaarts. Collega Sevenhans zei al dat onze buurlanden het ons hebben voorgedaan, en daar functioneert het. Wij zien dus inderdaad niet in waarom ons land achter zou moeten blijven.
Bovendien evolueren wij naar een krijgsmacht met een gemengd statuut, waarbij we militairen willen aanmoedigen om een aantal jaren binnen de krijgsmacht in dienst te gaan, en nadien makkelijker door te stromen naar de privé-diensten en naar de overheidsdiensten. Eigenlijk past de opheffing van die discriminatie volledig in de gelijkstelling tussen de burgers en de militairen bij de krijgsmacht.

Collega's, wij strijden met velen om militairen gelijke rechten te geven. Er is nog een discriminatie die heel dringend moet opgeheven worden. Mijnheer de minister van Landsverdediging, het is namelijk zo dat militairen tot op heden nog steeds geen deel mogen uitmaken van een assisenjury.
Ik heb dan ook de vrijheid genomen om in het Parlement een wetsvoorstel in te dienen om ook deze discriminatie op te heffen. Dat hoort hier niet meer thuis. Een assisenjury moet een afspiegeling zijn van onze maatschappij. Vandaar vind ik dat militairen zouden moeten kunnen opgeroepen worden om te zetelen in een assisenjury. Mijnheer de minister van Landsverdediging, ik vraag u dan ook wat uw visie is over het opheffen van die discriminatie.
Collega's, ik ga het hierbij houden. Ik wil iedereen in de commissie danken vanwege het harde werk aan de wijziging aan het tuchtreglement. Wij zullen straks heel blij zijn als het eindelijk goedgekeurd is.

Monsieur le président, mesdames, messieurs les ministres, je ne peux évidemment qu'être séduit devant le sourire ravi de Mme Vautmans. Ce dossier est en effet extrêmement difficile. Il nous a pris beaucoup de temps non seulement en séances de commission mais également en divers caucus avant d'aboutir à une solution.
Deux problèmes se posaient: le problème juridique et le problème politique. Heureusement, le problème juridique a été très vite réglé par le Conseil d'État — honneur à lui — qui a opéré une distinction très nette entre les incompatibilités, d'une part, et les problèmes d'éligibilité, de l'autre. Incompatibilités dont le contenu et les limites relevaient de l'État fédéral et problèmes d'éligibilité qui, eux, ressortaient à la compétence des Communautés et des Régions.
Très rapidement, nous nous sommes interrogés à propos des limites éventuelles d'un régime d'incompatibilités. Il s'agissait alors d'un choix politique en attendant que les Régions elles-mêmes, sur la base des décisions que nous avons prises, prennent les décrets nécessaires. Ce n'est pas encore fait, ni en Wallonie, ni à Bruxelles.
Dès lors, une question se pose. Le militaire, gardien de la sauvegarde de l'État et de l'intégrité du territoire, peut-il être un homme ou une femme politique et à quel niveau?
En 1975, vous le savez, la réponse avait été négative. Aujourd'hui, les principales raisons d'être de l'armée sont restées les mêmes, à savoir le maintien de l'indépendance nationale, etc. Mais la situation a évolué en trente ans. L'armée s'est professionnalisée; elle n'est plus composée que de militaires volontaires. Dès 1978, les militaires sont autorisés à adhérer à une organisation syndicale. Ces syndicats ne sont pas tous politiquement neutres. Ces changements se sont également produits dans nombre de pays voisins. Quand on examine leur situation et qu'on fait un peu de droit comparé, on constate que la situation a avancé.
En France, sous réserve de certaines inéligibilités prévues par la loi, les militaires peuvent être candidats à toute fonction publique élective. Les militaires qui sont élus sont alors détachés. En Allemagne, ils peuvent se porter candidats; une fois élus, ils sont placés dans une position statutaire particulière. En Espagne, ils peuvent être candidats aux élections; s'ils sont élus, ils bénéficient aussi d'une position statutaire particulière qui ne les soumet plus aux droits et obligations militaires. En Angleterre, le système est quelque peu différent. Dans ce pays, ils doivent démissionner dans certaines circonstances. Tout récemment, l'assemblée parlementaire du Conseil de l'Europe a présenté un document fort fouillé où elle insistait sur les droits électoraux des membres des Forces armées: droit d'élire et droit d'être élu.
Il me paraît qu'il fallait, à l'instar de l'évolution des sociétés, évoluer en cette matière. Dans la mesure où le droit d'éligibilité est un droit général qui ne peut connaître que des limites d'ordre pénal ou professionnel, il était normal qu'on envisage d'ouvrir cette possibilité aux militaires, pour autant que les éléments d'opérationnalité de l'armée soient maintenus. Il est évident que certains problèmes se posent encore — des risques bactériologiques, chimiques, ou que sais-je encore — et qu'un certain nombre de fonctions militaires ne sont pas compatibles avec la possibilité d'être, par exemple, conseiller communal.
Je ne prendrai qu'un exemple: un marin en opération dans le Golfe, sur la frégate "Westdiep", qui reste quatre mois en mer, peut difficilement demander à repartir et à assister à un conseil communal de Nivelles pour voter le budget. De même pour les fonctions de commandement, les fonctions d'instructeur, les "special forces" ou tous les militaires qui sont opérationnels, il est impossible de faire coller les activités au conseil communal ou provincial et les activités militaires.
Le texte final est très équilibré. Tout le monde peut être candidat. Bien entendu, les congés politiques sont réservés aux députés, échevins, bourgmestres, députés permanents, et que sais-je encore. Je ne vois donc pas de risque de mettre en cause l'armée. Évidemment, je suis d'accord sur ce texte-ci et je ne prends aucun engagement pour une extension, un grignotage, une ouverture tels que, avec son sourire dévastateur, Mme Vautmans a présentés tout à l'heure. Le reste, c'est autre chose.
Ici et maintenant, une écrasante majorité du groupe, si ce n'est l'unanimité, votera ce texte. The army has become professionalized; it is no longer made up of voluntary military personnel. Since 1978, military personnel have been allowed to join a trade union. These unions are not all politically neutral. These changes have also occurred in many neighboring countries. When you look at their situation and make a little comparative right, you see that the situation has advanced.
In France, subject to certain ineligibilities provided by law, military personnel may be candidates for any elected public office. The soldiers who are elected are then dispatched. In Germany, they can stand as candidates; once elected, they are placed in a particular statutory position. In Spain, they can be candidates in elections; if they are elected, they also enjoy a special statutory position that no longer submits them to military rights and obligations. Het is ook een vraag van de vakorganisaties, nietwaar collega Vautmans? Zoals reeds gezegd hebben ook in vorige legislaturen collega's die ons voorgegaan zijn reeds wetsvoorstellen met deze vraag ingediend.
Met het wetsvoorstel dat vandaag voorligt zullen we een concrete daad stellen. We zullen deze vraag eindelijk concretiseren en dus actieve politieke rechten verlenen aan militairen, waarmee we een stap vooruit zetten. Daarmee stellen we ons ook op de lijn, collega's, van andere Europese landen die ons voor zijn geweest. De sp.afractie is tevreden met deze stap. Als men weet hoeveel tijd er overheen is gegaan voor men eensgezindheid en een ruime meerderheid kreeg om dergelijke actieve politieke rechten te verlenen aan militairen, dan kan men vandaag toch wel spreken van een grote doorbraak wat betreft de gelijkschakeling van politieke rechten van burgers en militairen.
Door de collega's is ook al aangehaald dat de bezorgdheid er altijd is geweest om de specificiteit, de eigenheid van het departement Defensie, zijn personeel en zijn militairen evenals de integriteit en vooral de operationaliteit in overeenstemming te brengen met de actieve politieke rechten. Andere Europese landen die ons voor zijn geweest om die rechten te verlenen hebben ook deze evenwichtsoefening moeten maken. Een document heeft ons daarbij goed geholpen, een studie die trouwens door het departement zelf is uitgevoerd, door het Koninklijk Hoger Instituut voor Defensie, over de syndicale en politieke rechten van de militairen van de Europese NAVO-legers en de invloed ervan op de operationaliteit. Wij denken dus dat er op dat vlak met het voorliggend wetsvoorstel een goed evenwicht is gevonden.
Het is de bedoeling om een maximum aantal militairen maximale politieke rechten te verlenen. Daarom heeft de sp.a op een bepaald moment tijdens de werkzaamheden ook de uitbreiding van de mandaten die militairen zouden kunnen opnemen ter tafel gelegd, met name ook de uitvoerende mandaten zodat ze ook schepen en burgemeester kunnen zijn.

Onderhavig wetsvoorstel biedt militairen de kans tot deelname aan het politieke leven. Het is een hele tijd anders geweest. De vroegere regelgeving bepaalde immers dat militairen wel lid mochten worden van een politieke partij, maar in een partij geen andere functie mochten uitoefenen dan deskundige, raadgever of lid van het studiecentrum. Zij mochten zeker niet kandideren voor verkiezingen.
In Vlaanderen is de consensus gegroeid voor een zo breed mogelijke deelname van burgers aan de democratie en de opheffing van zo veel mogelijk discriminaties en beperkingen van de politieke rechten. Dat kwam tot uiting bij de goedkeuring van het nieuw gemeentedecreet. Er werd dus uitdrukkelijk gekozen voor de opheffing van de onverenigbaarheid van militairen in actieve dienst.
Uiteraard zijn wij erover verheugd dat er, in vergelijking met het oorspronkelijk voorgestelde wetsvoorstel, nu toch een uitbreiding komt tot de provincieraden en de uitvoerende mandaten. Dat is een goede zaak.
Mijnheer de minister, ik heb gelezen in het verslag dat u aanvankelijk ongerust was over de mogelijke gevolgen voor het goed functioneren van uw departement. Ik kan dat begrijpen, maar ook in andere landen deed dat recht geen afbreuk aan de operationaliteit van het leger, die toch wel heel belangrijk is, zelfs in de landen in Europa waar de mandatenlijst nog uitgebreider is dan dewelke wij hebben opgevat.
In mijn wetsvoorstel heb ik ervoor gepleit om militairen zo veel mogelijk gelijke politieke rechten te geven, zoals elke andere burger, ook inzake het op zich nemen van mandaten. Misschien zijn uitbreidingen in de toekomst nog mogelijk. Ik beschouw de tekst dan ook als een heel goede tussenstap. Daarom zal de N-VA het voorstel goedkeuren.

Ik herinner mij ook dat er diezelfde dag in dezelfde kazerne nog iemand anders zich aanmeldde die nog veel minder enthousiast was dan ik. Het was Marino Keulen die toen mijn kamergenoot werd. Ik heb toen tijdens de opleiding en gedurende mijn hele legerdienst tot mijn verbazing vastgesteld dat de daar gestationeerde militairen respect hadden voor de democratie, voor de democratische instellingen en deze verdedigden, en dat zij zich daarbij zeer neutraal opstelden.
Het is vooral dat laatste punt, het zich neutraal kunnen opstellen, waarover spirit zich zorgen maakt. Wij hebben ons uiteraard afgevraagd of het feit dat we de militairen de mogelijkheid zouden bieden om zich kandidaat te stellen een verdieping van de democratie zou zijn of niet. Komt het de democratie ten goede dat meer mensen zich kandidaat kunnen stellen?
Het is u niet onbekend dat militairen die kiezen voor een militaire carrière, politiemensen en bepaalde ambtenaren op voorhand weten dat zij zich geen kandidaat mogen stellen. Dat wordt onder andere ingegeven door het feit dat zij het algemeen belang moeten dienen en niet een specifiek belang. We kunnen ons afvragen of wij hier geen ongelijkheid creëren, aangezien wij het hier hebben over militairen en niet over politiemensen of bepaalde ambtenaren. We hebben het bovendien alleen over een mogelijkheid die in Vlaanderen wordt gecreëerd en niet in Brussel of Wallonië.
Een andere overweging is het gegeven dat het van 1996 geleden is dat een eerste voorstel werd ingediend. Collega Vautmans heeft dat ook aangehaald. Wat dit betreft, hebben we lang een defensieve wetgeving gekend waarbij men ervan uitging dat iemand die niets ondernam, bereid was afstand van organen te doen. Dan begint het pas. Op het ogenblik dat mensen in aanmerking zouden komen om organen af te staan volgt nog steeds een procedure, ook ten overstaan van de familie waardoor in die omstandigheden meestal toch geen toelating tot orgaandonatie wordt gegeven.
Met dit wetsvoorstel probeert men duidelijk de regeling die ouders eventueel hebben afgesloten voor hun minderjarige kinderen over te laten aan de meerderjarige eens betrokkene die leeftijd heeft bereikt.
Ik hoop en meen dat dit ook de bedoeling van de minister is vermits hij terzake reeds een aantal initiatieven heeft ondernomen dat we van dit wetsvoorstel gebruik zullen maken om nogmaals de campagne rond orgaandonatie te versterken.
We kunnen wel allerhande maatregelen nemen, maar de minister weet beter dan wie ook dat, als men niet aan sensibilisatie doet en voortdurend de aandacht van de mensen trekt, er meestal niet veel van in huis komt.
Ik reken erop dat de tekst die wij in de commissie unaniem hebben goedgekeurd meer bekend zal raken en dat dit ook een onderdeel is van het hele plan dat de minister opzet rond een positieve benadering van orgaandonatie.

Monsieur le président, chers collègues, je ne rappellerai pas ici ô combien est important le don d'organes: mes collaborateurs m'ont préparé une petite note pour souligner son intérêt, mais comme l'indiquait M. Chevalier, cette Chambre est unanime pour reconnaître l'utilité de concentrer tous nos efforts à faire du don d'organes un élément de plus en plus développé de la vie en société.
À cette tribune, je ne tiens pas à vous assommer avec une masse de chiffres que personne n'entendrait, mais je vous citerai cependant quelques repères fondamentaux. J'attire votre attention sur le fait que, le 31 décembre 2005, dans notre pays, 966 personnes étaient en attente d'un rein, 249 d'un foie, 32 d'un coeur, 60 d'un poumon et 34 d'un pancréas. Par rapport à l'année 2004, l'augmentation de demandes de rein, de foie et de poumon est indéniable. Je me permets aussi d'insister auprès de vous sur le fait qu'en 2005, 103 personnes inscrites sur des listes d'attente sont malheureusement décédées faute d'organes disponibles. Ces chiffres doivent nous faire réfléchir.
Si le nombre de personnes acceptant de se déclarer donneurs d'organes est en recrudescence, force est de constater qu'apparaît aussi une augmentation du nombre de refus. C'est l'envers de la médaille des campagnes: en attirant l'attention du public sur le don d'organes, une majorité de personnes répond positivement, mais une partie répond alors par la négative.
Nous devons donc tout mettre en oeuvre pour favoriser le don d'organes et diminuer le nombre de refus potentiels de donation.
Voilà un an, à l'initiative de mon chef de groupe, Daniel Bacquelaine, avec l'aide du président de la Chambre et de tous les groupes parlementaires et en collaboration avec l'ensemble des services de la Chambre, nous avons pu organiser un colloque sur le don d'organes. L'objectif était de trouver, par la voie législative ou via l'utilisation de la nouvelle carte d'identité électronique, une solution afin d'encourager le don d'organes dans notre pays. Des représentants de tous les secteurs intéressés par le don d'organes sont venus témoigner.
Il faut bien reconnaître que notre proposition visant à inciter chaque citoyen lorsqu'il va retirer sa carte d'identité électronique à la maison communale à faire une déclaration aux termes de laquelle il accepte ou refuse d'être donneur d'organes n'a pas recueilli le succès escompté. Nous proposions en effet d'inscrire les données relatives aux dons d'organes et au groupe sanguin sur la carte d'identité électronique. Cette démarche permettrait aux familles de ne pas devoir prendre une décision quant au don d'organes de leurs proches et, dès lors, de diminuer le taux de refus familiaux.
Les participants au colloque ont soulevé différents problèmes pratiques relatifs à la mise en oeuvre de cette mesure. Nous l'avons mise temporairement de côté.
En revanche, messieurs les ministres — je m'adresse en particulier à M. le ministre de la Santé publique et, si le ministre de l'Intérieur était présent, je m'adresserais à lui également —, nous pensons qu'il faut malgré tout poursuivre la réflexion sur tout ce qu'il y aurait lieu d'entreprendre, dans le respect de toute une série d'autres législations, notamment celle relative à la protection de la vie privée. Il y a sans doute moyen d'entreprendre de nombreuses initiatives visant à utiliser encore mieux le concept de la nouvelle carte d'identité électronique notamment en matière de santé publique pour valoriser et favoriser le don d'organes.
Au-delà de cette mesure, peut-être trop ambitieuse, que nous avions imaginée, les participants à notre colloque ont souligné qu'un certain nombre de mesures différentes pouvaient être prises parfois beaucoup plus simplement pour inciter les gens à faire un don d'organes.
Plus précisément, nous avons été informés que, selon les estimations, près de 55.000 enfants ont été inscrits au registre national en qualité de non-donneurs par leurs parents entre 1986 et 1998, soit au moment de l'adoption de la loi sur les prélèvements d'organes. Le problème soulevé, nous avons décidé, avec des collègues de différents groupes politiques, de déposer la présente proposition de loi en vue de rectifier le tir et, si vous me passez l'expression, de "récupérer" ces donneurs potentiels.
La loi du 23 juin 1986 sur le prélèvement et la transplantation d'organes prévoit que des organes, tissus et cellules destinés à la transplantation peuvent être prélevés sur le corps de toute personne inscrite au registre de la population ou, depuis plus de six mois, au registre des étrangers. Il est laissé à toute personne la possibilité de s'opposer au prélèvement. Cette loi se base donc sur le principe du consentement présumé en vertu duquel on est considéré comme donneur, hormis si l'on exprime son refus.
L'opposition au prélèvement peut se manifester, selon les cas, par la personne concernée ou par les proches - toujours par le biais de l'inscription au registre national. Le médecin ne peut opérer de prélèvement lorsqu'une opposition s'est exprimée ou lorsqu'un proche lui a communiqué son refus. Seul ce dernier peut se prévaloir de la volonté expresse du donneur qu'il aurait lui-même recueillie.
Concernant les mineurs - et c'est sur ce point que nous sommes intervenus -, leurs parents peuvent agir en leur nom et exprimer leur opposition. Beaucoup de parents ont donc agi dans le souci de protéger leurs enfants en les inscrivant au registre national en qualité de non-donneurs. Or, aujourd'hui, nous souffrons d'un manque de donneurs.
L'objectif de notre proposition est de "récupérer" ces donneurs potentiels. Nous proposons donc l'annulation automatique de l'opposition au prélèvement lorsque les enfants arrivent à l'âge de 18 ans. Ces personnes seraient informées de cette annulation et pourraient, si elles le désirent, se réinscrire aisément. Le Roi organiserait cette information ainsi qu'une période transitoire afin de permettre aux personnes concernées d'effectuer leur propre choix.
En outre, nous avons décidé d'annuler non seulement l'opposition au don d'organes mais également le consentement. À la majorité, cette remise à zéro permettra au jeune adulte d'exercer son libre choix.
Lors du vote en commission de la Santé publique, notre proposition a recueilli le soutien de tous les partis démocratiques. Nous nous réjouissons de constater qu'il n'y a pas de clivage politique sur un tel sujet de société.
Outre la mesure envisagée par notre proposition de loi, il convient de favoriser et de développer la déclaration au préalable. En effet, toute personne capable de manifester sa volonté peut actuellement s'adresser à l'administration communale de son domicile afin de déclarer son consentement à tout prélèvement d'organes ou de tissus après son décès. Il est essentiel de continuer à informer les citoyens sur le don d'organes en général et sur la possibilité de cette démarche.
Des initiatives allant dans ce sens ont déjà été organisées dans le passé, comme, par exemple, "Bourgmestres en choeur". Nous sommes heureux du renouvellement de cette initiative aux prochaines élections communales. Dans cette optique, le 28 juin 2005, le ministre Demotte, en collaboration avec le SPF Santé publique, a lancé sa campagne relative au don d'organes, Beldonor. Depuis le début de cette campagne, le nombre de Belges qui ont enregistré leur accord au don d'organes est passé de 33.850 à 45.288, soit une augmentation de près de 11.438 personnes. Par contre, 2.003 nouvelles oppositions ont été enregistrées. Actuellement, on comptabilise 192.581 oppositions au registre national. Selon les derniers chiffres, ils seraient 50.000 à avoir marqué leur accord au don d'organes.
Nous voulons aujourd'hui toutes et tous nous réjouir des initiatives qui ont été prises et c'est en toute modestie mais aussi avec bonheur que nous apportons notre toute petite pierre à cet édifice combien utile à la société et en particulier aux nombreuses personnes en attente d'un don d'organe.

We must therefore make every effort to promote organ donation and reduce the number of potential refusals of organ donation.
A year ago, on the initiative of my group leader, Daniel Bacquelaine, with the help of the chairman of the House and all the parliamentary groups and in collaboration with all the departments of the House, we were able to organize a colloquium on organ donation. The aim was to find, by legislative means or through the use of the new electronic identity card, a solution to encourage organ donation in our country. Representatives from all sectors interested in organ donation came to testify.
It must be acknowledged that our proposal aimed at encouraging every citizen when he is going to take his electronic identity card in the municipal house to make a statement under the terms of which he accepts or refuses to be an organ donor has not obtained the desired success. We proposed that the data on organ donation and blood group be entered on the electronic identity card. This would allow families not to have to make a decision about donating organs to their loved ones and, therefore, reduce the rate of family rejection.
Participants at the conference raised various practical problems related to the implementation of this measure. We temporarily put it aside.
In particular, I would like to address Mr. The Minister of Public Health and, if the Minister of Internal Affairs was present, I would also address him — we believe that we must nevertheless continue to reflect on all that should be undertaken, in compliance with a whole series of other legislations, including that relating to the protection of privacy. There are ⁇ ways to undertake numerous initiatives aimed at using the concept of the new electronic identity card even better, especially in the field of public health, to enhance and promote organ donation.
Beyond this, ⁇ too ambitious, measure we had imagined, the participants at our conference highlighted that a number of different measures could sometimes be taken much more simply to encourage people to donate organs.
More specifically, we were informed that, according to estimates, ⁇ 55,000 children were registered in the National Register as non-donor by their parents between 1986 and 1998, at the time of the adoption of the Law on Organ Proliferation. The problem raised, we decided, together with colleagues from different political groups, to file this bill in order to correct the shot and, if you pass the expression, to "recover" these potential donors.
The Act of 23 June 1986 on the collection and transplantation of organs provides that organs, tissues and cells intended for transplantation may be taken from the body of any person registered in the population register or, for more than six months, in the register of foreigners. Everyone is given the opportunity to oppose the collection. This law is therefore based on the principle of presumed consent under which one is considered as a donor, unless its refusal is expressed.
Opposition to the collection may be expressed, depending on the case, by the person concerned or by relatives – always through the registration in the national register. The doctor may not carry out a collection when an opposition has been expressed or when a relative has communicated to him his refusal. Only the latter can rely on the express will of the donor that he himself would have collected.
Regarding minors – and this is the point we have intervened – their parents can act on their behalf and express their opposition. Many parents have therefore acted in the interest of protecting their children by registering them in the national register as non-donors. Today we are suffering from a shortage of donors.
The aim of our proposal is to “recover” these potential donors. We therefore propose the automatic cancellation of the opposition to the collection when the children reach the age of 18. Those persons would be informed of this cancellation and could, if they wish, easily re-register. The King would arrange this information as well as a transitional period in order to allow the persons concerned to make their own choices.
In addition, we have decided to cancel not only the opposition to organ donation but also the consent. In the majority, this reduction to zero will allow the young adult to exercise his free choice.
During the vote in the Public Health Committee, our proposal received the support of all democratic parties. We are delighted to see that there is no political division on such a topic of society.
In addition to the measure envisaged in our bill, it is necessary to promote and develop the declaration in advance. Any person capable of expressing his will can now address the municipal administration of his domicile to declare his consent to any organ or tissue removal after his death. It is essential to continue to inform citizens about organ donation in general and the possibility of this approach.
Initiatives in this direction have already been organized in the past, such as, for example, "Bourgeois in Choir". We are pleased that this initiative will be renewed in the next municipal elections. In this context, on 28 June 2005, Minister Demotte, in collaboration with SPF Public Health, launched his campaign on organ donation, Beldonor. Monsieur le président, ce projet était revenu en commission pour une question bien précise, qui concernait son champ d'application exact: à savoir, dans quelles circonstances un marché doit-il être soumis aux règles de marché public et dans quel cas s'agit-il d'un marché privé ne devant pas se conformer à ce projet de loi?
Je vais limiter mon intervention essentiellement à la discussion que nous avons eue au sujet de l'amendement que j'avais déposé. Mais je tiens d'abord à rappeler, pour éviter tout quiproquo, que ce projet me paraît très positif. En effet, il clarifie les règles de marché public et y instaure un maximum de transparence. De plus, il uniformise ces règles sur le plan européen.
Le tout est de savoir si cette directive transposée en projet a pour effet de soumettre des institutions de droit privé à la réglementation sur les marchés publics. Nous avons discuté en commission de l'interprétation qu'il convenait de donner à une jurisprudence de la Cour de justice, définissant les organismes de droit public tombant dans le champ d'application de la future législation. Si l'on suit le raisonnement du gouvernement, c'est l'ensemble du patrimoine privé de ces personnes de droit privé qui se trouve - sans raison valable, me semble-t-il - "contaminé" par la législation sur les marchés publics et donc soumis à un régime juridique totalement étranger à la propriété privée.
On parle bien de marchés qui sont passés sur la base du patrimoine privé, donc de biens privés détenus par une entreprise privée. Même si certaines sociétés étant subventionnées tombent sous le coup de cette loi, elles disposent d'un capital privé et opèrent des investissements d'ordre privé. Par conséquent, cette propriété privée serait assimilée aux deniers publics. Cela me paraît contraire aux objectifs de la directive, qui consistent - je le rappelle - à faire en sorte que la réglementation sur les marchés publics ne puisse être contournée par le biais de l'allocation de subventions à des personnes privées. En effet, s'il suffisait de subventionner une entreprise ou une entité pour que celleci sorte du champ de l'application de la directive et du projet, cela n'aurait plus de sens.
Donc, lorsqu'une quelconque institution, telle une université, conclut des contrats dans des domaines pour lesquels elle est subventionnée, elle tombe évidemment dans le champ d'application de la directive et du projet.
A notre sens, il est impossible de soutenir que la présence d'un financement public majoritaire changerait quoi que ce soit dans la gestion du patrimoine privé d'une personne privée. Un bien privé est et demeure tel, qu'il y ait ou non octroi d'une subvention publique. C'est bien autour de ce marché privé que se noue le contrat. Dès lors il ne doit pas être soumis à ce projet.
En effet, les conséquences d'une telle pratique et d'une telle interprétation ne sont pas minces. On a cité quelques exemples en commission et je vais le refaire ici. Que fait-on des dons et des legs par des personnes privées au bénéfice d'institutions privées? Les bibliothèques privées bénéficiant de subventions publiques représentant plus de 50% de leur budget seront soumises à la législation sur les marchés publics pour toutes leurs activités, même celles réalisées exclusivement grâce à leur patrimoine propre. Les universités de droit privé seront astreintes au même régime, tout comme les hôpitaux universitaires et autres établissements hospitaliers bénéficiant d'un financement public majoritaire. Idem pour toutes les associations sans but lucratif créées par ces institutions au moyen de leur patrimoine privé.
Or, selon moi, il n'existe aucune raison valable de soumettre les activités générées par le patrimoine privé d'une personne privée à un régime juridique qui relève du droit administratif. C'est la raison pour laquelle nous avons déposé des amendements afin de revenir à l'esprit de la loi du 24 décembre 1993, grâce à laquelle on évitait que les pouvoirs publics puisent se soustraire à la réglementation en matière de marché public.
Face à la difficulté de percevoir toutes les nuances des arrêts Cambridge et Mannesmann évoquées par le gouvernement lors des discussions préalables, nous avions sollicité l'avis du Conseil d'État qui était censé examiner l'admissibilité du statut particulier donné aux universités libres dans le cadre de la passation de marchés privés. En fait d'analyse, les observations formulées par le Conseil d'État se résument à ces quelques considérations: "soit les amendements proposés (dont celui que j'avais initialement introduit) n'entendent pas déroger aux conditions légales permettant d'identifier parmi les personnes morales de droit privé celles qui sont soumises à l'intégralité de la législation sur les marchés publics, soit les amendements entendent réserver un sort particulier aux universités de droit privé en les faisant échapper à ces conditions". Dans le premier cas, le Conseil d'État ne voit pas l'utilité des amendements et dans le second cas, il estime que le texte proposé n'est pas compatible avec les arrêts invoqués par le gouvernement en commission. À l'évidence, l'objectif de ces amendements est de réserver un statut pour les universités privées. La conclusion de l'avis du Conseil d'État repose donc sur un constat d'incompatibilité avec les directives communautaires. Quels sont les fondements de cette conclusion? Le Conseil d'État se borne à avancer les conclusions tirées par la Cour de justice dans l'arrêt concernant l'Université de Cambridge. L'avis souligne que dans cet arrêt, la Cour a explicité la portée du critère relatif au financement majoritaire de l'institution en précisant qu'il devait être apprécié sur une base annuelle. Le Conseil d'État considère que les conclusions nuancées par cet arrêt ne se retrouvent pas dans le texte de l'amendement lorsqu'il limite l'application de la législation sur les marchés publics aux seuls marchés subsidiés par des pouvoirs publics
Toutefois, la portée de l'arrêt Cambridge ne permet pas, selon moi, de considérer que l'existence d'un financement majoritaire des universités aurait pour conséquence de rendre la réglementation des marchés applicable aux opérations financées par les universités sur fonds privés. D'où la nuance que j'ai tenté d'apporter en commission: plutôt que de savoir qui — c'est ce que délimite l'arrêt Cambridge —, il vaudrait mieux savoir sur quoi, avec quels fonds? Est-ce via des fonds purement privés? Est-ce via des fonds pour lesquels l'institution reçoit un minimum de subsides? Et pour cause, puisque la question n'avait pas été soumise à la Cour de justice qui était, quant à elle, uniquement saisie du cas Cambridge à proprement parler, à savoir quelles sont les entreprises qui sont soumises, quelle est la définition qu'il faut retenir?
Or, aucune des quatre questions préjudicielles posées à la Cour par la juridiction de renvoi ne concernait l'application de la législation sur les marchés publics aux activités privées d'une université financée majoritairement par les pouvoirs publics. Donc, aucune activité en tant que telle n'était privée. Je reviens à ce que j'ai dit: il ne s'agit pas de savoir qui mais sur quoi?
Sans doute pourrait-on, au vu de l'avis donné par le Conseil d'État, modifier le libellé de l'amendement en précisant que: "Ne sont pas soumis à la législation sur les marchés publics, les marchés des universités privées ne comprenant aucun financement public". Un amendement alternatif, répondant mieux à l'avis du Conseil d'État, aurait pu être déposé.
Cette modification va, certes, un peu plus loin que le texte actuel, qui ne soumet les universités privées à la réglementation des commandes publiques que pour leurs marchés subventionnés par les pouvoirs publics. La formulation serait tout simplement inversée.
Elle repose sur une logique qui peut être défendue, à savoir que si des personnes de droit privé peuvent, moyennant la satisfaction de diverses conditions, être considérées comme des pouvoirs adjudicateurs à part entière et non uniquement des opérateurs isolés, ce statut de "pouvoir adjudicateur" ne tient que dans les limites tracées par le législateur. Or, ces limites figurent dans les conditions précitées, à savoir qu'il faut que la personne de droit privé ait été créée en vue d'assurer des missions d'intérêt général, autres qu'industrielles et commerciales, et qu'elle soit contrôlée majoritairement par des pouvoirs adjudicateurs, que ce soit par le biais de ses organes ou de son financement.
Selon nous, il pourrait être soutenu qu'en dehors de ce contrôle ou de ce financement majoritaire, la personne de droit privé reste telle et n'est donc pas soumise à la réglementation sur les marchés publics. En effet, c'est bien dans le cadre de cette problématique qu'elle sort du champ d'application du projet en tant que tel.
Trois cas de figure pourraient ainsi être rencontrés: 1. la personne de droit privé qui ne répond pas aux conditions de la loi et n'est nullement soumise à la réglementation sur les marchés publics; 2. la personne de droit privé qui ne répond pas aux conditions de la loi, mais qui est soumise à la réglementation des marchés publics pour des marchés bien précis bénéficiant d'un financement public majoritaire — c'est l'essence même de l'arrêt Cambridge —; 3. la personne de droit privé qui répond aux conditions de la loi et qui sera soumise pour toutes ses opérations à la réglementation des marchés publics, à l'exception de celles qui ne s'inscrivent pas dans le cadre tracé par les conditions légales. Elles lui permettront donc de rendre applicable cette réglementation aux activités de la personne morale, de droit purement privé, soit parce qu'en dépit des missions d'intérêt général pour lesquelles l'institution a été créée, celle-ci accomplit d'autres missions; soit parce que les opérations ne s'inscrivent pas dans les limites du contrôle ou du financement majoritaire.
Comme vous le voyez, chers collègues, le débat est loin d'être clos, malgré les réserves émises par le Conseil d'État, étant donné qu'il s'est prononcé sur l'amendement en tant que tel. Selon moi, il n'allait peut-être pas suffisamment loin ou ne reprenait pas l'ensemble des discussions que nous avions eues en commission. Cela ne lui a pas permis d'aller au fond de la réflexion pour se poser, outre la question de l'interprétation de l'arrêt Cambridge, la question fondamentale suivante: sur quoi porte également ce projet?
Dans l'intérêt de l'ensemble de ces institutions, universitaires ou autres, qui se verront contraintes d'appliquer sans nuance la législation en matière de marchés publics, il me semble donc utile que le Sénat fasse usage de son droit d'évocation afin de permettre la poursuite du débat entamé et de trancher les quelques éléments de réflexion que je souhaitais rappeler à cette tribune.
J'ajoute cependant que, globalement, ce projet est tout à fait positif, en ce sens qu'il insère encore plus de transparence et qu'il uniformise les mécanismes de marchés publics au niveau européen.

If one follows the reasoning of the government, it is the entire private property of these individuals of private law that is - without a valid reason, it seems to me - "contaminated" by the legislation on public procurement and therefore subject to a legal regime totally alien to private property.
There is a lot of talk about markets that have been passed on the basis of private property, therefore private property held by a private company. Although some companies are subsidised and fall under this law, they have private capital and do private investments. Therefore, this private property would be assimilated to public money. This seems to me to be contrary to the objectives of the Directive, which, I recall, consists in ensuring that the regulation on public procurement cannot be circumvented by granting subsidies to private persons. In our view, it is impossible to argue that the presence of a majority public financing would change anything in the management of a private person’s private property. A private property is and remains such, whether or not public subsidy is granted. It is around this private market that the contract is concluded. Therefore, it should not be subject to this project. by
Indeed, the consequences of such practice and such interpretation are not small. A few examples have been cited in the commission and I will repeat it here. What is done about donations and legacy from private individuals for the benefit of private institutions? Private libraries receiving public grants representing more than 50% of their budget will be subject to public procurement legislation for all their activities, even those carried out exclusively through their own assets. Private law universities will be bound by the same regime, as will university hospitals and other hospital institutions receiving majority public funding. This applies to all non-profit associations created by these institutions through their private assets.
However, in my view, there is no valid reason to subject the activities generated by the private property of a private person to a legal regime which falls within the scope of administrative law. That is why we submitted amendments to return to the spirit of the Act of 24 December 1993, which prevented public authorities from escaping public procurement regulations.
Faced with the difficulty of perceiving all the nuances of the Cambridge and Mannesmann judgments mentioned by the government in the preliminary discussions, we had sought the opinion of the State Council, which was supposed to examine the admissibility of the special status granted to free universities in the context of private procurement. "Either the proposed amendments (including the one I had initially introduced) do not intend to deviate from the legal conditions allowing to identify among the legal persons of private law those who are subject to the whole legislation on public procurement, or the amendments intend to reserve a particular fate to the universities of private law by making them escape from these conditions." In the first case, the State Council does not see the usefulness of the amendments and in the second case, it considers that the proposed text is not compatible with the rulings invoked by the government in commission. Obviously, the aim of these amendments is to reserve a status for private universities. The conclusion of the State Council opinion is therefore based on a finding of incompatibility with Community directives. What are the foundations of this conclusion? The State Council is limited to advancing the conclusions drawn by the Court of Justice in the judgment concerning the University of Cambridge. The opinion highlights that in that judgment, the Court explicitly specified the scope of the criterion relating to the majority financing of the institution by specifying that it should be assessed on an annual basis. The State Council considers that the conclusions nuanced by this judgment do not appear in the text of the amendment when it limits the application of the legislation on public procurement to only contracts subsidized by public authorities.
However, the scope of the Cambridge judgment does not, in my view, allow to consider that the existence of a majority funding of universities would result in making market regulation applicable to operations financed by universities from private funds. Hence the nuance that I tried to bring in commission: rather than knowing who — this is what delimites the Cambridge judgment — would it be better to know what, with what funds? Is it through purely private funds? Is it through funds for which the institution receives a minimum of subsidies? And for a reason, since the question had not been submitted to the Court of Justice, which, in its turn, was only referred to the case of Cambridge properly speaking, namely which are the undertakings that are submitted, what is the definition to be taken? by
None of the four questions submitted to the Court by the referring court concerned the application of public procurement legislation to the private activities of a university financed mostly by public authorities. Therefore, no activity as such was private. I go back to what I said: it’s not about knowing who but on what? by
Without a doubt, in view of the opinion given by the State Council, the wording of the amendment could be modified by specifying that: "The public procurement legislation is not subject to public procurement, the private university procurement does not include any public financing." An alternative amendment, better responding to the opinion of the State Council, could have been submitted.
This amendment goes, of course, a little further than the current text, which submits private universities to the regulation of public procurement only for their procurement subsidized by public authorities. The wording would simply be reversed.
It is based on a logic that can be defended, namely that while private law persons can, subject to various conditions, be regarded as full-fledged contracting authorities and not only isolated operators, this status of “contracting authority” remains only within the limits drawn by the legislator. However, these limits are included in the above conditions, namely that the private law person must have been created in order to carry out tasks of general interest, other than industrial and commercial, and that it must be controlled mostly by the contracting authorities, either through its bodies or through its financing.
In our view, it could be argued that outside of this control or majority financing, the private entity remains such and is therefore not subject to the regulation on public procurement. Indeed, it is within this problem that it goes out of the scope of the project as such.
Three cases of figure could thus be met: 1. the private law person who does not meet the conditions of the law and is in no way subject to the regulation on public procurement; 2. the private-law person who does not meet the requirements of the law, but who is subject to the regulation of public procurement for very specific contracts receiving majority public financing — this is the very essence of the Cambridge judgment —; 3. the person of private law who fulfils the conditions of the law and who will be subject for all its operations to the regulation of public procurement, with the exception of those which do not fall within the framework drawn by the legal conditions. They will therefore allow it to make this regulation applicable to the activities of the legal person, of purely private law, either because despite the tasks of general interest for which the institution was established, it performs other tasks; or because the operations do not fall within the limits of majority control or financing.
As you can see, dear colleagues, the debate is far from closed, despite the reservations made by the State Council, given that it has taken a stand on the amendment as such. In my opinion, he may not have gone far enough or did not resume all the discussions we had in the committee. This did not allow him to go to the bottom of the reflection to ask himself, in addition to the question of the interpretation of the Cambridge judgment, the following fundamental question: What is this project also about?
In the interest of all these institutions, academic or other, which will be compelled to apply without nuance the legislation on public procurement, it therefore seems to me useful that the Senate make use of its right of evocation in order to allow the continuation of the debate initiated and to resolve the few elements of reflection that I wanted to remind this tribune.
However, I add that, overall, this project is quite positive, in the sense that it inserts even more transparency and uniformizes public procurement mechanisms at European level.

De goedkeuring van het voorliggend ontwerp zal een bijzonder zwarte dag zijn voor een aantal instanties, die nu zullen moeten meemaken dat de wetgeving op de aanbesteding van de overheidsopdrachten ook van toepassing wordt op bijvoorbeeld de VZW's en de privaatrechterlijk georganiseerde ziekenhuizen.
Ik begrijp dat het Europees element vaak als een argument wordt gebruikt. Ik vind dat de staatssecretaris zich daarop zeer snel fixeert. Ik ben zeer benieuwd om te weten of dat in alle landen op dezelfde manier gebeurt.
Voor iemand die staat voor de administratieve vereenvoudiging, is dat ten opzichte van die sector een bijzonder droevig moment, namelijk de idee dat iedereen nu die procedures zal moeten toepassen, ook degenen die dat in het verleden alleen hebben gedaan in geval van gesubsidieerde werken.
Ik heb onlangs over dezelfde wetgeving aan de eerste minister — hij heeft die dienst blijkbaar onder zijn bevoegdheid — de vraag gesteld: "Moeten de openbare ziekenhuizen, als zij een nieuwe arts willen aanwerven, dat nu ook doen via de wet op de aanbesteding van de overheidsopdrachten?" Er is nog een tijd geweest dat wij vanuit de oppositie, overigens in grote eenstemmigheid met de heer Mayeur van de PS, een regeling konden goedkeuren die openbare ziekenhuizen vrijstelde van dergelijke verplichting, tenzij in de mate dat Europa of de subsidiewetgeving dat zou verplichten. Dat wordt allemaal van de kaart geveegd, onder het adagium "Europa zegt het".
Ik had gehoopt op een veel kritischer lezing die de attitude had getoond dat we die wetgeving zo weinig mogelijk van toepassing zouden maken, maar ik heb alleen maar alle mogelijke methoden gelezen om daaromtrent onduidelijk te blijven.
Voor de private ziekenhuizen is het mij, eerlijk gezegd, mijnheer de staatssecretaris, nog altijd niet duidelijk. Ik hoop dat wij niet in de situatie terechtkomen waarbij wij voor elk dossier apart moeten nagaan of de wetgeving al dan niet van toepassing is. Zo wordt de efficiëntie niet gestimuleerd, niet bevorderd.
Ik ben zeer teleurgesteld — ik heb van mijn collega's gehoord dat er toch vragen over gesteld zijn — dat de antwoorden van dien aard zijn dat de sector, nadat de Kamer dat goedgekeurd zal hebben, de administratieve lasten enorm zal zien stijgen.

There has still been a time when we from the opposition, in other words in great unanimousness with Mr. Mayeur of the PS, could approve a regulation exempting public hospitals from such obligation, except to the extent that Europe or the subsidy legislation would require it. All that is wiped out of the card, under the adage "Europe says it".
I had hoped for a much more critical reading that had shown the attitude that we would apply that legislation as little as possible, but I only read all possible methods to remain vague about it.
For private hospitals, honestly, Mr. Secretary of State, it is still not clear to me. I hope that we do not find ourselves in a situation where we have to check for each case separately whether the legislation applies or not. Efficiency is not encouraged, not promoted.
I am very disappointed — I have heard from my colleagues that there have been questions about it — that the answers are of such nature that the sector, after the Chamber has approved it, will see the administrative burden increase enormously.

Mijnheer de voorzitter, vorige week is dit inderdaad terugverwezen naar de commissie voor de Financiën. Dat is beslist op 27 april in de plenaire vergadering van de Kamer van volksvertegenwoordigers. Tijdens de bespreking heeft op vraag van mevrouw Annemie Roppe de heer Didier Reynders, viceeerste minister en minister van Financiën, gezegd dat de door de regering ingediende amendementen — want er waren in totaal 7 nieuwe amendementen toegevoegd nadat het naar de plenaire vergadering was verstuurd — die voortsproten uit het overleg met de financiële sector preciseringen wilden aanbrengen inzake de vraag of, wanneer een institutionele of een privé-ICB toegelaten is of wordt tot een gereglementeerde of georganiseerde publieke markt, zulks automatisch tot gevolg heeft dat die ICB niet langer institutioneel of privé zou kunnen zijn.
Het antwoord op die vraag was negatief. Daar het institutionele of privé-karakter van een ICB wordt bepaald door het institutionele of privé-karakter van de beleggers erin, kan het feit dat het ICB op een markt genoteerd is daar geen verandering in brengen.
Uiteindelijk werden de verschillende amendementen telkenmale met 10 stemmen ja en 3 onthoudingen aanvaard.

Het is van cruciaal belang dat het oorlogsverleden goed bewaard blijft en dat we jongeren bewust maken van dit verleden. Steeds meer is dit zo en niet alleen op federaal vlak; ook de minister-president van Vlaanderen is daar voorstander van. Hij pleit ervoor om jongeren de concentratiekampen van Dachau en Krakau te laten bezoeken. Dat is een goed initiatief, maar ik denk dat we niet zo ver moeten gaan. Het bezoeken van een concentratiekamp is een uitzonderlijke ervaring. Zien welke gruwelen er zich daar voordeden brengt iets teweeg. Ik had de eer om samen met minister Flahaut een concentratiekamp te bezoeken en ik weet hoe klein men zich voelt mij de terugkeer. Ook in ons land zijn er heel veel monumenten en musea waar de herinnering aan beide wereldoorlogen levendig wordt gehouden. Vele van de organisaties die instaan voor het behoud van dit patrimonium, organiseren acties. Momenteel bestaat er helaas echter weinig coördinatie tussen die verschillende organisaties. Met de goedkeuring van dit wetsvoorstel over de Historische Pool van Defensie kan daarin verandering komen. Dit kan de bevolking en vooral de jongeren informeren over ons oorlogsverleden en bewust maken van de schat aan informatie die op de verschillende locaties te ontdekken valt. Natuurlijk zal de adviesraad ook instaan voor het onderhoud of herstel van het patrimonium. De oprichting van dit orgaan met een vaste structuur, een team en financiële middelen, is hiervoor nodig. De VLD zal dan ook dit wetsvoorstel van harte steunen, want het is een uitstekend initiatief.

Premièrement, de manière générale, elle donne au devoir de mémoire un outil qui lui permet de se développer davantage. On ne soulignera jamais assez l'importance du devoir de mémoire, du devoir de ne jamais oublier certains épisodes douloureux du passé.
Deuxièmement, cette proposition de loi a le mérite d'offrir une réponse aux nombreuses initiatives citoyennes qui ont parfois du mal à se concrétiser. De nombreuses personnes seules ou regroupées dans le cadre d'associations souhaitent mettre sur pied des projets dont le but est de témoigner de l'histoire de la résistance ou de la déportation, de faire comprendre aux jeunes et aux moins jeunes le pourquoi des évènements et de les faire prendre conscience du sacrifice de nos aînés et des souffrances vécues.
Il est important que ces initiatives citoyennes soient encouragées et soutenues. En effet, comme l'expression l'indique, le devoir de mémoire est un devoir, et il nous incombe à tous.
C'est notamment pour les raisons que je viens d'évoquer que j'appelle l'ensemble de mes collègues à voter en faveur de cette proposition de loi.

Cela étant, comme tous les collègues qui m'ont précédé, je tiens à vous dire qu'il est réconfortant de constater qu'à l'époque où beaucoup crient à la perte de valeurs et de repères, les commémorations des grands événements historiques intéressent aussi les jeunes.
Comme d'autres, je m'en suis rendu compte lors de la visite des camps, pour le 60 e anniversaire de la libération de ces sinistres lieux: la Défense a organisé de nombreux déplacements de jeunes. J'ai été heureusement surpris à cette occasion de l'attitude grave et digne de ces jeunes gens et jeunes filles de la génération "Hitler, connais pas!" mais qui, dans les plaines glacées d'Auschwitz, ressentaient presque physiquement l'horreur d'un système concentrationnaire.
Il n'est donc pas inutile de rappeler aux générations actuelles et futures l'histoire du passé et de l'illustrer par la sauvegarde et l'aménagement des lieux, des bâtiments, des vestiges d'événements liés à la Défense.
Certains, même en commission, ont certes dit que cela ne servait à rien. De fait, la mission du pôle est déjà assumée, comme on l'a vu, mais comment et par qui? Simplement par la volonté ministérielle d'aider financièrement ce type d'opération et par la volonté d'un homme, le général en retraite Hardy, qui s'en occupe et assure à lui seul la coordination, la préparation et l'exécution des actions. Cela signifie donc que, du jour au lendemain, en cas de changement ministériel, d'une part, ou en cas de départ de l'intéressé, d'autre part, ce pôle historique risquerait de ne plus exister.
La proposition de loi est justement la réponse à ce type de risque. Elle donne un statut juridique à cette initiative et pérennise la mission actuellement assumée par le Pôle historique de la défense.
Le système est simple, souple et respectueux des autres partenaires.
Il est simple car il s'agit d'un conseil consultatif, sur le modèle du Conseil supérieur de la Justice créé par la loi, comme vous le savez.
Il est souple parce que sa mission l'est elle-même. Il émet des avis soit à son initiative, soit à la demande du ministre. Il va réaliser un inventaire de tout le patrimoine et, surtout, il va développer des contacts avec les personnes publiques et privées qui sont intéressées par le patrimoine historique de la Défense.
Il est respectueux des autres partenaires puisqu'il ne se substitue pas à eux. Bien plus, les autres partenaires sont membres du conseil consultatif.
Le fonctionnement dépendra des crédits affectés par le ministre de la Défense à cette initiative. Je suis d'ailleurs persuadé que, dès le vote de la proposition, on verra apparaître dans le budget 2007 ou peutêtre même dans le budget ajusté 2006, les inscriptions budgétaires nécessaires permettant à la personne travaillant actuellement à cette tâche de disposer des moyens raisonnables en matériel et en personnel.
J'ajoute que le parlement aura l'occasion d'en débattre puisqu'un rapport sera rédigé annuellement sur les activités du conseil consultatif. Il me semble donc que les choses seront très claires.
Je terminerai en remerciant tous mes collègues qui ont approuvé cette proposition et qui d'ailleurs la partagent avec moi. Je souhaite au Pôle historique de la défense plein succès dans son très important travail de mise en valeur du patrimoine de la Défense.
