Mijnheer de voorzitter, mijnheer de minister, collega's, ik wil gewoon kort het woord vragen voor een ander probleem dat hiermee verband houdt. Dit is eigenlijk reparatiewetgeving van de wetgeving op de districtsraden. Samen met een aantal collega's heb ik een amendement ingediend om ook een oplossing te bieden voor een ander probleem, namelijk het stemrecht voor EU-onderdanen. Wat is het geval? Toen wij hierover destijds het debat voerden, was iedereen het erover eens dat exact dezelfde kiezers die voor de gemeenteraden mochten kiezen, ook zouden mogen kiezen voor de districtsraden. Meer zelfs, dit was ook zo bepaald in de tekst van de wet. Wij verwezen daarin immers niet naar de voorwaarden om gemeenteraadskiezer te zijn, maar naar het concept van gemeenteraadskiezer zelf. Wij dachten dat het probleem daarmee was opgelost, maar dat was buiten de waard gerekend. Immers, toen men het EU-stemrecht invoerde, hebben wij met zijn allen vergeten om ook voor de districtsraadsverkiezingen een kleine wetswijziging aan te brengen. Niet alleen de kiezer die volgens artikel 1 van de gemeentekieswet stemgerechtigd is, maar ook degene die volgens artikel 1bis stemgerechtigd is, hadden wij zijn rechten moeten geven. Artikel 1bis verwijst naar de uitbreiding naar EU-onderdanen. Dat was destijds door iedereen aanvaard, maar werd wel een vergetelheid van de wetgever. Om daaraan een oplossing te bieden, werd er een amendement ingediend. Dat moet tevens beletten dat de districtsraadsverkiezingen zoals die volgens het huidige systeem zouden worden georganiseerd, worden onderworpen aan eventuele procedures inzake hun geldigheid. U weet dat de Europese richtlijn de verplichting oplegt de EU-onderdanen kiesrecht te geven. In tegenstelling tot provincie of OCMW is het district slechts een bijkomend orgaan van de gemeente. Indien men voor deze categorie van verkiezingen het stemrecht niet op dezelfde wijze zou toepassen als voor de andere organen van de gemeente, dan heeft men een juridisch probleem. Ik weet dat de minister van Binnenlandse Zaken zich ondertussen bewust is van het probleem, maar ik wilde toch nog even de aandacht van de Kamer hierop vestigen. De minister vraag ik uitdrukkelijk in welke mate hij met de stellingen van de indieners van het amendement akkoord kan gaan. Heel kort wil ik ook nog even een andere, vergelijkbare problematiek aanhalen. Het gaat om een zekere dubbelzinnigheid waarvan de oorsprong niet helemaal duidelijk is. Er is namelijk discussie over de dubbele kandidaatstelling. Men zegt dat Binnenlandse Zaken zou verbieden dat mensen tegelijkertijd voor de gemeenteraad en voor de districtsraad kandideren. Ook dat moet worden rechtgezet. De tekst van de wet zelf bepaalt duidelijk dat de dubbele kandidatuur mogelijk is. Het is misschien niet helemaal gepast, maar ik lees het toch even voor opdat iedereen het zou weten. Indien een wet zegt dat er een onverenigbaarheid is tussen het mandaat van gemeenteraadslid en lid van de districtsraad, en daaraan toevoegt: De tot gemeenteraadslid verkozen kandidaat kan het mandaat van districtsraadslid niet opnemen , dan volgt daaruit natuurlijk automatisch dat men wel kandidaat kan zijn, want anders kan men niet voor de twee mandaten verkozen zijn. Het zou dan ook goed zijn dat de minister nu of later duidelijkheid schept over dat probleem.

When we were debating about this at the time, everyone agreed that exactly the same voters who were allowed to vote for the municipal councils would also be allowed to vote for the district councils. Moreover, this was also specified in the text of the law. In fact, we do not refer to the conditions for being a municipal councillor, but to the concept of the municipal councillor itself. We thought the problem was solved, but that was out of value. After all, when the EU voting right was introduced, we all forgot to make a small legislative change even before the district council elections. Not only the voter who is entitled to vote according to Article 1 of the Municipal Elections Act, but also the one who is entitled to vote according to Article 1bis, we should have given his rights. Article 1a refers to the extension to EU citizens. That was accepted by everyone at the time, but it became a forgetfulness of the legislator. To solve this problem, an amendment was submitted. This should also prevent the elections to district councils, such as those organized under the current system, from being subject to any procedures relating to their validity. You know that the European Directive imposes the obligation to give EU citizens the right to vote. Unlike the province or OCMW, the district is only an additional body of the municipality. If the right to vote for this category of elections is not applied in the same way as for the other bodies of the municipality, then there is a legal problem. I know that the Minister of Internal Affairs is aware of the problem in the meantime, but I would like to draw the attention of the House to this issue. I explicitly ask the Minister to what extent he can agree with the proposals of the proposers of the amendment. In short, I would like to address another similar issue. This is a certain ambiguity whose origin is not entirely clear. There is a debate about the double candidacy. It is said that Home Affairs would prohibit people from running for the municipal council and for the district council at the same time. This too must be corrected. The text of the law itself clearly states that double candidacy is possible. It may not be quite appropriate, but I read it a little before so that everyone knows. If a law states that there is an incompatibility between the mandate of a municipal council member and a member of the district council, and adds to it: The candidate elected as a municipal council member cannot take up the mandate of a district council member, then it follows, of course, automatically that one can be a candidate, because otherwise one cannot be elected for the two mandates. It would be good for the Minister to clarify this issue sooner or later.

J'ai cherché dans les travaux préparatoires et les seuls éléments de réponse que j'ai pu donner au parlement sont fondés sur une déclaration du premier ministre Dehaene, dont je dois reconnaître qu'elle est ambiguë. Le même constat s'impose d'ailleurs en ce qui concerne la participation des citoyens de l'Union à l'élection directe du conseil de l'aide sociale dans les six communes périphériques, ainsi qu'à Comines-Warneton et à Fourons. Quant à moi, j'estime qu'il est souhaitable que les citoyens de l'Union puissent participer à ces deux types d'élections. On m'a déjà à de multiples reprises interpellé dans ce parlement à ce sujet, en insistant pour la promotion de ces mesures aux prochaines élections communales. Je crois que le droit doit être largement ouvert. C'est la raison pour laquelle j'ai décidé de soumettre la problématique au Conseil des ministres de vendredi prochain. Un projet de loi y sera examiné, qui modifie l'article 86 de la loi électorale communale et l'article 17bis de la loi du 8 juillet 1976 organique des centres publics d'aide sociale, afin de reconnaître formellement aux citoyens de l'Union résidant sur notre territoire le droit de participer à ces deux élections. J'ai soutenu la proposition initiale de M. Borginon. Je partage tout à fait sa préoccupation pour l'élection dans les conseils de district. M. The provisions of the Municipal Electoral Law governing the direct election of district councils do not allow to determine with certainty whether non-Belgian citizens of the European Union may or may not participate in this election. I looked in the preparatory work and the only elements of response I could give to Parliament are based on a statement by Prime Minister Dehaene, which I must acknowledge is ambiguous. The same observation is also necessary with regard to the participation of Union citizens in the direct election of the social assistance council in the six peripheral municipalities, as well as in Comines-Warneton and Fourons. As for me, I consider it desirable that EU citizens can participate in these two types of elections.
