Mijnheer de voorzitter, tot u zou ik mij in het bijzonder willen richten.
Het is niet zonder bitterheid dat ik hier vandaag het woord neem, in de eerste plaats als Vlaming en Vlaams Belanger die moet vaststellen dat met dit wetsontwerp wellicht de laatste kans wordt begraven om voor de federale verkiezingen van 2007 de zo lang verhoopte en zo noodzakelijke splitsing van de unitaire kieskring Brussel-Halle-Vilvoorde goed te keuren. Ik sta hier ook in de eerste plaats als parlementslid, als volksvertegenwoordiger, als lid van de federale Kamer. Ik sta hier als democraat die node moet vaststellen dat uitgerekend de voorzitter van dit parlementair halfrond, die bij uitstek de hoeder van het Kamerreglement zou moeten zijn, de bewaker van het vrije woord en van de vrije meningsuiting, dat die voorzitter op een ongeziene wijze misbruik heeft gemaakt van zijn situatie en het debat over Brussel-Halle-Vilvoorde gewoon in de kiem heeft gesmoord.
Men kan onmogelijk de ernst van wat hier is gebeurd, overschatten. De voorzitter heeft amendementen onontvankelijk en dus onbespreekbaar verklaard op basis van het fameuze artikel 90 van het Reglement dat bepaalt dat amendementen rechtstreeks verband moeten houden met het precieze onderwerp of artikel van het wetsontwerp. Welnu, dit is een schandelijke primeur voor dit land. Binnen dit Parlement, mijnheer de voorzitter, bestond de traditie, bestond er een gouden regel dat dit artikel uit het Reglement nooit zou worden gebruikt, dat dit artikel beschouwd zou worden als een atoomwapen dat in normale omstandigheden nooit uit de kast zou worden gehaald. I would like to address you in particular.

Within this Parliament, Mr. Speaker, there existed the tradition, there existed a golden rule that this article of the Rules of Procedure would never be used, that this article would be considered a nuclear weapon that would never be removed from the closet under normal conditions. It would only serve as the ultimate, highly secure emergency brake, only to be used when the work of the Parliament would become completely paralyzed and the democracy itself would thus be endangered.

Hier gebeurde precies het tegenovergestelde. Het atoomwapen werd op een haast banale wijze te voorschijn getoverd op een vodje papier van de Kamervoorzitter dat stoemelings de commissie was binnengesluisd. Het ging zelfs zo ver dat, toen wij het document via het commissiesecretariaat opvroegen, wij een categorisch "njet" te horen kregen. We mochten het vodje papier van de voorzitter zelfs niet eens inzien. We zouden het allemaal wel te lezen krijgen in het verslag.
Men wist zeer goed dat er een reukje was aan het verhaal en de procedure en dat de voorzitter zijn hand zwaar had overspeeld.
Collega's, wanneer het fameuze artikel 90 uit het Reglement door het precedent van de commissie voor de Binnenlandse Zaken in de toekomst te pas en te onpas zou kunnen worden aangewend als het de commissievoorzitter of de Kamervoorzitter uitkomt, betekent dat min noch meer dat de oppositie te allen tijde en op volstrekt willekeurige basis de mond kan worden gesnoerd. Op die manier wordt de oppositie niet meer in staat gesteld een belangrijk deel van haar werk te doen, in casu de voorstellen van de meerderheid verbaal bekampen.
Mijnheer de voorzitter, wat u gedaan hebt, is bijzonder gevaarlijk voor de werking van onze instelling en fnuikt in niet geringe mate de rechten van uw parlementsleden. Ik zeg duidelijk namens onze fractie dat het niet voor herhaling vatbaar is en dat u vanavond niet zal beletten dat wij onze amendementen inzake de splitsing van Brussel-Halle-Vilvoorde toelichten.
Bovendien was het volkomen onjuist en leugenachtig om te zeggen dat de kwestie Brussel-Halle-Vilvoorde inhoudelijk los zou staan van het oorspronkelijk wetsontwerp, dat niets meer is dan een technisch ding dat een aantal praktische voorbereidingen moet regelen voor de komende federale verkiezingen. Niets is minder waar. Een van de belangrijkste bepalingen van het ontwerp, artikel 26, heeft wel degelijk een heel duidelijke politieke betekenis, die voor de volle 100% te maken heeft met het debat over de splitsing van de kieskring.
Waarover gaat het artikel? Het handelt over het fameuze dossier Lennik. Het gaat over het kanton Lennik waar in 2003 door een gril van de vorige francofone minister van Binnenlandse Zaken alle stemmen geconcentreerd werden die per brief vanuit het buitenland toekwamen. Dat resulteerde in een gigantische stemmenwinst voor de Franstalige partijen in dat landelijke en Vlaamse kanton.

Furthermore, it was completely incorrect and false to say that the Brussels-Halle-Vilvoorde issue would be substantially separate from the original bill, which is nothing more than a technical thing that should arrange a number of practical preparations for the upcoming federal elections. Nothing is less true. One of the key provisions of the draft, Article 26, has indeed a very clear political meaning, which is 100% related to the debate about the split of the electoral circles.
What is the article about? It is about the famous Lennik dossier. It is about the canton of Lennik where in 2003 through a grill of the former Franco-speaking Minister of Interior all the votes received by letter from abroad were concentrated. This resulted in a huge vote gain for the French-speaking parties in that country and Flemish canton.

We hadden ervoor gewaarschuwd dat deze buitenlandse kiezers die in Brussel-Halle-Vilvoorde waren ingeschreven in grote mate Franstalig zouden stemmen. Het ging over het zoveelste instrument om de Vlamingen verder achteruit te duwen. Ons gelijk werd door het resultaat in Lennik ten overvloede bevestigd.
Welnu, het was dit opmerkelijke resultaat in 2003 dat aan de basis lag van de acties van de burgemeesters, in het bijzonder van VLD-burgemeester Willy De Waele, een naamgenoot van u, mijnheer de minister, maar o zo veel voornamer dan u. Het lag uiteindelijk aan de basis van het overduidelijk Vlaams regeerakkoord van juli 2004 dat ik hier vandaag toch nog even voorlees, tenminste de betrokken passage. Ter attentie van onze collega’s van VLD, van sp.a-spirit en van CD&V-N-VA lees ik het volgende voor: “De Vlaamse regering en haar regeringspartijen nemen het engagement, zoals verwoord in de verklaring van 13 mei ten overstaan van de burgemeesters van het arrondissement Halle-Vilvoorde, over. Hiertoe vragen zij aan hun fractie in Kamer en Senaat” – luister goed, collega’s, het gaat over u – “om los van het door de federale regering aangekondigde forum uiterlijk bij de start van het parlementair jaar” – dus in september of oktober 2004 – “wetsvoorstellen tot de splitsing van het kiesarrondissement Brussel-Halle-Vilvoorde voor de verkiezing van de Kamer van Volksvertegenwoordigers, de Senaat en het Europees Parlement respectievelijk tot splitsing van het gerechtelijk arrondissement, in te dienen en onverwijld goed te keuren. De Vlaamse regering zal parallel en tegelijk de institutionele middelen aanwenden waarover zij in het kader van het coöperatief federalisme beschikt om dit te realiseren.”

Na de goedkeuring van dit ontwerp is er jammer genoeg geen enkele gelegenheid meer voor de parlementsleden om de kwestie met enige kans op slagen op de agenda te plaatsen.
Het debat moet dus vandaag wel worden gevoerd. Ten eerste omdat het Arbitragehof ons daar eigenlijk toe dwingt. Wie het arrest van het Arbitragehof goed leest en in zijn juiste context plaatst, zal moeten toegeven dat het Hof ons in 2003 verplicht heeft om de zaak binnen de 4 jaar te regelen en bijgevolg vóór de verkiezingen van 2007. Het Hof heeft allerminst toegelaten dat de zaak ineens voor 8 jaar mag worden doorgeschoven naar 2011. Daar gaat het precies om: als we het nu niet doen, wordt het 2011 vooraleer we het kunnen bespreken. Als de splitsing er nu niet komt, zijn we ineens weer vertrokken voor 4 jaar zonder dat de splitsing nadien gegarandeerd zal worden doorgevoerd.
Bovendien hebben de voorbije gemeente- en provincieraadsverkiezingen overduidelijk aangetoond dat er eindelijk een halt moet worden toegeroepen aan het imperialisme van bepaalde Franstalige politici. Het is werkelijk onaanvaardbaar dat een vicepremier van het genre Reynders, die binnen de regering bovendien nog de taak had om een uitweg te zoeken in dit dossier, in volle verkiezingstijd en in de meest perverse termen de Vlamingen in het vizier nam en uitschold voor onverdraagzamen en opriep tot een radicaal anti-Vlaams stemgedrag. Dit alles werd trouwens overgoten met een saus van heimwee naar une Belgique francophone. Zo staat het in zijn pamfletten die in Halle-Vilvoorde bus per bus werden verspreid. Aan dit schandelijke imperialisme, aan deze macabere Anschlusspolitiek, die doet terugdenken aan de meest donkerbruine episode uit de geschiedenis, moet een einde komen. Alleen de onmiddellijke splitsing van Brussel-Halle-Vilvoorde, zonder compensaties, kan daarop een antwoord bieden.

Moreover, the last municipal and provincial council elections have clearly demonstrated that the imperialism of certain French-speaking politicians must finally be stopped. It is indeed unacceptable that a deputy prime minister of the genre Reynders, who within the government had also the task of finding a way out in this dossier, in full election time and in the most perverse terms took the Flamings in the vizier and exiled for intolerants and called for a radical anti-Flames voting behavior. In dat geval dreigt het hele dossier in een onoverzichtelijk kluwen van toegevingen en compensaties terecht te komen en zouden wij van de regen in de drop kunnen belanden. In dat geval zouden de aanspraken van de Brusselse imperialisten op de Rand uiteindelijk kunnen worden versterkt in plaats van afgestopt.
Collega’s, onze amendementen zijn niets anders dan de tekst die de traditionele partijen VLD, sp.a-spirit en CD&V in oktober 2004 gezamenlijk hebben ingediend en waarvan was beloofd dat hij onverwijld zou worden goedgekeurd. Wij kunnen ons niet voorstellen dat u vandaag zomaar tegen uw eigen tekst zou stemmen.
Mijn slotwoord vandaag is voor de heer vice-eerste minister Dewael.
Hij kan er natuurlijk onmogelijk aan doen dat hij met een dergelijke achternaam door het leven moet gaan. Hij kan echter door zijn politiek handelen wel vermijden dat hij steeds meer wordt beschouwd als een halve Waal of als een Vlaming die aan de Waalse en francofone belangen prioriteit geeft.
Mijnheer de vicepremier, ik heb u destijds bewonderd als flamboyante oppositieleider, die onze partij in alle mogelijke debatten qua Vlaamsgezindheid de loef probeerde af te steken. Echter, sinds u in 1999 Vlaams minister-president en nadien Belgisch vice-eerste minister werd, is het met u alleen maar bergaf gegaan. U hebt de verwachtingen die de Vlamingen en uw Vlaamsgezinde VLD-kiezers - die er toch nog waren - in u hadden gesteld, niet kunnen waarmaken. Uw aanwezigheid aan de politieke top is voor Vlaanderen acht jaar tijdverlies gebleken. U hebt uw carrière op de rug van de Vlamingen gemaakt. U hebt echter op geen enkel moment de Vlamingen iets teruggegeven. Erger nog, in het dossier Brussel-Halle-Vilvoorde hebt u zich in 2004, met uw zware, tuchtrechtelijke dreigementen aan het adres van de burgemeesters en met uw intimidatiepolitiek ten aanzien van de burgemeesters, van uw allerdonkerste kant laten zien.
Vandaag probeert u opnieuw, als een volleerd slalomspecialist, om het echte, politieke debat heen te skiën. U wil de netelige kwestie BHV zo diep mogelijk begraven, en dat voor een man die ooit nog beloofde dat hij de faciliteiten zou afschaffen.

Mijnheer de voorzitter, er is een heel duidelijk onderscheid tussen het fameuze wetsvoorstel dat in oktober 2004 door de gezamenlijke Vlaamse meerderheidspartijen en CD&V werd ingediend, en de amendementen. Waarom? Omdat het wetsvoorstel van 2004 ook ging over de Europese verkiezingen.
Ik snap dat men zegt dat het wetsvoorstel een aantal zaken omvat dat niets te maken heeft met de Kamerverkiezingen. Wij laten niet toe dat dat exhaustief wordt besproken. Niets verbiedt dat men delen uit het wetsvoorstel indient bij wijze van amendement. Wij hebben in het verleden altijd die mogelijkheid gehad. Zelfs wanneer u een amendement ontvankelijk verklaart dat niets te maken heeft met de inhoud van het wetsontwerp, dan nog gaat u te ver. Men maakt het de oppositie dan immers onmogelijk om, zoals u destijds hebt gedaan, in bepaalde omstandigheden te filibusteren. Hier zou dat niet eens het geval zijn geweest. Hier zouden we niet hebben gefilibusterd. Wij zouden een zeer inhoudelijk debat hebben gevoerd over wat wij eigenlijk wilden, namelijk de kwestie Brussel-Halle-Vilvoorde in de Kamer behandelen.
Men heeft op alle mogelijke manieren verhinderd om hierover in de Kamercommissie te debatteren. U weet ook, meer dan wie ook - u bent daarin zelf destijds kampioen geweest - dat het op bepaalde momenten zeer nuttig en een recht van de oppositie is om te filibusteren en om teksten in te dienen die niet 100% te maken hebben met de lopende wetsvoorstellen, maar die toch nuttig kunnen zijn in de parlementaire democratie, omdat het debat wordt gerekt en daardoor tot nadenken wordt aangezet. Dat is een fundamenteel recht van de oppositie om te spreken en tegen te spreken. U fnuikt dat. Het is zeer vergaand om dat te fnuiken, te meer omdat u dat in het verleden zelf hebt gedaan. U hebt in het verleden langer dan wie ook, dan elk van ons in onze fractie, soms verhaaltjes zitten afdreunen die kant nog wal raakten. Niemand heeft u toen tegengehouden. Geen enkele voorzitter heeft toen tegen u gezegd: mijnheer De Croo, ik roep artikel 90 in. Nu doet u het zelf wel.
U bent dus geen grote voorzitter. U bent hier gewoon de lakei van minister Dewael, die zegt dat er geen enkel debat mag plaatsvinden. Ik stond daarstraks boven in uw buurt toen jullie twee stonden te konkelfoezen. Hij zei dat het amendement van de heer Ducarme niet mag worden besproken, later bij het wetsvoorstel wel, maar niet hier in de plenaire vergadering in het kader van onderhavig wetsontwerp, omdat hij dat niet wil. U voert uit wat de heer Dewael tegen u zegt. Daar ligt het probleem. U verdedigt het Parlement niet. U bent een aanhangsel van de regering. Ik vind dat bijzonder spijtig.

You also know, more than anyone – you have been a champion at the time – that at certain times it is very useful and a right of the opposition to philibuster and to submit texts that are not 100% related to the current bills, but that can still be useful in parliamentary democracy, because the debate is aroused and thus stimulated to reflect. This is a fundamental right of the opposition to speak and oppose. You fucking that. It is very widespread to cheat that, even more because you have done it yourself in the past. You have been in the past longer than anyone else, than each of us in our faction, sometimes telling stories that side was still in ruins. No one stopped you then. No President has said to you at that time: Mr. De Croo, I invoke Article 90. Now you do it yourself.
You are not a great president. You are here just the lakei of Minister Dewael, who says there should be no debate. I stood up there next to you when you two were standing on a conclave. He said that the amendment of Mr. Ducarme should not be discussed, later with the bill, but not here in the plenary session in the context of the present bill, because he does not want to. You carry out what Mr. Dewael says to you. That is where the problem is. You are not defending the Parliament. You are an appendix of the government. I find this ⁇ regrettable.
