Mijnheer de voorzitter, sta mij toe te beginnen met mevrouw Jacqueline Galant te bedanken voor het verslag dat zij uitstekend heeft gebracht en dat mij toelaat mijn betoog te beperken. Veel van wat ik of leden van mijn fractie hebben gezegd, staat in het verslag.
Ik wil opmerken dat het belangrijk is dat wij misbruiken van schijnhuwelijken aanpakken. Wij worden daarmee allemaal geconfronteerd in steden en gemeenten. Als wij bijvoorbeeld in Antwerpen het percentage bekijken van de huwelijken die onderzocht en tegengehouden worden, dan blijken 8% van de geplande huwelijken schijnhuwelijken te zijn. Gelukkig kunnen die vooraf onderschept worden. Het is dus belangrijk om daarvoor oog te hebben. Samen met collega's van CD&V en andere politieke partijen heb ik daarvoor een resolutie uitgewerkt, die binnenkort in de commissie behandeld zal worden. Vandaag staat dit niet op de agenda, ik zal daarover dus ook niet uitweiden.
Het is belangrijk dat wij misbruiken aanpakken, zonder evenwel elk huwelijk waarbij een vreemdeling betrokken is, bijvoorbeeld een huwelijk tussen een Belg en iemand die afkomstig is uit Turkije, als een potentieel schijnhuwelijk te beschouwen en angstvallig alles uit te pluizen. Er moet uiteraard grondig nagegaan worden of er misbruiken zijn, maar niet elk huwelijk is een bedreiging en niet elk huwelijk is een schijnhuwelijk. Laat dat duidelijk zijn.
Dit wetsontwerp dat besproken werd, voorziet in elk geval in een bestraffing van schijnhuwelijken, zodat er sancties genomen kunnen worden tegen personen die een huwelijk aangaan dat geen echt huwelijk is en enkel als bedoeling hebben een partner over te brengen naar België om hem of haar op die manier aan een verblijfsvergunning te helpen. Vanaf nu riskeren de twee partners, als ze beiden betrokken zijn, of één partner, dat wil ik er heel duidelijk bijzeggen, want soms is er maar één partner betrokken, een gevangenisstraf van drie maanden of een boete tot 100 euro. Als er geld betaald werd, dan loopt die boete gradueel op. Bij fysieke of psychische dwang kan het gaan over een gevangenisstraf tot 2 jaar en een boete tot 500 euro.
CD&V diende ook een wetsvoorstel in, zowel in de Kamer als in de Senaat. In de Kamer heb ik, samen met Carl Devlies en Simonne Creyf, een wetsvoorstel ingediend. In de Senaat werd er al voordien een voorstel ingediend door Mia De Schamphelaere. De essentie van het wetsvoorstel dat wij hebben ingediend, komt in grote mate overeen met het stuk dat thans voorligt, maar toch niet helemaal.
De essentie waarvoor wij pleiten, is dat er strafrechtelijke sancties worden opgelegd aan één of beide partners en ook een financiële bestraffing om te vermijden dat dit een goedkope manier van echtscheiding wordt. De Belgische nationaliteit moet kunnen ontnomen worden, want vaak worden mensen Belg nadat zij een schijnhuwelijk zijn aangegaan afgesloten om op die manier te vermijden dat zij hun verblijfsvergunning verliezen.
Ten slotte — vooral dat punt is belangrijk — hebben wij ook altijd gepleit voor een automatisch verlies van de verblijfsvergunning zodra bewezen is of er een uitspraak is van de rechter dat het over een schijnhuwelijk gaat en dat het huwelijk dus nietig is verklaard.
Het wetsontwerp van de regering is in dezelfde geest van ons wetsvoorstel, maar er blijven een aantal belangrijke verschillen. Ik ga niet op alle verschillen in, want die zijn ook al voor een stuk uiteengezet door mevrouw Galant. Ik wil mij beperken tot drie punten, waaraan wij als CD&V echt heel veel belang hechten.
Ten eerste, de straffen die de regering bepaalt in dit wetsvoorstel. De straffen zijn in mijn ogen te licht. Voor een gewoon schijnhuwelijk moet bijvoorbeeld een boete van 50 euro betaald worden en zelfs voor de zwaarste sanctie — bij een gedwongen huwelijk of een huwelijk waarmee echte fraude gemoeid is — loopt die boete op tot 500 euro. Dat lijkt misschien veel, maar dat is niets als men weet dat mensen voor gearrangeerde huwelijken of schijnhuwelijken bereid zijn heel veel te betalen. De gangbare prijzen lopen gemakkelijk op tot 20.000 euro en meer. Wat is 500 euro als men bereid is geweest om zelfs veel meer op tafel te leggen om hier een verblijfsvergunning te krijgen? Die straf is veel te licht.
De gevangenisstraffen voor gewone schijnhuwelijken zijn beperkt tot maximaal zes maanden. Doordat de gevangenissen in België overvol zitten, weten we dat gevangenisstraffen onder de zes maanden sowieso niet worden uitgezeten. Daarom is het eigenlijk een heel gemakkelijke keuze. Men riskeert niet veel, hooguit een boete, die helemaal niet zo hoog ligt, en een gevangenisstraf komt er bijna niet. Als die gevangenisstraf minder dan zes maanden bedraagt, dan moet men die zelfs helemaal niet meer uitzitten.
Een ander probleem dat ik heb aangehaald in verband met die straffen, is dat wij recent in dit Parlement de wet op de mensenhandel hebben goedgekeurd, die eveneens voorziet in sancties wanneer het gaat over schijnhuwelijken, uiteraard ook schijnhuwelijken waarmee mensenhandel gemoeid is. De praktijk leert dus dat wij enerzijds de sancties hebben waarin de wet op de mensenhandel voorziet, de wet van 10 augustus 2005, en anderzijds dit hier. Ik heb toen gezegd dat hier een probleem is omdat het zo kan zijn dat een persoon zelfs riskeert twee straffen te krijgen, een keer op basis van de wet van 10 augustus en een keer op basis van dit wetsontwerp. Dat kan dus. Het kan perfect dat men twee keer gesanctioneerd wordt. Het is natuurlijk afhankelijk van de rechter, maar het kan ook gebeuren dat de ene rechter een bepaalde strafmaat oplegt, terwijl een andere rechter een totaal andere strafmaat oplegt voor min of meer gelijkaardige feiten. Dat behoort uiteraard tot de appreciatiebevoegdheid van de rechter, iets waarin wij niet tussenbeide kunnen komen.
Met deze wetgeving zijn er echter twee verschillende straffen, een keer in de wet op de mensenhandel en een keer apart. Dat lijkt geen goed idee te zijn. Ik denk dat het veel beter was geweest, ofwel om in augustus één wetgeving te maken omtrent schijnhuwelijken, ook voor gewone schijnhuwelijken waar geen mensenhandel mee gemoeid is, ofwel in dit voorstel ook de schijnhuwelijken waarmee mensenhandel gepaard gaat te integreren. Op die manier kon men duidelijk aangeven welke sancties daarop staan.
De echte sanctie — want we hebben het nu over de geldboetes en de gevangenisstraffen — blijft echter uit. De echte sanctie is het automatisch ontnemen van de verblijfsvergunning van de partner die uiteindelijk een schijnhuwelijk of zelfs een gedwongen huwelijk heeft gebruikt om naar België te komen. Dat zien we niet. Zolang er niet automatisch een verlies is van de verblijfsvergunning nadat men het huwelijk nietig heeft kunnen verklaren, heeft men niet veel te verliezen en zal men dus toch naar België komen.
Wat is de procedure immers nu? Nu is het zo dat men eerst via de rechtbank moet zeggen dat men het slachtoffer is van een schijnhuwelijk. Men moet dan een advocaat raadplegen en een procedure opstarten. Dat duurt heel lang, het kan soms tot vijf jaar duren. Inmiddels ziet men het vaak al niet meer zitten en besluit men om, in plaats van de nietigverklaring van een schijnhuwelijk aan te vragen, de gemakkelijkste weg te nemen door na twee jaar feitelijk verblijf een echtscheiding aan te vragen. Men kiest bovendien ook vaak voor de gemakkelijkste weg. In de gevallen van de slachtoffers is dat natuurlijk te begrijpen omdat zij natuurlijk van die partner af willen omdat zij het niet meer zien zitten om er jaar in, jaar uit mee te moeten samenleven of er miserie mee te hebben. Stel echter dat het na een aantal jaren gelukt is om het huwelijk nietig te verklaren, dan moet men de beroepstermijnen afwachten en de DVZ in kennis stellen van het probleem. De DVZ start dan een procedure op en kan de verblijfsvergunning intrekken. Ik zeg wel "kan", want dat is geen automatisme. Bovendien kan tegen die procedure om de verblijfsvergunning in te trekken, opnieuw een beroepsprocedure ingesteld worden. Met andere woorden, er is veel tijd gewonnen en intussen kan die partner eventueel opnieuw huwen.
In theorie is het misschien wel mogelijk om de verblijfsvergunning te ontnemen. CD&V pleit ervoor dat dat altijd gebeurt, ook kort en onmiddellijk na de feiten, na de nietigverklaring van het huwelijk, en dat het ook een automatisme is. Dat is het belangrijkste.
Wij hebben gevraagd hoeveel mensen hun verblijfsvergunning hebben verloren nadat het huwelijk nietig was verklaard. Daarover had u geen cijfers. Dat valt te verklaren doordat weinig of geen mensen hun vergunning hebben verloren. Ik ken heel veel huwelijken die achteraf schijnhuwelijken bleken te zijn en waar de partner nog vrij rondloopt. Erger nog, meestal haalt die partner dan een nieuwe partner uit het buitenland, trouwt daarmee en begint het hele probleem soms opnieuw.
Ik kom tot een derde en laatste opmerking. Wanneer er sprake is van een schijnhuwelijk, is het niet meer dan logisch dat mensen die Belg zijn geworden via dat huwelijk, ook de nationaliteit wordt ontnomen. Als het huwelijk niet echt was, is de basis om de Belgische nationaliteit te krijgen, er ook niet. Wij pleiten ervoor dat de nationaliteit wordt ontnomen als die op basis van een schijnhuwelijk is verkregen. Zo niet wordt het heel gemakkelijk. Men komt naar hier en wordt zo snel mogelijk Belg. Dat kan heel snel zonder problemen. Dan wordt men ook niet meer teruggestuurd, want een Belg zijn verblijfsvergunning ontnemen, kan niet. De eerste stap is dus om de nationaliteit te ontnemen aan degenen die hebben gefraudeerd, die misbruik hebben gemaakt van het huwelijk.
Dat zijn onze drie belangrijkste bemerkingen. Ten eerste, de strafmaat is veel te laag. Er is veel verwarring met de wet op de mensenhandel. Ten tweede, de nationaliteit moet automatisch worden ontnomen. De theorie moet in de praktijk worden omgezet. Ten derde, de nationaliteit moet ook worden ontnomen in het geval van een schijnhuwelijk.
Het wetsontwerp ligt wel in de lijn van ons voorstel. De problematiek moet worden aangepakt. In ons voorstel gaan wij daarin veel verder. Gelukkig hebben wij binnenkort ook de mogelijkheid om over het deel preventie en controle te spreken naar aanleiding van de resolutie. Dat houd ik voor later.
Mijn conclusie is dat de poging van de regering verdienstelijk is, maar onvoldoende. Het is echter een eerste stap, een belangrijke stap, en daarom willen wij het wetsontwerp van de regering goedkeuren. Wij houden daarbij in het achterhoofd dat het zeker niet genoeg is. Schijn bedriegt. Het kan voldoende lijken, maar het is het niet. Er moet voort werk worden gemaakt van de aanpak van schijnhuwelijken.

Mr. Speaker, please allow me to begin by thanking Mrs. Jacqueline Galant for the excellent report she has delivered and which allows me to limit my speech. Much of what I or members of my group have said is included in the report.
I would like to note that it is important that we address the abuse of hypocritical marriages. We all face this in cities and municipalities. For example, in Antwerp, if we look at the percentage of marriages that are investigated and withheld, then 8% of planned marriages appear to be hypocritical marriages. Fortunately, they can be captured in advance. Therefore, it is important to keep an eye on this. Together with colleagues from CD&V and other political parties, I have drawn up a resolution for this purpose, which will soon be discussed in the committee. This is not on the agenda today, so I will not extend it.
It is important that we address abuse, without, however, considering any marriage involving a foreigner, for example, a marriage between a Belgian and a person originating in Turkey, as a potential hypocritical marriage, and fearfully plunging everything out. Of course, abuse must be thoroughly investigated, but not every marriage is a threat, and not every marriage is a false marriage. Let that be clear.
This draft law, which was discussed, in any case provides for a punishment of fake marriages, so that sanctions can be taken against persons who enter into a marriage that is not a real marriage and only intend to transfer a partner to Belgium in order to help him or her in such a way with a residence permit. From now on, the two partners, if they are both involved, or one partner, that I want to point out very clearly, because sometimes there is only one partner involved, a three-month prison sentence or a fine up to 100 euros. If the penalty is paid, the penalty is gradually increased. Physical or psychological coercion can be punished with imprisonment up to 2 years and a fine up to 500 euros.
CD&V also submitted a bill, both in the House and in the Senate. In the Chamber, I, together with Carl Devlies and Simonne Creyf, submitted a bill. In the Senate, a proposal was already submitted by Mia De Schamphelaere. The essence of the bill we have submitted corresponds to a large extent to the piece that is currently in the process, but not entirely.
The essence we advocate is that there are criminal sanctions imposed on one or both partners and also a financial penalty to avoid this becoming an inexpensive way of divorce. The Belgian citizenship must be deprived, because often people are closed in Belgium after they have entered into a false marriage in order to avoid losing their residence permit.
Finally — especially that point is important — we have also always advocated for the automatic loss of the residence permit as soon as it is proven that there is a judgment of the judge that it is a false marriage and that the marriage is therefore declared invalid.
The government bill is in the same spirit as our bill, but there are still some major differences. I will not address all the differences, as they have already been outlined by Mrs. Galant. I would like to limit myself to three points, to which we as CD&V really attach great importance.
First, the penalties that the government sets out in this bill. The penalties are too light in my eyes. For example, an ordinary fake marriage is subject to a fine of 50 euros and even for the heaviest penalty — forced marriage or marriage involving real fraud — this penalty amounts to 500 euros. That may seem like a lot, but that is nothing if one knows that people for arranged marriages or hypocritical marriages are willing to pay a lot. The usual prices can easily go up to 20,000 euros and more. What is 500 euros if one has been willing to put even much more on the table to get a residence permit here? The punishment is too light.
The prison sentences for ordinary hypocritical marriages are limited to a maximum of six months. Because the prisons in Belgium are overcrowded, we know that prison sentences below six months are not extended anyway. Therefore, it is actually a very easy choice. One does not risk much, at least a fine, which is not so high at all, and a prison sentence almost never comes. If that imprisonment is less than six months, then one should not even spend it at all.
Another problem I have cited in connection with these penalties is that we recently adopted in this Parliament the Law on Trafficking in Human Beings, which also provides for sanctions when it comes to hypocritical marriages, of course also hypocritical marriages involving human trafficking. So the practice teaches that on the one hand we have the sanctions provided by the law on human trafficking, the law of 10 August 2005, and on the other hand this here. I said then that here is a problem because it can be that a person even risks getting two penalties, once on the basis of the law of 10 August and once on the basis of this bill. So it can. It is perfectly possible to be sanctioned twice. It depends, of course, on the judge, but it can also happen that one judge imposes a certain penalty, while another judge imposes a completely different penalty for more or less similar acts. This, of course, belongs to the judge’s assessment power, something in which we cannot intervene.
With this legislation, however, there are two different penalties, once in the law on human trafficking and once separately. That doesn’t seem to be a good idea. I think it would have been much better, either to make a unified legislation in August on hypocritic marriages, also for ordinary hypocritic marriages that do not involve human trafficking, or to integrate the hypocritic marriages that involve human trafficking in this proposal. In this way, it could be clearly stated what sanctions are on it.
However, the real sanction — because we are now talking about fines and prison sentences — remains out. The real sanction is the automatic withdrawal of the residence permit of the partner who eventually used a false marriage or even a forced marriage to come to Belgium. We do not see that. As long as there is not automatically a loss of the residence permit after one has been able to annul the marriage, one has not much to lose and therefore one will still come to Belgium.
What is the procedure now? Now it is the case that one must first say through the court that one is the victim of a false marriage. You must then consult a lawyer and initiate a procedure. This takes a very long time, sometimes it can take up to five years. In the meantime, one often finds it no longer and decides, instead of applying for the annulment of a false marriage, to take the easiest way by applying for divorce after two years of actual residence. They also often choose the easiest way. In the cases of the victims, this is of course to be understood because they naturally want to get rid of that partner because they no longer see it to have to coexist with it years in, years out of, or to have misery with it. However, if it is assumed that after several years the marriage has been cancelled, then one must wait for the appeal deadlines and inform the DVZ of the problem. The DVZ then initiates a procedure and can withdraw the residence permit. I say “can” because that’s not automatic. Furthermore, a new appeal procedure may be initiated against that procedure for the withdrawal of the residence permit. In other words, a lot of time has been won and in the meantime that partner may eventually get married again.
In theory, it may be possible to withdraw the residence permit. CD&V advocates that this always happens, even shortly and immediately after the facts, after the annulment of the marriage, and that it is also an automation. That is the most important.
We asked how many people lost their residence permit after the marriage was annulled. You had no figures on that. This can be explained by the fact that few or no people have lost their licenses. I know a lot of marriages that later turned out to be hypocritical marriages and where the partner still freely runs around. Worse, usually that partner then takes a new partner from abroad, marries them, and sometimes the whole problem starts again.
I have a third and last comment. When there is a false marriage, it is no more than logical that people who have become Belgian through that marriage are also deprived of their nationality. If the marriage was not real, the basis for obtaining Belgian citizenship is also not there. We advocate the deprivation of nationality if it is acquired through a false marriage. Otherwise it will be very easy. You come here and become Belgian as soon as possible. This can be done very quickly without any problems. Then one is also no longer returned, because a Belgian can not withdraw his residence permit. So the first step is to deprive the nationality of those who have cheated, who have abused the marriage.
These are our three main remarks. First, the penalty is too low. There is a lot of confusion with the law on human trafficking. Second, citizenship should be automatically deprived. The theory must be translated into practice. Third, citizenship should also be deprived in the case of a false marriage.
The draft law is in line with our proposal. The problem must be addressed. In this proposal we go much further. Fortunately, soon we will also have the opportunity to talk about the prevention and control part following the resolution. I keep that for later.
My conclusion is that the government’s effort is meritorious, but insufficient. However, it is a first step, an important step, and that’s why we want to approve the government’s bill. We must bear in mind that this is ⁇ not enough. The appearance deceives. It may seem sufficient, but it is not. Work should be done on the approach to hypocritical marriages.

Monsieur le président, monsieur le ministre, chers collègues, le trafic d'êtres humains et la traite des êtres humains sont des réalités vécues en Europe et en Belgique. Des réalités inadmissibles tant les drames humains sont importants et exigent l'intervention des pouvoirs publics.
Notre législation s'est déjà dotée de moyens répressifs importants pour lutter contre ces fléaux, d'une part, dans le Code pénal avec les articles 433quinquies à 433octies et, d'autre part, avec l'adoption récente, dans la loi de 1980 relative au statut administratif des étrangers des articles 77, 77bis à 77quinquies. Ces dernières dispositions sont en vigueur depuis le mois d'août 2005.
Pour rappel, l'article 77bis de la loi de 1980 stipule que "constitue l'infraction de trafic d'êtres humains, le fait de contribuer, de quelque manière que ce soit, soit directement soit par intermédiaire, à permettre l'entrée, le transit ou le séjour d'une personne non ressortissante d'un Etat membre de l'Union européenne, en violation de la législation de cet Etat, en vue d'obtenir, directement ou indirectement un avantage patrimonial".
Comme le signalait le Conseil d'Etat dans son avis sur l'avant-projet de loi qui nous concerne, cette disposition permet déjà de sanctionner les mariages de complaisance monnayés en vue de permettre l'obtention d'un droit au séjour.
Cette infraction est punie d'un emprisonnement d'un an à trois ans. Cette sanction est fortement alourdie lorsque l'infraction "a été commise en faisant usage, de façon directe ou indirecte, de manoeuvres frauduleuses, de violence, de menaces ou d'une forme quelconque de contrainte". Dans ce cas, la loi érige l'infraction en crime puni de la réclusion de dix à quinze ans. La loi vise ici notamment le mariage forcé.
Les tentatives de commettre ces infractions sont aussi punies.
Le projet de loi que vous nous proposez, monsieur le ministre, vient en surimpression des dispositions actuelles. En effet, l'article 79bis en projet punira "quiconque conclut un mariage dans les circonstances visées à l'article 146bis du Code civil". Cette infraction sera punie d'un emprisonnement de huit jours à trois mois. La sanction sera plus lourde en cas de mariage monnayé et en cas de mariage forcé. Les tentatives de commettre ces délits seront aussi punies.
Mon souci, notre souci est d'assurer une correcte application des dispositions légales visant à lutter contre le trafic d'êtres humains. Vous savez que certains s'amusent à utiliser tous les arguments, notamment ceux de possibles confusions de dispositions légales, pour éviter d'être condamnés.
Je souhaiterais que vous apportiez des certitudes dans ce domaine. Il est clair que les nouvelles dispositions, que nous voterons aujourd'hui, s'appliqueront sans préjudice des dispositions légales actuelles, notamment:
- l'assurance que le juge répressif appliquera bien la peine la plus lourde lorsqu'un même fait sera poursuivi pour plusieurs infractions, c'est-à-dire celles prévues par les articles 77, 77bis et la nouvelle disposition du futur article 79bis de votre projet;

Des mariages de complaisance, des mariages forcés pour permettre à des personnes de disposer d'un droit de séjour en Europe existent. C'est du trafic d'êtres humains et ces mariages doivent être réprimés. Derrière ceux-ci, il y a généralement des filières mafieuses liées à la prostitution, au travail au noir. Nous en avons longuement parlé lors de l'adoption de la loi sur le trafic et la traite des êtres humains. Pour paraphraser les propos du philosophe Guy Haarscher, "il faut reconnaître la responsabilité de nos gouvernants dans la protection de base de leurs citoyens contre la criminalité, les soutenir dans cette entreprise tout en restant vigilants quant aux dérives possibles". Ainsi, nous espérons que ces nouvelles dispositions du futur article 79bis de la loi de 1980 constitueront des éléments utiles permettant d'améliorer les dispositions actuelles dissuadant les mariages de complaisance. Je fais ici allusion au pouvoir des officiers d'état civil qui peuvent refuser de célébrer ou surseoir à célébrer ce type de mariage de complaisance. Je pense aussi au pouvoir dont disposent l'Office des étrangers et nos postes diplomatiques pour appliquer correctement et humainement les dispositions légales à l'accès au territoire et au séjour.
A cet égard, une évaluation quantitative et qualitative de l'action de ces services s'impose afin d'objectiver la situation.
Enfin, une répression contre le trafic d'êtres humains par l'intermédiaire des mariages de complaisance doit se faire dans le respect du droit au regroupement familial et des cultures diverses de nos concitoyens. Il est évident que tous les mariages avec un ressortissant étranger ne sont pas des mariages de complaisance et, a fortiori, des mariages forcés. C'est la grande majorité des cas, bien heureusement.
Dans les cas contraires, des actions de prévention et d'information sont indispensables afin de travailler plus efficacement sur les causes des mariages blancs où le conjoint de bonne foi se fait avoir, mais aussi dans le but d'aider les jeunes femmes confrontées à un mariage forcé. A cet égard, pas d'amalgame ou de stigmatisation d'une communauté, d'une culture en particulier ou d'une religion. Je souhaite fermement le rappeler devant cette assemblée.

Trafficking in human beings and human trafficking are realities experienced in Europe and Belgium. Unacceptable realities as human dramas are important and require the intervention of public authorities.
Our legislation has already equipped itself with important repressive means to combat these plagues, on the one hand, in the Criminal Code with articles 433quinquies to 433quinquies and, on the other hand, with the recent adoption, in the 1980 law on the administrative status of foreigners articles 77, 77bis to 77quinquies. These last provisions have been in force since August 2005.
Article 77bis of the Act of 1980 stipulates that “constitute the offence of trafficking in human beings, the fact of contributing, in any way whatsoever, either directly or by intermediary, to allow the entry, transit or stay of a person not a national of a Member State of the European Union, in violation of the legislation of that State, in order to obtain, directly or indirectly, a patrimonial advantage”.
As the State Council pointed out in its opinion on the draft law that concerns us, this provision already allows to sanction marriages of complacency monetized in order to allow the obtaining of a right of residence.
This offence is punished with imprisonment from one year to three years. This penalty is heavily heightened when the offence "was committed by using, directly or indirectly, fraudulent manoeuvres, violence, threats or any form of coercion". In this case, the law establishes the offence as a crime punishable by imprisonment from ten to fifteen years. The law concerns forced marriage.
Attempts to commit such offences are also punished.
The draft law that you propose to us, Mr. Minister, comes in overprint of the current provisions. In fact, Article 79bis in the draft will punish "anyone who concludes a marriage in the circumstances referred to in Article 146bis of the Civil Code". This offence will be punished with imprisonment from eight days to three months. The penalty will be heavier in case of monetary marriage and in case of forced marriage. Attempts to commit such crimes will also be punished.
My concern, our concern is to ensure the correct application of the legal provisions aimed at combating human trafficking. You know that some enjoy using all arguments, including those of possible confusion of legal provisions, to avoid being condemned.
I would like you to provide certainty in this area. It is clear that the new provisions, which we will vote on today, will apply without prejudice to existing legal provisions, including:
- the assurance that the repressive judge will apply the heaviest punishment when the same fact is prosecuted for several offences, i.e. those provided for in Articles 77, 77bis and the new provision of the future Article 79bis of your project;
- the assurance that in the case of "simple white marriage", the spouse "who believed in good faith" or who acted "for purely humanitarian reasons" will not be disturbed.
There are complacency marriages, forced marriages to allow persons to have a right of residence in Europe. This is human trafficking and these marriages must be repressed. Behind them, there are usually mafia chains linked to prostitution, to black work. We have long talked about this during the adoption of the Law on Trafficking and Trafficking in Human Beings. To paraphrase the words of philosopher Guy Haarscher, “We must recognize the responsibility of our rulers in the basic protection of their citizens against crime, support them in this enterprise while remaining vigilant about possible deviations.” He called it “critical vigilance.” Our support and our critical vigilance with regard to your bill, Mr. Minister, is to remind some tags. Thus, we hope that these new provisions of the future article 79bis of the 1980 Act will constitute useful elements for improving the current provisions deterring complacency marriages. Finally, a repression against human trafficking through complacency marriages must be carried out in respect of the right to family reunification and the diverse cultures of our fellow citizens. It is obvious that all marriages with a foreign national are not marriages of complacency and, a fortiori, forced marriages. This is the vast majority of cases, fortunately.
Otherwise, prevention and information actions are indispensable in order to work more effectively on the causes of white marriages in which the good-faith spouse is made to have, but also in order to help young women facing forced marriages. In this regard, there is no amalgamation or stigmatisation of a community, a particular culture or a particular religion. I would like to strongly recall this before this Assembly.

Collega's, als het stelsel van het huwelijk wordt misbruikt — het gaat immers over schijnhuwelijken — om in België te kunnen verblijven, wordt natuurlijk ook de partner misbruikt, met alle gevolgen vandien. Mevrouw Nagy, veelal vrouwen werden maanden na elkaar door hun partner voor de aap gehouden. Ik heb het dan onder andere over mevrouw Nagy maar ook over mevrouw Belhouari. Ik was daarover verwonderd. Het gaat in de meeste gevallen immers over vrouwen die het slachtoffer zijn van voornoemde problematiek.
Mijnheer de minister, wij steunen u dus in uw aanpak van de misbruiken, ook de misbruiken inzake de asielproblematiek. Wij zijn blij dat u de asielprocedure verstrengt en dat u ook een gedegen terugwijzingsbeleid ontwikkelt.
Wij zijn ook heel verheugd — wij hebben er vandaag heel weinig over gehoord — over uw aangekondigde maatregelen inzake gezins- en familiehereniging. Wij zullen nog de kans krijgen over deze maatregelen te debatteren. De leeftijdsvoorwaarde van 21 jaar om te herenigen en het verlengen van de wachttijd zijn toch wel belangrijke punten om een definitieve verblijfsvergunning te verkrijgen en om beter te kunnen nagaan of het huwelijk wel met de juiste bedoelingen werd gesloten. In het geval van ascendenten is er de verplichting om financieel voor hen in te staan. Dat zijn stuk voor stuk goede maatregelen.
Mijnheer De Man, het hoofdargument van het Vlaams Belang om het voorliggende ontwerp niet goed te keuren, was dat het te weinig was. De minister kondigt nu echter toch een aantal maatregelen aan die u tegemoetkomen. Ik kijk dus nieuwsgierig uit naar uw stemgedrag.
Wij zijn natuurlijk ook voorstander van het voorstel om personen te bestraffen die een schijnhuwelijk sluiten of een bepaalde rol spelen in het sluiten van een schijnhuwelijk. Mevrouw Lanjri, het is duidelijk dat de bestraffing, naast boetes en gevangenisstraffen, ook het afnemen van het verblijfsrecht moet inhouden. Daarover was enige discussie in de commissie. De minister heeft echter heel duidelijk verklaard dat de DVZ, de Dienst voor Vreemdelingenzaken, altijd zal overgaan tot de intrekking van de verblijfsvergunning. Het probleem is dus, wat mij betreft, opgelost.
Ten slotte komt te weinig aan bod dat wij ook oog moeten hebben voor het preventief karakter van dit wetsontwerp. In de toekomst zullen er, denk ik, veel minder schijnhuwelijken ontstaan in dit land.
Mijnheer de voorzitter, de VLD-fractie is zeer tevreden met het voorliggend wetsontwerp. Wij zijn tevreden omdat wij met onze fractie ook talloze parlementaire vragen hebben gesteld, interpellaties hebben gehouden en wetsvoorstellen hebben ingediend — voor alle duidelijkheid: samen met andere partijen — in het belang van de vele slachtoffers die momenteel toch een beetje in de kou blijven staan.

J'ai fait état en commission de quelques cas concrets et je crois que l'on ne peut rester insensible face à ce véritable détournement de nos procédures d'immigration. Le phénomène prend de l'ampleur. Il était temps de renforcer notre arsenal légal.
Vous l'avez rappelé, monsieur le ministre, l'accord de gouvernement prévoit explicitement qu'en général, la lutte contre les abus des procédures d'immigration, en particulier la lutte contre les mariages blancs et la fraude en matière de regroupement familial doit être intensifiée. Force est de constater que, de plus en plus, des mariages sont contractés dans l'unique but d'acquérir un avantage sur le plan du séjour qui découle du statut de conjoint et non plus pour créer une communauté de vie durable. Il est dès lors essentiel d'enrayer cette tendance néfaste.
J'ai pris bonne note d'un certain nombre d'initiatives concrètes qui ont déjà été prises. Je pense notamment à la fameuse circulaire du 13 septembre 2005, qui met en place une collaboration efficace entre les fonctionnaires de l'état civil et l'Office des étrangers. Cette circulaire était attendue. Cette collaboration permettra aux fonctionnaires de l'état civil de disposer d'informations concrètes et complètes relatives aux étrangers qui souhaitent contracter un mariage durant leur séjour illégal.
Il est entendu qu'il fallait aller plus loin. Le pas effectué aujourd'hui va, à mon avis, dans le bon sens. L'idée est de cibler clairement et fortement ceux qui tirent un profit direct du mariage factice et de protéger aussi ceux qui en sont victimes.
Tout d'abord, le projet prévoit une sanction lorsqu'un mariage est conclu dans le seul but de conférer un droit de séjour à l'un des conjoints. En vertu de cette disposition, les deux partenaires, c'est-àdire à la fois celui qui poursuit un avantage en matière de séjour et la personne qui lui prête assistance dans ce cadre, peuvent et doivent être sanctionnés. La peine prévue est un emprisonnement de huit jours à trois mois ou une amende.
La deuxième hypothèse vise la situation dans laquelle le partenaire résidant légalement dans le Royaume reçoit une somme d'argent pour contracter un mariage de complaisance. La personne qui exerce la contrainte peut donc être l'étranger qui acquiert un avantage en matière de séjour par le biais du mariage de complaisance, mais aussi un tiers, par exemple un parent qui contraint son enfant à contracter mariage dans le seul but de voir accorder un droit de séjour à un étranger. En l'occurrence, la peine prévue est un emprisonnement d'un mois à deux ans ou une amende.
En commission, vous l'avez confirmé, votre intention n'est nullement d'en arriver à punir les victimes de mariages de complaisance. Les dispositions en projet s'appliquent uniquement à la personne qui n'avait manifestement pas pour objectif de s'engager dans une relation durable. Il m'a intéressé également de comprendre en quoi le projet à l'examen avait ou non un effet sur le retrait du droit de séjour. Je pense pouvoir être rassurée par votre réponse mais je voudrais quand même y revenir aujourd'hui. Vous avez dit, et Mme Galant l'a résumé, qu'il fallait distinguer deux hypothèses.
D'une part, il y a bien sûr l'annulation civile. Comme celle-ci s'applique avec effet rétroactif, cela signifie que le titre de séjour obtenu en raison du mariage est lui aussi annulé. Mais il ne fallait pas négliger que l'étranger pouvait également être autorisé à séjourner en Belgique pour d'autres motifs.
D'autre part, les mesures projetées que la condamnation, prononcée par le juge pénal et passée en force de chose jugée, d'un mariage dont le seul objet est d'obtenir un titre de séjour, entraîne également la perte de ce titre.
Je comprends bien la logique et l'intérêt de la nouvelle voie pénale mais je ne peux m'empêcher, monsieur le ministre, de penser que, dans la pratique, compte tenu du fait que l'annulation civile peut parfois prendre plusieurs années, il restera un nombre de cas de figure plus ou moins important où l'étranger obtiendra néanmoins ce qu'il veut, soit un droit de séjour sur base du mariage, ce qui est assez délicat. Certes, le mariage et le droit pourront être annulés mais, dans l'attente, un long, et parfois très long délai se sera écoulé, offrant à l'intéressé toute une liste de procédures de régularisation qui lui permettra peut-être de contourner ces initiatives. En d'autres termes, je crois que c'est aussi et avant tout contre le temps que nous devons lutter sur ce type de contentieux.
Il me revient à ce sujet qu'un autre projet de loi est en voie de finalisation. Je pense que ce dernier pourra permettre de contrôler pendant une période plus longue les personnes qui ont obtenu un droit de séjour suite à un mariage. S'il y a abus de l'institution du mariage, il devrait être enfin possible de mettre fin, après une période plus longue, au droit de séjour acquis abusivement.
Je crois aussi que la nouvelle procédure d'asile, pour laquelle vous venez d'obtenir tout récemment un accord au sein du gouvernement, devra permettre de resserrer le timing des différentes étapes par lesquelles doivent passer les candidats. Nous soutenons cette logique, elle intéresse l'ordre public qui ne peut être dévoyé par l'inertie administrative. Elle intéresse également l'étranger qui reçoit bien sûr plus vite une décision définitive sur son statut.
Nous serons très attentifs aux suites de ce dossier dans les prochaines semaines.

This collaboration will allow civil status officials to have concrete and comprehensive information about foreigners who wish to enter into a marriage during their illegal stay.
It is clear that we had to go further. The step taken today is, in my opinion, going in the right direction. The idea is to target clearly and strongly those who make direct profits from fake marriage and to protect those who are victims of it.
First, the draft provides for a penalty when a marriage is concluded with the sole purpose of granting a right of residence to one of the spouses. Under this provision, both partners, i.e. both the person seeking a stay benefit and the person assisting him in this context, can and must be punished. The penalty is imprisonment from eight days to three months or a fine.
The second hypothesis concerns the situation in which the partner legally residing in the Kingdom receives a sum of money to enter into a marriage of complacency. In case of cancellation of this marriage, the alleged partner will be obliged to leave our territory. Often the person who has acquired a financial advantage is not punished. By providing for a separate and more severe penalty for the person who wishes to get rich through the complacency marriage, the draft under consideration, however, fills the gap in our legislation. The punishment is imprisonment from fifteen days to one year or a fine. Finally, the project considers the situation in which a person forces one of the partners to contract a white marriage. It should be noted that, in this hypothesis, any person who compels another to enter into marriage in order to give rise to a stay advantage in favor of one of the partners, can be punished.
The person who exercises the coercion can therefore be the foreigner who acquires a stay advantage through the complacency marriage, but also a third party, for example a parent who compels his child to enter into marriage solely for the purpose of being granted a right of residence to a foreigner. In this case, the penalty is a prison sentence of one month to two years or a fine. by

In this regard, another bill is being finalised. I think the latter will be able to allow for longer periods of control of persons who have obtained a right of residence following a marriage. If there is abuse of the institution of marriage, it should finally be possible to end, after a longer period, the right of residence acquired abusively. by
I also believe that the new asylum procedure, for which you have recently obtained an agreement within the government, must allow to tighten the timing of the different stages through which applicants must go. Men zou kunnen zeggen dat het toe te juichen valt dat schijnhuwelijken eindelijk worden aangepakt. Voor het Vlaams Belang gaat de regering evenwel niet ver genoeg. Bovendien wordt aan het systeem van de gezinshereniging helemaal niet getornd. Minister Dewael doet niet meer of niet minder dan een lege doos voorstellen als een grote verwezenlijking.
Het dossier is nochtans ernstig genoeg om krachtige maatregelen te nemen. In dit land worden jaarlijks vele duizenden schijnhuwelijken gesloten. Alleen het parket van Brussel kreeg vorig jaar 1776 dossiers binnen. Het aantal gezinsherenigingen — men zou veeleer van gezinsvormingen moeten spreken — die hier moeten plaatsvinden omwille van de gulle sociale voorzieningen, bedraagt ongeveer 30.000.
De VLD heeft er veel voor over om toch minstens te mogen doen alsof ze dit aspect van het immigratieprobleem zal aanpakken. Daarom kregen ze van de PS de toestemming om een ongevaarlijk nummertje op te voeren. Waarom zeg ik ongevaarlijk nummertje? De heer Dewael gaat er zelfs niet mee akkoord om in de wet in te schrijven dat wie zich schuldig maakt aan een schijnhuwelijk meteen en automatisch zijn verblijfsrecht verliest. Zoals veelal de laatste jaren ging dit te ver voor de socialistische coalitiepartners. Dat is de waarheid. Daarom staat het verlies van verblijfsrecht niet in de tekst.
Wat krijgt de burger voorgeschoteld? Hij krijgt een wet die in het beste geval slechts een kleine fractie van de problemen zal aanpakken, een wet waarbij de voorziene straffen niet echt afschrikwekkend zijn — zeker als men weet welke grote bedragen gepaard gaan met de organisatie van schijnhuwelijken, dikwijls vele duizenden euro — een wet die niets vermag tegen schijnhuwelijken die in het buitenland aangegaan worden en vooral — ik herhaal het — een wet die niet stipuleert dat precies datgene wat men beoogt door een schijnhuwelijk, in casu het recht om in dit land van melk en honing te verblijven, zou worden afgenomen na veroordeling.
Het amendement over de automatische afname van de verblijfsvergunning is expliciet verworpen door de minister. Hij beweert dat de parketten hun taak wel zullen opnemen. Ik heb zo mijn twijfels. In de commissie verklaarde de minister dat het verblijfsrecht kan worden afgenomen, de overheid kan optreden tegen een allochtoon na een schijnhuwelijk en justitie kan optreden tegen een nieuwe Belg na een schijnhuwelijk. Het gerecht wordt niet expliciet verplicht om iets te doen.
Mijnheer de minister, u wist ons ook te melden dat een vreemdeling die een poging deed via schijnhuwelijk, ook op andere wijze die verblijfsvergunning kan opbouwen.
Als een lepe allochtoon na een schijnhuwelijk lang genoeg in het land kan blijven door de procedure te laten aanslepen, kan hij in het land der Belgen natuurlijk nog steeds asiel aanvragen. Hij kan dan een beroep doen op artikel 9.3 en humanitaire redenen inroepen. Hij of zij kan dan stellen dat er hier familiale banden of andere vriendschapsbanden bestaan.
Collega's van de VLD, als men er zelfs niet in slaagt om voor veel ergere feiten een vreemdeling het land uit te zetten, hoe zou men dat dan kunnen doen voor een die gepakt is na een schijnhuwelijk?
Mijnheer de minister, ik heb u trouwens gevraagd van hoeveel huwelijksbedriegers in de voorbije jaren de verblijfstitel en/of naturalisatie werd afgenomen. Collega's, er kwam geen antwoord.
Ten slotte merk ik op dat de echte patroons van de meerderheid, de PS'ers, in de commissie lieten weten dat de gearrangeerde huwelijken zeker niet onder de toepassing vallen van de wet. Als bijvoorbeeld een Marokkaanse die hier verblijft, onder familiale druk en om puur sociaal-economische redenen trouwt met haar neef, dan moet dat voor de PS kunnen. Het Vlaams Belang is het daarmee, zoals bekend, niet eens. Ik geef nog een ander voorbeeld. Als een Turk per se wil trouwen met een van zijn vele nichten uit zijn geboortedorp, dan moet hij dat doen in Turkije en ginder genieten van zijn prille huwelijksgenot en niet hier.
Die gearrangeerde huwelijken worden dus in het wetsontwerp ongemoeid gelaten. In de meeste gevallen gaat het eigenlijk om gedwongen huwelijken waarbij de familie een van de partners bedreigt, dwingt, betaalt. Het is natuurlijk zeer moeilijk om in die gevallen aan te tonen dat een of zelfs beide echtelieden door omstandigheden gedwongen worden om te trouwen, maar in feite alleen maar formeel trouwen omwille van de vele voordelen die ze hier kunnen genieten.
Ten slotte is het voor het Vlaams Belang hoe dan ook zo dat zelfs de normale importhuwelijken grote maatschappelijke problemen veroorzaken. Ik ben niet de eerste die zegt dat het telkens opnieuw invoeren van partners uit Anatolië of het Rifgebergte de zo geprezen integratie in feite onmogelijk maakt, dat men dan in feite opnieuw van nul moet beginnen, telkens weer. Wanneer ik dat zeg, dan zal ik natuurlijk wel een racist zijn.
Het blijkt dus dat voor de nieuwe kiezers van de socialisten geen inspanning te veel is, geen inspanning te groot is en dat, wanneer het over hen gaat, de VLD zeker niet te veel hoeft te piepen. Zij gaat onderhavige wet, zoals zovele andere trouwens, goedkeuren, maar naar de buitenwereld wel doen alsof ze het vreemdelingenprobleem aanpakt.
Kortom collega's, aan de grond van heel de problematiek — het recht op gezinshereniging of gezinsvorming — wordt tot nader order niets gedaan. Het is volstrekt onvoldoende om schijnhuwelijken in theorie strafbaar te stellen zonder automatisch te voorzien in de afname van het verblijfsrecht. Het Vlaams Belang zal derhalve met overtuiging tegenstemmen.

Monsieur le président, monsieur le ministre, je commencerai mon intervention en remerciant notre excellente collègue, Mme Galant, pour son rapport assez complet.
Je voudrais également rappeler au ministre un engagement qu'il n'a pas tenu et qui figure pourtant dans le rapport. En effet, monsieur le ministre, vous deviez transmettre à la commission le texte de la circulaire du 13 septembre 2005. Nous serions donc heureux si pouviez nous faire parvenir ce document.
Monsieur le ministre, comme stipulé dans le rapport, mon groupe ne soutiendra pas ce projet de loi. En effet, comme l'a signalé le Conseil d'Etat, les objectifs poursuivis ne sont pas toujours extrêmement clairs. Trois législations vont se superposer: la loi de 1980 qui punit déjà les mariages de complaisance, la loi sur la traite des êtres humains qui n'est entrée en vigueur qu'au mois d'août de cette année, et la nouvelle procédure qui sera bientôt soumise à notre vote. Comme cela a été dit lors des interventions, la manière dont ces trois législations seront appliquées n'est pas tout à fait claire, ce même après les explications et les débats en commission en présence du ministre.
A part ses aspects légaux, l'objectif principal de cette loi semble être, une nouvelle fois, de donner une mauvaise image des étrangers, de les criminaliser, de les stigmatiser et de laisser croire, monsieur Anthuenis, qu'ils sont les seuls responsables de la souffrance des autres. Selon moi, si tel n'est pas le principal but de cette législation, c'est en tout cas son principal résultat. On fait à nouveau apparaître les étrangers comme étant ceux — et le discours de mon prédécesseur à cette tribune en est la preuve — qui ne cherchent qu'à tricher, frauder et profiter. Il existe effectivement probablement, parmi les étrangers, des tricheurs, des fraudeurs et des profiteurs. Mais à force de faire figurer ces caractéristiques dans vos législations, vous finissez par rendre un mauvais service à la Belgique.
La réalité belge est multiculturelle! La Belgique s'inscrit dans un contexte européen et ne peut faire fi du monde dans lequel elle existe! C'est une erreur fondamentale que d'agir ainsi!
Ensuite, je constate un amalgame de toutes les dispositions. Je connais des gens, de mon âge, qui sont venus au monde grâce au fait que leurs parents, entre les deux guerres ou après guerre, ont eu quelqu'un en Belgique qui les a accueillis, parfois par un mariage que vous appelez aujourd'hui mariage de complaisance. Vous devez savoir que ce type de mariage est également contracté pour des raisons humanitaires. Il n'est pas question de tromper l'un ou l'autre.
Je suis tout à fait d'accord sur le fait que l'officier de l'état civil qui découvre la chose doit jouer son rôle. Néanmoins, j'aimerais qu'on distingue les situations et qu'on ne fasse pas l'amalgame entre celui qui contracte un mariage de complaisance pour des raisons financières et celui qui en contracte un pour de tout autres raisons, qui lui sont propres. Je condamne fermement les mariages contre rétribution. Cette matière est d'ailleurs un immense champ de bataille pour l'autorité publique. Néanmoins, comment faire la différence entre la législation relative aux mariages contre rétribution et celle sur la traite des êtres humains?
Monsieur le ministre, le Conseil d'Etat a attiré votre attention sur cette question et vous a d'ailleurs indiqué que les dispositions des articles 77bis, 77ter et 77quater de la loi du 15 décembre 1980 concernent la lutte contre le trafic des êtres humains. On rencontre des situations — je ne vais pas les détailler car M. le président ne m'en laissera pas le temps — où la législation pourrait déjà être appliquée. Je ne conteste donc pas l'importance de lutter contre ceux qui veulent s'enrichir en échange d'un titre de séjour ou qui organisent des filières mafieuses ou autres dans ce but.
La question du mariage forcé se pose également.
Monsieur le ministre, vous rendez-vous compte que vous êtes en train de faire un amalgame entre les mariages forcés, les mariages de complaisance sans rétribution et les mariages contre rétribution, voire dans un but de traite des êtres humains? Certains refusent, par principe, le mariage forcé — c'est mon cas, je pense qu'on ne peut forcer personne à se marier contre son gré — mais certaines institutions et certains représentants attirent l'attention sur le fait que ces questions doivent être abordées en tenant compte d'autres éléments. Il faut agir avec intelligence et respect. Si l'on met tout dans le même paquet, comme vous le faites, on risque de faire fausse route.
Je conclus. Monsieur le ministre, chers collègues, nous voterons contre ce projet. Vous avez entendu le collègue du Vlaams Belang: la bête affamée n'est jamais repue; elle trouve que le projet ne va pas assez loin. Vous irez de plus en plus loin dans la répression, dans la stigmatisation des étrangers! Eux, ils ne seront jamais contents! Ils vous pousseront de plus en plus à aller plus loin!
Il n'y a pas de fin à ce processus. Vous entrez dans une logique de répression, d'exclusion. Ils ne seront jamais satisfaits. Vous leur donnerez toujours des raisons de continuer à exister.
C'est une véritable mise en garde que je fais. Je le pense très profondément.
De plus, la criminalisation et la culpabilisation dans l'amalgame n'est pas une notion claire. La confusion dans les législations n'est pas une bonne chose. Je m'en réfère à l'avis du Conseil d'Etat; il ne s'agit pas seulement de mon humble avis.
Monsieur le président, chers collègues, voilà les raisons d'un refus catégorique à ce projet.

I know people, of my age, who came into the world because their parents, between the two wars or after the war, had someone in Belgium who welcomed them, sometimes through a marriage you now call a marriage of complacency. You should know that this type of marriage is also contracted for humanitarian reasons. There is no question of deceiving one or the other.
I totally agree that the civil state officer who discovers the thing must play his role. I strongly condemn marriage against remuneration. This issue is an immense battlefield for public authority. Nevertheless, how can we distinguish between the legislation on remuneration marriages and that on human trafficking?
Mr. Minister, the Council of State has drawn your attention to this question and has also indicated that the provisions of articles 77bis, 77ter and 77quater of the law of 15 December 1980 concern the fight against human trafficking. Mijnheer de voorzitter, ik wil een misverstand uit de wereld helpen. Ik hoor de voorlaatste spreker zeggen dat de socialistische coalitiepartners dwars zouden liggen in de strijd tegen schijnhuwelijken. Niets is minder waar wat onze partij betreft, mijnheer de minister. Ik denk dat ik niemand moet overtuigen wat de argumenten betreft: voorgaande sprekers hebben dit voldoende geïllustreerd. Het is effectief zo dat een minderheid waarvan niemand weet hoe groot of klein ze is, misbruik maakt van bestaande rechten inzake huwelijk en effectief schijnhuwelijken sluit. In mijn omgeving zie ik dat dit meestal gepaard gaat met grof geldgewin en dus een vorm van mensenhandel voor veel geld. Een tweede vaststelling op het terrein, is dat dit zeer vaak aanleiding geeft tot grote sociale ellende. Het gaat dan over gedumpte mensen die te goeder trouw werden misbruikt en in de miserie eindigen. Daarom steunen onze fractie en onze partij u, mijnheer de minister, volmondig met het voorliggende ontwerp.
Ik voeg daar nog iets aan toe dat ook uitlegt waarom ik heb gevraagd om mijn voorstel los te koppelen van het ontwerp. Ik denk dat er nog veel kan en moet gebeuren om dit moeilijke probleem efficiënt aan te pakken. Mijn in de Kamer ingediend voorstel waarover ik u nog heb aangesproken bij een vraag, is juist om de controleperiode voor een schijnhuwelijk van een jaar naar drie jaar te brengen. Ik heb begrepen en waardeer dat de regering gisteren of eergisteren heeft besloten om effectief een periode van drie jaar in plaats van een jaar in acht te nemen alvorens de definitieve verblijfspapieren toe te kennen. Samen met de twee andere maatregelen waartoe de regering heeft beslist, hebben we hiermee een instrumentarium in handen om dit probleem efficiënt te lijf te gaan.
U weet dat ik altijd nogal kritisch ben. Ik wil eindigen met een bedenking. Dit is een bijzonder delicaat probleem, omdat het om een minderheid gaat. Ik stel bij herhaling vast dat telkens men spreekt over schijnhuwelijken, dit bijzonder gemakkelijk wordt veralgemeend of wordt misbruikt, ook inzake wat de regering en de politici daarin willen doen. Ik suggereer dan ook dat de regering haar terecht genomen maatregelen in aanvulling op dit ontwerp dat wij steunen, zeer snel tot stand zou brengen. Hierover beslissen lijkt mij veel belangrijker dan hierover veel communiceren.

Wij zijn het er 100% mee eens dat de strafbaarstelling van het misbruik van het huwelijk zich opdringt. Wij zijn ervan overtuigd dat er echter aardig nog wat werk aan de winkel is, ook als het voorliggende wetsontwerp het haalt, want in de praktijk stellen wij vast dat het recht op gezinshereniging vaak ernstig wordt misbruikt.
Het voorstel, als amendement op het wetsontwerp, van de collega's Lanjri, Claes en Schryvers heeft oog voor de slachtoffers van schijnhuwelijken en brengt de straffen voor wie een schijnhuwelijk aangaat op het niveau van de straffen voor wie aan mensenhandel en mensensmokkel doen of wie aan huisjesmelkerij doen. Een schijnhuwelijk is ook vaak een verkapte vorm van mensenhandel en bij huisjesmelkers worden soms praktijken vastgesteld van hulp aan schijnhuwelijken. Zo zijn zij uiteraard verzekerd van een blijvend huurderbestand.
Het wetsontwerp zelf is voor NV-A niet verregaand genoeg. In de plaats van ook het fenomeen gezinsstichting aan te pakken, staart men zich blind op de problematiek van de schijnhuwelijken alleen. Het is dus nodig dat er in een bijkomende specifieke wettelijke basis wordt voorzien om ook aan die andere problematiek iets te gaan doen. Bijvoorbeeld: iemand die hier legaal verblijft, keert terug naar zijn of haar vaderland, kiest daar een partner en huwt ermee, en brengt die dan mee naar hier. Vaak volgt na enkele jaren een scheiding, waarna een en ander opnieuw begint, dit keer met de twee reeds in België verblijvende partijen die een nieuwe partner gaan zoeken, enzovoort.
Wij vinden dat een beter toezicht op de periode na het verbreken van het huwelijk aangewezen is. Het verblijfsrechtelijk voordeel zou moeten kunnen worden ontnomen zo snel mogelijk na het verbreken van het huwelijk zo dat een schijnhuwelijk blijkt te zijn. Anders is het risico te groot dat die mensen plots gaan verdwijnen in vaak illegale circuits.
Het voorstel dat de collega's Lanjri, Claes en Schryvers als amendement op het wetsontwerp doen om het verblijfsrechtelijk voordeel te ontnemen aan wie veroordeeld worden voor het aangaan van een schijnhuwelijk is dus goed, maar er moet over gewaakt worden dat die veroordeling er snel komt en dat de ontneming van het verblijfsrechtelijk voordeel dat aan het schijnhuwelijk verbonden was er eveneens heel snel kan komen.
NV-A vindt ook dat de strafmaten waarin in het voorliggende wetsontwerp voorzien is te licht zijn. Voor ons zijn zwaardere strafmaten wenselijk. Wij zijn ook voorstander van het opdrijven van de middelen voor preventie en ontrading.
Los van de scheiding der machten kan men toch de bedenking maken dat er alleszins nood is aan een eenduidige interpretatie van de wet door de verschillende parketten. Bij gebreke daaraan zal er anders in sommige arrondissementen een toevloed komen van schijnhuwelijken, terwijl er in andere arrondissementen met strenger optredende procureurs, aan het geheel een halt zal worden toegeroepen.
Mijnheer de minister, dit ontwerp bevat dus een aantal goede elementen. Het geeft een aanzet en ik zal het dan ook steunen, ook al vind ik dat het op sommige punten niet ver genoeg gaat.

NV-A also considers that the penalties provided in the present bill are too light. For us, heavier penalties are desirable. We are also in favor of increasing the resources for prevention and eviction.

Mijnheer de voorzitter, ik wil, ten eerste, even duidelijk maken dat strafbaarstelling van schijnhuwelijken een van de instrumenten is. Dit past in een pakket van maatregelen waarop onder meer collega Bonte heeft geïnsisteerd. Ik blijf uiteraard binnen mijn bevoegdheid. De eerste maatregel die ik genomen heb, is een verbetering van de communicatie tussen de schepenen van de burgerlijke stand en de Dienst Vreemdelingenzaken. Ik meen dat het belangrijk is, gezien de inspanningen die in de steden gebeuren inzake het oprichten van cellen ter bestrijding van schijnhuwelijken, dat men de expertise en de wetenschap die men opdoet in een gemeente ook vlot kan communiceren naar andere steden en gemeenten en de Dienst Vreemdelingenzaken.
Ten tweede, wat ook binnen mijn bevoegdheid valt, is het pakket maatregelen, voortvloeiend uit de Europese richtlijn, op het vlak van gezinsvorming en gezinshereniging. Collega De Groote dringt daarop aan, maar daarover heeft de kern eergisterenavond beslissingen genomen. Het gaat dan om de langere controleperiode waarbinnen de waarachtigheid van het huwelijk kan worden nagegaan en om strengere preventieve voorwaarden, maar ik stel voor, zoals de commissie heeft geoordeeld, dat wij dat debat voeren op het ogenblik dat ik het pakket van maatregelen voorleg die allemaal zullen ingrijpen in de wet van 1980. Het strafbaar stellen van het schijnhuwelijk, het verbeteren van de communicatie en het implementeren van de Europese richtlijn maken echter wel degelijk een geheel uit.
Er zijn aspecten die verbonden zijn aan de bevoegdheid van mijn collega van Justitie. Er is een amendement van CD&V dat daarop aanstuurt, met name de aanpassing van de nationaliteitswet, in die zin dat als het gaat om een schijnhuwelijk, de nationaliteit automatisch zou moeten vervallen. Met alle respect, maar dit behoort tot de bevoegdheid van mijn collega, de minister van Justitie en dat moet zijn beslag krijgen in de commissie voor de Justitie van de Kamer.
De regering besliste wel al het Burgerlijk Wetboek aan te passen. Bij verhuis wordt het dossier van de ambtenaar van de burgerlijke stand bezorgd aan zijn collega in de andere gemeente. Dat is een automatisme. Het is de bevoegdheid van collega Onkelinx. Ook dat werd reeds beslist door de Ministerraad.
Wat de strafmaat betreft, is het te zacht of te hard? Ik heb verschillende klokken horen luiden. Het is een getrapt systeem: het gewone schijnhuwelijk, het huwelijk tegen betaling, waarvoor geld betaald wordt — dat zijn praktijken die helaas bestaan — en het gedwongen huwelijk.
De strafmaat gaat in gradaties. Ik zou aan collega Lanjri willen zeggen dat wij daarover op een constructieve manier van gedachten hebben gewisseld. Ik heb verwezen naar een aantal wetsvoorstellen die in de Senaat door CD&V en ook door de sp.a zijn ingediend. Daarin is de strafmaat helemaal vergelijkbaar met wat wij voorzien in het voorliggend ontwerp.
Ik weet dat er voor collega Belhouari een probleem rees in verband met de verzwaringen die er onlangs zijn gekomen in verband met mensensmokkel en mensenhandel en die ook in de wet van 1980 terug te vinden zijn. De vraag was of we nu geen tweemaal hetzelfde aan het doen zijn. Kunnen we nu nog wel mensen gaan bestraffen voor mensensmokkel en mensenhandel? Wat als er een samenloop is? Ik heb in de commissie verduidelijkt — en dat ik wil ik nu nog eens doen — dat artikel 65 van het Strafwetboek heel duidelijk bepaalt dat wanneer er samenloop is alleen de zwaarste straf wordt uitgesproken. Er zullen helaas echter gevallen zijn van schijnhuwelijken waarbij men effectief niet beantwoordt aan de kwalificatie van mensenhandel en mensensmokkel. Die moeten echter ook bestraft kunnen worden. Het kan gaan om gevallen waarin de twee samenlopen. Als er samenloop is, dan zal de procureur die twee in zijn vordering ook samenbrengen. Dan weet de strafrechter wat te doen in zo'n geval. Daar is dus geen conflict of concurrentie tussen beide kwalificaties.
Wie wordt er bestraft? Dat is ook een van de zaken die ik in de commissie duidelijk heb gesteld. Uiteraard kan alleen degene die aan de basis ligt van het schijnhuwelijk, met onoprechte bedoelingen, met de bedoeling alleen een verblijfsrechtelijk voordeel te krijgen en niet het slachtoffer worden bestraft.
Een laatste zaak, voorzitter, collega's, lijkt mij fundamenteel te zijn. Collega De Man gaat uiteraard verder op die lijn. We kennen zijn bedoeling. Hij wil niet horen wat ik gezegd heb. Als een correctionele rechter in de toekomst zal vaststellen dat er sprake is van een schijnhuwelijk en hij dus een veroordeling zal uitspreken, dan heeft dit automatisch tot gevolg dat er een einde wordt gemaakt aan het verblijfsrecht. Er is dus wel degelijk een verband. De straf wordt uitgesproken en mijn diensten zullen op dat ogenblik, op basis van die correctionele uitspraak, automatisch een einde maken aan het verblijfsrecht.
Dat doet natuurlijk geen afbreuk aan de burgerlijke aspecten van de zaak. Als een burgerlijke rechter het huwelijk vernietigt, dan werkt die vernietiging natuurlijk ook ex tunc en dan zullen het huwelijk en de rechten die daaruit voortvloeien geacht worden nooit te hebben bestaan. Er zijn dus twee aspecten. Ten eerste zijn er de burgerrechtelijke aspecten. Men kan altijd burgerrechtelijk de vernietiging van een huwelijk vragen. Dat geldt voor de toekomst. Nu komt er echter een instrument bij. Als er een correctionele veroordeling tussenkomt, dan leidt dit automatisch ook tot het verlies van het verblijfsrecht.
Ik denk dat deze maatregel een evenwichtige maatregel is, mijnheer de voorzitter, waarbij de regering verder uitvoering geeft aan het vreemdelingenbeleid dat humaan is maar correct wil zijn en dat er dus op gericht is allerlei misbruiken ook effectief te bestraffen.

I know that for colleague Belhouari a problem arose in connection with the recent aggravations in connection with human trafficking and human trafficking, which are also reflected in the 1980 Act. One last point, my colleagues, seems to me to be fundamental. The man of course continues on that line. We know his intention. He does not want to hear what I said. If, in the future, a correctional judge finds that there is a false marriage and therefore pronounces a conviction, this will automatically result in the termination of the right of residence. There is indeed a connection. The penalty will be imposed and my services will automatically terminate the right of residence at that time, based on that correctional judgment.
This, of course, does not affect the civil aspects of the case. If a civil judge destroys the marriage, then, of course, that destruction also works ex tunc, and then the marriage and the rights resulting from it will be deemed never to have existed. There are therefore two aspects. First, there are the civil rights aspects. One can always demand the destruction of a marriage by civil law. This applies to the future. Now there is an instrument. If a correctional conviction intervenes, it automatically leads to the loss of the right of residence.
I think this measure is a balanced measure, Mr. Speaker, in which the government continues to implement the foreign policy that is human but wants to be correct and that is therefore aimed at effectively punishing all kinds of abuses.
