Monsieur le président, monsieur le ministre, chers collègues, en adoptant la Déclaration du millénaire en septembre 2000, les Etats membres des Nations unies, y compris la Belgique, se sont engagés à réaliser les huit objectifs internationaux de développement et de lutte contre la pauvreté qui sont, je le rappelle: réduire l'extrême pauvreté et la faim, assurer l'éducation primaire pour tous, promouvoir l'égalité des genres et l'autonomie des femmes, réduire la mortalité infantile, améliorer la santé maternelle, combattre le VIH-sida, le paludisme ainsi que d'autres maladies, assurer un environnement durable et un accès à l'eau potable, mettre en place un partenariat mondial pour le développement.
Tous ces objectifs qui ont un lien direct ou indirect avec les droits de l'enfant et sa protection se doivent d'être accompagnés par une préoccupation particulière vis-à-vis des enfants, tant des garçons que des filles, qui ont droit à une assistance spéciale et à une aide particulière. La coopération belge au développement a, dans ses contacts avec les pays en développement, une tradition de faire la promotion pour le respect des droits humains. L'article 6 de la loi du 7 février 1994 modifiée par la loi du 17 septembre 2000 relative à l'évaluation de la coopération au développement en fonction du respect des droits de l'homme, stipule clairement que notre gouvernement doit veiller explicitement au respect des droits de l'enfant.
Il est vrai que la responsabilité en matière d'amélioration de la position de l'enfant au sein de la société relève en première instance des pays eux-mêmes. Cependant, la Belgique et les autres pays développés doivent, eux aussi, assumer leurs responsabilités dans ces domaines. La Convention sur les droits de l'enfant et le protocole relatif à l'implication des enfants dans les conflits armés qui lui est annexé constituent des instruments internationaux majeurs, des outils indispensables pour que cette lutte pour l'amélioration de la position de l'enfant dans la société soit effective.
Monsieur le président, notre résolution plaide pour une véritable prise en compte de cette convention et du protocole qui lui est annexé. Il est du devoir de la Belgique, dans le cadre de la coopération, d'agir auprès de ses différents partenaires pour que la Convention sur les droits de l'enfant et le protocole relatif à l'implication des enfants dans les conflits armés qui lui est annexé soient signés, ratifiés et mis en oeuvre.

Monsieur le président, monsieur le ministre, chers collègues, faut-il octroyer un statut d'observateur à Taiwan pour l'assemblée générale de l'Organisation Mondiale de la Santé?
La question qui revient lors de chaque réunion annuelle de l'OMS à Genève est devenue rituelle, tout comme la réponse négative qui découle du diktat de la Chine qui considère, vous le savez, l'île comme sa province, île sur laquelle sont dirigés en permanence six cents missiles, ce qui plonge une population de 23 millions d'habitants dans une paranoïa quotidienne et légitime.
L'an dernier cependant, la communauté internationale semble avoir été sensibilisée à la demande de Taiwan puisque cette dernière a été soutenue par 25 pays dont les Etats-Unis et le Japon, au risque de s'attirer les représailles économiques de la Chine; ceux qui ont voté "non" comme l'Union européenne et le Canada ont toutefois insisté pour que l'on associe l'île aux travaux de l'OMS.
Au-delà de l'aspect politique que pose le soutien à Taiwan, nous ne devons quand même pas oublier que nous nous trouvons face à une question de santé publique. Le monde ne gagne pas à maintenir Taiwan hors de l'OMS. Le fait que Taiwan ne soit pas admise à l'OMS ne compromet pas seulement la santé publique dans l'île mais représente aussi un sérieux problème pour l'ensemble de la planète.
Le danger de la mise au banc de l'île s'est vraiment révélé en 2003 au moment de la crise du SRAS. En effet, sous prétexte que Taiwan est une province de la Chine populaire, ses experts ne pouvaient pas participer aux colloques d'experts et aux décisions urgentes au sein de l'OMS. Résultat: l'île qui est un important carrefour de communications aériennes et maritimes avec la Chine a enregistré un cinquième des décès de l'épidémie et a sans doute contribué à l'exporter tous azimuts. Le fait que Pékin ait d'abord nié puis minimisé ce fléau a d'ailleurs empiré le bilan, ceci allant à l'encontre du RSI (Règlement sanitaire international) qui a pour objet d'assurer le maximum de protection contre la propagation des maladies.
L'an dernier, à nouveau, dès l'apparition de la grippe aviaire, Taiwan a été exclue des échanges à l'OMS. Pékin a généreusement offert une assistance médicale aux autorités de Taipei, ce qui fait sourire lorsque l'on compare les niveaux des infrastructures et quand on sait les progrès considérables et constatés par tous effectués par Taiwan dans le domaine de la santé.
Mes chers collègues, monsieur le président, les 23 millions de Taiwanais ont droit à un traitement équitable et égal dans le système de l'OMS dont la constitution stipule que le but de l'OMS est d'amener tous les peuples au niveau de santé le plus élevé possible. Il n'existe donc aucune justification légale, professionnelle ou éthique à l'objection de la République populaire de Chine à la participation de Taiwan, non plus que la complicité de l'OMS dans l'institutionnalisation implicite d'un apartheid sanitaire, comme il convient de l'appeler, envers les 23 millions de Taiwanais.
C'est la raison pour laquelle, monsieur le président, monsieur le ministre, j'invite mes collègues à voter en faveur de cette résolution de soutien à la demande de Taiwan quant à siéger officiellement en tant qu'observateur à l'OMS.

Should Taiwan be granted observer status for the World Health Organization General Assembly? by
The question that comes back at every annual meeting of the WHO in Geneva has become ritual, just like the negative response that arises from the dictates of China, which, you know, considers the island as its province, an island on which six hundred missiles are permanently directed, which plunges a population of 23 million in daily and legitimate paranoia.
Last year, however, the international community appears to have been sensitized to Taiwan’s demand since it was supported by 25 countries including the United States and Japan, at risk of attracting China’s economic retaliation; those who voted “no” like the European Union and Canada, however, insisted that the island be associated with WHO’s work. by
Beyond the political aspect of supporting Taiwan, we must never forget that we are facing a public health issue. The world does not benefit from keeping Taiwan out of the WHO. The fact that Taiwan is not admitted to the WHO not only compromises public health on the island but also represents a serious problem for the entire planet.
The danger of bankruptcy on the island was really revealed in 2003 at the time of the SRAS crisis. Indeed, under the pretext that Taiwan is a province of People’s China, its experts were not allowed to participate in expert councils and urgent decisions within the WHO. The result: the island, which is a major crossroads of air and maritime communications with China, recorded one-fifth of the deaths from the epidemic and probably contributed to the export of all azimuts. The fact that Beijing first denied and then minimized this plague has worsened the balance sheet, which goes against the RSI (International Health Regulation) which aims to ensure maximum protection against the spread of diseases.
Last year, once again, since the outbreak of avian influenza, Taiwan was excluded from trade with the WHO. Beijing has generously offered medical assistance to the Taipei authorities, which makes a smile when you compare the levels of infrastructure and when you know the considerable and widely seen progress made by Taiwan in the field of health. by
The 23 million Taiwanese are entitled to equal and equal treatment in the WHO system, whose constitution stipulates that the goal of the WHO is to bring all peoples to the highest possible level of health. Wat onze fractie betreft, zijn wij die resolutie gunstig gezind en willen wij net als de collega's dat Taiwan op de jaarlijkse algemene vergadering van de Wereldgezondheidsorganisatie het statuut van observator zou verwerven.
De redenen daartoe zijn natuurlijk evident.
Gelet op de explosie van het internationale handels- en personenverkeer is inderdaad het risico verhoogd van een snelle en wereldwijde verspreiding van diverse infectieziekten, zoals hiv, tuberculose en malaria. Het is in die context — niet in de politieke context van twee naties tegenover elkaar - en dus uit zorg voor de wereldgezondheid dat we er alle belang bij hebben dat Taiwan kan deelnemen aan de internationale aanpak en de strijd tegen die infectieziekten.
Het land is een belangrijke economische speler op wereldvlak en een belangrijke handelspartner van Europa, de Verenigde Staten en ook China. Het kan bogen op een capita per inwoner van circa 25.000 dollar, zijnde vijf keer meer dan het capita per inwoner in China. Het land beschikt ook over belangrijke medische infrastructuur en kennis. Dat heeft het onder meer recentelijk bewezen door zijn voorbeeldige rol, zowel op het vlak van informatieverstrekking als op het vlak van de bestrijding van de gevaarlijke SARS-epidemie.
Taiwan het statuut van observator toekennen op de algemene vergadering van de Wereldgezondheidsorganisatie, is voor ons alvast een stap in de goede richting, maar veeleer een symbolische stap die operationeel aan de bestrijding van wereldwijde epidemieën niet veel bijbrengt. Het zou natuurlijk veel beter zijn mocht Taiwan het statuut van observator krijgen in de wereldorganisatie, dat niet beperkt is tot de vergadering van 17 tot 22 mei, maar een volwaardig statuut is binnen het operationeel kader waar de regels voor de wereldgezondheid worden bepaald en toegepast op het terrein.
De boodschap van ons Parlement aan onze ministers van Volksgezondheid en Buitenlandse Zaken met het oog op de algemene vergadering van de Wereldgezondheidsorganisatie van 17 tot 22 mei, zou moeten inhouden dat zij pleiten voor een statuut van Taiwan binnen de Wereldgezondheidsorganisatie, zoals heden geldt binnen de Wereldhandelsorganisatie. Pas op die manier levert men een effectieve bijdrage aan de wereldgezondheid.
Onze motie houdt geen rekening met de evolutie van de betrekkingen tussen beide China's. Begin mei was er de belangrijke ontmoeting in Beijing tussen de Chinese autoriteiten en de Taiwanese oppositie. Daaruit is gebleken dat China een regeling zoals die op dit moment bestaat in de Wereldhandelsorganisatie, niet ongenegen is. Daarom zou het evident zijn dat het eiland het statuut van observator zou kunnen verwerven, zoals in de WTO. Waarom zouden wij die gunstige evolutie niet vertalen in een aanpassing van de motie? Ik vraag dus aan de regering om eventueel de motie nog aan te passen.

The draft motion was discussed in the Foreign Affairs Committee on 27 April. As far as our group is concerned, we are in favour of that resolution and, like our colleagues, we want Taiwan to acquire the status of observer at the annual general meeting of the World Health Organization.
The reasons for this are obvious.
Indeed, given the explosion of international trade and trafficking of persons, the risk of a rapid and global spread of various infectious diseases such as HIV, tuberculosis and malaria has increased. It is in this context — not in the political context of two nations facing each other — and therefore for the sake of global health that it is of great interest that Taiwan can participate in the international approach and the fight against these infectious diseases.
The country is an important economic player on a global scale and an important trading partner of Europe, the United States and also China. It can boast a capita per capita of approximately $25,000, which is five times more than the capita per capita in China. The country also has important medical infrastructure and knowledge. This has been demonstrated, among other things, recently by its exemplary role, both in terms of information provision and in terms of combating the dangerous SARS epidemic.
Giving Taiwan the status of observer at the General Assembly of the World Health Organization is for us a step in the right direction, but rather a symbolic step that operatively contributes little to the fight against global epidemics. It would, of course, be much better if Taiwan received the status of observer in the World Organization, which is not limited to the meeting of 17 to 22 May, but a full-fledged status is within the operational framework where the rules for global health are determined and applied on the ground.
The message of our Parliament to our Ministers of Health and Foreign Affairs ahead of the General Assembly of the World Health Organization (WHO) from 17 to 22 May should include the call for a status of Taiwan within the World Health Organization, as is currently in place within the World Trade Organization. This is the only way to make an effective contribution to global health.
Our motion does not take into account the evolution of relations between the two China. In early May, there was an important meeting in Beijing between the Chinese authorities and the Taiwanese opposition. It has shown that China is not reluctant to a settlement such as that currently exists in the World Trade Organization. Therefore, it would be obvious that the island could acquire the status of observer, as in the WTO. Why should we not translate this favorable evolution into an adjustment of the motion? Therefore, I ask the Government to eventually amend the motion.

Mijnheer de voorzitter, ik onderschrijf uiteraard volmondig het pleidooi van de heer Chevalier. Hij intervenieerde reeds zeer uitvoerig, ook over de recente actualiteit die ons verheugt, gezien de toenadering tussen China en Taiwan, wat verrassend was na de verontrustende goedkeuring door China, enkele weken geleden, van de non separation act. De laatste evoluties zijn evenwel vrij positief te noemen.
Ik wens te benadrukken dat volgens het Vlaams Belang, Taiwan niet alleen gerechtigd is op een volwaardige status binnen alle internationale organisaties, maar ook op het zelfbeschikkingsrecht dat de internationale gemeenschap der volkeren als algemeen beginsel heeft aanvaard. Taiwan blijft voor het Vlaams Belang een bevriende natie, een bevoorrechte handelspartner, een natie die moet worden gesteund in haar streven naar een volwaardig statuut op internationaal niveau.
Wij onderschrijven deze resolutie dan ook volmondig. Ik herinner eraan dat het Vlaams Belang tijdens de vorige en deze legislatuur meerdere voorstellen in die zin heeft ingediend. Wij staan dus als een man achter deze resolutie en wij hopen dan ook dat alle andere fracties in dit Parlement deze resolutie steunen.

I would like to emphasize that, according to the Flemish Interest, Taiwan is entitled not only to a full status within all international organizations, but also to the right of self-determination that the international community of peoples has accepted as a general principle. Taiwan remains a friendly nation for the Flemish Interest, a privileged trading partner, a nation that needs to be supported in its endeavors for a full status at the international level.
We therefore fully support this resolution. I recall that the Flemish Interest in the previous and this legislature has submitted several proposals in this sense. We therefore stand as one man in favour of this resolution and we therefore hope that all other groups in this Parliament will support this resolution.

Monsieur le président, madame la ministre, ces derniers jours, la presse flamande et francophone a évoqué le refus à l'emploi dont ont été victimes des demandeurs d'emplois d'origine étrangère dans l'entreprise Feryn. Des chiffres alarmants ont été mis en avant tels que le taux de chômage très élevé des personnes — les jeunes notamment — issus de l'immigration ou encore le nombre de plaintes introduites auprès du Centre pour l'égalité des chances et de lutte contre le racisme. 154 plaintes ont été enregistrées pour l'année 2004.
Hier, le rapport final de la Commission du dialogue interculturel a aussi pointé du doigt la discrimination à l'embauche à l'égard des Belges d'origine étrangère. Dans ce cadre, permettez-moi de lire un court extrait de ce rapport: "Il faut constater qu'en Belgique les politiques d'actions positives sont généralement considérées comme pleinement légitimes par les responsables politiques et les citoyens quand il s'agit des femmes, des jeunes - plan Rosetta - ou des personnes handicapées mais qu'elles sont perçues comme beaucoup plus discutables quand il s'agit des membres des minorités culturelles et/ou des populations issues de l'immigration. La commission s'affirme résolument en faveur de politiques d'actions positives à l'égard de ces populations."
A cet égard, madame la ministre, je voudrais attirer tout particulièrement votre attention sur la Région de Bruxelles-Capitale qui connaît un contexte socio-économique pour le moins alarmant. En effet, les personnes issues de l'immigration sont trois fois plus touchées par le chômage que les Belges. Bruxelles, en raison de sa multiculturalité est particulièrement exposée à ce phénomène. Permettez-moi encore deux chiffres: 30% des habitants n'ont pas la nationalité belge; 125.000 naturalisations entre 1990 et 2001.
Il est évident que l'on peut avancer des arguments tels que la connaissance des langues, la bonne formation, l'éternel manque d'expérience professionnelle et j'en passe. Mais tous ces facteurs contribuent, autant que la discrimination ethnique à l'embauche, à expliquer le chômage de longue et de très longue durée des populations allochtones. La discrimination à l'embauche des Belges d'origine étrangère est une réalité criante et incontestable. Une récente étude de l'ULB et de la KUL, commanditée par l'ORBEM, démontre que la discrimination à l'embauche a augmenté à Bruxelles ces huit dernières années. Selon ce rapport, près d'un allochtone sur deux est au moins une fois victime d'une discrimination à l'embauche lors de sa recherche d'emploi. Non seulement les Belges d'origine étrangère n'ont pas les mêmes chances statistiques d'accéder à un emploi mais ils n'ont pas non plus les mêmes chances d'accéder à des emplois de qualité. Madame la ministre, compte tenu de votre compétence pour l'Emploi, quelle est votre position par rapport aux recommandations de la Commission du dialogue interculturel et, en particulier, sa recommandation selon laquelle les politiques d'actions positives doivent être mises en oeuvre à l'égard des populations issues de l'immigration?

In recent days, the Flemish and French-speaking press has evoked the refusal of employment of foreign-origin job seekers in the Feryn company. Alarming figures have been highlighted, such as the very high unemployment rate of people — especially young people — derived from immigration or the number of complaints filed with the Centre for Equal Opportunities and Combating Racism. 154 complaints were registered for 2004.
Yesterday, the final report of the Commission on Intercultural Dialogue also pointed to the discrimination in employment against Belgians of foreign origin. In this context, let me read a brief excerpt from this report: “It should be noted that in Belgium positive action policies are generally considered fully legitimate by policymakers and citizens when it comes to women, young people – Rosetta plan – or people with disabilities but are perceived as much more questionable when it comes to members of cultural minorities and/or immigration populations. The Commission firmly supports policies of positive action towards these populations."
In this regard, Mrs. Minister, I would like to draw your particular attention to the Brussels-Capital Region, which has a socio-economic context at least alarming. In fact, immigrants are three times more affected by unemployment than Belgians. Brussels, due to its multiculturality, is ⁇ exposed to this phenomenon. Let me add two figures: 30% of the inhabitants do not have the Belgian nationality; 125,000 naturalizations between 1990 and 2001.
It is obvious that one can advance arguments such as knowledge of languages, proper training, the eternal lack of professional experience and I pass. But all these factors contribute, as much as ethnic discrimination in employment, to explain the long-term and very long-term unemployment of immigrant populations. The discrimination in the hiring of Belgians of foreign origin is a screaming and undeniable reality. A recent study by ULB and KUL, sponsored by ORBEM, shows that employment discrimination has increased in Brussels over the past eight years. According to the report, ⁇ one in two immigrants is at least once victim of employment discrimination when seeking employment. Not only do Belgians of foreign origin not have the same statistical chances of accessing a job, but they also do not have the same chances of accessing quality jobs. Given your competence in Employment, what is your position regarding the recommendations of the Commission on Intercultural Dialogue and, in particular, its recommendation that positive action policies should be implemented with respect to immigration populations?

Monsieur le président, monsieur le ministre, chers collègues, la commission de la Justice a consacré deux séances, dont celle d'hier, à l'examen du projet de loi introduisant des dispositions relatives à la médiation dans le Titre préliminaire du Code de procédure pénale et dans le Code d'instruction criminelle.
L'objectif du présent projet vise à insérer la médiation dans nos Codes de procédure pénale et d'instruction criminelle et, ainsi, de généraliser l'offre de médiation afin que toute personne impliquée dans une procédure pénale puisse y recourir.
En donnant ainsi une base légale à la médiation entre l'auteur et la victime, on entend stimuler l'évolution vers une justice de participation et de communication; on entend ainsi promouvoir une justice davantage réparatrice. En effet, la médiation en matière pénale donne à la victime une place et une reconnaissance véritable dans le processus pénal et permet de concrétiser le sentiment de réparation.
Le projet de loi s'inscrit dans le prolongement de diverses expériences pilotes qui ont été menées en la matière par les ministres de la Justice de l'époque. Ainsi, déjà en 1993, un projet pilote de médiation réparatrice débutait en collaboration avec la Fondation Roi Baudouin et un groupe de recherche "Pénologie et Victimologie" de la KUL.
Dans le cadre des débats, diverses propositions de loi ont été prises en compte; à savoir la proposition de loi de M. Malmendier relative à l'agrément de certaines associations sans but lucratif, organisant la médiation auteur-victime, orientée vers la réparation, ainsi que la proposition de loi de Mmes Corinne De Permentier et Pierrette CahayAndré, et de M. Alain Courtois, proposition de loi modifiant le Code d'instruction criminelle afin de permettre au juge en matière pénale de proposer aux parties de renvoyer le dossier vers un agent du service des maisons de justice.
Lors de la discussion générale, M. Malmendier s'est réjoui du fait que l'on envisage d'autres solutions pour régler les situations conflictuelles; d'autres solutions que celles que nous connaissons actuellement dans notre droit. Il a également souligné la volonté de réconcilier, autant que faire se peut, les citoyens et surtout de leur reconnaître leur propre capacité à collaborer au règlement d'un conflit.
C'est d'ailleurs dans ce sens qu'il a déposé cette proposition de loi qui, au-delà de la condamnation, permet aux parties de retrouver une communication, voire une certaine réconciliation. Tel doit être le fond du travail de la médiation.
Pour sa part, le président de la commission de la Justice s'est inquiété des garanties qui pouvaient exister pour empêcher que la médiation soit utilisée à des fins dilatoires. En réponse à cette question, la ministre a souhaité rappeler les deux principes fondamentaux à la base de la médiation: d'une part, le fait qu'il s'agit ici d'un système dirigé et encadré par des médiateurs de qualité qui ont été validés; d'autre part, qu'une médiation implique, bien entendu, la volonté des deux parties, base volontaire sans laquelle elle ne pourrait débuter.
Enfin, un amendement visant à davantage préciser la date d'entrée en vigueur de la loi a été déposé et adopté à l'unanimité.
En conclusion, l'ensemble du projet tel qu'amendé a été adopté à l'unanimité.

Mr. Speaker, Mr. Minister, Ladies and Gentlemen, the Justice Committee has devoted two sessions, including yesterday’s, to the consideration of the bill introducing provisions relating to mediation in the preliminary Title of the Code of Criminal Procedure and in the Code of Criminal Instruction.
The aim of this project is to incorporate mediation into our Criminal Procedure and Criminal Investigation Codes and thus to generalize the offer of mediation so that any person involved in a criminal procedure can use it.
By thus providing a legal basis for mediation between the perpetrator and the victim, it is intended to stimulate the evolution towards a justice of participation and communication; it is thus intended to promote a more reparative justice. In fact, mediation in criminal matters gives the victim a true place and recognition in the criminal process and helps to concrete the feeling of compensation.
The bill is part of the continuation of various pilot experiments that were conducted in this area by the Justice Ministers of the time. Thus, already in 1993, a pilot project of reparative mediation was initiated in collaboration with the King Baudouin Foundation and a research group "Penology and Victimology" of the KUL.
In the framework of the discussions, various bill proposals were taken into account; namely, the bill proposal of Mr. Malmendier relating to the approval of certain non-profit associations, organising the author-victim mediation, oriented towards reparation, as well as the bill proposed by Ms. Corinne De Permentier and Pierrette CahayAndré, and M. Alain Courtois, draft law amending the Code of Criminal Instruction in order to allow the criminal judge to propose to the parties to return the file to an agent of the service of the houses of justice.
During the general discussion, Mr. Malmendier welcomed the fact that other solutions are being considered to resolve conflict situations; other solutions than those we currently know in our law. He also stressed the willingness to reconcile, as far as possible, the citizens and, above all, to recognize their own capacity to collaborate in the settlement of a conflict.
It is also in this sense that he deposited this proposal of law which, beyond the condemnation, allows the parties to regain a communication, or even a certain reconciliation. This should be the basis of mediation.
For his part, the Chairman of the Justice Committee was concerned about the guarantees that could exist to prevent mediation from being used for dilatory purposes. In response to this question, the Minister wanted to recall the two fundamental principles at the base of mediation: on the one hand, the fact that it is here a system led and framed by quality mediators that have been validated; on the other hand, that a mediation implies, of course, the will of both parties, a voluntary basis without which it could not start.
Finally, an amendment aimed at further clarifying the date of entry into force of the law was deposited and adopted unanimously.

Die ondraaglijke draagwijdte zal aanleiding geven tot ongelukken. Het ontwerp heeft zeer zeker goede intenties en kan daders en slachtoffers bij elkaar brengen, maar bij enige kwaadwillige intentie zal het aanleiding geven tot enorme problemen.
De tekst is dermate summier en de interpretatiemogelijkheden zijn dermate talrijk dat wij in deze alleen maar kunnen spreken van bijzonder slecht wetgevend werk. Daarom, mijnheer de voorzitter, valt het te betreuren dat door de procedure die in de commissie is gevolgd — nogmaals, ik ben mee verantwoordelijk, omdat ik er niet kon zijn —, wij zelfs geen wetgevende technische nota hebben gekregen, zodat zelfs de meest elementaire correcties niet aangebracht konden worden.

Ik zal niet insisteren, mijnheer de voorzitter. Ik begrijp ook dat minister Demotte uiteraard niet in staat is de antwoorden te geven op mijn technische vragen. Hoe dan ook, de wijze waarop het ontwerp besproken wordt, bewijst hoe met zulke ontwerpen, die belangrijk zouden kunnen zijn, en hoe met zulke belangrijke thema's wordt omgegaan.
Ik wil dat toch even scherp aan de kaak stellen door te wijzen op een aantal problemen dat door die teksten wordt gecreëerd.
Het voorliggend ontwerp voorziet in een bemiddeling in het strafproces, maar men heeft nagelaten te omschrijven voor welke misdrijven dit zal zijn. Dit betekent dat deze bemiddeling, zowel op het ogenblik van de strafvordering, de bestraffing en de strafuitvoering, kan gelden voor alle misdrijven. Voor om het even welk misdrijf kan men een dergelijke bemiddelingsprocedure opstarten. Moord, doodslag, verkrachting van minderjarigen, wat dan ook, er is geen enkele beperking. Naar aanleiding van de strafbemiddeling hadden we destijds in een duidelijke beperking voorzien voor een aantal misdrijven. We vonden immers dat voor zware en gruwelijke misdrijven de bemiddeling niet kon. In het voorliggend ontwerp heeft men evenwel in deze beperking niet voorzien.
Bovendien maakt dit wetsontwerp bemiddeling ook mogelijk in de loop van het gerechtelijk onderzoek, zelfs op het ogenblik van de behandeling ten gronde en op het ogenblik dat de straf is uitgesproken in de fase van de strafuitvoering. Ik wil waarschuwen voor mogelijke gevolgen. In de tekst wordt bepaald dat iedereen die direct belang heeft bij de bemiddeling, het initiatief van de bemiddeling kan vragen aan de betrokken dienst. U moet evenwel weten, collega's, dat in belangrijke gerechtelijke dossiers om het even wie — een familielid van de dader bijvoorbeeld, die uiteraard een direct belanghebbende is — op deze wijze in het dossier kan treden. Dit kan te kwader trouw zijn. Dit wordt niet gesanctioneerd of gespecificeerd in het voorliggend wetsontwerp. Op deze wijze kan het gerechtelijk onderzoek vertraagd worden. Bij de behandeling van het dossier ten gronde kan dit ervoor zorgen dat er procedure-incidenten ontstaan. Dit kan ook op het ogenblik van de strafuitvoering.
Men heeft op een bijzonder blinde en grenzeloos naïeve manier deze tekst geredigeerd, ongetwijfeld vanuit een goede bekommernis. Ik geef het voorbeeld van de informatie die op deze wijze oneigenlijke belanghebbenden zullen kunnen bekomen. Het ontwerp voorziet erin dat de dienst die met de bemiddeling gelast is bij het departement van Justitie een kopie kan krijgen van het strafdossier. Vraag is of de belanghebbenden op deze wijze inzage kunnen krijgen? Zo ja, betekent dit dat ze informatie kunnen bekomen hetzij over het gerechtelijk onderzoek, hetzij over het strafonderzoek in het algemeen. Destijds hebben we in onderzoekscommissies waar belangrijke dossiers werden behandeld, meegemaakt dat op deze wijze verschillende belanghebbenden een dossier hebben aangelegd via hetwelk zij kennis kunnen krijgen van het verloop van het onderzoek.
Ik herhaal dat deze bijzonder naïeve tekst via handige advocaten aanleiding zal geven tot tal van misbruiken.
We kunnen dan nog aannemen dat die bemiddeling noodzakelijk is. Ik geloof in de experimenten die daaromtrent gevoerd zijn, onder meer op initiatief van de Koning Boudewijnstichting, maar dan toch in eerste instantie beperkt tot de burgerlijke belangen. Ik denk dat dit bijzonder belangrijk kan zijn: de schade beperken en zoeken op welke wijze de dader nauwer betrokken kan worden bij de belangen van het slachtoffer. Ik denk dat dat een goed uitgangspunt is.
Daartoe is dat wetsontwerp echter niet beperkt. Dat wetsontwerp voorziet of kan erin voorzien dat die bemiddeling ook betrekking zou kunnen hebben op de strafvordering, op de bestraffing, op de strafuitvoering. Ik vraag me werkelijk af op welke wijze dat zou kunnen. Partijen die een belang kunnen hebben, om het even welk familielid, bijvoorbeeld, zouden het initiatief kunnen nemen om een bemiddelingsprocedure of een bemiddeling op te starten om zo invloed te krijgen op de wijze waarop het dossier ten gronde wordt behandeld, en desgevallend later in het kader van de strafuitvoering.
Daarbij rijst de fundamentele vraag welke de positie is van die bemiddelingsdienst in de trias politica. Het is een dienst afhangende van de Federale Overheidsdienst Justitie. Het is dus niet het parket, niet het openbaar ministerie. Het is niet de rechterlijke macht. Het is klaarblijkelijk een orgaan van de uitvoerende macht, dat zou tussenbeide kunnen komen op het ogenblik dat ofwel gerechtelijk onderzoek bezig is, ofwel de procedure ten gronde bezig is, in de loop van de behandeling, ofwel in de fase van de strafuitvoering. Op die wijze krijgt die dienst ongetwijfeld enige impact op de behandeling van het dossier. Ik vraag mij af in welke mate dat in overeenstemming is met de onafhankelijkheid van de rechterlijke macht.
Ik zou nog kunnen aanvaarden dat het parket dergelijke opdrachten krijgt, zoals het parket nu ook een opdracht heeft in het kader van de strafbemiddeling. Ik meen dat dat een bijzonder belangrijk en nuttig initiatief is waarvan vaak gebruikgemaakt wordt. Het is een instrument in handen van het openbaar ministerie.
Maar de vraag is: hoe zal die bemiddelingsdienst, afhankelijk van de Federale Overheidsdienst Justitie, dus van de heer Bourlet, zich verhouden tot de opdracht van het openbaar ministerie enerzijds, en de opdrachten van de justitiehuizen anderzijds? Ook in verband met de justitiehuizen rijst die vraag. De justitiehuizen hebben in de fase van de strafuitvoering alleszins een belangrijke rol te spelen. Zij hebben een belangrijke rol te spelen in het kader van de behartiging van de belangen van het slachtoffer. Zij worden hier gedoubleerd door een nieuwe dienst, die zal kunnen interfereren in de verschillende opdrachten. Dat is bijzonder zorgelijk. Ik vraag mij af wie mij zou kunnen zeggen wat wordt bedoeld met "door iedereen die direct belang heeft bij het onderzoek". Het is zo geformuleerd in een tekst die betrekking heeft op het strafrecht. Ik vrees dat bijna om het even wie op dat belang aanspraak zou kunnen maken.
Minstens zullen belangen worden gecreëerd die geen algemene belangen zijn noch de belangen van het slachtoffer, maar individuele belangen.
Dan stelt zich tevens de vraag: indien de bemiddeling aanleiding geeft tot een akkoord of resultaat, wat zal men daar dan mee doen? In vroegere teksten hebben we gezegd dat wanneer er bemiddeling was, er dan een uitvoerbaar vonnis kwam zodat de bemiddeling kon uitgevoerd worden en op die manier rechtszekerheid zou ontstaan. Dit is hier helemaal niet bepaald vermits er staat dat de rechter daarmee rekening kan houden. Welnu, stel dat in de loop van de procedure ten gronde een soort van akkoord tot stand komt tussen het slachtoffer en de dader, kan de rechter dan, naar aanleiding van dat akkoord, behoudens de regeling inzake de burgerlijke belangen, strafvermindering toestaan op basis van dat akkoord? Kan dat, op basis van deze tekst? Dit kan alleszins, zoals het nu geredigeerd is. Ik neem aan dat dit misschien de bedoeling niet is, maar zoals de tekst in dergelijke algemene bewoordingen is opgesteld, moet dit kunnen.
Hoe verhoudt dit initiatief zich tot het wetsvoorstel Franchimont dat in de Senaat op dit ogenblik wordt besproken en uiteraard ook tot het wetsvoorstel op de strafuitvoeringsrechtbanken dat binnen enkele weken in de Senaat zal worden behandeld? Het is duidelijk dat als men terzake in bemiddeling voorziet in het kader van de strafuitvoering, dit implicaties zal hebben op het wetsontwerp op de strafuitvoeringsrechtbanken. Dit zal precies een van de opdrachten zijn van de strafuitvoeringsrechtbank, als ik het goed begrepen heb. Men gaat dus hier iets heel partieel regelen, dat op dit ogenblik helemaal onduidelijk kadert in andere initiatieven. Ik denk dat het onontbeerlijk zou geweest zijn om hierover het standpunt van de balies te kennen. Ik meen te weten dat de Orde van Vlaamse balies bijzonder zware bedenkingen heeft bij dit wetsontwerp. Ik weet niet hoe dat is aan Franstalige kant.
Het zou natuurlijk bijzonder belangrijk zijn te weten wat het standpunt dienaangaande is van de Raad van procureurs en van het College van procureurs-generaal. Deze materie heeft immers een bijzondere impact op het verloop van het strafproces en op de strafuitvoering, een aangelegenheid die in grote mate het Openbaar Ministerie aanbelangt. Wij weten dit niet. werd men daarover geconsulteerd? Wij hebben vorige week nog de voorzitter van de Raad van procureurs horen zeggen dat het overlegmodel tussen de Raad, het College en de minister faalt en dat men daar nog nauwelijks rekening mee houdt. Daar vinden we geen spoor van terug. Ook de Hoge Raad voor de Justitie werd hieromtrent niet geconsulteerd. Voorzitter, ik denk dat wij hier een stommiteit aan het doen zijn vanuit de best mogelijke intenties, daarmee ben ik het weliswaar eens.
Dit is ondoordacht en niet bediscussieerd. Wij zullen de gevolgen ervan dragen. Hier komen ongelukken van. Men zal hiervan misbruik kunnen maken inzake het verzamelen van informatie, het vertragen van een gerechtelijk onderzoek of inzake het beïnvloeden van de dossiers bij de behandeling. Men heeft zich niet gewapend tegen de intenties terzake die in zware dossiers evident zijn. Men heeft naar mijn aanvoelen de fundamentele vergissing gemaakt om de bemiddeling niet te beperken tot de misdrijven waarvoor ze eigenlijk moet dienen. Nu is ze ook van toepassing op de zwaarste misdrijven.
Jammer genoeg zullen wij in deze omstandigheden tegen dit wetsontwerp moeten stemmen, hoewel het uitgangspunt en de intentie eigenlijk goed waren. Bij gebrek aan grondig overleg en consultatie en aan een degelijke bespreking zal dit ontwerp verworden tot wat het eigenlijk niet moet zijn.

There is the problem of the non-implementation of such an agreement. This has also been discussed in the committee. The essence of the case is that one does not come to a kind of enforceable punishment, in which the parties have each put a little water in the wine to then come to a kind of legally enforceable agreement. It is not about that. It is a recovery mediation. It is an attempt to contribute from society to the restoration of the relationship between the perpetrator and the victim.
It is said that this must be reserved for the smallest crimes. Practice shows that it must be exactly the opposite, that it is precisely in the most serious crimes that such a form of recovery mediation is most appropriate. A typical example is the family dramas: a result of partner violence, a serious crime being committed, up to murder. This implies, in addition to having a whole criminal procedure, which naturally punishes the person who committed the act in a normal way, that one must also try to continue to live and work after the process. This should be done with the same family members. In order to respond to this, such a framework is provided.
Mr. Speaker, I am going around. The question that can be asked is why this should be stated in a law. That must be inscribed in a law, because the mediator must be able to talk to someone who is imprisoned in prison. No one can be allowed to go to prison simply under the guise of an intermediary role between the perpetrator and the victim. Criteria must be established for this. C'est le même principe que la médiation pénale organisée par le parquet actuellement lorsqu'il met face à face celui qui a commis l'infraction et la victime pour essayer de "raccommoder" les choses et que chacun prenne conscience de ce qui lui est arrivé. Ensuite, en ce qui concerne la problématique des infractions graves, je crois que, par définition, le concept de justice restauratrice ou justice réparatrice a ses limites. Autant je peux l'imaginer comme étant efficace pour des infractions d'une gravité mineure ou moyenne, autant, objectivement, cela ne peut pas être raisonnablement envisagé pour des infractions de grande gravité; c'est évidemment la pratique et le bon sens qui me conduisent à dire cela.

I would like to make two further remarks in relation to what Mr. by Van Parys. First of all, it is obvious that the text provides for the possibility for the service responsible for mediation to obtain the copy of the repressive file but it is understood that all this is done under the responsibility, as already in our criminal procedure, the prosecutor’s office, the prosecutor of the King in particular.
Then, as regards the problem of serious offences, I believe that, by definition, the concept of restorative justice or reparative justice has its limits. As much as I can imagine it as being effective for offenses of minor or medium gravity, so objectively, it cannot be reasonably considered for offenses of great gravity; it is obviously the practice and common sense that lead me to say this.

Ik heb ook begrepen dat er weinig tot zelfs geen invloed mag of kan bestaan en zeker geen dwang op slachtoffer en rechter of procureur om via een bemiddeling de procedure in een bepaalde richting te sturen. Op dat punt voel ik alles wel vrij veilig aan en zullen we volgens mij hier niet te maken hebben met een revolutie in ons strafrechtsysteem die ons systeem in een slechte richting stuurt.
Wat me wel enigszins verontrust, is de volgende casus die zich kan voordoen. Een rechter mag uiteraard rekening houden met het feit dat een bemiddeling is geschied en dat de dader het slachtoffer of een andere partij die meent te zijn benadeeld door het misdrijf, heeft vergoed. Wanneer echter op een gegeven ogenblik een dader van een rechter strafvermindering krijgt, omdat een bemiddeling is gebeurd, en achteraf blijkt dat het voorwerp van de bemiddeling niet werd uitgevoerd en de bemiddelingsovereenkomst dus door de dader werd verbroken, dan heeft de dader in feite onrechtmatig geprofiteerd van een strafvermindering. Hij heeft dus strafvermindering gekregen voor een overeenkomst die hij uiteindelijk niet heeft uitgevoerd.
In ons systeem mag iemand niet onschuldig worden gestraft. De keerzijde van de medaille van ons systeem moet echter zijn dat niemand ooit voordeel mag halen uit zijn eigen fout, zeker niet wanneer hij voorwendt de fout te hebben hersteld en dat in werkelijk niet blijkt te hebben gedaan. In dat geval zouden we te maken hebben met onschuldige slachtoffers die worden gestraft. Dat mag ons systeem uiteraard ook niet dulden.
Ik vraag dus op dat punt uitleg van de minister of van de collega's van de meerderheid. Wat doen we met een dader die een bemiddelingsovereenkomst heeft gesloten, op basis daarvan een strafvermindering heeft verkregen, maar uiteindelijk de overeenkomst niet heeft uitgevoerd? Er zijn immers geen strafuitvoeringsrechtbanken — ik herinner er nog eens aan —, die aan een dergelijke situatie kunnen remediëren ten gunste van het slachtoffer.

In that case, we would have to deal with innocent victims who are punished. This is not tolerated by our system, of course.
Therefore, I ask the Minister or the colleagues of the majority to explain this point. Welnu, de handige advocaat die de wet heeft bekeken, vraagt aan een van de familieleden van de fraudeurs, van het bedrijf of wie dan ook om te zeggen, hetzij aan het openbaar ministerie, hetzij tijdens de behandeling ten gronde dat die gaat bemiddelen met het ministerie van Financiën om een regeling te proberen uit te werken inzake het nadeel dat de Belgische Staat heeft geleden. Met welke intentie? Uiteraard met de intentie om op die manier het gerechtelijk onderzoek te vertragen of de behandeling ten gronde te vertragen en eigenlijk ook voor een stuk te beïnvloeden. Men zal het aanbod om te bemiddelen met het ministerie van Financiën natuurlijk niet kunnen weigeren. Vermits deze wet zal bestaan, zal dat een gegeven zijn waarmee de rechter rekening kan houden, hetzij de onderzoeksrechter, hetzij de rechter ten gronde. Men zal dus effectief een impact krijgen op het verloop van een dossier, onvermijdelijk.
De teksten zijn het enige wat telt. Ik vind dat onze collega's uitstekende intenties hebben, maar we spreken over strafrecht en dus over de strikte interpretatie. Wat lezen we? Bemiddeling is een proces dat aan personen in conflict toelaat om, als ze er vrijwillig mee instemmen, actief en in alle vertrouwelijkheid deel te nemen aan het oplossen van moeilijkheden die voortvloeien uit een misdrijf.
Collega's, "moeilijkheden die voortvloeien uit een misdrijf" is een zodanig algemene kwalificatie dat men dit uiteraard niet zal beperken tot de herstelbemiddeling zoals men dat zou willen. Men zal het echter veel ruimer interpreteren en grond vinden in de teksten zoals ze op dit ogenblik voorliggen.
Ik ben het op een punt volkomen eens met de voorzitter van de commissie voor de Justitie, met name wanneer hij zegt dat deze tekst een "flou" gegeven is. Collega's, op basis hiervan zult u instrumenten aanreiken die alle soorten vertragingen en procedure-incidenten zullen uitlokken waardoor ingewikkelde dossiers opnieuw zullen worden vertraagd en opnieuw aanleiding zullen kunnen geven tot verjaring en dergelijke manoeuvres.
Mijnheer Borginon, men moet oordelen op basis van de teksten die men heeft goedgekeurd. Het is immers strafrecht. Men heeft dit op een zodanig onzorgvuldige manier omschreven dat men hier werkelijk de deur openzet voor alle vormen van misbruik. Uiteraard ben ik voor herstelbemiddeling, maar men had het in de voorliggende teksten moeten beperken tot dat waartoe het eigenlijk zou moeten dienen. Dat is niet het geval.
Ten slotte, een laatste bedenking. Dit is in eerste instantie een opdracht van het openbaar ministerie, zeker op het ogenblik dat het gerechtelijk onderzoek aan de gang is, des te meer wanneer de zaak ten gronde wordt behandeld door de rechtbank en nog meer op het ogenblik van de strafuitvoering. Dit lijkt mij zonneklaar. Ik begrijp niet dat de kamercommissie voor de Justitie deze teksten kan goedkeuren of bespreken zonder dat men het advies heeft gevraagd van de daarvoor bestaande organen, de Raad van procureurs, het college van procureurs-generaal en uiteraard ook de balies die vanzelfsprekend betrokken partijen zijn. Zij signaleren ons dat, zoals we hebben gezegd, er heel wat onaangename gevolgen kunnen voortvloeien uit de thans voorliggende teksten.
Collega's, het is uw verantwoordelijkheid hierop al of niet in te gaan. Wij kunnen vanuit de oppositie alleen maar wijzen op de risico's die men neemt ten aanzien van heel belangrijke teksten in soms heel belangrijke onderzoeken.

I fully agree on one point with the Chairman of the Committee on Justice, especially when he says that this text has been given a “flood”. On this basis, colleagues, you will provide tools that will trigger all kinds of delays and procedural incidents, which will cause complicated files to be delayed again and can again give rise to prescription and similar manoeuvres.
Mr. Borginon, one must judge on the basis of the texts approved. It is criminal law. This has been described in such a careless manner that it really opens the door for all forms of abuse. Of course I am in favour of recovery mediation, but it should have been limited in the preceding texts to what it should actually serve. This is not the case.
Finally, a final consideration. This is initially an order of the Prosecutor’s Office, ⁇ at the time when the judicial investigation is in progress, especially when the case is dealt with in substance by the court and even more at the time of the execution of the penalty. This seems clearly sunny. Tweede element, hiermee geef ik een antwoord op de bemerkingen van de heer Schoofs inzake de overeenkomst. Het probleem is dat in het debat gefocust wordt op de overeenkomst. Dat is een juridische reflex ons allemaal eigen. Indien ik het concept herstelbemiddeling goed begrepen heb, is de overeenkomst niet de kern van de zaak. Kern van de zaak is de weg naar die overeenkomst. Men focust op de mogelijkheid dat een overeenkomst eventueel niet kan worden nageleefd.
Collega's, de kern van de zaak is dat de overheid een middel aanreikt om buiten het strafprocesrecht te komen tot een situatie waarin de relatie dader-slachtoffer opnieuw genormaliseerd geraakt in de mate dat dat menselijkerwijze mogelijk is.
Bestaat het risico dat de overeenkomst niet wordt nageleefd? Natuurlijk. Vandaag bestaat in de gewone strafprocedure voor de rechter evenwel ook het risico dat zaken die in het proces worden ingebracht en beloften die gedaan worden, achteraf niet gevolgd worden. Dat is precies hetzelfde als wat er vandaag gebeurt.
Wat de vertraging betreft, mijnheer Van Parys, waar staat in het ontwerp dat de rechter zijn werkzaamheden moet opschorten totdat de bemiddeling tot een goed eind is gebracht?. Dat staat er helemaal niet in. Er is geen enkele verplichting voor een rechtbank of een openbaar ministerie om te talmen met zijn procedure lopende een bemiddeling. In die zin is dit verhaal niet anders dan hetgeen thans kan gebeuren voor de strafrechtbank. Een advocaat van de verdediging geeft samen met de advocaat van de burgerlijke partij aan de rechter het signaal een beetje tijd te willen krijgen om de burgerlijke belangen te kunnen regelen. De rechter gaat op dat verzoek in of hij gaat er niet op in. Dat is hier precies hetzelfde. Het proberen voor te stellen alsof er een nieuw soort van mechanisme wordt gecreëerd waarmee massa's uitstel wordt veroorzaakt in de strafgerechten, dat is eerlijk gezegd een brug te ver!

If I have well understood the concept of recovery mediation, the agreement is not the core of the matter. The core of the matter is the path to that agreement. It focuses on the possibility that an agreement may not be fulfilled.
Colleagues, the core of the case is that the government provides a means to get out of the criminal procedure law to a situation where the perpetrator-victim relationship has re-normalized to the extent that it is humanly possible.
Is there a risk that the agreement will not be complied with? of course . Today, however, in the ordinary criminal proceedings before the court there is also the risk that matters brought into the proceedings and promises made are not followed afterwards. It is exactly the same as what is happening today.
As regards the delay, Mr Van Parys, what is stated in the draft that the judge must suspend his work until the mediation has been successfully completed? That is not in it at all. There is no obligation for a court or a public prosecutor to tame with its procedure while conducting a mediation. In this sense, this story is no different from what can happen now before the Criminal Court. A defence attorney, together with the civil party attorney, gives the judge the signal that he wants to get some time to settle the civil interests. The judge will respond to that request or will not respond. It is exactly the same here. Trying to imagine as if a new kind of mechanism is being created that causes mass delay in the criminal courts, that is honestly a bridge too far!
