Mijnheer de voorzitter, collega's, de commissie voor de Justitie heeft op 7 juni 2002 het wetsvoorstel van collega Giet te Hertoginnendal besproken.
Het wetsvoorstel strekt tot aanvulling van artikel 33, §1, eerste lid, van de wet van 20 juli 1990 betreffende de voorlopige hechtenis. Dat wetsvoorstel werd toegelicht door de indiener ervan, collega Giet.
Het heeft tot doel de rechtspositie van de bij een voorlopige hechtenis in vrijheid gestelde beklaagde of beschuldigde te verduidelijken. Artikel 33, §1, eerste lid, van de wet van 20 juli 1990 betreffende de voorlopige hechtenis bepaalt ondubbelzinnig dat de beklaagde of de beschuldigde die wordt vrijgesproken, veroordeeld met uitstel of alleen tot een geldboete, onmiddellijk in vrijheid wordt gesteld. In de praktijk evenwel wordt de betrokkene steevast geboeid naar de gevangenis teruggebracht. Dat is gewoon een praktische maatregel die hem moet toelaten zijn persoonlijke bezittingen op te halen. Dat gebruik is volgens collega Giet strijdig met de wet. Omdat het een gewoonte is, moet uitdrukkelijk in de wet worden bepaald dat het verboden is iemand die in vrijheid is gesteld, de handboeien om te doen. Daarom stellen de indieners van het ter bespreking voorliggende wetsvoorstel voor om artikel 33, § 1, eerste lid, van de wet op de voorlopige hechtenis aan te vullen, zodat het gebruik van enig dwangmiddel op de in die bepaling bedoelde personen uitgesloten is.
De minister van Justitie stemt in met het wetsvoorstel.
De commissievoorzitter, collega Erdman, vraagt zich tijdens de besprekingen af of de term "handboeien" niet meer aangeraden is dan de term "dwangmiddelen", zoals voorzien in het wetsvoorstel van collega Giet. Hij vraagt zich af of het gebruik niet wil dat bij vrouwen geen handboeien worden omgedaan. Dat gebruik berust zeer waarschijnlijk op een wettekst of een reglement. Daarin moet wel uitdrukkelijk de term "handboeien" zijn gebezigd. De indieners zouden dat als precedent kunnen aanwenden om die term zonder problemen in hun tekst op te nemen.
De spreker verwijst bovendien naar de geschriften van eminente specialisten in het strafrecht die uitdrukkelijk het begrip "handboeien" gebruiken. Wie zijn dat? H. Bekaert in La manifestation de la vérité dans le procès pénal, Brussel, 1972, blz. 241 en 242 en M. Franchimont, A. Jacobs en A. Masset in Manuel de procédure pénale, Luik, 1989, blz. 245.
De heer Thierry Giet weet niet of een dergelijke tekst bestaat. Hij verkiest liever de huidige bewoordingen van het wetsvoorstel, dat dan ook op andere dwangmiddelen dan handboeien kan worden toegepast.
Vervolgens vonden de stemmingen plaats. Het artikel 1 werd eenparig goedgekeurd. Vervolgens werd artikel 2 eveneens eenparig goedgekeurd en tenslotte werd het gehele wetsvoorstel, zonder enige wijziging of amendering, eenparig goedgekeurd.

On 7 June 2002, the Justice Committee discussed the bill proposed by colleague Giet te Hertoginnendal.
The proposal is intended to supplement Article 33, §1, first paragraph, of the Act of 20 July 1990 on provisional detention. That bill was explained by its applicant, colleague Giet.
It aims to clarify the legal status of the accused or accused person released in temporary detention. Article 33, § 1, first paragraph, of the Act of 20 July 1990 on provisional detention unambiguously stipulates that the defendant or defendant who is acquitted, sentenced with delay or only to a fine shall be immediately released. Or, je pense que la liberté d'aller et de venir est sans doute la liberté la plus importante.
La modeste proposition de loi qui vous est soumise tend à réaffirmer ce qui semblerait aller de soi, à savoir que celui qui est acquitté, condamné avec sursis ou condamné à une simple amende doit être libre de sortir de l'audience. Malgré deux circulaires ministérielles, ce n'était toujours pas le cas. Ceci est évidemment inacceptable.
Ce texte a d'abord été inspiré par ma pratique professionnelle, mais il a également vu le jour grâce à un article de doctrine écrit par Maître Christophe Meunier, jeune avocat au Barreau de Liège. Aujourd'hui, je tiens à lui dédier cette loi puisqu'il nous a quittés il y a quelques mois, victime d'un tragique accident d'aviation.

Mijnheer de voorzitter, mijnheer de minister, collega's, het wetsontwerp dat wij hier behandelen, regelt een punctueel maar desalniettemin belangrijk probleem ingevolge een interpretatieruimte die artikel 52 van de wet van 8 april 1965 over de jeugdbescherming geeft. Door dat wetsontwerp wordt er een interpretatieprobleem opgelost, in die zin dat dringende en voorlopige maatregelen, te nemen door de jeugdrechter, mogelijk worden voor minderjarigen die op het ogenblik van het plegen van het misdrijf minderjarig waren maar meerderjarig zijn geworden vóór de aanvang van de rechtspleging. Ingevolge de interpretatie van artikel 52 was het onduidelijk — en in de realiteit deden zij dat niet — dat de jeugdrechters dringende en voorlopige maatregelen konden nemen. Door dat wetsontwerp wordt dat probleem op een behoorlijke wijze geregeld. De CD&V-fractie staat dan ook achter dat wetsontwerp.
Zoals u weet, zijn er nog meer fundamentele problemen in verband met de problematiek van de aanpak van de jeugdcriminaliteit. Naar aanleiding van dat wetsontwerp zijn wij zo vrij geweest om een amendement in te dienen dat het voorontwerp van wet van de minister van Justitie overneemt en waarbij wij ook graag de naam van de medewerker van de minister vernoemen, de heer Christian Maes. Het gaat om het voorontwerp houdende antwoorden op delinquent gedrag door minderjarigen. Dat voorontwerp hebben wij overgenomen, in een amendement gegoten en ingediend als amendement op dat wetsontwerp. De reden daarvoor is bijna vanzelfsprekend. Een wettelijke regeling houdende antwoorden op delinquent gedrag door minderjarigen is namelijk heel dringend nodig en noodzakelijk. Wij staan vandaag namelijk voor een toestand van straffeloosheid. Omdat er onvoldoende plaatsen zijn in de gesloten instellingen van de gemeenschappen en omdat Everberg niet de voorgespiegelde oplossingen biedt, worden er blijkbaar systematisch in de grote steden jonge criminele minderjarigen en jonge delinquenten vrijgelaten. Er bestaat op het terrein een toestand van straffeloosheid. De cijfers liegen er niet om. Afgelopen dinsdag deelde de minister van Justitie in de bevoegde commissie nog mee dat er sinds 1 januari 2002 — en nu zijn we bijna op de helft van 2002 — 59 minderjarige delinquenten moesten worden vrijgelaten, alleen al in het arrondissement Antwerpen. Het ging om 59 jeugdige delinquenten voor wie de jeugdrechter de maatregel had genomen van opname in een gesloten of halfopen instelling.
59 gevallen in één arrondissement op een half jaar tijd, dit kan tellen. Het bewijst de omvang van de problematiek, die inderdaad de publieke opinie de ogen uitsteekt en eigenlijk op een zeer flagrante wijze uitdrukking geeft aan het wantrouwen dat de mensen hebben in het apparaat justitie en politie.
Trouwens, de cijfers die door de minister werden meegedeeld sinds de oprichting van de instelling in Everberg, hebben even zeer aangetoond in welke mate het probleem bestaat. In de periode van 1 maart — de dag dat Everberg operationeel werd — tot 31 mei werd door de jeugdrechters 124 keer beslist dat de jongeren dienden opgenomen te worden in de instellingen Everberg. Bij gebrek aan plaatsen in de gesloten instellingen van de gemeenschappen konden 70 beslissingen niet worden uitgevoerd. Ook dit toont aan in welke mate het probleem bestaat.
Het probleem is natuurlijk dat een aantal criminele organisaties of de georganiseerde criminaliteit dit heeft begrepen. Deze internationale organisaties maken gebruik van minderjarige delinquenten om criminele feiten te plegen, ervan uitgaande dat deze toch straffeloos zullen blijven. Zeer jonge delinquenten — 11-, 12-, 13-jarigen vormen geen uitzondering — worden gebruikt om feiten te plegen die de slachtoffers erg verontrusten. Vandaar dat het probleem zich dus niet enkel stelt ten opzichte van individuele, jonge criminelen die laakbare feiten plegen, maar dat het een structureel probleem is geworden. Het is om die reden dat we dit amendement hebben ingediend. We willen het Parlement confronteren met het probleem, maar we willen het ook de kans geven om een begin van oplossing te bieden aan dit probleem.
Het probleem ontstaat, ten eerste, door feiten zoals ik ze u heb uiteen gezet: de aanwezigheid van vele jeugdige delinquenten die dikwijls optreden in het kader van criminele organisaties, maar bestaat ook omdat de huidige wetgeving, de wet van 1965 op de jeugdbescherming, niet meer voldoet. Ik geloof dat dit in allerlei verklaringen en publicaties de jongste tijd heel duidelijk is geworden, maar voor zover als nodig wil ik even citeren uit de memorie van toelichting uit het voorontwerp Verwilghen-Maes houdende antwoorden op het delinquent gedrag van minderjarigen. Daar zegt men zeer duidelijk en met kennis van zaken dat het model van de jeugdbescherming niet meer voldoet om een antwoord te bieden op de criminaliteit van jongeren van vandaag en ik wil even citeren uit pagina 5 van de memorie van toelichting: "Het beschermingsmodel heeft ontgoocheld, niet alleen wegens de dubbelzinnigheid in zijn doelstellingen, de oneerlijkheid van zijn voorstelling, het discretionaire van de gegeven bevoegdheden met verminderde rechtswaarborgen. Het geeft ook blijk van onmacht tegenover persisterende delinquenten waardoor uitzonderingen nodig worden geacht zoals de uithandengeving. De genomen maatregelen bieden geen gedifferentieerde, minstens geen adequate aanpak zoals voor drugverslaafde en geesteszieke minderjarigen".
Het kan niet duidelijker omschreven zijn dan door de minister zelf in de memorie van toelichting van het voorontwerp. Het beschermingsmodel voldoet niet; het heeft ontgoocheld en het is geen antwoord op de huidige situatie van de jongeren- en de jeugdcriminaliteit, vooral in de grote steden. Ik verwijs trouwens ook naar wat de minister van Justitie deze week in de commissie voor de Justitie heeft gezegd met betrekking tot de situatie in Antwerpen waarbij een aantal Roemeense minderjarige delinquenten werd uitgewezen. Ik citeer: "De wet op de jeugdbescherming is ten aanzien van deze vorm van criminaliteit volkomen inefficiënt". Enerzijds, hebben wij dus te maken met een structureel georganiseerde jeugdcriminaliteit en anderzijds is er een wetgevingsmodel dat in geen enkele mate voldoet.
Het kernkabinet heeft op 17 mei een regeling uitgewerkt waarvan men verkondigt dat ze een oplossing voor het probleem zou zijn. Deze regeling lost het probleem waarmee wij nu worden geconfronteerd niet op.
Ten eerste, de regeling die door het kernkabinet werd uitgewerkt, is volkomen tegengesteld aan de basisgedachte van het voorontwerp van wet van minister Verwilghen. Toen hierover in de commissie voor de Justitie werd gedebatteerd, heeft mevrouw Talhaoui zich in zeer cynische bewoordingen uitgelaten. Zij zei dat het voorontwerpVerwilghen-Maes, door wat het kernkabinet heeft uitgewerkt, is vervallen.
Mijnheer Tavernier, in de regeling die door het kernkabinet werd uitgewerkt en op een bepaald ogenblik ook door de meerderheid werd ondersteund, wordt het jeugdbeschermingmodel voor de minderjarige delinquenten tussen de 12 en de 16 jaar gehandhaafd en zelfs versterkt in de plaats van een regeling uit te werken die een andere reactie op de jeugdcriminaliteit kan hebben. Ik denk dat wij het er allemaal over eens zijn dat het jeugdbeschermingmodel niet meer voldoet. Dat is althans ook de conclusie van de minister van Justitie en zijn medewerkers. Het is werkelijk onbegrijpelijk dat men tegen de realiteit van de dingen in, tegen de gegevens op het terrein in de steden en gemeenten en tegen de realiteit van het niet meer voldoen van het beschermingsmodel in, komt de meerderheid, het kernkabinet, de regering met een dergelijk voorstel voor de dag.
Ten tweede, in het akkoord dat in de kern tot stand is gekomen, breidt men voor de minderjarigen boven de 16 jaar de bevoegdheden van de gewone rechtbanken, de correctionele rechtbank en het hof van assisen uit.
Het is zo flagrant omdat het ingaat tegen de basisfilosofie van het voorontwerp van de minister van Justitie. Het staat haaks op het — als ik het zo mag noemen — jeugdsanctierecht. Men had precies de bedoeling om aan de jeugdrechtbank en de uitgebreide jeugdrechtbank — zo heette het in het voorontwerp — de mogelijkheid te geven om aangepaste sancties aan minderjarigen op te leggen en de mogelijkheid tot uithandengeving in te krimpen. In de Memorie van Toelichting bij het wetsontwerp werd het heel duidelijk omschreven. Ik citeer de minister van Justitie op pagina 17: "De wet verloochent ten slotte, zoals ze dit vroeger deed, zichzelf niet wanneer ze de mogelijkheid van uithandengeving beperkt." In het akkoord van het kernkabinet heeft men de mogelijkheid van de uithandengeving aanzienlijk doen toenemen door te stellen dat voor de plus 16-jarigen de correctionele rechtbank en het Hof van Assisen bevoegdheid krijgen.
Ik citeer verder: "De wet verloochent tenslotte, zoals ze dit vroeger deed, zichzelf niet wanneer ze de mogelijkheid van uithandengeving beperkt tot jongeren die meerderjarig zijn op het ogenblik dat het gerecht kennis neemt van hun daderschap aan een misdaad die ze gepleegd hebben tussen 16 en 18 jaar. Zijn zij op dat ogenblik nog minderjarig, dan verkrijgt een uitgebreide jeugdrechtbank de bevoegdheid om tegen hen straffen van gemeen recht uit te spreken waarvan de uitvoering kan duren tot ze 25 jaar zijn." Met deze bepaling, waarbij de uithandengeving in het akkoord van het kernkabinet uitgebreid werd, heeft men eigenlijk op de ziel getrapt van de ontwerpers van de wet. Het is niet alleen onbegrijpelijk tegenover de minister van Justitie, die het had voorbereid, het is vooral onbegrijpelijk omdat men uitgaat van een systeem waarover iedereen het eens is dat het geen aangepaste reactie op delinquent gedrag van jongeren mogelijk maakt. Bijgevolg is de oplossing van het kernkabinet zonder meer tegengesteld aan al wie zich ooit heeft uitgesproken over de wijze waarop het probleem van jeugdcriminaliteit zou moeten worden aangepakt.
Nu is het ogenblik aangebroken om de keuze te maken. Wij reageren vanuit de overweging dat wij allen, ook vanuit de oppositie, mee moeten werken aan instrumenten die de overheid in staat stellen jeugdcriminaliteit op een degelijke manier aan te pakken. Het zogenaamde akkoord van 17 of 18 mei 2002, dat in het kernkabinet 's nachts is uitgewerkt en waarbij een onderscheid wordt gemaakt tussen 12- tot 16-jarigen en plus 16-jarigen, zal morgen nog niet gerealiseerd worden. De minister van Justitie heeft deze week in de commissie voor de Justitie gezegd dat de omzetting in een legistieke tekst op korte termijn niet evident is. Hij heeft gezegd dat de totstandkoming van het voorontwerp 2,5 jaar heeft geduurd. Wij hebben daar begrip voor. Hij stelde dat men niet mag verwachten dat wij op enkele weken tijd het wetsontwerp realiseren voor de 12- tot 16-jarigen die criminele feiten plegen. Dat zal heel wat tijd vergen.
We zijn dus nog helemaal niet toe aan de ontwerpen die het akkoord dat in het kernkabinet is bereikt, moeten realiseren. Wij weten nu op geen week of maand na wanneer we daarover van gedachten zullen kunnen wisselen in het Parlement.
Samenvattend, het akkoord is, ten eerste, geen antwoord op de problemen. Ten tweede is het nog helemaal niet in wetteksten gegoten. Bij de bespreking in de commissie heeft mevrouw Talhaoui trouwens gezegd dat zij nog geen tekst van het akkoord had gezien. Ze maakte op dat ogenblik het grootste voorbehoud ten opzichte van de teksten zoals ze vooralsnog in de pers werden meegedeeld.
Mijnheer de voorzitter, mijnheer de minister, collega's, vandaag is een belangrijk moment. Er bestaat op het ogenblik in het Parlement een meerderheid voor het ontwerp-Verwilghen-Maes. Er bestaat momenteel een akkoord over het ontwerp betreffende het jeugdsanctierecht. Dat is deze week nog gebleken in het Vlaams Parlement. Naar aanleiding van de bespreking van het samenwerkingsakkoord dat betrekking heeft op de Everberg-wet heeft het Vlaams Parlement uitdrukkelijk gezegd dat er eigenlijk meer nood is aan een regeling ten gronde van het jeugdsanctierecht dan aan de Everberg-wet. Het is zonder meer duidelijk dat de Vlaamse partijen zich allemaal op het ogenblik terugvinden in het voorontwerp van wet-Verwilghen-Maes, in het jeugdsanctierecht zoals wij dat in het amendement hebben overgenomen.
Er bestaat hiervoor dus een meerderheid in het Parlement en niet alleen bij de Vlaamse partijen. Ik heb deze week met heel veel belangstelling geluisterd naar de reactie van mevrouw Herzet in de commissie voor de Justitie. Ik heb haar reactie trouwens bijzonder gewaardeerd, zeker wanneer ze heel uitdrukkelijk onderstreepte dat ook zij zich terugvindt in de tekst van het voorontwerp — dat nu het amendement is geworden — om te antwoorden op delinquent gedrag van minderjarigen. Er is dus een meerderheid in het Parlement, namelijk de Vlaamse partijen en op zijn minst een aantal leden van de gewezen PRL-fractie. We moeten nu weten wat we daarmee aanvangen. Wij kunnen wachten op het initiatief dat de resultante zou moeten zijn van het akkoord in het kernkabinet, maar dat zal wachten op Godot zijn. De teksten zijn er niet en ze zijn trouwens ook niet adequaat noch lossen ze het probleem op. Wij kunnen ook gebruikmaken van de wetenschap dat er een meerderheid is voor een document waarvan iedereen zegt dat het het instrument is om de jeugdcriminaliteit aan te pakken. Wij vragen vandaag dan ook wanneer we van die meerderheid gebruik zullen maken. Waarop wachten we om van die meerderheid gebruik te maken? Wanneer zullen we de kans grijpen om van die meerderheid gebruik te maken? Er is in ons land een democratische meerderheid, niet alleen communautair bepaald, voor een jeugdsanctierecht, zoals beschreven in het ontwerp-Verwilghen-Maes. Wij moeten nu de kans grijpen om die meerderheid te laten gelden. We moeten dat doen, omdat de meesten onder ons als verantwoordelijke politici dagelijks met het probleem van de jeugdcriminaliteit geconfronteerd worden. Dag in dag uit worden wij geconsulteerd door en geconfronteerd met mensen die daar op een of andere manier het slachtoffer van zijn geworden.
Ook de media worden daarmee geconfronteerd. Nog eens: 59 jonge criminelen werden sinds 1 januari 2002 in Antwerpen vrijgelaten. Dit Parlement heeft ooit op stelten gestaan wanneer een crimineel ten onrechte werd vrijgelaten! Hier zijn er in één arrondissement 59 criminelen vrijgelaten.
Wij weten dat we een meerderheid hebben, een meerderheid waarvan wij nu gebruik moeten maken. Wij hebben de keuze. Als wij dit niet doen, gaan wij in de richting van wat mevrouw Maréchal en andere Franstalige collega's voorstaan, met name een situatie waarin wij geblokkeerd zijn in onze wil en onze intentie om deze vorm van criminaliteit aan te pakken. Laten wij ons vandaag blijvend gijzelen door wat Maréchal, de bevoegde Franstalige gemeenschapsminister, zegt, of gaan wij gebruik maken van het instrument dat wij hier in het Parlement hebben om het probleem op te lossen? Wij hebben de meerderheid om dit te doen, collega's. Laten wij daar vandaag gebruik van maken.
Waarom moeten wij dit nu doen? Wij moeten dit nu doen omdat het natuurlijk nog niet zal volstaan om dit amendement goed te keuren vooraleer deze wetgevende regeling zal kunnen worden omgezet in een wettelijke regeling op het terrein. Wij zullen dit nog moeten voorleggen aan het overleg met de gemeenschappen. Dat betekent dat, als wij de wil daartoe vandaag uitdrukken, dit nog een procedure vergt in overleg met de gemeenschappen. Als wij het vandaag niet doen, zullen wij in deze legislatuur niet meer tot een wettelijke regeling komen. Daartoe nodig ik u heel uitdrukkelijk uit, wetende dat wij in staat zijn om dit te doen. Ik vraag ook heel uitdrukkelijk aan de minister van Justitie om deze gelegenheid aan te grijpen. Het is een element van het justitiebeleid dat zo belangrijk is, dat zo gevoelig is voor om het even wie aan politiek doet, voor om het even welke partij die aan politiek doet, dat wij ons niet kunnen veroorloven om nog een dag langer te wachten met het op gang brengen van de procedure om de wettelijke regeling inzake het jeugdsanctierecht om te zetten in concrete realiteit. Dit is mijn vraag en mijn oproep. Die oproep is te situeren in een sfeer die leefde in dit Parlement op het ogenblik dat wij werden geconfronteerd met fundamentele problemen van Justitie. Dat was een sfeer van over de partijgrenzen heen zoeken naar fundamentele oplossingen voor maatschappelijke problemen die zich aandienen.
Er is een tekst. Het is een tekst van een minister van deze regering. Het is een tekst waarvan alle ingewijden zeggen dat het een degelijke oplossing is. Er is het gegeven dat de huidige tekst niet meer voldoet. Er is het gegeven van de jeugdcriminaliteit. Er is het gegeven van een meerderheid in dit Parlement. Wat zal ons nog tegenhouden om nu inderdaad onze verantwoordelijkheid op te nemen? Degenen die dit niet zouden doen, dragen natuurlijk een enorme verantwoordelijkheid. Ik wil het echter positief formuleren. Wij hebben nu de kans om dit te doen. Wij moeten ons nu uitspreken, elk van ons die toch al op een of andere wijze in zijn politieke activiteit met het fenomeen van de jeugdcriminaliteit zal zijn geconfronteerd. Dit document is trouwens ook geen exclusief repressief element. Het is een document dat een waaier van reacties mogelijk maakt, van een geëigende rechtsinstantie met de nodige rechtswaarborgen ten opzichte van jongeren die in de delinquentie terecht zijn gekomen.
Dit is de uitdaging van het moment. Het is een uitdaging voor elk van ons, waarvoor iedereen in eer en geweten zijn stem moet laten horen. Wetende wat wij weten, met name dat in het Vlaamse Parlement alle partijen op dezelfde golflengte zitten en uitdrukkelijk hebben gezegd dat zij zich in dit jeugdsanctierecht herkennen, wetende dat ook aan Franstalige zijde men uitdrukkelijk heeft gezegd dat men zich in deze tekst herkent, kan er inhoudelijk, politiek, ideologisch geen enkel probleem zijn.
Laten wij nu voor een keer de tegenstellingen overstijgen, niet in functie van een of ander politiek gewin, maar in functie van het oplossen van een probleem dat door iedereen van u zal aangevoeld worden. Want wanneer we weten dat jonge mensen van 10, 11, 12, 13, 14 jaar criminele feiten plegen, dan hebben wij een dubbele opdracht.
Dat wil zeggen: een aangepaste reactie uitlokken vanwege de samenleving en de overheid, maar ook zonder enige twijfel een aangepaste opvang realiseren voor deze jongeren. Dit is precies wat in dit document terug te vinden is. Laten wij dan ook met overtuiging dit engagement aangaan. We weten dat we ervoor zijn. Laten wij dat dan ook uitdrukken in het stemgedrag.

Mr. Speaker, Mr. Minister, colleagues, the draft law that we are dealing with here addresses a punctual but nevertheless important problem due to an interpretation space given by article 52 of the law of 8 April 1965 on the protection of youth. That draft law solves an interpretation problem, in the sense that urgent and provisional measures, to be taken by the juvenile judge, are possible for minors who were minors at the time of committing the offence but have reached the age of majority before the commencement of the proceedings. As a result of the interpretation of Article 52, it was unclear — and in reality they did not — that the juvenile judges could take urgent and provisional measures. This bill will properly resolve this problem. The CD&V group is therefore in favor of this bill.
As you know, there are even more fundamental problems related to the problem of addressing youth crime. Following that draft law, we have been so free to submit an amendment that takes over the preliminary draft law of the Minister of Justice and in which we also would like to mention the name of the employee of the Minister, Mr Christian Maes. It is about the preliminary design containing responses to criminal behavior by minors. That preliminary draft we have taken over, cast in an amendment and submitted as an amendment to that draft law. The reason for this is almost obvious. In fact, a legal framework containing responses to criminal behavior by minors is very urgently needed and necessary. Today we are in a state of impunity. Because there are insufficient seats in the closed institutions of the communities and because Everberg does not offer the foreseeable solutions, it appears that young criminal minors and young offenders are being systematically released in the big cities. There is a state of impunity on the ground. The figures do not lie. Last Tuesday, the Minister of Justice informed the competent committee that since 1 January 2002 — and now we are almost in the middle of 2002 — 59 minor offenders had to be released, alone in the district of Antwerp. There were 59 juvenile offenders for whom the juvenile judge had taken the measure of admission in a closed or semi-open institution.
59 cases in one district in a half-year period, this can count. It proves the extent of the problem, which indeed shines the public opinion from the eyes and actually expresses in a very flagrant way the mistrust that people have in the apparatus of justice and police.
Furthermore, the figures communicated by the Minister since the establishment of the institution in Everberg have equally demonstrated the extent to which the problem exists. During the period from 1 March — the day Everberg became operational — to 31 May, the youth judges decided 124 times that the youth should be admitted to the institutions Everberg. In the absence of seats in the closed institutions of the communities, 70 decisions could not be executed. This also shows to what extent the problem exists.
The problem is, of course, that some criminal organizations or organized crime have understood this. These international organizations use minor offenders to commit criminal acts, assuming that they will still remain impunity. Very young offenders — 11-, 12-, 13-year-olds are no exception — are used to commit acts that deeply disturb the victims. Therefore, the problem is not only in relation to individual, young criminals who commit false facts, but it has become a structural problem. That is why we submitted this amendment. We want to confront Parliament with the problem, but we also want to give it the opportunity to provide an initial solution to this problem.
The problem arises, in the first place, from facts as I have explained them to you: the presence of many juvenile delinquents who often act within the framework of criminal organizations, but also exist because the current legislation, the Act of 1965 on the protection of youth, no longer complies. I believe that this has become very clear in all sorts of statements and publications in recent times, but to the extent necessary I would like to quote from the explanatory memo from the preliminary project Verwilghen-Maes containing answers to the delinquent behavior of minors. There it is said very clearly and with knowledge of the facts that the model of youth protection is no longer suitable to respond to the crime of today’s youth and I would like to quote from page 5 of the memo of explanation: “The model of protection has disappointed, not only because of the ambiguity in its goals, the unfairness of its presentation, the discretionary of the given powers with reduced legal guarantees. It also demonstrates powerlessness towards persistent offenders, making exceptions deemed necessary, such as the outreach. The measures taken do not provide a differentiated, at least inadequate, approach for drug addicts and mentally ill minors.”
It cannot be described more clearly than by the Minister himself in the explanatory memo of the preliminary draft. The protection model is not satisfying; it has disappointed and it is not a response to the current situation of youth and youth crime, especially in the big cities. I also refer, by the way, to what the Minister of Justice said this week in the Committee on Justice regarding the situation in Antwerp in which a number of Romanian minor offenders were deported. I quote: “The law on the protection of youth is completely inefficient with regard to this form of crime.” On the one hand, therefore, we are dealing with structurally organized youth crime and on the other hand, there is a legislative model that does not meet in any way.
On 17 May, the nuclear cabinet drafted a scheme which is declared to be a solution to the problem. This arrangement does not solve the problem we are now facing.
First, the arrangement drawn up by the nuclear cabinet is entirely opposed to the basic idea of Minister Verwilghen’s preliminary draft law. When this was debated in the Committee on Justice, Ms. Talhaoui expressed herself in very cynical terms. She said that the preliminary design Verwilghen-Maes, due to what the nuclear cabinet has drawn up, has expired.
Mr. Tavernier, in the scheme developed by the nuclear cabinet and at some point also supported by the majority, the youth protection model for minor offenders between 12 and 16 years of age is ⁇ ined and even reinforced instead of developing a scheme that can have a different response to youth crime. I think we all agree that the youth protection model no longer meets. This is at least the conclusion of the Minister of Justice and his employees. It is truly incomprehensible that one goes against the reality of things in, against the data on the ground in the cities and municipalities and against the reality of no longer meeting the protection model, comes the majority, the nuclear cabinet, the government with such a proposal for the day.
Second, the agreement, which has been concluded in its core, extends the powers of the ordinary courts, the correctional court and the court of assises to minors over the age of 16.
It is so flagrant because it goes against the basic philosophy of the Minister of Justice’s preliminary draft. It is contrary to the — if I can call it so — youth sanction law. It was precisely intended to give the Youth Court and the extended Youth Court — as it was called in the preliminary draft — the possibility to impose adapted sanctions on minors and to curtail the possibility of extortion. In the Memory of Explanation attached to the bill, it was very clearly described. I quote the Minister of Justice on page 17: “Finally, as it did before, the law does not deny itself when it limits the possibility of excommunication.”In the nuclear cabinet agreement, the possibility of excommunication has been significantly increased by providing that for the plus 16-year-olds the correctional court and the Court of Assisi be competent.
I quote further: “The law, after all, as it did before, does not deny itself when it limits the possibility of extradition to young people who are major at the moment when the court becomes aware of their commitment to a crime they have committed between 16 and 18 years of age. If they are still underage at that time, then an extensive juvenile court acquires the power to impose against them common-law penalties, the execution of which can last until they are 25 years old."This provision, which extended the grant in the agreement of the nuclear cabinet, has actually stumbled on the soul of the drafters of the law. It is not only incomprehensible to the Minister of Justice, who had prepared it, it is especially incomprehensible because one assumes a system that everyone agrees that it does not allow an adapted response to youth’s delinquent behavior. Consequently, the solution of the nuclear cabinet is undoubtedly contrary to anyone who has ever spoken about how the problem of youth crime should be addressed.
Now is the time to make the choice. We respond from the consideration that all of us, including from the opposition, should work together on tools that enable the government to tackle youth crime in a sound way. The so-called agreement of 17 or 18 May 2002, which was drafted in the nuclear cabinet at night and which makes a distinction between 12- to 16-year-olds and plus 16-year-olds, will not be realized tomorrow. The Minister of Justice said this week in the Committee on Justice that the transition into a legislative text in the short term is not obvious. He said that the creation of the preliminary design took 2.5 years. We have understanding for that. He argued that we should not expect to implement the bill for the 12- to 16-year-olds who commit criminal acts within a few weeks. This will take a lot of time.
Therefore, we are not yet at all close to the designs that need to realize the agreement reached in the nuclear cabinet. We do not know in a week or a month when we will be able to exchange opinions on this in Parliament.
In summary, the agreement is, first of all, no answer to the problems. Secondly, it has not yet been put into legislative texts. During the discussion in the committee, Ms Talhaoui also said that she had not yet seen the text of the agreement. She made at that moment the greatest reservation with respect to the texts as they have been communicated in the press so far.
Mr. Speaker, Mr. Minister, Ladies and Gentlemen, today is an important moment. There is currently a majority in Parliament in favour of the draft-Verwilghen-Maes. There is currently an agreement on the draft law on youth sanctions. This was announced this week in the Flemish Parliament. Following the discussion of the cooperation agreement relating to the Everberg Act, the Flemish Parliament has explicitly stated that there is actually more need for a regulation on the basis of the youth sanction law than the Everberg Act. It is undoubtedly clear that the Flemish parties all find themselves at the moment in the preliminary draft of the law-Verwilghen-Maes, in the youth sanctions law as we have adopted it in the amendment.
Therefore, there is a majority in Parliament and not only among the Flemish parties. This week I listened with great interest to Mrs. Herzet’s response in the Justice Committee. I also ⁇ appreciated her response, especially when she very explicitly emphasized that she also finds herself in the text of the preliminary draft — which has now become the amendment — to respond to delinquent behavior of minors. There is thus a majority in Parliament, namely the Flemish parties and at least some members of the former PRL group. Now we need to know what to start with it. We can wait for the initiative that should result from the agreement in the nuclear cabinet, but that will wait for Godot to be. The texts are not there and, by the way, they are neither adequate nor solve the problem. We can also use the science that there is a majority for a document that everyone says is the tool to tackle youth crime. So today we ask when we will use that majority. What are we waiting for to use that majority? When will we take the opportunity to take advantage of that majority? There is in our country a democratic majority, not only community-determined, for a youth sanction right, as described in the draft-Verwilghen-Maes. We must now seize the opportunity to enforce that majority. We must do so because most of us, as responsible politicians, face the problem of youth crime on a daily basis. Day by day we are consulted by and confronted with people who have somehow become the victims of being there.
The media is also faced with this. Again, 59 young criminals have been released in Antwerp since January 1, 2002. This Parliament has once stood up when a criminal was unjustly released! In one district, 59 criminals were released.
We know that we have a majority, a majority that we must use now. We have the choice. If we do not do this, we will move towards what Ms. Maréchal and other French-speaking colleagues are advocating, in particular a situation in which we are blocked in our will and our intention to tackle this form of crime. Should we be held permanently hostage today by what Maréchal, the competent French-speaking community minister, says, or will we use the instrument we have here in Parliament to solve the problem? We have the majority to do this, colleagues. Let us use it today.
Why should we do this now? We must do this now because, of course, it will not be enough to approve this amendment before this legislative arrangement can be converted into a legal arrangement on the ground. We will still need to present this to the consultation with the communities. This means that, if we express the will to do so today, this requires a procedure in consultation with the communities. If we do not do it today, we will no longer come to a legal arrangement in this legislature. To this end, I invite you very explicitly, knowing that we are able to do this. I urge the Minister of Justice to take advantage of this opportunity. It is an element of justice policy that is so important, that it is so sensitive to anyone who is involved in politics, to any party who is involved in politics, that we cannot afford to wait a day longer with the initiation of the procedure to translate the legal system on the right of youth sanctions into a concrete reality. This is my question and my call. That call is to be situated in an atmosphere that lived in this Parliament at the time when we were faced with fundamental issues of Justice. That was an atmosphere of searching across party boundaries for fundamental solutions to social problems that arise.
There is a text. It is a text from a minister of this government. It is a text that all initiates say is a solid solution. There is a fact that the current text no longer satisfies. There is the issue of youth crime. There is a majority in this Parliament. What will stop us from taking responsibility now? Those who would not do this, of course, carry a huge responsibility. However, I would like to formulate it positively. We now have the opportunity to do this. We must now speak, each of us who, in some way or another, will have already faced the phenomenon of youth crime in his political activity. This document, by the way, is also not an exclusive repressive element. It is a document that allows a range of responses, from a suitable judicial authority with the necessary legal guarantees in relation to young people who have come into the delinquency.
This is the challenge of the moment. It is a challenge for each of us, for which everyone must make his voice heard in honour and conscience. Knowing what we know, in particular that in the Flemish Parliament all parties are on the same wavelength and have expressly said that they recognize themselves in this youth sanction law, knowing that also on the French-speaking side it has been expressly said that one recognizes itself in this text, there can be no problem in terms of content, politics, ideology.
Let us now once overcome the contradictions, not in terms of some political gain, but in terms of solving a problem that will be felt by each of you. For when we know that young people aged 10, 11, 12, 13, 14 are committing criminal acts, then we have a double mission.
That is, provoking an adapted response from society and the government, but also without any doubt realizing an adapted reception for these young people. This is exactly what can be found in this document. Let us therefore take this commitment with conviction. We know we are for. Let us express this in voting behavior.

Mijnheer de voorzitter, mijnheer de minister, collega's, vanzelfsprekend kan niemand tegen het kleine wetsontwerp zijn dat vandaag besproken wordt. Het vult immers een hiaat op in de bestaande wetgeving. Maar het belang van deze wet mag natuurlijk ook niet overschat worden. Het gaat enkel over jongeren die meerderjarig worden tijdens de procedure, of voorafgaand aan de procedure. Aan de grote problemen inzake het jeugdrecht wordt niets gedaan. Het is dan ook terecht dat het debat vandaag via de omweg van het amendement van collega Van Parys wordt opengetrokken. U weet dat wij niet al te hoog oplopen met het huidig Vlaamse Parlement zoals het vandaag bestaat, omdat het in de praktijk een vazalparlement is van zijn federale tegenpool. De denigrerende toon waarop sommige kamerleden over dit Parlement spreken is duidelijk genoeg. Recent hebben we nog meegemaakt dat het Vlaamse Parlement bij de behandeling van een belangenconflict inzake toegevoegde rechters gewoon belazerd werd door de minister van Justitie.
Maar af en toe kan het ook zeer zinvolle dingen doen. Ik moet toegeven dat ik heel aangenaam verrast was met de reactie van de meerderheidsfracties in het Vlaams Parlement op het fameuze akkoord van een halve A4 van 16 mei inzake het jeugdrecht. Het hele akkoord, waarover men zo lang over heeft moeten onderhandelen, werd neergeschreven op amper 1 A4-velletje.
Weliswaar heeft het een maand geduurd vooraleer er een reactie op kwam. Dat akkoord van 16 mei kreeg een reactie op 19 juni. De frank is bijzonder laattijdig gevallen. Bij ons zeggen ze dan dat het geen muntstuk was, maar een briefje. De reactie was in elk geval duidelijk. Ze klonk ons als muziek in de oren. Ik citeer De Standaard van 19 juni: "De Vlaamse meerderheidspartijen vinden het federale compromis over het jeugdrecht een mislukking. De volgende minister van Justitie krijgt de opdracht een nieuw ontwerp te schrijven. Liever een deugdelijk samenhangend nieuw jeugdrecht, dan de puzzel die men nu wil maken. In het kernkabinet over het jeugdrecht zijn twee culturen gebotst. Aan Waalse kant wil men alleen delinquente jongeren beschermen. Aan Vlaamse kant wil men jongeren het recht geven gestraft te worden', zei nota bene iemand van Agalev." Zij stond blijkbaar op een heel andere golflengte dan mevrouw Talhaoui.
Dit was een vernietigende analyse en alvast volstrekt in tegenspraak met de triomfantelijke taal van de VDL-Burgerkrant, waar dit akkoord door Karel De Gucht himself, overigens ook lid van het Vlaams Parlement, verdedigd wordt. De heer De Gucht fluit zichzelf dus terug.
Veel belangrijker is in ieder geval dat het Vlaams Parlement met deze uitspraak het vertrouwen in de huidige minister van Justitie Marc Verwilghen kort en goed opblaast. Men zegt zelfs dat de heer Verwilghen zijn huiswerk niet moet hermaken. Er moet niet opnieuw onderhandeld worden. Nee, men zegt dat de volgende minister van Justitie een nieuw jeugdsanctierecht moet schrijven, de volgende medewerker van de minister dus.
Met deze minister en met deze regering valt niet meer te praten. Als staaltje van wantrouwen vanwege VLD'ers in hun eigen minister kan dit tellen. Deze brute afwijzing komt er in de praktijk op neer dat minstens aan twee van de drie ontwerpen, die momenteel door de medewerker van de minister worden voorbereid, geen uitvoering kan worden gegeven en dat zijn werk nog maar eens, net zoals het ontwerp inzake het jeugdsanctierecht, zinloos zal zijn tenzij het misschien kan fungeren als amendement hier of daar, zoals het ontwerp dat vandaag als amendement wordt ingediend. Immers, de minister heeft de gemeenschappen nodig om die wetten goedgekeurd te krijgen en zeker om ze uit te voeren. De afgang is dus totaal. De opzegging van het vertrouwen is natuurlijk niet verwonderlijk als men de oorspronkelijke teksten vergelijkt met hetgeen uiteindelijk uit de bus is gekomen. Als een onderhandelaar er zelfs maar niet in slaagt een fractie van zijn belofte te realiseren, dan heeft hij gefaald als onderhandelaar. Als men dingen gaat verdedigen die compleet haaks staan op wat er in de eigen teksten stond, dan verliest men zijn geloofwaardigheid. Als men zich volledig laat dicteren door de Walen, dan heeft men gefaald als Vlaming. Dat is inderdaad wat hier is gebeurd.
Minister Verwilghen beloofde een samenhangend jeugdrecht met uitgebreide bevoegdheden voor de jeugdrechter, ook op het vlak van sancties, ook op het vlak van celstraffen. Voor ons was dit voorstel nog lang niet verregaand genoeg, zeker als we het vergelijken met de ons omringende landen waar veel langere straffen mogelijk zijn. Het was echter in elk geval een stap in de goede richting. Eindelijk werd afgestapt van het eenzijdige beschermingsmodel, eindelijk werd het roer omgegooid en werd uitgegaan van de realiteit met name dat jongeren niet altijd brave doetjes zijn die we moeten beschermen tegen de wereld van de volwassenen en dat zij zich integendeel al te vaak als criminele volwassenen gedragen en dat er bijgevolg duidelijke sancties moeten mogelijk zijn. Ik herhaal dat dit voor ons niet voldoende was. Een 13-jarige zou maximaal twee jaar celstraf kunnen krijgen, ook na het plegen van een gruwelijke moord, maar het was een stap vooruit.
Niets daarvan bleef heel in het compromis van 16 mei. Waar de tekst van het ontwerp nog duidelijk uitging van de bevoegdheid van de jeugdrechter om celstraffen uit te spreken voor jongeren vanaf 12 jaar komt daar nu niets meer van in huis. Alleen zullen 16-plussers wat gemakkelijker uit handen kunnen worden gegeven, en ook dat is zelfs nog niet duidelijk want het akkoord was terzake heel dubieus. Het was ook slechts een A5-je groot.
Alleen de jeugdrechter wordt hierdoor helemaal ontmand omdat hij geen stok achter de deur krijgt en niet repressief kan optreden. Deze beslissing is de letterlijke overname van een voorstel van het recente PS-congres inzake veiligheid en staat totaal haaks op de beschouwingen over uit handengeving in de teksten van de minister.
Ten tweede, voor jongeren onder de 16 wordt het überhaupt onmogelijk om celstraffen op te leggen. Ze kunnen alleen, zoals nu, tijdelijk in bewaring worden genomen terwijl het precies op die leeftijd het hardst nodig is dat jongeren uit hun milieu — en natuurlijk gaat het altijd om uitzonderingen — worden weggetrokken terwijl een celstraf op die leeftijd juist nog het meeste zin kan hebben.
Ten derde, het enige wat de jeugdrechters wel zullen mogen is alternatieve sancties opleggen. Dat is echter op zich helemaal niet nieuw want het gebeurde al in de praktijk. Was het niet vanwege de jeugdrechter dan was het via de parketmagistraat. Hiermee wordt dus niets nieuws gerealiseerd.
Ten vierde, de zware criminele jongeren die vandaag uit handen worden gegeven en in de gewone gevangenis terechtkomen moeten daaruit verdwijnen en moeten naar Everberg of naar een equivalent ervan. Ook dat is een sterke achteruitgang want voor die criminelen is Everberg een waar paradijs in vergelijking met de gevangenis. Ook hier wordt de afschrikking fel uitgehold.
Deze prutsmaatregelen zijn het enige wat nog overblijft van het zo lang verwachte ontwerp van minister Verwilghen. In de praktijk zal er hiermee niets ten goede veranderen en het is alleen maar toe te juichen dat de Vlaamse partijen daar niet wensen in mee te spelen en de huidige justitieminister desavoueren.
De botte afwijzing door het Vlaams Parlement betekent in elk geval dat er tijdens deze legislatuur niets meer in huis zal komen van de hervorming van het jeugdrecht.
Dat betekent vier jaar verloren tijd, alleen al in deze legislatuur, voor zover de regering het uithoudt tot juni 2003.
Het verhaal duurt natuurlijk al veel langer. Nog onder minister Wathelet werd de opdracht gegeven alternatieven te formulieren voor het lakse en achterhaalde jeugdbeschermingsrecht uit de jaren zestig. In 1996 — inmiddels zes jaar geleden — heeft de commissieCornelis een uitvoerig en degelijk rapport ingediend, waarin de eenzijdigheid van de wet van 1965 scherp werd aangeklaagd. Wat deden de twee vorige ministers van Justitie, Stefaan de Clerck en mijn goede collega Tony Van Parys, met die studie? Zij schoven de tekst jammer genoeg in een schuif en ze bleven stilzitten. Herhaaldelijk heb ik de vorige minister van Justitie ondervraagd. Men kwam tot de vaststelling dat men inderdaad bevoegd was voor de oprichting van jeugdgevangenissen, maar er werd niets ondernomen. Er werd wel kiespropaganda over gevoerd en er werden meetings over gehouden, maar de minister zelf heeft geen initiatieven genomen, ook niet om de schrapping van artikel 53 en de gevolgen daarvan voor te bereiden om de jongeren die vanaf 1 januari van dit jaar niet meer in de gevangenis mochten worden opgesloten, op te vangen. Zelfs tijdens deze legislatuur had de toenmalige CVP het niet begrepen met haar voorstel waarbij ook meerderjarigen naar de jeugdrechter zouden worden verwezen. Door de omgekeerde uithandengeving zou het probleem van tekort aan gevangeniscellen en concrete moeilijkheden op het terrein alleen maar groter geworden zijn.
Dat doet niets af aan de verpletterende verantwoordelijkheid van minister Verwilghen, voor wie de strijd tegen de onveiligheid het enige echte verkiezingsthema was, waarvan de jeugdcriminaliteit een zeer belangrijk hoofdstuk was. Terwijl het bij de CVP om een verregaande verwaarlozing ging, is het bij minister Verwilghen uitgedraaid op het radicale breken van zijn belofte. Dat is natuurlijk veel erger.
Het Vlaams Parlement heeft nog een essentiële vaststelling gedaan. Tijdens de onderhandelingen zijn twee culturen gebotst, zeggen de Vlaamse parlementsleden unisono. In Vlaanderen zijn de meningen inzake jeugdrecht — een thema dat ogenschijnlijk communautair neutraal zou kunnen zijn — totaal verschillend van die in Wallonië. Men maakt nu de fout opnieuw zijn hoop te stellen in een volgende federale minister. Ik heb dat zopas ook uit de woorden van collega Van Parys kunnen afleiden. Ook hij hoopt nog altijd dat er een federale meerderheid zal worden gevonden. Ik denk dat het naïef is te geloven dat een volgende federale minister wel een coherent jeugdbeleid zou kunnen uitwerken. Dat is de mensen blaasjes wijsmaken. Het is nu duidelijk genoeg dat de meningen in Vlaanderen en Wallonië zodanig haaks staan op elkaar, dat van een eenvormig beleid in de twee gewesten geen sprake kan zijn. Dat wordt overduidelijk geïllustreerd door het incident met de opvoeder van de Franse Gemeenschap, die weigerde een bewaker te helpen en daarvoor — ongelooflijk maar waar — werd beloond door minister Maréchal. Alleen al het feit dat men een absoluut onbekwaam geval als Maréchal handhaaft als minister van Jeugdzaken in de Franse Gemeenschap bewijst afdoende dat Wallonië niet wil weten van een harde aanpak. De Franse Gemeenschap wil Everberg heel bewust boycotten.
Dat blijkt uitgerekend vandaag opnieuw, nu de Franse Gemeenschap amper 5 extra plaatsen vraagt in Everberg en dus maximaal 10 criminele jongeren wil laten opvangen terwijl Everberg over 50 plaatsen zal beschikken. Nochtans zijn de problemen in Brussel en Wallonië op vlak van jeugdcriminaliteit nog veel groter dan in Vlaanderen. De cijfers van de minister liegen er niet om. Bij de uithandengeving zijn ongeveer dubbel zoveel Franstaligen als Vlamingen betrokken. Indien er inderdaad 40 plaatsen voor Nederlandstaligen in Everberg komen, evolueert Vlaanderen naar een totaal van 140 gesloten opvangplaatsen. Dat is nog steeds een peulschil in vergelijking met Nederland, maar Wallonië zal slechts over 60 plaatsen beschikken. Vandaag hebben zij 50 plaatsen en er komen er 10 bij, terwijl er eigenlijk 280 plaatsen — 4 keer zoveel — nodig zijn.
Collega's, met zo'n verschil in mentaliteit moeten we onvermijdelijk naar een splitsing van Justitie gaan, ook al omdat het jeugdrecht niet het enige dossier is waar Vlamingen en Walen botsen. Ik verwijs naar de nationaliteitswetgeving, waarover Vlamingen en Walen heel andere opvattingen hebben.
Er is de kwestie van de spijtoptanten waar we recht tegenover mekaar staan; er is het snelrecht dat de Franstaligen helemaal uitholden waarbij ze zelfs geen herstellingswet toelieten en er is het veiligheidsplan dat door de PS helemaal werd herschreven. Wij stellen in de commissie voor de Justitie trouwens voortdurend vast dat de standpunten van Franstaligen en Vlamingen telkens opnieuw uit elkaar lopen. De enige interessante discussie gaat over de wijze waarop moet worden gesplitst. Een opdeling van Justitie naar de Gemeenschappen is natuurlijk de enige aanvaardbare formule. Op het terrein zal ze echter onmogelijk zijn in Brussel. Er kunnen op hetzelfde grondgebied moeilijk twee soorten Justitie bestaan. Zulks is werken met twee maten en gewichten naargelang de erg wisselende en vage taalaanhorigheid in Brussel. Een splitsing van Justitie in Brussel kan wel een kantelmoment zijn om aansluiting te zoeken bij Vlaanderen, in de eerste plaats omdat de mentaliteit van de Brusselaars mijlenver is verwijderd van het laksisme van de PS dat in Wallonië zo dominant en alom tegenwoordig is. Ik hoop dat de Brusselaars op het juiste moment zullen inzien dat de Waalse leiders hun belangen niet dienen en dat ze vaststellen dat Vlaanderen wel degelijk een alternatief kan bieden. Vlaanderen kan en zal er op genereuze wijze voor zorgen dat Brussel eindelijk uit het moeras wordt getrokken.

Mr. Speaker, Mr. Minister, colleagues, of course, nobody can be against the small bill that is being discussed today. It fills a gap in existing legislation. The importance of this law should not be overestimated. It only concerns young people who become major during the procedure or before the procedure. Nothing is done to address the major problems of youth law. It is therefore right that the debate is opened today through the circumference of the amendment of colleague Van Parys. You know that we do not rise too high with the current Flemish Parliament as it exists today, because in practice it is a vassal parliament of its federal counterpart. The denigrating tone in which some House members speak about this Parliament is clear enough. Recently we have also experienced that the Flemish Parliament was simply fooled by the Minister of Justice when dealing with a conflict of interest regarding additional judges.
But from time to time it can also do very meaningful things. I must admit that I was very pleasantly surprised by the reaction of the majority factions in the Flemish Parliament to the famous half-A4 agreement of 16 May on youth law. The entire agreement, which had to be negotiated for so long, was written on just 1 A4 sheet.
It took a month before there was a response. That agreement of 16 May received a response on 19 June. The franc has fallen very late. In our case, they say it was not a coin, but a note. In any case, the reaction was clear. It sounded like music in our ears. I quote De Standaard of 19 June: "The Flemish majority parties consider the federal compromise on youth law a failure. The next Minister of Justice will be commissioned to write a new draft. Better a properly coherent new youth law than the puzzle that one wants to create now. In the nuclear cabinet on youth law, two cultures are broken. On the Wall side, only criminal youths are protected. On the Flemish side one wants to give young people the right to be punished,” said nota bene someone from Agalev.”She was apparently on a very different wavelength than Mrs. Talhaoui.
This was a devastating analysis and in total contradiction with the triumphant language of the VDL-Burgerkrant, where this agreement is defended by Karel De Gucht himself, also a member of the Flemish Parliament. So Mr. De Gucht whispers himself back.
Much more important, in any case, is that the Flemish Parliament with this judgment briefly and properly blows up the confidence in the current Minister of Justice Marc Verwilghen. It is even said that Mr. Verwilghen should not reconsider his homework. There is no need to negotiate again. No, it is said that the next Minister of Justice must write a new youth sanction law, the next employee of the Minister.
With this minister and with this government we can no longer talk. As a staple of mistrust due to VLD’s in their own ministry, this can count. In practice, this brutal rejection consists in the fact that at least two of the three drafts currently being prepared by the minister’s associate cannot be implemented and that his work again, like the draft on the law on youth sanctions, will be meaningless unless it may serve as an amendment here or there, like the draft submitted today as an amendment. After all, the minister needs the communities to get those laws approved and ⁇ to implement them. The departure is total. The termination of trust is of course not surprising when one compares the original texts with what eventually came out of the bus. If a negotiator fails to fulfill even a fraction of his promise, he has failed as a negotiator. If one begins to defend things that are completely contrary to what was stated in the own texts, one loses its credibility. If you allow yourself to be completely dictated by the Whales, you have failed as a Flaming. This is indeed what happened here.
Minister Verwilghen promised a coherent youth law with extended powers for the youth judge, including in terms of sanctions, including in terms of prison sentences. For us, this proposal was far from extensive enough, especially if we compare it with the countries around us where much longer sentences are possible. However, it was at least a step in the right direction. Finally, the unilateral protection model was abandoned, finally, the wheel was thrown back and it was taken from the reality, in particular, that young people are not always brave bearings that we must protect from the world of adults and that, on the contrary, they behave too often as criminal adults and that therefore clear sanctions must be possible. I repeat that this was not enough for us. A 13-year-old could be sentenced to up to two years in prison, even after committing a horrible murder, but it was a step forward.
None of this remained entirely in the compromise of 16 May. Whereas the text of the draft still clearly outlined the competence of the juvenile judge to pronounce prison sentences for young people from 12 years of age, there is now nothing in mind. Only 16-year-olds can be given out of hand a little easier, and this is not even clear yet because the agreement was very dubious in this regard. It was only an A5 size.
Only the juvenile judge is completely dismantled because he does not get a stick behind the door and can not act repressively. This decision is the literal takeover of a proposal from the recent PS-Congress on security and is completely contrary to the considerations left out of hand in the texts of the minister.
Second, it becomes impossible for young people under 16 to impose prison sentences at all. They can only be temporarily detained, as they are now, when it is precisely at that age that it is most necessary for young people to be removed from their environment — and, of course, there are always exceptions — while a prison sentence at that age can still make the most sense.
Third, the only thing the youth judges will be allowed to do is impose alternative sanctions. This, however, is not new in itself because it has already happened in practice. If it wasn’t because of the juvenile judge, it was through the parket magistrate. Therefore, nothing new is achieved.
Fourth, the heavy criminal youths who today are handed out and ended up in the ordinary prison must disappear from there and must go to Everberg or to an equivalent. This is also a strong decline because for those criminals Everberg is a real paradise compared to the prison. Here, too, the deterrence is severely exhausted. Their
These measures are the only remains of Minister Verwilghen’s long-awaited draft. In practice, this will not change anything for the better and it is only to congratulate that the Flemish parties do not want to play in that and disapprove the current Minister of Justice.
The flagrant rejection by the Flemish Parliament means, in any case, that during this legislature there will be nothing more in the house of the reform of the youth law.
That means four years of lost time, only in this legislature, as long as the government can endure it until June 2003.
The story, of course, has taken a long time. Even under Minister Wathelet, it was commissioned to formulate alternatives to the lax and outdated youth protection law of the 1960s. In 1996 — now six years ago — the Cornelis committee submitted a comprehensive and solid report, sharply denouncing the unilaterality of the 1965 law. What did the two former Justice Ministers, Stefaan de Clerck and my good colleague Tony Van Parys, do with that study? Unfortunately, they pushed the text into a slide and they remained silent. I have repeatedly questioned the former Minister of Justice. It was determined that it was indeed authorized to establish youth prisons, but nothing was done. Election propaganda and meetings were held, but the Minister himself did not take any initiatives, not even to prepare the removal of Article 53 and the consequences thereof to capture the young people who were no longer allowed to be imprisoned from 1 January this year. Even during this legislature, the then CVP had not understood its proposal, which would also refer adult persons to the youth court. As a result of the reverse outreach, the problem of the shortage of prison cells and concrete difficulties on the ground would have only been aggravated.
That does not diminish the crushing responsibility of Minister Verwilghen, for whom the struggle against insecurity was the only real election theme, whose youth crime was a very important chapter. While the CVP was a widespread negligence, Minister Verwilghen was driven to the radical breach of his promise. That is of course much worse.
The Flemish Parliament has made another important conclusion. During the negotiations, two cultures were struck, the Flemish parliamentarians say unisono. In Flanders, the views on youth law – a topic that could seem to be community-neutral – are completely different from those in Wallonia. They are now making the mistake of putting again their hopes in a next federal minister. I can only deduce this from the words of colleague Van Parys. He also hopes that a federal majority will be found. I think it is naïve to believe that a next federal minister could develop a coherent youth policy. That’s how people make blades. It is now clear enough that the opinions in Flanders and Wallonia are so opposite that there can be no uniform policy in the two regions. This is clearly illustrated by the incident with the educator of the French Community, who refused to help a guard and for this — incredible but true — was rewarded by Minister Maréchal. Only the fact that one ⁇ ins an absolutely incompetent case such as Maréchal as Minister of Youth in the French Community proves sufficiently that Wallonia does not want to know of a harsh approach. The French community wants to boycott Everberg very consciously.
This is significant again today, as the French Community requests only 5 additional seats in Everberg and thus wants to accommodate up to 10 criminal youths while Everberg will have 50 seats. However, the problems in Brussels and Wallonia in terms of youth crime are still much greater than in Flanders. The ministry’s figures don’t lie. There are about twice as many French speakers as Flamings involved. If there are indeed 40 places for Dutch speakers in Everberg, Flanders evolves to a total of 140 closed shelters. That is still a little bit compared to the Netherlands, but Wallonia will only have 60 seats. Today they have 50 seats and 10 more, while in fact 280 seats — four times as many — are needed.
Colleagues, with such a difference in mentality, we must inevitably go to a split of Justice, even because youth law is not the only file where Flamings and Whales collide. I refer to the nationality legislation, about which Vlamingen and Walen have very different views.
There is the question of the regret-optants where we stand right in front of each other; there is the high-speed right that the French speakers entirely upheld in which they did not even allow a recovery law, and there is the security plan that was completely rewritten by the PS. Furthermore, we constantly observe in the Justice Committee that the views of French speakers and Flemish people are repeatedly divided. The only interesting discussion is about how to divide. A division of the Judiciary into the Communities is, of course, the only acceptable formula. It will not be possible in Brussels. There can hardly be two types of justice in the same territory. Such is work with two sizes and weights depending on the very varying and vague language origin in Brussels. A split of the Justice in Brussels may be a moment of turning to Flanders, in the first place because the mentality of the Brusselsers is miles away from the laxism of the PS that is so dominant and widespread in Wallonia today. I hope that the Brusselsers will realize at the right time that the Wallonian leaders are not serving their interests and that they will realize that Flanders can indeed offer an alternative. Flanders can and will generously ensure that Brussels is finally pulled out of the mud.

Mijnheer de voorzitter, wat ingepakt wordt als een positieve boodschap, leidt ons eigenlijk af van de essentie van onderhavig technisch wetsontwerp. Het is al de tweede keer vandaag, mijnheer de voorzitter, dat we eigenlijk over iets anders discussiëren dan over wat op de agenda staat. In de plaats van een begrotingscontrole hebben we een begrotingsbespreking gevoerd. Er is geen discussie gewijd aan een technische wijziging van de wet op de jeugdbescherming van 8 april 1965, aanpassing die enkel en alleen moet toelaten dat daders die worden gesnapt op het ogenblik dat ze nog minderjarig zijn maar die, voor de strafvordering is afgerond, meerderjarig zijn geworden, toch aan strafmaatregelen kunnen worden onderworpen. Neen, het debat had een totaal andere impact.
Het wordt voorgesteld als een positieve oproep. Ik ervaar het echter als het toppunt van politiek cynisme. Ik wil hiermee geen afbreuk doen aan het werk dat de heer Christian Maes heeft gedaan. Het voorontwerp van wet, dat hij uit zijn pen heeft geschud en waarvoor hij zeer veel inspanningen heeft gedaan, heeft de lof en goedkeuring gekregen niet alleen van heel wat academici, maar ook van de Hoge Raad voor de Justitie.
Waarom zeg ik toch dat het gaat om politiek cynisme? Ik doe dat om drie redenen. De eerste reden heeft te maken met cijfers. De wet op de jeugdbescherming dateert van 1965 en is bijna 40 jaar oud. In die 40 jaar is een aantal partijen zeer lang aan het bewind geweest. Zij hebben op die manier een stempel op het beleid inzake het jeugdrecht kunnen drukken. Twaalf jaar hebben christen-democraten de mogelijkheid gehad om een beslissende wending te geven aan het debat inzake jeugdrecht. In heel die periode is men nooit verder gekomen dan een werkdocument dat werd afgeleverd door de werkgroep-Cornelis. Er was geen wetsontwerp. Nu geraakt men niet verder dan het indienen van een amendement dat eigenlijk niet meer is dan het plagiaat van het werk van mijn uitstekende medewerker Christian Maes. Ik vind dat bedroevend, vooral omdat men zelfs niet de eerste is om dit plagiaat te plegen. Senator Vandenberghe van de CD&V heeft naar aanleiding van de Everberg-wet hetzelfde manoeuvre uitgehaald en heeft toen ook al het werkstuk van Christian Maes ingediend. In 1987, in 1991, in 1995 heeft men nochtans telkens de mogelijkheid gehad om naar aanleiding van de regeringsvorming de beslissende wending in het jeugdrecht, die daadwerkelijk nodig is, door te voeren.
Ik ervaar ook politiek cynisme om een tweede, politieke reden. Wij moeten ons misschien eens de vraag stellen hoe het komt dat wij dit probleem met ons jeugdrecht hebben. Wat is de diepere oorzaak? Welnu, er is een dubbele diepere oorzaak. De eerste oorzaak situeert zich op het niveau van de bijzondere wetten van 1980 en 1988. Wij moeten misschien eens de vraag stellen wie die beslissing heeft genomen om de verantwoordelijkheid voor het uitzitten van maatregelen die aan jongeren worden opgelegd aan de gemeenschappen over te dragen. Ik wil met u de historische oefening maken. Voor de wetten van 1980 en 1988 is een aantal politici rekenplichtig: mevrouw Steyaert, de heer Lenssens, mevrouw Demeester. Zij hebben eertijds de beslissing genomen om daadwerkelijk verantwoordelijkheden aan de gemeenschappen op te leggen. Wij stellen vandaag vast dat deze verantwoordelijkheden nooit werden ingevuld. Dat is een historische waarheid die wij moeten erkennen. Een tweede oorzaak geeft ook blijk van politiek cynisme. Wie heeft het artikel 54 in de jeugdbeschermingswet afgeschaft waardoor niet meer is toegelaten dat minderjarigen in gevangenissen werden opgesloten?
Ook op dat vlak draagt iemand die vandaag het woord heeft gevoerd, verantwoordelijkheid. Ik aanvaard gerust dat wij een belangrijk probleem hebben inzake het jeugdrecht. Wij moeten ook de dingen durven te erkennen zoals ze zijn. Men moet mij vandaag bij wijze van positieve oproep, die eigenlijk een gecamoufleerd politiek cynisme weergeeft, niet komen vertellen dat men een boodschap van hoop uitdraagt. Het is een boodschap van pure verzuring.
Tot slot wil ik nog even een technische aangelegenheid behandelen. It is presented as a positive call. I see it as the height of political cynicism. I do not wish to undermine the work done by Mr. Christian Maes. The preliminary bill, which he shaken out of his pen and for which he has made very much effort, has received the praise and approval not only of many academics, but also of the High Council for Justice.
Why do I say this is political cynicism? I do that for three reasons. The first reason is related to numbers. The Youth Protection Act dates back to 1965 and is almost 40 years old. In those 40 years, a number of parties have been in power for a very long time. They have thus been able to make a mark on the youth law policy. For twelve years, Christian Democrats have had the opportunity to give a decisive turn to the debate on youth law. Thro ⁇ that period, there has never been more than a working document delivered by the Working Group-Cornelis. There was no draft law. Now, one does not go beyond submitting an amendment that is actually nothing more than plagiarism of the work of my excellent associate Christian Maes. I find that sad, especially since you are not even the first to commit this plagiarism. Senator Vandenberghe of the CD&V has taken the same manoeuvre following the Everberg Act and then submitted all the work of Christian Maes. In 1987, in 1991, in 1995, however, it has always been possible, following the formation of government, to make the decisive turn in the youth law, which is indeed necessary.
I also experience political cynicism for a second, political reason. We may have to ask ourselves why we have this problem with our youth rights. What is the deeper cause? Well, there is a double deeper cause. The first cause is situated at the level of the special laws of 1980 and 1988. We may have to ask who made that decision to transfer the responsibility for the outsourcing of measures imposed on young people to the communities. I want to do the historical exercise with you. For the laws of 1980 and 1988, a number of politicians are accountable: Mrs Steyaert, Mr Lenssens, Mrs Demeester. In the past, they have taken the decision to effectively impose responsibilities on communities. We note today that these responsibilities were never fulfilled. This is a historical truth that we must acknowledge. Another reason is political cynicism. Who has abolished Article 54 of the Youth Protection Act, which no longer permits minors to be imprisoned in prisons?
In this regard, the person who spoke today is also responsible. I am confident that we have a major problem with youth law. We must also dare to acknowledge things as they are. One should not come to me today in the form of a positive call, which actually represents a camouflaged political cynicism, to tell me that one is delivering a message of hope. Finally, I would like to address a technical issue. Even if a majority in this Parliament would decide to support and approve the amendment, Article 65 of the Rules of Procedure of the Chamber must apply. Everyone knows that. At that moment, the work that has never been carried out can be carried out in the way we would have desired, i.e. in consultation with the communities, should in any case still be carried out. We will have achieved that the technical aspect, the adaptation of the two small articles 49 and 52 of the Law of 1965, which, however, could bring so much clarity to the jurisprudence and the doctrine of law and which would address the young people who go freely because they have committed as minors crimes that were discovered only during their adulthood, would enable us to take action.

Op het einde van de vorige legislatuur waren wij inderdaad toe aan een nieuwe sfeer rond justitie, politie en veiligheidsproblematiek. In het kader van het Octopusoverleg hebben wij over de grenzen van meerderheid en oppositie samen een aantal fundamentele problemen aangepakt. Dat was een belangrijk moment als gevolg van belangrijke feiten die de publieke opinie hebben beroerd.
Wij stellen telkens opnieuw en systematisch vast dat jonge delinquenten moeten worden vrijgelaten. Ik hoopte dat wij in staat zouden zijn om dit discours op een gelijkaardige wijze te voeren. Wij hebben immers allen de opdracht om een oplossing voor het probleem te vinden. Als wij het probleem niet oplossen, zal het enorme politieke consequenties hebben, in eerste instantie voor wie nu beleidsverantwoordelijkheid draagt.
Het lijkt dus met deze minister van Justitie niet mogelijk om grensoverschrijdend dat gesprek te voeren. Het is bijzonder ontgoochelend. Deze vaststelling geeft collega Bourgeois gelijk wanneer hij zegt dat het naïef is om te hopen dat een meerderheid in deze Kamer omtrent een probleem kan worden gevaloriseerd. Het gevolg is dat wij nog lange jaren met het jeugdbeschermingmodel zullen worden geconfronteerd. Na de eerste helft van het jaar, waarin in Antwerpen 60 jonge criminelen werden vrijgelaten, zal ook in de tweede helft van het jaar hetzelfde gebeuren.
We zijn er dus niet aan toe om op een volwassen wijze met deze materie om te gaan. We moeten nog altijd spreken in termen van meerderheid tegen oppositie of omgekeerd. Mijnheer de minister, ik zal mij niet laten verleiden om in te gaan op het discours dat u hebt gehouden. Ik wil alleen een paar zaken rechtzetten die u hier op deze tribune hebt vertolkt. Ik begin met het fameuze artikel 53. U weet net als ik dat toen we verplicht werden om jongeren niet langer in gevangenissen op te sluiten, dit het gevolg was van een arrest van het Europees Hof voor de Rechten van de Mens. We werden verplicht onze wetgeving aan deze rechtspraak aan te passen. We hebben trouwens samen een regeling uitgewerkt waarbij wij uitstel hebben verleend tot 1 januari van dit jaar om deze rechtspraak in concrete realiteit om te zetten. Men had dus ruim de gelegenheid om in voldoende plaatsen te voorzien in de gesloten instellingen en/of om jeugdgevangenissen of jeugdinstellingen op te richten, georganiseerd door de federale overheid. Mijnheer de minister van Justitie, ik wil erop wijzen dat u die wettelijke bepaling mee hebt goedgekeurd in het Parlement. In die omstandigheden is het dus vrij incorrect om de zaken voor te stellen zoals u dat daarnet hebt gedaan. Hetzelfde geldt ten aanzien van het eigenlijke voorwerp van dit wetsontwerp. U hebt gezegd dat als het amendement zou worden goedgekeurd dit als gevolg zou hebben dat de wettelijke regeling voor minderjarigen die minderjarig waren op het ogenblik van de feiten en meerderjarig op het moment waarop de procedure aanhangig wordt gemaakt, niet van toepassing zou zijn. U hebt nagelaten te vermelden dat wij u tijdens de bespreking in de commissie hebben voorgesteld om het amendement in te trekken en een wetsvoorstel in te dienen op voorwaarde dat de meerderheid ermee akkoord ging het wetsvoorstel urgent te behandelen. Enkel toen de meerderheid weigerde dit te doen hebben wij het amendement gehandhaafd. U hebt toen de mogelijkheid gemist om, ten eerste, een wettelijke regeling te verwezenlijken omtrent voorlopige maatregelen door de jeugdrechter zoals in het ontwerp voorzien en, ten tweede, om bij urgentie een wetsvoorstel dat met uw inzichten en die van het kabinet overeenstemt aan de agenda van het Parlement te plaatsen.
Dit zijn de dingen zoals ze in de realiteit zijn gebeurd. Mijn conclusie op dit ogenblik van de discussie is dat de minister van Justitie ten aanzien van de veiligheidsproblematiek en ten aanzien van de problematiek van politie en justitie een discours voert dat niet meer van deze tijd is. Het verhindert dat wij een regeling tot stand brengen die een efficiënte en effectieve oplossing biedt voor de jeugdcriminaliteit. Dat is de vaststelling die we vandaag moeten doen. Ten aanzien van de collega's in dit Parlement zal ik de conclusie nog even in beraad houden omdat ik van oordeel ben dat velen in dit Parlement een stap verder zijn dan het discours van de minister van Justitie.
Ongetwijfeld zal men inzien dat de tekst van het amendement zoals die voorlegt, overeenstemt met de wil van de meerderheid van de leden van dit Parlement. Deze meerderheid moet zich kunnen vertalen in daadkracht ten opzichte van een meer dan actueel probleem inzake veiligheid, het probleem van de jeugdcriminaliteit. Voor 11 september hadden de politie- en inlichtingendiensten nog een vrij goed zicht op de eerste terroristische cellen, hoewel hierover in Amerika nu twijfel aan het ontstaan is, in het licht van de opgerichte parlementaire onderzoekscommissie. Daar rijst nu de vraag of deze antiterroristische cellen, de FBI of de CIA van alles op de hoogte waren.

Sinds de aanval op Afghanistan hebben wij die waarschuwingslampjes, jammer genoeg, niet meer. De in Afghanistan opgeleide mannen zijn over de islamitische landen uitgezwermd en zij komen nu via onder meer Marokko, Algerije, Maleisië, China en Pakistan naar ons land, zonder dat wij aanwijzingen hebben over hun terroristische opleiding. Zij hebben jammer genoeg dus eigenlijk geen contact meer met de gekende cellen en kunnen niet meer infiltreren. Een pak informatie komt hen niet meer tegemoet.
Dit is bijvoorbeeld het geval voor de Oeigoeren, een islamitischetnische minderheid uit China. Sommige van hun fundamentalistische strijders genoten immers een terroristenopleiding in Afghanistan. In België is een groep Oeigoeren neergestreken, maar wij hebben het raden naar hun bedoelingen. Zo luidt het binnen politiediensten en zo luidt het ook in gerechtelijke kringen.
Het gerecht vergaarde wel informatie over de plannen van terroristen. Hoe vergaarde zij die? Dat deed zij onder meer via het verhoren van personen verdacht voor terrorisme die in België werden aangehouden en twee fundamentalisten die Amerika op de basis in Guantanamo aanhield. Zo is dus een mogelijk aanslag op de luchtmachtbasis van Kleine Brogel verijdeld kunnen geworden. Maar een toekomstige aanslag op die luchtmachtbasis blijft uiteraard altijd mogelijk. Hoe kunnen we die aanslagen vermijden en verijdelen? Om die aanslagen te verijdelen moet er volgens de speurders meer coördinatie komen. Er moet meer samenwerking en overleg komen. En dat vergt uiteraard meer conversatie en meer gecoördineerde samenwerking. Niemand heeft immers een beeld van het aantal kandidaat-terroristen die bijvoorbeeld via netwerken van mensenhandelaars naar Europa komen. (...)
