                    De minister antwoordde dat de overheid bij haar optreden het territorialiteitsbeginsel in acht zou nemen en dat het dus gewoonweg onmogelijk zou zijn iets te ondernemen tegen de makers van dergelijke sites. In de artikelsgewijze bespreking en stemming wordt over artikel 1 geen opmerking gemaakt. Over artikel 2 heeft de minister toelichting gegeven, waarbij de heer Wathelet een amendement indiende dat ertoe strekte een aantal woorden te vervangen. Die amendementen werden eenparig aangenomen. Op artikel 3 diende de regering een amendement in dat eenparig werd aangenomen. Op artikel 4 diende de regering eveneens een amendement in, waarbij de woorden "mogelijke aanwending" vervangen werden door de woorden "normale aanwending". Die formulering sloot nauwer aan bij de overeenkomst van de Raad van Europa inzake informaticacriminaliteit. De amendementen werden eenparig aangenomen en de geamendeerde artikelen eveneens. Voor artikel 5 geldt hetzelfde. Op artikel 6 diende de heer Wathelet een amendement in dat ertoe strekt een aantal woorden door werkwoorden te vervangen. Dit werd eenparig aangenomen, evenals het geamendeerde artikel. Wat de artikelen 7, 8 en 9 betreft, voorzagen de artikelen dat de straffen als bedoeld in de wet van 25 maart 1995 voortaan ook zouden worden toegepast op het ontkennen van alle genociden en misdaden tegen de menselijkheid zoals omschreven in het internationaal recht. Hierover ontstond een discussie waarbij de minister amendement 11 indiende, dat beoogde het opschrift van de wet te veranderen in die zin dat het zou vervangen worden door "wet tot bestraffing van het ontkennen, minimaliseren, rechtvaardigen of goedte keuren van genocide en misdaden tegen de menselijkheid". Mevrouw Van der Auwera wierp op dat, hoewel beide artikelen echt verantwoord waren, zij niet thuishoorden in het ter bespreking voorliggende wetsontwerp en beter in een afzonderlijk wetsontwerp zouden worden gegoten. De heer Maingain diende een amendement in waarin hij vroeg dat het zou gaan om feiten waarbij men zou pogen te rechtvaardigen of goedkeuren, zoals deze gedefinieerd zijn door het internationaal recht et reconnus comme tels par tout tribunal international dont la juridiction a été reconnue par la Belgique, le Conseil de sécurité, l'Assemblée générale des Nations unies ou par une décision des juridictions belges ou d'un autre Etat membre de l'Union européenne.

The Minister replied that the government would observe the principle of territoriality in its action and that therefore it would be simply impossible to do anything against the creators of such sites. In the article-by-article discussion and voting, no comments on Article 1 are made. On Article 2, the Minister gave explanations, in which Mr Wathelet submitted an amendment aimed at replacing some words. These amendments were unanimously adopted. On Article 3, the Government submitted an amendment that was unanimously adopted. On Article 4, the Government also submitted an amendment, replacing the words "possible use" by the words "normal use". This wording was more closely aligned with the Council of Europe Agreement on Cybercrime. The amendments were unanimously adopted and the amended articles as well. The same applies to Article 5. On Article 6, Mr Wathelet submitted an amendment aiming to replace some words with verbal words. This was unanimously adopted, as was the amended article. With regard to Articles 7, 8 and 9, the Articles provided that the penalties provided for in the Act of 25 March 1995 would from now on also be applied to the denial of all genocides and crimes against humanity as defined in international law.                     De heer Borginon stipte aan dat dit amendement de toepassingssfeer van de wet van 1995 nog verder zou uitbreiden. Het ging over feiten die eventueel zelfs niet door internationale rechtsinstanties zouden worden erkend en alsnog strafbaar zouden worden. De heer Laeremans wierp op dat de wet in veel te zware straffen voorziet en indien zij alsnog behouden zouden blijven, zij wel zouden moeten toegepast worden op alle volkerenmoorden. De minister wees er nog op dat artikel 1, dat gemeenschappelijk is voor de vier verdragen van Genève, bepaalt dat de lidstaten zich ertoe verbinden die verdragen na te leven en te doen naleven en dat alle internationale rechtscolleges aan die bepaling de uitlegging geven dat, wanneer een staat een persoon heeft veroordeeld wegens een van de in de verdragen bedoelde misdaden, de andere staten alles in het werk moeten stellen om aan die veroordeling gevolg te geven.

Mr Schoofs expressed concern that certain provisions could jeopardize public debate and university research. He pointed out that professors and researchers established in a country whose college of law has judged that a genocide has occurred would no longer be able to examine the legal nature of those facts and should therefore be able to travel abroad to carry out the investigation further. M is Maingain responds that it is not a matter of banalizing the crimes against humanity, and a fortiori the Shoah, but that none could at the same time ignore that other crimes against humanity and other genocides had been committed and recognized as such by national and international jurisdictions, in accordance with the definitions of different international acts. The discussion was continued with comments from President Borginon, who argued that the mutual recognition of judicial decisions taken in other Member States of the European Union had a limited scope if those decisions concerned only the parties to a dispute. The Minister further pointed out that Article 1, which is common to the four Geneva Conventions, provides that Member States undertake to comply with and enforce those Conventions and that all international courts interpret that provision as follows: where a State has convicted a person for one of the crimes covered by the Conventions, the other States shall make every effort to enforce that conviction.

                    Mijnheer de voorzitter, collega's, mijnheer de minister — ter vervanging van de minister van Justitie, veronderstel ik —, in feite zou ik hier twee betogen na elkaar moeten houden, omdat de wet twee delen bevat, oorspronkelijk zelfs drie. Ik verklaar mij nader. Het eerste deel behandelde de informaticacriminaliteit, het tweede behandelde het auteursrecht en het derde behandelde de wet inzake negationisme. In drie deelontwerpen wil men dus, via een mengelmoes van een ontwerp, een aantal bestaande wetten wijzigen.

Wat het eerste deel, de informaticacriminaliteit, betreft meen ik dat het een understatement zou zijn te stellen dat de wet de feiten zal nahollen, nog meer dan andere wetten. Het is gemeengoed onder juristen — en het is geen schande dat te moeten toegeven — dat het recht de feiten altijd naholt. Wanneer wij spreken over informaticasystemen als bijvoorbeeld het internet — want internet is maar een van de informaticasystemen, het beslaat een ruimer terrein —, weten wij dat het gaat om een van de meest snelle, de meest vluchtige, de meest gecompliceerde en de snelst evoluerende en minst transparante media inzake communicatie en overdracht van informatie.

Hoe dan ook, het is dankzij de expertise van de FCCU, de Federal Computer Crime Unit, dat wij hier vandaag wat dat deel betreft met een deugdelijk en misschien zelfs verdienstelijk ontwerp naar de plenaire vergadering komen. Immers, ik herinner mij zeer goed dat, wanneer de FCCU haar expertise tijdens de hoorzittingen niet had getoond en het ontwerp op dat stuk niet was gewijzigd, elke toetsaanslag of elke muisklik strafbaar was geweest.

Dat was zo omdat het begrip onrechtmatigheid, de verwijzing naar het begrip onrechtmatigheid, aanvankelijk niet in de wet was opgenomen als criterium om een strafbaar feit na te gaan. Men zette dus de computer aan, tikte op een toets en men was strafbaar, want elke wijziging in een informaticasysteem of elke uitwisseling van informatie zou in principe geleid hebben tot strafbaarheid, wat uiteraard niet de bedoeling van de wet kon zijn. De geest van de wet had daaraan wel kunnen verhelpen. De letter van de wet liet daarover echter in elk geval voldoende twijfel bestaan. 

Ik zei reeds dat men naar omstandigheden op dit vlak inderdaad wellicht ver genoeg gegaan is en dat men een wetgeving gecreëerd heeft die in staat moet zijn om, althans hier op Belgisch grondgebied, misdrijven te beteugelen. Laten wij ons geen illusies maken. Het territorialiteitsbeginsel verhindert dat een website met manifest strafbare inhoud, die op een buitenlandse server geplaatst is, vervolgd kan worden. Er is dan geen rechtstreekse mogelijkheid om tot vervolging, laat staan beteugeling, over te gaan.

Over het technisch-juridisch gedeelte van de informaticacriminaliteit kan ik dus kort zijn. Wij krijgen nu inderdaad een meer uitgebreide wet, een wet die nog verder gaat dan hetgeen in de vorige legislatuur werd goedgekeurd. 

Ik wil het tweede, weliswaar geschrapte luik, aangrijpen om hier op het spreekgestoelte kritiek op de wet naar voren te kunnen brengen. Het tweede deel ging over het auteursrecht. Er was een artikel 7 dat inmiddels geschrapt is. Men kon of moest uit artikel 7 concluderen dat de realisatie ervan, de schending van de auteursrechten, onder andere door middel van informaticasystemen, reeds tot stand was gekomen via een wijziging van de wet van 30 juni 1994 tot omzetting van een Europese richtlijn. Dat is hier in de Kamer gebeurd door middel van de wet van 3 maart 2005. De richtlijn 2001/29/EG is inmiddels omgezet op 3 maart jongstleden in het auteursrecht. 

Ik verwijs naar dit tweede gedeelte omdat het auteursrecht niets te maken heeft met alleen informaticacriminaliteit, net zomin als, ik kom dan aan het derde deel, de negationismewet op zich iets te maken heeft met de informaticacriminaliteit. Het gaat over de negationismewet of de wet, die wij willen wijzigen, van 23 maart 1995 tot bestraffing van de ontkenning, de minimalisering, de rechtvaardiging of de goedkeuring van de genocide die gepleegd werd tijdens Wereldoorlog II door het nationaal-socialistisch regime. Op het vlak van die wetgeving heeft de minister besloten om ze samen te voegen met de wet op de informaticacriminaliteit. 

Ook in de commissie heb ik daarop de nodige kritiek geleverd. Ik zal het hier op het spreekgestoelte ook doen. Die kritiek is eerst en vooral een formele kritiek. Ik en de Vlaams-Belangfractie, namens wie ik spreek, vonden het niet getuigen van elegantie of van kiesheid om een technisch-juridisch ontwerp, dat ertoe strekt de informaticacriminaliteit te beteugelen, te koppelen aan een wet van een heel andere aard, van een heel andere natuur.

Het gaat om een wet die vooral gericht is op het respect voor de menselijkheid, de waardigheid van de menselijke persoon en het beteugelen van misdaden, van allerhande gruweldaden. Het doel is een dergelijke wet die dergelijke hoge morele standaarden poogt te koesteren, te voegen bij een louter strikt technisch-juridisch wetsontwerp. De minister heeft echter in die zin beslist. Wij zijn er minder gelukkig mee, maar sic transit gloria mundi. Wanneer men in allerhande wetsontwerpen alles bijeen begint te steken, dan begint men zich uiteindelijk vragen te stellen bij de kwaliteit van het wetgevend werk.

Naast de formele kritiek dat wij op weinig charmante wijze die twee wetsontwerpen hebben samengevoegd, is er uiteraard ook inhoudelijke kritiek. In de eerste plaats — en dat is mijns inziens de rode draad door heel dit ontwerp — is er de rechtsonzekerheid die geschapen wordt. Wat beoogt deze wet, meer concreet op het terrein? Om het even welke rechtbank gevestigd in een der lidstaten van Europa, kan een aantal feiten kwalificeren als zijnde een genocide en daarover ook een veroordeling uitspreken. Dat is niet alleen een morele, maar ook een strafrechtelijke veroordeling. Vanaf het ogenblik dat een van de duizenden rechtsprekende organen in Europa een dergelijk vonnis velt, pleegt degene die een dergelijk vonnis aanvalt door over de feiten te redetwisten, een misdrijf. Hij pleegt in feite een misdrijf van negationisme. 

Zijn wij werkelijk ertoe in staat om tijdig dergelijke vonnissen te traceren en ze te kunnen stellen ten aanzien van rechtsgeleerden, antropologen en historici, om hen erop te wijzen dat wat zij zeggen strafbaar is omdat een bepaalde rechtbank in een bepaald land heeft geoordeeld dat die feiten onmiskenbaar zijn vastgesteld als een genocide of een misdaad tegen de menselijkheid, wat in feite nog verder gaat en misschien nog een stuk moeilijker te traceren is dan een genocide waarbij de massamoorden manifest plaatsvinden. Dat is een eerste punt.

Ten tweede kunnen er tegenstrijdige vonnissen ontstaan. Ik heb in de commissie verwezen naar de balkanlanden die zullen toetreden tot de EU en waar er doorheen de geschiedenis en zelfs de recente geschiedenis, vaak tal van feiten gepleegd zijn, tal van gruweldaden, waarvan wij misschien het bestaan nog niet kennen maar die in elk geval hebben plaatsgevonden en die door een bepaalde rechter op een bepaalde plaats in een balkanland dat zal toetreden tot de Unie of dat misschien al toegetreden is tot de Unie, gekwalificeerd worden als genocide. Anderzijds zullen er misschien rechters zijn in dezelfde regio die dezelfde feiten niet eens willen kwalificeren als een misdaad tegen de menselijkheid, laat staan als genocide en die stellen dat wat daar gebeurt een gewone oorlogsdaad was, misschien in een vuile oorlog, maar toch zonder meer een gewone oorlogsdaad. Dan zit men met tegenstrijdige vonnissen.

Wat gaan wij daarmee doen? Ik denk dat deze wet voor duidelijkheid zal zorgen. In België zal men — zeker met ministers van Justitie als mevrouw Onkelinx, die terzake haar opvattingen al meer dan voldoende heeft laten blijken — vervolgd worden voor dit misdrijf. Tot daar die duidelijkheid.

In elk geval zie ik ook de mogelijkheid voor bepaalde actiegroepen om aan shopping te gaan doen. Bepaalde actiegroepen — ik ben zeer vertrouwd met de balkanlanden — zitten te springen om niet alleen in de Balkan maar als het moet over heel Europa bepaalde misdrijven te laten kwalificeren als genocide. Als men daar eenmaal in slaagt voor één rechtbank, eventueel bekrachtigd door een hof van beroep — stel zelfs dat er geen hoger beroep is — dan krijgen die vonnissen kracht van gewijsde en dan zit men met het misdrijf van genocide dat uiteraard onmiddellijk aanleiding geeft tot het misdrijf negationisme. Ik denk dat dit een weinig elegant omgaan is met zaken als genocide en misdaden tegen de menselijkheid. Ik denk dat zij beter verdienen dan dat wat misschien te gebeuren staat.

Het is inderdaad mogelijk dat één rechter in één land beslist dat iets een genocide is en men is eraan voor de moeite in dat land. Wat zal de reactie zijn? In die landen waar dergelijke vonnissen niet zullen worden aanvaard of waar men ze voorlopig naast zich kan leggen — België is immers een van de eerste landen, zoniet het eerste land, dat deze verregaande maatregel treft — zullen de tegenstanders volledig aan stemmingmakerij kunnen doen en volledig de kaart kunnen spelen tegen de erkenning van de genocide. Zij zullen door bepaalde staten misschien wel in bescherming worden genomen. Ik verwijs weer naar de balkanlanden. Op dat moment komt er een opbod in de kwalificering van genociden. Er gaat dan ook een opbod komen tussen de voor- en tegenstanders in verschillende lidstaten.

Ik vraag mij of wat vandaag ter stemming voorligt allemaal wel zo evident en zo gunstig is. Er is niet alleen het geval van de shopping maar er is ook de polemiek die kan ontstaan. Zo riskeert men een contraproductief effect van enerzijds het begrip genocide en anderzijds de negationismewet. Volgens mij kan het begrip genocide alleen maar aan impact verliezen en dat is het ergste wat er kan gebeuren. Dat is het contraproductieve effect ten aanzien van genociden en de holocaust. Uiteindelijk zullen bepaalde obscure actiegroepen erop uit zijn om hun eigen holocaust te constitueren via een van de rechtbanken in een van de lidstaten van de EU.

In België zal deze wet tot gevolg hebben — en ik verwijs naar de duidelijkheid waarover ik het daarnet had — dat er een exponentiële verruiming zal ontstaan van het opiniedelict. In België zullen wij vanaf nu moeten zeggen dat het niet alleen meer betrekking heeft op de holocaust, die als symbool misschien aan waarde zal verliezen. Ik durf het woord banaliseren niet in de mond nemen. Historici, rechtsgeleerden, antropologen en sociologen, let op uw woorden, let op uw tellen

Daarom stel ik op dit spreekgestoelte namens mijn fractie dat wij in deze omstandigheden en met deze terminologie deze wet niet zullen goedkeuren.

This was because the concept of unlawfulness, the reference to the concept of unlawfulness, was initially not included in the law as a criterion for investigating a criminal offence. So one turned on the computer, tapped on a key, and one was punishable, because any change in an information system or any exchange of information would in principle have led to punishment, which, of course, could not be the intent of the law. It is a law which is primarily aimed at respect for humanity, the dignity of the human person and the punishment of crimes, of all kinds of atrocities. We are less happy with it, but sic transit gloria mundi. When one begins to put everything together in all sorts of bills, then one finally begins to question the quality of the legislative work.

In addition to the formal criticism that we have combined these two bills in a little charming way, there is, of course, also content criticism. First – and that is, in my opinion, the red thread throughout this whole design – there is the legal uncertainty that is being created. What is the purpose of this law, more specifically in the field? Any court located in one of the member states of Europe can qualify a number of facts as a genocide and also condemn them. This is not only a moral, but also a criminal conviction. From the moment when one of the thousands of judicial bodies in Europe makes such a judgment, the person who attacks such a judgment by disputing the facts commits a crime. He is actually committing a crime of negationism. Their

Are we really able to trace such judgments in a timely manner, and to put them before legal scholars, anthropologists and historians, to remind them that what they say is punishable because a particular court in a given country has ruled that those facts have been undeniably established as a genocide or a crime against humanity, which in fact goes even further and ⁇  even much more difficult to trace than a genocide in which the mass killings manifestly take place. That is a first point.

Secondly, conflicting judgments may arise. I referred in the committee to the Balkan countries that will join the EU and where, throughout history and even recent history, often numerous acts have been committed, numerous atrocities, of which we may not yet know the existence but which in any case have taken place, and which are qualified as genocide by a certain court in a particular place in a Balkan country that will join the Union or that may already have joined the Union. On the other hand, there may be judges in the same region who do not even want to qualify the same facts as a crime against humanity, let alone as a genocide, and who argue that what is happening there was an ordinary act of war, ⁇  in a dirty war, but nevertheless an ordinary act of war. There are conflicting judgments.

What will we do with this? I think this law will provide clarity. In Belgium, ⁇  with Ministers of Justice such as Ms. Onkelinx, who has already shown more than sufficient views on this subject, one will be prosecuted for this crime. Until then that clarity.

In any case, I also see the possibility for certain action groups to go shopping. Certain action groups — I am very familiar with the Balkan countries — are jumping out to qualify certain crimes as genocide not only in the Balkans but if it should be across Europe. If one man succeeds in this before one court, possibly confirmed by a court of appeal — even suppose that there is no appeal — then those judgments become sacred and then one sits with the crime of genocide which of course immediately gives rise to the crime of negationism. I think this is a little bit elegant dealing with things like genocide and crimes against humanity. I think they deserve better than what might happen.

It is indeed possible that one judge in one country decides that something is a genocide and one is for the trouble in that country. What will be the reaction? In those countries where such judgments will not be accepted or where they can be temporarily removed – Belgium is one of the first countries, if not the first country, to take this extensive measure – the opponents will be able to make a full vote and play a full card against the recognition of the genocide. They may be protected by certain states. I refer again to the Balkans. At that time there is an offer in the qualification of genocides. There will therefore be a bidding between the pro and opponents in different Member States.

I wonder if what is being voted for today is all so obvious and so favorable. There is not only the case of shopping but there is also the controversy that can arise. Thus one risks a counterproductive effect of the concept of genocide on the one hand and the law of negationism on the other. In my opinion, the concept of genocide can only lose its impact and that is the worst thing that can happen. This is the counterproductive effect on genocide and the Holocaust. Eventually, certain obscure action groups will seek to constitute their own Holocaust through one of the courts in one of the EU Member States.

In Belgium, this law will result — and I refer to the clarity about which I was speaking then — that there will be an exponential expansion of the opinion delict. In Belgium, we will have to say from now on that it is not only more related to the Holocaust, which as a symbol may lose its value. I dare not take the word banalization into my mouth. Historians, legal scholars, anthropologists and sociologists, pay attention to your words, pay attention to your counts.

Therefore, I suggest in this speaking group on behalf of my group that under these circumstances and with this terminology, we will not approve this law.

Weliswaar hebben zij voor de buitenwereld ontslag genomen uit de functie die zij bekleedden, in de Senaat denk ik, maar vandaag zijn zij nog altijd verantwoordelijk voor een afdeling van uw partij. Tegelijkertijd hebben sommige van uw collega's hier in de Kamer of in andere parlementen, niet langer dan een aantal maanden geleden, ongeveer gelijktijdig met de viering van de bevrijding van dit land, in de IJzerwake mee gestapt en hulde gebracht aan iemand die in 1942 bijvoorbeeld schreef dat het gemakkelijker ademen werd in Antwerpen toen de deportatie van de joden begon.

Hebt u daarmee geen enkel probleem? U kunt dat tegelijkertijd hier komen verkondigen? Wat zegt u in uw partijcenakels daarover? Ik wil er nog aan toevoegen dat eventueel diplomatieke incidenten zouden kunnen ontstaan. Dit is een lelijke spin off van dit wetgevend initiatief. Ik geef een voorbeeld. Een Amerikaans soldaat die de strijd in Irak heeft meegemaakt, legt een verklaring af op een ogenblik dat een rechter geoordeeld heeft dat in Irak misdaden tegen de menselijkheid werden gepleegd. Indien een Amerikaans soldaat door een of andere groepering wordt uitgenodigd en hier uitspraken doet, dan is die persoon strafbaar op dit grondgebied.

Ik zwijg nog over politieke incidenten die zich kunnen voordoen, in dit geval niet met een Amerikaans soldaat van Abu Ghraib of die in die regio zijn dienst heeft gedaan maar met een ambtenaar, een minister, een consulair ambtenaar of een diplomaat — hoewel deze onschendbaar zijn. Dit kan tot ernstige incidenten leiden, zowel op politiek als op diplomatiek vlak en dat dan nog met bondgenoten. Ik houd mijn hart vast.

Dat is de reden waarom wij het amendement indienen dat in de commissie nipt werd weggestemd. Wij dienen het amendement van de heer Borginon in. Wij hebben dit amendement hartstochtelijk gesteund omdat dit het angeltje uit deze wet haalt, waardoor ze een veel degelijker statuut zal kunnen verkrijgen en waarmee in elk geval een hoop risico's worden vermeden. Daarom dient de Vlaams Belangfractie het amendement van de heer Borginon in. Indien dit amendement niet wordt goedgekeurd, zullen wij deze wet niet goedkeuren. Met de indiening van het amendement hopen wij de verzending naar de commissie te bekomen waar we de zaak opnieuw ten gronde kunnen bespreken zodat we de nefaste gevolgen kunnen uitwissen die deze wet kan ressorteren.

                    Monsieur le président, monsieur le ministre, chers collègues, la commission de la Justice a consacré six séances à l'examen des projets de loi qui nous sont soumis aujourd'hui, à savoir celui modifiant diverses dispositions en vue de renforcer la lutte contre la traite et le trafic des êtres humains et celui visant à compléter la protection pénale des mineurs. La commission a décidé d'examiner ces deux projets de loi en une seule et même discussion générale, dans la mesure où ces projets sont intimement liés.

Le premier projet concerne donc le trafic et la traite des êtres humains et poursuit plusieurs objectifs.

Tout d'abord, un premier volet de dispositions vise à apporter les modifications nécessaires aux incriminations de traite et de trafic des êtres humains pour mettre en conformité notre droit avec les instruments de droit international et de droit européen, notamment en ce qui concerne les seuils de peine prévus dans les décisions-cadres européennes, ainsi que la distinction qu'il y a lieu d'opérer entre l'incrimination de trafic et celle de traite. Désormais, l'incrimination de traite des êtres humains ne sera plus limitée aux seuls étrangers, comme le prévoit l'actuel article 77bis de la loi du 15 décembre 1980 sur l'accès au territoire; elle visera également les Belges.

Un nouvel article 433quinquies définit ce qu'il faut entendre par traite et vise explicitement une série de formes d'exploitations, qu'elles soient sexuelles - comme la pornographie, la débauche, la prostitution - ou économiques - comme l'exploitation par le travail, celle de la mendicité, le trafic d'organes, etc. - et ce, afin de se conformer aux instruments européens précités et au protocole de l'ONU relatif à la traite des êtres humains. Parallèlement à cela, l'article 77bis de la loi de 1980 a été modifié afin de viser spécifiquement et exclusivement le trafic des êtres humains. Ajoutons que des amendements ont également été déposés pour incriminer la tentative, tant pour ce qui est de l'exploitation de la mendicité que de la traite et du trafic des êtres humains.

Un deuxième volet des dispositions traite de l'exploitation de la mendicité. Il ne s'agit pas ici de recriminaliser le délit de mendicité, mais - un peu à l'instar de ce qui existe en matière de prostitution - de punir celui qui exploite la mendicité d'autrui. En ce sens, des circonstances aggravantes ont été prévues, lorsque le mendiant est mineur, que l'auteur exploite une précarité particulière telle que la maladie, le handicap ou quand il a autorité sur le mendiant.

Une autre mesure importante, et qui a fait l'objet de nombreux débats en commission, vise à reprendre dans le Code pénal la disposition de l'article 77bis § 1 er bis de la loi de 1980 qui concerne ce que l'on appelle les marchands de sommeil, l'objectif de cette modification étant d'étendre à tous la protection contre les marchands de sommeil. Cette infraction est désormais envisagée de façon autonome et non plus comme une forme particulière de traite des êtres humains.

J'en viens au deuxième projet de loi relatif à la protection pénale des mineurs, lequel vise à modifier le Code pénal pour punir plus sévèrement les personnes qui se servent de mineurs pour commettre des infractions. En effet, tenant compte de l'approche spécifique dont bénéficient les mineurs dans le cadre de la loi sur la protection de la jeunesse, ces adultes espèrent pouvoir se soustraire aux poursuites, tout en continuant à récolter les fruits des infractions qu'ils font commettre par des mineurs mais pour leur compte.

Un nouvel article du Code pénal, à lire conjointement avec l'article 66 relatif aux coauteurs, doit permettre d'élever de manière relative et conséquente le minimum de la peine pour chaque délit et chaque crime prévu dans le Code pénal. Une augmentation supplémentaire peut d'ailleurs avoir lieu si des circonstances aggravantes spécifiques le requièrent.

Par ailleurs, dans le cadre des débats, diverses propositions de loi ont été prises en compte, notamment celle de Mme Hilde Claes punissant les personnes qui utilisent des mineurs pour commettre un crime ou un délit, celle de Mme Nahima Lanjri et de MM. Tony Van Parys et Servais Verherstraeten modifiant le Code pénal, en vue d'étendre le champ de l'incrimination des pratiques des marchands de sommeil.

Il convient également d'ajouter le projet de loi n° 640 relatif à l'exploitation de la mendicité qui est à l'origine une proposition de loi de Mme de T'Serclaes.

Lors de la discussion générale, il est apparu que les partis démocratiques dans leur ensemble souscrivaient pleinement aux différents objectifs poursuivis par les deux projets de loi.

Néanmoins, certaines interrogations ont été soulevées, plus particulièrement à propos d'une disposition du projet concernant les marchands de sommeil. Ainsi, le CD&V, tout en souscrivant aux objectifs de cet article, s'est inquiété de l'absence de disposition prévoyant le relogement des victimes belges des marchands de sommeil, alors que c'est prévu dans la loi de 1980 pour les étrangers. Un amendement a été déposé en ce sens pour assurer le parallélisme.

Le groupe MR, pour sa part, a exprimé ses craintes de voir certains propriétaires hésiter désormais, si les termes de la loi ne sont pas davantage précisés, à mettre en location leurs immeubles. Il s'est également interrogé sur les conflits de compétences éventuels avec les législations régionales existantes en la matière.

Le groupe VLD s'est inquiété des amendes imposées contre les marchands de sommeil, qui sont calculées en fonction du nombre de victimes, et du risque, si celles-ci sont nombreuses, de ne pas pouvoir obtenir des dommages et intérêts si à la suite des amendes, le coupable devient insolvable.

Le groupe PS a rappelé que l'adoption du projet permettra de mettre le droit belge en concordance avec les législations européennes et internationales et a insisté sur les préoccupations essentielles en matière de traite des êtres humains et d'exploitation des personnes fragiles que rencontre le projet.

En conclusion, l'ensemble des projets de loi 1559 et 1560, tels qu'amendés, a été approuvé à l'unanimité.

Mr. Speaker, Mr. Minister, dear colleagues, the Justice Committee has devoted six sessions to the examination of the bills submitted to us today, namely the one amending various provisions in order to strengthen the fight against human trafficking and trafficking in human beings and the one aimed at supplementing the criminal protection of minors. The committee decided to examine these two bills in a single general discussion, since these projects are closely linked.

The first project, therefore, concerns trafficking and trafficking in human beings and pursues several objectives.

First, a first set of provisions aims to make the necessary changes to the incriminations of trafficking and trafficking in human beings in order to bring our law into conformity with instruments of international and European law, in particular with regard to the thresholds of punishment provided for in European framework decisions, as well as the distinction between the incrimination of trafficking and the incrimination of trafficking. From now on, the incrimination of trafficking in human beings will no longer be limited to only foreigners, as provided for in the current article 77bis of the law of 15 December 1980 on access to the territory; it will also target Belgians.

A new article 433quinquies defines what is to be understood by trafficking and explicitly targets a series of forms of exploitation, whether sexual – such as pornography, debauchery, prostitution – or economic – such as labour exploitation, begging, organ trafficking, etc. - in order to comply with the aforementioned European instruments and the UN Protocol on Trafficking in Human Beings. Simultaneously, Article 77bis of the 1980 Act was amended to target specifically and exclusively trafficking in human beings. Add that amendments have also been filed to incriminate the attempt, both in terms of exploitation of begging and trafficking and trafficking in human beings.

A second part of the provisions deals with the exploitation of begging. It is not about recriminalising the crime of begging, but – a little like what exists in the field of prostitution – to punish the one who exploits the begging of others. In this sense, aggravating circumstances have been envisaged, when the beggar is a minor, that the perpetrator exploits a particular precariousness such as illness, disability or when he has authority over the beggar.

Another important measure, which has been the subject of numerous discussions in committees, aims to reintroduce in the Criminal Code the provision of article 77bis § 1 er bis of the 1980 law concerning the so-called sleep merchants, the purpose of this modification being to extend to all the protection against sleep merchants. This offence is now considered independently and no longer as a particular form of trafficking in human beings.

The second draft law on the criminal protection of minors, which aims to amend the Criminal Code to punish more severely those who use minors to commit offences. Indeed, taking into account the specific approach that minors benefit from under the Youth Protection Act, these adults hope to escape prosecution, while continuing to reap the fruits of crimes committed by minors but for their own account.

A new article of the Criminal Code, to be read in conjunction with Article 66 relating to co-authors, should allow to raise in a relative and consistent manner the minimum penalty for each offence and each crime provided for in the Criminal Code. An additional increase may also take place if specific aggravating circumstances so require.

In addition, in the context of the debates, various bills were taken into account, including that of Ms. Hilde Claes punishing persons who use minors to commit a crime or a crime, that of Ms. Nahima Lanjri and MM. Tony Van Parys and Servais Verherstraeten amending the Criminal Code, in order to expand the scope of incriminating the practices of sleep merchants.

It is also worth adding the Bill No. 640 relating to the exploitation of begging which is originally a bill proposed by Mrs. de T'Serclaes.

During the general discussion, it appeared that the democratic parties as a whole fully endorsed the different objectives pursued by the two bills.

Nevertheless, some questions have been raised, in particular regarding a project provision concerning sleep merchants. Thus, the CD&V, while subscribing to the objectives of this article, was concerned about the absence of a provision providing for the relocation of Belgian victims from sleep merchants, while this is provided in the 1980 law for foreigners. An amendment has been submitted to ensure the parallelism.

The MR group, for its part, expressed its concerns that some owners are now hesitant, if the terms of the law are not further specified, to rent their buildings. It also asked about possible conflicts of competence with existing regional legislation on the subject.

The VLD group was concerned about the fines imposed on sleep merchants, which are calculated based on the number of victims, and the risk, if they are many, of not being able to obtain damages if as a result of the fines the culprit becomes insolvent.

The PS group recalled that the adoption of the project will bring Belgian law in line with European and international legislation and insisted on the key concerns regarding human trafficking and the exploitation of vulnerable persons that the project faces.

In conclusion, all bills 1559 and 1560, as amended, were approved unanimously.

                    Mijnheer de voorzitter, collega's, het voorliggend wetsontwerp behandelt het geheel van mensenhandel. In mijn betoog beperk ik me tot het deel over huisjesmelkerij omdat het wetsvoorstel dat ik samen met de heren Van Parys en Verherstraeten heb ingediend over dit onderwerp handelt.

Huisjesmelkerij is een gekend probleem dat we vooral in de grootsteden aantreffen maar niet alleen daar. Ook heel wat burgemeesters van kleinere steden hebben met het probleem te maken. Steeds vaker ziet men dat appartementen en woongelegenheden — als men dat nog woongelegenheden kan noemen — in zeer slechte staat worden verhuurd. Appartementen of studio's die bedoeld zijn voor één persoon worden aan meerdere personen verhuurd. Soms gebeurt het dat ze in shiften van acht uur verhuurd worden. Kortom, een praktijk die aan te klagen is.

Dikwijls gaat het om woningen die niet voldoen aan de minimale woonkwaliteitsnormen waardoor de bewoners in mensonwaardige omstandigheden leven. Alle woningen zowel huur- als eigendomswoningen, moeten immers aan een aantal minimale normen inzake woonkwaliteit en betrouwbaarheid voldoen. In het Vlaamse Gewest zien het kamerdecreet en de wooncode hierop toe. In de praktijk stellen we evenwel vast dat bepaalde woningen heel wat gebreken vertonen, vooral op vlak van veiligheid. Er is gevaar voor elektrocutie, brandgevaar, gebreken zoals kans op CO 2 -vergiftiging en heel wat gebreken in verband met comfort zoals gebrek aan verwarming.

Die panden worden heel vaak verhuurd aan mensen die in een economisch en sociaal zwakke positie staan en noodgedwongen terechtkomen in het slechtste segment van de huurmarkt. De overgrote meerderheid van de slachtoffers — dat heeft men in het verleden reeds gezien — zijn vaak vreemdelingen. Vaak gaat het in de praktijk over asielzoekers die het sowieso al moeilijk hebben op de huisvestingsmarkt en omwille van hun afkomst het dubbel moeilijk hebben.

Het is echter heel duidelijk dat het niet alleen over vreemdelingen gaat. Dat blijkt uit cijfers van de Vlaamse Woninginspectie. Hieruit blijkt dat in 2003 65% van de slachtoffers vreemdelingen zijn, 6% zijn van onbekende nationaliteit en 15% zijn Belgen. Vorig jaar zijn de cijfers gestegen. Dit betekent dat het aandeel Belgen gestegen is tot 19%. Uit de jaarrapporten blijkt dat bepaalde huisjesmelkers een pand verhuren, andere eigenaars verhuren verschillende panden. Gemiddeld verhuurt een huisjesmelker 4 panden. Een verhuurderhuisjesmelker was goed voor 37 panden

Een nieuw feit dat de laatste jaren opduikt zijn het toenemend aantal criminele organisaties die onder het mom van vennootschappen, huisjes verhuren die helemaal niet in orde zijn.

Tot op heden was de voornaamste wet waarop men zich kon baseren om deze problematiek aan te pakken de Vreemdelingenwet. Ik heb er reeds op gewezen dat steeds meer slachtoffers Belgen zijn. Daarom was het nodig ook Belgen te kunnen beschermen tegen dit fenomeen. Bovendien was het in het algemeen beter dit probleem uit de Vreemdelingenwet te halen en in het Strafwetboek in te schrijven zodat men de problemen adequaat kan aanpakken.

Daarom heb ik, samen met collega's Tony Van Parys en Servais Verherstraeten, een wetsvoorstel ingediend dat inderdaad een gelijkschakeling nastreeft wat betreft de slachtoffers. Het mag uiteraard geen betrekking hebben op de nationaliteit. Of het Belgen of vreemdelingen zijn, zij kunnen allen slachtoffer worden en zij moeten dus allen evenveel recht hebben op bescherming. De lat moet gelijk gelegd worden voor iedereen.

Enige tijd na de indiening van ons wetsvoorstel kwam dan ook het wetsontwerp van de regering over de mensenhandel. Een deel ervan, te weten vanaf artikel 6, gaat ook over huisjesmelkerij. Zowel het ontwerp van de regering als ons wetsvoorstel, beoogden hetzelfde, namelijk de aanpak van huisjesmelkerij, deze materie opnemen in het Strafwetboek en een sterk signaal geven op het vlak van bestraffing.

Er zijn evenwel een aantal kleine verschillen tussen ons wetsvoorstel en het ontwerp van de regering, bijvoorbeeld in verband met de strafmaat. Wij namen de strafmaat over van de vreemdelingenwet, die iets strenger is. Het ontwerp van de regering is soepeler, in die zin dat de strafmaat is bepaald van zes maanden tot een jaar voor een gewoon geval van huisjesmelkerij. Dat wordt echter gecompenseerd door de vermenigvuldiging met het aantal slachtoffers. Daarom konden wij ons daarin terugvinden, ook wat de strafmaat betreft.

Naast de gevangenisstraf zijn er boetes van 500 euro tot 25.000 euro. De boetes lopen op naargelang de dader meer woningen verhuurt die werkelijk niet voldoen aan de minimale kwaliteitsnormen, tegen een abnormaal hoge prijs, en ook wanneer dat gebeurt in het kader van georganiseerde criminaliteit.

Een andere strafbepaling die in het ontwerp staat, is dat huisjesmelkers kunnen worden ontzet uit hun burgerrechten. Men kan de huisjesmelkers ook opleggen dat zij de woning op eigen kosten moeten herstellen.

Waarover in het wetsvoorstel niets staat, al is het een probleem dat vaak voorkomt en waarmee de burgemeesters vooral van de grote steden geconfronteerd worden, zijn de schrijnende toestanden waarbij families dreigen op straat te komen. De burgemeester moet die slachtoffers herhuisvesten. Daar wringt het schoentje, want in de wetgeving was niet bepaald dat die herhuisvesting kon gebeuren op kosten van de eigenaar, dus van de huisjesmelker. Daarom hebben de heer Van Parys en ikzelf een amendement ingediend, zodat slachtoffers weer kunnen worden gehuisvest op kosten van de huisjesmelker. Dat is, denk ik, in elk geval een stap vooruit. Ons amendement werd unaniem aanvaard en dat verheugt ons. Geen enkel lid van geen enkele fractie was het op dat vlak niet met ons eens. Dat is belangrijk.

Ik wil een kanttekening maken die ik ook in de commissievergadering heb gemaakt, met name over amendementen die ter sprake zijn gekomen op vraag van de MR en cdH. Zij vonden dat de bepalingen met betrekking tot de definiëring, de omschrijving van het begrip "slachtoffer", te vaag waren. Zij wilden daaraan een aantal termen en voorwaarden koppelen.

De voorwaarde die men in de tekst heeft ingeschreven is, en ik lees voor: "...dat het slachtoffer geen andere keuze had dan zich te laten misbruiken." Daar heb ik namens onze fractie toch echt wel voorbehoud bij gemaakt; dit is toch wel een stap achteruit. Hoe kan men als slachtoffer bewijzen dat men geen andere keuze had? Wat als er inderdaad, een beetje verderop in dezelfde straat, ook een appartement te huur stond? Is dat dan een bewijs dat men toch nog een andere keuze had, of wat dan ook? Ik hoop in elk geval dat wanneer dit wetsontwerp in de praktijk wordt toegepast, de rechters met gezond verstand zullen oordelen en het de slachtoffers niet moeilijker zullen maken dan zij het nu al hebben. Ik hoop dat zij daar niet te zwaar zullen aan tillen. 

Meer in het algemeen wil ik nog zeggen dat wij in de commissie zowel artikel 6 als het geheel van het ontwerp over de mensenhandel hebben goedgekeurd en dat ook vandaag zullen doen, omdat het werkelijk tegemoetkomt aan een probleem dat zich voordoet in de samenleving. Het ligt bovendien volledig in de lijn van het wetsvoorstel dat ik heb ingediend met de heren Tony Van Parys en Servais Verherstraeten. Daarom zullen wij het geheel goedkeuren.

The present bill deals with the whole of human trafficking. In my speech, I will limit myself to the section on domestic dairy because the bill I have submitted together with Mr. Van Parys and Mr. Verherstraeten deals with this subject.

House milk production is a well-known problem that we find mainly in large cities but not only there. Many mayors of smaller cities are also facing the problem. More and more often, apartments and residential buildings — if one can even call them residential buildings — are rented in very poor condition. Apartments or studios intended for one person are rented to several persons. Sometimes it happens that they are rented in shifts of eight hours. In short, a practice that can be accused.

Often these are houses that do not meet the minimum standards of housing quality which causes residents to live in unhuman conditions. After all, all houses, both rental and ownership houses, must meet a number of minimum standards on housing quality and reliability. In the Flemish Region, the Chamber Decree and the Housing Code reflect this. In practice, however, we find that certain houses have many shortcomings, especially in terms of safety. There is a danger of electrocution, fire hazard, defects such as the possibility of CO 2 poisoning and a lot of defects related to comfort such as lack of heating.

These properties are very often rented to people who are in an economically and socially weak position and are forced to fall into the worst segment of the rental market. The overwhelming majority of the victims — which has already been seen in the past — are often foreigners. Often in practice it is about asylum seekers who have already had difficulty in the housing market anyway and because of their origin have a double difficulty.

However, it is very clear that it is not just about foreigners. This is evidenced by figures from the Flemish Housing Inspection. This shows that in 2003 65% of the victims were foreigners, 6% were of unknown nationality and 15% were Belgians. Last year the figures increased. This means that the share of Belgians has risen to 19%. The annual reports show that some house milkers rent a property, while other owners rent different properties. On average, a housekeeper rents 4 pants. A rental house milkmaker was good for 37 properties

A new fact that has emerged in recent years is the growing number of criminal organizations renting houses that are not in order at all under the guise of companies.

Until now, the main law on which one could rely to address this problem was the Foreign Relations Act. I have already pointed out that more and more victims are Belgians. Therefore, it was necessary to be able to protect the Belgians from this phenomenon. In addition, it was generally better to remove this problem from the Foreigners Act and to include it in the Criminal Code so that the problems can be addressed appropriately.

That is why, together with my colleagues Tony Van Parys and Servais Verherstraeten, I have submitted a bill that indeed seeks equality with respect to the victims. It should not be related to nationality. Whether they are Belgians or foreigners, they can all become victims and they must therefore all have the same right to protection. The latter must be placed equally for everyone.

Some time after the submission of our bill, therefore, came the government’s bill on human trafficking. Part of it, namely from Article 6, also concerns domestic dairy. Both the government draft and our bill intended the same thing, namely the approach to domestic dairy, to include this matter in the Criminal Code and to give a strong signal in terms of punishment.

However, there are some small differences between our bill and the government’s bill, for example in relation to the penalty. We adopted the penalty measure from the Foreigners Act, which is somewhat stricter. The government’s draft is more flexible, in the sense that the penalty is set from six months to one year for a common case of house milk farming. However, this is compensated by the multiplication by the number of victims. That is why we were able to find ourselves in it, also in terms of the penalty.

In addition to the prison sentence, there are fines from 500 euros to 25,000 euros. The fines are based on the fact that the perpetrator rents more homes that do not actually meet the minimum quality standards, at an abnormally high price, and also when this happens in the context of organized crime.

Another penalty provision in the draft is that house milkers can be deterred from their civil rights. You can also impose on the house milkers that they must repair the home at their own expense.

What is not mentioned in the bill, although it is a problem that is frequent and with which mayors are faced especially from the big cities, are the shaking conditions in which families threaten to come out on the streets. The mayor must resettle the victims. There the shoe wreaks, because in the legislation was not stipulated that that resettlement could take place at the expense of the owner, i.e. of the house milkmaker. For this reason, Mr Van Parys and I have submitted an amendment so that victims can be resettled at the expense of the house milkmaker. That, I think, is at least a step forward. Our amendment was unanimously accepted and we are pleased. No member of any political group agreed with us on this point. That is important.

I would like to make a comment that I also made in the committee meeting, in particular on amendments that have been discussed at the request of the MR and CDH. They found that the provisions relating to the definition, the definition of the concept of “victim”, were too vague. They wanted to link a number of terms and conditions.

The condition that has been inscribed in the text is, and I read for: "...that the victim had no choice but to be abused." How can one as a victim prove that one had no other choice? What if, indeed, a little further in the same street, there was also an apartment to rent? Is this proof that there was another choice, or something else? In any case, I hope that when this bill is applied in practice, the judges will judge with common sense and will not make it more difficult for the victims than they already have. I hope they won’t be too heavy on it. Their

More generally, I would like to say that we in the committee have approved both Article 6 and the whole draft on human trafficking and will do so today, because it really addresses a problem that arises in society. It is also fully in line with the bill I have submitted with Mr. Tony Van Parys and Mr. Servais Verherstraeten. We will approve the whole.

                    - introduire dans le Code pénal la notion d'exploitation de la mendicité et les circonstances aggravantes y applicables; - introduire des dispositions définissant la notion de traite des êtres humains et les circonstances aggravantes y applicables; - adapter la définition de la notion de trafic d'êtres humains à la définition contenue dans la directive du 28 novembre 2002 qui précise l'aide à l'entrée, au transit et au séjour irrégulier ainsi que la définition des circonstances aggravantes y applicables.

Ce projet de loi vise également à introduire dans le Code pénal des dispositions définissant la notion d'abus de la vulnérabilité d'autrui en vendant, louant ou mettant à disposition des biens immobiliers en vue de réaliser un profit anormal. C'est sur ce point que les discussions en commission ont principalement porté, comme l'a rappelé notre collègue Perpète, rapporteur pour ce projet.

Dans une société démocratique moderne, il est évidemment inacceptable que des propriétaires mal intentionnés mettent en location, en connaissance de cause, des taudis à des prix exorbitants en profitant ainsi de la détresse que vivent certaines personnes. Une question qui se posait était de savoir si cet objectif n'était pas déjà rencontré par des normes régionales, comme les codes régionaux du logement. Par exemple, pour ce qui concerne Bruxelles, l'ordonnance du 17 juillet 2003 consacre le droit à un logement décent et contient une série de normes de sécurité, de salubrité et d'équipement qui sont garanties par tout un arsenal de mesures plus ou moins contraignantes. Des enquêtes de contrôle peuvent être effectuées, à la suite de plaintes émanant d'un locataire, par un service d'inspection régional qui peut également diligenter des enquêtes d'initiative.

Cette ordonnance de la Région bruxelloise constitue le Code bruxellois du logement et prévoit également des sanctions, et c'est là que les choses sont plus intéressantes: - une mise en demeure du bailleur de régulariser la situation; - une interdiction de louer ou de faire occuper le bien, ce qui est déjà très contraignant, - et enfin, une amende administrative de 3.000 à 25.000 euros, ce montant pouvant être doublé s'il y a récidive dans les deux ans.

Les codes du logement et la disposition en projet poursuivent le même objectif, à savoir lutter contre les mauvais propriétaires intentionnels qui comptent mettre en location un bien ne correspondant pas aux normes minimales définies par les Régions.

À titre d'information complémentaire, il existe également des normes fédérales qui traitent de la conformité des logements. L'article 2 de la section 2 du chapitre 2 du titre VIII du livre III du Code civil prescrit que le bien loué doit répondre aux exigences élémentaires de sécurité, de salubrité et d'habitabilité. L'arrêté royal du 8 juillet fixe les conditions minimales à remplir pour qu'un bien immeuble donné en location à titre de résidence principale soit conforme aux exigences élémentaires de sécurité, de salubrité et d'habitabilité. Si ces conditions ne sont pas remplies, le preneur peut exiger l'exécution des travaux nécessaires pour mettre le bien loué en conformité, il peut demander la résiliation du contrat avec dommages et intérêts et en attendant l'exécution des travaux, le juge peut accorder une diminution du loyer.

Par ailleurs, il convenait de faire en sorte que la disposition juridique en projet et en discussion respecte le prescrit de l'article 12 de la Constitution et de l'article 7 de la Convention de sauvegarde des droits de l'homme et des libertés fondamentales, selon lesquels les dispositions contenant des incriminations pénales doivent présenter un caractère de précision et de prévisibilité. C'était, en effet, chers collègues, le second écueil que le MR voyait à ce projet en discussion: le manque de précision de l'incrimination pénale, outre le fait que d'autres sanctions existaient sur le plan régional.

D'autres questions ont également été soulevées dans la discussion. Que faut-il entendre par "situation sociale précaire du preneur"? Que faut-il entendre par "intention de réaliser un profit anormal"? Comment le bailleur peut-il s'assurer du nombre de personnes qui occupent le bien loué? Quels sont les biens immobiliers visés? Sont-ce uniquement les logements ou tous les immeubles ou des parties de logement ou des logements inhabituels tels que conteneurs, caves, greniers ou autres? Le groupe MR a participé activement et de manière constructive au débat, en déposant une série d'amendements visant à préciser la portée du texte et à circonscrire de la manière la plus précise l'incrimination proposée. Il importait à notre sens de préciser la portée du texte afin d'éviter que des propriétaires de bonne foi soient visés par cette disposition. Il se peut en effet que le locataire se retrouve dans une situation sociale précaire, en cours de bail et pour des raisons liées à l'évolution de son existence, sans que le propriétaire en soit forcément informé. Que faire dans ce cas-là? Il se peut également que la situation sociale précaire ne soit pas apparente lors de la mise à disposition du logement.

Le groupe MR a donc proposé de préciser que le logement litigieux est celui qui est mis à disposition dans des conditions incompatibles avec la dignité humaine. La notion de condition incompatible avec la dignité humaine ressortit à l'article 23 de la Constitution — une norme supérieure à la loi — qui précise que chacun a le droit de mener une vie conforme à la dignité humaine, en ce compris le droit à un logement décent.

Le projet à l'examen utilise d'ailleurs cette notion à l'article 433quinquies §1, 3° tel que proposé. L'objectif de notre amendement consistait également, en matière de sanction fédérale, puisqu'il s'agit bien d'une sanction fédérale, d'utiliser une notion qui soit générale et qui ne vise pas uniquement l'insalubrité, d'application différente selon les législations régionales en fonction desdites législations. L'objectif était donc de choisir une caractérisation globale qui ne soit pas modulable en fonction de ces législations, de telle sorte que l'infraction ne soit pas appliquée différemment selon la Région où l'on se trouve.

Ces précisions constituaient, pour nous, le minimum minimorum, étant donné que chaque fois que l'on décide d'instituer ou de créer une sanction pénale, il faut toujours penser que les personnes qui y seront soumises devront résister à la contrainte de la force publique et qu'il se doit, dans une société démocratique, que l'incrimination pénale soit la plus précise possible pour éviter l'exercice abusif de cette contrainte et l'erreur judiciaire. - to introduce in the Criminal Code the concept of exploitation of begging and the aggravating circumstances applicable to it; - to introduce provisions defining the concept of trafficking in human beings and the aggravating circumstances applicable to it; - to adapt the definition of the concept of trafficking in human beings to the definition contained in the Directive of 28 November 2002 which specifies the aid for illegal entry, transit and illegal stay as well as the definition of aggravating circumstances applicable to it.

This bill also aims to introduce in the Criminal Code provisions defining the notion of abuse of the vulnerability of others by selling, renting or making available real estate in order to ⁇  an abnormal profit. This is the point on which the discussions in the committee have mainly focused, as our colleague Perpète, rapporteur for this project, recalled.

In a modern democratic society, it is obviously unacceptable for malicious owners to rent, in knowledge of the facts, houses at exorbitant prices, thus taking advantage of the distress experienced by certain people. One question that arose was whether this goal was not already met by regional standards, such as regional housing codes. For example, with regard to Brussels, the Ordinance of 17 July 2003 enshrines the right to decent housing and contains a series of safety, sanitation and equipment standards that are guaranteed by a whole arsenal of more or less compelling measures. Control investigations may be carried out, following complaints from a tenant, by a regional inspection service which may also diligently conduct initiative investigations.

This order of the Brussels Region constitutes the Brussels Housing Code and also provides for sanctions, and this is where things are more interesting: - an order of the landlord to regularise the situation; - a ban on renting or making the property occupy, which is already very compelling, - and finally, an administrative fine of 3,000 to 25,000 euros, this amount can be doubled if there is a recurrence within two years.

The housing codes and the project arrangement pursue the same objective, namely to fight against intentional bad owners who intend to lease a property that does not meet the minimum standards defined by the Regions.

For additional information, there are also federal standards that deal with housing compliance. Article 2 of Section 2 of Chapter 2 of Title VIII of Book III of the Civil Code prescribes that the rented property must meet the basic requirements of safety, sanitation and habitability. The Royal Decree of 8 July establishes the minimum conditions to be met for an immovable property leased as a main residence to comply with the basic requirements of safety, health and habitability. If these conditions are not met, the leasee may require the execution of the works necessary to bring the leased property into conformity, he may request the termination of the contract with damages and while waiting for the execution of the works, the judge may grant a reduction in the rent.

Furthermore, it was appropriate to ensure that the legal provision in project and in discussion complies with the provisions of Article 12 of the Constitution and Article 7 of the Convention for the Protection of Human Rights and Fundamental Freedoms, according to which provisions containing criminal incriminations must have a character of precision and predictability. This was, in fact, dear colleagues, the second hassle that the MR saw to this project in discussion: the lack of accuracy of the criminal incrimination, in addition to the fact that other sanctions existed on the regional level.

Other issues were also raised in the discussion. What should be understood by “precary social situation of the buyer”? What should be understood by “intention to ⁇  an abnormal profit”? How can the landlord be sure of the number of people who occupy the rented property? What are the properties targeted? Are these only housing or all buildings or parts of housing or unusual housing such as containers, basements, stalls or other? The MR group actively and constructively participated in the debate, submitting a series of amendments to clarify the scope of the text and to specify the proposed incrimination in the most precise way. It was important in our opinion to clarify the scope of the text in order to prevent good-faith owners from being covered by this provision. It is possible that the tenant finds himself in a precarious social situation, in lease and for reasons related to the evolution of his existence, without the owner being necessarily informed. What to do in this case? It may also be that the precarious social situation is not apparent when making the housing available.

The MR group therefore proposed to clarify that the contested housing is that which is made available under conditions incompatible with human dignity. The notion of condition incompatible with human dignity is reflected in Article 23 of the Constitution – a standard superior to the law – which specifies that everyone has the right to lead a life consistent with human dignity, including the right to decent housing.

The project under consideration uses this notion in article 433quinquies §1, 3° as proposed. The purpose of our amendment was also, in the field of federal sanction, since it is indeed a federal sanction, to use a concept that is general and that does not refer only to insalubrity, of different application according to regional legislation depending on the said legislation. The aim was therefore to choose a global characterization that is not modulable according to these legislations, so that the infringement is not applied differently depending on the Region in which you are located.

These clarifications constitute, for us, the minimum minimorum, given that whenever one decides to institute or create a criminal sanction, one must always think that the persons who will be subjected to it will have to resist the coercion of public force and that it is necessary, in a democratic society, that the criminal incrimination be as precise as possible to avoid the abuse of this coercion and the judicial error. As a result of what I said, the MR group will support the text that is submitted today to your vote. Thank you for your attention, dear colleagues.

                    Mijnheer de voorzitter, mijnheer de minister, collega's, sta mij toe te beginnen met een woord van dank en met felicitaties aan de verslaggever, collega Perpète, die terzake een duidelijk en uitvoerig verslag heeft gegeven, zowel wat betreft de inhoud van de voorliggende wetsontwerpen en wetsvoorstellen als omtrent de knelpunten, de discussiepunten die wij hadden tijdens de behandeling in de commissie voor de Justitie, wat voor mij vandaag het werk uiteraard enigszins vergemakkelijkt.

Collega's, ik meen dat ik een open deur intrap wanneer ik zeg dat de voorliggende wetsontwerpen en wetsvoorstellen een aantal belangrijke verbeteringen bevatten. Sta mij toe in het kort te benadrukken welke punten voor de sp.a zeer belangrijk zijn. Om het enigszins overzichtelijk te houden stel ik voor ze te bundelen, enerzijds inzake het wetsvoorstel over mensenhandel en mensensmokkel en anderzijds, inzake de aanvulling van de strafrechtelijke bescherming van de minderjarigen.

Eerst behandel ik het wetsontwerp over mensenhandel en mensensmokkel. Ook tijdens het verslag is al gebleken dat het essentieel is omdat dankzij het ontwerp een aantal internationale en Europese bepalingen en instrumenten zullen omgezet worden in Belgisch recht. Op internationaal vlak waren er inderdaad al de Aanvullende Protocollen bij het Verdrag van de Verenigde Naties tegen transnationale georganiseerde misdaad inzake preventie, bestrijding en bestraffing van mensenhandel en meer in het bijzonder van vrouwenhandel en kinderhandel, en tegen smokkel van migranten over het land, via de zee en in de lucht. Op Europees vlak bestonden er twee instrumenten, enerzijds, het kaderbesluit van 19 juli 2002 van de Raad van de Europese Unie inzake de bestrijding van de mensenhandel, en anderzijds, de richtlijn van 28 november 2002 van de Raad van de Europese Unie tot omschrijving van de hulpverlening bij illegale binnenkomst, illegale doortocht en illegaal verblijf.

Die Europese en internationale instrumenten worden nu eindelijk omgezet in Belgisch recht.

Daarnaast is er, misschien belangrijker nog, een aantal positieve elementen. Een eerste positief element in het ontwerp inzake mensenhandel en mensensmokkel is voor sp.a dat dankzij het ontwerp, de strafbaarstelling van mensenhandel en mensensmokkel in de toekomst niet langer beperkt zal blijven tot het internationaal niveau maar ook tot het nationaal niveau zal behoren en bijgevolg niet langer alleen zal slaan op vreemdelingen maar ook op Belgen.

Wat de strafbaarstelling betreft is er ook een uitbreiding van het toepassingsgebied naar de verschillende vormen, enerzijds naar de seksuele uitbuiting zoals prostitutie, pornografie, ontucht en anderzijds naar de economische uitbuiting van bijvoorbeeld arbeid, de exploitatie van bedelarij, maar ook het wegnemen van organen.

Een tweede belangrijke positieve element in dit ontwerp voor ons is dat het ontwerp voorziet in een aantal bijkomende verzwarende omstandigheden. Ik denk aan het feit dat men deel uitmaakt van een criminele organisatie, maar ook het in gevaar brengen van het leven van een slachtoffer.

Een derde belangrijk positief element voor ons is de verzwaring van straffen voor personen die zich bezig houden met de handel in smokkel van niet-begeleide minderjarigen. Dat realiseert men hier door de draagwijdte van de verzwarende omstandigheden uit te breiden naar alle minderjarigen. Dat is een belangrijke realisatie en vooruitgang.

Een laatste belangrijke positieve element voor de sp.a in het ontwerp inzake de mensenhandel en mensensmokkel is de aanpak van de huisjesmelkerij. Mevrouw Lanjri heeft het daarover reeds uitvoerig gehad. Ik denk dat wij het er inderdaad allemaal over eens zijn dat het hier gaat over een verachtelijk gebruik. Het gaat echt wel over het misbruik maken van de zwakheid of kwetsbaarheid van iemand door het ter beschikking stellen, verhuren of verkopen van onroerend goed met één duidelijke doelstelling, namelijk het halen van een abnormaal profijt.

Ik denk inderdaad dat deze praktijk absoluut verachtelijk is en wel om meerdere redenen. Het gaat veelal om woningen die in een erbarmelijke staat verkeren. Zij voldoen niet aan de nodige kwaliteitsnormen waardoor de personen die deze woningen verhuren aan heel wat gevaren worden blootgesteld. Ik denk aan het gevaar voor brand of een CO 2 -vergiftiging. Dat zijn mensonwaardige woonomstandigheden. Dat zijn voor ons de positieve elementen in het ontwerp inzake de mensenhandel en de mensensmokkel.

Dan kom ik tot het tweede ontwerp dat vandaag voorligt, namelijk de aanvulling van de strafrechtelijke bescherming van de minderjaren dat mij na aan het hart ligt.

Dat is de reden waarom wij terzake een eigen wetsvoorstel hebben ingediend. Wij mogen hier echt wel zeggen dat het hier gaat om een ontwerp dat absoluut essentieel is. Het is essentieel omdat het een noodzakelijke hervorming vormt van het strafrechtelijk gedeelte van de jeugdbeschermingwet van 1965. Het wetsontwerp wordt in de eerste plaats terecht gericht op de aanpassing van het Strafwetboek teneinde personen die gebruik maken van minderjarigen om strafbare feiten te plegen strenger te gaan straffen. 

Ik zei net dat dit deel voor de sp.a een essentieel gedeelte vormt, om de eenvoudige reden dat voor ons de wettelijke bescherming van de minderjarige echt wel essentieel is. Ik moet toegeven dat de wet van 28 november 2000 inzake de strafrechtelijke bescherming van de minderjarigen in die zin reeds een vooruitgang was, in die zin echt wel belangrijk was. Voor ons was er echter toch wel één grote maar aan verbonden, namelijk het feit dat er niets geregeld was over het gebruik of misbruik van de minderjarige. Dat vormde een heel belangrijk gebrek, een belangrijke lacune, temeer daar heel wat studies vandaag aantonen dat precies die vorm van criminaliteit vandaag in opmars is. Ze is in opmars om heel wat redenen. 

Volgens het Belgisch systeem is de minderjarige strafrechtelijk onverantwoordelijk. Begrijp mij niet verkeerd, ik vind dit persoonlijk een positieve zaak. Een minderjarige is en blijft een minderjarige en moet in die zin behandeld worden. Ik ben ervan overtuigd dat men er alles aan moet doen om die jongeren zo lang mogelijk uit de criminele sfeer te houden. 

Anderzijds stellen wij vast dat die vorm van criminaliteit echt een opmars maakt doordat volwassenen een vertrouwensband hebben met minderjarigen, een gezagsband hebben op minderjarigen, een machtspositie hebben waarvan zij misbruik kunnen maken om vervolgens die minderjarige te gaan dwingen om, ik zeg maar wat, gedwongen inbraken te plegen, om derden af te dreigen of zelfs om gedwongen diefstallen te gaan plegen. 

Wij mogen globaal zeggen dat dit een vorm is van criminaliteit die zodanig verachtelijk is dat ze moet worden aangepakt en heel duidelijk strafrechtelijk bestraft moet worden.

Vandaar dat wij als fractie gekomen zijn met een eigen wetsvoorstel. Minister Onkelinx is zelf gekomen met ons wetsontwerp dat zelf tegemoetkomt aan deze problematiek. Als fractie zijn we hier gelukkig mee. Als fractie hebben wij dit ten volle gesteund tijdens de behandeling en de stemming in de commissie. Collega's, wij zullen dat vandaag ook doen bij de stemming van beide ontwerpen in deze plenaire vergadering. Dank u.

Mr. Speaker, Mr. Minister, Colleagues, I would like to begin with a word of thanks and congratulations to the reporter, Mr. Perpète, who gave a clear and comprehensive report on this subject, both in terms of the content of the draft laws and legislative proposals presented, as well as in terms of the difficulties, the discussion points we had during the hearing in the Committee on Justice, which for me today obviously makes the work somewhat easier.

Colleagues, I think I find an open door when I say that the current bills and bills contain a number of important improvements. Let me briefly highlight which points are very important for the SP.A. To keep it somewhat clear, I propose to combine them, on the one hand regarding the bill on human trafficking and human trafficking and on the other, on supplementing the criminal protection of minors.

First, I will discuss the draft law on human trafficking and human trafficking. Also during the report it has already been shown that it is essential because thanks to the draft a number of international and European provisions and instruments will be translated into Belgian law. On the international level, there were indeed already the Additional Protocols to the United Nations Convention against Transnational Organized Crime concerning the prevention, control and punishment of trafficking in human beings and more ⁇  of trafficking in women and children, and against the smuggling of migrants on land, by sea and in the air. At the European level, two instruments existed, on the one hand, the Framework Decision of the Council of the European Union of 19 July 2002 on combating human trafficking, and on the other hand, the Council Directive of 28 November 2002 on the definition of assistance in the case of illegal entry, illegal transit and illegal stay.

These European and international instruments are now finally translated into Belgian law.

In addition, and ⁇  more importantly, there are a number of positive elements. A first positive element in the draft on human trafficking and human trafficking is for sp.a that thanks to the draft, the criminalization of human trafficking and human trafficking in the future will no longer be limited to the international level but also to the national level and consequently will no longer affect only foreigners but also Belgians.

As regards the criminalization, the scope of the application is also extended to the various forms, on the one hand to sexual exploitation such as prostitution, pornography, fornication and on the other hand to the economic exploitation of for example labour, the exploitation of begging, as well as organ removal.

A second important positive element in this design for us is that the design provides a number of additional aggravating conditions. I think of the fact that one is part of a criminal organization, but also putting the life of a victim at risk.

A third important positive element for us is the aggravation of penalties for persons engaged in the smuggling of unaccompanied minors. This is achieved by extending the scope of aggravating circumstances to all minors. This is an important achievement and progress.

A last important positive element for the sp.a in the draft on human trafficking and human trafficking is the approach of the cottage dairy. Mrs Lanjri has already talked extensively about this. I think we all agree that this is a contemptible use. It really is about abusing one’s weakness or vulnerability by making available, renting or selling property with one clear goal, namely obtaining an abnormal profit.

I really think this practice is absolutely disgusting, and for several reasons. These are often houses that are in a miserable state. They do not meet the necessary quality standards which expose the persons who rent these houses to many dangers. I think of the danger of fire or a CO 2 poisoning. These are inhuman living conditions. These are, for us, the positive elements of the draft on human trafficking and human trafficking.

Then I come to the second draft that is presented today, namely the supplementation of the criminal protection of minors that I care about.

That is why we have submitted our own bill on this subject. We can really say that this is a design that is absolutely essential. It is essential because it constitutes a necessary reform of the criminal part of the 1965 Youth Protection Act. The draft law is first and foremost correctly aimed at the adaptation of the Criminal Code in order to strengthen the punishment of persons who use minors to commit criminal offences. Their

I just said that this part is an essential part for the sp.a, for the simple reason that for us the legal protection of the minor is really essential. I must admit that the Act of 28 November 2000 on the criminal protection of minors was already a progress in that sense, in that sense it was indeed important. For us, however, there was one big but connected, namely the fact that there was nothing regulated about the use or abuse of the minor. That constituted a very important deficiency, a significant gap, especially since many studies today demonstrate that precisely that form of crime is on the rise today.
