Ik zal inderdaad een korte uiteenzetting houden namens de sp.a-spirit-fractie.
Het wetsontwerp dat ter bespreking voorligt, omvat het verkoopverbod van tabak aan jongeren onder de zestien jaar, de mogelijkheid tot aanpassing van de automatische distributieapparaten, het beperken van de onrechtstreekse reclame voor tabaksproducten en de mogelijkheid tot de bestrijding van het maskeren van gezondheidswaarschuwingen. Het globaal plan ter bestrijding van het tabaksgebruik dat in januari in de commissie voor de Volksgezondheid werd besproken en het voorliggend wetsontwerp dat daaraan voor een gedeelte uitvoering geeft, kunnen alleszins op de goedkeuring van de sp.a-spirit-fractie rekenen. Het hoeft geen betoog dat het gebruik van tabaksproducten schadelijk is voor de gezondheid. Dat wordt trouwens al lang algemeen wetenschappelijk erkend. De risico's voor de gezondheid gaan van hart- en vaatziekten tot kanker, tuberculose tot problemen in de mondholte, verminderde fysieke conditie, osteoporose, cataract, impotentie, voortijdige menopauze enzovoort. Ik vergeet er wellicht nog een aantal.
Een tweede aspect dat zeer belangrijk is in deze problematiek, is de vaststelling dat tabaksgebruik als eerste te voorkomen doodsoorzaak geldt en dat dit sterftecijfer alsmaar stijgt.
Een derde heel belangrijk aspect omvat het rookgedrag bij jongeren. Onderzoek wijst uit dat het aantal rokende jongeren in stijgende lijn gaat en dat meisjes meer roken dan jongens. Een zeer recent onderzoek van de Wereldgezondheidsorganisatie dat specifiek bij vijftienjarigen werd gevoerd, toont aan dat een kwart van hen rookt. In België is dat 23,3% bij de meisjes en 23,1% bij de jongens. Persoonlijk vind ik dat onthutsende cijfers.
Dat de tabaksindustrie alle mogelijke inspanningen levert om haar klantenpotentieel te houden en dan vooral het jeugdig segment, bleek vorige week nog maar eens uit een persartikel. Daarin werd verslag gedaan van een onderzoek uitgevoerd door British American Tobacco, fabrikant van onder andere Lucky Strike.
Zij doen onderzoek naar het effect van toevoeging van onder meer chocolade en fruitsmaken aan sigaretten. Anti-tabaksactivisten zoals Action on Smoking en Health stellen dat daar een strategie achterzit om meer jongeren aan te zetten tot roken. Zulke toegevoegde zoete smaken trekken immers kinderen aan. Indien dit inderdaad correct is, is dat een verontrustende en een zeer onethische evolutie.
Daarom zijn wij bijzonder verheugd dat de regering deze problematiek een beleidsprioriteit vindt en een aantal maatregelen naar voren schuift. Wij gaan ervan uit, mijnheer de minister, dat dit wetsontwerp slechts een begin is van de uitvoering van uw globaal plan en dat wij kortelings nog een aantal voorstellen in dit verband mogen verwachten.
Ik kijk uit naar een debat over eventuele accijnsverhogingen op tabaksproducten met als doel het roken tegen te gaan en ook een debat over eventuele terugbetaling van rookstopmiddelen lijkt mij in de nabije toekomst evident. Dat zijn punten die wij in de nabije toekomst moeten bespreken.
Ik kom terug tot het voorliggend wetsontwerp.
Sp.a-spirit vindt het goed dat in dit ontwerp werk wordt gemaakt van de bescherming van jongeren op een leeftijd waarop ze - dat weten we allemaal - zeer vatbaar zijn voor beïnvloeding en dat ze vaak aan het experimenteren slaan. Indien wij kunnen voorkomen dat jongeren van die leeftijd vrij sigaretten kunnen komen, dijken wij, mijns inziens, een belangrijke risicofactor voor later gebruik in. Ik betreur dat de discussie over de vraag of de leeftijdsgrens 16 of 18 jaar moet zijn, niet grondiger werd gevoerd. Er zijn een aantal argumenten die pleiten voor 16 jaar, terwijl andere pleiten voor 18 jaar. In een aantal Scandinavische landen is de leeftijdsgrens 18 jaar. Ik heb begrepen dat u een evaluatie van de leeftijdsgrens plant, mijnheer de minister, en ik hoop dat wij op dat ogenblik het debat alsnog ten gronde zullen voeren.
Dat in dit ontwerp het controle- en sanctieproces niet is gericht tegen de minderjarigen zelf, maar wel tegen eenieder die deze kwetsbare jongeren op eender welke manier zou aanzetten tot tabaksgebruik, vind ik ook een heel goed uitgangspunt.
Een laatste aspect dat ik even wil aanhalen, is de handhaving van de wetsbepalingen. Net zoals nog andere sprekers in de commissie, heb ik een aantal vragen bij de praktische toepassing. Wanneer men weet dat er in België om en bij de 70.000 verkooppunten van sigaretten zijn plus nog enkele duizenden distributieautomaten, dan heb ik inderdaad mijn vragen bij de controle op het verkoopverbod. Ook de manier waarop men de automaten zal aanpassen, baart mij een beetje zorgen. Dat is nog niet helemaal duidelijk. Zal men wel een waterdicht systeem vinden om te voorkomen dat jongeren sigaretten uit de automaat halen? Ik ben daar heel erg benieuwd naar. Ik kijk dan ook uit naar de tekst van het koninklijk besluit terzake.
Tot slot, mijnheer de voorzitter, collega's, de sp.a-fractie wil met klem benadrukken dat ze het tabaksgebruik bij jongeren mee wil bestrijden. Ondanks mijn voorgaande bemerkingen, mijnheer de voorzitter, collega's, zal de sp.a-spirit-fractie het wetsontwerp met overtuiging goedkeuren. Ik meen dat het wetsontwerp een belangrijke stap zet in het bestrijdingsplan van tabaksgebruik en dat de regering hier toont dat het haar werkelijk menens is met de bescherming van de volksgezondheid, van onze bevolking en vooral van de jongeren.

I will indeed make a brief explanation on behalf of the sp.a-spirit faction.
The bill proposed for discussion includes a ban on the sale of tobacco to young people under sixteen years of age, the possibility of adapting the automatic distribution devices, limiting the indirect advertising of tobacco products and the possibility of combating the masking of health warnings. The global plan for the control of tobacco use, which was discussed in the Public Health Committee in January, and the current draft law, which provides for its partial implementation, can all count on the approval of the sp.a-spirit group. There is no need to argue that the use of tobacco products is harmful to health. This has long been widely acknowledged scientifically. Health risks range from cardiovascular disease to cancer, tuberculosis to oral problems, reduced physical condition, osteoporosis, cataract, impotence, premature menopause and so on. I may forget a few more.
A second aspect that is very important in this problem is the finding that tobacco use is the first preventable cause of death and that this mortality rate is constantly rising.
A third very important aspect includes smoking behavior among young people. Research shows that the number of smoking young people is on the rise and that girls smoke more than boys. A very recent study by the World Health Organization conducted specifically in 15-year-olds shows that a quarter of them smoke. In Belgium, that is 23.3% for girls and 23.1% for boys. Personally, I find these numbers shocking.
That the tobacco industry is making every effort to keep its customer potential and then especially the youth segment, was revealed once again from a press article last week. The study was conducted by British American Tobacco, the manufacturer of Lucky Strike.
They are investigating the effect of adding chocolate and fruit flavors to cigarettes. Anti-tobacco activists such as Action on Smoking and Health say there is a strategy behind it to encourage more young people to smoke. After all, such added sweet flavors attract children. If this is true, it is a disturbing and very unethical evolution.
Therefore, we are ⁇ pleased that the Government considers this issue a policy priority and is pushing forward a number of measures. We assume, Mr. Minister, that this bill is only the beginning of the implementation of your global plan and that we can expect shortly a number of further proposals in this regard.
I look forward to a debate on any increase in the excise duty on tobacco products with the aim of preventing smoking and also a debate on any reimbursement of smoking cessation funds seems to me evident in the near future. These are issues that we need to discuss in the near future.
I will return to the current bill.
Sp.a-spirit welcomes the fact that in this design work is made of protecting young people at an age when they – we all know that – are very susceptible to influence and that they often go to experiment. If we can prevent young people of that age from getting cigarettes free, we, in my opinion, dig into an important risk factor for later use. I regret that the discussion about whether the age limit should be 16 or 18 years has not been conducted more thoroughly. There are some arguments advocating for 16 years, while others advocate for 18 years. In some Scandinavian countries, the age limit is 18 years. I have understood that you are planning an evaluation of the age limit, Mr. Minister, and I hope that at that point we will continue the debate.
That in this draft the control and sanction process is not directed against the minors themselves, but against anyone who would in any way encourage these vulnerable young people to use tobacco, I also find a very good starting point.
The last aspect that I would like to point out is the enforcement of the legal provisions. Like other speakers in the committee, I have a few questions regarding the practical application. When one knows that there are in Belgium around and at the 70,000 points of sale of cigarettes plus a few thousand distribution machines, then I have indeed my questions in the control of the prohibition of sale. The way the machines will be adjusted also makes me a little worried. This is not yet quite clear. Will a waterproof system be found to prevent young people from pulling cigarettes out of the automate? I am very curious about it. I look forward to the text of the Royal Decree on this subject.
Finally, Mr. Speaker, colleagues, the sp.a. group would like to emphasize strongly its commitment to combat tobacco use among young people. Despite my previous remarks, Mr. Speaker, colleagues, the sp.a-spirit group will approve the bill with conviction. I think that the bill is an important step in the plan to control tobacco use and that the government here shows that it is really concerned with the protection of public health, of our population and especially of the youth.

Monsieur le président, monsieur le ministre, mes chers collègues, le tabagisme est un véritable fléau, nous en convenons certainement tous et toutes ici. Le tabac est la cause de 5 millions de décès par an dans le monde. Si les habitudes tabagiques actuelles ne diffèrent pas d'ici 2030, dix millions de fumeurs décéderont annuellement. En Belgique, 60 personnes meurent chaque jour d'avoir fumé au cours de leur vie. Notre pays occupe la première place européenne en termes de mortalité due au cancer du poumon.
Devant ces chiffres particulièrement édifiants — et il faudrait encore mentionner les deux milliards d'euros de coûts en soins de santé engendrés par les maladies dues au tabac -, il est particulièrement important et urgent de se doter de moyens efficaces dans la lutte antitabac.
Celle-ci doit cependant s'envisager d'une manière globale. En effet, seule la combinaison de mesures prises dans le cadre d'un plan global de lutte contre le tabac est en mesure de produire des résultats significatifs et d'inverser la tendance. C'est en tout état de cause l'objectif que se propose le présent projet puisqu'il s'inscrit dans un ensemble de mesures approuvées par le Conseil des ministres, le 23 janvier dernier, et destinées à lutter contre le tabagisme. Le projet entend en effet, tout d'abord, interdire la vente de tabac aux jeunes de moins de 16 ans, avec la possibilité pour le Roi de prescrire que les lieux où les produits du tabac sont mis dans le commerce doivent afficher des avertissements concernant la nocivité de ces produits ou des annonces rappelant l'interdiction de vente aux moins de 16 ans.
Le projet entend aussi prévoir l'adaptation des appareils de distribution automatique.
Il envisage également d'interdire la vente ou l'offre conjointe à des produits à base de tabac, de produits qui sont destinés à priver de tout effet utile, de manière directe ou indirecte, les avertissements sanitaires apposés sur les produits du tabac.
Enfin, le projet entend limiter la publicité indirecte pour les produits du tabac.
Bref, il s'agit d'un véritable arsenal s'inscrivant dans le plan fédéral de lutte contre le tabagisme et dont notre groupe, avec d'autres, a fait une priorité politique et sanitaire pour notre pays.
Déjà dans un rapport de 2003, la Banque mondiale épinglait six moyens de réduire les maladies et décès consécutifs à la cigarette, à savoir des taxes plus élevées, l'interdiction sur les lieux publics et de travail, l'interdiction de la publicité, l'information du consommateur, les avertissements sanitaires sur les paquets et l'aide au sevrage via les thérapies ou les substituts nicotiniques.
Ces mesures ne sont généralement efficaces que lorsqu'elles sont mises en oeuvre conjointement, je le répète, et un petit classement sur base de ces recommandations a été réalisé par le Réseau européen de prévention du tabagisme, l'ENSP, pour voir comment se déroulait la lutte contre le tabagisme dans 28 pays d'Europe. La Belgique, d'après cette étude, n'est que 19 ème au classement de l'ENSP avec 37 points sur 100, à cause principalement de son noninvestissement en matière de dénormalisation et de faible cote pour la politique des prix et d'aide au sevrage.
En fait, si tous les projets contenus dans le plan global du ministre Demotte sont correctement mis en oeuvre et contrôlés, la cote de la Belgique pourrait grimper entre 55 et 60 points et rejoindre le peloton de tête. Nous sommes donc sur la bonne voie, même s'il ne s'agit que d'une partie d'un plan global à mettre en oeuvre par étapes.
Les arrêtés royaux devront être pris sur base d'une concertation impliquant le secteur et d'autres niveaux de pouvoir pour finaliser l'ensemble de ces propositions. D'autres actions spécifiques orientées vers les plus défavorisés devraient cependant être menées parallèlement à ces mesures, en leur proposant notamment de pouvoir accéder gratuitement ou du moins à moindre coût, aux méthodes permettant l'arrêt du tabac.
J'ai été particulièrement frappée, en effet, lors de la récente journée mondiale sans tabac consacrée à la thématique "tabac et pauvreté", par toute une série d'indicateurs qui tendent à démontrer que les personnes en situation socio-économique précaire ont davantage tendance à devenir dépendantes que les autres.
Si le tabagisme ne s'est pas généralisé dans ces populations, il s'y est incrusté pourtant dans des proportions particulièrement significatives. Plusieurs paramètres permettent de cerner le problème, en sachant que gros soucis d'argent riment souvent avec inactivité et moindres rentrées financières. Ces gens, nos concitoyens, vivent souvent au jour le jour. Les préoccupations quotidiennes requièrent quasi toute leur attention, de sorte que les habitudes de vie saine et dont les conséquences ne se font sentir qu'à long terme ne sont pas ressenties comme prioritaires.
Ainsi, on peut constater que le nombre de fumeurs dans notre pays est nettement plus élevé parmi les invalides (47%) et les chômeurs (40%) qu'au sein des actifs (30%). Sur un autre plan, il apparaît que les propriétaires fument beaucoup moins que les locataires: 27% contre 40%. Des différences nettes surviennent aussi selon le niveau d'études: 36% chez les non-diplômés, 25% chez les universitaires.
Dans cet ordre d'idées, une récente enquête conduite par l'Observatoire de la santé du Hainaut révèle des données hallucinantes. Dans cette province, notre province, monsieur le ministre, les jeunes de 16 ans sont 17% à fumer dans l'enseignement général contre 25% dans le technique et 62% dans le professionnel. Quant aux revenus, on passe de 34% de fumeurs dans les tranches les plus faibles à 24% parmi les plus élevées. Enfin, un autre indice révélateur m'interpelle personnellement: 35% de femmes au statut socio-économique faible continuent à fumer durant la grossesse alors qu'elles ne sont que 7% parmi les plus fortunées.
C'est pourquoi, nous plaidons, au groupe socialiste, pour des actions ciblées sur les personnes vivant dans la pauvreté.
Inverser le cercle vicieux constitué par la pauvreté et le tabac est possible. Lutter contre la consommation de tabac par les populations les plus pauvres, c'est indirectement combattre la pauvreté. Aussi, nous insistons beaucoup sur la nécessité d'initier de nouveaux programmes de prévention primaires avant la pré-adolescence pour contrer l'image sociale positive de la cigarette.
En ce qui concerne les jeunes dont la motivation principale réside dans l'appartenance à un groupe, la prévention doit continuer en instaurant des règles interdisant la consommation dans les lieux publics et permettant des augmentations dissuasives du prix des cigarettes.
Enfin, face à tous ces jeunes qui cherchent l'affirmation d'une certaine image de soi au travers de cette dépendance, nous devons, me semble-t-il, intensifier la dénonciation des pratiques mafieuses et des manipulations de l'industrie du tabac.
A cet égard, le PS est particulièrement préoccupé par les annonces faites par certains fabricants qui voudraient commercialiser des cigarettes parfumées au chocolat et à la vanille. Si l'ajout de telles substances aromatisantes a pour but d'inciter des enfants à fumer ou de rendre le tabagisme plus accessible, alors il faudrait mettre un terme le plus rapidement possible à une telle pratique. Nous nous félicitons en tout cas, puisque cela doit être réglementé dans le contexte européen, que le ministre Demotte ait envoyé une note à la Commission européenne afin de mettre en oeuvre une réglementation rapide pour limiter ou prohiber certains ingrédients dans les produits du tabac.
Enfin, on ne soulignera jamais assez, monsieur le président, chers collègues, le rôle prépondérant de l'éducation dans cette problématique. Le tabagisme ne doit pas être interdit. C'est l'éducation qui doit préconiser un mode de vie sain et faire en sorte que les jeunes ne commencent pas à fumer. Une coopération poussée avec les Communautés est nécessaire. En effet, une politique globale doit comporter un volet préventif, un volet soins et un volet désintoxication.
La lutte reste longue et difficile, mais le défi est passionnant. Votre projet, monsieur le ministre, est une étape audacieuse pour y répondre.

Mr. Speaker, Mr. Minister, my dear colleagues, smoking is a real plague, we definitely all agree here. Tobacco is the cause of 5 million deaths per year worldwide. If current smoking habits do not differ by 2030, 10 million smokers will die annually. In Belgium, 60 people die every day from smoking during their lifetime. Our country occupies the first place in Europe in terms of mortality from lung cancer.
In the face of these ⁇ constructive figures — and it would be worth mentioning the two billion euros of health care costs incurred by tobacco-related diseases — it is ⁇ important and urgent to provide effective means in the fight against tobacco.
However, this must be considered in a comprehensive way. Only the combination of measures taken as part of a comprehensive tobacco control plan can produce significant results and reverse the trend. This is, in any case, the objective of the present project, since it is part of a set of measures approved by the Council of Ministers on 23 January last year, and intended to combat smoking. The bill intends, in the first place, to prohibit the sale of tobacco to young people under the age of 16, with the possibility for the King to prescribe that places where tobacco products are placed on the market must display warnings regarding the harmfulness of these products or advertisements reminding the prohibition of selling to children under the age of 16.
The project also intends to provide for the adaptation of the automatic distribution devices.
It also considers to prohibit the sale or joint offering of tobacco products, products which are intended to deprive any useful effect, directly or indirectly, of the health warnings placed on tobacco products.
Finally, the project aims to limit indirect advertising for tobacco products.
In short, this is a real arsenal that is part of the federal anti-smoking plan and that our group, along with others, has made a political and health priority for our country.
Already in a 2003 report, the World Bank identified six ways to reduce smoking-related diseases and deaths, namely higher taxes, a ban on public and work places, a ban on advertising, consumer information, health warnings on packages and help with withdrawal through therapies or nicotine substitutes.
These measures are generally effective only when implemented jointly, I repeat, and a small ranking based on these recommendations was made by the European Network for the Prevention of Smoking, the ENSP, to see how the fight against smoking was going in 28 European countries. Belgium, according to this study, is only 19th in the ENSP ranking with 37 points out of 100, mainly due to its non-investment in de-normalization and low price policy ratings and withdrawal aid.
In fact, if all the projects contained in the overall plan of Minister Demotte are properly implemented and controlled, the rating of Belgium could rise between 55 and 60 points and join the lead peloton. We are therefore on the right track, even if it is only part of a comprehensive plan to be implemented in steps.
Royal decrees will have to be taken on the basis of a consultation involving the sector and other levels of power to finalize all of these proposals. Other specific actions aimed at the most disadvantaged should, however, be carried out in parallel with these measures, in particular by providing them with free access, or at least at a lower cost, to tobacco cessation methods.
I was ⁇ struck, in fact, during the recent World No Tobacco Day dedicated to the theme "Tobacco and poverty", by a whole series of indicators that tend to demonstrate that people in precarious socio-economic situation are more likely to become dependent than others.
Although smoking has not spread in these populations, it has, however, incorporated it in ⁇ significant proportions. Several parameters allow to identify the problem, knowing that big money worries often run with inactivity and lower financial returns. These people, our fellow citizens, often live day by day. Daily worries require almost all of their attention, so healthy lifestyle habits and whose consequences are felt only in the long run are not felt as priority.
Thus, we can find that the number of smokers in our country is significantly higher among the disabled (47%) and the unemployed (40%) than among the active (30%). On another plane, it appears that owners smoke much less than tenants: 27% versus 40%. Clear differences also occur according to the level of education: 36% among non-graduates, 25% among academics.
In this order of ideas, a recent survey conducted by the Hainaut Health Observatory reveals hallucinating data. In this province, our province, Mr. Minister, 16-year-olds are 17% smoking in general education against 25% in the technical and 62% in the professional. In terms of income, 34% of smokers in the lowest segments went to 24% among the highest segments. Finally, another revealing indicator interpels me personally: 35% of women with low socio-economic status continue to smoke during pregnancy, while they are only 7% among the wealthiest.
Therefore, we advocate, in the Socialist Group, for actions targeted at people living in poverty.
It is possible to reverse the vicious circle of poverty and tobacco. Fighting tobacco consumption by the poorest populations means indirectly fighting poverty. Also, we strongly insist on the need to initiate new primary prevention programs before pre-adolescence to counter the positive social image of cigarettes.
For young people whose primary motivation lies in belonging to a group, prevention should continue by introducing rules prohibiting consumption in public places and allowing dissuasive increases in the price of cigarettes.
Finally, in the face of all these young people who seek the affirmation of a certain self-image through this dependence, we seem to have to intensify the denunciation of the mafia practices and manipulations of the tobacco industry.
In this regard, the PS is ⁇ concerned about the announcements made by certain manufacturers who would like to market cigarettes scented with chocolate and vanilla. If the addition of such aromatic substances is intended to encourage children to smoke or to make smoking more accessible, such practice should be stopped as soon as possible. We welcome in any case, since this must be regulated in the European context, that Minister Demotte has sent a note to the European Commission in order to implement a quick regulation to limit or prohibit certain ingredients in tobacco products.
Finally, we will never emphasize enough, Mr. Speaker, dear colleagues, the preponderant role of education in this problem. Smoking should not be banned. It is education that should advocate a healthy lifestyle and ensure that young people do not start smoking. Strong cooperation with the communities is necessary. A comprehensive policy must include a preventive, a care and a detoxification component.
The fight remains long and difficult, but the challenge is exciting. Your proposal, Mr. Minister, is a bold step to respond to it.

Monsieur le ministre, chers collègues, ce projet est évidemment une étape intéressante. Mais cela fait pratiquement un an que ce gouvernement est en place. Le Conseil des ministres du 23 janvier s'est mis d'accord sur toute une série de mesures. Et maintenant, nous avons finalement un projet qui ne reprend que quelques mesures qui sont, à mon avis, relativement faibles.
Cela m'énerve d'autant plus que, pour le projet qui est soumis aujourd'hui à notre vote sur l'interdiction de vente au moins de 16 ans, en réponse à une recommandation de l'OMS, pratiquée dans certains Etats - il s'agit donc d'une mesure que l'on peut soutenir, même si son efficacité dépend aussi de tout ce qui est organisé autour d'elle -, les arrêtés ne sont pas pris et la concertation va avoir lieu maintenant. Je pense qu'elle aurait pu se faire préalablement, vu le temps qui s'est écoulé entre le 23 janvier et aujourd'hui.
Cela m'inquiète d'autant plus qu'en Belgique, nous avons effectivement un grand nombre de lieux de vente, et que ceux-ci sont particulièrement diversifiés, puisque cela va des grandes surfaces aux librairies en passant par les magasins spécialisés, les cafés, les hôtels, les gares - sous forme de comptoirs ou de distributeurs. La mise en application va donc être particulièrement difficile à élaborer. Il était donc d'autant plus nécessaire que cette concertation et sa concrétisation soient prises en compte avant que ce projet n'arrive au Parlement.
L'autre mesure qui pourrait aussi être intéressante concerne la limitation de la publicité indirecte. Il est vrai que ce projet comprend certaines avancées. Mais, en même temps, dans certains articles, on voit immédiatement comment les entreprises cigarettières vont pouvoir détourner les articles. Il leur suffira de constituer des filiales, de jouer sur le chiffre d'affaires, pour échapper aux restrictions inscrites dans le projet de loi. Nous avons été bernés par la Fondation Rodin - vous me direz que je fais une fixation sur cette fondation - avec sa demande actuelle de reconnaissance en tant qu'organisme d'utilité publique. Elle était au départ constituée en asbl, mais financée directement par les cigarettiers, ce qui est contraire à la convention-cadre de l'OMS. Pour pouvoir être reconnue organisme d'utilité publique, elle crée une nouvelle asbl qui sera subventionnée par la première asbl. En quelque sorte, elle se protège des exigences de la convention-cadre.
On voit que les cigarettiers sont prêts à tout. Leur objectif est davantage de fumeurs, les plus jeunes possibles, car il faut de nouveaux clients et ceux-là fumeront plus longtemps que les personnes plus avancées en âge.
Ce projet de loi, en fait, ne permet pas d'interdire le recours à la publicité indirecte qui est évidemment la publicité la plus dangereuse. J'avais fait part de cette remarque au ministre pendant les discussions, mais sa réponse a été que selon d'aucuns, il allait trop loin ou pas assez loin et que dès lors sa position était donc la meilleure puisqu'il se situe au centre, sans autres arguments.
Pas de réponse non plus par rapport à un élément qui aurait dû figurer dans le projet de loi, à savoir la prise en compte des photos qui figurent dans toutes les pages sportives des magazines grâce à la publicité autorisée dans les grands prix internationaux de Formule 1, notamment, puisque le public regardant ces photos-là est essentiellement composé de jeunes, ceux-là mêmes que l'on veut protéger. Cela signifie qu'à longueur de pages, ils voient les marques de cigarettes sur le maillot de leur pilote préféré.
Si ce n'est pas une belle publicité indirecte, alors j'ignore ce que c'est!
A la suite de ces différentes constatations, nous ne pouvons évidemment que nous abstenir sur ce projet de loi en regrettant vraiment que l'occasion n'ait pas été saisie, d'une part, pour concrétiser l'ensemble des dispositions qui auraient pu être prises et sur lesquelles le Conseil des ministres avait marqué son accord et, d'autre part, pour prendre des dispositions à l'encontre des entreprises cigarettières.
J'ajoute, à l'attention de Mmes Burgeon et Jiroflée, qu'il existe effectivement un risque en matière de substances parfumées. Souvenez-vous, sous le précédent gouvernement, il a fallu intervenir pour éviter que du chocolat ne puisse être ajouté dans les cigarettes car c'était une manière de rendre le goût agréable et d'ajouter la dépendance au chocolat à celle du tabac. Ceci nous rappelle qu'il faut une vigilance bien plus grande encore que celle qui a pu être concrétisée par ce projet de loi.

This project is obviously an interesting step. This government has been in place for almost a year. The Council of Ministers of 23 January agreed on a series of measures. And now, we finally have a project that only takes a few measures that are, in my opinion, relatively weak.
This irritates me even more because, for the project that is subject today to our vote on the ban on the sale of at least 16 years, in response to a WHO recommendation, practiced in some states – it is therefore a measure that can be supported, even though its effectiveness also depends on everything that is organized around it – the arrests are not taken and the consultation will take place now. I think it could have been done earlier, given the time that passed between January 23 and today.
This worries me even more because in Belgium, we actually have a large number of points of sale, and these are ⁇ diversified, since it ranges from large surfaces to bookstores through specialized stores, cafes, hotels, stations - in the form of counters or distributors. The implementation will therefore be ⁇ difficult to develop. It was therefore all the more necessary that this consultation and its implementation be taken into account before this project reaches Parliament.
Another measure that could also be interesting concerns the limitation of indirect advertising. It is true that this project includes some advances. But, at the same time, in some articles, we immediately see how cigarette companies will be able to divert the items. It will be enough for them to establish subsidiaries, to play on turnover, to escape the restrictions contained in the bill. We have been bearded by the Rodin Foundation – you will tell me I am making a fixation on this foundation – with its current application for recognition as a public utility organization. It was originally constituted in asbl, but financed directly by cigarette manufacturers, which is contrary to the WHO Framework Convention. In order to be recognized as a public utility organization, it creates a new asbl which will be subsidized by the first asbl. In some way, it protects itself from the requirements of the Framework Convention. by
Cigarette smokers are ready for everything. Their goal is more smokers, as young as possible, as new customers are needed and those will smoke longer than older people.
This bill, in fact, does not allow to prohibit the use of indirect advertising, which is obviously the most dangerous advertising. I had communicated this comment to the minister during the discussions, but his response was that according to some, he went too far or not far enough and that since then his position was therefore the best since he is in the center, without other arguments.
There is also no answer in relation to one element that should have been included in the bill, namely the taking into account of the photos that appear on all the sports pages of magazines through the advertising permitted in the international Grand Prix of Formula 1, in particular, since the public watching those photos is essentially composed of young people, the same ones that we want to protect. This means that over the length of pages, they see the cigarette brands on the shirt of their favorite driver.
If this is not a beautiful indirect advertising, then I don’t know what it is!
Following these different findings, we can obviously only abstain from this bill, really regretting that the opportunity was not seized, on the one hand, to concrete the set of provisions that could have been taken and on which the Council of Ministers had agreed, and, on the other hand, to take provisions against cigarette companies.
I add, to the attention of Ms. Burgeon and Jiroflée, that there is indeed a risk in terms of fragrance substances. Remember, under the previous government, it was necessary to intervene to prevent chocolate from being added to cigarettes because it was a way to make the taste pleasant and add addiction to chocolate to that of tobacco. This reminds us that there needs to be a much greater vigilance than that which could be realised by this bill.

Monsieur le président, déjà hier, nous avons entamé ce débat. J'ai répondu à Mme Jiroflée sur le fond des questions qu'elle a posées et je la renverrai aux questions de même nature posées hier soir par Mme Dierickx.
Pour ce qui concerne les intervenantes d'aujourd'hui, je dirai qu'il m'est difficilement acceptable d'entendre un argument consistant à dire que nous n'aurions qu'une démarche trop modeste et trop tardive en matière de lutte contre le tabac. J'ai pris pour principe dans la vie de ne jamais faire la morale aux autres parce que je pense qu'il est utile de regarder devant ses pas. Je ne ferai donc pas allusion, comme j'aurais pu le faire si j'étais un homme politique qui se sert d'arguments vils et bas, à l'inaction de ceux qui m'ont précédé pour dire qu'aujourd'hui tout pas est bon à prendre.
Je ne le dirai pas: je pense que les uns et les autres ont toujours souhaité, en matière de soins de santé, et singulièrement de santé publique, poser les bons gestes aux bons moments, mais qu'il est parfois difficile de trouver les voies exactes pour atteindre nos objectifs.
En matière de prévention du tabac, nous avons besoin de l'aide des Communautés. En matière de prévention pour empêcher de commencer à fumer, nous avons aussi besoin d'un ensemble de dispositifs fédéraux que nous actionnons par cette loi; je songe notamment à l'interdiction de la vente de tabac aux moins de 16 ans. La question de l'âge est une question compliquée et je n'ai pas d'éléments scientifiques suffisants pour vous dire que 16 ou 18 ans est un choix définitif aujourd'hui.
Je peux cependant vous dire que, sur le plan moral, il est inacceptable que nous n'ayons jamais pu jusqu'à présent disposer d'un outil quelconque pour interdire à ces jeunes d'accéder au tabac par le biais de l'achat. Il reste qu'il est vrai qu'un certain nombre d'adolescents, un peu plus âgés, pourraient très bien acheter ce tabac pour le recéder ensuite à ces jeunes. Je parlais tout à l'heure de responsabilité morale: là, elle est clairement engagée.
Pour ce qui concerne les autres questions: l'application ou la mise en oeuvre des divers arrêtés, les négociations avec le secteur, il m'est aussi difficilement acceptable d'entendre que nous n'avons pas avancé sur ces différents champs: c'est inexact. En effet, depuis janvier, nous discutons avec le secteur. Evidemment, nous n'avons pas trouvé toutes les réponses aux questions complexes qui se posent à nous, notamment en matière de distributeurs — comme je l'ai rappelé hier soir -, mais notre volonté n'est certainement pas prise en défaut.

As for today’s speakers, I would say that it is hardly acceptable for me to hear an argument consisting of saying that we would only have a too modest and too late approach in the fight against tobacco. I have taken as a principle in life to never moralize others because I think it is worth looking ahead of their footsteps. I will therefore not make allusion, as I could have done if I were a politician who uses vile and low arguments, to the inaction of those who preceded me to say that today everything is not good to take.
I will not say it: I think that some and others have always wanted, in terms of health care, and especially public health, to make the right gestures at the right times, but that it is sometimes difficult to find the exact ways to ⁇ our goals.
In the prevention of tobacco, we need the help of the Communities. In terms of prevention to prevent starting to smoke, we also need a set of federal arrangements that we act by this law; I think in particular of the prohibition of the sale of tobacco to under 16 years of age. The question of age is a complicated question and I don’t have enough scientific evidence to tell you that 16 or 18 years is a definitive choice today.
However, I can tell you that, morally speaking, it is unacceptable that we have never before been able to have any tool to prohibit these young people from accessing tobacco through purchase. It remains that it is true that a number of teenagers, a little older, could very well buy this tobacco and then give it to these young people. I was already talking about moral responsibility: there, she is clearly committed.
As for the other issues: the application or implementation of the various decrees, the negotiations with the sector, I also find it hardly acceptable to hear that we have not made progress in these different fields: this is inaccurate. We have been talking with the industry since January. Obviously, we haven’t found all the answers to the complex questions that arise to us, especially in the area of distributors – as I recalled last night – but our will is ⁇ not taken into default.
