Monsieur le président, madame la ministre, chers collègues, le projet de loi examiné en commission de la Justice et qui se trouve aujourd'hui sur nos bancs concerne la mise en conformité du droit belge avec les dispositions du Statut de Rome de la Cour pénale internationale.
L'objet de ce traité est important. Il s'agit d'instituer une cour permanente chargée de la répression des violations les plus graves du droit international humanitaire, commises par des personnes physiques.
La Cour pourra connaître des crimes de génocide, des crimes contre l'humanité, des crimes de guerre les plus graves aussi bien dans le cadre d'un conflit armé international que dans celui d'un conflit armé non international.
La Cour aura un caractère subsidiaire par rapport aux juridictions répressives nationales. Elle ne pourra exercer sa juridiction que lorsque ces crimes n'auront pas été jugés au préalable par une juridiction nationale ou lorsque les enquêtes et poursuites menées au niveau national n'ont pas abouti en raison du manque de volonté ou de l'incapacité des organes nationaux de les mener véritablement à bien.
La Cour sera composée de 18 juges répartis en chambres d'instruction, de première instance et d'appel et pourra être saisie de trois manières différentes.
Elle pourra être saisie par le Conseil de sécurité, soit par un Etat partie au statut. Mais elle pourra également être saisie directement par le procureur de la Cour agissant d'initiative en toute indépendance et sous le seul contrôle des juges eux-mêmes concernant un ou plusieurs crimes relevant de sa compétence.
Le fonctionnement de la Cour est essentiellement autonome. Son financement dépendra à la fois de l'ONU et des contributions faites par les Etats parties au statut, voire de contributions volontaires d'origine publique ou privée.
Le Conseil de sécurité pourra suspendre momentanément le fonctionnement de la Cour, mais il ne pourra le faire qu'au moyen d'une résolution explicite, pour une durée maximum de douze mois, renouvelable. Une telle mesure pourrait se comprendre dans le cadre, par exemple, de négociations de paix.
La mise en place de la Cour pénale internationale constituera un progrès important pour le respect international des droits de l'homme.
Après avoir signé le Statut de Rome instituant la Cour pénale internationale, le gouvernement a ratifié celui-ci le 28 juin 2000. La mise en conformité du droit belge avec le Statut constitue donc l'exécution de nouvelles obligations internationales de la Belgique et nous permettra d'honorer nos obligations en matière de coopération avec la Cour pénale internationale.
En ce qui concerne la constitutionalité du projet, se référant à la première observation générale de l'avis du Conseil d'Etat, des membres de la commission de la Justice ont remis en question la constitutionalité du projet de loi à l'examen et ont plaidé pour une révision de la Constitution préalable à l'adoption de la loi en projet.
En effet, la section de législation du Conseil d'Etat renvoie à une observation qu'elle avait déjà faite antérieurement dans son avis relatif au projet de loi d'assentiment au Statut. Déjà à l'époque, l'avis du Conseil d'Etat n'avait pas été suivi. Cette observation rappelle que, selon la section de législation, il convient d'adapter la Constitution au Statut de Rome avant de ratifier le projet et de promulguer la loi de coopération.
Le gouvernement et la commission n'ont pas suivi cette observation pour les raisons suivantes: - Tout d'abord, en votant la loi d'assentiment au Statut pour permettre sa ratification rapide, alors que la Constitution ne pouvait être révisée sur ce point, le parlement en premier lieu a montré, sous la précédente législature, qu'il ne suivait pas l'analyse du Conseil d'Etat. - Ensuite, le gouvernement en a fait de même en déposant l'instrument de ratification du Statut avant que la Constitution ne soit modifiée. Ce faisant, parlement et gouvernement se rallient à la jurisprudence constante de la Cour de cassation et de la section d'administration du Conseil d'Etat qui considèrent qu'un traité a primauté sur toute norme de droit interne, alors que la section législation du Conseil d'Etat et la Cour d'arbitrage, dans certains arrêts, considèrent qu'un traité ne peut être ratifié par la Belgique lorsqu'il contient des dispositions contraires à la Constitution, qu'à la seule condition d'adapter au préalable la Constitution au contenu du traité.
En adoptant le projet, le gouvernement et le Parlement ne font que confirmer l'attitude qu'ils avaient déjà adoptée dans le cadre de la coopération avec les tribunaux pénaux internationaux. En effet, lors de l'adoption de la loi du 22 mars 1996 relative à la coopération avec ces tribunaux, le Conseil d'État avait déjà soulevé le problème de constitutionnalité et, pourtant, la loi de 1996 a été adoptée sans changement constitutionnel et, en fin de législation, le gouvernement de l'époque n'a pas ouvert la Constitution à révision sur ce point.
Toutefois, le constituant a dès maintenant la possibilité d'insérer un nouvel article au titre IV de la Constitution dans le but de l'adapter au statut. À cette fin, la ministre de la Justice a saisi, en décembre dernier, la commission interministérielle de droit humanitaire pour que celle-ci fasse une proposition de texte de révision de la Constitution dans les plus brefs délais.
Monsieur le président, madame la ministre, chers collègues, en ce qui concerne l'obligation générale de coopération entre la Cour pénale internationale et la Belgique, les bases et les modalités de cette coopération ainsi que le règlement des relations entre la Cour et la Belgique, je renvoie au rapport de la commission.
J'en ai ainsi terminé avec le rapport de la commission et je vous demande l'autorisation, monsieur le président, d'intervenir maintenant comme parlementaire pour indiquer quelle est la position du MR dans ce dossier.

Mr. Speaker, Mrs. Minister, dear colleagues, the bill examined in the Justice Committee and which is now on our banks concerns the conformation of Belgian law with the provisions of the Rome Statute of the International Criminal Court.
The purpose of this treaty is important. It is about setting up a permanent court to punish the most serious violations of international humanitarian law committed by natural persons.
The Court may judge crimes of genocide, crimes against humanity, and the most serious war crimes both in the context of an international armed conflict and in the context of a non-international armed conflict.
The Court will have a subsidiary character in relation to national repressive courts. It may exercise its jurisdiction only when such crimes have not been judged in advance by a national court or when the investigations and prosecutions conducted at the national level have failed due to the lack of will or the inability of the national bodies to effectively carry them out.
The Court shall consist of eighteen judges divided into Chambers of Instruction, First Instance and Appeal and may be brought in three different ways.
It may be submitted by the Security Council or by a State Party to the Statute. However, it may also be brought directly by the Prosecutor of the Court acting on its own initiative in full independence and under the sole control of the judges themselves concerning one or more crimes falling within its jurisdiction.
The functioning of the Court is essentially autonomous. Its funding will depend both on the UN and on contributions made by States Parties to the Statute, or even on voluntary contributions of public or private origin.
The Security Council may temporarily suspend the functioning of the Court, but it may do so only by means of an explicit resolution, for a maximum period of twelve months, renewable. Such a measure could be understood in the context, for example, of peace negotiations.
The establishment of the International Criminal Court will constitute an important step forward for international respect for human rights.
After signing the Rome Statute establishing the International Criminal Court, the government ratified it on 28 June 2000. The compliance of Belgian law with the Statute therefore constitutes the fulfillment of new international obligations of Belgium and will allow us to honour our obligations in terms of cooperation with the International Criminal Court.
Regarding the constitutionality of the draft, referring to the first general observation of the State Council opinion, members of the Justice Committee questioned the constitutionality of the draft law under consideration and advocated for a revision of the Constitution prior to the adoption of the draft law.
Indeed, the legislative section of the State Council refers to an observation that it had already made earlier in its opinion on the draft law of consent to the Statute. At that time, the opinion of the State Council had not been followed. This observation reminds that, according to the section of legislation, it is necessary to adapt the Constitution to the Rome Statute before ratifying the draft and promulgating the law of cooperation.
The Government and the Commission did not follow this observation for the following reasons: - First, by voting the Act of Assent to the Statute to allow its prompt ratification, while the Constitution could not be revised on this point, the Parliament first showed, during the previous legislature, that it did not follow the analysis of the State Council. Then, the government did the same by depositing the instrument of ratification of the Statute before the Constitution was amended. In doing so, Parliament and Government adhere to the consistent jurisprudence of the Court of Cassation and the Administrative Section of the Council of State, which consider that a treaty has priority over any norm of domestic law, while the Legislative Section of the Council of State and the Court of Arbitration, in certain judgments, consider that a treaty can not be ratified by Belgium when it contains provisions contrary to the Constitution, only on the sole condition of adapting the Constitution in advance to the content of the treaty.
By adopting the draft, the government and Parliament only confirm the attitude they had already taken in the framework of cooperation with international criminal courts. Indeed, when adopting the law of 22 March 1996 on cooperation with these courts, the State Council had already raised the question of constitutionality and, nevertheless, the law of 1996 was adopted without constitutional change and, at the end of legislation, the government of the time did not open the Constitution for revision on this point.
However, the constituent has now the possibility to insert a new article in Title IV of the Constitution in order to adapt it to the Statute. To this end, the Minister of Justice referred, in December last year, to the interministerial commission on humanitarian law to make a proposal for a text of revision of the Constitution as soon as possible.
As regards the general obligation of cooperation between the International Criminal Court and Belgium, the basis and modalities of this cooperation and the regulation of the relations between the Court and Belgium, I refer to the report of the committee.
I have thus concluded with the report of the committee and I ask for your permission, Mr. Speaker, to intervene now as a parliamentary to indicate what is the position of the MR in this case.

Monsieur le président, madame la ministre, chers collègues, la Belgique a été le treizième pays à déposer son instrument de ratification au Statut de Rome de la Cour pénale internationale, le 28 juin 2000. Le statut est entré en vigueur le 1 er juillet 2002 après qu'une soixantaine d'États y soient devenus parties. À ce jour, 92 États dont tous les États membres de l'Union européenne ont ratifié ou adhéré au statut. Comme le signalait le président de la Cour pénale internationale, Philippe Kirsch lors de la deuxième session de l'assemblée des États parties:
"La Cour pénale internationale est devenue, au cours des derniers mois, une réalité. En effet, la Cour n'est plus l'objet d'une simple aspiration. Au contraire, il s'agit maintenant d'une institution fonctionnelle. Les plus hauts responsables ont été nommés et, actuellement, la Cour construit ses structures et définit ses procédures. Nous nous préparons à répondre au défi que la communauté internationale nous a lancé: assurer que justice soit rendue équitablement et effectivement et au cours de procès efficaces, transparents et justes. La Cour et l'autorité judiciaire doivent être prêtes pour la première affaire qui sera présentée."
Il ajoutait également que "la Cour pénale internationale est à la fois indépendante et inter-dépendante; elle ne peut agir seule. Elle ne sera efficace que si elle travaille en étroite collaboration avec les autres acteurs de la communauté internationale."
Louise Arbour, procureur des tribunaux pénaux internationaux pour l'ex-Yougoslavie et le Rwanda déclarait déjà en 1997 devant le comité préparatoire pour l'instauration de la Cour pénale internationale que "le bon fonctionnement de la Cour pénale internationale instaurée par un traité dépendra dans la pratique de la coopération efficace des États, tout autant que dans le cas des tribunaux ad hoc pour l'exYougoslavie et le Rwanda."
À la différence des juridictions nationales, la Cour pénale internationale ne dispose pas de pouvoir direct d'exécution, vous l'aurez compris. Elle ne peut exécuter les mandats d'arrêt ni perquisitionner des maisons ou des immeubles ou contraindre des témoins à comparaître. La Cour pénale internationale dépend des autorités nationales pour accomplir ses tâches précises. L'adoption de ce projet de loi est essentielle au bon fonctionnement de la Cour pénale internationale, chargée, sur la base du principe de complémentarité avec les juridictions nationales, de poursuivre les crimes internationaux les plus graves. C'est grâce à cette coopération que la Cour, qui ne possède pas de police ou de force de coercition propre, peut mener à bien sa mission de juridiction internationale.
Au jour d'aujourd'hui, les principaux officiers de la Cour, les juges, le greffier, le procureur, le procureur-adjoint sont entrés en fonction. Comme l'a signalé la ministre de la Justice dans son exposé introductif devant la commission de la Justice, le bureau du procureur de la Cour a déjà reçu plus de 600 plaintes concernant des faits susceptibles de relever de la compétence de la Cour. Pour l'instant, quelques situations relevant de la compétence de la Cour sont examinées avec le plus grand soin par le procureur. Des demandes de coopération émanant de la Cour sont donc susceptibles d'être émises dans des délais relativement brefs. Il est par conséquent primordial que la Belgique adopte au plus tôt une loi de coopération afin de pouvoir respecter ses engagements internationaux.
C'est pour ces raisons fondamentales que le MR apportera son soutien au texte proposé par le gouvernement, même si nous aurions préféré que le texte de la Constitution soit adapté au préalable. La ministre l'a admis en commission, la doctrine et la jurisprudence sont plus que divisées en la matière, sur la question de la ratification d'un traité concernant des dispositions contraires à la Constitution. Nous estimons toutefois que le processus d'assentiment, de ratification et de mise en conformité de notre droit interne ne peut être reporté si nous souhaitons que la coopération avec la Cour pénale internationale soit effective le plus rapidement possible.
Comme le signalait le vice-premier ministre et ministre des Affaires étrangères, dans le cadre de l'examen du projet de loi portant assentiment au statut de la Cour pénale internationale, fait à Rome le 17 juillet 1998, reporter le processus d'assentiment parlementaire au statut ne serait pas suffisant du point de vue politique car la Belgique perdrait le rôle moteur qu'elle joue en matière de droit international humanitaire.
Durant la dernière législature, le Parlement n'a pas eu la possibilité de revoir la Constitution sur ce point. Aucun article permettant de régler cette problématique n'était ouvert à révision, mais aujourd'hui c'est tout à fait réalisable. Le Constituant a donc la possibilité d'insérer un nouvel article au titre IV de la Constitution, dans le but de l'adapter au statut.
Nous espérons que la commission interministérielle de droit humanitaire adressera au gouvernement, dans les plus brefs délais, une proposition de révision de la Constitution. A notre sens, cette question devrait être réglée avant la fin de cette année.

Belgium was the thirteenth country to deposit its instrument of ratification of the Rome Statute of the International Criminal Court on 28 June 2000. The Statute entered into force on 1 July 2002 after approximately sixty States became Parties. To date, 92 countries, including all Member States of the European Union, have ratified or acceded to the Statute. As the President of the International Criminal Court, Philippe Kirsch, pointed out at the second session of the Assembly of States Parties:
The International Criminal Court has become a reality in recent months. Indeed, the Court is no longer the object of a mere aspiration. Instead, it is now a functional institution. The highest officials have been appointed and, at present, the Court is building its structures and defining its procedures. We are preparing to respond to the challenge that the international community has set us: to ensure that justice is delivered fairly and effectively and through effective, transparent and fair trials. The Court and the judicial authority must be prepared for the first case to be brought."
He also added that "The International Criminal Court is both independent and interdependent; it cannot act alone. It will only be effective if it works in close collaboration with other actors of the international community.”
Louise Arbour, prosecutor of the International Criminal Tribunals for the former Yugoslavia and Rwanda, already stated in 1997 before the Preparatory Committee for the establishment of the International Criminal Court that "the proper functioning of the International Criminal Court established by a treaty will depend on the practice of effective cooperation between States, as well as in the case of ad hoc tribunals for the former Yugoslavia and Rwanda."
Unlike national courts, the International Criminal Court has no direct enforcement power. It may not execute arrest warrants or search houses or buildings or force witnesses to appear. The International Criminal Court depends on national authorities to carry out its specific tasks. The adoption of this bill is essential to the proper functioning of the International Criminal Court, which, on the basis of the principle of complementarity with national courts, is responsible for prosecuting the most serious international crimes. It is through this cooperation that the Court, which does not have its own police or coercive force, can carry out its mission of international jurisdiction.
Today, the main officers of the Court, the judges, the secretary, the prosecutor, the deputy prosecutor have entered office. As the Minister of Justice pointed out in her introductory presentation to the Justice Committee, the Office of the Court’s Prosecutor has already received more than 600 complaints concerning facts likely to fall within the jurisdiction of the Court. Currently, some cases falling within the jurisdiction of the Court are examined with the utmost care by the prosecutor. Requests for cooperation from the Court are therefore likely to be issued within a relatively short period of time. It is therefore of the utmost importance that Belgium adopt a cooperation law as soon as possible in order to be able to comply with its international commitments.
It is for these fundamental reasons that the MR will support the text proposed by the government, even if we would have preferred that the text of the Constitution be adapted in advance. The Minister admitted it in a committee, the doctrine and jurisprudence are more than divided in the matter, on the issue of ratification of a treaty concerning provisions contrary to the Constitution. However, we believe that the process of approval, ratification and enforcement of our domestic law cannot be postponed if we want cooperation with the International Criminal Court to be effective as soon as possible.
As the Deputy Prime Minister and Minister of Foreign Affairs pointed out, in the context of the examination of the draft law concerning consent to the status of the International Criminal Court, made in Rome on 17 July 1998, postponing the process of parliamentary consent to the status would not be sufficient from a political point of view because Belgium would lose its driving role in matters of international humanitarian law.
During the last legislature, Parliament did not have the opportunity to revise the Constitution on this point. No article to resolve this problem was open to review, but today it is quite feasible. The Constituent has therefore the possibility to insert a new article in Title IV of the Constitution, in order to adapt it to the Statute.
We hope that the Interministerial Commission on Humanitarian Law will send to the Government, as soon as possible, a proposal for the revision of the Constitution. In our opinion, this issue should be resolved before the end of this year.

Mijnheer de voorzitter, mevrouw de vice-premier, mijnheer de vice-premier, ik heb niet geapplaudisseerd voor de rapporteur omdat zij haar persoonlijk betoog vastgeklonken heeft aan het verslag. Ik feliciteer en dank haar uiteraard voor het voortreffelijk verslag waarin zij zeer goed de discussie in de commissie voor de Justitie heeft samengevat.
N-VA vindt dit ontwerp fundamenteel een goede zaak. Ik heb in de commissie gezegd dat ik een van de meest fervente voorstanders ben van de natiestaat. Ik geloof in het behoud en de toekomst van de natiestaat als antwoord op de mondialisering. Ik ben echter ook een van de meest fervente voorstanders van het versterken van de internationale rechtsorde. Ik geloof dat dit ontwerp, waarbij de samenwerking met het Internationaal Strafgerechtshof en de internationale straftribunalen wordt goedgekeurd, een zeer goede stap is in de versterking van de internationale rechtsorde. Identiteit en natiestaat mogen niet leiden tot immuniteit, zeker niet indien het over fundamentele misdrijven gaat zoals ze beoogd worden in het ontwerp en het voorwerp kunnen zijn van vervolging en bestraffing door het Internationaal Strafgerechtshof. Het gaat over genocide, misdaden tegen de menselijkheid, oorlogsmisdaden en misdaad van agressie. Laten wij ons erover verheugen dat reeds heel wat landen toegetreden zijn. Ik betreur echter dat een aantal belangrijke staten, niet het minst de Verenigde Staten van Amerika, zich verzetten tegen deze regeling in de internationale rechtsorde. Meer nog, de Verenigde Staten zijn zeer actief in het overtuigen van landen om niet toe te treden en bijgevolg in het creëren van een bepaalde vorm van immuniteit.
Mevrouw de minister, het is een goede zaak dat deze internationale rechtsregeling tot stand komt zodat dictators waar ook ter wereld weten dat ze geen immuniteit hebben en dat ze vroeg of laat riskeren zich te moeten verantwoorden voor een internationaal gerechtshof. Dit statuut voorziet in geen enkele immuniteit voor staatshoofden, regeringsleiders, ministers, noch voor parlementairen.
Ondanks deze zeer positieve, fundamentele benadering heb ik een aantal grote bedenkingen bij dit ontwerp. Een eerste bedenking heeft betrekking op de ongrondwettigheid. Het is niet verantwoord dit ontwerp goed te keuren zonder onze Grondwet aan te passen aan deze inperking van de nationale autonomie en zonder dat onze Grondwet bepaalt dat België toetreedt tot het Internationaal Strafgerechtshof. De Raad van State heeft dit opgemerkt. Een aantal collega's hebben samen met mij deze kritiek geuit. De regering schuift deze kritiek opzij en stelt voor deze wet niettemin goed te keuren, hoewel mijnheer de voorzitter van de commissie voor de Herziening van de Grondwet, de desbetreffende titel in de Grondwet vatbaar is voor herziening. Men had op heel korte tijd, voorafgaand aan de goedkeuring van dit ontwerp zelfs , ervoor kunnen zorgen dat de Grondwet werd aangepast. De Raad van State heeft terzake zelf een voorstel geformuleerd, in die zin dat in onze Grondwet zou worden ingeschreven "De Staat treedt toe tot het Internationaal Strafgerechtshof".
Mijn tweede bedenking betreft de scheiding der machten. Naar mijn aanvoelen krijgt de uitvoerende macht in de persoon van de minister van Justitie, die in dit ontwerp de centrale autoriteit wordt genoemd, een te grote bevoegdheid. Daarmee wordt het principe van de scheiding der machten dat staat ingeschreven in onze Grondwet, geschonden. Ik denk bijvoorbeeld aan de bevoegdheid van de centrale autoriteit die kan optreden bij een opschorting en bij een weigering van tenuitvoerlegging van de aanhouding en van de vordering door het Internationaal Strafgerechtshof.
Ten derde, dit ontwerp bevat volgens mij onvoldoende rechtswaarborgen voor zij die in het licht ervan worden aangehouden en vervolgd. Het feit dat het hier gaat over zeer zware criminele feiten mag ons er niet van ontslaan om te voorzien in justitiële waarborgen. De fundamentele rechten en vrijheden moeten op elk moment gerespecteerd worden.
Dit principe geldt bijvoorbeeld ook in de strijd tegen het terrorisme, in welke verband personen die een gezonde kijk op de zaken hebben terecht aanklagen dat de Verenigde Staten op Guantanamo mensen vasthouden — ook al worden zij beticht van terroristische daden — zonder enige vorm van proces. Het recht op respect voor de fundamentele rechten en vrijheden moet in acht genomen worden. Welnu, ook op dat vlak zijn de bepalingen van dit ontwerp onvoldoende zorgvuldig opgesteld. In de bespreking in commissie heb ik in dat verband diverse voorbeelden aangehaald. Een ervan betreft artikel 13 § 2, waarbij aan de raadkamer, bij een verzoek van het hof tot uitvoerbaarheidverklaring, alleen de bevoegdheid wordt toegekend om na te gaan of er geen dwaling is betreffende de persoon en of de stukken tot staving bedoeld in artikel 91 van het statuut, werden voorgelegd. Welnu, dit komt in aanvaring met onze principes van rechtsbescherming en met onze principes van recht op onderzoek door een onafhankelijke rechtelijke instantie.
Een vierde bezwaar gaat over de onduidelijkheid, zowel aangaande de immuniteit van ministers als omtrent de procedure wanneer Belgische parlementsleden betrokken zouden zijn in procedures voor het Internationaal Strafgerechtshof. De minister verwees naar artikel 103 van de Grondwet dat voorziet in een zeer speciale procedure voor de ministers, waarbij de Kamer verlof moet verlenen als het Internationaal Strafgerechtshof zou willen overgaan tot vervolging van een minister. Ik heb het gevoel dat het standpunt van de regering is dat in dat geval artikel 103 van de Grondwet onverkort geldig blijft. De Kamer van volksvertegenwoordigers zou zich met andere woorden boven de internationale rechtsorde kunnen plaatsen en, omwille van het feit dat ze bijvoorbeeld van mening is dat de nationale veiligheid in het gedrang zou komen, niet toelaten dat een minister wordt vervolgd en moet verschijnen voor het Internationaal Strafgerechtshof. Het is duidelijk dat deze internationale regeling meestal precies tot stand komt met het oog op een mogelijke vervolging en bestraffing van regeringsleiders, staatshoofden, ministers en dergelijke. Als we er niet in voorzien dat artikel 103 van de Grondwet niet in de weg zou staan van dergelijke daden van vervolging en bestraffing, dan schieten wij tekort in onze internationale verplichtingen en in onze medewerking aan de internationale rechtsorde.
Hetzelfde geldt voor de procedure voor parlementsleden. Artikel 59 van de Grondwet kan botsen met de procedure die hier uitgewerkt is. Ondanks het feit dat ik daarover opmerkingen gemaakt heb, is dit onvoldoende uitgeklaard en zijn er onvoldoende aanpassingen gebeurd in de commissie voor de Justitie.
Dat is ook de reden waarom ik het ontwerp — hoewel ik het in principe volmondig en volkomen steun — niet zal goedkeuren. Ik zal mij onthouden.

Mr. Speaker, Mrs. Vice-Premier, Mr. Vice-Premier, I have not applauded the rapporteur because she has attached her personal discourse to the report. I congratulate her and, of course, thank her for the excellent report in which she very well summed up the discussion in the Committee on Justice.
N-VA considers this design fundamentally a good thing. I have said in the committee that I am one of the most fervent supporters of the nation-state. I believe in the preservation and future of the nation-state as a response to globalization. However, I am also one of the most fervent advocates of strengthening the international legal order. I believe that this draft, which approves cooperation with the International Criminal Court and international criminal courts, is a very good step in strengthening the international legal order. Identity and national state should not lead to immunity, especially if it concerns fundamental crimes as they are intended in the draft and may be the subject of prosecution and punishment by the International Criminal Court. These include genocide, crimes against humanity, war crimes and crimes of aggression. We are pleased that many countries have already joined. I regret, however, that a number of important states, not least the United States of America, are opposed to this arrangement in the international legal order. Moreover, the United States is very active in persuading countries not to join and consequently in creating a certain form of immunity.
Mrs. Minister, it is a good thing that this international legal system is established so that dictators everywhere in the world know that they do not have immunity and that sooner or later they risk being held accountable before an international court. This statute does not provide for any immunity for heads of state, heads of government, ministers, nor for parliamentarians.
Despite this very positive, fundamental approach, I have some major concerns about this design. The first concern concerns the unconstitutionality. It is not responsible to approve this draft without adapting our Constitution to this limitation of national autonomy and without our Constitution stipulating that Belgium joins the International Criminal Court. The State Council has noted this. Several of my colleagues, along with me, have expressed this criticism. The Government puts this criticism aside and proposes that this law nevertheless be approved, although, Mr. Chairman of the Committee for the Revision of the Constitution, the relevant title in the Constitution is subject to revision. In a very short time, even before the approval of this draft, the Constitution could have been adjusted. The State Council has itself formulated a proposal in this regard, in the sense that in our Constitution would be inscribed "The State joins the International Criminal Court".
The second issue concerns the separation of powers. In my opinion, the executive power in the person of the Minister of Justice, which in this draft is referred to as the central authority, is given too much power. This violates the principle of the separation of powers, which is inscribed in our Constitution. I think, for example, of the competence of the central authority which can act in the event of a suspension and in the event of a refusal to execute the arrest and the claim by the International Criminal Court.
Third, this draft does not, in my view, provide sufficient legal guarantees for those who are detained and prosecuted in the light of it. The fact that this is a very serious criminal offence should not dispense us from providing judicial guarantees. Fundamental rights and freedoms must be respected at all times.
This principle also applies, for example, in the fight against terrorism, in which persons who have a healthy view of the matter rightly accuse the United States of detaining people at Guantanamo — even if they are confessed of terrorist acts — without any form of trial. The right to respect for fundamental rights and freedoms must be respected. Well, even in that regard, the provisions of this draft have not been drawn up with sufficient care. In the discussion in the committee, I have cited several examples in this regard. One of them relates to Article 13 § 2, which, upon a request by the court to declare enforceability, only grants to the council the power to verify whether there is no error concerning the person and whether the documents referred to in Article 91 of the Statute have been submitted. Well, this comes in conflict with our principles of legal protection and with our principles of the right to be investigated by an independent legal body.
A fourth objection concerns the uncertainty, both as regards the immunity of ministers and as regards the procedure where Belgian parliamentarians would be involved in proceedings before the International Criminal Court. The Minister referred to Article 103 of the Constitution which provides for a very special procedure for ministers, in which the Chamber must grant leave if the International Criminal Court wants to proceed to prosecute a minister. I feel that the position of the government is that in that case Article 103 of the Constitution remains unshorted. In other words, the House of Representatives could put itself above the international legal order and, because it believes, for example, that national security would be compromised, would not allow a minister to be prosecuted and must appear before the International Criminal Court. It is clear that this international arrangement is usually established precisely for the purpose of a possible prosecution and punishment of government leaders, heads of state, ministers and the like. If we do not provide that Article 103 of the Constitution does not prevent such acts of persecution and punishment, we fail in our international obligations and in our cooperation with the international legal order.
The same applies to the procedure for Members of Parliament. Article 59 of the Constitution may conflict with the procedure outlined herein. Despite my comments, this has not been sufficiently clarified and there have been insufficient adjustments in the Justice Committee.
That is also the reason why I will not approve the design—although I in principle fully and fully support it—. I will remember.

Die gaat niet naar het Parlement, maar roept de verzamelde pers bijeen en zegt: "Vrienden, ik heb twee keer goed nieuws. Het eerste goede nieuws is dat ik bij God ben geroepen. Chirac en Schröder waren daar niet aanwezig, maar ik was daar als premier van ons land. Dat is toch een goed teken, dat is een teken dat wij op de goede weg zijn met de modelstaat, dat is goede publiciteit voor ons land". Dan vraagt men hem naar het tweede goede nieuws. Verhofstadt zegt: "Dat is toch evident. God Zelf heeft gezegd dat ik premier blijf tot het einde der tijden. ""
Beste vrienden, de begroting en haar wijzigingen zijn dan ook opgesteld met het idee dat het einde der tijden voor zeer binnenkort is. De toekomstvisie ontbreekt volledig in deze begroting. Wat er heerst is een mentaliteit van après nous le déluge. Ik zou graag enkele argumenten naar voren brengen die de regering aanhaalt om haar beleid te verdedigen. Ik zou die graag ontkrachten.
De regering zegt dat de Belgacom-operatie financieel neutraal is voor de overheid. Ik wil daarover drie zaken zeggen. Ik neem aan dat er wat twijfel is bij de VLD-fractie over het tweede goede nieuws, maar dat moet u zelf uitmaken hoe u dat arrangeert. Ik wil drie zaken zeggen over het feit of de Belgacom-operatie al dan niet financieel neutraal is. Ten eerste, wij hebben de transactiesom zelf nooit betwist. Wij nemen aan dat de actuarissen daar goed werk hebben geleverd. Ten tweede, wij keuren de transactie zelf niet af. De overname op zich is goed nieuws voor Belgacom en zijn werknemers.
Thans blijkt dat de pensioenlast voor de Belgacomwerknemers, die de overheid moet betalen, in het jaar 2005 bijvoorbeeld, 270 miljoen euro zal bedragen. Dat is ongeveer evenveel als de rente die de overheid in dat jaar uitspaart. Tegen het jaar 2020, mijnheer De Gucht, blijkt dat de pensioenlast 446 miljoen euro zal bedragen. Dat is dus tweemaal zoveel als de uitgespaarde rente. Dat is een eerste gat in de berekening van uw regering.
Ten tweede gaat u ervan uit dat de 5 miljard euro vanaf 2010 onaangeroerd zal blijven. Anders zou uw rentevoordeel zakken. Nochtans rekent u erop dat dat bedrag onaangeroerd blijft om het te kunnen aanwenden voor het Zilverfonds. Dit is een tweede gat in uw berekening.
Ten derde rekent u in de berekeningen de dividenden in. Deze dividenden van Belgacom zou u in elk geval ontvangen hebben, ook indien u ze niet op die manier geboekt zou hebben. Dat is een derde gat in uw berekening.
Ten vierde stopt uw berekening in het jaar 2023 terwijl het heel duidelijk is dat de pensioenlasten doorlopen tot en met het jaar 2050. Dat is het vierde gat in uw berekening.
Ten vijfde houdt u er geen rekening mee dat Belgacom door deze operatie de opleg van 1,5 miljard euro in haar kosten kan inbrengen. Dat betekent dat 600 miljoen aan vennootschapsbelasting alsook 450 miljoen dividenden ontsnappen aan de overheid. Het argument dat de minister in de commissie aanhaalde, houdt geen steek. Belgacom is immers sowieso van plan Proximus in een aparte vennootschap in te brengen.
Samengevat blijkt dus heel duidelijk dat de Belgacomoperatie absoluut niet financieel neutraal is voor de overheidsfinanciën. Voor elke euro die u inschrijft als ontvangsten, blijkt dat er een euro verplichtingen tegenover staat.
Beste VLD-fractie, u hebt een Parmalatbegroting goedgekeurd. Parmalat verwijst naar het gelijknamige Italiaanse zuivelbedrijf dat ook dacht dat het 5 miljard euro schulden uit de boeken kon laten verdwijnen zonder dat iemand dit zou merken.
Een tweede argument dat u aanhaalt, is dat de Belgacomoperatie op die wijze geboekt diende te worden, omdat de verlaging van de personenbelasting in het andere geval uitgesteld zou moeten worden. Uit recente feiten blijkt evenwel dat u die personenbelasting sowieso uitgesteld hebt. Doordat u de bedrijfsvoorheffing niet aanpast aan de nieuwe belastingvrije sommen, zal deze belastingsverlaging pas in 2006 enig effect hebben. Dat betekent dat pas zeven jaar nadat Verhofstadt aan de macht gekomen is, de mensen eindelijk iets van die belastingsverlaging zullen merken. Dit contrasteert zeer sterk met de grote ijver die u aan de dag hebt gelegd op het moment dat u deze zomer de belastingen verhoogd hebt. Toen u deze zomer de accijnzen verhoogde, waren de maatregelen reeds in voege, dit nog voor ze in het Staatsblad gepubliceerd waren. U doet dus het omgekeerd van wat Schröder in Duitsland doet. Schröder is een socialistische kanselier die de belastingsverlaging gaat vervroegen. In ons land hebben we een liberale kanselier die de belastingsverlaging gaat uitstellen.
Wat een contrast, dames en heren! Wat een afgang voor de VLD!
We zeggen dan ook meer dan ooit dat het met de belastingverlaging in dit land is zoals met de UFO's. Heel veel mensen spreken erover, maar bijzonder weinigen hebben ze al echt gezien. Een UFO definiëren we in de volksmond dan ook als een unidentified fiscal object. Dat hebben we te danken aan de VLD-fractie.
De regering zegt ook dat ze niet wist dat de Belgacom-operatie niet over twee boekjaren zou mogen worden geboekt, maar dat ze dat eigenlijk ook niet had bedoeld. De minister verklaarde in de commissie voor de Infrastructuur dat ze nooit had gezegd dat de Belgacom-operatie in twee keer zou worden geboekt. Nochtans staat in artikel 8, §1, van de Belgacom-wet duidelijk dat de boekhoudkundige manipulatie met voorbedachten rade werd gepland. De wet bepaalt immers dat na 31 december 2003 nog een bijkomende termijn van 15 dagen zou worden gelaten om een deel van het Belgacom-geld uit te betalen in het nieuwe boekjaar.
Ik wil ook citeren uit De Tijd — toen nog De Financieel Economische Tijd — van 14 oktober 2003. In deze krant staat: "Minister van Begroting Johan Vande Lanotte gaf gisterenochtend, na vele nachtelijke uren aarzelen, het groene licht om de overdracht in twee delen uit te voeren." Dat staat zwart op wit in deze krant. De twijfel die daarover nu wordt gezaaid, is dus volkomen misplaatst. De minister antwoordt: "Pas deze ochtend kreeg ik de zekerheid van de experts van Belgacom en van andere raadgevers dat de spreiding over twee jaar mogelijk is." Met andere woorden, er was helemaal geen twijfel dat de operatie over twee jaar zou worden gespreid.
Een vierde argument dat de regering aanhaalt, is dat de Belgacomoperatie op die manier moest worden geboekt, omdat anders de pensioenen niet zouden kunnen worden betaald. Het is duidelijk dat de Belgacom-operatie absoluut niets verandert aan de gigantische uitdaging om de pensioenen vanaf 2010 te kunnen uitbetalen. Tegenover elke euro activa, die nu in het Zilverfonds zit dankzij de Belgacom-operatie, staat eenzelfde euro passiva. Dat betekent dat er tegenover alles wat in het fonds binnenkomt, voor hetzelfde bedrag verplichtingen staan.
Laten wij eens van dichterbij analyseren wat de keuzes van Verhofstadt en zijn regering zijn geweest en wat ze hadden kunnen zijn. Laten wij Verhofstadt eens vergelijken met Dehaene II.
De cijfers zijn cumulatief, uitgedrukt als een percentage van het bruto binnenlands product en vergelijken Verhofstadt en Dehaene II met Dehaene I.
Tijdens de periode van Dehaene I was de euro er nog niet. We konden dus niet profiteren van de lage intrestvoeten die we nu kennen. Het is dankzij Dehaene dat we in de Europese Muntunie zijn geraakt. Het is dus ook dankzij Dehaene dat we van de lage rente kunnen genieten.
Beide regeringen hebben geprofiteerd van de lage rente. Dehaene II haalde daarmee cumulatief 8 procentpunten op, maar Verhofstadt 16 procentpunten.
Beste VLD-fractie, beide regeringen hebben de belastingdruk verhoogd, zowel Dehaene als Verhofstadt. Dehaene deed dat cumulatief met 1,4% van het bruto binnenlands product. Verhofstadt deed dat echter met veel meer, namelijk met 1,8 procentpunten. Het verhaal van de hoge belastingdruk in België is inderdaad niet nieuw, al blijkt echter duidelijk dat de regering Verhofstadt er nog een schep bovenop heeft gedaan.

Dear friends, the budget and its amendments are therefore drawn up with the idea that the end of times is for very soon. The future vision is completely missing in this budget. The government says that the Belgacom operation is financially neutral to the government. I would like to say three things about this. Belgacom plans to incorporate Proximus into a separate company.
In summary, it is therefore very clear that the Belgian cooperation is absolutely not financially neutral for the public finances. For each euro that you deposit as receipts, it shows that there is one euro of obligations against you.
Dear VLD group, you have approved a Parmalat budget. Parmalat refers to the Italian dairy company of the same name that also thought it could make 5 billion euros of debt disappear from the books without anyone noticing it.
A second argument that you cite is that the Belgian cooperation had to be booked in this way, because the reduction of the personal tax would otherwise have to be postponed. However, recent facts show that you have postponed this personal tax anyway. As you do not adjust the corporate advance tax to the new tax-free amounts, this tax reduction will have any effect only in 2006. That means that only seven years after Verhofstadt came to power, people will finally notice something of that tax reduction. This contrasts very strongly with the great zeal you put on the day when you raised taxes this summer. When you raised the excise duties this summer, the measures were already in place, before they were published in the Staatsblad. So you are doing the opposite of what Schröder is doing in Germany. Schröder is a socialist chancellor who is going to anticipate tax cuts. In our country we have a liberal chancellor who will postpone the tax cuts.
What a contrast, ladies and gentlemen! What a departure for the VLD!
Therefore, we say more than ever that the tax cuts in this country are like the UFOs. A lot of people talk about it, but very few have actually seen it. UFO is defined as an unidentified fiscal object. This is due to the VLD group.
The government also says that it did not know that the Belgacom operation could not be booked in two fiscal years, but that it did not actually intend to do so. The Minister stated in the Infrastructure Committee that she had never said that the Belgacom operation would be booked twice. However, it is clear in Article 8, § 1, of the Belgacom Act that the accounting manipulation with premeditated advice was planned. In fact, the law stipulates that after 31 December 2003 an additional period of 15 days would be left to pay out part of the Belgacom money in the new financial year.
I would also like to quote from The Time — then The Financial Economic Time — of 14 October 2003. In this newspaper it says: "Minister of Budget Johan Vande Lanotte gave yesterday morning, after many nightly hours of hesitation, the green light to carry out the transfer in two parts." Against each euro asset, which is now in the Silver Fund thanks to the Belgacom operation, stands the same euro liability. This means that compared to everything that enters the fund, there are liabilities for the same amount.
Let us take a closer look at what the choices of Verhofstadt and his government have been and what they could have been. Let us compare Verhofstadt with Dehaene II.
The figures are cumulative, expressed as a percentage of gross domestic product and compare Verhofstadt and Dehaene II with Dehaene I.
During the Dehaene I period, the euro was not yet in place. So we couldn’t take advantage of the low interest rates we know now. It is thanks to Dehaene that we have entered the European Monetary Union. So it is also thanks to Dehaene that we can enjoy the low interest rate.
Both governments have benefited from low interest rates. Dehaene II collected 8 percentage points, while Verhofstadt gained 16 percentage points.
Dear VLD faction, both governments have increased the tax burden, both Dehaene and Verhofstadt. Dehaene did that cumulatively with 1.4% of gross domestic product. However, Verhofstadt did that with much more, namely with 1.8 percentage points. The story of the high tax pressure in Belgium is indeed not new, although it turns out clearly that the Verhofstadt government has made another step on top of it.

De impact van het verschil in aanpak is gigantisch, namelijk 5% van het bruto binnenlands product. Dat bedrag is een veelvoud van wat er reëel in het Zilverfonds zit. In het Zilverfonds zit namelijk slechts geld voor één maand pensioen.
De regering maskeert op manifeste wijze haar eigenlijke keuzes en heeft de moed niet om uit te komen voor de keuzes die ze maakt. Economische cycli brengen ons van het ene dal in het andere dal. Als men in het dal van melk en honing niet voldoende voorraad inslaat en vervolgens in het dal van de koude en de mist komt, dan zal men de mensen ook effectief in de kou laten.
De regering laat de gepensioneerden de komende decennia in de kou staan. Ook al geeft uw eigen collega Vandenbroucke nu schoorvoetend toe — op dat punt zijn we bondgenoten — dat het bijzonder krap wordt om weer op het goede pad te raken, zien we in de praktijk in het beleid en ook in de recente maatregelen geen enkele intentie om daar iets aan te doen. Daarom is er in dit land een alternatief nodig.
CD&V heeft dat alternatief in de vorm van een pensioenspaarpot. Die heeft als doel de pensioenen veilig te stellen. In plaats van zoals bij het Zilverfonds te wachten op het einde van het jaar en te kijken of er eventueel iets over is om de pensioenen uit te betalen en een aantal trucs toe te passen is het een veel betere aanpak om op voorhand in het begin van het jaar geld opzij te zetten, te reserveren voor de pensioenen. Dat doet uw regering niet. Vandebroucke zegt dat de regering dat wel doet. Zij doet dat helemaal niet. Zij legt gewoon geld opzij voor het lopende jaar, maar reserveert niets voor de toekomst, voor de pensioenen vanaf 2010.
Het Planbureau heeft ondertussen bekendgemaakt dat tot en met 2008 er absoluut geen enkel overschot zal zijn, met andere woorden dat het Zilverfonds helemaal ondergefinancierd zal zijn om de pensioenen vanaf 2010 te betalen. Daar is uw fractie, mijnheer Van der Maelen, voor 100% verantwoordelijk voor. Daarom pleiten wij er als CD&V met ons alternatief van de pensioenspaarpot voor om in het begin van het jaar één miljard euro opzij te zetten voor de pensioenen, zodanig dat die pensioenen veilig gesteld worden. Dat komt overeen met 0,35% van het bruto binnenlands product. Wij hopen dat diverse fracties zich zo snel mogelijk aansluiten bij ons alternatief.
De vraag is waarom een pensioenspaarpot en waarom geen Zilverfonds? Het is duidelijk dat overschotten verkrijgen in de Belgische context bijzonder moeilijk is. Ik zeg dat over alle partijgrenzen heen. Vanaf het ogenblik waarop men denkt dat men een overschot gerealiseerd heeft, komen er tientallen lijstjes boven om het potentiële overschot al op te delen, zodat het overschot al opgesoupeerd is voor het aan de kant kan worden gezet. Daarom bevat onze pensioenkas in België dan ook zo bitter weinig reserves.

CD&V has this alternative in the form of a pension savings pot. The aim is to secure pensions. Instead of waiting for the end of the year as with the Silver Fund and looking to see if there is anything left to pay out pensions and apply some tricks, it is a much better approach to put money aside in advance at the beginning of the year, to reserve for pensions. Your government does not do that. Vandebroucke says the government does. She does not do it at all. She simply puts money aside for the current year, but does not reserve anything for the future, for the pensions from 2010.
Meanwhile, the Planning Bureau has announced that until 2008 there will be absolutely no surplus, in other words that the Silver Fund will be completely underfunded to pay the pensions from 2010. Your group, Mr Van der Maelen, is 100% responsible for that. Therefore, as CD&V, we advocate with our alternative to the pension savings pot to set aside one billion euros at the beginning of the year for pensions, in such a way that those pensions are secured.
