Mijnheer de voorzitter, mijnheer de minister, collega's, we bespreken dit ontwerp in verlengde zitting omdat deze paarse meerderheid van mening is dat dit ontwerp hoogdringend is en nog voor het reces wetgeving dient te worden.
Bij het zoeken naar de redenen voor die hoogdringendheid maakt de memorie van toelichting ons niet veel wijzer. De besprekingen in de commissie hebben de onduidelijkheid evenmin weggewerkt. De minister antwoordde dat er een consensus was binnen de regering. Waarom zou het ontwerp dan nog moeten worden uitgesteld. Beter was de koe bij de horens te vatten. Indien een consensus binnen de meerderheid een argument is om de hoogdringendheid in te roepen, begrijp ik niet waarom we vandaag niet alle punten als hoogdringend behandelen waarover binnen de regering en in het regeerakkoord een consensus bestaat, of moet ik hieruit besluiten dat indien dit ontwerp er wordt uitgelicht er geen consensus bestaat over al de andere parafrases en delen van het regeerakkoord? Waarom moet de rest worden uitgesteld?
De werkelijke reden zit hem uiteraard in de vergunning voor Nepal. Ze bracht Verhofstadt I in verlegenheid. Ze bracht het kartel in wording van sp.a en spirit in verlegenheid. We weten allemaal dat op 23 juli jongstleden de oorspronkelijke vergunningen — de vergunningen Verhofstadt I - verstreken. De minister heeft zelf in het Parlement gezegd dat op dit ogenblik slechts 2.500 van 5.500 Minimi's aan Nepal geleverd zijn. Men had een looptijd van 3 jaar. Dit betekent dat de vergunningen moesten worden verlengd. Dit kon echter niet meer op federaal vlak.
Mijnheer de minister, u hebt terecht, juist en eerlijk geantwoord op mijn vraag in de commissie of u op de hoogte was van een aanvraag door FN voor een verlenging van de vergunning. U antwoordde dat u er geen kennis van had. Dit was correct. De volgende dag konden we in de pers vernemen dat de woordvoerder van FN verklaarde te wachten met de aanvraag omdat hij verkoos de aanvraag in te dienen bij het beleidsniveau waar het moest gebeuren.
Die urgentie leidt dan ook zo ver, collega's, dat deze regering zelfs in tegenspraak gaat met haar eigen regeringsverklaring. Op het beruchte forum zouden eigenlijk wetsontwerpen worden uitgewerkt; daar zou worden gezorgd voor meer coherentie in bevoegdheden tussen de federale overheid en de Gewesten en de Gemeenschappen. Enkele voorbeelden werden exemplarisch aangehaald, waaronder het uitreiken van uitvoervergunningen voor wapens. Waar is het forum? Als het al is opgericht, heeft het inderdaad wel zeer snel en efficiënt gewerkt. Waarom nu reeds van wal steken als men eerst heeft afgesproken om dit binnen het forum te doen?
Als er — zoals de minister terecht aanhaalde — in de regering en in de meerderheid reeds een consensus was, dan vraag ik aan de sp.a- spirit-onderhandelaars naar aanleiding van de regeringsvorming waarom dit akkoord niet onmiddellijk in het regeerakkoord expressis verbis mocht worden opgenomen? Waarom moest daarover worden gezwegen? Waarom moest er met betrekking tot deze materie naar het forum worden verwezen om, terwijl de inkt van het regeerakkoord nog niet droog is, toch reeds een wetsontwerp — dat daar eigenlijk tegenin druist — hier in te dienen?
Het argument van de regering met betrekking tot de coherente bevoegdheidspakketten kan een valabel criterium zijn, maar dan stel ik mij de vraag waarom geen andere bevoegdheden mee in dit ontwerp zijn opgenomen. Laten we er de werkgelegenheid uitnemen. Werkgelegenheid is toch de prioriteit van Verhofstadt II? Het is toch deze regering die voor 200.000 bijkomende jobs zal zorgen? Dit heeft niets te maken met het gegeven dat de overheveling van werkgelegenheid misschien gevoeliger ligt aan Vlaamse kant dan aan Waalse kant, terwijl het met de overheveling van de wapenwetgeving omgekeerd het geval is.
Dit heeft niets te maken met het treiteren van respectievelijke Gemeenschappen. Dit heeft te maken met beter bestuur. Ik verwijs terzake naar de analyse van de Europese Investeringsbank. Die stelde dat de overheveling van werkgelegenheid in Wallonië zou leiden tot 80.000 bijkomende jobs. Lijkt dat niet relevant in het kader van dé prioriteit van Verhofstadt II en was dat niet hoogdringend? 80.000 jobs in Wallonië alleen tegenover 1.500 jobs bij FN Herstal en ongeveer 1.500 onrechtstreeks. 80.000 tegenover 3.000: wat is hier hoogdringend?
Wij kunnen de vraag stellen naar het nut van de regionalisering van deze wetgeving. De regering Verhofstadt II zegt meer efficiëntie te willen. De echte reden, collega's, is het primaat van de economie op de ethiek. Het Waalse Gewest als meerderheidsaandeelhouder van FN, luistert naar de balansen van FN. De balansen van FN, de balansen van de intercommunale Francorchamps, die bepalen de communautaire agenda en niet het forum. Met het gevolg dat men rechter en partij kan spelen. Het heeft een voordeel: Verhofstadt II, paars II, is af van vervelende discussies. Sp.a-spirit kan naar links kijken, terwijl er rechts vergunningen worden afgeleverd aan Nepal. Ik herinner mij dat spirit in oktober 10.000 kartonnen mannetjes, met het hoofd in een bloempotje gestoken, uitdeelde in het Vlaamse land om te protesteren tegen de Nepal-leveringen.
Wel, na de goedkeuring van dit ontwerp zult u geen bloemetjes krijgen maar zult u die tienduizend bloempotten terugkrijgen en als de kartonnen mannetjes er niet meer in zitten, kunt u zelf uw hoofd in het zand van die bloempot stoppen.
De feiten tonen dat overigens aan. De meerderheid ondermijnde tijdens de regeringsonderhandelingen het dossier. Alsof dat nog niet genoeg was, moest aan het hoofd van de Delcrederedienst een PSfiguur worden benoemd hoewel hij niet als beste was geplaatst in het assessment, een PS-man die ook bij de wapenleveringen onder Verhofstadt I aan Nepal een cruciale rol heeft gespeeld. De feiten tonen het nogmaals aan: er moest druk worden gezet op de Franstalige oppositie, op onze collega's van cdH. Die druk heeft succes gekend. L'histoire se répète. Wij zijn Lambermont niet vergeten. Uiteraard kunnen wij begrip opbrengen voor economische belangen in dit land en in de diverse regio's. Elke bewaarde job is een job gewonnen, of het nu in het noorden of het zuiden van het land is. Maar de historiek van de staatshervorming in dit land heeft ons geleerd dat wij stap per stap evolueren en dat de diverse Gemeenschappen als partners, met wederzijds respect, wederzijdse toegevingen doen. Dat is een goede traditie. Waar vinden wij dat wederzijdse karakter van dat respect nu nog? De Franstaligen halen hun slagen binnen: Francorchamps, de wapenwetgeving, en de rest verdwijnt naar de communautaire koelkast, naar het forum.
Men mag respect hebben voor Waalse gevoeligheden, voor Franstalige gevoeligheden. Maar is het dan te veel gevraagd, Vlaamse regeringsonderhandelaars, leden van de Vlaamse meerderheid, ook een beetje begrip en aandacht te hebben voor Vlaamse gevoeligheden? Ik citeer senator Van Krunkelsven — het zijn niet mijn woorden: "Als de Franstaligen dan toch vragende partij waren voor een regionalisering, had daar best een pakketje Vlaamse vragen tegenover mogen staan". Eigenlijk zegt Van Krunkelsven dat dit akkoord toch een beetje goedkoop is. In zijn betoog in de Senaat zei hij dat hij echter hoopte dat men daarmee goodwill creëert voor het forum. Die goodwill, collega's van de Vlaamse meerderheid, daar hoeft u niet op te rekenen. Dat hebben wij tijdens de vorige legislatuur kunnen merken naar aanleiding van bijvoorbeeld het akkoord omtrent het Franstalig onderwijs en de financiering ervan. Wij weten wat dat heeft opgeleverd, later in de Costa. Als wij de verklaringen horen van minister-president Van Cauwenberghe over mogelijke toegevingen inzake de Kyoto-norm, zien wij dat van die gecreëerde goodwill niets in huis zal komen.
Ik stel mij de vraag, collega's, wie in casu in de Gewesten de beslissingen gaat nemen. Op federaal vlak was dat duidelijk: dat gebeurde via trappen die wat voorzichtigheid teweegbrachten en die enige terughoudendheid teweegbrachten inzake het leveren van vergunningen. De dienst Contingenten, Economische Zaken en Buitenlandse Zaken, de ambtelijke commissie, het advies van de Belgische ambassades, zulke soort instanties vinden wij op dit ogenblik niet terug bij de regio's.
Als dit morgen wet wordt, wie zal dan adviseren? Wie zal dan het grondig voorbereidend werk doen, opdat de nodige voorzichtigheid aan de dag zou kunnen worden gelegd? In de Franstalige regio wordt op dit moment reeds geruzied of de bevoegdheid naar de minister van Economie of naar de minister-president moet gaan. Men had vooraf beter voor meer duidelijkheid gezorgd en voorbereidend werk verricht, zodat men wist waar men aan toe was. Morgen zal FN haar dossier wel uit de kast halen. Ze zal dan niet lang meer wachten.
De vraag rijst ook hoe een regionaal wapenexportbeleid zich zal verhouden tot de buitenlandse federale politiek. Mijnheer de minister, u bent bevoegd voor conflictpreventie. De vraag is hoe u dat zal doen ten opzichte van landen waarvoor de Gewesten exportvergunningen hebben afgegeven. Er bestaan inderdaad internationale afspraken. De vraag is alleen of die internationale afspraken bij bijvoorbeeld de leveringen aan Nepal werden gerespecteerd.
Ik denk dat, wanneer overheden en regio's andere accenten leggen en andere keuzes willen maken, regionalisering inderdaad op zijn plaats kan en hoort te zijn. Wanneer ik het jaarrapport 2002 bekijk, stel ik vast dat Wallonië het leeuwenaandeel van de exportvergunningen, 60%, voor zijn rekening neemt, terwijl het verantwoordelijk is voor de helft van de exportweigeringen in Vlaanderen. In Vlaanderen is er numeriek minder export van wapens. Als wij respect hebben voor verschillende accenten, moet er ook respect zijn voor de verschillen in andere beleidsdomeinen en niet alleen voor de keuze om wapens al dan niet te leveren.
Mijnheer de minister, collega's, de regering-Verhofstadt II heeft twee prioriteiten. Ten eerste moet zij de belastingen verhogen om het begrotingstekort dat er voor de verkiezingen niet was, aan te zuiveren en ten tweede, moet zij voldoen aan Franstalige eisen.
Deze regering, dit land worden in feite geleid en gedomineerd door de Franstaligen. In die zin is dit paars een heruitgave van paarsgroen. Het is niet paars I, het is Verhofstadt II.
We hadden reikhalzend kunnen uitkijken naar het stemgedrag en de houding van spirit binnen het kartel met de sp.a en naar het stemgedrag van de spirit-mandatarissen. Volgens de pers kunnen zij ermee leven en is dit een stap naar de regionalisering. Nochtans hebben zij ooit anders gesproken en in dat verband citeer ik de voorzitter van spirit in oktober 2002: "Als spirit in de positie van de sp.a zat, dus binnen de schoot van de meerderheid, zouden wij anders gehandeld hebben wat betreft de uitvoering van Nepal. Zoveel is duidelijk. Spirit zal tijdens de campagne niet zwijgen over Nepal". Na de campagne wel.
De voorzitter voegde eraan toe: "Ik ben niet van plan mijn mond te houden over de wapenleveringen". Zij verklaarde destijds: "Spirit is ook ontgoocheld over de houding van de socialisten en zal zijn positie, als eenmaal het kartel tussen sp.a en spirit een feit is, gebruiken om klare afspraken te maken rond wapenhandel als het kartel regeringsverantwoordelijkheid zou opnemen". Ik citeer verder: "Een sp.a met spirit zou FN niet de nodige vergunningen geven om aan Nepal te leveren". Welnu, het verschil is dat een sp.a met spirit in de regering zal zorgen voor een tweede levering aan Nepal! Lees er uw partijprogramma en uw verklaringen op na. Het kan verkeren, zei Bredero.
Het is duidelijk dat deze wet het glijmiddel is om Verhofstadt II in het zadel te zetten en dat de leden van de Franstalige oppositie dit ook begrijpen. Dit is een communautair onevenwicht en het staat haaks op het federaal model. Wij kunnen dat niet goedkeuren.

However, this could no longer be done at the federal level.
Mr. Minister, you correctly, correctly and honestly answered my question in the committee whether you were aware of an application by FN for a renewal of the permit. The next day we could hear in the press that the FN spokesman stated to wait with the application because he chose to submit the application at the policy level where it should be done.
That urgency leads so far, colleagues, that this government even contradicts its own government statement. In the notorious forum, bills would actually be drafted; there would be ensured greater coherence in powers between the federal government and the Regions and the Communities. Some examples were exemplified, including the issue of export licences for weapons. Where is the forum? If it has already been established, it has indeed worked very quickly and efficiently. Why do you get rid of it now when you have agreed to do this in the forum?
If, as the minister correctly pointed out, there was already a consensus in the government and in the majority, then I ask the sp.a. spirit negotiators following the formation of the government why this agreement should not be included immediately in the government agreement expressly verbis? Why should this be silenced? Why was it necessary to refer to the forum on this subject in order, while the ink of the governmental agreement is not yet dry, yet already to submit here a draft law — which is actually opposed to it? We have not forgotten Lambermont. Of course, we can understand economic interests in this country and in the various regions. Every retained job is a job won, whether it is in the north or south of the country. But the history of state reform in this country has taught us that we evolve step by step and that the various Communities as partners, with mutual respect, make mutual concessions. That is a good tradition. Where do we find that mutual character of that respect now? The French-speaking take their strikes in: Francorchamps, the weapons legislation, and the rest disappears to the community refrigerator, to the forum.
One should respect Wallonian sensitivities, French-speaking sensitivities. But is it too much asked, Flemish government negotiators, members of the Flemish majority, to have a little understanding and attention to Flemish sensitivities? I quote Senator Van Krunkelsven — these are not my words: "If the French speakers were still a requesting party for a regionalization, there would have been a package of Flemish questions." In fact, Van Krunkelsven says that this agreement is still a bit cheap. In his speech in the Senate, he said, however, that he hoped that this would create goodwill for the forum. That goodwill, colleagues of the Flemish majority, you do not have to count on that. We have noticed this during the previous legislature, for example, following the agreement on French-speaking education and its financing. We know what it has brought, later in the Costa. If we hear the statements of Prime Minister Van Cauwenberghe on possible concessions regarding the Kyoto standard, we see that of that created goodwill nothing will come back.
I wonder, my colleagues, who in this case will make the decisions in the regions. At the federal level, that was clear: it happened through stairs that brought about some caution and some restraint in granting permits. The Service Contingents, Economic Affairs and Foreign Affairs, the official committee, the advice of the Belgian embassies, such types of bodies we do not find at the moment among the regions.
If this becomes law tomorrow, who will advise? Who will then carry out the thorough preparatory work, so that the necessary caution can be displayed? In the French-speaking region, there is already a rumor about whether the power should go to the Minister of Economy or to the Prime Minister. It would have been better to provide for greater clarity in advance and to carry out preparatory work, so that one knew what was going on. Tomorrow, the United Nations will take its file out of the closet. She will not wait long anymore.
The question also arises how a regional arms export policy will relate to the federal foreign policy. You are responsible for conflict prevention. The question is how you will do that in relation to countries for which the Regions have issued export permits. There are indeed international agreements. The question is only whether those international agreements were respected in, for example, the deliveries to Nepal.
I think that when governments and regions put different emphasis and want to make different choices, regionalization can and should indeed be in place. When I look at the 2002 Annual Report, I find that Wallonia accounts for the lion’s share of export licenses, 60%, while it is responsible for half of export refusals in Flanders. In Flanders there is numerically less arms exports. If we respect different accents, there must also be respect for the differences in other policy areas and not just for the choice to deliver or not deliver weapons.
Mr. Minister, colleagues, the Government-Verhofstadt II has two priorities. First, it must raise taxes to clean up the budget deficit that did not exist before the elections and secondly, it must comply with French-speaking requirements.

Le premier était la fin de l'utilisation de ce dossier d'octroi ou de refus de licence à des fins communautaires, le deuxième était le souci éthique et le troisième, le souci de maintenir une certaine cohérence au niveau des Affaires étrangères.
En ce qui concerne la fin de cette possibilité d'utiliser l'octroi ou non de licences d'armes dans une Région ou une autre, à des fins communautaires ou régionales, dans le but d'attiser des conflits et des discussions passionnées, nous estimons que ce système, avec une régionalisation sur le principe, est bon, car nous ne pourrons plus utiliser ce dossier passionné pour en faire des enjeux communautaires et régionaux. Nous ne faisons que traduire ce qui est déjà la réalité étant donné qu'actuellement, au gouvernement fédéral, c'est un ministre wallon qui octroie les licences pour les entreprises wallonnes et un ministre flamand qui octroie les licences pour les entreprises flamandes.
Pour ce qui est de l'éthique, je me réjouis, et M. Maingain l'a rappelé, que sous l'influence du cdH, le Code de conduite ait été inséré dans cette régionalisation de l'octroi des licences d'armes. Je pense qu'il s'agit d'un garde-fou, non que nous craignions que les Régions soient moins loyales ou moins éthiques, mais nous pensons que pour éviter tout dérapage, l'insertion de ce Code de conduite était approprié et opportun. Ce Code de conduite va non seulement s'appliquer lorsque les Régions vont accepter ou refuser l'octroi des licences d'armes, mais également si les Régions décident ultérieurement de légiférer dans ces matières.
En regard de la cohérence au niveau des Affaires étrangères, si cette compétence est exercée par les Régions et non plus par les Affaires étrangères, il y a un risque, peut-être théorique, qu'il y ait des divergences entre les Régions et les Affaires étrangères. Non pas, comme M. Maingain l'a dit plus tôt, que les Régions soient moins éthiques ou loyales, mais ces dernières n'ont pas nécessairement l'ensemble des informations ni les mêmes informations que les Affaires étrangères. Les Affaires étrangères restent l'interlocuteur privilégié de la Belgique à l'étranger et elles sont, à certains moments, en possession d'informations résultant de négociations, qui peuvent être méconnues des Régions. C'est la raison pour laquelle nous avions proposé un mécanisme d'information obligatoire des Régions auprès de l'interlocuteur privilégié des instances internationales, les Affaires étrangères, afin que les Régions ne puissent pas prétendre ne pas être au courant de pouvoir ou non octroyer la licence.
Cependant, nous pensons que le Code de conduite inséré impliquera une cohérence minimale, étant donné que tout le monde se basera sur les mêmes critères qui y sont inclus. Le vice-premier ministre nous a assurés que les échanges d'informations qui s'effectuaient déjà continueront et qu'il sera à tout moment à la disposition des Régions pour leur fournir les informations nécessaires pour qu'elles prennent les mesures opportunes dans le cadre de l'octroi ou du refus des licences. Nous espérons donc que cette cohérence pourra être maintenue entre les Régions et les Affaires étrangères.

Mijnheer de voorzitter, mijnheer de vice-eerste minister, collega's, vandaag worden wij verondersteld het ontwerp van bijzondere wet tot regionalisering van het geweten te bespreken. Mijnheer de voorzitter, ik ken reeds een tijd de geplogenheden van dit huis, maar iedere keer opnieuw maakt een reeks kleine details duidelijk op welke manier deze Belgische constructie werkt.
Toen ik maandag jongstleden aankwam in de commissie voor de Herziening van de Grondwet, was meteen duidelijk dat een onderwerp stond geagendeerd dat voor de Franstalige collega's ongetwijfeld zeer belangrijk was. Een Franstalige vice-eerste minister, de heer Louis Michel, niet bepaald gekend als de man die overdreven respect heeft voor het Parlement, was voorwaar voortijdig naar de commissie afgezakt. De aanwezigheid van zowat alle Franstalige collega's maakte onmiddellijk duidelijk hoe de vork in de steel zat. Net zoals bij de bespreking van het financiële onderdeel van het Lambermont-akkoord, waren de Franstalige collega's vast van plan hun politiek van het Waalse "eigen volk eerst" met kracht te verdedigen.
Mijnheer de voorzitter, wie zou ik zijn om hen hierin ongelijk te geven? Meer zelfs, ik wil van mijn spreekrecht op dit spreekgestoelte gebruikmaken om hen hiermee uitdrukkelijk te feliciteren. Tot nader order kan ik als Vlaming alleen maar dromen van Nederlandstalige politici die, eenmaal zij aan de macht participeren, consequent de belangen van hun Gemeenschap verdedigen.
Mijnheer de voorzitter, mijnheer de vice-eerste minister, collega's, wie had gedacht dat de federale regeringsverklaring als leidraad zou kunnen dienen om onze regeringsploeg te beoordelen, is er bij de eerste test reeds aan voor de moeite. In het onderdeel over de verdere uitbouw van de federale Staat lezen wij: "Het forum zal bovendien oplossingen onderzoeken en wetsontwerpen uitwerken voor verschillende vragen, om bij te dragen tot een grotere structurele coherentie van de federale, gewestelijke en/of gemeenschapsbevoegdheden. In dit kader zal het forum onder meer de verkeersveiligheid en het uitreiken van uitvoervergunningen voor wapens behandelen".
Collega's, na lectuur hiervan past het toch even onze verwondering uit te drukken over het feit dat nu bij hoogdringendheid dit ontwerp van bijzondere wet dient te worden behandeld. En wat antwoordt de vice-eerste minister op de vraag waarom de verkeersveiligheid minder snel moet worden aangepakt dan de wapenproblematiek? Hij zegt letterlijk: "In de schoot van de regering en in het Parlement bestaat nu reeds een brede consensus over de betrokken aangelegenheid. Dit zal het forum overigens in de mogelijkheid stellen om sneller vooruitgang te maken in andere materies".
Collega's, ik moet toegeven dat ik de vice-eerste minister nooit zo grappig heb weten zijn in een commissievergadering. Deze man beschikt voorwaar over een zeer bijzondere vorm van humor. De werkwijze die door de regering werd gekozen, druist ook in tegen een andere paragraaf uit de regeringsverklaring, met name in het hoofdstuk over het actief vredesbeleid. Collega's, ook daar lezen wij: "...de strikte toepassing van de nieuwe wet inzake wapenleveringen, met inbegrip van de bepalingen inzake informatie aan het Parlement".
Mijnheer de voorzitter, mag ik vanop dit spreekgestoelte mijn verontwaardiging cynisch laten blijken over het feit dat hier zomaar het levenswerk van onze sp.a-collega Van der Maelen — hier aanwezig — met één pennentrek van tafel wordt geveegd? Was het niet collega Van der Maelen die bij het begin van dit jaar nog ieder van ons trachtte wijs te maken of zelfs trachtte te overtuigen van het feit dat de nieuwe wet op de wapenuitvoer, die na de Nepal-crisis werd goedgekeurd, strenger was geworden? Wat gebeurt nu bij de eerste test, collega Van der Maelen? Uw nieuwe wapenwet gaat terug naar af. Ik moet u vandaag feliciteren met uw oneindig groot incasseringsvermogen. Bij elke nieuwe regeringsvorming voelt u zich geroepen om minister, staatssecretaris of voorzitter van een commissie voor de Politieke Vernieuwing te worden. Heel uw carrière, collega Van der Maelen, is erop gebouwd van kaakslag naar kaakslag te gaan. Zelfs een regeringskrant als De Standaard was daar deze week op gekomen. Uw incasseringsvermogen is inderdaad onbeperkt.
Voorzitter, mijnheer de vice-premier, collega's, uit het onlangs aan het Parlement overgezonden rapport over de wapenhandel blijkt overduidelijk dat Wallonië goed is voor minstens 60% van de Belgische wapenexport. Dit naakte cijfer verklaart veel beter dan welk argument dan ook waarom we snel de aflevering van wapenexportvergunningen moeten overdragen naar de Gewesten. De belangen van FN en dus van het Waalse Gewest moesten worden veiliggesteld en dan moet iedere ethische overweging in de politiek wijken. Amen en uit.
Voorzitter, collega's, de vice-premier, Louis Michel, was de vorige legislatuur zowat constant op reis vermits hij de wereld rond de vredesboodschap moest brengen. Is het gepermitteerd, mijnheer de voorzitter, luidop de vraag te stellen of hij terzelfder tijd niet gewoon bezig was met wapens van FN te gaan versjacheren? Uit de officiële cijfers blijkt dat ondanks alle vredesretoriek, mijnheer de vicepremier, België nooit meer wapens uitvoerde dan de voorbije legislatuur. Was het dan echt maar een dom toeval dat uitgerekend diezelfde Louis Michel degene was die alle wapenexportvergunningen voor Wallonië moest tekenen? Ben ik dan echt de enige die logische afleidingen maak?
Mijnheer de voorzitter, sta me dan ook toe deze politieke hypocrisie, die hier deze dagen wordt opgevoerd, aan te klagen. Laten we de dingen gewoonweg bij hun naam noemen en zeggen aan de bevolking dat Louis Michel de voorbije legislatuur gewoon een redelijk goed betaalde handelsreiziger van het Waalse FN was. Dit is iets exacter geformuleerd dan de grote vredesbrenger van de MR.

The approach chosen by the government also contradicts another paragraph of the government statement, in particular in the chapter on active peace policy. Colleagues, we also read there: "...the strict application of the new law on arms deliveries, including the provisions on information to Parliament".
Mr. Speaker, can I, in this speech, give a cynical expression of my indignation over the fact that here simply the life work of our sp.a. colleague Van der Maelen — present here — is wiped out of the table with one penny? Mijnheer de vice-eerste minister, alleen al uw reactie op mijn betoog bewijst dat het pijn doet en dat het inderdaad zeer nauw aansluit bij de werkelijkheid. Wie heeft de wapenvergunningen getekend voor uw prille democratie in Nepal? Was u het? Waar is uw ethiek? Laten we lachen. U bent niet de grote vredesbrenger overal ter wereld. U bent gewoon de sjacheraar van wapens. Laten we de dingen bij hun naam noemen.
Mijnheer de voorzitter, collega's, ikzelf kom uit de Westhoek, die nog altijd diepe littekens draagt van het zinloze van oorlogen. Als vertegenwoordiger van het radicale Vlaams-nationalisme beschouw ik ons ook als de ideologische erfgenaam van de radicale frontbeweging die aan het IJzerfront in 1914-1918 ontstond. Vanuit dit goed begrepen pacifisme en uit respect voor de nooit-meeroorlog-gedachte wil ik mij vandaag heel in het bijzonder richten tot mijn spirit-collega's. Ik wil hen toch even herinneren aan hun zogenaamd pacifistisch geweten.
Collega's van spirit, op de IJzerbedevaart van 25 augustus 2002 verklaarde voorzitter Lionel Vandenberghe van het IJzerbedevaartcomité het volgende. Ik citeer: "Wij hebben ons altijd verzet tegen wapenhandel, wapenexport en wapenproductie. Het is een schande dat België opnieuw 5.000 moordwapens zal verkopen aan een land in burgeroorlog. Wij doen hier een oproep tot alle parlementsleden om zich hiertegen te verzetten. Dit is zeker een regeringscrisis waard". Wat zegt diezelfde Lionel Vandenberghe nog geen jaar later vanuit het rode pluche van de reflectiekamer? Ik citeer: "Als regionalist kan ik er niet tegen zijn, als pacifist heb ik er wat problemen mee". Collega's van spirit, waar is nu uw regeringscrisis? Zijn de moordwapens van een jaar geleden nu plotsklaps, in één vlotte beweging, onschuldige pijlen en bogen geworden? Leg het uit. Zeg gewoonweg aan de kiezers dat het u alleen om de poen was te doen en om het mandaat via de opvolgerplaatsen.
Spirit-collega's, tijdens het Nepal-debat in deze Kamer op 29 augustus 2002 verklaarde collega Els Van Weert, en ik citeer: "De wapenwet van 1991 verbiedt, zoals u maar al te goed weet, wapenexport naar landen waar een wapenlevering zal bijdragen tot manifeste schendingen van de mensenrechten. Het risico dat deze duizenden Belgische wapens bijdragen tot nog grotere schendingen van de mensenrechten is minstens uitermate groot. Onze minister van Buitenlandse Zaken, de heer Michel, en met hem de blauwe, rode en groene regeringspartners minimaliseren echter de zaak: niets aan de hand, kop in het zand". Ik citeer u verder, collega Van Weert: "Ik richt mij nu speciaal tot de collega's uit groene en rode meerderheidspartijen hier. Minister Michel is een meesterlijk strateeg. De belangrijke levering voor FN-Herstal moest en zou doorgaan, maar gelet op het voorgaande wist hij ook dat er een reukje aan het dossier zat". Wat verklaart Els Van Weert nauwelijks een jaartje later? Ik citeer: "Het verlenen van vergunningen was de facto al geregionaliseerd omdat de minister die erover besliste tot dezelfde taalrol behoorde als het bedrijf dat wenste te exporteren. Deze hypocriete situatie is hiermee uit de wereld geholpen".
Collega's, in minder dan een jaar tijd is die "meesterlijke strateeg" — het zijn uw woorden, mevrouw Van Weert, over uw nieuwe vriend Louis Michel — de vriendelijke probleemoplosser geworden die een eind maakt aan een hypocriete situatie. Collega's, het hangt er inderdaad vanaf hoe men het bekijkt.
Mijnheer de voorzitter, wat moet men doen als men zoveel politieke hypocrisie aanschouwt? Mag ik u eventueel voorstellen - in de positieve geest waarmee wij volgens de eerste minister allemaal een nieuwe blik op de toekomst moeten werpen - om deze namiddag toch nog een grote therapeutische sessie te houden waar we allen samen, in een echte Bert Anciaux-stijl een traantje zouden plengen om onze spirit-collega's te helpen verlossen van een immens gewetensprobleem?
Mijnheer de voorzitter, mijnheer de vice-premier, collega's, ware het niet van de enorme politieke hypocrisie waarmee deze regionalisering gepaard gaat, dan zouden we misschien nog in een goede bui positief kunnen reageren op dat zeer kleine stapje voorwaarts in de verdere ontmanteling van de Belgische Staat.
Maar iedereen die het politieke bedrijf een beetje kent — collega Lambert, u zult inderdaad de stiel nog een beetje moeten leren, maar ik zal u wat leertijd geven —, weet dat de Franstaligen geen vragende partij zijn voor een verdere staatshervorming. Het forum wordt dus gewoonweg een grote diepvrieskast. Van een toewijzing aan de beide deelstaten van de sociale zekerheid komt dus niets in huis. Van een echte fiscale autonomie komt dus niets in huis. Van een defederalisering van het werkgelegenheidsbeleid, Justitie en NMBS komt dus niets in huis. Laten wij mekaar niets wijsmaken.
Collega's, met de voorliggende regionalisering van het geweten wordt meer dan ooit duidelijk gemaakt dat iedere ethiek in de politiek eindigt waar de Waalse belangen beginnen. Vandaag halen onze Franstalige collega's hun trofeeën binnen. De Francorchamps-sigaret en de FN-mitraillette zijn gered. Vlaanderen geeft daarmee inderdaad zijn laatste onderhandelingstroeven gewoon weg.

Vandaag stellen wij vast dat de Vlaamse onderhandelaars van deze meerderheid, zoals het kleine kinderen past, reeds zielsgelukkig zijn als zij met lege handen staan.
Mijnheer de voorzitter, collega's, het Vlaams Blok weigert mee te spelen met die politieke show waarbij het geweten wordt geregionaliseerd. As a representative of the radical Flemish nationalism, I also consider ourselves the ideological heir of the radical front movement that emerged on the Iron Front in 1914-1918. From this well-understood pacifism and from respect for the never-more-war-thought, I would like to address my spirit-colleagues in particular today. I would like to remind them of their so-called pacifist conscience.
Colleagues of spirit, at the IJzerbedevaart on 25 August 2002, Chairman Lionel Vandenberghe of the IJzerbedevaart Committee stated the following. “We have always opposed weapons trade, weapons export and weapons production. It is a shame that Belgium will sell another 5,000 murder weapons to a country in civil war. We call on all members of parliament to oppose this. This is definitely worth a government crisis.” What does that same Lionel Vandenberghe say not a year later from the red plush of the reflection chamber? I quote: “As a regionalist I can’t oppose it, as a pacifist I have some problems with it.” Colleagues of spirit, where is your government crisis now? Have the murder weapons of a year ago now become suddenly, in one smooth movement, innocent arrows and bows? Put it out. Simply tell the voters that it was you only to do the poon and to mandate through the successor places.
Spirit colleagues, during the Nepal debate in this House on August 29, 2002, colleague Els Van Weert stated, and I quote: "The Arms Act of 1991 prohibits, as you too well know, arms exports to countries where a delivery of arms will contribute to manifest violations of human rights. The risk that these thousands of Belgian weapons contribute to even greater human rights violations is at least extremely high. Our Minister of Foreign Affairs, Mr. Michel, and with him the blue, red and green government partners, however, minimize the matter: nothing wrong, head in the sand.” I quote you further, colleague Van Weert: "I am now specifically addressing my colleagues from the green and red majority parties here. Minister Michel is a masterful strategist. The important delivery for FN-Herstal had to and would continue, but given the above, he also knew that there was a smell in the file.” What does Els Van Weert explain barely a year later? I quote: “Licensing was de facto already regionalized because the minister deciding about it belonged to the same language role as the company wishing to export. This hypocritical situation has been helped out of the world.”
Colleagues, in less than a year time, that “mastery strategist”—these are your words, Mrs. Van Weert, about your new friend Louis Michel—has become the friendly problem solver who puts an end to a hypocritical situation. It really depends on how you look at it.
What should we do when we see so much political hypocrisy? Could I possibly suggest you – in the positive spirit with which we must all, according to the Prime Minister, cast a new look at the future – to hold a large therapeutic session this afternoon, where we would all together, in a real Bert Anciaux style, shake a tear to help our spirit colleagues to get rid of an immense problem of conscience?
Mr. Speaker, Mr. Deputy Prime Minister, colleagues, if it were not the enormous political hypocrisy with which this regionalization is accompanied, then we might still be able to respond positively in a good mood to that very small step forward in the further dismantling of the Belgian State.
But everyone who knows a little about the political business — colleague Lambert, you will indeed have to learn the steel a little more, but I will give you a little lesson — knows that the French speakers are not a party asking for a further state reform. Monsieur le président, monsieur le vice-premier ministre, chers collègues, nous allons terminer la session parlementaire en débattant du problème des licences et de l'octroi des licences d'exportation d'armes. En fait, nous terminons cette session un peu comme nous l'avons commencée, sur le même thème en tout cas. Vous vous souviendrez que nous avons été rappelés, fin août de l'année dernière, pour un problème d'exploitation politique d'une licence par certains membres de cette Assemblée qui utilisent davantage l'injure et l'insinuation que l'argumentation politique. Nous avons alors rappelé certains principes qui sont évidemment toujours d'actualité et qui restent valables aujourd'hui.
Il faut rappeler que la notion même de fabrication d'armes porte sur une activité non seulement légitime mais aussi parfois nécessaire. Je ne partage évidemment pas l'utopie de ceux qui croient à un monde sans armes. Ce monde serait livré aux bandes les mieux organisées, ce serait un monde où les règles de la démocratie auraient beaucoup de mal à s'affirmer. C'est un constat pessimiste sur la nature humaine mais je pense qu'il faut en convenir. Un monde sans armes n'est évidemment pas possible et, au contraire, les armes sont parfois nécessaires pour assurer la sécurité intérieure et extérieure, pour assurer la force de la démocratie, deux concepts qui peuvent paraître antinomiques, mais qui sont pourtant nécessaires.
La fabrication d'armes est légitime et parfois nécessaire mais il faut encadrer leur utilisation. Je me réjouis que nos Régions, que ce soit la Flandre avec les composants entrant dans la fabrication des équipements militaires ou la Wallonie avec l'industrie de l'armement, aient des industries performantes en la matière, qui jouissent d'une réputation internationale. Pourquoi devrions-nous nous en affliger? Au contraire, nous pouvons être fiers d'une performance technique de nos entreprises en la matière.
Cette régionalisation trouve plusieurs justifications, dont certaines ont été rappelées. Je pense notamment au besoin d'harmonisation des compétences. Le commerce extérieur, l'économie sont régionalisés. Il me paraît logique qu'une activité économique importante comme celle de l'armement puisse, elle aussi, entrer dans le cadre de l'activité de nos Régions.
Une autre justification a trait à la clarification. Olivier Maingain a rappelé tout à l'heure qu'il existait déjà une régionalisation intrafédérale ou intra-gouvernementale, dans le sens où les licences sont octroyées par un ministre francophone ou néerlandophone en fonction de la langue dans laquelle la demande de licence a été introduite. Cette régionalisation intra-fédérale ou intragouvernementale qui existe déjà de fait n'est qu'un prélude à cette régionalisation que nous allons voter.
La troisième justification a trait à l'intérêt régional qui ne peut souffrir l'exploitation politique telle qu'on l'a parfois connue jusqu'à présent en matière de licences d'exportation. Notre pays en tant que tel, audelà de ses régions, n'a aucun intérêt à souffrir des débats de type politicien tels que ceux qui ont eu lieu au moment d'octroyer la licence pour la vente d'armes au Népal.
Je rappellerai à cette occasion qu'il s'agissait, dans ce cadre, de prendre une responsabilité politique. Nous pouvons faire toutes les lois que nous voulons en matière d'octroi de licence, il restera toujours qu'il s'agit avant tout d'une responsabilité politique, et non pas de l'application d'un simple mécanisme. Cette responsabilité politique ne vise pas seulement l'octroi d'une licence, elle concerne aussi le refus éventuel d'une licence. Lorsque nous refusons, par exemple, d'accorder une licence vis-à-vis d'une entreprise qui exporte des armes dans un régime qui tend à défendre sa démocratie, nous prenons une responsabilité politique. Cette responsabilité politique, c'est de soutenir a contrario ceux qui mettent en péril ou en danger l'essor d'une démocratie.
La responsabilité politique existe bel et bien, que nous octroyions ou pas une licence d'exportation. Le fait de la refuser implique que nous assumions les choix du moment.
Il reste quelques questions qui ont été émises à juste titre par une opposition responsable. Les questions qui concernent notamment la notion de transit étaient légitimes. Le problème a été réglé: il n'y a pas de transit intranational; il n'y a pas de transit intra-fédéral. C'est la législation douanière qui s'applique en cette matière, et le Conseil d'Etat va dans le même sens que le gouvernement. La question me paraît réglée.
Reste la question fondamentale de l'éthique. L'amendement introduit à cet égard était opportun: nous allons effectivement bénéficier de l'intégration du Code de bonne conduite européen au niveau régional, comme c'était le cas au niveau fédéral. Depuis quatre ans, le ministre des Affaires étrangères a toujours appliqué le Code de bonne conduite européen, même au moment où il n'était pas dans notre législation. Il a d'ailleurs demandé à plusieurs reprises au niveau de l'Europe que ce code soit partie intégrante de l'ensemble des législations de nos quinze pays de l'Union européenne. Ce n'est pas nouveau. Il convenait effectivement que cela soit repris intégralement dans notre législation actuelle.
Reste la question de la cohérence de la politique étrangère. Certains se sont demandé comment assurer l'harmonisation de la politique étrangère de la Belgique, suite à ce nouveau transfert de compétence. Nous avons entendu des revendications tendant à instituer des possibilités de veto, ou des possibilités de tutelle au profit de l'autorité fédérale. A cet égard, il convient de souligner que l'arsenal juridique existant et les procédés de concertation entre autorités fédérées permettent déjà largement d'atteindre cet objectif. Nous vivons en effet dans un Etat fédéral où est garanti le principe de coopération, principe qui suppose une réelle autonomie des collectivités fédérées et une coopération entre les différents gouvernements. Les mécanismes de coopération sont connus; ils ont fait leurs preuves. Je rappellerai l'article 31bis de la loi ordinaire du 9 août 1980 de réforme institutionnelle qui prévoit la mise sur pied de la conférence interministérielle de politique étrangère, la CIPE. Au sein de cette conférence, le gouvernement fédéral informe régulièrement les gouvernements régionaux et communautaires sur la politique étrangère, soit à l'instigation du gouvernement fédéral, soit à la demande des entités fédérées qui souhaitent des informations par rapport au développement de la politique étrangère de notre pays, en ce qu'elle peut concerner l'ensemble de nos Régions.
A l'avenir, cette conférence interministérielle pourra être saisie par une des Régions en cas de doute quant à la mise en oeuvre des compétences en matière d'octroi de licence, et en cas de risque de discordance en termes de politique étrangère. Pour nous, cette conférence interministérielle doit demeurer un forum intergouvernemental de discussion entre niveaux de pouvoirs pour l'ensemble de la politique étrangère. Si nous avions introduit des mécanismes de veto ou des cahiers de tutelle sur les Régions, nous aurions semé des germes d'instabilité politique et institutionnelle. Pareil système risquerait de conduire à de véritables situations de blocage et engendrerait à nouveau des turbulences dont notre pays doit pouvoir se passer.
De plus, il faut souligner que certains principes tirés de la jurisprudence de la Cour d'arbitrage devront guider l'action des autorités régionales, Olivier Maingain en a parlé out à l'heure. Il s'agit des principes de loyauté fédérale et de proportionnalité. Le principe de loyauté fédérale est évidemment essentiellement politique, j'en conviens, mais il s'applique, tandis que le principe de proportionnalité permet à la Cour d'arbitrage de rappeler qu'un ordre de gouvernement ne peut, par l'exercice de ses compétences, rendre impossible ou exagérément difficile l'exercice de ces compétences par un autre niveau de pouvoir.
Avant de conclure, je voudrais insister sur ce paradoxe. Je suis un peu étonné d'entendre les plus confédéralistes d'entre nous prétendre, avec une forme de condescendance ou je dirais même de mépris, que la Région ne pourrait pas s'occuper d'un système dans lequel l'éthique interviendrait. La Région ne peut-elle s'occuper que de plomberie, de tuyauterie, de mécanismes purs et simples? C'est la thèse, me semble-t-il, des plus confédéralistes d'entre nous. Cela me surprend car j'ai tendance à croire que nos Régions sont fières de ce qu'elles font, ont une capacité d'action, ont une autonomie qu'elles utilisent à bon escient et qui les rend tout à fait aptes à exercer ces compétences, tout en préservant l'éthique.
Pour certains, semble-t-il, Région et éthique sont incompatibles. J'en suis désolé mais si c'est ainsi qu'ils considèrent les choses, dans ce cas, je pense qu'il ne faut plus rien régionaliser du tout! Si vraiment nos Régions sont incapables de la moindre éthique, alors ne régionalisons plus rien! Ici, au contraire, nous considérons que nos Régions sont capables de prendre des décisions dans le cadre d'un code de bonne conduite, dans le cadre de l'éthique, comme a su en faire preuve l'Etat fédéral précédemment. De ce côté, ce paradoxe doit être soulevé.
Enfin, je terminerai en disant que, pour moi, quelle que soit la loi, qu'elle soit régionalisée, qu'elle soit fédérale, quels que soient les mécanismes législatifs, il s'agit avant tout d'un problème de responsabilité politique. Ce problème subsistera, quelle que soit la loi. A un moment donné, il va falloir prendre une décision par rapport à l'octroi d'une licence. Que cela se passe au niveau fédéral, que cela se passe au niveau régional en concertation avec le fédéral, que cela se passe au niveau régional seul, celui qui prendra la décision engagera sa responsabilité politique. C'est ce qui me paraît essentiel. Il sera d'ailleurs jugé pour cela par l'électeur. Et c'est bien qu'il en soit ainsi, c'est cela la démocratie.
A mon sens, la régionalisation de cette loi sur l'octroi des licences va permettre de quitter la sphère de l'agitation purement communautaire et politicienne pour se concentrer sur l'objet même de sa responsabilité politique qui est l'octroi ou le refus d'octroi d'une licence d'exportation.

Mr. Speaker, Mr. Deputy Prime Minister, dear colleagues, we will conclude the parliamentary session by debating the issue of licenses and the granting of licenses for arms exports. In fact, we end this session a little like we started it, on the same theme in any case. You will remember that we were reminded, at the end of August last year, of a problem of political exploitation of a license by some members of this Assembly who use more insult and insinuation than political argument. We then recalled some principles that are of course still relevant and that remain valid today.
It should be remembered that the very notion of manufacture of weapons refers to an activity not only legitimate but also sometimes necessary. I do not share the utopia of those who believe in a world without weapons. This world would be delivered to the best organized gangs, it would be a world where the rules of democracy would be very difficult to assert. This is a pessimistic statement about human nature, but I think we must agree on it. A world without weapons is obviously not possible and, on the contrary, weapons are sometimes needed to ensure internal and external security, to ensure the strength of democracy, two concepts that may seem antinomial, but which are nevertheless necessary.
The manufacture of weapons is legitimate and sometimes necessary, but we must frame their use. I look forward to the fact that our regions, whether Flanders with the components involved in the manufacture of military equipment or Wallonia with the arms industry, have successful industries in this area, which enjoy an international reputation. Why should we be upset about it? On the contrary, we can be proud of the technical performance of our companies in this area.
This regionalization has several justifications, some of which have been recalled. In particular, I think of the need to harmonize competencies. Foreign trade and the economy are regionalized. It seems to me logical that an important economic activity such as the arms activity can also enter into the framework of the activity of our Regions.
Another reason is the clarification. Olivier Maingain recently recalled that there was already an intra-federal or intra-governmental regionalization, in the sense that licenses are granted by a French- or Dutch-speaking minister depending on the language in which the license application was submitted. This intra-federal or intra-governmental regionalization that already exists in fact is only a prelude to this regionalization that we are going to vote on.
The third justification relates to the regional interest that cannot be affected by the political exploitation as it has sometimes been known to date in the field of export licences. Our country as such, beyond its regions, has no interest in suffering from political-type debates such as those that took place at the time of granting the license for the sale of weapons to Nepal.
I would like to remind you that, in this context, it was about taking political responsibility. We can make all the laws we want in terms of licensing, it will always remain that it is primarily a political responsibility, and not the application of a simple mechanism. This political responsibility does not only concern the granting of a license, it also concerns the possible refusal of a license. When we refuse, for example, to grant a license to a company that exports weapons in a regime that tends to defend its democracy, we take political responsibility. This political responsibility is to support a contrario those who endanger or endanger the rise of a democracy. by

There are still a few questions that were rightly raised by a responsible opposition. The questions concerning, in particular, the concept of transit were legitimate. The fundamental question of ethics remains. The amendment introduced in this regard was timely: we will effectively benefit from the integration of the European Code of Good Conduct at the regional level, as was the case at the federal level. For four years, the Minister of Foreign Affairs has always applied the European Code of Good Conduct, even when it was not in our legislation. He has also repeatedly asked at the European level that this code be an integral part of all the legislations of our fifteen European Union countries. This is not new. This should be fully incorporated into our current legislation.
The question remains the coherence of foreign policy. Some have wondered how to ensure the harmonisation of Belgium’s foreign policy following this new transfer of competence. We have heard claims to impose veto possibilities, or guardianship possibilities in favour of the federal authority. In this regard, it should be emphasized that the existing legal arsenal and the procedures of consultation between federal authorities already largely enable this goal to be achieved. We live in a federal state where the principle of cooperation is guaranteed, a principle that presupposes real autonomy of the federated communities and cooperation between the different governments. The mechanisms of cooperation are known; they have demonstrated themselves. I will recall Article 31bis of the Ordinary Law of 9 August 1980 on Institutional Reform, which provides for the establishment of the Interministerial Conference on Foreign Policy, the CIPE. During this conference, the federal government regularly informs the regional and community governments about foreign policy, either at the instigation of the federal government or at the request of federal entities who wish to receive information regarding the development of our country’s foreign policy, in so far as it may affect all of our regions.
In the future, this interministerial conference may be requested by one of the Regions in the event of doubts regarding the implementation of the licensing powers, and in the event of risk of disagreement in terms of foreign policy. For us, this interministerial conference must remain an intergovernmental forum of discussion between levels of power for the whole of foreign policy. If we had introduced veto mechanisms or custody codes on the Regions, we would have sowed germs of political and institutional instability. Such a system would risk leading to real blocking situations and would again generate turbulence that our country must be able to avoid.
Furthermore, it should be emphasized that certain principles derived from the case-law of the Court of Arbitration will have to guide the action of regional authorities, Olivier Maingain spoke out at the time. These are the principles of federal loyalty and proportionality. The principle of federal loyalty is obviously essentially political, I agree with it, but it applies, while the principle of proportionality allows the Arbitration Court to remind that a government order cannot, by the exercise of its powers, make impossible or excessively difficult the exercise of these powers by another level of power.
Before concluding, I would like to emphasize this paradox. I am a little surprised to hear the most confederalist of us pretending, with some form of condescendance, or I would even say contempt, that the Region could not take care of a system in which ethics would intervene. Can the Region only deal with plumbing, piping, pure and simple mechanisms? This is the thesis, I think, of the most confederalist of us. This surprises me because I tend to believe that our Regions are proud of what they do, have a capacity for action, have an autonomy that they use wisely and which makes them quite capable of exercising these skills, while preserving ethics.
For some, it seems, Region and ethics are incompatible. I’m sorry, but if that’s how they look at things, in this case, I think there is no need to regionalize anything at all! If really our Regions are incapable of the slightest ethics, then let’s not regionalize anything! Here, on the contrary, we consider that our Regions are able to make decisions within the framework of a code of good conduct, within the framework of ethics, as the federal state has previously proven. This paradox has to be addressed.
Finally, I will conclude by saying that, for me, whatever the law, whether it is regionalized, whether it is federal, whatever the legislative mechanisms, it is above all a problem of political responsibility. This will continue, regardless of the law. At some point, a decision on granting a license will need to be made. Whether it happens at the federal level, whether it happens at the regional level in consultation with the federal, whether it happens at the regional level alone, the decision-maker will engage his political responsibility. That is what I think is essential. This will be judged by the voter. That is the case, that is democracy.
In my opinion, the regionalization of this law on licensing will allow to leave the sphere of purely community and political agitation to focus on the very object of its political responsibility which is the grant or refusal of granting an export license.

Mijnheer de voorzitter, mijnheer de vice-premier, ik moet zeggen dat ik in dit debat vandaag met een ongelooflijk stijgend onbegrip en zelfs ongeloof het discours heb gehoord van sommige collega's in deze Kamer aanwezig, mensen die zich volgens partijprogramma separatist of confederalist noemen. Mijnheer Bogaert, gij waart voorzitter van uw CD&V-congres wanneer jullie zich confederalist gingen noemen. Vandaag hoor ik niet anders dan een ongelooflijk unitaristisch discours, waarbij zelfs collega Bultinck zich bijna op dezelfde lijn bevindt als het discours van collega Wathelet wanneer die het heeft over een coherent buitenlands beleid.
Mijnheer de voorzitter, mijnheer de vice-premier, wij zullen met spirit wel degelijk dit wetsontwerp goedkeuren, omdat wij er rotsvast van overtuigd zijn dat dit wetsontwerp inderdaad een stap vooruit is in, eens te meer, een staatshervorming die ons land kenmerkt, waarbij gestreefd wordt naar en bekomen wordt dat men inderdaad meer homogene bevoegdheidspakketten krijgt. (Protest vanwege de oppositie)
Ik vind het schitterend! Mijnheer de voorzitter, ik heb er op zich geen probleem mee dat men mij zo interrumpeert. Men moet eens goed beseffen dat wij vandaag met deze wet inderdaad een stap vooruit zetten om straks een correcte discussie te kunnen voeren, een stap vooruit omdat men in deze discussie tot homogene bevoegdheidspakketten komt. Ik vind het ongelooflijk bizar dat we als argument krijgen vandaag dat we deze wet niet mogen goedkeuren, omdat we vrezen dat de Walen wel eens veel minder ethisch zouden te werk gaan, omdat we vrezen dat zij van alles zullen gaan uitvoeren.
Mag ik deze redenering doortrekken naar een thema dat ons eveneens zeer geliefd is? Mag ik deze redenering doortrekken dat we dus straks evenmin moeten spreken over elke vorm van federalisering van sociale zekerheid omdat we wel eens zouden kunnen vrezen dat men het aan de andere zijde zou doen. Mijnheer Van den Eynde, in de regeringsverklaring is er afgesproken dat we een forum creëren, waarbij we niet alles zullen versmachten en waarbij we evenmin, mijnheer Tant — ik heb van u geen lessen te krijgen op dat vlak — alles zullen realiseren. Ik ben mij daar heel goed van bewust. Een staatshervorming, de realisering van een nieuwe vorm van staat, is een proces van jaren, is een proces van eeuwen, is een proces dat nooit zal voltooid zijn. Het zal een proces zijn waarbij men stap voor stap stappen realiseert, om uiteindelijk tot een beter bestuur te kunnen komen.
Mijnheer de voorzitter, het toont aan dat tussen degenen die zich confederalist noemen en degenen zoals wij, die inderdaad onze staat reeds hervormd hebben, er een andere visie geldt. Wanneer wij gedurende de laatste decennia erin geslaagd zijn de staat te hervormen, dan hebben wij dat altijd gedaan in de optiek om tot een beter bestuur te komen. Wij hebben dit nooit gedaan vanuit een loopgravenstelling. Wij hebben niet gestreefd naar de defederalisering van Onderwijs vanuit de redenering dat Waalse onderwijzers profiteurs waren, maar wel vanuit de redenering — à la Van den Brande — dat wij inderdaad in Vlaanderen met eigen bevoegdheden bepaalde zaken zelf konden realiseren. Wij hebben een defederalisering gekregen van Openbare Werken, niet omdat wij vonden dat Waalse aannemers sjoemelaars zouden zijn, maar omdat we ervan overtuigd waren dat we in Vlaanderen met eigen bevoegdheden zaken zelf konden realiseren. In dezelfde optiek zullen we straks verkeersveiligheid gaan aanpakken. In dezelfde optiek, collega's, pakken we vandaag die wapenwetgeving aan.
Wanneer in dit halfrond gesproken werd over wapenleveringen, ging de discussie keer op keer tussen Vlamingen en Walen, alsof de enen beter dan de anderen waren. Door de defederalisering van de exportlicenties zullen we eindelijk in de regionale parlementen een discussie kunnen voeren die tot de kern van het debat gaat en handelt over wat we willen met onze wapenindustrie.
Laat ons niet spreken van het defederaliseren van het geweten. Mijnheer De Crem, in mijn maidenspeech tijdens het investituurdebat heb ik er reeds op gewezen dat uw partij in de jaren 90 de regeling heeft uitgewerkt zoals ze thans bestaat. In de commissie heeft de vice-premier gewezen op de zeer hypocriete redenering die erin bestond dat één Franstalige minister bevoegd was voor de exportlicenties aan Waalse zijde en één Nederlandstalige minister bevoegd was voor de exportlicenties aan Vlaamse zijde. Het is onbegrijpelijk dat men vanuit dezelfde logica geen vertrouwen kan stellen in Ecoloministers die — bij mijn weten - nog steeds deel uitmaken van de gewestregering. Ook in Wallonië is er een zeer actieve vredesbeweging. Ik heb er alle vertrouwen in dat zij meer dan stringent zal nagaan of de verbetering die aangebracht werd via een amendement dat ertoe strekt de Europese gedragsregels stringent te laten naleven, effectief plaatsvindt.

Monsieur le président, monsieur le vice-premier ministre, chers collègues, le gouvernement avait promis une réflexion de fond sur la problématique de la régionalisation des ventes d'armes. Aujourd'hui, c'est tout le contraire qui se produit. Les deux assemblées ont voté à la va-vite une loi spéciale qui permet avant tout à la majorité de se débarrasser de problèmes épineux qui risqueraient de la fragiliser dès la rentrée parlementaire. L'agenda de cette dernière semaine de juillet est avant tout dicté par la stratégie interne du gouvernement et non par le souci de définir une ligne claire dans cette matière éthiquement sensible.
La première remarque que je voudrais formuler sur le fond du dossier est partagée par de très nombreux observateurs: par cette régionalisation, la Belgique se positionne à contresens de la tendance générale qui consiste à confier les décisions relatives aux armes au niveau de pouvoir le plus global et si possible au niveau européen.
Or, dans le projet qui nous est proposé, ce sont les trois Régions qui vont devenir compétentes. Il s'agit donc d'un morcellement de la décision dans une matière où la dimension internationale devrait rester prépondérante. De plus, aucun espace de concertation ou de coordination n'est prévu. On risque fort d'avoir, à court terme, trois politiques étrangères belges en fonction des dossiers et des contrats. Les armes ne sont évidemment pas des biens comme les autres et des contradictions vont nécessairement jaillir entre les entités fédérées.
Le confort intellectuel du gouvernement est-il plus important que la cohérence de la politique menée? On peut en tout cas se poser la question.
En ce qui concerne les règles éthiques, les écologistes ont largement contribué, au printemps dernier, à l'amélioration de la loi de 1991, notamment en y intégrant le Code de conduite européen en matière d'armes, qui est ainsi devenu contraignant. D'autres améliorations sont également intervenues: interdiction de vendre à des armées qui ont recours à des enfants-soldats, soutien à des régimes démocratiques menacés, présentation d'un rapport bisannuel au parlement.
Une fois la compétence transférée aux Régions, c'est évidemment à celles-ci que reviendra le pouvoir de conserver, de modifier, d'améliorer peut-être, ces règles éthiques. A priori, rien ne permet de penser que les Régions seront moins soucieuses d'éthique et de responsabilité morale que ne l'a été, en son temps, le gouvernement fédéral. Nous sommes donc confiants sur ce point.
En bref, vu la précipitation avec laquelle ce projet est traité, vu l'absence de mécanisme qui permet à la Belgique de sauvegarder la cohérence de sa politique extérieure et vu les conflits d'intérêts potentiels au niveau des Régions, les écologistes s'abstiendront sur ce projet.

Mijnheer de voorzitter, mijnheer de vice- eerste minister, geachte collega's, de VLD-fractie zal het wetsontwerp tot wijziging van de bijzondere wet op de afgifte van de exportlicenties steunen. Ik zal ook toelichten waarom. Collega's, het valt me trouwens op dat in het debat dat tot hiertoe werd gevoerd een aantal voorgaande sprekers graag met symbolen schermen. Zij hollen graag symboliek achterna. Het lijkt mij gevaarlijk om dat in dit dossier te doen. Ik zou graag even met u abstractie willen maken van de symboliek en kijken naar de feiten.
Het blijkt uit de feiten dat de Vlaamse wapenexport de voorbije jaren met 40% is toegenomen. De Waalse wapenexport is met 18% toegenomen. Dat zijn dingen die ook eens moeten worden gezegd. De nieuwe wapenexportwetgeving maakt, sinds ze in 2002 werd goedgekeurd, ook uitdrukkelijk melding van alle dual-use toepassingen. Dual-use toepassingen zijn alle fabricaties voor dubbel gebruik. We weten allemaal dat zij vooral in Vlaanderen, in het noorden van het land, worden gefabriceerd. Ook zij vallen onder de federale wapenexportwetgeving zoals ze vandaag geldt. Dat zijn twee vaststellingen, die ik toch even met u wilde doen.
Collega's, waarom zouden wij in dit federale Parlement en in deze federale regering op dit ogenblik politieke spelletjes spelen? De burger ligt vandaag wakker van zijn job, van tewerkstelling, van de economische terugval die internationaal overal toeslaat. Deze terugval stellen wij allemaal vast. De burger wil dan volgens ons niet dat Vlamingen en Walen politieke spelletjes spelen rond een aantal symbolen, zoals vandaag gebeurt. Bij deze spelletjes roepen Vlamingen steeds opnieuw het zwarte beest van FN Herstal naar voren. De Walen roepen op hun beurt het zwarte beest van de dualuse industrie in West-Vlaanderen naar voren. Ik denk daarentegen dat de burger vandaag wil dat zijn job behouden blijft. Hij wil dat er meer tewerkstelling komt en dat we in eerste instantie daarvoor zorgen.
Er is hier vandaag geopperd dat in dit dossier de Walen de winnaar zouden zijn en de Vlamingen de verliezer. Laat mij hierover duidelijk zijn. Reeds verschillende jaren pleit ik er zelf binnen mijn fractie voor dat het dossier zou worden gedefederaliseerd. Ik doe dat om de eenvoudige reden dat Vlaanderen in de toekomst zelf zal beslissen aan wie en op welke wijze zij haar exportlicenties zal afleveren, zonder dat Waalse politici zich zullen moeien.
Daarmee kom ik bij het probleem van het geweten, waarvan men ook zegt dat het zou worden gedefederaliseerd. Natuurlijk is niets minder waar. De Europese gedragscode en de wapenexportwetgeving blijven immers onverkort van kracht. Ze zullen ook voor de gewestregeringen van kracht blijven, zoals vandaag het geval is voor de federale regering. Trouwens, er is ook nog de interministeriële conferentie. Zoals u weet, kan zij steeds worden gevat door een van de gewestregeringen.
Ten slotte, collega's, elke overtuigde federalist in deze assemblee en in dit halfrond zou dit wetsontwerp voluit moeten steunen. Zoals u weet, zijn vandaag de Gewesten bevoegd voor het afleveren van bouwvergunningen, milieuvergunningen, economische vergunningen. Zij zijn bevoegd voor de ondersteuning van de economie, voor de ondersteuning van onderzoek en ontwikkeling. Zij zijn ook bevoegd voor de ondersteuning van de export, behalve voor de exportlicenties. Monsieur le président, monsieur le vice- premier ministre, chers collègues, on le sait depuis de nombreuses années, l'évolution du dossier relatif à l'exportation, à l'importation et au transit d'armes s'est étalé sur plusieurs législatures.
Chaque fois, il nous interpelle quant à notre registre de valeurs. Les enjeux d'hier sont encore et toujours ceux d'aujourd'hui. Ils concernent notamment les droits de l'homme et visent à concilier ceux-ci avec les critères éthiques, les enjeux socio-économiques et commerciaux.
Il ne s'agit certainement pas aujourd'hui d'un vote à la va—vite car cela fait des mois, des années que l`on discute de ce problème. Le transfert de compétences dont il est question se justifie par la volonté du gouvernement d'aboutir à des paquets de compétences cohérents et homogènes, à gérer dans la concertation absolument nécessaire à tout principe fédéral.
Pour rappel, les autorités régionales ont déjà des compétences en matière économique, ainsi que politique en ce qui concerne les débouchés, l'exportation et l'emploi. Par cette mesure, il s'agit de consacrer une logique du système, tout simplement.
Il convient également de souligner que cette matière fait l'objet d'une réglementation internationale qui devra, bien sûr, être respectée par les Régions dans le cadre de l'exercice de leurs compétences, ce qui signifie, bien entendu, encore une fois l'applicabilité du Code de conduite européen à celles-ci. Même si certains, aujourd'hui, découvrent la lune, dois-je rappeler que le Code de conduite européen est déjà appliqué dans les faits chez nous? Je suis bien entendu favorable avec mon groupe à son adoption qui rencontre la démarche symbolique proactive que nous souhaitons vis-à-vis de nos autres partenaires de l'Union.
Nous avions jusqu'à présent, dans le domaine de l'importation, de l'exportation, du transit d'armes, de munitions et de matériel servant spécialement à un usage militaire, la loi la plus restrictive à l'échelle européenne et mondiale. De toute évidence, la régionalisation de cette compétence n'entraînera pas de modification ou d'affaiblissement de contraintes éthiques que certains semblent redouter, contraintes qui étaient déjà présentes lorsque l'Etat fédéral jouissait de tous les pouvoirs en la matière.
Le nouveau cadre légal dans lequel cette compétence s'inscrit aujourd'hui n'empêchera ni les entreprises ni les autorités régionales de se soumettre aux critères éthiques, mais également au grand nombre de dispositions prévues par le Code de conduite européen, ce qui constitue bien évidemment un élément non négligeable, notamment si l'on considère la mise en application de l'article 10 de ce Code, supposant la prise en compte des intérêts sociaux, économiques, industriels et commerciaux de la Belgique.
Par ailleurs, ce transfert de compétences concerne l'ensemble du pays. Il n'y a pas lieu de cibler des critiques sur telle ou telle partie de la Belgique. Pourquoi le flux de critiques devrait—il s'abattre uniquement sur le sud du pays parce qu'on y défend l'emploi comme partout ailleurs, alors que l'on constate une réelle augmentation des exportations d'armes - M. Goris vient de le rappeler - et plus particulièrement de la technologie afférente à une production liée à un usage militaire, laquelle demeure une spécificité industrielle propre au nord du pays? A cet égard, je vous renvoie au récent rapport sur le sujet adressé au parlement, et à l'histoire économique et industrielle de notre pays.
Cette régionalisation apparaît dés lors comme l'expression d'un développement adapté à notre réalité économique et à notre contexte social. De plus, le transfert des compétences vers les entités régionales constitue un élément positif permettant, entre autres, d'éviter les incompréhensions dont nous avons tant souffert et de consacrer une meilleure répartition et un système économique plus cohérent.

It should also be emphasized that this matter is the subject of an international regulation which, of course, will have to be respected by the Regions in the exercise of their competence, which means, of course, once again the applicability of the European Code of Conduct to them. I am, of course, with my group in favour of its adoption, which meets the proactive symbolic approach we want towards our other EU partners.
We had so far, in the field of import, export, transit of weapons, ammunition and equipment specifically for military use, the most restrictive law on a European and global scale. Obviously, the regionalization of this competence will not result in the modification or weakening of ethical constraints that some seem to fear, constraints that were already present when the federal state ⁇ all powers in this matter.
The new legal framework in which this competence is now incorporated will not prevent companies or regional authorities from subjecting themselves to the ethical criteria, but also to the large number of provisions provided by the European Code of Conduct, which is obviously a non-negligible element, especially when considering the implementation of Article 10 of this Code, which implies taking into account the social, economic, industrial and commercial interests of Belgium.
Furthermore, this transfer of competence concerns the whole country. There is no need to target criticism on one or another part of Belgium. Why the flow of criticism should—it will only hit the south of the country because there is defending employment as everywhere else, while we see a real increase in arms exports—Mr. Goris has just recalled it - and more ⁇ of the technology related to a production related to a military use, which remains an industrial specificity in the north of the country? In this regard, I refer you to the recent report on the subject addressed to Parliament, and to the economic and industrial history of our country.
This regionalization appears as the expression of a development adapted to our economic reality and to our social context. Furthermore, the transfer of competence to regional entities is a positive element that helps, among other things, to avoid the misunderstandings we have suffered so much and to dedicate a better distribution and a more coherent economic system.

Mijnheer de voorzitter, ik zou willen inpikken op wat de heer Moriau zegt over de Vlaamse wapenleveringen en ook op wat de heer Lambert heeft gezegd.
Ik ben het ermee eens dat het niet gemakkelijk is en een uitdaging zal zijn om een eigen ethische code uit te werken op Vlaams gebied. Dat is echter eigenlijk de kern van de zaak niet. De kern van wat nu voorligt is hoe de onderhandeling verlopen is tijdens de regeringsvorming. Het valt mij op dat er eigenlijk praktisch niets instaat dat belangrijk is voor Vlaanderen. Vandaar mijn vraag, ook aan minister Louis Michel, of er tijdens de regeringsonderhandelingen een geheim akkoord is gesloten in verband met het communautaire. Met andere woorden, het valt mij zodanig op dat er niets instaat dat belangrijk is voor Vlaanderen op dat vlak — naast de verkeersveiligheid dan, wat belangrijk is maar erg weinig — dat ik mij afvraag of er soms een geheim akkoord bestaat op communautair vlak dat gesloten zou zijn tijdens de regeringsonderhandelingen. Ik zou daar graag een duidelijk antwoord op krijgen van Louis Michel. Een ja of een neen op dat vlak zou interessant zijn.

Monsieur le président, mes chers collègues, le législateur en avait déjà tenu compte, puisque depuis1991 — faut-il encore le rappeler! — des ministres fédéraux différents signaient l'octroi des licences en tenant compte des régions de notre pays. Cela a également été rappelé à cette tribune.
Monsieur le président, monsieur le vice-premier ministre, chers collègues, pour conclure — et encore une fois au risque de me répéter —, j'insiste sur le fait que cette régionalisation est plus que justifiée, dans son exposé des motifs, par un souci de cohérence entre l'exportation d'armes et les compétences régionales économiques et d'emploi. Tout le reste, vous le savez, ne relève que de procès d'intention — on vient encore d'entendre un exemple —, d'allégations, d'a priori, en fait, de l'excessif! Et vous le savez, tout ce qui est excessif devient insignifiant!
Car, voyez-vous, en entendant certains de mes collègues pacifistes opportunistes, je pense qu'il serait urgent de légiférer quant à l'exportation, l'importation et le transit des allumettes! Oui, parce que l'utilisation des allumettes provoque des drames, entraîne des conséquences incommensurables! Soyons sérieux! Le monde est une réalité dont on ne peut faire abstraction et, dans cette optique, il n'y a ni gagnant, ni perdant!

Mijnheer de voorzitter, men kan in ons land nooit de toekomst voorzien als men niet het verleden kent.
Op 11 juli 2002, de zevenhonderdste verjaardag van de Guldensporenslag, was er een belangrijke beslissing van het kernkabinet van de paars-groene regering van Verhofstadt I. Toen gaf de regering de toelating voor het leveren van Minimi's aan het regime in Nepal, een regime dat zich achteraf heeft vermomd in een prille democratie. Wij hebben toen veel geleerd over de wijze waarop paars-groen handelde en waarop de onderhandelingen en de beraadslagingen in paars-groen verliepen. Wij hebben toen ook geleerd dat het kernkabinet van paars-groen eigenlijk een duiventil was. Men was er soms bij, maar soms ook niet. Mevrouw Aelvoet liep eens binnen en eens buiten. Op het moment dat de beslissing moest worden genomen, was ze er echter niet. Ze had er nochtans een groot belang bij. De Nepal-crisis van juli, augustus, september 2002 ligt ten grondslag van het zogezegd wettelijk werk dat wij hier vandaag in ogenschouw nemen. Wat is er ondertussen gebeurd? Mevrouw Aelvoet heeft ontslag genomen en de groenen zijn naar aanleiding van het Nepal-dossier — daar ben ik van overtuigd — in de nevelen van de Belgische politieke geschiedenis teruggedrongen. Het Nepal-dossier heeft ervoor gezorgd dat ze hun al geblutste geloofwaardigheid nooit meer hebben kunnen oppoetsen.
De oorverdovende stilte van de sp.a op dat moment en in het bijzonder van fractievoorzitter Van der Maelen doet onze trommelvliezen nog altijd natrillen. Die oorverdovende stilte was natuurlijk ook geïnstrumenteerd door onze huidige collega en toenmalig voorzitter Patrick Janssens die iedereen de opdracht had gegeven, via een schrijven op de website van de sp.a, dat niemand tenzij hijzelf zou communiceren over de problematiek van de wapenleveringen aan Nepal.
Ik herinner mij nog meer — dat zullen wij nooit vergeten — de stroperige interventies van mevrouw Van Weert over de meest moorddadige wapens die in de noordelijke hemisfeer werden gemaakt. Haar koepelvoorzitter, de heer Stevaert, had het nadien over pijlen en bogen, een beetje in de traditie van de Guldensporenslag of de oude Belgen. Mevrouw Van Weert had het over de traditie van de IJzer, nooit meer oorlog, de traditie van het Vlaamse pacifisme, de traditie van het gebroken geweer en het parool over de reconversie van de FN van Herstal. Collega's, mevrouw Van Weert hield een stroperige uiteenzetting tijdens de Nepal-crisis over de problematiek en de moorddadigheid van deze wapens, maar de stroop heeft zich in gelei vermomd tijdens de gesprekken in de Lambermont. Dan heeft mevrouw Van Weert - zij heeft vorige week nog een paar historische woorden uitgesproken — het gehad over de reconversie van de FN van Herstal. Men ging met andere woorden van wapens ploegscharen maken en dat ging gebeuren onder de impuls van mevrouw Van Weert. Dat is natuurlijk allemaal niet gebeurd. Mevrouw Van Weert, dit is voor u een schandalig dossier.
Nu, als het moeilijk gaat, brengt een glijmiddel de believers altijd wat soelaas. Het gaat even moeilijk maar het voelt een beetje aangenamer aan. Het glijmiddel voor de sp.a was de nieuwe wapenwet, de aanpassing van artikel 4 en de fameuze commissie voor de Wapenhandel die in het leven geroepen zou worden. Ik wil toch nog even zeggen dat met de pacifisten van de sp.a in de regering er nog nooit zoveel wapens zijn uitgevoerd sinds 1998. In het jaar 2000 — collega's houdt u goed vast — is de wapenexport zo maar eventjes met 4 miljard Belgische frank toegenomen. Oases van peis en vree: ongeveer 30% werd geleverd aan het Midden-Oosten. Wanneer wij er de wapens bijtellen die aan Indonesië werden geleverd, en aan Noordoost Azië — dat is een omschrijving voor Nepal — komen wij aan 40%.
Wij slaan een stukje over. Dat was het rendez-vous van de sp.a met de geschiedenis. Met de commissie voor de Wapenhandel zou alles worden opgelost en dan kwamen de telegrammen vanuit Lambermont: onderhandelingen Lambermont — stop — Verhofstadt II in steigers — stop — pacifistisch regeerakkoord — stop — pijlen en bogen — stop — FN wordt aan de Walen overgeleverd — stop. Over en uit. Voor de rest hebben wij er niets meer van gehoord. Dat was het resultaat van de aanwezigheid van sp.a en spirit in de regeringsonderhandelingen. Laten wij eerlijk zijn: het gesplitste geweten, dat hebben wij zelf gelanceerd. Ik zie dat het origineel is want een aantal mensen heeft het overgenomen, aan Vlaamse kant maar ook aan Franstalige kant. Dat gesplitste geweten is een aanvaardbaar gegeven. Het geweten is nu gesplitst in een Vlaams geweten en een Waals, Franstalig geweten wanneer het erop aan komt die wapenleveringen goed te keuren.
Zeggen dat de wapenleveringen moesten worden gefederaliseerd of dat de Walen over hun wapens moesten kunnen beslissen omdat het anders tot politieke crisissen had geleid is natuurlijk compleet onjuist. Als dat het geval is, moet in dit land alles geregionaliseerd worden. Onder paars en paars-groen, onder Verhofstadt en in de Lambermont-onderhandelingen is over alles ruziegemaakt: over de sociale zekerheid, over de tewerkstelling, over de pensioenen, over de nachtvluchten, over Kyoto... Dat daar — zoals de minister had gezegd — de reden zou liggen voor het moeten regionaliseren, is natuurlijk niet juist. Dat is geen reden. Dat dit dossier vlugger moest worden gerealiseerd omdat er een akkoord over was — en dat het dus niet naar het forum moest — is natuurlijk een absolute leugen. De enige reden, vredescollega's van sp.a en spirit, is dat er een nieuwe order is voor Minimi's, te leveren aan Nepal door de Fabrique Nationale van Herstal. Dat is de reden waarom er geregionaliseerd moest worden. Het heeft te maken met puur commercieel belang omdat de Fabrique Nationale van Herstal niet overleeft zonder die nieuwe order van Minimi's, te leveren aan Nepal. Dat is de enige reden. Al de rest is larie en apekool.
Deze regionalisering maakt het de regering gemakkelijk. Mijnheer de minister, ik geef het toe. Het maakt het voor uw regering bijzonder gemakkelijk. Ik zou zeggen dat het zeer bijzonder gemakkelijk wordt voor u. Het wordt zo gemakkelijk omdat het nu zo is dat Vlaanderen en de meerderheid van Vlaanderen hun ogen kunnen sluiten voor FN ze opnieuw zal openen.
Bovendien zijn er ethische bezwaren. Ik weet dat ethische politiek voor u een drijfveer was. Het was de ethiek die opnieuw in ons buitenlands beleid moest komen. Ik denk dat de mensen na alles dat gebeurd is reeds lang doorhebben dat de enige ethiek in dit dossier de ethiek is van de harde centen die de Fabrique Nationale in Herstal krijgt.
Er zijn echter ook praktische bezwaren. Ik zou het toch eventjes willen hebben over de praktische bezwaren. Het gaat niet over het intellectuele gehalte van de heren Van Cauwenberghe en Daerden. Ik zou daaraan niet durven te twijfelen. Ik heb minister Daerden hier vaak gezien. Het gaat niet over het intellectuele gehalte van de heer Foret of van de heer Detienne van Ecolo. Deze laatste moet hierover beslissen in de Waalse regering. Ik ben ervan overtuigd dat onze Waalse collega's intellectueel bij machte zijn om in alle onafhankelijkheid te oordelen over de gegrondheid, over de bienfondé van wapenleveringen.
Wat echter wel het geval is, is het feit dat in de meeste federale landen — laten we Duitsland als voorbeeld nemen — wapenleveringen het voorwerp uitmaken van een federale toetsing. Dat is zo omdat wapenleveringen eigenlijk ook een exponent zijn van buitenlands beleid. De wapenexporten zijn immers geen makkie, mijnheer de minister. We hebben dat gezien. Er zijn daarop immers verdragen en reglementen van toepassing. Er zijn ook speciale diensten voor. Mijnheer de voorzitter, collega's, de eerste speciale dienst bevindt zich op het ministerie van Buitenlandse Zaken. Die dienst kan daarover meespreken, want die heeft nogal wat moeten doen om die wapenlevering aan Nepal en de wapenleveringen die nog komen erdoor te jagen. Eigenlijk zijn er dus speciale diensten op het ministerie van Buitenlandse Zaken. Er is ook de Delcrederedienst. Collega Verherstraeten had het hierover ook al. De Delcrederedienst moet de reglementeringen eigenlijk indekken. Die dienst doet zijn werk of probeert toch zijn werk te doen.
Tenslotte is het toch niet zo dat Wallonië een eiland is in de wereld. Het kan ook niet anders, want we willen een ethische politiek voeren. Er zijn ook nog internationale contacten. Mijn vraag is wie u gaat sturen. Wie gaat u naar New York sturen om de onderhandelingen te gaan voeren? Gaat u een Waal sturen? Gaat u een Brusselaar sturen? Gaat u een Vlaming sturen? Zelfs wanneer het geregionaliseerd is, zelfs wanneer het Waalse Parlement hierover beslist, zal u daar niets kunnen gaan doen. Het zullen dus de Walen zijn die zelf hun boetiek gaan verdedigen in het buitenland.
Vrienden, de tweede reden waarom deze wapenleveringen absoluut moesten geregionaliseerd worden is de volgende. Weet u wie er voor 100% aandeelhouder is van de Fabrique Nationale van Herstal? Het is de Waalse regering. De Waalse regering is voor 100% aandeelhouder van de Fabrique Nationale van Herstal. Ze heeft er dus alle belang bij om wapenleveringen goed te keuren en om exportlicenties af te leveren. Dat betekent immers dat ze meer inkomsten in haar kas heeft. Dat is dus de essentie. Dit is een puur geldelijk dossier. Dit is puur een dossier du pognon. Het gaat hier over de fric. Dit heeft niets te maken met grote ethische principes. Het gaat over het geld dat aan de noodlijdende Fabrique Nationale van Herstal moet worden toebedeeld.
Daarin is de overheid geen aandeelhouder, collega Henry.
Ik zou in het kader van het optimisme met enig cynisme in de stem bravo willen zeggen aan de Vlamingen die dit hebben onderhandeld. Bravo aan de Vlamingen van paars-groen en in het bijzonder die van de sp.a en spirit.
Ik heb hier een citaat mee uit Berts dagboek van 22 mei 2003. Bert schrijft in een brief die werd gepost om 15.56 uur: "Ik ben benieuwd". Ik dacht dat hij benieuwd was of hij op 29 juli in de Kamer aanwezig kon zijn, maar dat was het niet. Ik lees verder: "Tot op heden heb ik de VLD enkel horen zeggen dat spirit het wel niet te hard zal spelen, zeker op communautair gebied. Ze vergissen zich, spirit zal het wel hard spelen, niet ten koste van de mensen maar wel in het belang van de mensen". Bravo aan spirit! De Fabrique nationale van Herstal kan wapens uitvoeren zonder controle, de Waalse regering kan participeren zonder controle en u kunt met uw spirit-onderhandelaars fluiten naar het rechtmatige deel dat de Walen moeten participeren in het Kyoto-fonds. Uw minister van Mobiliteit is erin geslaagd de nachtvluchten in het kader van het harde communautaire spel over de Oostrand van Brussel te spreiden. Ik zal het dan nog niet hebben over het verkeersreglement dat u in de doos van de regionalisering van de wapenhandel had geworpen.
Ik denk dat er een kans bestaat dat de minister van Mobiliteit het hard gaat spelen. Hij moet het hard spelen, wil hij zijn dagboek van 22 mei gestand doen. Waarlangs worden de wapens van FN getransporteerd? Ze worden getransporteerd via Zaventem.
Mijnheer Lambert, ik zou u willen voorstellen om minister Anciaux even te bellen in Center Parcs om hem te vragen wanneer de wapens via Antwerpen — tot nader order liggende in Vlaanderen - worden getransporteerd, wanneer de wapens langs Zaventem — tot nader order liggende in Vlaanderen - worden weggevlogen. Zal hij dan zijn volle bevoegdheid van minister van Mobiliteit laten gelden? Zal de Vlaams-nationalist in hem wakker worden? Zal hij de leeuw laten klauwen? Zal hij neen zeggen aan die leveringen? Anciaux zal ja zeggen. U hebt niets gekregen voor de regionalisering van de Fabrique nationale van Herstal. Wij zullen er u altijd aan herinneren.
Collega's, in het kader van het optimisme breng ik nogmaals hulde aan de collega's van de sp.a. Collega Van der Maelen, het moeten voor u moeilijke tijden zijn. Ik zou niet graag mijn vakantie beginnen met het oog van de kenner en de verkenner die gisteren in De Standaard aan het woord was.
Overigens, wij zaten daar voor niets tussen, geloof me. Minister Michel gelooft altijd in een CD&V-complot.Ik weet dat u De Standaard ervan verdenkt een CD&V-gazet te zijn en wij verdenken De Standaard ervan een paarse gazet te zijn. Wat dat betreft, zijn we kiefkief. Collega Van der Maelen, het doet mij pijn dat ik u dit moet zeggen, u heeft in dit dossier geen enkele geloofwaardigheid meer. Ik kan u maar een zaak aanraden - ik zie dat u op de sprekerslijst staat -, en dat is te zwijgen. Wij hebben hier al meneer Lambert op het spreekgestoelte gehad. Het enige wat de sp.a en spirit kan redden in dit dossier is zwijgen in alle talen. Ik zou u willen oproepen om alstublieft te zwijgen. Geef aan uw webmaster van de sp.awebsite alstublieft de opdracht om u bij de figuren van de week te deleten. Het is te pijnlijk. Ik zeg het met echte compassie voor u.
De collega's van spirit wil ik toch nog even herinneren aan de reconversie van de Fabrique Nationale van Herstal. Weet u nog dat u dat heeft gezegd, mevrouw Van Weert? We hadden het erover gisteren: de blauwe wand,.be, flitsend, hyperkinetisch, perscommuniqués, het perscentrum vanuit de Lambermont.
"Ja dames en heren, wij gaan ook nog ervoor zorgen dat de Fabrique Nationale van Herstal wordt gereconverteerd." "U maakt zich dus sterk dat er geen wapens meer zullen worden gefabriceerd bij FN Herstal?" "Inderdaad, mijnheer de ondervrager"
Wat zien wij? Dat ondertussen het perfide spel doorgaat en de Fabrique Nationale van Herstal zonder de minste controle en met aval, mevrouw Van Weert, van u.... U wil weer zo'n beetje de vredesengel spelen, de Scooby Doo van paars, de vredesengel die op vleugeltjes rondvliegt en overal de goede boodschap brengt. Scooby, Scooby Doo I love you, maar ondertussen bent u de meest fantastische gangmaker van de Waalse wapenindustrie.
Weet u hoe uw illustere voorgangers van de Vlaamse beweging dat noemden? Ik zal de woorden van Flor Grammens niet parafraseren, want het begon met kl, maar in elk geval weten de Vlamingen wat jullie zijn, namelijk kazakkenkeerders eerste klas. Ten slotte, de spirit-vleugel gaat door, want er is nieuw nieuws. Het nieuwe nieuws is dat mevrouw Van Weert heeft gezegd: nu gaan we nog veel verder, nu gaan we onze bilaterale verdragen met de Amerikanen opzeggen. Nu is het gedaan. On en a marre, ça suffit, es genügt, over is over, het is gedaan. Ik, Els Van Weert, Scooby Doo, I love you, maar niet de Amerikanen, wij gaan dus al die verdragen die wij met de Amerikanen hebben gemaakt nog een keer opzeggen.
U hebt goede voorbeelden. Er zit er hier een: de vorige en de huidige minister van Buitenlandse Zaken. Die heeft dat ook gedaan. Non, trois fois. Flahaut zei: njet. Toen heeft hij in De Standaard gezegd dat Flahaut een ezel was. Ik roep u op om deze verdragen te respecteren, want als er troepentransporten moeten zijn, niet alleen van de Amerikanen, maar ook van de Nederlanders en de Engelsen, dan denk ik dat het slecht zou zijn — ook voor uw teerbeminde Vlaanderen — dat ze via Frankrijk, Nederland of Luxemburg zouden passeren en, sinds de regionalisering, langs Wallonië. Ik denk dat dit zeer slecht zou zijn voor uw teerbeminde Vlaanderen.
Dames en heren, wij hebben op het einde van deze discussies veel meegemaakt. Wij hebben twee dagen discussie gehad. Wij hebben de schabouwelijke voorstelling gehad van de genocidewet. Ik heb gisteren iets meegemaakt wat ik nog nooit heb meegemaakt: een minister die niet wist wat zij moest antwoorden op de meest fundamentele bezwaren die er waren.
Wij hebben een programmawet meegemaakt waarbij belastingverhogingen aan de bevolking kond worden gedaan alsof het belastingverlagingen zijn. Niemand gelooft dat.
Vandaag, over enkele ogenblikken, moeten wij stemmen over hetgeen wij tot voor kort onmogelijk achtten, met name dat Vlaamsnationalisten zelf het mogelijk zouden maken dat Vlamingen niets meer te zeggen zouden hebben over een Waalse aangelegenheid, die bovendien past in de militaristische traditie die u altijd voor de bevolking hebt verworpen. The earthly silence of the sp.a at that time, and in particular of Fraktions Chairman Van der Maelen, still makes our drumming flies. When we count the weapons that were delivered to Indonesia, and to Northeast Asia — which is a description for Nepal — we get 40%.

With the Committee on Arms Trade, everything would be resolved and then the telegrams from Lambermont came: negotiations Lambermont — stop — Verhofstadt II in hills — stop — pacifist government agreement — stop — arrows and arches — stop — FN is handed over to the Whales — stop. Over and out. For the rest, we have heard nothing about it. This was the result of the presence of sp.a and spirit in government negotiations. The conscience is now divided into a Flemish conscience and a Wallish, French-speaking conscience when it comes to approving those arms deliveries.
To say that weapons supplies should be federalized or that the Whales should be able to decide about their weapons because otherwise it would have led to political crises is, of course, completely wrong. If that is the case, everything in this country must be regionalized. Between purple and purple-green, under Verhofstadt and in the Lambermont negotiations, there has been a dispute about everything: about social security, about employment, about pensions, about night flights, about Kyoto... That there, as the minister had said, the reason for having to be regionalized is, of course, not correct. That is not a reason. That this dossier had to be implemented sooner because there was an agreement — and that it therefore did not have to go to the forum — is, of course, an absolute lie. The only reason, peacekeepers of sp.a and spirit, is that there is a new order for Minimi's, to be delivered to Nepal by the Fabrique Nationale of Herstal. That is why it needs to be regionalized. It has to do with purely commercial interest because the Fabrique Nationale van Herstal does not survive without delivering that new order of Minimi's, to Nepal. That is the only reason. All the rest is larie and apekool.
This regionalization makes it easy for the government. Mr. Minister, I admit it. It makes it ⁇ easy for your government. I would say that it becomes very especially easy for you. It becomes so easy because it is now that Flanders and the majority of Flanders can close their eyes before FN will open them again.
In addition, there are ethical concerns. I know that ethical politics was a driving force for you. It was the ethics that had to come back into our foreign policy. I think the people after all that happened have long known that the only ethics in this file is the ethics of the hard coins that the Fabrique Nationale in Herstal gets.
However, there are also practical objections. I would like to talk a little about the practical objections. It is not about the intellectual content of the gentlemen Van Cauwenberghe and Daerden. I would not dare to doubt that. I have seen Minister Daerden here often. It is not about the intellectual content of Mr. Foret or Mr. Detienne of Ecolo. The latter must decide on this in the Wallonian government. Wallonia is not an island in the world. It cannot be otherwise, because we want to conduct an ethical policy. There are also international contacts. My question is who you are going to send. Who will send you to New York to start negotiations? Are you going to send a Waal? Are you going to send a Brussels? Are you going to send a flame? Even when it is regionalized, even when the Walloon Parliament decides about it, you will be able to do nothing there. So it will be the Whales who will defend their own boutique abroad.

De hoop die u stelt, collega's ter linkerzijde, op de civiele samenleving in Wallonië is volledig ongeloofwaardig. Mijnheer Van der Maelen, u hebt zelf gezegd dat u een oud-strijder van de vredesgedachte bent en van de ontwapening en dat soort zaken. Ik neem aan dat u ofwel bedoelt dat u zoals ik, een oude strijder van de Vlaamse Beweging die nu twee minuten het woord vraagt, een oude strijder bent van de vredesgedachte, ofwel bedoelt u werkelijk dat u een oud-strijder bent, iemand voor wie de strijd afgelopen is, voor wie de strijd definitief afgelopen is. Dat is de les. Ook tegen de heer Lambert zeg ik dat. U ziet de heer Michel en de heer Kubla die hier eenstemmig zitten, niet om de vredesbeweging of de ngo-wereld in Wallonië te stimuleren maar om de economie te stimuleren. Dat is de treurnis van deze oude strijder — niet van deze oud-strijder want ik doe voort — van de Vlaamse Beweging: dat ik het communautaire moment hier — want dat is het toch — afrond met te zeggen: ja, wij hebben aan communautair gehakketak gedaan, zoals u dat dan noemt. Wij hebben dat niet gedaan om economische belangen, ook niet wegens vredesbeweegredenen. Wat de economische belangen betreft, zal ik met de heer Janssens die daar naast u zit graag in september een debat voeren over de vraag of Alcatel in Antwerpen blijft bijvoorbeeld. Want blijkbaar heeft de heer Van der Maelen hier een primeur: Alcatel blijft in Antwerpen en wij gaan de productie van Alcatel in Antwerpen verder beperken. Dat zal mooi nieuws zijn voor Alcatel. Wij zullen dat debat met de heer Janssens voeren in Antwerpen.
Wat wij u verwijten, is dat u à la carte hebt geregionaliseerd terwijl zij hier voortdoen. Zij bezegelen dat, op een rustige manier. Het waren hun laatste eisen in Lambermont. U hebt het niet bestreden, mijnheer Lambert. Aan Lambermont verweten wij, als Vlaamse Beweging, dat daar het laatste middel uit handen werd gegeven in ruil voor de mogelijkheid te regionaliseren. Daar is geregionaliseerd, maar het feit dat Wallonië toen vragende partij was, werd verkwanseld voor een appel en een ei. Het enige wat nog overbleef waren twee voor hen symbooldossiertjes, details als het ware, die bij hen echter hoge passies hebben doen oplaaien, te weten Francorchamps en de wapenwet. Die twee dingen, daarvoor zaten zij op hun knieën. En wat gebeurt er nu? Vlak voor de zomer — iedereen wil met vakantie, iedereen is weg, dat past in de methodiek van de VLD en van de anderen — wordt het Vlaams-nationalisme en het communautaire gehakketak met medewerking van de pers opgeplooid. Zelfs de laatste dossiers waarmee wij nog een communautaire doos hadden kunnen openen geven zij helemaal cadeau. In ruil voor niets meer, gewoonweg omdat de regering voor de vakantie nog twee wetsontwerpjes indient. Dan volgt nog een tirade van de fractieleider van de sp.a die de oppositie interpelleert. En alles is afgelopen.
Wat wij hen verwijten is niet dat zij regionaliseren, maar wel dat zij in een volledige infernale methodiek zijn terechtgekomen met een legitiem machtsspel tussen Franstaligen en Vlamingen. Daar rust geen taboe op. Dat is een legitieme krachtverhouding, een machtsaangelegenheid. Het is geen ethische aangelegenheid en evenmin een gehakketak, maar een confrontatie van belangenverdediging. Die confrontatie van belangenverdediging wordt in de Belgische politiek "getaboeïseerd".
Vlaanderen heeft hier volledig vrije baan gegeven onder leiding van haar regeringspartijen. De Franstaligen zijn zelf zo verstandig en ludiek — ik moet hen feliciteren — dat zij nu zelfs de regionalisering van de verkeersveiligheid als een grote communautaire eis van Vlaanderen voorstellen, terwijl zij dat zelf wilden om van het gezaag over de onbemande camera's af te zijn. Ze deden dat net zoals ze nu van dat gezaag over die wapenhandel en tabaksreclame willen af zijn. In mijn ogen is het dus een Franstalige eis om de verkeersveiligheid te regionaliseren.
Ironisch is dat Stevaert, die hoorde dat Di Rupo graag wil verlost zijn van het Vlaamse gezaag over de onbemande camera's, zal proberen om de regionalisering van het verkeersdossier voor te stellen als een Vlaamse eis zodat die ook nog moet betaald worden, terwijl het een Franstalige eis is.
Die methoden wil ik in alle rust en kalmte naar de oppervlakte brengen, maar ik kreeg Van der Maelen op mijn dak met een of ander moreel praatje, terwijl hij moet optornen tegen de fysieke aanwezigheid van de minister van Economie van het Waalse Gewest. Als lid van de Vlaamse beweging, die blijft strijden, wil ik die methoden onderstrepen.
Mijnheer De Gucht, ik moet erkennen dat wij met de Vlaamse Beweging een absoluut dieptepunt hebben bereikt. De spreekbuis van de Vlaamse Beweging, de heer Lionel Vandenberghe, is getransformeerd in een onderdeel van de meest Belgicistische partij langs Vlaamse kant, namelijk de sp.a. Wij hebben inderdaad een dieptepunt bereikt. Bij de VLD slaapt iedereen en die politieke partij is helemaal gebiologeerd door het uitoefenen van de macht. Op de sp.a moeten wij niet rekenen en op spirit uiteraard evenmin.
Ik herhaal dat wij een dieptepunt bereikten en dat wil ik onderstrepen, net voor de vakantie en voor het allemaal afgelopen is. Er is slechts één hoop, met name dat wij opnieuw wapens in de hand krijgen en dat de Vlaamse Beweging heropleeft. Je voudrais encore préciser, si besoin est, que la loi entrera en vigueur dix jours après sa publication au Moniteur belge. Les dossiers introduits à ce moment seront transmis à la Région compétente en application de l'article 93 de la loi spéciale du 8 août 1980. Un transfert de personnel spécialisé du SPF économie aura éventuellement lieu suivant la procédure prévue à l'article 88 de la loi spéciale et de l'arrêté royal du 25 juillet 1989.
Encore quelques mots d'explication pour éviter tout malentendu. Cela a déjà été dit mais il faut le redire avec force: par transit, il faut entendre le commerce frontalier de biens et de technologies depuis et vers le territoire du Royaume. Il faut entendre en effet par importation, exportation et transit la définition donnée à ces termes par la législation douanière. Cette définition ne s'applique donc pas aux exemples donnés pendant le débat. Il n'y a pas de douane intérieure en Belgique. Une Région ne peut opposer un veto à la décision d'une autre Région. La licence accordée par une Région aura la même valeur qu'une licence accordée par le pouvoir fédéral. En ce qui concerne l'effet territorial de la répartition des compétences, le gouvernement renvoie à la jurisprudence de la Cour d'Arbitrage citée par le Conseil d'État: une licence ne pourra être accordée par une Région qu'à une entreprise qui relève de cette Région; la licence accordée par une Région aura la même valeur qu'une licence accordée aujourd'hui par le pouvoir fédéral. La seule licence accordée par une Région doit donc permettre l'importation, l'exportation et le transit sur l'ensemble du territoire. Par importation, exportation et transit, il faut entendre le commerce transfrontalier depuis et vers le territoire du Royaume. L'existence des règles de l'Union économique et de l'unité monétaire implique au premier chef la libre circulation des marchandises entre les composantes de l'État. Sont incompatibles avec les règles de l'Union économique les mesures prises de manière autonome par une des composantes de l'Union qui entravent la libre circulation.
Il y a aussi eu une question sur le rôle du Ducroire. La compétence d'octroyer des garanties contre les risques à l'importation et l'exportation et à l'investissement n'est pas modifiée par le présent projet et demeure fédérale. Elle a été explicitement confirmée lors de l'adoption de la loi spéciale du 13 juillet 2001 portant transfert de diverses compétences aux Régions et Communautés. Il n'appartient pas à l'Office national du Ducroire, institution fédérale à vocation économique, de vérifier la politique d'une Région par rapport à la législation sur l'importation, l'exportation et le transit. Il n'appartient pas à une institution fédérale d'apprécier la politique des Régions. Cette conception heurte les principes d'autonomie et de responsabilité propres à un système fédéral.
