Monsieur le président, monsieur le ministre, chers collègues, je vais continuer ce rapport en traitant des amendements qui ont été déposés et que j'ai essayé de regrouper par thèmes. Vous ne vous étonnerez pas que ceux-ci recouvrent pour la plupart les points importants par lesquels notre collègue vient de terminer. La première catégorie consiste en un amendement déposé par le Vlaams Blok visant à instaurer un tout nouveau code de citoyenneté. Il s'agit d'un système nouveau de nationalité plutôt qu'un amendement senso stricto au texte proposé. J'invite par conséquent les membres à le consulter dans le rapport. Sans doute le Vlaams Blok aura-t-il en outre l'occasion de l'exposer durant les débats. Une série d'amendements ont été déposés à propos de la possibilité de recourir à d'autres éléments que l'acte de naissance lorsque celui-ci fait défaut. Sur le principe même, certains membres justifient leur amendement tendant à la suppression de cette possibilité par la crainte de voir produire de faux documents ou de faux témoignages lorsqu'il s'agit d'un acte de notoriété. Le gouvernement rappelle que de faux documents ne peuvent produire d'effet et que les instances compétentes devront apprécier la validité des pièces qui leur sont soumises. Plusieurs amendements portent sur la notion de résidence principale, laquelle se retrouve à divers endroits dans les projets qui vous sont soumis. Certains préfèrent la notion de séjour légal de manière ininterrompue, d'autres évoquent la nécessité d'une présence effective à cette résidence principale, tandis que la notion même de résidence principale apparaît floue à d'aucuns. Le gouvernement renvoie à la jurisprudence habituelle sur cette notion connue en droit civil, ainsi qu'à la circulaire du 8 novembre 1991 relative au Code de nationalité. Que ce soit en matière de nationalité ou de naturalisation, la problématique du raccourcissement des délais donnés aux diverses instances - parquets, Office des étrangers, Sûreté de l'Etat - pour émettre un avis a suscité de nombreux amendements. Ceux-ci ont tous pour objet soit de maintenir les délais actuels, soit d'allonger ceux qui sont proposés, ou encore de les adapter progressivement, invoquant comme motif que les délais proposés dans les textes ne permettront pas aux instances de rendre un avis suffisamment informé. En ce qui concerne notamment les services du parquet, le ministre a précisé que le collège des procureurs généraux n'avait pas fait obstacle à la modification proposée. Des amendements concernent également les conditions de fond, soit pour l'acquisition de la nationalité, soit pour la naturalisation. Ainsi en est-il de la durée de résidence nécessaire sur le territoire ou d'une condition d'intégration. L'article 23 actuel a fait l'objet de multiples amendements en suite logique du débat à ce sujet, lors de la discussion générale. Plusieurs souhaits sont émis à propos de cet article 23, notamment et surtout quant à l'élargissement des causes de déchéance. Je citerai en exemples de ces nouvelles causes que l'on voudrait voir intégrées dans le texte, la fraude lors de la procédure, le fait d'être condamné pour des crimes divers, ou simplement de commettre un crime en tant que tel, l'infanticide en raison du sexe de l'enfant et enfin toute la problématique de l'excision. Le gouvernement s'est référé à la définition traditionnelle de la notion de motif grave de ce texte tel qu'il a été appliqué, à l'enseignement de la doctrine ainsi qu'aux travaux préparatoires de la loi de 1934 qui a introduit cet article 23. Un amendement du gouvernement a supprimé les articles prévoyant la gratuité de la procédure: ils faisaient double emploi avec ceux de la loi portant des dispositions fiscales et autres, loi que la Chambre a déjà adoptée. Le débat sur ces articles a donc eu lieu en séance plénière et un extrait du compte rendu analytique est joint au rapport écrit. Je ne voudrais pas terminer mon intervention sans remercier les services de la Chambre dont le concours s'est révélé très précieux dans un débat particulièrement nourri. Je rappelle également à l'assemblée que le projet numéro 292, modifié à la suite de l'adoption des amendements du gouvernement, a été adopté par 10 voix contre 6, et que le projet numéro 293, non amendé, a été adopté par 10 contre 6 et une abstention.

Mr. Speaker, Mr. Minister, dear colleagues, I will continue this report by addressing the amendments that have been submitted and which I have tried to group by themes. You won’t be surprised that these mostly cover the important points our colleague just finished with. The first category consists of an amendment filed by the Vlaams Blok to introduce a completely new code of citizenship. This is a new system of nationality rather than a senso stricto amendment to the proposed text. I therefore invite members to consult it in the report. Unfortunately, the Vlaams Blok will also have the opportunity to expose it during the debates. A number of amendments have been submitted regarding the possibility of using other elements than the birth certificate when it is missing. On the same principle, some members justify their amendment aimed at removing this possibility by the fear of producing false documents or false testimony when it is an act of notoriety. The Government recalls that false documents cannot produce effect and that the competent authorities will have to assess the validity of the documents submitted to them. Several amendments address the concept of primary residence, which is found in various places in the projects submitted to you. Some prefer the notion of legal residence in an uninterrupted manner, others refer to the need for an effective presence at this main residence, while the very notion of main residence appears blurred to some. The Government refers to the usual case-law on this concept known in civil law, as well as to the Circular of 8 November 1991 relating to the Code of Nationality. Whether in matters of nationality or naturalization, the problem of shortening the deadlines given to the various instances - prosecutors, Office of Foreigners, State Security - to issue an opinion has caused many amendments. These are all intended either to maintain the current deadlines, or to extend those proposed, or even to adapt them gradually, citing as a reason that the deadlines proposed in the texts will not allow the instances to give a sufficiently informed opinion. Regarding, in particular, the prosecutor’s services, the minister clarified that the college of prosecutors did not prevent the proposed amendment. Amendments also concern the substantive conditions, either for the acquisition of nationality or for naturalization. This is the case for the necessary duration of residence in the territory or a condition for integration. The current article 23 has been the subject of multiple amendments following the logical debate on this subject, during the general discussion. Several wishes are issued regarding this article 23, in particular and especially with regard to the expansion of the causes of default. I will cite examples of these new causes that we would like to see incorporated into the text, fraud during the procedure, being convicted for various crimes, or simply to commit a crime as such, infanticide due to the sex of the child and finally the entire problem of excision. The government referred to the traditional definition of the notion of serious reason in this text as it was applied, to the teaching of doctrine as well as to the preparatory work of the Act of 1934 which introduced this article 23. A government amendment removed the articles providing for the free of charge of the procedure: they used double with those of the law on tax and other provisions, a law that the House has already adopted. The discussion on these articles was therefore held in plenary session and an excerpt of the analytical report is attached to the written report. I would not like to finish my speech without thanking the services of the House whose contribution proved very valuable in a ⁇ nourished debate. I also remind the assembly that Bill No. 292, amended as a result of the adoption of the Government amendments, was adopted by 10 votes against 6, and that Bill No. 293, not amended, was adopted by 10 against 6 and one abstention.

Mijnheer de voorzitter, mijnheer de minister, collega's, in de eerste plaats dank ik de rapporteurs voor het correcte verslag van onze uitvoerige besprekingen. De besprekingen zijn, wat onze fractie betreft, begonnen met een prognose over het verloop van de debatten. Ik herinner me de toelichting van de minister van Justitie in de commissie voor de Justitie, waarin ook de spoedbehandeling voor deze ontwerpen was gevraagd. Namens onze fractie trachtte ik te peilen naar de manier waarop de meerderheid het debat zou voeren. Ik ben een beetje in de huid gekropen van de mensen die vanuit de meerderheid dit ontwerp steunen. Ik heb mijn vermoeden geuit dat men instructies had gekregen om op een zo kort mogelijke tijd, met zo weinig mogelijk debat, deze ontwerpen af te werken, goed beseffende dat het slechte ontwerpen zijn. Men moet een regeerakkoord nu eenmaal uitvoeren. De inzet van de ontwerpen is niettemin zeer fundamenteel. Het gaat om de vraag hoe men aan een verdraagzame, veilige samenleving bouwt. Toch is het debat een dovemansgesprek geworden. Wij moesten naar de televisie kijken of naar de radio luisteren om de gemoedsgesteldheid van de meerderheidspartijen te kennen en deze vervolgens ter sprake te brengen in de commissie, waar de meerderheid niet heeft gesproken. Eigenlijk was de inzet niet meer de vraag hoe mensen zich kunnen integreren in de samenleving, onder meer door het bevorderen van de nationaliteitsverwerving. Wij zijn ervan overtuigd dat men in de plaats van een goede wet goed te keuren, men enkel loyaal het regeerakkoord dat met weinig dossierkennis werd afgesloten, wou uitvoeren. Wij hebben de indruk dat sommigen denken op die manier goed parlementair werk af te leveren en dat zij niet op de kern van de zaak moeten ingaan. Dat heeft ons erg teleurgesteld. Voor ons zijn deze ontwerpen een verkeerd signaal. Mensen moeten geen inspanning meer doen om in deze samenleving te integreren. De ontwerpen zijn een bedreiging voor onze veiligheid, ze zullen aanleiding geven tot een onbeheersbare migratiestroom en ze werken de politisering van de nationaliteitsverwerving in de hand. Wij zijn ervan overtuigd dat we inderdaad voor een verdraagzame samenleving moeten pleiten. De overheid moet mensen die hier duurzaam verblijven uitnodigen om zich te integreren. De overheid moet hiervoor kansen creëren. Zij moet die boodschap van verdraagzaamheid brengen, maar ze moet ook uitnodigen om zich te integreren, om een van de landstalen te leren, om te participeren aan de lokale samenleving. Dat is onze christen-democratische overtuiging. Vanuit die overtuiging zijn we ook in vorige discussies over deze wetgeving vertrokken. We hebben toen getracht een bredere toegang tot de nationaliteit te creëren, maar altijd vanuit de opvatting dat de integratiebereidheid het fundament moet zijn. Daarin staan we niet alleen. Al onze buurlanden vinden dat men een signaal moet geven dat men zich wil integreren. In onze nationaliteitswetgeving zat een grote logica: naarmate er meer redelijke aanduidingen waren die erop wezen dat iemand bereid was zich te integreren, kon de betrokkene meer en meer het recht laten gelden op de verwerving van de Belgische nationaliteit. Onze nationaliteitswetgeving vormt dus een brede basis voor migranten van de tweede en derde generatie, waardoor zij inderdaad het recht op de Belgische nationaliteit krijgen via de verklaring of de nationaliteitskeuze. Naarmate die aanwijzingen minder en minder evident zijn, minder en minder voor de hand liggen, moet degene die de Belgische nationaliteit wil verwerven zich in extremis richten tot het Belgische Parlement. Dat kan bij wijze van gunst inderdaad de nationaliteit toekennen aan degenen die hier vijf jaar hun hoofdverblijfplaats hebben en die bereid zijn zich hier te integreren. Deze mensen moeten hiervan actief het bewijs leveren. Ik herhaal dat dit geen ketterij of een ondemocratisch standpunt is. Dit is het standpunt dat alle ons omringende landen altijd hebben ingenomen. Dat is het standpunt van de Fransen, van de Duitsers en ook van paars in Nederland. Als men een inburgeringsverplichting organiseert zoals in Nederland, moet men natuurlijk consequent zijn in de nationaliteitswetgeving en daarin dezelfde signalen uitzenden, met dezelfde elementen. Als men het zeer moeilijk vindt om het begrip integratie te definiëren, verwijs ik ernaar dat al die landen vanuit dezelfde opvatting vertrekken. De Nederlanders hebben daarover heel mooie nota's gemaakt, die trouwens uitvoerig door de heer Van Peel werden toegelicht in de commissie. Dit om maar te zeggen dat dit geen argument is. De praktijk wijst op het tegendeel. Er is een kritiek op het begrip integratiebereidheid die terecht vanuit verschillende hoeken werd geformuleerd. Het is geen nieuwe kritiek, het gaat erover dat het onderzoek op het terrein door de politiemensen in het kader van de huidige naturalisatiewetgeving gebreken vertoont. Het onderzoek verloopt niet op alle plaatsen op dezelfde manier, sommige vragen zijn potsierlijk en de kwaliteit van het onderzoek is niet overal dezelfde. Die kritiek heeft ons ertoe gebracht de wet te wijzigen onder de vorige legislatuur. Dit gebeurde op verzoek van, alleszins, de christen-democraten. Nu bevat de wet een artikel waardoor de minister van Justitie de politiemensen dwingende richtlijnen kan geven over de manier waarop het onderzoek naar de integratiebereidheid moet worden uitgevoerd. Dat artikel is in werking getreden op 1 september 1999. Wij verkeerden in de naïeve veronderstelling dat wij via de commissie voor de naturalisaties, via het parlement, via het college van procureurs-generaal, via het Centrum voor gelijke kansen en racismebestrijding en via universitair wetenschappelijk onderzoek ertoe zouden komen dat eens goed af te wegen, de vragenlijst correct op te stellen, de mensen vorming te geven en ervoor te zorgen dat ook de juiste, relevante onderzoeken zouden gebeuren. In de plaats van die weg te bewandelen, in de plaats van de geboden kansen in de wetgeving ter hand te nemen, schiet men met een kanon op een mug en wordt heel de wetgeving overgedaan. Ik hoorde in het verslag door Agalev-Ecolo nog pleiten voor het voortzetten van de strijd voor het gemeentelijk stemrecht. Iedereen in dit halfrond is er toch wel van overtuigd dat die strijd niet meer hoeft te worden gevoerd. Wij zijn al vier stappen verder als deze ontwerpen worden goedgekeurd. Collega's, er was tijdens de vorige legislatuur een eenparige houding van alle democratische partijen. Ik zeg dit nog eens met nadruk, omdat sommigen zich angstvallig verschuilen en doen alsof dit niet zo was. Angstvallig wordt vermeden daarvan ook maar enig element in de media te brengen. Tijdens de vorige legislatuur was er een eenparige houding van de democratische partijen inzake het begrip van integratiebereidheid. En de socialisten, én de groenen, én de liberalen, al degenen die voor de democratische partijen in de commissie voor de naturalisaties zetelden, hebben de richtlijnen en de rechtspraak van deze commissie opnieuw bevestigd in deze legislatuur. Zij hebben die onderschreven. Toen u op het einde van vorig jaar werd uitgenodigd om te stemmen over de voorstellen van de commissie voor de naturalisaties, dus over verwerping of aanvaarding van naturalisatiedossiers, hebt u allen consequent deze rechtspraak toegepast. Over die rechtspraak zijn wij het altijd eens geweest in de commissie, over de partijgrenzen heen. Steeds werd de naturalisatieaanvraag geweigerd van wie deelnemen aan extremistische bewegingen. Wij weigerden de aanvraag tot naturalisatie, omdat zij strijdig was met de wil tot integratie. Dit kan nu niet meer. Bepaalde buitenlandse studenten hebben de toelating gekregen om in België te komen studeren. Zij hebben een verblijfsvergunning bekomen, waarbij uitdrukkelijk als voorwaarde werd gesteld dat België hiermee de ontwikkeling van het land van herkomst wou ondersteunen, met dien verstande dat degene die hier kwam studeren, nadien zou terugkeren naar het eigen land om daar de opgedane kennis ten dienste te stellen van de lokale gemeenschap. Deze studenten konden de Belgische nationaliteit niet bekomen, want hierdoor zou hun land van herkomst niet meer kunnen genieten van de in hen gedane investering. Collega's, dit kan nu niet meer. Wij weigerden de Belgische nationaliteit toe te kennen aan diegenen van wie het verblijf beperkt was tot de duur van de opdracht, zoals het geval is voor diplomaten of het personeel van ambassades. Dit zou namelijk in strijd zijn geweest met het begrip integratiebereid. Collega's, ook dit kan nu niet meer. Diegenen die hier drie jaar verblijven, ook al zijn zij in dienst op een buitenlandse ambassade, zullen de Belgische nationaliteit kunnen verkrijgen. Wij weigerden de Belgische nationaliteit toe te kennen aan diegenen waarvan de aanvraag verschillende keren werd verdaagd, zonder dat een verbetering van de wil tot integratie werd waargenomen. Collega's, ik vertolk hier geen christen-democratisch standpunt, het was het standpunt van de commissie. De commissie heeft, met de gebrekkige middelen waarover zij vaak beschikte, dossiers uitgesteld of verdaagd. Zij heeft mensen een tweede kans gegeven, waarbij zij werden aangemaand een inspanning te doen om één van de beide landstalen te leren, de verbintenis aan te gaan om op dat vlak enige verbetering te laten merken. Kortom, de commissie heeft nooit op radicale wijze, noch abrupt, noch kortzichtig of op basis van één element een aanvraag verworpen. Wij hebben angstvallig erover gewaakt een aanvraag slechts te verdagen, als daarvoor een geldige reden was. De betrokkene werd behoedzaam uitgelegd dat er vele wegen voor hem openstonden, maar dat hij ook zelf een positief signaal moest uitzenden. De commissie was het er unaniem over eens dat aanvragen zouden worden verdaagd, wanneer het dossier verscheidene concrete gegevens bevatte op grond waarvan kon worden getwijfeld aan de reële integratiebereidheid van de verzoeker. Het ging onder meer, en ik citeer letterlijk uit het door de commissie gemeenschappelijk ingenomen standpunt: ...een onvoldoende kennis van één van de beide landstalen, weinig of geen contact met Belgische onderdanen, gebrek aan belangstelling voor de aanvraag, het verkrijgen van sociale uitkeringen als eerste beweegreden . Nogmaals, dit was geen christen-democratisch standpunt, maar een standpunt dat unaniem werd ingenomen door de commissie. Collega's, ik zou nog een lange lijst kunnen voorlezen van afspraken die wij hebben gemaakt en die er enerzijds toe hebben geleid vele aanvragen gunstig te beoordelen en hier aan de voltallige vergadering voor te leggen. Anderzijds hebben wij ook een verdaging van een aantal dossiers voorgesteld. De minister van Justitie en de Diensten voor naturalisaties zijn zo vriendelijk geweest om ons hierover tijdens de bespreking van het wetsontwerp cijfermateriaal ter beschikking te stellen. De minister-president in het Vlaamse Parlement en de voorzitter van de VLD hebben ooit gezegd dat de Kamer, bij de behandeling van de naturalisatie-dossiers, slechts als een brievenbus fungeerde. De naturalisatieprocedure in het parlement zou slechts theorie en fictie geweest zijn. Collega's, ongeveer 25% van de aanvragen werd minstens één keer verdaagd en van die 25% zijn er 40% tot 45% verdaagd wegens een gebrek aan integratiebereidheid van de betrokkene. Nogmaals, niet de christen-democratische leden, maar de meerderheid van de commissie heeft 40% tot 45% van de aanvragen tot naturalisatie verdaagd, omwille van een gebrek tot integratiebereidheid, gesteund op elementen uit het dossier. Op basis van deze zelfde gebrekkige integratiewil, hebben wij 5% tot 15% van de aanvragen verworpen. Men moet dus niet beweren dat de huidige praktijk de rol van het parlement reduceert tot die van een brievenbus. De cijfers spreken dit tegen. Toen de vorige wetswijziging werd goedgekeurd, gebeurde dat met medewerking van de PRL en de SP en met grote tegenstand van de VLD. Als jong, beginnend parlementslid heb ik vaak het vermanende vingertje van fractieleider Dewael moeten aanschouwen als er een groot communautair akkoord werd gesloten. Hij probeerde op het gemoed van de christen-democraten te werken door te zeggen dat hij het laf vond dat wij, niettegenstaande het feit dat wij ertegen gekant waren, een wet toch goedkeurden. Collega's, ik kom nu tot het verkiezingsprogramma van de VLD en haar standpunt bij het bespreken van deze wetsontwerpen in de vorige zittingsperiode. Collega Coveliers verkondigde toen in de Senaat dat de integratiebereidheid moest worden aangetoond aan de hand van de arbeidsbereidheid, de kennis van de landstalen en het inzicht in de democratische rechten en vrijheden. Hij zei, ik citeer: Deze toevoegingen aan de wet zijn zo evident dat de Senaat zal inzien dat ze nodig zijn voor een harmonieuze en niet-discriminatoire samenleving. We gaan evenwel totaal de andere weg op. Ik heb de indruk dat de missie van de VLD-fractie er niet meer in bestaat een goede wet te maken, maar wel, zonder nadenken, een slecht akkoord door het parlement te laten goedkeuren. De genese van de nieuwe wet is een voorbeeld van de manier waarop de besluitvorming in ons Belgisch politiek bestel met deze meerderheid verloopt. Er was eerst een voorontwerp van de regering, dat inhield dat de Kamer niet meer moest oordelen over een naturalisatie als het parket een positief advies had gegeven. Ze moest de naturalisatie dan ambtshalve toestaan. Hoewel wij vanop deze tribune hadden gewaarschuwd voor dit denkspoor, dat tegen de Grondwet ingaat, heeft men moeten wachten op het advies van de Raad van State om de bevestiging daarvan te hebben. Ik moet glimlachen als men nu aanvoert dat de bespreking van de naturalisatieprocedure het prerogatief van het parlement is en niet van de regering. In haar eerste ontwerp had de regering immers aangegeven dat het parlement geen keuze meer had. Het moest de naturalisaties toestaan als het parket een positief advies uitbracht. Nadat het eerste ontwerp werd afgekeurd door de Raad van State, kwam er een tweede ontwerp tot stand. Dat maakte van de verklaring en de naturalisatie een gelijkwaardige procedure. Ook toen heeft de Raad van State te kennen gegeven dat een onderscheid moet worden gemaakt tussen het verkrijgen van de Belgische nationaliteit via een subjectief recht en via de naturalisatieprocedure. Toen kwam uiteindelijk het derde ontwerp tot stand. De huidige tekst heeft helemaal niet meer de draagwijdte van datgene wat in de tekst van het regeerakkoord was opgenomen. Afgezien van de positie van de Vlamingen in Brussel, heb ik vier punten van inhoudelijke kritiek op dit ontwerp. Ten eerste, geeft het een verkeerd signaal. Ten tweede, het vormt een aanslag op de veiligheid in ons land. Ten derde, het opent de deur voor een migratiestroom waarop we geen zicht hebben. Ten vierde, het is een nieuwe politisering van de verwerving van de nationaliteit. Het is een verkeerd signaal omdat het parlement aan de kandidaat-Belgen nu zegt dat zij geen inspanning hoeven te leveren om zich te integreren, dat zij de landstalen niet moeten leren en niet moeten proberen deel te nemen aan de lokale samenleving. Zij krijgen de Belgische nationaliteit als zij een aantal jaren verblijf in ons land kunnen aantonen. Wij zijn verontwaardigd over het ontwerp omdat het haaks staat op onze opvatting over integratiebeleid. Een integratiebeleid moet vertrekken vanuit de opvatting dat de overheid kansen moet creëren en moet uitnodigen om te participeren. De overheid moet echter ook een signaal geven dat mensen aanmoedigt om op die kansen in te gaan. Het signaal dat we thans geven is dat verbondenheid en samenhorigheid in de lokale samenleving niet meer belangrijk zijn. Men krijgt de nationaliteit nadat men een aantal jaren hier in ons land verblijft. Daarmee zou alle discriminatie verdwijnen. Ik gaf het voorbeeld van de nationaliteitsverklaring. Als deze Kamer, ingevolge deze wet, de naturalisatie toestaat, kunnen meerderjarige kinderen uit het buitenland, die nog nooit in ons land geweest zijn, zich naar de hoofdplaats in ons land verplaatsen. Ze hebben het recht tot toegang in ons land op basis van de wet die de toegang van vreemdelingen op het grondgebied regelt. Deze wet bepaalt uitdrukkelijk dat iedereen die, via de verklaring, recht heeft op de nationaliteit, de toegang tot ons grondgebied verwerft. In Brussel dienen ze de aanvraag in en de nationaliteit kan hen niet worden geweigerd tenzij het parket binnen een maand kan vernemen dat ze in het buitenland een strafrechtelijk verleden hebben. Zij verwerven de Belgische nationaliteit samen met hun minderjarige kinderen die onder hun hoede zijn. Ze verlaten het grondgebied, reizen door Europa, keren terug naar het moederland en beschikken over twee nationaliteiten. Dat is het signaal van samenhorigheid en verbondenheid dat wij met deze wet aan de migranten geven. Het is mijn overtuiging dat deze wet het onbegrip, de onverdraagzaamheid en de verharding van de standpunten in de hand zal werken en een zeer pervers effect zal hebben op de gehele integratiepolitiek die men via de Gemeenschappen wil laten uitvoeren. Het is een signaal dat de tegenovergestelde richting uitgaat. Het is een kaakslag voor de politiemensen en integratiewerkers die hun werk op het terrein correct uitvoeren, die willen pleiten voor verdraagzaamheid en aanmoedigen tot participatie. Zij willen mensen aanzetten om deel te nemen aan de samenleving. Zij willen de vrouwen die, vanuit hun eigen cultuur, moeten thuisblijven uit hun isolement halen. Welnu, als wetgever geven wij hen precies het tegenovergestelde signaal. De manoeuvres van de liberalen voor het wegvallen van de integratiebereidheid en het organiseren van het onweerlegbaar vermoeden dat wie de aanvraag doet en bereid is zich te integreren, zijn verbazingwekkend geweest. Eerst zei de heer Coveliers dat artikel 23 zou toelaten om achteraf, als men de nationaliteit had toegekend, hierop terug te komen. Dit is natuurlijk onmogelijk met dat artikel. Dat zorgde voor heel wat commotie. Als ik het goed begrepen heb liet de heer Somers van de liberalen zich op een bepaald moment ontvallen dat hij het bijzonder moeilijk zou hebben om deze ontwerpen goed te keuren als dàt niet de interpretatie zou zijn van artikel 23. De voorzitter van de liberalen zei dat dit absoluut niet de interpretatie kan zijn van dit artikel. De nationaliteit kan niet ontnomen worden aan iemand die later zou tonen niet tot integratie bereid te zijn. De heer De Gucht verklaarde in het programma De Zevende Dag dat we andere methoden moesten vinden om mensen aan te zetten om zich te integreren. Toen ging het over de sociale zekerheid. Ik werd sprakeloos, want geen haar op ons hoofd dat eraan dacht om het in die richting te gaan zoeken. Er werd gesproken over negatieve incentives. Er werd gezegd dat degenen die de taal niet leerden, daartoe via de sociale zekerheid op een of andere manier zouden worden aangezet. Een paar jaren geleden heeft de heer De Gucht een artikel geschreven waarin hij na een geleerde uitleg tot de conclusie komt dat het in strijd is met een resem verdragen om iemand die de Belgische nationaliteit heeft verworven maar niet de streektaal wil leren, te straffen door zijn sociale zekerheidsuitkeringen te verminderen of op te heffen. De Gucht schrijft, ik citeer: Vreemdelingen dwingen zich in te burgeren door te dreigen hun sociale uitkeringen te verminderen of af te nemen als ze de streektaal niet kennen, is als methode onaanvaardbaar. Belangrijke mensenrechten komen in het gedrang . Er stond nog meer in het artikel van de heer De Gucht. Voor De Gucht staat het als een paal boven water dat een incentive om mensen aan te moedigen zich in te burgeren onder meer door de streektaal te leren alleen mogelijk is vóór de toekenning van de nationaliteit. Alhoewel het opleggen van de streektaal voor de verwerving van de Belgische nationaliteit volgens internationale normen niet verboden is, is het geheel anders gesteld met dezelfde eis voor de genaturaliseerde vreemdelingen. Diverse mensenrechtenverdragen en algemene principes tonen aan dat een dergelijke handelwijze niet aanvaardbaar is. Voor de heer De Gucht was het op dat ogenblik overduidelijk dat de federale overheid slechts incentives kon uitwerken om mensen in te burgeren vóór ze de Belgische nationaliteit toekent. Als vreemdelingen de Belgische nationaliteit hebben verworven, kan de overheid geen incentives meer geven omdat dit discriminatoir is en in strijd met een aantal verdragen. Mijnheer de voorzitter, mijnheer de minister, collega's, het verhaal wordt nog potsierlijker. Men wil de gemeenschappen de inburgering laten organiseren. Men verwijst opnieuw naar Nederland. Om die vergelijking door te trekken zou de Vlaamse Gemeenschap 1 miljard frank moeten vrijmaken om inburgeringsprojecten op te zetten. Als deze projecten effectief worden opgestart, is dit een grote stap voorwaarts. We zijn echter lang niet zo ver. De Vlamingen moeten de alarmklok luiden. Op het ogenblik dat de Vlaamse Gemeenschap gigantische inspanningen wil doen inzake inburgeringsprojecten, doet de federale overheid met haar wetsontwerpen inzake de nationaliteitsverwerving het tegenovergestelde en geeft ze een teken dat het allemaal niet hoeft. Collega's, een dergelijk beleid is inconsistent. Bovendien beklemtoon ik dat de inburgering in Nederland wel degelijk verplicht is voor de nationaliteitsverwerving. Het is, mijns inziens, volkomen onlogisch de wil tot inburgering en de nationaliteitsverwerving van elkaar te scheiden. Wie de verklaring tekent, zal door de nieuwe wet geacht worden bereid te zijn zich te integreren. De meerderheid voegt eraan toe dat de aanvrager de rechten van de mens moet respecteren. In België is het Verdrag van de rechten van de mens reeds lang wet. Inhoudelijkjuridisch vult de nieuwe tekst de bestaande verklaring niet aan. Degenen die binnenkort de verklaring zullen ondertekenen, zullen het onweerlegbaar vermoeden hebben gegeven dat ze integratiebereid zijn, ook al verblijven ze slechts een paar weken in ons land en zullen ze onmiddellijk na de verwerving van de Belgische nationaliteit opnieuw vertrekken. Degenen die dezelfde verklaring hebben getekend voor de aanvragen die wij vorige maand behandelden, zijn pechvogels. De meerderheid heeft vorige maand immers beslist dat ondanks de verklaring er wel redenen waren om te twijfelen aan de integratiebereidheid, zodat de nationaliteitsverwerving werd geweigerd. De praktijk wijst uit dat de ondertekening van de verklaring absoluut niet betekent dat men bereid is zich in ons land te integreren. Mijn tweede kritiek gaat over de migratiestromen. Iemand die Belg wordt in dit land, zal aan zijn meerderjarige kinderen in het buitenland kunnen meedelen dat ook zij recht hebben op de nationaliteit. Zij krijgen het recht om zich in België te komen vestigen. Zij krijgen het recht op de Belgische nationaliteit en daarmee ook hun minderjarige kinderen. Dit gecombineerd met een zeer slecht sluitende controle op het strafrechtelijk verleden van de betrokkenen, creëert een enorm risico op een onbekende migratiestroom. Daarvan zal men later vaststellen dat deze niet plaatsvindt via de wet die de toegang van de vreemdelingen tot het grondgebied regelt, maar via de nationaliteitswetgeving. Mijn derde voorwerp van kritiek, en voor onze fractie de meest fundamentele, betreft het veiligheidsrisico dat met deze nieuwe wet ontstaat. Ik wil dit opnieuw beklemtonen omdat het anders in de beeldvorming verloren zal gaan. Uiteraard zijn de meeste mensen die de nationaliteit aanvragen, correct en integer en integreren zij zich behoorlijk. Daarover is geen discussie. Indien u echter een wetgeving wilt invoeren, dan moet ze wel sluitend zijn. De wet moet elk risico dat de veiligheid van de burgers in het gedrang brengt, vermijden of op zijn minst zo klein mogelijk maken. Daar staan wij voor een compleet raadsel. Immers, het ontwerp van de regering stelt voor de adviestermijnen voor de diensten Bestuur van de Veiligheid van de Staat, Vreemdelingenzaken en het openbaar ministerie tot een maand te verkorten, terwijl iedereen weet dat dit in veel gevallen een risico is en gewoon niet haalbaar zal zijn. U kunt in het parlement van mening verschillen over integratie en de positie van Justitie, maar u kunt toch niet tegen het licht van de zon in bepaalde standpunten blijven volhouden. We zijn bijzonder ontgoocheld omdat nu ook de minister van Binnenlandse Zaken aan zijn collega van Justitie laat weten dat de dienst Vreemdelingenzaken dit advies niet op een maand kan geven zonder een grote reorganisatie die nog moet beginnen. Deze reorganisatie zal ook nooit beginnen voordat de wet in werking treedt. De reorganisatie is nodig om het überhaupt denkbaar te maken dat we dat misschien zouden kunnen. De minister voegt er in een brief aan toe dat dit een substantiële toename van de middelen voorziet. Deze middelen zijn er momenteel niet. Als een collega uit de regering dit schrijft en dan zegt dat er geen probleem is en dat we de termijn zullen halen, dan is er een einde gekomen aan dialoog en overreding. Dat zijn twee collega's uit dezelfde regering die elkaar volledig tegenspreken.

Mr. Speaker, Mr. Minister, colleagues, first of all, I thank the rapporteurs for the correct report of our extensive discussions. The discussions, as far as our group is concerned, have begun with a forecast on the course of the debates. I remember the explanation of the Minister of Justice in the Committee on Justice, which also called for the urgent treatment of these drafts. On behalf of our group, I sought to measure how the majority would conduct the debate. I am slightly crushed in the skin of the people who support this design from the majority. I have expressed my suspicion that one had been instructed to finish these designs in the shortest possible time, with as little debate as possible, well aware that they are bad designs. A government agreement must be implemented. However, the implementation of the designs is very fundamental. It is about how to build a tolerant, safe society. Nevertheless, the debate has become a deceitful conversation. We had to watch television or listen to radio to know the mood of the majority parties and then bring them to the committee, where the majority has not spoken. In fact, the commitment was no longer the question of how people can integrate into society, including by promoting the acquisition of nationality. We are convinced that instead of approving a good law, one would only loyally implement the government agreement that was concluded with little knowledge of the dossier. We have the impression that some think in this way to do good parliamentary work and that they should not go into the core of the matter. This has very disappointed us. For us, these designs are a wrong signal. People should no longer make an effort to integrate into this society. The designs are a threat to our security, they will give rise to an uncontrollable migratory flow and they work the politization of nationality acquisition in the hand. We are convinced that we must indeed advocate for a tolerant society. The government must invite people who reside here permanently to integrate. Government must create opportunities for this. It must bring that message of tolerance, but it must also invite to integrate, to learn one of the national languages, to participate in the local society. That is our Christian democratic belief. From this belief we have also left in previous discussions on this legislation. We then sought to create a broader access to nationality, but always from the view that integration readiness should be the foundation. In this we are not alone. All our neighbors believe that one must give a signal that one wants to integrate. In our nationality legislation there was a great logic: as there were more reasonable indications indicating that someone was willing to integrate, the person concerned could more and more apply the right to acquire the Belgian nationality. Our nationality legislation thus forms a broad basis for migrants of the second and third generations, which indeed gives them the right to Belgian nationality through the declaration or the choice of nationality. As these indications are less and less obvious, less and less obvious, the person who wishes to acquire the Belgian nationality must address the Belgian Parliament in extremis. This can indeed, in a way of favour, grant citizenship to those who have had their main place of residence here for five years and who are willing to integrate here. These people must actively provide proof of this. I repeat that this is not heresy or an undemocratic position. This is the position that all the countries around us have always taken. This is the position of the French, of the Germans and also of purple in the Netherlands. If one organizes a citizenship obligation as in the Netherlands, one must of course be consistent in the nationality legislation and in it send the same signals, with the same elements. If one finds it very difficult to define the concept of integration, I point out that all those countries are based on the same viewpoint. The Dutch have made very good notes on this subject, which, by the way, were thoroughly explained by Mr. Van Peel in the committee. This is to say that this is not an argument. Practice shows the opposite. There is a criticism of the concept of integration readiness that was correctly formulated from different angles. It is not a new criticism, it is about the fact that the investigation on the ground by police officers shows flaws within the framework of the current naturalization legislation. The investigation does not proceed in the same way in all places, some questions are potsier and the quality of the investigation is not the same everywhere. That criticism has led us to amend the law during the previous legislature. This was done at the request of the Christian Democrats. Now the law contains an article allowing the Minister of Justice to give the police officers compelling directives on how the integration readiness investigation should be carried out. That article entered into force on 1 September 1999. We were in the naïve assumption that through the Committee on Naturalizations, through the Parliament, through the College of Attorneys-General, through the Centre for Equal Opportunities and Anti-Racism and through university scientific research we would attain that one time to properly weigh, correctly formulate the questionnaire, educate the people and ensure that the appropriate, relevant investigations were also conducted. Instead of walking that path, instead of taking in hand the opportunities provided in the legislation, one shoots with a cannon on a mosquito and the entire legislation is passed. I heard in the report by Agalev-Ecolo still advocating for the continuation of the struggle for municipal voting rights. Everyone in this hemisphere is convinced that this struggle no longer needs to be fought. We are already four steps further when these designs are approved. During the previous legislature, there was a unanimous stance of all democratic parties. I say this again with emphasis, because some are hiding fearfully and pretending that this was not the case. Furiously, it is also avoided to bring any element into the media. During the previous legislature, there was a unanimity of the democratic parties on the concept of integration readiness. And the socialists, and the Greens, and the liberals, all those who sat for the democratic parties in the naturalization committee, have reaffirmed the guidelines and jurisprudence of this committee in this legislature. They have signed them. When you were invited at the end of last year to vote on the proposals of the naturalization committee, i.e. on the rejection or acceptance of naturalization dossiers, you have all consistently applied this jurisprudence. We have always agreed on this judicial practice in the committee, beyond the party boundaries. Naturalization applications have been rejected from those who participate in extremist movements. We rejected the application for naturalization because it was contrary to the will for integration. This can no longer be done. Some foreign students have been admitted to study in Belgium. They obtained a residence permit, explicitly conditioning that Belgium would support the development of the country of origin, with the meaning that the person who came to study here would then return to their own country to place the knowledge acquired there at the service of the local community. These students could not obtain the Belgian nationality, as this would prevent their country of origin from enjoying the investment made in them. Dear colleagues, this is no longer possible. We refused to grant Belgian citizenship to those whose residence was limited to the duration of the assignment, as is the case for diplomats or the staff of embassies. This would have been contrary to the concept of integration ready. Colleagues, this cannot be done anymore. Those who stay here for three years, even if they are employed at a foreign embassy, will be able to obtain the Belgian citizenship. We refused to grant Belgian citizenship to those whose application was repeatedly challenged, without noticing an improvement in the will to integrate. Colleagues, I did not interpret a Christian-Democratic standpoint here, it was the standpoint of the committee. The committee, with the insufficient resources which it often had at its disposal, delayed or suspected files. It has given people a second chance, in which they were encouraged to make an effort to learn one of the two national languages, to undertake the commitment to see some improvement in that area. In short, the committee has never rejected an application in a radical way, either abruptly, short-sightedly or on the basis of one element. We fearfully watched to challenge a request only if there was a valid reason for it. The person concerned was carefully explained that there were many roads open for him, but that he himself also had to send a positive signal. The committee unanimously agreed that applications would be suspected if the file contained several concrete data which could give rise to doubts about the applicant’s actual readiness to integrate. It included, and I quote literally from the position commonly adopted by the committee: ... an insufficient knowledge of one of the two national languages, little or no contact with Belgian nationals, lack of interest in the application, obtaining social benefits as the first motive . Again, this was not a Christian-Democratic position, but a position unanimously taken by the committee. Colleagues, I could still read a long list of agreements that we have made and which, on the one hand, have led to favorably assessing many applications and presenting them here to the plenary meeting. On the other hand, we also proposed a questioning of several dossiers. The Minister of Justice and the Services for Naturalizations have been so kind to provide us with numerical material on this subject during the discussion of the bill. The Prime Minister-President in the Flemish Parliament and the Chairman of the VLD have once said that the Chamber, when dealing with the naturalization files, only acted as a mailbox. The naturalization procedure in parliament would have been only theory and fiction. Colleagues, approximately 25% of the applications were contested at least once and of those 25% 40% to 45% were contested due to a lack of integration readiness of the person concerned. Again, not the Christian Democratic members, but the majority of the committee has denounced 40% to 45% of applications for naturalization, because of a lack of integration readiness, supported by elements from the file. Based on this same flawed integration will, we have rejected 5% to 15% of applications. It should therefore not be argued that the current practice reduces the role of parliament to that of a mailbox. The figures contradict this. When the previous legislative amendment was approved, it happened with the cooperation of the PRL and the SP and with great opposition from the VLD. As a young, beginner parliamentary member, I have often had to see the encouraging finger of group leader Dewael when a major community agreement was concluded. He tried to work on the spirit of the Christian Democrats by saying that he found it cowardly that, despite the fact that we were opposed to it, we still passed a law. Colleagues, I now come to the electoral program of the VLD and its position when discussing these bills in the previous parliamentary period. Collega Coveliers then proclaimed in the Senate that integration readiness should be demonstrated by means of working readiness, knowledge of the national languages and understanding of democratic rights and freedoms. He said, I quote: These additions to the law are so obvious that the Senate will realize that they are necessary for a harmonious and non-discriminatory society. However, we are going completely the other way. I have the impression that the mission of the VLD group is no longer to make a good law, but rather, without thinking, to get a bad agreement approved by the parliament. The genesis of the new law is an example of how decision-making in our Belgian political system proceeds with this majority. There was first a government’s preliminary draft, which included that the Chamber should no longer judge about naturalization if the parliament had given a positive advice. She had to allow naturalization by office. Although we had warned from this tribune of this thought track, which goes against the Constitution, one has had to wait for the opinion of the Council of State to have its confirmation. I must smile when people now argue that the discussion of the naturalization procedure is the prerogative of the parliament and not of the government. In its first draft, the government had indicated that Parliament had no choice anymore. It had to allow the naturalizations if the parquet gave a positive advice. After the first draft was rejected by the State Council, a second draft was created. This made declaration and naturalization an equivalent procedure. Also at that time, the Council of State stated that a distinction should be made between obtaining Belgian nationality through a subjective right and through the naturalisation procedure. Eventually, the third project came into being. The current text has no longer the scope of what was included in the text of the government agreement. Apart from the position of the Flamings in Brussels, I have four points of substantial criticism of this draft. First, it gives a wrong signal. Second, it represents an attack on the security of our country. Third, it opens the door to a migration stream that we have no sight of. Fourth, it is a new politicization of the acquisition of nationality. It is a false signal because the Parliament now tells the candidate-Belgium that they do not need to make an effort to integrate, that they should not learn the national languages and should not try to participate in the local society. They get Belgian citizenship if they can prove a number of years of residence in our country. We are angry at the draft because it contradicts our view of integration policy. An integration policy should start from the notion that the government must create opportunities and invite to participate. However, the government must also give a signal that encourages people to take advantage of those opportunities. The signal we are giving now is that connectivity and cohesion in the local society are no longer important. Citizenship is granted after a few years of residence in our country. This would eliminate all discrimination. I gave the example of the declaration of nationality. If this Chamber, under this law, permits naturalization, adult children from abroad, who have never been in our country, may move to the headquarters in our country. They have the right to enter our country on the basis of the law governing the entry of foreigners into the territory. This law expressly stipulates that anyone who, through the declaration, has the right to the nationality, acquires access to our territory. In Brussels they submit the application and their nationality cannot be denied unless the prosecutor can find out within one month that they have a criminal history abroad. They acquire Belgian nationality together with their underage children who are under their custody. They leave the territory, travel through Europe, return to their homeland and have two nationalities. That is the signal of cohesion and connection that we give to the migrants with this law. It is my conviction that this law will work hand in hand with the incomprehension, intolerance and hardening of the views and will have a very perverse effect on the entire integration policy that one wishes to implement through the Communities. It is a signal that the opposite direction is going out. It is a blow to the policemen and integration workers who perform their work on the ground correctly, who want to advocate tolerance and encourage participation. They want to encourage people to participate in society. They want to get the women who, from their own culture, have to stay home out of their isolation. Well, as legislators, we give them exactly the opposite signal. The liberals’ manoeuvres to break away from integration readiness and organize the irrefutable suspicion that whoever makes the application and is willing to integrate has been astonishing. First, Mr. Coveliers said that Article 23 would allow to return to it afterwards, if one had granted citizenship. This is not possible with this article. This caused a lot of commotion. If I have understood it correctly, Mr. Somers of the Liberals has at some point forgotten that it would be ⁇ difficult for him to approve these drafts if that was not the interpretation of Article 23. The chairman of the liberals said that this can absolutely not be the interpretation of this article. Citizenship cannot be deprived of a person who would later demonstrate unwillingness to integrate. Mr. De Gucht stated in the Seventh Day program that we must find other methods to encourage people to integrate. Then it was about social security. I became speechless, because no hair on our head thought to go looking for it in that direction. We talked about negative incentives. It was said that those who did not learn the language would be encouraged to do so through social security in some way. A few years ago, Mr. De Gucht wrote an article in which he concluded, after a learned explanation, that it is contrary to a resem treaty to punish a person who has acquired the Belgian nationality but does not want to learn the regional language by reducing or lifting his social security benefits. The Gucht writes, I quote: Foreigners forcing themselves to become citizens by threatening to reduce or reduce their social benefits if they do not know the regional language is unacceptable as a method. Important human rights are threatened. There was more in the article of Mr. De Gucht. For De Gucht it stands like a pillar above water that an incentive to encourage people to become citizens, including by learning the regional language, is only possible before the granting of nationality. Although the imposition of the regional language for the acquisition of the Belgian nationality according to international standards is not prohibited, it is set entirely differently with the same requirement for the naturalized foreigners. Various human rights conventions and general principles show that such practices are unacceptable. For Mr De Gucht it was clear at that time that the federal government could only develop incentives to citizenship people before granting the Belgian nationality. If foreigners have acquired Belgian citizenship, the government can no longer give incentives because this is discriminatory and in violation of a number of conventions. Mr. Speaker, Mr. Minister, Ladies and Gentlemen, the story is becoming even more complicated. They want communities to organize citizenship. We refer again to the Netherlands. In de brief schrijft de heer De Lentdecker dat hij kan bevestigen dat over de noodzakelijke middelen nog informatie dient te worden ingewonnen bij de verschillende parketten van de procureur des Konings. Dit betekent dat de informatie, waaruit moet blijken welke supplementaire middelen moeten worden ingezet om de termijn van een maand te kunnen waarmaken, nog niet beschikbaar is. Monsieur le président, monsieur le ministre, chers collègues, nous sommes aujourd'hui réunis en séance plénière pour discuter d'un projet de loi modifiant le code de la nationalité, un peu plus d'un an seulement après la loi du 22 décembre 1998 qui modifiait déjà ledit code, publiée en mars dernier et qui entrait en vigueur le 1er jour du sixième mois suivant celui de la publication, soit le 1er septembre 1999, c'est-à-dire voici moins de six mois. Je vous rappelle que ce texte avait fait l'objet d'un large consensus au-delà des partis de la majorité de l'époque. Etant donné que l'on n'a pas laissé, ou pas voulu laisser le temps à cette législation de démontrer, le cas échéant, son efficacité, j'imagine que, en l'absence de toute évaluation en la matière, le projet de loi déposé par la nouvelle majorité doit s'expliquer par d'autres raisons. Celles-ci me paraissent claires. Une d'entre elles me vient plus particulièrement à l'esprit: le projet de loi résulte d'un compromis regrettable dans lequel Ecolo et le PS ont renoncé à octroyer le droit de vote aux étrangers non européens pour les communales de 2006, question qui était pourtant un des fers de lance programmatiques de ces partis - prérogative de la citoyenneté au profit de l'acquisition très simplifiée de la nationalité, dont l'objectif est pourtant totalement différent. En contrepartie, les libéraux obtiennent, non seulement l'enterrement de la question du droit de vote des non européens, mais aussi et surtout - car les deux sujets ont été liés, même s'ils n'ont pas de lien intrinsèque - l'adoption d'un projet de loi instaurant dans notre pays une procédure accélérée, avec arrestation en vue de comparution, procédure dont tout laisse à penser qu'elle ne sera pas applicable sur le terrain et constituera sans doute une autre mesure sans effet. Tout d'abord, au niveau de la méthode, le troc entre ces différentes questions -droit de vote des étrangers, naturalisation et procédure accélérée - est clairement apparu dans les propos virils tenus récemment par le VLD devant la presse, voici plusieurs semaines, et aussi, dans deux des points mis à l'ordre du jour de la commission de la Justice. On se rend compte qu'un certain nombre de tractations politiques cachées ont imposé un agenda, et donc, l'organisation hâtive d'un débat, insupportable, qui en arrive, malgré toutes les critiques et les craintes que nous avons émises en ce qui concerne les délais, à un projet de loi dont nous devons discuter dans la précipitation, sans avoir mené les concertations nécessaires, sans avoir recueilli les avis suffisamment éclairés sur la faisabilité des dispositions. Selon moi, ce n'est pas de cette fac¸on que l'on gère la problématique de la nationalité, suffisamment importante pour que le parlement puisse lui accorder un minimum de temps. Je voudrais cibler rapidement les deux principaux effets pervers du projet: d'abord, l'abandon du droit de vote pour les étrangers non européens et ensuite, le fait de galvauder, en quelque sorte, une notion aussi essentielle que celle de la nationalité. En ce qui concerne l'abandon du droit de vote, je rappelle que l'article 8 de la Constitution dont déjà, l'adoption n'avait pas été aisée, prévoit que le droit de vote des citoyens de l'Union européenne n'ayant pas la nationalité belge, peut être étendu par la loi aux résidents en Belgique qui ne sont pas ressortissants d'un Etat mem- bre de l'Union, étant entendu que cette loi ne pouvait être applicable qu'après le 1er janvier 2001. Etant donné les débats passionnés qui ont eu lieu sous la précédente législature et les prises de position progressistes des uns et des autres en la matière, je m'attendais légitimement, ainsi que mon parti, à ce que la nouvelle majorité se mette d'accord sur le principe de cette loi, que, par ailleurs, deux des trois familles politiques souhaitaient. Mais il n'en fut rien. Dans l'accord gouvernemental du 7 juillet dernier, rien n'apparaît sur le droit de vote des étrangers non européens: le gouvernement a clairement privilégié l'acquisition de la nationalité belge comme facteur d'intégration dans notre société et a estimé que des modifications considérables seraient apportées à notre code de nationalité afin de favoriser une telle intégration. Comme en témoigne le projet qui nous est proposé, le nouveau gouvernement a donc fait un choix entre citoyenneté et nationalité. Il a opté clairement et exclusivement pour un système de nationalité ou de nationalisation des personnes en vue de leur intégration. Je tiens tout d'abord à dire que le PSC restera cohérent par rapport à son programme et qu'il ne renoncera pas. Il continuera à plaider - il le fera activement - l'idée selon laquelle il faut pouvoir octroyer le droit de vote, aux élections communales, aux étrangers non européens à condition qu'ils résident depuis cinq ans au moins en Belgique et qu'ils aient effectué une démarche volontaire auprès de la commune. C'est une question de citoyenneté et non de nationalité. L'un n'exclut pas l'autre et les deux doivent être abordés en même temps. Comme le disaient certains partenaires dans leur programme, il faut découpler la nationalité de la citoyenneté. La question centrale qui se pose - nous n'avons pas pu la poser avec la sérénité voulue lors des débats bâclés en commission - est la place que l'on accorde aux individus dans notre pays sans qu'il doivent nécessairement être belges. Comme l'a dit un professeur de l'UCL, M. Michel Molitor, La citoyenneté, c'est le droit à l'appartenance. A cette appartenance sont liés un certain nombre de devoirs, mais aussi de droits et de bénéfices. Si la démocratie repose sur la responsabilité des citoyens d'un pays, c'est la citoyenneté qui leur confère l'appartenance qui leur permet de se sentir responsables de ce pays. Une fois de plus, nous avons galvaudé ce débat. Dès lors, nous ne pouvons pas cautionner une approche selon laquelle l'octroi du droit de vote aux étrangers non européens, qui n'était pas possible pour ces élections communales, ne le soit pas non plus pour 2006. Comme je le constatais il y a près de six mois en réaction à la déclaration gouvernementale, la voie que la majorité ouvre vers le XXIème siècle risque dès lors de n'être ouverte qu'aux Belges. Je constate également que Ecolo en est réduit à devoir timidement demander que cette problématique soit mise à l'ordre du jour de la commission parlementaire pour le renouveau politique, c'est-à-dire peut-être jamais. C'est là un des premiers effets pervers du compromis. Le deuxième effet pervers est que, dès lors que la majorité essaye de tout faire passer par la nationalité, on en arrive à un galvaudage d'une notion aussi essentielle. Si nous partageons l'objectif général du projet de loi qui vise à renforcer la gratuité - bien que nous soulignions le risque de discrimination par rapport à d'autres procédures tout aussi légitimes qui sont par contre coûteuses -, si nous partageons l'idée qu'il fallait accélérer la procédure, faciliter l'acquisition de la nationalité pour les étrangers qui résident chez nous depuis un certain temps et s'il fallait - elle a été interprétée de manière trop arbitraire supprimer la notion de volonté d'intégration, nous regrettons que l'on simplifie tellement la procédure d'acquisition de la nationalité belge que celle-ci tend à devenir une simple formalité totalement dénaturée. Dans ce texte, elle est dénaturée pour trois raisons. Tout d'abord parce que les délais prévus pour l'avis du parquet, de l'office des étrangers et de la sécurité - bien que sur ce point ils ne soient même plus prévus explicitement alors que nous pensons qu'ils doivent l'être et nous avons déposé un amendement dans ce sens - sont impraticables. Nous l'avions souligné, ainsi que nos partenaires du CVP, en commission. Il nous avait été répondu que tout allait bien, qu'il n'y avait aucun problème. Je rappelle cependant que dans la lettre qu'il avait adressée à M. Verwilghen, M. Duquesne expliquait que, dans le cadre de la restructuration des services des étrangers - ce qui est loin d'être le cas -, il ferait son possible pour tenir compte des délais. Cela ne nous donne aucune assurance sur ce point. Par ailleurs, un fait nouveau vient de se produire. Les réponses du parquet sont claires: sans personnel supplémentaire, ils sont dans l'incapacité, notamment à Bruxelles où un tiers des demandes de naturalisation risquent de se produire, de donner leur avis dans un délai d'un mois. Pour assurer une gestion au moins praticable des délais, nous redéposerons nos amendements pour que les délais actuels soient maintenus. Il n'y a pas urgence au point de ne pas pouvoir attendre 4 mois ou 2 mois selon les cas. Il est tout à fait absurde, alors que des avis de ce type n'ont pu être rendus dans un délai raisonnable, d'imaginer qu'on puisse donner des avis sur des faits graves dans le délai d'un mois. Sur ce point, si on continue dans cette optique, non seulement on rend les choses impraticables et on ne se contente pas de galvauder la notion de nationalité, mais on galvaude également la notion d'avis qui, immanquablement, ne pourra être rendu dans les délais et de manière pertinente. Nous vous demandons, monsieur le ministre, de bien vouloir écouter l'opposition sur ce point. Elle essaie de travailler de manière constructive. Dans ce sens, elle a déposé des amendements très raisonnables en matière de délais. Je vous rappelle que des cadres manquent dans l'arrondissement judiciaire de Bruxelles, notamment au sein du parquet, pour des raisons linguistiques. Pourtant, il faudrait que ces cadres soient remplis de toute urgence. Si ce n'est pas le cas et si, en plus, on leur impose des charges déraisonnables, je ne vois pas comment le parquet de Bruxelles pourra fonctionner correctement; chacun connaît la situation difficile dans laquelle il se trouve. J'en viens à ma deuxième critique et donc à la deuxième dénaturation. Après une durée de résidence de trois ans seulement, durée qui n'est pas nécessairement continue et qui peut être formelle, on pourra accéder à la nationalité belge. Nous avions déjà déposé un amendement subsidiaire pour introduire la notion de continuité mais il n'a pas été rencontré. Pourtant, il nous semble réellement que ce délai de trois ans est trop court pour donner l'accès sans autre critère à la nationalité. L'idée du délai actuel de cinq ans est largement approuvée par l'ensemble des partis. On a évoqué cette problématique dans le cadre de la régularisation et dans celui de la durée de résidence pour l'octroi du droit de vote aux non européens. Je répète donc qu'un délai minimal de cinq ans eût été préférable. En effet, il s'agit non seulement d'une durée qui est plus communément admise mais qui caractérise également une attache plus durable avec le pays, ce d'autant plus que le critère d'intégration est supprimé. Etant donné que c'était le seul critère qui restait déterminant, trois ans nous semble être une durée trop courte. J'arrive à la troisième critique de dénaturation. La majorité persiste à vouloir diminuer les délais sans s'assurer de manière générale que les durées de séjour exigées soient suffisamment effectives. Nous avons élaboré une proposition. Suivant cette dernière, on revient à une définition antérieure qui, juridiquement, tient la route. Elle pourrait donc être rencontrée. Si ce n'est pas le cas, nous risquons d'être confrontés à des durées uniquement formelles. A cet abandon du droit de vote des étrangers non européens, à cette dénaturation de la nationalité s'ajoute un effet d'annonce. On crée l'illusion qu'on va régler le problème de la difficulté de produire un acte de naissance. En effet, si on prévoit une possibilité de suppléer à un acte de naissance dans le cadre des procédures d'obtention de la nationalité par un document diplomatique ou consulaire équivalent ou encore par un acte de notoriété délivré par le juge de paix et homologué par le tribunal, encore faut-il que cette disposition ne soit pas privée d'effet par une formulation trop stricte comme c'est le cas dans le projet. Nous avions donc proposé une amélioration du texte mais nous n'avons pas été suivis dans ce sens. C'est pourquoi je crains que nous aurons à faire face à des interprétations trop restrictives qui ne contribueront pas nécessairement à améliorer la situation alors que tel était le but de ce projet. Je voudrais encore insister sur un point. La naturalisation est de la compétence de la Chambre des représentants mais puisque l'article constitutionnel n'est pas soumis à révision, un débat à ce sujet n'a pu avoir lieu. Cependant, nous voudrions insister sur les risques du caractère vraiment arbitraire et donc politique de l'octroi de la nationalité par une commission parlementaire qui, désormais, ne se verra plus imposer aucun autre critère d'appréciation que les siens. Ces derniers ne seront régulés par aucune législation et une simple durée de séjour pourra suffir pour octroyer la nationalité. Si nous devions nous diriger vers une réforme de la nationalité, il eût été sans doute opportun de trouver d'autres mécanismes décisionnels que celui-là. En effet, sans autre règle ou critère, nous risquons d'être à nouveau confrontés à la politisation ou à l'arbitraire, organisé par une commission parlementaire. Ce n'est sans doute pas là le moyen le plus sain pour une démocratie. Je voudrais évoquer encore deux risques d'effets pervers qui me semblent être importants. Tout d'abord, si on augmente la possibilité, après trois ans de séjour non continu dans notre pays, d'obtenir la nationalité, nous risquons d'avoir un effet pervers en amont dans la mesure où les différents services chargés de délivrer les autorisations de séjour risquent de mener une politique beaucoup plus frileuse sachant que l'on peut accéder à la nationalité après une durée de séjour assez courte. C'est un risque et un effet pervers que nous ne pouvons pas négliger, d'autant plus que tout le monde n'adhérera peut-être pas, au niveau des services, à l'esprit de cette loi. Il existe un deuxième effet pervers qui n'a pas été suffisamment discuté en commission, je veux parler de la complémentarité avec l'article 23 du Code de la nationalité qui permet la déchéance. Si d'un côté, vous permettez d'accéder à la nationalité sans condition d'intégration - et sur ce point nous sommes d'accord - il n'en demeure pas moins que l'article 23 - certains ont déjà évoqué le spectre de son utilisation excessive - interprété comme la jurisprudence le précise, dit bien que le manquement grave au devoir du citoyen belge doit révéler que l'intéressé ne manifeste pas l'attachement requis au pays. Que représente cet attachement requis au pays? Sans avoir aménagé l'article 23, ne risque-t-on de reprendre d'une main ce qu'on aura donné de l'autre? Ce serait terriblement délicat parce qu'on agirait après avoir accordé la nationalité, ce qui serait contraire au principe de l'égalité des Belges devant la loi. On risque de revenir avec des notions d'attachement requis telle que la jurisprudence l'écrit actuellement alors qu'on aura supprimé la condition d'intégration en amont. Je pense qu'il existe des incompatibilités sur ce point, qu'on aura un effet pervers en aval dû à une utilisation excessive de l'article. Certains partenaires de la majorité l'ont déjà évoqué et je crois qu'ils y seront sensibles. En conclusion, si le projet du gouvernement contient des aspects positifs que nous avons cités, nous ne partageons pas un compromis qui fait primer une logique sur une autre alors que les deux doivent coexister, un compromis qui donne de fausses assurances aux uns, une nationalité vidée de son sens et laisse faussement croire aux autres qu'une nationalité plus facile à obtenir servira la citoyenneté. Je répète le risque d'effet pervers de l'utilisation de l'article 23. Par ailleurs, je pense qu'il faut être raisonnable et responsable et qu'en tout cas, en ce qui concerne les délais, il est indispensable qu'au vu des éléments nouveaux, nous puissions amender ce texte en séance plénière et en revenir sur ce point aux amendements que nous avions proposés. Ils ne sont pas excessifs, ce sont les délais actuels et je ne pense pas qu'ils soient contraires à la bonne administration de la problématique de la nationalité.

Mr. Speaker, Mr. Minister, dear colleagues, today we have gathered in a plenary session to discuss a bill amending the code of citizenship, a little more than a year only after the law of 22 December 1998 that already amended the said code, published last March and which came into force on the 1st day of the sixth month following that of publication, that is, on 1 September 1999, that is, less than six months ago. I remind you that this text had been the subject of broad consensus beyond the parties of the majority of the time. Since this legislation has not been allowed, or has not wanted to give time to demonstrate, if necessary, its effectiveness, I imagine that, in the absence of any assessment in this matter, the bill submitted by the new majority must be explained by other reasons. These seem clear to me. One of them comes to my mind more ⁇ : the bill results from a regrettable compromise in which Ecolo and the PS renounced to grant the right to vote to non-European foreigners for the 2006 municipal elections, which was, however, one of the programmatic threads of these parties - the prerogative of citizenship in favor of the very simplified acquisition of citizenship, whose objective is however totally different. In exchange, the liberals obtain, not only the burial of the issue of the voting right of non-Europeans, but also and above all - because the two subjects have been linked, even if they do not have an intrinsic connection - the adoption of a bill establishing in our country an accelerated procedure, with arrest for appearance, a procedure of which all leaves to think that it will not be applicable on the ground and will probably constitute another measure without effect. First of all, at the level of the method, the exchange between these different issues – foreign voting rights, naturalization and accelerated procedure – has clearly appeared in the masculine remarks held recently by the VLD before the press, here several weeks ago, and also, in two of the points put on the agenda of the Justice Commission. We realize that a number of hidden political negotiations have imposed an agenda, and therefore, the hasty organization of an unbearable debate, which comes, despite all the criticisms and fears that we have issued regarding the deadlines, to a bill we must discuss in the rush, without having conducted the necessary consultations, without having gathered sufficiently informed opinions on the feasibility of the provisions. In my opinion, it is not in this way that the problem of nationality is dealt with, sufficiently important for parliament to give it a minimum of time. I would like to quickly target the two main perverse effects of the project: first, the abandonment of the voting right for non-European foreigners and then, in some way, the fact of galvanizing a notion as essential as that of nationality. As regards the abandonment of the right to vote, I recall that Article 8 of the Constitution, which already, adoption was not easy, provides that the right to vote of the citizens of the European Union not having the Belgian nationality, can be extended by law to residents in Belgium who are not nationals of a Member State of the Union, understood that this law could not be applicable until after 1 January 2001. Given the enthusiastic debates that took place during the previous legislature and the progressive positions taken by one and another in the matter, I legitimately expected, as well as my party, that the new majority would agree on the principle of this law, which, besides, two of the three political families wanted. But it was nothing. In the government agreement of July 7, nothing appears on the right to vote of non-European foreigners: the government clearly favoured the acquisition of Belgian citizenship as a factor of integration into our society and considered that considerable changes would be made to our code of citizenship in order to promote such integration. As evidenced by the proposed project, the new government has thus made a choice between citizenship and nationality. He has clearly and exclusively opted for a system of nationality or nationalization of persons for their integration. First of all, I would like to say that the PSC will remain consistent with its program and will not give up. He will continue to advocate – he will actively do so – the idea that it is necessary to be able to grant the right to vote, in municipal elections, to non-European foreigners provided that they have resided in Belgium for at least five years and that they have carried out a voluntary approach to the municipality. It is a matter of citizenship, not of nationality. One does not exclude the other and both must be addressed at the same time. As said by some partners in their program, citizenship must be separated from citizenship. The central question that arises – we have not been able to ask it with the desired serenity during the chaotic discussions in committees – is the place that is granted to individuals in our country without necessarily being Belgians. As said by a professor of UCL, Mr. Michel Molitor, Citizenship is the right to belonging. With this belonging are connected a number of duties, but also rights and benefits. If democracy is based on the responsibility of the citizens of a country, it is citizenship that gives them the belonging that allows them to feel responsible for that country. Again, this debate has been carried out. Therefore, we cannot endorse an approach according to which the granting of voting rights to non-European foreigners, which was not possible for these local elections, is also not possible for 2006. As I observed almost six months ago in response to the government declaration, the path that the majority opens towards the 21st century risks therefore to be open only to the Belgians. I also find that Ecolo is reduced to having to timidly ask that this problem be put on the agenda of the parliamentary committee for political renewal, that is, ⁇ never. This is one of the first perverse effects of the compromise. The second perverse effect is that, as soon as the majority tries to make everything pass through nationality, one comes to a galvaudage of such an essential notion. If we share the overall objective of the bill aiming to strengthen the gratuity – although we highlighted the risk of discrimination against other equally legitimate procedures that are, on the other hand, costly – if we share the idea that the procedure should be accelerated, facilitated the acquisition of citizenship for foreigners who have resided with us for a certain time and if it should be – it has been interpreted too arbitrarily to remove the notion of will to integrate, we regret that the procedure for acquiring Belgian citizenship is so simplified that it tends to become a mere completely distorted formality. In this text, it is misrepresented for three reasons. First of all because the deadlines for the opinion of the Prosecutor’s Office, the Office of Foreigners and Security – although at this point they are no longer even explicitly provided while we think they should be and we have submitted an amendment in this direction – are impractical. We have noted this, as well as our partners of the CVP, in the committee. We were told that everything was okay, that there was no problem. In the letter he sent to Mr. In the meantime, Mr. Duquesne explained that, as part of the restructuring of the services of foreigners – which is far from the case – he would do his best to take into account the deadlines. This does not give us any assurance on this point. However, a new fact has just occurred. The prosecutor’s answers are clear: without additional staff, they are unable, ⁇ in Brussels where a third of naturalization applications are likely to occur, to give their opinion within a month. To ensure at least practicable time management, we will resubmit our amendments so that the current time limits are ⁇ ined. There is no urgency to the point of not being able to wait 4 months or 2 months depending on the case. It is quite absurd, although such opinions could not be delivered within a reasonable time, to imagine that one could give opinions on serious facts within a month. On this point, if we continue in this perspective, not only do we make things impractical and we do not merely galvaud the notion of nationality, but we also galvaud the notion of opinion which, inevitably, will not be able to be delivered in time and in a relevant manner. We ask you, Mr. Minister, to listen to the opposition on this point. They try to work constructively. In this regard, it has submitted very reasonable amendments regarding deadlines. I remind you that cadres are lacking in the judicial district of Brussels, especially within the prosecutor’s office, for linguistic reasons. However, these frameworks should be filled up urgently. If this is not the case, and if, in addition, they are imposed unreasonable charges, I do not see how the Brussels Prosecutor’s Office will be able to function properly; everyone knows the difficult situation in which they find themselves. I come to my second criticism and therefore to the second denaturation. After a residence period of only three years, which is not necessarily continuous and may be formal, one can access the Belgian citizenship. We had already submitted a subsidiary amendment to introduce the notion of continuity but it was not met. Nevertheless, it really seems to us that this three-year period is too short to give access to citizenship without any other criteria. The idea of the current five-year deadline is widely endorsed by all parties. This problem has been discussed in the context of the regularization and in that of the duration of residence for the granting of voting rights to non-Europeans. Therefore I repeat that a minimum period of five years would have been preferable. Indeed, this is not only a longer period that is more commonly accepted but also characterizes a more lasting bond with the country, especially as the integration criterion is removed. Since this was the only criterion that remained decisive, three years seems to us to be too short. I come to the third criticism of denaturation. The majority persists in wanting to shorten the deadlines without generally ensuring that the required durations of stay are sufficiently effective. We have made a proposal. Following this latter, we return to an earlier definition that, legally, holds the road. It could be met. If this is not the case, we risk being faced with only formal durations. To this abandonment of the right to vote of non-European foreigners, to this denaturation of nationality is added an announcement effect. It creates the illusion that we will solve the problem of the difficulty of producing a birth certificate. Indeed, if a possibility is provided to supplement a birth certificate in the framework of procedures for obtaining citizenship by an equivalent diplomatic or consular document or by an act of notoriety issued by the peace judge and approved by the court, it is still necessary that this provision is not deprived of effect by a too strict formulation as is the case in the draft. So we had proposed an improvement of the text but we were not followed in this direction. That is why I fear that we will face too restrictive interpretations that will not necessarily contribute to improving the situation while that was the purpose of this project. I would like to insist on one point. Naturalization is within the competence of the House of Representatives, but since the constitutional article is not subject to revision, a debate on this subject could not take place. However, we would like to emphasize the risks of the truly arbitrary and therefore political character of the granting of citizenship by a parliamentary committee which, from now on, will no longer be imposed on any other criteria of assessment than its own. The latter will not be regulated by any legislation and a mere period of stay may be sufficient to grant citizenship. If we were to move towards a nationality reform, it would ⁇ have been appropriate to find other decision-making mechanisms than that. Indeed, without another rule or criterion, we risk being again confronted with politization or arbitrary, organized by a parliamentary committee. This is probably not the healthiest way for a democracy. I would like to mention two more risks of perverse effects that I think are important. First, if we increase the possibility, after three years of non-continuous stay in our country, of obtaining citizenship, we risk having an upward perverse effect in so far as the different services responsible for issuing the residence permits are likely to pursue a much more frileous policy given that one can access citizenship after a rather short period of stay. This is a risk and a perverse effect that we cannot neglect, especially since everyone may not adhere, at the level of services, to the spirit of this law. There is a second perverse effect that has not been sufficiently discussed in the committee, I mean talking about complementarity with Article 23 of the Code of Citizenship that allows discharge. If, on the one hand, you allow access to citizenship without a condition of integration - and on this point we agree - there is no less than Article 23 - some have already mentioned the spectrum of its excessive use - interpreted as the case-law specifies, says well that the serious breach of duty of the Belgian citizen must reveal that the interested party does not manifest the required attachment to the country. What is this attachment required to the country? Without having drawn up Article 23, is it not possible to take back from one hand what has been given from the other? This would be terribly delicate because one would act after granting citizenship, which would be contrary to the principle of equality of Belgians before the law. There is a risk of returning with required attachment notions as the case-law currently writes, while the condition of upward integration has been removed. I think there are incompatibilities on this point, that we will have a perverse effect downstream due to excessive use of the article. Some partners of the majority have already mentioned this and I believe they will be sensitive to it. In conclusion, if the government project contains the positive aspects that we have cited, we do not share a compromise that preempts one logic over another while both must coexist, a compromise that gives false assurances to some, a nationality empty of its meaning and makes others false to believe that a nationality easier to obtain will serve citizenship. I repeat the risk of perverse effect from the use of Article 23. Furthermore, I think that we must be reasonable and accountable and that in any case, as regards the deadlines, it is indispensable that in the light of new elements, we can amend this text in plenary session and return on this point to the amendments we had proposed. They are not excessive, they are the current deadlines and I do not think they are contrary to the proper administration of the problem of nationality.

Mijnheer de voorzitter, mijnheer de minister, collega's, in 1998 hebt u, mijnheer de minister, op een onbewaakt moment van grootmoedigheid voormalig eerste minister Dehaene vastgebeiteld in de galerij der groten. U zult het zich nog herinneren. Het gebeurt zelden dat een politicus van de ene partij met het wierookvat zwaait naar een politicus van een andere partij, maar ik denk dat er vandaag andermaal zo'n moment is aangebroken. Wanneer ik vandaag bij de groenen was, of als ik vandaag een Franstalige was, dan zou ik uitgebreid de loftrompet schallen over deze Marc Verwilghen, want zeer zeldzaam zijn de politici die zich op een dergelijke manier verloochenen en die, zonder meer, voor de ogen van iedereen, hun eigen principes opeten en schaamteloos de meest extremistische programmapunten van andere partijen uitvoeren. In de ogen van de groenen en de Franstaligen verdient u een huizenhoog standbeeld, omdat hetgeen u doet inderdaad werkelijk uniek is. Wat u doet is uniek, omdat u de wildste dromen waarmaakt. Er is geen enkele integratiewil meer nodig en de groenen hadden wellicht nooit gedacht dat zij dit gerealiseerd zouden kunnen krijgen. Ten gunste van de Franstalige partijen worden er op uiterst korte termijn tienduizenden nieuwe Franstalige kiezers bij gecreëerd. Men zou voor minder een gat in de lucht springen! Wat u doet is uniek, omdat u diametraal ingaat tegen uw eigen partijprogramma. U handhaaft het lakse beleid dat wordt gevoerd bij het toekennen van de Belgische nationaliteit. Bij de aanloop naar de vorige verkiezingen werd dit beleid nog door u en het programma van uw partij verketterd. Terecht, want de Belgische nationaliteit werd naar iedereen gegooid. Nu maakt u het nog veel erger, omdat het verwerven van de Belgische nationaliteit volledig gratis wordt, in alle opzichten van het woord. Voortaan gaat u dus met de identiteitskaarten nog veel harder gooien dan dit vroeger ooit het geval was. Dit land heeft in de loop der jaren veel compromissenbouwers en -loodgieters gehad, veel gevers en toegevers, maar vandaag zijn de plooibaarheidsfactor, de kneedbaarheid, de manipuleerbaarheid en de ruggengraatloosheid van Marc Verwilghen en van zijn partij verbijsterend groot geworden. Wat u doet, mijnheer de minister, is uniek omdat u hier een nationaliteitswetgeving in het leven roept die de meest lakse ter wereld zal zijn. Wij hebben de vergelijking gemaakt en nergens in Europa noch in de wereld, geeft men zomaar, louter op aanvraag en op basis van een kort verblijf, de nationaliteit weg. Door wat nu bij ons op stapel staat, zal er zo laks en kwistig met de nationaliteit worden omgesprongen, dat het zijns gelijke niet zal hebben, noch in Europa, noch daarbuiten. Het spreekt uiteraard voor zich dat hij die zich leent tot een dergelijk unieke en groteske vorm van politieke prostitutie en tot een dramatische uitverkoop van de Vlaamse belangen, in de ogen van de groenen en de Franstaligen een levensgroot standbeeld verdient. Ik zie het al voor mij, mijnheer de minister: Marc Verwilghen vereeuwigd als milde weldoener, kwistig de tienduizenden identiteitskaarten uitstrooiend over de dankbare dompelaars. Laten wij beginnen met een aspect van dit dossier dat al maandenlang op een schandelijke manier wordt doodgezwegen, met name de catastrofale gevolgen van dit wetsontwerp voor de Vlamingen in Brussel. Ik heb in dit land al veel weten doodzwijgen en onder de mat vegen. Ik ben evenwel verbijsterd vandaag een absoluut stilzwijgen te moeten vaststellen. Vorige week maandag gaven de voorzitters van respectievelijk het Vlaams Comité voor Brussel, het Davidsfonds en het Overlegcentrum van Vlaamse verenigingen, die samen een klein miljoen Vlamingen vertegenwoordigen, een persconferentie. Er werd een dramatische oproep gedaan om de Brusselse Vlamingen niet te laten versmachten door de tienduizenden nieuwe Belgen die bijna zonder uitzondering voor de Franse taalrol kiezen. Hun oproep vond evenwel nauwelijks gehoor. Hun boodschap werd in Vlaanderen nagenoeg doodgezwegen. Nauwelijks 15 maand geleden werd in dit halfrond ook gedebatteerd over de versoepeling van de nationaliteitswetgeving. Het was de pasmunt om de steun van PRL en FDF voor het Eurostemrecht af te kopen. Toen klonk het echter anders. Men was zich blijkbaar wel bewust van het gevaar. Zelfs de CVP was toen van mening dat de Vlamingen in Brussel in de verdrukking dreigden te komen. De Vlaamse pers was bijzonder kritisch en afwijzend. Unisono werd toen gezegd dat er een gewaarborgde vertegenwoordiging van de Vlamingen in Brussel moest komen. Sta mij toe een citaat van Patrick Dewael voor te lezen, dat de strategie van de francofonen duidelijk verwoordde: PRL, FDF en PS willen de Bel- gische nationaliteitswetgeving zodanig versoepelen dat allochtonen quasi automatisch Belg kunnen worden. Op die manier denken zij het debat over het al dan niet verlenen van stemrecht aan de vreemdelingen in hun voordeel te beslechten. De Franstaligen zien in de stemmen van de allochtonen een middel om Brussel en Vlaams-Brabant verder te verfransen. De VLD wil, in tegenstelling tot de Vlaamse meerderheidspartijen, niet meestappen in deze francofone strategie. Vandaag is het evenwel diezelfde VLD die voor de francofonen door de knieën is gegaan en mee het voortouw neemt in het eindoffensief tegen de Brusselse Vlamingen. Merkwaardig genoeg wordt plots over dit thema zo hard mogelijk gezwegen. Dit is des te pijnlijker omdat in de praktijk is gebleken dat wij eind 1998 overschot van gelijk hadden. Toen konden wij nog voor doemdenkers worden versleten, maar vandaag kan dat niet meer. Bij de afgelopen verkiezingen hebben de buitenlanders immers massaal voor de Franstalige lijsten gestemd, en niet voor de Vlaamse. Of hoe kan men verklaren dat op de tijd van een zittingsperiode de Vlamingen in Brussel bijna 14 000 stemmen verliezen en de Franstaligen er bijna 36 000 winnen? De Franstalige vooruitgang is in het geheel niet te wijten aan de toename van de autochtone kiezers. Zij hebben immers de voorbije jaren met tienduizenden de stad verlaten. De gigantische Franstalige vooruitgang is uitsluitend te wijten aan de vele tienduizenden nieuwe Belgen die, op een paar uitzonderingen na, allemaal voor de Franstaligen hebben gestemd. Het charmeoffensief van de Vlaamse partijen ten aanzien van de buitenlan- ders, waarmee de CVP zwaaide, heeft dus niet gewerkt. Het is een totale mislukking gebleken. Nochtans, ondanks deze onbetwistbare, catastrofale cijfers, kijkt iedereen vandaag de andere kant op. Blijkbaar niemand is nog geïnteresseerd in het lot van de Brusselse Vlamingen, net nu het aantal Franstalige kiezers voor de gemeenteraadsverkiezingen - want daarvoor is dit wetsontwerp geschreven - nog maar eens met vele tienduizenden zal worden uitgebreid. De Vlaamse vertegenwoordiging in de gemeenteraden dreigt binnenkort te worden gedecimeerd. Uiteraard ligt de eerste en grootste verantwoordelijkheid voor hetgeen vandaag gebeurt, bij de VLD. Maar tegelijkertijd ligt er bij zowel de VU&ID als de CVP een verpletterende verantwoordelijkheid voor de penibele situatie waarin de Brusselse Vlamingen vandaag zitten. Beide partijen hebben terecht aangeklaagd dat de versoepelde nationaliteitsverwerving een bedreiging vormt voor de Brusselse Vlamingen, maar precies op de terreinen waar zij zelf over de mogelijkheid beschikken om daaraan iets te doen, steken zowel de CVP als de VU de handen in de lucht en geven zij openlijk forfait. Ik kom eerst tot de CVP. Het bewijs is nu geleverd dat wij eind 1998 overschot van gelijk hadden toen we de onmiddellijke invoering van een gewaarborgde vertegenwoordiging van de Brusselse Vlamingen eisten. Volgens de CVP van toen vormde dit geen probleem en zou alles in orde komen na de parlementsverkiezingen. Zoals door ons voorspeld, is daarvan vandaag absoluut niets in huis gekomen. Er werden geen afspraken gemaakt na de verkiezingen; alles werd verschoven naar de Costa en wat Brussel betreft naar de Brusselse Costa. En wie heeft de gewaarborgde vertegenwoordiging voor de gemeenteraden daar van de agenda afgevoerd? Uitgerekend de CVP. Op de enige plaats waar de CVP aan de macht is, met name Brussel waar de heer Chabert als minister fungeert, weigert zij druk op de ketel te zetten en abdiceert zij. Men zal eindelijk moeten toegeven dat het debat over het eurostemrecht gepaard ging met een discussie over de Brusselse Vlamingen, meer bepaald over de gewaarborgde vertegenwoordiging op gemeentelijk vlak. Omwille van het burgemeester-effect, omwille ook van de ondemocratische behandeling van kleine lijsten en omwille van het eurostemrecht dat enkel op het gemeentelijk vlak speelt, is het daar het moeilijkste om verkozen te raken. Het spel dat nu wordt gespeeld door zowel de CVP, de VU, de VLD als SPAGA of de unie van SP en Agalev in Brussel, is dat men nog wel bekommerd is om de gewaarborgde vertegenwoordiging, maar dan enkel op het gewestelijk vlak en niet op het gemeentelijk vlak. Precies op dat niveau waar de vette mandaten te rapen vallen, willen de traditionele partijen er nog een aantal bij. Nochtans is het helemaal niet dringend. De verkiezingen zijn pas in 2004 en bovendien is het ook veel minder noodzakelijk omdat de Vlamingen reeds waarborgen hebben op uitvoerend vlak. Het gaat hier trouwens om een Franstalige eis. De Franstaligen willen via bijzondere coöptatie- mogelijkheden het Vlaams Blok tegengaan. Daar waar het echter veel harder nodig is, daar waar de echte senakels van de macht in Brussel zitten, daar waar over enkele maanden door de verwachte vloedgolf van nieuwe Belgen en door de uittocht van de autochtonen, de Vlaamse gemeenteraadsleden dreigen te worden weggespoeld, wordt niets gedaan. Het kleine Vlaamse gemeenteraadslid, de kleine Vlaamse vertegenwoordiger in Brussel die de echte strijd moet leveren, wordt door de VLD, door de VU&ID en door de CVP op een laffe manier in de steek gelaten. Het hoogste cijfer dat de Vlaamse lijsten gezamenlijk behaalden bij de voorbije verkiezingen was dat van de Kamer, met name 60 900 stemmen. Het aantal buitenlanders dat in Brussel alleen al in aanmerking komt om de nationaliteit te krijgen, dus dezen die hier drie jaar wonen, ligt vier maal hoger, met name 240 000. Misschien doen deze cijfers bij sommige collega's eindelijk een lichtje branden. Ook de VU is medeplichtig aan dit spel. Ik zie dat er toch één vertegenwoordiger van de VU is. Blijkbaar is het debat toch een beetje van belang voor die partij. Zij heeft het nog gortiger gespeeld dan de CVP. In 1998 reeds stelden we vast dat die partij ongelooflijk veel bochtenwerk afleverde. Aanvankelijk kon de nationaliteit niet genoeg worden versoepeld tot bleek dat PRL en FDF de zaak koppelden aan het eurostemrecht. Op dat ogenblik wisselde de VU van kamp; toen begreep men dat dit alles in een Franstalig offensief paste. Nu opnieuw is de VU hopeloos dubbelzinnig. Net in de week toen de VU en de CVP op een gezamenlijke persconferentie het regeringsontwerp afkraken en waarschuwen dat de veiligheid in gevaar komt omdat het parket nog maar één maand de tijd krijgt voor zijn werk, zat bij ieder van ons een wetsvoorstel van Vanquickenborne in de bus. Het was een oud voorstel van Bert Anciaux, waarin het parket nog maar vijftien dagen de tijd kreeg voor zijn veiligheidsonderzoek. Op 16 december 1999 kreeg VU&ID de unieke kans om heel dit debat inzake de nationaliteit te blokkeren door een belangenconflict in te roepen dat was aangebracht door de CVP- en de Vlaams Blokfractie van het Vlaams Parlement. Wat doet VU&ID die in deze Kamer had uitgeroepen dat dit wetsontwerp moest worden tegengehouden? VU&ID stemt zonder enige scrupule tegen het belangenconflict. Het Brussels VU&ID-lid Gatz verdedigt de versoepeling van de wetgeving, ik citeer: Als men blijft herhalen dat al de vreemdelingen potentiële Franstaligen zijn, dan vervult men zijn eigen profetie . Met zijn uitspraak gaat Gatz diametraal in tegen het standpunt dat de CVP en VU&ID op een gemeenschappelijke persconferentie hadden ingenomen. Op het ogenblik dat VU&ID de eigen woorden hard kan maken en kan tonen dat ze het meent met haar oppositiewerk in deze Kamer, redt ze eens te meer de federale regering. Wat een toestand! Dit wetsontwerp van de nationaliteit op aanvraag, dit schandalig nefaste wetsontwerp kon wel degelijk worden tegengehouden. Als de Vlaamse partijen een minimum aan zelfrespect en solidariteit met de Brusselse Vlamingen hadden getoond, hadden ze dit dossier een communautaire behandeling gegeven. Dit dossier heeft immers een gigantische weerslag op de communautaire verhoudingen in dit land en vooral in de hoofdstad. Dit dossier hoort thuis in de Costa. Dit is te veel gevraagd van het doorzicht van de Costagangers. De Franstaligen slagen erin al de voor hen belangrijke dossiers zoals de nationaliteitsverwerving, de financiering van het onderwijs en de kwestie van het Brussels gerecht zo ver mogelijk weg te houden van het Costa-overleg. De Vlaamse partijen blijven achter met de dossiers waarin zij vragende partij zijn. Van een goede strategie gesproken! Uit dit nare verhaal kan slechts één les worden getrokken. De houding van de CVP, de VLD en VU&ID is identiek. Als ze in de oppositie zitten, schreeuwen ze moord en brand en schermen ze met de Vlaamse belangen. Als ze zelf aan de macht zijn, op om het even welk beleidsniveau, offeren ze de Vlaamse belangen op voor het hoger Belgisch belang en planten ze de Brusselse Vlamingen het mes in de rug. Dames en heren van de CVP, VU&ID en VLD, uw Vlaamse reflex is niet meer dan een schijnvertoning, wat window dressing. Alleen de vetpotten en ministerportefeuilles zijn voor u van belang. U bent allemaal even ongeloofwaardig! Collega's, het behoeft weinig betoog dat dit wetsontwerp in de eerste plaats electorale bedoelingen heeft. Het wetsontwerp kwam er ter compensatie van het algemeen vreemdelingenstemrecht. In de praktijk gaat dit wetsontwerp echter veel verder. Het impliceert immers stemplicht alle niveaus. De haast waarmee dit dossier door het parlement wordt gejaagd, heeft alles vandoen met de komende gemeenteraadsverkiezingen. Bepaalde partijen hebben dringend nood aan een snelle en massale uitbreiding van hun kiezerskorps. Deze wet dient niet - wat van elke wet mag verwacht worden - het algemeen belang, maar de particuliere belangen van een aantal partijen. Daarom alleen al is deze wet een van de meest immorele die ooit in dit halfrond werden besproken. Deze wet dient onder meer de belangen van de aftandse SP die in bepaalde steden tot 30% en meer van haar aanhangers is kwijtgespeeld. De SP smeekt en bidt om nieuwe kiezers. Dankzij deze wet zien de Vlaamse socialisten de kans schoon om hun verouderd en afkalvend kiespubliek versneld te vervangen door vreemdelingen. Deze wet dient eveneens de belangen van AGALEV, de vreemdelingenpartij bij uitstek die er openlijk voor uitkomt dat ze deze wet wil gebruiken in haar strijd tegen het Vlaams Blok en die de vreemdelingen in Antwerpen nu reeds oproept massaal en snel de Belgische nationaliteit aan te vragen. Ik heb het reeds uitgebreid gehad over de Franstalige partijen en hun overduidelijke strategie tegen de Brusselse Vlamingen. Dan blijft er nog de VLD over. De VLD, de enige partij die zeker weet geen electoraal voordeel te halen uit de nieuwe wet, heeft er wel alle belang bij dat deze perfide wet zo snel mogelijk wordt goedgekeurd. Hoe langer ermee gewacht wordt, hoe groter immers kans dat de kiezer zich op 8 oktober nog alles zal herinneren. Daarom moest deze immorele wet er zo snel komen. Daarom wordt dit wetsontwerp aan deze Kamer opgedrongen zonder dat daaraan iets is veranderd in de commissie en zonder dat de parlementsleden hun democratische rol konden spelen. In de Kamercommissie voor de Justitie hebben zich onwaarschijnlijke taferelen afgespeeld. De minister van Binnenlandse Zaken had in een brief aan zijn collega van Justitie laten weten dat het volgens de dienst Vreemdelingenzaken in de praktijk bijna onmogelijk zal zijn om binnen de vereiste termijn van één maand advies te geven. We vernemen zelfs dat dit op dit moment negen maanden duurt. Eén maand is in de praktijk dus totaal onmogelijk. Toch komt minister Verwilghen zonder scrupules aan de commissie vertellen dat er geen vuiltje aan de lucht is en dat Binnenlandse Zaken zijn rol wel zal kunnen vervullen. Alle problemen zijn dus van de baan. Er mag niet eens een hoorzitting komen met de mensen van de dienst Vreemdelingenzaken over de haalbaarheid van deze wet. Ik zal het verslag even raadplegen omdat het misschien interessant is te weten wat er over de zaak van het parket en over de adviestermijn van één maand die het parket nog zou hebben in de commissie voor de Justitie is gezegd. De heer Van Peel had meegedeeld dat hij het zou bestuderen. De minister verduidelijkt dat er vooraf een gesprek heeft plaatsgevonden met de procureursgeneraal. Daar is gepeild naar de haalbaarheid van de termijn van één maand. Uit dit gesprek bleek dat de termijn haalbaar was. Ik zal dit nu vergelijken met de notulen van het college van procureurs-generaal dat hierover heeft beraadslaagd. Hierin kondigt de minister aan om schriftelijk het advies van het college te vragen. U hebt dit niet gedaan, mijnheer de minister. Er is enkel een initieel gesprek geweest. Mijnheer de minister, in de commissie voor de Justitie hebt u ons voorgelogen. U hebt ons gezegd dat alles in orde was en dat er misschien alleen in Brussel een probleem zou zijn. Dit blijkt echter allerminst uit deze notulen. In de praktijk is er geen aanvraag geweest. Dit blijkt des te meer uit de brief van advocaat-generaal Jacques De Lentdecker. Hij zegt dat hij zelf nog advies moet inwinnen bij de diverse parketten. Er is dus mogelijk niet alleen een groot probleem inzake Brussel, maar ook in de andere parketten. U hebt ons dat niet verteld. Integendeel, u hebt ons verteld dat alles in orde was. Dit is een incident van de hoogste orde, mijnheer de minister. U hebt de commissie voor de Justitie voorgelogen. U hebt onder dat mom ook geweigerd om een hoorzitting te laten plaatsvinden. Het was allemaal niet meer nodig, omdat het parket zijn rol had gespeeld en alles aankon. Nu blijkt dat het parket zijn rol helemaal niet aankan. We gaan dan ook deze vergadering vragen om zo snel mogelijk tot het besluit te komen om dit ontwerp terug naar de commissie voor de Justitie te verzenden. Zo kunnen de leden van de commissie te weten komen of de parketten inderdaad in staat zijn om het advies op één maand tijd te leveren. Mijnheer de minister, ik neem het u bijzonder kwalijk dat u aan de commissie voor de Justitie heel andere dingen zegt dan wat er in werkelijkheid gebeurt. U schudt van nee. U zult het dan eens moeten komen uitleggen. Ik vind het bijzonder merkwaardig wat er uit de teksten van het college van procureurs-generaal blijkt. De oppositie merkt op dat de talloze manieren waarop men zijn identiteit en geboorte zal kunnen bewijzen, de poort wagenwijd openzet voor misbruiken, vervalsingen en het fabriceren van bewijsmateriaal. Er zijn dus sancties nodig om dit gedrag te beteugelen. Als dit gezegd wordt, wordt de oppositie weggehoond. Bij de VLD weet men heel goed wat de gevaren en risico's van deze wet zijn. Maar deze partij heeft nu eenmaal besloten alles kritiekloos door te slikken om de kiezer in verwarring te brengen. Om de schijn van enig verzet hoog te houden, werd Kamerfractieleider Coveliers in het veld gestuurd om mist te spuien en om de ene dolle uitspraak na de andere te doen. In de praktijk blijkt dat allemaal boter aan de galg. De versoepeling van de nationaliteitsverwerving zou worden gekoppeld aan het snelrecht, collega Coveliers en dit is niet gebeurd. Het had trouwens geen enkele zin. De nationaliteit zou opnieuw worden afgenomen.

It is obvious that those who lend themselves to such a unique and grotesque form of political prostitution and to a dramatic sale of Flemish interests deserve a life-size statue in the eyes of the Greens and the French speakers. I see it already before me, Mr. Minister: Marc Verwilghen eternated as a gentle benefactor, questioningly spreading the tens of thousands of identity cards over the grateful diveers. Let us begin with one aspect of this file that has been shamefully silenced for months, in particular the catastrophic consequences of this bill for the Flamings in Brussels. I have known in this country a lot of silence and wiping under the mat. However, I am surprised today to have to establish an absolute silence. Last week Monday, the chairs of the Flemish Committee for Brussels, Davidsfonds and the Consultation Centre of Flemish associations, which together represent a small million Flemish people, gave a press conference. A dramatic call was made to prevent the Brussels Flamings from being forced by the tens of thousands of new Belgians who almost without exception choose the role of the French language. However, their call was hardly heard. Their message was almost silenced in Flanders. Nearly 15 months ago in this hemisphere was also debated on the easing of the nationality legislation. It was the pass currency to buy off the support of PRL and FDF for the Eurostem right. But then it sounded different. They were apparently aware of the danger. Even the CVP was then of the opinion that the Flamings in Brussels threatened to come into the oppression. The Flemish press was ⁇ critical and rejecting. Unisono was then told that there should be a guaranteed representation of the Flaming in Brussels. Allow me to read a quote from Patrick Dewael, which clearly expressed the strategy of the Francophones: PRL, FDF and PS want to ease the Belgian nationality legislation so that immigrants can almost automatically become Belgians. In this way they think to resolve the debate about whether or not to grant voting rights to foreigners in their favour. The French speakers see in the voices of immigrants a means to further refresh Brussels and Flemish-Brabant. The VLD, unlike the Flemish majority parties, does not want to participate in this Franco-speaking strategy. Today, however, it is the same VLD that has gone through the knees for the Francophones and takes the lead in the final offensive against the Brussels Flamings. Strangely enough, this topic is suddenly silenced as loudly as possible. This is even more painful because in practice it has been shown that we had a surplus of right at the end of 1998. Then we could still be consumed for doom-thinkers, but today it can no longer be. In recent elections, foreigners massively voted for the French-speaking lists, and not for the Flemish. Or how can one explain that during a parliamentary period the Flemish in Brussels lose almost 14 000 votes and the French-speaking win almost 36 000? The French-speaking progress is not at all due to the increase in indigenous voters. In recent years, tens of thousands of people have left the city. The enormous French-speaking progress is due solely to the many tens of thousands of new Belgians who, with a few exceptions, all voted for the French-speaking. The charme offensive of the Flemish parties with regard to the foreign sector, with which the CVP swung, has therefore not worked. It turned out to be a total failure. Nevertheless, despite these undisputed, catastrophic figures, everyone is looking in the opposite direction today. Apparently no one is yet interested in the fate of the Brussels Flamings, just now the number of French-speaking voters for the municipal council elections - because for that this bill was written - will be expanded by many tens of thousands again. The Flemish representation in the municipal councils is threatening to be decimated soon. Of course, the first and greatest responsibility for what is happening today lies with the VLD. But at the same time, both the VU&ID and the CVP have a crushing responsibility for the penible situation in which the Brussels Flamings are today. Both sides have rightly accused that the eased acquisition of nationality poses a threat to the Brussels Flamings, but precisely in the areas where they themselves have the possibility to do something about it, both the CVP and the VU put their hands in the air and give openly forfait. Let me start with the CVP. The evidence has now been provided that we had a surplus of equity at the end of 1998 when we demanded the immediate introduction of a guaranteed representation of the Brussels Flamings. According to the CVP of the time, this was not a problem and everything would be fine after the parliamentary elections. As predicted by us, nothing of this has come into the house today. There were no agreements made after the elections; everything was moved to the Costa and, in Brussels, to the Brussels Costa. And who removed the guaranteed representation for the municipal councils from the agenda? Calculate the CVP. In the only place where the CVP is in power, in particular Brussels where Mr. Chabert acts as a minister, she refuses to put pressure on the boiler and abdicates. One must finally admit that the debate on the euro-vote right was accompanied by a discussion on the Brussels Flamings, more specifically on the guaranteed representation at the municipal level. Because of the mayor-effect, also because of the undemocratic treatment of small lists and because of the euro-vote right that only plays at the municipal level, it is the most difficult place to get elected. The game now played by both the CVP, the VU, the VLD and SPAGA or the union of SP and Agalev in Brussels, is that one is still concerned about the guaranteed representation, but then only on the regional level and not on the municipal level. Exactly at that level where the fatty mandates fall, the traditional parties want to add a few more. However, it is not urgent at all. The elections are only in 2004 and, in addition, it is also much less necessary because the Flamings already have guarantees on the executive level. This is a French-language requirement. The French speakers want to counter the Flemish Block through special cooperation opportunities. There, however, where it is much more necessary, where the real senacles of power are in Brussels, where in a few months by the expected floodwave of new Belgians and by the exodus of the indigenous people, the Flemish municipal councillors are threatened to be washed away, nothing is done. The small Flemish municipal council member, the small Flemish representative in Brussels who must deliver the real struggle, is abandoned by the VLD, by the VU&ID and by the CVP in a cowardly way. The highest figure that the Flemish lists collected in the last elections was that of the Chamber, notably 60 900 votes. The number of foreigners who are eligible to obtain citizenship in Brussels alone, so those who live here for three years, is four times higher, notably 240 000. Per ⁇ these figures finally make some colleagues burn a light. The VU is also complicit in this game. I see that there is one representative of the VU. Apparently, the debate is a bit important for this party. She has played even harder than the CVP. Already in 1998 we noticed that this party delivered an incredible amount of curve work. Initially, the nationality could not be eased enough until it turned out that PRL and FDF linked the case to the euro-vote right. At that moment the VU changed camp; then it was understood that all this fit into a French-speaking offensive. Now again, the VU is hopelessly ambiguous. Just in the week when the VU and the CVP at a joint press conference broke out the government draft and warned that security is in danger because the parliament has only one month to work, each of us had a bill from Vanquickenborne in the bus. It was an old proposal by Bert Anciaux, in which the parquet was given only fifteen days for its safety investigation. On 16 December 1999, VU&ID was given the unique opportunity to block this whole debate on nationality by invoking a conflict of interests brought about by the CVP and the Flemish Bloc Group of the Flemish Parliament. What does VU&ID do that in this Chamber had proclaimed that this bill should be stopped? VU&ID votes without any scrupule against the conflict of interest. Brussels VU&ID member Gatz defends the easing of the legislation, I quote: If one continues to repeat that all the foreigners are potential French speakers, then one fulfills his own prophecy. With his judgment, Gatz diametrically contradicts the position taken by the CVP and VU&ID at a joint press conference. At the moment that VU&ID can make its own words tough and can show that she means it with her opposition work in this Chamber, she once again saves the federal government. What a condition! This bill of nationality upon request, this scandalously nefaste bill, could indeed be stopped. If the Flemish parties had shown a minimum of self-respect and solidarity with the Brussels Flamings, they would have given this file a community treatment. After all, this dossier has a huge impact on community relations in this country and especially in the capital. This case belongs home in the Costa. This is too much requested from the insight of the Costagangers. The French speakers succeed in keeping all important files such as the acquisition of nationality, the financing of education and the issue of the Brussels court as far as possible away from the Costa negotiation. The Flemish Parties remain behind with the files in which they are the requesting party. Speaking of a good strategy! From this horrible story only one lesson can be drawn. The attitude of the CVP, VLD and VU&ID is identical. When they are in the opposition, they scream murder and fire and screen them with the Flemish interests. When they themselves are in power, at any level of policy, they sacrifice the Flemish interests for the higher Belgian interest and they plant the Brussels Flamings the knife in the back. Ladies and gentlemen of the CVP, VU&ID and VLD, your Flemish reflex is nothing more than an appearance, something window dressing. Only the fat pots and ministerial portfolios are of interest to you. You are all incredible! There is little need to argue that this bill has primarily electoral intentions. The draft law came to compensate for the universal voting right of foreigners. In practice, however, this bill goes much further. After all, it implies voice light all levels. The hurry with which this file is being chased by parliament has wiped out everything with the upcoming municipal council elections. Some parties urgently need a rapid and massive expansion of their electorate. This law does not serve – as may be expected from each law – the general interest, but the private interests of a number of parties. Therefore, this law alone is one of the most immoral that has ever been discussed in this hemisphere. This law serves, among other things, the interests of the downward SP which in certain cities has lost up to 30% and more of its supporters. The SP begs and prays for new voters. Thanks to this law, the Flemish socialists see the opportunity to accelerate the replacement of their outdated and decaying electorate by foreigners. This law also serves the interests of AGALEV, the outstanding foreign party which openly assumes that it wants to use this law in its struggle against the Flemish Bloc and which already calls on foreigners in Antwerp to apply massively and quickly for Belgian nationality. I have already talked extensively about the French-speaking parties and their clear strategy against the Brussels Flamings. Then there remains the VLD. The VLD, the only party that knows for sure no electoral advantage from the new law, has all interest in that this perverse law is approved as soon as possible. The longer you wait, the more likely the voter will remember everything on October 8th. That is why this immoral law had to come so quickly. Therefore, this bill is imposed on this House without any change in the committee and without allowing the members of parliament to play their democratic role. In the Chamber of Justice Committee unlikely events took place. The Minister of Internal Affairs had in a letter to his colleague of Justice informed that, according to the Foreign Affairs Service, it will be almost impossible in practice to give advice within the required one-month period. We even learn that this currently takes nine months. One month is practically impossible. Nevertheless, Minister Verwilghen comes without scruples to tell the committee that there is no dirt in the air and that Home Affairs will be able to fulfill its role. All problems are from the job. There should not even be a hearing with the people of the Foreign Affairs Service about the feasibility of this law. I will consult the report for a moment because it may be interesting to know what has been said about the case of the Prosecutor’s Office and about the one-month counseling term that the Prosecutor’s Office would still have in the Justice Committee. Mr. Van Peel had informed that he would study it. The Minister clarifies that a preliminary conversation was held with the Attorney General. There is a question of the feasibility of the one-month period. The meeting showed that the deadline was feasible. I will now compare this to the minutes of the College of Attorneys-General that discussed this matter. In this, the Minister announces that he will request the advice of the College in writing. You did not do this, Mr. Minister. There was only an initial conversation. Mr. Minister, in the Justice Committee you lied to us. You told us that everything was okay and that there might only be a problem in Brussels. However, this is not shown in the minutes. In practice, there was no application. Iedereen kan zonder enig probleem zijn eigen culturele identiteit behouden. Alle culturen mogen op dezelfde voet behandeld worden en zijn voortaan gelijkwaardig aan de onze in ons land. Dit wetsontwerp is inderdaad een hoogfeest van de multiculturele waanzin. Daarom is dit ook zo'n grote overwinning voor de linkerzijde en in het bijzonder voor Agalev, dat de culturele homogeniteit van Vlaanderen al zo lang een doorn in het oog vindt. Wij mogen niet langer eisen dat buitenlanders zich aan ons aanpassen. Neen, wij moeten ze in heel hun eigen culturele eigenheid respecteren, want hun aanwezigheid kan in de ogen van de groene dogmatici niets anders zijn dan een verrijking voor onze samenleving. Agalev heeft in dit dossier, dat moeten wij ruiterlijk erkennen, met open kaarten gespeeld. De integratie wordt op deze wijze meer dan ooit tegengegaan. Zij moeten het toch allemaal slikken, de onleefbaarheid in de steden, de dramatische onveiligheid van de binnensteden, de systematische gettovorming, de blijvende en stelselmatige toename van het aantal vreemdelingen, zowel via de gezinshereniging - alleen al in Brussel kwamen er zo 1 800 burgers bij in 1 jaar tijd - als langs illegale weg, de blijvende toename van asielzoekers en asielcentra. Bange ministers hebben de moed niet om een daadwerkelijk repatriëringsbeleid voor illegalen op poten te zetten. U vraagt wel zeer veel van de mensen die dat allemaal moeten dulden. Monsieur le président, monsieur le ministre, chers collègues, j'interviens au nom du groupe Ecolo-Agalev. Je serai suivi par Mmes Leen, Coenen et Talhaoui, lesquelles prendront aussi la parole au nom de ce groupe. Le projet dont nous avons débattu en commission de la Justice procède directement de la déclaration gouvernementale et de son application. Que nous dit clairement et explicitement cette déclaration gouvernementale? Le gouvernement estime que l'acquisition de la nationalité belge est un facteur d'intégration important dans notre société. Afin de favoriser cette intégration, des modifications importantes seront apportées au Code de la nationalité belge, en particulier au sujet de la procédure d'acquisition de la nationalité belge par voie de naturalisation qui sera alignée sur la procédure actuelle de déclaration de nationalité. Plus précisement, la demande de naturalisation sera gratuite et elle contiendra l'engagement du demandeur de respecter la Constitution et les lois du peuple belge ainsi que la Convention européenne des droits de l'homme et des libertés fondamentales et elle exprimera la volonté d'intégration. Les dispostitions de l'article 15 du Code de la nationalité belge seront revues dans le but de supprimer le questionnaire. En outre, l'arrêté royal du 13 décembre 1995 relatif aux documents à fournir par le demandeur sera modifié comme suit: primo, acte de naissance du demandeur ou document équivalent délivré par les autorités diplomatiques ou consulaires du pays d'origine. En cas d'impossibilité ou de difficulté sérieuse à se procurer cet acte, il peut être remplacé par acte de notoriété visé aux articles 71 et 72 du Code civil. De plus, poursuit le texte adopté par la Chambre à la mi-juillet, le rôle du parquet sera redéfini. Ainsi, le parquet se prononcera-t-il dans un délai d'un mois sur l'existence éventuelle de faits personnels graves dans le chef du demandeur. Ce n'est que si cet avis est négatif que le dossier sera transmis à la Chambre des représentants pour décision. Dans le même esprit, le ministre de la Justice enverra au parquet une circulaire afin de combattre les demandes de naturalisations qui visent un but criminel. La déclaration de nationalité elle-même sera simplifiée en réduisant le délai d'avis du parquet à un mois et en assouplissant les conditions d'âge. Le gouvernement introduira au parlement les projets concernés immédiatement après les accords de l'été. Il évaluera la nouvelle réglementation un an après son entrée en vigueur. Voilà sur quoi repose le texte dont nous débattons aujourd'hui en assemblée plénière. En ce qui concerne les écologistes, ce texte est, comme bon nombre d'autres éléments de la déclaration gouvernementale, un compromis. Est-ce le programme des écologistes? Non. En tout cas, ce n'est pas leur programme prioritaire puisque depuis une vingtaine d'années, les Verts relayent une série de revendications formalisées par les groupes et associations militant pour l'octroi du droit de vote aux personnes d'origine étrangère. Nous demandons effectivement dans notre programme politique - tout comme nous le demandions aux élections - que pour les élections locales, c'est à dire les scrutins communaux et provinciaux, le droit de vote et d'éligibilité soit reconnu aux personnes d'origine étrangère qui résident légalement depuis au moins cinq ans sur le territoire. Au terme de la négociation gouvernementale au cours de laquelle chacun a fait valoir son point de vue, nous avons obtenu une simplification de la procédure d'acquisition de la nationalité par déclaration de nationalité ou par naturalisation. Pourquoi? Parce que nous constatons, avec d'autres, à partir des échos recueillis sur le terrain, que bon nombre de cas examinés sur la base de l'ancienne législation restent pendants durant de nombreux mois, voire de nombreuses années, en dépit de la présence dans les dossiers d'éléments objectivement favorables. Parce que nous pensons que l'interprétation de la notion d'intégration débouche dans certains cas sur des éléments d'arbitraire. Ce compromis relèverait-il d'un troc malheureux ou d'une négociation de mauvais aloi entre des partenaires qui ne seraient pas d'accord sur le fond et qui procéderaient de la sorte à des échanges sur des dossiers qui n'auraient rien à voir? Je ne le pense pas à la lumière de deux éléments au moins. Tout d'abord, les personnes intéressées sont potentiellement les mêmes. On n'en est donc pas à l'échange d'un dossier contre un autre dans le contexte de ce que nous appelons, avec beaucoup d'auto-dérision, un compro- mis à la belge . Pour ma part, il s'agit d'un vrai compro- mis qui fait une part importante au fond non seulement parce que les personnes intéressées sont potentiellement les mêmes, comme je l'ai déjà dit, mais aussi parce qu'il existe un accord de principe sur l'objectif. De quel objectif s'agit-il? Dans la revendication du droit de vote ou d'une procédure de naturalisation ou d'acquisition de la nationalité simplifiée, l'objectif est, notamment, de favoriser l'intégration et, en particulier, la participation politique par le biais du vote. Celui-ci pourra être atteint par les bénéficiaires de la nouvelle loi en matière de nationalité, et cela dans des proportions plus larges puisque les droits qu'ils vont acquérir grâce à cette législation vont plus loin que le seul droit de vote aux élections locales qui leur aurait été accordé si nous avions triomphé sur toute la ligne, en tant que Verts, dans cette négociation. Oui, le nouveau Belge a le droit de vote à toutes les élections et, à ce point de vue, l'objectif est atteint. Deux autres éléments témoignent de l'intérêt de cette évolution législative. Je pense tout d'abord au droit au travail. Quelqu'un qui devient belge grâce à cette législation obtient, de ce fait, un droit au travail beaucoup plus étendu que celui que lui aurait conféré le simple droit de voter aux élections locales. En outre, cette nouvelle loi permet à son bénéficiaire d'éviter une éventuelle double peine en cas de condamnation pénale, d'éviter, au-delà de la peine prévue par le juge, un ordre de quitter le territoire pendant au moins dix ans et de n'y revenir qu'au terme d'une procédure de réhabilitation qui n'est pas automatique. Tout cela pour dire que je pense qu'il s'agit là d'un vrai compromis qui ne fait pas fi des objectifs de fond poursuivis par les uns et les autres au sein de la coalition gouvernementale ou en dehors de celle-ci même si, pour nous, le découplage nationalité/citoyenneté reste une nécessité qui, nous l'espérons, sera concrétisée rapidement, et même si cela ne relève pas simplement de considérations idéologiques ou académiques. Dès lors, chers collègues, quel est le fondement de ce projet de loi? Ceci pour relativiser quelque peu un certain nombre de cris d'orfraies que j'entends à cette tribune face à une simplification, dont certains tiennent manifestement à ne voir que de prétendus effets pervers au lieu d'en mesurer les atouts réels et avérés. Nous nous référons à une loi du 13 avril 1995, promue par notre collègue, M. Erdman, qui déjà comprenait une importante dimension de simplification. Cette loi centralise les demandes non plus au parquet mais à la Chambre, le parquet devant émettre un avis dans les quatre mois, les mêmes délais étant exigés de l'Office des étrangers et des services de la Sûreté de l'Etat. Le ministre de la Justice introduit alors l'obligation d'un certificat de naissance délivré non plus par l'ambassade ou le consulat du pays d'origine en Belgique, mais sur place, ce qui est un événement important pour la suite. Le deuxième élément législatif d'évolution récente repose sur la loi du 22 décembre 1998, qui introduit encore certaines modalités de simplification et d'assouplissement pour les personnes de la seconde génération ainsi que pour les personnes qui souhaitent obtenir la nationalité par le mariage avec une personne de nationalité belge. Dans les deux cas, le questionnaire et l'enquête sur la volonté d'intégration restent une réalité. Un certain nombre de ces questions sont vécues, parfois objectivement et à juste titre, comme parfois humiliantes, relevant d'un ton moralisateur ou d'une méthode inquisitoriale. Cela permet de mesurer l'avancée de la législation nouvelle proposée ici: un principe de présomption d'intégration, dès lors que la personne formule une demande en bonne et due forme pour bénéficier des nouvelles mesures; une législation qui prévoit et consacre la suppression de ce questionnaire pouvant être vécu comme humiliant; une législation qui assouplit les conditions d'âge; une législation qui impose des délais de rigueur pour le traitement du dossier par le parquet et l'Office des étrangers, dont les rôles dans la procédure sont reprécisés et qui contient plusieurs réponses, apportées lors des débats parlementaires, à certaines critiques relatives aux exigences de délais de rigueur. Je voudrais y revenir brièvement. Au-delà du fait qu'à l'époque, des délais de quatre mois avaient été laissés aux différents services concernés, force a été de constater que d'aucuns tiraient sur l'élastique à propos du respect de ces délais et les outrepassaient en fin de parcours. Nous avons d'abord constaté que le travail demandé à ces services, à qui un délai sera désormais imposé, n'est plus entièrement comparable à celui qui leur était demandé auparavant dans le cadre des quatre mois. Aujourd'hui, nous avons enregistré que seuls les avis négatifs doivent être signalés, comme prévu dans la déclaration gouvernementale. Par ailleurs, nous avons observé de fac¸on très pragmatique et concrète qu'en tout état de cause, la commission des Naturalisations de notre parlement ne se réunit que toutes les six semaines environ, ce qui, de facto, prolonge le délai et permet encore d'intégrer et prendre en compte des avis qui dépasseraient légèrement le délai de rigueur imposé. Evidemment, la question des moyens des parquets et de l'Office des étrangers doit être reposée, encore qu'un certain nombre de services de l'administration ou du pouvoir judiciaire ont pris la désagréable habitude, chers collègues, depuis quelques mois, de résister systématiquement à toute forme d'évolution législative, en brandissant a priori un problème de manque de moyens pour exécuter la mission que nous leur confions. Cette interpellation doit être entendue et faire l'objet de dialogues et de concertations. Cela fera certainement l'objet de l'audit de la fonction publique programmé par ce même gouvernement. Cela fera enfin certainement l'objet d'une évaluation promise pour l'année prochaine et sur laquelle nombre de ceux qui voient aujourd'hui davantage les inconvénients d'une législation que ses effets positifs réels et immédiats réattireront sans aucun doute notre attention. Voilà pour ce qui concerne les délais de rigueur. Je voudrais insister sur la gratuité des procédures, ce qui n'est pas rien. Quand on sait les difficultés concrètes que certains bénéficiaires sous l'ancienne législation devaient affronter - un vrai parcours du combattant -, l'évaluation des frais liés aux formalités à accomplir auprès des autorités administratives de leur pays d'origine, au voyage qui, lui, n'est pas gratuit, au congé que l'on doit prendre par rapport à sa profession et qui représente souvent une moins-value, au séjour sur place, en hôtel éventuellement, étant donné que certaines de ces personnes n'ont plus guère d'attaches dans les villes où elles doivent se rendre, tout cela peut représenter quinze, vingt, vingt-cinq mille francs d'impact sur le budget des demandeurs. Dès lors, la gratuité de la procédure est un point non négligeable, de même que l'exemption de formulaires administratifs dans certains cas. Monsieur le président, monsieur le ministre, mesdames et messieurs, je voudrais laisser la conclusion de cette contribution au débat à quelqu'un que vous reconnaîtrez rapidement. Elue Bruxelloise de l'année il n'y a pas longtemps, elle nous a commenté ce titre dans les termes suivants: J'adore ce prix, n'en déplaise à l'ex- trême droite. Dommage que ce ne soit pas Ixelloise de l'année, car au fond, je n'ai jamais quitté Ixelles, je n'ai jamais quitté la rue Gray. C'est aussi un prix qui doit traduire ce que je suis. Ne me parlez pas d'intégration: moi, je suis née ici, j'ai toujours vécu ici, et je ne vois pas finalement à quoi je devrais m'intégrer. Quand je me balade dans les rues de Bruxelles, je me dis: tout cela, c'est ma vie, c'est un peu moi. Cette personne, c'est Nabela Benaïssa. Elle nous dit aussi dans un chapitre de conclusion de son livre: Qui suis-je? Une immigrée. Mais je n'aime pas cette image. Cessez de me considérer de la sorte. Je suis Bruxelloise, je suis belge. Pourtant, sur ma carte d'identité, on peut lire à la rubrique nationalité marocaine. Spontanément, pourtant, je me sens belge. Je suis née ici, et je ne connais pas d'autres endroits que la Belgique, même si j'ai des racines au Maroc, où sont nés mes parents, où sont nés mes grands-parents. Dans le futur, j'aimerais posséder la double nationalité. Je suis une métisse culturelle. J'ai l'habitude de dire que je suis assise entre deux chaises et que j'y ai trouvé une position confortable. I am speaking on behalf of the Ecolo-Agalev Group. I will be followed by Ms. Leen, Coenen and Talhaoui, who will also speak on behalf of this group. The draft that we discussed in the Justice Committee comes directly from the government statement and its implementation. What does this government statement clearly and explicitly say to us? The Government considers that the acquisition of Belgian citizenship is an important factor of integration in our society. In order to facilitate this integration, significant changes will be made to the Code of Belgian Citizenship, in particular regarding the procedure for acquiring Belgian citizenship by means of naturalization, which will be aligned with the current procedure for declaring citizenship. More specifically, the application for naturalization will be free of charge and it will contain the applicant’s commitment to respect the Constitution and the laws of the Belgian people as well as the European Convention on Human Rights and Fundamental Freedoms and it will express the will to integrate. The provisions of Article 15 of the Belgian Nationality Code will be revised in order to remove the questionnaire. In addition, the Royal Decree of 13 December 1995 concerning the documents to be submitted by the applicant shall be amended as follows: primo, birth certificate of the applicant or equivalent document issued by the diplomatic or consular authorities of the country of origin. In case of impossibility or serious difficulty in obtaining this act, it may be replaced by an act of notoriety referred to in Articles 71 and 72 of the Civil Code. In addition, continues the text adopted by the House in mid-July, the role of the prosecutor’s office will be redefined. Thus, the Prosecutor’s Office will decide within one month on the possible existence of serious personal facts in the head of the applicant. Only if this opinion is negative will the file be forwarded to the House of Representatives for decision. In the same spirit, the Minister of Justice will send a circular to the Prosecutor’s Office in order to combat requests for naturalizations aimed at a criminal purpose. The declaration of nationality itself will be simplified by reducing the time limit for the public prosecutor's opinion to one month and easing the age conditions. The government will submit the relevant projects to parliament immediately after the summer agreements. It will evaluate the new regulation one year after its entry into force. This is what we are discussing today in the plenary session. As for environmentalists, this text is, like many other elements of the government statement, a compromise. Is this the environmentalists? and no. In any case, this is not their priority program since for about twenty years, the Greens have been relaying a series of demands formalized by groups and associations militant for the granting of the right to vote to persons of foreign origin. In fact, we demand in our political agenda – just as we demanded in elections – that for local elections, i.e. municipal and provincial scrutiny, the right to vote and eligibility be recognized to persons of foreign origin who have legally resided in the territory for at least five years. At the end of the governmental negotiation, during which each person made his point of view, we obtained a simplification of the procedure for obtaining citizenship by declaration of citizenship or by naturalization. Why Why ? Because we see, along with others, from the echoes gathered on the ground, that many cases examined on the basis of the old legislation remain pending for many months, even many years, despite the presence in the files of objectively favorable elements. Because we believe that the interpretation of the notion of integration leads in some cases to elements of arbitrariness. Would this compromise be an unfortunate exchange or a bad alliance negotiation between partners who would not agree on the substance and who would proceed in this way to exchanges on matters that would have nothing to do with? I do not think so in the light of at least two elements. First, the interested people are potentially the same. We are therefore not concerned with the exchange of one file for another in the context of what we call, with a lot of self-dérision, a verification to the Belgian. For my part, this is a real proof that plays an important part in the bottom not only because the interested persons are potentially the same, as I have already said, but also because there is a principled agreement on the goal. What objective is this? In the claim of the right to vote or a procedure for naturalization or for the acquisition of simplified citizenship, the aim is, in particular, to promote integration and, in particular, political participation through voting. This will be achieved by the beneficiaries of the new law on citizenship, and this in wider proportions since the rights they will acquire through this legislation go beyond the only right to vote in local elections that would have been granted to them if we had triumphed on the whole line, as Greens, in this negotiation. Yes, the new Belgian has the right to vote in all elections and, in this respect, the goal is achieved. Two other elements prove the importance of this legislative evolution. First of all, I think of the right to work. Someone who becomes Belgian through this legislation obtains, as a result, a much broader right to work than that which would have been granted to him by simply voting in local elections. In addition, this new law allows its beneficiary to avoid a possible double penalty in case of criminal conviction, to avoid, beyond the penalty provided by the judge, an order to leave the territory for at least ten years and to return there only after the end of a non-automatic rehabilitation procedure. All this to say that I think that this is a real compromise that does not disregard the fundamental objectives pursued by one and another within the government coalition or outside it, even though, for us, the separation of nationality/citizenship remains a necessity that, we hope, will be realized quickly, and even if this is not merely ideological or academic considerations. So, my colleagues, what is the basis for this bill? This is to relativize somewhat a certain number of screams of orphans that I hear at this tribune in the face of a simplification, some of which obviously tend to see only alleged perverse effects instead of measuring their real and proven assets. We refer to a law of 13 April 1995, promoted by our colleague, Mr. Erdman, who already understood a significant dimension of simplification. This law centralizes requests not to the Prosecutor’s Office but to the Chamber, the Prosecutor’s Office must issue an opinion within four months, the same deadlines being required from the Office of Foreigners and the Services of the State Security. The Minister of Justice then introduces the obligation of a birth certificate issued not by the embassy or consulate of the country of origin in Belgium, but on the spot, which is an important event for the subsequent. The second legislative element of recent evolution is based on the law of 22 December 1998, which still introduces certain modalities of simplification and easing for persons of the second generation as well as for persons wishing to obtain citizenship by marrying a person of Belgian citizenship. In both cases, the questionnaire and the survey on integration will remain a reality. A number of these questions are experienced, sometimes objectively and rightly, as sometimes humiliating, with a moralizing tone or an inquisitory method. This makes it possible to measure the progress of the new legislation proposed here: a principle of presumption of integration, as soon as the person makes a proper application to benefit from the new measures; a legislation that provides and dedicates the removal of this questionnaire that can be experienced as humiliating; a legislation that eases the age conditions; a legislation that imposes strict deadlines for the processing of the file by the Prosecutor’s Office and the Office of Foreigners, whose roles in the procedure are redefined and which contains several answers, made during parliamentary debates, to some criticisms relating to the requirements of strict deadlines. I would like to come back briefly. Beyond the fact that at the time, four-month deadlines had been left to the different departments concerned, it was necessary to find that some were shooting on the elastic about compliance with these deadlines and exceeded them at the end of the course. We first found that the work requested from these services, to whom a deadline will now be imposed, is no longer fully comparable to that which was previously requested from them within the four months. Today, we recorded that only negative opinions should be ⁇ , as envisaged in the government statement. Furthermore, we have observed in a very pragmatic and concrete way that in any case, the Commission of Naturalizations of our Parliament meets only every six weeks or so, which de facto extends the deadline and still allows to incorporate and take into account opinions that would slightly exceed the time limit imposed. Obviously, the question of the means of the prosecutors and of the Office of Foreigners must be restored, even though a number of services of the administration or of the judiciary have taken the unpleasant habit, dear colleagues, for a few months, to systematically resist any form of legislative evolution, branding a priori a problem of lack of means to carry out the mission that we entrust them. This interpellation must be heard and subject to dialogue and consultation. This will ⁇ be the subject of the public service audit scheduled by that same government. This will probably also be the subject of evaluation measures which will be taken by the Supreme Council of Justice, which will soon take office. This will finally ⁇ be the subject of an assessment promised for next year and on which many of those who today see more the disadvantages of a legislation than its actual and immediate positive effects will undoubtedly re-attract our attention. This applies to strict deadlines. I would like to insist on the free procedures, which is nothing. When one knows the concrete difficulties that some beneficiaries under the old legislation had to face — a true journey of the fighter — the assessment of the costs related to the formalities to be accomplished with the administrative authorities of their country of origin, to the journey which, he, is not free, to the leave that one must take in relation to his profession and which often represents a disadvantage, to the stay on the spot, in a hotel eventually, given that some of these persons have little attachment in the cities where they are to go, all this can represent fifteen, twenty, twenty-five thousand francs of impact on the budget of the applicants. Therefore, the free of charge of the procedure is a non-negligible point, as is the exemption of administrative forms in some cases. Mr. Speaker, Mr. Minister, Ladies and Gentlemen, I would like to leave the conclusion of this contribution to the debate to someone you will soon recognize.
