Mijnheer de voorzitter, ten eerste, ik dank de collega's die dit ontwerp samen met mij hebben ingediend en die ook aan de behandeling ervan hebben meegewerkt. Samen hebben wij een aantal praktische problemen die met de inwerkingtreding van de districtsraden gepaard gaan, opgelost. Het is een goede manier van parlementaire werking. Ten tweede, er kan nog een klein probleem ontstaan - dit probleem kan worden opgelost en is niet van wetgevende aard - bij het zich niet tijdig inschrijven als EUvreemdeling. In dat geval zal de minister niet anders kunnen dan desnoods bij circulaire duidelijk maken dat al diegenen die zich voor de gemeenteraadsverkiezingen hebben ingeschreven, ook aan de district- raadsverkiezingen kunnen deelnemen. Dit punt moet nog met de minister worden besproken. Ik vermeld het hier opdat reeds enig spoor van deze discussie zichtbaar zou zijn.

Mijnheer de voorzitter, mijn partij ziet geen problemen met het technische gedeelte van dit wetsvoorstel. Het amendement van de heer Borginon om de Europese vreemdelingen ook stemrecht te geven voor de districtsraden is volgens ons een zoveelste poging om te proberen het Vlaams Blok bij de komende verkiezingen in Antwerpen in de districtsraden van de macht te houden. Heel de campagne die nu door pater Leman wordt opgezet is vandaag opnieuw uitgebreid op radio en televisie aan bod gekomen. Hij heeft een persconferentie gegeven. Hij heeft een grootscheepse campagne aangekondigd opdat nog voor de zomer zoveel mogelijk vreemdelingen zich zouden laten naturaliseren, zodat zij op 8 oktober nog kunnen meestemmen. Het is één gestroomlijnde campagne om te proberen het Vlaams Blok in Antwerpen van de macht te houden. Het is toch wel jammer dat de Volksunie zich daartoe leent, een partij die in haar verleden zelf door het establishment genoeg werd aangevallen. Monsieur le président, chers collègues, je ferai juste un bref rapport destiné à marquer le coup. Le Sénat nous a transmis ce projet de loi relatif au financement des communautés, projet de loi touchant à des problématiques sensibles - celles des communautés -, mais aussi à des compétences importantes: l'enseignement, la petite enfance, la culture et autres. La période transitoire de dix ans terminée, l'ancien gouvernement n'ayant pas tranché, il était urgent de présenter rapidement un projet, sans sombrer dans le mélodrame. C'est ce qui fut fait. Le projet de loi prévoit dès lors un système de financement des communautés basé sur le nombre d'élèves, nombre permettant un traitement égal à chaque élève. Le contrôle des données finales est confié à un organisme indépendant, la Cour des comptes. Plusieurs points ont donc été abordés. Le problème du comptage et le choix du critère élèves plutôt que enfants a beaucoup alimenté la discussion. Le comptage des enfants n'était-il pas plus précis, mais le critère élèves ne répond-il pas plus au principe d'éga- lité inscrit dans la Constitution? Certains ont regretté l'absence de prise en compte des élèves de 18 ans et plus, présents dans l'enseignement secondaire. Le problème de la définition et du ramassage concurrentiel a aussi été évoqué. Le projet de loi met uniquement en place un cadre général en ce qui concerne le contrôle de la Cour des comptes, pour respecter son pouvoir autonome d'interprétation. Certains s'interrogent sur la compétence de la Cour des comptes pour ce qui concerne l'aspect politique de ces matières: comment décidera-t-elle si un écart est significatif? Pour le ministre, elle décidera sur la base d'une jurisprudence administrative qu'elle mettra en place. La date de remise du comptage, fixée au 15 mai pour cette année, paraît difficile à respecter. Certains ont regretté que ce projet de loi ne s'applique pas aussi à 1999; d'autres ont regretté que le gouvernement précédent n'ait pas été plus entreprenant en la matière. A la suite de ces discussions, du débat et du vote des différents amendements, la commission a adopté le texte du projet transmis par le Sénat, texte que nous soutenons et espérons voir mis en vigueur rapidement.

The bill therefore provides for a community funding system based on the number of students, allowing equal treatment for each student. The control of the final data is entrusted to an independent body, the Court of Auditors. Several points were therefore addressed. The problem of counting and choosing the criterion students rather than children has fuelled much of the discussion. Didn’t the counting of children be more precise, but didn’t the criterion of students respond more to the principle of equality enshrined in the Constitution? Some regretted the lack of consideration of students aged 18 and older, present in secondary education. The problem of definition and competitive collection was also discussed. The bill only establishes a general framework for the control of the Court of Auditors, in order to respect its autonomous interpretation power. Some question the Court of Auditors’ competence with regard to the political aspect of these matters: how will it decide whether a deviation is significant? For the Minister, it will decide on the basis of an administrative jurisprudence that it will establish. The deadline, set for May 15 for this year, seems to be difficult to meet. Some regretted that this bill did not apply to 1999 as well; others regretted that the previous government had not been more entrepreneurial in this matter. Following these discussions, the debate and the vote on the various amendments, the committee adopted the text of the draft submitted by the Senate, a text that we support and hope to see quickly come into force.

Mijnheer de voorzitter, mijnheer de minister, collega's, het tweede wetsontwerp heeft tot doel uitvoering te geven aan de Bijzondere Wet van 16 januari 1989 met betrekking tot de financiering van de gemeenschappen. De Bijzondere Wet stelt de kredieten vast die de gemeenschappen toegekend krijgen voor het verstrekken van het universitair onderwijs aan buitenlandse studenten. Sedert 1989 is dit niet aangepast. Nochtans bepaalt het huidige artikel 62 dat vanaf het begrotingsjaar 1990 zulks wel kon gebeuren. Dit ontwerp legt ook de verplichting op hierover voorafgaand overleg te hebben met de deelregeringen. De praktijk leert dat het aantal buitenlandse studenten toegenomen is en dat de Europese regelgeving ons ertoe noopt om buitenlandse studenten een gelijkwaardige behandeling te geven als Belgische studenten. Met dit ontwerp worden de bedragen verhoogd, zodat aan het Vlaams onderwijs 1,11 miljard frank wordt uitgegeven en aan het Waals onderwijs 2,26 miljard frank, volgens wettelijke criteria die volgens de regering door een verplicht vooroverleg worden voorafgegaan. De commissie heeft onder meer het kritisch advies van de Raad van State onder de loep genomen. Volgens de Raad van State werd met dit ontwerp de Bijzondere Wet niet uitgevoerd, maar werd ze integendeel gewijzigd, waardoor een bijzondere meerderheid werd vereist. Deze bijzondere wet komt volgens sommige leden slechts via gewone wet tot stand omdat er in de Kamer op dit ogenblik geen bijzondere meerderheid voorhanden is. Politieke motieven dirigeren de juridische redenering. Volgens de oppositie zou de Europese regelgeving niet gewijzigd zijn. De minister verwees in zijn repliek daarop onder meer naar veroordelingen van de Belgische Staat door het Europees Hof van Justitie. De amendementen die terzake werden ingediend werden alle verworpen. De tekst, identiek aan de tekst van de Senaat, werd goedgekeurd met 9 stemmen tegen 4. Mijnheer de voorzitter, ik dank u reeds op voorhand om mij toe te staan namens mijn fractie het woord te kunnen voeren.

Beide wetsontwerpen vormen uiteraard een politieke deal, zonder welke de paarse coalitie niet tot stand was gekomen. eerste minister Verhofstadt is erin geslaagd datgene te doen wat zijn voorganger nooit gedaan heeft, namelijk Vlaanderen laten dokken voor de problemen van het Franstalig onderwijs. Dit hoeft ons niet te verrassen. Historici zeggen l'histoire se répète. Dat is hier ook het geval. In 1991 had de heer Verhofstadt reeds aan Wallonië beloofd voorschotten te geven op de algemene herziening van de financieringswet. Hij doet dit huzarenstukje in 1999 met meer succes over. Boze tongen beweren dat da joeng niet veranderd is. Vlaanderen stoot zich voor de tweede maal aan dezelfde steen, maar nu wel met financiële gevolgen. Toen dit akkoord tot stand is gekomen, werd het niet onmiddellijk openbaar gemaakt. Men spreekt vandaag van openbaar zwijgen. Intern werd er wel gepraat. Als ik de berichten in de kranten mag geloven, zou dit akkoord tot stand gekomen zijn op een verjaardagsfeestje voor minister Vande Lanotte. Mijnheer de vice-eerste minister, eigenlijk zouden we detective moeten gaan spelen en u vragen wanneer u verjaard bent. Zo kunnen we te weten komen wanneer het geheime onderwijsakkoord van deze regering initieel tot stand is gekomen. Vervolgens werd er wetgevend werk gedaan op het kabinet van de viceeerste minister. In elk geval waren de afspraken die aanvankelijk binnen de meerderheid waren gemaakt - en waarvan de Volksunie niet of onvoldoende op de hoogte was - niet duidelijk. Dat blijkt onder meer ook uit diverse verklaringen van de eerste minister zelf. Hij heeft gezegd dat hij overleg heeft gepleegd met het Rekenhof. Als we het verslag van de Senaat erop nalezen, stellen we vast dat het Rekenhof duidelijk zegt dat er geen formeel overleg heeft plaatsgevonden met de regering. De premier heeft in zijn verklaring in september gezegd dat het vrij evident was dat de schoolplichtige jeugd als basis werd genomen. Hij antwoordde dit op een vraag van mevrouw Van de Casteele. Als we het ontwerp dat hier voorligt onder de loep nemen, moeten we duidelijk vaststellen dat de objectieve criteria die hier worden gebruikt totaal in tegenstrijd zijn met de verklaring die de eerste minister in september aflegde. De eerste minister heeft ook gezegd dat deze ontwerpen tijdelijk waren. We moeten nochtans vaststellen dat de Waalse regering het tegenovergestelde liet optekenen in het Overlegcomité. De eerste minister stelde bovendien dat het in communautaire zaken afgelopen moest zijn met de wafelijzerpolitiek. Deze ontwerpen zijn een typisch voorbeeld van consumptiefederalisme waarbij een wet wordt goedgekeurd ten behoeve van één Gemeenschap. Toen het akkoord er eenmaal was, moest alles snel en zo mogelijk ook efficiënt gaan. Het is echter iets minder efficiënt verlopen. Men spreekt van het Sint- Elooisakkoord. Sint-Elooi is de patroonheilige van de smeden. In de nacht van Sint-Elooi is in elk geval wat recht was krom gesmeed. In een paar uren werd er een groot kostenplaatje voor de Vlaamse Gemeenschap opgesteld. Het triomfalisme van de minister-president van Vlaanderen, dat het niet om 1,8 miljard frank maar slechts om 1,55 miljard frank gaat, is dan ook totaal misplaatst. Er zijn duidelijk ook legistieke opmerkingen te maken over deze ontwerpen. De kritiek van de Raad van State op deze ontwerpen was sneerend. Deze regering houdt daar geen rekening mee, niettegenstaande ze het tegenovergestelde beweert. De Raad van State zegt dat deze ontwerpen ongrondwettig voorkomen en de regering ontkent dat, ten onrechte. De vice-eerste minister zei in de commissie dat deze ontwerpen wel in overeenstemming zijn met artikel 180 van de Grondwet. Hij baseerde zich hiervoor op de extensieve interpretatie. Hij beweerde dat er reeds uitbreidingen hadden plaatsgevonden van de wetgeving inzake het Rekenhof, de wetgeving van 1995 en 1998, de laatste met de beperkte doelmatigheidscontrole. Die wetten hebben echter in elk geval niet aan de basisbevoegdheden van artikel 180 van de Grondwet geraakt. Deze ontwerpen doen dat wel. Het Rekenhof mag nu onder meer het vrij onderwijs controleren, mag lokale besturen die onderwijs organiseren controleren, wat een schending van de gemeentelijke autonomie is, mag privé-onderwijs controleren, mag nietgesubsidieerd onderwijs, dat niet over overheidsgelden beschikt, controleren. Dat druist in tegen de bepalingen van artikel 180 van de Grondwet. Het artikel 180 gaf het Rekenhof bevoegdheden tot legaliteitscontrole en tot een beperkte opportuniteitscontrole. Het Rekenhof wordt nu van een beleidscontrolerend instrument van de wetgevende macht omgevormd tot een beleidsvoorbereidend instrument van de uitvoerende macht. Het Rekenhof wordt zo een speelbal van toevallige meerderheden met het gevaar de onafhankelijkheid en de reputatie, die het jarenlang heeft opgebouwd, te verliezen. Deze wet zou een bijzondere wet moeten zijn. Men heeft er een gewone wet van gemaakt aangezien deze meerderheid geen bijzondere meerderheid in het parlement kan krijgen. Politieke motieven vormen de basis van juridische redeneringen. Deze wet is onuitvoerbaar en oncontroleerbaar. Dat zal in de praktijk blijken. Het Rekenhof moet op 6 weken tijd de elektronische bestanden controleren en de criteria ervan bepalen. Indien de elektronische bestanden niet correct zijn, dient het Rekenhof binnen de 6 weken het leerlingenaantal na te gaan tussen 15 januari en 1 februari. In de besprekingen van de Senaat bleek dat het schaamlapje van de concurrentiële ophalingen alleen kan worden voorgehouden op basis van verklaringen van eer, die niet kunnen worden gecontroleerd. Er gebeuren, tussen haakjes, ophalingen van minder dan 9 leerlingen. Zij vallen hier dus niet onder. Het Rekenhof krijgt bovendien een beleidsmarge. Mijnheer de vice-eerste minister, wij hebben de besprekingen in de Kamer kort gehouden. Wij hebben de oefening van de Senaat niet herhaald. U hebt eigenlijk bevestigd dat het Rekenhof autonome uitleggingsbevoegdheid voor deze wet zal krijgen waardoor u niet op specifieke vragen in de Senaat hebt geantwoord. Het is niet aan het Rekenhof om wetten op dat vlak te interpreteren maar aan de wetgever om objectieve criteria in te vullen. Er is een belangrijk element dat niet is aangehaald in de besprekingen van de Senaat. Het rijksregisternummer behoort in voorkomend geval tot de gegevens die de gemeenschappen moeten bezorgen aan het Rekenhof. Het rijksregister is een belangrijk element omdat op die manier een objectieve controle kan plaatsvinden en men dubbeltellingen kan nagaan. Het rijksregisternummer moet niet worden bekendgemaakt, in tegenstelling tot alle andere elementen zoals de naam en het adres. Het rijksregisternummer wordt in de wet vermeld als in voorkomend geval , dus als het er is. Men weet inder- daad dat noch de Vlaamse Gemeenschap, noch de Waalse Gemeenschap volledig in orde is met gegevens omtrent het rijksregisternummer. Men moet op het terrein vaststellen dat Vlaanderen quasi niet in orde is. Het Vlaams onderwijs keert subsidies uit op basis van het rijksregisternummer van leerlingen. Dat is de enige objectieve controle. In het Waals onderwijs staat men daar ver van. Deze meerderheid is tevreden met de belofte van de twee gemeenschappen dat ze hun best zullen doen. Ze hebben daar noch een timing, noch een resultaatsverbintenis aan gekoppeld. Het gaat om een louter morele belofte, een inspanningsverbintenis die op geen enkele wijze wordt bestraft indien ze niet op korte of middellange termijn wordt ingevuld. U geeft het enige instrument van het Rekenhof om op een ernstige en objectieve manier dubbeltellingen te controleren, uit handen. Om deze redenen zullen wij nogmaals een amendement indienen om deze wet terzake sluitender te maken. Dit is een politiek akkoord dat ons moet verbazen en niet verbazen. Tijdens de vorige wetgevende verkiezingen van 13 juni, zei de fractievoorzitter van de VLD in het Vlaams Parlement, de heer Denys, dat er geen herziening van artikel 39 van de financieringswet mocht gebeuren zonder een globale herziening van de staatshervorming. Ze moesten aan elkaar worden gekoppeld. Dit artikel moest de hefboom zijn. We moeten vaststellen dat die hefboom uit handen wordt gegeven. Tijdens besprekingen in de commissie voor de Herziening van de Grondwet hier in de Kamer viel het op dat één Franstalige collega, de heer Maingain, heeft geïntervenieerd. Hij juichte toe dat er een ontkoppeling is gebeurd tussen de herziening van dit artikel 39 en de verdere wijziging van de staatshervorming. In dezelfde lijn als de verklaringen van fractievoorzitter Denys, zei de toenmalige partijvoorzitter Verhofstadt toen dat hij pleitte voor een Vlaams front om de gesprekken gezamenlijk voor te bereiden. Die woorden is hij vergeten, minstens heeft hij ze ingeslikt. De partijvoorzitter van de Volksunie zei dat de VLD haar naam opnieuw diende te wijzigen in de oorspronkelijke PVV, de Pest Voor Vlaanderen . De naam dient niet gewijzigd. De VLD kan haar naam behouden: Vlaanderen Laten Dokken. Het doet ons uiteraard deugd dat ook onze vrienden van de Volksunie deze twee ontwerpen zullen afkeuren. Hun rol in de cruciale periode tijdens het jaareinde was zeer bizar. Mevrouw Van de Casteele heeft de premier hierover geïnterpelleerd, onder meer tijdens de septemberverklaring. De premier vergiste zich toen en beweerde dat de bevolkingscijfers evident moeten worden gebruikt. Ook de VU vertolkte dit nobel standpunt, maar ze hebben het moeten inslikken. Ze hebben toen gezegd dat de verandering van de financieringswet op de COSTA moest worden besproken. Die woorden waren nog niet koud of ze beweerden dat het niet op de COSTA moest worden besproken, maar dat men de ronselpraktijken wel moest gaan uitzuiveren. We zien dat die uitgezuiverd worden. Ronselpraktijken mogen nog op particulier initiatief en zeker als het om minder dan 9 leerlingen gaat. Ook dat begreep de VU en ze verklaarden deze wet tijdelijk, hoogstens voor een jaar. Wanneer ook dat niet kon worden hard gemaakt in deze wet, beloofden ze dat indien er binnen twee jaar niets zou zijn gebeurd, ze een wetsvoorstel terzake zouden indienen. Dit is in die cruciale periode pijnlijk, vooral omdat u met uw vertegenwoordigers in de Vlaamse regering, de hefboom vast had om deze twee wetten nog tegen te houden. Als oppositie konden wij dat niet. U kon dit vanuit de Vlaamse meerderheid. Jammer genoeg hebben sommige leden van de VU hun twee ministers voor een periode van twee jaar vastgespijkerd op de regeringsbanken en zo de herziening van de financieringswet mogelijk gemaakt. Aldus kan een belangrijk bedrag Vlaams geld - het doet niet terzake dat het maar 1,55 miljard is - zonder objectieve controle van Vlaanderen naar Wallonië sluizen. Dit is een slecht akkoord. Vlaanderen betaalt voor 64% belastingen in dit land en zal meer moeten betalen. Wij zijn geen tegenstander van een gelijke behandeling van een leerling in het onderwijs. Eigenlijk is dat ook in de financieringswet bepaald en voor een stuk bij de wet van 1989 afgesproken. Een Waalse leerling mag inderdaad gelijk zijn aan een Vlaamse leerling. Wij hebben echter geen garanties over de wijziging van deze ontwerpen. Er is geen objectieve controle mogelijk. Deze ontwerpen zijn niet alleen slecht voor Vlaanderen, ze zijn ook slecht voor het onderwijs. De concurrentieslag om leerlingen en meer in het bijzonder de concurrentieslag in Brussel, zal blijven voortduren en dit kan niet ten bate zijn van de kwaliteit van het onderwijs. Voor ons is het onbegrijpelijk dat een objectieve en beleidsneutrale regeling volgens de bevolkingscijfers niet als basis heeft gediend voor de wijziging van de financieringswet. Dit zijn niet alleen onze woorden of de woorden van mevrouw Van de Casteele, maar het waren ook de woorden van de toenmalige minister van Onderwijs Van den Bossche toen hij nog Vlaamse bevoegdheden had. Je voudrais réunir mon propos sur les deux textes, même si formellement notre ordre du jour parle d'abord de l'article 39, puisqu'ils sont connus l'un et l'autre sous le terme d' accord de la Saint-Eloi et que, comme chacun le sait, Saint-Eloi est le patron des orfèvres et des forgerons. On pourrait penser que tout cela est prémonitoire, mais en fait, les accords de la Saint-Eloi constituent sans aucun doute un très bel hommage au patron des orfèvres. Les accords de la Saint-Eloi représentent ce qu'il y a de mieux dans le domaine de l' orfèvrerie politicienne que certains, à l'époque, ont appelé la plomberie. Je pré- tends qu'ils font preuve d'illégalité, de duplicité et, même si le terme est abusif pour certains, de mensonge - je m'expliquerai à ce sujet - combinés à un brio digne des grands orfèvres, au nombre desquels figure d'ailleurs Saint-Eloi qui vécut à Tournai au Ve siècle, pour rester dans les références historiques. Ces accords de la Saint-Eloi constituent une insulte au patron des forgerons dans la mesure où ils sont d'une infime fragilité. Ils ne résisteront ni à l'examen d'un recours introduit devant la Cour d'arbitrage, ni à la moindre poussée de fièvre communautaire qui serait l'occasion de les remettre en cause sous prétexte d'illégalité. J'en veux davantage, bien entendu, aux membres francophones du gouvernement qui, selon moi - et je m'emploierai à le démontrer -, se sont fait rouler, une fois de plus, par leurs partenaires flamands. En fait, cette attitude a conduit les partenaires francophones à devoir invoquer demain, pour rester dans la même logique, non plus Saint-Eloi, mais Sainte-Rita, patrone des causes désespérées qui sera sans doute évoquée pour sortir du mauvais pas dans lequel nous sommes aujourd'hui. Je voudrais revenir sur ces trois caractéristiques: l'illégalité, la duplicité et le mensonge. Premièrement, l'illégalité des accords. Ce n'est pas nous qui l'affirmons, ni moi, mais bien le Conseil d'Etat dans son avis rendu en chambres réunies. Il y constate que les deux projets exécutant les accords de la Saint-Eloi sont entachés de graves illégalités. Je ne peux m'empêcher de rappeler, avant de l'évoquer, que le Conseil d'Etat est une institution que le gouvernement n'a pas intérêt à négliger. Sans vouloir insister trop lourdement sur la question, je suppose quand même que la nomination de Mme Reynders a dû rafraîchir la mémoire de certains membres du gouvernement quant à l'intérêt et au rôle du Conseil d'Etat, tout comme l'annulation, par la Cour d'arbitrage, d'un décret pris à l'initiative de Mme Onkelinx, concernant la suspension automatique des professeurs accusés de pédophilie, sur lequel le Conseil d'Etat a rendu un avis extrêmement critique et pour lequel la Cour d'arbitrage vient de prononcer l'illégalité. Le Conseil d'Etat et la Cour d'arbitrage sont donc deux institutions qu'il ne faut pas prendre à la légère. En l'occurrence, le Conseil d'Etat formule cinq critiques fondamentales à l'encontre du premier projet discuté aujourd'hui, c'est-à-dire l'article 39, et une critique fondamentale à l'encontre du projet de loi exécutant l'article 62 de cette même loi. En ce qui concerne le projet de loi, le Conseil d'Etat souligne d'abord qu'il viole l'article 39, §2, alinéa 2 de la loi spéciale de financement qu'il est censé exécuter dans la mesure où il ne prévoit aucun moyen pour l'année 1999, alors que cette disposition imposait que des critères objectifs soient fixés, y compris pour cette année 1999. Il relève ensuite que le projet de loi est contraire à l'article 180 de la Constitution qui n'est pas soumis à révision dans la mesure où il attribue de nouvelles compétences de contrôle, de vérification et d'arbitrage à la Cour des comptes, alors qu'il ressort de la jurisprudence du Conseil d'Etat que seul le constituant peut attribuer des compétences à la Cour des comptes. Il s'interroge encore sur le point de savoir si la complexité de la procédure mise en place ne risque pas de rendre le régime inopérant. Il considère que les dispositions visant à exclure des chiffres les élèves ayant fait l'objet d'un ramassage concurrentiel dans une autre communauté est aussi contraire à l'article 39, §2, alinéa 2 de la loi spéciale de financement, dans la mesure où la distinction entre ramassage concurrentiel et non concurrentiel ne repose pas sur un critère comme le requiert la loi de financement. Il ajoute d'ailleurs à cet égard qu'il y a lieu de s'interroger sur la compatibilité de cette disposition avec les droits fondamentaux que sont la liberté d'enseignement et la libre circulation des personnes. Enfin, il relève une contradiction entre l'exposé des motifs qui indique que, pour être considéré comme objectif au sens de l'article 39, §2, alinéa 2 de la loi spéciale de financement, un critère doit être neutre sur le plan politique, c'est-à-dire qu'il ne doit pas être susceptible d'interprétation divergente ou de manipulation par chacune des communautés. Or, le Conseil d'Etat constate que la référence contenue dans le projet de loi à la notion d'élève régulièrement inscrit dans un établisse- ment d'enseignement organisé ou subventionné n'est pas un critère neutre puisque la régularité des inscriptions, l'organisation de l'enseignement et son subventionnement dépendent des compétences des communautés. Pour augmenter ces chiffres, chaque communauté pourrait décider d'octroyer par exemple un franc de subvention à tous les établissements qui ne sont pas subventionnés actuellement. Nous estimons donc que le projet du gouvernement, via l'article 39, §2 de la loi spéciale de financement, travestit la notion d'élève en excluant de la population scolaire prise en compte pour le calcul des montants fixés par le premier projet de loi, les élèves âgés de plus de 17 ans, ce qui vise par exemple les bisseurs, les trisseurs, contrairement à ce qui avait été fait en 1989, lors de la genèse de cette disposition. Cette exclusion remet en cause le principe de solidarité auquel le PSC est profondément attaché. Elle rend difficile la solidarité dont doit faire preuve la communauté la plus favorisée sur le plan socio-économique avec la communauté la moins favorisée, au sein de laquelle il est inévitable que des redoublements soient plus nombreux. J'espère que ce renoncement à la solidarité entre les communautés n'augure pas d'autres renoncements plus graves en ce qui concerne la sécurité sociale ou, peutêtre bientôt, la fiscalité. En ce qui concerne le second projet, le Conseil d'Etat formule dans son avis une critique fondamentale à l'encontre du projet de loi: il estime en effet qu'il viole l'article 62 de la loi spéciale de financement qu'il est précisément censé exécuter. L'article 62 de la loi spéciale de financement ne permet pas au législateur ordinaire de modifier les montants de base des crédits accordés par le pouvoir fédéral aux communautés, au titre de financement des élèves étrangers pour plus d'une année. Il souligne que le montant doit, en vertu de l'article 62, soit être fixé chaque année dans le budget, comme d'ailleurs ce fut fait depuis 1990, soit être inscrit à l'article 62 lui-même, mais alors via une modification de ce dernier par le biais d'une loi spéciale, ce qui n'est pas le cas en l'occurrence. Il en conclut donc que si l'intention du législateur est de modifier les montants définis au titre de l'article 62 pour plus d'une année, il lui incombe de modifier à la majorité spéciale la loi spéciale de financement. Ni l'exposé des motifs de ces deux projets de loi, ni les interventions du ministre en commission, ni même les discussions en commission n'ont permis de lever les objections graves d'illégalité formulées par le Conseil d'Etat à l'encontre des deux projets. Je note en particulier la manière à la fois scandaleuse et insuffisante dont il a été répondu à l'objection du Conseil d'Etat relative au caractère subjectif du critère relatif au ramassage concurrentiel des élèves. Pour rencontrer l'objection du Conseil d'Etat, on vise en fait tous les ramassages scolaires puisqu'on vise non seulement les ramassages organisés par les communautés et les régions, mais également les ramassages effectués par une entité reconnue ou subventionnée par celles-ci, ce qui revient à viser tous les ramassages, dès lors qu'un véhicule de plus de huit places est utilisé. La rupture des solidarités entre la Communauté franc¸aise et les habitants des communes à facilités est donc totale et il n'y a malheureusement pratiquement pas de francophones présents au parlement pour s'en rendre compte. Les enfants francophones des communes à facilités, soit ne pourront plus bénéficier du ramassage scolaire, soit ne seront plus pris en compte dans le calcul des moyens de la Communauté franc¸aise. La formule retenue pour le ramassage scolaire imposera à terme à la Communauté franc¸aise de mettre fin au ramassage dans les communes à facilités. En effet, si elle maintient les ramassages, elle sera pénalisée deux fois, d'une part en raison du coût du ramassage et d'autre part, en raison de l'absence de prise en compte de ces élèves dans la répartition des moyens. C'est grave; je suis impatient de voir si les parlementaires du FDF qui se sont toujours présentés comme les grands défenseurs de la périphérie, se rallieront au gouvernement sur ce point. La réponse est aussi insuffisante. Il n'est en effet apporté aucune réponse aux objections du Conseil d'Etat quant à la compatibilité de cette mesure avec les droits fondamentaux que sont la liberté d'enseignement et la libre circulation des personnes. J'attends toujours les éléments de réponse à cet égard. Je note ensuite que tous les amendements visant à transformer les deux projets de loi en projets de loi spéciale ont été rejetés sans qu'aucun argument substantiel n'ait été invoqué. Je note enfin qu'aucune explication satisfaisante n'est fournie quant à la dénaturation du concept d'élève qu'implique le projet du gouvernement et quant au fait qu'aucun moyen n'est prévu pour l'année 1999. Que l'on ne vienne pas nous dire qu'il était trop tard en décembre 1999 pour prévoir de tels moyens! Lors de la discussion de chaque ajustement du budget 1999, nous avons déposé des amendements en ce sens. Ils ont tous été rejetés, avec l'appui des francophones de la majorité. Concrètement, pour nous, les conséquences de cette capitulation se traduiront à l'avenir par une perte de moyens financiers récurrente de 1,8 milliard, en raison de l'exclusion des élèves de plus de 17 ans, et par la perte, au titre seul de l'année 1999, d'une somme de 3,6 milliards de francs. C'est beaucoup quand on connaît la situation financière de l'enseignement du côté francophone. Les enseignants en sauront gré aux francophones de la majorité. Voilà pour ce qui est de l'illégalité du projet du gouvernement. Je voudrais ensuite évoquer sa duplicité, au moins à trois égards. Le premier, c'est celui du contenu des accords de la Saint-Eloi. Il semble que ces accords comprennent une série de clauses secrètes qui apparaissent progressivement au fil du temps. Alors qu'au début, on avait le sentiment que seuls les deux projets de loi dont nous discutons actuellement avaient fait l'objet de ces accords, nous avons découvert que le ministre des Finances avait, à la suite de ces accords, changé radicalement d'attitude en ce qui concerne le degré d'autonomie fiscale autorisé par la loi de financement. C'est en réponse à l'une de mes interpellations qu'il avait donné son premier point de vue. Nous avons appris la réactivation de l'inspection linguistique de l'enseignement par la désignation de nouveaux inspecteurs linguistiques. Puis, nous avons appris que la régionalisation avant Pâques de l'agriculture et du commerce extérieur avait aussi fait l'objet de ce sordide marchandage. Nous nous attendons donc, dans les semaines et mois à venir, à voir apparaître de nouvelles clauses, jusque-là gardées cachées par les négociateurs. Nous craignons - et nous en sommes quasi certains - qu'elles ne pourront être que défavorables aux francophones. Deuxième exemple de duplicité: les francophones du gouvernement prétendent que l'augmentation du crédit prévue par l'article 62, §1er de la loi spéciale de financement, est acquise, oserais-je le dire, pour l'éternité! Tandis que les Flamands, soutenus en cela par le Conseil d'Etat - ce qui n'est pas rien -, prétendent que cet accord ne vaut que pour l'année 2000. Les francophones jouent les autruches. Ils prétendront demain que leur bonne foi a été abusée, alors que tant le Conseil d'Etat que l'opposition les avaient mis en garde. Il faudra s'en souvenir. Dernier élément de duplicité: en commission du Sénat, le ministre de l'Economie a justifié l'augmentation du crédit prévu par l'article 62, §1er, destinée à financer les étudiants universitaires étrangers, par une augmentation du nombre d'étudiants de 80%. Pour être précis, il a dit: le nombre d'étudiants étrangers européens a augmenté de manière sensible. Il s'agit d'une augmentation d'envi- ron 80% . A l'examen et malgré le refus réitéré du ministre de fournir des chiffres précis, il semble que l'augmentation serait bien de 80% dès lors qu'on prend en compte les étudiants de l'enseignement supérieur non universitaire. Si tel est le cas, il faut alors être cohérent: si on prend en compte les étudiants non universitaires, il faut modifier l'article 62, §1er afin de permettre leur inclusion dans les calculs. Il faut également que la clé de répartition de ce crédit entre les communautés soit elle aussi adaptée à la réalité des chiffres concernant non seulement les étudiants universitaires mais également ceux du supérieur non universitaire qui sont inscrits dans chacune des deux communautés. En jouant sur les mots et sur les chiffres, le gouvernement fait encore preuve de duplicité. Pour clarifier la situation, nous avons déposé deux amendements visant à inclure les étudiants du supérieur non universitaire tant pour le calcul du crédit que pour sa répartition entre les communautés. Selon les chiffres dont nous disposons, faute de disposer de ceux que le ministre a refusé de nous donner, cette rectification représente un montant récurrent de 360 millions de francs par an. J'en viens au troisième volet de mon intervention. Avec l'illégalité et la duplicité, les orfèvres gouvernementaux sont parvenus à combiner le mensonge. Puisque j'en suis à des métaphores inspirées de la vie des saints, je me permets de me référer à une distinction religieuse entre les mensonges par action et les mensonges par omission. L'attitude du gouvernement relève de cette seconde catégorie. Tout au long de la discussion, celui-ci n'a eu de cesse de nous cacher les chiffres sur lesquels il fondait la répartition des moyens, tirée de l'article 62, § 1er de la loi spéciale de financement ainsi que le fait qu'il avait chargé la Cour des comptes, en violation de la Constitution, d'exécuter des missions que doit lui conférer le premier projet de loi sans attendre que celui-ci soit voté. Cela, c'est une première! C'est, en effet, la première fois que le gouvernement impose, sans le concours du pouvoir législatif, une mission à la Cour des comptes, qui est une institution relevant du pouvoir législatif et qui est chargée de contrôler l'exécutif. C'est une violation patente de la séparation des pouvoirs. Elle témoigne d'ailleurs du peu de cas que fait le gouvernement du respect de nos institutions et horresco referens, le gouvernement persiste, puisqu'à l'égard d'un audit de la SNCB dont nous allons parler demain après-midi, la même procédure a été utilisée par la ministre des Transports, qui, par le détour d'une initiative parlementaire, dont le gouvernement est à la source, demande à la Cour des comptes une intervention pour compte du gouvernement. En conclusion, je souhaite solennellement mettre les francophones de cette assemblée en garde - il en reste un - contre les conséquences dramatiques qu'aura pour la Communauté franc¸aise l'adoption des deux projets de loi. J'espère, monsieur le député, que vous en ferez part à vos amis du FDF. Le premier entérine une capitulation francophone, malgré l'avis du Conseil d'Etat qui avait entièrement désavoué les francophones du gouvernement, dont les concessions excessives ont été jugées contraires à la loi spéciale de financement. Cette capitulation représente pour 1999, 3,6 milliards de francs et pour les années suivantes, 1,8 milliard, soit 25 milliards sur dix ans. Le second projet de loi, quant à lui, ressemble étrangement à un miroir aux alouettes, puisqu'il accorde aux francophones des moyens supplémentaires, incontestablement 795 millions de francs, mais qui sont loin de compenser le montant auquel les francophones ont renoncé dans le cadre du premier projet et par le biais d'un instrument juridique inadéquat, ce qui les expose à un arrêt de la Cour d'arbitrage qui réduira à néant ce faible acquis. En outre, il répartit les montants dégagés par le gouvernement fédéral d'une manière qui lèse les francophones de 360 millions de francs par an, c'est-à-dire 4 milliards sur dix ans. A ces renoncements francophones, il convient encore d'ajouter les suivants sur la régionalisation de l'agriculture et du commerce extérieur, intervenue ultérieurement, sur la réactivation contraire aux droits de l'homme de l'inspection linguistique et sur l'autonomie fiscale, qui heureusement, n'a pas encore été exécutée. Je crains que le revirement d'attitude patent du ministre des Finances par rapport aux soustractionnels ciblés sur les bas revenus, que se propose d'accorder le gouvernement flamand, n'ouvre la porte à une interprétation de la loi de financement des communautés et des régions qui rendra possible une concurrence fiscale exacerbée entre les régions, souhaitée par les Flamands - ils ne s'en sont jamais cachés - mais à laquelle ne survivrait pas le niveau des vie des Wallons. A cet égard, j'attire votre attention sur une carte blanche publiée dans le journal Le Soir, signée par quelques- uns de nos plus grands économistes, qui sonnent, toutes tendances confondues, le tocsin par rapport au risque de l'autonomie fiscale. En conclusion, monsieur le président, nous estimons que le premier projet de loi est imbuvable, tandis que le second constitue une duperie, s'il n'est pas adopté, comme le suggère le Conseil d'Etat, à la majorité spéciale et si les montants ne sont pas eux-mêmes adaptés.

I thank you. I would like to gather my words on the two texts, although formally our agenda speaks first of article 39, since they are both known under the term agreement of the Saint-Eloi and that, as everyone knows, Saint-Eloi is the patron of orphans and forgers. One might think that all this is premonitorious, but in fact, the agreements of the Saint-Eloi constitute undoubtedly a very beautiful tribute to the patron of the orphans. But they also constitute an insult and an insult to the boss of the forgers who, themselves, produce durable works. The Agreements of Saint-Eloi represent the best in the field of political orphanage that some, at the time, called plumbing. I pretend that they demonstrate illegality, duplicity and, even if the term is abusive for some, lies - I will explain myself on this subject - combined with a brilliance worthy of the great orphans, among which there is also Saint-Eloi who lived in Tournai in the fifth century, to remain in the historical references. These agreements of the Saint-Eloi constitute an insult to the patron of the forgers in so far as they are of a slight fragility. They shall not resist the examination of an appeal brought before the Court of Arbitration, nor the slightest rise of Community fever which would be the occasion to challenge them under the pretext of illegality. I want more, of course, to the French-speaking members of the government who, in my opinion – and I will try to prove it – have been rolled, once again, by their Flemish partners. In fact, this attitude has led the Franco-speaking partners to have to invoke tomorrow, to remain in the same logic, no longer Saint-Eloi, but Sainte-Rita, patron saint of desperate causes that will probably be evoked to get out of the bad step in which we are today. I would like to return to these three characteristics: illegality, duplicity, and lies. First, the illegality of agreements. This is not stated by us, nor by me, but by the Council of State in its opinion delivered in chambers assembled. He notes that the two projects executing the Saint-Eloi agreements are plagued with serious illegalities. I cannot help reminding, before mentioning it, that the Council of State is an institution that the government has no interest in neglecting. Without wanting to insist too heavily on the issue, I presume, however, that the appointment of Ms Reynders must have refreshed the memory of some members of the government regarding the interest and role of the State Council, as well as the cancellation, by the Arbitration Court, of a decree taken at the initiative of Ms Onkelinx, concerning the automatic suspension of professors accused of pedophilia, on which the State Council has given an extremely critical opinion and for which the Arbitration Court has just ruled illegal. The State Council and the Arbitration Court are therefore two institutions that should not be taken lightly. In this case, the State Council formulates five fundamental criticisms against the first draft discussed today, namely Article 39, and one fundamental criticism against the draft law implementing Article 62 of that same law. As regards the draft law, the State Council first points out that it violates Article 39, §2, paragraph 2 of the Special Financing Act which it is supposed to execute in so far as it does not provide for any means for the year 1999, while that provision required that objective criteria be established, including for that year 1999. It further notes that the bill is contrary to Article 180 of the Constitution, which is not subject to revision in so far as it assigns new control, verification and arbitration powers to the Court of Auditors, while it follows from the case-law of the State Council that only the constituent can assign powers to the Court of Auditors. It still asks itself whether the complexity of the procedure established does not risk making the regime inoperative. He considers that the provisions aimed at excluding from the figures students who have been subject to a competitive pick-up in another community is also contrary to Article 39, §2, paragraph 2 of the Special Funding Act, in so far as the distinction between competitive and non-competitive pick-up is not based on a criterion as required by the Funding Act. It further adds in this regard that it is necessary to question the compatibility of that provision with the fundamental rights of freedom of education and the free movement of persons. Finally, it finds a contradiction between the statement of reasons which indicates that, in order to be considered as an objective within the meaning of Article 39, §2, paragraph 2 of the Special Financing Act, a criterion must be politically neutral, that is, it must not be subject to divergent interpretation or manipulation by each of the communities. However, the State Council observes that the reference contained in the bill to the notion of a student regularly enrolled in an organized or subsidized educational institution is not a neutral criterion since the regularity of the enrollments, the organization of the teaching and its subsidization depend on the competence of the communities. To increase these numbers, each community could decide to grant, for example, a grant franc to all establishments that are not currently subsidized. We therefore consider that the government project, through Article 39, §2 of the Special Financing Act, disguised the notion of student by excluding from the school population taken into account for the calculation of the amounts fixed by the first draft law, students aged over 17 years, which covers, for example, bisers, trisseurs, contrary to what had been done in 1989, when the genesis of this provision. This exclusion challenges the principle of solidarity to which the PSC is deeply attached. It makes difficult the solidarity that the most socio-economically favoured community must demonstrate with the least favoured community, within which it is inevitable that there will be more redoublements. I hope that this renunciation of solidarity between communities does not increase further serious renunciations in terms of social security or, ⁇ soon, taxation. With regard to the second draft, the State Council in its opinion formulates a fundamental criticism of the draft law: it in fact considers that it violates Article 62 of the Special Financing Act which it is precisely intended to execute. Article 62 of the Special Financing Act does not allow the ordinary legislator to modify the base amounts of the credits granted by the federal authority to communities, for the purpose of financing foreign students for more than one year. He emphasizes that the amount must, under Article 62, either be fixed each year in the budget, as has been done since 1990, or be included in Article 62 itself, but then through a modification of the latter through a special law, which is not the case in this case. He therefore concludes that if the legislator intends to change the amounts defined under Article 62 for more than one year, it is his responsibility to amend the Special Financing Act by special majority. Neither the exposition of the reasons for these two bills, nor the interventions of the minister in committee, nor even the discussions in committee have allowed to lift the serious objections of illegality formulated by the State Council against the two projects. I note in particular the both scandalous and insufficient response to the State Council objection concerning the subjective nature of the criterion relating to the competitive collection of pupils. In order to meet the State Council objection, it is in fact aimed at all school gatherings since it is aimed not only at gatherings organized by communities and regions, but also at gatherings carried out by an entity recognized or subsidized by them, which is equivalent to targeting all gatherings, as long as a vehicle with more than eight seats is used. The rupture of solidarity between the French Community and the inhabitants of facilities communes is therefore total and there are, unfortunately, practically no French speakers present in the parliament to be aware of it. French-speaking children in facilitated communes will either no longer be able to benefit from the school collection or will no longer be taken into account in the calculation of the means of the French Community. The formula adopted for school collection will ultimately impose on the French community to end collection in facilities communes. Indeed, if she ⁇ ins the gathering, she will be penalized twice, on the one hand because of the cost of the gathering and on the other, because of the lack of consideration of these students in the distribution of resources. This is serious; I’m looking forward to seeing if the FDF parliamentarians who have always presented themselves as the great defenders of the periphery will join the government on this point. The answer is also insufficient. There is, in fact, no response to the objections of the State Council as to the compatibility of this measure with the fundamental rights of freedom of education and the free movement of persons. I am still waiting for answers in this regard. I further note that all amendments aimed at transforming the two bills into special bills were rejected without any substantial argument being invoked. Finally, I note that no satisfactory explanation is provided for the misrepresentation of the concept of student in the government project and for the fact that no means is planned for the year 1999. Let us not come to tell us that it was too late in December 1999 to anticipate such means! During the discussion of each adjustment to the 1999 budget, we submitted amendments in this regard. They were all rejected, with the support of the French-speaking majority. Concretely, for us, the consequences of this capitulation will result in a recurring loss of financial means of 1.8 billion in the future, due to the exclusion of students over the age of 17, and by the loss, for the year 1999 alone, of a sum of 3.6 billion francs. This is a lot when you know the financial situation of the teaching on the French-speaking side. The teachers will be grateful to the French-speaking majority. This is why the government’s project is illegal. I would then like to mention its duplicity, at least in three respects. The first is the content of the Agreements of Saint-Eloi. It seems that these agreements include a series of secret clauses that appear gradually over time. While at first we had the feeling that only the two bills we are currently discussing were the subject of these agreements, we found that the Minister of Finance had, as a result of these agreements, radically changed his attitude with regard to the degree of tax autonomy permitted by the Finance Act. It was in response to one of my inquiries that he gave his first point of view. We learned the reactivation of the language inspection of teaching by the appointment of new language inspectors. Then we learned that the regionalization before Easter of agriculture and foreign trade had also been the subject of this sordid trade. We therefore expect, in the coming weeks and months, to see new clauses appear, so far kept hidden by the negotiators. We fear – and we are almost certain – that they can only be unfavorable to French speakers. Second example of duplicity: the French-speaking government claims that the credit increase provided for in Article 62, §1 of the Special Financing Act, is acquired, dare I say, for eternity! While the Flemish, supported in this by the State Council – which is nothing – claim that this agreement is only valid for the year 2000. French speakers play the autruches. They will claim tomorrow that their good faith has been abused, while both the State Council and the opposition have warned them. It will have to be remembered. Last element of duplicity: in a Senate committee, the Minister of Economy justified the increase of the credit provided for by Article 62, §1er, intended to finance foreign university students, by an increase in the number of students by 80%. To be precise, he said: the number of foreign European students has increased significantly. This represents an increase of 80 percent. At the examination and despite the minister’s repeated refusal to provide precise figures, it seems that the increase would be 80% if students of non-university higher education are taken into account. If this is the case, then it is necessary to be consistent: if non-university students are taken into account, it is necessary to amend Article 62, §1 to allow their inclusion in the calculations. It is also necessary that the key for the distribution of this credit among the communities is also adapted to the reality of the figures concerning not only the university students but also those of the non-university superior who are enrolled in each of the two communities. By playing on the words and on the numbers, the government is still showing duplicity. To clarify the situation, we submitted two amendments aiming to include non-academic senior students both in the calculation of the credit and in its distribution among communities. According to the figures that we have, in the absence of those that the minister refused to give us, this correction represents a recurring amount of 360 million francs per year. I come to the third part of my speech. With illegality and duplicity, government orphans have managed to combine the lie. Since I am referring to metaphors inspired by the lives of the saints, I allow myself to refer to a religious distinction between lies by action and lies by omission. The government’s attitude belongs to this second category. Thro ⁇ the discussion, he continued to hide from us the figures on which he founded the distribution of funds, drawn from Article 62, § 1 of the Special Finance Act, as well as the fact that he had commissioned the Court of Auditors, in violation of the Constitution, to perform the tasks which must be conferred on him by the first draft law without waiting for its vote. This is a first! This is, in fact, the first time that the government imposes, without the contribution of the legislative power, a mission to the Court of Auditors, which is an institution within the legislative power and which is responsible for controlling the executive. This is a clear violation of the separation of powers. It also testifies to the few cases that the government does of respect for our institutions and the government persists, since with regard to an audit of the SNCB which we will talk about tomorrow afternoon, the same procedure has been used by the Minister of Transport, who, by the detour of a parliamentary initiative, whose government is at the source, asks the Court of Audit to intervene on behalf of the government. In conclusion, I wish solemnly to warn the French speakers of this assembly — there remains one — against the dramatic consequences that the adoption of the two bills will have for the French Community. I hope, Mr. Deputy, you will communicate this to your friends of the FDF. The first approved a Franco-speaking surrender, despite the opinion of the State Council that had completely disapproved the French-speaking government, whose excessive concessions were judged contrary to the special law of financing. This capitulation represents for 1999, 3.6 billion francs and for the following years, 1.8 billion, or 25 billion over ten years. The second draft law, on the other hand, looks strangely like a mirror with alouettes, since it grants French speakers additional resources, undoubtedly 795 million francs, but which are far from compensating for the amount that French speakers renounced within the framework of the first draft and through an inadequate legal instrument, which exposes them to a decision of the Court of Arbitration that will reduce to nothing this weak acquisition. In addition, it distributes the amounts paid by the federal government in a way that leaves the French-speaking of 360 million francs per year, i.e. 4 billion over ten years. To these French-speaking renunciations, it is still worth adding the following on the regionalization of agriculture and foreign trade, intervened subsequently, on the reactivation contrary to human rights of the linguistic inspection and on tax autonomy, which fortunately has not yet been executed. I am afraid that the reversal of the attitude of the Minister of Finance in relation to the low-income targeted subtractionals, which the Flemish government is proposing to grant, will not open the door to an interpretation of the law on the financing of communities and regions that will make possible an exacerbated fiscal competition between regions, desired by the Flemish – they have never hidden from it – but to which the living standards of the Wallons would not survive. In this regard, I draw your attention to a white paper published in the newspaper Le Soir, signed by some of our greatest economists, who sound, all trends confused, the toss in relation to the risk of fiscal autonomy. In conclusion, Mr. Speaker, we consider that the first bill is non-drinkable, while the second constitute a deception, if it is not adopted, as the State Council suggests, by the special majority and if the amounts themselves are not adjusted.

Mijnheer de voorzitter, mijnheer de minister, de politieke context waarin dit akkoord tot stand kwam is bekend. De Sint-Elooisontwerpen zijn een grote farce: pure window dressing. De Franstaligen moesten hun extra miljarden krijgen voor hun noodleidend Onderwijs. Dat werd hen door formateur Verhofstadt in het geheim toegezegd. De kaduke constructie werd opgezet om het geheel een schijn van wettelijkheid te geven. Het geheim akkoord werd bedisseld bij de totstandkoming van deze regering, een regering die in de loges van Wallonië werd gevormd en die vervolgens, naar traditioneel recept, aan België en Vlaanderen werd opgedrongen. Omdat deze coalitie in Vlaanderen geen meerderheid had, werd ook de VU erbij gehaald. Sedert 1977 is deze partij de schotelvod van Vlaanderen, de partij van het geven en het toegeven. Op schaamteloze wijze toonde Bert Anciaux zijn regeergeilheid; het was toen voor iedereen in de Wetstraat duidelijk dat de VU er hoe dan ook wilde bijhoren. Het gevolg was dat haar onderhandelingspositie het nulpunt benaderde. Er werd vrijwel niets uit de brand gesleept door toenmalig VUvoorzitter Patrick Vankrunkelsven die op het verkiezingscongres van de VU nog onder luid applaus had uitgeroepen dat zijn partij nooit tot een regering zou toetreden die niet de vijf resoluties van het Vlaams Parlement inzake de verdere staatshervorming, zou uitvoeren. Als schaamlapje werd hen dan het covoorzitterschap van de zogenaamde Costa aangeboden, de intergouvernementele en interparlementaire conferentie voor de staatshervorming, een vergeetput waarnaar alle Vlaamse eisen worden verwezen, terwijl de Franstalige telkens boter bij de vis krijgen. En Vankrunkelsven hapte toe, want hij mocht alweer een figurantenrolletje spelen, terwijl Bert Anciaux en Johan Sauwens hun limousines lieten voorrijden en hun kabinetten konden vullen met 150 medewerkers: de echte en enige reden waarom de VU haar steun aan deze coalitie verleende. Mijnheer de voorzitter, ik zal niet meer uitvoerig ingaan op de technische details van beide wetsontwerpen. Deze kwam reeds voldoende aan bod in de Senaat en in de commissie voor de Grondwetsherziening van de Kamer. CVP-collega Servais Verherstraeten toonde daarnet op een schitterende wijze de mankementen aan van de voorliggende ontwerpen. Als de CVP haar amendementen opnieuw indient, dan zullen wij deze steunen, net zoals in de commissie. Trouwens het heeft niet meer zoveel belang. Immers, iedereen weet dat de regering deze ontwerpen, hoe gammel en krakkemikkig ook, ongewijzigd zal laten goedkeuren. Alleen nog dit: het blijft hoe dan ook verbazingwekkend met welk gemak deze regering een aantal wettelijke en grondwettelijke bepalingen naast zich neerlegt. Het wetsontwerp dat de financiering wil baseren op het correcte aantal leerlingen, wat overigens niet het geval zal zijn, geeft geen uitvoering aan de bijzondere financieringswet, maar wijzigt deze. Er is dus een bijzondere meerderheid vereist, maar de regering negeert dit. Voorts zijn de bevoegdheden van het Rekenhof, dat een controle op het leerlingenaantal zou moeten uitoefenen, vastgelegd in de Grondwet. Er is dus eveneens een grondwetsherziening vereist, maar ook dat negeert de regering. De regering maakt van het Rekenhof op schaamteloze wijze een instrument voor haar beleid, terwijl deze instelling bij uitstek ten dienste staat van het parlement. Het Rekenhof heeft trouwens zelf aangegeven dat het niet over de nodige mensen en middelen beschikt om de controle op het leerlingenaantal uit te oefenen. Hoe zou het ook kunnen? Geen nood echter. Het is toch slechts een farce, want als het Rekenhof er niet in slaagt de controles uit te oefenen, werd er bepaald dat het in laatste instantie aan de regering toekomt het aantal leerlingen van elke Gemeenschap vast te leggen. De regering zal dan wellicht haar kristallen bol raadplegen. Het enige echte criterium om de onderwijsdotaties te bepalen is uitgaan van het aantal schoolplichtige leerlingen tussen 6 en 17 jaar in elke Gemeenschap. Dat is echter te doorzichtig en te rechtvaardig. De Franstaligen willen meer federaal geld voor hun onderwijs; dat is de kern van de zaak. Dat geld is voor het overgrote deel Vlaams belastinggeld. Ze dringen trouwens nu al aan - ik verwijs naar hun 1 mei-toespraken op vers geld, bovenop de 2,4 miljard extra die ze al binnenhaalden in ruil voor de belastingverlaging die de liberalen zo graag willen doorvoeren. Heeft iemand zich al eens afgevraagd waarom de Franstaligen zoveel geld voor hun onderwijs nodig hebben? Dat onderwijs is per leerling het duurste van Europa. Aan de hoge kwaliteit zal het niet liggen, want het Franstalig onderwijs levert zowat de grootste domoren van Europa af, die niet eens in staat zijn een woord Nederlands te spreken. Het Franstalig onderwijs telt eveneens een groot aantal bissers en trissers, veel meer dan in het Vlaams onderwijs, dat nochtans veel goedkoper is. De SERV berekende dat het Vlaams onderwijs nu al jaarlijks 5 miljard frank te weinig krijgt. Het Franstalige onderwijs is zo duur omdat de francofone politici hun onderwijs als een opvangcapaciteit voor werklozen beschouwen. De Franstalige scholen worden via politieke benoemingen volgepropt met pakken overbodige leraars. Wallonië heeft het laagste aantal leerlingen per klas van Europa en misschien wel van de hele wereld. Zij hebben over- bodige bedienden en overbodig onderhoudspersoneel. Nu Ecolo tot de regering is toegetreden, eist deze partij die in het onderwijs veel kiezers rekruteert - ook haar deel van de benoemingskoek op. Daarom eist men nu al nog meer onderwijsgeld. De VLD kijkt toe. Zij laat dit alles gebeuren, want het enige wat Verhofstadt en zijn kompanen interesseert is het behoud van de macht na de tocht van bijna 12 jaar door de politieke woestijn. Dat de machtsgeile SP en Agalev dat spelletje graag meespelen hadden we wel verwacht. Ze houden, geheel in hun traditie, deze door Franstaligen gedomineerde, anti-Vlaamse regering mee in het zadel. Dat de eens Vlaams-nationale Volksunie zich daartoe leent, is door niets anders te verklaren dan door de regeringsgeilheid van haar leiders. De heer Bourgeois, die begin dit jaar tot voorzitter werd verkozen, zal daar niets aan kunnen veranderen. Vele mensen uit de Volksunie hadden hun hoop op Bourgeois gesteld. Ik heb in een open brief aan de Vlaams-nationalisten in de Volksunie voorspeld dat Bourgeois een machteloze voorzitter zou worden, gegijzeld door de twee Vlaamse Volksunie-ministers en hun hovelingen. Deze voorspelling is uitgekomen. Niet als mens, maar als VU-voorzitter, is Geert Bourgeois een zielenpoot. Op het Barricadenplein wordt hij tegen zijn zin omringd door Anciaux- en Vankrunkelsven-gezinden. De deskundige maar machteloze Marc Platel is een uitzondering. De VU-ministers herkennen zijn gezag niet. De heer Bourgeois verklaarde terecht dat het akkoord in verband met de defederalisering van Landbouw en Buitenlandse Handel veel te mager was. Hij noemde het onvoldoende, een eufemisme voor lege doos of dode mus. Toch moest hij even later zijn woorden inslikken en het voor Vlaanderen belabberde akkoord goedkeuren. Landbouw wordt een uiteindelijke bevoegdheid van de Waal Louis Michel. Buitenlandse Handel wordt versterkt als federale instelling, ook al onder Louis Michel, die de Vlaamse export naar Oostenrijk dapper schade blijft toebrengen omdat daar een democratisch verkozen partij in de regering zit die hem niet zint. Het enige wat we van de heer Bourgeois al hoorden was zijn ophefmakend voorstel om het Vlaams Blok te verbieden, de Vlaams-nationale partij die meer dan 600 000 kiezers vertegenwoordigt. Uitgerekend de Volksunie, de partij van zwartzakken, die in haar aanvangsjaren zelf door het Belgische establishment in haar bestaan werd bedreigd, stelt zoiets voor. Die wetenschap moet de laatste Vlaams-nationalisten in de Volksunie toch wel de ogen openen. Omwille van de houding van de Volksunie heerst in de Vlaamse Beweging op dit ogenblik een gevoel van we worden verraden . Sinds het aantreden van deze paars- groene regering, gesteund door de Volksunie, gaan we er zienderogen op achteruit. In het verleden hebben we dikwijls veel kritiek gehad op de CVP. Als we moeten vaststellen hoe anti-Vlaams deze regering te werk gaat, krijgen we haast heimwee naar de tijd van de CVP. Dit betekent dat de huidige toestand wel heel erg moet zijn! Deze regering wordt volkomen geregisseerd en gedomineerd door de Franstaligen. Ik verwijs naar een uitspraak van Hugo De Ridder, een van de meest vooraanstaande Wetstraatwatchers. Hij zei, ik citeer: Als ik nu in de Wetstraat kom, voel ik bijna lijfelijk de suprematie en de arrogantie van de Franstaligen . Zonder volledig te zijn - dat zou ons te veel tijd kosten wil ik een overzicht geven van de vele anti-Vlaamse daden van deze regering. Het begon met de benoeming van de totaal Nederlandsonkundige Busquin tot lid van de Europese Commissie. Op dat ogenblik was Verhofstadt nog formateur. Vervolgens gingen de Franstalige regeringspartners waarvan een aantal Nederlandsonkundig zijn, in de regering al de belangrijke departementen bezetten. Meteen werd afgesproken de meest anti-Vlaamse politiek te gaan voeren sedert de repressieperiode. Ik herhaal dat dit kon gebeuren met de schuldige medeplichtigheid van de Volksunie. Die anti-Vlaamse politiek kwam tot uiting in de ontwerpen inzake de regularisaties en de naturalisaties. Naast de strijd tegen het Vlaams Blok waren deze ontwerpen bedoeld om de Vlamingen in Brussel helemaal van de kaart te vegen door de creatie van tienduizenden nieuwe Belgen, kiezers die de francofone lijsten zullen versterken. De Vlaamse eisen die het Vlaams Parlement had opgesteld, werden vakkundig afgevoerd. Dag hervorming van de sociale zekerheid! Dag eigen fiscaliteit! Dag overheveling van de provincie- en gemeentewet! De waarborgen voor de Brusselse Vlamingen werden afgevoerd naar een Brusselse mini-Costa waar alleen wordt gesproken over het gewestelijke niveau en niet over het gemeentelijke en waar andermaal een zware prijs zal moeten worden betaald. In Brussel blijft men de taalwetten op een grove manier met de voeten treden. Van het zogenaamde taalhoffelijkheidsakkoord blijft niets meer over. Niet lang geleden werd in deze Kamer een wetsvoorstel weggestemd dat ertoe strekte de tweetaligheid van de Brusselse brandweer te verplichten. In een ver verleden werd een dergelijk voorstel medeondertekend door de VLD en SP. Nu stemden ze samen met de Franstaligen tegen. Dit alles gebeurt met de schuldige medeplichtigheid van de Volksunie. Het veiligheidsplan van Marc Verwilghen werd onder Franstalige druk geneutraliseerd. Het snelrecht werd totaal uitgekleed. De politie- hervorming is volkomen op Franstalige leest geschoeid en zal de enorme bevoordeling van Wallonië, dat in verhouding meer rijkswachters telt, nog bestendigen. De ambtenarenhervorming zal in niets lijken op de efficiënte hervorming die op Vlaams niveau werd doorgevoerd. De economische maatregelen zijn op maat van Wallonië en gaan in tegen de Vlaamse belangen. Verwijzen we maar naar het oorspronkelijke Rosettaplan van minister Onkelinx en naar haar voorstel inzake de invoering van de 35-urige werkweek. Deze maatregelen zijn totaal ontoepasselijk in Vlaanderen omdat de loonkosten alleen maar zullen stijgen en bepaalde sectoren nu reeds te kampen hebben met een tekort aan werkkrachten. Dit alles gebeurt met de schuldige medeplichtigheid van de Volksunie. In Brussel waar de taalwetten met Vlaams zweet zijn afgedwongen met als paradepaardje de tweetaligheid van het Brusselse gerecht, worden deze zwaarbevochten wetten met de voeten getreden en worden op grote schaal eentalig Franstalige rechters benoemd. Van de splitsing van het gerechtelijk arrondissement BrusselHalle-Vilvoorde is geen sprake meer, laat staan van het kiesarrondissement. Bij de MIVB, de NMBS en De Post worden de Franstaligen eveneens constant bevoordeeld. In het kanton Sint-Pieters-Leeuw moet de vrederechter nu plots tweetalig zijn. De Vlaamse politieagenten die in de gemeenten werken die met Wemmel een politiezone zullen vormen, zullen in Wemmel Frans moeten spreken. Dit alles gebeurt met de schuldige medeplichtigheid van de Volksunie. De Vlaamse achterstelling blijft voortduren tot op de dag van vandaag. Deze week raakte bekend dat het kernkabinet de bouw van vier nieuwe kustmijnenvegers heeft geschrapt, waardoor de enige overgebleven Vlaamse scheepsbouwer, SKB, dreigt ten onder te gaan. Het verlies van deze bestelling van 12 miljard Belgische frank die in 1994 werd goedgekeurd als een Vlaamse compensatie voor de modernisering van de F16's die vooral Wallonië en Brussel ten goede kwam, is de meest recente benadeling van Vlaanderen. Dit alles gebeurt met de schuldige medeplichtigheid van de Volksunie. Tot slot, maar vooral blijven de enorme geldstromen van Vlaanderen naar Wallonië en Brussel nog altijd bestaan. Meer nog, ze nemen zelfs toe, onder meer door dit nefaste Sint-Elooisakkoord. In 1996 werden de geldstromen berekend op 186,5 miljard Belgische frank. Dat bedrag moet nu al boven de 200 miljard Belgische frank uitkomen. Als we daar ook nog de historisch veroorzaakte rentelast bijtellen die meer dan 200 miljard Belgische frank bedraagt, komen we uit op een jaarlijks bedrag van meer dan 400 miljard Belgische frank. Ik citeer hier professor Robert Senelle: De situatie is onhoudbaar. De Vlamingen betalen zich blauw aan Walen en Brusselaars. Solidariteit tussen de regio's is noodzakelijk en bestaat in alle federale staten, maar in België hebben we niet langer te maken met solidariteit maar met een hold-up. Mijnheer Coveliers, dit alles gebeurt inderdaad met de schuldige medeplichtigheid van de Volksunie. Intussen is de Vlaamse regering verworden tot een willoos aanhangsel van de federale regering. Patrick Dewael zit daar alleen maar om de Vlaamse eisen af te remmen en om elke drang naar meer zelfstandigheid in de kiem te smoren. Zelfs het prachtige project Vlaanderen Europa 2002 moet eraan geloven. En de Volksunie geeft geen kik, want dit alles gebeurt met de schuldige medeplichtigheid van de Volksunie. De Volksunie zal weliswaar tegen het Sint-Elooisakkoord stemmen, het zou er nog aan ontbreken. Die houding is echter totaal ongeloofwaardig. VU-collega's, in de commissie verklaarde onze overigens gewaardeerde collega Danny Pieters dat het onbegrijpelijk was dat de Vlaamse regeringspartners hun steun verlenen aan een wetsontwerp dat niet de minste waarborg bevat voor het houden van een betrouwbare leerlingentelling. Tot de heer Pieters - hij is er wel niet - en de andere collega's van de Volksunie wil ik zeggen: wees niet langer hypocriet. In de Vlaamse regering heeft de Volksunie mee haar fiat gegeven aan dit voor Vlaanderen vernederende en schadelijke Sint-Elooisakkoord. Geloof niet dat de fiscaliteit tegen eind 2001 in voor Vlaanderen gunstige zin zou worden hervormd. Geloof dat niet want het zal niet gebeuren. VU-collega's, wees nu eindelijk eens consequent. Neem nu eindelijk eens uw verantwoordelijkheid op voor Vlaanderen en laat u niet langer leiden door de machtsgeilheid en het pure geldgewin van enkele principelozen. Zeg dat het genoeg is, zeg dat Vlaanderen en de Vlamingen niet vooruitgaan, maar dat ze achteruitgaan. Kom op voor de zelfontplooiing en de zelfbeschikking van ons Vlaamse volk. Zorg ervoor dat het Vlaams Blok niet meer moet gaan betogen op het Barricadenplein met de slogan Alles voor Wallonië, voor Vlaanderen niets. VU-collega's, ga uit die ellendige COSTA, maar ga vooral uit die lamme en slaafse Vlaamse regering zodat die valt. Stuur op die manier ook de meest anti-Vlaamse Belgische regering sedert de repressieperiode naar huis. Alleen dan zult u uw zelfrespect hebben herwonnen. Alleen dan zult u voor Vlaanderen en de Vlamingen uw plicht hebben gedaan.

It remains surprising, however, with what ease this government puts a number of legal and constitutional provisions aside. The draft law, which intends to base the funding on the correct number of pupils, which, by the way, will not be the case, does not implement the special funding law, but changes it. Therefore, a special majority is required, but the government ignores this. Furthermore, the powers of the Court of Auditors, which should exercise control over the number of pupils, are laid down in the Constitution. Therefore, a constitutional revision is also required, but this is also ignored by the government. The government shamelessly makes the Court of Auditors an instrument for its policies, while this institution serves parliament primarily. The Court of Auditors has indicated that it does not have the necessary people and resources to exercise control over the number of pupils. How could it be? No need though. However, it is only a farce, because if the Court fails to carry out the checks, it was decided that it is ultimately up to the government to record the number of pupils in each Community. The government may then consult its crystal ball. The only true criterion for determining educational grants is to assume the number of compulsory pupils between 6 and 17 years of age in each Community. This is too transparent and too fair. The French speakers want more federal money for their education; that is the core of the matter. That money is for the vast majority of Flemish tax money. By the way, they are already insisting – I refer to their May 1st speeches on fresh money, in addition to the 2.4 billion extra they have already collected in exchange for the tax cuts that the liberals are so eager to implement. Has anyone ever wondered why French speakers need so much money for their education? This education is the most expensive per student in Europe. It will not lie to the high quality, because the French-speaking education delivers almost the largest domes in Europe, who are not even able to speak a word Dutch. The French language education also counts a large number of bishops and trissers, much more than in the Flemish education, which is however much cheaper. The SERV calculated that Flemish education already receives less than 5 billion francs annually. French-speaking education is so expensive because French-speaking politicians view their education as an accommodation capacity for unemployed. The French-speaking schools are filled with packages of unnecessary teachers through political appointments. Wallonia has the lowest number of students per class in Europe and ⁇ in the world. They have overworked servants and unnecessary maintenance personnel. Now that Ecolo has joined the government, this party that recruits many voters in education is demanding its share of the appointment cookie. Therefore, they are now demanding more education money. The VLD is watching. She lets all this happen, because the only thing that interests Verhofstadt and his comrades is the preservation of power after the almost 12-year journey through the political desert. That the power giant SP and Agalev would like to play that game we had expected. They keep, in their tradition, this French-speaking-dominated, anti-Flemish government in the seat. That the once Flemish-National People’s Union borrows itself for this is explained by nothing other than by the governance greed of its leaders. Mr. Bourgeois, who was elected president earlier this year, will not be able to change that. Many people from the People’s Union had placed their hopes on the bourgeois. In an open letter to the Flemish nationalists in the People’s Union, I predicted that the Bourgeois would become a powerless president, held hostage by the two Flemish People’s Union ministers and their courtiers. This prediction has come true. Not as a human being, but as VU chairman, Geert Bourgeois is a soul foot. On the Barricade Square, he is surrounded by Anciaux and Vankrunkelsven spirits. The expert but powerless Marc Platel is an exception. The VU ministers do not recognize his authority. The only thing we’ve heard from Mr. Bourgeois was his dismissive proposal to ban the Flemish Bloc, the Flemish national party representing more than 600,000 voters. The People's Union, the party of black bags, which in its early years was threatened by the Belgian establishment in its existence, proposes such a thing. This science should open the eyes of the last Flemish nationalists in the People’s Union. If we have to determine how anti-Flemish this government is working, we will soon get back to the time of the CVP. This means that the current situation must be very serious! This government is completely directed and dominated by the French speakers. I refer to a statement by Hugo De Ridder, one of the most prominent Wetstraatwatchers. Now they voted against, together with the French speakers. All this happens with the guilty complicity of the People’s Union. Marc Verwilghen’s security plan was neutralized under French-speaking pressure. The highway was completely disguised. The police reform is entirely based on French-speaking reading and will continue to sustain the enormous advantage of Wallonia, which has proportionally more national guards. The civil servants reform will in no way resemble the efficient reform carried out at the Flemish level. The economic measures are tailored to Wallonia and are contrary to the Flemish interests. Let us only refer to the original Rosetta Plan of Minister Onkelinx and her proposal for the introduction of the 35-hour working week. These measures are completely inapplicable in Flanders because wage costs will only rise and certain sectors are already facing labor shortages. All this happens with the guilty complicity of the People’s Union. In Brussels, where the language laws with Flemish sweat have been enforced with the bilinguality of the Brussels court as a pair, these hard-fought laws are struck with the feet and single French-speaking judges are largely appointed. The division of the judicial district BrusselHalle-Vilvoorde is no longer the case, let alone the electoral district. At the MIVB, the NMBS and De Post, French speakers are also constantly benefited. In the canton of Sint-Pieters-Leeuw, the peace judge must now suddenly be bilingual. The Flemish police officers working in the municipalities that will form a police zone with Wemmel will have to speak French in Wemmel. In the Flemish government, the People’s Union has given its fiat to this for Flanders humiliating and harmful Saint-Elois Agreement. Do not believe that the tax system would be reformed in favour of Flanders by the end of 2001. Don’t believe it because it won’t happen. Ladies and gentlemen, be finally consistent. Now finally take your responsibility for Flanders and no longer let yourself be guided by the power-gospel and the pure monetary gain of some unprincipled ones. Say that it is enough, say that Flanders and the Flanders are not progressing, but that they are declining. Stand up for the self-development and self-determination of our Flemish people. Make sure that the Flemish Bloc no longer has to demonstrate on the Barricades Square with the slogan All for Wallonia, for Flanders nothing. Met enige zin voor oratorische elementen heeft collega Tastenhoye bijna elke zin van zijn betoog aangevuld met de woorden dat het met schuldige medeplichtigheid van de Volksunie was. Mijnheer Tastenhoye, wij zullen deze tekst niet goedkeuren en ik zal u zo dadelijk zeggen waarom. De collega's van het Vlaams Blok wil ik toch even duidelijk maken dat er ook zoiets bestaat als schuldig verzuim. Zelfs de meest beperkte akkoorden - ik denk bijvoorbeeld aan de overheveling van Buitenlandse Handel en Landbouw - betekenen meer dan het Vlaams Blok in zijn 25-jarig bestaan en met zijn roepen op de tribune heeft bereikt. U kunt natuurlijk aanbrengen dat niemand met u zaken wil doen. Dat ligt natuurlijk ook aan uw eigen houding. Ik denk dat ook de geschiedenis een ander oordeel zal vellen dan het verhaal dat u hier vertelt. Alles wat aan Vlaamse autonomie is verwezenlijkt, is er gekomen mede dankzij de fundamentele bereidheid van de Vlaams-nationalisten om in dialoog te treden en te proberen akkoorden te sluiten. Wij hebben al heel wat bereikt en wij hopen nog heel veel te bereiken. Niet alleen de maatschappelijke positie waarin u zich hebt opgesteld maken gesprekken met iedereen zeer moeilijk. De strategische optie om aan geen enkel akkoord deel te nemen is eigenlijk een bijzonder comfortabele houding voor u die u toelaat om zonder enige moeite een aantal zitjes in het parlement te bekleden en hier uw gedachten te spuien. Dat zet echter totaal geen zoden aan de dijk. Ik kom dan terug bij mijn tekst. Eigenlijk is het niet mijn tekst want de heer Pieters zou normaal voor ons het woord voeren. Aangezien hij de democratie gaan verspreiden is in Armenië, zal ik op basis van zijn tekst mijn betoog houden. Rond deze tijd zou hij op Zaventem moeten landen en misschien komt hij hier nog voor het einde van het debat aan. Het gaat hier vandaag om de vertaling van de zogenaamde Sint-Elooisakkoorden. Deze akkoorden bestonden uit drie delen, te weten een eerste groot deel onderwijsfinanciering, een tweede deel over het erkennen van trekkingsrechten voor de gewesten en een derde deel om het Vlaams Gewest zogezegd toe te staan over te gaan tot lineaire kortingen. Vandaag gaat het in essentie om het onderwijsdossier. Toch moet het mij van het hart dat de twee andere delen, waarin een aantal zogenaamde voordelen voor Vlaanderen vervat zouden zitten, ook op een doos van Pandora of een lege doos zouden kunnen uitdraaien. Wat de trekkingsrechten betreft, zou het om een doos van Pandora kunnen gaan aangezien niet uit te sluiten valt dat dit bijkomend geld de tewerkstelling geenszins ten goede zal komen en dat het uiteindelijk bij het Franstalig onderwijs kan terechtkomen. Wat de kortingen betreft, is dit natuurlijk deels een lege doos. In onze visie waren wij daarvoor immers al bevoegd, tenzij het vaststellen of een korting invloed zou hebben op de monetaire en economische unie dan wel of ze verenigbaar is met de stabiliteitseisen van de Europese Unie ook al louter politieke beslissingen zouden zijn. Een beetje ernst zou hier op zijn plaats zijn. Wij hebben het hier vandaag echter over de wettelijke uitwerking van de onderwijsakkoorden. Ook in dit deel zou er voor elk wat wils te vinden zijn, alleen bleek er voor de ene Gemeenschap wat meer wils te zijn dan voor de andere. De Franse Gemeenschap kreeg het geld waarnaar ze hongerde. Wat velen in Vlaanderen, niet alleen in de oppositie, steeds weer een van de belangrijkste hefbomen voor een verdere staatshervorming noemden, werd hier weggegooid. Allerhande arrangementen tussen de Vlamingen alleen kunnen wat dit fundamentele onderhandelingsgegeven betreft niets meer verhelpen. Deze akkoorden zijn het gevolg van het geheim akkoord waarvan de eerste minister het bestaan eerst ontkende maar uiteindelijk moest toegeven. Het feit dat de eerste minister in dit dossier een belangrijk deel van zijn geloofwaardigheid en zijn Vlaamse flank heeft prijsgegeven is nefast. Het is immers erg moeilijk om dit vertrouwen opnieuw op te bouwen. Wij hopen dat met het akkoord inzake Landbouw en Buitenlandse Handel een eerste stap is gezet om een klein stukje vertrouwen weer op te bouwen. In onze beoordeling van de betrouwbaarheid van de eerste minister kan dit akkoord echter geenszins opwegen tegen het opgeven van de hefboom. Wij zullen het dossier verder volgen in de hoop dat uiteindelijk zal blijken dat er aan het einde van de rit heel wat gerealiseerd is. Dit was echter beter op een andere manier van start gegaan. Ik wil u even herinneren aan enkele elementen van het akkoord zelf. Het akkoord en het thans voorliggende wetsontwerp gaan niet uit van het meest objectief vaststelbare cijfer, te weten het aantal kinderen in de leerplichtige leeftijd tussen zes en achttien jaar maar van een veel minder vaststelbaar gegeven, te weten het aantal regelmatig ingeschreven leerlingen van zes tot en met zeventien jaar. Er worden heel wat correctiecoëfficiënten gebruikt waardoor het probleem van de controle erg reëel wordt. Men gaat die cijfers tonen in de periode van 15 januari tot 1 februari, te beginnen in het jaar 2000. De gemeenschappen leveren het Rekenhof elektronische bestanden per leerling en per school waarna het Rekenhof met tweetalige ploegen de data gaat verifiëren. Het leerlingenaantal zal aan een dubbele controle worden onderworpen als er tegen 15 mei, over enkele dagen, geen adequate elektronische bestanden zouden worden aangereikt. Enerzijds zal men tot een telling of controle in de scholen overgaan. Anderzijds zal men de telling aan de meest objectieve gegevens toetsen, namelijk de bevolkingscijfers van de kinderen van die leeftijd. Het is duidelijk dat deze procedure fundamenteel niet kan werken. De grote vragen die het personeel van het Rekenhof in de Senaat heeft geuit omtrent de doenbaarheid van haar bijkomende opdrachten werden in de wind geslagen. Het Rekenhof moet eigenlijk uitsluitend ten dienste van het parlement staan. De opbouw van de timing is misschien wel logisch tellingen in januari en februari met een controle op het einde van het schooljaar - maar het is een louter politieke logica. Hoe zal de telling in de meeste jaren gebeuren? Het Rekenhof heeft weinig eigen criteria om de bestanden te controleren. Op een bepaald ogenblik zal men tot de vaststelling komen dat deze bestanden niet kloppen en dat de gemeenschappen en het Rekenhof er niet uitkomen. Geen nood echter, als de gemeenschappen en het Rekenhof er niet uitkomen, komt als een deus ex machina de federale regering die in al haar wijsheid de knoop zal doorhakken. Men kan de timing hiervan voorspellen. Dit zal gebeuren in de vroege zomermaanden, in de week tussen 21 en 28 juli. In deze week zijn de ministers, in tegenstelling tot de kamerleden en de senatoren, nog niet vertrokken zijn naar het warme Zuiden. Tegen oktober zal er veel water door de zee gelopen zijn. Men heeft een diabolische timing ingevoerd. Deze dubbelzinnigheden kan men in het wetsontwerp terugvinden. Men spreekt over een tijdelijke wet maar dat schrijft men niet in de tekst van de wet zelf. Het mag ook alleen in het Nederlands gezegd worden. Ik hoop dus dat de heren Picqué en Poncelet even niet luisteren. Het staat wel in de tekst van het akkoord tussen de Vlaamse meerderheidspartijen, dus eigenlijk een soort van bisakkoord. Daarin wordt gezegd dat er tegen 2001 een oplossing moet zijn. Indien geen akkoord wordt bereikt omtrent de wijzigingen van de bijzondere financieringswet, engageren de Vlaamse meerderheidspartijen zich tot het indienen, in het federaal Parlement, van een voorstel tot herziening van de bijzondere financieringswet en een voorstel om de thans goed te keuren wet onderuit te halen. Wij geloven nog in de goede wil die uit de akkoorden blijkt, anders zouden wij van boerenbedrog spreken. De verplichting tot het indienen van een wetsvoorstel, waarvan de kans groot is dat ze geen meerderheid haalt in de Franse taalgroep, kan in onze ogen alleen maar betekenen dat de Vlaamse meerderheidspartijen dienaangaande hun vertrouwen in de federale regering opzeggen. De federale regering moet immers voor een fatsoenlijk politiek compromis zorgen dat dit tweede bisakkoord tussen de Vlaamse meerderheidspartijen realiseert. Ik hoop alleen dat de eerste minister iets meer vertrouwen zal uitstralen en niet zal doen alsof zijn neus bloedt door te zeggen dat dit akkoord door Karel of Patrick gesloten werd en dat hij niet op de hoogte was. Wij zullen ons niet laten bedriegen. De tekst van het wetsontwerp bevat tal van dubbelzinnige concepten. Zo wordt overgegaan tot een alternatieve tijdsprocedure indien de bestanden die door de gemeenschappen worden afgeleverd als niet geschikt worden beschouwd. De regering antwoordt niet op vragen dienaangaande. Wat dat is? Op vragen daarover antwoordt de regering niet. Ook laat de regering ons gissen naar wat er dan moet worden verstaan onder een betekenisvolle en niet te verklaren, in cijfers uitgedrukte afwijking tussen de gegevens verstrekt door een Gemeenschap en de controlegegevens. Hoe groot moet dergelijke afwijking zijn? Het blijft in het vage. Telkens cruciale begrippen op cruciale ogenblikken in de procedure opduiken, moet dat worden uitgemaakt door het Rekenhof. Hoe kan men daar nu het Rekenhof mee opzadelen? Het Rekenhof kan dit niet, omdat het niet over stavingscriteria beschikt. Het Rekenhof zou dan al zelf de criteria moeten vaststellen en dus buiten zijn rol treden: in plaats van een orgaan ten dienste van de Kamers, zou het dan zelf een politiek orgaan worden. Dat is een wel erg vergiftigd geschenk aan deze eerbiedwaardige instelling. Zo wordt er ook bepaald dat in voorkomend geval ook vrede zou worden genomen met de afwezigheid van de rijksregisternummers. Naïef zou men kunnen veronderstellen dat het gaat om gevallen waar men geen rijksregisternummer heeft, maar nee: als men er niet in slaagt om dat te verstrekken, volstaat het blijkbaar al. Ook dat is blijkbaar een probleem dat moeilijk ligt bij de Franse Gemeenschap. Een aantal elementen uit het Sint-Elooisakkoord zou anderzijds de Vlamingen moeten paaien. Zo zou werk worden gemaakt van de selectieve ophaling van leerlingen in het andere taalgebied, wat dan vastgelegd zou moeten worden in een samenwerkingsakkoord tussen... ja, tussen wie? Dat is nog niet helemaal duidelijk. Aan Vlaamse kant is het duidelijk, maar aan Franstalige kant is men het nog niet eens met wie een samenwerkingsakkoord zou moeten worden gesloten. Goed dus, een samenwerkingsakkoord. Dat zou eigenlijk al klaar moeten zijn over vijf dagen. Ik kan niet in de geest en het hart van de ministers van de diverse regeringen kijken, maar ik zie dat op vijf dagen toch niet lukken. Men schuift het ophalingsakkoord op de lange baan en als het er toch komt, Franstalige vrienden, dan geen nood, iemand van u loopt beslist naar de rechter om te protesteren tegen wat u ongetwijfeld weer eens als een aanslag op uw liberté du père de famille zult beschouwen. Wanneer hoor ik de heer Maingain of de heer Eerdekens mij hierin tegenspreken? Sterker nog, u steunt het verzet tegen de taalinspectie die nu reeds wettelijk bestaat voor de scholen in de rand. Vlaamse collega's uit de meerderheid, ziet u dit niet? Een ander gegeven zou ook weer de Vlamingen ter wille zijn, te weten de in een wetsontwerp vervatte regeling voor de buitenlandse studenten. Iedereen wordt daar beter van: meer geld voor beide gemeenschappen en bovendien een voor Vlaanderen meer voordelige sleutel. Niet meer twee derden voor de Franse Gemeenschap en een derde voor de Vlaamse Gemeenschap zoals in het verleden, nee, ook hier weer een dubieuze toegift aan Vlaanderen: men verbetert de verdeelsleutel. De Raad van State had nochtans in alle duidelijkheid gesteld dat die materie zou moeten worden geregeld met bijzondere dubbele tweederdemeerderheid. Het magere argument om daar onderuit te komen zou dan zijn dat de bijzondere wet toestaat de bedragen aan te passen als volkenrechtelijke beslissingen bijkomende kosten voor de gemeenschappen met zich zouden brengen. Alleen is er op dat vlak eigenlijk niets veranderd sinds de bijzondere wet werd goedgekeurd. Dat kinderen van buitenlandse werknemers in België gelijk moeten worden behandeld, staat eigenlijk al vast vanaf 1968, als het al niet vanaf 1958 is. De verdeelsleutel zelf wordt daarenboven nergens onderbouwd. Wat zal er gebeuren als straks in de Franse Gemeenschap iemand opstaat die zich gediscrimineerd voelt omdat voor buitenlanders in die Gemeenschap minder wordt betaald dan voor buitenlanders in die andere Gemeenschap? Dat is een realiteit die wij ook onder ogen moeten zien. Het zou dus wel eens een vergiftigd geschenk kunnen zijn. Mijnheer de voorzitter, geachte collega's, uit al het voorgaande moge voldoende blijken dat er voor de VU&IDfractie als democratische Vlaams-nationalisten in deze Kamer geen reden kan bestaan om dit akkoord goed te keuren. Het onderwijsfinancieringsakkoord van Sint-Elooi is strategisch fout, gevaarlijk voor de instellingen, dubbelzinnig en slecht voor Vlaanderen. De regeling van de financiering van het onderwijs hoort thuis in de onderhandelingen tussen de gemeenschappen over verdere stappen in de staatshervorming en niet in een geheim akkoord bij de vorming van de regering dat dan door Sint-Elooi gezegend wordt.

A little seriousness would be in place here. Today, however, we are talking about the legal development of the educational agreements. Also in this part there would be some will for each one, but it turned out that there was some more will for one Community than for the other. The French Community received the money it was hungry for. What many in Flanders, not only in the opposition, repeatedly called one of the main leverages for a further state reform, was thrown away here. All sorts of arrangements between the Flamingos alone can no longer remedy this fundamental negotiation issue. These agreements are the result of the secret agreement the Prime Minister first denied its existence but eventually had to admit. The fact that the Prime Minister in this file has given up a significant part of his credibility and his Flemish flank is nefast. After all, it is very difficult to rebuild this trust. We hope that the Agreement on Agriculture and Foreign Trade is a first step to rebuild a little bit of confidence. In our assessment of the reliability of the Prime Minister, however, this agreement can in no way outweigh the abandonment of the lever. We will follow the file further in the hope that eventually it will show that at the end of the ride a lot has been realized. However, it would have been better to start this in a different way. I would like to remind you of some elements of the agreement itself. The agreement and the current bill are not based on the most objectively determinable figure, namely the number of children in the compulsory age between six and eighteen years, but on a much less determinable data, namely the number of regularly enrolled pupils from six to seventeen years. Many corrective coefficients are used, making the problem of control very real. These figures will be shown in the period from 15 January to 1 February, starting in the year 2000. The communities provide the Court of Auditors with electronic files per student and school, after which the Court of Auditors will verify the data with bilingual teams. The number of pupils will be subject to a double check if adequate electronic files are not submitted by 15 May, within a few days. On the one hand, there will be a counting or control in schools. On the other hand, the count will be tested on the most objective data, namely the population figures of the children of that age. It is clear that this procedure fundamentally cannot work. The major questions raised by the staff of the Court of Auditors in the Senate regarding the feasibility of its additional tasks were blown into the wind. In fact, the Court of Auditors should be exclusively at the service of Parliament. Building up the timing may be logical counting in January and February with a check at the end of the school year – but it is a purely political logic. How will the counting happen in most years? The Court of Auditors has few own criteria for controlling the stocks. At some point one will find that these stocks are not correct and that the communities and the Court of Auditors are not. No need, however, if the communities and the Court of Audit fail to do so, comes as a deus ex machina the federal government which in all its wisdom will cut through the node. The timing of this can be predicted. This will happen in the early summer months, in the week between 21 and 28 July. De regering krijgt volmacht om onderwijsgeld tussen de gemeenschappen te verdelen, maar wie wint er eigenlijk bij dit akkoord? Niet Vlaanderen - wie zou dat ook nog maar durven te denken -, niet de democratie - wellicht is het belangrijk elders te spreken over democratie dan het hier dag na dag te verwezenlijken - en zelfs niet het onderwijs in Franstalig België. Uiteindelijk zal er voor beide gemeenschappen van ons land slechts goed onderwijs komen wanneer men in totaal vrije zelfbeschikking met eigen belastinginkomsten gestalte kan geven aan een onderwijs op de manier en met de middelen die men zelf wil. Op die manier kan men in Vlaanderen en Franstalig België een kwalitatief hoogstaand en aan onze eigenheden aangepast onderwijs garanderen waarop onze kinderen, die allemaal met dezelfde intellectuele basiscapaciteiten vertrekken, recht hebben.

Ik heb daarnet zelfs vastgesteld dat deze discussie anders wordt benaderd door de Franstalige en de Nederlandstalige christendemocratische oppositie. De heer Tastenhoye zou de mooie spreuk van Goethe In der Beschränkung zeigt sich den Meister , moeten kennen. Ik stel vast dat hij erin slaagt over de politiehervorming te spreken en banale en onjuiste dingen daarover te zeggen naar aanleiding van de bespreking van een onderwijsakkoord. Het scheelde niet veel of hij had het ook over de Seefhoek in Antwerpen. Dit debat en de sereniteit dienaangaande worden vertroebeld door een dubbele spanning die nog altijd niet is opgelost. Het is een spanning die enerzijds in verband staat met de investeringsinspanningen van de overheid en met de frictie tussen het overheidsinitiatief en het vrij initiatief anderzijds. Daarnaast is er de inbedding, conform artikel 24, paragraaf 3, van de Grondwet, dat duidelijk - en terecht - stelt dat iedereen het recht heeft op onderwijs, met eerbiediging van de fundamentele rechten en vrijheden en dat de toegang tot het onderwijs kosteloos is tot het einde van de leerplicht. Dit recht impliceert op de eerste plaats het vermogen voor iedereen om zonder voorafgaande toestemming, naar eigen inzicht onderwijs in te richten en te laten verstrekken, zowel naar de vorm als naar de inhoud. Op de tweede plaats houdt dit recht de vrijheid van de ouders of van de studenten in om zelf een school te kiezen, wat noodzakelijk de vereiste met zich brengt dat zij onder redelijke voorwaarden die in objectieve criteria moeten worden vertaald, een beroep zouden moeten kunnen doen op een school van hun keuze. Het hoeft geen betoog dat de concrete invulling en tenuitvoerlegging van dit recht, waaraan trouwens het gelijkheidsbeginsel is vastgekleefd, voor de gemeenschappen een niet onaanzienlijke financiële verplichting betekent die door toedoen van het kosteloos karakter van de onderwijstoegang en de vaststelling dat de door de federale overheid doorgestorte kredieten wel worden verantwoord door de behoefte van het onderwijs, maar dat de financiering ervan niet geheel wordt voorbehouden en dat de problemen worden verzwaard. Het is niet verwonderlijk, wat men daarover ook moge beweren, dat uit simulaties op basis van de huidige bijzondere financieringswet is gebleken dat zowel de Vlaamse als de Franse gemeenschap in de nabije toekomst een financiële nood zullen vertonen op het vlak van het onderwijs. Het zou goed zijn mocht iedereen beseffen dat dit voor beide gemeenschappen een probleem is. Trouwens, de vraag naar de omvang en de grootte van deze financiering werd reeds gesteld. Precies de twee thans voorliggende wetsontwerpen hebben tot doel om, in afwachting van een fundamentele oplossing, een voorlopige oplossing te brengen. Dat betekent dat in eerste instantie concrete problemen die om een dringende oplossing vragen, moeten worden aangepakt.

It is not surprising, whatever it may be said, that simulations based on the current special funding law have shown that both the Flemish and French communities will in the near future be in financial need in the field of education. Ik heb het over de vrijheid van onderwijs, de volledige financiering door de overheid - ook als het onderwijs niet wordt ingericht door de overheid - en de mogelijkheid voor iedereen om op al die onderwijsmogelijkheden een beroep te doen. Dat is niet in tegenspraak met de woorden van de VLD-voorzitter. Hij verklaarde immers dat het inderdaad een probleem is dat binnen de Vlaamse regering zal moeten worden opgelost in het licht van de mogelijkheden die zij heeft. Dat verklaart de andere eisen die de VLD in dat verband stelt. Ik wil het nu over het beruchte artikel 39,§ 2 van de bijzondere financieringswet hebben. We hebben er al veel over gehoord. Er zijn blijkbaar mensen die het nog nooit hebben gelezen, maar het toch in verband willen brengen met al het mogelijke en de schuldige van een andere partij. Artikel 39,§ 2 geeft voor de begrotingsjaren 1989, toen u nog journalist was, mijnheer Tastenhoye, tot 1998... Mijnheer Annemans, in tegenstelling tot veel van uw vrienden heb ik met mijn verleden geen enkel probleem. Artikel 39,§2 bepaalt voor de begrotingsjaren 1989 tot 1998 de verdeling van de opbouw van de belasting op de toegevoegde waarde in het licht van het huidig aantal leerlingen; 57,55% voor de Vlaamse Gemeenschap en 42,55% voor de Franse Gemeenschap. Het is duidelijk bepaald - en dat wist men in 1989 - dat men vanaf het begrotingsjaar 1999 de verdeelsleutel moest aanpassen aan de verdeling van het aantal leerlingen. Dit moest gebeuren aan de hand van bij wet vastgestelde, objectieve criteria. Het is een neutrale vaststelling dat de vorige regeringen bij een gebrek aan eensgezindheid en een zekere inertie, er nooit in zijn geslaagd om een afdoend antwoord te bieden op deze bijzondere wettelijke vereiste. Wie durft nu te betwisten dat het een verdienste van de huidige regering is om een aantal aanvaardbare parameters vast te leggen? Sta mij toe u deze parameters te geven. Ten eerste is er de conformiteit met de bijzondere wet die uitdrukkelijk gewag maakt van het leerlingenaantal. Dat staat in de wet. Men kan dat niet wegmoffelen. Ten tweede is er de neutraliteit ten aanzien van het beleid. Dat betekent dat een gemeenschap haar beleid niet kan oriënteren in de richting van een voor haar gunstige middelenverdeling. Ten derde is er een onbetwistbare, transparante en objectieve controle door een onafhankelijke, gezaghebbende instantie, namelijk het Rekenhof. Mijnheer Tastenhoye, u vergist zich ongelooflijk. Ik kom daar dadelijk op terug. Een gebrek aan financiële zuurstof zal de gemeenschap verplichten de kwaliteit en kwantiteit van haar onderwijs terug te schroeven. Mijnheer Tastenhoye, ik betreur uw uitspraak over de kwaliteit van het Franstalig onderwijs. Ik ken mensen, opgeleid in het Franstalig onderwijs, die bijzonder intelligent zijn.

Dit begrip moet in de formele zin van het woord worden geïnterpreteerd. Men moet de vraag beantwoorden in hoeverre de bestanden van de twee gemeenschappen overeenstemmen met de richtlijnen van het Rekenhof. In de loop van de jaren is de opdracht van het Rekenhof geëvolueerd. Als men bijzonder conservatief is ingesteld en men de evolutie in de maatschappij niet wil zien en denkt dat de gemeenschap altijd zal blijven zoals ze in de Middeleeuwen was, kan men een dergelijke evolutie niet begrijpen. Ik herinner u eraan dat het Rekenhof op een bepaald ogenblik gevraagd werd over rekenplichtigen te oordelen. Dat staat ook niet in de oorspronkelijke tekst van de Grondwet en behoort niet tot de oorspronkelijke opdrachten van het Hof. Het is een evolutie die het Rekenhof doormaakt. Het lijkt me evident dat de regering met een wet die door het parlement wordt goedgekeurd deze opdracht aan het Rekenhof geeft. Wat de ophaling betreft, wens ik te beklemtonen dat het hier geen beperking van de vrijheid van de ouders betreft om hun kinderen naar een bepaalde school te sturen maar een beperking van de vrijheid van de overheden om buiten hun werkterrein op een deloyale manier activiteiten te ontwikkelen. Met ophaling bedoelt men een regelmatige en bewust georganiseerde ophaling van kinderen. Dit begrip wordt ingevuld op basis van de verordening 684/92 van de Raad van de Europese Gemeenschappen die het begrip ophaling duidelijk vermeldt. Volgens deze verordening betekent ophaling het vervoer van leerlingen door middel van voertuigen met 9 of meer plaatsen, de bestuurder inbegrepen. Het is correct dat er problemen kunnen ontstaan als de regeling niet correct wordt nageleefd. De wettekst bevat terzake duidelijke regelingen en geeft het Rekenhof belangrijke bevoegdheden. Wij zijn ervan overtuigd dat het Rekenhof deze opdracht in de praktijk aankan en dat men de opdrachten van het Hof niet moet beperken tot de globale en klassieke opdrachten van dit controleorgaan zoals die oorspronkelijk in de Grondwet zijn opgenomen. In de komende weken en maanden zal de regering het Rekenhof nog andere opdrachten toevertrouwen die eveneens verder strekken dan de opdrachten die het Hof destijds heeft gekregen. Het is, mijns inziens, eveneens een taak van het parlement om mee te evolueren met de maatschappij. Mijnheer de voorzitter, het tweede ontwerp strekt ertoe de sinds 1989 bepaalde financiering van het universitair onderwijs aan buitenlandse studenten aan te passen. Recente arresten van het Europees Hof voor Justitie herinneren ons land aan de verplichting om de buitenlandse studenten van de Europese Unie te beschouwen als financierbaar op dezelfde basis als de Belgische studenten. De vrees van heer Borginon inzake discriminatie is onterecht. Artikel 62, 3 van de bijzondere financieringswet verzet zich geenszins tegen een meer structurele en op criteria gestoelde regelgeving die toelaat om de in deze geldende bedragen te verhogen met de bedoeling rekening te houden met de eventuele financiële gevolgen voor de gemeenschappen van de beslissingen die de federale overheid bij de uitoefening van haar eigen bevoegdheid heeft genomen. Ik vind het in een democratie zeer goed dat deze twee ontwerpen kritiek hebben gekregen van de oppositie. Het tegenovergestelde zou me niet alleen verbazen maar ook beangstigen. Ik zou bijzonder veel argwaan hebben over een tekst van de meerderheid die door de oppositie niet bekritiseerd wordt. Wanneer we alle ernstige argumenten bekijken, dan mogen we duidelijk stellen dat de regering erin geslaagd is om haar doel te bereiken, namelijk het verwezenlijken van een neutrale operatie gestoeld op objectieve criteria. Dat is een regeling waar men in het verleden niet in geslaagd is en waar men nu tot een voor iedereen... In the coming weeks and months, the Government will entrust the Court of Auditors with other tasks that also extend beyond the tasks that the Court received at the time. It is, in my opinion, also a task of Parliament to evolve with society. Mr. Speaker, the second draft aims to adapt the financing of university education for foreign students established since 1989. Recent judgments of the European Court of Justice remind our country of the obligation to consider foreign students of the European Union as eligible for funding on the same basis as Belgian students. Mr Borginon’s fear of discrimination is unjustified. Article 62, paragraph 3 of the Special Financing Act is in no way opposed to a more structural and criterion-based regulation allowing to increase the amounts in force in these terms with the intention of taking into account the possible financial consequences for the communities of the decisions taken by the federal government in the exercise of its own competence. I think it is very good in a democracy that these two drafts have received criticism from the opposition. The opposite would not only surprise me, but also scare me. Il y aura donc une information très directe de la commission des Finances, au fur et à mesure de l'adoption des arrêtés par le Conseil des ministres, après l'examen par le Conseil d'Etat bien entendu. Deuxième élément lié à cette procédure: j'ai annoncé que je déposerais chaque fois au Conseil des ministres les projets de loi de ratification en même temps que les arrêtés. De cette fac¸on, le débat de ratification interviendra très tôt après l'adoption des arrêtés par le gouvernement. Ik wil even beklemtonen dat veel ontwikkelingslanden sterk afhankelijk zijn van koffie als exportproduct. Elke prijsdaling heeft een onmiddellijke invloed op het leven van miljoenen kleine boeren die instaan voor 10% van de totale koffieproductie. Het internationaal koffieakkoord van 1994 is een flauw afkooksel van de 4 voorgaande internationale koffieakkoorden die tussen 1963 en 1989 werden gesloten. Zij regelden de koffieprijs aan de hand van vastgelegde exportquota. Er werden geen clausules meer opgenomen sinds het afsluiten van het laatste akkoord in 1989. De gevolgen waren dramatisch voor de derde wereld door het ontstaan van prijsdalingen, prijsschommelingen en de bijbehorende speculaties. Wij pleiten daarom om, bij de onderhandelingen binnen de Internationale Koffie Organisatie, het ICO, dergelijke clausules opnieuw op te nemen. Heden vonden reeds 3 onderhandelingssessies plaats, waar nog geen sprake was van een prijsstabilisatie. Wij zullen de opname van een economische clausule blijven bepleiten. Ik zal niet nalaten om de regering hierover te bevragen. België kan op die manier, samen met de Europese Unie, binnen het ICO een voortrekkersrol spelen en initiatief nemen om ook de consumerende landen te laten bijdragen aan de financiering van bufferstocks. Deze bufferstocks zijn belangrijk om een prijsregularisering te kunnen afspreken indien een economische clausule niet haalbaar zou zijn.

The consequences were dramatic for the Third World due to the emergence of price drops, price fluctuations and the associated speculation. We therefore advocate the reintroduction of such clauses in the negotiations within the International Coffee Organization, the ICO. Today, three negotiating sessions have already taken place, where there has not yet been a price stabilization. We will continue to advocate the inclusion of an economic clause. I will not fail to ask the government about this. In this way, together with the European Union, Belgium can play a pioneering role within the ICO and take the initiative to allow consuming countries to contribute to the financing of buffer stocks as well. These buffer stocks are important for negotiating a price regulation if an economic clause would not be feasible.
