Mijnheer de voorzitter, mijnheer de minister, collega's, het is jammer dat deze plenaire vergadering samenvalt met een vergadering van de commissie voor de Binnenlandse Zaken waarin aandacht wordt besteed aan de invulling van de politiehervorming. Voor sommige collega's zal dit een geruststelling zijn want dit is een extra reden om het zo kort mogelijk te houden.
Mijnheer de voorzitter, mijnheer de minister, collega's, in zijn inleiding bij deze wetsontwerpen zei de minister in de commissie, ik citeer: "De aldus voorgestelde hervorming past in het streven om de burgerdemocratie te versterken en te vervolmaken. Meer dan tevoren zal de burger bij machte zijn te bepalen wie hem moet vertegenwoordigen in de betrokken assemblees. Die nieuwe weging van de lijststem zal bovendien bijdragen tot een betere vertegenwoordiging van de vrouwen op het politieke forum aangezien een stem op een vrouw ook zwaarder zal doorwegen".
De reële effecten van deze hervorming zijn heel wat bescheidener. Wie het voorkeurstemmengedrag bij verkiezingen grondig analyseert, weet dat er door de kiezers meer voorkeurstemmen worden uitgebracht naarmate afstand tussen kiezer en verkozene fysiek kleiner is. Procentueel worden er veel meer voorkeurstemmen uitgebracht bij gemeenteraadverkiezingen dan bij parlementsverkiezingen. Bij gemeenteraadsverkiezingen wordt het merendeel van de kandidaten buiten de lijstvolgorde verkozen omdat het voorkeurstemmenpercentage hoog ligt en het aantal overdraagbare stemmen bijgevolg gering is.
Uit onderzoek van de afdeling Politicologie van de Katholieke Universiteit Leuven over de gemeenteraadsverkiezingen van 1994 bleek dat 84,4% van de Vlaamse kiezers een voorkeurstem uitbracht en dat tweederde van de gemeenteraadsleden in de Vlaamse gemeenten verkozen werd zonder dat dit in verband kon worden gebracht met een lijststem.
Bij de bespreking van de vorige wetsontwerpen heeft de CVP erop gewezen dat het effect van de halvering van de lijststem bij de gemeenteraadsverkiezingen om die redenen gering zou zijn. Ook de resultaten van de laatste gemeenteraadsverkiezingen geven ons gelijk. Onderzoek van de afdeling Politicologie van de Katholieke Universiteit Leuven in de gemeenten van de provincie Vlaams-Brabant over dat effect bij de gemeenteraadsverkiezingen van 8 oktober van vorig jaar heeft aangetoond dat 27 zetels van de in totaal 1.467 toe te kennen zetels door de halvering een andere eigenaar hebben verkregen.
Procentueel uitgedrukt bedraagt dit effect 1,84%. In 40 van 65 gemeenten veranderde er door de halvering trouwens helemaal niets. De zetels zouden in deze gemeenten naar exact dezelfde personen zijn gegaan, ook zonder de halvering van de lijststem. Het onderzoek heeft zich weliswaar beperkt tot Vlaams-Brabant, maar de onderzoekers beweren dat de onderzoeksresultaten veralgemeend kunnen worden naar heel Vlaanderen. Het ziet er naar uit dat het effect van de halvering van het gewicht van de lijststem voor parlementaire asemblees minstens even gering zal zijn. Uit simulaties op basis van de verkiezingsuitslagen van 1999, zoals deze gepubliceerd werden in het tijdschrift Res Publica, kan men het volgende opmaken. Ten eerste, zijn er voor de verkiezing van het Europees Parlement geen wijzigingen. Ten tweede, wat de verkiezing van de Kamer betreft, zouden 4 van de 150 volksvertegenwoordigers die op 13 juni 1999 verkozen werden hun zetel aan een partijgenoot moeten afstaan. Het is interessant om dit eventjes concreet uit te spitten. Dit zou bijvoorbeeld tot gevolg gehad hebben dat mevrouw Anke Vandermeersch, toen nog kandidate voor de VLD, zou verkozen geweest zijn. Voor de verkiezing van de Senaat zouden vier van de rechtstreeks verkozen senatoren hun zetel hebben moeten afstaan en zou bijvoorbeeld Johan Demol verkozen geweest zijn en in de Senaat zetelen. Een ongelooflijke vooruitgang nietwaar? Als je de concrete resultaten bekijkt dan moet ik zeggen dat er puik, vernieuwend werk wordt geleverd. Echter niet in de gewenste richting. Voor de verkiezing van het Vlaams Parlement zouden 9 zetels van eigenaar verwisselen. Onder meer Fatima Bali en niet Jo Vermeulen zou dan voor Agalev in het Vlaams Parlement gezeteld hebben. Ludwig Meeuws en niet Frans Decock zou de VLD vertegenwoordigd hebben. Voor de verkiezing van de Waalse Gewestraad zouden 3 van 75 zetels een andere titularis krijgen. In totaal gaat het om 20 van 408 parlementsleden, de Brusselse Hoofdstedelijke Raad buiten beschouwing gelaten.
Tot zover een evaluatie van wat het concrete effect van deze halvering is, rekening houdend met de heel ambitieuze verwachting die men in het vooruitzicht had gesteld. De regering motiveert de halvering van het gewicht van de lijststem ook met het argument dat hierdoor ook meer dames zouden verkozen worden. In totaal zouden er, aangenomen dat de verkiezingsuitslag dezelfde is, in de vier assemblees 7 dames meer zetelen. Hierdoor zou hun totale aantal op 87 komen, ofwel 21,3%. Dit is dus een stijging van 1,7%. Een fantastisch resultaat. Het toeval zal hierbij dan nog geen rol gespeeld hebben, wat ook nog mogelijk is. De halvering van het gewicht van de lijststem heeft dus maar een zeer beperkte invloed. De halvering leidt er dus zeker niet toe dat de kiezer, meer dan nu het geval is, zou kunnen bepalen wie hem zal vertegenwoordigen in het parlement. Dit is echter het argument waarmee men om de haverklap voor de dag komt. De kiezer zou door de halvering een grotere impact hebben op de verkiezingsuitslag, de kiezer zou zijn stem zwaarder kunnen laten doorwegen. Ik wil dat straks toch even relativeren. Indien de stem van de kiezer zwaar moet doorwegen, mag men dat wat ons betreft niet beperken tot enkel het aanduiden van het politieke personeel. Ik dacht dat het houden van verkiezingen ook de gelegenheid was waarop de kiezer de kans kreeg om een uitspraak te doen over het door hem of haar gewenste beleid.
Alles in het teken van de mandaten stellen, lijkt ons niet het belangrijkste of meest verantwoorde uitgangspunt.
Overigens blijkt uit de simulaties dat het zeer beperkte effect van de halvering van het gewicht van de lijststem alleen geldt voor de grote partijen. Dat is nog een bijkomende nuance. In de meeste arrondissementen halen kleinere partijen hoogstens een zetel, zodat de impact daarvan nihil is.
Ter gelegenheid van de bespreking in de commissie heb ik dit in korte bewoordingen reeds onderstreept: in feite zou het ontwerp de aanleiding moeten vormen om een debat te voeren over ons kiesstelsel, over de rol van de politieke partijen in ons politiek systeem, over de personalisering en de mediatisering van de politiek en over de gevolgen daarvan en uiteindelijk over de vraag welke soort politici wij willen. In feite had het debat over het al dan niet neutraliseren of afzwakken van de lijststem minstens ook moeten zijn gevoerd in de commissie voor Politieke Vernieuwing. Dat had gekund in het kader van het debat over de vertegenwoordigende democratie in die commissie. Echter, de ontwerpen in verband met het halveren van het gewicht van de lijststem moesten, naar de woorden van de eerste minister, snel en efficiënt worden goedgekeurd, want het betrof een van de symbooldossiers, niet voor de regering in haar geheel, maar wel voor de eerste minister. Nochtans dekt de vlag in deze de lading helemaal niet. Ik hoop dat degenen met dezelfde ambities als de eerste minister de moed zullen hebben het verslag te lezen. Ik stel namelijk vast dat zij ook in dit debat totaal afwezig blijven.
Ik heb begrepen dat het hier een van de hot items betreft uit heel de aanloop naar de voorbije verkiezingen, zeg maar de — gelukte — greep naar de macht. Als het er dan op aankomt om van die programmapunten echt werk te maken, schitteren zij net als in de commissie voor Politieke Vernieuwing door hun afwezigheid.
Dat geldt natuurlijk niet voor u, mijnheer de voorzitter. Uw rol als voorzitter is altijd zo onpartijdig en onbevooroordeeld, dat ik u in deze geen verwijten kan maken. U zult dat niet ontkennen.

Mr. Speaker, Mr. Minister, Colleagues, it is regrettable that this plenary session coincides with a meeting of the Committee on Internal Affairs which focuses on the completion of the police reform. For some colleagues, this will be a reassurance because this is an additional reason to keep it as short as possible.
Mr. Speaker, Mr. Minister, colleagues, in his introduction to these bills, the Minister in the committee, I quote, said: "The reform thus proposed fits in the effort to strengthen and perfect the civil democracy. More than ever before, the citizen will be in power to decide who will represent him in the respective assemblies. This new weighting of the list vote will also contribute to a better representation of women in the political forum as voting for a woman will also be more important.”
The real effects of this reform are much more modest. Those who thoroughly analyze preferred behavior in elections know that the more preferred votes are issued by the voters as the distance between the voter and the elected is physically smaller. A lot more preferential votes are cast in municipal council elections than in parliamentary elections. In municipal council elections, the majority of candidates are elected outside the list order because the preferred vote percentage is high and the number of transferable votes is therefore low.
Research by the Department of Political Science of the Catholic University of Leuven on the 1994 municipal council elections found that 84.4% of Flemish voters gave a preferred vote and that two-thirds of municipal council members were elected in the Flemish municipalities without this being connected with a list vote.

The halving, therefore, ⁇ does not mean that the voter, more than now, would be able to determine who will represent him in parliament. This, however, is the argument with which one comes to the oatmeal for the day. The voter would have a greater impact on the election outcome by the halving, the voter could have his vote more heavy. I would like to relativize this later. If the vote of the voter must be heavy, we must not limit this to the mere designation of the political staff. I thought holding elections was also the opportunity where the voter was given the opportunity to make a judgment about the policy he or she wanted.
Puting everything in the sign of the mandates does not seem to us to be the most important or most responsible starting point.
By the way, the simulations show that the very limited effect of halving the weight of the list vote applies only to the large parties. This is another additional nuance. In most districts, smaller parties have a maximum of one seat, so the impact is null.
On the occasion of the discussion in the committee, I have already emphasised this in brief terms: in fact, the draft should be the occasion for a debate about our electoral system, about the role of political parties in our political system, about the personalization and medialization of politics and about its consequences and finally about what kind of politicians we want. In fact, the debate on whether or not to neutralize or weaken the list vote should at least also have been held in the Committee for Political Renewal. This could have been done in the context of the debate on representative democracy in that committee. However, the drafts related to halving the weight of the list vote needed, according to the Prime Minister, to be approved quickly and efficiently, because it concerned one of the symbol files, not for the government as a whole, but for the Prime Minister. However, the flag in this does not cover the cargo at all. I hope those with the same ambitions as the Prime Minister will have the courage to read the report. In fact, I find that they are also completely absent in this debate.
I have understood that this is one of the hot items in the whole run-up to the last elections, say the — lucky — seizure of power. When it comes to making real work of those program points, they shine in their absence, just like in the Committee on Political Renewal.

Mijnheer de voorzitter, er is geen spreektijdbeperking in deze aangelegenheid. We behandelen hier wetsontwerpen en, aangezien u en uw partij onderhavige ontwerpen zo belangrijk achten, vind ik dat wij daar ook de nodige tijd voor moeten uittrekken.
In de commissie voor de Politieke Vernieuwing bleek het een probleem te zijn om de heer Van der Maelen binnen de afspraken te houden en zijn werk daadwerkelijk te laten doen. Toen liet de eerste minister er zich toe verleiden om door middel van beeldspraak het belang van die commissie te onderlijnen. Ik kan niet nalaten om dat hier even aan te halen.
De eerste minister vergelijkt namelijk het belang van de commissie voor de Politieke Vernieuwing met de invoering van het algemeen enkelvoudig stemrecht en het stemrecht voor vrouwen. De eerste minister zei dat de installatievergadering van de commissie voor de Politieke Vernieuwing plaatsvond op een historisch moment: respectievelijk 80 en 50 jaar na de belangrijke momenten van democratisering, dus na de invoering van het algemeen enkelvoudig stemrecht en de toekenning van stemrecht aan vrouwen.
Het integrale relaas van het concreet verloop van de zaken nadien zal ik u besparen.
Op het ontwerp van de neutralisering van de lijststem hebben we nog ongeveer een jaar moeten wachten. Op alle andere zogenaamd erg belangrijke ontwerpen betreffende politieke vernieuwing wachten we nog altijd. Ik weet niet of daar ooit nog iets van in huis zal komen. Ik maak me daar wel wat zorgen over, alhoewel ik dat niet hoef te doen. Wel stel ik vast dat de partners in deze regering het helemaal niet meer met mekaar eens zijn over de ideeën die in die commissie geconcretiseerd zouden moeten worden.
In de commissie voor de Politieke Vernieuwing willen we het debat aangaan over onder meer de rol van partijen en de optimale functionering van een kiessysteem. Misschien is het wat oudmodisch om dit nog te zeggen, maar de CVP heeft het standpunt ingenomen dat politieke partijen een belangrijke rol moeten kunnen blijven spelen in de rekrutering van het politieke personeel. Politieke partijen verzamelen namelijk mensen op grond van een visie op de gewenste inrichting van de samenleving. Als politieke partijen die rol niet meer kunnen vervullen, dan zullen andere sociale elites die rol overnemen, zoals bijvoorbeeld de media of kapitaalkrachtige individuen. Zonder politieke partijen komt de burger alleen te staan tegenover de staat. Dat wensen wij niet.
Vermits politieke partijen voor ons een belangrijke rol moeten kunnen blijven spelen in de rekrutering van politiek personeel, zijn wij tegen de volledige neutralisering of de afschaffing van de lijststem. Voor ons moeten verkiezingen méér zijn dan een populariteitspoll. Verkiezingen dienen overigens niet alleen om de vertegenwoordigers van het volk aan te wijzen, maar ook om meerderheden te vormen die moeten leiden tot enige stabiliteit in het bestuur, ook het dagelijkse bestuur.
Die twee invalshoeken, enerzijds de inspraak van de kiezers en anderzijds de vorming van stabiele bestuursmeerderheden, zijn voor ons in het debat over het kiesstelsel even belangrijk. De ene doelstelling is niet ondergeschikt aan de andere. Wij delen de opvatting van de liberalen dus niet. Mijnheer de voorzitter, aangezien er nu geen liberalen aanwezig zijn, zult u hen dat moeten laten weten. De liberalen willen de invloed van partijen tot een minimum terugdringen, aldus de heer Cortois. Ik heb in de commissie vastgesteld dat de liberalen met die opvatting eigenlijk geïsoleerd staan. De socialisten en de groenen zitten meer op onze lijn dan op die van de liberalen. Het ligt niet zo goed in de markt om op dat punt voluit zijn mening te zeggen. Nochtans is dit de plaats waar het moet gebeuren.
Mijnheer de voorzitter, ik kan alleen maar vaststellen dat het echte debat niet wordt gevoerd, al het gebazel over nieuwe politieke cultuur ten spijt. Hier wordt geen enkele aanzet gegeven. Integendeel collega's, men moet enige moed hebben om in dit huis nog inhoudelijke debatten over ontwerpen en voorstellen van wet te voeren. Nochtans, als het hier niet gebeurt, zal het nergens gebeuren. Als men een opvatting heeft, moet men die ook formuleren.
Ten tweede stel ik vast dat toch over de tekst moet worden gestemd om de schone schijn van de zogenaamde burgerdemocratie hoog te houden. De voorliggende teksten zijn immers de schaarse restanten van Verhofstadt's burgermanifesten. De halvering van het gewicht van de lijststem is hierbij het schaamlapje van de burgerdemocratie. Ik dacht dat ik dat voldoende heb aangetoond. Achter deze maatregel kan de partij die dit lanceert zich nog proberen verbergen.
In zijn eerste interviews na het aantreden van zijn regering, heeft de eerste minister, met de grootspraak die hem eigen is, dit voorgesteld als één van de grote hervormingen. In feite is het niet meer dan een symbooldossier en de betreffende wetgeving is symboolwetgeving. Deze ontwerpen zijn er trouwens alleen gekomen omdat de liberalen ze nodig hebben om, op een niet eens essentieel domein, hun bestaan in deze regering te bewijzen. Men hoopt voor de kiezer het bewijs te leveren dat de afgelegde beloften ook worden nagekomen. Een andere motivering is er niet.
Mijnheer de voorzitter, mijnheer de minister, collega's, ik kan niet anders dan mezelf herhalen met mijn besluit na de bespreking van de ontwerpen die de vorige keer om dezelfde reden hier aan de orde waren. Ik besluit met het adagium much ado about nothing. Men zet een hele hervormingsmachine op gang voor een resultaat dat nauwelijks zichtbaar is.
Ten slotte, mijnheer de minister, collega's, wou ik nog even uw aandacht vragen voor een niet te onderschatten risico bij de werkelijke toepassing van de nieuwe wetgeving, zoals ze na de stemming bij verkiezingen, ook in onze regionale parlementen, zal moeten worden toegepast.
Een aspect dat ik ook in de commissievergaderingen reeds aankaartte vraagt, volgens mij, echt om een amendering. Ik sta met die mening niet alleen.
Mijnheer de minister, als u deze tekst zondermeer van toepassing laat worden, dan zult u, vooral in een paar kleinere kiesdistricten waar maar twee of drie zetels te verdelen zijn, meer dan u lief is met de noodzaak van tussentijdse verkiezingen worden geconfronteerd. Als er maar twee zetels te verdelen zijn en één van de verkozenen wordt geroepen om minister te worden, dan is het de vraag of de tweede niet-verkozene op dat ogenblik zal willen of kunnen zetelen in de assemblee in kwestie. Als dat niet het geval is, moet u onmiddellijk nieuwe verkiezingen organiseren met de vraag naar wie de zetels dan zullen gaan.
Ik sta met die opvatting niet alleen. Ik stel vast dat dezelfde vrees bij de Raad van State aanwezig is. Ik verontschuldig mij voor het komende, ietwat lange citaat, maar het is nuttig om er even bij stil te staan.
Mijnheer de minister, ik ben niet door dezelfde gezondheidstoestand aangestoken, maar door uw voorstel om ons beiden een beetje uit te putten om deze zaak de aandacht te geven die ze verdient.
De Raad van State stelt, ik citeer: "In tegenstelling tot wat bepaald was in het voorontwerp van wet, voorziet het voorliggende voorontwerp waarbij onderscheid tussen kandidaat-titularissen en kandidaat-opvolgers wordt opgeheven niet aansluitend in de mogelijkheid om meer kandidaten op de lijsten te plaatsen dan het aantal te verkiezen kandidaten. Met zulk een regeling wordt de kans veel groter dat er tussentijdse verkiezingen worden gehouden, inzonderheid in de kleine kieskringen waar er slechts 2, 3 of 4 zetels worden toegewezen. In de huidige regeling worden voor iedere lijst waarop minstens een kandidaat wordt gekozen minstens drie kandidaten als opvolger aangewezen. Wanneer bijvoorbeeld twee zetels moeten worden toegewezen, zal het huidige ontwerp voor gevolg hebben dat de lijst die een zetel behaalt slechts een enkele opvolger heeft. Zodra de gekozen kandidaat aangewezen wordt voor een ministerambt en zijn opvolger om een of andere reden zijn ambt niet kan uitoefenen, moet een nieuwe verkiezing worden gehouden. Indien de betrokken lijst niet de meerderheid van de stemmen behaalt, verliest ze haar zetel". Collega's, dit betekent dat het perfect mogelijk is dat bij een herverkiezing de te begeven zetel naar een andere lijst gaat. De Raad van State vervolgt, ik citeer opnieuw: "Door niet te zorgen voor voldoende opvolgers kan de ontworpen wet dus ongewild het evenwicht van de huidige regeling aanzienlijk wijzigen".
Mijnheer de voorzitter, collega's, de regering reageert op een bijzonder laconieke wijze op het advies van de Raad van State. Zij stelt, ik citeer: " De regering heeft het niet opportuun geacht rekening te houden met de door de Raad van State geformuleerde opmerking".
Mijnheer de minister, het is, mijns inziens, zeer bedenkelijk dat u, als minister onder wiens bevoegdheid de Raad van State ressorteert, zich met een dergelijke laconieke reactie van het advies van de Raad van State probeert te ontdoen. Het is niet de eerste keer dat de regering een advies van de Raad van State naast zich neerlegt. Dat zij zelfs niet de moeite doet om inhoudelijk op het advies te reageren, is echter zeer bedenkelijk.
Het door de CVP en de Raad van State aangekaarte probleem stelt zich nog scherper bij de verkiezing van de gewestassemblees dan bij de verkiezing van de federale kamers. Voor de verkiezing van de Waalse gewestraad zijn er een aantal kleinere kieskringen dan voor de Kamer. Ik geef een paar voorbeelden: in de kieskring Neufchateau-Virton kunnen slechts 2 kandidaten verkozen worden, in Thuin, Aarlen, Marche-enFamenne, en Bastogne kunnen slechts 3 kandidaten verkozen worden, in Soignies kunnen slechts 4 kandidaten verkozen worden.
Collega's, geen oplossing zoeken voor dit probleem staat gelijk met onbehoorlijk bestuur.De CVP stelde tevreden vast dat de SP bij de stemming in de commissie ons amendement terzake heeft gesteund.
Ik roep u allen op — u die de mond vol heeft over de herwaardering van het parlementaire werk — deze gelegenheid niet te laten voorbijgaan en een oplossing te bieden voor een probleem dat men niet kan negeren. De CVP biedt de oplossing aan. Ons amendement strekt ertoe een paar kandidaten toe te voegen in geval van een beperkt aantal kandidaten. De oplossing is zeer eenvoudig. In het slechtste geval kan de Kamer volgende week het ontwerp goedkeuren. Na meer dan een jaar op deze tekst te hebben moeten wachten, kan een weekje uitstel de zaak niet maken.
Iedereen die nog een greintje verantwoordelijkheid voelt voor de kwaliteit van het hier gepresteerde wetgevende werk, en iedereen die meent dat het parlement inderdaad nog een rol te spelen heeft in de totstandkoming van de wetgeving, en vooral in het toezicht op de kwaliteit van die wetgeving, roep ik op om nog eens kritisch na te denken en om het amendement samen met ons te steunen. Without political parties, the citizen stands alone against the state. We do not desire that.
Since political parties should continue to play an important role for us in the recruitment of political personnel, we oppose the complete neutralization or the abolition of the list vote. For us, elections should be more than a popularity pool. Elections, by the way, serve not only to appoint the representatives of the people, but also to form majorities that should lead to some stability in the administration, including the daily administration.
These two perspectives, on the one hand the participation of the voters and on the other hand the formation of stable administrative majorities, are equally important for us in the debate about the electoral system. One goal is not subordinate to the other. We do not share the views of the liberals. Mr. Speaker, since there are no liberals present now, you will have to let them know. The Council of State states, I quote: "In contrast to what was stipulated in the preliminary draft law, the preliminary draft which removes the distinction between candidate-titulars and candidate-successors does not consistently provide for the possibility of placing more candidates on the lists than the number of candidates to be elected. Such a scheme increases the likelihood of holding interim elections, ⁇ in the small electoral circles where only 2, 3 or 4 seats are allocated. In the current system, for each list on which at least one candidate is elected, at least three candidates are designated as successors. C'est pour des raisons de technique légistique que je me retrouve aujourd'hui pour la troisième fois en séance plénière de la Chambre, après être déjà intervenu en commission et, pour certains autres projets, en commission du Sénat et en séance plénière du Sénat.
Il est très difficile, monsieur Tant, de se renouveler en ce qui concerne les arguments de fond, mais vous pratiquez le principe de la répétition bien connu en pédagogie. Rassurez-vous, je ne vais pas faire la même chose puisque j'ai déjà répondu à bon nombre de vos observations. Je voudrais cependant revenir sur certaines d'entre elles, notamment dans la mesure où vous citez un rapport, d'ailleurs fort bien fait mais qui est toujours une synthèse des interventions des uns et des autres et qui ne reprend pas toutes les nuances exprimées par leur auteur.
Il y a en tout cas une chose sur laquelle je suis d'accord. Ce n'est pas un projet comme celui-ci qui est de nature en soi et à lui seul à rénover le fonctionnement de notre démocratie. D'ailleurs, toutes les réformes que nous votons ici au parlement, qui sont souvent des réformes techniques, c'est-à-dire les supports de la démocratie, les instruments utilisés, sont évidemment importantes mais ne constituent pas l'essentiel. Je me souviens de mes convictions lorsque j'avais 20 ans, à savoir que la démocratie est quelque chose de vivant, qu'elle peut progresser par la formation, l'éducation du citoyen, par l'effort d'information qu'il fait, par la manière dont il exerce son esprit critique, par le débat que l'on développe devant lui pour lui présenter — car dans un monde de plus en plus complexe, les choses ne sont jamais simples — les différentes facettes d'un problème et les options qui sont ouvertes. C'est là l'essentiel et, spécialement pour les hommes politiques, c'est tous les jours, dans leur pratique quotidienne et dans l'exemple qu'ils donnent qu'ils peuvent renforcer le fonctionnement de la démocratie.
Cela étant, les instruments ne sont pas inutiles. Au-delà de ce projet relatif à la suppression de la moitié de l'effet dévolutif de la case de tête, beaucoup d'autres initiatives peuvent être prises. J'ai moi-même, me trouvant pendant longtemps dans l'opposition, développé un certain nombre de propositions qui malheureusement n'ont pas rencontré grand succès, ni de la part du gouvernement de l'époque ni même ici au parlement. Il ne faut toutefois pas désespérer, monsieur Tant. Je vous invite à faire preuve d'imagination et à déposer des propositions pour favoriser le débat.
Nous avons eu ce matin une petite discussion en commission de l'Intérieur sur des propositions déposées par deux de vos collègues dont l'objet est modeste. Et vous aurez constaté que, malgré l'avis contraire de mon administration, j'ai pour ma part soutenu ces propositions parce que je trouvais qu'elles constituaient une contribution.
Comme je ne croyais pas que vous alliez vous répéter aujourd'hui, je n'ai pas repris tout mon dossier.
Je commencerai par vous répondre en ce qui concerne les chiffres. Bien sûr, l'effet est modeste mais il s'agit avant tout d'une question de principe. Même s'il ne devait y avoir qu'une modification dans l'attribution d'un siège, cela aurait un sens parce que, pour les électeurs, celui qui est appelé à les représenter dans une circonscription est certainement un homme extrêmement important.
J'avais le souvenir, sur base d'une étude faite par le CRISP, qu'à la Chambre, si le système avait été appliqué aux précédentes élections, il y aurait eu une modification d'une dizaine de sièges. Vous me citez le nombre de quatre.
J'ajoute que cette analyse, réalisée a posteriori, n'a pas vraiment de sens. En effet, ce n'est qu'à partir du moment où les électeurs savent que le choix individuel qu'ils font peut avoir plus de poids dans la décision, qu'ils vont mettre en oeuvre ce choix renforcé.
Je trouve légitime, politiquement, dans un régime démocratique, de renforcer la possibilité de choix de l'électeur et ce, quels que soient les risques que cela peut comporter. Je ne vais pas revenir sur tout ce qui a été dit en commission. Nous n'avons pas négligé l'effet du rôle que les partis peuvent utilement jouer. Nous connaissons tous un certain nombre de grands parlementaires qui, probablement, n'auraient pas été élus par le suffrage direct uniquement car ils n'étaient pas d'une popularité extraordinaire et qui, pourtant, ont honoré nos deux chambres.
C'est pour cette raison que certains ont souhaité la réduction de moitié de l'effet dévolutif de la case de tête.
Je n'ai jamais prétendu non plus que c'était le moyen d'avoir un renforcement très important de la représentation féminine.
Mais, par cette technique, si l'électeur le désire, il en aura la possibilité. Selon moi, ce n'est pas cela qui est décisif. Ce qui est décisif, c'est qu'il choisisse, homme ou femme, le représentant qu'il souhaite.
En ce qui concerne la représentation des femmes, je reconnais que nous pourrions faire mieux. Bientôt, j'aurai l'occasion, avec Mme la vicepremière ministre Onkelinx, de déposer une proposition de modification de la Constitution mais également un projet de loi qui devrait, par son application, permettre le renforcement de la présence féminine au sein de nos assemblées.
Je crois qu'il faudrait animer un peu plus le débat sur le fonctionnement de la démocratie et dynamiser la commission prévue à cet effet: la commission pour le renouveau de la démocratie.
Enfin, vous évoquez un problème technique. Je vous signale que c'est la troisième fois que le problème se présente. A l'occasion de l'examen de projets précédents, les amendements qui avaient été déposés pour faire face aux problèmes et risques éventuels résultant d'un manque de candidats dans certaines circonscriptions - et je connais bien la situation de Neufchâteau-Virton - n'avaient pas pu recueillir de majorité. Le gouvernement a laissé au parlement le soin d'apprécier la technique qui doit être utilisée pour, éventuellement, faire face à cette situation.
J'ai toujours reconnu l'existence d'un risque, plus important au niveau des élections régionales, parce que les circonscriptions sont plus petites, que, par exemple pour l'élection du Sénat ou du Parlement européen.
Je souhaite que, si une modification est apportée, elle le soit non seulement à ce projet mais à tous les projets, y compris ceux qui ont déjà été votés, relativement à l'ensemble des élections. Il n'y a en effet aucune urgence. Cela concerne l'élection du Conseil flamand, du Conseil régional wallon, du Conseil de la Région bruxelloise. Les élections ont lieu, non pas à des dates indéterminées mais bien à des périodes précises.
J'étais prêt à apporter tout l'appui technique de mon cabinet pour soutenir une initiative parlementaire permettant de faire face, selon la modalité la plus opportune et la plus adéquate, à ce problème qui pourrait en effet être réel.

I remember my convictions when I was 20 years old, namely that democracy is something living, that it can progress through training, education of the citizen, by the information effort he makes, by the way he exercises his critical spirit, by the debate that is developed before him to present him — for in an increasingly complex world things are never simple — the different facets of a problem and the options that are open. This is the essential and, especially for politicians, it is every day, in their daily practice and in the example they give that they can strengthen the functioning of democracy.
However, the tools are not unnecessary. Beyond this project of removing half of the devolving effect of the headbox, many other initiatives can be taken. I myself, having been in the opposition for a long time, developed a number of proposals which unfortunately did not meet great success, neither from the government of the time nor even here in parliament. However, we must not despair, Mr. Tant. I invite you to show imagination and submit proposals to promote the debate.
This morning we had a small discussion in the Interior Committee on proposals submitted by two of your colleagues whose subject matter is modest. And you will have found that, despite the contrary opinion of my administration, I, for my part, supported these proposals because I thought they constituted a contribution.

I will start by answering you with regard to the numbers. Of course, the effect is modest but it is above all a matter of principle. Finally, you are talking about a technical problem. It is the third time that the problem arises. On the occasion of the examination of previous projects, the amendments that had been submitted to address the problems and possible risks resulting from a lack of candidates in some constituencies – and I know well the situation in Neufchâteau-Virton – could not have gathered a majority. The government has left parliament the care to assess the technique to be used to, eventually, cope with this situation.
I have always recognized the existence of a risk, greater at the level of regional elections, because the constituencies are smaller, than, for example, for the election of the Senate or the European Parliament.
I wish that, if a change is made, it will be done not only for this project but for all projects, including those that have already been voted, with respect to all the elections. There is no urgency. This concerns the election of the Flemish Council, the Walloon Regional Council, the Council of the Brussels Region. Elections are held not on indefinite dates but at specific periods.
I was ready to provide all the technical support of my cabinet to support a parliamentary initiative to address, in the most timely and appropriate manner, this problem that could indeed be real.

Ik heb het daar in alle klaarheid toegelicht. Het heeft zelfs sommige socialistische collega's kunnen overtuigen en ook leden van Agalev en Ecolo heb ik instemmend zien knikken, al heeft het zich daartoe evenwel beperkt; dat wordt bij hen een tweede natuur.
Mijnheer de minister, ik ben het met u eens dat in deze instelling, zowel als in het algemeen trouwens, hervormingen doorgaans in kleine stappen worden doorgevoerd. De evolutie is liefst zo weinig mogelijk een revolutie. De voorwaarde is evenwel dat de evolutie aanhoudt, wat impliceert dat u steeds bereid moet zijn bij te sturen waar mogelijk. En daartegen heb ik geen enkel bezwaar. Ik ben echter wel tegen een gebrek aan politieke correctheid. Eerst met de vlag van de grote politieke vernieuwing zwaaien en grootse hervormingen aankondigen, maar dan tevreden zijn met een hervorming die er nauwelijks één is, is verre van een consequente politieke houding. Men confronteert de samenleving en de kiezer plots met nieuwe spelregels, terwijl de oude regels hen meestal onbekend waren. Door in technische materies voortdurend kleine bijsturingen door te voeren, zal het de kiezer steeds minder duidelijk zijn in welk spel hij eigenlijk meespeelt.
Tevreden zijn met kleine bijsturingen na grote hervormingen te hebben aangekondigd, is niet de juiste houding voor wie zich nog bekommert om doorzichtigheid, begrijpelijkheid en rechtszekerheid. Ik betreur dat, mijnheer de minister, temeer daar ik samen met de fractieleider vaststel dat de gelegenheid die thans wordt geboden om eens grondig na te denken over ons kiessysteem, slechts weinig leden van deze assemblee kan bekoren, vooral behorend tot uw politieke familie. Maar wat op straat staan roepen, dat kan wel.

J'ai participé aux travaux de ce qui fut appelé "les assises de la démocratie" dont les résultats étaient, diront volontiers certains, modestes. Ils ont été pourtant utiles parce que tout ce qui peut permettre le progrès dans le fonctionnement de nos institutions est utile.
M. Tant ironise quant à la modestie de certaines réformes. Après l'avoir entendu à trois reprises, répétant les mêmes arguments, pour une tentative dont il reconnaît certainement qu'elle n'est pas inutile mais qu'elle ne permet pas de résoudre tous les problèmes, quand je vois l'énergie qu'il déploie à s'opposer à cette réforme limitée, je n'ose pas m'imaginer ce que cela pourrait représenter si l'on venait ici avec des dossiers plus importants et plus conséquents. Mais il ne faut jamais désespérer.
Ensuite, en ce qui concerne la méthode de travail, là aussi, je persiste et signe.
Il est vrai, monsieur le président, qu'à l'occasion d'examens de projets antérieurs identiques, il ne s'est pas trouvé de majorité parlementaire pour se mettre d'accord sur un système permettant de faire face aux risques qui ont été soulignés.
