Dit wetsvoorstel heeft geen enkele budgettaire weerslag. Met dit voorstel wil men een bepaling corrigeren die via de wet van 15 maart 1999 betreffende de beslechting van fiscale geschillen in diverse fiscale wetboeken is ingevoegd. De betrokken bepaling legt de voorwaarden vast waaraan cassatievoorzieningen in fiscale aangelegenheden moeten beantwoorden. De eerste zin neemt vrijwel letterlijk de tekst over van artikel 1080 van het Gerechtelijk Wetboek. Die zin is echter overbodig en geeft ten onrechte de indruk dat het een speciale wet betreft die afwijkt van het gemeen procesrecht. Het wetsvoorstel strekt ertoe die bepaling in de voornoemde artikelen op te heffen.
In de algemene bespreking heeft de minister van Financiën gezegd dat hij geen bezwaren heeft tegen de voorgestelde wijziging. Hij maakt bovendien van de gelegenheid gebruik te suggereren om het bij de wet van 15 maart 1999 opgeheven artikel 379 in de volgende lezing te herstellen. De tekst luidt als volgt: "Inzake de geschillen betreffende de toepassing van een belastingwet kan de verschijning in persoon in naam van de Staat worden gedaan door elke ambtenaar van een belastingadministratie." Waarover gaat het nu? De wetten van 15 en 23 maart 1999 tot hervorming van de fiscale procedure hebben de rechtbanken van eerste aanleg bevoegd gemaakt om in eerste aanleg uitspraken te doen over geschillen met betrekking tot de inkomstenbelasting.
Uit de parlementaire voorbereiding blijkt dat de werkgever werk wou maken van een eenvormig beheer van de belastingheffing en de geschillen waarbij de taxatieambtenaar zelf zijn dossier voor de rechtbank van eerste aanleg zou kunnen verdedigen. In de rechtsleer is er echter veel kritiek geuit op het feit dat de Staat in het kader van fiscale geschillen in persoon voor de rechtbank kan verschijnen via een van zijn ambtenaren die dan als orgaan optreedt.
Een en ander leidt overigens tot voor de Staat ongunstige vonnissen. Volgens deze strekking in de rechtsleer en overeenkomstig de terzake gewezen vonnissen wordt de Staat als uniek rechtspersoon vertegenwoordigd door zijn bevoegde instanties, in casu de ministers. Een onderneming kan zich als gewone rechtspersoon laten vertegenwoordigen door iemand die zij zelf binnen de eigen structuur aanwijst. De ministers daarentegen zijn als enigen gemachtigd om in persoon de Staat te vertegenwoordigen voor de rechtbanken van de rechterlijke orde. Dit vereist dat de minister in persoon moet verschijnen. Deze vereiste maakt het onmogelijk rationeel en doeltreffend op te treden en valt bovendien niet te verzoenen met de doelstelling van de hervorming die ertoe strekt de verantwoordelijkheidzin van de taxatieambtenaar aan te scherpen. Daarom stelt de minister voor de procedure voor de rechtbank van eerste aanleg lichter te maken door de ambtenaren van de belastingsadministratie wettelijk de hoedanigheid te verlenen van orgaan van de Staat zoals bedoeld in het Gerechtelijk Wetboek. Voor complexe dossiers zou nog steeds een advocaat worden ingeschakeld.
De heer Van Hoorebeke heeft een aantal positieve bemerkingen gemaakt, maar ook een aantal vraagtekens geplaatst. Positief is, zijns inziens, dat deze maatregel de motivatie kan vergroten van de ambtenaar die gemachtigd is het dossier tot op het einde van de procedure te behandelen. Het lid had wel 4 bemerkingen. Volgens het lid dreigt de daartoe vereiste opleiding het takenpakket van sommige ambtenaren nog te verzwaren. Zijn de betrokkenen bereid een dergelijke opleiding te volgen? Het risico bestaat dat de ambtenaar een aantal taken moet laten vallen om zich te kunnen toespitsen op de opmaak van conclusies en het volgen van de zittingen. Hierdoor kan er vertraging ontstaan in de behandeling van administratieve geschillen. Bij de verdediging van dossiers voor de rechtbank kan het zijn dat de belaste ambtenaar een aantal verplaatsingen moet maken en heel wat tijd zal verliezen. De laatste bemerking was van principiële aard. Voor de rechtbank fungeert de taxatieambtenaar als tegenpartij. Op administratief vlak wordt de ambtenaar echter geacht het kwestieuze dossier op een onpartijdige wijze te behandelen. Zal deze toestand niet leiden tot een gewijzigde houding binnen de belastingadministratie? De betrokken administratie zou wel eens de neiging kunnen vertonen bij de behandeling van dossiers van de belastingplichtige laatstgenoemde als tegenpartij te beschouwen in plaats van de diverse elementen ten laste en ter ontlasting tegen elkaar af te wegen.
Na de algemene bespreking vond de artikelsgewijze bespreking plaats. Voor de eindstemming heeft de juridische dienst de commissie een nota toegezonden inzake de terugwerkende kracht die gevolgen zou kunnen hebben voor de hangende gerechtelijke procedures. Voor de bespreking van deze nota en de implicaties ervan verwijs ik naar het schriftelijk verslag.
Het gehele aldus geamendeerde wetsvoorstel wordt ongewijzigd aangenomen met 9 stemmen en 3 onthoudingen.

An undertaking may be represented as an ordinary legal entity by a person whom it itself designates within its own structure. On the other hand, the ministers are the only ones authorized to represent the State in person before the courts of the judicial system. This requires the Minister to appear in person. This requirement makes it impossible to act rationally and effectively and is also incompatible with the objective of the reform, which aims to strengthen the sense of responsibility of the taxation officer. Therefore, the Minister proposes to simplify the procedure before the court of first instance by legally granting the officials of the tax administration the status of State body as provided for in the Judicial Code. For complex files, a lawyer would still be engaged.
Mr Van Hoorebeke made a number of positive comments, but also raised a number of questions. It is positive, in its view, that this measure can enhance the motivation of the official authorised to handle the file until the end of the procedure. The member had 4 comments. According to the member, the training required for this purpose threatens to further complicate the task package of some officials. Are the participants prepared to take such training? There is a risk that the official will have to miss a number of tasks in order to focus on drafting conclusions and following the meetings. This can lead to delays in the handling of administrative disputes. When defending files before the court, the taxable official may have to make a number of moves and will lose a lot of time. The last observation was of a principled nature. Before the court, the taxation officer acts as the counterparty. On the administrative level, however, the official is considered to handle the file in question in an impartial manner. Will this situation not lead to a change in attitude within the tax administration? However, the administration concerned may tend to consider the latter as a counterparty when handling the files of the taxable person, rather than weighing the various elements in charge and in discharge against each other.
After the general discussion, the article-based discussion took place. Before the final vote, the Legal Service sent a note to the committee on retroactive effect that could affect ongoing judicial proceedings. For the discussion of this note and its implications, I refer to the written report.
The entire amended bill is adopted unchanged by 9 votes and 3 abstentions.

Mijnheer de voorzitter, mijnheer de minister, collega's, ik wens de rapporteur te danken voor zijn duidelijk verslag waarin hij een aantal heikele punten heeft aangekaart inzake het amendement van de regering dat op de valreep werd ingediend en dat de commissie voor de Financiën heeft besproken.
Mijnheer de minister, neem me niet kwalijk dat ik even de gevolgde werkwijze schets. Het wetsvoorstel van collega Leterme tot wijziging van verscheidene belastingwetboeken, wat de voorzieningen in Cassatie betreft, mocht in principe niet leiden tot een langdurige bespreking. Tijdens de mondelinge vragen hebt u echter aangekondigd dat u een amendement zou indienen. Ik zal eerst de ontstaansgeschiedenis van dit amendement schetsen.
Mijnheer de minister, vanochtend werd u ondervraagd door mezelf en twee andere collega's met betrekking tot de blokkering van de fiscale rechtbanken en de rechtbanken van eerste aanleg, die een gevolg was van een rondzendbrief van de secretaris-generaal van uw departement. Volgens deze rondzendbrief mochten de fiscale ambtenaren pleiten en de Staat vertegenwoordigen voor de fiscale rechtbanken of de fiscale kamers in de rechtbanken van eerste aanleg. Naar aanleiding daarvan ontstond verzet bij de advocatuur. Daarop volgden drie uitspraken door de rechtbanken van eerste aanleg van Antwerpen, Gent en Leuven. Volgens u heeft de rechtbank van Bergen een tegenovergestelde uitspraak gedaan. Volgens de rechtbanken van Antwerpen, Gent en Leuven hebben de fiscale ambtenaren niet de bevoegdheid om te pleiten voor de fiscale rechtbanken. Hun argumentatie was tweevoudig. Ten eerste, de fiscale wetgeving bevat geen bijzondere bepaling aangaande het verschijnen van de Staat voor de fiscale rechtbanken, zodat de algemene regels van het Gerechtelijk Wetboek van toepassing zijn. Ten tweede, volgens artikel 440 van het Gerechtelijk Wetboek beschikt de advocatuur over een pleitmonopolie.
Mijnheer de minister, bij de daarop volgende discussie hebt u verwezen naar de ontstaansgeschiedenis van de wetgeving inzake de hervorming van de fiscale procedure. Collega Pieters heeft de wetten van 15 en 23 maart 1999 geciteerd. Reeds toen kwam dit probleem aan de orde. Volgens de oorspronkelijke tekst mochten de fiscale ambtenaren pleiten voor de fiscale rechtbanken. In een studie die u toen hebt ontvangen van de Brusselse balie stond echter dat dit niet nodig was, want krachtens de theorie van het orgaan kan de minister van Financiën zich voor de rechtbanken door een van zijn ambtenaren laten vertegenwoordigen.
Op basis van deze overwegingen werd dit onderdeel niet opgenomen in de wetgeving inzake de hervorming van de fiscale procedure. Ze hebben wel aanleiding gegeven tot een controverse binnen de rechtspraak. Bijgevolg — en dit is het belangrijkste — werden de fiscale rechtbanken geblokkeerd. Men wist immers niet of men tegen de uitspraken in beroep zou gaan of niet.
Mijnheer de minister, tijdens het debat naar aanleiding van de mondelinge vragen van vanochtend hebt u aangekondigd dat u het wetsvoorstel van collega Leterme zou gebruiken als kapstok voor een amendement. Het amendement is misschien niet helemaal passend — dat is niet erg, want ik heb er zelf aan meegewerkt — maar kan leiden tot de oplossing van het acute probleem. Zoals ik in de commissie heb gezegd, is het niet goed dat de fiscale rechtbanken opnieuw geblokkeerd raken. Wij hebben duidelijk voor de nieuwe fiscale procedure gekozen, zodat de fiscale geschillen zo spoedig mogelijk zouden worden opgelost. Op die manier zal de burger, die een bezwaarschrift heeft ingediend, snel zijn fiscale situatie kennen. Nu moet men daar soms jaren op wachten.
Mijnheer de minister, collega's, de blokkering van de fiscale rechtbanken was inderdaad geen goede zaak.
Ik heb toen ook gepleit voor een snelle oplossing. U kon bijvoorbeeld een amendement indienen, wat u ook hebt gedaan. U kon ook zeggen dat de Belgische Staat in de toekomst vertegenwoordigd zou worden door een advocaat gespecialiseerd in fiscale zaken. U hebt geopteerd voor de snelste werkwijze die voor u misschien ook wel het meest voor de hand ligt. De motieven die ten grondslag liggen aan uw amendement hebt u verdedigd en kan ik gedeeltelijk tegemoet treden. U hebt ervoor gekozen dat de fiscale ambtenaren voor de fiscale rechtbank mogen pleiten en de Belgische Staat vertegenwoordigen en dit met terugwerkende kracht vanaf 1 april 2001. Daaromtrent heb ik een aantal kritische vragen gesteld. Ik wens die te herhalen. De weerstand die ik toen naar voren bracht, moet ik vandaag aanhouden. Ik wil geen pleitbezorger zijn van de balies en het pleitmonopolie. Het pleitmonopolie van de advocatuur wordt nu echter al doorbroken in arbeidsgeschillen en bijvoorbeeld voor de beslagrechter in de procedure van de collectieve schuldenregeling, waarbij de OCMW's zelf mogen optreden. Dit debat past dus in een ruimere context. Daarbij moeten wij ons de vraag stellen welke rol de advocatuur en de balies nog moeten spelen in de rechtsgang naar de rechtbanken en de gerechtshoven?
Vandaag zou het pleitmonopolie door fiscale ambtenaren kunnen worden doorbroken. Binnenkort vraagt de overheid van het Vlaams Gewest misschien hetzelfde voor de vele betwistingen inzake de overheidsopdrachten. Zij zou ook haar gespecialiseerde ambtenaren kunnen afvaardigen naar de rechtbanken. Ik wil het debat over het doorbreken van het pleitmonopolie dus graag voeren en neem vandaag geen standpunt in. Vooraleer een definitief standpunt kan worden ingenomen, moet er een grondig debat worden georganiseerd waarin de verschillende actoren worden gehoord.
Ik heb vier bedenkingen bij het doorbreken van het pleitmonopolie.
Ten eerste, door het optreden van de fiscale ambtenaren voor de rechtbanken komt de onafhankelijkheid en de neutraliteit in het gedrang die wordt geëist door een partij die een zaak voor de rechtbank bepleit. Het was een deontologische regel dat een advocaat nooit een eigen zaak mocht pleiten noch een zaak voor een nabij familielid, omdat een advocaat steeds voldoende afstand en neutraliteit moest kunnen behouden ten aanzien van de partij wiens zaak hij of zij behartigt. Volgens mij is een bepaalde onafhankelijkheid vereist om een dossier te behandelen. Een fiscale ambtenaar zou echter zijn eigen zaak kunnen gaan pleiten. U wenst namelijk dat een ambtenaar zijn dossier behartigt van a tot z, van het bezwaar tot de beslissing voor de rechtbank. Die fiscale ambtenaar is niet meer onafhankelijk, maar wordt rechtstreeks betrokken partij waardoor hij zijn neutraliteit verliest. Volgens mij moet een fiscale ambtenaar het algemeen belang dienen. Hij moet de argumenten pro en contra onderzoeken en verantwoord beslissen in het kader van het algemeen maatschappelijk belang.
Het gevaar bestaat dat als een ambtenaar een dossier gaat verdedigen, het eigenlijk zijn of haar zaak wordt waarbij hij of zij zoveel mogelijk tracht gelijk te halen. Dat is geen goed uitgangspunt. Hierdoor wordt inbreuk gepleegd op de vereiste onafhankelijkheid en neutraliteit.
Mijnheer Leterme, ik ben blij dat u weer aanwezig bent, want ik had al verwezen naar uw goed wetsvoorstel dat wij voor het overige volkomen onderschrijven. Het is natuurlijk een grote eer voor u dat de regering uw wetsvoorstel heeft gebruikt om een niet onbelangrijk amendement toe te voegen. Het amendement zelf is natuurlijk slecht, daar kom ik straks nog even op terug.
Mijnheer de minister, mijn tweede argument is dat men op die manier overgaat tot het miskennen van een gespecialiseerd beroep door de overheid. Eens te meer spreek ik mij niet uit voor of tegen de advocatuur. Het is blijkbaar zo dat onze wetgever, onze rechtsstaat, geopteerd heeft voor het invoeren van de advocatuur als een gespecialiseerd beroep dat bepaalde belangen gaat verdedigen voor de rechtbanken en de hoven. Wanneer men het monopolie op pleiten zoals dat is voorzien in artikel 440 van het gerechtelijk wetboek meer en meer gaat doorbreken, dan doet men de facto ook afbreuk aan de specialisatie van het beroep. Men kan dat dan ook voor andere beroepen gaan doen. Dit lijkt mij echter geen goed uitgangspunt te zijn. Het is een gespecialiseerd beroep dat gepaard gaat met een strikt beroepsgeheim, een onafhankelijke opstelling en een grote vakkennis. De vertrouwdheid met de procedure is dermate groot dat de advocaat garant zou moeten staan voor een goede vertegenwoordiging op het proces. Mijnheer de minister, u hebt weliswaar aangekondigd dat de fiscale ambtenaren die vertegenwoordigingsbevoegdheid voor de rechtbank zullen krijgen ook een opleiding zullen krijgen in de procedure zodat ze vertrouwd raken met de geplogenheden van de rechtbanken en hoven, maar ik meen dat dit geen goede werkwijze is. Men kan die kennis, het beroepsgeheim en de confidentialiteit die binnen de advocatuur van kracht is nooit tot stand brengen wanneer men fiscale ambtenaren de bevoegdheid om te pleiten geeft.
Mijnheer de voorzitter, ik kom dan bij mijn voorlaatste argument. Mijnheer de minister, ik kan uw motivatie niet volgen als u zegt dat dit een kostenbesparing met zich zou brengen. U zegt dat wij minder een beroep op de advocatuur moeten doen en dus minder erelonen moeten betalen. U hebt wel gezegd dat u voor de meer gespecialiseerde dossiers nog steeds een beroep zult doen op een advocaat. Ik vraag mij in elk geval af of het wel efficiënt is als een fiscaal ambtenaar bijvoorbeeld om 9 uur aanwezig moet zijn voor de fiscale rechtbank en daar tot 11 of 12 uur moet wachten voor hij zijn dossier kan bepleiten. Dat kan alleen maar aanleiding geven tot verdere vertraging in de afhandeling van fiscale geschillen terwijl de hervorming van de fiscale procedure net het omgekeerde beoogde. Een ambtenaar die daar twee of drie uur zit en dan nog moet terugkeren naar zijn bureau voor hij een ander dossier ter hand kan nemen zal waarschijnlijk geen toonbeeld van efficiëntie zijn. Op termijn zou dit een zwaardere belasting doen ontstaan in plaats van een kostenbesparing.
Vanuit syndicale kringen van de fiscale ambtenaren heb ik het signaal gehoord dat dit ook zorgt voor een verzwaring van het statuut van de ambtenaar.
De responsabilisering van de bevoegde ambtenaar - waarmee ik akkoord ga vermits het aanleiding geeft tot een grotere motivering - betekent inderdaad een verzwaring van het statuut. Dit betekent dat hij ook beroepsfouten zal kunnen maken, iets waarvoor bijvoorbeeld de advocaat wel is verzekerd en de fiscale ambtenaar niet.
Het is belangrijk - ik hoop dat sommigen deze bezorgdheid kunnen onderschrijven - dat er snel een oplossing komt voor de huidige blokkering van de fiscale rechtbanken. Voorts moet het debat over het doorbreken van het pleitmonopolie ruimer worden gevoerd en moeten verschillende actoren daarbij worden betrokken. Ik stel voor dat wij daarvoor in een hoorzitting onder meer het standpunt van de vertegenwoordigers van de balies horen.
Mijnheer de voorzitter, dit amendement werd 'en stoemelings' aan het wetsvoorstel werd toegevoegd. Dit wetsvoorstel werd 's morgens aangekondigd en hier in de namiddag geïntegreerd. Ik stel voor dat terzake het advies aan de Raad van State wordt gevraagd. Ik heb er geen probleem mee dat naar een snelle oplossing voor de deblokkering van de fiscale rechtbanken wordt gezocht. Dit amendement heeft echter een grotere draagwijdte dan wij vandaag kunnen inschatten. Als dit wordt goedgekeurd, zal mijns inziens immers een andere overheidsdienst een wetsvoorstel, een wetsontwerp of amendement laten indienen om ook voor die specifieke tak de vertegenwoordigingsbevoegdheid te vragen.
Mijnheer de voorzitter, naar aanleiding van de discussie over artikel 3 wil ik mijn vraag inzake een advies van de Raad van State even kort toelichten.

Mr. Speaker, Mr. Minister, Colleagues, I would like to thank the rapporteur for his clear report, in which he addressed a number of sensitive points concerning the Government amendment submitted at the fallout and which was discussed in the Committee on Finance.
Mr. Minister, I do not apologize for setting out the following method. The bill proposed by colleague Leterme to amend several tax codes, as regards the provisions in Cassation, should in principle not lead to a lengthy discussion. During the oral questions, however, you announced that you would submit an amendment. I will first outline the history of this amendment.
Mr. Minister, this morning you were questioned by myself and two other colleagues regarding the blocking of the tax courts and the courts of first instance, which was a result of a circular letter from the secretary-general of your department. According to this circular letter, tax officials were allowed to advocate and represent the State before the tax courts or the tax chambers in the courts of first instance. As a result, there was resistance among the lawyers. Three judgments were followed by the courts of first instance of Antwerp, Gent and Leuven. The Court of Bergen has made the opposite judgment. According to the courts of Antwerp, Gent and Leuven, tax officials do not have the power to advocate before the tax courts. Their argument was double. First, the tax legislation does not contain any special provision concerning the appearance of the State before the tax courts, so the general rules of the Judicial Code apply. Secondly, according to Article 440 of the Judicial Code, the lawyer’s profession has a plea monopoly.
Mr. Minister, in the subsequent discussion you referred to the history of the legislation on the reform of the tax procedure. Collega Pieters quoted the laws of 15 and 23 March 1999. This problem was already discussed at that time. According to the original text, tax officials were allowed to advocate before the tax courts. However, in a study that you received from the Brussels Bureau at the time, it was stated that this was not necessary, because according to the theory of the body, the Minister of Finance can be represented before the courts by one of his officials.
On the basis of these considerations, this element was not included in the legislation on the reform of the tax procedure. This has caused controversy within the judiciary. Consequently — and this is the most important thing — the tax courts were blocked. It was not known whether the judgments would be appealed or not.
Mr. Minister, during the debate following the oral questions of this morning, you announced that you would use the bill of colleague Leterme as a capstone for an amendment. The amendment may not be entirely appropriate — which is not bad, because I have worked on it myself — but it may lead to the solution of the acute problem. As I said in the committee, it is not good for tax courts to be blocked again. We have clearly opted for the new tax procedure so that tax disputes could be resolved as soon as possible. In this way, the citizen who has submitted an objection will quickly know his fiscal situation. Sometimes we have to wait for years now.
Mr. Minister, colleagues, the blocking of tax courts was indeed not a good thing.
I also called for a quick solution. For example, you could submit an amendment, whatever you did. You could also say that the Belgian State would in the future be represented by a lawyer specializing in tax matters. You have opted for the fastest process that may be most obvious to you. The reasons underlying your amendment have been defended by you and I can respond in part. You have chosen to allow tax officials to appeal before the tax court and represent the Belgian State with retroactive effect from 1 April 2001. I have asked a number of critical questions. I wish to repeat it. The resistance I raised then, I must continue today. I do not want to be an advocate of the bullies and the advocate monopoly. However, the lawyer’s advocacy monopoly is now already broken in labour disputes and for example for the seizure judge in the procedure of collective debt settlement, where the OCMWs can act themselves. This discussion fits into a broader context. At the same time, we must ask ourselves what role should the lawyer’s profession and the bars still play in the process to the courts and courts? Their
Today, the advocacy monopoly could be broken by tax officials. In the near future, the government of the Flemish Region may ask the same for the many disputes concerning public procurement. It could also delegate its specialized officials to the courts. I would therefore like to conduct the debate on breaking the pledge monopoly and will not take a position today. Before a final position can be adopted, a thorough debate should be organised in which the various actors are heard.
I have four concerns about breaking the plea monopoly.
First, the intervention of tax officials before the courts undermines the independence and neutrality demanded by a party advocating a case before the court. It was a deontological rule that a lawyer should never advocate for his own case or a case for a close family member, because a lawyer should always be able to maintain sufficient distance and neutrality with regard to the party whose case he or she represents. In my opinion, a certain degree of independence is required to handle a file. However, a tax official could start advocating his own case. You want an official to represent his file from a to z, from the objection to the judgment before the court. That tax official is no longer independent, but becomes a directly involved party, thereby losing its neutrality. I believe that a tax official should serve the public interest. He must examine the pro and contra arguments and make responsible decisions in the context of the general public interest.
The danger exists that if a civil servant begins to defend a file, it actually becomes his or her affair in which he or she tries to match as much as possible. That is not a good starting point. This violates the required independence and neutrality.
Mr. Leterme, I am glad that you are present again, because I had already mentioned your good bill that we fully support for the rest. It is of course a great honour for you that the government has used your bill to add a not insignificant amendment. The amendment itself is of course bad, which I will return to later.
Mr. Minister, my second argument is that in this way one goes to disregard a specialized profession by the government. Again, I do not speak for or against the legal profession. It is obvious that our legislator, our rule of law, has opted for the introduction of the lawyer’s profession as a specialized profession that will defend certain interests before the courts and courts. The increasing breach of the monopoly on advocacy, as provided for in Article 440 of the Judicial Code, de facto also undermines the specialization of the profession. This can be done for other professions. However, this does not seem to be a good starting point. It is a specialized profession that is accompanied by strict professional secrecy, independent preparation and extensive professional knowledge. The familiarity with the procedure is so great that the lawyer should guarantee a good representation in the process. Mr. Minister, although you have announced that the tax officials who will be given the power of representation before the court will also receive training in the procedure so that they become familiar with the plots of the courts and courts, I think this is not a good practice. One can never ⁇ that knowledge, professional secrecy and confidentiality that is in force within the legal profession if one gives tax officials the power to advocate.
Let me come to my last argument. Mr. Minister, I cannot follow your motivation if you say that this would bring cost savings. You say that we should use less of the lawyer’s profession and therefore pay less honorary wages. You have said that you will still use a lawyer for the more specialized cases. In any case, I wonder if it is efficient if a tax official, for example, must be present before the tax court at 9 o’clock and there must wait until 11 or 12 o’clock before he can defend his case. This could only lead to further delays in the settlement of tax disputes, while the reform of the tax procedure aimed just the opposite. An official who sits there for two or three hours and then has to return to his office before he can take another file into his hand will probably not be a demonstration of efficiency. In the long run, this would lead to a heavier tax instead of cost savings.
From the trade union circles of tax officials, I have heard the signal that this also creates an aggravation of the status of the official.
The accountability of the competent official – with which I agree since it gives rise to greater motivation – indeed means an aggravation of the statute. This means that he will also be able to make professional mistakes, something for which, for example, the lawyer is insured and the tax official is not.
It’s important – I hope some can endorse this concern – that a quick solution to the current blocking of tax courts will come. Furthermore, the debate on breaking the plea monopoly should be broader and involve various actors. I suggest that we hear in this hearing, among other things, the views of the representatives of the Balais.
This amendment was "and steemelings" added to the bill. This bill was announced in the morning and integrated here in the afternoon. I suggest that the State Council be consulted on this matter. I have no problem with the fact that a quick solution is being sought for the unblocking of the tax courts. However, this amendment has a larger scope than we can estimate today. In my opinion, if this is approved, another public service will submit a bill, draft law or amendment to request representation for that particular branch as well.
Mr. Speaker, following the discussion on Article 3, I would like to briefly explain my question on a State Council opinion.

Mijnheer de voorzitter, ik wil u en de meerderheid, waarvan u nu en dan tracht de dienaar te zijn, bij wijze van inleiding voorlezen uit een opiniërend artikel dat begin deze week verscheen en dat u recht naar het hart zal gaan vanuit uw bekommernis om het prestige van deze Kamer. Het gaat namelijk om een artikel van Rolf Falter dat maandag 16 juli 2001 in De Standaard verscheen onder de titel "Bodemplaat". Mijnheer de minister, in het Frans betekent bodemplaat het niveau waaronder men niet daalt.
Ik citeer de heer Falter: "Onvoorstelbaar toch wat er allemaal in de laden van de Kamer blijkt te zitten op het ogenblik dat men die vlak voor de vakantie leeghaalt. De plenaire vergadering van 's lands belangrijkste parlement" — de heer Falter heeft kennis van zaken — "debatteert deze week over de NMBS, over de gemeentefinanciën, over de politiehervorming, over de anonieme getuigen en een half dozijn kleinere justitiewetten" — alsof justitiewetten ooit anders zijn — "over de faillissementwetgeving, over baarmoederhalskanker en de transplantatie van organen en over een wetsontwerp over de gezondheidszorg dat" — mevrouw D'Hondt en mevrouw Schauvliege, heren Brouns, Vandeurzen en Goutry — "door de regering veel te laat werd ingediend" — een objectieve waarneming — "en op de eerste bespreking door dezelfde regering voor twee derde werd ingekort".
Ik sla een aantal passages uit het artikel over. Ik citeer uit een volgende paragraaf: "Wetgevende macht is irrelevant wanneer de wetten in toenemende mate zelf irrelevant worden. Die evolutie is uiterst gevaarlijk, maar wel reëel. Veel te veel wetten, snel en slordig in elkaar geflanst op kabinetten en dan met de karwats door het Parlement gejaagd, leveren een wetgevend arsenaal op dat niemand nog kent, waarvan misschien de helft uitvoerbaar is en nog geen kwart afdwingbaar. De wetgeving is, net als de rechtbanken en advocaten, de essentie van het probleem geworden, eerder dan een element van oplossing". Dan wordt het artikel zeer zwaar. "Wie zou er dan nog malen om de brij die door de strot van 200 fulltime (en dus dociele) politici wordt geperst".
Ik citeer uit de laatste paragraaf: "Zeker Kamer en Senaat hebben — alle goedbedoelde en nuttige moderniseringen van een Herman De Croo bijvoorbeeld ten spijt — zich het laatste greintje zelfrespect laten afnemen, zeker onder deze regering. Deze uitvoerende macht permitteert zich alles en mag dat ook. Ministers die niet komen opdagen, teksten die veel te laat worden ingediend, permanente karwatstoestanden, de ontmanteling van de Raad van State en het Rekenhof en bovenal: liegen, manifest liegen. Ministers hebben in parlementen altijd uitvluchten mogen zoeken, vaagheden debiteren en waarheden verdraaien, maar het onverbiddelijk bestraffen van 'lying before the Commons' is altijd de bodemplaat geweest waarop elk parlement rust. In België is deze bodemplaat weg". Einde citaat. Het lijkt mij belangrijk u in de laatste week van deze zittingstijd deze objectieve waarneming mee te geven van de manier waarop de huidige meerderheid omgaat met onze instellingen en in het bijzonder met Kamer en Senaat.
Eigenlijk is de agenda die wij vandaag bespreken een illustratie daarvan. Collega Van Hoorebeke heeft daarstraks reeds verwezen naar het feit dat "en stoemelings" een amendement in een ander wetsvoorstel werd geschoven alhoewel dit amendement nochtans een ruimere en fundamentele parlementaire bespreking vergt omdat het een aantal belangrijke principes van onze rechtsstaat betreft. Dit staat dan nog los van de verlegenheid waarin u mij brengt doordat een wetsvoorstel van mijzelf, dat ertoe strekt vereenvoudiging en uniformiteit aan te brengen in belastingwetboeken, wordt gefnuikt door het initiatief van de regering.
Ik zou hierover een aantal opmerkingen willen maken. Ten eerste, ik zou willen verwijzen naar de inschatting van de Kamer bij de behandeling van de wetsontwerpen met betrekking tot de geschillenregeling in fiscale zaken begin 1999. Sta me toe te citeren uit het verslag over het bicamerale wetsontwerp nummer 1341. Op een bepaald moment in de discussie vertolkt de regering haar standpunt over het al dan niet kunnen optreden van ambtenaren van het ministerie van Financiën namens de Belgische Staat, ik citeer: "In het kader van de nieuwe procedure zal de administratie daarentegen het omstreden dossier bij de rechtbank van eerste aanleg kunnen opvolgen en in beroep gaan, eens de rechtbank een beslissing heeft genomen. Bovendien houdt de administratie het recht om het geschil voor het hof van Cassatie te brengen. Voorts bevestigt de minister de weglating van de bepaling van artikel 7 van het wetsontwerp betreffende de rechterlijke inrichting in fiscale zaken zoals het door de Kamer werd aangenomen, dat bepaalt dat de minister van Financiën zich kan laten vertegenwoordigen door een door hem aangewezen ambtenaar voor de rechtbank van eerste aanleg. Hij verklaart dat die bepaling in feite zinloos is omdat, overeenkomstig de door de rechtspraak en het hof van Cassatie bevestigde rechtsregel, elke ambtenaar, die er door de bevoegde overheid behoorlijk toe gemachtigd is de Staat te vertegenwoordigen, in werkelijkheid een orgaan van de Staat is. De ambtenaar spreekt namens de Staat. Ten slotte bevestigt de minister dat voortaan voorziening in cassatie kan worden ingesteld zonder dat daarvoor een advocaat bij het hof van Cassatie hoeft te worden ingeschakeld (...) Daarbij is het zaak de toegang van de belastingplichtige tot alle niveaus van gerechtelijke aanleg te vergemakkelijken. Bovendien wordt de mogelijkheid voor de administratie der directe belastingen om, zonder een beroep te doen op een advocaat, voorziening in cassatie in te stellen; door het ontwerp uitgebreid tot de verschillende soorten van belastingen".
Tot daar het citaat uit het verslag van de werkzaamheden van het voorjaar 1999. Dit geeft aan dat wij ons ook tijdens de vorige legislatuur met de problematiek hebben beziggehouden.
Met betrekking tot de opportuniteit van het inschuiven van het regeringsamendement in het voorstel van uw dienaar, namelijk het doorbreken van het pleitmonopolie van de advocatuur door ambtenaren te laten pleiten inzake fiscale materies, wil ik twee bezwaren opperen. Deze bezwaren komen zowel van de kant van de advocatuur als belanghebbende, als van de kant van de ambtenaren. Ik ga niet in op de bezwaren van de eerste partij, vermits zij daarstraks door collega Van Hoorebeke uitstekend werden verwoord.
De ambtenaren zelf voeren een aantal bezwaren aan. Deze bezwaren volstaan om te zeggen dat u een maatregel opdringt die door de mensen op het terrein een slechte maatregel wordt genoemd die de behoorlijke werking van de belastingsdiensten in het gedrang zal brengen.
Mijnheer de minister, met permissie gezegd, nadat ik u in de commissie voor de Financiën herhaaldelijk heb gehoord over bestrijding van de fiscale fraude en de fiscale geschillenregeling, heb ik de stellige indruk — en u zult die in uw repliek moeten weerleggen — dat u liever hebt dat de administratie in haar werkzaamheden wordt bemoeilijkt om zo te komen tot terughoudende ambtenaren. U geeft hun immers de opdracht om hun aanslag achteraf voor de rechtbank te gaan verdedigen — met een verlies van tijd en energie tot gevolg - zonder dat dit voor hun beroep een meerwaarde oplevert. Bijgevolg zullen zij lakser zijn bij het leggen van hun aanslagen.
De belastingadministratie zelf haalt vier argumenten aan tegen het amendement dat u op het wetsvoorstel hebt ingediend. Ten eerste, de fiscale ambtenaren worden niet verondersteld de typische opleiding tot het hanteren van de procedure voor een rechtbank in de vingers te hebben. Bij uitbreiding beschikt een zeer groot deel van de ambtenaren niet over de juridische opleiding die dit veronderstelt en zeker niet over de ervaring.
Ten tweede, voeren de ambtenaren terecht aan dat ondanks uw ronkende verklaringen, ondanks de installering van een regeringscommissaris ter bestrijding van de fiscale fraude, ondanks de doorlichting door het Rekenhof van de fiscale administraties men er nog altijd niet toe gekomen is de personeelsbezetting uit te breiden. Er is ook vandaag nog een tekort aan personeel en tijd en het is dus contraproductief van dit beperkt korps te veronderstellen dat zij tijd zouden vrijmaken voor deze opdracht.
Ten derde, bij de uitvoering maakt u in feite een onderscheid tussen verschillende taxatieambtenaren. De ene keer zal men een advocaat kunnen inschakelen, want u laat de mogelijkheid open; de andere keer kan dit niet. Welnu, dit wordt een drukkingmiddel dat tegen de individuele taxatieambtenaar kan worden gebruikt.
Die individuele taxatieambtenaar kan onder druk worden gezet om zijn aanslag niet te sterk te onderbouwen of een bepaalde aanslag niet te vestigen, omdat hij weet dat hij op een bepaald moment zonder wapens zal worden geplaatst.
Een vierde argument is uiteraard dat na de inloopperiode en het aantal gevallen dat reeds voor de rechtbank is gekomen, de uitslag bijzonder negatief blijkt. Bijna alle ambtenaren schrikken terug voor de situatie waarin zij worden geplaatst, namelijk gebrek aan kennis van de procedure, tijdverlies en allerlei moeilijkheden waarmee zij worden geconfronteerd als zij namens de Belgische Staat effectief voor de rechtbanken een dossier moeten pleiten. Dit is een geheel van bezwaren. U glimlacht, maar ik denk dat de mensen met meer terreinkennis die het werk effectief moeten doen en niet als u ex cathedra grote profetieën verkondigen over de werking van de fiscale administratie, pertinent goed de toestand kennen en sterk gemotiveerd zijn. Wij moeten luisteren naar de mensen met terreinkennis en aanvoelen dat de voorgestelde maatregel negatief is.
Mijnheer de minister, ik heb een concrete vraag wat dat betreft. Bovendien laat zij ook toe in te schatten wat de concrete effecten zijn inzake de inzetbaarheid van de belastingadministratie de komende maanden, wanneer zou blijken dat uw maatregelen retroactief vanaf 1 april 2001 werkelijkheid en wettelijkheid zouden worden. Kunt u ons meedelen hoeveel fiscale geschillen vandaag aanhangig zijn bij de fiscale kamers? Kunt u ons dit in uw repliek laten weten? Dit is een zeer concrete vraag.
Vervolgens kom ik tot de overzijde, met name de advocatuur. Ik zal niet elk argument herhalen, maar wij steunen de argumenten die werden aangevoerd en vermoedelijk ruim verspreid, zij het tevergeefs, door de Vereniging van Vlaamse Balies. Zij waarschuwt ervoor dat ondoordachte amendementen van de regering inzake de bevoegdheid van fiscale ambtenaren zullen leiden tot verminderde efficiëntie, wat een slechte zaak zal zijn. De heer Van Hoorebeke heeft een en ander reeds ontwikkeld en ik herhaal dit in het kort. Normaal kan men bij de behandeling van een fiscaal dossier veronderstellen dat er een zekere onafhankelijkheid en neutraliteit is. Die onafhankelijkheid en die neutraliteit kan niet worden verondersteld aanwezig te zijn bij fiscale ambtenaren die hun aanslag moeten motiveren voor een rechtbank. Door het pleitmonopolie van de advocaten te doorbreken, miskent de overheid, de regering, deze meerderheid inclusief een aantal belangrijke meesters uit dit Huis, een gespecialiseerd beroep als dit van de advocatuur. Dit is toch wel een kaakslag voor die mensen. Bovendien wordt dit geen efficiënte maatregel.
De kostenbesparing die zal worden gerealiseerd door geen beroep te doen op advocaten, zal men verliezen door het gigantische tijdverlies en het verlies aan inzetbaarheid van mensen, gespecialiseerde taxatieambtenaren, op concrete dossiers. Nu reeds stellen wij vast, conform bijvoorbeeld de doorlichting door het Rekenhof, dat een aantal belangrijke kantoren reeds een tekort aan personeelssterkte kent en de normale controle niet meer kan verrichten. Als men van taxatieambtenaren eist dat zij uren en uren voor rechtbanken dossiers gaan verdedigen, gaat u deze mensen nog minder inzetbaar maken. Ten slotte is het nog de vraag of de vertegenwoordigers van het personeel dit zo maar over zich heen zullen laten gaan. Plots wijzigt men de arbeidsvoorwaarden. Men verwacht nu van het personeel een bepaalde kennis die voorheen niet was vereist, onder meer het hanteren van gerechtelijk procesrecht voor de rechtbanken. Daarnaast voert men een bijzondere verantwoordelijkheid en aansprakelijkheid in voor deze ambtenaren.
Dit is een bescherming die wel aanwezig is bij de advocaten. Wij zijn dus zeer uitdrukkelijk gekant tegen deze maatregel die in een wetsvoorstel wordt opgenomen dat overigens de steun van mijn fractie wegdraagt. Wij zullen wegens dit feit en wegens het belang van de aangehaalde problematiek de vraag van collega Van Hoorebeke om het advies van de Raad van State over de toelaatbaarheid van dit amendement in te roepen, dan ook steunen.

The plenary session of the country's most important parliament" — Mr. Falter has knowledge of matters — "debates this week on the NMBS, on municipal finances, on police reform, on the anonymous witnesses and half a dozen smaller judicial laws" — as if judicial laws ever were different — "on bankruptcy laws, on cervical cancer and organ transplants, and on a bill on health care that" — Mrs. D'Hondt and Mrs. Schauvliege, Mr. Brouns, Vandeurzen and Goutry — "was submitted by the government too late" — an objective observation — "and at the first discussion by the same government was reduced by two-thirds".
I will remove a few passages from the article. I quote from a following paragraph: “Legislative power is irrelevant when the laws themselves become increasingly irrelevant. This evolution is extremely dangerous, but real. Too many laws, quickly and flatteringly flanked together on cabinets and then chased with the carwats by the Parliament, provide a legislative arsenal that no one knows yet, of which ⁇ half is enforceable and not yet a quarter enforceable. Law, like the courts and lawyers, has become the essence of the problem, rather than an element of solution.” Then the article becomes very heavy. "Who would then repeat the burst pressed by the throat of 200 full-time (and thus docile) politicians?"
I quote from the last paragraph: “Certainly the Chamber and the Senate — despite all the well-intentioned and useful modernizations of a Herman De Croo, for example — have let themselves lose the last piece of self-respect, ⁇ under this government. This executive power permits itself everything and can do so. Ministers who do not appear, texts that are submitted too late, permanent karwat states, the dismantling of the State Council and the Court of Auditors and above all: lies, manifest lies. Ministers have always been allowed to seek escapes in parliaments, debit vagues, and distort truths, but the relentless punishment of 'lying before the Commons' has always been the bottom floor on which every parliament rests. In Belgium, this soil plate is gone.” End of quote. In the last week of this session time, I think it is important to give you this objective observation of how the current majority deals with our institutions and in particular with the Chamber and Senate.
In fact, the agenda we discuss today is an illustration of this. Collega Van Hoorebeke has already referred to the fact that an amendment was pushed "and steamlessly" into another bill, although this amendment nevertheless requires a broader and fundamental parliamentary discussion because it concerns a number of important principles of our rule of law. This is then separate from the embarrassment in which you bring me by the fact that a bill of mine, which aims to bring simplification and uniformity into tax codes, is flattered by the initiative of the government.
I would like to make a few comments on this. First, I would like to refer to the House’s assessment of the draft laws relating to the settlement of disputes in tax matters at the beginning of 1999. Let me quote from the report on the bicameral bill draft number 1341. At some point in the discussion, the Government interprets its position on whether or not officials of the Ministry of Finance can act on behalf of the Belgian State, I quote: "In the framework of the new procedure, on the other hand, the administration will be able to follow up the disputed file at the court of first instance and appeal, once the court has made a decision. In addition, the administration reserves the right to bring the dispute before the Court of Cassation. Furthermore, the Minister confirms the omission of the provision of Article 7 of the Bill on the judicial structure in tax matters as adopted by the Chamber, which provides that the Minister of Finance may be represented by an official appointed by him before the court of first instance. He declares that that provision is in fact meaningless because, in accordance with the rule of law confirmed by the jurisprudence and the Court of Cassation, every official who is duly authorised by the competent authority to represent the State is in fact an organ of the State. The official speaks on behalf of the state. Finally, the Minister confirms that from now on, a case of cassation can be brought without requiring the involvement of a lawyer at the Court of Cassation (...) In addition, the matter is to facilitate the access of the taxable person to all levels of judicial proceedings. Furthermore, the possibility for the administration of direct taxes to establish, without resorting to a lawyer, provision in cassation is extended by the draft to the different types of taxes”.
To this end, the quotation from the spring 1999 work report. This indicates that we have also been dealing with the problem during the previous legislature.
Regarding the possibility of inserting the government amendment into your servant’s proposal, namely breaking the lawyer’s advocacy monopoly by letting officials advocate in tax matters, I would like to raise two objections. These objections come both from the side of the lawyer’s profession as the interested party, as well as from the side of the officials. I will not comment on the objections of the first party, since they were subsequently expressed by colleague Van Hoorebeke excellently.
The officials themselves raise a number of objections. These objections are sufficient to say that you are imposing a measure called by the people on the ground a bad measure that will jeopardize the proper functioning of the tax services.
Mr. Minister, with permission, after repeatedly hearing you in the Committee on Finance on the fight against tax fraud and the settlement of tax disputes, I have the firm impression — and you will have to refute it in your replica — that you would rather that the administration in its work be complicated in order to thus become restrained officials. After all, you instruct them to subsequently start defending their offence before the court — with a loss of time and energy — without adding value to their profession. Consequently, they will be more lax when setting out their attacks.
The tax administration itself raises four arguments against the amendment you submitted to the bill. First, tax officials are not expected to have the typical training to handle the procedure before a court in their fingers. In the case of enlargement, a very large proportion of officials do not have the legal training that this implies and ⁇ do not have the experience.
Second, the officials rightly argue that despite your blatant statements, despite the appointment of a government commissioner to combat tax fraud, despite the Court of Auditors’ inspection of the tax administrations, it has still not been achieved to expand the employment of staff. There is still a shortage of staff and time today, and therefore it is counterproductive of this limited corps to assume that they would free time for this task.
Third, in execution, you actually make a distinction between different taxation officers. One time you will be able to engage a lawyer because you leave the possibility open; the other time you cannot. Well, this becomes a pressure agent that can be used against the individual taxation officer.
That individual taxation officer may be pressured not to substantiate his attack too strongly or not to establish a particular attack, because he knows that at some point he will be placed without weapons.
A fourth argument is, of course, that after the entry period and the number of cases already brought before the court, the outcome is ⁇ negative. Almost all officials are scared of the situation in which they are placed, namely lack of knowledge of the procedure, loss of time and all kinds of difficulties they face when they must effectively file a case before the courts on behalf of the Belgian State. This is a whole set of objections. You smile, but I think the people with more field knowledge who should do the work effectively and not if you ex cathedra proclaim great prophecies about the functioning of the tax administration, pertinent well know the state and are strongly motivated. We must listen to the people with field knowledge and feel that the proposed measure is negative. Their
Mr. Minister, I have a concrete question in this regard. Furthermore, it also allows you to estimate the concrete effects on the employability of the tax administration in the coming months, when it would appear that your measures would become reality and legal retroactively from 1 April 2001. Can you tell us how many tax disputes are pending today at the tax chambers? Can you tell us this in your replica? This is a very concrete question.
Then I come to the other side, especially the lawyer’s profession. I will not repeat every argument, but we support the arguments that were raised and presumably widespread, though in vain, by the Association of Flemish Balies. She warns that unreasonable government amendments to the competence of tax officials will lead to reduced efficiency, which will be a bad thing. Mr. Van Hoorebeke has already developed a number of things and I will repeat this in brief. Normally, when handling a tax file, one can assume that there is a certain degree of independence and neutrality. That independence and neutrality cannot be presumed to be present among tax officials who must justify their attack before a court. By breaking the advocacy monopoly of the lawyers, the government, the government, this majority including some important masters from this House, lacks a specialized profession like that of the law profession. This is a protection that exists with lawyers. We are therefore very explicitly opposed to this measure, which is included in a bill that, by the way, removes the support of my group. Monsieur le président, c'est un débat particulièrement intéressant parce qu'il n'est pas neuf et qu'il démontre qu'il peut exister un très grand nombre de lobbies dans notre pays et que certains se manifestent parfois fortement dans cette assemblée; on a parlé tout à l'heure des municipalistes. Voilà un autre débat qui concerne une catégorie d'avocats, non pas l'ensemble des membres du barreau, mais une catégorie d'avocats travaillant à l'abonnement au ministère des Finances.
Première remarque. La décision de transférer cette compétence de défendre les intérêts du ministère des Finances devant les tribunaux des avocats vers les agents du département a été prise par la direction générale d'une des directions des administrations fiscales, transmise à l'ensemble des fonctionnaires; elle a d'ailleurs fait l'objet d'une approbation à l'occasion de très nombreuses visites de ma part auprès des services. Quand on oppose une décision du ministre à la situation, à des personnes sur le terrain, il faut se rendre compte que c'est une décision prise par l'administration elle-même. Tâchons de ne pas confondre les genres; il ne s'agit pas d'une mesure imposée mais d'une mesure adoptée très clairement en interne au sein de l'administration.
Deuxième élément. C'est une mesure qui n'est pas prise tout à coup, à l'occasion d'un amendement. Elle a été débattue à l'occasion déjà des discussions au parlement sur la nouvelle procédure fiscale, législation antérieure; elle a été débattue lorsque M. Zenner a présenté son plan pour une nouvelle culture fiscale: la nouvelle proposition s'y trouvait formellement. Comme l'a rappelé M. Van Hoorebeke, j'ai été interrogé le matin même des débats en commission et j'ai annoncé qu'un amendement viendrait l'après-midi; nous en avons débattu l'après-midi en commission.
Je peux comprendre qu'il faille beaucoup plus de temps, plus d'années encore pour se rendre compte du contenu d'un débat, mais on a rarement vu une discussion se développer aussi longuement.
Le premier élément, c'est une mesure prise en interne par l'administration. Deuxième élément, c'est une mesure annoncée depuis longtemps, confirmée en commission et qui, je le croyais, avait reçu l'aval du parlement lorsque M. Zenner est venu présenter son plan comme commissaire du gouvernement. Personne n'a émis de réserve quant à cette idée de réserver les moyens de défense du département aux affaires de grande fraude fiscale, de criminalité organisée, plutôt que d'avoir une déperdition de moyens à l'occasion de toutes ces affaires devant les nouvelles chambres que sont les chambres fiscales des tribunaux de première instance.
Troisième remarque. J'entends parler à répétition du monopole du barreau. Ne nous trompons pas: le principe général est que chacun peut se défendre lui-même en justice. Il n'y a quand même pas un monopole du barreau qui interdirait à un citoyen de se défendre lui-même devant les cours et tribunaux. C'est un premier élément.
Deuxième élément, pour les personnes morales, le Code judiciaire prévoit lui-même en son article 703 la théorie de l'organe. Il se fait qu'il existe par moments une contradiction dans l'argumentation qu'utilise le barreau à l'égard du secteur public. Lorsqu'on a débattu du projet de loi concernant la procédure fiscale, Me Balthus, représentant du barreau de Bruxelles, est venu devant la commission des Finances du Sénat expliquer luimême qu'un amendement comme celui encore débattu aujourd'hui n'était pas nécessaire, que l'Etat pouvait être représenté devant les juridictions par quelque fonctionnaire que ce soit. A l'époque, le ministre qui me précédait l'a d'ailleurs aussi confirmé; M. Leterme y a fait allusion.
Une fois qu'il s'agit de mettre en oeuvre ce principe, un certain nombre de membres du barreau adoptent une attitude tout à fait inverse et demandent une comparution volontaire dans des affaires opposant l'Etat à des contribuables pour exiger que l'Etat soit représenté par un avocat. Ce que j'ai donc proposé en commission, c'est de mettre fin à ce débat absurde où, lorsqu'il s'agit de défendre le principe, on vient plaider au parlement sur la possibilité pour l'Etat d'être représenté par ses propres fonctionnaires; et puis, dans chaque dossier concret, on va plaider le contraire, bloquant ainsi la situation d'un très grand nombre de procédures. Je n'ai pas le chiffre exact à cette heure-ci du nombre de dossiers introduits depuis le 1 er avril; à la fin avril, il y en avait quelques dizaines, très peu dès lors par rapport aux 55.000 qui auraient pu aller devant les cours et tribunaux. C'est assez logique que les contribuables préfèrent encore négocier avec l'administration partout où c'est possible. Aujourd'hui, il y a certainement un plus grand nombre de dossiers introduits.
Monsieur le président, je voudrais à nouveau confirmer l'intention de confier effectivement aux agents du département la défense des dossiers devant le tribunal de première instance. Comme je l'ai rappelé en commission, il ne s'agit nullement de retirer toutes les affaires fiscales des mains du barreau, mais bien de concentrer, dans les mains d'avocats spécialisés, les affaires pour lesquelles le parlement souhaite lui-même une particulière attention, c'est-à-dire les affaires de grande fraude fiscale, les affaires de crime organisé auxquelles nous souhaitons accorder particulièrement les moyens de lutte réservés au département.
En conclusion, lorsqu'il s'agit de désigner des avocats spécialisés chargés de défendre les intérêts de l'Etat dans des dossiers de grande fraude fiscale, il n'est pas toujours simple de trouver, parmi les avocats disponibles en Belgique, des spécialistes en matière fiscale qui ne soient pas déjà le conseil d'une des parties adverses.
Il faut savoir si l'on souhaite, pour défendre un certain nombre d'intérêts fortement mis en avant par l'un ou l'autre lobby, bloquer la démarche de l'Etat qui veut réserver ses moyens d'action pour lutter contre la fraude fiscale ou si l'on souhaite suivre la proposition que je vous ai faite en commission, à savoir mobiliser des moyens pour ce type de grande fraude. C'est un choix. Je peux comprendre qu'il y ait des groupes aujourd'hui qui ne souhaitent pas aller dans cette voie. Au moins le débat sera clair. L'article 440 du Code judiciaire est très clair: les exceptions peuvent être prévues par la loi. C'est d'ailleurs déjà prévu par un certain nombre d'articles du Code judiciaire, il n'y a aucun doute quant au fondement constitutionnel et légal du texte qui se trouve aujourd'hui à l'examen.
Je crains malheureusement, mais cela ne sera probablement pas la première fois dans notre pays, que la manoeuvre qui consiste aujourd'hui à demander un renvoi d'un texte au Conseil d'Etat vise simplement à faire perdre au moins 2 à 3 mois face à la volonté ferme du gouvernement et de la majorité de réserver les moyens d'action à la lutte contre la grande fraude fiscale. Nous l'avons encore signalé à l'occasion du récent contrôle budgétaire. Si plusieurs groupes ne veulent pas soutenir cette démarche de lutte contre la grande fraude fiscale, c'est leur choix, ce n'est pas le mien.

I can understand that it takes much more time, even more years to realize the content of a debate, but we have rarely seen a discussion develop so long.
The first element is a measure taken internally by the administration. The second element is a measure announced for a long time, confirmed in committee and which, I believed, had received the approval of parliament when Mr. Zenner came to present his plan as a government commissioner. No one has made a reservation on this idea of reserving the department’s means of defence for cases of major tax fraud, organized crime, rather than having a waste of funds on occasion of all these cases before the new chambers that are the tax chambers of the courts of first instance.
The third observation. I hear repeatedly about the monopoly of the bar. Let us not be mistaken: the general principle is that everyone can defend himself in court. There is nevertheless no bar monopoly that would prohibit a citizen from defending himself before courts and courts. This is a first element.

De heer Ansoms, indiener van het wetsvoorstel, verwees naar de toelichting van zijn ingediend stuk. Hij besloot dat het doel van zijn wetsvoorstel kan worden gerealiseerd door een zinsdeel toe te voegen aan het bestaande artikel 91 van de wet van 25 juni 1992 op de landverzekeringsovereenkomst.
De minister kon beamen dat de verzekerbaarheid van de geldboetes een gevoel van straffeloosheid kan creëren bij de betrokken werknemers. Het wordt momenteel namelijk niet door de wet verboden dat bijvoorbeeld werkgevers zich verzekeren tegen dergelijke geldboetes die hun werknemers zouden kunnen oplopen. De heer Ansoms bevestigde dat momenteel terzake verzekeringsovereenkomsten worden gesloten, onder meer in de sector van de pakjesdiensten.
Een lid van de Parti Socialiste vroeg of men zich in het algemeen kan verzekeren tegen geldboetes. De heer Ansoms verwees hierbij naar de bestaande tekst van artikel 91 van de wet op de landverzekeringsovereenkomst die als volgt luidt, ik citeer: "Geldboeten en minnelijke schikkingen in strafzaken. Geen enkele geldboete of geen enkele minnelijke schikking in strafzaken kan het voorwerp zijn van een verzekeringsovereenkomst, met uitzondering van die welke ten laste zijn van de personen die burgerrechtelijk aansprakelijk zijn". De strafrechterlijke verantwoordelijkheid blijft hoe dan ook individueel. Het wetsvoorstel van de heer Ansoms viseert alleen de geldboetes die betrekking hebben op de wetten en uitvoeringsbesluiten betreffende het wegverkeer of het vervoer over de weg, te rangschikken onder het algemeen verbod opgenomen in de aanhef van voornoemd artikel 91. Inzake overtredingen van de wegcode is de rechtspraak echter minder eenduidig, volgens mevrouw Gerkens. In elk geval vindt men nergens een expliciet verbod op de tussenkomst van de werkgever.
Wellicht vindt men een dergelijk verbod wel in de fiscale wetgeving. De minister merkte op dat een werkgever de eventuele financiële tussenkomsten inzake geldboetes ten laste van de werknemer zeker niet mag aftrekken als bedrijfskosten. Hij voegt eraan toe dat het wetsvoorstel bij nazicht geenszins strijdig blijkt te zijn met het arbeidsovereenkomstenrecht. Hij besluit dat hij zich kan aansluiten bij het wetsvoorstel en bij de motivatie van de indiener. Een werkgever die zich verzekert voor de betrokken geldboetes verhoogt het risico voor de werknemers in kwestie. Door zodoende een situatie van straffeloosheid te creëren bevordert hij het onvoorzichtig rijgedrag van de werknemer. De heer Van Aperen kan het opzet van de indiener van het wetsvoorstel onderschrijven. Bij de artikelen worden geen opmerkingen gemaakt, zij worden eenparig aangenomen en het hele wetsvoorstel wordt vervolgens eveneens eenparig aangenomen.

Mijnheer de voorzitter, collega's, het wetsvoorstel dat hier wordt behandeld heeft te maken met onze niet aflatende strijd voor meer verkeersveiligheid, hoewel het hier over een verzekeringsaangelegenheid gaat. Inderdaad, vorige week stonden de kranten bol van de belangstelling van de politieke wereld voor de verkeersveiligheid, dit naar aanleiding van de publicatie van de nieuwe NIS-cijfers over het gestegen aantal dodelijke verkeersslachtoffers. Wij konden allerlei goede voornemens en beloftes vernemen, maar meer en meer wordt duidelijk dat de strijd voor meer verkeersveiligheid alle dagen en op verschillende niveaus moet worden gevoerd.
Er zijn drie elementen: het voertuig, de infrastructuur en vooral het gedrag van de automobilist. Ons wetsvoorstel heeft hiermee te maken. Als wij het gedrag van de automobilist in het verkeer wensen te veranderen, kunnen wij dat door sensibilisering, door preventief optreden en door een handhavingsbeleid. Meer dan ooit is dit in ons land nodig. Als u ziet dat ons land 14 verkeersdoden op 100.000 inwoners telt tegen 7 per 100.000 in Nederland, dan loopt er op onze wegen iets fundamenteels mis. Wat loopt er mis? Welnu, het gedrag van de automobilisten is niet aangepast aan de weginfrastructuur. Vandaar de nood aan een volgehouden en kwaliteitsvol handhavingsbeleid. Het is dan ook nodig alle mogelijke achterpoortjes te sluiten. Tot onze verbazing ontdekten wij dat het in dit land mogelijk is zich te verzekeren tegen verkeersboetes en dat bepaalde bedrijven dit voor hun werknemers ook doen.
Welnu, op deze manier kan geen handhavingsbeleid worden gevoerd. Vandaar dat wij dat kleine achterpoortje in de wet op de landverzekeringsovereenkomst stond, hebben gesloten. Ik dank de leden van de commissie voor het Bedrijfsleven en de minister voor zijn positieve medewerking en ik hoop dat alle collega's, vandaag in de Kamer en morgen in de Senaat, dit wetsvoorstel zullen goedkeuren.

If we want to change the behavior of the driver in the road, we can do so through awareness, through preventive action and through enforcement policies. More than ever this is needed in our country. If you see that our country has 14 road deaths per 100,000 inhabitants against 7 per 100,000 in the Netherlands, then something is fundamentally wrong on our roads. What is going wrong? Well, the behavior of the drivers is not adapted to the road infrastructure. Hence the need for a sustained and high-quality enforcement policy. Therefore, it is necessary to close all possible back doors. To our surprise, we discovered that it is possible to insure against traffic fines in this country and that certain companies do this for their employees as well.
Well, in this way, no enforcement policy can be conducted. Therefore, we closed that small backdoor in the law on the Land Insurance Agreement. I thank the members of the Committee on Business and the Minister for their positive cooperation and I hope that all colleagues, today in the House and tomorrow in the Senate, will approve this bill.

Mijnheer de voorzitter, mijnheer de minister, collega's, de wetgevende macht lijkt weerom toe te geven aan de uitvoerende macht. De Senaat keurde namelijk eenparig, dus over alle partijgrenzen heen, het voorstel van senator Lizin goed, hoewel de minister van Financiën daar tegen was. De minister van Financiën legde zich bij die nederlaag in de Senaat blijkbaar niet neer. Nu krijgt hij zijn zin doordat een gedweeë meerderheid hem volgt in de Kamer. Een belangrijk partijvoorzitter en vele sprekers hebben in het debat nochtans voldoende argumenten aangedragen voor de afschaffing van de 3% aan inningkosten. Het besluit is echter ontmoedigend. De reflecterende senatoren scoren momenteel hoger inzake de herwaardering van het Parlement dan de collega's in dit halfrond. Hopelijk heeft de Senaat de moed om de strijd nogmaals aan te gaan en ze opnieuw in haar voordeel te beslechten.
De redenen van de regering en de meerderheid in de commissie om het wetsontwerp geworden voorstel van senator Lizin te wijzigen, waren de kostprijs voor de federale overheid en de noodzakelijke vergoeding die de gemeenten moeten betalen voor die federale dienstverlening. Een dergelijke dienstverlening zou niet gratis mogen gebeuren. Er kan dus geen sprake zijn van een afschaffing, maar wel van een vermindering van het percentage. Daarenboven werd smalend gedaan over de budgettaire onverantwoordelijkheid van de Senaat. Nochtans hadden de collega's in de Senaat hun huiswerk op dit punt net wel goed gemaakt. Zij stelden terecht dat de federale staat moreel gezien geen aanspraak kan maken op die extra 3% omdat de federale staat al royaal voorgefinancierd wordt door de gemeenten.
Hoe steekt het systeem van de doorstortingen aan de gemeenten immers in elkaar? De doorstortingen gebeuren pas een viertal maanden na de effectieve verrekening van het aanslagbiljet. De federale staat ontvangt het grootste deel van de aanvullende gemeentelijke personenbelasting echter al veel vroeger. Ongeveer 60 miljard van de 70 miljard frank wordt immers geïnd via de bedrijfsvoorheffing pakweg twee jaar vóór de latere doorstorting aan de gemeenten. De Schatkist beschikt dus twee jaar lang over 60 miljard frank. Dat geld behoort eigenlijk toe aan de gemeenten. De Schatkist moet dat minder ontlenen. 60 miljard frank beleggen aan bijvoorbeeld 7% zou jaarlijks 4,2 miljard frank opbrengen. Twee jaar voorfinanciering is dus goed voor 8,5 miljard frank aan intresten die door de federale staat wordt bespaard. Andersom beschikken de gemeenten niet over die 8,5 miljard frank. Dat is ongeveer 12% van de totale aanvullende gemeentelijke personenbelasting en maar liefst het viervoud van de 3% inningkosten die de gemeenten daarbovenop nog steeds moeten betalen.
De minister stelde dat de inningkosten als een billijke vergoeding moeten blijven bestaan omdat er noodzakelijkerwijze een link moet zijn met die dienstverlening aan de gemeenten. Omgekeerd zouden de gemeenten ook heel wat kunnen factureren aan het federale adres. Wie vergoedt de gemeentelijke dienstverlening inzake onder andere identiteitskaarten, paspoorten, rijbewijzen, landbouwtellingen, politioneel beleid en veiligheidsbeleid? Zeker niet de federale overheid, me dunkt. Overigens zou dat principe dan moeten worden doorgetrokken naar de facturering van de diensten die de gemeenten voor de gemeenschappen en de gewesten verrichten.
Maar neen, de noodzakelijke facturering wordt alleen in dit dossier ingeroepen. Als de federale overheid de juste retour inroept, willen we het wel eens hebben over alle ontvangsten die ze geniet wanneer de gemeenten meer personeel aanwerven, meer aankopen verrichten en meer investeren, dit via de BTW en andere kanalen. De Vereniging van Vlaamse Steden en Gemeenten pleit terecht voor een ruimere financiële tegemoetkoming, zowel vanwege de federale Staat als van de Gemeenschappen en Gewesten, als compensatie voor de bijkomende taken of financiële lasten die de gemeenten worden opgelegd. Toegegeven, dit speelt veel meer voor de Gemeenschappen en de Gewesten en wettigt vooral een sterke stijging van het gemeentefonds. Het is echter ook federaal echt relevant. Het is intussen wel duidelijk dat de politiehervorming, ondanks alle vroegere beloften, veel geld zal kosten aan de gemeenten die de kwaliteit van hun dienstverlening op het vroegere niveau willen behouden. Niet alleen is ingevolgde de Mammoetwet bijkomend personeel vereist waarmee de federale toelagen geen rekening houden, er komt ook niets van een gratis overdracht van kazernes voor de huisvesting van de politie. Kortom, de voorgestelde geleidelijk vermindering van de inhouding voor administratiekosten — kostprijs voor de staatskas 1,4 miljard frank in 2003 — weegt niet op tegen de lasten die de federale overheid op de gemeenten afwentelt. Door de recente verhoging van de wedden van burgemeesters en schepenen zal de Staat trouwens maar liefst 850 miljoen frank bijkomende fiscale inkomsten kunnen innen. De netto kostprijs van wat hier nu nog ter stemming voorligt, is dus voor de federale overheid slechts 550 miljoen frank. Vergelijk dit bedrag even met de 8,5 miljard frank ingevolge de voorfinanciering door de gemeenten. De toestand van de gemeentelijke financiën is nochtans ernstig. Tussen 1990 en 2000 steeg het aandeel van de belastingontvangsten in de totale inkomsten van de gemeenten in Vlaanderen gemiddeld met 10%, met name van 36,6% in 1990 naar 46,7% in 2000. De inkomsten uit subsidies en fondsen daalden daarentegen tijdens dezelfde periode met 10%, van 46,9% naar 37% in 2000. De inkomsten van de gemeenten kunnen daardoor geen gelijke tred houden met de uitgaven waardoor structurele tekorten zullen ontstaan.
Volgens studies van de bank Dexia over de evolutie van de gemeentelijke financiën was er in 1999 voor alle Belgische gemeenten samen nog een batig saldo van 12,6 miljard frank. Dit zou in 2006 evolueren naar een gezamenlijk tekort van 56,8 miljard frank. Reeds dit jaar hebben vele gemeenten noodgedwongen bepaalde taksen verhoogd. Ik staaf mijn betoog met objectieve cijfers afkomstig van de Vereniging van Vlaamse Steden en Gemeenten. Uit de in commissie besproken tabel blijkt duidelijk dat het gemiddeld tarief van de aanvullende gemeentebelasting op de personenbelasting toeneemt van 6,59% in 2000 tot 6,8% in 2001. Deze stijging is sterker dan normaal, zelfs in vergelijking met andere jaren na de gemeenteraadsverkiezingen. Uit de tabel blijkt dat ook in de periode 1988-2000 nooit zo'n sterke stijging is opgetekend.
Met betrekking tot het gemiddelde tarief van de onroerende voorheffing toont een andere tabel dezelfde evolutie. Tussen 2000 en 2001 stegen de opcentiemen van 1074 tot 1168, wat eveneens meer is dan ooit tevoren. Ik besluit hieruit dat zowat alle gemeenten zich thans verplicht zien hun belastingen te verhogen. Niettegenstaande de recente hervorming van de personenbelasting slechts binnen enkele jaren voelbaar zal zijn, zal ook zij op kruissnelheid een gevoelige vermindering van de aanvullende belasting op de personenbelasting met zich brengen, voor zover de gemeenten natuurlijk geen gevolg geven aan de cynische raad van de minister van Financiën om dan maar het tarief van de aanvullende belasting te verhogen. Ik schat de impact van de hervorming op de gemeentelijke financiën op 8 à 9 miljard frank. De achterstand inzake de uitbetalingen van het Rijksinstituut voor Ziekte- en Invaliditeitsverzekering heeft als gevolg dat de gemeenten bepaalde kosten van de OCMWziekenhuizen en -rusthuizen prefinancieren.
De hervorming van de overheidspensioenen, het toenemend aantal artsenvennootschappen en andere vennootschappen van zelfstandigen en vrije beroepen, waardoor de belastbare basis krimpt, de opvang van kandidaat-politieke vluchtelingen door de OCMW's, de steun aan vreemdelingen in de regularisatieperiode, de vrijmaking van de energiemarkt, zijn voorbeelden van vele andere dossiers met een negatieve financiële weerslag voor de gemeenten.
Ten slotte, worden ook de federale toelagen voor gesubsidieerde contractuelen, de gesco's, niet verhoogd, zodat de gemeenten in toenemende mate moeten bijspringen. Meer nog, hoeveel gemeenten hebben dit jaar al geld voor hun gesco's ontvangen?
Dexia schat de totale negatieve financiële impact van deze maatregelen door de gemeenten vanaf de jaren 2005-2006 op 60 tot 70 miljard frank per jaar. Wat stellen de minister en de meerderheid daar tegenover? Het geamendeerde wetsvoorstel van de heer Bacquelaine, dat grotendeels als een vestzak-broekzakoperatie kan worden beschouwd omdat de Staat het bedrag van 850 miljoen frank aan de gemeenten terugstort dat zij zelf, ingevolge de verhoging van de wedden van de burgemeesters en schepenen, aan bijkomende belastingsontvangsten heeft geïnd. De gemeenten krijgen bovendien slechts 550 miljoen frank extra ter beschikking.
Voor het overige verwijst u naar de gemeenschappen en de gewesten en cynisch naar de autonomie van de gemeenten om zelf hun tarieven te verhogen. Inderdaad mijnheer de minister, ook de gewesten zouden via een verhoging van het gemeentefonds een bijdrage moeten leveren tot de gezondmaking van de financiën van de gemeenten. Ik vind het echter ongehoord dat de federale regering haar eigen, zeer bescheiden bijdrage van 550 miljoen frank netto afhankelijk maakt van de wil of onwil van de gemeenschappen en gewesten om ook over de brug te komen. Werd hierover trouwens al uitsluitsel verkregen? Ik verwijs naar het verslag waar de datum van 13 juli 2001 werd vooropgesteld.
De CVP-fractie vindt hoe dan ook dat het geamendeerde voorstel van de heer Bacquelaine ruimschoots onvoldoende is omdat het niet aan de werkelijke behoeften van de gemeenten tegemoet komt, ook al is iets beter dan niets. De CVP-fractie zal dan ook uit protest tegen dit voorstel stemmen, tenzij alsnog het gezond verstand in de Kamer zegeviert - zoals destijds in de Senaat - en de door ons ingediende amendementen tot afschaffing van de 3% inningkosten alsnog zouden worden aanvaard.

The reasons for the government and the majority in the committee to amend Senator Lizin’s proposal, which became the bill, were the cost for the federal government and the necessary fee that municipalities must pay for that federal service. Such services should not be provided for free. There can therefore be no abolition, but a reduction of the percentage. In addition, it was narrowed about the budgetary irresponsibility of the Senate. However, the colleagues in the Senate had done their homework on this point just as well. They justified that the federal state can morally not claim that extra 3% because the federal state is already generously pre-financed by the municipalities.
How does the system of transfers to the municipalities interfere? The transfers take place only four months after the effective settlement of the ticket. However, the federal state receives most of the additional municipal personal tax much earlier. In fact, approximately 60 billion of the 70 billion francs are collected through the corporate advance tax roughly two years before the subsequent transfer to the municipalities. The Treasury has 60 billion francs for two years. That money belongs to the municipalities. The treasury should get less. Investing 60 billion francs at, for example, 7% would yield 4.2 billion francs annually. Two-year pre-financing is therefore equivalent to 8.5 billion francs of interest saved by the federal state. On the other hand, the municipalities do not have those 8.5 billion francs. That is approximately 12% of the total additional municipal personal tax and as much as four times the 3% collection costs that the municipalities above still have to pay.
The Minister argued that the collection costs should continue to exist as a fair remuneration because there must necessarily be a link with that service to the municipalities. Conversely, municipalities would also be able to invoice a lot at the federal address. Who reimburses the municipal services concerning, among other things, identity cards, passports, driving licenses, agricultural counts, police policy and security policy? Not the federal government, I think. Furthermore, that principle should then be extended to the invoicing of the services provided by the municipalities for the communities and the regions.
But no, the necessary invoicing is only invoked in this file. If the federal government calls for just return, we would like to talk about all the revenue it enjoys when the municipalities hire more staff, make more purchases and invest more, this through VAT and other channels. The Association of Flemish Cities and Municipalities rightly advocates for a wider financial response, both due to the federal state and of the communities and regions, as compensation for the additional tasks or financial burdens imposed on the municipalities. Obviously, this plays a lot more for the Communities and the Regions and, above all, legitimates a strong increase in the municipal fund. However, it is also really relevant federally. In the meantime, it is clear that the police reform, despite all previous promises, will cost a lot of money to the municipalities who want to maintain the quality of their services at the previous level. Not only does the Mammoet Act require additional personnel that the federal subsidies do not take into account, there is also nothing of a free transfer of casernes for the housing of the police. In short, the proposed gradual reduction of the retention for administrative expenses — cost to the state treasury 1.4 billion francs in 2003 — does not offset the burden imposed by the federal government on the municipalities. As a result of the recent increase in the bets of mayors and farmers, the State will be able to collect up to 850 million francs of additional tax revenues. The net cost of what is now put forward for voting is, therefore, for the federal government only 550 million francs. Compare this amount to the 8.5 billion francs resulting from pre-financing by the municipalities. The state of municipal finances is serious. Between 1990 and 2000, the share of tax receipts in the total incomes of the municipalities in Flanders increased by an average of 10%, notably from 36.6% in 1990 to 46.7% in 2000. Revenue from grants and funds, on the other hand, decreased by 10% during the same period, from 46.9% to 37% in 2000. As a result, the incomes of the municipalities cannot keep pace with the expenditure resulting in structural deficits.

The reform of public pensions, the increasing number of medical companies and other companies of self-employed and freelance professions, which reduces the taxable base, the reception of candidate-political refugees by the OCMWs, the support to foreigners in the regularization period, the liberation of the energy market, are examples of many other dossiers with a negative financial impact on the municipalities.
Finally, the federal subsidies for subsidized contracts, the SCOs, are also not increased, so municipalities need to contribute increasingly. Moreover, how many municipalities have already received money for their SCOs this year?
Dexia estimates the total negative financial impact of these measures by the municipalities from 2005-2006 to 60 to 70 billion francs annually. What does the minister and the majority say about this? The amended bill of Mr. Bacquelaine, which can largely be regarded as a vest-pocket-pocket operation because the State returns the amount of 850 million francs to the municipalities that it itself has collected from additional tax receipts as a result of the increase in the bets of the mayors and crews. In addition, the municipalities will receive only 550 million francs extra.
For the rest, you refer to the communities and the regions and cynically to the autonomy of the municipalities to raise their own rates. Mijnheer de voorzitter, mijnheer de minister, collega's, vandaag wordt ingevolge de bepalingen van artikel 470 van het Wetboek op de Inkomstenbelastingen van 1992 op het bedrag van de aan de gemeenten verschuldigde aanvullende belastingen een korting, een last van 3%, ingehouden voor de terugbetaling van de administratiekosten aan de Schatkist. De heer Pieters zei reeds dat in de Senaat een wetsvoorstel van mevrouw Lizin werd aangenomen dat ertoe strekt artikel 470 volledig op te heffen. De auteur van het wetsvoorstel was van mening dat deze vergoeding helemaal niet nodig is om de kosten van de Schatkist te dekken voor de uitvoering van deze verrichtingen. Immers, de Schatkist int de gemeentelijke ontvangsten vooraf en in de bedrijfsvoorheffing en de voorafbetalingen is een forfaitair aandeel van 6% inbegrepen. Aangezien de gemeenten dat stuk met een vertraging van 15 tot 18 maanden krijgen terugbetaald, bij de inning van de ingekohierde belastingen, krijgt de Staat volgens deze redenering elk jaar de facto een meevaller in de schoot geworpen die eigenlijk al een voldoende vergoeding vormt voor zijn dienstverlening aan de lokale besturen.
In de senaatcommissie verklaarde de minister van Financiën dat in het begrotingsjaar 1999 een som van 2,118 miljard frank werd ingehouden op een totaal van 69,056 miljard frank dat werd doorgestort aan de gemeenten. Uiteindelijk werd het voorstel in de senaatcommissie eenparig door de negen aanwezige leden aangenomen.
In de kamercommissie voor de Financiën werd beslist om als uitgangspunt de tekst te gebruiken van het wetsvoorstel van de heer Bacquelaine en consorten die voorziet in een verlaging van die korting tot 1%. Uiteindelijk werd het voorstel zo geamendeerd dat de korting zal worden verlaagd tot 2% vanaf 1 januari van volgend jaar en tot 1% het daaropvolgende jaar. Mijnheer de minister, ik stel mij de vraag wat de vergadering van dat overlegcomité op 13 juli heeft opgeleverd. In de commissie hebt u immers aangekondigd dat u uw houding daarvan zou laten afhangen.
Wat is ons standpunt terzake? De VLD had liever de volledige afschaffing gezien van de korting van 3% maar toch hebben we beslist de afbouw tot 2% in 2002 en tot 1% in 2003 te steunen. Wij hebben hiervoor verschillende redenen. Ten eerste, ook deze regering is nog steeds onderhevig aan budgettaire contraintes. Ik denk niet dat men 's morgens de regering kan aanmanen tot budgettaire voorzichtigheid om dan 's namiddags te zeggen, kijk daar allemaal niet naar en stem dan maar die 3%. Ten tweede, het is misschien nuttig om de band tussen de gemeenten en de federale belastingadministratie niet te verbreken. Dit kan belangrijk zijn bij eventuele klachten over de laattijdige doorstorting aan de gemeenten van de geïnde belastingen. Ten derde, wij steunen het voornemen van de minister van Financiën om binnen de Hoge Raad van Financiën een nieuwe afdeling op te richten die zal worden belast met de controle op de overdracht van de door de federale overheid geïnde belastingontvangsten.
Het zou zeer nuttig zijn om deze nieuwe afdeling een studie te laten uitvoeren over de financiële weerslag die de op federaal of gewestelijk vlak genomen beslissingen zullen hebben op de inkomsten en uitgaven van de gemeenten en de provincies. Het valt immers niet te ontkennen dat de lokale besturen vaak te kampen hebben met een bepaalde rechtsonzekerheid en een gebrek aan duidelijkheid omtrent de implicaties — ook financiële implicaties — van beslissingen die worden genomen door andere bestuursniveaus. Begin dit jaar publiceerde de Vereniging van Vlaamse Steden en Gemeenten een document waarin op vrij pessimistische wijze prognoses werden gemaakt voor de komende jaren inzake de evolutie van de gemeentelijke financiën. De VVSG onderstreept dat, door een samenloop van omstandigheden en overheidsmaatregelen, de lokale besturen op korte en middellange termijn met enorme financiële uitdagingen zullen worden geconfronteerd en waarschuwt voor de dreiging van een vrij algemene stijging van de lokale fiscale druk.
De stelling van de VVSG dat de lokale besturen op korte en middellange termijn met enorme financiële uitdagingen zullen worden geconfronteerd en dat alleen extra maatregelen van de federale en de Vlaamse overheid kunnen vermijden dat de gemeenten hun belastingen drastisch zullen moeten verhogen, dient echter toch een klein beetje te worden genuanceerd. Het is namelijk ook zo dat in de voorbije jaren de gemeentelijke ontvangsten zijn gegroeid want hoge belastingen op federaal niveau hebben ook hogere inkomsten op gemeentelijk niveau voor gevolg. Die gemeenten hebben in veel gevallen steeds meer taken — ook vrijwillig — op zich genomen. Indien achteraf blijkt dat de gemeenten de kostprijs, die verbonden is aan de uitvoering van die taken, niet hoog genoeg hebben ingeschat, moeten zij daarvoor een deel van de verantwoordelijkheid dragen. Het is al te gemakkelijk om alle verantwoordelijkheid af te schuiven op de federale of de regionale overheid.
De VLD vraagt dan ook met aandrang — ook aan die steden en gemeenten waar de VLD in de bestuursmeerderheid zit — dat de lokale besturen zich zouden houden aan het principe van fiscale stop. Waar mogelijk dienen de gemeentelijke belastingen te worden vervangen door retributies en alle belastingen waarvan de inningskosten hoger zijn dan de opbrengsten, zouden sowieso moeten worden afgeschaft.
Indien bepaalde beslissingen van hogere overheden om bijkomende taken op te leggen aan de lokale besturen een uitgavenstijging voor deze besturen tot gevolg hebben, dan is de VLD wel van mening dat de overheden die deze verplichtingen opleggen ook in de nodige compensaties moeten voorzien voor het lokale niveau. Meer bewind is immers onmogelijk zonder bijkomende middelen. Daarnaast moet waar mogelijk ook het principe van de intergemeentelijke samenwerking maximaal worden toegepast.
Ten slotte denkt de VLD ook dat besparingen kunnen worden doorgevoerd door modernisering van schuldbeheer en door de verplichte toepassing van een meerjarenplanning. De VLD hoopt alleszins dat de voorgestelde maatregel om voor de federale inhouding van drie naar één procent te gaan, de golf van verhogingen van gemeentelijke opcentiemen sedert de laatste gemeenteraadsverkiezingen zal kunnen afremmen. Te meer daar in het Vlaamse Gewest werd beslist de bijkomende middelen die in het kader van de recente staatshervorming ter beschikking werden gesteld van gemeenschappen en gewesten ten dele aan te wenden om een vaste en constante stijging te waarborgen van de financiële middelen van het Gemeentefonds. Volgens de VLD zou het nog doeltreffender zijn om de verschillende fondsen die moeten inspelen op de behoeften van de gemeenten samen te voegen en de gemeenten grotere armslag te geven inzake de bestemming van de middelen die beschikbaar zijn in het kader van de besturen.

We have several reasons for this. First, this government is also still subject to budgetary constraints. I don’t think one can urge the government to be budgetary cautious in the morning and then say in the afternoon, don’t look at it all and vote for those 3%. Second, it may be useful not to break the bond between municipalities and the federal tax administration. This can be important in case of any complaints about the late transfer to the municipalities of the taxes collected. Third, we support the intention of the Minister of Finance to establish within the High Council of Finance a new department that will be charged with the control of the transfer of the tax receipts collected by the federal government.
It would be very useful to have this new department conduct a study on the financial impact that decisions taken at the federal or regional level will have on the incomes and expenditure of municipalities and provinces. Indeed, it cannot be denied that local governments often face certain legal uncertainty and lack of clarity regarding the implications — including financial implications — of decisions taken by other levels of government. Earlier this year, the Association of Flemish Cities and Municipalities published a document in which, in a rather pessimistic way, forecasts were made for the coming years regarding the evolution of municipal finances. The VVSG emphasizes that, due to a convergence of circumstances and government measures, local governments will face immense financial challenges in the short and medium term and warns of the threat of a fairly general rise in local fiscal pressure.
However, the statement of the VVSG that local governments will face huge financial challenges in the short and medium term and that only additional measures by the federal and Flemish governments can prevent municipalities from having to raise their taxes drastically needs to be somewhat nuanced. In fact, it is also true that in recent years the municipal revenue has grown because high taxes at the federal level also result in higher incomes at the municipal level. In many cases, these municipalities have taken on more and more tasks, including voluntarily. If it turns out subsequently that the municipalities have not estimated the cost associated with the performance of those tasks sufficiently high, they should bear part of the responsibility for this. It is all too easy to shift all responsibility to the federal or regional government.
The VLD therefore urges – also to those cities and municipalities where the VLD is in the administrative majority – that the local governments adhere to the principle of tax stop. Where possible, municipal taxes should be replaced by remuneration, and all taxes whose collection costs exceed the income should be abolished anyway.
If certain decisions of higher governments to impose additional tasks on local governments result in an increase in expenditure for these governments, the VLD is of the opinion that the governments that impose these obligations should also provide for the necessary compensation for the local level. More governance is impossible without additional resources. In addition, where possible, the principle of intercommunal cooperation should also be applied as far as possible.
Finally, the VLD also believes that savings can be achieved by modernising debt management and by the mandatory application of a multiannual planning. The VLD is very hopeful that the proposed measure to move for the federal retention from three to one percent will be able to curb the wave of increases in municipal options since the last municipal council elections. Moreover, in the Flemish Region it was decided to use in part the additional resources made available to communities and regions in the context of the recent state reform to ensure a steady and constant increase in the financial resources of the Municipal Fund. According to the VLD, it would be even more effective to bring together the different funds to respond to the needs of the municipalities and to give the municipalities a greater grip on the allocation of the resources available within the framework of the administrations.

Monsieur le président, il ne faut pas mélanger la réforme des polices, si ce n'est qu'un jour, nous serons comptables du réel impact de cette réforme. On en reparlera demain. Sur le problème spécifique du choix politique de la fiscalité à appliquer dans chaque commune, monsieur le ministre, puis-je tout d'abord vous demander de ne pas généraliser? Certaines communes, durant ces dernières années, dont la mienne — j'en suis fier — ont diminué leur taux d'impôts. Je pense qu'autant l'Etat fédéral doit, à travers sa politique, être respectueux de l'autonomie communale, autant nous devons l'être de l'autonomie de l'Etat fédéral de travailler sur sa fiscalité.
Mais de deux choses l'une, si votre raisonnement est correct, à savoir que les communes pourront décider de suivre le mouvement lancé par l'Etat fédéral ou de le compenser; dans ce cas, il conviendra de renégocier, au niveau des régions, la fameuse problématique du pacte fiscal, puisque certaines communes se trouveront empêchées de relever leur taux d'impôts pour organiser la compensation, par rapport à la diminution que vous entrevoyez.
Certaines communes ont, d'ores et déjà, enfreint le pacte fiscal pour augmenter leur taux d'impôts avant que la diminution que vous entrevoyez n'entre en application, soit avant le réel impact de la réforme. Ces communes travaillent déjà à une augmentation de l'impôt local, enfreignent le pacte fiscal et lorsque le ministre de tutelle, le fils de qui vous savez, essaie d'empêcher les communes d'agir de la sorte, ces mêmes communes s'adressent au Conseil d'Etat, notamment celle de M. Eerdekens. Tout porte à croire que ces communes obtiendront gain de cause au Conseil d'Etat. Dès lors, le raisonnement que nous tenons est le suivant: aussi louable que soit votre politique, en cas de cumul de celle-ci et des mesures prises par le gouvernement fédéral, notamment en matière de réforme des polices, l'impact pour le citoyen sera non seulement nul mais à terme, on s'acheminera vers une augmentation du taux d'impôt, dont la responsabilité incombera non à l'Etat fédéral, qui sauvegardera son image comme à l'accoutumée, mais à chaque commune qui n'aura d'autre choix que d'augmenter l'impôt local. Donc, ce que vous proposez aujourd'hui en termes de réforme fiscale et ici en matière d'aide aux communes n'est autre qu'une duperie et tôt ou tard, vous devrez en assumer les conséquences.

Mijnheer de voorzitter, ik zal het kort houden. Collega Pieters heeft al op zijn bekende uitmuntende wijze het standpunt van onze fractie duidelijk gemaakt. Ik wil er nog een viertal punten aan toevoegen.
Mevrouw Moerman zei daarnet dat het inconsequent is dat de CVP voor de middag in de commissies voor de Begroting en Financiën aanstuurt op budgettaire voorzichtigheid en bepaalde meeruitgaven wil afwimpelen, terwijl de CVP na de middag meeruitgaven veroorzaakt inzake de afhouding op de fiscale inkomsten die moeten worden doorgestort aan de gemeenten. Ik wil mevrouw Moerman corrigeren. Het is niet omdat wij aandringen op budgettaire voorzichtigheid — iets dat meer dan ooit noodzakelijk is gezien de budgettaire situatie van ons land — dat wij als oppositie geen alternatieve accenten mogen leggen wat de uitgaven betreft.
Wij maken blijkbaar andere keuzen dan de meerderheidspartijen. Ik heb er geen probleem mee om te erkennen dat wij effectief andere keuzen maken inzake de begrotingscontrole. Wij zouden bijvoorbeeld geen extra 500 miljoen frank toebedelen aan het Europees voorzitterschap en tegelijk 1 miljard frank besparen op rusttehuizen, op de rug van de bejaarden. De huidige keuze is een keuze voor meer luxe en meer vertoon, iets dat bovendien provocatief werkt op de betogers die zich reeds aankondigen voor de Europese bijeenkomsten in ons land. Wij zouden inderdaad andere keuzes maken. Wij zouden de bejaarden in de intramurale bejaardenzorg niet zo harteloos aanpakken.
Mijnheer de voorzitter, wat de minister ook probeert te doen, de bewijsvoering van collega Pieters blijft overeind. Ook in de commissie heeft hij bewijzen aangevoerd op basis van documenten van de Vlaamse Vereniging van Steden en Gemeenten. De VVSG is overigens een pluralistische organisatie waarvan de beheersorganen zijn samengesteld uit politici van verschillende strekking. Of betwijfelt u dat, mijnheer de minister? In de bestuursorganen van de VVSG zetelen toch collega's van de liberale, van de socialistische, van de groene fractie?
Mijnheer de minister, collega Pieters heeft de documenten van deze pluralistische instelling gebruikt bij zijn markante bewijsvoering in de commissie voor de Financiën en de Begroting. U kunt dus niet meer betwisten dat twee jaar paarsgroene regering, op Vlaams vlak nog aangevuld met de Volksunie, geleid heeft tot een verhoging van de lasten van de gemeentebesturen. Alle partijen zijn het daar over eens. Zelfs de kamervoorzitter heeft er zich recent in zeer duidelijke termen over uitgelaten. Natuurlijk probeert u het beeld te creëren van een federale overheid die de belastingen verlaagt, maar in de praktijk is dat niet het geval. Ik wil hier het debat van twee weken geleden niet herhalen, maar u zult maar een fractie teruggeven van wat u al hebt geïncasseerd aan meerontvangsten tijdens de voorgaande twee jaren.
Mijnheer de minister, maak u geen illusies, de mensen beseffen wel degelijk dat hoewel de federale regering, de federale minister van Financiën, en de liberale fractie zeggen "dank zij ons worden de belastingen verlaagd", de fiscale druk niet daalt. Wanneer puntje bij paaltje komt, en wanneer de mensen hun rekeningen maken, zullen zij zien dat het saldo tussen de vrijwel gelijkblijvende federale belasting en de extra lasten die via de gemeenten werden opgelegd, negatief uitvalt. Dat geldt ook voor gemeentebesturen die in handen zijn van mandatarissen van de meerderheid, inclusief liberale mandatarissen. Wanneer u geconfronteerd wordt met die realiteit, zal de geloofwaardigheid van uw uitspraken en van die van uw geestesgenoten over de zogezegde lastenverlaging hol blijken te zijn.
Mijnheer de voorzitter, het laatste punt dat ik wil aanvoeren, ligt in het verlengde van wat collega Moerman al heeft aangebracht. Dit punt is al aan de orde sinds het debat over de federale, regionale, provinciale en gemeentelijke taakverdeling, en vooral over de financiële lastenverdeling tussen die verschillende bestuursniveaus, dus al een aantal maanden. Het betreft de hele problematiek van het opvolgen van de budgettaire en fiscale impact door de gemeentebesturen van de federale of Vlaamse maatregelen. Ik neem de vrijheid om in het kader van de huidige besprekingen enige kritische kanttekeningen te maken bij een aantal oogmerken van het beleid, zowel op het niveau van het Vlaamse Gewest als op het federale niveau.
Mijnheer de minister, ik heb het meer bepaald over het 'belfort', een soort observatorium dat de gemeentefinanciën zou moeten opvolgen volgens de voorstellen van Vlaams minister Stevaert. Ik heb het ook over uw intentie om de afdeling financieringsbehoeften van de Hoge Raad voor Financiën op te dragen deze materie op te volgen, te weten de impact van federale beslissingen op de gemeentebesturen.
In dat verband wens ik een viertal kritische opmerkingen te formuleren.
Ten eerste, ik veronderstel dat de bijkomende opdracht slechts aan de Hoge Raad voor Financiën, afdeling financieringsbehoeften, kan worden gegeven indien deze zowel op het vlak van het personeel als van de uitrusting wordt versterkt. Immers, het zou niet logisch zijn mocht de afdeling financieringsbehoeften van de Hoge Raad voor Financiën deze belangrijke opdracht krijgen zonder over bijkomende mankracht en bijkomende middelen te beschikken, tenzij de minister die opdracht niet ernstig neemt en wegschuift naar de Hoge Raad, hopend dat er niets meer van terechtkomt. Trouwens, vorige week, bij de stemming over het wetsontwerp met betrekking tot het Zilverfonds, kreeg de afdeling financieringsbehoeften, en de Hoge Raad voor Financiën in het algemeen, reeds een bijkomende opdracht, meer bepaald in het kader van het jaarlijks te verlenen advies over de Zilvernota, waarin elk jaar zal worden bepaald hoeveel middelen fictief op het Zilverfonds zullen worden overgemaakt.
Een tweede punt van kritiek is de intentie van de minister om de Hoge Raad voor Financiën afdeling financieringsbehoeften te belasten met de opvolging, de monitoring, van de financiële verhoudingen tussen federale overheid, provincies en gemeenten. Het probleem op dat vlak is het inwinnen van de informatie. Het is evident dat om een onderbouwd, nauwgezet advies te kunnen verlenen, de afdeling financieringsbehoeften van de Hoge Raad voor Financiën moet beschikken over informatie. Welnu, zowel in hoofde van het Gemeentekrediet, thans Dexia, dat goed is geplaatst om daartoe rechtstreeks toegang te hebben, als proefondervindelijk, onder meer door de Hoge Raad voor Financiën, is het niet zo evident om snel en accuraat informatie te halen uit de jaarlijks goed te keuren begrotingen op gemeentelijk vlak.
Uiteraard zijn de financiële en fiscale beslissingen die op het terrein worden genomen een conditio sine qua non voor de afdeling financieringsbehoeften van de Hoge Raad voor Financiën om een objectief, goed onderbouwd en wetenschappelijk gefundeerd advies dienaangaande te kunnen geven. Op dat vlak rijst op de eerste plaats een statistisch probleem waarvoor de Hoge Raad voor Financiën momenteel niet goed is uitgerust. Wellicht ware het aangewezen om bijvoorbeeld het Instituut voor de Nationale Rekeningen, waarover de minister ook enige bevoegdheid heeft, hiervoor verantwoordelijk te stellen. Het lijkt mij zelfs aangewezen, wanneer het erop aankomt voorspellingen te doen met betrekking tot de evolutie van de financiële stromen tussen de federale overheid, de gemeenten en de provincies, na te gaan of het Federaal Planbureau — waarover de minister eveneens enige bevoegdheid heeft — niet evengoed of zelfs beter is geplaatst om deze opdracht te vervullen.
Mijnheer de voorzitter, tot hier beperken zich mijn opmerkingen, aanvullend aan het betoog van de heer Dirk Pieters.

Ms. Moerman just said that it is inconsistent that the CVP urges budgetary caution in the committees for Budget and Finance in the afternoon and wants to reduce certain additional expenditure, while the CVP causes additional expenditure after the afternoon in respect of the withholding of tax revenues to be transferred to the municipalities. I would like to correct Mrs. Moerman. It is not because we insist on budgetary prudence — something that is more necessary than ever given the budgetary situation of our country — that we as the opposition should not put alternative emphasis on spending.
We are making different choices than the majority parties. I have no problem with acknowledging that we are effectively making different choices regarding budgetary control. For example, we would not allocate an additional 500 million francs to the European Presidency and at the same time save 1 billion francs on rest homes, on the back of the elderly. The current choice is a choice for more luxury and more display, something that also acts provocatively on the protesters who already announce themselves for the European meetings in our country. We would indeed make other choices. We would not treat the elderly in the intramural old-age care so heartlessly.
Mr. Speaker, whatever the Minister attempts to do, the evidence of Mr. Pieters remains standing. In the committee, he also cited evidence based on documents from the Flemish Association of Cities and Municipalities. The VVSG is a pluralist organization whose management bodies are composed of politicians of different backgrounds. Do you doubt that, Mr. Minister? In the governing bodies of the VVSG, do colleagues from the liberal, the socialist, the green group sit?
Mr. Minister, Mr. Pieters has used the documents of this pluralist institution in his striking evidence presentation in the Committee on Finance and Budget. So you can no longer argue that two years of purple-green government, on the Flemish level supplemented by the People's Union, has led to an increase in the burdens of the municipal governments. All parties agree on this. Even the House Chairman has recently expressed himself in very clear terms. Of course, you’re trying to create the image of a federal government that reduces taxes, but in practice that’s not the case. I do not want to repeat the debate of two weeks ago here, but you will only return a fraction of what you have already collected to surplus revenues during the previous two years.
Mr. Minister, do not make illusions, the people realize that although the federal government, the federal minister of finance, and the liberal faction say “thanks to them we are reducing taxes”, the fiscal pressure does not decrease. When point by point comes, and when people make their accounts, they will see that the balance between the almost simultaneous federal tax and the additional charges imposed through the municipalities is negative. This also applies to municipal governments held by majority mandators, including liberal mandators. When you are faced with that reality, the credibility of your statements and those of your fellow spirits about the so-called burden reduction will prove to be hollow.
Mr. Speaker, the last point I would like to point out is in the extension of what colleague Moerman has already put forward. This point has been discussed since the debate on the federal, regional, provincial and municipal task distribution, and especially on the financial burden distribution between those different levels of government, so for several months. It concerns the entire problem of monitoring the budgetary and fiscal impact by the municipal governments of the federal or Flemish measures. I take the freedom to make some critical comments in the context of the current discussions on a number of objectives of the policy, both at the level of the Flemish Region and at the federal level.
Mr. Minister, I have spoken more specifically about the "belfort", a kind of observatory that should follow the municipal finances according to the proposals of Flemish Minister Stevaert. I am also talking about your intention to commission the Finance Needs Department of the High Council for Finance to monitor this matter, namely the impact of federal decisions on municipal governments.
In this regard, I would like to formulate four critical comments.
First, I assume that the additional contract can only be assigned to the High Council for Finance, the financing needs department, if it is strengthened both in terms of personnel and equipment. After all, it would not be logical if the financing needs department of the High Council for Finance received this important assignment without having additional manpower and additional resources, unless the Minister does not take that assignment seriously and shifts away to the High Council, hoping that nothing more will come out of it. Monsieur le président, monsieur le ministre, chers collègues, d'autres orateurs avant moi ont signalé que la proposition qui a été retenue par la commission n'est pas celle qui nous est venue du Sénat et qui, après y avoir été adoptée, se parait de l'appellation de "projet", puisqu'elle avait été adoptée. C'est bien la preuve que nos deux assemblées sont fondamentalement différentes; cela a déjà été dit aujourd'hui.
Nous avons parfois l'obligation de nous écarter de la pureté idéale et nous sommes confrontés aux contraintes budgétaires. Car la Chambre a bien la mission de veiller au contrôle budgétaire et à la bonne utilisation des deniers de l'Etat. Le Sénat, lui, a d'autres considérations, certes plus nobles, plus élevées. Chaque assemblée doit, à cet égard, assumer sa propre identité. C'est la raison pour laquelle certains d'entre nous ont voulu maintenir la faisabilité budgétaire de cette orientation, en la canalisant en quelque sorte et en l'étalant partiellement jusqu'en 2003, de telle sorte que nous puissions assurer la compatibilité de cet avantage aux communes avec la bonne gestion du budget de l'Etat.
Dès le départ, dans ma proposition, j'avais maintenu un taux de 1%, évitant de la sorte la suppression globale de ce prélèvement. Pourquoi? Nous avons pensé qu'il était utile de maintenir une liaison entre la recette communale et le ministère des Finances. A cet égard, si les communes veulent parfois revendiquer quant à la rapidité des versements ou à leur justesse, il est utile que le service qu'elles reçoivent de l'Etat soit rétribué par elles sous la forme d'un prélèvement, de telle sorte qu'elles puissent faire valoir leurs droits et avoir un dialogue d'égal à égal. Sans ce prélèvement, il pourrait advenir que le ministre des Finances, à une époque plus ou moins lointaine, dise tout d'un coup: "Mesdames et messieurs les municipalistes, prélevez vous-mêmes vos impôts; ce n'est plus notre matière; débrouillez-vous". Je pense qu'à ce moment-là, le prélèvement des impôts en toute autonomie par les communes refléterait certes le renforcement de l'autonomie communale, mais je pense que l'Etat serait alors de nouveau accusé de mettre sur le dos des communes de nouvelles charges, puisque l'organisation par les communes elles-mêmes du prélèvement coûterait vraisemblablement plus cher que ce pour cent. Ce service aux communes doit donc être maintenu; et ce moyennant rétribution.
M. Pieters dit que les communes remplissent déjà une série de charges pour l'Etat. C'est vrai. Elles l'ont d'ailleurs revendiqué. Depuis l'indépendance de la Belgique, les communes ont revendiqué la possibilité de remplir elles-mêmes certaines charges dont elles ne désirent d'ailleurs pas se défaire. Je pense notamment à tous les services de proximité, les services de la population et de l'état civil. Il s'agit là de tâches séculaires des communes.
Je crois vraiment que cela fait partie de la mission même des communes. C'est toute la différence entre le jacobinisme et la décentralisation et la proximité des services communaux par rapport à leur population. Je crois donc que c'est extrêmement important et je pense qu'il ne faut pas mélanger touts les débats dans cette matière.
Les finances communales ont été souvent évoquées et notamment les charges qui seraient mises sur le dos de communes par le pouvoir fédéral. Je rappellerai d'abord que le financement des communes est essentiellement du ressort des régions actuellement. Nous l'avons voulu de manière nette et pratiquement à l'unanimité. Les régions viennent d'ailleurs, et en tout cas pour ce qui concerne la Région wallonne, de décider d'un certain nombre de mesures utiles au financement des communes. En ce qui concerne les charges vis-à-vis desquelles les communes pourraient considérer qu'elles s'accroissent par le fait de politiques générées par l'Etat fédéral, il ne faut pas tout confondre.
M. Fournaux, dans son amendement, parle notamment de la politique des réfugiés. Pour les communes qui ont accepté de rentrer dans le cadre des mesures proposées par le gouvernement fédéral en matière d'accueil des réfugiés, c'est-à-dire qui ont accepté de prendre leurs responsabilités à cet égard, la situation est moins onéreuse pour les communes aujourd'hui que l'année précédente et ce, de manière très nette. On peut aligner tous les chiffres et démontrer que pour les communes qui ont accepté une véritable politique d'accueil des réfugiés et qui ont accepté de prendre en charge cet accueil dans des logements et l'encadrement des réfugiés pour lesquels elles perçoivent 1.075 ou 1.155 francs par jour et par réfugié, il est clair qu'il ne s'agit évidemment pas d'une charge pour les communes mais bien au contraire d'une participation de l'Etat fédéral au financement de l'accueil des réfugiés dans notre pays.
En ce qui concerne la réforme des polices, je ne m'y attarderai pas aujourd'hui puisque nous en parlerons demain et particulièrement de l'impact de cette réforme sur les finances communales. Le débat reste ouvert et sans doute devrons-nous maintenir une vigilance des municipalistes pour les municipalistes, maintenir une vigilance accrue dans ce secteur d'activité. Ce débat aura lieu demain et nous nous retrouverons demain pour en discuter.
Tout ceux qui s'intéressent un tant soit peu à l'évolution des finances communales savent que l'origine des difficultés des communes tient essentiellement dans les décisions des municipalistes que nous avons acceptées. Je pense à la révision générale des barèmes: chaque municipaliste l'a acceptée dans sa commune ou ne l'a pas fait et, ici, nous avons également accepté de relever les traitements des bourgmestres et échevins. Nous devons en assumer les conséquences puisqu'un acte n'est vraiment politique que s'il implique la responsabilité de ce qu'il propose. Les charges salariales sont, en ce compris celles des bourgmestres et échevins, la cause principale des difficultés des communes. Toutes les études sur les finances communales le démontrent allègrement. Tout le reste a un effet pelliculaire par rapport à l'augmentation des charges salariales et je pense qu'il est bon de le rappeler.
Je pense qu'il y a souvent confusion entre la défense des finances communales et celle de certaines gestions communales déficientes ou carencées. A ce sujet, j'aimerais qu'on ait parfois le courage d'admettre que nous nous trouvons dans une année post-électorale, qui a suivi une année électorale pendant laquelle des dépenses ont été engagées par certaines communes de manière parfois inconsidérée, pour des engagements de personnels ou des investissements qui dépassaient les capacités financières, et qui ont été faits dans l'année précédent les élections. Il est clair que tous les six ans, nous sommes dans une année postélectorale avec un certain nombre de difficultés dans les communes qui sont générées par certaines largesses ou visions politiques généreuses qui se manifestent un peu avant les élections. Il faut avoir le courage de le reconnaître sans tout confondre, d'autant plus lorsque l'on est dans une période d'approbation budgétaire, comme pour l'instant, dans la plupart de nos communes. Et on s'aperçoit de nouveau que de nombreux budgets communaux étaient de faux budgets.
Je suis prêt à ce que l'on établisse la liste publique des faux budgets communaux: sur les 582 communes de Belgique, combien y a-t-il de faux budgets prouvés par les comptes? Le décalage entre les comptes et les budgets démontre qu'il y a parfois des entorses dans la gestion. Et il faudrait avoir le courage de le reconnaître.

En ce qui concerne la réforme fiscale, à supposer que l'on diminue les impôts de 10 ou de 15%, il est clair que si le taux reste le même, la diminution va se traduire de la même façon. A ce moment-là, je suppose que beaucoup de municipalistes informeront leurs concitoyens qu'ils participent à la diminution de la fiscalité. Si, par contre, ils veulent maintenir la même imposition communale, il suffit qu'ils augmentent de 10 à 15% le taux relatif de leur imposition communale.
Mes chers collègues, je me félicite de cette orientation consistant à réduire les charges communales de 700 millions en 2002 et de 1,4 milliard en 2003. Il n'y a pas deux discours, monsieur Fournaux. Waarover gaat dit wetsontwerp?

Collega D'Hondt, ik weet niet of dit in uw nieuw Reglement — dat hier vorige week werd voorgelegd en op applaus werd onthaald — staat vermeld, maar collega's strijden eerst om het verslaggeverschap rond ontwerpen en vertikken het vervolgens met dezelfde hardnekkigheid om in de plenaire vergadering verslag te geven. Dat wordt in een bijgevoegd artikel 7 in het Reglement behandeld? Ik stel in elk geval vast dat dit steeds meer gebeurt. Daarom wil ik loco de verslaggever, mijn goede en gewaardeerde vriend Jef Tavernier — insiders weten wat dit betekent — kort schetsen waarover het gaat.
Het is de bedoeling om retroactief, met de oprichting van het MTS-tradingsplatform voor de verhandeling van effecten van de staatsschuld op de secundaire markt, de participatie van de Belgische Staat daarin een wettelijke basis te geven. Het kapitaal van die nieuwe rechtspersoon bestaat uit 400.000 euro, waarvan 300.000 euro volstort, verspreid over een drietal aandeelhouders. De eerste aandeelhouder is een geprivatiseerde Italiaanse vennootschap, de MTSSPA — SPA is waarschijnlijk een Italiaanse afkorting — die voor 20% aandeelhouder in deze vennootschap wordt.
De tweede categorie van aandeelhouders zijn de primary dealers. Zij hebben een vlottend aandeelhouderschap van 76,5% van het maatschappelijk kapitaal van MTS Belgium met een bedrag van 306.000 euro. MTS Belgium werd in mei 2001 opgericht. Daarvan zullen we nu retroactief de wettelijke basis vernemen.
De reden waarom wij echter dit wetsontwerp in de plenaire vergadering van de Kamer bespreken, is het feit dat de Belgische Staat de derde aandeelhouder is. De staat bezit 3,5% of 14.000 euro van het maatschappelijk kapitaal van MTS Belgium. De Belgische Staat kan blijkbaar zijn aandeel tijdelijk optrekken tot 150.000 euro. Volgens de tekst van het wetsontwerp, dat wij zullen goedkeuren kan de Belgische Staat zijn aandeel tijdelijk optrekken wanneer primary dealers, die tot de tweede categorie aandeelhouders behoren en die 76,5% van de aandelen bezitten, zouden beslissen om uit het maatschappelijk kapitaal van MTS Belgium te treden. De Belgische Staat kan tijdelijk het aandeel van 3,5% met een waarde van 14.000 euro in het maatschappelijk kapitaal verhogen tot 150.000 euro.
Minister Reynders, mijn eerste vraag luidt: waarom werd precies dat bedrag van 150.000 euro vooropgesteld? Waarom geen 140.000 of 180.000 euro? Waarom werd er voor de Belgische Staat een plafond vastgesteld in het aandeelhouderschap van MTS Belgium?
Een vraag in het verlengde daarvan. Stel dat de Belgische Staat op een bepaald moment, in het kader van transacties of het uittreden van primary dealers uit het aandeelhouderschap van MTS Belgium, tijdelijk zijn aandeel in de rechtspersoon zou optrekken tot 120.000 euro. Krijgt de Belgische Staat dan alle normale aandeelhoudersrechten die verbonden zijn aan het in het handen hebben van 30% aandelen?
In het verslag van de besprekingen las ik dat er sprake is van een mandaattermijn van de primary dealers. Als ik het goed voor heb, is die termijn eind 2000 verlopen. Ik citeer uit het merkwaardige verslag van collega Tavernier: "Op het einde van hun mandaat, zijnde het mandaat van de primary dealers, 24 maanden na 1 januari 1999...". Ik veronderstel dat het einde van de mandaattermijn dan voorzien is op 31 december 2000. Dit zou logisch zijn als men de tekst letterlijk overneemt. Wie is dan de potentiële verwerver van de aandelen vanaf 1 januari 2001? Is dat dan de Belgische Staat? Mijnheer de minister, hoe zit het trouwens met de retroactieve werking van het wetsontwerp dat wij hier bespreken? Ik verwacht hierop een antwoord, gelet op de belangrijkheid van de materie die wij hier behandelen.
Mijnheer de minister, ik had mijn vragen ook in de artikelsgewijze bespreking kunnen stellen, maar ik probeer tijd te winnen door ze nu reeds te stellen.
Artikel 2 van het voorliggend wetsontwerp bepaalt dat het belangrijkste maatschappelijk doel van de vennootschap MTS Belgium de verhandeling van schuldbewijzen van de Belgische Staat op de secundaire markt is. In de legistiek heb ik altijd geleerd dat de notie "de belangrijkste" a contrario veronderstelt dat er minstens hypothetisch —dit moet worden bewezen uit de beleidspraktijk, uit de handelingen van de betrokken rechtspersoon - uit hoofde van de betrokken vennootschap, in casu MTS Belgium ook nog andere maatschappelijke doelen zouden kunnen zijn. Zonder ongelukken zal het voorliggend wetsontwerp worden goedgekeurd. Het is belangrijk dat de minister van Financiën een duidelijk antwoord geeft op de vraag of de rechtspersoon andere maatschappelijke doelen heeft dan de belangrijkste doelstelling, in casu de verhandeling van schuldbewijzen van de Belgische Staat op de secundaire markt.
De volgende vraag is veeleer een opmerking en heeft betrekking op de inbedding van de Belgium MTS in het Europese verband. Wij kunnen, mijns inziens, tevreden zijn dat wij tijdens het Europees voorzitterschap van België dit wetsontwerp bespreken. Mijnheer de minister, als voorzitter van de Ecofinraad en wandelend van het ene succes naar het andere - denken wij maar aan de coördinatiecentra, de Tobintaks, de eurobelasting - bent u wellicht de geknipte persoon om ons in te lichten over de inpassing van MTS Belgium in het breder Europees kader. Als ik goed ben ingelicht, maakt ons land onderhand deel uit van EuroMTS dat op dit ogenblik reeds de benchmarks van de Belgische staatsschuld verhandelt. EuroMTS verhandelt niet alle schuldbewijzen, maar de benchmarks. De vraag dringt zich op of met de komst van de euro in het verschiet - dit is geen hypothese maar een realiteit - maar ook met de recente transnationale samenwerking via Euronext op de beursvloer én een stijgende internationalisering van de financiële wereld, de deelname van de Belgische Staat aan een Belgium MTS wel opportuun is op het ogenblik dat de EuroMTS reeds actief is en de Belgische Staat hierin participeert. Waarom wordt een nationaal platform opgericht? Men kan een parallel trekken met EuroNext dat de zware aandelen zou verhandelen terwijl de nationale beurzen bevoegd kunnen blijven voor de kleine aandelen. Waarom maakt men geen werk van het verhandelen via EuroMTS van alle schuldeffecten en niet alleen van de benchmarks? Dit zou dubbel werk kunnen voorkomen.
Wat de samenstelling van de schuldpositie en de spreiding van de effectenschuld betreft, vraag ik mij af of in het licht van de vrijgemaakte nieuwe Europese financiële architectuur een nationale uitgifte van schuldeffecten niet voorbijgestreefd is. Wat denkt de Europese Centrale Bank - u goed bekend via uw goede vriend Duisenberg waarmee u zeer vriendschappelijke en loyale betrekkingen onderhoudt - van een eenzijdige participatie van de Belgische Staat in de MTS Belgium waarvan de activiteiten in de feiten even goed kunnen worden ondergebracht in de EuroMTS?
Mijnheer de minister, deze vragen en bemerkingen verdienen, mijns inziens, een antwoord vooraleer de CVP-fractie die gunstig vooringenomen is, het voorliggend ontwerp goedkeurt.

Therefore I want to loco the reporter, my good and valued friend Jef Tavernier — insiders know what this means — briefly sketch what it is about.
With the establishment of the MTS trading platform for the trading of government debt securities on the secondary market, it is intended to provide a legal basis for the participation of the Belgian State in the secondary market. The capital of that new legal entity consists of EUR 400,000, of which EUR 300,000 is sufficient, spread over a third of the shareholders. The first shareholder is a privatized Italian company, the MTSSPA — SPA is probably an Italian abbreviation — which becomes a 20% shareholder in this company.
The second category of shareholders are the primary dealers. They have a floating shareholding of 76,5% of the corporate capital of MTS Belgium with an amount of 306,000 euros. MTS Belgium was founded in May 2001. We will now learn the legal basis retroactively.
However, the reason why we are discussing this bill in the plenary session of the House is the fact that the Belgian State is the third shareholder. A question in its extension. Suppose that at a given time, in the context of transactions or the withdrawal of primary dealers from the shareholding of MTS Belgium, the Belgian State would temporarily increase its share in the legal entity to EUR 120,000. Does the Belgian State then obtain all normal shareholder rights associated with holding 30% of shares?
In the report of the discussions I read that there is a mandate deadline of the primary dealers. If I am right, that deadline has expired at the end of 2000. I quote from the strange report of colleague Tavernier: "At the end of their mandate, being the mandate of the primary dealers, 24 months after 1 January 1999...". I assume that the end of the term of the mandate is then foreseen on 31 December 2000. This would be logical if the text is taken literally. Who is the potential acquirer of the shares from 1 January 2001? Is this the Belgian state? What about the retroactive effect of the bill we are discussing here? I expect an answer to this, given the importance of the matter we are dealing with here.
Mr. Minister, I could have asked my questions in the article-by-article discussion, but I try to gain time by asking them now.
Article 2 of the bill stipulates that the main social objective of the company MTS Belgium is the trading of debt securities of the Belgian State on the secondary market. In the jurisprudence, I have always learned that the notion “the most important” a contrario assumes that there is at least hypothetical — this must be proven from the policy practice, from the acts of the legal entity concerned — from the head of the company concerned, in this case MTS Belgium could also have other societal goals. Without accidents, the present bill will be approved. It is important that the Minister of Finance gives a clear answer to the question whether the legal entity has other social objectives than the main objective, in this case the trading of debt securities of the Belgian State on the secondary market.
The following question is rather a note and relates to the incorporation of the Belgium MTS in the European context. We can, in my opinion, be satisfied that we are discussing this bill during the Belgian European Presidency. Mr. Minister, as chairman of the Ecofin Council and walking from one success to another – let us think of the coordination centers, the Tobint Tax, the euro tax – you may be the cut person to inform us about the insertion of MTS Belgium in the broader European framework. If I am properly informed, our country is now part of EuroMTS, which is already trading the benchmarks of the Belgian government debt. EuroMTS does not trade all debt securities but the benchmarks. The question is whether with the arrival of the euro in a hurry – this is not a hypothesis but a reality – but also with the recent transnational cooperation via Euronext on the stock exchange floor and an increasing internationalisation of the financial world, the participation of the Belgian State in a Belgium MTS is opportune at the moment that the EuroMTS is already active and the Belgian State participates in it. Why is a national platform established? One could draw a parallel with EuroNext that would trade the heavy shares while the national exchanges could remain competent for the small shares. Why does not one do the work of trading through EuroMTS of all debt securities and not only of the benchmarks? This could avoid double work.
As regards the composition of the debt position and the distribution of the securities debt, I wonder whether, in the light of the liberalized new European financial architecture, a national issue of debt securities has not been overlooked. What does the European Central Bank – you are well known through your good friend Duisenberg with whom you maintain very friendly and loyal relations – think of a unilateral participation of the Belgian State in the MTS Belgium whose activities can in fact be equally well accommodated in the EuroMTS?
Mr. Minister, these questions and comments deserve, in my opinion, an answer before the CVP group, which has been favorably accepted, approves the present draft.

Je répondrai donc simplement aux questions posées en renvoyant, mais en les explicitant, tant au résumé du projet tel que présenté qu'à l'exposé des motifs, voire au rapport.
Pourquoi une intervention de l'Etat, moyennant, malgré la répartition des titres annoncée, une possibilité d'acquisition de titres jusqu'à un montant maximal de 150.000 euros?
Simplement parce qu'il y a un lien entre les deux dispositifs. Les "primary dealers" sont désignés pour une durée de 24 mois à partir du 1 er janvier 1999; on a alors prévu qu'ils pourraient être au maximum d'un nombre de 17. Et la Trésorerie, d'après ses estimations, estime que, moyennant une possibilité d'acquisition de titres à concurrence de 150.000 euros, nous pourrions reprendre les titres des "primary dealers" qui devraient quitter la plate-forme avant de les recéder à ceux qui intégreraient à nouveau la plate-forme à la suite d'une nouvelle désignation.
Donc un lien existe effectivement - je comprends les deux questions de M. Leterme — entre les délais impartis en ce qui concerne la nomination des "primary dealers" et le montant autorisé d'acquisition par l'Etat de titres supplémentaires. La Trésorerie estime — et je crois que c'est raisonnable — qu'avec un montant maximum de 150.000 euros, on dispose de possibilités tout à fait suffisantes pour assurer le portage en attendant que de nouveaux "primary dealers" soient désignés, si certains devaient quitter la plate-forme.
Il me paraît donc raisonnable à la fois d'annoncer la répartition telle qu'elle se trouve dans le résumé et dans l'exposé des motifs, mais aussi de permettre à l'Etat d'aller jusqu'à un maximum de 150.000 euros. Je me fie évidemment à l'évaluation faite par la Trésorerie en discussion avec les "primary dealers". Une capacité de portage suffisante existe pour permettre de franchir les échéances de désignation à terme de ces intervenants.
En ce qui concerne l'objet social principal, on n'a pas voulu se limiter à une plate-forme électronique déterminée. L'exposé des motifs y fait d'ailleurs allusion: la volonté est de permettre qu'en fonction des évolutions technologiques, l'objet social qui indique un objet social principal permette d'aller éventuellement vers de nouvelles technologies que la technologie MTS et, pourquoi pas, vers une technologie qui pourrait passer par une intégration européenne.
Je rejoins tout à fait la remarque formulée également: pourquoi certaines plates-formes nationales pour l'instant et pas directement des organisations transnationales? Simplement que le lien avec Euronext est logique mais pas tout à fait pertinent en ce sens qu'ici, nous parlons de plateforme d'intervention pour les opérateurs publics. Il n'est pas exclu que, dans l'avenir, on puisse effectivement mettre en commun divers opérateurs. Certains accords sont déjà passés pour le calendrier d'émission des titres de la dette publique entre différents émetteurs européens et je n'exclus pas qu'on puisse un jour aller plus loin. Ce que le projet prévoit en tout cas, c'est effectivement un objet social principal pour permettre de s'adapter soit à de nouvelles technologies, soit à de nouvelles évolutions de rapprochement entre opérateurs de pays différents.
Cela étant, je reconnais qu'il s'agit là d'une opération qui vient couvrir finalement une démarche déjà réalisée dans le cadre de l'opérateur lui-même. Il y a donc un effet rétroactif aux mesures proposées. Mais l'annonce de la création de MTS-Belgium est une annonce faite dans la présentation des rapports précédents sur la gestion de la dette publique.
Je me réjouis que tous les groupes qui se sont exprimés sur ce sujet soutiennent la démarche de modernisation de la gestion de la dette. Je pense qu'ils pourront comprendre qu'il est utile de disposer d'une certaine souplesse afin de permettre le remplacement éventuel de certains partenaires. C'est ce que prévoit la disposition qui autorise l'Etat à acquérir un certain nombre de titres à concurrence d'un montant maximum de 150.000 euros, mais également que la souplesse permette de faire évoluer l'activité concrète de MTS-Belgium en fonction à la fois de l'évolution technologique sur d'autres plates-formes électroniques, mais peut-être aussi en fonction de l'évolution entre différentes plates-formes de pays qui travaillent de manière identique sur ce marché de la dette publique.

I am pleased that all the groups that have expressed their views on this topic support the approach to modernize debt management. I think they will be able to understand that it is useful to have some flexibility in order to allow the possible replacement of certain partners. This is what is provided in the provision that allows the State to acquire a certain number of securities for a maximum amount of 150,000 euros, but also that the flexibility allows to make the concrete activity of MTS-Belgium evolve according both to the technological development on other electronic platforms, but ⁇ also according to the evolution between different platforms of countries that work in the same way on this public debt market.

Mijnheer de voorzitter, collega's, het wetsvoorstel van de heer Brouns heeft tot doel artikel 7, §1 van de wet van 13 juli 1986 betreffende het wegnemen en transplanteren van organen te wijzigen. De huidige wettekst bepaalt dat aan het wegnemen van organen bij minderjarigen twee voorwaarden zijn verbonden: het wegnemen mag geen ernstige gevolgen hebben voor de donors en moet betrekking hebben op regenereerbare organen. Oorspronkelijk stond in de wet "of" moet betrekking hebben op regenereerbare organen, zodat de twee voorwaarden niet cumulatief waren. Het wetsvoorstel heeft tot doel ervoor te zorgen dat beide voorwaarden zijn vervuld, zodat minderjarigen nog alleen regenereerbare organen en weefsels als beenmerg aan een broer of zus zullen mogen afstaan als het wegnemen voor de donors geen ernstige gevolgen heeft.
Het belangrijkste discussiepunt inzake dit wetsvoorstel rees met betrekking tot de rechten van het zieke kind en van de minderjarige potentiële donor om alsnog zelf te kunnen beslissen een niet regenereerbaar orgaan af te staan. Dit ging dan vooral over jongeren die de leeftijd van 18 jaar benaderden. Kunnen jongeren tussen 15 en 18 al dan niet nog beslissen om een niet regenereerbaar orgaan af te staan? Deze opmerkingen werden gemaakt door de heer Denis, mevrouw Descheemaeker, mevrouw Avontroodt en mijzelf. Op basis van de discussie werd een aantal adviezen gevraagd, namelijk aan de kinderrechtencommissarissen, aan het raadgevend comité voor bio-ethiek en aan de Belgische transplantatieraad. Na het aankomen van die adviezen werd de discussie opnieuw gevoerd. De meeste of alle adviezen waren gunstig voor het wetsvoorstel van de heer Brouns.
De kinderrechtencommissarissen hadden wel een aantal bijkomende opmerkingen, waarna de heer Brouns een amendement op zijn voorstel indiende. Dit voegt een nieuw artikel in waardoor de leeftijd vanaf wanneer de minderjarige donor zelf zijn toestemming moet verlenen, wordt teruggebracht naar 12 jaar. Daarmee wordt ingespeeld op het advies van de kinderrechtencommissaris, dat zegt dat jongeren ouder dan 15 jaar op dit ogenblik geen enkel vetorecht hebben, wat strijdig is met artikel 12 van het Verdrag van de rechten van het kind, aangenomen te New York op 20 november 1989. Op basis van dit amendement wees mevrouw Descheemaeker er nogmaals op dat een tegenstrijdigheid werd ingevoerd, aangezien een kind vanaf 12 jaar het recht heeft te worden gehoord, terwijl een kind van 17,5 niet zelfstandig mag beslissen een van zijn organen af te staan.
Het standpunt van de minister was duidelijk. Zij wees, enerzijds, op de positieve adviezen en, anderzijds, op de toestand in het buitenland, waar overal gelijkaardige regelingen gelden. Na de discussie werden de artikelen 1 en 2 van het wetsvoorstel eenparig aangenomen. Het amendement van de heer Brouns werd met 6 stemmen voor bij 3 onthoudingen aangenomen. Het geheel van het wetsvoorstel werd aangenomen met 10 stemmen voor bij 1 onthouding.

Mr Brouns’s bill aims to amend Article 7, § 1 of the Act of 13 July 1986 on the removal and transplantation of organs. The current legislation stipulates that organ removal from minors is subject to two conditions: the removal must not have serious consequences for the donors and must relate to regenerable organs. Originally in the law "or" must refer to regenerable organs, so that the two conditions were not cumulative. The proposed legislation aims to ensure that both conditions are met, so that minors will only be allowed to hand over regenerable organs and tissues such as bone marrow to a brother or sister if the removal does not have serious consequences for the donors.

These comments were made by Mr Denis, Mrs Descheemaeker, Mrs Avontroodt and myself. On the basis of the discussion, a number of opinions were requested, namely the Commissioners for Children’s Rights, the Bioethics Advisory Committee and the Belgian Transplantation Council. The Commissioners for the Rights of the Child had a number of additional comments, after which Mr Brouns submitted an amendment to his proposal. This adds a new article that reduces the age from when the minor donor must give his consent himself to 12 years. This reflects the opinion of the Commissioner for the Rights of the Child, which states that young people over 15 years of age currently have no veto right, which is contrary to Article 12 of the Convention on the Rights of the Child, adopted in New York on 20 November 1989. On the basis of this amendment, Ms. Descheemaeker once again pointed out that a contradiction was introduced, since a child from 12 years of age has the right to be heard, while a child of 17.5 years of age cannot independently decide to give up one of his organs.
The Minister’s position was clear. She pointed out, on the one hand, the positive opinions and, on the other hand, the situation abroad, where similar arrangements apply everywhere. After the discussion, Articles 1 and 2 of the bill were unanimously adopted. Mr Brouns’ amendment was adopted by 6 votes in favour and 3 abstentions. The entire bill was adopted with 10 votes in favor and 1 abstinence.

Het wetsvoorstel van de heer Brouns strekt ertoe de positie van de minderjarigen beter te beschermen. Daartegen heb ik uiteraard geen enkel bezwaar. Ik heb het artikel zelf dus goedgekeurd. Ik wil immers duidelijk maken dat ook ik voorstander ben van de bescherming van de minderjarigen. Het amendement houdt echter ook in dat de minderjarige tot zijn 18 jaar geen niet-regenereerbaar orgaan — eigenlijk kan het dus enkel over een nier gaan — kan afstaan. De randvoorwaarden voor transplantatie zijn nochtans duidelijk omschreven in de huidige wet: alleen in een situatie van levensgevaar, alleen voor een broer of een zus en alleen indien er geen volwaardig alternatief is. Volgens mij zit er in het voorstel van de heer Brouns een duidelijke contradictie inzake de rechten van minderjarigen. De bescherming van de minderjarige kandidaat-donors wordt uitgebreid, maar de rechten van de minderjarige broer of zus die in levensgevaar verkeert, verminderen. Er zit nog een contradictie in. Tegelijkertijd acht het wetsvoorstel iemand tot 18 jaar immers onbekwaam om zelfstandig over een dergelijke situatie te oordelen en te beslissen.
Bijna als een roepende in de woestijn heb ik verwezen naar de huidige wetgeving. Het viel mij op dat die wetgeving nog dateerde uit de periode toen de meerderjarigheid op 21 jaar werd bereikt. De keuzemogelijkheid bestond voor de toenmalige minderjarigen vanaf 18 jaar, dus drie jaar vroeger. Ik vond het dus vrij logisch dat diezelfde drie jaar in het nieuwe voorstel zouden worden weerspiegeld.
Mijnheer Brouns, u hebt die redenering gevolgd toen het in een artikel ging over transplantatie van regenereerbare organen. Daar hebt u de leeftijd vanaf dewelke het kind zijn toestemming moest geven, verlaagd van 15 jaar naar 12 jaar. Mijn idee was om ook in uw voorstel over transplantatie van niet-regenereerbare organen de leeftijd te verlagen van 18 jaar naar 15 jaar. De meerderjarigheid wordt nu immers op 18 jaar bereikt. Men kan ervan uitgaan dat iemand van 15 jaar in de meeste gevallen bekwaam is om zelf te beslissen of hij zijn nier wil afstaan aan een doodzieke broer of zus. Dit was mijn probleem bij de eindstemming in de commissie. Ik ben dus bij mijn onthouding gebleven. Ik had immers het gevoel dat er een te grote contradictie bestond.
Mijnheer Brouns, u hebt mij geantwoord dat er weinig gevallen voorkomen waarin een orgaan van een broer of een zus noodzakelijk is, en waarbij er geen alternatief is. Dat kan wel zo zijn, maar waarom wil u dan de wet veranderen? Ik heb in elk geval beslist dat ik me zou onthouden bij de eindstemming.

In my opinion, Mr Brouns’ proposal contains a clear contradiction with regard to the rights of minors. The protection of minor candidate donors is extended, but the rights of the minor brother or sister who is in danger of life are reduced. There is another contradiction. At the same time, the bill considers a person under the age of 18 incapable of independently judging and deciding on such a situation.
Almost as a crying in the desert, I have referred to the current legislation. I noticed that that legislation dates back to the period when the age of majority was reached at 21 years. The option existed for the minor at that time from 18 years old, i.e. three years earlier. So I found it quite logical that the same three years would be reflected in the new proposal.
Mr. Brouns, you followed that reasoning when in an article it was about transplantation of regenerable organs. There you have lowered the age from which the child had to give his consent, from 15 years to 12 years. My idea was to reduce the age of transplantation of non-regenerable organs from 18 years to 15 years, too. The majority age is now reached at 18 years. One can assume that a 15-year-old is in most cases capable of deciding for himself whether to give his kidney to a deadly sick brother or sister. This was my problem in the final vote in the committee. I remained with my abstinence. I felt that there was too much contradiction.
Mr. Brouns, you answered me that there are few cases in which an organ of a brother or a sister is necessary, and where there is no alternative. It may be so, but why do you want to change the law? In any case, I decided to abstain in the final vote.

Mevrouw Descheemaeker heeft haar onthouding verdedigd met de argumenten die zij ook in de commissie heeft aangehaald. Het enige verweer dat ik daartegen wil opperen, is de realiteit. De realiteit zegt ons dat inderdaad weinig beroep gedaan wordt op minderjarige broers of zussen voor de transplantatie van een niet-regenereerbaar orgaan. Men wacht eerder op het moment dat zij volwassen zijn voor men ze de vraag stelt of zij een nier willen afstaan.
De twee adviezen die in dat verband werden ingewonnen spreken zich niet uit in de zin zoals u het stelt. Met dit wetsvoorstel beogen wij een uitbreiding van de bescherming van levende minderjarige donoren. De eerste wijziging — de oorspronkelijke bedoeling van het wetsvoorstel overigens - was in feite de rechtzetting van een fout in de tekst bij het tot stand komen van de wet van 1986. Uit de memorie van toelichting en de commentaren met betrekking tot deze wet blijkt duidelijk dat het geenszins de bedoeling was zo tekstueel in de wet op te nemen wat er stond. Immers, toen reeds werd gewezen op de inhoudelijk verstrekkende gevolgen van het feit dat het woord "of" werd gebruikt in plaats van het woord "en". In principe liet de wet van 1986 het wegnemen van organen bij personen jonger dan 18 jaar aan een broer of een zus toe, op voorwaarde dat dit geen ernstige gevolgen voor de schenker inhoudt of op voorwaarde dat het gaat om een regenereerbaar orgaan. Beenmerg is daarvan een voorbeeld aangezien het weefsel zich vanzelf herstelt.
Levende donoren kunnen ook een nier of een deel van de lever afstaan, maar deze organen herstellen zich niet.
De huidige tekst van de wet laat toe dat minderjarigen ook een nier of een deel van de lever aan broer of zus afstaan, ofschoon dit nooit de bedoeling was van de wetgever in 1986. Vandaar dat het woord "of" in de tekst moest worden vervangen door het woord "en".
Na de besprekingen die terzake werden gevoerd en na zowel bij de kinderrechtencommissaris als bij de transplantatieraad adviezen te hebben ingewonnen, werd op hun voorstel de leeftijd verlaagd van vijftien jaar tot twaalf jaar. Tevens werd in de wet ingeschreven dat kinderen jonger dan twaalf jaar in elk geval in de mogelijkheid moeten worden gesteld om hun mening te uiten.
Daarmee werd het doel dat reeds in 1986 werd gesteld, namelijk de bescherming van levende minderjarige donoren, volledig bereikt. Meteen werd een grotere betrokkenheid van de kinderen zelf gerealiseerd.
Ik dank zowel de rapporteur als de commissieleden voor hun positieve medewerking met betrekking tot dit wetsvoorstel, ondanks de te begrijpen - onthouding van mevrouw Descheemaeker.

The first amendment — the original purpose of the bill — was in fact to correct an error in the text in the Act of 1986. It is clear from the memo of explanations and the comments concerning this law that it was not intended at all to incorporate so textually what was stated in the law. After all, when already it was pointed out the substantially extending consequences of the fact that the word "or" was used instead of the word "and". In principle, the law of 1986 allowed organ harvesting from a person under the age of 18 to a brother or sister, provided that it did not result in serious consequences for the donor or that it is a regenerable organ. The bone marrow is an example of this as the tissue recovers itself.
Living donors can also give up a kidney or part of the liver, but these organs do not recover.
The current text of the law allows minors to also hand over a kidney or part of the liver to a brother or sister, although this was never intended by the legislator in 1986. Therefore, the word "or" in the text had to be replaced by the word "and".
Following discussions and consultations with the Commissioner for the Rights of the Child and the Transplant Council, their proposal reduced the age from 15 to 12 years. The law also stipulated that children under 12 years of age should in any case be allowed to express their views.
This fully achieved the goal set in 1986, namely the protection of living minors donors. Immediately greater involvement of the children was achieved.
