Mijnheer de voorzitter, mijnheer de minister, ik dank de heer Smets voor het omstandig verslag dat hij op een gedetailleerde wijze naar voren heeft gebracht. Ik zal mij beperken tot het verdedigen van mijn amendement in de hoop dat mijn oproep gevolg zal hebben. Toen we enkele weken geleden het ontwerp houdende opheffing van de nietigheid van sommige wetsontwerpen nakeken, verbaasde het ons dat in die lange lijst van ontwerpen het wetsontwerp tot bevordering van de organisatie van het woon-werkverkeer met bedrijfsvervoerplannen niet werd opgenomen. Ik dacht dat het een vergetelheid betrof en werd daarin gesteund door de heren Wauters, mede-auteur van het wetsvoorstel en Tavernier, die me de indruk gaven dat het inderdaad om een vergetelheid ging. Met een eenvoudig amendement kon dit worden rechtgezet. Vandaar dat ik een amendement heb ingediend. Mijn verbazing was groot toen we gisteren overgingen tot de discussie van dit amendement in de commissie voor de Binnenlandse Zaken en zagen dat het niet om een vergetelheid ging, maar om een bewuste keuze van de regering. Dit wetsontwerp dat in deze Kamer werd goedgekeurd door een grote meerderheid - over de grenzen van meerderheid en oppositie heen - mocht niet op deze lijst voorkomen! De minister heeft duidelijk gezegd dat dit wetsontwerp op korte termijn geen wet mocht worden. Voor mij is dit om twee redenen onbegrijpelijk. De eerste reden is gesitueerd op het inhoudelijke, omdat de fileproblemen vooral het gevolg zijn van het woonwerkverkeer. Dit ondervindt ieder van u. Congestieproblemen rond Brussel, Antwerpen en Gent nemen dramatische afmetingen aan. Eenieder die begaan is met mobiliteit en mogelijke oplossingen voor dit probleem, weet dat bedrijfsvervoerplannen een belangrijke bijdrage kunnen leveren, dat het autosolisme met 15 tot 20% naar beneden kan worden gehaald zonder miljarden overheidsgeld te spenderen. Dan zullen de files verminderen. In de partijprogramma's van de afgelopen maanden waren bedrijfsvervoerplannen trouwens opgenomen als een van de meest voor de hand liggende instrumenten om de fileproblemen te lijf te gaan. Als het wetsvoorstel wordt goedgekeurd, kunnen de meesten aan de kiezer meedelen dat een belangrijk partijprogrammapunt werd gerealiseerd. Toch mag van de regering dit wetsontwerp op deze lijst niet voorkomen. Dit is politiek onbegrijpelijk. Hoe is dit wetsvoorstel tot stand gekomen? Aanvankelijk was het een wetsvoorstel van onze hand. Maar in de vorige legislatuur werd een subcommissie, onder voorzitterschap van de heer Van Aperen, opgericht. De heer Van Aperen heeft als voorzitter vertegenwoordigers van alle politieke fracties uitgenodigd en samen met collega's van vooral SP, PS, Ecolo en Agalev hebben wij dan dit wetsontwerp opgesteld. Het werd op 22 april 1999 hier ter goedkeuring voorgelegd en het kreeg een grote meerderheid, uiteraard ook van de beide socialistische partijen. De heren Bonte en Moock hadden heel intensief meegewerkt aan het totstandkomen van dit ontwerp. Het werd tevens goedgekeurd door Agalev en Ecolo, want Joos Wauters was ook een van de grote promotors. Uiteraard keurden ook de christen-democraten het vol overtuiging goed. De VLD heeft geen tegenstem uitgebracht, maar zich onthouden, samen met de VU. Alleen de PRL en het Vlaams Blok, naar ik meen, hebben een tegenstem uitgebracht. In Nederland zou men zeggen dat dit wetsontwerp kamerbreed werd gedragen door het parlement. Zo zegt men dat daar. Er waren toen ook mensen die op dat moment licht euforisch waren. Ik heb er de Handelingen op nagelezen en citeer daaruit een uitspraak van een collega: Mijn- heer de voorzitter, met dit wetsvoorstel en het vele werk van de heer Ansoms wordt er eigenlijk een groene idee gerealiseerd waarvoor wij al lang vechten. Wij hadden verder willen gaan, maar gezien de mogelijkheden die zich hier voordoen, zullen wij dit ontwerp met overtuiging steunen . Dixit Joost Wauters, in deze Kamer op 22 april 1999. Over dit ontwerp bestaat inhoudelijk in feite geen grote discussie meer. Het kan rekenen op een grote meerderheid over de partijgrenzen heen, maar van deze regering mag het niet in deze lijst worden opgenomen. En dat van een regering die de mond vol heeft over trendbreuk, duurzame ontwikkeling, nieuwe politieke cultuur, het recht van partijen om zich in de regering te profileren en om te scoren, het tendensrecht en ga zo maar door! U kent dat wel. U hoeft er dagelijks de kranten maar op na te slaan. Alle dagen worden er nieuwe prachtige beelden gecreëerd en de wereld ingestuurd. Deze regering verwerpt dus dit ontwerp dat volgens Joos Wauters de realisatie is van een groene idee en dat vooral tot stand kwam dank zij de medewerking van de beide socialistische partijen. Als men belang hecht aan politieke geloofwaardigheid, mag ik toch aannemen dat zowel PS, SP, Agalev als Ecolo dadelijk ons amendement zullen steunen. Dit betekent immers niet dat deze tekst te nemen of te laten is, maar wel dat deze tekst opnieuw ter discussie komt en dat iedereen, regeringspartijen incluis, kan amenderen en de tekst verbeteren. Dan kan men inderdaad nieuwe accenten leggen in deze tekst. Het is niet meer dan dat. Maar zoals gezegd mocht het niet. Wellicht heeft de eerste minister zich er persoonlijk tegen verzet dat dit ontwerp in deze lange lijst werd opgenomen. Als straks dit amendement niet wordt goedgekeurd, denk ik dat wij mogen vragen dat men ophoudt met praten over een nieuwe aanpak, trendbreuk, nieuwe politieke cultuur, tendensrecht of het recht om te scoren. Dat men daar dan alstublieft over zwijge. Dat men er ook over zwijge dat de vorige regering zowat het toonbeeld was, de exponent van oude politieke cultuur, en verstikkend, ondemocratisch en voorbijgestreefd werkte. Dat men daar ook over zwijge als straks dit amendement niet wordt goedgekeurd. Als dit amendement niet wordt goedgekeurd, nodig ik de regeringspartijen uit vlug opnieuw rond de tafel te gaan zitten en het regeerakkoord aan te vullen met een klein zinnetje. U kunt het misschien noteren, ik lees het u voor: De meerderheidspartijen hebben afgesproken dat zij zich voor de overige materies zullen houden aan de klassieke regel om deze te behandelen op basis van de consensus in de regering en tussen de meerderheidsfracties in het parlement . Dit is een welbekend zinnetje dat best ook in dit regeerakkoord wordt opgenomen. Het zou nog kunnen worden verbeterd door het niet te hebben over overige materies, maar over alle materies. Dan is men tenminste eerlijk ten opzichte van de kiezer.

When we looked at the draft revoking the nullity of some bills a few weeks ago, we were surprised that in that long list of bills the draft law promoting the organization of residential-working traffic with business transport plans was not included. I thought it was a forgetfulness and was supported by Mr. Wauters, co-author of the bill, and Tavernier, who gave me the impression that it was indeed a forgetfulness. This could be corrected by a simple amendment. Therefore, I submitted an amendment. My surprise was great when yesterday we went to the discussion of this amendment in the committee for internal affairs and saw that it was not a forgetfulness, but a conscious choice of the government. This bill, which was approved in this House by a large majority – beyond the boundaries of majority and opposition – was not allowed to appear on this list! The Minister has made it clear that this bill should not become a law in the short term. This is incomprehensible for two reasons. The first reason is situated on the substantive, because the file problems are mainly due to the housing work traffic. This is experienced by each of you. Congestion problems around Brussels, Antwerp and Gent are taking dramatic dimensions. Anyone engaged in mobility and potential solutions to this problem knows that business transport plans can make a significant contribution, that autosolism can be reduced by 15 to 20% without spending billions of government funds. Then the files will decrease. In addition, in the party programmes of the past few months, corporate transport plans were included as one of the most obvious tools to address the file problems. If the bill is approved, the majority can communicate to the voter that an important party program item has been realized. However, the government cannot prevent this bill from being included on this list. This is politically incomprehensible. How did this bill come into being? Initially, it was a bill of our hands. In the previous legislature, however, a subcommittee, under the chairmanship of Mr Van Aperen, was established. Mr. Van Aperen, as chairman, invited representatives of all political groups and together with colleagues from especially SP, PS, Ecolo and Agalev, we then drafted this bill. It was submitted here for approval on 22 April 1999 and it received a large majority, of course also from both socialist parties. The gentlemen Bonte and Moock had worked very intensively to create this design. It was also approved by Agalev and Ecolo, as Joos Wauters was also one of the great promoters. Of course, the Christian Democrats also approved it with full conviction. The VLD did not vote against, but abstained, together with the VU. Only the PRL and the Flemish Bloc, I think, voted against. In the Netherlands, one would say that this bill was carried by the parliament. That’s what they say there. There were also people who were lightly euphoric at that time. I have read the Acts on it and quote from it a statement of a colleague: Mr. President, with this bill and the many work of Mr. Ansoms, we actually realize a green idea for which we have been fighting for a long time. We would have wanted to go further, but given the possibilities that arise here, we will support this design with conviction. Dixit Joost Wauters, in this Chamber on 22 April 1999. In fact, there is no longer any substantial discussion about this project. It can count on a large majority across party boundaries, but from this government it should not be included in this list. This government thus rejects this project which, according to Joos Wauters, is the realization of a green idea and which was achieved mainly thanks to the cooperation of the two socialist parties. After all, this does not mean that this text is to be taken or let go, but that this text is again discussed and that anyone, including government parties, can amend and improve the text. It is possible to put new accents in this text. It is nothing more than that. But as I said, it was not allowed. Per ⁇ the Prime Minister personally opposed that this draft was included in this long list. If this amendment is not approved later, I think we can ask that one stop talking about a new approach, trend break, new political culture, trend law or the right to score. Please be silent about this. It should also be noted that the previous government was almost the image, the exponent of old political culture, and worked suffocating, undemocratic, and transcendent. This amendment will not be approved later. If this amendment is not approved, I invite the governing parties to quickly again sit around the table and supplement the government agreement with a small sentence. Het was een goed wetsvoorstel en een eerste stap in de richting van een oplossing voor deze problematiek.

Het is bevreemdend dat de regering, die voortdurend spreekt over vernieuwing, over een nieuwe relatie met het parlement en over tendensrecht van parlementsleden, net het tegenovergestelde doet wanneer het erop aankomt het werk van dit parlement te valoriseren en blijk te geven van openheid van geest. Als parlementariër met enige anciënniteit wijs ik erop dat het in dit Huis een oude regel was teksten die in een van beide Kamers waren aangenomen, automatisch te beschouwen als zijnde ontheven van caduciteit. Deze regering maakt er nu een politieke zaak van. Als dat de uitgestoken hand is waarover de eerste minister ons enkele weken geleden heeft gesproken, bedank ik hem daarvoor feestelijk. Men heeft er doodeenvoudig voor gezorgd dat een wettekst die de goedkeuring kreeg van zeer veel fracties in dit Huis niet meer kan worden besproken, omdat hij stuit op weerstand vanuit liberale hoek. De eerste minister sluit de deur, steekt de sleutel op zak en kondigt een nieuw initiatief aan. Ik ben ervan overtuigd dat degenen die dit geloven, zich vergissen. Van enig initiatief zal niets te merken zijn. Dit is mijn innige overtuiging. De ontwerptekst kon rekenen op een zeer ruime meerderheid onder de vorige regering.
