Mijnheer de voorzitter, mijnheer de minister, collega's, ik wil eerst de rapporteur, mevrouw De Meyer, welgemeend bedanken voor de grote klus die zij heeft opgeknapt om op zo'n korte tijd en in zo'n hels vergadertempo vanmorgen toch een keurig ingebonden verslag via De Post aan ons te bezorgen. Mevrouw De Meyer, dit is op zich een hele prestatie en ik wil u daarvoor oprecht gelukwensen. Dat geldt uiteraard ook voor alle mensen die op een of andere manier hebben meegeholpen. Dit geldt vooral voor de drukkers, die waarschijnlijk gisteren — tijdens de Vlaamse feestdag — de drukkerij hebben moeten laten draaien om dit verslag vandaag op de banken te krijgen.
Mijnheer de voorzitter, er moet mij nog iets van het hart. Ik zal daar niet lang bij blijven stilstaan. Het is spijtig dat wij, zoals verleden jaar, helemaal op het einde van de zittijd allerlei soorten heksentoeren moeten uithalen om onze normale werkzaamheden te kunnen afwerken. Normaal is het onze opdracht — naast het controleren van de uitvoerende macht — om het hele jaar door bezig te zijn met het maken van wetgeving. Wij zijn daartoe altijd graag bereid, vol collegialiteit en constructiviteit, maar als we slechts een dag de tijd krijgen om een wetsontwerp voor te bereiden, zijn we toch niet op een ordentelijke wijze bezig. De Raad van State heeft zich bovendien moeten haasten om gedurende vier weken de mogelijkheid te hebben dat ontwerp te ontleden, te bespreken en de opmerkingen te formuleren. Zij hebben daar vier weken tijd voor nodig gehad, wat — naar ik het ontwerp kan beoordelen — helemaal niet overdreven is. Wij zelf — de wetgevers — hebben dat op één dag moeten doen, het advies van de Raad van State, alle teksten en de verwijzingen naar de wetgeving incluis. Zoals iedereen weet, wordt de wetgeving inzake ziekteverzekering en alles wat daarmee samenhangt, alsmaar complexer.
We hebben dat ook gemerkt tijdens de besprekingen. Niet zelden werden er bijkomende informatieve vragen gesteld om het geheel goed te kunnen vatten en goed te kunnen plaatsen.
Ik betreur dit in elk geval. We hopen ook dat het de allerlaatste keer is geweest — de legislatuur duurt ook niet zo lang meer — en dat de volgende wetsontwerpen ons op een meer convenabel tijdstip zullen bereiken.
Een tweede opmerking over het ontwerp is dat het ook veel volmachten aan de Koning bevat. Natuurlijk kan men zeggen dat het om een vrij technische wetgeving gaat, waarbij nogal wat modaliteiten later moeten worden geregeld en dat men toch niet kan verwachten dat dit alles in de wet wordt geregeld. Ik heb deze opmerking ook gemaakt bij de algemene bespreking; u hebt ze gedeeltelijk weerlegd, mijnheer de minister. Achteraf heb ik het nog even rustig bekeken. Over een aantal regels biedt het verslag gelukkig nog enige verduidelijking, maar dat verbindt ons tot niets. Het verslag begeleidt enkel de teksten uit het ontwerp, maar kan nooit relevant zijn wat de intenties en de toekomst betreft. Hoe dikwijls moeten wij geen uitleg vragen om te weten wat men van ons verlangt? U verlangt dat wij bij wijze van spreken een volmacht geven, zodat de minister de zaak kan uitwerken of de Koning ze kan bepalen. Wat de bredere intenties betreft die in de wet zijn opgenomen, wordt dat natuurlijk moeilijk, vooral voor de oppositie die steeds kritisch en waakzaam moet zijn.
Mijnheer de minister, dit zou ook — wij hebben daarover reeds van gedachten gewisseld — een soort emanatie kunnen zijn van de toenemende drang naar centralisering van alles wat op budgettair vlak, dus inkomsten en uitgaven, samenhangt met de ziekteverzekering, de gezondheidszorg.
Er lijkt een tendens te bestaan tot dirigisme en centralisme. Een en ander wordt blijkbaar heel wat rigider. Zo worden er allerlei comités opgericht, terwijl de minister de bevoegdheid wordt verleend om de nadere regels te bepalen, zelfs in verband met de samenstelling van die comités. Daar houden we ons hart voor vast!
Collega's, er doet zich een paradox voor en we zullen in de toekomst daarover zeker een debat moeten voeren. Ik verklaar mij nader. Enerzijds is er nu een zeer groot budget op het vlak van gezondheidszorg, waarbij de druk om het budget nog te verruimen, nog altijd toeneemt. Anderzijds moet de minister toch in staat zijn om zijn budget te beheren en te beheersen. Natuurlijk heb ik er begrip voor dat de behoeften oneindig zijn en de middelen eindig. Beide verzoenen en prioriteiten vastleggen — en dus keuzes maken —, dat is geen gemakkelijke opdracht. Natuurlijk volgen we die logische redenering.
De vraag rijst dan wel hoe we een en ander zullen beheersen. Mijns inziens zijn daartoe twee modellen voorhanden. Het ene bestaat erin dat we eenieder zoveel mogelijk trachten te responsabiliseren. Daartoe hebt u al stappen gedaan, mijnheer de minister. Het andere bestaat erin dat wij de verantwoordelijkheden op een logische en consequente wijze vastleggen. We staan nu eenmaal allen voor dezelfde opdracht; we moeten keuzes maken gelet op het eindige budget en we zullen op een democratische manier met elkaar overleggen om te komen tot een bepaalde beslissing.
Er is natuurlijk de druk van het budget: de rekeningen moeten kloppen. Wij hebben herhaaldelijk gewezen op de overschrijding van het budget. Daarop hebt u geantwoord dat u de uitgaven echt in handen moest nemen en dat u instrumenten nodig had om overschrijdingen onmiddellijk te kunnen detecteren via knipperlichten, waarna recuperatiemechanismen in werking treden enzovoort.
Mijn fractie heeft u daarin steeds gesteund. Mocht ik in uw schoenen staan, zou ik het ook nodig vinden over instrumenten te beschikken om de vinger aan de pols te kunnen houden en op continue wijze de inkomsten maar zeker de uitgaven te kunnen volgen zodat de regering in staat is direct op te treden en bepaalde maatregelen te nemen. Mijnheer de minister, het zal niet gemakkelijk zijn om in de toekomst een evenwicht te vinden tussen, enerzijds, het beleid dat op korte termijn — elk jaar — ervoor moet zorgen dat het pakket in evenwicht blijft en over voldoende middelen beschikt en, anderzijds, de druk die ontstaat in het moeilijke proces van responsabilisering, overleg en democratisering. De paradox is beide proberen te beheersen.
Mijnheer de minister, met een kenniscentrum dat al de gegevens centraliseert en verwerkt als een soort groot planbureau dat alles in kaart brengt en bijgevolg ook alle kennis bezit, loopt u het gevaar dat de kennis zich te veel in een deskundigencentrum bevindt en onvoldoende kan worden getoetst aan de maatschappij, onder meer bij het maken van keuzes. Mocht u als eerste kennisnemer zich op de gegevens van het deskundigencentrum en op de adviezen van de multipartite baseren om uw beleid uit te stippelen is de kans groot dat u steeds verder af zult staan van de keuzes die de maatschappij wil maken en waarover het Parlement zijn zeg wil hebben. De paradox in het beheersen van de uitgaven voor de gezondheidszorgen door, enerzijds, snel op de bal te kunnen spelen door over accurate gegevens en profielen te beschikken om aberraties te kunnen opsporen en, anderzijds, de interpretatie van de gegevens is een belangrijk debat dat in de toekomst zal moeten worden gevoerd.
Daarmee ben ik het voor 100% eens.
Maar wie doet het uiteindelijk? Wie interpreteert dat? Wie neemt de beslissingen? In hoeverre worden die overlegd en gedeeld? Hoe zal dat mechanisme werken? Laten wij eerlijk zijn, tot nu toe is vooral geïnvesteerd in één aspect, namelijk het verzamelen van gegevens, het snel op de bal kunnen spelen, het in gang zetten van knipperlichtsystemen en correctiemechanismen, het nauwkeurig bewaken van de uitgaven. Volgens mij hebt u op dat vlak zeker verdienstelijk werk geleverd. Het is natuurlijk nog wat koffiedik kijken, want het is voor ons veel duisterder om te zien welk systeem u voor de toekomst wilt uitbouwen om de daaruit voortvloeiende beslissingen te nemen.
De kinesitherapie is daarvan geen goed voorbeeld. De beslissing over de kinesitherapie is vrij dirigistisch genomen. Bij de regeringsverklaring in oktober 2001 kondigde u aan dat u iets ernstigs wilde doen met het budget van de kinesitherapie, waaraan u bovendien plannen zou koppelen. Tegen eind februari 2002 moest die hervorming op punt staan. In oktober wist u echter al hoeveel u uit die hervormingen zou halen. Daarnaar hebben wij toen ook gevraagd. U antwoordde dat u eigenlijk nergens op steunde, maar dat u een simulatie maakt met bepaalde resultaten tot gevolg. Achteraf blijkt dat u wel degelijk een hervormingsplan in uw kast hebt liggen.
Dan begint er een soort van schijnconsultatie. Daarmee moet u toch opletten, vind ik. De kinesisten worden eerst al overstelpt met de plannen, die te nemen of te laten zijn. Bovendien worden zij dan voor een onmogelijke opdracht gezet. De beroepsgroeperingen zijn wat versplinterd. Zij zijn dat soort werk niet gewoon. Zij zijn het niet gewoon om hervormingen door te voeren of mee na te denken over beleidswerk. U geeft hen dan twee maanden de kans, met de hete adem van het klaarliggend plan in hun nek, om eruit proberen te geraken. Als ze er niet uit zouden geraken, zou u zelf wel beslissen. Dat is er gebeurd, ondanks alles en mogelijk ook ondanks al uw goede bedoelingen. Ik heb een hervorming op dat vlak namelijk altijd nuttig of zinvol gevonden. De manier waarop die hervorming is doorgevoerd, brengt echter, tot vandaag aan toe, grote chaos met zich. Omwille van de intellectuele eerlijkheid wil ik zelfs de berichten uit de pers niet gebruiken dat sommige kinesisten aan de grond zitten wegens een grote terugloop van cliënteel. Daarover wil ik het niet hebben, want ik denk dat er altijd een periode is die moeilijk ligt.
De manier waarop het gebeurd is, is geen goed voorbeeld. Het resultaat had kunnen zijn dat een hervorming op het vlak van de kinesitherapie nodig was en dat die hervorming middelen zou genereren, maar de manier waarop het hele proces verliep is een slecht voorbeeld.

I still have something from my heart. I will not stay there for long. It is regrettable that, like last year, at the very end of the sitting time, we have to harvest all kinds of witchtours in order to be able to finish our normal work. Normally it is our task — in addition to controlling the executive power — to be engaged in legislation throughout the year. We are always willing to do so, full of collegiality and constructivity, but if we only have one day to prepare a bill, we are still not working in an orderly way. Furthermore, the State Council has had to hurry to have the opportunity for four weeks to discuss, discuss and formulate the comments on the draft. They needed four weeks to do so, which — I can judge the design — is not exaggerated at all. We ourselves — the legislators — must do this in one day, including the opinion of the State Council, all texts and references to the legislation. As everyone knows, the legislation on health insurance and everything related to it is becoming more and more complex.
We also noticed this during the discussions. Not seldom additional information questions were asked in order to be able to understand the whole correctly and place it correctly. Their
I regret this in any case. We also hope that this has been the very last time — the legislature will not take so long anymore — and that the next bills will reach us at a more convenient time.
A second note about the design is that it also contains many powers to the King. Of course, one can say that it is a fairly technical legislation, with a lot of modalities to be regulated later, and that one can never expect that all this is regulated in the law. I also made this comment during the general discussion; you partially rejected it, Mr. Minister. Then I looked at it quietly. Fortunately, the report provides some clarification on a number of rules, but that binds us to nothing. The report only accompanies the texts of the draft, but can never be relevant in terms of intentions and future. How often should we not ask for an explanation in order to know what is required of us? You demand that we give a full authority by way of speech, so that the minister can elaborate the matter or the King can determine them. With regard to the broader intentions contained in the law, this becomes, of course, difficult, especially for the opposition, which must always be critical and vigilant. Their
Mr. Minister, this too — we have already exchanged thoughts on it — could be a sort of emanation of the increasing urge to centralize everything that on the budgetary level, i.e. revenue and expenditure, relates to health insurance, health care.
There seems to be a tendency to dirigism and centralism. Everything seems to be a lot more rigid. Thus, various types of committees are established, while the Minister is empowered to determine the detailed rules, even in relation to the composition of those committees. We hold our hearts for it!
This is a paradox, and we will ⁇ have to discuss this in the future. I explain myself more closely. On the one hand, there is now a very large budget in healthcare, with the pressure to further expand the budget still increasing. On the other hand, the Minister must be able to manage and control his budget. Of course, I understand that the needs are infinite and the resources end. Both reconciling and prioritizing — and thus making choices — is not an easy task. Of course, we follow that logical reasoning.
The question then arises how we will control one and the other. In my opinion, there are two models for this. One is that we try to make everyone as responsible as possible. You have already taken steps, Mr. Minister. The other is that we define responsibilities in a logical and consistent way. We are all facing the same task; we must make choices in view of the finite budget and we will consult with each other in a democratic way to come to a certain decision.
There is, of course, the pressure of the budget: the accounts must be blown. We have repeatedly pointed out the excess of the budget. You answered that you really needed to take over the expenses and that you needed instruments to detect excesses immediately via flashlights, after which recovery mechanisms take action, and so on.
My group has always supported you. If I were in your shoes, I would also find it necessary to have the tools to keep the finger on the wrist and to continuously track the income but ⁇ the spending so that the government is able to act immediately and take certain measures. Mr. Minister, it will not be easy in the future to find a balance between, on the one hand, the short-term policy – every year – to ensure that the package remains balanced and has sufficient resources, and, on the other hand, the pressure arising from the difficult process of accountability, consultation and democratization. The paradox is both trying to control.
Mr. Minister, with a knowledge center that centralizes and processes all data like a kind of large planning agency that maps everything and therefore also possesses all knowledge, you are at risk of the knowledge being found too much in an expert center and not being sufficiently tested by society, including in making choices. If you are the first to rely on the data of the Expert Center and on the opinions of the multi-party to define your policy, it is likely that you will be increasingly distracted from the choices that society wants to make and about which Parliament wants to have its voice. The paradox of controlling the spending of the health care facilities by, on the one hand, being able to quickly play the ball by having accurate data and profiles to detect aberrations and, on the other hand, the interpretation of the data is an important debate that will need to be conducted in the future.
I agree with this 100%.
But who does it ultimately? Who interprets that? Who makes the decisions? To what extent are they discussed and shared? How will this mechanism work? Let’s be honest, so far it has been mainly invested in one aspect, namely the collection of data, the ability to quickly play on the ball, the launch of flashlight systems and corrective mechanisms, the accurate monitoring of spending. I think you have done a meritorious job in this area. It is, of course, still a bit of coffee thickness, because it is much darker for us to see what system you want to build for the future to make the resulting decisions.
Chinese therapy is not a good example. The decision on kinesiotherapy has been taken quite dirigently. In the government statement in October 2001, you announced that you wanted to do something serious with the budget of kinesiotherapy, to which you would also link plans. By the end of February 2002, this reform had to be completed. In October, however, you already knew how much you would benefit from those reforms. Then we asked for it. You answered that you did not actually rely on anything, but that you are doing a simulation with certain results resulting. Afterwards, it turns out that you have a reform plan in your closet.
Then a kind of fake consultation begins. You should be careful with that, I think. The Chineseists are already first overwhelmed with the plans, to take or to let be. In addition, they are then placed on an impossible task. The professional groups are somewhat fragmented. They are not just that kind of work. They are not just about implementing reforms or thinking about policy work. You then give them two months of chance, with the hot breath of the ready-made plan in their neck, to try to get out of it. If they didn’t get out, you would decide for yourself. That has happened, despite everything and possibly despite all your good intentions. I have always found a reform in this area useful or meaningful. However, the way that the reform has been carried out has, to this day, brought about great chaos. For the sake of intellectual honesty, I don’t even want to use the press reports that some Chineseists are on the ground because of a large decline in clientele. I don’t want to talk about that, because I think there is always a difficult period.
The way it happened is not a good example. The result could have been that a reform in the field of kinesiotherapy was necessary and that that reform would generate resources, but the way the whole process went is a bad example.

And it is precisely thanks to this latter — an extensive practice — that general physicians gain experience, which leads them to raise the bar for themselves, to acquire even more knowledge and simply to be better. If one touches it, then, of course, one gets a different picture.
The measures relating to hospitals constitute the majority of the draft. In the speech, I would like to pay attention to two important points. De ziekenhuizen willen het probleem dan ook grondig aanpakken. Zij wensen niet te opteren voor het vragen van allerlei supplementen want dit creëert een drempel zelfs als men dit recupereert en zelfs als men met sociale categorieën werkt. Het principe is evenwel ongunstig omdat op men die manier steeds kan overgaan tot het vragen van supplementen als het vermoeden bestaat van een oneigenlijk gebruik in bepaalde situaties. Een supplement vragen voor de spoeddienst kan de weg openen voor supplementen voor andere diensten. Er zijn in een ziekenhuis nog heel wat diensten die worden geraadpleegd zonder dat de patiënt eerst naar de huisarts gaat, die veel te snel worden geraadpleegd wat dan leidt tot verspilling en oneigenlijk gebruik. Op dit vlak onderneemt men niets en dat is de oorzaak voor het ongenoegen bij de ziekenhuizen. De ziekenhuizen willen dat wordt geluisterd naar de echte problemen van onderfinanciering.
Ik herinner mij dat een zomer geleden een snoodaard voorspelde dat het budget van de sociale zekerheid een overschot zou vertonen. In volle vakantieperiode waren er verschillende van onze collega's die voorstellen deden om het bedrag op een bepaalde manier te besteden. Wij hebben toen ervoor gepleit om dit overschot te gebruiken om de onderfinanciering aan te passen. Dit is precies een jaar geleden. Ondertussen vonden reeds hoorzittingen plaats. Mijnheer de minister, er is evenwel sprake van een bijkomend probleem. Ik wil er mij niet gemakkelijk vanaf maken door het probleem met de nieuwe financiering in de ziekenhuizen aan te halen en te wijzen op de chaos die dit met zich heeft gebracht. Een dergelijke werkwijze lijkt mij te goedkoop. Tijdens de besprekingen van het desbetreffende wetsontwerp in de maand januari hebben wij reeds gewezen op de moeilijkheid van de implementatie in de ziekenhuizen. U heeft toen gezegd dat u zou trachten de maatregel van kracht te laten worden tegen 1 juli. Het siert u dat uw daadkracht u tot beslissingen aanzet.
Misschien hebt u het nog niet vernomen, al betwijfel ik dat, maar op dit moment verloopt dat allemaal zeer moeilijk in de ziekenhuizen. Het is bijna dramatisch. Men heeft meer dan honderd bladzijden technische richtlijnen gekregen een tweetal weken geleden. Men moet dat nu allemaal uitwerken, terwijl men nog met de huidige financieringstechniek bezig is. Men zou echter al moeten beginnen met de nieuwe financieringstechniek. Wij hebben onszelf wat uitstel gegeven voor bijvoorbeeld de recuperatie van de financiering van de pathologie en dit tot 2003, omdat u zelf meende dat het waarschijnlijk niet haalbaar zou zijn. Het wetsontwerp bevat het belangrijke artikel 11 over de pathologiefinanciering. Wij staan daar achter. Het is een goede zaak dat men op termijn een gelijke prijs voor een gelijke behandeling kan invoeren. Wij staan er ook achter dat men een duidelijk zicht heeft op wat men behandelt, hoeveel dit kost, voor welk soort patiënten, wat de gouden standaarden en richtlijnen zijn die zouden moeten worden gehanteerd. Wij steunen dit volledig. Dit concept voor ziekenhuizen is gericht op de toekomst, maar dan op voorwaarde dat ook het vrij initiatief en de concurrentie moeten kunnen blijven spelen en dat ook daar de kwaliteitsstimulus behouden kan blijven. Wij hebben wel wat zorgen rond een model van terugvordering waarbij een ziekenhuisbeheerder na datum zal moeten zien als de fameuze marge van 10% is overschreden, hoe dat kan worden gerecupereerd. De beheerder wordt daar uiteraard geconfronteerd met een moeilijk probleem en zal zijn artsen daarbij moeten betrekken. Ik herinner mij de vraag van de heer Mayeur wat men dan moet doen met artsen die al niet meer in dienst zijn. Hij heeft er ook op gewezen dat het moeilijker zal zijn om niet contractuele artsen met een zelfstandigenstatuut te doen terugbetalen dan artsen die contractueel aan een ziekenhuis verbonden zijn. Mijn fractie heeft geen probleem met een stevig adviesorgaan als de multipartite. Het is goed dat dit een orgaan is met gezag. Het zal echter beter moeten werken dan de huidige tripartite. De multipartite heeft mogelijkheden. De bevoegdheden worden ruimer. De kans is groot dat er in de toekomst beter kan gewerkt worden. De vertegenwoordiging moet zeer representatief zijn. Zo niet kan men geen goed overleg organiseren inzake ziekenhuizen. Mijn fractie heeft haar amendement aangehouden dat vraagt alle zetels voor alle banken status quo te houden en niet te verlagen zodat de vertegenwoordiging gewaarborgd is. Er zijn verschillende soorten ziekenhuizen, openbare en privé-ziekenhuizen, verschillende federaties en koepels. Iedereen moet zijn werk ten volle kunnen doen en vertegenwoordigd zijn. Ik herhaal dat CD&V geen probleem heeft met een goed adviesorgaan op voorwaarde dat het voldoende democratisch werkt en ruimte biedt aan iedereen.
Mijn laatste punt heeft betrekking op de financiering van de rusthuizen. Er wordt een nieuwe stap gezet inzake de budgetfinanciering van rusthuizen. Monsieur le président, je sais que je ne peux pas interroger M. Goutry du haut de cette tribune.
Monsieur Goutry, pour que nous puissions jouer à armes égales, nous pourrions peut-être avoir tout à l'heure une conversation au cours de laquelle vous m'éclaireriez sur votre formation d'origine et sur votre expérience professionnelle.
Monsieur le président, je reviens au projet qui nous est soumis aujourd'hui. Ce projet comporte deux grands volets importants, à mon sens: d'une part, les mesures visant le médecin généraliste et la pratique de cette médecine de première ligne dans notre pays; d'autre part, tout ce qui concerne la politique hospitalière.
Avant d'aborder ces deux sujets, vous me permettrez de revenir un moment sur la réforme de la kinésithérapie. Je sais que cette problématique ne fait pas l'objet du projet actuel mais M. Goutry en a longuement parlé et plusieurs interruptions de séance ont été consacrées à cet objet. Je me réjouis que des modifications puissent encore être apportées à cette réforme. C'est cela, l'esprit réformateur, permettez au président du groupe réformateur de le rappeler, l'esprit d'une réforme est évidemment une dynamique du changement. Pour imprimer une véritable dynamique du changement, il faut accepter qu'une réforme puisse être sans cesse remise sur le métier, afin d'améliorer et d'adapter régulièrement ce que l'on fait. Cette nécessité de réforme me semble évidente, notamment sur trois points: - la complexité administrative que peut rencontrer une profession; - la composition de la fameuse liste F qui fait l'objet d'une série de discussions importantes; l'adaptation de cette liste doit être une réalité; on ne peut pas une fois pour toutes considérer que cette liste est figée pour l'éternité, cela n'aurait aucun sens par rapport à l'évolution des pratiques médicales qui doit faire l'objet d'ajustements permanents; - la notion de ticket modérateur; je l'aborde parce que, à mon sens, cela concerne l'ensemble des prestations de soins de santé.
Si on a instauré les tickets modérateurs, c'est précisément parce que l'on voulait modérer les consommations et responsabiliser le patient. Cela s'inscrit donc dans une politique de la responsabilisation de ce dernier. Les tickets modérateurs doivent, selon moi, être perçus. Cette perception devrait d'ailleurs être mieux organisée, d'autant plus que nous possédons aujourd'hui un système du maximum à facturer qui permet d'éviter les effets délétères du ticket modérateur sur un plan social et par rapport aux patients les plus démunis. Et à partir du moment où l'on possède un tel système, il est d'autant plus normal que les tickets modérateurs fassent l'objet d'un meilleur contrôle de perception.
Voilà les quelques remarques que je voulais formuler sur ce sujet. Je vais aborder maintenant les deux thèmes majeurs de ce projet de loi.
Le premier a trait à la politique hospitalière. Je serai relativement bref à ce sujet.
On instaure donc les montants de référence concernant une série de prestations de santé qui sont effectuées dans le cadre de procédures standard. Ce nouveau concept vise utilement à supprimer des différences de pratique que l'on peut retrouver dans des procédures standard appliquées dans les hôpitaux de notre pays.
Cette mesure constitue, à mon avis, un premier instrument de maîtrise des coûts hospitaliers. Il faut savoir que ces coûts sont évidemment la source majeure des dépenses de l'assurancemaladie. Il est donc bon de se doter d'instruments efficaces en matière de maîtrise des coûts.
Les données disponibles devront apporter de la clarté, de la transparence ou niveau de la situation spécifique de chaque hôpital et devraient permettre la confrontation en termes d'activités avec la moyenne des hôpitaux de notre pays.
Il conviendra bien sûr que les mesures visent à sensibiliser, à éveiller un comportement qui soit davantage basé sur l'"evidence base medecine".
Une période d'expérimentation devrait toutefois être mise en place pour sensibiliser davantage les hôpitaux qui s'écartent de la référence et analyser les causes des écarts plutôt que de sanctionner immédiatement toute différence par rapport aux normes ou aux montants de référence. Je voudrais aussi vous signaler un acquis important de nos travaux en commission. En effet, un amendement a été introduit. Il instaure la notion de responsabilité partagée entre les gestionnaires d'hôpitaux et les médecins hospitaliers conformément au règlement visé dans la loi sur les hôpitaux. Il s'agit pour nous d'une clarification importante. Ces rapports entre les gestionnaires d'hôpitaux et les médecins hospitaliers sont un élément essentiel en vue de l'organisation d'une meilleure maîtrise des coûts hospitaliers sans que ni les uns ni les autres n'aient le sentiment d'être les victimes d'une position qui pourrait leur apparaître comme étant partisane.
J'espère que la commission Dillemans clôturera bientôt ses travaux et que le gouvernement pourra, très prochainement, se prononcer sur la clarification nécessaire des relations entre les médecins hospitaliers et les gestionnaires d'hôpitaux, notamment dans le cadre du fameux article 140 de la loi sur les hôpitaux qui devra être modifié.
En ce qui concerne le volet en rapport avec la médecine générale et les mesures qui sont établies afin de modifier certains éléments et de revaloriser la médecine générale, je voudrais dire d'emblée qu'il existe à l'heure actuelle, parmi les médecins généralistes, une démotivation. N'y voyez pas d'intérêt corporatiste, monsieur Goutry, puisque je ne pratique plus actuellement la médecine générale à temps plein même si j'y reste particulièrement attaché.
Cette démotivation procède certainement d'un niveau de rémunération peu valorisé, d'un statut social précaire — à l'instar des indépendants en général —, de conditions de travail de plus en plus exigeantes, d'une insécurité dans le travail mais aussi de l'incertitude quant à l'avenir de cette profession, ce qui est la question principale.
L'évolution de la médecine générale impose aux médecins généralistes une formation permanente sans cesse plus poussée et qui nécessite de plus en plus de temps. Si on ajoute à cela les obligations administratives auxquelles sont confrontés les médecins généralistes et qui deviennent proprement déraisonnables, on peut imaginer l'état d'esprit qui prévaut au sein de cette profession. Toutes ces obligations administratives de formation hypothèquent le temps consacré par le médecin aux patients — ce qui devrait rester évidemment le but principal — ainsi qu'à sa vie familiale. Le temps consacré à l'écoute et à l'examen du patient reste, à mon sens, nettement sous-évalué et sous-valorisé.
En tout état de cause, le médecin généraliste doit demeurer le pivot de l'organisation des soins ambulatoires et il importe de lui en donner les moyens.
Le présent projet instaure quatre mesures qui me semblent intéressantes et qui tendent à résoudre, pour partie seulement, les problèmes rencontrés en médecine générale.
La première mesure consiste à instaurer une bonification pour les médecins qui satisfont à certains critères de bonne pratique médicale. Cette bonification serait donc en partie intégrée dans le système de l'accréditation. Ces dispositions doivent cependant être appréhendées avec une certaine circonspection. Comme je l'ai dit en commission, il faut évidemment être attentif à ne pas créer un système qui mette en opposition l'intérêt financier propre du médecin et l'intérêt du patient. Comme je l'ai dit au ministre qui a bien voulu me donner des éléments d'apaisement à ce sujet, on ne peut pas mettre en concurrence l'intérêt du médecin et celui du patient en termes de qualité des soins. Les critères quantitatifs ne doivent pas interférer sur les critères qualitatifs. Et il me semble qu'en cette matière, la qualité des soins doit rester primordiale.
Cette bonification ne doit pas non plus être limitée aux médecins généralistes. Elle doit évidemment concerner également les médecins spécialistes. Il appartiendra à la commission médicomutualiste de prendre des mesures concrètes dans le cadre de cette bonification qui doit être applicable, non seulement aux médecins généralistes, mais aussi aux médecins spécialistes.
La seconde mesure concerne l'établissement d'un honoraire de disponibilité pour les gardes. Mon groupe marque sa satisfaction sur cette mesure qui est une vieille revendication. Elle est largement souhaitable et méritée. Je rappelle que les gardes de médecine générale sont en fait l'équivalent d'un véritable service public. Il est normal que le secteur public participe à la bonne organisation de ces gardes de médecine générale. La désaffection des médecins généralistes en ce qui concerne les gardes constitue un sérieux problème. Il indique la nécessité de prendre des mesures efficaces en la matière. La mobilisation des praticiens pendant de longues heures est peu compatible avec la vie privée. Il en résulte que de nombreux médecins généralistes ne souhaitent plus participer aux rôles de garde qui sont de moins en moins "rentables" sur le plan de l'organisation de la profession. Cet honoraire de disponibilité m'apparaît donc comme étant nécessaire.
Cet honoraire de disponibilité va redynamiser la motivation des médecins pour accepter la garde. Il reconnaît la valeur de la disponibilité du médecin généraliste. Il encouragera donc certainement le retour des médecins généralistes vers les services de garde ambulatoire. Cet élément va permettre de limiter le recours direct aux gardes hospitalières, ce qui est un réel problème en termes d'utilisation optimale des moyens financiers disponibles dans le cadre de l'assurance maladie-invalidité.
L'affluence aux urgences hospitalières ne s'explique pas seulement par les problèmes de disponibilité des gardes ambulatoires. Ce problème s'explique également par une recherche de gratuité et de facilité de la part de certains patients.
Par conséquent, l'honoraire qui sera demandé, dans certaines conditions, dans les services d'urgence hospitalière est un élément opportun, pour autant, bien entendu, qu'il n'hypothèque pas la qualité de la réception au niveau des services d'urgence et qu'il ne mette pas en péril les patients les plus démunis. A cet égard, les mesures ont été prises pour que des correctifs interviennent en cette matière.
En ce qui concerne les gardes et la possibilité pour le médecin généraliste de pratiquer le tiers payant pendant les gardes, il m'apparaît que cette mesure ne sera véritablement effective que le jour où l'on aura résolu le problème du renvoi des attestations de soins dans les organes mutuellistes. A l'heure actuelle, les médecins généralistes doivent, au lendemain d'une garde, et s'ils ont pratiqué le tiers payant, consacrer un certain temps à renvoyer les attestations de soins dans chacun des sièges des mutuelles et des organismes mutuellistes, alors qu'une centralisation du renvoi de ces attestations permettrait d'alléger cette tâche administrative, qui décourage assurément un certain nombre de médecins de s'engager dans cette pratique.
Une troisième mesure intéressante, à mon sens, consiste en une intervention financière pour l'utilisation de la télématique et pour la gestion électronique des dossiers médicaux. Il s'agit d'une avancée incontournable dans la pratique d'une médecine moderne. Espérons d'ailleurs que cette généralisation conduira à réduire de manière significative le travail administratif des médecins.
Dans le même esprit, l'instauration d'un honoraire aux médecins généralistes pour la gestion du dossier médical global et la revalorisation de cet honoraire constitue un élément intéressant. Il ne fait que concrétiser, via une base légale, une structure et une mesure existantes. Cependant, il est nécessaire de revaloriser cet honoraire concernant le dossier médical global pour lui donner un meilleur développement dans le cadre de la pratique de la médecine de première ligne. Il conviendrait d'ailleurs d'améliorer davantage l'information à l'égard du patient. En effet, je suis surpris de voir le grand nombre de patients qui ignorent encore la possibilité de s'inscrire dans le cadre d'un dossier médical global, alors que cette mesure existe déjà depuis un certain nombre d'années maintenant. Malgré tout, les efforts d'information doivent encore être renforcés en la matière.
Pour positives que soient toutes ces mesures, il n'en reste pas moins que la priorité en matière de revalorisation de la médecine générale ne me semble toujours pas largement rencontrée. La revalorisation de l'acte intellectuel reste sans doute encore nécessaire. Nous savons que les médecins généralistes français ont obtenu, dernièrement, une revalorisation très importante des honoraires pour les visites à domicile et consultations, portant celles-ci respectivement à 30 euros et 20 euros. Il me semble que cette revalorisation existe dans la plupart des pays européens et que la Belgique reste à la traîne, et ce même si les avancées en termes d'honoraires de disponibilité et d'honoraires de dossier médical global sont utiles et souhaitables. La revalorisation de l'acte intellectuel doit toutefois encore bénéficier de mesures constructives.
Je suis bien conscient qu'il n'est évidemment pas possible de revaloriser immédiatement, et en une fois, les actes intellectuels en médecine générale, ainsi qu'en médecine spécialisée. Mais je crois qu'on aurait tout à y gagner. En effet, la revalorisation de l'acte intellectuel, d'une part, renforcera la qualité de la médecine et, d'autre part, permettra de limiter le recours abusif à certains actes de médecine technique, qui ne sont parfois rendus nécessaires que par rapport à l'insuffisance de moyens mis à disposition de la pratique des actes intellectuels.
Je crois vraiment que financièrement, l'assurance-maladie aurait avantage à s'orienter vers une plus grande revalorisation de l'acte intellectuel. C'est la raison pour laquelle je lance un appel au gouvernement pour qu'une programmation de cette revalorisation soit effectivement mise en place dans un proche avenir et que l'on puisse donner un signal extrêmement important aux médecins en matière de revalorisation de l'acte intellectuel, qui entraînerait une remotivation de la profession tout en indiquant la volonté du gouvernement de s'orienter vers une meilleure qualité de la médecine.

I would like to return to the proposal presented to us today. This project has two major important aspects, in my opinion: on the one hand, the measures aimed at the general physician and the practice of this first-line medicine in our country; on the other hand, everything related to hospital policy.
Before addressing these two topics, you will allow me to return a moment to the reform of the kinesiotherapy. I know that this problem is not the subject of the current project but Mr. Goutry spoke long about it and several session interruptions were devoted to this subject. I look forward to making further changes to this reform. That is, the reformist spirit, let the chairman of the reformist group recall it, the spirit of a reform is obviously a dynamic of change. To print a true dynamic of change, it is necessary to accept that a reform can be continually brought back on the business, in order to improve and adapt regularly what is done. This need for reform seems to me obvious, especially on three points: - the administrative complexity that a profession can encounter; - the composition of the famous list F which is the subject of a series of important discussions; the adaptation of this list must be a reality; one cannot once and for all consider that this list is fixed for eternity, it would have no sense in relation to the evolution of medical practices that must be subject to permanent adjustments; - the notion of ticket moderator; I address it because, in my opinion, this concerns the whole of health care services.
If we introduced moderator tickets, it was precisely because we wanted to moderate consumption and empower the patient. This is part of a policy of accountability of the latter. Moderators should be noticed. This perception should also be better organized, especially since we now have a system of the maximum to be charged that allows to avoid the harmful effects of the moderator ticket on a social level and in relation to the most impoverished patients. And from the moment that one has such a system, it is all the more normal that moderator tickets are subject to better perception control.
These are the few comments I wanted to make on this subject. I will now address the two main themes of this bill.
The first concerns the hospital policy. I will be relatively brief on this subject. by
Therefore, reference amounts are introduced for a series of health benefits that are provided under standard procedures. This new concept is useful for removing practical differences that can be found in standard procedures applied in our country’s hospitals. by
This measure is, in my opinion, a first tool for controlling hospital costs. It should be noted that these costs are obviously the main source of insurance expenses. Therefore, it is good to have effective tools in terms of cost control.

However, a trial period should be established to raise awareness among hospitals that deviate from the benchmark and to analyze the causes of the deviations rather than immediately sanctioning any deviation from the standards or reference amounts. I would also like to point out a significant achievement of our work in commission. An amendment has been introduced. It introduces the notion of shared responsibility between hospital managers and hospital doctors in accordance with the regulations referred to in the Hospital Act. This is an important clarification for us. These relationships between hospital managers and hospital doctors are an essential element in order to organize a better control of hospital costs without neither of them having the feeling of being the victims of a position that might appear to them as partisan. by
I hope that the Dillemans Committee will soon conclude its work and that the government will be able, very soon, to make a decision on the necessary clarification of the relations between hospital doctors and hospital managers, in particular within the framework of the famous article 140 of the law on hospitals that must be amended.
Regarding the aspect relating to general medicine and the measures that are established in order to modify certain elements and revaluate general medicine, I would like to say from the outset that there is at present, among general physicians, a dismotivation. If one adds to this the administrative obligations facing general physicians, which become inherently unreasonable, one can imagine the state of mind that prevails within this profession. All these administrative training obligations hypothesize the time spent by the doctor on patients — which should obviously remain the primary goal — as well as on his family life. The time spent listening and examining the patient remains, in my opinion, markedly undervalued and undervalued. by

This benefit should not be limited to general practitioners. It should also apply to specialized doctors. It will be up to the Medicomutualist Commission to take concrete measures within the framework of this bonification, which must be applicable, not only to general physicians, but also to specialized physicians.
The second measure concerns the establishment of a availability fee for guards. My group is pleased with this measure, which is an old claim. It is highly desirable and deserved. I would like to remind you that the general medical guard is actually the equivalent of a real public service. It is normal that the public sector participates in the proper organization of these general medical guards. The dissatisfaction of general physicians with regard to the guards is a serious problem. It emphasizes the need to take effective measures in this regard. The mobilization of practitioners for long hours is incompatible with privacy. As a result, many general practitioners no longer wish to participate in the care roles that are less and less "profitable" in terms of the organization of the profession. This fee of availability seems to me to be necessary.
This availability fee will revive the motivation of doctors to accept custody. He recognizes the value of the availability of the general physician. It will therefore ⁇ encourage the return of general doctors to the outpatient care services. This element will allow to limit the direct recourse to hospital guards, which is a real problem in terms of optimum use of the financial resources available within the framework of health-invalidity insurance. by
The affluence to hospital emergencies is not only explained by problems with the availability of outpatient guards. This problem is also explained by the search for freedom and ease by some patients.
Therefore, the fee that will be requested, under certain conditions, in hospital emergency services is an appropriate element, provided, of course, that it does not mortgage the quality of reception at the level of emergency services and that it does not endanger the most disadvantaged patients. In this regard, measures have been taken to make corrections in this matter.
Regarding the guards and the possibility for the general physician to practice the third-party paying during the guards, it seems to me that this measure will be truly effective only on the day when the problem of returning the certificates of care to the mutual organs has been resolved. At present, general physicians must, the day after a guard, and if they have practiced the paying third party, devote some time to send back the certificates of care to each of the headquarters of mutual and mutual organizations, while a centralization of the return of these certificates would allow to ease this administrative task, which ⁇ discourages a certain number of physicians from engaging in this practice.
A third interesting measure, in my opinion, is a financial intervention for the use of telematics and for the electronic management of medical records. This is an inevitable breakthrough in the practice of modern medicine. Hopefully, this generalization will lead to a significant reduction in the administrative work of doctors. by
In the same spirit, the introduction of an honorary to general physicians for the management of the overall medical record and the revaluation of this honorary is an interesting element. It merely concretizes, through a legal basis, an existing structure and measure. However, it is necessary to revaluate this fee regarding the overall medical record to give it a better development as part of the practice of front-line medicine. Furthermore, information about the patient should be improved. Indeed, I am surprised to see the large number of patients who still ignore the possibility of registering as part of a comprehensive medical record, while this measure has already existed for a number of years now. Nevertheless, information efforts in this area need to be further strengthened.
As positive as all these measures may be, the priority in terms of revaluation of general medicine still seems to me not widely met. The revalorization of the intellectual act is probably still necessary. We know that French generalists have recently obtained a very significant revaluation of the fees for home visits and consultations, raising these to 30 euros and 20 euros, respectively. It seems to me that this revaluation exists in most European countries and that Belgium remains behind, even though advances in terms of availability fees and overall medical record fees are useful and desirable. However, the revaluation of the intellectual act must still benefit from constructive measures. by
I am well aware that it is obviously not possible to revaluate immediately, and at once, the intellectual acts in general medicine, as well as in specialized medicine. But I think we have everything to win. Indeed, the revaluation of the intellectual act, on the one hand, will strengthen the quality of medicine and, on the other hand, will allow to limit the abuse of certain acts of technical medicine, which are sometimes made necessary only in relation to the insufficient means available to the practice of intellectual acts. by
I truly believe that financially, health insurance would have an advantage in orienting itself towards a greater revaluation of the intellectual act. That is why I call on the government to effectively program this revaluation in the near future and to give a very important signal to doctors in terms of revaluation of the intellectual act, which would lead to a removal of the profession while indicating the government’s willingness to orient itself towards a better quality of medicine.

Mijnheer de voorzitter, mijnheer de minister, mevrouw de minister, collega's, elk individu heeft volgens de Grondwet recht op gepaste gezondheidszorgen. Die gezondheidszorgen hebben echter een prijs. Door de vergrijzing van de bevolking, de technologische vooruitgang en de hogere eisen van de consument — de patiënt dus — stijgen die kosten zeer snel en wordt het steeds moeilijker om binnen het voorziene budget de zorgverlening voor iedereen toegankelijk te houden. In het voorliggende wetsontwerp zit een aantal positieve aanzetten tot het oplossen van enkele pijnpunten die ik even kort wil toelichten.
Het is essentieel dat de juiste zorg op de juiste plaats wordt verleend. Wij juichen dan ook elke stap tot herwaardering van de eerstelijnszorgverlening toe waarbij de huisarts de centrale figuur is. Wij juichen toe dat de huisartsenkringen erkend worden, dat het honorarium van het globaal medisch dossier wettelijk geregeld wordt en dat er een beschikbaarheidshonorarium wordt ingevoerd voor huisartsen die een georganiseerde wachtdienst verzekeren. Die nieuwe vergoeding zou een gedeeltelijke oplossing moeten bieden voor het soms verkeerde gebruik van de spoedgevallendienst. Wanneer er nu bij problemen geen huisarts beschikbaar is, richten patiënten zich immers tot de spoedgevallendienst zonder dat er sprake is van een medische urgentie.
Ook in de akkoorden tussen artsen en ziekenfondsen worden de huisartsen meer gewaardeerd. Bij beslissingen die specifiek met hen te maken hebben, moet de meerderheid immers minstens voor de helft uit algemeen geneeskundigen bestaan.
Voor de financiering van de ziekenhuizen wordt het principe van de referentiebedragen ingevoerd als middel om een aantal zaken bij te sturen. De nationaal gemiddelde kostprijs — verhoogd met 10% — van de standaardverrichtingen bij een geselecteerde groep pathologieën, zal via de website van het ministerie kenbaar worden gemaakt. Wanneer ziekenhuizen dat referentiebedrag met 10% overschrijden voor meer dan de helft van hun pathologiegroepen, zal dat bedrag teruggevorderd worden.
Wij kunnen een dergelijke maatregel zeker steunen. Er is echter een marge van 20% in de overschrijding van het nationaal gemiddelde en dit op meer dan de helft van de pathologiegroepen vooraleer er wordt gesanctioneerd. Is dat niet wat ruim? Eveneens positief is het inschrijven in de GVU-wet van diëtisten en podologen voor specifieke zorgen bij diabetici. Jaarlijks worden immers 1.600 amputaties uitgevoerd waarvan, mits een betere preventie, een groot aantal kan worden vermeden.
Ik wil toch ook een negatieve opmerking maken. Gezien de evolutie in de ROB- en RVT-instellingen waar steeds meer zwaar zorgbehoevende bejaarden worden opgenomen, blijft die sector ondergefinancierd. De regering moet daarmee in de komende begrotingsbespreking terdege rekening houden en de middelen voor de reële zorgkosten op basis van de graad van zorgafhankelijkheid optrekken.
Als het beleid terecht ons degelijk systeem van gezondheidszorg wil behouden, moeten de kosten ervan worden beheerst zonder afbreuk te doen aan de kwaliteit en de toegankelijkheid. Daarvoor is bewustmaking en responsabilisering van zowel de zorgvrager als de zorgverlener noodzakelijk. Arts en patiënt moeten zich bewust zijn van de kostprijs van de zorgverlening. Dit wetsontwerp zet daarvoor de eerste, maar nog voorzichtige stappen.
Agalev en Ecolo zullen dit ontwerp steunen, maar wensen in de toekomst nog verder te zoeken. Vorig jaar kwam er in Vlaanderen bijvoorbeeld bij de jaarlijkse selectieve ophaling 316.258 kilogram of meer dan 300 ton oude en vervallen geneesmiddelen bij Ovam terecht. Dat cijfer geldt alleen voor Vlaanderen. Zeker wat de geneesmiddelenconsumptie betreft, zullen dus nog concrete stappen moeten worden gezet.
Elke hervorming die financieel raakt aan de een of de andere groep, zal door die groep nooit op gejuich worden onthaald. Om een goed beleid te voeren, moet men echter de moed hebben om in overleg en met kennis bij te sturen waar het nodig is.

Mr. Speaker, Mr. Minister, Mrs. Minister, colleagues, every individual has the right to adequate health care according to the Constitution. However, these health benefits have a price. As a result of the ageing population, technological advances and the higher demands of the consumer – the patient – those costs are rising very rapidly and it is becoming increasingly difficult to keep health care accessible to all within the budget provided. In the present bill there are a number of positive incentives to resolve some pain points that I would like to briefly explain.
It is essential that the right care is provided in the right place. We therefore welcome every step towards the revaluation of primary care, where the primary physician is the central figure. We welcome the recognition of general medical circles, the legal regulation of the fees of the global medical dossier and the introduction of a availability fee for general physicians providing an organized waiting service. That new fee should provide a partial solution to the sometimes misused use of emergency services. After all, when there is no general doctor available for problems, patients turn to the emergency services without medical urgency.
Also in the agreements between doctors and hospital funds, the family doctors are appreciated more. In decisions that are specifically concerned with them, the majority must consist of at least half general practitioners.
For the financing of hospitals, the principle of reference amounts is introduced as a means of updating a number of matters. The national average cost price — increased by 10 % — of the standard operations for a selected group of pathologies will be made known via the Ministry’s website. If hospitals exceed that reference amount by 10% for more than half of their pathology groups, that amount will be recovered.
We can ⁇ support such a measure. However, there is a margin of 20% in exceeding the national average and this in more than half of the pathology groups before sanctioning. Isn’t that a little spacious? Similarly positive is the entry into the GVU law of dieticians and podologists for specific concerns in diabetics. 1,600 amputations are performed annually, many of which can be avoided if better prevented.
I would also like to make a negative comment. Given the evolution in the ROB and RVT institutions, where an increasing number of heavily caring elderly persons are being accommodated, this sector remains underfunded. The Government must take due account of this in the upcoming budget discussion and increase the resources for the real costs of care based on the degree of dependence on care.
If the policy is rightly intended to maintain our sound health care system, its costs must be controlled without compromising quality and accessibility. This requires awareness and responsibility of both the caregiver and the caregiver. The doctor and the patient should be aware of the cost of health care. This draft legislation sets the first but cautious steps for this.
Agalev and Ecolo will support this design, but wish to look even further in the future. Last year, for example, in Flanders, in the annual selective collection of 316.258 kilograms or more than 300 tons of old and decayed medicines at Ovam. This number applies only to Flanders. Especially with regard to drug consumption, concrete steps will therefore need to be taken.
Any reform that affects financially one or another group will never be welcomed by that group. However, in order to conduct a good policy, one must have the courage to assist in consultation and with knowledge where it is needed.

Monsieur le président, monsieur le ministre, chers collègues, le groupe PS se réjouit des dispositions prévues dans ce projet de loi. Je voudrais simplement apporter quelques précisions quant aux positions que nous voulons défendre.
Un des points importants concerne la revalorisation du rôle de la médecine générale qui implique, pour notre groupe, une certaine réorientation des flux financiers vers les soins de première ligne, le renforcement de ces structures ainsi qu'une nouvelle délimitation du "pouvoir" entre les différentes lignes de soins. Cela ne peut signifier en aucun cas le démantèlement des réseaux hospitaliers ou la limitation artificielle des recours utiles à la médecine spécialisée et aux technologies médicales. Il ne s'agit évidemment pas de faire de la médecine au rabais mais de la médecine complémentaire, avec une bonne complémentarité dans l'intérêt du patient.
Le chapitre consacré à la médecine générale, concrétisation de certaines initiatives inspirées du rapport du Docteur Vandemeulebroeck, rencontre donc globalement nos préoccupations.
On constate d'ailleurs une série de rémunérations nouvelles pour les médecins généralistes: bonification pour ceux qui satisfont à des critères qualitatifs et quantitatifs de pratique médicale, honoraires de disponibilité pour les gardes, intervention pour l'utilisation de la télématique et pour la gestion électronique des dossiers médicaux. Il faut toutefois signaler que la qualité finale des changements escomptés ne dépendra pas seulement des budgets alloués mais aussi du degré de mobilisation sur le terrain. Pour nous, ce dernier aspect est primordial. Il faut une adhésion, notamment des médecins généralistes, à tous ces dispositifs pour les faire fonctionner.
L'instauration du dossier médical général peut également être qualifiée de succès pour ce qui est de son développement quantitatif. Son renforcement — notamment l'élargissement à toute la population, une meilleure rémunération, un ticket modérateur réduit chez le médecin qui tient le dossier — est, à notre sens, la voie à privilégier en priorité non pas dans un objectif de rationalisation, ce qui n'est d'ailleurs nullement corroboré au stade actuel des évaluations, mais afin d'assurer la continuité des soins et le rôle central du généraliste. Le dossier médical général doit être l'instrument privilégié de communication et de collaboration entre les différents échelons.
La mise en place d'un cadre légal permettant d'octroyer des bonifications aux médecins qui satisfont à des critères qualitatifs et quantitatifs de pratique médicale nécessitera à mon avis des explications détaillées sur le terrain.
Je crois que l'information devra, à ce sujet, être la plus large. A l'inverse de ce qui était prévu dans l'exposé des motifs, le texte de l'article 3 initial ne prévoyait pas que le Conseil national pour la promotion de la qualité sera l'organe compétent pour fixer les paramètres. La commission et le ministre ont accepté un amendement à ce sujet et je les remercie.
Les honoraires de disponibilité sont importants pour les gardes et sont directement liés à la problématique du recours aux services d'urgence hospitaliers. J'aborderai donc ces deux questions ensemble.
L'exposé des motifs suggère une réglementation qui aborde globalement la problématique: services de garde en médecine générale, services d'urgences dans les hôpitaux, responsabilisation des patients et des médecins. Il faut s'inscrire dans cette voie globale. Si l'on constate sur le terrain qu'une partie croissante des activités des services d'urgences dans les hôpitaux sont des activités de dispensaire — une expérience ponctuelle faite dans un hôpital à Bruxelles a montré qu'effectivement une majorité des consultations aux urgences relevait de la médecine générale —, on ne peut pas dire, malgré ces analyses sporadiques, qu'il existe à ce jour une étude sérieuse permettant de quantifier avec précision le problème et ses multiples origines.
En commission, le ministre a pris l'exemple de l'Angleterre et l'a comparé. La constatation en est que c'est un phénomène européen. Cela étant dit, cela ne nous permet pas d'analyser le modèle anglais avec la situation en Angleterre pour la calquer sur la situation belge. Un simple exemple: les files d'attente existent en Angleterre alors qu'elles n'existent pas encore en Belgique. C'est sans doute un des paramètres inexistants chez nous mais qui pourrait expliquer un tel recours aux urgences en Angleterre.
Il y a donc plusieurs paramètres. Il faut probablement aussi intégrer le fait que des patients précarisés ne disposent généralement pas d'alternative à un prix comparable. Lorsqu'elles existent, les patients précarisés ne connaissent pas nécessairement leur existence ou sont mal informés à propos de l'accoutumance culturelle à la consommation des urgences hospitalières. C'est donc un paramètre important dans les grandes villes qui devrait être intégré dans notre analyse.
Sans mesure d'accompagnement, la cotisation forfaitaire, qui peut être envisagée pour les recours dits injustifiés ou abusifs, pénalisera incontestablement les populations les plus défavorisées, celles qui, précisément, sont les plus écartées sur le plan culturel et social du recours à bon escient aux différents échelons de la médecine.
Là aussi, et j'en remercie la commission et le ministre, l'amendement que j'avais déposé visant à intégrer à la facture maximale le coût éventuel qui serait porté à charge du patient lors d'une consultation aux urgences, est un correctif social important.
Ce correctif social me semble important. Il est en outre non négligeable que la commission et le gouvernement aient accepté cet amendement, car ce correctif social vient compenser le fait que des gens ont recours aux urgences pour des raisons sociales.
Ce projet de loi établit clairement qu'aucune contribution ne pourra être demandée aux patients pour le recours aux urgences. Et ceux qui le font aujourd'hui, comme par exemple le VVI, devront garder cela à l'esprit. La réponse du ministre à ce sujet était claire. Elle l'était déjà à l'issue des questions posées en séance plénière à ce sujet. Il est important que cela ait pu être rappelé en commission, notamment au regard des dispositions que nous avons prises dans ce projet de loi.

One of the important points concerns the revaluation of the role of general medicine which implies, for our group, a certain reorientation of the financial flows towards the first-line care, the strengthening of these structures as well as a new delimitation of the “power” between the different lines of care. This cannot under any circumstances mean the dismantling of hospital networks or the artificial limitation of useful resources to specialized medicine and medical technologies. It is obviously not about making medicines at a discount but complementary medicine, with good complementarity in the interest of the patient.
The chapter dedicated to general medicine, concretization of some initiatives inspired by the report of Dr. Vandemeulebroeck, thus meets our concerns overall.
There are also a number of new remunerations for general practitioners: bonuses for those who meet qualitative and quantitative criteria of medical practice, availability fees for guards, intervention for the use of telematics and for the electronic management of medical records. However, it should be noted that the final quality of the expected changes will depend not only on allocated budgets but also on the degree of mobilization on the ground. For us, this latter aspect is primary. There is a need for membership, including general doctors, to all these devices to make them work.
The establishment of the general medical record can also be qualified as a success in terms of its quantitative development. Its strengthening — notably the expansion to the entire population, a better remuneration, a reduced moderator ticket with the doctor who holds the dossier — is, in our sense, the way to prioritize as a priority not in an objective of rationalization, which is by no means corroborated at the current stage of evaluations, but in order to ensure the continuity of care and the central role of the generalist. The general medical record must be the preferred instrument of communication and collaboration between the different levels.
The establishment of a legal framework for granting bonuses to physicians who meet qualitative and quantitative criteria of medical practice will, in my opinion, require detailed explanations on the ground. by
I believe that information on this subject should be the broadest. Contrary to what was envisaged in the statement of reasons, the text of the original Article 3 did not provide that the National Council for the Promotion of Quality would be the competent body to fix the parameters. The Committee and the Minister accepted an amendment on this subject and I thank them.
Availability fees are important for guards and are directly related to the problem of using hospital emergency services. I will address these two issues together.
The exposition of reasons suggests a regulation that addresses the problem globally: care services in general medicine, emergency services in hospitals, patient and physician accountability. We need to join in this global path. If one finds on the ground that an increasing part of the activities of emergency services in hospitals are dispensary activities — a one-off experience in a hospital in Brussels has shown that indeed a majority of emergency consultations belonged to general medicine — one cannot say, despite these sporadic analyses, that there is to date a serious study that can accurately quantify the problem and its multiple origins.
In a committee, the minister took the example of England and compared it. The conclusion is that this is a European phenomenon. That being said, this does not allow us to analyze the English model with the situation in England to lay it on the Belgian situation. A simple example: waiting rows exist in England while they do not yet exist in Belgium. This is ⁇ one of the parameters that do not exist in our country, but which could explain such a recourse to emergencies in England.
There are several parameters. It may also be necessary to include the fact that precarious patients generally do not have an alternative to a comparable price. When they exist, precarious patients do not necessarily know about their existence or are poorly informed about the cultural habit of consuming hospital emergencies. It is therefore an important parameter in large cities that should be integrated into our analysis.
Without an accompanying measure, the flat-rate contribution, which can be considered for so-called unjustified or abusive appeals, will undoubtedly penalize the most disadvantaged populations, those who, precisely, are the most culturally and socially detached from the wise use of the different levels of medicine.
There too, and I thank the commission and the minister, the amendment I had submitted to include in the maximum invoice the possible cost that would be borne by the patient during an emergency consultation, is an important social correction. by

Monsieur le président, je connais l'argumentaire et je suis d'accord, comme d'autres mais comme tout le monde peut l'être y compris le gouvernement. Nous souffrons d'un sous-financement structurel de la pratique médicale. Il faut réfléchir à la façon d'obtenir un meilleur financement de ce secteur. Le mauvais signal donné par le VVI est de proposer que ce soit le patient qui compense ce sous-financement structurel que tout le monde reconnaît et qui implique une restructuration de l'ensemble de ce secteur des soins de santé. Je le répète, c'est un très mauvais signal politique de faire peser ce déficit de financement structurel sur les patients. J'estime qu'il est fort heureux que le gouvernement et la majorité ne s'orientent pas dans cette voie. Le VVI commet une erreur politique et c'est regrettable.
Je suis par contre très heureux que la majorité et le gouvernement aient décidé de réfléchir à une restructuration de l'ensemble de ce secteur, de faire participer les médecins généralistes aux rôles de garde, avec des honoraires payés, pour restructurer ce domaine, de ne pas faire peser la charge sur le patient et si l'on décide d'une contribution, d'ajouter un correctif social en permettant aux plus démunis d'introduire ce coût dans la facture maximale. Je crois que c'est une approche toute différente que le signal politique donné par le VVI en demandant 25 euros par patient. Il aurait peut-être fallu réfléchir à deux fois avant de faire une telle proposition.
Je voudrais revenir sur la problématique des urgences et notamment des économies décidées, à savoir 320 millions dans le B1 et le B2 pour les recours injustifiés et indus aux urgences. M. le ministre a répondu qu'il n'existait pas d'analyse scientifique sur le recours abusif aux urgences, bien qu'on dispose d'un certain nombre de paramètres. J'ai demandé à la ministre de la Santé, Mme Aelvoet, si nous avions une cartographie des gardes alternatives en dehors de l'hôpital. Nous ne disposons pas non plus de cet élément. Je n'incrimine pas le gouvernement; il y a probablement toutes sortes d'explications à cette lacune.
Il faut cependant reconnaître que c'est ennuyeux de faire des économies dans ce secteur, économies basées sur un usage indu des urgences, quand on n'a pas la capacité de justifier scientifiquement la réalité de ces usages indus. Il y a un usage indu, et nous le savons, lié à la situation sociale. Certains croient que le recours à l'urgence est gratuit, alors qu'à la polyclinique ou à la consultation, ils doivent payer. C'est évidemment un des problèmes importants. Il y a aussi, c'est vrai, la consommation des urgences par le cadre stressé qui n'a pas envie de faire la file et préfère aller se faire soigner rapidement et en urgence dans les hôpitaux.
Cela est inadmissible, évidemment, mais c'est un phénomène de société. Comme on mange vite — une "malbouffe" d'ailleurs mais enfin, on la mange vite —, certains pensent que se soigner vite fait partie d'un mode de vie qu'ils doivent intégrer. Je pense que ce n'est pas une bonne chose et cela doit être sanctionné, mais il ne faut pas sanctionner l'ensemble du système. Je suis d'ailleurs intéressé par le fait que le ministre ait répondu en commission qu'il fallait effectivement réfléchir à l'ensemble de cette problématique.
Enfin, je voudrais intervenir sur le problème des montants de référence qui devraient, selon l'exposé des motifs, selon le projet de loi, atténuer les différences de pratiques dans les hôpitaux. Ceci permettra, toujours selon le projet, d'abandonner le système de récupération linéaire qui est appliqué aujourd'hui et où il n'est pas tenu compte des indicateurs de performance. Si on saisit bien le mécanisme mis en place ici, l'écart de plus de dix pour cent — et on a reçu les tableaux avec l`équation proposée par le gouvernement — s'imputera sur les honoraires portés en compte à l'assurance. On peut évidemment souscrire à ce dispositif pour autant qu'il n'entraîne pas des sélectivités tant au niveau des pathologies qu'au niveau des patients. Ce serait bien entendu inacceptable.
La question qui se pose pour nous, je l'ai posée en commission et je la répète ici, en apportant ma réponse. Comment va-t-on faire lorsque les médecins sont statutaires ou salariés? La solution est actuellement impraticable dans les hôpitaux. Je vais donner un élément de réponse. Il suffirait qu'on accepte dans la loi sur les hôpitaux l'existence d'hôpitaux publics ou d'hôpitaux académiques qui engagent du personnel salarié, que cela soit reconnu comme tel. Je pense qu'on permettra alors d'avoir un traitement différencié entre les hôpitaux privés et les hôpitaux publics ou à personnel salarié parce que la relation entre le gestionnaire et le médecin ne peut pas, bien entendu, être la même. Naturellement, la relation est différente.
Enfin, la technique des gratte-ciels qu'on publiera sur le site internet, c'est évidemment stigmatisant pour l'hôpital concerné. Mais enfin, si c'est une mauvaise pratique, il faut évidemment la dénoncer. Je trouve important que les hôpitaux concernés aient la possibilité de faire valoir leur point de vue. Une précision à ce sujet a été apportée au projet. Il faut que la référence soit aussi publiée sur le site, sinon on ne comprendrait pas de quoi il s'agit quand on veut faire des comparaisons.
Je termine par deux points. Nous souscrivons bien entendu au principe de la création d'une commission financière au sein de chaque hôpital. Je pense que dans la relation entre les gestionnaires et les médecins, il faut qu'on aboutisse à un véritable dialogue qui permette une meilleure gestion de l'hôpital, une meilleure gestion des coûts financiers et des pratiques médicales. Je pense que cette technique est indispensable dans ces entreprises que les hôpitaux sont devenus aujourd'hui. Le dialogue entre le corps médical et le gestionnaire doit se faire. S'il ne se fait pas, c'est bien entendu au détriment du financement, donc au détriment de la situation du patient. C'est une bonne chose de le forcer par la loi. Les travaux de la task force ont mis en évidence ce manque de confiance entre les gestionnaires hospitaliers et les médecins. Il faut rétablir cette confiance. La forcer par la loi n'est donc en l'occurrence pas une mauvaise chose.
Pour conclure, je dirai que nous sommes évidemment très satisfaits sur un dernier point, qui concerne le principe de la croissance annuelle des frais d'administration des organismes assureurs ainsi que la partie variable de ces frais d'administration qui sera exprimée en un pourcentage fixe à partir de 2004. Nous sommes satisfaits parce que désormais les règles seront transparentes et le poids de la responsabilité financière des mutualités sur la qualité de leur travail augmente. C'est évidemment important et nous nous en félicitons, comme de l'ensemble de ce projet de loi. Je vous remercie.

I think this is a completely different approach than the political signal given by the VVI asking for 25 euros per patient. You might have thought twice before making such a proposal.
I would like to return to the problem of emergencies and especially decided savings, namely 320 million in B1 and B2 for unjustified and emergency-induced appeals. by Mr. The Minister replied that there is no scientific analysis of the abuse of emergency services, although there are a number of parameters available. However, it must be acknowledged that it is boring to make savings in this sector, savings based on improper use of emergencies, when one does not have the ability to scientifically justify the reality of these improper uses. There is an undue use, and we know it, related to the social situation. Some believe that emergency treatment is free, while at the polyclinic or consultation, they have to pay. This is obviously one of the major problems. There is also, it is true, the consumption of emergencies by the stressed framework that does not want to go in line and prefers to go to get treated quickly and urgently in hospitals.
This is unacceptable, of course, but it is a social phenomenon. Mijnheer de voorzitter, collega's, het optimaal aanwenden van het budget in de gezondheidszorg is altijd het streefdoel van onze partij geweest. Wij hebben steeds de output van een beleidsmaatregel in termen van gezondheidswinst voor de individuele patiënt als leidraad genomen. Wij hebben ook steeds de prijs voor ogen gehouden.
Mijnheer de minister, mevrouw de minister, ik ben ervan overtuigd dat wij met deze wet een aantal stappen zetten om daadwerkelijk met gezondheidsdoelen te werken. De wet reikt een aantal instrumenten aan. De gezondheidsdoelen staan weliswaar nog steeds niet voorop. Nog steeds tekenen budgettaire doelstellingen een aantal beleidsmaatregelen.
Bij deze algemene bespreking zou ik nog even willen stilstaan bij artikel 10, waarover wij in de commissie niet uitdrukkelijk hebben gesproken, dat de Koning machtigt tot het nemen van beslissingen over dialyse. Mijnheer de minister, mevrouw de minister, er is inderdaad overleg, er is een tripartiete werkgroep, er zou een consensus bereikt worden. Jammer genoeg beperkt de regering zich echter tot de overeenkomst die zal worden bereikt in de overeenkomstige commissie Ziekenhuizen en Ziekenfondsen. Hoewel de artsen uiteraard ook mee aan tafel hebben gezeten, worden zij niet bij het overleg betrokken vóór het regelen van de zaak door de Koning. Ik zou de minister opnieuw willen vragen of de artsen zullen worden betrokken bij het overleg. Zij mogen toch niet over het hoofd worden gezien. In de gezondheidszorg en de dialyse hebben zij immers samen met de andere partijen het verhaal toch volgens de richtlijnen praktisch op poten gezet. Als er één groep bestaat waar heel degelijk overleg heeft plaatsgevonden, is het de groep van de artsen. Ik richt mij nu vooral tot de minister van Volksgezondheid omdat die commissie zich op dat departement daarmee heeft beziggehouden. Hoe komt het dan dat de artsen niet in het ontwerp worden vermeld? Vervolgens kom ik tot artikel 11 van het wetsontwerp dat een trendbreuk betekent voor het ziekenhuisbeleid. Inderdaad, vanaf nu zullen voor een aantal geneeskundige verstrekkingen die bij standaardprocedures worden uitgevoerd, effectief referentiebedragen worden ingevoerd. Onze partij kan zich daarmee volledig verzoenen. Dit is een effectieve trendbreuk en zoals de heer Nothomb zegde: "On arrive plus vite en marchant lentement". Ik denk inderdaad dat het invoeren van referentiebedragen met een goede afbakening van de desbetreffende pathologieën, op termijn kan leiden tot een rationele toekenning van de middelen.
Ook met de oprichting van de multipartiete structuur en de aanzet naar responsabilisering is onze partij het volkomen eens. Wij houden uiteraard niet van conflicten en ook in dit ontwerp zijn er wel een aantal artikelen waarin mogelijk stof tot conflicten verborgen zit. Ik verwijs hier naar de refentiebedragen en naar de verdeling ervan. Wie zal immers uiteindelijk de rekening betalen? U zult het mij niet kwalijk nemen, mijnheer de minister, dat ik hierbij verwijs naar hen die het gezondheidsbeleid op het terrein mee bepalen. Er zouden toch garanties moeten worden ingebouwd zodat de artsen niet verantwoordelijk kunnen worden gesteld voor prestaties die zij in opdracht zouden moeten uitvoeren of waartoe zij zouden worden aangezet in bepaalde ziekenhuizen. U weet immers dat dit gebeurt en dit ontwerp kan aan de misbruiken paal en perk stellen. Voorwaarde is wel dat de factuur niet volledig naar de artsen kan worden doorgeschoven.
In verband met de gedeelde aansprakelijkheid van ziekenhuizen en artsen wensen wij de heer Mailleur te danken evenals de regering en de commissie. Het verheugt ons inderdaad dat dit item werd opgenomen in het wetsontwerp. Ik meen dat dit een rechtvaardige maatregel is en het is onze zorg om een gezondheidsbeleid uit te tekenen waaraan alle partners met enthousiasme kunnen meewerken en daarin ook nog voldoening vinden.
De relatie tussen de artsen en de ziekenhuizen blijft uiteraard een heikel punt. Volgens het wetsontwerp zou de regering in ieder ziekenhuis een financiële commissie oprichten. Ik ben ervan overtuigd dat dit een positief punt is om de zolang gevraagde transparantie eindelijk door te voeren. Deze commissie, die mede op verzoek van onze partij paritair is samengesteld, kan daartoe bijdragen. Daarbij kan een beroep worden gedaan op een financieel deskundige. Artsen zijn immers geen financiële deskundigen. Men zegt heel vaak dat de gezondheidspolitiek de zachte sector is maar ik denk dat de leden die hier aanwezig zijn zeer goed weten dat dit een harde sector is, ook financieel, waarvoor de nodige financiële deskundigheid vereist is om af en toe door het bos de bomen nog te zien. De in het wetsontwerp ingebouwde transparantie is hierbij zeker gebaat. Dit zal uiteindelijk tot een geloofwaardige gezondheidspolitiek leiden, waardoor wij dit ontwerp ten volle kunnen steunen.
Ik wil het hoofdstuk over de afdrachten en de correcte verhoudingen tussen ziekenhuizen en artsen besluiten. Artikel 139bis van de ziekenhuiswet is allang een heikel punt. Ik ben ervan overtuigd dat de regering haar afspraken terzake hierdoor zal nakomen, zodanig dat er een correcte inhouding van de centraal geïnde honoraria staat tegenover de daadwerkelijk gemaakte kosten verbonden aan de prestaties. Dat blijft een aandachtspunt. Wij staan erop dat de regering terzake nog initiatieven neemt.

Beide ministers hebben terzake geantwoord dat het niet de bedoeling was een of andere praktijkvorm te bevoordelen maar dat het inderdaad gaat om kwalitatieve vereisten. Het is de bezorgdheid van mijn partij dat solopraktijken, waaraan dezelfde kwalitatieve eisen worden gesteld, op dezelfde manier in aanmerking zouden komen voor de herwaardering die met deze wet wordt doorgevoerd. Nagenoeg alle actoren die betrokken zijn in het gezondheidsbeleid worden geresponsabiliseerd: de verstrekkers, de ziekenhuizen, de ziekenfondsen en de wetenschappers. Het is dan ook niet meer dan normaal dat een eerste stap wordt gezet naar de responsabilisering van de patiënt. Als men een beleid op lange termijn wil realiseren, is het noodzakelijk dat de patiënt beseft wat de kostprijs is die zijn verzorging met zich brengt. De responsabilisering van de patiënt is nodig. Mijnheer Mayeur, dit wil niet zeggen dat de sociale correcties onterecht zijn. Het is om die reden belangrijk dat er een evaluatie wordt gemaakt met een bepaling van de juiste indicatoren en uiteraard ook met aandacht voor de sociale indicatoren. Wij zijn voor een doelmatige allocatie van de middelen: de juiste zorg op de juiste plaats. Mevrouw Descheemaeker heeft terzake ook een aantal opmerkingen gemaakt. Het rapport van deze evaluatie moet daadwerkelijk rekening houden met de sociale indicatoren.
Wij hebben via het advies van de Raad van State kennis kunnen nemen van de elementen in het ontwerp die wij na het reces zullen behandelen. Ook hier denk ik dat voor een doelmatige allocatie van de middelen het door de regering op te zetten kenniscentrum een zeer waardevol instrument zal blijken. Daardoor is zowel inzake responsabilisering als inzake beleidsmatige maatregelen een trendbreuk mogelijk. Onze partij staat daar uiteraard achter. Wij hebben daartoe een voorstel in de Kamer ingediend en zijn de regering dankbaar dat zij daarop is ingegaan.
Het debat dat wij nog altijd missen is dat over de verspilling van de middelen in de gezondheidszorg. Waar zit die? Over alle partijgrenzen heen denken mensen dat er zoveel wordt verspild in de gezondheidszorg. Ik ben die mening niet toegedaan. In de gezondheidszorg zijn er middelen nodig en die moeten doelmatig worden aangewend. Wij kunnen niet voorbijgaan aan de noden inzake innovatie, vergrijzing en de vraag van de patiënt. Als de gezondheidszorg — mijnheer Goutry, ik ga een Engels woord gebruiken — consumer driven wordt, dan betekent dit ook dat de responsabilisering van de patiënt ook gestalte zal moeten krijgen. Het kan niet zijn dat een goede gezondheidszorg of de beste gezondheidszorg wordt onthouden aan de patiënt. Hij heeft daar recht op. Wij creëren dat recht en verankeren dat zelfs in een wet. Dat wil zeggen dat de patiënt als een volwaardige partner in het gezondheidsbeleid zijn aandeel krijgt, met rechten en plichten tot gevolg.
Mijnheer de voorzitter, onze fractie zal dit ontwerp zeker steunen. Wij vinden dit een goede aanzet om naar een doelmatige allocatie van de middelen in het gezondheidsbeleid te evolueren. Wij nodigen de regering nogmaals uit om op termijn toch zeker met gezondheidsdoelen te komen in plaats van met budgettaire doelstellingen in de gezondheidszorg.

We then come to the mandatory collection of the brake money in the hospital's emergency services. There has been an important and correct discussion on this subject. Almost all actors involved in health policy are accountable: the providers, the hospitals, the hospital funds and the scientists. D'autres renforcent la première ligne en organisant la possibilité de financer des généralistes pour toute une série de fonctions. Il y a également la mesure qui permet d'accentuer le rôle des généralistes dans les instances de l'INAMI.
La bonification prévue pour les généralistes qui satisfont à des critères quantitatifs et qualitatifs dans leur pratique, l'honoraire de disponibilité, l'intervention allouée aux médecins pour l'utilisation de la télématique et enfin, l'assurance obligatoire qui paie les honoraires des médecins généralistes agréés pour la gestion du dossier médical, constituent de très bonnes mesures qui permettront aux généralistes d'être encore plus actifs sur le terrain et qui renforceront la première ligne.
Au-delà de cela, nous devrons nous interroger — d'autres l'ont dit avant moi — sur le renforcement de l'acte intellectuel. En effet, si toutes ces mesures vont dans le bon sens, elles ne seront pas suffisantes. Cette matière devra donc bientôt faire l'objet d'un débat.
Je voudrais également vous faire part de deux inquiétudes persistantes de mon groupe.
La première a trait au forfait pour les urgences. Je suis d'ailleurs intervenue sur ce point en commission.
Vous savez qu'Ecolo n'est pas très favorable à une telle mesure si elle ne tient pas compte de l'ensemble des paramètres qui conduisent le patient à faire usage des urgences et donc à utiliser un outil performant lorsque ce n'est pas nécessaire.
Lors de la discussion en commission, nous avons admis que cette problématique ne pouvait être résolue par le simple forfait. Nous avons d'ailleurs également pu constater le lien avec l'une des mesures relatives aux généralistes dont j'ai parlé il y a un instant. Chacun sait que cette problématique est complexe et requiert la mise en oeuvre de différentes techniques.
De plus, lorsque que l'on examine de près les urgences, on s'aperçoit qu'une grosse partie du public qui fait un usage non adéquat des urgences, est défavorisée socialement et économiquement. Notre groupe ne souhaite donc pas que les mesures qui sont prises diminuent finalement l'accessibilité aux soins pour ce public.
Il est vrai que la possibilité d'imputer le forfait dans le maximum à facturer a été introduite.
C'est un premier correctif. De plus, une évaluation de cette mesure aura lieu dans les deux ans en tenant compte, comme l'a dit Mme Avontroodt, des caractéristiques sociales du public. Ces amendements sont importants. Toutefois, je voudrais vous demander, monsieur le ministre, si vous ne pourriez pas annexer au rapport sur la pauvreté un rapport consacré à l'accessibilité financière des plus démunis.
Vous savez que je suis très partisane des petites évaluations. Je me réjouis donc qu'une évaluation soit prévue dans la loi. Cependant, étant donné que la problématique de l'accès aux urgences dépasse le cadre du forfait, il me semble qu'une évaluation qui ne tiendrait compte que du forfait et des urgences ne permettra pas de visualiser, dans l'ensemble des mesures qui ont été prises par le gouvernement, si l'accès aux soins est favorisé, quelles sont les limites et où subsistent des difficultés.
La seconde inquiétude est relative à la question de la responsabilité. Celle-ci n'est pas abordée fondamentalement dans le projet de loi. Elle devrait faire l'objet d'un débat plus approfondi à la rentrée. Pour nous, ce point est important. Monsieur le ministre, nous voulons vous encourager à poursuivre la réflexion avec le secteur dans la voie du contrôle. Il est clair que nous souhaitons vous voir arriver à un consensus sur ce point.
Par ailleurs, nous voudrions profiter de l'occasion pour attirer votre attention sur deux points. Tout d'abord, nous plaidons pour que le système qui sera mis en place dans l'évaluation permette de visualiser ce qui relève de l'infraction, de l'erreur administrative et de la surconsommation.
Ensuite, nous ne nous prononçons pas en faveur d'un système monolithique. C'est ainsi que nous estimons qu'il serait opportun de séparer la recommandation médicale et le contrôle médical. Les deux fonctions sont essentielles. Elles doivent toutes les deux être développées mais les lier dans un même service ne permettrait pas d'assurer l'indépendance nécessaire de ces fonctions. Un champ de réflexion s'ouvre là.
Monsieur le ministre, je souhaiterais connaître votre avis à propos des deux suggestions que je viens d'émettre.

In het wetsontwerp zien we ook een aantal aanzetten tot oplossing van de items die ik zojuist heb vermeld. Mijn vraag blijft of deze aanzetten voldoende zijn, zowel qua volume als qua inhoud. De tegemoetkomingen voor administratieve noden — zoals de telematica, waarover de minister uitvoerig heeft gesproken, en het aanleggen van de GMD's, waarvan de wet zich ook op de drempel van het Parlement bevindt — zijn inderdaad positieve stappen voor de toekomst. Het is wel zo dat deze stappen — vooral in huisartsenkringen — niet overal en niet door iedereen op gejuich zullen worden onthaald. Dat lijkt ons logisch omdat de nood en de vraag steeds groter zullen zijn dan wat wordt aangeboden. Derhalve blijft de discrepantie tussen die vraag en het antwoord bestaan. Daarom dienen we ervoor te waken dat de eerstelijnszorgers — zeker de huisartsen — het niet massaal laten afweten, zoals we in de media al meer dan uitvoerig hebben kunnen constateren. In de toekomst moeten we ervoor waken dat onze studenten geneeskunde de optie huisarts niet overslaan omwille van het zwakke sociale statuut en de financiële verdiensten, die op dit moment niet opwegen tegen de gevraagde of geëiste zorgverstrekking en overbevraging door de patiënt.
Wij hebben een aantal mogelijkheden opgesomd om de negatieve spiraal ten aanzien van het huisartsenberoep om te buigen. Ik verwijs naar de erkenning van de huisartsenkring, die ondertussen een feit is, wat de samenwerking in de eerstelijnszorg zeer nadrukkelijk op de voorgrond brengt. Wij hadden het ook over het specifieke budget voor de huisartsen, de administratieve vereenvoudiging en — last but not least — het responsabiliseren van de patiënten, wat in de toekomst een zeer delicaat punt zal worden.
Ik wil nog enkele punten vermelden waarvoor volgens ons speciale aandacht nodig is.
In de eerste plaats spreek ik over de spoedgevallendienst, wat ook door andere collega's naar voren werd geschoven. Ten tweede verwijs ik naar de referentiebedragen die zullen worden toegepast en — ten derde — de samenstelling van de werking van de multipartiten, waarvoor wij bij de artikelsgewijze bespreking nog een paar amendementen achter de hand hebben gehouden.
Ik rond af met het feit dat er heel wat technische aanpassingen aan bod komen die mij, enerzijds, nuttig en nodig lijken maar mij, anderzijds, ook de indruk geven in een grijze zone te zitten.
