Monsieur le président, monsieur le ministre, chers collègues, je serai d'autant plus bref que le rapport de 165 pages que vous avez reçu est détaillé. Je tiens d'ailleurs à remercier les services pour leur contribution à cet important rapport.
La commission des Finances a entamé l'examen de la proposition de loi initiale voici près d'un an, le 26 février 2002. Quatre réunions ont eu lieu en mars, deux en avril, une en décembre et deux réunions encore depuis le début de cette année.
Le cheminement de cette proposition en commission des Finances ne fut pas banal et connut quelques rebondissements. En fait, la proposition initiale a été entièrement discutée, article par article, durant six réunions en février et mars de l'année dernière avant de faire l'objet d'un premier amendement général réécrivant la proposition pour tenir compte de toutes les remarques formulées durant la discussion, amendement déposé le 30 avril 2002. L'adoption de cet amendement a toutefois été postposée dans l'attente de l'avis du Conseil d'Etat et de l'avis demandé par la commission à la Cour des comptes sur l'impact budgétaire estimé.
Au mois d'octobre dernier suite à une concertation entre les auteurs et le gouvernement, un nouvel amendement général a été déposé par les auteurs de la proposition initiale. Ce nouveau texte renonçait à la création d'un fonds au profit de l'extension du régime existant au sein des CPAS.
De la discussion de cet amendement en commission des Finances le 17 décembre dernier est résulté un troisième et dernier amendement général nettement plus proche de la proposition initiale puisqu'il en revient à la création d'un Fonds des créances alimentaires et ne prévoit aucun plafond de revenus pour en bénéficier.
C'est ce dernier texte qui vous est soumis et qui fut adopté en commission au début de ce mois de janvier par dix voix et trois abstentions.
La commission a décidé de scinder la proposition, selon que les dispositions reprises règlent une matière visée à l'article 77 ou à l'article 78 de la Constitution. C'est ainsi que deux propositions distinctes mais formant un tout vous sont soumises. La seconde proposition modifiant le Code judiciaire règle la compétence juridictionnelle du juge des saisies en cas de recours, à savoir celle du juge du domicile du créancier. S'agissant d'un texte d'initiative parlementaire, les auteurs auront l'occasion d'en exposer les objectifs et de préciser leur appréciation quant au texte finalement adopté. En tant que rapporteur, je ne vais donc pas ici, comme c'est le cas lorsqu'il s'agit d'un projet, résumer la proposition
Quant au débat qui fut extrêmement animé et constructif, je ne vais pas davantage tenter de le synthétiser, compte tenu de l'existence, comme je viens de le rappeler, de quatre textes successifs, ce qui nécessiterait un temps d'exposé déraisonnable.
Je me permets donc de vous renvoyer à mon rapport écrit. Je dirai simplement — et j'espère en cela ne pas trahir le sentiment des commissaires — que le traitement réservé à cette proposition est un très bel exemple de travail et de constance parlementaires, les débats s'étant déroulés en dehors de tout clivage politique classique et avec la collaboration technique très efficace des conseillers du ministre des Finances qui fit d'ailleurs lui-même preuve de patience constructive.

The Finance Committee began the examination of the initial bill almost a year ago, on February 26, 2002. Four meetings were held in March, two in April, one in December and two more meetings since the beginning of this year.
The course of this proposal in the Finance Committee was not banal and experienced some rebounds. In fact, the original proposal was fully discussed, article by article, during six meetings in February and March last year before being the subject of a first general amendment re-writing the proposal to take into account all the comments made during the discussion, amendment filed on 30 April 2002. The adoption of this amendment was, however, postponed in anticipation of the opinion of the State Council and the opinion requested by the Commission to the Court of Auditors on the estimated budgetary impact. by
In October last, following a consultation between the authors and the government, a new general amendment was submitted by the authors of the original proposal. This new text renounced the creation of a fund for the benefit of the extension of the existing regime within the CPAS. by
The discussion of this amendment in the Finance Committee on 17 December resulted in a third and last general amendment significantly closer to the initial proposal since it relates to the creation of an Alimentary Claims Fund and does not provide for any income ceiling to benefit from it.
This last text is submitted to you and was adopted in a committee at the beginning of this month of January with ten votes and three abstentions.
The committee decided to divide the proposal, depending on whether the provisions taken regulate a matter referred to in Article 77 or Article 78 of the Constitution. This is how two distinct but forming one whole propositions are submitted to you. The second proposal amending the Judicial Code regulates the jurisdiction of the seizure judge in case of appeal, namely that of the judge of the creditor’s domicile. As a parliamentary initiative text, the authors will have the opportunity to outline its objectives and to specify their appreciation for the text finally adopted. As a rapporteur, I will therefore not here, as is the case when it is a project, summarize the proposal.
As for the debate, which was extremely lively and constructive, I will not try to synthesize it, given the existence, as I just recalled, of four successive texts, which would require an unreasonable time of exposure.
I would like to refer to my written report. I will simply say — and I hope in this not to betray the feelings of the Commissioners — that the treatment reserved for this proposal is a very beautiful example of parliamentary work and constancy, the debates having taken place outside of any classical political clash and with the very effective technical collaboration of the advisors of the Minister of Finance, who also showed himself constructive patience.

Monsieur le président, monsieur le ministre, mes chers collègues, je voudrais vous citer simplement trois dates: 1974, dépôt de la première proposition de loi au Sénat par Mme Huberte Hanquet; janvier 2002, dépôt de la proposition de loi signée par l'ensemble des parlementaires des partis démocratiques et aujourd'hui, mesdames, messieurs, janvier 2003, vote — je n'en doute pas — de la proposition de loi.
Je voudrais commencer par remercier notre brillant rapporteur pour ce rapport concis mais néanmoins très précis, très constructif et très positif. Cela n'a pas dû être facile tous les jours. Je vous sais gré, monsieur le rapporteur, du rapport que vous avez élaboré à l'intention de la séance plénière.
Le 15 janvier 2002 fut pour moi un jour extrêmement important de ma vie parlementaire. Ce jour-là, avec l'ensemble des partis démocratiques, nous avons déposé une proposition de loi créant un Fonds d'avances et de recouvrement des créances alimentaires, sujet qui tient énormément à coeur à l'ensemble des parlementaires et pour lequel ils se battent, quel que soit le parti, majorité et opposition, francophones et néerlandophones, depuis 1974.
En effet, les discussions étaient en cours depuis trente ans. Ces deux projets étaient déposés par les uns et par les autres, tant à la Chambre qu'au Sénat et les ministères se renvoyaient la balle, une fois la Justice, une fois les Affaires sociales, une autre fois la Santé. Nous avons enfin trouvé dans le chef du ministre des Finances, M. Reynders, un interlocuteur qui a cherché avec nous une solution à ce problème qui devenait insoluble. Cette solution, le ministre l'a trouvée dans son département de recouvrement des créances non fiscales. En effet, il nous a proposé de développer ce département pour qu'il puisse prendre en charge — il a rappelé tout à l'heure le nombre important d'employés et de services opérationnels à sa disposition — le recouvrement de l'ensemble des créances alimentaires impayées.
Nous avons immédiatement embrayé sur cette proposition intéressante. En fait, l'intervention du ministère des Finances auprès du débiteur d'aliments devait être le moyen d'exercer une pression psychologique sur les débiteurs "mauvais payeurs" afin que ceux-ci s'exécutent plus rapidement. Je vous rappelle que les pensions alimentaires sont trop souvent impayées, payées incomplètement ou trop tard et que cela met pas mal de familles en difficulté.
Voilà, monsieur le président, monsieur le ministre, mes chers collègues, le point de départ de ce processus qui a connu de nombreux rebondissements cette dernière année. Je vous rappelle que 133 amendements ont été déposés en commission des Finances, non seulement déposés mais discutés, écoutés et entendus pour la plupart, qu'ils émanent de la majorité ou de l'opposition. Pourtant, le mode consensuel, qui fut le point de départ du dossier, reste tout à fait d'actualité. Je profite de l'instant qui m'est accordé pour remercier l'ensemble de mes collègues députés, qui se sont vraiment investis dans ce dossier pour avoir contribué, de manière constructive, à l'élaboration du texte qui nous est soumis aujourd'hui.
Je suppose et j'espère que le ministre viendra tout à l'heure nous donner des explications techniques importantes. Le texte qui vous est soumis instaure la création d'un service de créances alimentaires, un service qui sera autonome, viable financièrement et durable. C'est ce que nous voulions tous.
Sur le plan des principes, je tiens à souligner certains avantages de ce système qui me semblent particulièrement importants. Il sera efficace, rapide, facilement compréhensible, avec une excellente information que le ministère des Finances fournira aux administrations communales, aux CPAS et à toute personne s'intéressant à ce problème.
Premier principe, la proposition de loi permet de faire respecter l'obligation d'assistance entre parents et enfants et entre ex-époux. Il s'agit de faire respecter un droit consacré par une décision judiciaire et non pas d'accorder une faveur ou un privilège. L'ordre politique et l'Etat ne peuvent tolérer que les institutions sur lesquelles il repose soient violées ou bafouées impunément.
Deuxième principe, la proposition de loi vise à accorder un droit à l'avance sur pension alimentaire à tous les créanciers d'aliments qui ne reçoivent plus la pension alimentaire. Cela concerne les enfants, les ex-conjoints, les ex-cohabitants et ce, quel que soit leur niveau de revenu. Il s'agit donc d'une sorte de service universel auquel nous tenions tous absolument. Le montant de l'avance sera plafonné à 175 euros, alors qu'il l'est actuellement à 125 euros.
Troisième principe, la garantie d'avance faite par le service des créances à l'ayant droit, sera un instrument de lutte important contre la précarité des familles devenues monoparentales ou recomposées. Nous qui vivons dans nos communes au jour le jour, nous savons combien cette avance permettra aux familles de respirer, d'avoir une sécurité sur les plans financier, affectif et social. Quatrième principe, le respect de l'obligation alimentaire constitue aussi un enjeu important dans le maintien des relations familiales. Trop souvent, après un divorce, le problème du non-paiement de la pension alimentaire devient l'objet d'un enjeu, d'un chantage ou d'un marchandage affectif. L'intervention d'un service indépendant et neutre en cas de non-paiement de la pension alimentaire permettra de désamorcer certaines tensions. Cela ne pourra être que bénéfique pour toutes les familles.
Cinquième principe, le service des créances alimentaires permet d'assurer la protection du créancier tout en conservant l'entière responsabilité du débiteur. Cela a pour avantage de réserver à la solidarité nationale un rôle subsidiaire par rapport à la solidarité familiale. Il faut veiller à ce que la carence familiale ne mette pas ces créanciers à charge de la collectivité.
Les CPAS sont déchargés de leur fonction en cette matière. Je vous rappelle que nous avons eu beaucoup d'auditions et que les CPAS refusaient absolument le surcroît de travail et de charges financières que représentait pour eux le fait de devoir faire le nécessaire pour assurer le recouvrement et l'avance des créances alimentaires.
Je tiens à attirer l'attention de mes collègues sur le fait que le service des créances alimentaires ne décharge pas les CPAS de leurs responsabilités en la matière. En vertu de la loi sur les CPAS, ils demeurent le service de proximité, le service de première ligne, de conseil et d'orientation des personnes qui se présentent à eux pour d'autres besoins, notamment en vue d'être orientées vers le service compétent pour leur permettre d'obtenir les créances alimentaires.
Après l'adoption de la présente proposition de loi, l'administration des Finances aura un rôle essentiel dont dépendra le bon fonctionnement du service. Un mécanisme d'information devra être mis en place pour les créanciers mais aussi pour les débiteurs d'aliments. Nous en avons reçu la promesse du ministre. Nous comptons sur son efficacité pour permettre un accès rapide et facile aux créanciers. Nous avons mis tellement d'espoir dans cette proposition de loi qu'il ne faut pas que le service occasionne des déceptions. Il doit être correct, efficace, rapide, facile et clairement compréhensible. Des formulaires doivent être rédigés à l'avance et permettre un usage utile pour chacun d'entre nous.
Je voulais dire aussi que la mise en place du service des créances alimentaires doit rester d'usage de proximité et d'un accès facile à tout un chacun. Chose importante, qui a été rajoutée aussi au cours des discussions, une commission d'évaluation sera instituée. Elle sera chargée d'établir un rapport annuel d'évaluation. Cette dernière permettra d'améliorer le système mis en place et d'adapter à la hausse les montants des avances en cas de bon fonctionnement.
Je vous rappelle qu'au Québec, on recouvre 90% de l'ensemble des créances alimentaires. Pourquoi ne pas imaginer qu'en Belgique aussi, on parvienne à un tel taux de recouvrement? Il semble dès lors que la proposition de loi constitue une réponse adéquate, trop longtemps différée, aux besoins matériels, aux besoins sociaux de nombreux créanciers d'aliments se trouvant, du fait de la défaillance de leur débiteur, dans la précarité. Elle permet de garantir l'équilibre entre les rôles de chacun des intervenants, de venir en aide tout en préservant les responsabilités de chacun et nous y tenions également beaucoup.
Je souhaiterais présenter mes plus vifs remerciements, avec mon amitié en sus, monsieur le ministre, à vous, ministre des Finances, pour votre soutien, mais aussi à votre cabinet et à votre administration qui ont fait, défait et refait un texte qui, en fin de compte, a obtenu un large consensus, en tous cas de l'ensemble des partis démocratiques. Je sais, monsieur le ministre, qu'au sein du gouvernement, cela n'a pas dû être facile tous les jours pour vous et que vous n'avez jamais laissé tomber les bras. Je tenais aussi à vous rendre hommage cet après-midi.
Je souhaiterais aussi remercier l'ensemble de mes collègues députés, hommes et femmes — car ce n'est pas un projet qui intéresse seulement les femmes, on vit dans une société mixte et ce projet intéresse les hommes, les femmes et les enfants — qui se sont attelés, dans un souci de consensus, de respect et d'estime réciproques, à ce projet, qui y ont cru jusqu'au bout et qui n'ont jamais désespéré; à tous ceux qui ont contribué à sa réalisation et à son adoption.

I would like to begin by thanking our brilliant rapporteur for this brief but yet very precise, very constructive and very positive report. It shouldn’t have been easy every day. I would like to thank you, Mr. Rapporteur, for the report you have prepared for the plenary session.
January 15, 2002 was for me an extremely important day in my parliamentary life. On that day, together with all the democratic parties, we submitted a bill creating a Fund for advances and recovery of food claims, a subject that is very close to the heart of all parliamentarians and for which they have been fighting, regardless of the party, majority and opposition, French-speaking and Dutch-speaking, since 1974.
The discussions have been ongoing for thirty years. These two projects were deposited by each other, both in the House and in the Senate and the ministries returned the ball, once Justice, once Social Affairs, another time Health. Finally we found in the head of the Minister of Finance, Mr. Reynders, an interlocutor who sought with us a solution to this problem that became insoluble. This solution, the minister found it in his department of recovery of non-tax receivables. Indeed, he proposed us to expand this department so that it can take care — he recently recalled the large number of employees and operational services at his disposal — of the recovery of all unpaid maintenance claims.
We immediately embraced this interesting proposal. In fact, the Ministry of Finance’s intervention with the maintenance debtor was meant to be a means of exercising psychological pressure on the “bad payers” debtors so that they execute more quickly. I would like to remind you that maintenance pensions are too often unpaid, incomplete or too late and that this puts many families in trouble.
This is, Mr. Speaker, Mr. Minister, my colleagues, the starting point of this process that has experienced many rebounds this past year. I remind you that 133 amendments have been submitted in the Finance Committee, not only submitted but discussed, listened and heard for the most part, whether they come from the majority or the opposition. However, the consensual mode, which was the starting point of the dossier, remains quite up-to-date. I take the opportunity to thank all my colleagues, who have really invested in this dossier for contributing constructively to the drafting of the text that is presented to us today.
I suppose and I hope that the Minister will come soon to give us important technical explanations. The text submitted to you establishes the creation of a service of food claims, a service that will be autonomous, financially viable and sustainable. This is what we all wanted.
In terms of principles, I would like to highlight some advantages of this system that I find ⁇ important. It will be effective, quick, easily understandable, with excellent information that the Ministry of Finance will provide to municipal administrations, CPAS and anyone interested in this issue.
The first principle is that the proposed law enables the obligation of assistance between parents and children and between former spouses to be enforced. It is about enforcing a right enshrined by a judicial decision and not granting a favor or privilege. The political order and the State can only tolerate that the institutions on which it rests are violated or blamed impunely.
The second principle is that the proposed law aims to grant an advance right on maintenance to all maintenance creditors who no longer receive maintenance. This applies to children, former spouses, former cohabitants and this regardless of their income level. So this is a kind of universal service that we all absolutely depend on. The amount of the advance will be placed at 175 euros, while it is currently at 125 euros.
The third principle, the advance guarantee made by the service of claims to the entitled, will be an important instrument in the fight against the precariousness of families that have become monoparental or recomposed. We who live in our communes day by day, we know how much this advance will allow families to breathe, to have financial, emotional and social security. Fourth principle: compliance with the maintenance obligation is also an important issue in ⁇ ining family relations. Too often, after a divorce, the problem of non-payment of alimony becomes the subject of betting, blackmail or affective merchandising. The intervention of an independent and neutral service in the event of non-payment of the maintenance pension will help to dismantle certain tensions. This can only be beneficial for all families.
Fifth principle: the service of maintenance claims ensures the protection of the creditor while ⁇ ining the full liability of the debtor. This has the advantage of giving national solidarity a subsidiary role over family solidarity. It is necessary to ensure that the family shortage does not put these creditors at the expense of the community.
The CPAS are discharged from their functions in this regard. I remind you that we had many hearings and that the CPAS absolutely refused the extra work and financial burdens that represented for them the fact of having to do what was necessary to ensure the recovery and advance of the maintenance claims.
I would like to draw the attention of my colleagues on the fact that the Food Claims Service does not discharge the CPAS from their responsibilities in this regard. Under the CPAS Act, they remain the service of proximity, first-line, counseling and guidance of persons who come to them for other needs, in particular in order to be directed to the competent department to enable them to obtain maintenance claims.
After the adoption of this bill, the Finance Administration will have an essential role on which the proper functioning of the service will depend. An information mechanism should be established for creditors but also for alimony debtors. We have received the Minister’s promise. We rely on its effectiveness to allow quick and easy access to creditors. We have put so much hope in this bill that the service should not cause disappointment. It must be correct, effective, quick, easy and clearly understandable. Forms must be written in advance and allow useful use for each of us.
I also wanted to say that the establishment of the service of food claims must remain of use of proximity and easy access for everyone. Another important thing, which was also added during the discussions, a evaluation committee will be established. It will be responsible for drawing up an annual evaluation report. The latter will improve the system in place and adjust the amounts of advances to the rise in case of proper functioning.
In Quebec, 90% of all food claims are recovered. Why not imagine that in Belgium, too, such a recovery rate is achieved? It therefore appears that the proposed law constitutes an adequate response, too long delayed, to the material needs, to the social needs of many alimony creditors who, due to the default of their debtor, are in precariousness. It allows to ensure the balance between the roles of each of the stakeholders, to come in help while preserving the responsibilities of each and we also cared a lot about it.
I would like to present my most vivid thanks, with my friendship above, Mr. Minister, to you, Minister of Finance, for your support, but also to your cabinet and your administration who have made, defeat and re-made a text that, in the end, has obtained a broad consensus, in any case from all the democratic parties. Mijnheer de voorzitter, ik dank u en de collega's. Ik verontschuldig mij omdat ik niet alle debatten volledig zal kunnen volgen, aangezien ik dadelijk terug naar de Sabena-commissie dien te gaan.
Mijnheer de voorzitter, mijnheer de minister, collega's, enerzijds denk ik dat het vandaag een blij moment is als er straks wetgeving gecreëerd zal worden. Ik wil iedereen die daaraan meegewerkt heeft ook danken en proficiat wensen. Anderzijds denk ik echter dat het ook past om sommige nuanceringen aan te brengen in het debat.
Aan dit wetgevend initiatief is een paar jaar parlementair werk voorafgegaan. Geregeld hebben wij — dat heb ik in de commissievergadering ook al gezegd — wat rondjes in de paardenmolen gedraaid. Uiteindelijk is de paardenmolen gestopt en zijn wij kunnen landen. Wij zijn nu echter aan het einde van de rit. Het nadeel van te landen aan het einde van de rit is dat de factuur niet wordt vereffend door de meerderheid die deze wet zal goedkeuren, maar wordt doorgeschoven naar de volgende legislatuur. Was dit niet gebeurd, dan was er wellicht geen akkoord geweest.
Mede namens mijn fractie had ik enerzijds, een apart voorstel ingediend en anderzijds, een consensusvoorstel waarover achteraf een tijdlang geen consensus bestond en nadien weer wel, dan weer niet en uiteindelijk wel. Ik heb dat goedgekeurd omdat ik het zelf mee heb ingediend met de duidelijke afspraak weliswaar dat dit niet mijn weg was, maar dat elke verbetering positief was. Dat is ook de reden — ik hoor dat sommigen nog altijd een andere optie prefereren — waarom onze fractie zich zal onthouden bij deze regelgeving, niettegenstaande ze ook positieve elementen en zelfs meer dan dat bevat.
Hoe dan ook is het een belangrijk maatschappelijk probleem. De slechtst betaalde schuld, alimentatie, geeft schandelijke sociale drama's. Elk voorstel houdt een verbetering in. Toch past het enkele kritische kanttekeningen te maken.
Ten eerste, wij koerieren hier ook een beetje am Symptomen, zonder de oorzaken aan te pakken. Vele binnen- en buitenhuwelijkse relaties spatten uit elkaar. Wij worden vandaag de dag geconfronteerd met een gezinsinstabiliteit, die nog steeds groeit. Dat heeft heel veel te maken met een spitsuurgeneratie, die de druk niet meer aankan. Men maakt te weinig tijd voor elkaar. Men kan soms ook te weinig tijd voor elkaar maken. Het gevolg is dat gezinnen onder druk komen en uit elkaar spatten, met alimentatieproblemen tot gevolg. Over dit probleem hebben we teveel gezwegen.
Ten tweede, in de huwelijkse relaties is er ook druk. Als gevolg daarvan gaan jammer genoeg ook gezinnen uit elkaar. Voor deze relaties zitten we nog steeds met een wetgeving, die hoe dan ook voorbijgestreefd is. We hebben tijdens deze legislatuur wel diverse wetsvoorstellen ingediend — ook ik heb dat gedaan — om van onze "vechtscheidingswetgeving" een meer vriendelijke, conflictbeheersende en conflictvoorkomende wetgeving te maken, die minder gebaseerd is op begrippen als fout en schuld maar meer op verantwoordelijkheid. Het moest een wetgeving zijn die in het licht stond van keuzes die gezamenlijk zijn gemaakt, van zelfredzaamheid en ook van verantwoordelijkheid. Tijdens deze legislatuur zijn er stappen gezet: de termijn voor feitelijke scheiding werd van vijf jaar teruggebracht op twee jaar; de familiebemiddeling werd geregeld. De echtscheidingswetgeving as such en het foutprincipe hebben wij echter niet uit de wet gehaald. Nochtans hebben er diverse voorstellen op de banken gelegen. Ik denk dat dit hoe dan ook tijdens de volgende legislatuur moet gebeuren. Ook hier ligt immers soms de basis van een conflict, dat later rijst en soms aanleiding geeft tot het niet of laattijdig betalen van alimentatie.
Ten derde, in deze wetgeving wordt verwezen naar het misdrijf "familieverlating". Dit is reeds lang opgenomen in de wet. Toch besteedt Justitie onvoldoende prioriteit aan dit misdrijf. Er is te veel sepot. Het college van procureurs-generaal geeft er geen prioriteit aan. De minister van Justitie heeft terzake zijn verantwoordelijkheid. Men is verplicht om klacht met burgerlijke partijstelling in te dienen. Dat is niet de juiste weg. Hierdoor slepen problemen veel te lang aan. Zo worden ze enkel nog erger.
Had de eerste minister in zijn regeerverklaring van oktober 2002 niet gezegd dat hij van familieverlating een prioriteit zou maken? Ondertussen zijn we vrijwel zes maanden verder. Wat is hiervan terechtgekomen? Dit had aan elkaar moeten worden gekoppeld. Ik heb dit tot in den treure tijdens diverse besprekingen herhaald, zowel in de commissie voor de Justitie als daarna in de commissie voor de Financiën.
Ten vierde, naast het schandelijke probleem van het niet-betalen van alimentatie, wat op geen enkele wijze goed te praten is, bestaat er nog een probleem, met name het omgangsrecht, het recht op contact. Ook hierover werd gezwegen. Juridisch valt en is het omgangsrecht niet te koppelen, maar in feite wordt het gekoppeld. Dit heeft niets met geslachten te maken. Of het slachtoffer nu een man of een vrouw is, in beide gevallen is het ergerlijk en niet goed te praten. In de geest, het hart en de buik van de mensen — en ik heb daarvoor zeer veel begrip — worden beide gekoppeld. Wij geven daarop een antwoord, maar alleen inzake het probleem van de nietbetaling van alimentatie. Wij zwijgen echter te zedig over het nietrespecteren van het omgangsrecht.
Collega Bourgeois heeft destijds nog een schriftelijke vraag gesteld over de grootte van de cijfers. Ik weet niet of hij van plan is om die schriftelijke vraag te verwerken in zijn betoog. Hij zal dat ongetwijfeld doen en dus zwijg ik erover.
In ieder geval, het niet respecteren van het omgangsrecht is een groot probleem. Ik denk dat we de problematiek hadden moeten koppelen aan de problematiek die wij thans bespreken, te meer omdat deze regering, deze meerderheid in de begroting bespaart op het budget voor de neutrale ontmoetingsruimtes. Nochtans had dat een uitstekend instrument kunnen zijn in dat verband, waarin beter meer was geïnvesteerd. Ik betreur dat in de tekst te weinig de koppeling is gemaakt tussen de niet-betaling van de alimentatie en de oorzaken ervan.
Ten derde, naast het feit dat er teveel aan kurieren am Syptom wordt gedaan en dat de problemen te weinig met de wortel worden aangepakt, vind ik het jammer dat er niet werd gekozen voor het behoud van de bestaande voorschottenregeling. Collega's, u weet dat ik liever een andere weg had gekozen. Immers, de voorschottenregeling heeft zijn nut op het terrein bewezen. De regeling functioneerde goed en er was lokaal bij de OCMW's heel wat expertise opgebouwd. Ik ontken niet dat de regeling ook nadelen had. Zo werd er geflirt met de kansarmoede; enkel de kinderen kwamen voor de uitbetaling ervan in aanmerking; de bedragen waren te laag; de inkomensgrenzen waren te laag en het OCMW kreeg, meestal heel laat, slechts 90% van het voorgeschoten bedrag terug. Ik geef toe dat aan vele van deze nadelen met de nieuwe regelgeving een antwoord wordt geboden. Dat dient toegejuicht te worden. Er blijven echter nadelen bestaan. Niettegenstaande de vroegere regeling voor een stuk mogelijk blijft, vrees ik dat met de tientallen bureaus die nu te lande zullen worden opgericht, het contact tussen het bureau en het slachtoffer van de niet-betaling van de alimentatie onpersoonlijker zal zijn dan dat het geval was toen de ambtenaar van het OCMW daarvoor zorgde.
Ik vrees ook dat de nieuwe regeling een stukje trager zal verlopen. De ervaring van het Fonds voor Slachtoffers van Opzettelijke Gewelddaden leert dat men soms veel te lang moet wachten. Ik vrees dat dat hier ook het geval zal zijn en dat de bureaucratie zal regeren, met tijdsverlies tot gevolg. Ik begrijp dat de OCMW's niet wildenthousiast waren en dat ze geen vragende partij waren om deze rol te vervullen. Ze waren dat niet, omdat ze er niet voor betaald werden, noch kregen ze er logistieke steun voor. Als we hadden gezegd dat ze ervoor zouden worden betaald, alle onkosten terugbetaald zouden krijgen en daarbovenop zouden hebben kunnen rekenen op bijkomend personeel, steun en een tussenkomst in de gemaakte onkosten, dan was er misschien een ander debat mogelijk geweest. Ik begrijp ten gronde nog steeds niet waarom onderhoudsgerechtigden 5% moeten inleveren.
Goede vrienden, collega's, ten slotte vind ik ook dat het niet past dat we geen prijskaartje plakken op dit wetgevend initiatief. Dat is niet anders dan het doorschuiven van facturen, een recept dat we deze legislatuur al vaker mochten smaken. Ik betreur dat.
Mijnheer de minister, ik had nog één vraag aan u. De Vereniging van Belgische Steden en Gemeenten schrijft de leden van de commissies voor de Financiën en de Begroting aan. Ze drukt haar bezorgdheid uit over artikel 22. Volgens dat artikel zijn de gemeenten en steden verplicht om informatie te verstrekken op hun kosten. Ze vrezen vooral dat het beroepsgeheim terzake zou worden geschonden.
Zou u voor het verslag en voor de duidelijkheid hier misschien een antwoord op kunnen geven? Ik meen dat dit niet noodzakelijk zo hoeft te zijn en ik hoop dat u terzake een stukje opheldering kan verschaffen.
Na deze nuanceringen, voorzitter, collega's, wil ik in elk geval zeggen dat deze regelgeving een goede stap is die wij toejuichen. Wij hadden natuurlijk liever iets anders gezien en waren liever ook iets verder gegaan. Ik hoop dat vooral op de vele oorzaken die dit probleem eigenlijk doen ontstaan en waar ik daarstraks naar heb verwezen in de volgende legislatuur — want we staan nu aan de eindbaan — wel een antwoord kan worden gegeven. Een humaniserende echtscheidingswetgeving en ook het omgangsrecht verdienen maatschappelijke aandacht. Ik dank u voor uw aandacht. Wij zullen ons omwille van de nuanceringen onthouden, maar toch juichen wij het initiatief en de verbeteringen toe.

Thank you and my colleagues. I apologize for not being able to follow all debates in full, as I will immediately return to the Sabena committee to do so.
Mr. Speaker, Mr. Minister, colleagues, on the one hand, I think that today is a happy moment when legislation will be created later. I also wish to thank and congratulate all who have contributed. On the other hand, however, I think it is also appropriate to introduce some nuances in the debate.
This legislative initiative was preceded by several years of parliamentary work. We have arranged — I have already said that at the committee meeting — some rounds turned in the horse mills. Eventually, the horse mills stopped and we were able to land. However, we are now at the end of the ride. The disadvantage of landing at the end of the ride is that the invoice is not settled by the majority that will approve this law, but is forwarded to the next legislature. If this had not happened, there would probably have been no agreement.
In part on behalf of my group, I had, on the one hand, submitted a separate proposal and, on the other hand, a consensus proposal on which there was no consensus afterwards for a period of time and then again, then again not, and eventually yes. I approved it because I submitted it myself with the clear agreement though that this was not my way, but that every improvement was positive. That is also the reason — I hear that some still prefer another option — why our group will abstain from this regulation, despite it also contains positive elements and even more than that.
In any case, it is an important social problem. The worst-paid debt, maintenance, gives shameful social dramas. Every proposal involves an improvement. However, it is appropriate to make a few critical comments.
First, we courier here also a little am Symptoms, without addressing the causes. Many domestic and out-of-marriage relationships splashed apart. Today we are faced with a family instability, which continues to grow. That has a lot to do with a spicy acid generation, which can no longer cope with the pressure. They have too little time for each other. Sometimes you can spend too little time together. As a result, families are under pressure and break up, resulting in nutrition problems. We have silenced too much on this issue.
Second, there is also pressure in marriage relationships. As a result, families are also separated. For these relations, we still have legislation, which is overlooked anyway. During this legislature we have submitted several legislative proposals — and I have done so — to make our “divorce legislation” a more friendly, conflict-managing and conflict-prevention legislation, which is less based on concepts such as error and guilt but more on responsibility. It had to be a legislation that was in the light of choices made jointly, of self-reliance and also of responsibility. During this legislature, steps were taken: the period for actual separation was reduced from five years to two years; family mediation was regulated. However, the divorce law as such and the error principle have not been removed from the law. However, several proposals have been made to the banks. I think this should happen in the next legislature anyway. Even here is sometimes the basis of a conflict, which later arises and sometimes leads to the non-payment or late payment of alimony.
Third, this legislation refers to the crime "family abandonment". This has been included in the law for a long time. However, the judiciary does not give sufficient priority to this crime. There is too much sepot. The College of Attorneys-General does not give priority to this. The Minister of Justice has his responsibility. It is mandatory to file a complaint with a civil party. That is not the right way. This causes problems to last too long. Thus they only get worse.
Didn't the Prime Minister in his government statement in October 2002 say that he would make family abandonment a priority? In the meantime, we are almost six months ahead. What has come out of this? This should have been linked. I have repeated this until in the mourning during various discussions, both in the Committee on Justice and then in the Committee on Finance.
Fourth, in addition to the shameful problem of non-payment of maintenance, which is in no way good to speak of, there is another problem, in particular the right of contact, the right to contact. This was also silenced. Legally it falls and the right of contact cannot be linked, but in fact it is linked. This has nothing to do with gender. Whether the victim is a man or a woman, in both cases it is annoying and not good to speak. In the mind, the heart, and the belly of the people—and I have a great deal of understanding for that—both are connected. We give an answer, but only with regard to the problem of non-payment of maintenance. However, we are too silent about the non-respect of the right of contact.
Collega Bourgeois also asked a written question about the size of the figures. I do not know if he intends to incorporate that written question into his speech. He will undoubtedly do that, and so I will be silent about it.
In any case, the failure to respect the right of contact is a big problem. I think we should have linked the problem with the problem we are discussing now, especially because this government, this majority in the budget, saves on the budget for the neutral meeting rooms. However, that could have been an excellent instrument in that regard, in which more was better invested. I regret that there is not enough link in the text between the non-payment of alimony and its causes.
Third, in addition to the fact that there is too much courier at Syptom and that the problems are addressed too little with the root, I regret that it was not chosen to maintain the existing advance scheme. My colleagues, you know, I would have chosen a different path. After all, the advance scheme has proven its usefulness on the ground. The scheme worked well and there was a lot of local expertise at the OCMW’s. I do not deny that the regulation also had disadvantages. Thus, there was flirting with poverty; only the children were eligible for its payment; the amounts were too low; the income limits were too low and the OCMW received, usually very late, only 90% of the amount of advance. I admit that many of these disadvantages are addressed by the new regulation. This should be welcomed. However, disadvantages remain. Despite the fact that the previous scheme remains possible in part, I fear that with the dozens of offices that will now be established on land, the contact between the office and the victim of the non-payment of maintenance will be more impersonal than was the case when the official of the OCMW took care of it.
I am also concerned that the new regulation will run a little slower. The experience of the Fund for Victims of Deliberate Violence teaches that sometimes one has to wait too long. I fear that this will be the case here, and that the bureaucracy will rule, resulting in a loss of time. I understand that the OCMWs were not wild enthusiasts and that they were not asking party to fulfill this role. They were not, because they were not paid for it, nor were they given logistical support for it. If we had said that they would be paid for it, all costs would be reimbursed, and in addition could have counted on additional staff, support and intervention in the costs incurred, then maybe another debate would have been possible. I still fundamentally don’t understand why subscribers should pay 5 percent.
Finally, my friends and colleagues, I also find it inappropriate that we do not place a price label on this legislative initiative. That is no different than the shifting of invoices, a recipe that we have been able to taste more often in this legislature. I regret that.
Mr. Minister, I had another question to you. The Association of Belgian Cities and Municipalities nominates the members of the committees for Finance and Budget. She expressed concern about Article 22. According to that article, municipalities and cities are obliged to provide information at their own expense. They are especially concerned that the professional secret would be violated.
Could you be able to answer this for the report and for the clarity? I think this does not necessarily have to be so and I hope you can provide a bit of clarification on this subject.
After these nuances, Mr. Speaker, colleagues, I would like to say in any case that this regulation is a good step that we welcome. We would have preferred to see something else and would have preferred to go a little further. I hope that a response can be given, especially to the many causes that actually cause this problem and which I have referred to later in the next legislature – because we are now on the final track – can be given. A humanising divorce legislation and also the right of contact deserve public attention. I thank you for your attention. We will abstain for the nuances, but we welcome the initiative and the improvements.

Mijnheer de voorzitter, mijnheer de minister, collega's, men zegt veel dat politici zich bezighouden met problemen die ver van de mensen verwijderd zijn. Ik zei wel "men", ik keek naar u, mijnheer de minister, maar ik bedoelde u niet. Men verwijt ons dat dikwijls. Ik denk dat wat hier vandaag in deze Kamer zal worden goedgekeurd niet tot deze categorie behoort. Het gaat hier om een ernstig maatschappelijk probleem, een probleem dat niet alleen in de privé-sfeer thuishoort. Het gaat om het garanderen van bestaande rechten.
Het heeft lang geduurd tot hier eindelijk een wetgevend initiatief tot een goed einde kon worden gebracht. Ik ga niet herhalen wat zowel de rapporteur als mevrouw Herzet hebben gezegd. In 1974 lag het eerste voorstel ter tafel. Bijna dertig jaar later kunnen we eindelijk een dienst voor alimentatievorderingen oprichten. Ik zou graag kort de redenen opsommen of herhalen — herhalen is soms nodig in de politiek — waarom deze dienst voor alimentatievorderingen zo noodzakelijk is en waarom de VLD dit zal steunen.
In België zijn in 2001 bijna 30.000 huwelijken in een echtscheiding geëindigd. In vele gevallen geeft dit aanleiding tot de betaling van onderhoudsgelden voor de kinderen, voor de ex-partner of voor beiden. In twee van de drie gevallen betreft het alimentatiegelden voor kinderen. Het gemiddelde alimentatiebedrag per kind bedroeg in Vlaanderen een jaar of drie geleden als ik mij niet vergis — cijfers van de Gezinsbond — 150 euro. In één geval op vijf wordt er nooit betaald, in twee gevallen op vijf wordt er te weinig betaald of onregelmatig betaald. Slechts in iets minder dan de helft van de gevallen gebeurt alles correct zoals het hoort. Het gaat dus om een maatschappelijk probleem van grote omvang. Zoals we hebben kunnen vernemen tijdens de hoorzittingen die we hebben georganiseerd, toen nog in de commissie voor de Justitie, is wanbetaling van onderhoudsgelden, hetzij voor kinderen, hetzij voor de ex-echtgenoot één van de belangrijkste oorzaken van armoede of van financieel precaire situaties. Tot op vandaag kan diegene die daarmee wordt geconfronteerd klacht indienen wegens familieverlating. De heer Verherstraeten — die hier helaas niet meer is — heeft terecht aangehaald dat het misbruik van familieverlating veel te vaak wordt geseponeerd. Dat geldt trouwens ook voor de klachten die worden ingediend wegens het weigeren van omgangsrecht. Het is spijtig dat de minister van Justitie hier niet is, want beide gevallen zijn terug te voeren tot hetzelfde, namelijk het niet adequaat optreden van het gerecht, zowel wat betreft de weigering van omgangsrecht als wegens het misdrijf van familieverlating. Maar goed, wie ermee wordt geconfronteerd moet dan maar zelf het heft in handen nemen en proberen het moeizame en dure proces van invordering tot een goed einde te brengen.
Daarnaast bestaat nu al een regeling in het kader van het OCMW. Ik zal ze niet herhalen maar deze regeling heeft tekortkomingen. De bedragen zijn te laag en de categorieën zijn beperkt. Het gaat immers alleen om kinderen. De OCMW's zelf worden met een aantal problemen geconfronteerd want de invordering of de terugvordering is nagenoeg nihil en de OCMW's krijgen niet alles terugbetaald van de Staat wat ze voorschieten.
Onderhoudsgeld is een recht. Het is ofwel een recht vastgesteld tussen de beide partijen, in onderling akkoord, ofwel vastgesteld door de rechter. Het is geen sociale uitkering, het is geen gunst. Het is een recht, een onderhoudsplicht. In de meeste gevallen gaat het om een onderhoudsplicht jegens de eigen kinderen wat niet alleen een wettelijke maar mijns inziens ook een morele plicht is. Redenen genoeg dus om hier eindelijk een antwoord op te bieden en om ervoor te zorgen dat degenen die het recht hebben er ook kunnen op rekenen dat zij adequaat dit recht gewaarborgd zien.
Er is een lange calvarietocht geweest voor dit wetsvoorstel. Men heeft verschillende pistes bewandeld, verlaten, opnieuw bewandeld, toch weer verlaten maar uiteindelijk werden we geconfronteerd met een fundamentele keuze: ofwel een uitbreiding van het bestaande OCMW-systeem, ofwel een alimentatiefonds. Een uitbreiding van het OCMW-systeem zou het probleem van de onderhoudsgelden blijvend als sociale hulp gecatalogeerd zien. Een sociale hulp die slechts zou zijn weggelegd voor "minderbedeelden", ongeacht de grens. Enkel schuldeisers met een bepaald niveau van inkomen, die de grens niet zouden overschrijden, zouden gebruik kunnen maken van dat recht op voorschotten.
Uiteindelijk hebben wij met zijn allen — in de commissie is hierover unaniem gestemd met enkele onthoudingen — geopteerd voor de oprichting voor een Dienst voor alimentatievorderingen binnen het ministerie van Financiën en voor een toepassing van het principe van de universaliteit. Dit betekent dat iedereen die recht heeft op alimentatie een beroep kan doen op die dienst zonder inkomensbeperking. De beperking zit hem in de hoogte van de voorschotten.
Ik denk, collega's, mijnheer de minister, dat dit terecht is. Vergeten we immers niet dat er binnen het systeem van alimentatie en onderhoudsgelden een fiscale aftrekbaarheid bestaat die de Staat verschillende miljarden oude Belgische frank per jaar kost. Deze aftrekbaarheid geldt ook zonder inkomensbeperking. Als het ene recht zonder inkomensbeperking bestaat, moet het andere recht — mijns inziens terecht — ook zonder inkomensbeperking bestaan. Bovendien geldt het systeem voor alle onderhoudsgelden en niet enkel voor kinderen.
Eigenlijk is dit een alternatieve piste voor de sanctionering van een bestaand recht. Het is niet de toevoeging van rechten. In plaats van keer op keer het gerechtelijk apparaat in te schakelen — wat ook veel geld kost -, hebben we ervoor geopteerd het recht te sanctioneren door deze instantie die daarvoor het meest geëigend is, namelijk het ministerie van Financiën. Misschien heeft dit inschakelen van het ministerie een ontradend effect voor wanbetalers want men zal in de toekomst als onderhoudsplichtige wel goedkoper af zijn als men rechtstreeks betaalt aan degene die recht heeft op het onderhoudsgeld. Betaalt men immers niet en wendt men zicht tot de dienst, dan komt er sowieso voor minimum 6 maanden een verhoging van 10% bij. We kunnen er toch op rekenen dat dit een groter ontradend effect zal hebben dan een vriendelijk briefje van het OCMW om eventueel, als het even kan, toch maar te betalen. De OCMW's komen in het verhaal niet meer voor en dit op hun eigen vraag.
Wat de OCMW's betreft, heeft collega Verherstraeten erop gewezen dat zij vorige week in een brief hun bezorgdheid hebben geuit over het feit dat zij ertoe gehouden zijn, volgens artikel 22 van het ontwerp, op hun kosten alle nuttige inlichtingen te verstrekken met betrekking tot de bestaansmiddelen en de woonplaats of verblijfplaats van de onderhoudsplichtigen.
Zij vrezen immers dat ze de dienst voor alimentatievorderingen informatie zullen moeten doorgeven die onder het beroepsgeheim valt, met betrekking tot hun cliënten die onderhoudsgeld verschuldigd zijn. Daarom stellen zij in die brief voor om in de wettekst uitdrukkelijk op te nemen dat de artikelen 36, tweede lid, en 50 van de organieke wet van 8 juli 1976 over de OCMW's en artikel 458 van het Strafwetboek die het beroepsgeheim betreffen, onverminderd van toepassing zouden zijn. De vraag is gesteld aan de minister. Ik wil ze niet in zijn plaats beantwoorden, maar sta mij toch toe mijn mening te geven. Ik denk dat het niet nodig is om dit hier in de tekst op te nemen. Het wetsvoorstel heeft immers niet de bedoeling om te voorzien in een uitzondering op die bepalingen van de organieke wet of op de bepalingen van het Strafwetboek: deze blijven onverminderd van toepassing. Bovendien zullen bij koninklijk besluit nadere regels worden ingeschreven inzake de toepassing van deze bepaling van de wet, waarbij dan wel rekening zal worden gehouden met het beroepsgeheim.
Ik wil nog even stilstaan bij de prijs. Het is juist dat het alimentatiefonds een inzet zal vragen van mensen en van middelen, maar mij dunkt, dat is het waard. Ook het huidige systeem kost de Staat veel geld. Ten eerste, de voorschotten die nu via de OCMW's worden uitgekeerd en waar de recuperatiegraad ergens rond de 5% of 6% draait, hoeven niet meer. Laten wij zeggen: een bijna integraal verloren post! Ten tweede, ik zei het reeds eerder, de inschakeling van het gerechtelijk apparaat met alles wat daarbij hoort. Dat kost ook geld. Waarschijnlijk is een efficiëntere afhandeling via de dienst alimentatievorderingen te verkiezen, zeker als we de overbelasting van het gerechtelijk apparaat nu al bekijken. Ten laatste, veel zal afhangen van de efficiëntie van de recuperatie door de dienst zelf. Werkt deze dienst goed, werkt deze dienst snel — wat dat betreft stel ik het volle vertrouwen in de minister en zijn diensten —, dan zal inderdaad het roulement in de dienst groot zijn en zal door de terugvordering, die dan ook een sociaal heterogenere groep zal betreffen, uiteindelijk een stuk geldmassa kunnen worden gecreëerd waaruit de voorschotten kunnen worden betaald.
Ik onderken een tegenstrijdigheid bij wat collega Verherstraeten daarnet zei. Hij vroeg waarom je nog 5% moet betalen als rechthebbende op de gelden. Ten eerste, dat is niet juist. Je moet geen 5% betalen op hetgeen je krijgt van de dienst; op het voorschot moet je niks betalen. Die 5% worden later ingehouden en alleen op het supplementaire deel dat de dienst eventueel later recupereert. Maar ook dat is nodig om de werking van de dienst te financieren. Men kan niet langs de ene kant vragen of er wel is gedacht aan de kosten en of men de factuur niet doorschuift, en aan de andere kant ervoor pleiten om de kosten nog te gaan opdrijven.
De VLD zal dit wetsvoorstel, dat volgens ons de beste oplossing is, goedkeuren. We willen dit niet doen zonder de minister van Financiën en ook zijn diensten, waarvan enkele afgevaardigden hier op de tribune zitten, te bedanken voor de ongelofelijke inspanningen die zij hebben gedaan. Zij hebben tot en met in hun vakantie de zaak bekeken, uitgepuurd, herkauwd, aangepast aan compromissen, aangepast aan nieuwe teksten omdat de compromissen werden herroepen en uiteindelijk toch andere pistes werden gekozen. Chapeau daarvoor, jullie hebben echt heel goed werk geleverd.
Ter afsluiting, mijnheer de minister, mijnheer de voorzitter, laten wij dit plaatsen in een groter geheel. Inderdaad is het zo, dat ons echtscheidingsrecht terug een beetje verouderd is geworden en dat we moeten gaan naar schuldloze echtscheiding. Daarvoor liggen vele voorstellen op tafel. Of we nog rond geraken, weten we niet, maar in elk geval mag dit niet worden vergeten. Wat ook niet mag worden vergeten is dat we in het kader daarvan moeten gaan naar een objectivering van de bepaling van de hoogte van onderhoudsgelden.
Men heeft nu al te vaak het gevoel dat, als men een scheiding aanvraagt, men ergens instapt waarvan men de uitkomst niet kent, waarvan men niet weet hoeveel men verschuldigd zal zijn. Het verdient misschien aanbeveling ook daar binnen een welomschreven kader te werken en objectiveerbare criteria te hanteren. Dat is trouwens ook in andere landen het geval.
Collega's, ik wil het daarbij laten. Ik heb lang genoeg gesproken. Wij zullen dit voorstel in elk geval goedkeuren.

It took a long time for a legislative initiative to finally come to an end. I will not repeat what both the rapporteur and Mrs Herzet have said. In 1974, the first proposal was put on the table. Almost thirty years later, we can finally establish a service for maintenance claims. I would like to briefly list or repeat the reasons — repeating is sometimes necessary in politics — why this service for maintenance claims is so necessary and why the VLD will support this.
In 2001, ⁇ 30,000 marriages in Belgium ended in divorce. In many cases, this leads to the payment of maintenance payments for the children, for the former partner or for both. In two out of three cases, the child maintenance is concerned. The average amount of maintenance per child in Flanders was a year or three years ago if I am not mistaken — figures from the Family Union — 150 euros. In one case out of five, there is no payment, in two cases out of five, there is either insufficient or irregular payment. Only in a little less than half of the cases everything is done correctly as it should be. This is a large-scale social problem. As we have learned during the hearings we organized, then still in the Committee on Justice, non-payment of maintenance, either for children or for the former spouse, is one of the main causes of poverty or financial precarious situations. To this day, anyone who is faced with it can file a complaint for family abandonment. Mr. Verherstraeten — who, unfortunately, is no longer here — has rightly cited that the abuse of family abandonment is too often spotted. This also applies to complaints submitted for refusal of access. It is regrettable that the Minister of Justice is not here, because both cases can be traced back to the same, namely the inadequate action of the court, both in terms of the refusal of the right of contact and because of the crime of family abandonment. But well, those who are faced with it must then take the heft in their own hands and try to bring the difficult and expensive process of collection to a good end.
In addition, there is already a scheme within the framework of the OCMW. I will not repeat them, but this scheme has shortcomings. The amounts are too low and the categories are limited. After all, it is only about children. The OCMWs themselves are facing a number of problems because the recovery or recovery is almost null and the OCMWs do not get back all of the State that they advance.
Maintenance is a right. It is either a law established between the two parties, in mutual agreement, or established by the court. It is not a social benefit, it is not a favor. It is a right, a maintenance duty. In most cases, it is a maintenance obligation towards their own children which is not only a legal but, in my opinion, also a moral duty. There are, therefore, sufficient reasons to finally answer this question and to ensure that those who have the right can also rely on them to see this right adequately guaranteed.
There has been a long calvary for this bill. We have walked several pistes, abandoned, re-walked, yet again abandoned but eventually we were faced with a fundamental choice: either an extension of the existing OCMW system, or an alimony fund. An extension of the OCMW system would see the problem of maintenance payments permanently cataloged as social assistance. A social aid that would only be paid for “minority-divided” people, regardless of the border. Only creditors with a certain level of income, which would not exceed the limit, would be able to exercise that right to advance.
In the end, we all — the committee voted unanimously with a few abstentions — opted for the establishment of a Service for Maintenance Claims within the Ministry of Finance and for the application of the principle of universality. This means that anyone entitled to maintenance can use that service without income restriction. The limitation is at the level of the advances.
I think, my colleagues, Mr. Minister, this is right. After all, let us not forget that within the system of alimentation and maintenance payments there is a tax deductibility that costs the State several billion old Belgian francs per year. This deductibility also applies without income limitation. If one right exists without income limitation, the other right must, in my opinion rightly, also exist without income limitation. In addition, the system applies to all maintenance payments and not only children.
In fact, this is an alternative pathway for sanctioning an existing right. It is not the addition of rights. Instead of activating the judicial apparatus over and over again — which costs a lot of money — we have opted to sanction the right by this body that is most suitable for it, namely the Ministry of Finance. Per ⁇ this involvement of the Ministry has a deterrent effect for default payers because one will in the future be cheaper as a maintenance liable if one pays directly to the person who is entitled to the maintenance payment. After all, if one does not pay and one turns sight to the service, then anyway for a minimum of 6 months an increase of 10% will be added. We can still count on that this will have a greater deterrent effect than a friendly note from the OCMW to eventually, if possible, pay anyway. The OCMWs are no longer present in the story and this on their own request.
As regards the OCMWs, colleague Verherstraeten pointed out that in a letter last week they expressed their concerns about the fact that they were obliged, under Article 22 of the draft, to provide, at their own expense, all useful information relating to the means of subsistence and the place of residence or residence of the debtors.
In fact, they fear that they will have to communicate to the Service for Maintenance Claims information covered by the professional secrecy relating to their clients who are liable for maintenance. I recognize a contradiction in what colleague Verherstraeten recently said. He asked why you should pay another 5% as the rightholder on the funds. First, that is not correct. You do not have to pay 5% on what you get from the service; on the advance you do not have to pay anything. That 5% will be retained later and only on the additional part that the service may recover later. But this is also necessary to finance the functioning of the service. One cannot, on the one hand, ask whether the costs have been considered and whether the invoice is not pushed over, and on the other hand, advocate that the costs should continue to rise.
The VLD will approve this bill, which we believe is the best solution. We do not want to do this without thanking the Minister of Finance and also his services, some of whom are represented here on the tribune, for the incredible efforts they have made. They have looked at the matter until in their holidays, exhausted, refurbished, adjusted to compromise, adjusted to new texts because the compromise was revoked and eventually other pistes were chosen. Chapeau, you have done a really good job.
In conclusion, Mr. Minister, Mr. President, let us put this in a larger whole. Indeed, it is true that our right to divorce has become somewhat outdated and that we must go to innocent divorce. There are many proposals on the table. Whether we are still around, we do not know, but in any case this should not be forgotten. What should not be forgotten is that in this context we must go towards an objectivization of the determination of the amount of maintenance payments.
Too often now one has the feeling that, when one requests a divorce, one enters somewhere of which one does not know the outcome, of which one does not know how much one will be owed. It may also be recommended to work there within a well-defined framework and to use objectivable criteria. This is also the case in other countries.

Monsieur le président, monsieur le ministre, je voudrais vous formuler quatre réflexions à propos de cette proposition de loi. La première concerne nos travaux. Nous avons fait la démonstration à travers cette proposition que les deux branches du législatif que sont le parlement et le gouvernement peuvent, à certains moments, unir leurs efforts pour porter une idée. Cela ne se serait pas fait s'il n'y avait eu au sein du gouvernement un relais puissant de la préoccupation du parlement. De notre côté, je pense que nous avons beaucoup contribué à soutenir une logique qui était inscrite dans la démarche initiale et s'il y a eu plus de 130 amendements, ils ne tendaient pas à bouleverser les textes mais plutôt à les améliorer pour arriver dans l'état actuel des choses à un système aussi bon que possible et qui rencontre l'idée initiale qui avait animé un certain nombre de groupes.
Il faut dire aussi — et je rends hommage à tous les membres de la commission — que l'assiduité a été très grande, que la volonté d'aboutir a été très forte et que la manière de travailler a été marquée par cette volonté d'aboutir à une solution, au-delà des clivages naturels dans un parlement entre majorité et opposition.
En ce qui concerne les principes, ce qui est capital dans le texte que nous avons adopté, c'est que le droit à une créance alimentaire, le droit à voir cette créance alimentaire payée échappe largement à une vision qui rejetait ce problème dans la sphère privée, estimant qu'il s'agissait du problème classique d'un créancier et d'un débiteur, consistant à trouver, par les modes normaux d'exécution, la manière de voir le droit respecté.
Nous savions dès le départ que cette situation n'est pas vraie pour les créances alimentaires car, dans cette matière, nous ne sommes pas, d'après cette fiction du Code civil, entre un créancier et un débiteur qui sont égaux devant le droit et les moyens d'exécution. Il y a un déséquilibre qui joue le plus souvent en défaveur du créancier d'aliments. En effet, il commence son périple de créancier d'aliments dans des circonstances souvent humainement difficiles. Ce sont les ruptures, ce sont les tensions. C'est le chantage permanent concernant les enfants quand il y a des enfants. C'est le chantage permanent à ne pas payer les pensions lorsqu'il s'agit d'une pension alimentaire plutôt qu'une contribution. Il y a un faible et il y a un fort. Ce qui est capital sur le plan des principes, c'est que l'État vient ici au secours du faible, comme c'est son devoir, même si le fort peut avoir lui aussi ses faiblesses et ses difficultés. C'est, sur le plan des principes, l'affirmation que le droit à la créance alimentaire est un droit auquel la société s'intéresse et auquel l'État apporte sa force et son bras. Sur toutes les expéditions des jugements, on retrouve cette formule exécutoire disant que l'on mande les procureurs généraux, les procureurs du Roi, les forces de police pour exécuter le jugement. On sait bien que souvent en matière civile, cela se heurte à l'impossibilité d'obtenir le paiement. Dans ce système-ci, nous voyons désormais consacrée l'appartenance de ce problème à une sphère sociétale où la société s'intéresse clairement à l'exécution de ces obligations.
Très longtemps, nous avons eu l'illusion qu'à travers le droit pénal, l'Etat marquait bien son intérêt, puisqu'il avait instauré en délits le non-paiement de pensions alimentaires et l'abandon d'enfants. Mais il s'agissait de mesures souvent inadéquates, quoique nécessaires, puisque les parquets évitaient de poursuivre en pareille matière et surtout évitaient d'exécuter des décisions qui, entraînant des peines de prison, maintenaient l'impossibilité d'exécution.
Ici, nous avons un système accessible à tous et je pense que le droit de chacun des créanciers alimentaires est ici consacré, quel que soit son état de fortune, quelle que soit sa situation. C'est important. Je pense que c'est un des éléments essentiels du texte et c'est un progrès majeur. Par ailleurs, le système est simple, rapide et il s'accompagne, indépendamment du montant payé comme avance par les pouvoirs publics, par l'Etat, de la substitution au niveau de l'exécution des arriérés, ce qui soulage incontestablement les créanciers d'aliments.
J'ai été pendant 25 ans avocat et je peux dire que, à plusieurs reprises, j'ai été frappé par la lassitude des créanciers alimentaires lorsqu'ils sont à leur cinquième, à leur sixième exécution. Ils ont dépensé des frais irrécupérables mais largement supérieurs au montant de la pension et donc, à un certain moment, par lassitude, ils abandonnent. Par conséquent, très souvent, on voit des personnes disant qu'elles ont renoncé à réclamer leur pension alimentaire. Dans cette relation du faible et du fort; c'est le faible qui, à un moment donné, n'a plus confiance dans les institutions publiques, n'a plus la possibilité matérielle d'utiliser la force publique ou les moyens d'exécution. C'est quelque chose qui marque une vie que d'être ainsi entièrement soumis à cette obligation de peser entre des frais et des démarches administratives et juridiques très lourdes et le renoncement à la pension alimentaire.
Il y a un autre aspect marquant dans ces relations, c'est ce que j'appelle le chantage. Combien de fois ne voit-on pas dire au créancier ou à la créancière d'aliments, en ce qui concerne les enfants par exemple, "ou bien tu abandonnes toute revendication ou je monte les enfants contre toi"?. Combien de fois, lors de ses droits de visite, le débiteur d'aliments ne fait-il pas de chantage sur l'enfant en lui disant "mais voilà, je te refuse tel ou tel avantage parce que ta mère me poursuit, parce qu'il y a des frais de justice, etc."? La tension est donc souvent maximale dans des couples déchirés et ce chantage est d'autant plus facile que l'on est en présence d'un affrontement direct entre créancier et débiteur d'aliments. L'intervention d'un tiers, qui en l'espèce est l'Etat à travers le service des Finances, est un progrès énorme dans ces rapports. L'interposition de ce tiers a pour effet que les rapports peuvent être moins tendus, que ces rapports ne sont plus des rapports d'aigreur, puisque si l'huissier est envoyé, il ne l'est pas par le créancier alimentaire mais par un tiers. Je pense que cela va apaiser fortement les relations entre les créanciers et les débiteurs d'aliments.
Enfin, il y a cet élément capital de toute législation qui doit être effective, c'est ce que l'on appelle le gros bâton derrière la porte. Je suis persuadé que le caractère dissuasif du recours à ce système va faire en sorte que des gens qui n'ont pas la bonne volonté quant au payement vont être amenés à payer.
M. van Weddingen disait tout à l'heure que la vocation de ce système est d'être biodégradable, c'est-à-dire dégradable par son efficacité et par le fait que chacun saura que l'on n'échappe pas à une obligation. Savoir une telle chose constitue un élément important pour la remplir.
J'en viens au dernier élément positif de ce texte.
Très longtemps, les adversaires étaient essentiellement guidés par la peur de voir les collectivités locales et en particulier les CPAS se trouver face à une charge extrêmement lourde qui n'était pas seulement la gestion administrative. Il y avait aussi l'avance, le paiement avec des délais entre le paiement et le remboursement par l'Etat. Le système libère, selon moi, les collectivités locales et particulièrement les CPAS de cette obligation et aboutit surtout à ce que ces derniers peuvent se concentrer sur leurs obligations en la matière, qui consistent à faire face à des situations urgentes sans que leurs fonctions ne soient alourdies.
Voilà donc l'aboutissement de près de 30 ans de combat.
Il est assez intéressant de constater que s'il n'y avait pas eu un nombre suffisant de femmes au sein de ce Parlement, nous n'aurions pas pu faire aboutir ce texte. En conséquence, s'il fallait un argument pour convaincre que l'équilibre hommes/femmes est un élément de progrès dans notre société, vous en avez fait, mesdames, lors de tous ces débats, la démonstration. Et je pense pouvoir dire que quelques hommes vous ont accompagnées dans cette démarche.
Nous voterons donc cette loi sans réserve.

It must also be said – and I pay tribute to all the members of the commission – that the attendance was very large, that the will to succeed was very strong, and that the way to work was marked by this will to succeed in a solution, beyond the natural divisions in a parliament between majority and opposition.
Regarding the principles, what is crucial in the text we adopted is that the right to an alimony claim, the right to see that alimony claim paid, largely escapes a vision that rejected this problem in the private sphere, believing that it was the classic problem of a creditor and a debtor, consisting in finding, through the normal modes of execution, the way to see the right respected.
We knew from the beginning that this situation is not true for maintenance claims because, in this matter, we are not, according to this fiction of the Civil Code, between a creditor and a debtor who are equal before the law and the means of enforcement. There is an imbalance that most often plays at the disadvantage of the food creditor. In fact, he begins his journey as a food creditor under often humanally difficult circumstances. These are the breaks, these are the tensions. This is the constant blackmail of children when there are children. This is the constant blackmail of not paying pensions when it comes to an alimentary pension rather than a contribution. There is a strong and there is a weak. What is capital on the level of principles is that the State comes here to help the weak, as it is its duty, even though the strong may also have its weaknesses and its difficulties. It is, on the level of principles, the assertion that the right to maintenance claim is a right that society is interested in and to which the state contributes its strength and arm. On all expeditions of judgments, we find this executable formula saying that the prosecutors general, the prosecutors of the King, the police forces are sent to execute the judgment. It is well known that often in civil matters, this comes up with the impossibility of obtaining payment. In this system, we now see consecrated the belonging of this problem to a social sphere where the society is clearly interested in the fulfillment of these obligations.
For a very long time, we have had the illusion that through the criminal law, the state marked its interest well, since it had established in crimes the non-payment of alimony pensions and the abandonment of children. But these were often inadequate measures, although necessary, since the prosecutors avoided prosecution in such matters and above all avoided the execution of decisions which, resulting in prison sentences, kept the impossibility of execution.
Here, we have a system accessible to all and I think that the right of each of the food creditors is hereby enshrined, regardless of their state of fortune, regardless of their situation. It is important. I think this is one of the essential elements of the text and it is a major progress. Furthermore, the system is simple, quick and it is accompanied, regardless of the amount paid as advance by the public authorities, by the State, of the substitution at the level of the execution of the delays, which undoubtedly relieves the alimony creditors.
I have been a lawyer for 25 years and I can say that, repeatedly, I have been struck by the fatigue of food creditors when they are at their fifth, sixth execution. They have spent irrevocable expenses but largely higher than the amount of the pension and therefore, at some point, out of fatigue, they give up. Therefore, very often, we see people saying that they have given up claiming their maintenance. In this relationship of the weak and the strong; it is the weak who, at a given moment, no longer trusts the public institutions, no longer has the material possibility to use the public force or the means of execution. It is something that marks a lifetime to be thus fully subject to this obligation to weigh between very heavy costs and administrative and legal procedures and the renunciation of the maintenance pension.
There is another striking aspect in these relationships, that is what I call blackmail. How often do we not see the creditor or the creditor of alimony, in relation to children for example, say, "or you give up any claim or I raise the children against you"? How many times, during his visitor rights, does the maintenance debtor not blackmail the child by saying to him, "but here, I refuse you this or that advantage because your mother is pursuing me, because there are court fees, etc."? The tension is therefore often maximum in divorced couples and this blackmail is all the easier as one is in the presence of a direct confrontation between a creditor and an alimony debtor. The intervention of a third party, which in this case is the State through the Department of Finance, is a huge progress in these reports. The interposition of this third party has the effect that the reports can be less tense, that these reports are no longer aggravation reports, since if the executor is sent, it is not by the food creditor but by a third party. I think this will greatly soothe the relations between creditors and food debtors.
Finally, there is that essential element of any legislation that must be effective, that is what is called the big stick behind the door. I am convinced that the deterrent nature of using this system will ensure that people who do not have the good will in terms of payment will be forced to pay.
by Mr. Van Weddingen once said that the vocation of this system is to be biodegradable, i.e. degradable by its effectiveness and by the fact that everyone will know that one cannot escape an obligation. Knowing such a thing is an important element in fulfilling it.

For a very long time, opponents were essentially driven by the fear of seeing local authorities and in particular the CPAS face an extremely heavy burden that was not just administrative management. There was also the advance, payment with deadlines between payment and refund by the state. The system releases, in my opinion, the local authorities and in particular the CPAS from this obligation and results above all in the latter being able to focus on their obligations in the matter, which consists in dealing with urgent situations without their functions being burdened.

Mijnheer de voorzitter, mijnheer de minister, collega's, vandaag ligt ter bespreking voor een wetsvoorstel dat ertoe strekt bij de FOD Financiën een nieuwe dienst voor alimentatievorderingen op te richten, die belast zal worden met het uitbetalen van voorschotten op onderhoudsgelden aan de onderhoudsgerechtigden en met het innen van dat onderhoudsgeld bij de onderhoudsplichtigen. Het nieuw op te richten fonds neemt zo de taken over die nu door de OCMW's worden uitgevoerd, met dien verstande dat het toepassingsgebied verruimd wordt. Er geldt geen inkomensgrens meer om in aanmerking te komen voor een tussenkomst van het fonds. Ook het onderhoudsgeld tussen gewezen echtgenoten of samenwonende partners kan door het fonds voorgeschoten worden. Tot slot wordt ook het plafond van het maandelijkse onderhoudsgeld opgetrokken. Ik denk dat al die verruimingen toe te juichen zijn en dat zij inderdaad serieuze verbeteringen zijn van de huidige regeling.
Voortaan zal het onderhoudsgeld efficiënter worden ingevorderd omdat die taak wordt toevertrouwd aan de Federale Overheidsdienst Financiën die op dat terrein een bijzondere ervaring en expertise heeft opgebouwd.
De nagestreefde efficiëntie staat in tegenstelling tot de toestand tot op heden. Uit de cijfers blijkt immers dat de OCMW's een te beperkt gedeelte van de door hen voorgeschoten sommen konden recupereren van de onderhoudsplichtige. Het OCMW van Antwerpen bijvoorbeeld heeft In 1999 slechts 5,4% van de dossiers ingevorderd. De kostprijs voor het voorschieten en invorderen van dat onderhoudsgeld kost een stad als Antwerpen ongeveer 250.000 euro. Deze kost wordt bijna integraal afgewenteld op de overheid. Dat betekent dat de gemeenschap — wij allen dus — opdraaien voor wie zich aan zijn meest elementaire plichten onttrekt.
Als gemeenschapspartij pleiten wij voor solidariteit. Als verantwoordelijkheidspartij menen wij echter dat de burgers hun verantwoordelijkheid niet mogen ontvluchten. De Staat — en bij uitstek de wetgever — moet ervoor zorgen dat de burger zijn verantwoordelijkheid opneemt en, bij gebrek hieraan, op de meest efficiënte wijze daartoe wordt gedwongen en dat als ultimum remedium de Staat ingrijpt waar nodig. In dat geval is de vraag op welke manier zulks het meest efficiënt gebeurt. Precies op dat vlak heb ik tal van vragen en opmerkingen waarop ik later terugkom.
Eerst wil ik het principe poneren dat voor ons in elk geval moet gelden dat de individuele verantwoordelijkheid speelt, dat de onderhoudsplichtige zijn plichten moet nakomen en dat hij daartoe zo nodig moet worden gedwongen alvorens bijna automatisch wordt gegrepen naar de solidariteit van de gemeenschap.
Wij hebben de indruk dat de slinger inzake individuele verantwoordelijkheid uit cadans is geraakt en dat hij veel te ver doorslingert in de richting van onverantwoordelijkheid.
Vanuit dit principe staan wij zeer kritisch tegenover de uitgewerkt methode, mevrouw Herzet, maar niet tegenover de doelstelling van dit voorstel, laat dit duidelijk zijn. Wij sluiten onze ogen niet voor de problematiek die aan de basis ligt van dit wetsvoorstel en ik meen dat ik wellicht als eerste en misschien zelfs als een van de weinige leden van de commissie voor de Justitie niet een keer, maar herhaaldelijk de minister van Justitie interpelleerde over de problematiek van de familieverlating en van het niet-naleven van het omgangsrecht waarop ook de heer Verherstraeten de aandacht nogmaals vestigde.
Ik wees de minister op het falende vervolgingsbeleid van de parketten in deze aangelegenheid. Het betalen van onderhoudsgeld is een verplichting die wordt opgelegd, hetzij bij overeenkomst, hetzij door een vonnis van de rechterlijke macht. Het niet-betalen van onderhoudsgeld is strafbaar.
Op mijn vragen tot de minister over deze problematiek ontving ik schrijnende en onthutsende antwoorden.
Heel die problematiek van familiaal disfunctioneren — het niet-betalen van onderhoudsgeld, het niet-naleven van het omgangsrecht — en zelfs de problematiek van het intrafamiliaal geweld, waarop ik de minister herhaaldelijk heb gewezen, blijft veel te veel buiten het blikveld van de parketten. Dit is geen vervolgingsprioriteit. Ik heb de minister daarover herhaaldelijk ondervraagd. Ik heb hem herhaaldelijk gevraagd om, in zijn hoedanigheid van minister van Justitie die het vervolgingsbeleid aanstuurt, daarvan een prioriteit te maken. Dit gebeurt niet, net zoals er geen prioriteit wordt gemaakt van het vervolgend optreden bij het niet-naleven van het omgangsrecht en net zoals niet naar efficiënte middelen wordt gezocht om het omgangsrecht te laten naleven.
In Frankrijk, collega's — ik zeg dit even terzijde — heeft 25% van de adolescenten geen contact meer met een van zijn ouders. Het gaat om 25% van de adolescenten. Ik denk dat dit maatschappelijk echt onrustwekkend is. Heel wat mensen overal in Europa beginnen daarvoor aandacht te krijgen. Daarom stellen wij voor om op het trouwboekje ook de plichten van de ouders ten aanzien van de kinderen in te schrijven. Wij staan voor onrustwekkende evoluties. Ik heb een paar wetsvoorstellen ingediend op dit punt om de rechter een actieve rol te geven inzake de naleving van het omgangsrecht. U weet dat gerechtsdeurwaarders heel terughoudend zijn in deze materie. Zij weigeren om op te treden omdat het gaat over bijna materieel geweld ten opzichte van minderjarigen, wat heel delicaat is. Ik heb ook een wetsvoorstel ingediend om een dwangsom apart te kunnen opleggen als het omgangsrecht niet wordt nageleefd. Hierdoor kan men nog eens apart naar de rechter stappen om een dwangsom op te leggen. Dit wou ik terzijde opmerken om te wijzen op de problematiek van het omgangsrecht die langs de andere kant evenzeer grote menselijke, maatschappelijke frustraties veroorzaakt. Dan heb ik het nog niet over het intrafamiliaal geweld dat ook door de parketten wordt verwaarloosd.
Ik meen dat de cijfers inzake het niet-betalen van onderhoudsgeld onthutsend zijn. Minstens 18% van de onderhoudsuitkeringen ten gunste van kinderen wordt helemaal niet betaald en 24% wordt laattijdig betaald. We weten dat heel veel uit de echtgescheiden ouders onder de armoedegrens terechtkomen omdat het onderhoudsgeld waarop zij recht hebben, niet wordt betaald. Dit is een zeer reëel probleem dat een punt van zorg moet zijn voor de wetgever. Eenoudergezinnen met één inkomen die onderhoudsgeld nodig hebben en onderhoudsgeld krijgen, zitten reeds veelal in de categorie van de maatschappelijk zwaksten, laat staan dat het onderhoudsgeld waarop zij rekenen, niet wordt betaald.
Deze principes mogen echter niet beletten, collega's, dat wij het voorliggende wetsvoorstel kritisch moeten benaderen. Zoals ik in het begin heb gezegd, moeten wij ons afvragen of het middel dat hier wordt aangewend het meest efficiënte is om dit doel — dat wij, denk ik, allemaal onderschrijven — te bereiken. Ik meen dat dit niet het geval is. Het nagestreefde doel kan veel efficiënter, goedkoper en met een grotere responsabilisering tot gevolg, worden bereikt. Ik meen dat de wetgever er in eerste instantie voor moet zorgen dat de onderhoudsplichtige zelf zijn verantwoordelijkheid opneemt en zijn verplichtingen nakomt. Het is immers in eerste instantie de ouder die de verantwoordelijkheid voor zijn kinderen moet opnemen. Men mag dit niet al te vlug — ik zou bijna a priori zeggen — afwentelen op de gemeenschap. De tussenkomst van de gemeenschap moet de ultieme remedie zijn om deze mensen in een noodsituatie te helpen.
Ik heb een aantal wetsvoorstellen ingediend. Ik heb een aantal suggesties geformuleerd die mijns inziens eigenlijk voorafgaandelijk moeten worden goedgekeurd en vooral moeten worden uitgevoerd.
Het eerste, ik heb het al gezegd, heeft betrekking op de vervolgingsprioriteit voor het misdrijf familieverlating. Een aanzienlijk aantal klachten over het niet betalen van onderhoudsgeld wordt niet vervolgd en komt dus nooit voor de rechtbank. De meeste dossiers worden zelfs geseponeerd. Ik heb daarover de minister van Justitie ondervraagd, onder andere op 6 maart 2001, met mijn mondelinge vraag nummer 4035. Daaruit blijkt dat het aantal seponeringen veel groter is dan het aantal veroordelingen.
Ik wil toch een nuance maken bij wat collega Viseur heeft gezegd, namelijk dat men geen onderhoudsgeld meer kan betalen eens men in de gevangenis zit. Dat is juist, maar de praktijk is natuurlijk anders. De praktijk is dat de meeste van die vervolgden, wanneer zij voor de strafrechter staan en wanneer deze hen voor de keuze plaatst — het gaat meestal over een man -: "Mijnheer, gaat u betalen of verkiest u de gevangenis? Ik zie u hier terug over twee maanden" alsnog tot betaling overgaan. Als praktijkjurist kan ik u zeggen dat de meesten onder hen op dat moment betalen. Een keer zij geconfronteerd worden met de dreigende gevangenisstraf, gaan zij plots beseffen dat zij verplichtingen hebben die zij moeten nakomen.
Ik betreur zeer sterk, en ik sluit mij aan bij de kritiek van collega Moerman op de minister van Justitie, dat de minister ondanks herhaalde vragen van kamerleden uit de oppositie en de meerderheid, hiervan geen vervolgingsprioriteit maakt. Men zou maatschappelijk het allersterkste signaal geven door te zeggen: dit is vervolgingsprioriteit, alsook alles wat te maken heeft met de familiale situatie. Ik denk dat collega Moerman hierin gelijk heeft. Ik heb dit trouwens vroeger herhaaldelijk gevraagd aan de minister van Justitie.
Een tweede voorstel dat wij formuleren en hebben ingediend bij wijze van wetsvoorstel, is de veralgemening van de ontvangstmachtiging. Terecht werd hier door collega's, ik denk ook door collega Herzet, gewezen op de enorme kosten die mensen soms moeten maken om het onderhoudsgeld, dat soms relatief laag is, te recupereren. Men moet beslag laten leggen, de onderhoudsplichtige verandert van werkgever of verhuist, men moet opnieuw beslag laten leggen, er moet een nieuwe verkoopdatum worden bepaald; de kosten stapelen zich op. Dat moet worden vermeden, daarom stellen wij voor om inzake onderhoudsgeld altijd automatisch een ontvangstmachtiging uit te spreken. De vrederechter kan dit nu doen, maar volgens ons moet dit in plaats van facultatief een automatisme worden. Dit betekent dat de facultatieve ontvangstmachtiging veralgemeend zou moeten worden, dat zij regel zou moeten worden. Het wetsvoorstel nr. 1217, dat ik heb ingediend samen met collega Van Hoorebeke, houdt in dat de vrederechter en de rechter in kort geding een ontvangstmachtiging uitspreken, telkens als een persoon veroordeeld wordt tot het betalen van onderhoudsgeld. Op die manier kan de onderhoudsgerechtigde — zonder dat hij kosten moet maken of naar een deurwaarder moet gaan — bij de instelling die moet betalen, bij de werkgever die moet betalen of bij eender welke schuldenaar van de onderhoudsplichtige, ervoor zorgen dat de bedragen worden geïnd. Zo komt men tot een veel efficiëntere, eenvoudigere en uiteraard goedkope manier van invordering.
Wij stellen ook voor om de rechter in kort geding dezelfde bevoegdheden te geven als de vrederechter, door er met name voor te zorgen dat de kort gedingrechter — zoals de vrederechter dus nu al kan doen — de echtgenoten en zelfs derden kan verplichten om alle inlichtingen en documenten te verstrekken die een licht werpen op de inkomsten en schuldvorderingen van de partijen.
Na aanvaarding van ons voorstel zou inning van onderhoudsgeld veel gemakkelijker en met veel minder kosten kunnen verlopen.
Het derde voorstel dat mijn fractie heeft ingediend is een wetsvoorstel tot wijziging van het misdrijf familieverlating. Collega's, ik vraag uw aandacht voor dit voorstel. De N-VA vraagt de Franse wet in te voeren. Artikel 391bis van het Strafwetboek definieert het misdrijf familieverlating. Wie meer dan 2 maanden in gebreke blijft om onderhoudsgeld te betalen stelt zich bloot aan correctionele vervolging. Een van de constitutieve bestanddelen van het misdrijf is dat er een rechterlijke beslissing moet zijn die niet meer vatbaar is voor beroep of voor verzet, anders gezegd een rechterlijke beslissing die in kracht van gewijsde is getreden. In de praktijk valt het heel vaak voor dat er beroep wordt aangetekend tegen een rechterlijke beslissing die onderhoudsgeld oplegt. Ondertussen moet die onderhoudsplichtige wel betalen, de beslissing is uitvoerbaar. Het vonnis is echter niet definitief. Dit betekent dat het parket niet kan vervolgen terwijl de zaak in beroep jarenlang kan aanslepen. Er is geen misdrijf. Degene die zijn onderhoudsgeld niet betaalt, kan niet voor de strafrechter worden gebracht. Een strafrechtelijke vervolging is niet mogelijk. Ons wetsvoorstel 1218 strekt ertoe om de constitutieve bestanddelen van het misdrijf familieverlating te wijzigen. We stellen voor niet langer een definitief vonnis te eisen, wel een vonnis dat uitvoerbaar is en betekend wordt. Op grond van dit vonnis — los van verdere procedures — kan men tot vervolging overgaan zoals dit op dit ogenblik in Frankrijk het geval is.
Ons vierde wetsvoorstel, document 1388, strekt ertoe een onderzoeks- en informatierecht door de gerechtsdeurwaarder in te voeren. Dit voorstel strekt ertoe alle soorten vonnissen veel makkelijker te kunnen uitvoeren om veel makkelijker zicht te hebben op de inkomsten en het vermogen van de betrokkene. Ook dit voorstel is in Frankrijk wet. In alle bescheidenheid durf ik te stellen dat wij dit verfijnd en verbeterd hebben. De gerechtsdeurwaarders zijn vragende partij. In de praktijk is het immers zo dat voor een partij die moet betaald worden het praktisch ondoenbaar is om het vonnis uit te voeren. In vele gevallen zijn de debiteuren heel vindingrijk in het onttrekken van hun vermogen aan de grip van hun schuldeisers. Daarom stellen we voor dat de gerechtsdeurwaarder het recht krijgt om informatie te verwerven over, en een onderzoek in te stellen naar het vermogen van de schuldenaar. Dit kan bij de schuldenaar zelf, bij de banken, bij de notarissen en zelfs bij advocaten. Dit evenwichtige voorstel leidt ertoe dat er transparantie ontstaat en dat een vonnis veel gemakkelijker en met veel minder kosten kan worden uitgevoerd.
Mijnheer de voorzitter, collega's, ik zal niet in detail ingaan op elk van de voorstellen. Dat zou me veel te ver leiden. Ik heb echter willen aantonen dat er andere, veel meer wenselijke wegen bestaan om het doel dat we allemaal voor ogen hebben te bereiken, in casu ervoor zorgen dat het onderhoudsgeld betaald wordt. Het meest efficiënte middel is, mijns inziens, vervolgingsprioriteit voor dit misdrijf. De onderhoudsplichtige kan dus, naar mijn mening, via een aantal technieken sterk geresponsabiliseerd worden zodat in eerste instantie het niet betalen van onderhoudsgeld niet op de Staat, niet op de gemeenschap, niet op ons allemaal afgewenteld wordt. Maar natuurlijk moet de gemeenschap wel bijspringen. Daarin steun ik het doel, collega Herzet, van uw wetsvoorstel. De gemeenschap moet bijspringen wanneer er niet betaald wordt, wanneer men behoeftig is, wanneer er een probleem ontstaat. De vraag rijst dan hoe men dat het best doet. Wij, van de N-VA, geloven dat dit nog altijd het beste zou gebeuren door het OCMW. Wij geloven niet in die nieuwe centrale, centralistische instelling, die nieuwe dienst bij de FOD Financiën. Ik heb daar een aantal bezwaren tegen.
In eerste instantie heb ik, bij het wetsvoorstel zelf, toch wel bedenkingen bij artikel 6. Artikel 6 eist namelijk niet dat men een beroep doet op die dienst alimentatie als er achterstal is. Er moet geen achterstal zijn en toch kan men zich tot die dienst wenden. Artikel 6 bepaalt alleen dat er achterstal geweest moet zijn van twee al dan niet opeenvolgende termijnen gedurende de voorbije periode van 12 maanden. Dat betekent dus dat die dienst kan invorderen terwijl de onderhoudsplichtige ondertussen toch kan betalen. Hij heeft ooit een achterstal gehad, maar nu niet meer, en betaalt nu goed. Dan ontstaat er een serieus conflict, met een nieuwe discussie, nieuwe rompslomp en verzet bij de beslagrechter. Ik vind dat artikel 6, zoals het hier geformuleerd is, heel ver gaat.
Een volgend bezwaar betreft de nieuwe dienst en in het bijzonder de nieuwe administratieve rompslomp die gecreëerd wordt. Het gaat om een nieuwe procedure. De betrokkene moet dat namelijk schriftelijk aanvragen, ook in dit tijdperk van e-governement. De betrokkene mag niet naar zijn OCMW gaan, waar alles toch zo dicht bij de mensen staat. Dat gebeurt uitgerekend op een moment waarop alleszins in Vlaanderen gedacht wordt aan de uitbouw van het OCMW tot een sociaal huis. Ik maak dus toch wat voorbehoud bij wat een van de vorige sprekers zei: "Wie naar het OCMW gaat, wordt gestigmatiseerd". Dat mag het dus juist niet meer zijn, collega's! Een OCMW zou een sociaal huis moeten worden waar iedereen, niet alleen de behoeftigen, maar ook andere mensen met sociale noden — welke die ook moge zijn —, terecht kan en geholpen wordt op een eenvoudige, vriendelijke en klantvriendelijke manier, dicht bij de mensen. Nu wordt dat van de mensen weggetrokken. Wij, van de N-VA, zijn voorstander van het Deense model waarbij de diensten bij de mensen gebracht worden en niet centraal in Brussel worden ondergebracht.
Waarom die nieuwe administratieve rompslomp, die procedure, die termijnen, die verzetsmogelijkheid bij de beslagrechter, zowel van de onderhoudsgerechtigde als van de onderhoudsplichtige? Dat zal een zware, bijkomende procedure worden, terwijl het precies een van de hoofddoelstellingen van deze meerderheid was om tot administratieve vereenvoudiging te komen. Dat was toch een van de grote dada's van paars-groen: "Wij gaan administratief vereenvoudigen". Hoe kan men eenvoudiger werken in zulke sociale materie dan aan de mensen te zeggen dat ze in hun gemeente naar hun OCMW kunnen stappen, dat voor hen alles oplost en dat ook de voorschotten betaalt. Dat is natuurlijk het meest eenvoudige en het meest efficiënte. Collega's, waarom laat u die voorschotten niet betalen door het OCMW? Laat u ze daarna inderdaad — daarin geef ik u gelijk — invorderen door de fiscus die daarin, zoals gezegd, ervaring heeft, daarvoor de nodige middelen heeft en zelf kan overgaan tot invordering. Maar laat de OCMW's voorschieten en laat dan de fiscus terugvorderen. Dat lijkt mij een goed idee te zijn. Niet echter de manier waarop nu te werk gegaan wordt.
Ik kom tot een derde bezwaar.
Collega's, deze wet zal een transfer realiseren van Vlaanderen naar Wallonië. Ik kijk naar de praktijkjuristen rond mij. Elke praktijkjurist in Vlaanderen weet dat invorderen in Wallonië nagenoeg een onmogelijke klus is. Ik word daar nog elke maand over aangesproken. Men komt in Wallonië niet tot uitvoering. In Vlaanderen ligt dat helemaal anders. Ik geef het u op een blaadje: met het wetsvoorstel zal een nieuwe noord-zuid-transfer ontstaan. Dit zal het zijn: wie zich het meeste aan zijn verantwoordelijkheid onttrekt, zal het meeste kunnen rekenen op de solidariteit van degene die de wet naleeft. Hij zal kunnen rekenen op de solidariteit van degene die ervoor zorgt dat de wet wordt uitgevoerd. Dat is de realiteit.
Ten slotte heb ik nog een laatste bezwaar. Ik betreur dat de Raad van State geen advies heeft gegeven over de grondwettelijkheid en de bevoegdheidsproblematiek van dit laatste voorstel. Er is wel advies gevraagd aan de Raad van State over het aanverwante wetsvoorstel van mevrouw Burgeon. Over dat voorstel heeft de Raad van State gezegd dat de federale wetgever de bevoegdheid heeft om deze aangelegenheid te regelen. Het ging immers over een materie van Justitie, met name de invordering van onderhoudsgelden. Dat is inderdaad nog altijd een federale bevoegdheid.
Collega's, ik denk dat deze redenering niet kan worden doorgetrokken naar dit wetsvoorstel. Dit wetsvoorstel heeft geen betrekking op het oprichten van een fonds, laat staan op het oprichten van een fonds bij het ministerie van Justitie. Het wetsvoorstel strekt ertoe bijstand te verlenen aan degenen die moeilijkheden ondervinden bij de inning van onderhoudsgeld. Welnu, bijstand aan personen is de bevoegdheid van de Gemeenschappen. Het wetsvoorstel heeft door de vele peripetieën en vele discussies een totaal andere oriëntatie gekregen. Het fonds was eerst een materie van Justitie. Het was dus een federale materie. Het is nu echter een materie geworden van bijstand aan personen. Naar mijn aanvoelen is dat een bevoegdheid van de Gemeenschappen. Het is geen federale bevoegdheid. Over dat aspect heeft de Raad van State geen advies gegeven.
Collega's, ik besluit. Ik herhaal dat wij volmondig achter de doelstelling staan. Wij zouden die doelstelling op diverse andere manieren willen bereiken. Ik heb u vier methodes geschetst om de doelstelling te bereiken.
Ten slotte, als de doelstelling met andere wettelijke middelen niet wordt bereikt, moet naar ons aanvoelen geen centrale dienst worden opgericht bij het ministerie van Financiën. Het OCMW moet die taak vervullen op een klantvriendelijke manier, dichtbij de mensen en gedecentraliseerd, zoals moderne democratieën werken. Ik verwijs naar het Deense voorbeeld.
De huidige meerderheid slaat hier een weg in, die eigenlijk niet strookt met wat haar prioriteit was. Haar prioriteit was immers administratieve vereenvoudiging.
Wij hebben dus grote problemen met de middelen die de meerderheid heeft uitgewerkt om een erg behartigenswaardig doel te bereiken. Wij blijven achter dit doel staan. Wij hebben echter in alle bescheidenheid evengoede, zo niet betere voorstellen om dat doel te bereiken. Omwille van de grote, praktische en constitutionele bezwaren keuren wij het wetsvoorstel niet goed. Wij zijn uiteraard niet tegen. Wij stemmen niet tegen een voorstel, waarvan wij de doelstellingen volmondig onderschrijven.

Mr. Speaker, Mr. Minister, colleagues, today is under discussion for a bill aiming at establishing a new service for maintenance claims at the FOD Finance, which will be charged with the payment of advances on maintenance payments to the entitled to maintenance and with the collection of that maintenance payments from the entitled to maintenance. The new fund to be established will thus take over the tasks currently carried out by the OCMWs, with the extension of its scope. There is no longer an income limit to be eligible for an intervention from the Fund. Also the maintenance between former spouses or cohabiting partners can be advanced by the fund. Finally, the ceiling of the monthly maintenance allowance is also raised. I think that all these expansions are welcome and that they are indeed serious improvements to the current scheme.
From now on, maintenance payments will be collected more efficiently because the task is entrusted to the Federal Public Service Finance, which has gained special experience and expertise in this area.
The desired efficiency is contrary to the state of affairs so far. Indeed, the figures show that the OCMWs were able to recover an excessively limited part of the amounts advanced by them from the maintenance debtor. The OCMW of Antwerp, for example, collected only 5.4% of the files in 1999. The cost of pre-shooting and collecting that maintenance fee costs a city like Antwerp about 250,000 euros. This cost is almost entirely allocated to the government. This means that the community—that is, all of us—inspires those who escape from their most basic duties.
As a community party, we advocate solidarity. As a responsible party, however, we believe that citizens should not escape their responsibility. The State — and above all the legislator — must ensure that the citizen assumes his responsibility and, in the absence of this, is forced to do so in the most efficient way, and that as ultimum remedy the State intervenes where necessary. In this case, the question is how to do this most efficiently. I have a lot of questions and comments to which I will return later.
First, I would like to point out the principle that, in any case, we must assume individual responsibility, that the person liable for maintenance must fulfill his duties and that he must be forced to do so if necessary before almost automatically resorting to the solidarity of the community.
We have the impression that the slope on individual responsibility has stumbled from cadans and that it is sliding too far in the direction of irresponsibility.
From this principle, we are very critical of the method developed, Mrs Herzet, but not of the objective of this proposal, let this be clear. We do not close our eyes to the problem that is at the basis of this bill and I think that I may be the first and maybe even one of the few members of the Justice Committee not once, but repeatedly interpelled the Minister of Justice about the problem of family abandonment and the non-compliance with the right of contact which also Mr. Verherstraeten once again drew attention to.
I pointed out to the Minister the failing prosecution policy of the prosecutors in this matter. Payment of maintenance is an obligation imposed, either by contract or by a judgment of the judiciary. Failure to pay maintenance is criminal.
To my questions to the Minister on this issue, I received shocking and shocking answers.
The whole problem of family dysfunction — the non-payment of maintenance, the non-compliance with the right of contact — and even the problem of intra-family violence, which I have repeatedly pointed out to the minister, remains far too far out of the field of view of the parks. This is not a persecution priority. I have repeatedly questioned the Minister about this. I have repeatedly asked him, in his capacity as the Minister of Justice who directs the prosecution policy, to make it a priority. This does not happen, just as no priority is given to the follow-up action in the case of non-compliance with the right of contact and just as no efficient means are sought to enforce the right of contact. In France, colleagues — I say this for a moment aside — 25% of adolescents no longer have contact with one of their parents. It affects 25% of adolescents. I think this is socially really disturbing. A lot of people across Europe are starting to get attention to this. Therefore, we propose that the marriage certificate also contain the obligations of the parents towards the children. We are facing disturbing developments. I have submitted a few bills on this point to give the judge an active role in compliance with the right of contact. You know that court enforcers are very reluctant in this matter. They refuse to act because it is almost material violence against minors, which is very delicate. I have also submitted a bill to allow for a separate imposition of a penalty if the right of contact is not respected. This makes it possible to go to the court separately to impose a penalty. I would like to point this aside in order to point out the problem of the right of access which, on the other hand, causes equally large human, social frustrations. Then I’m not talking about intrafamily violence that is also neglected by the parks.
I think the figures on non-payment of maintenance payments are shocking. At least 18% of child maintenance benefits are not paid at all and 24% are paid late. We know that many divorced parents fall below the poverty line because the maintenance they are entitled to is not paid. This is a very real problem that should be a point of concern for the legislator. Single-income single-income families who need maintenance and receive maintenance are already often in the category of the socially weakest, let alone the maintenance they charge is not paid. Their
These principles, however, should not prevent us, colleagues, from having a critical approach to the present bill. As I said at the beginning, we must ask ourselves whether the means used here is the most efficient in achieving this goal, which we, I think, all endorse. I think this is not the case. The aim pursued can be achieved much more efficiently, cheaper and with a greater responsibility result. I believe that the legislator must first ensure that the person liable for maintenance assumes his own responsibility and fulfils his obligations. After all, it is in the first instance the parent who must take responsibility for his children. It is not permissible that this too quickly — I would say almost a priori — fall upon the community. Community intervention should be the ultimate remedy to help these people in an emergency.
I have submitted a number of legislative proposals. I have formulated a number of suggestions that, in my opinion, actually need to be approved in advance and, above all, implemented.
The first, I have already said, relates to the prosecution priority for the crime of family abandonment. A significant number of complaints about non-payment of maintenance is not prosecuted and therefore never comes to court. Most of the files are even spoofed. I interrogated the Minister of Justice on this subject, inter alia, on 6 March 2001, with my oral question no. 4035. It shows that the number of suspension is much greater than the number of convictions.
I would like to make a nuance of what colleague Viseur has said, namely that one can no longer pay maintenance money once one is in prison. This is true, but the practice is different. The practice is that most of those persecutors, when they are in front of the criminal court and when it puts them before the choice — it’s usually a man — say, “Sir, will you pay, or do you prefer prison? I’ll see you here again in two months.” As a practice lawyer, I can tell you that most of them pay at that time. Once confronted with the threatening prison sentence, they suddenly realize that they have obligations to fulfill.
I deeply regret, and I agree with the criticism of colleague Moerman on the Minister of Justice, that the Minister, despite repeated questions from Chamber members from the opposition and the majority, does not make this a prosecution priority. One would give the most powerful social signal by saying: this is the priority of persecution, as well as everything that has to do with the family situation. I think Mr. Moerman is right in this. I have repeatedly asked the Minister of Justice.
A second proposal, which we have formulated and submitted in the form of a bill, is the generalization of the receipt authorization. Rightly, colleagues, I think also colleague Herzet, pointed out the enormous costs that people sometimes have to make to recover the maintenance fee, which is sometimes relatively low. One must be seized, the maintenance liable changes of employer or moves, one must be seized again, a new date of sale must be determined; the costs accumulate. This should be avoided, which is why we suggest that a receipt authorisation should always be issued automatically in respect of maintenance. The peacekeeper can do this now, but we think this should become an automation instead of optional. This means that the optional acceptance authorization should be generalized, that it should become the rule. The Bill No. 1217, which I have submitted together with colleague Van Hoorebeke, implies that the peace judge and the court in short-term proceedings issue a receipt authorization, whenever a person is condemned to pay maintenance. In this way, without having to pay costs or go to a custodian, the entitled to maintenance can ensure that the amounts are recovered from the institution that has to pay, from the employer who has to pay or from any debtor of the entitled to maintenance. This leads to a much more efficient, simpler and, of course, cheaper way of collecting.
We also propose that the court in short-term proceedings be granted the same powers as the peace judge, in particular by ensuring that the court in short-term proceedings — as the peace judge can thus already do — can require the spouses and even third parties to provide all information and documents that shed light on the income and debt claims of the parties.
Upon acceptance of our proposal, the collection of maintenance would be much easier and cost much less.
The third proposal submitted by my group is a bill to amend the crime of family abandonment. I would like to draw your attention to this proposal. The N-VA calls for the introduction of French law. Article 391bis of the Criminal Code defines the crime of family abandonment. Anyone who fails to pay maintenance for more than 2 months is subject to correctional prosecution. One of the constituent elements of the crime is that there must be a judicial decision that is no longer subject to appeal or opposition, in other words, a judicial decision that has entered into force from time to time. In practice, it is very common to appeal against a court decision imposing maintenance. In the meantime, the debtor must pay, the decision is enforceable. However, the verdict is not final. This means that the prosecutor cannot prosecute while the case can be appealed for years. There is no crime. A person who does not pay his maintenance cannot be brought before the criminal court. Criminal prosecution is not possible. Our bill 1218 aims to change the constituent elements of the crime of family abandonment. We propose that no longer a final judgment be demanded, but a judgment that is enforceable and is notified. This judgment – regardless of further proceedings – allows prosecution as is currently the case in France.
Our fourth bill, document 1388, aims to introduce a right of investigation and information by the court executor. This proposal aims to make it much easier to enforce all types of judgments in order to have much easier insight into the income and assets of the person concerned. This is also a law in France. In all humility, I dare to say that we have refined and improved this. The court enforcement officers are the requesting party. In practice, it is practically impossible for a party to be paid to execute the judgment. In many cases, the debtors are very ingenious in extracting their assets from the grip of their creditors. Therefore, we propose that the court executor be granted the right to obtain information about, and to initiate an investigation into the debtor’s assets. This can be done with the debtor himself, with the banks, with the notaries and even with lawyers. This balanced proposal leads to transparency and makes it much easier and cost-effective to enforce a judgment.
I will not go into detail on each of the proposals. That would take me too far. However, I wanted to show that there are other, much more desirable ways of achieving the goal that we all have in mind, in this case ensuring that the maintenance is paid. The most effective means is, in my opinion, prosecution priority for this crime. Therefore, in my opinion, the person liable for maintenance can be highly personalised through a number of techniques so that in the first instance the non-payment of maintenance does not affect the State, not the community, not all of us. Of course, the community must contribute. In this, I support the purpose, colleague Herzet, of your bill. The community must contribute when there is no payment, when one is in need, when a problem arises. The question then arises how to do it best. We, of the N-VA, believe that this would still be best done by the OCMW. We do not believe in that new central, centralist institution, that new service to the FOD Finance. I have a number of objections to this.
In the first instance, however, I have concerns with Article 6 of the bill itself. In fact, Article 6 does not require that such maintenance service be applied if there is a delay. There should be no backstop and yet one can turn to that service. Article 6 only stipulates that there must have been a default of two consecutive or non-consecutive periods during the previous 12-month period. That means that the service can be recovered while the maintenance liable can pay in the meantime. He once had a backbone, but now no longer, and now pays well. Then a serious conflict arises, with a new discussion, a new trouble and resistance at the seizure judge. I think that Article 6, as it is formulated here, goes a long way.
The next objection concerns the new service and in particular the new administrative burden that is being created. This is a new procedure. The person concerned must request this in writing, even in this era of e-government. The person concerned should not go to his OCMW, where everything is so close to the people. This happens significantly at a time when all in Flanders is thought of the expansion of the OCMW into a social home. So I make some reservations to what one of the previous speakers said: "Whoever goes to the OCMW is stigmatized." This should not be the case, my colleagues! An OCMW should become a social home where everyone, not only the needy, but also other people with social needs — whatever they may be — can be justified and helped in a simple, friendly and customer-friendly way, close to the people. Now that is being removed from the people. We, of the N-VA, are in favor of the Danish model in which services are brought to the people and not centrally located in Brussels.
Why that new administrative burden, that procedure, those deadlines, that possibility of resistance with the seizure judge, both of the entitled to maintenance and of the entitled to maintenance? That will be a difficult, complementary procedure, while it was precisely one of the main objectives of this majority to ⁇ administrative simplification. That was one of the big dada's of purple-green: "We are going to simplify administrative." How can one work easier in such a social matter than to tell the people that they can step into their OCMW in their congregation, which solves everything for them and which also pays the advances. This is of course the simplest and most efficient. Why do you not allow these advances to be paid by the OCMW? Let them then indeed — in which I give you the right — be collected by the tax officer who, as I said, has experience in it, has the necessary means for it, and can himself proceed to collection. But let the OCMWs shoot ahead and then let the taxpayer collect back. I think that seems to be a good idea. However, not the way it is being done now.
I come to a third objection.
Colleagues, this law will realize a transfer from Flanders to Wallonia. I look at the practical lawyers around me. Every practical lawyer in Flanders knows that collecting in Wallonia is almost an impossible task. I am being addressed about this every month. It is not implemented in Wallonia. In Flanders it is quite different. I will give it to you on a piece of paper: with the bill, a new north-south transfer will be created. It will be this: whoever most evades his responsibility will be able to rely most on the solidarity of those who obey the law. He will be able to count on the solidarity of those who ensure that the law is enforced. That is the reality.
Finally, I have one last objection. I regret that the State Council has not given an opinion on the constitutionality and competence issues of this latter proposal. The State Council was consulted on the related bill proposed by Mrs. Burgeon. On that proposal, the State Council said that the federal legislature has the power to regulate this matter. In fact, it was a matter of justice, in particular the collection of maintenance payments. This is still a federal authority.
Colleagues, I think this reasoning cannot be passed on to this bill. This bill does not concern the establishment of a fund, let alone the establishment of a fund at the Ministry of Justice. The proposal aims to provide assistance to those who have difficulty collecting maintenance. Well, assistance to individuals is the competence of the Communities. The bill has received a completely different orientation due to the many peripeties and many discussions. The fund was initially a matter of justice. It was a federal matter. However, it has now become a matter of helping individuals. In my view, this is a competence of the Communities. It is not a federal authority. The State Council has not given advice on this issue.
My colleagues, I will decide. I repeat that we fully support the goal. We would like to ⁇ this goal in various other ways. I have outlined four methods for achieving the goal.
Finally, if the goal is not achieved by other legal means, we feel no central service should be established at the Ministry of Finance. The OCMW should fulfill that task in a customer-friendly way, close to the people and decentralized, as modern democracies work. Let me take the Danish example.
The current majority finds a way in this, which is actually not consistent with what its priority was. Its priority was administrative simplification.
Therefore, we have great problems with the means that the majority has developed to ⁇ a very worthy goal. We remain behind this goal. But in all humility we have equally, if not better, suggestions for achieving that goal. Due to the large, practical and constitutional objections, we do not approve the bill. Of course we are not against. We do not vote against a proposal whose objectives we fully endorse.

Monsieur le 18.11 président, monsieur le ministre, chers collègues, mesdames, messieurs à la tribune, voilà encore un projet pris en charge par la coalition arc-en-ciel et qui trouve une solution au cours de cette législature!
De mon point de vue, un hommage s'impose aux pionnières qui nous ont précédés car cette proposition de loi mérite sans doute d'être épinglée comme étant l'une de celles qui ont mis le plus de temps à aboutir. Monsieur le président, je me pose même la question de savoir s'il ne s'agit pas d'un record depuis la deuxième guerre mondiale en termes de temps et de durée avant d'aboutir à un vote.
Comme l'a rappelé Mme Herzet, c'est en 1974 que Melle Hanquet dépose sa première proposition au Sénat. A l'époque, elle constatait déjà que les séparations de couples allaient en augmentant, laissant dans la précarité les enfants et parfois les conjoints sans revenu. Les créances alimentaires n'étaient pas payées ou étaient versées de manière aléatoire.
Depuis lors, les législatures se sont succédé et des propositions de loi ont été déposées en 1981, 1985, 1986, 1987, 1988, 1990, 1991, 1992, 1995, 1996 pour arriver à cette cinquantième législature où le dossier est repris et remis sur le métier pour la énième fois mais cette fois-ci, c'est la bonne!
La solution qui avait été trouvée entre-temps pour apporter un début de solution était le système d'avances, via les CPAS, pour les enfants avec examen des revenus de la personne qui en avait la responsabilité. C'était Mme Miet Smet sur les rangs de l'ex-CVP, secrétaire d'Etat chargée de l'Emancipation à l'époque, qui avait lancé des études plus approfondies sur la question et qui avait essayé d'étudier le montant moyen et le nombre de familles concernées par ce problème de non-paiement des créances. Ces études servent d'ailleurs encore de références aujourd'hui lorsque l'on veut prendre le problème en charge.
Mme Smet présentait elle-même le système comme un pis-aller, comme un système de transition qui ne constituait pas la solution. L'eau a coulé sous les ponts, des recherches et des colloques réunissant des experts, des mouvements familiaux et des mouvements de femmes ont régulièrement attiré l'attention des autorités publiques sur la nécessité de trouver une solution durable.
En fait, il ne s'agit ni de porter assistance, ni de faire la charité mais bien de respecter les droits des personnes et de faire appliquer un jugement. L'obligation d'entretien est d'ailleurs un des principes élémentaires dans notre société.
On m'a fait remarquer qu'il était très rare que des matières relevant plutôt du civil aient également un volet pénal; en effet, le nonpaiement de créances alimentaires prévoit une peine de prison de 6 mois pour les débiteurs défaillants. Tout le monde s'accorde pour dire qu'emprisonner les gens pour le non-paiement de créances n'est pas une solution. De fait, cela ne résout pas le versement et, de plus, cela coûte cher à l'Etat. Quant à moi, je ne crois pas que les prisons soient faites pour cela. C'est la vertu pédagogique de dissuasion que le législateur a voulu mettre en exergue et, pour ma part, le Service de créances a cette même valeur. D'autres l'ont dit avant moi. En l'occurrence, on ne prive pas une personne de sa liberté mais on s'adresse finalement à son portefeuille, si je peux m'exprimer ainsi.
Tant mieux si des lois peuvent être améliorées, tant mieux s'il y a encore du travail ainsi que des perspectives de changement et d'amélioration tant de la qualité et de l'objectivité du jugement que de l'ensemble des procédures.
Mais je ne crois pas que c'est en chargeant la barque aujourd'hui dans cette proposition de loi que l'on résoudra l'entièreté de la question. Je crois que le chantier restera ouvert. Ceci n'est qu'une solution qui répond à un problème concret, pratique et tellement important. Au cours de la prochaine législature, tant mieux si le dossier continue à faire des émules et tant mieux si se concrétisent des propositions de loi qui améliorent l'ensemble du système.
Néanmoins, je me pose toujours cette question: pourquoi a-t-il fallu tellement de temps? Pourquoi y a-t-il eu tant de résistance à mettre en place un fonds, aujourd'hui un service?
Depuis le début des années '80, tous les partis démocratiques ont déposé des propositions. Tous les partis démocratiques ont, à un moment donné, participé à la gestion des affaires de l'Etat mais jamais une solution durable n'a pu aboutir.
Parfois, je me demande si le prétexte budgétaire n'est pas l'arbre qui cache la forêt, c'est-à-dire le changement de société qui ne manquera pas d'intervenir si nous votons cette loi. Nous arrivons peut-être à un noeud de notre société patriarcale. Quelque part, on ouvre le champ à l'intervention de l'Etat dans une affaire privée où, jusqu'à présent, il avait mis beaucoup de réticence à s'immiscer.
Le monde politique a mis du temps pour prendre la mesure du problème. La justice, M. Verherstraeten l'a rappelé, n'a peut-être pas encore donné la priorité à ces questions dans son agenda. J'espère vraiment que le vote de cette loi va aussi, sur ce plan-là, faire avancer plus rapidement les dossiers relatifs aux conflits entre les personnes, au niveau des créances alimentaires.
Cette proposition de création d'un service des créances alimentaires est soumise à votre vote et j'espère qu'il sera positif. Je crois entendre qu'il y aura plutôt des abstentions que des votes négatifs et je m'en réjouis.
Je voudrais tout de même rappeler le circuit emprunté par cette proposition. A force de se féliciter, on en oublierait peut-être le chemin parcouru: avis du Comité d'avis pour l'émancipation sociale, examen des multiples propositions en commissions conjointes Justice et Affaires sociales, des auditions très intéressantes, des ministres qui, les uns après les autres, déclinaient la demande qui leur était faite "d'abriter" le fonds. Finalement, ne restait en lice que l'intervention des CPAS pour améliorer les choses.
Monsieur le président, ce volet-là qui a duré un an — toutes ces enquêtes, ces auditions, ces différentes propositions — mériterait aussi d'être joint au rapport en tant qu'annexe. En effet, les personnes qui sont venues nous ont remis des rapports, des évaluations. A ce moment-là, les présidents de CPAS, la section CPAS de l'Union des Villes et des Communes de Wallonie, de Bruxelles et de Flandre, tous sont venus nous dire que le système n'était pas bon, pas très efficace et ne répondait pas au problème fondamental du respect du droit.
Je souhaiterais donc que le rapport de M. van Weddingen comporte un volet annexe qui permette d'assurer la pérennité de tous ces travaux et la participation de toutes ces personnes qui se sont mises à notre disposition pour réfléchir collectivement à ces différents problèmes.
Certes, monsieur Reynders, vous avez accepté de nous recevoir. C'était le 8 novembre 2000 et vous avez accepté que votre administration réfléchisse à la possibilité d'intégrer cette matière dans ses compétences et dans son fonctionnement. Chacun connaît la suite. Le dossier émigre vers la commission des Finances, dont je remercie le président pour la diligence avec laquelle il a assuré le suivi de ce dossier. Tous s'accordent à dire que c'est une bonne chose et qu'il y avait du pain sur la planche.
Le travail sur les textes s'est fait par essais et par erreurs. Il n'est pas facile d'innover, surtout en respectant des situations acquises. Pour moi, c'est une expérience riche, politiquement forte que d'avoir oeuvré à l'élaboration de cette proposition de loi. Nos échanges étaient constructifs, même s'ils sont contradictoires parfois. Vous en avez le reflet à cette tribune, mais le résultat est là. Au passage, je voudrais remercier votre cabinet et votre administration. Je voudrais également remercier Mme Herzet qui a pris les rennes de ce paquebot et qui, avec beaucoup de diligence, d'ouverture d'esprit et de sens de conciliation, a fait avancer la proposition et a systématiquement essayé de faire sauter les blocages là où ils se présentaient.
Majorité et opposition, nous nous sommes retrouvés autour de ce travail collectif, même s'il y a, parfois, eu des couacs. Aussi, je vous remercie, madame Herzet, pour ce travail de pilotage. Vous ne vous représenterez plus aux prochaines élections, mais vous avez montré une méthode de travail dont nous ferions bien de nous inspirer dans d'autres occasions. En ma qualité de jeune parlementaire, j'ai appris à adopter un esprit de conciliation.
L'adoption de la loi par la Chambre est une étape. Cette proposition devra être examinée par le Sénat, mais nous avons ouï dire que les sénatrices ne se battraient pas pour l'évoquer. Donc, le texte est attendu et, qu'il soit évoqué ou non, je sais, monsieur le ministre, que vous mettrez tout en oeuvre pour que les délais les plus brefs soient respectés. Je vous rappelle que vous vous êtes engagé devant le parlement des femmes, le 8 mars 2002 et qu'il serait dommage, à la date anniversaire, de rater cette convergence. Je suis certaine que vous y serez attentif. J'aimerais que ce texte paraisse au "Moniteur belge" pour le 8 mars prochain.
Je voudrais également attirer l'attention sur l'attente et l'immense espoir que cette proposition de loi suscitent. C'est la concrétisation du principe selon lequel le droit doit être respecté, la justice doit être faite et qu'un jugement rendu doit être observé. Beaucoup d'ailleurs croient qu'elle est déjà votée. Mme Moerman signalait que déjà, on s'informe à propos des procédures à suivre. Elle est attendue avec impatience. Elle fait partie intégrante du débat de notre société et il est donc nécessaire, monsieur le ministre, — cela sera d'ailleurs de votre ressort — de concrétiser ce qui doit encore l'être: formulaires, mise au point d'une procédure. Vous avez déjà levé le voile sur la méthodologie que vous allez utiliser dans la conférence de presse qui vient d'avoir lieu. Je suppose que vous ferez le point dans la synthèse que vous allez apporter maintenant. Néanmoins, le service risque de rencontrer des problèmes d'efficacité dans son démarrage.
A ce sujet, je reprendrai un adage que M. Dehaene mettait toujours en évidence: "Une question doit trouver une solution quand elle se pose. Cela ne nous empêche pas d'y penser avant mais on ne fait pas de la politique uniquement sur des hypothèses de ce qui risque d'arriver."
Je pense que nous pouvons voter cette loi en toute sécurité et faire confiance au SPF.
Je rappelle que nous avons mis en place une commission d'évaluation qui suivra pas à pas la mise en route, l'élaboration et la concrétisation de cette proposition.
Nous avons voulu cette commission d'évaluation paritaire. Il me semble normal que sa composition ne reflète pas uniquement une répartition égalitaire hommes/femmes mais il faut aussi qu'elle soit pluraliste, c'est-à-dire qu'elle touche les administrations concernées, Finances et Budget, ainsi que la société civile, les mouvements familiaux, les associations et les mouvements de femmes; ces dernières ont été, selon moi, à la pointe de ce combat dans ce dossier. Mémorandum après mémorandum, elles ont interpellé les gouvernements successifs et les représentants de la nation que nous sommes.
Comme l'a souligné Mme Moerman, ce projet suppose une bonne information, non seulement vers les citoyens mais aussi vers les départements comme celui de la Justice, avec les juges et les avocats, les experts qui s'occupent de ces questions, les services d'assistance juridique pouvant venir en aide aux personnes concernées, tant débitrices que créancières.

Sometimes I wonder if the budget pretext is not the tree that hides the forest, that is, the change of society that will not fail to intervene if we vote this law. Per ⁇ we are coming to a node of our patriarchal society. Somewhere, the field is opened for state intervention in a private affair where, until now, it had put a lot of reluctance to interfere.
The political world has taken time to measure the problem. The Justice, Mr. Verherstraeten recalled it, ⁇ has not yet given priority to these issues on its agenda. I really hope that the vote of this law will also, on that level, make the cases relating to conflicts between persons, at the level of food claims, progress faster.
This proposal for the creation of a service for food claims is subject to your vote and I hope it will be positive. I think there will be more abstentions than negative votes and I look forward to this.
However, I would like to recall the circuit taken by this proposal. For the sake of congratulating, one might forget the path taken: the opinion of the Committee of Opinion for Social Emancipation, the examination of the multiple proposals in joint committees Justice and Social Affairs, very interesting hearings, ministers who, one after the other, declined the request that was made to them to "shelter" the fund. In the end, there was only the intervention of the CPAS to improve things.
Mr. Speaker, this part that lasted a year — all these investigations, these hearings, these different proposals — would also deserve to be attached to the report as an annex. The people who came here gave us reports, evaluations. At that time, the CPAS presidents, the CPAS section of the Union of Cities and Communes of Wallonia, Brussels and Flanders, all came to tell us that the system was not good, not very efficient and did not answer the fundamental problem of respect for law.

I think we can vote this law safely and trust the SPF.
I would like to remind you that we have set up an evaluation committee that will step by step follow the launch, development and implementation of this proposal.
We wanted this parity assessment committee. It seems to me normal that its composition does not only reflect an equal distribution between men and women, but it must also be pluralist, that is, it affects the relevant administrations, Finance and Budget, as well as civil society, family movements, associations and women’s movements; the latter have been, in my opinion, at the forefront of this struggle in this case. Le troisième était la mise en oeuvre de ce projet que nous portions depuis tellement longtemps avec l'ensemble des organisations des femmes, à savoir le service des créances alimentaires.
Il reste encore du pain sur la planche. Le vote de cette loi ne constitue qu'une étape. Il faut donner forme et réalité à ce projet, le concrétiser.
Monsieur le ministre, vous pouvez compter sur notre collaboration et sur notre vigilance. A la fin de cette législature, c'est le temps du bilan et je crois pouvoir dire que l'arc-en-ciel a relativement bien fonctionné dans ces matières. Pour moi, c'est une opération "win win" pour tout le monde qui offre plus de justice, plus d'égalité et plus de bonheur pour tous. A cet égard, nous sommes tous gagnants. Toutes les députées et tous les députés ayant oeuvré à ce projet pourront certainement le mettre en évidence.

Het is een historisch moment voor vrouwen in het Parlement. Ik heb het geluk gehad om jaren geleden nog zo'n historisch moment in het Parlement mee te maken, met name de stemming over abortus. Ook op dat moment heeft de wetgever eigenlijk zijn hart getoond ten opzichte van die vele, vele vrouwen met enorm grote problemen. Op dit ogenblik gebeurt eigenlijk precies hetzelfde.
Eindelijk, na lange omzwervingen, na heel veel discussie en met heel veel tegenstand hebben we dit kunnen verwezenlijken. Het is een bewijs van de enorme kracht van de vrouwen in dit Parlement, van hun doorzettingsvermogen, en van een samenwerking over alle partijgrenzen heen. Dat het meer dan dertig jaar heeft geduurd is een bewijs dat vrouwen nog een lange weg te gaan hebben om het machogehalte en het testosterongehalte in het Parlement een beetje naar beneden te halen ten voordele van een beetje meer vrouwvriendelijkheid. Het bestaan in het Parlement van maar een adviescomité Maatschappelijke Emancipatie toont aan dat er toch nog een hele weg is af te leggen. Er zijn dus nog meer vrouwen nodig om ervoor te zorgen dat het Parlement zich bezighoudt met zaken waarvan mensen wakker liggen.
Dit voorstel is een hart onder de riem van alleenstaande vrouwen die helemaal alleen de zorg voor en de opvoeding van hun kinderen op zich nemen en van de enkele mannen die dat ook doen. Het is immers vaak zo dat de vader die niet betaalt ook meestal de totaal afwezige vader is. Het zijn de alleenstaande vrouwen die problemen hebben, niet alleen om de eindjes aan elkaar te knopen maar ook omdat ze alleen voor de opvoeding van de kinderen staan. Als wetgever hebben we er op dit moment tenminste al voor gezorgd dat we de financiële zorgen van die vrouwen wegnemen. Dat is erg belangrijk. Voor de rest zal het probleem van mannen die hun verantwoordelijkheid niet opnemen vooral moeten worden opgelost via sensibilisering, via opvoeding in scholen en via het aankweken van verantwoordelijkheidszin, want de nieuwe man is nog lang niet veralgemeend.
Belangrijk voor ons is dat vrouwen vanaf nu d'office kunnen rekenen op die 175 euro per maand per kop, zowel voor hun kind als voor zichzelf, zonder extra kosten voor de alimentatiegerechtigde. De filosofie is inderdaad dat alimentatiegeld een recht is en geen bijstandsformule via het OCMW. Ik hoop dan ook van harte dat de nieuwe dienst snel en efficiënt zal werken, gebruikmakend van de bestaande fiscale kantoren, via een eenvoudig formulier, vlot verkrijgbaar. We hebben nog zes maanden de tijd om dit systeem op poten te zetten. De fiscale administratie heeft ervaring op het terrein van de invorderingen en heeft ook heel wat meer gezag in de schaal te werpen dan de achtergelaten vrouwen met kinderen om de exechtgenoten onder druk te zetten.
De SP.A is erg blij met deze belangrijke verwezenlijking tijdens deze legislatuur. Op dit parlementaire initiatief zitten duizenden vrouwen en kinderen te wachten. De stemming over dit voorstel straks is trouwens ook een prachtige kroon op het werk van collega Jacqueline Herzet die de motor was achter dit titanenwerk. Ik wens haar daarvoor dan ook van harte te feliciteren. Met dit voorstel zal België eindelijk de groep vervoegen van de beschaafde landen zoals Nederland en Duitsland waar gelijkaardige systemen al jaren van kracht zijn zonder dat de staatskas eraan onderdoor is gegaan.
De SP.A zal ook met argusogen kijken naar de stemming over dit wetsvoorstel. In de commissie vond de oppositie het niet nodig om dit voorstel te steunen. Ik hoor nu in de uiteenzettingen hetzelfde. In de plenaire vergadering krijgt ook de oppositie de ultieme kans om aan te tonen dat het Parlement wel degelijk begaan is met de reële problemen van de mensen. Ik hoop dan ook van harte dat de oppositie in deze eens geen politieke spelletjes speelt maar haar hart laat spreken ten voordele van al die alleenstaande vrouwen met kinderlast en ervoor zorgt dat dit voorstel — alsjeblieft — met unanimiteit in deze Kamer wordt goedgekeurd.

It is proof of the enormous power of women in this Parliament, of their perseverance, and of cooperation across all party boundaries. The fact that it has lasted more than thirty years is evidence that women have a long way to go to bring the level of machogue and testosterone in Parliament a little down in favor of a little more female-friendliness. The existence in Parliament of only one Advisory Committee on Social Emancipation shows that there is still a long way to go. Therefore, more women are needed to ensure that Parliament deals with matters that people are awake to.
This proposal is a heart under the belt of single women who take on the care and upbringing of their children and of the only men who do so. After all, it is often the case that the father who does not pay is also usually the completely absent father. It is the single women who have problems, not only to tie the ends together but also because they are solely for the upbringing of the children. As legislators, we have at least already taken care to remove the financial worries of these women. That is very important. For the rest, the problem of men who do not take on their responsibilities will primarily need to be solved through awareness, through education in schools and through the cultivation of sense of responsibility, because the new man is still far from being generalized.
Important to us is that from now on women can count on those 175 euros per month per cup, both for their child and for themselves, without additional costs for the maintenance entitled. The philosophy is indeed that maintenance is a right and not a form of assistance through the OCMW. I therefore sincerely hope that the new service will work quickly and efficiently, using the existing tax offices, via a simple form, easily available. We still have six months to put this system on our feet. The tax administration has experience in the field of recovery and also has a lot more authority to throw into the scale than the left behind women with children to put pressure on the spouses.
The SP.A is very pleased with this important achievement during this legislature. Thousands of women and children are waiting for this parliamentary initiative. The vote on this proposal is, by the way, also a beautiful crown on the work of colleague Jacqueline Herzet who was the engine behind this titanium work. I would like to cordially congratulate her on this. With this proposal, Belgium will finally join the group of civilized countries such as the Netherlands and Germany where similar systems have been in place for years without the state treasury having gone under.
The SP.A will also watch with arguments the vote on this bill. In the committee, the opposition found it not necessary to support this proposal. I hear the same thing in the statements. The plenary session also gives the opposition the ultimate opportunity to demonstrate that Parliament is indeed committed to the real problems of the people. I therefore sincerely hope that the opposition in this time will not play political games but let its heart speak in favor of all those single women with childburden and will ensure that this proposal — please — is unanimously approved in this Chamber.

Monsieur le président, monsieur le ministre, chers collègues, c'est vraiment avec beaucoup d'émotion que je prends la parole aujourd'hui pour vous dire que la proposition de loi créant un service des créances alimentaires au sein du service public fédéral des Finances répond à un travail parlementaire de plus de 25 ans. Le parti socialiste a pour le moins toujours été très attentif au problème aigu que constitue le non- paiement des pensions alimentaires. En 1990 déjà, les socialistes, dont Laurette Onkelinx et Viviane Jacobs à qui je rends hommage aujourd'hui, ainsi que moimême avaient déposé une proposition de loi relative à la création et à l'organisation d'un Fonds national des créances alimentaires. Ce combat politique que nous avons mené et gagné aujourd'hui grâce à vous toutes et tous, représente une avancée incontestable et permettra à beaucoup de familles de sortir de la pauvreté.
La création du service des créances alimentaires apporte, en effet, une réponse globale à la question du recouvrement des pensions alimentaires impayées, qui mettait les bénéficiaires de ces créances dans une grande instabilité financière. Identifié comme une cause majeure de précarité, le non-paiement des créances touche 40% des familles monoparentales divorcées. Cet état de fait crée une situation inacceptable de précarité et de pauvreté pour celles-ci. La Ligue des familles a rappelé dans le cadre de nos débats que le non-paiement des pensions alimentaires reste un problème important. Seulement 60% d'entre elles sont versées régulièrement et 19% ne sont pas payées du tout.
La mise en place d'un service spécifique était nécessaire pour sortir de la situation actuelle. La créance alimentaire reste un moyen de pression entre les ex-conjoints qui risque de détériorer leur relation de parents. La mise en place d'un tiers, le service créé par notre proposition de loi, dans les situations litigieuses permet de réduire l'utilisation de la pension alimentaire comme instrument de pression. Le système actuel impliquant les CPAS a montré ses limites. En effet, il ne vise pas toutes les catégories d'enfants et a été déclaré inconstitutionnel par la Cour d'arbitrage. En outre, la quantité de travail par dossier pour les travailleurs sociaux était considérable et on ne voyait pas le résultat de récupération. Une évaluation du système d'avances sur les pensions alimentaires dans les CPAS a mis en évidence l'augmentation constante du nombre de bénéficiaires de ce système depuis son lancement en 1989 jusqu'à nos jours. Elle a également mis l'accent sur le faible taux de récupération des avances auprès des créanciers. Cette étude a permis d'orienter notre réflexion et le dépôt de notre proposition de loi visant à créer un Fonds de créances alimentaires. À un moment, il a été question que les CPAS soient responsables de l'octroi de ces avances, sans pour autant prévoir leur remboursement à 100%, le CPAS devant donc en supporter une partie. Les représentants des Villes et Communes se sont insurgés contre cette proposition et ont adopté un point de vue sans équivoque: les communes ne peuvent se voir imposer de nouvelles charges. À l'analyse, il apparaît clairement que les CPAS font déjà face à d'énormes charges, tant au niveau de leurs missions que d'un point de vue financier. Renforcer cette mission d'avances sur créances alimentaires par les CPAS aurait eu pour effet de les étrangler encore un peu plus et d'en amener plus encore à ne pas tenter de recouvrer la dette du débiteur d'aliments.
Heureusement, grâce aux amendements déposés par le PS, nous sommes parvenus à faire évoluer le débat et à trouver un accord.
Le service des créances alimentaires sera donc finalement implanté au sein du service public des Finances (SPF), ce qui présente pour nous un double avantage: celui des moyens de l'administration pour la gestion du service et celui de la proximité du fisc pour la récupération des sommes non versées. Le pouvoir fédéral aura ainsi la totale maîtrise du dossier, sans aucune intervention de la part des CPAS. A cet égard, il faut souvent remarquer qu'il est parfois très difficile pour certaines personnes de passer la porte d'un CPAS.
Le service devra, au départ du moins, être alimenté par un crédit inscrit au budget de l'Etat. De plus, il sera alimenté par la contribution des personnes concernées, soit 10% des sommes à recouvrer en principal, à charge du débiteur d'aliments, et 5% du solde du montant de la créance alimentaire recouvrée et des arriérés recouvrés, à charge du créancier d'aliments. D'où l'intérêt pour les intéressés de ne pas utiliser ce service.
A partir du 1 er septembre, voire le 1 er octobre — mais vous nous donnerez les précisions nécessaires, monsieur le ministre —, le bénéficiaire d'une pension alimentaire impayée pourra s'adresser directement au service des créances pour recevoir une avance, plafonnée à 175 .
Les députés socialistes ont obtenu que ce service soit accessible à tous les créanciers et que la démarche auprès de celui-ci soit un droit pour tous, indépendamment de leurs revenus. Cette revendication découlait du fait que, pour nous socialistes, un enfant égale un enfant. Il s'agit du respect d'un droit prévu par convention ou par jugement et cela, pour tous les enfants. L'article 3 de la Convention des droits de l'enfant rappelle d'ailleurs aux Etats leur responsabilité en la matière. Il ne fallait pas installer les familles concernées dans une logique d'assistance, inacceptable à nos yeux. A l'instar du droit aux allocations familiales, il s'agit d'un droit universel dont on ne peut subordonner la jouissance au non-dépassement d'un plafond de ressources. Il faut, par ailleurs, préciser que la possibilité de s'adresser au SPF n'empêche pas que tout un chacun puisse s'adresser aux CPAS pour solliciter, comme cela existe déjà dans d'autres circonstances, un soutien administratif. La loi organique des CPAS du 8 juillet 1976 prévoit en effet que tout citoyen a le droit d'être assisté dans ses démarches administratives et sociales, le CPAS étant tenu de lui apporter son aide.
De plus, pour les personnes en plus grande difficulté, les CPAS gardent leur capacité d'action en matière d'avances financières, comme c'est d'ailleurs actuellement le cas pour, par exemple, les avances sur allocations de chômage et les avances sur pensions.
De plus, il est important de souligner que l'arrêté royal du 11 juillet 2002, portant règlement général en matière de droit à l'intégration sociale, prévoit explicitement que pour le calcul des ressources, afin de déterminer si une personne peut ou non bénéficier du revenu d'intégration, il n'est tenu compte ni de la pension alimentaire ni de l'avance sur le terme de la pension alimentaire perçue au profit des enfants célibataires. La formulation est sans équivoque: les avances perçues par les enfants doivent être considérées comme des ressources exonérées.
D'autre part, je me permets d'insister sur le fait que, en dessous d'un certain seuil, aucune saisie ne pourra avoir lieu, même lorsqu'il s'agit de garantir le paiement de créances alimentaires. En effet, l'objectif du législateur n'est pas de plonger les personnes dans une plus grande précarité, si ce fait est déjà établi.
Par ailleurs, je voudrais souligner que le nouveau texte à l'article 22, alinéa 1 er n'implique en aucune manière que les CPAS devront fournir au service des créances alimentaires des informations couvertes par le secret professionnel concernant les débiteurs de pensions alimentaires. Il serait sans doute souhaitable, monsieur le ministre, que vous confirmiez ce point afin de rassurer l'Union des Villes et des Communes qui nous a exprimé sa crainte en ce domaine.
Enfin, j'insisterai sur les engagements pris par le ministre pour que la composition de la commission d'évaluation du service reflète bien toutes les tendances politiques et intègre des groupements d'intérêts, afin que n'y siègent pas uniquement des représentants du ministère des Finances. Il s'agit, en effet, d'assurer la plus grande transparence et indépendance de cette commission d'évaluation.
Pour terminer, je me réjouis, tout comme mes collègues de la commission mais aussi Yvan Mayeur et Claude Eerdekens, qui se sont battus avec moi pour faire aboutir ce dossier, qu'une solution concrète et efficace ait enfin été trouvée pour faire face au nonversement des créances alimentaires. Cette solution permettra, en effet, à un grand nombre de familles de sortir de la précarité. Il était temps!
Je forme maintenant des voeux pour que le Sénat adopte ce texte au plus vite afin que les familles, qui en ont le plus besoin, puissent profiter de ce service. Enfin, je voudrais me joindre à toutes mes collègues pour remercier toutes les personnes de votre cabinet, dont une en particulier, qui ont travaillé sur ce dossier et qui nous permettent de vivre aujourd'hui un grand moment.

Mr. Speaker, Mr. Minister, dear colleagues, it is really with a lot of emotion that I speak to you today to tell you that the bill creating a service of food claims within the Federal Public Service of Finance responds to a parliamentary work of more than 25 years. The Socialist Party has at least always been very attentive to the acute problem of non-payment of maintenance pensions. Already in 1990, socialists, including Laurette Onkelinx and Viviane Jacobs, to whom I pay tribute today, as well as myself, had submitted a bill concerning the creation and organization of a National Fund for Food Claims. This political struggle, which we have led and won today thanks to all of you, represents an undeniable advance and will enable many families to get out of poverty.
The establishment of the Service of Maintenance Claims provides a comprehensive response to the issue of recovery of unpaid alimony pensions, which put the beneficiaries of these claims in great financial instability. Identified as a major cause of uncertainty, non-payment of claims affects 40% of divorced single-parent families. This situation creates an unacceptable situation of precariousness and poverty for them. The League of Families has recalled in our debates that non-payment of alimony pensions remains a major problem. Only 60% of them are paid regularly and 19% are not paid at all.
The establishment of a specific service was necessary to get out of the current situation. Maintenance claims remain a means of pressure between former spouses that may deteriorate their relationship as parents. The establishment of a third party, the service created by our bill, in disputed situations allows to reduce the use of maintenance pension as a tool of pressure. The current system involving CPAS has shown its limits. Indeed, it does not target all categories of children and has been declared unconstitutional by the Arbitration Court. In addition, the amount of work per file for social workers was considerable and the result of recovery was not seen. An evaluation of the subsistence advance scheme in the CPAS has highlighted the steady increase in the number of beneficiaries of this scheme since its launch in 1989 to the present day. It also highlighted the low rate of recovery of advances from creditors. This study helped guide our reflection and the submission of our bill for the creation of a Fund for Food Claims. At one point, it was discussed that the CPAS were responsible for the granting of these advances, without, however, providing for their 100% refund, the CPAS must therefore bear part of it. The representatives of the Cities and Communes revolted against this proposal and adopted an unambiguous point of view: the communes cannot be imposed new charges. The analysis clearly shows that the CPAS are already facing huge burdens, both in terms of their missions and from a financial point of view. Strengthening this mission of advances on food claims by the CPAS would have had the effect of strangling them a little more and leading more to not attempt to recover the debt of the food debtor.
Fortunately, thanks to the amendments submitted by the PS, we have managed to evolve the debate and reach an agreement.
The service of maintenance claims will therefore eventually be implanted within the Public Service of Finance (SPF), which presents for us a double advantage: that of the means of the administration for the management of the service and that of the proximity of the tax office for the recovery of unpaid amounts. The federal power will thus have full control of the dossier, without any intervention from the CPAS. In this regard, it is often to be noted that it is sometimes very difficult for some people to pass the door of a CPAS.
The service must, at least initially, be fed by a credit entered in the state budget. In addition, it will be fed by the contribution of the persons concerned, i.e. 10% of the amounts to be recovered in the main, at the expense of the maintenance debtor, and 5% of the balance of the amount of the recovered maintenance claim and recovered delays, at the expense of the maintenance creditor. Therefore, it is in the interest of interested parties not to use this service.
As of 1 September, or even 1 October — but you will give us the necessary details, Mr. Minister — the beneficiary of an unpaid alimentary pension will be able to address directly to the credit department to receive an advance, which is limited to 175 .
The Socialist MPs have achieved that this service is accessible to all creditors and that the approach to it is a right for all, regardless of their income. This claim arose from the fact that, for us socialists, a child is equal to a child. It is the respect of a right provided by convention or by judgment and this, for all children. Article 3 of the Convention on the Rights of the Child reminds States of their responsibility in this matter. We should not install the affected families in a logic of assistance, unacceptable to our eyes. Like the right to family allowances, it is a universal right of which enjoyment cannot be subordinated to the non-exceeding of a resource ceiling. Furthermore, it should be clarified that the possibility of addressing the SPF does not prevent anyone from addressing the CPAS to request, as already exists in other circumstances, administrative support. The Organic Law of the CPAS of 8 July 1976 provides that every citizen has the right to be assisted in his administrative and social proceedings, the CPAS being obliged to provide his assistance.
Furthermore, for those in greater difficulty, the CPAS retains their capacity for financial advances, as is currently the case for, for example, advances on unemployment benefits and advances on pensions.
Furthermore, it is important to emphasize that the Royal Decree of 11 July 2002 concerning the general regulation on the right to social integration, explicitly provides that for the calculation of resources, in order to determine whether a person can or cannot benefit from the integration income, neither the maintenance pension nor the advance on the term of the maintenance pension received for the benefit of single children is taken into account. The formulation is unambiguous: advances perceived by children should be considered as exempt resources.
On the other hand, I would like to insist on the fact that, below a certain threshold, no seizure can take place, even when it comes to guaranteeing the payment of maintenance claims. Indeed, the objective of the legislator is not to plunge people into greater precariousness, if this fact is already established.
Furthermore, I would like to emphasize that the new text of Article 22, paragraph 1, does not imply in any way that the CPAS will be obliged to provide the Service for Maintenance Claims with information covered by professional secrecy concerning the debtors of alimony. It would ⁇ be desirable, Mr. Minister, that you confirm this point in order to reassure the Union of Cities and Communes, which has expressed its concern in this area.
Finally, I will insist on the commitments made by the Minister to ensure that the composition of the service evaluation committee reflects well all political trends and integrates interest groups, so that there are not only representatives of the Ministry of Finance. The aim is to ensure the greatest transparency and independence of this assessment committee.
Finally, I am delighted, as well as my colleagues in the commission, but also Yvan Mayeur and Claude Eerdekens, who fought with me to bring this case to an end, that a concrete and effective solution has finally been found to deal with the non-return of food claims. This solution will enable a large number of families to get out of the precariousness. It was time!
I now form wishes for the Senate to adopt this text as soon as possible so that families, who need it most, can take advantage of this service. Finally, I would like to join all my colleagues to thank all the people in your office, including one in particular, who worked on this file and who allow us to live today a great moment.

Mijnheer de voorzitter, mijnheer de minister, beste collega's, de wet die we vandaag zullen goedkeuren en die mijns inziens verkeerdelijk staat aangekondigd als een fonds, want het gaat om een dienst voor alimentatievorderingen, is zeer belangrijk. Ik zou de wet zelfs historisch willen noemen en wel om de volgende redenen.
Ten eerste, de wet biedt een oplossing aan een maatschappelijk probleem dat reeds jarenlang wordt aangekaart en dat nu een definitieve oplossing heeft gekregen. Met deze wet wordt een probleem aangekaart van niet-betaalde alimentatiegelden waarvan vooral alleenstaande vrouwen met kinderen nadeel ondervinden. Deze wet is ook een resultaat van puur parlementair werk over verschillende partijgrenzen heen. Dit is ook niet zo alledaags. Het is ook een resultaat van vooral vrouwelijke parlementsleden die aan de kar hebben getrokken en ook in moeilijke periodes van onderhandelingen hebben volgehouden.
Geachte collega's, het probleem van de niet-betaalde alimentatiegelden moeten worden geplaatst in het geheel van het echtscheidingsproces wat een belangrijk maatschappelijk probleem is. Steeds meer koppels, steeds meer relaties eindigen met een echtscheiding. Dat is een vaststelling. Nochtans, het begint allemaal met een verliefdheid, een relatie en in de sprookjes eindigt het met: "En ze leefden nog lang en gelukkig en kregen vele kindertjes." De werkelijkheid is echter anders.
Steeds meer koppels kunnen het duurzame engagement dat ze zijn aangegaan niet meer blijvend waarmaken. De beslissing om uiteen te gaan, wordt niet lichtzinnig genomen. Het wordt trouwens ook steeds ervaren als een mislukking en het heeft zeer veel en ingrijpende gevolgen op het verdere leven van alle betrokkenen. Het komt er dan ook niet op aan bij een echtscheiding te willen zoeken naar wiens schuld het nu wel allemaal is geweest en om bij de afhandeling van de echtscheiding de andere de rekening te presenteren.
Te veel echtscheidingen eindigen trouwens ook in vechtscheidingen. Volwassen partners die mekaar graag hebben gezien, staan mekaar nu naar het leven en zijn zeer creatief in het mekaar de duivel aandoen.
De problemen bij een echtscheiding ontstaan blijkbaar ook vooral als er regelingen moeten worden getroffen over de verdeling van gezamenlijke eigendommen, over de regeling voor kinderen en over het bedrag van de alimentatie, niet zozeer omwille van het bedrag voor de kinderen, maar vooral omwille van het bedrag voor de vroegere partner. Na een echtbreuk is het nog dikwijls de vrouw die de kinderen grootbrengt en die de kinderen bij zich heeft. Dat brengt extra kosten mee en extra zorgen, zeker wanneer men nu op een of helemaal geen inkomen terugvalt na een echtscheiding. De gemiddelde bedragen die nu aan alimentatie voor kinderen worden uitgekeerd, bedragen ongeveer 150 euro per maand. Daarvan kan je de kinderopvang betalen.
Maar er is niet alleen het financieel element. Kinderen krijgen betekent ook verantwoordelijkheid opnemen en die stopt niet na een echtscheiding. Beide partners moeten die verantwoordelijkheid blijven opnemen en de kinderen hebben ook recht op contact met beide ouders. In die zin begrijp ik ook wel de reactie van sommige mannen en van sommige mannenverenigingen die zich beziggehouden hebben met vooral strijd te voeren om het niet kunnen afdwingen van bezoekrecht voor hun kinderen in de belangstelling te brengen. Sommige mannen lijken vooral na de echtscheiding ook te ontdekken dat ze kinderen hebben. Ik volg ze echter niet in hun redenering als ze alimentatiegeld betalen automatisch verbinden aan bezoekrecht uitoefenen. Verschillende alimentatiebetalers hebben dus niet zozeer moeite met alimentatie voor kinderen, wel voor een vroegere partner. Persoonlijk vind ik dan ook dat we er moeten naar streven dat elke volwassene beter een eigen inkomen zou verwerven en aldus eigen rechten kan opbouwen. Mocht dat het geval zijn, dan zou de alimentatie beperkt kunnen blijven tot een financiële steun in de opvoeding van de kinderen.
We moeten echter rekening houden met en vooral niet blind zijn voor het nog steeds bestaande rollenpatroon dat ook in jonge gezinnen nog blijft voortbestaan. Vanaf het moment dat er kinderen komen is het zeer dikwijls de vrouw die met liefde en uit vrije keuze een stap terug zet om voor kinderen en voor een huishouden te zorgen. De man stemt met die keuze meestal graag in. Evident ook, want die keuze verbetert ook voor hem de kwaliteit van zijn leven. Het schept ruimte die hij kan investeren in het werk. Deze regeling wordt meestal met beider toestemming ingevoerd, maar vormt dikwijls een discussiepunt achteraf, bij de echtscheiding en de alimentatieregeling. Het is een redenering die je veel ziet terugkomen in brieven en e-mails die we naar aanleiding van deze wet misschien allemaal wel hebben gekregen. Om het cru uit te drukken: de man vindt dat zijn vrouw al die tijd toch maar een mooi leven heeft gehad en dat ze nu zelf maar moet gaan werken; de vrouw voelt zich gepakt omdat ze zich ten dienste heeft gesteld van de carrière van haar man en haar kansen heeft laten passeren.
Wanneer we kiezen voor een model waarbij beide partners worden aangemoedigd om voor een inkomen te zorgen, dan heeft dat als gevolg dat zorgtaken en zorg voor kinderen ook gelijk moeten worden verdeeld.
Steeds meer mannen kiezen trouwens bewuster voor meer levenskwaliteit, waarbij er meer vrije tijd overblijft om deel te nemen aan het huiselijk leven en om zorg te besteden aan de kinderen. Men moet hiermee trouwens niet wachten tot men grootouder wordt.
Een volgend punt betreft de oprichting van de dienst voor alimentatievordering. Wat was het probleem dat men wou verhelpen? Het werd al herhaaldelijk gezegd en het is ondertussen voldoende bekend dat alimentatiegelden te dikwijls niet of onregelmatig worden betaald. Dat heeft als gevolg dat de partner die alimentatie moet krijgen, steeds in onzekerheid leeft over het inkomen. Het alimentatiegeld vormt dikwijls een noodzakelijke aanvulling van het inkomen van alleenstaande vrouwen met kinderen. Het niet of onregelmatig krijgen van dat geld brengt hen in geldproblemen, naast de andere zorgen die ze al hebben. Wanneer een wettelijke regeling werd vastgelegd voor alimentatie en die regeling wordt niet nageleefd, ontstaat er een gevoel van rechtsonzekerheid. Men heeft recht op alimentatie, maar het blijft dode letter. De betrokkenen voelen zich dan ook in de steek gelaten door de overheid en zij krijgen de indruk dat de overheid er zelf niet in slaagt de eigen regels te laten naleven.
Het volgend punt handelt over de voorschottenregeling via het OCMW. Het is duidelijk geworden tijdens de vele besprekingen dat die regeling niet meer voldoet. Het vragen van voorschotten via het OCMW wordt door de betrokkenen trouwens dikwijls ervaren alsof zij een beroep moeten doen op bijstand, terwijl zij eigenlijk recht erop hebben. Er zijn ook vrouwen die getuigen dat ze het sociaal onderzoek dat door het OCMW wordt uitgevoerd, of de begeleiding van het OCMW ervaren als betuttelend en onrechtvaardig. Waarschijnlijk zal het probleem van het alimentatiegeld in de toekomst nog ter sprake komen bij de OCMW's. Zeker wanneer die evolueren naar een sociaal huis, zullen nog veel mensen in eerste instantie proberen daar informatie te verkrijgen. Het is dus belangrijk dat de OCMW's — zeker in de overgangsperiode die we zullen meemaken — goed worden geïnformeerd en dat de overgang van de bestaande naar de nieuwe regeling vlot kan verlopen.
De voorgestelde oplossing van de wettekst, die wij vandaag zullen goedkeuren, bevat veel voordelen. De discussie tussen ex-partners over het betalen van alimentatiegeld wordt hierdoor geneutraliseerd. Dat lijkt mij een heel belangrijke factor. Het moet duidelijk zijn dat de overheid tussenkomt wanneer de rechthebbende niet of onregelmatig wordt uitbetaald. Dat is een zeer belangrijk aspect. Op die wijze wordt het wel of niet betalen van alimentatiegeld niet langer uitgespeeld als een middel om de vroegere partner te sarren, te kwetsen of te chanteren. Het wel of niet betalen van alimentatiegeld is te dikwijls een element geweest van chantage en van spanningen tussen vroegere partners.
De dienst zal ook een preventief effect hebben. Als de wanbetaler duidelijk weet dat niet-betalen ernstige gevolgen zal hebben, zal hij daarmee omzichtiger omgaan. Als het inkomen van de man echter niet voldoende is, wordt de invordering gestaakt. De dienst biedt de rechthebbende de zekerheid dat men een beroep kan doen op — weliswaar gelimiteerde — voorschotten en dat de overheid stappen onderneemt om achterstallen te recupereren. De procedure die de rechthebbende volgt, is veel eenvoudiger geworden en vermijdt extra kosten.
Wij moeten er wel nog voor zorgen dat de dienst snel bevolkt en georganiseerd kan worden om aan het werk te gaan. Er is een intensieve informatiecampagne nodig die iedereen op de hoogte brengt. Al wie recht heeft op die regeling moet dat ook kunnen te weten komen. Wie moedwillig niet betaalt of wie daaraan zou denken, moet gewaarschuwd worden. Het zal nodig zijn te zorgen voor een vlotte overgang van de bestaande regeling via de OCMW's naar de nieuwe dienst. Het is ondenkbaar en ontoelaatbaar dat de rechthebbenden die nu een dossier bij het OCMW hebben enige hinder, enige vertraging van uitbetaling, zouden ondervinden bij het overstappen naar de nieuwe regeling. Tot slot, de nieuwe regeling voorziet ook in een evaluatiemoment. Wanneer regelmatig een evaluatie wordt gedaan van de nieuwe wet zal er met zorg en aandacht naar eventuele problemen geluisterd worden en zal er een oplossing worden gezocht.
Om af te sluiten, wens ik zeer uitdrukkelijk dank te zeggen aan de collega's over alle partijgrenzen heen, die in een constructieve sfeer hebben meegewerkt om dit resultaat te bereiken. Ik bedank ook zeer uitdrukkelijk de mensen van de administratie voor het geduld dat zij telkens konden opbrengen, wat ik zeer kon appreciëren. Hun inbreng is absoluut van groot belang geweest. Natuurlijk bedank ik ook minister Reynders. Hij heeft vandaag een goede dag, denk ik, want hij is al heel vaak gefeliciteerd voor de keuze die hij gemaakt heeft.
Beste collega's, tot slot wil ik toch nog een oproep lanceren. In de loop van alle besprekingen over het Alimentatiefonds werden verschillenden onder ons dikwijls gecontacteerd door mensen die ons hun persoonlijke verhaal, hun persoonlijke problemen, wilden duidelijk maken. Een ding is ons daarbij onomstotelijk duidelijk geworden: alles wat te maken heeft met relaties, met kinderen, met echtscheiding, daar zijn de mensen mee bezig, daar liggen zij van wakker. Het is dan ook onze verantwoordelijkheid aan die signalen een antwoord te bieden. Misschien moeten wij, zoals wij konden werken aan deze wet over alimentatievorderingen, in de toekomst ook samenwerken om een oplossing te vinden voor het probleem van het omgangsrecht met kinderen, voor het probleem van de objectivering van alimentatiegelden en voor het probleem van de schuldloze echtscheiding. Mr. Speaker, Mr. Minister, dear colleagues, the law that we will pass today and which, in my opinion, is erroneously announced as a fund, because it is a service for maintenance claims, is very important. I would even call the law historical, for the following reasons.
First, the law provides a solution to a social problem that has been addressed for years and that has now received a definitive solution. This law addresses a problem of unpaid alimony payments which are ⁇ detrimental to single women with children. This law is also the result of purely parliamentary work across different party boundaries. This is not so everyday either. It is also the result of mostly female MPs who have pulled to the carriage and also sustained in difficult periods of negotiations.
Dear colleagues, the problem of unpaid alimony must be placed in the entire divorce process, which is a major social problem. More and more couples, more and more relationships end in a divorce. That is a determination. However, it all starts with a love, a relationship and in the fairy tales it ends with: "And they still lived long and happy and had many children."
More and more couples are no longer able to sustainably fulfill the sustainable commitment they have made. The decision to separate is not taken lightly. By the way, it is also always experienced as a failure and it has very many and profound consequences on the further lives of all involved. Therefore, it is not necessary to seek out whose fault it has now been all and to present the account to the other in the process of divorce.
Too many divorces also end in disputes. Adult partners who have liked to see each other now stand each other to life and are very creative in each other doing the devil. Their
The difficulties in the case of divorce appear also to arise in particular when arrangements must be made on the distribution of common property, on the regime for children and on the amount of maintenance, not so much because of the amount for the children, but primarily because of the amount for the former partner. Some men, especially after divorce, also seem to discover that they have children. However, I do not follow them in their reasoning if they pay alimony automatically commit to exercise visiting rights. Different alimony payers therefore have not so much trouble with alimony for children, but for a former partner. Therefore, I personally believe that we must strive to ensure that each adult better acquires his own income and thus builds up his own rights. More and more men are more consciously choosing better quality of life, with more free time left to participate in family life and to take care of the children. There is no need to wait until you become grandparents.
The next point concerns the establishment of the service for maintenance claims. What was the problem they wanted to fix? It has been said repeatedly, and it is now well known that maintenance payments are too often not or irregularly paid. As a result, the partner who needs to receive maintenance lives constantly in uncertainty about the income. Maintenance is often a necessary supplement to the income of single women with children. Failing or irregularly getting that money brings them into money problems, along with the other concerns they already have. When a legal regime has been established for maintenance and that regime is not complied with, a sense of legal uncertainty arises. They are entitled to alimony, but it remains a dead letter. Thus, the people concerned feel abandoned by the government and they get the impression that the government itself fails to enforce its own rules.
The next item is about the advance scheme through the OCMW. It has become clear during the many discussions that this scheme is no longer compliant. Furthermore, requesting advances through the OCMW is often perceived by the persons concerned as having to apply for assistance, while in fact they are entitled to it. There are also women who testify that they perceive the social research carried out by the OCMW, or the guidance of the OCMW as overwhelming and unfair. Probably the problem of the maintenance payment in the future will still be discussed by the OCMWs. Especially when they evolve into a social home, many people will initially try to obtain information there. It is therefore important that the OCMWs — ⁇ during the transitional period we will experience — are properly informed and that the transition from the existing to the new scheme can go smoothly.
The proposed solution of the legislation, which we will approve today, has many advantages. The discussion between ex-partners about paying alimony is thereby neutralized. This seems to me a very important factor. It should be clear that the government intervenes when the rightholder is not or irregularly paid out. This is a very important aspect. In this way, whether or not to pay alimony is no longer played out as a means of harassing, hurting or blackmailing the former partner. Paying or not paying alimony has too often been an element of blackmail and tensions between former partners.
The service will also have a preventive effect. If the insolvent clearly knows that non-payment will have serious consequences, he will deal with it more cautiously. However, if the income of the man is not sufficient, the collection is stopped. The service provides the rightholder with the assurance that advances — though limited — can be invoked and that the government is taking steps to recover the defaults. The procedure followed by the rightholder has become much simpler and avoids additional costs.
We still need to ensure that the service can be quickly populated and organized to get to work. There is a need for an intense information campaign that informs everyone. Anyone who has the right to this regulation should also be able to know this. Those who intentionally do not pay or who would think about it should be warned. It will be necessary to ensure a smooth transition from the existing scheme through the OCMWs to the new service. It is unthinkable and unacceptable that the rightholders who now have a file with the OCMW would encounter any obstacle, any delay in payment, in the transition to the new scheme. Finally, the new scheme also provides for an evaluation moment. When a regular review of the new law is carried out, any problems will be listened with care and attention and a solution will be sought.
To conclude, I would like to express my very express thanks to my colleagues across all party boundaries, who have worked together in a constructive atmosphere to ⁇ this result. I also expressly thanked the people of the administration for the patience that they were able to exert at all times, which I could highly appreciate. Their contribution has absolutely been of great importance. I would like to thank Minister Reynders. He has a good day today, I think, because he has been congratulated very often for the choice he has made.
Finally, I would like to make a call. In the course of all discussions on the Alimentation Fund, different people among us were often contacted by people who wanted to clarify their personal story, their personal problems. One thing has become unmistakably clear to us: everything that has to do with relationships, with children, with divorce, that is what people are doing, that is what they are waking up. It is our responsibility to respond to these signals. Mijnheer de voorzitter, mijnheer de minister, collega's, ik sta hier vandaag met een uitzonderlijk grote tevredenheid, om twee redenen. Ten eerste, uiteraard wegens de doorbraak in dit dossier dat mij na aan het hart ligt. Waarom? Het is hier al ten overvloede gezegd, maar ik wil het toch even herhalen. Er worden al jaren lang grote problemen vastgesteld inzake de nietuitbetaling of de onvolledige uitbetaling van alimentatie.
Ik herhaal dat 40% van de betrokkenen niet, te laat of onvolledig betaalt. Voor alle duidelijkheid, dit is zeer belangrijk, want studie wijzen uit dat dit voor heel wat gezinnen het verschil betekent tussen bestaanszekerheid en bestaansonzekerheid.
De doorbraak in dit dossier is dus verheugend en zelfs uitzonderlijke verheugend omdat dit het eerste dossier is dat werd behandeld door het adviescomité voor maatschappelijke emancipatie waarvan ik het geluk had om als nieuwbakken parlementslid meteen het voorzitterschap te mogen waarnemen.
Het adviescomité voerde een sereen, maar uitgebreid debat, pleegde veel overleg, woog de pro's en de contra's tegen elkaar af en stelde een duidelijke inventaris op van het probleem. Op dat ogenblik — thans meer dan drie jaar geleden — waren wij nog niet rijp om het eensgezind te worden omtrent de manier waarop wij het probleem zouden aanpakken. Een punt was evenwel duidelijk, met name dat er zeker een oplossing moest komen in de loop van deze legislatuur.
Ik ben de collega's van het adviescomité dan ook zeer dankbaar dat zij, als vervolg van de gevoerde debatten, het voortouw in handen namen om tot een compromis te komen teneinde deze problematiek aan te pakken. Zeer uitdrukkelijk wens ik de dames Herzet, Moerman, Grauwels, De Meyer en alle andere leden te danken die mee aan de kar trokken om eensgezindheid te bereiken in het vinden van een degelijke oplossing voor deze problematiek. Dat degenen van wie ik de naam vergeet te noemen het mij niet kwalijk nemen. Hun namen staan hoe dan ook vermeld bij de ondertekening.
Na de bespreking bleven er twee pistes over om dat grote probleem om te lossen. De eerste piste bestond erin de OCMW's bij de zaak te betrekken en het bestaande systeem van voorschotten bij de OCMW's uit te breiden. Dat had een aantal voordelen. Het OCMW is een instelling die dichtbij de mensen staat, maar waarvan de drempel jammer genoeg nog steeds hoog is. Ik merk dat de heer Bourgeois momenteel niet aanwezig is, maar ik wens duidelijk te maken dat ook wij graag zouden komen tot een echt sociaal huis waarvan de drempel niet meer zo hoog is en waar mensen op een vlotte manier terechtkunnen met al hun sociale problemen. Zover is het echter nog niet, maar er wordt werk van gemaakt.
Een ander nadeel van de OCMW-piste is dat de inkomsten worden nagegaan en dat een inkomstenplafond wordt gehanteerd. Bovendien stellen wij vast dat de OCMW 's duidelijk het signaal gaven reeds ernstig overbelast te zijn met een aantal taken die zij nauwelijks kunnen bolwerken.
De tweede piste, het fonds, waarvoor een aantal voorstellen werden geformuleerd, had als nadeel dat heel wat personen vreesden voor misbruik en voor een gebrek aan selectiviteit.
Na veel wikken en wegen en na degelijk werk, in samenspraak met de administratie, werd een eerbaar en degelijk compromis gesloten en kwam er een goed voorstel uit de bus. Dit voorstel is globaal gezien positief.
Alimentatie is een recht dat moet worden gerespecteerd, dat mogen wij niet vergeten, en de overheid moet hierop toezien. De formule waarvoor vandaag wordt gekozen is laagdrempelig. Ik pleit er wel voor om in de praktische toepassing eventueel op termijn toch de OCMW 's of het sociaal huis hierbij te betrekken om de mensen te begeleiden bij het indienen van hun dossier en in hun contacten met de betrokken dienst. De formule zou evenwel laagdrempelig moeten zijn en ik benadruk dat wij hiervan werk moeten maken.
Vooral de recuperatie van de gelden die door de dienst worden voorgeschoten, is in handen van Financiën, die toch het meest geschikt is om op een vlotte, ernstige manier ervoor te zorgen dat de overheidsmiddelen snel worden gerecupereerd van diegenen die bij rechterlijk vonnis zijn aangeduid om dat te betalen.
Ik wil nog even een paar kleine nadelen in het huidige voorstel onder uw aandacht brengen. Mevrouw Moerman heeft goed beargumenteerd dat het ook betaalbaar moet zijn, maar ik betreur het toch nog een beetje dat nog 5% ten laste komt van de schuldeiser. Het blijft uiteraard een systeem van voorschotten. Het blijft een beetje een lapmiddel met een plafond van bedragen die kunnen worden uitgekeerd. Dat is allemaal zeer begrijpelijk en terecht, maar het ware natuurlijk beter dat wij het percentage zouden kunnen terugdringen van hen die het alimentatiegeld niet betalen. Dat zou toch ook nog altijd onze doelstelling moeten zijn. Vandaar dat ik ook wil oproepen om ervoor te zorgen dat Justitie hierbij geen aanleiding geeft om nog lakser op te treden bijvoorbeeld in het geval van familieverlating. Ik vraag toch uitdrukkelijk aandacht om dit ook nog als een ernstig vergrijp te catalogeren en daarvan ook werk te maken vanuit justitiële hoek. Een meersporenbeleid blijft dus echt noodzakelijk.
Tot slot zou ik toch wel heel duidelijk willen zeggen dat dit een heugelijk moment is voor al die vrouwen en soms ook mannen — ik heb er al ontmoet — die hun alimentatie voor de kinderen niet krijgen van de echtgenoot of echtgenote die moet betalen. Al die gezinnen die op dit ogenblik een recht niet uitgevoerd zien en daardoor vaak in moeilijkheden zitten, zullen op die manier zeker worden geholpen, dit meer dan dertig jaar nadat die problematiek

At that time — now more than three years ago — we were not yet mature to agree on how we would address the problem. One point, however, was clear, in particular that there must ⁇ be a solution in the course of this legislature.
I am therefore very grateful to the colleagues of the Advisory Committee that, as a follow-up to the debates held, took the lead in finding a compromise to address this problem. Very expressly I wish to thank the ladies Herzet, Moerman, Grauwels, De Meyer and all the other members who joined the chariot in order to ⁇ consensus in finding a solid solution to this problem. Those whose names I forget to name do not blame me. Their names are mentioned at the signature.
After the discussion, there remained two pistes to solve that big problem. The first step was to involve the OCMWs in the case and to extend the existing system of advances to the OCMWs. This had a number of advantages. The OCMW is an institution that is close to the people, but whose threshold is unfortunately still high. I notice that Mr. Bourgeois is not present at the moment, but I would like to make it clear that we too would like to come to a true social home whose threshold is no longer so high and where people can easily end up with all their social problems. This is not yet done, but work is being done.
Another disadvantage of the OCMW track is that income is checked and that an income ceiling is used. Furthermore, we note that the OCMWs clearly gave the signal that they were already severely overloaded with a number of tasks that they could hardly support.
The second track, the fund, for which a number of proposals were formulated, had the disadvantage that many people feared abuse and a lack of selectivity.
After many wheels and roads and after hard work, in consultation with the administration, a honest and decent compromise was concluded and a good proposal came out of the bus. This proposal is overall positive.
Alimentation is a right that must be respected, that we must not forget, and the government must monitor it. The formula for which today is chosen is low threshold. I suggest, however, that in the practical application, eventually in the long term, the OCMWs or the social house should be involved in this, in order to guide the people in submitting their file and in their contacts with the relevant service. However, the formula should be low threshold and I emphasize that we need to work on this.
Particularly the recovery of the funds that are advanced by the service is in the hands of Finance, which, however, is the most suitable to ensure in a smooth, serious way that the public funds are quickly recovered from those designated by a court ruling to pay that.
I would like to draw your attention to a few minor disadvantages of the present proposal. Ms. Moerman has well argued that it must also be affordable, but I still regret a little that another 5% will be borne by the creditor. It is, of course, a system of advances. It remains a bit of a layer with a ceiling of amounts that can be paid out. That is all very understandable and justified, but it would of course be better that we could reduce the percentage of those who do not pay the alimony. That should still be our goal. Therefore, I would also like to appeal to ensure that the Judiciary does not give an incentive to act even more loudly, for example in the case of family abandonment. Mijnheer de voorzitter, mijnheer de minister, collega's, als voorlaatste in dit debat, wou ik toch nog een aantal elementen naar voren brengen met betrekking tot de standpuntbepaling van mijn fractie hieromtrent.
Uit het debat van deze namiddag blijkt toch duidelijk dat we het allemaal eens zijn dat er een oplossing moest komen voor het probleem van de alimentatievergoedingen, een maatschappelijk probleem dat al jarenlang aansleept. Als het om alimentatievergoedingen gaat, bedoel ik daarmee de niet-betaling of de laattijdige betaling van uitkeringen; twee elementen die al vele vrouwen — maar ook mannen — in de armoede hebben gedrukt. Het zijn twee elementen die oorzaak zijn van bestaansonzekerheid van betrokkenen.
Ondanks het feit dat voorliggende wetsvoorstellen een zeer nobel doel hebben, heeft het Vlaams Blok toch een aantal opmerkingen te maken.
Een eerste element is het feit dat de OCMW's niet langer als aanspreekpunt of plaats voor het indienen van de aanvraag gelden. Het zijn per slot van rekening toch de OCMW's die een enorme expertise op dat vlak hebben. Het blijft, volgens ons, een sociale dienst aan de bevolking. De lokale bereikbaarheid van de OCMW's was steeds een van de troeven.
De vraag is of dit met het veeleer beperkt aantal kantoren van het ministerie van Financiën ook het geval zal zijn, ik denk dat het gaat om een vierenveertigtal kantoren, verspreid over het hele land. Als Vlaams Blok vinden wij het belangrijk dat dossiers inzake sociale uitkeringen, en dit in dit geval uitkeringen tot onderhoud, in de handen blijven van het OCMW, los van het feit of de voorgestelde structuur van het ministerie van Financiën binnen de zes maanden operationeel zal zijn. Het ministerie van Financiën heeft trouwens ook bij het grote publiek een nogal negatieve perceptie.
Ik kom tot het tweede element. Het Vlaams Blok is van oordeel dat de problematiek van de alimentatievergoedingen een persoonsgebonden aangelegenheid is. Aangezien het hier gaat om een bijstand aan personen en de Gemeenschappen bevoegd zijn voor het gezinsbeleid, met inbegrip van alle vormen van hulp en bijstand aan gezinnen en kinderen, zijn wij van oordeel dat dit probleem niet op het Belgische federale niveau, maar op het niveau van de Gemeenschappen moet worden geregeld. De Raad van State heeft trouwens al verschillende malen bevestigd dat de Gemeenschappen een regeling mogen opzetten van voorschotten op uitkeringen tot onderhoud van behoeftige personen die bij gerechtelijke beslissing het recht op zo'n uitkering hebben gekregen.
Zoals bij iedere Belgische regelgeving inzake de sociale sector, en dat is het derde element, vrezen wij ook hier voor een transfer van Vlaanderen naar Wallonië, een transfer van noord naar zuid, al was het maar vanwege het feit dat het invorderen van achterstallen in het Franstalige landsgedeelte blijkbaar heel wat stroever en moeilijker verloopt dan in Vlaanderen.
Ik kom ten slotte tot het vierde element, mijnheer de voorzitter. Het is ontegensprekelijk zo dat de druk van het einde van de legislatuur verschillende fracties tot meer bereidheid, tot meer compromis heeft gebracht, maar de financiële rekening wordt doorgeschoven naar de volgende legislatuur. Ik kan begrijpen dat dit het nobel doel niet in de weg kan staan, maar indien dit voorstel een jaar geleden zou zijn afgewerkt, dan zou waarschijnlijk het financiële aspect een van de breekpunten zijn geweest.
Mijnheer de voorzitter, wij steunen in ieder geval de noodzaak van een regeling en de rechtszekerheid rond de alimentatievergoedingen, zeker voor degenen die er recht op hebben, maar gezien de voormelde feiten zullen wij het voorliggende wetsvoorstel niet goedkeuren en ons onthouden.

The question is whether this will be the case with the rather limited number of offices of the Ministry of Finance, I think it is about forty-four offices, spread across the country. As the Vlaams Blok, we consider it important that files regarding social benefits, and this in this case maintenance benefits, remain in the hands of the OCMW, regardless of whether the proposed structure of the Ministry of Finance will be operational within six months. The Ministry of Finance, by the way, also has a rather negative perception among the general public.
I come to the second element. The Flemish Blok considers that the problem of maintenance benefits is a personal matter. Since this is a matter of assistance to individuals and the Communities are responsible for family policy, including all forms of assistance and assistance to families and children, we believe that this issue should be addressed not at the Belgian federal level, but at the level of the Communities. Furthermore, the Council of State has repeatedly confirmed that the Communities may establish a system of advances on maintenance benefits for needy persons who have been entitled to such benefits by court decision.
As with any Belgian regulation on the social sector, and that is the third element, we also fear here for a transfer from Flanders to Wallonia, a transfer from north to south, though it was only because the collection of backstakes in the French-speaking part of the country appears to be much more difficult and more difficult than in Flanders.
Finally, I come to the fourth element, Mr. Speaker. It is undisputed that the pressure of the end of the legislature has brought several groups to more willingness, to more compromise, but the financial account is moved to the next legislature. I can understand that this cannot stand in the way of the noble purpose, but if this proposal had been completed a year ago, then the financial aspect would probably have been one of the breakpoints.

Monsieur le président, chers collègues féminins et masculins, il est vrai que la proposition de loi qui aboutit en séance plénière ce jour est tout à l'honneur du Parlement.
Il s'agit d'une initiative parlementaire due à nos collègues féminins pour un objectif sociétal essentiel.
D'aucuns pouvaient s'interroger sur la question de savoir si l'intervention du législateur afin de faire exécuter les décisions de justice et si le recours à un service particulier de l'Etat étaient nécessaires.
Le débat en commission des Finances — et je remercie ici les collègues qui l'ont nourri — a démontré que pour apporter l'apaisement dans les relations entre les ex-conjoints et pour éviter que les enfants ne soient parfois les otages de mauvaises querelles dues à des sentiments qui ne sont pas encore apaisés, il y avait lieu, sans doute, de prévoir un mécanisme juridique qui permette de rétablir si ce n'est totalement l'apaisement, en tout cas, un autre mode de relation entres les ex-conjoints dans le règlement de leurs litiges financiers.
On connaît tous les aléas de procédure que nous avons dû rencontrer et les différentes formules qui ont été esquissées lors des travaux de commission. Selon moi, la proposition de loi, qui a abouti grâce à la collaboration remarquable du ministre des Finances, de ses services, de ses collaborateurs et de sa collaboratrice en particulier, a permis de trouver un juste équilibre.
Il est important de souligner le maintien de la matière visée par la proposition de loi dans une logique de compétence fédérale. Le Conseil d'Etat s'est, en effet, prononcé à deux reprises au sujet de cette compétence dans les avis qu'il a respectivement rendus les 2 mai 2000 et 9 juillet 2002.
Dans son premier avis, le Conseil d'Etat disait que, je cite: "Les règles relatives aux créances alimentaires font partie des dispositions du Code civil portant sur le statut des personnes et de la famille. Ces matières sont demeurées de la compétence de l'Etat fédéral au titre de sa compétence résiduelle. Les propositions de loi examinées ont pour objet d'assurer l'effectivité du respect des obligations alimentaires telles qu'elles ont été constatées par une décision de justice ou par une convention préalable à un divorce par consentement mutuel. Les compétences transférées aux Communautés n'ont pas porté atteinte à la compétence fédérale en la matière. La compétence de régler les modalités destinées à assurer l'effectivité du paiement des créances alimentaires est, en effet, liée à ce point aux règles relatives aux obligations alimentaires qu'elle y est demeurée indissolublement attachée en termes de répartition des compétences et qu'elle relève donc de l'autorité fédérale".
Dans un deuxième avis, le Conseil d'Etat réitérait ses constatations, quelles que soient les différentes formules esquissées à un moment donné pour régler cette matière.
C'est ainsi que le système est pleinement cohérent et permet d'éviter le risque d'une communautarisation du débat; je crois même qu'il était temps qu'on légiférât sur cette question avant qu'éventuellement le débat institutionnel ne vienne perturber la correcte appréhension de cette matière.
Le fait de créer un fonds au sein du Service public fédéral des Finances garantit, de manière plus certaine encore, la compétence au niveau fédéral. Il est donc préférable à ce qui était esquissé en termes de missions confiées aux CPAS, pas seulement pour toutes les raisons qui ont été évoquées mais aussi pour garantir le maintien de cette compétence au niveau fédéral. Un morcellement de cette matière entre les Communautés présenterait le risque d'une application différente des décisions de justice en fonction des personnes et de l'endroit où elles vivent.
Les auteurs de la proposition de loi ont veillé à inscrire les mécanismes de recouvrement des créances alimentaires, en exécution d'une décision de justice; il ne s'agit donc nullement d'une forme d'aide aux personnes sur une base volontaire.
Le deuxième aspect fondamental pris en compte par la proposition de loi est que les avances sont octroyées au créancier d'aliments sans tenir compte du niveau de ses revenus; je m'y étais particulièrement attaché avec d'autres membres de la commission. D'aucuns peuvent s'interroger sur la pertinence de cette demande et de cette reconnaissance.
Je me permets de redire ici que, par rapport à l'objectif poursuivi qui est de faire exécuter les décisions de justice ayant reconnu des droits, il n'existe effectivement aucun argument objectif permettant de justifier que ce soit le niveau de revenus des créanciers d'aliments qui détermine ou non l'accès au mécanisme proposé. Il s'agit d'un droit résultant de l'exécution d'une décision de justice qui ne relève, dès lors, pas de la logique de l'aide sociale, logique qui évidemment entend prendre en compte les revenus des éventuels bénéficiaires. Un système d'avances qui aurait créé une différence de traitement en fonction des revenus du créancier d'aliments pourrait même être juridiquement critiqué, au regard du principe d'égalité défendu par la Constitution, et pourrait faire l'objet d'un recours à la Cour d'arbitrage; ce risque a été écarté par la solution définitivement retenue.
Faut-il aussi rappeler que les magistrats tiennent compte des revenus des ex-conjoints pour déterminer le montant des pensions alimentaires? Pourquoi les débiteurs ou les créanciers d'aliments devraient-ils dès lors être ultérieurement pénalisés sur la base de ces mêmes revenus, lors de l'octroi éventuel d'avances?
Une troisième avancée dont il faut se réjouir est l'opportunité d'avoir placé le service des créances alimentaires au sein du service public fédéral des Finances. Plus d'un l'ont dit, cela assure vraiment la cohérence du système et une égalité de traitement de toutes les personnes concernées, non seulement quelle que soit leur région de domiciliation, mais aussi quels que soient leurs revenus ou leur situation personnelle.
Je relève aussi la création de la commission d'évaluation et je crois que ce serait rendre hommage à celles qui ont porté ce projet que de veiller, monsieur le ministre, à les associer demain — puisque d'aucunes n'auront plus la chance de siéger dans notre assemblée — au travail de cette commission d'évaluation.
Un quatrième grand aspect mérite d'être souligné dans les équilibres de cette proposition. Il s'agit de la sécurité juridique et de ses différentes facettes. Quand on parcourt la proposition de loi, que ce soit pour la phase d'instruction de la demande introduite par le créancier d'aliments ou par son représentant, éventuellement son avocat, que ce soit pour la phase de recouvrement, on est frappé par les obligations qui pèsent sur le service des créances alimentaires. Il doit veiller à informer correctement chacune des parties quant aux conséquences de la procédure qui est ainsi engagée. Il faut bien dire que ce n'est pas une procédure d'étranglement du débiteur alimentaire.
Avant même la mise en oeuvre de la procédure de recouvrement, il existe la possibilité pour le débiteur d'aliments de régulariser sa situation, de faire éventuellement état du fait que le titre de recouvrement de la créance n'est plus actuel et de faire valoir ses moyens juridiques auprès du service public fédéral. Donc, la proposition de loi a été particulièrement soucieuse, dans les différentes étapes de la procédure, de veiller à l'équilibre des droits de chacune des parties. Bien entendu, l'objectif est de permettre aux créanciers d'aliments de bénéficier des avances et de voir un recouvrement effectif intervenir. Il n'en demeure pas moins que nous n'avons pas versé dans l'excès qui serait d'entendre le seul point de vue du créancier d'aliments. Non. On a encore veillé, après décision de justice à donner toute chance au débiteur d'aliments de faire valoir son point de vue, non pour contester la décision de justice, mais pour éventuellement faire état de paiements qu'il aurait effectués et qui ne seraient pas relevés par le créancier des aliments ou faire état d'autres causes juridiques qui justifieraient le bien-fondé de sa position. Je crois qu'en cela, la proposition est aussi particulièrement remarquable.
Je relève aussi que, dans les procédures de recouvrement, avant que les procédures de contrainte ne soient mises en oeuvre, il sera encore laissé un temps au débiteur d'aliments pour veiller à se mettre en conformité avec la loi et à respecter ses obligations légales.
Je conclus en disant que cette proposition de loi, non seulement est à mettre à l'honneur du travail parlementaire de ses auteurs et de tous ceux qui ont concouru à sa réussite, mais démontre que le service public fédéral des Finances, souvent appréhendé comme un service parfois difficile dans ses relations avec les contribuables, peut assumer en somme une mission éminemment sociale, avec la volonté de faire respecter l'autorité d'un jugement mais aussi avec la volonté de concilier les points de vue de toutes les parties.
C'est sans doute un fait novateur mais qui démontre aussi que la volonté du ministre des Finances de voir ses services avoir une conception d'attention à l'égard des citoyens est une volonté qui est confirmée par cette proposition de loi. Ce n'est pas la moindre des choses de voir que c'est le ministère des Finances qui, par la mise à disposition de ses moyens humains et logistiques, permet en définitive de faire aboutir une légitime revendication qui avait trop attendu sa réponse.

Mr. Speaker, dear colleagues women and men, it is true that the bill that ends in plenary session today is all in the honour of Parliament.
This is a parliamentary initiative due to our female colleagues for an essential social goal.
Some might question whether the intervention of the legislator in order to enforce judicial decisions and whether the recourse to a particular service of the state were necessary.
The debate in the Finance Committee — and I thank here the colleagues who fed it — demonstrated that in order to bring calm in relations between former spouses and to prevent children from sometimes being hostages of bad quarrels due to feelings that are not yet calmed, there was no doubt the need to provide for a legal mechanism that allows to restore if it is not completely calming, in any case, a different way of relationship between former spouses in the settlement of their financial disputes.
We know all the procedural difficulties we have encountered and the different formulas that were sketched during the committee work. In my opinion, the bill, which resulted from the remarkable collaboration of the Minister of Finance, his services, his collaborators and his collaborator in particular, helped to find the right balance.
It is important to emphasize the maintenance of the matter covered by the bill in a logic of federal jurisdiction. The State Council has, in fact, ruled twice on this competence in its opinions delivered on 2 May 2000 and 9 July 2002, respectively.
In its first opinion, the State Council stated that, I quote: "The rules on maintenance claims are part of the provisions of the Civil Code concerning the status of persons and the family. These matters remain within the competence of the federal state under its residual competence. The objective of the proposals is to ensure the effective compliance with maintenance obligations as established by a court decision or by an agreement pre-divorce by mutual consent. The powers transferred to the Communities did not prejudice the federal competence in this matter. The competence to regulate the arrangements intended to ensure the effective payment of maintenance claims is, in fact, so linked to the rules relating to maintenance obligations that it remains inseparably attached to them in terms of the allocation of competences and that it therefore belongs to the federal authority.”
In a second opinion, the State Council would reiterate its findings, regardless of the different formulas outlined at a given time to settle this matter.
This is how the system is fully coherent and allows to avoid the risk of a communitarianization of the debate; I even believe that it was time to legislate on this issue before eventually the institutional debate comes to disturb the correct understanding of this matter.
The fact of creating a fund within the Federal Public Service of Finance guarantees, in an even more certain way, the competence at the federal level. It is therefore preferable to what was sketched in terms of tasks entrusted to the CPAS, not only for all the reasons mentioned but also to ensure the maintenance of this competence at the federal level. A fragmentation of this matter between the Communities would pose the risk of a different application of judicial decisions depending on the persons and the place where they live.
The authors of the bill have ensured that the mechanisms for the recovery of maintenance claims are registered, in execution of a court decision; therefore it is in no way a form of assistance to persons on a voluntary basis.
The second fundamental aspect taken into account by the bill is that advances are granted to the maintenance creditor without taking into account the level of his income; I was ⁇ attached to this with other members of the committee. Some may question the relevance of this request and recognition.
I would like to reiterate here that, in relation to the aim pursued, which is to enforce judgments recognizing rights, there is indeed no objective argument to justify whether it is the level of income of maintenance creditors that determines whether or not access to the proposed mechanism. It is a right resulting from the execution of a court decision which, therefore, does not fall within the logic of social assistance, a logic which obviously intends to take into account the income of potential beneficiaries. An advance scheme that would have created a difference of treatment based on the income of the maintenance creditor could even be legally criticized, in light of the principle of equality protected by the Constitution, and could be the subject of an appeal to the Arbitration Court; this risk was excluded by the solution finally elected. by
Should it also be recalled that the magistrates take into account the incomes of former spouses in determining the amount of maintenance pensions? Why should debtors or alimony creditors therefore be subsequently penalized on the basis of the same income, when granting any advances? by
A third advance to be welcomed is the opportunity to have placed the service of maintenance claims within the Federal Public Service of Finance. More than one said it really ensures system coherence and equal treatment of all people concerned, not only regardless of their area of residence, but also regardless of their income or personal situation.
I also take note of the creation of the evaluation committee and I believe that it would be to pay tribute to those who have carried this project than to make sure, Mr. Minister, to associate them tomorrow — since some will no longer have the chance to sit in our assembly — with the work of this evaluation committee.
A fourth major aspect deserves to be emphasized in the balances of this proposal. It is about legal certainty and its various facets. When searching the bill, whether for the examination phase of the application submitted by the alimony creditor or his representative, possibly his lawyer, whether for the recovery phase, you are hit by the obligations that weigh on the service of alimony claims. It must ensure that each party is properly informed of the consequences of the procedure that is thus initiated. It should be noted that this is not a procedure to strangle the food debtor.
Even before the enforcement of the recovery procedure, there is a possibility for the maintenance debtor to regularise his situation, to eventually declare that the debt recovery document is no longer valid, and to claim his legal remedies with the federal public service. Thus, the bill was ⁇ concerned, in the different stages of the procedure, to ensure the balance of the rights of each of the parties. Of course, the goal is to enable alimony creditors to benefit from advances and to see effective recovery take place. It remains, however, that we did not pay in the excess that would be to hear the only point of view of the alimony creditor. and no. After a court ruling, it was also ensured to give the debtor of alimony every chance to assert his point of view, not to challenge the court decision, but to eventually report payments that he would have made and which would not be recovered by the creditor of alimony or to report other legal causes that would justify the well-founded nature of his position. I also note that in recovery proceedings, before the compulsory proceedings are implemented, there will still be a time left for the maintenance debtor to ensure that it complies with the law and fulfils its legal obligations.
I conclude by saying that this bill, not only is to honor the parliamentary work of its authors and of all those who contributed to its success, but demonstrates that the federal public service of Finance, often perceived as a service sometimes difficult in its relations with taxpayers, can assume in short an eminently social mission, with the will to respect the authority of a judgment but also with the will to reconcile the points of view of all parties. by
This is ⁇ an innovative fact but it also demonstrates that the Minister of Finance’s will to see his services have a conception of attention towards citizens is a will that is confirmed by this bill. Monsieur le président, je vous rassure d'emblée. Je tenterai d'être très bref en évoquant simplement trois ou quatre éléments. Il me paraît naturel de commencer par le débat qui vient d'avoir lieu en séance plénière, en tentant de répondre à quelques-unes des questions posées.
La première portait sur les relations entre les CPAS et le département des Finances, en ce qui concerne la transmission de données. Mme Burgeon y est revenue. Je confirme, bien entendu, que le département des finances a une longue tradition d'échanges de données et que la confidentialité d'un certain nombre de données transmises sera respectée. Il n'y a pas de difficulté à cet égard. Mevrouw Moerman heeft vragen gesteld over de aftrekbaarheid van verschillende posten. We moeten daarover verder nadenken. Il est important d'associer de manière large ceux qui ont, de l'une ou l'autre manière, participé à nos travaux, qu'il s'agisse d'associations, du Parlement ou des départements concernés.
Quant au contenu de la proposition, je rappelle que nous avons choisi de concentrer les actions au sein d'un seul lieu: le département des finances, le service public fédéral des finances. Wat de FOD Financiën betreft, moeten we verder gaan met initiatieven te nemen. We moeten evolueren naar een gedecentraliseerde dienst, een werking van veel gedecentraliseerde diensten. Ik hoop dat het mogelijk is een 40-tal lokale kantoren op te richten om de mensen te woord te staan en te helpen. Wat het eerste contact betreft, moet het eveneens mogelijk zijn samen te werken met andere overheden zoals de gemeenten en de OCMW's. Dès lors, nous ferons tout notre possible pour que tous ces services soient le plus décentralisés possible, afin que la proximité joue dans le cadre de la mise en place de cette nouvelle formule. Nous prendrons évidemment en charge l'ensemble des missions que le parlement souhaite confier au Service fédéral des Finances tant en matière d'avances que de recouvrements.
Le troisième élément sur lequel je veux intervenir concerne, bien entendu, les actions que nous aurons à entreprendre pour que cette nouvelle activité du département fonctionne correctement. Il y aura lieu de mettre en place la nouvelle organisation et de faire fonctionner non seulement le service lui-même mais sa coordination avec d'autres services. Je pense à la Trésorerie pour le paiement rapide des avances une fois celles-ci décidées ainsi qu'à la collaboration avec beaucoup d'acteurs qui interviennent dans ce même débat, dans d'autres mondes parfois que celui du département des finances. Nous n'hésiterons pas, dans les prochains mois, à diffuser de l'information à ce sujet. Je rassure tous ceux qui seraient inquiets en la matière: nous allons bien entendu prendre contact avec tous les intervenants et tous les publics concernés pour faire en sorte que les textes et les mécanismes soient connus et que dès l'entrée en vigueur effective de ce système, tout puisse se passer de la meilleure façon qui soit.
Je voudrais conclure sur deux éléments. Le premier concerne évidemment les remerciements que tous et toutes ont déjà adressés à un grand nombre d'intervenants. En tout cas, je voudrais dire qu'une proposition comme celle-ci n'aurait pu aboutir sans la motivation d'un certain nombre d'associations. Chacun et chacune y a fait allusion. Dans les mois et années à venir, nous aurons encore à travailler avec ces associations.
Cette proposition n'aurait pu aboutir sans l'investissement de nombreux parlementaires dans un tel dossier et ce, depuis plusieurs années. Permettez-moi de me joindre aux remerciements adressés à Mme Herzet sur ce point. Je n'ignore pas l'acharnement, la patience et le doigté dont elle a fait preuve pour faire aboutir cette proposition. J'utilise le terme "aboutir" car nous sommes à la veille des dernières étapes de la mise en place du nouveau service.
Beaucoup d'entre vous ont évoqué une personne sans la nommer. Permettez-moi, puisqu'elle fait partie de mon département, d'associer Mme Laloux à nos remerciements. Elle est à l'origine de nombreuses solutions et elle assiste encore aujourd'hui à nos travaux. De temps en temps, il faut savoir rendre à ceux qui collaborent aux dossiers ce qui leur revient.
Enfin, monsieur le président, mon intention est de faire en sorte que l'ensemble de ce projet voie effectivement le jour au 1 er septembre prochain. Dès lors, j'espère que le travail pourra se faire très rapidement en collaboration avec les groupes du Sénat, afin de pouvoir tout mettre en oeuvre et démarrer très concrètement l'activité de ce nouveau service à cette date.
C'est avec beaucoup de plaisir que je tenterai de faire publier cette loi à bref délai et je salue cette initiative parlementaire, il me semble utile de le rappeler.

With regard to financial affairs, we must go further with initiative and take you. We must evolve towards a decentralized service, a working of many decentralized services. I think of the Treasury for the quick payment of advances once these are decided as well as the collaboration with many actors who intervene in this same debate, in other worlds sometimes than that of the department of finance. We will not hesitate, in the coming months, to disseminate information on this subject. I reassure all those who are concerned about this matter: we will of course contact all stakeholders and all the public concerned to make sure that the texts and mechanisms are known and that from the effective entry into force of this system, everything can be done in the best way possible.
I would like to conclude on two points. The first concerns of course the thanks that all and all have already addressed to a large number of speakers. In any case, I would like to say that a proposal like this could not have resulted without the motivation of a number of associations. Everyone and every one has mentioned it. In the coming months and years, we will still have to work with these associations.
This proposal could not have achieved without the involvement of many parliamentarians in such a matter, and this, for several years. Let me join in the thanks to Mrs. Herzet on this point. I do not ignore the stubbornness, patience and fingering she has shown to bring this proposal to fruition. I use the term “success” because we are on the eve of the final stages of the establishment of the new service.
Many of you have mentioned a person without naming him. Let me, since she is part of my department, associate Mrs. Laloux with our thanks. It is the source of many solutions and it still assists our work today. From time to time, it is necessary to know how to give back to those who collaborate with the files what belongs to them.
Finally, Mr. Speaker, my intention is to make sure that this whole project actually starts on 1 September next year. Therefore, I hope that the work can be done very quickly in collaboration with the Senate groups, so that we can put everything in place and start very concretely the activity of this new service by this date.
It is with great pleasure that I will try to publish this law in a short time and I welcome this parliamentary initiative, I find it useful to recall it.
