Voorzitter, vooruitlopend op de uiteenzettingen van onze fractie zowel in de algemene bespreking als in de artikelsgewijze bespreking van dit ecotaksontwerp, het ontwerp dat de belasting-Reynders invoert, denken wij dat het goed is om verwijzend naar artikel 56 van ons Reglement te vragen dat twee amendementen, de amendementen nummer 28 en 30, voor advies aan de Raad van State zouden worden voorgelegd.
Ik wil kort toelichten waarover het gaat. Het staat in de verantwoording. Enerzijds heeft het te maken met de bekrachtiging van koninklijke besluiten waarvoor in de wet zelf geen termijn bepaald is. Het betreft een artikel van het wetsontwerp dat niet aan de Raad van State is voorgelegd en dat in het ontwerp is "gesukkeld". Tevens gaat het om de invoering van een nieuw artikel 36 dat duidt wat ik zou noemen de vicieuze cirkel die optreedt als men de tekst van de wet zo laat, ook met betrekking tot hetgeen voor de Europese Commissie dienaangaande moest gebeuren. Wij wensen ons begrip van het desbetreffende artikel en de cirkelredenering die in het wetsontwerp zit voorgelegd te zien aan de Raad van State voor advies.

De enige methode om paars-groen de komende uren en dagen in stand te houden, is blijkbaar verschillende dossiers te linken. De Francorchamps-wet zal niet goedgekeurd worden, maar de collega's uit het Luikse zullen kunnen zeggen dat al hebben zij Francorchamps niet binnengehaald — en Francorchamps zou trouwens enkel tijdelijk gered zijn -, zij toch inzake FN-Herstal een knieval hebben verkregen van de groene fractie, Ecolo-Agalev, en van collega Van der Maelen.

Een eerste belangrijke kritiek is dat men voor dat ontwerp dat door een meerderheid wellicht zal worden goedgekeurd — jammer genoeg voor u niet vandaag, collega's van de groene fractie, maar een van de volgende dagen of weken — hier het roer gaat omgooien in de richting van hergebruik. Daardoor zal men de drankensector in ons land volledig voor schut zetten.
Collega's, de wet van 16 juli 1993 voorzag in een vrijstelling van de milieutaks voor niet herbruikbare verpakkingen, voor zover aan twee voorwaarden voldaan was. De eerste voorwaarde was: een oplopend percentage van het hergebruik, verschillend naar gelang van het soort drank, te realiseren op het totaalvolume van drank dat men op de markt brengt. Dat was de eerste voorwaarde.
De tweede voorwaarde is de realisatie van een recyclagepercentage voor de niet-herbruikbare verpakkingen die op de markt verschijnen. Het gaat om een afzonderlijk percentage naar gelang van de verpakking, glas, plastic, metaal of karton, maar er werd geen definitief percentage recycled contents naar voren geschoven. Het bewijs hiervan kon worden geleverd via de aansluiting bij een door de Gewesten erkende organisatie die zelf globaal aan de voorwaarden zou voldoen.
De wet van 7 maart 1996 heeft de wet van 6 juli 1993 aangepast en voorzag in artikel 373 in een paragraaf 4, die in de feiten de paragrafen 1 en 2 van het bedoelde artikel zoals daarnet geschetst, weerlegde. Via de wet van 7 maart 1996 werd de vrijstelling van ecotaks voor hergebruikbare verpakkingen ingevoerd onder dezelfde voorwaarden als voordien en voor de andere verpakkingen, onder meer de eenmalige plastic flesverpakkingen, indien voor de verschillende verpakkingsmaterialen in de tijd toenemende recyclagedoelstellingen — die werden tot 2000 vastgelegd — zouden worden behaald. De realisatie van oplopende hergebruikpercentages ten opzichte van het totale volume aan dranken dat op de markt wordt aangeboden, was dus sedert de wet van 1996 niet langer noodzakelijk.
Door deze wetswijziging — en ik kom thans tot het eerste punt van kritiek ten opzichte van de industrie of ten aanzien van de verbruiker — komt de nadruk veel meer te liggen op recyclage in plaats van op hergebruik. Nochtans, via FOST Plus, dat in 1994 werd opgericht, werden op het vlak van drankverpakking recyclageresultaten behaald waarmee België zich situeerde bij de koplopers in de Europese Unie en zelfs op wereldvlak. Vorige week nog lazen wij in de pers dat ons land — dus de consumerende bevolking — met 92% recyclagepercentage tot de wereldtop behoort.
Hoewel daardoor het aandeel van het verpakkingsafval van dranken dat niet wordt gerecycleerd, nu nog slechts 1% vertegenwoordigt van het huishoudelijk afval dat naar finale verwijdering gaat, zijn het de drankverpakkingen die worden getroffen door de ecotaks.
Hoewel ons land wereldrecordhouder is inzake recyclage na gedurende zeven of acht jaar hiervoor inspanningen te hebben geleverd, na sensibilisatie, informatie en organisatie van de selectieve ophaling waardoor uiteindelijk slechts 1% restafval is bestemd voor finale verwijdering, wordt dat systeem op de helling gezet.
Doordat de drankverpakkingen 2/3 de vertegenwoordigen van de stroom aan glas en PMD spelen zij uiteraard een locomotieffunctie in het geheel van de recyclage-inspanningen. Het zwaarder taxeren van eenmalige drankverpakkingen bedreigt meteen de collectieve inzameling, de sensibilisatie en de gedragswijziging op dat vlak en de selectieve inzameling via glascontainers en PMD-zakken.
Volgens ons is de vrijstelling volgens de recycled contents niet te verkiezen boven de vrijstelling op basis van behaalde recyclagepercentages, omdat het minder gemakkelijk meetbaar en controleerbaar is. Bovendien leidt de recycled contents tot een discriminatie. Luidens een ontwerptekst van de Europese Raad dreigt het voor drankkartons immers verboden te worden om gerecycleerde vezels van papier en karton afkomstig van huishoudens, te gebruiken, zodat die verpakkingen per definitie bij gebruik van dat soort materiaal, worden veroordeeld tot verpakkingschepping zonder dat er een ontwijking kan zijn, zonder dat er een gedragsbeïnvloeding kan zijn die leidt tot positieve resultaten inzake leefmilieu.
Het hergebruik van hernieuwbare grondstoffen en het hoger recyclagepercentage met herverwerking in andere verpakkingen en verpakkingssystemen wordt zonder meer over het hoofd gezien. Trouwens, ook de producenten van bronwater en van dranken met een oorsprongsbenaming worden gediscrimineerd. Voor alle duidelijkheid: hun discriminatie berust in het feit dat zij niet onverpakt of verpakt tot vlakbij de grens mogen worden vervoerd om ze aldaar in hergebruikbare verpakkingen te verpakken. Dat betekent dat de herbruikbare verpakkingen moeten worden gerepatrieerd, hetgeen economisch niet haalbaar is. In dat verband verwijs ik onder meer naar de vraag — het bezwaar eigenlijk — dat bij de Europese Commissie werd ingediend door een Mexicaanse brouwerij. Immers volgens de letter van de ecotakswet die thans wordt besproken en waarover zal worden gestemd, zal die de flesjes met het Mexicaanse Coronabier, opnieuw moeten exporteren naar Mexico om ze daar opnieuw te vullen. Op economisch vlak is zulks uiteraard onzinnig en onhaalbaar.
Het gevolg is dat men aangewezen is op verpakkingen die niet herbruikbaar zijn. Men heeft dus haast geen mogelijkheid om de verpakkingsheffing te ontlopen, temeer daar het in een aantal Europese landen — onder andere in Frankrijk en België — verboden is om bij het voor PET-flessen bedoeld mineraal en bronwater gerecycleerd materiaal te gebruiken.
Dit is onze eerste belangrijke kritiek. De invoering van de ecotakswet zet heel het FOST Plus-systeem op de helling. Heel de sensibiliseringsoefening — de informatieoefening die de laatste jaren is gebeurd — tot en met de gedragswijziging bij de Belgische burger wordt op de helling gezet en confronteert heel de economische sector van de recyclage met een nieuw probleem. Heel wat investeringen uit het verleden worden trouwens gewoon aan de kant geveegd.
Ik kom tot onze tweede fundamentele kritiek. Wij hebben erover gesproken in de commissievergadering. Men verkiest op dogmatische wijze het promoten van herbruikbare verpakkingen, vermits noch in de hoorzittingen, noch tijdens de commissiebesprekingen op objectieve, wetenschappelijke basis een analyse naar voren is gebracht waaruit blijkt dat de levenscyclus van een herbruikbare verpakking op macro-economisch en macroecologisch vlak voordeliger zou zijn dan die van een nietherbruikbare drankverpakking.
Wij hebben voor onze argumentatie geput uit documenten van de Bond Beter Leefmilieu. In brochures van de Bond Beter Leefmilieu — onder andere de brochure "Retour of wegwerp" — zijn een aantal levenscyclusanalyses opgenomen waaruit men eigenlijk geen eenduidige conclusie kan trekken. Ik citeer een conclusie van een studie door OVAM in 1994: "De studie besluit geen argumenten te kunnen aanleveren om voor een van de drie alternatieve verpakkingswijzen te kiezen." In de conclusie van een Zwitserse studie van 1993 — waarnaar wordt verwezen in de brochure van de Bond Beter Leefmilieu — lees ik het volgende, en ik citeer: "Voor cola, limonade en water vormt de hervulbare PET-fles de beste keuze. De uitkomst van de hervulbare glazen fles ten opzichte van de eenmalige PET-fles is afhankelijk van het recyclagepercentage van de eenmalige PET-fles." De conclusie van een Finse studie uit 1995 — waarnaar wordt verwezen in de brochure van de BBL en waarin eenmalige glazen flessen met andere verpakkingen worden vergeleken — stelt het volgende. Ik citeer: "De auteurs kunnen op basis van de studie geen duidelijke voorkeur geven aan één van de onderzochte verpakkingssystemen." Ik citeer de conclusie van een Belgische studie uit 1997, met ook een vergelijking van de levenscyclus van verschillende verpakkingsmaterialen: "In alle gevallen zijn de verschillen tussen de verpakkingsopties relatief gering zodat een substantiële verbetering van de milieukwaliteit niet kan bereikt worden door van het ene naar het andere systeem over te schakelen."
Ik citeer uit de conclusie van een Duitse studie uit 1999: "Het eenduidig en voor alle criteria naar voren schuiven van een verpakkingssysteem voor verse melk, retour dan wel eenmalig, laat zich op het vlak van de aparte werkcategorieën uit de voorliggende resultaten niet afleiden". Ten slotte is er de conclusie van een Duitse studie waarnaar ook verwezen wordt in de brochure van de Bond Beter Leefmilieu, de zogenaamde UBA2-studie. Ik citeer: "De gebruikte onderzoekmethode duidt geen significante milieuvoordelen, noch nadelen aan voor zowel de bestaande hervulbare glasverpakkingssystemen als de drankkartons, en dit voor mineraalwater, enzovoort". Dit is trouwens een citaat uit een persconferentie van de Duitse groene minister voor Leefmilieu op 9 augustus 2000. De tweede fundamentele kritiek is dus dat men zonder betrouwbare wetenschappelijke onderbouw op een dogmatische wijze, en zonder veel argumenten overigens, kiest voor het bevoordelen van de hergebruikbare verpakking, hoewel uit geen enkele levenscyclusanalyse op te maken is dat dit op macroeconomisch en macro-ecologisch vlak de voordeligste optie zou zijn.
Een volgende element van kritiek is het feit dat de consument geen vragende partij is, en uit een studie blijkt dat hij zijn gedrag niet zal wijzigen. Uit die studie van de heer Patteson, die werd uitgevoerd in opdracht van FEVIA en FEDIS in februari en maart 2001, blijkt dat glazen flessen door 2/3 van de gezinnen onbetwistbaar als gevaarlijk worden beschouwd, onder meer wanneer het erop aan komt om drank mee te geven met kinderen naar school of drank mee te nemen naar het werk. Een gevulde glazen colafles weegt 2 kilogram per liter, een gevulde plasticfles 1 kilogram per liter. De consument ervaart dit als een nadeel voor de hergebruikbare verpakking. Consumenten denken vandaag dat een doeltreffend systeem voor het beheer van drankverpakkingen werd ingevoerd en dat zij aan hun behoeften kunnen voldoen in de wetenschap dat er "achter hen iemand zorg draagt voor de dingen", zodat de gevolgen voor het leefmilieu beperkt blijven.
Een volgend element uit de studie is het feit dat 75,3% denkt dat het niet van realiteitszin getuigt dat men hergebruikbaar glas wil opleggen, 64% staat negatief tegenover een belastingverschil tussen recycleerbaar plastic en hergebruikbaar glas voor dranken, 85% begrijpt de ecologische grondslag van het plan niet, 74,7% van de kopers van plasticflessen zal luidens die studie, mijnheer de minister, deze flessen blijven aankopen.
Dit is de onbetwistbare onderbouw van onze derde stelling, namelijk dat de consumenten niet rijp zijn voor deze complete beleidswijziging ten aanzien van de drankverpakkingen en niet van plan zijn om de eventuele stimuli die worden aangereikt aan een gedragswijziging te koppelen.
Een vierde belangrijke kritiek is dat het wetsontwerp ook budgettair geconditioneerd is, en dus niet enkel milieudoelstellingen nastreeft, maar ook budgettaire doelstellingen. In een eerste versie van het wetsontwerp werd voorzien in een verpakkingheffing die verschilde naargelang het soort drank, en daar was veel voor te zeggen omdat de beoogde gedragsbeïnvloeding naar doeltreffendheid aangepast moet kunnen worden naargelang het soort drank. Zowel de Europese Commissie als de Raad van State hebben erop gewezen dat dit onverenigbaar zou zijn met de milieudoelstelling die het ontwerp zogezegd heeft. De Europese Commissie wees er zelfs op dat de keuze van het tarief veeleer leek te berusten op budgettaire beschouwingen dan op milieuoverwegingen.
Men herzag dan ook de hele logica en voorziet nu in één tarief inzake verpakkingsheffing. Het is dus onduidelijk, wanneer men dan toch oppert dat ecologische doelstellingen primordiaal zouden zijn, waarom er geen onderscheid wordt gemaakt tussen de verschillende soorten verpakkingen. Nochtans is het duidelijk dat een blik een andere impact heeft dan een niet-hergebruikbare glazen fles. Het zou dan ook logisch zijn dat men het tarief van de Reynders-belasting zou aanpassen naargelang het materiaal waaruit de verpakking is vervaardigd.
De invoering van een verpakkingsheffing op niet-herbruikbare verpakkingen heeft alleen tot doel de budgettaire impact van de BTW- en accijnzenverlaging te counteren. Budgettair gezien is de Reynders-belasting alleen bedoeld om de minderinkomsten omwille van de verlaging van de BTW en de accijnzen op te vangen. De milieudoelstelling is — dit staat ook in de memorie van toelichting waarop ik straks terugkom — ondergeschikt aan de doelstelling van de budgettaire neutraliteit. Mijnheer de voorzitter, ik open een voetnoot. Dat is de reden waarom we op de tekstbepaling met betrekking tot de budgettaire neutraliteit heel uitdrukkelijk rechtszekerheid wensen en het advies van de Raad van State hebben ingewonnen. Feit is dat de milieudoelstelling ondergeschikt is aan de budgettaire doelstelling inzake budgettaire neutraliteit. In de commentaar bij de artikelen heeft de minister dat zonder veel schroom vermeld. Ik citeer zijn passage met betrekking tot de eventuele impact van de vrijstelling voor recycled contents — het bedrag waar het aandeel herleid is tot 50%-: "De invoering van die afwijkende regeling mag geen negatieve invloed hebben op de openbare financiën. De bedragen en tarieven van de accijnzen, de BTW en de verpakkingsheffing moeten worden aangepast op het ogenblik van de invulling van de voorwaarden voor de vrijstelling". Dit betekent dat in de mate dat de vrijstellingsvoorwaarde wordt ingevuld de Reynders-belasting inzake hoogte zal worden aangepast aan de budgettaire impact van de verlaging van BTW en accijnzen wegens het bereiken van de voorwaarden inzake recycled contents. Er zal met de Reynders-belasting soepel worden omgesprongen. Rekening houdend met de reputatie van de minister en eenmaal het ontwerp is goedgekeurd mag men zich aan een stijging van die Reynders-belasting verwachten om op die manier de budgettaire impact van de verlaging van BTW en accijnzen op te vangen.
Artikel 35 van het ontwerp laat toe bij koninklijk besluit de tarieven van BTW, accijnzen en verpakkingsheffing te herzien als de minister naar aanleiding van de jaarlijkse evaluatie vaststelt dat het ingevoerde systeem een negatieve invloed heeft op de begroting. Dat staat met zoveel woorden in de Memorie van Toelichting. De minister mag mij eens uitleggen hoe hij zijn tariefbeslissing gaat nemen onafhankelijk van de gedragswijziging van de consument die nochtans de bepalende factor is voor de budgettaire impact. Het bedrijfsleven vraagt zich nu reeds terecht af welke rechtszekerheid men uiteindelijk heeft als dit soort procedures inzake aanpassing van tarieven, accijnzen en BTW die fundamenteel zijn met betrekking tot de concurrentiepositie en de economische levenskracht, worden toegepast.
Ik heb een vijfde element van kritiek. De voorgestelde regeling in het wetsontwerp heeft een uitgesproken asociaal karakter. Uit consumentenonderzoek blijkt dat vooral oudere mensen, kroostrijke gezinnen, alleenstaanden en de lagere inkomensklassen — groepen waaraan de promotoren van dit ontwerp en vooral de groene fractie blijkbaar geen aandacht schenken — een beroep doen op eenmalige verpakkingen om hun drank in te slaan. 80% van de gezinnen deelt ons standpunt en vindt dat de verschillende heffingen tussen plastic verpakking en herbruikbaar glas een asociale maatregel is die de minst welstellende gezinnen, gezinnen met kinderen en bejaarden straft. Deze verpakkingen worden door de Reynders-belasting niet alleen duurder. De perversiteit van de ecotaksen en ecoboni maakt dat de impact van de Reynders-belasting — houd u vast — zwaarder weegt naarmate het product goedkoper is.
Want, inderdaad, uit studie blijkt dat een goedkoop merk water in een recipiënt voor eenmalig gebruik een prijsstijging zal kennen van maar liefst 26,9%. Dus 27% stijging voor een goedkoop merk water, een wit product water, een recipiënt voor eenmalig gebruik, terwijl een merkproduct van hogere prijsklasse slechts een prijsstijging zal kennen van 1,9%. Met andere woorden, met toepassing van de Reynders-belasting op de verschillende merken, de verschillende recipiënten of, in casu, op de eenmalige verpakking, stellen wij vast dat een duurder merk een prijsstijging kent die een veertiende bedraagt van de prijsstijging van een goedkoop merk. Als asociale maatregel, als omgekeerde herverdeling — en het gaat hier over dagelijkse consumptie, over een dagelijks gebruikt product — kan dat toch wel tellen.
73,5% van de gezinnen vindt dat het bovendien niet van werkelijkheidszin getuigt om herbruikbaar glas op te leggen als drankverpakking. Men ervaart het als een straf omdat reeds — ik heb daarnaar al verwezen in het begin van mijn betoog — de afgelopen tien jaar, onder impuls van de beslissingen in 1993, toch heel wat inspanningen werden geleverd om recyclage te integreren in het dagdagelijks leven van de consument. Het is voor de modale Belg, voor de modale landgenoot, bijna een gewetenskwestie geworden. Wanneer men in de garage of in de bergplaats zijn afval gaat sorteren en het zou aandurven om een recipiënt van water, bijvoorbeeld een niet-hergebruikbare verpakking, niet in het juiste recipiënt te deponeren, in casu de blauwe zak, dan ontstaat er bij de Vlaming of de Belg bijna een gewetenskwestie. Welnu, het succes en het resultaat van die sensibilisering zal u op de helling plaatsen, naast het feit dat het gaat om een heel asociale maatregel.
Mijn zesde element van kritiek ten gronde ten aanzien van het ontwerp dat voorligt, is uiteraard het volgende. Het wetsvoorstel dat ik samen met Stefaan De Clerck, Dirk Pieters en een aantal andere collega's had ingediend, had precies tot doel om de discriminatie ten aanzien van die groep mensen voor een stukje recht te trekken, maar ik stel vast dat met de invoering van de Reynders-belasting de concurrentiepositie van de grenshandel, van de winkeliers, van de zelfstandige ondernemers in de grensregio, die duizenden winkeliers en zelfstandige ondernemers, nog nadelig zal worden beïnvloed. Dat staat met zoveel woorden ook te lezen in de memorie van toelichting bij het wetsvoorstel dat ter bespreking bij dit wetsontwerp is gevoegd: de grenshandel, onder meer die met Frankrijk in Zuid-WestVlaanderen, langs de hele grensstreek en de koopvlucht vanuit onze grensgebieden naar onder andere Frankrijk, ontstaat doordat de fiscale heffing op dranken in het algemeen en waters en frisdranken in het bijzonder in België veel hoger uitvalt dan in onze buurlanden. Ik wil toegeven dat dit historisch is gegroeid. Daaraan is in het verleden te weinig gewerkt. Waarom? Onder meer wegens van het feit dat de budgettaire sanering moest voorgaan. In elk geval, vandaag bedraagt de fiscale heffing op de gemiddelde winkelprijs van mineraalwater in België 49,7%, dus 49,7% fiscale heffing op de gemiddelde winkelprijs van mineraalwater, dure merken en goedkope merken door elkaar. In Frankrijk is dat niet 49,7% maar 7,7%. Het gevolg is natuurlijk dat de consument in België voor een doorsnee zogenaamd 6-pack-pet-one-way, de verpakking per 6 flessen die het meest gebruikt wordt, ongeveer 49% meer betaalt dan in buurland Frankrijk. Uiteraard heeft de invoering van de euro terzake gezorgd voor een nog grotere prijstransparantie, zodat het verschil nog meer in de verf wordt gezet. Om het dan in euro uit te drukken: in België kost voornoemde 6-pack-pet-one-way mineraalwater in flessen van anderhalve liter 3,33 euro, terwijl dat in Frankrijk 2,40 euro is. Een gevolg daarvan is de koopvlucht, is het feit dat veel Belgen hun waters en frisdranken in grootwarenhuizen net over de grens gaan aankopen en waarbij men als consument, aangetrokken door die lagere prijzen, niet aarzelt om gemiddeld tot 70 km heen en terug af te leggen omdat men weet dat de brandstof en de vervoerskosten die men bijkomend heeft meer dan opgevangen worden door alleen de lagere prijs van het water, van de drank, die men in Noord-Frankrijk aankoopt.
Dit is al erg op zichzelf, maar de problemen betreffen niet alleen het water. Het water vervult als het ware een locomotieffunctie. Wanneer mensen hun water bij Auchan of in andere warenhuizen over de grens gaan kopen, kijken zij bij die gelegenheid ook eens rond, zoals het goede Belgen past. Terwijl zij water aan het kopen zijn, zien zij dit en dat product, voedingswaren, maar ook hifimateriaal en andere zaken. De mensen profiteren van het feit dat ze zich in die hypermarkten in Frankrijk bevinden om ook andere zaken te kopen. Het water fungeert als motor, als locomotief voor die grenshandel. De winkeliers en de ondernemingen, onder meer in Zuid-WestVlaanderen, zien met lede ogen aan hoe de Belgische consument vanuit Frankrijk terugkeert, zijn wagen volgestouwd met andere waren dan dranken. 59% van de grensoverschrijdende aankopen, collega's, mijnheer de voorzitter, mijnheer de minister, heeft onder meer betrekking op dranksoorten. In 95% van de gevallen waarin mensen vanuit ons land naar Frankrijk gaan om daar aankopen te doen, zit er ook drank in het mandje met aankopen.

Mr. Speaker, as a compensatory measure within the framework of the compromise concluded here, I will raise my own vote a little.
In any case – you can see that also because of the lack of attention of the colleagues – what stands out here is seen by the Greens as a big trophy of green government participation, in addition to the nonsensical decision on nuclear power plants. Well, that green achievement has actually become meaningless. Unfortunately, there is hardly any interest in all banks.
I would therefore very strongly, on behalf of my group, which has carefully studied the draft law — together with colleague Pieters I have very explicitly participated in the debate — present a six or seven fundamental criticisms of that draft law.
A first important criticism is that for that design that may be approved by a majority — unfortunately for you not today, colleagues of the Green group, but one of the next days or weeks — here the wheel is going to turn in the direction of reuse. This will completely destroy the drinking industry in our country.
Colleagues, the law of 16 July 1993 provided for an exemption from the environmental tax for non-reusable packaging, provided that two conditions were met. The first condition was to ⁇ an increasing percentage of reuse, varying depending on the type of beverage, on the total volume of beverage placed on the market. That was the first condition.
The second condition is the achievement of a recycling rate for the non-reusable packaging that appears on the market. It is a separate percentage depending on the packaging, glass, plastic, metal or cardboard, but no definitive percentage of recycled content was pushed forward. The proof of this could be provided by joining an organization recognised by the Regions that would itself globally meet the conditions.
The law of 7 March 1996 modified the law of 6 July 1993 and provided Article 373 in a paragraph 4, which, in fact, contradicted paragraphs 1 and 2 of that article as outlined below. By law of 7 March 1996, the exemption from ecotax was introduced for reusable packaging under the same conditions as before and for other packaging, including single-use plastic bottle packaging, if for the different packaging materials increasing recycling targets — which were set until 2000 — would be achieved over time. The realization of rising rates of reuse in relation to the total volume of beverages offered on the market was therefore no longer necessary since the Act of 1996.
This legislative change — and I am now coming to the first point of criticism towards the industry or towards the consumer — makes the emphasis much more on recycling rather than on reuse. Nevertheless, through FOST Plus, which was established in 1994, recycling results were achieved in the field of beverage packaging, which placed Belgium among the leaders in the European Union and even worldwide. Last week, we read in the press that our country — the consumer population — is among the world’s top with a 92% recycling rate.
Although the proportion of non-recycled beverage packaging waste now represents only 1% of household waste going to final disposal, it is the beverage packaging that is affected by the eco-tax.
Although our country is the world record holder in recycling after having worked for seven or eight years to do so, after awareness, information and organization of the selective collection that ultimately only 1% of residual waste is destined for final disposal, that system is put on the slope.
Because the beverage packaging represents 2/3 of the flow of glass and PMD, they play a locomotive function in the whole of the recycling efforts. The heavier taxation of single-use beverage packaging immediately threatens collective collection, awareness and behavioral change in that area and selective collection through glass containers and PMD bags.
In our view, the exemption based on the recycled content cannot be preferred over the exemption based on achieved recycling rates, as it is less easily measured and verified. Moreover, the recycled content leads to discrimination. In fact, according to a draft text of the European Council, the use of recycled paper and carton fibers from households could be prohibited for beverage cartons, so that those packaging, by definition, when using that kind of material, are condemned to packaging creation without evasion, without a behavioral influence that leads to positive environmental results.
The re-use of renewable raw materials and the higher recycling rate with re-processing in other packaging and packaging systems are undoubtedly overlooked. Furthermore, producers of source water and beverages with a designation of origin are also discriminated against. For the sake of clarity: their discrimination is based on the fact that they cannot be transported unpacked or packaged to close to the border to be packed there in reusable packaging. This means that the reusable packaging must be repatriated, which is not economically feasible. In that regard, I refer, inter alia, to the question — the objection in fact — submitted to the European Commission by a Mexican brewery. After all, according to the letter of the eco-tax law that is currently being discussed and which will be voted on, it will have to re-export the bottles with the Mexican Coronabier, to Mexico to re-fill them there. From an economic point of view, this is unreasonable and impossible.
The result is that one is appropriate for packaging that is not reusable. Therefore, it is almost impossible to avoid the packaging tax, especially since in a number of European countries — including France and Belgium — the use of recycled material for PET bottles and source water is prohibited.
This is our first major criticism. The introduction of the Ecotax Act puts the entire FOST Plus system on the slope. The whole awareness exercise — the information exercise that has taken place in recent years — to the change in behavior of the Belgian citizen is put on the slope and confronts the whole economic sector of recycling with a new problem. A lot of investments from the past are simply wiped aside.
I come to our second fundamental criticism. We discussed this at the committee meeting. It is dogmatically preferred to promote reusable packaging, since neither in the hearings nor during the committee discussions, on an objective, scientific basis, an analysis has been presented showing that the life cycle of a reusable packaging would be more advantageous on a macroeconomic and macroecological level than that of a non-usable beverage packaging.
We have drawn for our argument from documents of the Bond Beter Leefmilieu. Brochures of the Bond Beter Leefmilieu — including the brochure "Retour of disposal" — have included a number of life cycle analyses from which one can actually draw no unambiguous conclusion. I quote a conclusion from a 1994 study by OVAM: “The study decides that there is no reason to choose one of the three alternative packaging methods.” In the conclusion of a 1993 Swiss study — referred to in the Bond Better Living Environment brochure — I read the following, and I quote: “For cola, limonade and water, the refuelable PET bottle is the best choice. The result of the refuelable glass bottle compared to the single-use PET bottle depends on the recycling rate of the single-use PET bottle." The conclusion of a 1995 Finnish study — referred to in the BBL brochure and comparing single-use glass bottles with other packaging — states the following. I cite the conclusion of a Belgian study from 1997, including a comparison of the life cycle of different packaging materials: "In all cases, the differences between the packaging options are relatively small so that a substantial improvement in the quality of the environment cannot be achieved by switching from one system to another."
I quote from the conclusion of a German study from 1999: “The unambiguous and for all criteria forward-shifting of a packaging system for fresh milk, either returned or one-time, cannot be deduced from the above-mentioned results in terms of the separate work categories.” Finally, there is the conclusion of a German study which is also referred to in the brochure of the Bond Beter Leefmilieu, the so-called UBA2 study. I quote: “The research method used does not indicate significant environmental benefits or disadvantages for both existing refuelable glass packaging systems and the beverage cartons, and this for mineral water, and so on.” This is, by the way, a quote from a press conference of the German Green Minister for the Environment on 9 August 2000. The second fundamental criticism is, therefore, that without reliable scientific support, one chooses to favour the reusable packaging in a dogmatic manner, and without many arguments at the same time, although no life cycle analysis can prove that this would be the most advantageous option on a macroeconomic and macroecological level.
Another element of criticism is the fact that the consumer is not the requesting party, and a study shows that he will not change his behavior. That study by Mr. Patteson, which was conducted on behalf of FEVIA and FEDIS in February and March 2001, shows that glass bottles are undoubtedly considered dangerous by two-thirds of families, including when it comes to bringing drinks with children to school or bringing drinks to work. A filled glass cola bottle weighs 2 kilograms per liter, a filled plastic bottle weighs 1 kilogram per liter. The consumer perceives this as a disadvantage to the reusable packaging. Consumers today think that an effective system for the management of beverage packaging has been introduced and that they can meet their needs in the knowledge that “there is someone behind them who takes care of things” so that the impact on the environment remains limited.
A further element of the study is the fact that 75.3% think that it does not show in the sense of reality that one wants to impose reusable glass, 64% is negative to a tax difference between recyclable plastic and reusable glass for beverages, 85% does not understand the ecological basis of the plan, 74.7% of the buyers of plastic bottles will continue to buy these bottles.
This is the undisputed basis of our third statement, namely that consumers are not mature for this complete policy change with regard to beverage packaging and do not intend to link any incentives provided to a change in behavior.
A fourth important criticism is that the bill is also budgetarily conditioned, and therefore not only pursues environmental objectives, but also budgetary objectives. An initial version of the draft law provided for a packaging tax that varied depending on the type of beverage, and there was much to say about it because the intended behavioral influence must be able to be adjusted for effectiveness depending on the type of beverage. Both the European Commission and the Council of State have pointed out that this would be incompatible with the environmental objective so-called in the draft. The European Commission even pointed out that the choice of the rate appeared to be based on budgetary considerations rather than environmental considerations.
It therefore revised the whole logic and now provides for a single tariff on packaging tax. Therefore, it is unclear, if one still points out that environmental objectives would be primary, why there is no distinction between the different types of packaging. However, it is clear that a glimpse has a different impact than a non-reusable glass bottle. It would therefore be logical that the rate of the Reynders tax would be adjusted according to the material from which the packaging is manufactured.
The introduction of a packaging tax on non-reusable packaging is only intended to counter the budgetary impact of the VAT and excise duty reductions. Budgetarily, the Reynders tax is intended solely to collect the minor income for the sake of the reduction of VAT and the excise duties. The environmental objective — which is also stated in the memorandum of explanation to which I will return later — is subordinate to the objective of budgetary neutrality. Mr. Speaker, I am opening a footnote. That is why we have very explicitly requested legal certainty in the text clause concerning budgetary neutrality and have obtained the opinion of the State Council. In fact, the environmental objective is subordinate to the budgetary objective of budgetary neutrality. In the commentary to the articles, the Minister mentioned this without much scorn. I quote his passage regarding the possible impact of the exemption for recycled content — the amount at which the share has been reduced to 50%-: "The introduction of that derogatory scheme should not have a negative impact on public finances. The amounts and rates of the excise duties, the VAT and the packaging tax shall be adjusted at the time when the conditions for the exemption are met.” This means that to the extent that the exemption condition is fulfilled, the Reynders amount tax will be adjusted to the budgetary impact of the reduction of VAT and excise duties due to the achievement of the conditions for recycled content. The Reynders tax will be reversed smoothly. Taking into account the reputation of the Minister and once the draft has been approved, it can be expected to increase that Reynders tax in order thus to capture the budgetary impact of the reduction of VAT and excise duties.
Article 35 of the draft allows, by royal decree, to revise the rates of VAT, excise duties and packaging tax if the Minister, following the annual review, finds that the system introduced has a negative impact on the budget. That is stated with so many words in the Memory of Explanation. The Minister may explain to me how he will make his tariff decision independently of the change in consumer behavior which, however, is the determining factor for the budgetary impact. The industry is already rightly wondering what legal certainty is ultimately achieved when these types of procedures for the adjustment of tariffs, excise duties and VAT, which are fundamental to the competitive position and economic vitality, are applied.
I have a fifth element of criticism. The proposed regulation in the draft law has a pronounced associative character. Consumer surveys show that especially older people, poor families, single persons and the lower income classes — groups to which the promoters of this design and especially the Greens seem to not pay attention — rely on single-use packaging to store their beverages. 80% of families share our view and believe that the different taxes between plastic packaging and reusable glass are an associal measure that punishes the least prosperous families, families with children and the elderly. These packaging are not only more expensive due to the Reynders tax. The perversity of the ecotax and ecoboni makes the impact of the Reynders tax — hold hold — weigh more heavily as the product becomes cheaper.
Indeed, a study shows that a cheap brand of water in a single-use container will experience a price increase of as much as 26.9%. So 27% increase for a cheap brand water, a white product water, a single-use container, while a brand product of higher price class will only experience a price increase of 1.9%. In other words, by applying the Reynders tax to the different brands, the different containers or, in the present case, to the single packaging, we find that a more expensive trade mark has a price increase equal to a fourteenth of the price increase of a cheap trade mark. As an associal measure, as a reverse redistribution — and this is a matter of daily consumption, of a product used daily — this can count.
Moreover, 73.5% of households consider that it is not realistic to impose reusable glass as drink packaging. It is perceived as a punishment because, as I have already mentioned at the beginning of my speech, in the last ten years, under the impetus of the decisions of 1993, a lot of effort has been made to integrate recycling into the daily life of the consumer. For the modal Belgian, for the modal compatriot, it has almost become a matter of conscience. When one is going to sort his waste in the garage or in the mountain town and it would dare not to deposit a recipient of water, for example a non-reusable packaging, in the right recipient, in this case the blue bag, then the Flaming or the Belgian almost a question of conscience arises. Well, the success and the outcome of that sensitization will put you on the slope, in addition to the fact that it is a very associal measure.
My sixth element of fundamental criticism of the draft that precedes is, of course, the following. The bill, which I had submitted together with Stefaan De Clerck, Dirk Pieters and a number of other colleagues, was precisely intended to remove discrimination against that group of people, but I note that with the introduction of the Reynders tax the competitive position of the border trade, of the merchants, of the self-employed entrepreneurs in the border region, which thousands of merchants and self-employed entrepreneurs, will still be adversely affected. The border trade, including that with France in South-West Flanders, along the entire border region and the purchase flight from our border areas to, among other things, France, is due to the fact that the tax on drinks in general and water and soda drinks in particular in Belgium is much higher than in our neighboring countries. I want to admit that this has grown historically. There has been little work done on this in the past. Why Why ? This was due to the fact that the budget restructuring had to be carried out. Ik hoop dat u de juiste zaken in de hand houdt, mijnheer de voorzitter. Collega Detremmerie heeft ons jammer genoeg moeten verlaten, maar in de hypermarkt van Moeskroen — Belgische zijde — bedraagt de wateromzet de helft van die in Gosselies en Brugge.
Ons wetsvoorstel had tot doel om via een verlaging van het BTW- en accijnstarief op minerale waters en frisdranken dat concurrentienadeel op te lossen. Het voorstel voorzag in een BTWverlaging tot 6% op waters, frisdranken en vruchten- en groentesappen. Daarnaast werd voor dezelfde dranksoorten een verlaging van de accijnzen voorgesteld. Ons inziens zou dit leiden tot terugverdieneffecten die de budgettaire impact ervan zou beperken.
De regering, collega's, wil nu de onrechtstreekse fiscaliteit op dranken in hergebruikbare verpakking afbouwen, maar dit laat enkel toe om eindelijk het niveau van de buurlanden te benaderen. De onrechtstreekse fiscaliteit op dranken in eenmalige verpakkingen zal worden opgedreven via de invoering van de Reynders-belasting, een verpakkingsheffing waardoor het concurrentienadeel niet wordt weggenomen, maar voor bepaalde verpakkingen zelfs wordt opgedreven.
Mijn voorlaatste element van kritiek, mijnheer de voorzitter, is dat de consument bij wege van de Reynders-belasting in feite drie keer zal worden belast, tegen het "non bis in idem"-principe in — of misschien beter "non ter in idem" of "non quater in idem". De consument wordt in ieder geval drie keer getroffen. Hij zal drie maal worden belast bij de aanschaf van een niet-hergebruikbare drankverpakking: eenmaal via de bijdrage bij de groenpuntregeling, eenmaal via de nieuwe Reynders-belasing, de verpakkingsheffing, en ten slotte ook eenmaal via de gemeentelijke of gewestelijke afvalstoffenheffing. Dit niettegenstaande — ik herhaal het — er helemaal geen wetenschappelijke consensus bestaat inzake het voordeligere milieuprofiel van een hergebruikbare verpakking op macroeconomisch vlak.
Vooral het transport van hergebruikbare glazen flessen is problematisch. Het transport van hergebruikbare flessen naar een onderneming die haar producten erin zal verpakken neemt 26 keer meer laadruimte in beslag in vergelijking met een situatie waarbij een onderneming PET-flessen aanwendt. Die PET-flessen kunnen uiteraard in kleine pre-forms worden geleverd, dit naast het feit dat uiteraard de hergebruikbare glazen flessen nog heel wat detergenten vereisen om uiteindelijk gezuiverd en hygiënisch verantwoord op de markt te worden gebracht. Mijnheer de voorzitter, het laatste punt zou de collega's van de VLD toch ter harte moeten gaan, al is dat niet zo. Zij hebben de oproepen van onder meer Unizo immers gewoon naast zich neergelegd, terwijl dit toch een punt van aandacht is. Ten slotte, mijnheer de voorzitter, wordt de kleinhandelszaak door dit wetsontwerp zeer uitdrukkelijk benadeeld, vermits kleinhandelszaken, winkels, gemiddeld over minder stockeringsruimte beschikken om hergebruikbare flessen op te slaan, hoewel daar heel wat meer nood aan zal zijn. Daar zal heel wat meer ruimte voor moeten worden gevonden, maar de modale zelfstandige winkelier heeft die ruimte niet.
Het is ook moeilijker voor betrokkenen om in die ruimte te voorzien. Dat betekent dus dat de kleine zelfstandigen en de kleinhandelszaak door dit wetsontwerp worden gediscrimineerd. Ook de KMO's, de modale kleine brouwer, de modale kleine bottelaar in ons land worden trouwens gediscrimineerd. Er zijn zo nog tientallen bedrijven. De financiële draagkracht van een KMO om te investeren in een tweede verpakkingslijn is veel geringer dan bij grotere bedrijven. Dit zal dus ook nadelig zijn voor deze KMO's. Indien men doorgaat met dit wetsontwerp waartegen wij zullen stemmen, zouden wij willen oproepen om — eventueel als overgangsmaatregel — te voorzien in fiscale maatregelen om de nadelige positie van de winkeliers en de KMO's wat op te vangen.
Samengevat besluit ik dat wij tegen het ontwerp zullen stemmen. Wat men hier doet, is acht tot tien jaar sensibiliseringswerk teniet doen. Het sensibiliseringswerk heeft nochtans resultaten opgeleverd. Ons land, onze consumenten, onze mensen, onze landgenoten zijn immers koplopers inzake recyclage en sorteren van afval. 92% van het recycleerbaar materiaal wordt daadwerkelijk selectief opgehaald en gerecycleerd. De industrie wordt met nieuwe problemen geconfronteerd. De grenshandel wordt niet weggewerkt. De concurrentiepositie van onze winkels in de grensregio wordt niet versterkt. Er is geen enkel wetenschappelijk argument om te kiezen voor hergebruikbare verpakkingen ten nadele van niethergebruikbare verpakkingen. De consument zal niet ingaan op de stimuli die hem worden aangereikt.
Ten slotte, dit is een asociale maatregel. De lagere inkomenscategorieën zullen immers bij uitstek meer bijdragen. Vooral inkomenscategorieën en mensen die het wat moeilijker hebben inzake mobiliteit zullen wat meer lijden onder de maatregelen die men hier in de praktijk voorstelt.

In summary, I decide that we will vote against the draft. What is being done here is destroying eight to ten years of awareness-raising work. However, the awareness-raising work has yielded results. After all, our country, our consumers, our people, our compatriots are leaders in recycling and sorting waste. 92% of the recyclable material is actually selectively collected and recycled. The industry is facing new challenges. Border trade is not eliminated. The competitive position of our stores in the border region is not strengthened. There is no scientific argument for choosing reusable packaging at the detriment of non-reusable packaging. The consumer will not interfere with the incentives provided to him.
Finally, this is an associal measure. The lower income categories will contribute more. In particular, income categories and people who have somewhat more difficulties with mobility will suffer somewhat more from the measures proposed here in practice.

Monsieur le président, monsieur le ministre, chers collègues, je vous dirai d'emblée que nous appuierons le projet qui introduit les écobonis. Il faut, en effet, se rappeler d'où l'on vient pour apprécier en quoi le présent projet représente un progrès considérable. Le point de départ était la loi, qualifiée par certains de calamiteuse, qui fut votée le 18 juillet 1993 par une autre majorité. Cette loi, fort heureusement, ne fut jamais mise en oeuvre tant elle était, osons le mot, imbuvable.
Je concède que ceux qui, dans un moment d'égarement, ont voté cette loi qui consistait, rappelons-le, à appliquer indistinctement une écotaxe de 15 francs belges sur tous les emballages de boissons non réutilisables, je concède que ceux-là se sont rapidement rendu compte de leur erreur. D'où notamment la correction de la loi de mars 1996 dont a parlé M. Leterme tout à l'heure. Il n'empêche que c'est le 1 er janvier 2001 que les 15 francs belges par emballage auraient été appliqués si une proposition d'initiative libérale, à laquelle le parlement s'est très largement et massivement rallié — la loi Coveliers —, n'avait in extremis prorogé l'exonération transitoire de l'écotaxe, dans l'attente d'une nouvelle législation plus cohérente.
Cette législation plus cohérente est le projet qui nous est soumis. D'abord, c'est évidemment l'introduction d'un incitant, et non plus d'une pénalité, adressé aux consommateurs et aux intervenants économiques qui constituent l'innovation la plus heureuse de ce dispositif légal.
L'introduction d'écobonis, c'est-à-dire d'une diminution sensible des taxes frappant les boissons, tant les accises que la TVA, constitue la mise en oeuvre d'une très ancienne revendication des secteurs concernés. Elle est ici rencontrée pour la première fois par une suppression des accises et une diminution de 21% à 6% de la TVA sur les boissons non alcoolisées et par une diminution des accises sur les boissons alcoolisées. A titre d'exemple, l'effet de cette réduction de la fiscalité sur le prix d'achat d'un litre d'eau minérale sera de l'ordre de 25%, c'est une mesure appréciable.
Ensuite, l'opposition entre l'emballage réutilisable et l'emballage recyclable prend fin. Ces emballages sont dorénavant mis sur un même pied puisqu'ils bénéficient d'un accès à la même réduction de la taxe. C'en est donc fini de la priorité, que nous avons toujours jugée arbitraire, du réutilisable sur le recyclable, à la condition que les emballages contiennent au moins 50% de matières recyclées. Ceci signifie également, indépendamment des problèmes pratiques, que je ne nie pas, que l'initiative est laissée au consommateur. Celuici aura le choix d'obtenir ou non le bénéfice de la réduction en achetant un produit bénéficiant entièrement de l'écoboni. Quant au producteur, il peut également choisir de produire le réutilisable ou le recyclable à plus de 50%.
Il est entendu que l'arrêté royal fixant le taux de 50% doit entrer en vigueur en même temps que la loi. C'est une promesse formelle qui nous a été faite par le représentant du gouvernement et qui conditionne bien évidemment notre soutien.
Je note enfin qu'une évaluation des effets de la loi aura lieu en septembre 2003. Ce sera l'occasion de réexaminer attentivement, à la lumière du principe de précaution, les performances écologiques et de santé publique du réutilisable et du recyclable. Un an d'expérience permettra également d'apprécier l'impact budgétaire de la loi, son effet tant sur les habitudes et le comportement du consommateur que sur les modes de production, mais aussi sur la concurrence.
Un dernier mot à propos précisément de concurrence: je reste assez septique par rapport à l'accueil que le projet rencontrera au niveau européen, mais cela est une autre histoire. Je vous remercie.

This more coherent legislation is the project that is submitted to us. First of all, it is obviously the introduction of an incentive, and not a penalty, addressed to consumers and economic stakeholders that constitute the happiest innovation of this legal device. by
The introduction of ecobonis, i.e. a significant reduction in the taxes on beverages, both excise taxes and VAT, constitutes the implementation of a very old claim of the sectors concerned. It is here encountered for the first time by the abolition of excise duties and a 21% to 6% reduction in VAT on non-alcoholic beverages and by a reduction in excise duties on alcoholic beverages. For example, the effect of this tax reduction on the purchase price of a liter of mineral water will be about 25%, which is a valuable measure.
Then, the opposition between reusable packaging and recyclable packaging ends. These packages are now placed on the same foot as they have access to the same tax reduction. This is the end of the priority, which we have always considered arbitrary, of the reusable over the recyclable, provided that the packaging contains at least 50% of recycled materials. This also means, regardless of practical problems, which I do not deny, that the initiative is left to the consumer. The latter will have the choice of obtaining or not the benefit of the discount by purchasing a product that benefits entirely from the ecoboni. Mijnheer de voorzitter, mijnheer de minister, waarde collega's, in de marge van de politieke ontwikkelingen van de laatste dagen — en ook deze van de laatste uren — moet het toch zonder twijfel voor iedereen duidelijk zijn dat het aanslepende dossier van de ecofiscaliteit één van de symbooldossiers is. Een symbooldossier waaruit de groeiende obsessie van blauw en groen naar voren komt om mekaar vooral geen politiek succesje meer te gunnen. Als we de historiek van de wetgeving op de ecotaks in ogenschouw nemen, kunnen we alleen maar vaststellen dat deze in de negen jaar dat ze bestaat — de eerste invoering dateert van 1993 — reeds aan haar achtste wijziging toe is. Uit het hele verhaal van dit voorliggende ontwerp blijkt overduidelijk dat de huidige kruising tussen ecotaksen en ecoboni het geheel niet eenvoudiger maakt. Integendeel, het systeem van BTW- en accijnsdalingen en —heffingen wordt steeds maar complexer. Anderzijds vragen wij ons af welke burger — en dit in het licht van de veel actuelere en veel belangrijkere maatschappelijke problemen die nu opdoemen — zit te wachten op het invoeren van een nieuwe belasting op de consumptie van basisvoedingsproducten zoals plat water. Dit gebeurt dan nog los van de discussie of de burger met deze wet zijn consumptiegedrag zal aanpassen.
Mijnheer de voorzitter, er zijn in dit ontwerp toch een aantal elementen die onze aandacht vragen. Een eerste element is het welbewuste artikel 11 waarin gesteld wordt dat de drankverpakkingen worden vrijgesteld van de verpakkingsheffing indien ze per soort van grondstof bestaan uit een minimumhoeveelheid gerecycleerde grondstoffen. Het percentage hiervan wordt bij ministerieel overleg en daarna bij een bij wet bekrachtigd koninklijk besluit vastgelegd. We kunnen hierover toch een aantal vragen stellen. Hoeveel moet deze minimumhoeveelheid bedragen? Is het 10%, 20%, 50% of 70%? Op basis waarvan zal het percentage vastgelegd worden? Welke drankverpakkingen kunnen deze norm halen? Wie gaat dit permanent controleren? Hoe gaat men dit controleren? Het is ongetwijfeld zo dat met dit artikel het paard van Troje in deze wet binnensluipt. Hiermee wordt de invoering van de verpakkingsheffingen volledig uitgehold. Ik zou er toch op willen wijzen dat op Europees niveau er geen enkele regelgeving bestaat voor het gebruik van gerecycleerd materiaal en meer specifiek voor het herincorporeren van gerecycleerd materiaal in plasticverpakkingen die in contact zijn met levensmiddelen. Bijgevolg kan men zich afvragen of een fiscale vrijstelling op deze basis door de Europese Commissie niet als een technische hinderpaal kan worden beschouwd en mogelijk door de Europese wetgeving kan worden gesanctioneerd. Dit is dan nog los gezien van het feit dat bijvoorbeeld in Italië en in Frankrijk — dit zijn toch twee belangrijke producenten van mineraalwater — het niet toegelaten is om gerecycleerd materiaal te gebruiken in plasticverpakkingen die in contact komen met levensmiddelen.
Een tweede element is de invloed van het invoeren van de verpakkingsheffingen op het bedrijfsleven en meer specifiek de voedingsmiddelensector. Ik verwijs dan naar de nadelige invloed van de verpakkingsheffing op de grenshandel. Gezien de huidige aanzienlijke verschillen in BTW-tarief en -accijnzen met onze buurlanden, voornamelijk Frankrijk, maar ook Nederland — en dit geldt zeker voor de frisdranken en de waters — heeft het voorliggende ontwerp tot gevolg dat de verschillen nog groter zullen worden en dat in de winkels in het binnenland en aan de grensstreek er nog minder dranken als waters en limonades zullen worden verkocht. Bijgevolg zal de distributie en de kleinhandel een belangrijke hoeveelheid aan inkomsten derven. Berekeningen hebben trouwens ook aangetoond dat de Belgische Staat hierdoor rechtstreeks jaarlijks ongeveer 2,4 miljard frank of 62 miljoen euro aan inkomsten uit BTW-accijnzen en —tarieven derft.
De Franse en de Nederlandse distributeurs zullen zeker niet nalaten om dit in de hen op maat gemaakte reclamecampagnes uit te spelen om zo de klanten in de grensstreek naar de Franse of de Nederlandse winkels te lokken. Bijgevolg zal het invoeren van de ecotaksen voor een marktverstorende werking zorgen.
Een derde element is de weerslag die deze wet zal hebben op de recyclage en de selectieve ophaling van drankverpakkingen. We mogen toch niet vergeten dat de selectief ingezamelde verpakkingsstromen voor tweederde uit drankverpakkingen bestaat en dat dit land zich in een tijdspanne van enkele jaren heeft opgewerkt tot de top van de recyclage in Europa. Ruim 92% van de selectief ingezamelde verpakkingen — en dit omvat zowel de retourflessen als eenmalige verpakkingen — krijgt na recyclage een nieuw leven. Door de eenmalige drankverpakkingen te gaan belasten wordt het bestaande recyclagesysteem zoals we dat momenteel kennen op de helling geplaatst. De laatste jaren zijn er door de steden en gemeenten belangrijke inspanningen geleverd om bij wijze van spreken de burgers een milieugeweten te schoppen door contracten af te sluiten met onder andere FOST Plus en tal van intercommunales voor de selectieve ophaling van PMD om wat men noemt de restfractie te doen dalen. Vele landgenoten sorteren zich dagdagelijks nagenoeg onnozel, al was het maar omdat de prijs van de verwerking van het restafval of wat men in de bruine afvalzak kan deponeren spectaculair is toegenomen. Hoe met de voorliggende wet de gewestelijke recyclagedoelstellingen op termijn blijvend gehaald zullen worden, is verre van duidelijk.
Tot slot, mijnheer de minister, wil ik nog iets zeggen over het mogelijk invoeren van een discriminatie — om het woord protectionisme niet te moeten gebruiken — voor de invoer van natuurlijke mineraalwaters. Toen het voorliggende ontwerp werd bekendgemaakt, heeft de Europese Commissie eraan herinnerd dat natuurlijke waters aan de bron zelf moeten gebotteld worden. Dat heeft natuurlijk zo zijn reden. Natuurlijk mineraalwater en bronwater moeten worden beschermd tegen om het even welk besmettings- of pollutierisico en mogen tevens niet aan een ontsmettingsbehandeling onderworpen worden. Bijgevolg is hierop een strenge internationale en Europese wetgeving van toepassing. Vandaar dat deze niet in bulk mogen getransporteerd worden omdat dit bulktransport een bron van besmetting zou kunnen zijn. Het maakt het bottelen op een lokale markt mogelijk en vermijdt tevens het terugbrengen van de lege herbruikbare flessen naar de oorspronkelijke bron, daarbij compleet negerend dat drinkwater een water is dat geen specifieke oorsprong heeft en onderworpen wordt aan ontsmettingsregels terwijl dit voor bron- en mineraalwater gezien de strenge reglementering niet kan. Bijgevolg is de mogelijke regeling rond de naamsverandering een volledige miskenning van de regels en de verplichtingen zoals die van toepassing zijn op bron- en mineraalwater maar ook een miskenning van de regels en de koninklijke besluiten inzake etikettering. Bijgevolg, voorzitter — en daarmee rond ik af — kan ik alleen maar besluiten dat in dit hele dossier aangaande de ecotaksen en de ecoboni partijpolitieke dogma's belangrijker zijn gebleken dan een objectieve benadering, zowel ecologisch als sociaal-economisch. A third element is the impact that this law will have on the recycling and selective collection of beverage packaging. More than 92% of selectively collected packaging — including both returned bottles and single-use packaging — will get a new life after recycling. By taxing the single-use beverage packaging, the existing recycling system as we currently know it is placed on the slope. In recent years, the cities and municipalities have made significant efforts to give citizens an environmental awareness by concluding contracts with, among other things, FOST Plus and numerous intercommunals for the selective collection of PMD in order to reduce what is called the residual fraction. Many compatriots sort themselves almost day-to-day nonsense, even if it was only because the price of the treatment of the residual waste or what one can deposit in the brown waste bag has increased spectacularly. How with the present law the regional recycling targets will be achieved permanently in the long term is far from clear.
Finally, Mr. Minister, I would like to say something about the possible introduction of a discrimination — in order not to use the word protectionism — for the importation of natural mineral waters. When the present draft was published, the European Commission reminded that natural waters must be bottled at the source itself. This, of course, has its reason. Natural mineral water and source water should be protected from any risk of contamination or pollution and should not be subjected to disinfecting treatment. Therefore, this is subject to strict international and European legislation. Therefore, they should not be transported in bulk because this bulk transport could be a source of contamination. From the point of view of food safety, this is, in my opinion, a legitimate concern and – in addition to the various food crises that have also occurred with the Greens at the wheel of Public Health – an important argument. What is the solution to this issue in Belgium? Very simply, the suggestion is to change the sales name of the product. Simply convert mineral water or spring water into drinking water and the problem of bulk transport is solved. It enables bottling on a local market and also avoids the return of empty reusable bottles to the original source, completely ignoring that drinking water is water that does not have a specific origin and is subject to disinfection rules, whereas for source and mineral water this is not possible given the strict regulation. Consequently, the possible regime surrounding the name change is a complete disregard of the rules and obligations as applicable to source and mineral water, but also a disregard of the rules and royal decrees on labelling. Consequently, Mr. Speaker — and therefore I am around — I can only conclude that in this whole dossier concerning the ecotax and the ecoboni party political dogmas have proven to be more important than an objective approach, both ecological and socio-economic. The Flemish Blok group is convinced that the present draft is therefore an empty box, so we cannot approve this law.

Er is bovendien een ander principe dat uitermate belangrijk is, namelijk het principe van de afvalbeheershiërarchie. Ook de fracties van de VLD en de MR zou ik willen bedanken voor de constructieve wijze waarop zij dit dossier tot een goed einde hebben helpen brengen. Ik denk dat dit een belangrijk wetsontwerp is. Ik ben het met u eens als u zegt dat er een aantal details zijn die voor verdere verbetering vatbaar zijn. Dat is ook de reden waarom er in een opvolging, in een evaluatie wordt voorzien in het midden van het volgende jaar. Monsieur le président, monsieur le ministre, chers collègues, le projet de loi qui nous est soumis aujourd'hui fait suite aux engagements qu'a pris le gouvernement de rendre écologique la fiscalité. Il prévoit des dispositions fiscales concernant les récipients pour boissons mais également pour les piles, les récipients industriels et les appareils photo jetables. En ce qui concerne les emballages pour boissons, le but est d'atteindre une différence suffisamment grande entre les récipients réutilisables et les jetables afin de limiter la production croissante de déchets.
Des écoréductions ou écobonis sont établis sous la forme d'une diminution, voire d'une suppression, des accises et d'une réduction de la TVA. Ainsi, une réduction générale des accises grevant les boissons est instaurée. Les accises sont même supprimées pour les eaux minérales — un vieil engagement qui remonte à quelques années —, les jus de fruits et les jus de légumes. De plus, le taux de TVA est diminué de 21 à 6% sur les boissons non alcoolisées, quel que soit l'emballage.
Parallèlement aux écoréductions, une cotisation d'emballage est instaurée sur toutes les boissons conditionnées dans un emballage non réutilisable. Des exemptions à l'application de cette cotisation d'emballage sont néanmoins prévues par le législateur. La première de celle-ci est valable pour les récipients soumis à un système de consigne. Ainsi, les bouteilles consignées ne seront pas assujetties à la cotisation. La deuxième exemption est prévue pour les récipients contenant le lait ou ses dérivés.
Enfin, la chose la plus importante à mes yeux et pour laquelle je me réjouis, monsieur le ministre, concerne l'exonération instaurée pour les récipients partiellement constitués de matériaux obtenus du recyclage de matières déjà utilisées auparavant.
Pour rappel, le Conseil des ministres du vendredi 6 décembre a décidé d'exonérer les emballages contenant au moins 50% de matières recyclées. Ce taux est relevé à 70% pour les récipients en verre coloré. Selon moi, cette décision est conforme aux souhaits que nous avions formulés et qui s'inscrit dans la lignée de l'amendement que nous avions déposé. En effet, il était primordial de ne pas pénaliser les entreprises de pointe dans le domaine des emballages en matériaux recyclés et de leur permettre de poursuivre leurs efforts.
Le taux de 50% est un objectif ambitieux, certes, mais je pense qu'il sera réalisable pour les entreprises ayant déjà investi dans les technologies liées au recyclage. Il fallait ainsi tenir compte des efforts fournis depuis plusieurs années par le secteur des eaux et des limonades pour produire des bouteilles composées, en grande partie, de produits recyclés. Cette nécessité s'imposait également par le fait que, sans le dispositif d'exonération, un impact négatif pour l'emploi risquait de survenir.
Dès lors, je pense que les dispositions prévues dans ce projet de loi, avec les dispositions de l'arrêté royal tendent vers la sauvegarde du développement durable, tant sur le plan de l'emploi que de l'environnement et de l'économie.
Monsieur le ministre, pour terminer, je parlerai brièvement de la crainte d'une éventuelle plainte que ce dispositif fiscal pourrait générer auprès des autorités européennes. En effet, lors des auditions, certains intervenants nous ont fait part de leur sentiment que ce projet générait une discrimination. N'étant pas un spécialiste de la législation européenne, je pense qu'il faut faire confiance, en ce domaine, au ministre des Finances et en son administration qui ont rédigé ce projet dans le but, j'en suis convaincu, d'assurer la plus grande sécurité juridique possible. Votre avis à cet égard nous intéresserait. Je vous remercie monsieur le ministre.

It provides for tax provisions for beverage containers but also for batteries, industrial containers and disposable cameras. With regard to beverage packaging, the aim is to ⁇ a sufficiently large difference between reusable containers and disposable containers in order to limit the increasing production of waste.
Ecoreductions or ecobonis are established in the form of a reduction, or even an abolition, of excise duties and a reduction of VAT. Thus, a general reduction in excise taxes on drinks is introduced. The excise duties are even abolished for mineral waters — an old commitment dating back to a few years —, fruit juices and vegetable juices. In addition, the VAT rate is reduced from 21 to 6% on non-alcoholic beverages, regardless of the packaging.
In addition to the reductions, a packaging fee is introduced on all beverages packaged in a non-reusable packaging. However, exemptions from the application of this packaging fee are provided by the legislator. The first one is valid for containers subject to a consignment system. Thus, the bottles ordered will not be subject to the contribution. The second exemption is provided for containers containing milk or its derivatives.
Finally, the most important thing in my view, and for which I look forward, Mr. Minister, concerns the exemption established for containers partially made of materials obtained from the recycling of materials already used before.
The Council of Ministers on Friday, December 6, decided to exempt packaging containing at least 50% of recycled materials. This rate is increased to 70% for colored glass containers. In my opinion, this decision is in accordance with the wishes we had expressed and which is in line with the amendment we had submitted. Indeed, it was crucial not to penalize the leading companies in the field of packaging from recycled materials and to allow them to continue their efforts.
The 50% rate is an ambitious goal, of course, but I think it will be feasible for companies that have already invested in recycling-related technologies. This had to take into account the efforts of the water and limonade sector for several years to produce bottles composed, in large part, of recycled products. This necessity was also imposed by the fact that, without the exemption scheme, a negative impact on employment could occur.
Therefore, I believe that the provisions provided for in this bill, together with the provisions of the Royal Decree, tend to safeguard sustainable development, both in terms of employment, environment and economy.
Mr. Minister, to conclude, I will briefly speak of the fear of a possible complaint that this tax arrangement could generate to the European authorities. Indeed, during the hearings, some speakers expressed to us their feelings that this project generates discrimination. As I am not a specialist in European legislation, I think that in this area we must trust the Minister of Finance and his administration who have drafted this project in order, I am convinced, to ensure the greatest possible legal certainty. Your opinion in this regard would interest us. Thank you Mr. Minister.

Mijnheer de voorzitter, mijnheer de minister, collega's, in navolging van sommige andere leden van dit huis zal ik mijn uiteenzetting onderverdelen in een voorafgaande opmerking en een vijftal bedenkingen of vragen.
Ik wil met mijn voorafgaande opmerking inhaken op hetgeen collega Vanhoutte zei. De ondertoon daarvan was dat het merkwaardig is dat de diverse liberale fracties in dit huis uiteindelijk toch zijn meegegaan in dit ontwerp om een en ander te realiseren. Hij was daarvoor dankbaar en wij appreciëren dat natuurlijk. Ik denk echter toch dat ook op principieel vlak de toestand helemaal anders is. Waarom zou de VLD tegen ecofiscaliteit zijn? Ik durf zelfs de voorspelling te doen dat, naarmate het voor een groter deel van de publieke opinie duidelijk wordt dat de enige manier om op een structurele manier de werkloosheid en de inactiviteit op te lossen ligt in het verlagen van de transactiekosten van de arbeidsruil, ook de belangstelling voor ecofiscaliteit als alternatieve overheidsfinanciering in een context van globale lastendalingen alleen maar zal toenemen. Dat is een hele volzin om gewoonweg te zeggen dat onze samenleving vanuit haar industrieel verleden een steeds groter deel van de overheidsfinanciering heeft doen wegen op arbeid in allerlei vormen: sociale bijdragen, BTW op diensten, personenbelasting en vennootschapsbelasting op KMO's. De eenvoudige toepassing van de wet van vraag en aanbod leidt onvermijdelijk tot een veel lager evenwichtspunt inzake arbeidsruil dan zonder al die lasten. In een economie die vooral richting tertiaire en quartaire sector evolueert, betekent dat de tak afzagen waarop men zit. De tendens zal dus de afbouw van de lasten op arbeid blijven. Men kan dat hopelijk nog een tijdje doen zonder nieuwe lasten in te voeren, maar vroeg of laat komt ook de vraag naar de alternatieve financiering van de overheid terug.
Dan zal men, net zoals men in de middeleeuwen de consumptie van zout ging belasten — overigens: als u naar een Toscaans brood kijkt, weet u dat die ook soms wordt ontweken — zal men zoeken naar producten en dan vooral consumptiegoederen die als grondslag van lasten kunnen dienen. Het zou een hele goede zaak zijn indien men op dat moment nog nadrukkelijker het onderscheid maakte tussen milieuvriendelijke en milieuschadelijke goederen. Dit maar om te zeggen dat ik ervan overtuigd ben dat het grote debat over ecofiscaliteit nog lang niet ten einde is. Ook vanuit een visie van een lastenverlaging in het algemeen en een verlaging van lasten op arbeid in het bijzonder moet daarover nagedacht worden.
Ik kom dan bij mijn eerste vraag: zal de consument de dupe worden van deze hervorming? Eigenlijk had ik die vraag niet hoeven te stellen want het antwoord is simpel: neen. Zonder deze wet — en de wet van 26 juli 2002 die er politiek een eenheid mee uitmaakt — trad het mechanisme van de wet van 1993 in werking zonder overheidsmaatregelen. Dan kreeg men een hoge milieutaks die onvermijdelijk de kosten voor de consument zwaar had verhoogd. Maar zelfs wanneer men daar geen rekening mee houdt, zijn er nog de substantiële verlaging van accijnzen en de verlaging van de BTW tot 6% voor de niet-alcoholhoudende dranken die tegenover de ecotaks van maximum 11 cent per milieuvervuilende literfles staan. 11 cent of 4 frank is natuurlijk niet het einde van de wereld. Financieel ziet het er dus alleszins niet naar uit dat de gemiddelde consument meer zal betalen dan vandaag het geval is. Zijn gedrag zal wel gestuurd worden doordat producten in hergebruikbare verpakkingen goedkoper zullen zijn dan die in niet-hergebruikbare verpakkingen of in verpakkingen die niet minstens een voldoende percentage aan gerecycleerde vezels bevatten. Dus rijst de vraag of die positieve stimulans om milieuvriendelijk gedrag te vertonen, moet worden aanzien alsof de consument er de dupe van zou zijn. Ik denk dat dit alleszins een zwaar overtrokken redenering zou zijn.
Een tweede vraag die men kan stellen, is of de vrijheid van de producent om een verpakkingswijze te kiezen nodeloos aan banden wordt gelegd? Inderdaad, uit de hoorzittingen bleek dat het bedrijfsleven een grote bekommernis heeft om zo weinig mogelijk door overheidsingrijpen tot een bepaalde verpakking te worden gedwongen. Als algemeen principe kan ik dat zeker onderschrijven. Maar ik wil dat tegelijkertijd relativeren, zeker wat voedingsmiddelen betreft. Als er één sector is waar tal van normen bestaan die de verpakking reglementeren, is het precies de voedingssector, al was het maar om redenen van volksgezondheid. Dat gegeven heeft het bedrijfsleven toch niet verhinderd een accurate marketing en productiepolitiek te organiseren waardoor men nog altijd de kost kan verdienen door het produceren van voedingsproducten.
Ik denk zelfs dat het voor het bedrijfsleven gemiddeld genomen belangrijker is dat de reglementering stabiel blijft dan wat de inhoud van de norm is. Dit ontwerp creëert door de evenwichtigheden die er in vervat zijn het stabiele kader waar het bedrijfsleven terecht om vraagt. Dat betekent niet dat er geen problemen zouden bestaan die onze aandacht verdienen. De situatie van de drankkartons, en die van de importeurs van dranken verdient om er nader bij stil te staan. Globaal genomen, denk ik, kijkend naar de normen waarin in het uitvoeringsbesluit worden voorzien, dat er enkel voor wit glas dat niet in een hergebruiksysteem zit en voor drankkartons een reëel probleem zal zijn om een vrijstelling op de ecotaks te verkrijgen.
Vanzelfsprekend is het voor een buitenlands bedrijf moeilijk om een systeem van hergebruik te organiseren. Het is trouwens zeer de vraag of de combinatie met de Europese verplichting om bronwaters aan de bron te bottelen het voor hen de facto niet onoverkomelijk maakt een statiegeldsysteem op te zetten. Aangezien juist een deel van die producenten gebruikmaakt van wit glas is de kans inderdaad groot dat de ecotaks precies op die producten geheven wordt. Hoewel het volgens het Europese recht mijns inziens wel degelijk mogelijk is strengere nationale milieunormen in te voeren, blijft er toch een zweem van marktafscherming bestaan. Het zou goed zijn indien met die sector gezocht werd naar realistische en ecologisch evenwaardige oplossingen die hem meer kansen zouden bieden.
Inzake de drankkartons vind ik dat het ontwerp die niet helemaal fair behandelt. Door de eigen aard van die kartons is het moeilijk om ze te recycleren tot diezelfde soort verpakkingen. Dat wil niet zeggen dat duurzame vormen van recyclage van die drankkartons tot andere producten niet mogelijk zou zijn. Oorspronkelijk wensten wij vanuit de VLD een amendement in te dienen dat dit probleem zou regelen, door in een vrijstelling te voorzien voor drankverpakkingen waarvan de materialen voor een hoog percentage gerecycleerd worden tot andere producten die de levensduur van drankkartons overstijgt.
Ik blijf het jammer vinden dat er geen ruimte bestond om daarover te praten met de meerderheid, maar ik heb het gevoel dat vroeg of laat dit element opnieuw ter sprake zal komen.
De derde vraag, waarover vandaag trouwens al een beetje werd gedebatteerd, is te weten of de keuze voor hergebruik een irrationeel niet-wetenschappelijk onderbouwd dogma is. In de commissie werden wij om de oren geslagen met diverse levenscyclusanalyses van verpakkingsproducten: de ene om te bewijzen dat recyclage zeker zo goed is als hergebruik en de andere om de bewijzen dat hergebruik minstens evengoed is als recyclage.
De kern van de vraag is wat al die analyses aantonen.
Wetenschappelijkheid bestaat erin dat de studies vatbaar zijn voor objectieve kritiek en falsificatie. En dat zijn ze ook. Wat vooral blijkt is dat de vraag welk verpakkingssysteem ecologisch gezien superieur is, niet eenduidig kan worden aangetoond. Met andere woorden, dat dit afhankelijk is van de gekozen parameters.
Een levenscyclusanalyse is verschillend naargelang de gebiedsomschrijving waarop zij wordt toegepast, naargelang het tijdstip waarop zij wordt gehouden en naargelang de wijzigingen die zich voordoen in een aantal parameters en in de evolutie van de technologie, alsook naargelang de toerekening van factoren zoals milieubelasting door wasprocessen of door de impact van verkeer en luchtvervuiling. In die omstandigheden kan men aan al die studies slechts de waarde hechten die er eenduidig uit blijkt. Systemen van hergebruik zijn een waardevolle mogelijkheid van verpakkingssystemen. Doorgedreven recyclagesystemen zijn absoluut geen ecologische waanzin.
Kan men daaruit afleiden dat dit wetsontwerp geen rekening zou houden met die wetenschap? Nee, helemaal niet. Integendeel, het wetsontwerp volgt de stelling dat hergebruiksystemen en bepaalde recyclagesystemen de voorkeur verdienen. Dat is perfect conform de resultaten van het wetenschappelijk onderzoek. Men gaat inderdaad iets verder in het bevoordelen van hergebruiksystemen, maar dat is eigenlijk meer een toepassing van het voorzorgsprincipe dan van de zuivere wetenschappelijkheid.
Bij de onmogelijkheid om met harde bewijzen wetenschappelijk aan te tonen dat iets goed of slecht is, is het beleid inderdaad niet ontslagen om te trachten problemen te voorkomen. Hoewel men dat voorzorgsprincipe met enige omzichtigheid moet hanteren — ik geloof zeker niet in fundamentalistische toepassingen daarvan — meen ik dat het gezonde verstand zegt dat een beleid waarbij wordt geprobeerd schaarse grondstoffen zo lang mogelijk ongewijzigd te behouden, een goed beleid is. Een ecotaks van 11 eurocent per literfles, met tal van uitzonderingen en nuances, lijkt mij alleszins geen fundamentalistische toepassing van dat voorzorgsprincipe.
Het zou boeiend zijn alle opeenvolgende accijnsverhogingen die door alle mogelijke regeringen ooit werden doorgevoerd op alcohol, tabak en benzine, te toetsen aan het criterium van wetenschappelijkheid, hoewel zij destijds ook altijd werd beargumenteerd vanuit allerlei bevlogen redenen van volksgezondheid en dergelijke.
De keuze voor een ecotaks van 11 eurocent, gecombineerd met diverse lastenverlagingen op die producten en de vrijstellingsbepalingen voor melk en gerecycleerde verpakkingen, is volgens mij geen uiting van extremisme, strookt met het gezond verstand en is niet onwetenschappelijk.
Zal de recyclagesector door dit ontwerp in elkaar stuiken? Tot op heden bestond er een systeem waarbij de producenten hun verplichting tot recyclage konden overdragen aan FOST Plus in ruil voor het betalen van het groene punt. Sommigen beweren dat het verdwijnen van die formele verwijzing in de wet naar die wijze van handelen, tot gevolg zal hebben dat het recyclageapparaat in elkaar zal stuiken. Ik zie dat niet zo. De bedrijven die niet wensen over te stappen naar hergebruiksystemen blijven een belang hebben in het organiseren van de recyclage, conform de regels van de wet. In de mate dat zij dat zelf niet kunnen, zal op de markt ruimte bestaan voor organisaties en bedrijven die hen daarbij helpen.
Er is uiteraard wel een verschil, in die zin dat het een minder monopolistische situatie zal worden. Dat is ook een algemene trend in de hele milieusector, waarbij we van monopolistische, dikwijls semi-overheidsbedrijven evolueren naar een meer marktconforme benadering. Hoewel het van de sector wel degelijk een omvorming vraagt, ben ik ervan overtuigd dat hoe sneller wij onze milieusector op een marktconforme manier kunnen organiseren, hoe relevanter die sector zal blijken in de Europese economie. Vroeg genoeg omvormen zal latere accidenten voorkomen.
Daarnaast heft dit wetsontwerp het Vlaams afvalstoffenbeleid natuurlijk niet op. De verpakkingen die niet worden hergebruikt of niet in nieuwe verpakkingen worden gerecycleerd, zullen moeten worden verwijderd conform de Vlaamse decreten — en de Waalse tegenhanger daarvan — inzake afval. Voor zover ik daarover nog iets weet, zijn er ook daar mechanismen die de recyclage bevorderen.
Ik kom tot mijn conclusie. Ja, de recyclagesector staat voor een omvormingsproces, maar dit lijkt mij absoluut niet tot de instorting ervan te leiden.
Ik zal mijn betoog een klein beetje inkorten en tot slot de vraag proberen te beantwoorden of het milieu hier nu eigenlijk beter van wordt. Wordt er iemand beter van? Lossen we met dit ontwerp al dan niet een probleem op? Ik denk het wel. Het is alleszins zo dat gedurende deze legislatuur een wetgevend ingrijpen in de sector van de ecotaksen noodzakelijk was, tenzij men de tamelijk draconische ecotaks onverkort wou gaan toepassen. Dit ontwerp, samen met de wet die de naam wet-Coveliers draagt — althans in de commissie — regelt deze materie op een bevredigende manier, namelijk door te kiezen voor het positief sturen van het aankoopgedrag in plaats van alleen de stok te gebruiken. De combinatie van accijns- en BTWverlagingen op dranken, het afschaffen van een aantal ecotaksen op diverse producten en het invoeren van een verpakkingsheffing op milieuonvriendelijke verpakkingen van drank, lijkt mij een redelijke oplossing voor een concreet probleem dat bestond. Dat alleen al rechtvaardigt dit ontwerp. Het feit dat met het systeem van ecoboni nieuwe pistes worden ontwikkeld inzake de ecofiscaliteit lijkt mij alleen maar een positieve ontwikkeling in de milieusector.

Mr. Speaker, Mr. Minister, Colleagues, following some other members of this House, I will subdivide my presentation into one previous note and five concerns or questions.
I would like to conclude with my previous comment on what colleague Vanhoutte said. The bottom line of this was that it is strange that the various liberal factions in this house have eventually joined in this design to realize something. He was grateful for that and we appreciate that, of course. However, I also think that in principle the situation is completely different. Why should the VLD be against ecofiscality? I even dare to predict that, as it becomes clear to a greater part of the public opinion that the only way to structurally solve unemployment and inactivity is to reduce the transaction costs of labour exchange, the interest in ecofiscality as an alternative public financing in a context of global burdens will only increase. That is a whole nonsense to simply say that our society, from its industrial past, has made an ever-increasing part of public financing into labour in all forms: social contributions, VAT on services, personal tax and corporate tax on SMEs. The simple application of the law of supply and demand inevitably leads to a much lower balance point in labour exchange than without all these burdens. In an economy that is evolving mainly toward the tertiary and quaternary sectors, that means cutting off the branch on which one sits. Therefore, the trend will remain to reduce the burden on labour. One can hopefully do so for a while without introducing new charges, but sooner or later the demand for alternative government financing will also return.
Then, just as in the Middle Ages the consumption of salt was taxed — by the way, if you look at a Tuscany bread, you know that it is also sometimes avoided — one will look for products and then especially consumer goods that can serve as the basis of burdens. It would be a very good thing if at that time the distinction between environmentally friendly and environmentally harmful goods was made even more accurately. This is only to say that I am convinced that the big debate on ecofiscality is far from over. Also from a vision of a reduction in the burden in general and a reduction in the burden on labor in particular, this should be considered.
So I come to my first question: will the consumer become the asshole of this reform? In fact, I didn’t have to ask that question because the answer is simple: no. Without this law — and the law of 26 July 2002 which forms a political unity with it — the mechanism of the law of 1993 came into effect without government measures. Then one received a high environmental tax that inevitably increased the costs for the consumer heavily. But even if this is not taken into account, there is still the substantial reduction of excise duties and the reduction of the VAT to 6% for non-alcoholic beverages, which are opposed to the ecotax of a maximum of 11 cents per environmentally polluting litre bottle. Of course, 11 cents or 4 francs is not the end of the world. Therefore, financially, it does not seem that the average consumer will pay more than it is today. However, its behavior will be driven by the fact that products in reusable packaging will be cheaper than those in non-reusable packaging or in packaging that does not contain at least a sufficient percentage of recycled fiber. Thus, the question arises whether that positive incentive to show environmentally friendly behavior should be treated as if the consumer was the fool of it. I think this would be a heavily overwhelmed reasoning.
A second question that can be asked is whether the manufacturer’s freedom to choose a type of packaging is unnecessarily exposed to tyres? Indeed, the hearings showed that the industry is deeply concerned about being coerced to a particular packaging as little as possible by government interventions. As a general principle, I can ⁇ endorse that. But I want to relieve that at the same time, especially when it comes to food. If there is one sector where there are numerous standards that regulate the packaging, it is precisely the food sector, even if it is for reasons of public health. However, this has not prevented the industry from organizing an accurate marketing and production policy, so that one can still earn the cost by producing food products.
I even think it is more important for business, on average, that regulation remains stable than what the content of the standard is. This design, through the balances contained in it, creates the stable framework that the business rightly demands. That does not mean that there would be no problems that deserve our attention. The situation of the beverage cartons, and that of the importers of beverages, deserves to be discussed more closely. Overall, I think, considering the standards provided for in the implementing decision, that only for white glass which is not in a reuse system and for beverage cartons will be a real problem to obtain an eco-tax exemption.
Of course, it is difficult for a foreign company to organize a system of reuse. Furthermore, it is very questionable whether the combination with the European obligation to bottle springwater at the source does not make it de facto insurmountable for them to set up a station money system. Since precisely a part of those producers use white glass, it is likely that the ecotax will be levied precisely on those products. Although, in my opinion, it is possible under EU law to introduce stricter national environmental standards, there is still a small amount of market coverage. It would be good if the sector sought realistic and ecologically equivalent solutions that would give it more opportunities.
As for the beverage boxes, I think that the design does not treat it completely fair. Due to the very nature of these cartons, it is difficult to recycle them into the same type of packaging. That does not mean that sustainable forms of recycling from those beverage cartons to other products would not be possible. Initially, we wanted from the VLD to submit an amendment to address this problem by providing an exemption for beverage packaging whose materials are recycled for a high percentage to other products that exceed the lifetime of beverage cartons.
I continue to regret that there was no room to talk about it with the majority, but I feel that sooner or later this element will come back.
The third question, which, by the way, has already been debated today, is whether the choice for re-use is an irrational, non-scientifically-founded dogma. In the committee we were beaten to the ears with various life cycle analyses of packaging products: one to prove that recycling is ⁇ as good as reuse and the other to prove that reuse is at least as good as recycling.
The core of the question is what all these analyses show.
Scientificity consists in the fact that the studies are prone to objective criticism and falsification. And so are they too. What is ⁇ evident is that the question of which packaging system is ecologically superior cannot be demonstrated unambiguously. In other words, that this depends on the chosen parameters.
A lifecycle analysis is different depending on the area description to which it is applied, the time at which it is held and the changes that occur in a number of parameters and in the evolution of technology, as well as the allocation of factors such as environmental impact from washing processes or the impact of traffic and air pollution. In those circumstances, all these studies can only be attributed the value which is clearly demonstrated. Re-use systems are a valuable possibility of packaging systems. Extensive recycling systems are absolutely not ecological madness.
Can it be inferred from this that this bill would not take into account that science? No, not at all. On the contrary, the bill follows the statement that reuse systems and certain recycling systems deserve preference. This is perfectly consistent with the results of scientific research. Indeed, one goes a little further in favouring reuse systems, but that is actually more an application of the precautionary principle than of pure scientificity.
When it is impossible to scientifically prove that something is good or bad with hard evidence, the policy is indeed not dismissed in an effort to prevent problems. Although this precautionary principle should be used with some caution — I ⁇ do not believe in fundamentalist applications of it — I think common sense says that a policy that tries to keep scarce raw materials unchanged for as long as possible is a good policy. An ecotax of 11 euro cents per liter bottle, with numerous exceptions and nuances, does not seem to me to be a fundamentalist application of that precautionary principle.
It would be fascinating to test all the successive increases of excise duties ever made by all possible governments on alcohol, tobacco, and gasoline, on the criterion of scientificity, though at that time it was always argued for all sorts of serious reasons of public health and the like.
The choice of an eco-tax of 11 euro cents, combined with various reductions in the burden on those products and the exemption provisions for milk and recycled packaging, is, in my opinion, not an expression of extremism, consistent with common sense and is not unscientific.
Will the recycling industry get stuck by this design? Until now, there was a system in which producers could transfer their recycling obligation to FOST Plus in exchange for paying the green point. Some argue that the disappearance of that formal reference in the law to that way of acting will result in the recycling machine collapsing. I do not see it so. Companies that do not wish to switch to reuse systems continue to have an interest in organizing the recycling, in accordance with the rules of the law. To the extent that they cannot do so on their own, there will be room on the market for organizations and companies to help them do so.
There is, of course, a difference, in the sense that it will become a less monopolistic situation. This is also a general trend across the entire environmental sector, where we are evolving from monopolistic, often semi-governmental companies to a more market-compliant approach. While it really requires a transformation of the sector, I am convinced that the faster we can organize our environmental sector in a market-compliant manner, the more relevant that sector will prove to be in the European economy. Converting early enough will prevent later accidents.
Moreover, this bill does not, of course, alter the Flemish waste policy. Packaging that is not reused or recycled in new packaging will have to be disposed of in accordance with the Flemish decrees — and their Wallish counterpart — on waste. As far as I know, there are also mechanisms that promote recycling. Their
I come to my conclusion. Yes, the recycling sector is undergoing a transformation process, but this does not seem to me to lead to its collapse.
I will shorten my argument a little and finally try to answer the question of whether the environment is actually getting better. Does anyone get better? Will this design solve a problem or not? I think so. It is ⁇ true that during this legislature a legislative intervention in the sector of the ecotaxes was necessary, unless the rather draconian ecotax was to be applied unshortedly. This draft, together with the law which bears the name law-Coveliers — at least in the committee — regulates this matter in a satisfactory way, namely by choosing to positively direct the buying behavior rather than using only the stick. The combination of excise duty and VAT reductions on beverages, the abolition of a number of ecological taxes on various products and the introduction of a packaging tax on environmentally unfriendly packaging of beverages seems to me to be a reasonable solution to a concrete problem that existed. That alone justifies this proposal. The fact that the ecoboni system develops new pistes on ecofiscality seems to me to be only a positive development in the environmental sector.

Vous avez également pris des mesures en termes de mobilité où, là aussi, d'autres types de mobilité que le tout à la voiture sont encouragés. On a beaucoup entendu de discussions ici pour savoir si le récipient réutilisable est moins polluant. Je ne vais pas me lancer dans une comparaison des différentes études montrant, d'un point de vue des écobilans, que les récipients non réutilisables sont nettement moins écologiques. Autre mythe qui circule: La Belgique est extraordinaire en termes de recyclage. Par exemple, Bruxelles est souvent oubliée, on peut se dire que cela pose quand même un problème. On oublie aussi qu'énormément de bouteilles viennent de l'extérieur, des pays transfrontaliers et ainsi de suite. Donc, là aussi, ne mythifions pas les chiffres qui nous arrivent au sujet du recyclage.
Ici, grâce aux écobonis, nous allons essayer d'enrayer l'érosion actuelle par rapport à l'utilisation des bouteilles consignées. Que se passe-t-il? Depuis des années, les producteurs nous promettent qu'ils vont s'arranger pour arrêter la diminution des bouteilles consignées. On voit que la tendance est totalement inverse. De plus en plus, même dans l'horeca, un des secteurs qui utilisait beaucoup les récipients réutilisables, on constate un lobbying d'un certain nombre d'industries pour essayer de les faire migrer vers les récipients jetables. Il était donc urgent d'intervenir.
On a beaucoup dit: "Mais vous voulez retourner à l'ère du verre, des bouteilles lourdes, dangereuses et qui s'abîment". Soyons clairs! Dans les pays voisins, on observe, avec un système d'écotaxes et/ou de quotas, une grande utilisation de bouteilles modernes, en plastique, réutilisables. Je ne comprends vraiment pas pourquoi la Belgique ne peut pas se mettre au même diapason que l'Allemagne, la Hollande, la Suède, la Finlande, etc. D'ailleurs, de nombreuses firmes qui sont actives sur notre territoire font cet effort quand elles vont chez nos voisins. Je suis très heureuse que l'on puisse bientôt rencontrer ce type de produits chez nous. Je rassure toutes les personnes qui s'inquiétaient pour les vieilles dames et pour les enfants, il n'y a pas lieu de l'être. Sans compter que quand vous discutez avec les vieilles dames, elles vous disent: "De mon temps on gardait les sachets de café et on les réutilisait, tandis que maintenant on gaspille".
J'ai bien peur que ces craintes ne soient pas vraiment des préoccupations de vieilles dames mais un simple prétexte. Bien sûr, nous ne voulons pas dire pour autant qu'il faut mettre le verre au rancart. Le verre a encore de beaux jours devant lui et c'est tant mieux puisque nous avons une industrie verrière dans nos régions et que le verre est encore toujours un matériau noble qui permet d'embellir les tables. C'est d'ailleurs celui qu'on utilise à la Chambre. Cela va donc continuer, sans compter que de nombreuses entreprises soucieuses de l'environnement ont investi dans des filières de verre réutilisable et méritent donc d'être récompensées. On a peu entendu parler d'elles dans les médias mais je pense qu'elles sont nettement plus nombreuses qu'on pourrait le croire d'après les échos médiatiques.
Autre critique, les écobonis sont antisociaux. Je ne pense pas. En effet, si les gens veulent réaliser des économies, ils passeront aux récipients réutilisables. Ces mesures vont-elles pour autant nous pousser à aller davantage chez nos voisins? Non. Que se passait-il jusqu'à présent? Celui qui se souciait de son porte-monnaie allait dans le pays voisin. Désormais, celui qui se soucie de son portemonnaie achètera des bouteilles réutilisables. Là aussi, un objectif pourra être atteint.
Un autre secteur qui va profiter pleinement des ecobonis est l'horeca. On a calculé qu'à l'heure actuelle, l'horeca pourrait toucher environ 21 millions d'euros en continuant à utiliser principalement des fûts et des bouteilles réutilisables. Je pense que ce secteur avait besoin d'une petite bouffée d'oxygène, on l'a souvent entendu ici au parlement. Elle sera donc la bienvenue. Autres acteurs qui vont profiter de ces écobonis, les écoles et les collectivités qui travaillent avec ce type de récipients.
Par ailleurs, il sera important d'assurer une sécurité juridique. Je sais que le cabinet du ministre est déjà en train de travailler sur l'étiquetage et les différentes modalités pratiques. Il est important de sécuriser très rapidement le projet de loi pour que les entreprises puissent pleinement utiliser ses effets positifs au plus vite.
