Monsieur le président, messieurs les ministres, chers collègues, le projet de loi relatif au maximum à facturer dans l'assurance soins de santé est un projet important que nous avons examiné dans nos réunions de la commission des Affaires sociales des 27 mars et 17 avril 2002.
Dans son exposé introductif, le ministre des Affaires sociales a tout d'abord rappelé que l'assurance soins de santé dans notre pays a pour objectif premier d'offrir à toute la population une protection contre le coût engendré par la maladie.
Bien que des mesures particulières aient été prises au fil des années afin de garantir un meilleur accès aux soins de santé à des assurés se trouvant dans des conditions sociales et financières déterminées, ces mesures n'ont pas empêché que régulièrement encore, la maladie puisse entraîner un ménage dans des difficultés financières importantes, voire insurmontables.
Deux groupes à risques doivent faire l'objet d'une attention particulière: les personnes que l'on appelle les malades chroniques et leur famille ainsi que tous les ménages qui, échappant aux catégories sociales définies par la loi, sont néanmoins confrontés à des frais de santé importants avec des revenus insuffisants pour y faire face.
Il importait donc de prévoir une mesure significative qui accorde une protection plus rapide et plus forte aux ménages qui en ont le plus besoin. Tel est l'objet du présent projet de loi, le maximum à facturer. Une première étape a été franchie en 2001 par l'extension du bénéfice de la franchise sociale et de la franchise fiscale aux médicaments indispensables, c'est-à-dire des catégories A et B.
Le principe fondamental du maximum à facturer est la fixation d'une limite aux frais de santé que doit supporter un ménage. Lorsque cette limite est dépassée, l'assurance octroie une intervention égale à 100%. Le seuil de dépense est fixé en fonction des revenus du ménage et les interventions personnelles qui sont comptabilisées sont identiques pour toutes les catégories de revenus.
Par ailleurs, une protection particulière est accordée aux enfants de moins de 16 ans. Si ceux-ci supportent des tickets modérateurs pour un certain plafond (650 euros), ils bénéficieront d'une intervention égale à 100% quel que soit le montant des revenus du ménage dont ils font partie.
Enfin, dans l'hypothèse où l'enfant est handicapé et s'il bénéficie d'allocations familiales majorées au moment de l'entrée en vigueur de la présente loi, ce plafond est ramené à 450 euros.
Le maximum à facturer est une mesure de protection qui sera exécutée rapidement par les organismes assureurs en faveur des personnes appartenant à une catégorie sociale déterminée ou à un ménage disposant de revenus modestes. Dans cette dernière hypothèse, une enquête sur les revenus sera effectuée en collaboration avec le ministère des Finances.
Les dispositions proposées produisent leurs effets au 1 er janvier 2002. Il y a lieu de remarquer que pour les ménages disposant de revenus inférieurs à 13.730 euros, le maximum à facturer sera appliqué au début de l'année 2002 pour les prestations effectuées en 2001.
De nombreuses interventions ont eu lieu lors de la discussion générale. Je vais en reprendre quelques-unes parmi les plus significatives. Mmes De Block et Cahay ont exprimé le souhait que les discussions qui auront lieu en juin prochain dans le cadre de la Table ronde de la solidarité sociale permettent de dégager un calendrier quant à l'intégration des petits risques auxquels sont confrontés les travailleurs indépendants dans l'assurance obligatoire soins de santé.
Soulignant que les soins de santé accordés aux enfants atteints d'une maladie chronique ne peuvent être liés aux revenus des parents, les deux intervenantes se sont réjouies de la protection particulière que le projet de loi tend à instaurer vis-à-vis des enfants.
Notre collègue Luc Goutry a exprimé son soutien au projet de loi parce que ce texte, a-t-il dit, s'inscrit dans la continuité d'une politique précédemment initiée quant à l'accès aux soins de santé et à l'attention particulière qu'il convient de porter aux malades chroniques et aux ménages à revenus faibles ou modestes.
Toutefois, par rapport aux cotisations que supportent l'ensemble des travailleurs et par rapport à la sélectivité que le maximum à facturer introduit dans le système, l'intervenant s'est inquiété du financement présent et futur dudit système, mais aussi du risque d'une désolidarisation de la part des revenus plus élevés et de celui d'une déresponsabilisation croissante des patients.
En ce qui concerne les prestations qui sont comptabilisées dans la facture maximum et les personnes qui appartiennent ou non à l'une ou l'autre des catégories sociales définies par le projet, notre collègue Goutry a posé diverses questions et s'est interrogé sur le caractère illogique ou même discriminatoire du système. Il en est ainsi, selon l'orateur, des distinctions opérées en fonction de l'âge de l'enfant et de l'exclusion, sur la base de l'article 37, 9° du projet de loi, des bénéficiaires d'une allocation d'intégration appartenant aux catégories 3 et 4 du maximum à facturer déterminé en fonction de la catégorie sociale.
Mme Genot a souligné que le plafonnement des frais de santé, s'il est utile et nécessaire, n'épuise pas le débat sur les problèmes d'accessibilité. En effet, les tickets modérateurs ne représenteraient qu'un tiers des dépenses des ménages en soins de santé.
Par ailleurs, la question du contrôle de l'utilisation de la franchise doit se poser avant tout en termes de responsabilisation des prestataires.
Tout en considérant que le système procède d'une intention généreuse, M. Valkeniers a exprimé quelques craintes sur la bonne application du système, tant de la part des patients que des prestataires.
M. Bellot, quant à lui, s'est interrogé sur l'articulation entre le mécanisme du maximum à facturer et celui des assurances complémentaires en soins de santé.
Votre rapporteur a marqué sa satisfaction quant à la concrétisation d'un mécanisme qui renforce l'accessibilité des soins pour l'ensemble de la population. Compte tenu de la problématique des soins différés dans notre pays, une sélectivité accrue constitue un mal nécessaire, dans un contexte où les moyens de l'assurance sont et seront toujours limités.
Enfin, notre collègue M. Wauters, président de la commission, a conclu la discussion générale en déclarant que le texte proposé répond à un des défis les plus importants de cette législature. L'intervenant considère que la sélectivité est nécessaire, en particulier pour les catégories les plus précarisées et pour les malades chroniques, mais que celle-ci devra faire l'objet d'une évaluation permanente afin que la solidarité demeure un principe acceptable et supportable pour tous.
Dans ses réponses, M. le ministre, tout en admettant que le montant maximum à facturer n'est pas la formule miracle, estime qu'il ne permettra pas de répondre à toutes les attentes des patients. Il a fait valoir que le texte constituait une première étape par laquelle certaines prestations sont rassemblées et comptabilisées dans un nouveau système de franchise.
Le problème ne réside pas dans l'affectation d'un budget mais surtout dans la détection, d'une manière conforme à la justice sociale, des véritables besoins en soins de santé et pour y faire face ensuite, dans un instrument qui fonctionne de manière adéquate.
M. le ministre a fait observer que la justice sociale se mesure à la manière dont l'autorité intervient vis-à-vis des plus défavorisés et que la sélectivité du montant maximum à facturer est plus graduelle, en quelque sorte moins brutale que celle qui avait été instaurée antérieurement par les franchises sociale et fiscale.
En ce qui concerne le droit au maximum à facturer dans le chef des travailleurs indépendants, le ministre a renvoyé à la réforme envisagée de leur statut social. Son option est que ces travailleurs doivent être intégrés dans le régime général de l'assurance, de façon à recevoir la même protection pour les petits risques. Dans l'état actuel des choses, si le travailleur indépendant a souscrit une assurance complémentaire, les tickets modérateurs acquittés pour les gros risques et les petits risques sont pris en compte pour déterminer les plafonds applicables. Par contre, la dispense de la quote-part personnelle du bénéficiaire ne vaut, dans le chef des indépendants, que pour les prestations de l'assurance obligatoire "soins de santé".
L'âge limite de l'enfant — soit 16 ans — pour l'application de la protection particulière a été fixé compte tenu d'impératifs budgétaires, mais aussi en raison du fait que cet âge coïncide, en médecine pédiatrique, avec le passage de l'enfance à l'âge adulte.
Par ailleurs, le ministre a bien expliqué que les catégories sociales pour lesquelles il n'y avait pas de contrôle du revenu dans le cadre de la franchise sociale, ne bénéficieront plus automatiquement du maximum à facturer déterminé en fonction de la catégorie sociale.
La philosophie du projet de loi réside dans le fait que le mécanisme est applicable, non pas tellement parce que le bénéficiaire est chômeur, invalide, pensionné ou handicapé, mais surtout parce que ce bénéficiaire ne possède que de faibles revenus. Par exemple, les bénéficiaires d'une allocation d'intégration — les catégories 3 et 4 — profitent d'une neutralisation importante des revenus de leur conjoint ou de leur partenaire: un abattement de 700.000 francs. Le contrôle classique des revenus est donc fortement réduit, ce qui explique la portée de l'article 37 nonies.
Le contrôle du revenu opéré par les mutualités s'effectuera à l'instar du contrôle exercé à l'égard des bénéficiaires de l'intervention majorée de l'assurance "soins de santé", d'abord sur la base d'une déclaration sur l'honneur des bénéficiaires et ensuite sur la base des renseignements qui seront fournis par l'administration fiscale. Dans l'hypothèse où au sein d'un même ménage, les personnes sont assignées à des organismes assureurs différents, celui d'entre eux auprès duquel est affiliée la personne la plus âgée gérera le dossier sur la base des informations transmises par les autres organismes assureurs.
Ni l'octroi du maximum à facturer, ni les montants remboursés en vertu de ce système ne sont limités par l'intervention financière éventuelle d'une assurance complémentaire. Les personnes morales qui offrent de telles assurances seront toutefois informées, conformément à l'article 3 du présent projet, au sujet des remboursements dont auront bénéficié leurs assurés.
Enfin, le ministre a répondu à toute une série de questions ponctuelles. Il a évoqué divers problèmes particuliers et il a fourni, par ailleurs, le détail du calendrier de la mise en oeuvre du nouveau système, ainsi qu'une liste des prestations de santé qui seront prises en compte dans la nouvelle franchise. Cette liste se trouve dans le rapport.
De nombreuses questions ont été posées, notamment par M. Goutry, en ce qui concerne la portée ou la compréhension technique de certaines dispositions. Des corrections légistiques ont été apportées et quelques amendements ont été adoptés par notre commission. Je renvoie à ce sujet au rapport écrit. L'ensemble du projet de loi, tel qu'amendé et corrigé, a été adopté par 7 voix et 2 abstentions.
Après vous avoir lu ce rapport, monsieur le président, je souhaiterais faire une brève intervention au nom du groupe socialiste. Bien que la liaison entre revenu et niveau de la couverture sociale des soins de santé soit contraire au principe de base de l'assurance sociale qui veut que chacun cotise selon sa capacité contributive mais reçoit les prestations selon ses besoins, donc sans discrimination sur la base des revenus, notre groupe soutient ce projet de loi qui revêt une grande importance en ce qui concerne l'accessibilité aux soins pour l'ensemble de notre population, en particulier pour les catégories à faibles revenus et les malades chroniques.
En commission, j'ai parlé d'un mal nécessaire, mais je reprendrai également les propos de notre collègue Wauters à ce sujet, qui a très bien rappelé en commission que la sélectivité en faveur des groupes cibles est importante et que la solidarité entre les différents revenus socioprofessionnels l'est tout autant, mais qu'il conviendra aussi de surveiller l'évolution de la nouvelle franchise, afin qu'elle demeure acceptable et soutenable pour tous. J'ajouterai que c'est là une exigence fondamentale si nous voulons éviter tout risque de désolidarisation par rapport à un système sélectif qui comporte un danger toujours possible de surconsommation. Un système aussi complexe que celui qui nous est présenté aujourd'hui ne peut pas d'emblée être parfait. Il conviendra tout d'abord de le mettre en oeuvre sur le plan pratique et, ensuite, de l'évaluer, de l'affiner et d'en éliminer les effets pervers ou discriminatoires.
Nous voyons globalement quatre avantages à l'introduction du maximum à facturer dans l'assurance-maladie.
1° Les interventions personnelles dans les frais de santé qui seront comptabilisées dans le maximum à facturer sont bien plus larges qu'elles ne l'étaient avec les mécanismes de franchise sociale et fiscale et ce, sans différenciation selon que la personne appartienne à une catégorie déterminée, à un ménage disposant de revenus modestes ou à un ménage auquel aucun des deux critères ne peut s'appliquer.
2° On se rapproche d'une égalité effective entre des ménages se trouvant dans des situations sociales comparables. En effet, la garantie existe qu'un ménage à revenus faibles ou modestes sera rapidement remboursé, ce qui n'était pas le cas auparavant, puisque le bénéfice de la franchise sociale n'était réservé qu'à des catégories sociales bien précises.
3° Le passage de la notion de ménage mutualiste à celle de ménage réel offre une protection plus efficace, étant donné que c'est l'ensemble des quotes-parts personnelles de tous les membres du ménage qui sera, désormais, comptabilisé.
4° Enfin, dernier atout de cette réforme, une protection particulière pour les enfants de moins de 16 ans, indépendamment du montant des revenus de la cellule familiale dont ils font partie. Au XXIème siècle, il est en effet inacceptable que des familles soient confrontées à de très lourdes charges financières pour assurer les soins indispensables à leur enfant malheureusement atteint de maladie grave.
En conclusion, le principe qui sous-tend le projet de loi est de répondre à la justice sociale en détectant avant tout les besoins prioritaires en soins de santé et en les plaçant dans un nouvel instrument dont l'évaluation future nous dira quels sont ses atouts mais peut-être aussi ses faiblesses.
Sur cette base, le groupe socialiste soutiendra, bien entendu, ce projet de loi.

Mr. Speaker, Mr. Ministers, Mr. Colleagues, the bill on the maximum amount to be charged in healthcare insurance is an important bill that we discussed in our meetings of the Social Affairs Committee of 27 March and 17 April 2002.
In his introductory explanation, the Minister of Social Affairs first recalled that the health insurance in our country has as its primary objective to offer the whole population protection against the cost of disease. by
Although special measures have been taken over the years to ensure better access to health care for insured persons in certain social and financial conditions, these measures have not prevented that still regularly, the disease may lead a household into significant or even insurmountable financial difficulties.
Two risk groups should be given special attention: the so-called chronic patients and their families, as well as all households that, escaping the social categories defined by the law, are nevertheless faced with significant health costs with insufficient income to cope with them. by
It was therefore important to provide for a significant measure that would provide faster and stronger protection to the households that need it most. This is the purpose of this bill, the maximum to be charged. A first step was made in 2001 by extending the benefit of the social exemption and tax exemption to essential medicines, i.e. categories A and B.
The basic principle of the maximum to be charged is the establishment of a limit to the health expenses that a household must bear. If this limit is exceeded, the insurer grants an intervention equal to 100%. The spending threshold is set according to household income and the personal interventions that are accounted for are the same for all income categories. by

The proposed provisions shall take effect on 1 January 2002. It should be noted that for households with incomes below 13,730 euros, the maximum to be invoiced will be applied at the beginning of 2002 for the benefits made in 2001.
There were many speeches during the general discussion. I will repeat some of the most significant ones. Ms. De Block and Cahay expressed their desire that the discussions that will take place in June next in the framework of the Round Table of Social Solidarity enable a timetable for the integration of the small risks faced by self-employed workers in the mandatory health care insurance.
Underlining that the health care provided to children with chronic disease cannot be linked to the income of the parents, the two speakers welcomed the special protection that the bill tends to introduce in relation to children.
Our colleague Luc Goutry expressed his support for the bill because this text, he said, is part of the continuity of a previously initiated policy regarding access to health care and the special attention that should be paid to chronically ill people and households with low or modest incomes. by
However, in relation to the contributions paid by all workers and in relation to the selectivity that the maximum to be billed introduces in the system, the interviewer was concerned about the current and future financing of the said system, but also about the risk of a desolidarization by the part of higher incomes and that of a growing disresponsibility of patients.
With regard to the benefits that are accounted for in the maximum invoice and the people who belong or not to one or another of the social categories defined by the project, our colleague Goutry asked various questions and questioned the illogical or even discriminatory nature of the system. This is the case, according to the speaker, of the distinctions operated according to the age of the child and the exclusion, on the basis of article 37, 9° of the bill, of beneficiaries of an integration allowance belonging to categories 3 and 4 of the maximum to be billed determined according to the social category.
Ms. Genot stressed that the ceiling on healthcare costs, if it is useful and necessary, does not exhaust the debate on accessibility issues. In fact, moderator tickets would account for only one-third of household spending on health care.
Furthermore, the question of controlling the use of the franchise must arise first and foremost in terms of liability of the service providers.
Considering that the system proceeds from a generous intention, Mr. Valkeniers expressed some concerns about the proper implementation of the system, both by patients and providers.
by Mr. Bellot, on the other hand, questioned the link between the mechanism of the maximum to be charged and that of supplementary health insurance.
Your rapporteur expressed satisfaction with the implementation of a mechanism that enhances access to care for the whole population. Given the problem of delayed care in our country, increased selectivity is a necessary evil, in a context where the means of insurance are and will always be limited.
Finally, my colleague Mr. Wauters, chairman of the committee, concluded the general discussion by stating that the proposed text meets one of the most important challenges of this legislature. The speaker considers that selectivity is necessary, especially for the most precarious categories and for chronic patients, but that it will need to be subject to continuous evaluation so that solidarity remains an acceptable and tolerable principle for all.
In his answers, Mr. The Minister, while admitting that the maximum amount to be billed is not the miracle formula, believes that it will not allow to meet all patient expectations. He argued that the text constituted a first step by which certain benefits are collected and accounted for in a new franchise system.
The problem lies not in the allocation of a budget but above all in the detection, in a manner consistent with social justice, of the real needs in health care and to meet them then, in an instrument that works properly.
by Mr. The Minister noted that social justice is measured by the way in which the authority intervenes towards the most disadvantaged and that the selectivity of the maximum amount to be invoiced is more gradual, somehow less brutal than the one that was previously established by social and tax exemptions.
Regarding the maximum right to invoice in the head of self-employed workers, the minister referred to the planned reform of their social status. Its option is that these workers must be integrated into the general insurance scheme, so that they receive the same protection for small risks. In the current state of affairs, if the self-employed has subscribed to a supplementary insurance, the moderators tickets paid for large and small risks are taken into account in determining the applicable ceilings. On the other hand, the exemption from the beneficiary's personal quota-part only applies, in the head of the self-employed, for the benefits of the compulsory insurance "health care".
The child’s limit age — i.e. 16 years — for the application of special protection has been fixed taking into account budgetary imperatives, but also because this age coincides, in pediatric medicine, with the transition from childhood to adulthood.
In addition, the Minister explained that social categories for which there was no income control within the framework of the social franchise, will no longer automatically benefit from the maximum to be billed determined according to the social category.
The philosophy of the bill is that the mechanism is applicable, not so much because the beneficiary is unemployed, disabled, retired or disabled, but mostly because this beneficiary only has low incomes. For example, beneficiaries of an integration allowance — categories 3 and 4 — benefit from a significant neutralization of their spouse or partner’s income: a discount of 700,000 francs. The conventional control of income is therefore heavily reduced, which explains the scope of Article 37 nonies.
The revenue control operated by the mutualities will be carried out in the same way as the control exercised with respect to the beneficiaries of the increased intervention of the health insurance, first on the basis of a declaration on the honor of the beneficiaries and then on the basis of the information that will be provided by the tax administration. In the event that within the same household, persons are assigned to different insurance organizations, the one of them to which the elderly person is affiliated shall manage the file on the basis of the information transmitted by the other insurance organizations. by
Neither the granting of the maximum to be invoiced nor the amounts reimbursed under this scheme shall be limited by any financial intervention of a supplementary insurance. Legal persons offering such insurance shall, however, be informed, in accordance with Article 3 of this draft, of the refunds received by their insured.
Finally, the Minister answered a whole series of punctual questions. He addressed various particular issues and provided, in addition, details of the timetable for the implementation of the new system, as well as a list of health benefits that will be taken into account in the new franchise. This list is in the report.
Many questions have been asked, ⁇ by Mr. Goutry, as regards the scope or technical understanding of certain provisions. Legal corrections have been made and some amendments have been adopted by our committee. I refer to this in the written report. The entire draft law, as amended and corrected, was adopted by 7 votes and 2 abstentions.
After reading this report, I would like to make a brief speech on behalf of the Socialist Group. Although the link between income and level of social coverage of healthcare is contrary to the basic principle of social insurance that means that everyone contributes according to their contributive capacity but receives benefits according to their needs, so without discrimination on the basis of income, our group supports this bill which is of great importance in terms of accessibility to care for the whole of our population, especially for low-income categories and chronically ill.
As a committee, I spoke of a necessary evil, but I will also take back the words of our colleague Wauters on this subject, who very well recalled in committee that the selectivity in favor of target groups is important and that the solidarity between the different socio-professional income is equally, but that it will also be appropriate to monitor the evolution of the new franchise, so that it remains acceptable and sustainable for all. I would add that this is a fundamental requirement if we want to avoid any risk of desolidarization compared to a selective system that carries a always possible risk of overconsumption. A system as complex as the one presented to us today cannot be perfect at first. It will first need to be implemented in practice and then evaluated, refined and eliminated its perverse or discriminatory effects. by
We see overall four advantages to the introduction of the maximum to be charged in health insurance.
Personal interventions in health expenses that will be accounted for within the maximum to be billed are much wider than they were with the mechanisms of social and tax exemption and this without differentiation according to whether the person belongs to a certain category, to a household with modest income or to a household to which neither of the two criteria can be applied.
Approaching effective equality between households in comparable social situations. Indeed, the guarantee exists that a household with low or modest incomes will be quickly reimbursed, which was not the case before, since the benefit of the social franchise was reserved only to very specific social categories.
The transition from the notion of mutual household to the notion of real household provides more effective protection, given that it is the set of personal quotas of all members of the household that will now be accounted for.
Finally, the last asset of this reform, a special protection for children under the age of 16, regardless of the amount of income of the family cell of which they are part. In the twenty-first century, it is indeed unacceptable for families to face very heavy financial burdens to ensure the essential care for their unfortunately seriously ill child.
In conclusion, the principle underlying the bill is to respond to social justice by first of all detecting the priority health care needs and placing them in a new instrument whose future evaluation will tell us what its strengths are but ⁇ also its weaknesses.
On this basis, the Socialist group will, of course, support this bill.

Mijnheer de voorzitter, mijnheer de minister, collega's, ik wil uiteraard eerst namens onze fractie de verslaggever, de heer Delizée, danken voor het uitgebreide en objectieve verslag dat hij gebracht heeft van deze belangrijke werkzaamheden, namelijk de bespreking van de maximumfactuur. Tevens wil ik de commissievoorzitter en de collega's van de commissie danken omwille van de nodige aandacht en de tijd die werd vrijgemaakt om samen over dit belangrijk ontwerp te kunnen debatteren. Ik denk dat we dat uitvoerig hebben kunnen doen zoals dit hoort bij zo'n technisch ontwerp en ik wil de collega's danken voor hun luisterbereidheid.
Ondanks onze waakzame en kritische interventie steunen wij uiteraard het systeem van de maximumfactuur. Het mechanisme dat daarachter steekt moet er immers voor zorgen dat de kosten voor mensen die kwetsbaar zijn op het vlak van de gezondheidszorg worden geplafonneerd, zodat zij niet bestaansonzeker zouden worden door de toename van de hoeveelheid kosten. Een dergelijk systeem, een dergelijk mechanisme van franchise om de kosten vast te leggen op een bepaald maximumbedrag steunen wij. Dat is evident. Dat is trouwens een voortzetting van hetgeen in de vorige legislatuur — dat mag toch ook even worden gezegd — in het leven werd geroepen of werd uitgedokterd, met name de sociale en de fiscale franchise. Wij hebben daaraan toen in de commissie voor de Sociale Zaken ook veel aandacht besteed en zijn erin geslaagd een revolutionair model van sociale en fiscale franchise in het leven te roepen. Wat de fiscale franchise betreft wordt altijd met terugwerkende kracht een toets gedaan naar het inkomen van de mensen om na te gaan of de kosten die zij hebben op vlak van medische verzorging niet te groot worden in verhouding tot hun inkomen. Met de sociale franchise had men eigenlijk al hoofdzakelijk dezelfde doelgroepen voor ogen als nu met de maximumfactuur. Op dat vlak is er eigenlijk niet zoveel veranderd. De sociale franchise dateert al van de vorige legislatuur na samen met de socialistische collega's en onder impuls van mevrouw De Galan verscheidene malen te hebben vergaderd op het kabinet. Het initiatief werd gesteund door de toenmalige coalitiepartners.
Het is ook een regeling die tot hiertoe veel vruchten heeft afgeworpen. Ik denk dat de sociale franchise veelvuldig is gebruikt en veelvuldig haar nut heeft bewezen bij de mensen. Veel mensen worden toch een beetje beschermd tegen de overspoeling van de hoge kosten die zij hebben wanneer hun ziekte chronisch en langdurig wordt en wanneer de cumulatie van kosten toeneemt.
Niettegenstaande deze positieve benadering van dit mechanisme zullen wij ons bij de stemming over de tekst van het ontwerp toch onthouden. Wij doen dat, niet omdat we tegen het systeem, tegen het mechanisme van de maximumfactuur zijn, maar omdat het wetsontwerp een aantal mankementen en tekorten vertoont die wij tijdens de discussie in de commissie hebben toegelicht. Wij hebben terzake trouwens ook amendementen ingediend. U zult merken, collega's, dat wij voor de stemming straks drie amendementen hebben gehandhaafd. Wij hebben veel meer amendementen ingediend, maar wij hebben een goede bespreking gehad. De minister heeft een aantal keren de opmerkingen die wij bij amendement hadden overgemaakt voldoende kunnen weerleggen. Op drie principiële punten willen wij onze amendementen echter handhaven.
In de toekomst zullen wij, samen met heel wat sociaalvoelende leden in dit halfrond die ook actief zijn in de commissies, vragende partij zijn voor de totstandkoming van een efficiënt systeem van kostenonderdrukking voor kwetsbare groepen. De minister hanteerde het systeem dat van toepassing is bij de sociale franchise. Enerzijds zijn er bepaalde groepen die sowieso deze regeling genieten omdat zij, wegens het feit dat ze onder het statuut van de voorkeursregeling vallen, een inkomenscontrole ondergingen waarbij werd bewezen dat zij kwetsbaar zijn op het vlak van hun inkomen, maar risicodragend wat de kosten betreft. Zij behoren immers tot de groep van de WIGW's. Anderzijds zijn er de personen met een beperkt inkomen voor wie de teller van de kosten afslaat vanaf een bepaald inkomen — hetzij 18.000 Belgische frank, hetzij 26.000 Belgische frank.
Hoewel wij het mechanisme steunen hebben wij een aantal opmerkingen ten gronde met betrekking tot het ontwerp en om die reden zullen wij ons bij de stemming onthouden.
Mijnheer de minister, zoals ik reeds zei in de commissie zullen wij goed moeten evalueren wie precies wordt geholpen met dit systeem. De doelgroepen werden weliswaar afgebakend en uiteraard houden wij er veronderstellingen op na, maar eigenlijk is het tot op heden nog steeds niet helemaal duidelijk welke groepen precies zullen worden geholpen. Het ware aangewezen dit goed te registreren en terzake statistieken te maken teneinde te kunnen aantonen dat het systeem van de maximumfactuur wordt toegepast op de meest kwetsbare doelgroepen, zoals bedoeld.
Inderdaad, rekening houdend met de reacties terzake uit allerlei hoeken krijg ik een vaag onbehaaglijk gevoel. Sommige personen lieten weten dat zij, ondanks het systeem van de maximumfactuur en de diverse systemen van opvang van problemen bij chronische zieken en dergelijke en ondanks het feit dat zij geen genereus inkomen genieten, toch uit de boot vallen. Eigenlijk zouden zij het naar eigen zeggen met hun inkomen nog kunnen redden, maar door de opstapeling van de kosten en door het feit dat zij precies buiten het toepassingsveld van de systemen vallen die als een ketting aan elkaar aansluiten — het ene statuut geeft automatisch recht op het andere — komen zij in de problemen terecht. Mochten zij dan hun kosten samentellen, dan zouden deze hoog oplopen. Aangezien de fiscale franchise voor betrokkenen later in actie treedt en wordt gekoppeld aan hun inkomen, biedt dit evenmin een oplossing voor de hoge kosten.
Men moet durven vooruitlopen. Dit systeem is bij wijze van spreken een proefsysteem dat nog goed moet worden geëvalueerd. Wij zullen vooral moeten opletten dat er geen vals gevoel van veiligheid wordt gecreëerd en wij mogen niet de inruk hebben alles te hebben geregeld.
Ik begrijp uw fierheid over dit systeem, mijnheer de minister, al wil ik dat meteen wat relativeren aangezien het een uitvloeisel is van de sociale franchise en bijgevolg geen gloednieuwe uitvinding. Hoe dan ook, u leverde grote inspanningen terzake en ik begrijp ook uw enthousiasme, maar tegelijk waarschuw ik u ervoor om dit systeem niet aan te wenden als een passe-partout-oplossing voor alle problemen. Immers, al te vaak worden de zaken aldus voorgesteld dat het systeem van de maximumfactuur een oplossing zal bieden voor elkeen die uit de boot valt.
Via mijn tweede opmerking wil ik waarschuwen voor te hoge verwachtingen. Thans wordt een bedrag van afgerond 3 miljard Belgische frank uitgetrokken als eerste subsidiëring van het systeem, maar dat betekent slechts een fractie van het totaal aan medische kosten. De medische kosten die in ons land door de patiënten uit eigen zak worden betaald belopen 450 miljard Belgische frank; de remgelden — de persoonlijke opleg — van terugbetaalbare middelen bedragen 150 miljard frank.
Daarvan gaat 2% of 3 miljard Belgische frank naar de maximumfactuur. Dat is op een bedrag van 450 miljard een peulenschil, maar op een bedrag van 150 miljard aan remgeld kan dat substantieel zijn. Er zijn immers heel wat remgelddragers die de extra bescherming niet nodig hebben. Wij moeten wel waakzaam zijn. Vandaar mijn vraag: is de 3 miljard waarin nu is voorzien, ook de limiet? Moeten we het daarmee doen? Als we het systeem niet kunnen volhouden, zullen er dan knipperlichten gaan branden, zoals bij de andere uitgaven in de ziekteverzekering? Zullen wij dan moeten nagaan hoe we het systeem kunnen beheren of zijn de knipperlichten voor u eerder een aansporing om te besluiten dat wij de kosten, op basis van simulaties, te laag hebben ingeschat? Bent u dan bereid om die bedragen aan te passen? Bent u bereid om in de toekomst meer middelen uit te trekken — als het nodig zou blijken — om ons systeem goed te laten werken? Dat is de fundamentele vraag die ik aan u wil voorleggen, mijnheer de minister.
Collega's, ik heb nog een derde opmerking. De minister heeft in dit verband in de commissie al een aanzet gegeven. Wij hebben het debat weliswaar niet echt uitgesponnen. Ik nodig u uit, mijnheer de commissievoorzitter, om te gelegener tijd de discussie over de solidariteit versus de verzekering aan te gaan. De sociale zekerheid is een uitstekend voorbeeld van een systeem waarin wij genereus zijn bij het herverdelen van de middelen. Mensen met een groot inkomen voeden het systeem uitermate genereus, terwijl zij er zelf weinig aanspraak op maken. Mensen die het systeem helemaal niet meer kunnen voeden, kunnen er wel in belangrijke mate van profiteren. Dat is een moeilijke evenwichtsoefening. We moeten altijd oog blijven hebben voor een zekere evenwichtige verhouding. In alle debatten over de hervorming van de sociale zekerheid en in zowat alle politieke fracties was men het erover eens dat het niet alleen een systeem van solidariteit is, maar ook een verzekering. Daarom spreken we over sociale zekerheid. Als het een systeem van verzekering is, collega's, dan moeten wij ook een link leggen tussen de premie en de uitkering. De modale gezinnen, de tweeverdieners die allebei hun bijdrage aan het systeem storten en er hopelijk zo weinig mogelijk gebruik van moeten maken, dragen toch zeer solidair bij aan het systeem. Wij moeten opletten dat wij geen systeem creëren waarin de selectieve bijstand overmatig wordt. Wij staan achter het uitgangspunt. Chronische zieken en kwetsbare mensen moeten worden geholpen. De vraag is of we dat met het systeem van sociale zekerheid kunnen realiseren of moeten wij andere vormen van solidariteit zoeken om een en ander te kunnen beheersen?
Ik verwijs naar de Vlaamse zorgverzekering, naar het systeem waarbij het inkomen van bejaarden met een beperkt pensioen wordt verhoogd, naar het systeem van inkomensvervangende tegemoetkomingen, naar het kostendekkend systeem van integratietegemoetkomingen, naar het systeem van het Vlaams Fonds — waarbij een aantal tussenkomsten kunnen worden verkregen — en naar het solidariteitsfonds in het RIZIV. Wij moeten ons behoeden voor teveel "covering", het ene boven het andere systeem, niet alleen vanwege de complexiteit, maar ook om een Matteüs-effect te vermijden. Ik spreek over een effect waarbij enerzijds het inkomen verhoogt en anderzijds de kosten beter worden gedekt. In zo'n systeem bestaat het gevaar op overdekking van bepaalde personen, terwijl de risico's bij degenen die juist buiten de regeling vallen, op een andere manier worden gedekt. Ik denk daarbij aan de modale burgers, die tenslotte het systeem van de sociale zekerheid moeten voeden.
Ik steek hier een beetje mijn nek uit. Ik weet dat het moeilijke debatten zijn, maar wij moeten ervoor opletten dat wij niet in een verhaal geraken zoals bij de migranten. Wie dat systeem ter discussie durft te stellen, wordt bijna onmiddellijk aan de muur gespijkerd als zijnde iemand waarmee niet wordt gediscussieerd of als iemand met een bepaalde visie. De solidariteit is zo kwetsbaar dat we het debat terzake voortdurend moeten blijven voeren. Wij mogen niet teveel sluiks van alles aan die algemene solidariteit blijven toeschuiven, zonder goed te weten waar we willen uitkomen.
Mijnheer de minister, mijnheer de commissievoorzitter, ik dring erop aan dat wij het debat over de eventuele blinde vlekken gaande houden. Ik denk aan het feit dat sommige groepen zeer goed tegen toekomstige risico's worden ingedekt, terwijl op bepaalde kruispunten blinde vlekken ontstaan, omdat andere groepen buiten de regeling vallen. Ik heb het over degenen die door het kettingsysteem buiten alle regelingen vallen en daardoor in de problemen terechtkomen. Collega's, we weten dat de sociale zekerheid in de toekomst veel middelen zal nodig hebben en blijven nodig hebben onder meer omwille van de verlaagde activiteitsgraad, de verhoogde uitkeringen, brugpensioenen. Wat hierover ook moge gezegd worden, de druk blijft zwaar. De cijfers van de RVA en het plan voor de werkgelegenheid in het licht van de Europese richtlijn bewijzen dat. We zullen veel geld nodig hebben ook voor de problemen die samenhangen met de vergrijzing. Er zal geld nodig zijn om de rusthuizen betaalbaar te maken en de pensioenen te verhogen. Dit zijn uitdagingen die op ons af komen. We zullen er moeten voor zorgen dat we dit allemaal kunnen blijven betalen in een solidair systeem.
Na de discussie in de commissie over het voorstel van mevrouw Avontroodt dat ertoe strekte ziekenfondsen te verplichten gegevens uit te wisselen aan privé-verzekeraars was ik zeer verheugd dat de voltallige commissie van geen privatisering in de sociale zekerheid wil weten maar absoluut een solidair systeem wenst te behouden dat voor iedereen toegankelijk, betaalbaar én performant is. Dat is een moedige houding. Het siert het democratisch parlement dit te doen. Als oppositiepartij zal de CD&V haar volle steun hieraan verlenen.
Mijnheer de minister, ik wens een bedenking te maken naar aanleiding van de actie van Ziekenzorg-CM "5 voor 12". We moeten ons de vraag durven stellen op welke manier we zo performant als mogelijk kunnen werken. Wat we op dit ogenblik doen is corrigeren aan de uitgavenzijde. Mensen hebben onkosten omwille van hun medische toestand. De onkosten stapelen zich op. Op een bepaald ogenblik wordt ingegrepen, de kosten worden niet langer ten laste van de betrokkenen gelegd maar ten laste van de gemeenschap. Tegelijkertijd moet men, mijns inziens, ook denken aan inkomensverhogende maatregelen. Op die manier krijgen mensen die kwetsbaar zijn zelf een grotere draagkracht zodat ze minder snel aan de limiet van hun mogelijkheden komen inzake de opstapeling van de kosten. Als de eisen van Ziekenzorg zouden worden uitgevoerd en het inkomen van de alleenstaande invaliden substantieel verhoogd wordt, het inkomen van de gezinshoofden-invaliden wordt beschermd en het partnerinkomen wordt aangepast zodat men minder snel terugvalt op een lagere uitkering, doen we aan belangrijke preventie niet alleen voor degenen die kosten lijden maar voor iedereen die wordt geconfronteerd met invaliditeitsproblemen. Ik hoop dat we ons niet zullen verschuilen achter de MAF. Op dit ogenblik houdt u de boot van de inkomensverhogende maatregelen af. U verwijst naar initiatieven die wel gerealiseerd worden zoals de MAF, de cumulatie van bepaalde vormen van tewerkstelling. Dit mag ons niet in slaap wiegen. We mogen er niet van uitgaan dat de MAF voldoende is en dat inkomensverhogende maatregelen kunnen wachten. Integendeel, dit moet een grote prioriteit worden. Mensen met een inkomen van 34 tot 36.000 frank per maand zijn onmogelijk in staat om een huishouden te runnen als ze in hun verdienvermogen beknopt zijn omdat ze niet kunnen werken of ziek zijn.
Mijn vierde punt handelt over het belang van de tariefakkoorden voor de toekomst. Het systeem van de maximumfactuur stoelt op objectieve remgelden, bewijsbare bedragen met een maximumbedrag. Er moeten tarieven zijn. Zo niet, betaalt men zich blauw en is het bedrag van de maximumfactuur ontoereikend. U hebt in de commissie gesteld dat u deze tariefakkoorden erg belangrijk vindt. Ik wil beklemtonen dat het zeer belangrijk is dat dergelijke tariefakkoorden ook in de toekomst worden afgesloten. Op dit ogenblik is dat niet evident. Ik verwijs onder meer naar de kinesisten waarvan een groot deel niet bereid is tot de conventie toe te treden en naar artsen die — gepast of ongepast, ik laat dit in het midden, dikwijls als chantagemiddel maar dikwijls ook uit nood — dreigen met het opblazen van conventies. Dergelijke conventies zijn zeer belangrijk voor de toekomst.
Een laatste bemerking, collega's, gaat over de doelgroepen. Men zegt dat het een genereus systeem is, dat het de bedoeling is voor een echt vangnet te zorgen voor kwetsbare mensen door kostenopstapeling te vermijden en zo voor deze mensen geen bestaansonzekerheid te creëren; Ik noem het een gemiste kans, een discriminatie, onbegrijpelijk dat men dan plots arbitrair twee categorieën uitsluit. Ik heb in de commissie hemel en aarde bewogen om op dat vlak aanpassingen door te voeren en tot een beter systeem te komen. Ik heb trachten te bewijzen, mijnheer de minister, dat de logica zoek is wanneer u de categorieën 3 en 4 uitsluit. Het gaat hier om mensen die iets toegestopt hebben gekregen, maar het gaat niet om velen. Ik heb de cijfers onlangs opgevraagd en het gaat slechts om een paar duizend mensen. Indien zij worden uitgesloten, zullen zij het niet zijn die het land in rep en roer zullen zetten. Het is een beetje symbolisch dat kwetsbare groepen worden geviseerd, namelijk mensen van categorieën 3 en 4. De betrokkenen hebben vaak vele punten — meer dan 12 of 15 punten — en zij hebben een groot gebrek aan zelfredzaamheid. Het zou kunnen dat enkelen onder hen in staat zijn om een relatie te vormen en te gaan samenwonen met een partner die ook een integratietegemoetkoming heeft. Wij gaan nu zeggen dat deze mensen al goed bij kas zitten, dat wij al een inkomenstoets hebben gedaan en dat wij ze dus uit het systeem stoten. Hoewel het misschien gaat om slechts eenderde van hen, toch zou eenderde van deze paar duizend mensen niet meer kunnen toetreden tot het systeem, God weet om welke reden. Wees eens eerlijk: wij hebben geen afdoend antwoord gekregen, tenzij het principe dat het nu eenmaal zo is en zo zal zijn.
Mijnheer de minister, ik heb u gepareerd door te vragen wat u dan doet met de mensen die een vrijstelling krijgen van 500.000 Belgische frank als zij hun tegemoetkoming combineren met een inkomen of loon. Zij zullen het systeem van de maximumfactuur blijven genieten, terwijl de mensen die ik hiervoor heb vernoemd, geen beroep meer kunnen doen op dat systeem. Mensen die een tegemoetkoming genieten van 500.000 Belgische frank kunnen, zelfs als zij één frank hebben, reeds onder het systeem vallen, al voldoen ze perfect aan de regeling van de maximumfactuur, terwijl diegenen van categorie 3 en 4, omdat zij al een zogenaamde prijs der liefde gekregen hebben, geen tweede keer langs de kassa mogen passeren. Wij zeggen gewoon, wij sluiten jullie uit.
Mijnheer de minister, ik begrijp u nog minder wat de verhoogde kinderbijslag betreft. Ik zag u daarstraks non-verbaal reageren en ik begreep dat niet zo goed, omdat ik daarover altijd een consistent standpunt heb ingenomen. Hoe zult u kunnen duidelijk maken dat kinderen waarvoor nu al een verhoogde kinderbijslag wordt uitgekeerd, de gelukkigen zijn die zich zullen kunnen beroepen op een verworven recht. Zij zullen verder onder het systeem vallen, terwijl de kinderen die na de publicatie van de wet het slachtoffer worden van een aandoening die recht geeft op een verhoogde kinderbijslag, uit het systeem zullen worden gesloten, onder het voorwendsel dat voor hen een nieuwe regeling zal worden uitgewerkt die voor hen kostendekkend zal zijn. Maar, dat geldt uiteraard even goed voor de eerste groep, waarvan wij zeggen dat daar het verworven recht meespeelt. Ik heb reeds dikwijls gezegd, ter gelegenheid van de bespreking van de tegemoetkoming aan mindervaliden, dat wij nooit meer discussies hebben gehad dan over verworven rechten. Ofwel erkent men dat er een recht is en dan moet het niet verworven zijn, dan is het gewoon een recht, ofwel vinden wij dat het recht niet meer verantwoord is, maar durven wij het niet afnemen en laten wij het zo. Wij willen daarvoor de nek niet uitsteken, wij doen alsof het recht vanzelf zal uitdoven, maar er mogen geen nieuwe gegadigden bijkomen. Zoiets kan men niet verdedigen en het zal op onbegrip stuiten en tot misverstanden leiden. Mensen zullen zich afvragen hoe dit mogelijk is, waarom zo een arbitraire beslissing wordt genomen, waarom zij onder die regeling vallen en iemand anders niet.
Ik heb daarom twee voorstellen gedaan, mijnheer de minister, en ik herhaal ze op deze tribune. Veel beter ware het op uw elan verder te gaan en ervoor te zorgen dat alle kinderen tot zestien jaar het systeem kunnen genieten — uiteraard ook gehandicapte kinderen met verhoogde kinderbijslag — en de kinderen vanaf zestien jaar uit te sluiten, hoewel wij daar eigenlijk ook geen begrip voor hebben.
Ofwel zegt men dat tot 16 jaar alle kinderen, uiteraard ook gehandicapte kinderen, in aanmerking komen voor verhoogde kinderbijslag en vanaf 16 jaar niemand meer, maar dan is het ook niemand meer. Dan is het voor iedereen gelijk. Er mag dan geen onderscheid worden gemaakt tussen degenen die een verworven recht hebben en de anderen. We moeten dan maar sleutelen aan andere systemen die ook kostendekkend zijn zoals de verhoogde kinderbijslag en dan moeten we zien dat we daar een afdoend antwoord kunnen geven want daar gebeurt een toets op basis van zelfredzaamheid.
Ofwel zegt men, als we bepaalde engagementen willen nakomen, dat men beter iedereen ouder dan 16 jaar die een verhoogde kinderbijslag geniet, want de anderen sluiten we uit, ervan verder laat genieten. Zij zullen er geen gebruik van maken als ze dat niet nodig hebben. Kinderen die mentaal gehandicapt zijn en weinig medische kosten hebben, vallen niet binnen de maximumfactuur. Zij hebben dat niet nodig. Daarom hebben we voorgesteld dat iedereen in het systeem blijft tot op het moment dat we aan de ouders en de kinderen kunnen bewijzen dat ons systeem van kinderbijslag beter is geworden en dan halen we via een eenvoudige wettelijke aanpassing al deze kinderen eruit. Dan kunnen we een afdoende oplossing aanbieden. Het was dus correcter om via een koninklijk besluit of een andere weg, hier duidelijk de categorieën te bepalen.
Dit zijn de belangrijkste opmerkingen vanuit onze fractie, de fractieleider zal me daarin ondersteunen. De eerste behandelen algemene principiële opmerkingen rond het systeem van de sociale zekerheid en rond het mechanisme van de maximumfactuur. Maar onze laatste twee opmerkingen zijn echt principieel, ze gaan ten gronde. Ze zijn van die aard dat ze discriminaties bestrijden. We zullen die aan de hand van drie amendementen straks verder bespreken.

Mr. Speaker, Mr. Minister, Colleagues, of course, first of all, on behalf of our group, I would like to thank the reporter, Mr. Delizée, for his comprehensive and objective report on this important work, namely the discussion of the maximum invoice. I would also like to thank the Chairman of the Commission and the colleagues of the Commission for the necessary attention and time allocated to discuss this important draft together. I think we have been able to do that extensively, as this belongs to such a technical design, and I want to thank the colleagues for their willingness to listen.
Despite our vigilant and critical intervention, we naturally support the system of the maximum invoice. The underlying mechanism must, in fact, ensure that the costs for people who are vulnerable in the field of health care are plafoned, so that they do not become insecure of subsistence due to the increase in the amount of costs. We support such a system, such a mechanism of franchise to fix the costs at a certain maximum amount. That is obvious. This, by the way, is a continuation of what in the previous legislature – that may be said for a moment – was brought into existence or learned out, in particular the social and fiscal franchise. We also paid much attention to this at the time in the Social Affairs Committee and succeeded in establishing a revolutionary model of social and fiscal franchise. With regard to the tax franchise, a check is always done with retroactive effect on people’s income to check whether the costs they have in terms of medical care do not become too large in proportion to their income. With the social franchise, one had essentially the same target groups as now with the maximum invoice. In fact, there hasn’t changed so much in that area. The social franchise dates back to the previous legislature after meeting several times in the cabinet together with the socialist colleagues and under the impulse of Ms. De Galan. The initiative was supported by the then coalition partners.
It is also a scheme that has so far yielded many fruits. I think the social franchise has been used frequently and has often proven its usefulness to the people. However, many people are somewhat protected from the flooding of the high costs they have when their illness becomes chronic and prolonged and when the accumulation of costs increases.
Despite this positive approach to this mechanism, we will still abstain from voting on the text of the draft. We do that, not because we are against the system, against the mechanism of the maximum invoice, but because the bill shows a number of shortcomings and shortcomings that we explained during the discussion in the committee. We have also submitted amendments in this regard. You will notice, colleagues, that we have ⁇ ined three amendments before the vote. We submitted many more amendments, but we had a good discussion. The Minister has been able to sufficiently refute several times the comments that we had submitted in the amendment. On three principled points, however, we would like to maintain our amendments.
In the future, together with many socially sensitive members in this hemisphere who are also active in the committees, we will be a calling party for the establishment of an efficient system of cost reduction for vulnerable groups. The Minister applied the system applicable to the social franchise. On the one hand, there are certain groups that benefit from this scheme anyway because, because they are covered by the status of the preferential scheme, they have undergone an income control demonstrating that they are vulnerable in terms of their income, but carrying risks in terms of costs. They belong to the group of the WIGWs. On the other hand, there are the persons with limited income for whom the cost counter deduces from a certain income — either 18,000 Belgian francs, or 26,000 Belgian francs.
Although we support the mechanism, we have a number of substantial comments regarding the draft and therefore we will abstain from voting.
Mr. Minister, as I said before in the committee, we will have to evaluate carefully who exactly is being helped with this system. The target groups were defined and of course we hold assumptions, but in fact it is still not quite clear which groups will be helped exactly. It would be appropriate to properly record this and produce statistics in order to demonstrate that the system of the maximum invoice is applied to the most vulnerable target groups, as intended.
Indeed, taking into account the reactions from all sorts of angles, I get a vague uncomfortable feeling. Some individuals informed that, despite the system of the maximum invoice and the various systems of accommodation of problems in chronic sick and the like, and despite the fact that they do not enjoy generous income, they still fall out of the boat. In fact, they would still be able to save it, as they say, with their income, but by the accumulation of costs and by the fact that they fall precisely outside the scope of the systems connected as a chain — one statute automatically gives right to the other — they fall into trouble. If they were to compute their costs, they would be high. Since the tax franchise for data subjects comes into effect later and is linked to their income, this also does not provide a solution to the high costs.
You have to dare to advance. This system is, by way of speech, a test system that needs to be properly evaluated. We must be especially careful that no false sense of security is created and we should not have the impression of having everything arranged.
I understand your pride in this system, Mr. Minister, although I would like to relieve it immediately, since it is a derivative of the social franchise and therefore not a brand new invention. Anyway, you made great efforts in this regard and I also understand your enthusiasm, but at the same time I warn you not to use this system as a passe-partout solution for all problems. After all, too often things are presented in such a way that the system of the maximum invoice will provide a solution for everyone who falls out of the boat.
In my second comment, I would like to warn you of excessive expectations. Currently, an amount of rounded 3 billion Belgian francs is allocated as a first subsidy of the system, but that means only a fraction of the total medical costs. The medical costs paid in our country by the patients from their own pockets amount to 450 billion Belgian francs; the brake fees — the personal imposition — of reimbursable funds amount to 150 billion francs.
Of this, 2% or 3 billion Belgian francs go to the maximum invoice. That’s at an amount of 450 billion a pearl shell, but at an amount of 150 billion in brake funds that can be substantial. After all, there are many brake money carriers that do not need the additional protection. We must be vigilant. Hence my question: is the 3 billion that is now provided also the limit? Should we do it with it? If we are unable to sustain the system, will flashing lights start to burn, as with the other expenses in health insurance? Should we then look at how we can manage the system or are the flashlights an incentive for you to decide that we have underestimated the costs, based on simulations? Are you willing to adjust these amounts? Are you willing to raise more resources in the future — if necessary — to keep our system working properly? That is the fundamental question I would like to ask you, Mr. Minister.
My colleagues, I have a third comment. The Minister has already given an initiative in this regard in the committee. We did not really extend the debate. I invite you, Mr. Speaker of the Commission, to initiate the discussion on solidarity versus insurance at some time. Social security is an excellent example of a system in which we are generous in redistributing resources. People with high incomes feed the system extremely generously, while they themselves make little claim to it. People who can no longer no longer feed the system can benefit considerably from it. This is a difficult balance exercise. We must always keep an eye on a certain balanced relationship. In all the debates on social security reform, and in almost all political groups, it was agreed that it is not only a system of solidarity, but also an insurance. That is why we are talking about social security. If it is a system of insurance, colleagues, then we must also link the premium and the benefit. The modal families, the two-payers who both deposit their contribution to the system and hopefully need to make as little use of it as possible, still contribute very solidally to the system. We must be careful that we do not create a system in which selective assistance becomes excessive. We stand behind the starting point. Chronically sick and vulnerable people need to be helped. The question is whether we can ⁇ that with the system of social security or should we seek other forms of solidarity to be able to control one and another?
I refer to the Flemish health insurance, to the system of increasing the income of elderly persons with a limited pension, to the system of income replacement benefits, to the cost-covering system of integration benefits, to the system of the Flemish Fund — where a number of interventions can be obtained — and to the solidarity fund in the RIZIV. We must beware of too much "covering", one above the other system, not only because of its complexity, but also to avoid a Matthew effect. I am talking about an effect that, on the one hand, increases income and, on the other hand, better covers costs. In such a system there is a danger of coverage of certain persons, while the risks in those specifically outside the scheme are covered in a different way. I think of the modal citizens, who must ultimately feed the social security system.
I pull my neck out a little here. I know that these are difficult debates, but we must be careful not to get into a story like the migrants. Anyone who dares to challenge that system is almost immediately stabbed to the wall as someone with whom it is not discussed or as someone with a certain vision. Solidarity is so fragile that we need to continue the debate on this subject. We must not continue to devote too much of everything to this general solidarity, without knowing exactly where we want to come out.
Mr. Minister, Mr. Chairman of the Commission, I urge that we continue the debate on the possible blind spots. I think of the fact that some groups are very well covered against future risks, while at certain crosspoints blind spots arise because other groups are outside the scheme. I’m talking about those who, due to the chain system, fall out of all arrangements and thus fall into the trouble. Colleagues, we know that social security in the future will need a lot of resources and will continue to need, among other things, because of the reduced activity rate, the increased benefits, bridge pensions. Whatever can be said about this, the pressure remains heavy. The figures of the RVA and the employment plan in the light of the European directive prove that. We will also need a lot of money for the problems associated with ageing. Money will be needed to make rest homes affordable and increase pensions. These are challenges that come upon us. We will have to ensure that we can continue to pay for all this in a solidary system.
After the discussion in the committee on Mrs. Avontroodt’s proposal to require health funds to exchange data with private insurance companies, I was very pleased that the whole committee wants to know that there is no privatization in social security but absolutely wants to maintain a solidary system that is accessible, affordable and performing for everyone. This is a courageous attitude. It is a pleasure for the democratic parliament to do this. As an opposition party, the CD&V will give its full support to this.
Mr. Minister, I would like to make a complaint in connection with the action of Ziekenzorg-CM "5 for 12". We must dare to ask ourselves how we can work as efficiently as possible. What we are doing right now is correcting on the spending side. People have costs because of their medical condition. The costs accumulate. At a certain point, the costs are no longer borne by the interested parties but by the community. At the same time, I think, we should also think about measures to increase incomes. In this way, people who are vulnerable will have a greater support for themselves, so that they are less quickly at the limit of their capabilities in terms of accumulation of costs. If the requirements of Health Care are implemented and the income of single disabled persons is substantially increased, the income of the head of family disabled persons is protected and the partner income is adjusted so that one falls back on a lower benefit less quickly, we will do important prevention not only for those who suffer costs but for everyone who is facing disability problems. I hope we will not hide behind the MAF. At this moment, you are holding off the boat of the income-increasing measures. You refer to initiatives that are being implemented such as the MAF, the cumulation of certain forms of employment. This should not make us fall asleep. We should not assume that the MAF is sufficient and that income-increasing measures can wait. On the contrary, this should become a big priority. People with an income of 34 to 36,000 francs per month are impossible to run a household if they are narrow in their earnings because they cannot work or are sick.
My fourth point is about the importance of tariff agreements for the future. The system of the maximum invoice is based on objective brake fees, proven amounts with a maximum amount. There must be tariffs. If not, you pay blue and the amount of the maximum invoice is insufficient. You have stated in the committee that you consider these tariff agreements very important. I would like to emphasize that it is very important that such tariff agreements are also concluded in the future. At the moment, this is not obvious. I refer, among other things, to the Chineseists, many of whom are unwilling to join the convention, and to the doctors who—appropriate or inappropriate, I leave this in the middle, often as a means of blackmail but often also out of need—threaten with blasting conventions. Such conventions are very important for the future.
One last note, colleagues, is about the target groups. It is said that it is a generous system, that it is intended to provide a real safety net for vulnerable people by avoiding cost accumulation and thus not creating existence uncertainty for these people; I call it a missed opportunity, a discrimination, incomprehensible that then one suddenly arbitrarily excludes two categories. I have moved heaven and earth in the committee to make adjustments in that area and to come to a better system. I have tried to prove, Mr. Minister, that logic is searching when you exclude the categories 3 and 4. It’s about people who have gotten something, but it’s not about many. I asked the figures recently and it is only about a few thousand people. If they are excluded, they will not be the ones who will put the land in rear and roar. It is a little symbolic that vulnerable groups are fishing, namely people of categories 3 and 4. Those involved often have many points — more than 12 or 15 points — and they have a great lack of self-reliance. It might be that some of them are able to form a relationship and start cohabiting with a partner who also has an integration approach. We are now going to say that these people are already well on the greenhouse, that we have already done an income test and that we thus throw them out of the system. Although it may be only one-third of them, yet one-third of these few thousand people would no longer be able to join the system, God knows why. Be honest: we have not received an adequate answer, except the principle that it is and will be.
Mr. Minister, I have pared you by asking what you do with the people who get an exemption of 500,000 Belgian francs if they combine their satisfaction with an income or salary. They will continue to enjoy the system of the maximum invoice, while the people I mentioned before can no longer rely on that system. People who enjoy a benefit of 500,000 Belgian francs can already fall under the system, even if they have one franc, even if they perfectly comply with the regime of the maximum invoice, while those of category 3 and 4, since they have already received a so-called “premium of love”, are not allowed to pass through the box for a second time. We just say, we will shut you out.
Mr. Minister, I understand you even less with regard to the increased child allowance. I saw you then react non-verbally and I understood that not so well, because I have always taken a consistent position on that. How can you make it clear that children for whom an increased child allowance is already paid are the lucky ones who will be able to invoke an acquired right. They will further fall under the system, while children who, after the publication of the law, become victims of a condition entitled to an increased child allowance, will be excluded from the system, under the pretext that for them a new arrangement will be developed that will cover their costs. But, of course, this is equally true for the first group, of which we say that there the acquired right plays. I have already said many times, on the occasion of the discussion of the welfare of disabled persons, that we have never had more discussions than about acquired rights. Either one acknowledges that there is a right and then it must not be acquired, then it is simply a right, or we find that the right is no longer responsible, but we do not dare to take it away and let it so. We do not want to shake the neck for this, we pretend that the law will fade out of its own, but no new candidates should be added. Such a thing cannot be defended and it will encounter misunderstanding and lead to misunderstandings. People will wonder how this is possible, why such an arbitrary decision is made, why they fall under that regime and someone else not.
Therefore, I have made two proposals, Mr. Minister, and I repeat them on this tribune. It would be much better to continue on your drive and ensure that all children up to sixteen years of age can enjoy the system — of course also disabled children with increased child allowance — and to exclude children from sixteen years of age, although we actually have no understanding of that either.
Either it is said that up to 16 years all children, of course also disabled children, are eligible for increased child allowance and from 16 years no one anymore, but then it is also no one anymore. Then it is equal for everyone. There should be no distinction between those who have an acquired right and the others. We must then only key to other systems that are also cost-covering such as the increased child allowance and then we must see that we can give a solid answer there because there is a test based on self-saving.
Or it is said, if we want to fulfill certain commitments, that it is better for everyone older than 16 years who enjoys an increased child allowance, because the others we exclude, let it continue to enjoy. They will not use it if they do not need it. Children who are mentally disabled and have little medical expenses are not covered by the maximum invoice. They do not need it. Therefore, we have proposed that everyone remains in the system until we can prove to parents and children that our child allowance system has improved and then we take out all these children through a simple legal adjustment. Then we can offer an adequate solution. It was, therefore, more correct to determine the categories clearly here through a royal decree or another way.
These are the most important comments from our group, the group leader will support me in this. The first addresses general principled observations about the social security system and about the mechanism of the maximum invoice. But our last two comments are really principled, they go to the ground. They are of the kind that they fight discrimination. We will discuss them further in three amendments.

Monsieur le président, le groupe PSC s'abstiendra à l'égard de ce projet relatif au maximum à facturer dans l'assurance soins de santé, et ce pour plusieurs raisons.
Ce projet contient incontestablement des éléments positifs et intéressants. Nous avons évidemment, comme tous, le souci de couvrir davantage les malades chroniques, les plus défavorisés et de prévoir des interventions en faveur de ceux qui, sur le plan des revenus, sont les moins bien nantis dans notre société.
Il y a une série de remarques techniques à formuler — et je rejoins assez ce qu'a dit M. Goutry —, par exemple en ce qui concerne la question des enfants de 16 ans. Il est évident que la distinction est tout à fait théorique. Entre 16 et 18 ans et même au-delà pour les enfants qui bénéficient encore des allocations familiales, on se rend bien compte qu'il n'y a pas de rupture et que l'âge de 16 ans est purement théorique. Ce sont des éléments qui peuvent être corrigés dans l'avenir et l'on pourrait s'arrêter là en disant que l'on adhère à une logique qui a déjà été inscrite dans la franchise sociale et dans la franchise fiscale. Nonobstant certaines imperfections, nous sommes pragmatiquement dans une situation qui améliore les choses et nous pourrions nous contenter de dire que tout ce qui apporte une amélioration doit être approuvé.
Il y a cependant deux raisons fondamentales à notre abstention. La première, c'est que l'on se trouve clairement dans un système de sélectivité et que la sélectivité est pour nous la manière d'ébranler tout le régime de notre sécurité sociale. Ce dernier repose sur des données assez simples. Au niveau des recettes, il y a deux sources d'intervention: d'une part, ce qu'on appelle le financement alternatif, c'est-à-dire l'impôt selon la progressivité, donc c'est une solidarité par la progressivité. Et d'autre part, en ce qui concerne les cotisations sociales, c'est la proportionnalité. Dans le contrat social qui existe dans notre société, c'est à travers ces deux mécanismes de solidarité que l'on fonde notre système de sécurité sociale, basé sur une assurance. Si au niveau de la contribution aux ressources de cette assurance, il y a un mécanisme fort de solidarité, il est évident qu'en ce qui concerne les conséquences de cette assurance, c'est-à-dire les prestations, la logique veut que ces prestations soient valables pour tous les bénéficiaires de l'assurance. C'est cela qui a constitué notre Etat providence où le contrat social a permis à chacun d'adhérer au système.
Je sais bien que je joue ici la Cassandre de notre Etat social, mais je reste persuadé que, coup de canif après coup de canif, nous arriverons progressivement à un démantèlement de ce principe de base. En d'autres termes, les plus riches vont considérer qu'il n'est pas normal qu'ils contribuent de façon importante, si cette importante contribution ne procure pas un certain nombre d'avantages dans les prestations. L'essence même de ce pacte social va ainsi céder petit à petit la place à une logique de sélectivité. On commence par une sélectivité qui semble séduisante au niveau des prestations, on continuera — cela a d'ailleurs été écrit par le ministre récemment —, en considérant qu'on ne peut pas tout faire dans notre système et qu'il faut donc que la sélectivité soit la règle. C'est exactement le système anglo-saxon, le système venu de la déformation du système beveridgien. C'est cela qui, à terme, tue le pacte social existant.
Toute dérive en la matière est extrêmement dangereuse. M. Delizée exprimait d'ailleurs certaines craintes et certaines réserves. Moi, je vais plus loin en disant qu'il arrivera un moment où ces craintes et ces réserves se transformeront en regrets.
Je tiens beaucoup à l'idée que le grand mérite de la sécurité sociale, c'est que, née au lendemain de la guerre par un pacte entre tous les Belges, elle est le fondement-même de la solidarité dans notre société. Et ce n'est pas par la sélectivité que l'on maintient cette solidarité, même si cela n'apparaît pas important dans un premier temps.
Le second point — on le voit tous les jours —, c'est que le maximum à facturer peut, demain, servir d'alibi à une modification importante des tickets modérateurs. Car en fait, le maximum à facturer, c'est une réassurance des tickets modérateurs qui se fonde sur une logique de protection des plus faibles. C'est-à-dire que petit à petit disparaît l'idée que le ticket modérateur est, en soi, quelque chose de lourd, de difficile et de pesant sur la société, puisqu'on peut dire: "les plus faibles sont protégés."
A titre de comparaison, je prendrais le système "Medicare" américain. Il s'agit d'un système où l'on a une participation très importante des personnes à la sécurité sociale, qui est corrigée au niveau des plus faibles par un système d'intervention médicale. C'est donc bien plus qu'un ticket modérateur.
A travers une logique comme celle-ci, on ne s'attaque pas aux fondements mêmes de notre système de sécurité sociale — est-ce qu'il faut des tickets modérateurs importants? Est-ce qu'il faut augmenter les tickets modérateurs? Ou faut-il au contraire veiller à réduire le poids des tickets modérateurs? — mais on lui substitue une tout autre logique qui consiste à dire que, pour la viabilité du système, il est nécessaire d'augmenter les tickets modérateurs, de faire une sélection au niveau des prestations. C'est d'ailleurs déjà le cas avec la nomenclature en kinésithérapie et l'application du prix de référence dans le secteur du médicament. Et ces alourdissements, considérés comme devenus nécessaires, sont compensés, pour les plus faibles, par le système du maximum à facturer.
Je pense qu'en agissant de la sorte, on déstabilisera le système. Et demain, dans une logique d'Etat social actif, on parlera de moins en moins de ce contrat social fondamental qui est, depuis près de cinquante ans, le fondement même de la vie et de la solidarité en société.
En résumé, ce projet contient de bonnes choses. C'est pourquoi notre vote ne sera pas négatif. Malheureusement, je crains que ce que je dis aujourd'hui, d'autres le rediront plus tard, mais cette fois-ci sous une forme bien plus dure pour affirmer qu'on a raté la transformation, la modernisation de la sécurité sociale pour basculer d'un système de protection sociale "bismarckien" vers un système à l'anglaise, "beveridgien", où l'Etat prendra de plus en plus d'importance et adaptera sa logique en fonction de ses besoins au niveau de ses recettes et de ses dépenses, laissant les partenaires sociaux démunis devant ce changement de régime social.
J'espère qu'on freinera cette évolution, mais ceci est un coup de canif supplémentaire au principe d'Etat providence auquel nous sommes tellement attachés.

There are a number of technical remarks to be made — and I quite agree with what Mr. said. Goutry — for example, with regard to the issue of children 16 years old. Obviously, the distinction is quite theoretical. Between 16 and 18 years of age and even beyond for children who still receive family allowances, it is clear that there is no break and that the age of 16 is purely theoretical. These are elements that can be corrected in the future and one could stop there by saying that one adheres to a logic that has already been inscribed in the social franchise and in the tax franchise. Despite some imperfections, we are pragmatically in a situation that improves things and we could simply say that everything that brings improvement must be approved.
There are two main reasons for our abstention. The first is that we are clearly in a system of selectivity and that selectivity is for us the way to shake down the whole regime of our social security. This is based on fairly simple data. At the level of revenue, there are two sources of intervention: on the one hand, what is called alternative financing, that is, the tax according to progressivity, so it is a solidarity through progressivity. On the other hand, in terms of social contributions, it is proportionality. In the social contract that exists in our society, it is through these two mechanisms of solidarity that our social security system, based on insurance, is founded. If there is a strong solidarity mechanism at the level of the contribution to the resources of this insurance, it is obvious that with regard to the consequences of this insurance, that is, the benefits, the logic requires that these benefits are valid for all beneficiaries of the insurance. This is what constituted our Providence State where the social contract allowed everyone to join the system.
I know very well that I play here the Cassandre of our social state, but I remain convinced that, blow of cane after blow of cane, we will gradually arrive at a dismantling of this basic principle. In other words, the richest will consider that it is not normal that they contribute significantly, if this significant contribution does not provide a number of benefits in the benefits. The very essence of this social pact will thus gradually give way to a logic of selectivity. In short, this project contains good things. Therefore, our vote will not be negative. Unfortunately, I fear that what I say today, others will repeat it later, but this time in a much harder form to affirm that we have failed the transformation, the modernization of social security to switch from a “bismarck” social protection system to an English system, “beveridgien”, where the state will take more and more importance and adjust its logic according to its needs at the level of its revenues and expenses, leaving the social partners impoverished in the face of this change of social regime. by

Mijnheer de voorzitter, mijnheer de minister, geachte collega's, de toegankelijkheid van de gezondheidszorg is een belangrijke bekommernis voor zowel de regering als dit Parlement. De kosten waarmee chronisch zieken soms worden geconfronteerd, hebben ons toch doen nadenken over de efficiëntie van onze sociale bescherming. Deze bezorgdheid vond bij de vorming van deze regering zelfs haar weerslag in het regeerakkoord.
De uitbreiding van de maximumfactuur die wij vandaag bespreken, geeft deels een antwoord op dit probleem. Ik zeg deels omdat uiteraard kosten die vandaag niet terugbetaald worden door het RIZIV en vaak toch een belangrijk aandeel uitmaken van de kosten, uiteraard ook niet gedekt worden door de maximumfactuur.
Terecht hebben de leden van de commissie beklemtoond dat de maximumfactuur niet mag worden aangekondigd als een deus ex machina die alle problemen zal oplossen. De maximumfactuur is een verbetering ten aanzien van de huidige situatie, maar lang niet alle uitgaven in de gezondheidszorg zullen worden terugbetaald. Een realistische voorstelling aan de publieke opinie moet ontgoocheling voorkomen.
De maximumfactuur is misschien wel een nieuw woord, de doelstelling is evenwel niet nieuw. De vorige minister van Sociale Zaken had een eerste aanzet gegeven tot een betere bescherming door de introductie van de fiscale en sociale franchise.
De maximumfactuur gebruikt dan ook dezelfde technieken, maar met een paar verschillen. Ten eerste is ze sneller. Ten tweede wordt er geen onderscheid meer gemaakt op basis van het sociaal statuut van de patiënt, maar wel op basis van het belastbaar inkomen. Voor 2001 worden de uitgaven voor geneesmiddelen van de categorieën A en B opgenomen voor de berekening van het plafond. Voor heel wat mensen betekent dat een belangrijke vooruitgang, want geneesmiddelen betekenen vaak een grote hap uit het budget van een gezin.
Vanaf 2002 worden de kosten voor hospitalisatie mogelijk opgenomen en vanaf 2003 zal worden gedacht aan de opname van de materiaalsupplementen. Uiteraard zal dat tijdspad mee bepaald worden door de financiële repercussies van de maatregelen en mogelijk ook door de budgettaire mogelijkheden. Op kruissnelheid worden de uitgaven nu geraamd op 85 miljoen euro. Het is uiteraard belangrijk dat wij de financiële repercussies nauwgezet volgen.
In het systeem dat vandaag voorligt, zijn er twee categorieën van mensen: mensen met een laag inkomen, die een snelle terugbetaling krijgen, en mensen met een hoger inkomen, met een terugbetaling via de fiscus. Voor de eerste categorie denk ik dat het een trendbreuk is niet langer te behoren tot een bepaalde categorie en daarom terugbetaling te krijgen, maar eenvoudig het feit dat iemand met een lager inkomen sneller recht op terugbetaling krijgt. Daarom waarderen wij daarin de aanpak van de minister, waarbij een gelijke regeling uitgewerkt wordt voor, enerzijds, genieters van het WIGW-statuut, bestaansminimumtrekkers, genieters van het gewaarborgd inkomen voor bejaarden en, anderzijds, mensen die uit arbeid een laag inkomen hebben. Die mensen hebben nu hetzelfde voordeel. Het is niet langer exclusief gegeven aan bepaalde sociale categorieën. Voor de VLD is dat een grote vooruitgang. Het werken met sociale categorieën is namelijk stigmatiserend voor de betrokkenen. Bovendien leidt het tot grote onrechtvaardigheden voor wie werkt en daarvoor een laag loon ontvangt. De inactiviteitvallen die vandaag bestaan maar langzaamaan worden weggewerkt, zijn het gevolg van dit soort maatregelen.
Mijnheer de minister, ik hoop dat die werkmethode ook nog een inspiratiebron zal zijn voor de maatregelen in de toekomst. Wij denken daarbij aan het WIGW-statuut. Heel wat mensen die opnieuw gaan werken na een tijd werkloos te zijn of het bestaansminimum te hebben genoten, stellen vast dat het gaan werken bestraft wordt. Het zou goed zijn om daarover in de toekomst nog na te denken.
Bovendien wordt ook de positie van het chronisch zieke kind goed geregeld. Het is duidelijk dat het hebben van een chronisch ziek kind een zware financiële belasting betekent voor het gezin. Het is dan ook positief dat de maximumfactuur afzonderlijk wordt toegepast op dat kind, ongeacht het inkomen van het gezin. Dat maakt dat gezinnen met hoge gezondheidsuitgaven voor kinderen het in de toekomst toch ietwat gemakkelijker zullen krijgen. In de commissievergadering is er discussie geweest over de overgangsmaatregelen, waarbij kinderen, die vandaag recht hebben op een verhoogde kinderbijslag, automatisch de regeling van de maximumfactuur zullen genieten. Na 2002 wordt dat geen automatisme meer. Ik denk dat de bijzondere regeling voor de kinderen voldoende garanties biedt en dat ze billijk is.
Voor de VLD is de positie van de zelfstandigen in die regeling uiteraard belangrijk. Voor de zelfstandigen geldt de maximale factuur, zij het wel in beperkte vorm. Voor wie aanvullend verzekerd is voor kleine risico's worden alle remgelden, zowel voor grote als kleine risico's, in aanmerking genomen om het plafond te berekenen. Evenwel worden de remgelden voor de grote risico's slechts terugbetaald als de maximale factuur van toepassing is. Het is uiteraard positief dat de maximale factuur ook voor zelfstandigen van toepassing is, maar wij vinden dat de discussie in de commissievergadering duidelijk gemaakt heeft dat deze meerderheid een absolute prioriteit moet maken van de integratie van de kleine risico's in de verplichte ziekteverzekering voor de zelfstandigen.
Doen wij dat niet, dan creëren wij een nieuwe groep van kansarmen in onze maatschappij. Voor wie aanvullend verzekerd is als zelfstandige, is deze weg wellicht een ontgoocheling. Als zelfstandige neemt men zijn verantwoordelijkheid op zich ten opzichte van de maatschappij en van het eigen gezin door zich aanvullend te verzekeren voor kleine risico's. Men stelt dan vast dat de kleine risico's wel in aanmerking voor de berekening van het plafond worden genomen, maar niet voor de berekening van wat via het remgeld moet worden terugbetaald.
Ten slotte rees de vraag of de zelfstandige die aanvullend bij een verzekeringsmaatschappij verzekerd is, er eveneens op kan rekenen dat zijn remgelden voor kleine risico's worden meegeteld bij de berekening van het plafond. Chronisch zieken met veel uitgaven voor geneesmiddelen zullen het wetsontwerp als een afstraffing zien voor de vele jaren bijdrage die zij reeds hebben betaald, voor de verantwoordelijkheid die zij op zich hebben genomen. Het is niet goed dat de politiek die mensen niet honoreert. De verschillende structuren van de ziekteverzekeringen voor respectievelijk werknemers en zelfstandigen is een verklaring, maar geen excuus. Wij verwachten dan ook dat men hiervoor aan de ronde tafel, aangekondigd voor juni, een oplossing zoekt. Hoe vlugger, hoe beter voor ons, mijnheer de minister. U weet dat.
Het is wellicht goed dat wij de toepassing van de maximumfactuur volgend jaar een eerste keer zullen evalueren. Die evaluatie moet betrekking hebben op zowel de kostprijs als op de dekking, met andere woorden de concrete gevolgen voor gezinnen in vergelijking met de situatie van vandaag. Samen met andere collega's in de commissie — zoals de heer Valkeniers — denk ik dat de nodige voorzichtigheid inzake de mogelijke misbruiken aan de dag moet worden gelegd. Eens het plafond bereikt, kan een zekere nonchalance ontstaan over het gebruik van de gezondheidszorg wegens het zogezegde gratis karakter. Dat is uiteraard niet de bedoeling van de maximale factuur. Het is echter geen denkbeeldig gevaar. Mijnheer de minister, wij vinden dat ook dat aspect een element moet zijn van de evaluatie. Een responsabilisering van de patiënt is volgens mijn partij evenzeer blijvend noodzakelijk om de factuur en kostprijs van de gezondheidszorg in het algemeen betaalbaar te houden. Ondanks die voorzichtige opmerking steunen wij dan ook volmondig de uitbreiding van de maximumfactuur.

The falls of inactivity that exist today but are slowly being eliminated are the result of this type of measures.
Mr. Minister, I hope that this method of work will also be an inspiration for future measures. We are referring to the WIGW statute. Many people who return to work after being unemployed for a period of time or having ⁇ the subsistence minimum find that starting to work is punished. It would be good to think about this in the future.
In addition, the position of the chronically ill child is also well regulated. It is clear that having a chronically ill child means a heavy financial burden for the family. It is therefore positive that the maximum invoice is applied separately to that child, regardless of the family’s income. This means that families with high health expenses for children will get it a little easier in the future. During the committee meeting, transitional measures were discussed, in which children, who today are entitled to an increased child benefit, will automatically enjoy the regime of the maximum invoice. After 2002 this will no longer be automatic. I think that the special scheme for children provides sufficient guarantees and that it is fair.
For the VLD, the position of the self-employed in this scheme is of course important. For the self-employed, the maximum invoice applies, though in limited form. For those who are additionally insured for small risks, all brake fees, both for large and small risks, will be taken into account to calculate the ceiling. However, the brake fees for the high risks will only be refunded if the maximum invoice applies. It is of course positive that the maximum invoice also applies to self-employed persons, but we believe that the discussion at the committee meeting has made clear that this majority should make the integration of small risks in the mandatory health insurance for self-employed persons an absolute priority.
If we do not, we will create a new group of disadvantaged people in our society. For those who are supplementally insured as self-employed, this path may be a disappointment. As a self-employed, one assumes his responsibility towards society and his own family by supplementing insurance for small risks. It is then determined that the small risks are taken into account for the calculation of the ceiling, but not for the calculation of what is to be reimbursed through the brake fund.
Finally, the question arose whether the self-employed person who is additionally insured by an insurance company can also rely on the fact that his brake fees for small risks are taken into account in the calculation of the ceiling. Chronically ill people with high spending on medicines will see the bill as a punishment for the many years of contributions they have already paid, for the responsibility they have taken on. It is not good that politics does not honor people. The different structures of health insurance for employees and self-employed, respectively, is an explanation, but not an excuse. We therefore expect that a solution will be sought at the round table, announced for June. The sooner, the better for us, Mr. Minister. You know that.
It may be good that we will evaluate the application of the maximum invoice for the first time next year. That evaluation should cover both cost and coverage, in other words the concrete implications for families compared to the current situation. Together with other colleagues in the committee — such as Mr Valkeniers — I think that the necessary caution should be demonstrated with regard to possible abuses. Once the ceiling is reached, a certain nonchalance can arise over the use of health care due to the so-called free character. This, of course, is not the purpose of the maximum invoice. However, it is not an imaginary danger. We believe that this aspect should also be an element of the evaluation. A responsibility of the patient is, in my opinion, equally permanently necessary in order to keep the invoice and cost of health care generally affordable. Despite this cautious comment, we therefore fully support the extension of the maximum invoice.

Monsieur le président, monsieur le ministre, chers collègues, le système du montant maximum à facturer est à la fois une idée simple et géniale.
En fait, le problème qui se pose sans cesse est celui de l'accessibilité aux soins pour tous et de manière égale. De nombreux systèmes ont déjà été inventés, mais jusqu'à présent on n'avait encore jamais trouvé un système aussi simple et efficace que celui qui nous intéresse aujourd'hui.
Selon moi, ce système a le mérite de rendre l'accessibilité des soins tout à fait efficiente. Le Mouvement réformateur soutiendra donc ce projet de loi qui lui semble être une excellente initiative.
Nous nous trouvons face à un paradoxe: plus la science et la technologie progressent, plus le progrès médical s'amplifie et plus l'accessibilité devient difficile à garantir. Si l'on n'y prend garde, dans quelques années, cette accessibilité sera de moins en moins possible au fur et à mesure que notre société, de plus en plus évolutive, réussira à engranger des progrès scientifiques et technologiques importants. Il fallait donc trouver un système qui garantisse cette accessibilité et qui accompagne le progrès technologique et scientifique.
Il est évident que le maximum à facturer comporte certaines difficultés d'application. Il ne faut pas se leurrer, ce sera parfois difficile. La difficulté résidera dans le contrôle pour éviter l'étouffement du système, mais aussi dans l'intégration des soins qui rentrent en ligne de compte car il faudra toujours faire des choix. A un certain moment, il faudra que l'on s'en tienne aux données objectives des techniques thérapeutiques et diagnostiques, les intégrer dans le montant maximum à facturer et peut-être écarter du système certains types de soin, de diagnostics ou de thérapeutiques qui n'ont pas fait leurs preuves de manière suffisamment évidente. Ces derniers ne doivent donc pas rentrer dans le système. En effet, si l'on n'opère pas une certaine sélection en matière d'intégration dans le système, ce dernier s'étouffera en raison des contraintes budgétaires qui rendront leur application impossible. Cela nécessitera de la part du gouvernement et de votre département, monsieur le ministre, un effort supplémentaire quant à la définition des traitements et diagnostics qui, objectivement, apportent un plus en matière de santé publique et qui doivent donc faire partie de ce système, qui permet l'accessibilité aux meilleurs soins et aux soins de qualité.
Le fait d'avoir prévu une couverture totale pour les enfants de moins de 16 ans me semble une raison supplémentaire de se réjouir du vote de ce projet de loi. En effet, quand la vie d'une famille bascule, la solidarité doit être totale. On sait combien les familles d'enfants malades vivent des drames et souffrent dans leur coeur et dans leur âme, mais aussi combien elles connaissent de difficultés de gestion du budget familial.
Aujourd'hui, nous faisons un pas vers un système qui améliore l'accessibilité et qui s'inscrit délibérément dans les projets les plus humanistes que nous avons eu à discuter au cours de cette législature.
Je voudrais cependant, comme d'autres l'ont déjà fait, mettre un bémol à tous ces aspects positifs. Je veux parler de la création de nouvelles discriminations à l'égard des indépendants.
Au moment où tout le monde s'accorde pour dire qu'il faut réduire drastiquement — et si possible faire disparaître progressivement — les inégalités de traitement entre les indépendants et les salariés, il est clair qu'en l'occurrence le risque est de créer une nouvelle discrimination.
Il conviendra donc, dans le cadre des discussions sur le statut social des indépendants, que l'on tienne compte de la nécessité d'assurer un parallélisme de traitement entre les différentes catégories de travailleurs, sans quoi nous aurons créé de nouvelles frustrations dans une catégorie de la population et certainement une inégalité de traitement en matière d'accessibilité aux soins, ce qui est le contraire de l'objectif poursuivi.
Monsieur le ministre, chers collègues, tels sont les éléments sur lesquels je voulais insister. Je considère, tout comme mon groupe, que ce projet est certainement ce que nous avons fait de mieux au cours de la législature pour améliorer l'accessibilité des soins. Il y a là un progrès extrêmement important. L'enjeu et le défi, c'est d'assurer le bon fonctionnement de cette mesure et de l'application de la loi; c'est aussi d'assurer des mécanismes à la fois de contrôle et de sélection des soins qui sont intégrés dans le système qui repose sur des données objectives, sans quoi on risque l'étouffement de ce système.
Voilà les quelques points que je voulais mettre en avant dans le cadre de l'apport du soutien de mon groupe à ce projet de loi.

The difficulty will be in the control to avoid suffocation of the system, but also in the integration of care that comes into account because there will always be choices to make. At some point, it will be necessary to stick to the objective data of therapeutic and diagnostic techniques, to integrate them into the maximum amount to be billed and ⁇ to exclude from the system certain types of care, diagnostics or therapeutics that have not proven themselves in a sufficiently obvious way. They should not enter the system. Indeed, if one does not make a certain selection in terms of integration into the system, the latter will suffocate due to budgetary constraints that will make their application impossible. This will require additional efforts from the government and your department, Mr. Minister, to define treatments and diagnostics that objectively contribute to public health and which must therefore be part of this system, which allows access to the best care and quality care.
The fact that I have provided full coverage for children under the age of 16 seems to me an additional reason to welcome the vote on this bill. In fact, when the life of a family turns, solidarity must be total. We know how many families of sick children are experiencing dramas and suffering in their hearts and souls, but also how difficult they are to manage the family budget.
Today, we are taking a step towards a system that improves accessibility and is deliberately part of the most humanistic projects we have had to discuss during this legislature.
I would like, however, as others have already done, to put a benchmark to all these positive aspects. I want to talk about the creation of new discrimination against independent workers.
At a time when everyone agrees that the inequality of treatment between self-employed and employees must be drastically reduced — and, if possible, gradually eliminated — it is clear that in this case the risk lies in creating a new discrimination.
It will therefore be appropriate, in the context of discussions on the social status of self-employed persons, to take into account the need to ensure a parallel treatment between the different categories of workers, otherwise we would have created new frustrations in a category of the population and ⁇ an unequal treatment in terms of access to care, which is the opposite of the aim pursued.
These are the elements that I wanted to emphasize. I consider, like my group, that this project is ⁇ what we did best during the legislature to improve accessibility to care. There is an extremely important progress here. Mijnheer de voorzitter, mijnheer de minister, collega's, de maximumfactuur vervangt het systeem dat wij vroeger hadden met de sociale en fiscale franchise. Mensen met een beschermd statuut betaalden daardoor tot in 2000 niet meer dan 375 euro voor hun medische verzorging. Voor andere gezinnen gebeurde de verrekening van de gezondheidsuitgaven pas twee jaar later, op basis van hun belastingaangifte. Mijnheer de minister, als sociale partij kan het Vlaams Blok inhoudelijk de verbetering van de sociale bescherming van de gezinnen die een laag en bescheiden inkomen hebben, volledig onderschrijven. Alleen vermoeden wij dat zeer snel de vraag zal worden gesteld om de uiteindelijk zeer lage inkomensplafonds te verhogen, zoals die voorzien zijn als voorwaarde om het recht dat in het wetsontwerp wordt omschreven, af te dwingen. In die zin moeten wij ervoor zorgen dat onze sociale zekerheid een voldoende breed draagvlak behoudt. Met andere woorden, mensen die een beter inkomen genieten, moeten uiteindelijk voldoende stimuli blijven krijgen om te participeren aan het solidaire systeem van sociale zekerheid. Mijnheer de minister, collega's, bij iedere uiteenzetting over de begroting klopt het Vlaams Blok op het spijkertje van het sociaal statuut van de zelfstandigen. Ieder van ons weet dat wat de kleine risico's inzake gezondheidszorg betreft de zelfstandigen nog niet vallen onder het stelsel van de verplichte verzekering voor geneeskundige zorg. Zij kunnen dus niet ten volle profiteren van de voorliggende maximumfactuur. Wij betreuren dat ten zeerste en wij hopen dat de aankondiging dat er vanaf 2003 echt werk zal worden gemaakt van een verbetering van het sociaal statuut van de zelfstandigen niet zal blijven steken in de klassieke paars-groene show van mooie aankondigingen. Wij hopen dat er nu eens echt werk zal worden gemaakt van een beter statuut voor de zelfstandigen.
Mijnheer de minister, het Vlaams Blok sluit zich graag aan bij de commentaar van de Gezinsbond die niet begrijpt waarom kinderen ouder dan 16 en gehandicapte kinderen ouder dan 16 die een recht op verhoogd kindergeld doen ontstaan, de maximumfactuur niet kunnen genieten. In de rand van de commissiebesprekingen hebt u de intentie laten blijken om dat probleem op te lossen via een aanpassing van de kinderbijslagregeling voor gehandicapte kinderen die recht op verhoogd kindergeld hebben. In alle bescheidenheid zou ik durven aan te bevelen toch even een wetsvoorstel van het Vlaams Blok te willen bekijken. Wij hebben reeds een tijdje geleden een wetsvoorstel ingediend dat ertoe strekt de regeling met betrekking tot verhoogde kinderbijslag voor gehandicapte kinderen te versoepelen en uit te breiden. Laten we mekaar geen liezebet noemen; veel moet er niet meer bestudeerd worden. Het Vlaams Blok heeft een wetsvoorstel ingediend dat u op ideeën kan brengen.
Mijnheer de minister, de MAF brengt ook een gigantische gegevensstroom op gang. Inlichtingen worden uitgewisseld tussen het rijksregister, het RIZIV, de fiscus en de ziekenfondsen. Die diensten geven in hun administratie allemaal een andere interpretatie aan het begrip "gezin". De ziekenfondsen werken met mutualistische gezinnen waarbij zij het uiteindelijk hebben over leden-titularissen die bijdragen betalen. De belastingdiensten stellen de aanslag vast op basis van de fiscale gezinnen. De maximumfactuur die hier vandaag ter bespreking voorligt, werkt op basis van het feitelijke gezin, met andere woorden iedereen die onder hetzelfde dak woont. Het zou dan ook wel eens kunnen dat de regeling met betrekking tot uw maximumfactuur zeer complex blijkt in de uitvoering. Uiteraard spelen de ziekenfondsen hierin een cruciale rol. Zij krijgen ettelijke nieuwe taken opgelegd. U zult zich ongetwijfeld nog herinneren dat ik in de commissie de pertinente vraag heb durven te stellen in welke mate er over financiële compensaties voor de verzekeringsinstellingen is onderhandeld.
Ik moet u eerlijk zeggen dat ik uw klaar en ondubbelzinnig antwoord toen wist te appreciëren. Het Vlaams Blok zal er scherp op toezien dat geen extra middelen, geen zogenaamde extra administratiekosten worden toegekend aan de ziekenfondsen. Wij menen dat het geld van de ziekteverzekering efficiënt moet worden gebruikt en doelmatig moet worden ingezet. Het geld van de sociale zekerheid dient dan ook niet om in dit verzuilde land allerlei belangenorganisaties van een goed belegde boterham te voorzien.
Mijnheer de voorzitter, mijnheer de minister, collega's, onze fractie kan zich in grote lijnen herkennen in voorliggend wetsontwerp. De opmerkingen die ik namens mijn fractie heb geformuleerd, brengen ons er wel toe om ons tijdens de stemming te onthouden.

We deeply regret that and we hope that the announcement that there will be real work made from 2003 on improving the social status of the self-employed will not continue to get stuck in the classic purple-green show of beautiful announcements. Mr. Minister, the Flemish Blok is happy to join the commentary of the Family Union, which does not understand why children over 16 and disabled children over 16 who have a right to an increased child benefit cannot enjoy the maximum invoice. The Flemish Bloc will carefully ensure that no additional resources, no so-called additional administrative costs are allocated to the health funds. We believe that the money of health insurance should be used efficiently and used efficiently. The money of social security is therefore not intended to provide all sorts of interest organizations in this deserted country with a well-invested sandwich.

Mijnheer de voorzitter, mijnheer de minister, voor de groenen wordt een zeer belangrijk punt uit het regeerakkoord gerealiseerd. Wij willen u feliciteren, mijnheer de minister, met dit zeer sociaal geïnspireerde wetsontwerp dat straks zal worden goedgekeurd.
Wij zijn samen de strijd aangegaan om de toegankelijkheid van de gezondheidszorg voor iedereen maar vooral voor de lage inkomens veilig te stellen. Wij vinden het belangrijk dat de chronisch zieken niet langer zullen worden gestraft. Wij vinden het ook heel interessant dat u de kinderen die zwaar chronisch ziek zijn eveneens in dit wetsontwerp opneemt. Wij menen dat dit een zeer sociale maatregel is.
Wij vinden dit een wezenlijke verbetering van de sociale en fiscale franchise door de integratie van de remgelden, de geneesmiddelen van de categorie A en B, de hospitalisatiekosten en later ook de materiaalsupplementen. Wij komen met dit ontwerp wezenlijk tegemoet aan de gezinnen die getroffen zijn door zeer zware kosten voor de gezondheidszorg.
Wij vinden het positief dat de meest kwetsbare groepen en de lage inkomens beter worden beschermd. Wij ondersteunen de selectieve benadering ten gunste van deze groepen, vooral omdat dit systeem gebouwd is op een basis van solidariteit tussen hoge en lage inkomens.
Naast die solidariteit bestaat in de sociale zekerheid ook het verzekeringsprincipe. Dit verzekeringsprincipe moeten wij blijvend in het oog houden. Wij moeten ervoor zorgen dat iedereen in het systeem blijft geloven. Het zou jammer zijn, mijnheer de minister, als hogere inkomens het systeem zouden verlaten om zich privé te herverzekeren. Wij moeten nadenken over de vraag of wij de verschillende inkomenstrappen, die nu zijn ingebouwd, moeten behouden. De kans is groot dat mensen met een zeer hoog inkomen de ziekteverzekering verlaten omdat ze niets terugkrijgen van die ziekteverzekering. Wij vinden dat op zo'n moment het algemeen systeem voor iedereen moet blijven gelden zodat ook andere inkomensgroepen hun rechten behouden. Het zou jammer zijn, mijnheer de minister, als we in de gezondheidszorg op lange termijn een tweede pijler zouden moeten uitbouwen. Wij menen dat het algemene systeem van toepassing moet blijven.
Belangrijk is dat er een garantie komt inzake tarieven. Ik weet dat het ook uw bekommernis is dat de medico-mut daarin haar volle verantwoordelijkheid neemt. Ook daar moeten wij erop toekijken dat er geen afwijkingen komen in de medico-mut en dat men alleen maar aan de laagste inkomens tariefzekerheid zou bieden, terwijl men dan voor hogere inkomens naar meer gedifferentieerde tarieven kan gaan. Voor die groepen zou dan ook de hogere bijdrage worden ingeschreven. Ik denk dat wij in het oog moeten houden dat er voor die groepen geen afwijkingen totstandkomen.
Wij weten allen dat het remgeld vrij hoog is. Er wordt 150 miljard bijgedragen door de mensen zelf. Wij vinden dat daar ook een limiet aan is. Daarom hebben wij de sociale en de fiscale franchise ondersteund, omdat er dergelijke zware last op de patiënten werd gelegd. Wij wilden systemen die dat afbouwen, steunen. Dat moeten wij goed in het oog houden.
Mijnheer de minister, wij moeten ook een oplossing vinden voor het remgeld in de ziekenhuizen. Wij weten dat er bij de sociale en de fiscale franchise eigenlijk een ongelukje is gebeurd. Mensen die lang verblijven in algemene of psychiatrische ziekenhuizen, wordt eigenlijk een deel van de maximumfactuur ontzegd. In de commissie is daar aandacht voor gevraagd en op korte termijn zou dit moeten worden opgelost, zodat wie de zwaarste kosten moet dragen ook volledig van de maximumfactuur kan genieten.
Een ander punt betreft het geneeskundig materiaal, implantaten en prothesen.

We believe it is important that chronically ill people will no longer be punished. We also find it very interesting that you also include children who are seriously chronically ill in this bill. This is a very social measure.
We see this as a substantial improvement of the social and fiscal franchise through the integration of the brake fees, the medicines of category A and B, the hospitalization costs and later also the material supplements. With this design, we come substantially to the families affected by very heavy healthcare costs.
We find it positive that the most vulnerable groups and low-income groups are better protected. We support the selective approach in favor of these groups, especially since this system is built on a basis of solidarity between high and low incomes.
In addition to this solidarity, social security also includes the insurance principle. This insurance principle must be kept in mind. We must ensure that everyone continues to believe in the system. It would be a pity, Mr. Minister, if higher incomes would leave the system to reinsure themselves privately. We need to think about whether we should keep the different income stairs, which are now built in. Chances are high that people with very high incomes will leave the health insurance because they get nothing back from that health insurance. We believe that at such a time the general system should continue to apply to all so that other income groups also retain their rights. It would be a shame, Mr. Minister, if we should build a second pillar in long-term health care. We believe that the general system should continue to apply.
It is important that there is a guarantee regarding tariffs. I know that it is also your concern that the medico-mut in this takes its full responsibility. Here too, we must take care that there are no deviations in the medico currency and that only the lowest incomes would be given tariff certainty, while for higher incomes one could go to more differentiated rates. For these groups the higher contribution would therefore be registered. I think we should keep in mind that there are no exceptions for these groups.
We all know that the brake money is quite high. There are 150 billion contributed by the people themselves. We believe that there is a limit to that too. That is why we supported the social and tax franchise, because such a heavy burden was placed on the patients. We wanted to support systems that destroy that. We must keep that in mind.
Mr. Minister, we must also find a solution to the brake money in hospitals. We know that there has been an accident in the social and tax franchise. People who stay in general or psychiatric hospitals for a long time are actually denied part of the maximum invoice. The committee has asked for this attention and should be addressed in the short term, so that those who have to bear the heaviest costs can also fully benefit from the maximum invoice.
Another point concerns medical equipment, implants and prosthetics.

Ons systeem van gezondheidszorg vergoedt daarentegen slecht de kosten als gevolg van chronische ziekten, de veelvuldige, kleine en grote ziekenhuisfacturen, de medicamentenfacturen en de doktersrekeningen. Tienduizenden personen — niet alleen degenen met een laag inkomen, maar ook degenen met een middeninkomen — geraken in financiële problemen, wanneer er sprake is van cumulatie van gezondheidsproblemen en een langdurig chronisch ziektebeeld waardoor de ziekte-uitgaven zich opstapelen. De maximumfactuur in de gezondheidszorg biedt zonder al teveel ideologische troelala en prietpraat een concreet antwoord op de zeer concrete vragen om verbetering, zodat het leven in vaak moeilijke omstandigheden dragelijk en gelukkiger wordt. Het past dan ook dat wij de hervorming met volle overtuiging steunen. Wat wij ook met volle overtuiging steunen, is de vraag die minister Vandenbroucke naar aanleiding van deze aangelegenheid heeft gesteld, met name om verder te gaan met de herfinanciering van de gezondheidszorg en van het RIZIV in ons land. Ik denk inderdaad dat het MAF gegroeid is uit de vaststelling dat er veel geld tekort is in de ziekteverzekering en dat de goedkeuring van de MAF-hervorming automatisch moet leiden tot de politieke vaststelling dat wij de komende jaren veel extra geld zullen moeten blijven vrijmaken voor de ziekteverzekering.
De vraag die minister Vandenbroucke gisteren via de media lanceerde om in de loop van de komende jaren in 2 miljard euro extra te voorzien voor de gezondheidszorg, is terecht. Het is ook van cruciaal belang bij de begrotingsonderhandelingen, hetzij tijdens deze legislatuur, hetzij tijdens de volgende.
De maximumfactuur is een zeer goed begin, maar zal slechts een degelijke sociale dekking kunnen garanderen wanneer er een herfinanciering van de gezondheidszorgen wordt doorgevoerd. Dat is de belangrijkste politieke conclusie uit deze discussie. Daarop zullen wij in de toekomst, met andere coalitiepartners, ongetwijfeld terugkomen. Monsieur le ministre, à plusieurs reprises, vous avez indiqué que vous comptiez continuer à travailler sur le système du tiers-payant pour le rendre plus simple à employer par une série d'acteurs qui ont peur de l'utiliser étant donné sa complexité. Il va en effet falloir s'y atteler avec énergie et ce sont des mesures moins onéreuses car elles fonctionnent déjà. Actuellement, les gens paient déjà le ticket modérateur mais ils feront une différence s'ils ne doivent pas débourser avant de se faire rembourser. Cela compte psychologiquement et cela ne coûte pas grand chose dans notre système.
Un autre problème est celui de la sélectivité. Comme d'autres, nous sommes inquiets mais pas autant que M. Viseur car nous considérons que l'ensemble des individus pourra trouver sa part dans le maximum à facturer. Pour les revenus plus importants, le plafond qui est très haut les concerne toujours et il sera toujours intéressant pour cette catégorie de personnes de rester dans le système. Il faut cependant rester prudent car, au niveau du marché des assurances, cette catégorie bénéficie des primes les plus légères.
Un autre aspect réside dans le fait qu'une série de gens prennent le maximum à facturer comme prétexte pour demander une augmentation du ticket modérateur ou pour interdire l'absence de ticket modérateur dans un certain nombre de cas. Il est hors de question que ce maximum à facturer puisse servir à cela.
Par ailleurs, est-ce que les catégories de revenus délimitées par le maximum à facturer pourront être utilisées par d'autres acteurs? Est-ce que les hôpitaux pourraient se servir de ces catégories pour déterminer des suppléments? Monsieur le ministre, avez-vous déjà prévu ce cas de figure? Imaginons que les hôpitaux décident d'agir comme tel et procèdent à une certaine sélectivité. Est-il bien clair que ces catégories de revenus ne pourront pas servir à d'autres choses? Il deviendra alors "encore plus intéressant" pour certaines personnes de sortir de notre système si ces catégories sont utilisées à de multiples endroits.
Dernier aspect que je soulèverai. Il est clair qu'il faudra rester attentif au coût que cela représentera pour les mutuelles sur le plan administratif. Il ne faudrait pas que ce coût soit tellement important qu'elles ne puissent plus accomplir d'autres missions essentielles à nos yeux, comme les contrôles par exemple. Nous pensons en effet qu'elles ont un rôle important à jouer en cette matière.
Bien sûr, nous soutenons ce projet, mais nous voulons rester vigilants sur tous les aspects que je viens d'évoquer.

Op hetzelfde ogenblik is men in Frankrijk ook met zo'n systeem begonnen, maar men heeft dat kort daarna moeten stilleggen omdat het niet meer betaalbaar was. Mevrouw De Galan heeft toen voorgesteld om een keuze te maken onder de chronische ziekten, maar zij heeft later gezien dat zoiets niet mogelijk is. Uiteindelijk heeft zij van haar plan afgezien.
Er zal een evaluatie moet gebeuren, wat mijn collega reeds heeft aangehaald. Op de controlediensten blijkt duidelijk dat eenmaal de patiënt recht heeft op de sociale franchise, de uitgaven zo de hoogte in gaan. Dat wil zeggen dat er ergens misbruiken zijn. Ik ben het ook volledig eens met mijn collega dat wij geen schroom moeten hebben om de patiënt voor zijn verantwoordelijkheid te plaatsen. De patiënten moeten weten dat misbruiken uiteindelijk ook op hun eigen hoofd terechtkomen.
Ik wil nog een andere opmerking maken. Ik heb in de bladen van de ziekenfondsen gelezen dat de toepassing — de afhandeling van de dossiers — niet gemakkelijk zal zijn. Dat zal tamelijk gecompliceerd zijn. Mijnheer de minister, als blijkt dat dit inderdaad voor de ziekenfondsen heel wat werk vraagt, zullen zij onmiddellijk eisen dat hun administratiekosten verhogen. Ik wil de vraag duidelijk stellen. Dit plan mag niet inhouden dat de administratiekosten verhogen. In het verleden hebben de ziekenfondsen ons, wat dat betreft, al meer dan eens beetgenomen. Zij hebben vroeger altijd gezegd dat hun onkosten maar 5% bedroegen, terwijl in de private verzekeringen de onkosten — administratiekosten — 12,5% bedroegen. Ik heb dat gevraagd toen wij met de verzekeringen hebben vergaderd. Die cijfers kloppen, maar in die 12,5% zit ook 10% "courtage".
