Monsieur le président, madame la ministre, messieurs les ministres, chers collègues, au nom de mon groupe, je tiens, dans ce dossier, à marquer mon soutien sur le fond des arrêtés royaux confirmés par cette proposition de loi.
Je regrette, comme nous l'avons regretté en commission, qu'un amendement déposé, permettant la confirmation de l'entièreté de l'arrêté royal du 4 avril 2014, ait été rejeté par la majorité. Madame la ministre, vous en avez mentionné la raison en commission. Elle concernait les articles 10 et 11. Il y a lieu d'observer qu'à l'époque, ceux-ci sont entrés en vigueur rétroactivement, de sorte que, si l'on confirmait ces dispositions, on risquerait de mettre en péril la confirmation des autres dispositions dudit arrêté royal
Ce n'est pas tant l'entrée en vigueur de manière rétroactive lors de la publication de cet arrêté royal qui pose problème mais le fait que ces dispositions auraient dû être confirmées avant le 1ᵉʳ janvier 2015. Pour rappel, je cite le principe de technique législative du Conseil d'État: "Dans les matières que la Constitution a réservées au législateur, celui-ci ne peut conférer une habilitation au Roi que sous des conditions strictes, notamment sous la condition que les arrêtés édictés en vertu de cette habilitation doivent être confirmés dans un délai relativement court et qu'à défaut de confirmation dans les temps, ces arrêtés sont réputés n'avoir jamais produit d'effet."
Par ailleurs, au vu de cette législation, nous savons bien que la publication au Moniteur belge interviendra après la date d'entrée en vigueur de cette loi et que la majorité a dû encore agir en urgence et n'a donc pas déposé un projet de loi et demandé effectivement l'avis du Conseil d'État. Voilà encore un projet juridiquement ambigu!
Pour conclure, madame la ministre, monsieur Friart, qui est l'auteur de cette proposition, il aurait été plus judicieux pour la majorité de demander l'avis du Conseil d'État sur cette question. Elle devra donc assumer la responsabilité en cas de problème lié à la non-confirmation de certaines dispositions. C'est pourquoi nous nous abstiendrons dans le vote de cette proposition de loi.

I regret, as we regretted in the committee, that an amendment submitted, allowing the confirmation of the entirety of the royal decree of 4 April 2014, was rejected by the majority. You mentioned the reason in the committee. It relates to Articles 10 and 11. It should be noted that at that time they entered into force retroactively, so that if these provisions were confirmed, the confirmation of the other provisions of the said royal decree would be endangered.
It is not so much the retroactive entry into force at the publication of this royal decree that is problematic but the fact that these provisions should have been confirmed before 1 January 2015. As a reminder, I cite the principle of legislative technique of the State Council: “In matters which the Constitution has reserved for the legislator, the latter may confer an authorization on the King only under strict conditions, in particular under the condition that the decrees issued under this authorization must be confirmed within a relatively short period of time and that in the absence of confirmation in time, these decrees are deemed never to have produced effect.”
Furthermore, given this legislation, we know well that the publication in the Belgian Moniteur will take place after the date of entry into force of this law and that the majority still had to act urgently and therefore did not file a bill and effectively requested the opinion of the Council of State. This is a legally ambiguous project.
To conclude, Mrs. Minister, Mr. Friart, who is the author of this proposal, it would have been more reasonable for the majority to seek the opinion of the State Council on this issue. It will therefore have to assume responsibility in the event of a problem related to the non-confirmation of certain provisions. We will abstain from voting on this bill.

Monsieur le président, il est vrai que nous n'avons pas de problème sur le fond du projet, à savoir sur les subsides accordés à l'éolien offshore et sur le financement des services de médiation de l'énergie.
Mais, comme d'habitude, le problème se situe au niveau de la méthode de travail. En effet, les travaux sont encore effectués dans l'urgence. Une proposition de loi plutôt qu'un projet de loi a été déposée. L'avis du Conseil d'État n'a pas été demandé. Nous nous trouvons face à des incertitudes quant à des articles qui n'ont pas été confirmés dans le cadre de ladite proposition de loi, incertitudes qui contribueront une nouvelle fois à instaurer une insécurité juridique pour ce qui concerne les subsides.
C'est la deuxième fois que nous nous trouvons face à ce genre de pratique alors qu'il est uniquement question de confirmation d'arrêtés royaux. C'est la raison pour laquelle, même si nous n'avons rien à dire sur le fond, nous nous abstiendrons lors du vote de cette proposition de loi.

But, as usual, the problem lies at the level of the working method. The work is still being carried out in an emergency. A bill instead of a bill was submitted.
