                    Monsieur le président, monsieur le ministre, chers collègues, la commission des Finances a examiné ce projet de loi le 16 janvier dernier. La loi en projet poursuit essentiellement deux objectifs.

Le premier est de renforcer le dispositif antiblanchiment à l'égard des pays et territoires non coopératifs dans la lutte contre le blanchiment des capitaux. Ces pays et territoires non coopératifs sont identifiés sur la base de critères définis par le GAFI — Groupe d'Actions financières. Le GAFI veut agir de manière ferme par rapport aux pays et territoires qui persistent dans une attitude de non-coopération depuis au moins un an. Les mesures portent essentiellement sur l'identification, d'une part, et sur le renforcement des mécanismes de déclaration, d'autre part.

Le second objectif de la loi est de renforcer le dispositif antiblanchiment relatif aux activités de transferts de fonds.

Au cours de la discussion générale, les intervenants ont abordé les aspects suivants: la disponibilité de la liste des pays non coopératifs — celle-ci est annexée au rapport —, la nécessité de s'engager de manière ferme dans la lutte contre le blanchiment, le problème du cautionnement, le problème du montant maximum pouvant faire l'objet d'un transfert de fonds opéré par un agent de change.

Le projet de loi a été adopté à l'unanimité par les membres de la commission.

The proposed law has two main objectives.

The first is to strengthen the anti-money laundering mechanism towards non-cooperative countries and territories in the fight against money laundering. These non-cooperative countries and territories are identified on the basis of criteria defined by the Financial Action Group (FATF). The FATF wants to act firmly against countries and territories that persist in a non-cooperative attitude for at least a year. The measures are mainly focused on identification, on the one hand, and the strengthening of reporting mechanisms, on the other.

The second objective of the law is to strengthen the anti-laundering mechanism relating to money transfer activities.

During the general discussion, the speakers addressed the following aspects: the availability of the list of non-cooperative countries — which is annexed to the report —, the need to commit firmly to the fight against money laundering, the problem of collateral, the problem of the maximum amount that can be subject to a money transfer operated by a foreign exchange agent.

The bill was adopted unanimously by the members of the committee.
