                    Monsieur le président, chers collègues, pour éveiller votre attention en cette fin d'après-midi, je voulais commencer par vous citer un chiffre, celui de 10 000. Dix millle, c'est le nombre de faillites qu'a connu notre pays en 2015 et malheureusement, ce chiffre annuel est d'une terrible stabilité. Il n'a quasiment pas bougé depuis 2013. Sur ces 10 000 faillites d'entreprises, 91 % concernent des indépendants, des petites entreprises comptant entre 0 et 4 salariés. Les petites structures souffrent donc le plus de ce véritable fléau.

Au niveau des secteurs, il s'agit principalement du commerce, du petit commerce, de l'horeca et de la construction. En extrapolant un peu, ce que je me suis permis de faire, on arrive à 20 000 emplois par an qui seraient perdus à cause de ces faillites, ce qui donnerait d'ici à la fin de la législature, 60 000 emplois perdus.

Ce chiffre est un parallèle intéressant puisqu'il correspond au nombre d'emplois que vous, chers collègues du gouvernement, avez promis de créer grâce au tax shift: 60 000 créations d'emplois, c'est ce que vous avez promis. À nos yeux, la création d'emplois, c'est bien. Éviter que les emplois existants ne disparaissent, c'est mieux.

Ten miles is the number of bankruptcies our country experienced in 2015 and unfortunately, this annual figure is of terrible stability. He has hardly moved since 2013. C'est l'objectif de notre proposition d'allocation-rebond.

Votre proposition part peut-être d'une bonne intention mais il faut noter que ce n'est pas le rôle de l'INASTI de régler et superviser tout cela. À chaque structure, son job. Le fédéral n'a pas non plus de consignes à donner aux structures régionales qui sont déjà mises en place et qui travaillent très bien dans les trois Régions pour prévenir les faillites.

C'est ce que j'ai cru comprendre de vos propos. Je vais quand même y répondre.

Nous ne demandons pas à l'INASTI de tout régler. Nous demandons aux indépendants en difficulté de se faire accompagner par des structures existantes. Ce n'est pas l'INASTI! C'est le CED à Bruxelles et en Wallonie, le Tussenstap en Flandre. Ce n'est donc pas l'INASTI qui doit tout régler. L'INASTI est là pour, pendant un maximum de neuf mois, comme c'est décrit dans la proposition, subvenir avec l'équivalent du revenu d'intégration, soit 700 euros par mois, afin que l'indépendant ne devienne pas subitement démuni ou ne tombe dans la pauvreté. Tel est le rôle de l'INASTI! Celui-ci est effectivement contrôlé par des paramètres clairs qui sont détaillés dans le texte si la personne est vraiment en difficulté. Car il importe effectivement d'éviter les abus.

Aussi, ne nous cachons pas derrière des structures pour ne pas soutenir la proposition sur le fond! J'aurais aimé que nous puissions discuter sur le fond. Si vous souhaitez que ce soit un autre organe qui le fasse, il était bienvenu de déposer des amendements. Il est encore temps de le faire! Mais sur le principe même de la structure, validée avec les acteurs du secteur, notamment le CED, le rôle de l'INASTI est de subvenir à cette période transitoire, via les cotisations des indépendants, leur permettant de continuer à survivre et de vérifier qu'ils sont bien en difficulté. Dès lors, un accompagnement est nécessaire.

Le dossier que doit préparer l'indépendant doit revenir vers une première administration et partir vers une deuxième administration. Ce sont des personnes qui ont une très bonne vision des affaires et qui peuvent parfaitement, en peu de temps, et très concrètement aider les indépendants en difficulté.

Ici, nous essayons de manière proactive d'empêcher la faillite.

Sur le fond, je n'entends pas de réels arguments de votre part et je regrette sincèrement que vous ne puissiez pas nous rejoindre sur ce texte. Il n'y aucune raison qu'il en soit ainsi. Au demeurant, nous soutenons certaines de vos propositions de manière constructive, comme nous venons de le faire voici dix minutes en ce qui concerne les commerces. Au-delà des différences idéologiques qu'on peut avoir sur de nombreux sujets, il aurait été intéressant qu'on puisse se retrouver sur ce texte. Tous les secteurs vous le diront, il y a une sonnette d'alarme concernant le nombre de faillites dans ce pays. Il y en a eu 10 736 en 2014 et 9 800 en 2015.

Je m'adresse aux collègues de la majorité qui ont rejeté le texte en commission, en particulier aux collègues du MR. Vous voulez être le parti des entrepreneurs et je ne comprends pas comment vous pouvez rejeter une mesure qui s'attaque au nombre élevé de faillites. Je ne comprends pas comment vous pouvez envoyer à la gare les petits indépendants quand, trop souvent, vous répondez présent pour les grandes multinationales et le secteur diamantaire. Je ne comprends pas et je vous demande de revoir votre position et de soutenir ce texte.

                    Mijnheer de voorzitter, collega’s, met de wijziging van de wet van 10 november 2006 betreffende de openingsuren in handel, ambacht en dienstverlening wat de beperking van openingsuren in badplaatsen en toeristische centra betreft, zullen vele steden en gemeenten gebaat zijn. De badsteden en toeristische centra zijn zelfs vragende partij voor de wetswijziging. Burgemeesters van de betreffende steden en gemeenten, kunnen, ongeacht hun politieke kleur, namelijk niets anders dan vaststellen dat er een probleem met de huidige wetgeving is en dat ze moet worden gewijzigd.

Vandaag gelden in de gewone steden en gemeenten openingsuren. Dat betekent concreet dat alle winkels hun deuren pas vanaf 5 uur ’s ochtends mogen openen en ze om 20 uur en op vrijdag om 21 uur opnieuw moeten sluiten. Er zijn natuurlijk een paar uitzonderingen op die regel, zoals tankstations en krantenwinkels. De grootste uitzondering is er echter voor de zogenaamde badsteden, plaatsen aan onze Vlaamse kust, en toeristische centra. De laatste term verwijst naar gemeenten of steden die geheel of gedeeltelijk als ‘toeristische zone’ zijn erkend. Om laatstgenoemde status te verkrijgen, moet een aanvraag worden ingediend en aan verschillende toeristische eisen worden voldaan. Een stad of gemeente in Vlaanderen die daaraan voldoet, krijgt van de Vlaamse regering een positief en bindend advies. De minister bevoegd voor zelfstandigen en kmo’s, zal vervolgens die stad, gemeente of delen ervan als toeristische zone erkennen.

De erkenning heeft belangrijke gevolgen. Zoals ik zopas heb aangehaald, geldt voor die steden en gemeenten een uitzondering op de openingsurenwet. Daar gelden vandaag immers geen openingsuren. In theorie kunnen handelaars hun winkels dus 24 uur op 24 en zeven dagen op zeven openhouden, wat in de praktijk natuurlijk erg weinig voorkomt. Handelaars hebben aldus een heel grote flexibiliteit. Het grote voordeel is dat zowel op de dijk aan de Noordzee als in het historische centrum van bijvoorbeeld Antwerpen of in een druk bezocht dorpje in de Ardennen handelaars hun winkels langer dan normaal kunnen openhouden en ze beter op hun klanten kunnen afstemmen. Toeristen wandelen namelijk graag ’s avonds ook nog rond en kopen nog graag een souvenir of andere zaken. Handelaars zien daardoor hun omzet stijgen. De beleving van de gemeente of de stad gaat erop vooruit. Dat is uiteraard een win-winsituatie.

U vraagt zich nu wellicht af waarom wij iets aan die wet hebben willen wijzigen.

Collega’s, een van de weinige nadelen van de wet heeft grote gevolgen voor de betrokken steden en gemeenten. Gemeentelijke reglementen kunnen namelijk worden omzeild. Bovendien zijn de lokale besturen het beste geplaatst, om te bepalen wat in hun stad belangrijk is. Daarom is het belangrijk dat steden en gemeenten zelf hun economie kunnen sturen.

The amendment of the Act of 10 November 2006 on opening hours in trade, crafts and services, as regards the limitation of opening hours in resorts and tourist centers, will benefit many cities and municipalities. The beach towns and tourist centers are even demanding parties for the legislative change. In other words, the mayors of the cities and municipalities concerned, regardless of their political colour, can only conclude that there is a problem with the current legislation and that it needs to be amended.

Today in the towns and municipalities there are regular opening hours. This means that all stores will not be allowed to open their doors until 5 a.m. and will have to close at 20 a.m. and at 21 a.m. on Friday. There are, of course, a few exceptions to that rule, such as gas stations and newspaper stores. The biggest exception, however, are the so-called beach towns, places on our Flemish coast, and tourist centers. The latter term refers to municipalities or cities that have been fully or partially recognised as “tourist zones”. To obtain the latter status, an application must be submitted and various tourist requirements must be met. A city or municipality in Flanders that complies with this will receive a positive and binding advice from the Flemish government. The Minister responsible for self-employed persons and SMEs will then recognize that city, municipality or parts thereof as a tourist area.

Recognition has significant consequences. As I mentioned earlier, these cities and municipalities are subject to an exception to the opening hours law. There are no opening hours today. In theory, traders can therefore keep their stores open 24 hours a day and seven days a day, which in practice, of course, is very rare. Traders have a great deal of flexibility. The great advantage is that both on the dike along the North Sea and in the historic centre of Antwerp, for example, or in a crowded village in the Ardennes, merchants can keep their stores open longer than normal and better tailor them to their customers. Tourists also like to walk around at night and buy souvenirs. Traders see their sales increase. The experience of the municipality or the city is moving forward. This is of course a win-win situation.

You may be wondering why we want to change this law.

Colleagues, one of the few disadvantages of the law has major implications for the cities and municipalities involved. Local regulations can be avoided. In addition, the local governments are best placed, to determine what is important in their city. Therefore, it is important that cities and municipalities can manage their economies themselves.

Begrijp mij absoluut niet verkeerd: nachtwinkels hebben een zeer relevante maatschappelijke functie, in die zin dat ze meer vrijheid geven aan de burgers om bepaalde artikelen te kopen na de conventionele openingsuren. Ik denk dat de meeste van onze collega’s te laat thuis zijn op een standaardwerkdag om nog tijdens de gebruikelijke uren te kunnen gaan winkelen. Echter, omdat die winkels ’s nachts open zijn, kunnen ze ook overlast met zich brengen. Daarom is het belangrijk dat een gemeente via een vergunningsbeleid kan sturen waar er en hoeveel nachtwinkels toegelaten zijn.

In de badsteden en toeristische centra doet er zich daaromtrent vandaag een probleem voor. Daar gelden namelijk geen openingsuren. Een gewone winkel mag daar ’s nachts open zijn, dus niet alleen de nachtwinkels. Wanneer de uitbaters het bordje ‘nachtwinkel’ weghalen, wordt de zaak en gewone winkel en kunnen ze toch nog 's nachts openblijven, terwijl ze niet meer hoeven te voldoen aan de vergunningsplicht. De mogelijkheid om het aantal nachtwinkels te beperken en de overlast te vermijden, valt voor die gemeenten dus weg. Dat zorgt voor een ware golf van verdoken nachtwinkels, met meer overlast tot gevolg. Eerlijkheidshalve moeten we bovendien toegeven dat een eenzijdig aanbod aan winkels niet bijdraagt tot een aangename beleving van de stad voor de toeristen. De beoogde win-winsituatie voor handelaar en consument staat dus onder grote druk.

Bovendien ontstaat er op die manier discriminatie. De nachtwinkel buiten een toeristische zone moet immers een vergunning aanvragen, aan de spelregels voldoen en ook taksen betalen. Een nachtwinkel in een toeristische zone hoeft dat niet. Op die manier worden de nachtwinkels uit de niet-toeristische rand weggetrokken en ontstaat er een concentratie in de toeristische zone, waardoor het probleem nog vergroot. Door de nu voorliggende nieuwe wet zullen we de discriminatie wegwerken en een gelijk speelveld voor alle nachtwinkels herstellen.

Met de voorgestelde wijziging sluiten we de achterpoortjes en krijgen de badsteden en toeristische centra nu eindelijk de bevoegdheid om hun economie zelf te sturen. Zij zijn en blijven namelijk het best geplaatst om te bepalen wat er goed is voor de stad, de inwoners en de bezoekers. De nieuwe tekst geeft aan badsteden en aan de toeristische centra de bevoegdheid om naar eigen noden beperkingen op te leggen aan de vooralsnog onbestaande openingsuren.

Let me outline the problem. In many cities and municipalities, night shops must apply for a permit. This is necessary to prevent the wild growth of those shops. Absolutely do not misunderstand me: night shops have a very relevant social function, in the sense that they give citizens more freedom to buy certain items after the conventional opening hours. I think most of our colleagues are too late at home on a standard working day to be able to go shopping during the usual hours. However, because these shops are open at night, they can also cause inconvenience. Therefore, it is important that a municipality can direct through a licensing policy where and how many night shops are allowed.

In the beach towns and tourist centers, this is a problem today. There are no opening hours. A regular store may be open there at night, so not only the night shops. When the operators remove the sign ‘night shop’, the case becomes a regular store and they can still remain open at night, while they no longer have to comply with the licensing obligation. The possibility of limiting the number of night shops and avoiding inconvenience is therefore absent for those municipalities. That creates a real wave of dusty night shops, resulting in more inconvenience. In order to be honest, we must also admit that a one-sided offer of shops does not contribute to a pleasant experience of the city for tourists. The intended win-win situation for traders and consumers is therefore under great pressure.

In this way, there is also discrimination. After all, the night shop outside a tourist zone must apply for a permit, comply with the rules of the game and also pay taxes. A night shop in a tourist area does not need to. In this way, the night shops are removed from the non-tourist edge and a concentration in the tourist zone is created, aggravating the problem. Through the current new law, we will eliminate discrimination and restore equal playing conditions for all night shops.

With the proposed amendment, we close the backdoors and finally give the seaside cities and tourist centres the power to direct their own economies. They are and remain in the best position to determine what is good for the city, its inhabitants and its visitors. The new text gives beach towns and tourist centers the power to impose, for their own needs, restrictions on the opening hours not yet existing.

                    Het is dus alleen aan de betreffende gemeenten en steden om te beslissen wanneer winkels open moeten zijn en wanneer ze moeten sluiten. Natuurlijk is het daarbij belangrijk te noteren dat de beperkingen niet verder mogen gaan dan de verplichte sluitingsuren buiten de toeristische zones. Tussen 5 uur en 20 uur moeten winkels open kunnen zijn. Alle geldende uitzonderingen voor bijvoorbeeld nachtelijke releases van een boek of film blijven uiteraard van toepassing. Daarvoor hoeft u zich geen zorgen maken.

Die wijziging is mogelijk, maar is geen verplichting. Het is aan elke gemeente zelf om die afweging te maken. Waar dat nodig is, kan men de wildgroei nu onder controle krijgen en ervoor zorgen dat de discriminatie tussen winkels binnen en buiten de toeristische zone verdwijnt.

Een ander groot voordeel van de nieuwe wetgeving is dat de gemeenten zelf hardleerse handelaars zullen kunnen sanctioneren. Als een gemeente ervoor kiest de openingsuren te beperken, moeten de handelaars zich daaraan houden. Met de voorgestelde tekst krijgen de gemeenten zelf de mogelijkheid om bij overtredingen via de GAS-wet tot sancties over te gaan. Dat kan gaan van een geldboete bij een eerste overtreding tot zelfs sluiting, in extreme gevallen bij herhaaldelijke overtredingen. Opnieuw, het is de gemeente, die hier het best geplaatst is om te bepalen welke straffen nodig zijn.

Met de wijziging is een gat in de bestaande wetgeving, waardoor gemeentelijke reglementen konden worden ondermijnd, gedicht. Bovendien wordt de bestaande discriminatie tussen nachtwinkels van binnen en buiten de toeristische zone aangepakt. Badsteden en toeristische steden krijgen nu eindelijk waarop zij recht hebben, namelijk de mogelijkheid om de lokale economie te sturen naar het beeld van de stad om een zo goed mogelijke harmonie te realiseren. Openingsuren kunnen worden opgelegd en ook de sanctioneringsbevoegdheid komt hun toe.

Veel burgemeesters en schepencolleges van alle politieke strekkingen worden al jaren geconfronteerd met een ongewenste situatie, waaraan zij zelf niets konden doen. Met onderhavige wetswijziging bieden wij hun een oplossing aan.

This can range from a fine for a first infringement to even closure, in extreme cases for repeated infringements. Again, it is the municipality, which is best placed here to determine which penalties are needed.

With the amendment, a gap in existing legislation, which could undermine municipal regulations, is poised. Furthermore, it addresses the existing discrimination between night shops inside and outside the tourist zone. Bathing cities and tourist cities now finally get what they are entitled to, namely the ability to direct the local economy to the image of the city to realize the best possible harmony. Opening hours may be imposed and the sanctioning power also belongs to them.

Many mayors and shipping colleges of all political facets have been facing an unwanted situation for years, with which they themselves could do nothing. With this legislative amendment, we offer them a solution.

                    Monsieur le président, messieurs les ministres, chers collègues, notre commission de l'Économie a consacré beaucoup de temps à étudier la question des heures d'ouverture dans les magasins.

Dans un premier temps, des auditions ont été organisées à l'initiative du groupe Open Vld avec sa proposition de loi visant à étendre les heures d'ouverture, proposition qui, au final, a reçu peu de soutien de la part des membres de la commission (majorité et opposition): un seul vote favorable, personne n'ayant été convaincu du bien-fondé des arguments avancés par les auteurs! On ne pourra donc pas acquérir un smartphone en Belgique un dimanche à 4 h du matin comme à New York! Ouf!

Dans un second temps, six autres propositions de loi ont été examinées au départ de la proposition de loi initiée par le groupe N-VA visant à limiter les heures d'ouverture dans les stations balnéaires et les centres touristiques. Le moins que l'on puisse dire, c'est qu'une certaine cacophonie ou une cacophonie certaine a régné au sein de la majorité autour de ces différentes propositions de loi, le ministre Borsus annonçant un projet de loi qui n'est finalement jamais arrivé.

Bref, tout ce travail a accouché d'une souris. C'est en quelque sorte une occasion manquée. En effet, les autres propositions de loi de l'opposition contenaient des éléments concrets. Nous aurions pu réaliser un travail parlementaire de qualité (majorité et opposition), car les objectifs, les constats ne faisaient l'objet d'aucune divergence de points de vue. Peut-être y en avait-il sur les moyens pour y parvenir. Nous aurions pu œuvrer ensemble pour revoir, amender, corriger la loi de base de 2006 sur les heures d'ouverture des commerces. Telle n'est pas la voie qui a été sélectionnée par la majorité qui a refusé la discussion des propositions de loi de l'opposition. Je ne peux que le déplorer.

Nous avions élaboré un document de synthèse des propositions des uns et des autres en vue d'examiner la façon de remédier à une série de problèmes qui se posent. Nous recherchions un consensus. Celui-ci n'a pas abouti. Je le répète, c'est une occasion manquée. Een gemiste kans, mijnheer Klaps! Jammer genoeg!

We had prepared a summary document of each other’s proposals in order to examine how to address a series of problems that arise. We are looking for consensus. This has not succeeded. I repeat, this is a missed opportunity. A gemist chance, my lord Klaps! Sorry enough!

                    Ce travail de synthèse et de recherche de consensus a été balayé d'un revers de la main et, finalement, seule la proposition de la N-VA a été examinée.

Sur le sujet qui nous occupe, la problématique a été rappelée par le premier auteur, M. Klaps. Les stations balnéaires et les zones touristiques bénéficient d'un régime d'exception concernant les heures d'ouverture. Les magasins de nuit qui sont soumis à une autorisation communale ont très vite compris l'avantage qu'ils pouvaient tirer de cette spécificité, afin de pouvoir également ouvrir vingt-quatre heures sur vingt-quatre et ne plus relever du champ d'application de l'article 18 qui impose notamment une autorisation communale. Ils ont très vite abandonné l'appellation "magasin de nuit" et cette astuce leur permet ainsi de vider de leur substance les politiques communales qui visent à limiter et réglementer la présence des magasins de nuit en les soumettant à une autorisation communale.

Monsieur Klaps, nous étions tout à fait d'accord pour faire ce constat ensemble. Ce problème est-il spécifique à la côte belge ou aux centres touristiques? Non. Il y a sans doute là des problèmes particuliers mais je crois que l'ensemble de nos villes et communes sont confrontées à ce type de problématique.

Dans de nombreuses communes, touristiques ou non, les magasins de nuit ont profité d'un effet pervers de cette loi du 10 novembre 2006 en s'engouffrant dans la brèche ouverte par les exceptions qui sont énumérées dans son article 16, § 2. Ces magasins de nuit se sont ainsi transformés et sont devenus des magasins de tabac ou des vidéo-clubs, échappant ainsi à l'imposition d'heures d'ouverture et de repos hebdomadaire mais également, voire surtout, échappant à l'autorisation préalable d'exploitation délivrée par le collège communal ainsi qu'aux éventuels arrêts de fermeture en cas d'infraction au règlement communal. À ce petit jeu, on doit constater que l'imagination est très grande pour contourner la réglementation.

C'est d'ailleurs pour résoudre ce problème sur l'ensemble du pays, et non pas sur certaines parties de celui-ci, que le groupe socialiste, sur l'initiative de mon collègue Paul-Olivier Delannois, a déposé deux propositions de loi. Ces propositions de loi visent à obliger les commerces qui ouvrent la nuit à obtenir une autorisation préalable d'exploiter. Nous voulions ainsi donner les outils nécessaires aux communes pour leur permettre de prévenir les éventuelles nuisances et éviter ainsi l'installation de commerces de nuit dans des lieux manifestement inappropriés.

Le groupe N-VA n'a pas jugé cette solution intéressante et a préféré persévérer dans son erreur – monsieur Klaps, je vous le dis. Je donne en tout cas mon analyse de ce dossier. Il a proposé aux communes côtières et touristiques de pouvoir imposer des heures de fermeture aux magasins classiques et ne bénéficiant pas des dérogations visées à l'article 16.

Je relis cet extrait parce que les mots qu'il contient sont très importants: "ne bénéficiant pas des dérogations visées à l'article 16 de la loi de 2006". Ces termes fondamentaux signent à eux seuls l'inefficacité de la proposition de loi que la majorité s'apprête à voter.

Pire encore, on a introduit un traitement inégal des sanctions entre les unités commerciales situées en zone touristique et les autres, les premières relevant de la loi sur les sanctions administratives communales tandis que les secondes continueront à relever de la loi de 2006. De mon point de vue, cela contrevient à une interdiction constitutionnelle de discrimination – fait qui a été clairement épinglé par les services juridiques. Toujours est-il que les auteurs ont préféré ignorer cet aspect du dossier.

On peut déjà écrire le scénario comme suit. Dans quelques mois, les magasins de nuit s'engouffreront dans les dérogations prévues à l'article 16, § 2. La côte belge, de Vlaamse kust, et d'autres centres touristiques verront fleurir des magasins de tabac et des vidéo-clubs qui pourront continuer, comme si de rien n'était, à ouvrir vingt-quatre heures sur vingt-quatre comme bon leur semble. Peut-être la solution proposée sera-t-elle utile pour quelques mois, mais elle ne sera pas durable.

Nous évaluerons donc cette loi dans quelques mois, dans six mois ou un an. Donnons-nous rendez-vous pour constater l'échec de la proposition de loi qui nous est soumise aujourd'hui.

Night shops subject to a municipal authorization quickly understood the advantage that they could draw from this specificity, so that they could also open twenty-four hours in twenty-four and no longer fall within the scope of Article 18, which requires in particular a municipal authorization. They quickly abandoned the term "night store" and this trick allows them to empty from their substance the municipal policies that aim to limit and regulate the presence of night shops by subjecting them to a municipal authorization.

Mr. Klaps, we totally agreed to make this conclusion together. Is this problem specific to the Belgian coast or tourist centers? and no. There are ⁇  particular problems here, but I believe that all our cities and municipalities are facing this type of problem.

In many municipalities, tourist or non-tourist, night shops have benefited from the perverse effect of this law of 10 November 2006 by sinking into the open gap by the exceptions listed in its article 16, § 2. These night shops have thus been transformed into tobacco shops or video-clubs, thus escaping the imposition of opening hours and weekly rest but also, or even above all, escaping the prior authorisation of operation issued by the municipal college as well as the possible closure decisions in case of violation of the municipal regulation. In this little game, one must find that the imagination is too big to bypass the regulation.

In order to solve this problem on the whole country, and not on certain parts of it, the socialist group, on the initiative of my colleague Paul-Olivier Delannois, submitted two bills. These legislation proposals aim to compel shops that open at night to obtain a prior authorization to operate. We thus wanted to give the necessary tools to the municipalities to enable them to prevent possible annoyances and thus avoid the installation of night shops in clearly inappropriate places.

The N-VA group did not find this solution interesting and preferred to persist in its mistake – Mr. Klaps, I tell you. In any case, I give my analysis of this case. It proposed to the coastal and tourist municipalities to be able to impose closing hours on traditional stores and not benefiting from the derogations referred to in Article 16.

I read this excerpt because the words it contains are very important: "not benefiting from the derogations referred to in article 16 of the 2006 law". These fundamental terms alone sign the ineffectiveness of the bill that the majority is about to vote.

Even worse, there has been an unequal treatment of sanctions between commercial units located in the tourist area and the others, the first ones falling under the Act on Municipal Administrative Sanctions, while the latter ones will continue to fall under the Act of 2006. From my point of view, this is contrary to a constitutional prohibition of discrimination – a fact that has been clearly struck by the legal services. The authors preferred to ignore this aspect of the case.

The script can be written as follows. Within a few months, night shops will be immersed in the derogations provided for in Article 16, § 2. The Belgian coast, Vlaamse kust, and other tourist centers will see flourishing tobacco shops and video-clubs that can continue, as if nothing was, to open twenty-four hours of twenty-four as they want. Per ⁇  the proposed solution will be useful for a few months, but it will not be sustainable.

So we will evaluate this law in a few months, in six months or a year. Let us make an appointment to see the failure of the bill that is submitted to us today.

Pour rappel, du fait de leur spécificité, ces territoires bénéficient d'un régime dérogatoire au droit commun prévu par la loi du 10 novembre 2006 en matière d'heures d'ouverture et de jours de fermeture hebdomadaires. Les commerces traditionnels situés dans ces territoires peuvent rester ouverts 24 heures/24 et 7 jours/7. Si cette exception représente un intérêt certain pour les commerçants et pour les consommateurs, il faut constater que les zones touristiques sont cependant confrontées ces dernières années à un phénomène qui peut parfois présenter certains inconvénients pour les habitants de ces territoires. En effet, suite aux mesures adoptées par certains pouvoirs locaux situés en dehors des zones touristiques pour lutter contre le développement trop important des magasins de nuit, il se fait que les communes situées dans des zones touristiques sont désormais confrontées à une prolifération de ce type de commerces. Or il s'avère qu'un certain nombre de night-shops, une fois situés dans les zones touristiques, contournent les règlements communaux sur les magasins de nuit, en ce compris l'autorisation communale préalable qui y est attachée, en se faisant passer pour des commerces traditionnels. Ils vident ainsi la loi de 2006 de sa substance en profitant des régimes dérogatoires prévus pour les zones touristiques.

À l'instar d'autres établissements, les night-shops ont un rôle économique à part entière. Il est important de ne pas stigmatiser l'ensemble des commerçants de nuit qui, comme l'ensemble des indépendants, contribuent au dynamisme de notre tissu de PME, mais aussi parfois à la création d'emplois.

                    Cela étant dit, nous sommes également conscients de certains désagréments générés par la prolifération de ce type de commerces dans des quartiers qui ne sont pas nécessairement adaptés au développement de ces établissements.

Certaines communes sont par ailleurs parfois confrontées à certaines fraudes sociales.

La proposition de loi offre la possibilité aux pouvoirs locaux de fixer des heures d'ouverture dans les zones touristiques. Il était important de veiller à ce qu'ils ne puissent cependant aller en deça des heures d'ouverture prévues pour les territoires situés en dehors de ces zones. C'est à cet effet qu'avec d'autres collègues, nous avons déposé un amendement permettant de préciser ces éléments dans la proposition de loi.

Nous avons également veillé à ce que certains types de commerces, bénéficiant déjà de la dérogation concernant les heures d'ouverture en dehors des zones touristiques, ne soient pas pénalisés.

Enfin, la proposition de loi offre la faculté aux pouvoirs locaux de sanctionner les violations de leur règlement communal fixant les heures d'ouverture conformément à la loi du 24 juin 2013 sur les sanctions administratives communales.

Nous avons veillé à préciser, pendant nos travaux en commission, que ce nouveau régime de sanctions ne pourra en aucune façon être considéré comme étant en contradiction avec le régime prévu par les dispositions pénales visées par l'article 22 de la loi du 10 novembre 2006. Ce régime ad hoc s'explique par la situation spécifique à laquelle sont confrontées les communes situées en zone touristique, dès lors que ces pouvoirs locaux doivent prévoir un règlement ad hoc concernant les heures d'ouverture afin de déroger à la loi de 2006, contrairement aux autres communes, dont le régime est déjà régi par ladite législation.

We have taken care to clarify, during our committee work, that this new sanctions regime cannot in any way be considered to be contrary to the regime provided for by the criminal provisions referred to in Article 22 of the Law of 10 November 2006. This ad hoc regime is explained by the specific situation faced by municipalities located in a tourist area, since these local authorities must provide for an ad hoc regulation on opening hours in order to derogate from the Act of 2006, unlike other municipalities, whose regime is already governed by that legislation.

The unions of Brussels, Flemish and Walloon cities and municipalities welcomed this legislative initiative. It must be said that the local authorities, in the first line in this case, constitute field actors obviously sensitive to the management of this type of problem.

Wij hebben met de meerderheid ook een meerderheidsamendement ingediend op het wetsvoorstel van de heer Klaps om nog een aantal zaken te verduidelijken. Wij willen zeker verduidelijken dat een beperking op de globale vrijheid van openingsuren in die zones en centra via het gemeentelijk reglement, dus niet via de burgemeester, door die steden of gemeenten kan worden toegestaan, wanneer het alle vestigingseenheden in die stad of gemeente betreft en het dus niet aan individuele handelszaken is gericht. Trois principes fondamentaux ont guidé mon groupe dans l'analyse du texte, car ils lui sont chers. Le premier a trait au développement du commerce local, de l'activité économique des petits indépendants dans les centres-villes.

Le deuxième concerne leur qualité de vie, l'équilibre entre leur vie de famille et leur travail. Ils doivent bénéficier, par exemple, d'un emploi durable.

Le troisième porte sur l'autonomie des communes et des pouvoirs locaux. Il importe, en effet, qu'ils puissent prendre des décisions en cas de nuisances nocturnes et de prolifération de certains commerces indésirables.

Ces principes nous amènent à une réflexion plus globale. Comme l'ont dit quelques collègues, le texte n'est pas parfait. Certains points peuvent ainsi conduire à une relative confusion. Plusieurs types de commerce pourraient contourner la règle; nous savons que c'est déjà le cas. Toutefois, comme nous avons envie d'être constructifs, nous soutiendrons cette proposition dans la mesure où elle va dans la bonne direction. Cela dit, je me joins à la demande d'évaluation. Dans un an ou deux, il faudra mesurer l'effet de ces dispositions dans les zones touristiques et les stations balnéaires. En tout cas, nous soutiendrons ce texte dans un esprit positif.

These principles lead us to a more comprehensive reflection. As many have said, the text is not perfect. This can lead to some relative confusion. Several types of trading could bypass the rule; we know that is already the case. However, as we want to be constructive, we will support this proposal as far as it goes in the right direction. I agree with the request for an assessment. Within a year or two, the effect of these provisions on tourist areas and resorts will need to be measured. In any case, we will support this text in a positive spirit.

Les problèmes rencontrés par les communes sont nombreux et, dans ce secteur, les nuisances sont parfois multiples. Certaines communes sont confrontées à des troubles de l'ordre public, eu égard à ces magasins de nuit: tapage, ivresse publique, bagarres, débordements, etc., troubles occasionnés par la présence de magasins non réglementés. De plus, des incidents à des degrés plus élevés impliquant des infractions pénales sont également constatés. Il suffit de le vérifier sur le terrain.

Certes, des règlements communaux peuvent être pris pour réglementer les magasins de nuit sur la base du maintien de l'ordre public. La sécurité, la tranquillité publique, vous connaissez cela! Malheureusement, des magasins trouvent des subterfuges pour ne pas y être soumis.

Actuellement, la loi permet aux communes de réglementer l'ouverture des magasins de nuit, des internet et phone cafés. Hélas, cette possibilité de réglementation disparaît lorsque le magasin vend, à titre principal, certains types de produits limitativement énumérés, tels que journaux, magazines, produits de tabac et cartes téléphoniques, notamment. À la base, cette disposition était une exception pour protéger les libraires, ce qui est indispensable. En effet, le nombre de librairies diminue de manière significative.

Aujourd'hui, pour contourner les règlements communaux, nombre de magasins de nuit profitent de cette disposition. Si les ventes de tabac et de DVD représentent 50 % de leur chiffre d'affaires, ils changent leur dénomination sociale et leurs statuts en débit de tabac. Ils ne sont ainsi plus soumis à ces règlements communaux. Face à ce phénomène, les communes sont démunies.

Deux textes avaient été déposés à ce sujet. Ils ont été balayés d'un revers de la main. Nous y reviendrons, soyez-en sûrs, dans les prochaines semaines!

Currently, the law allows municipalities to regulate the opening of night shops, internet and phone cafes. Unfortunately, this possibility of regulation disappears when the store primarily sells certain types of products listed restrictively, such as newspapers, magazines, tobacco products and phone cards, in particular. Basically, this provision was an exception to protect bookstores, which is indispensable. The number of bookstores is decreasing significantly.

Today, to bypass municipal regulations, many night shops take advantage of this provision. If the sales of tobacco and DVD account for 50% of their turnover, they change their company name and status in tobacco flow. They are no longer subject to these regulations. In the face of this phenomenon, municipalities are impoverished.

Two texts were submitted on this subject. They were cut off from one side of the hand. We will be back there, be sure, in the coming weeks!

Pour notre groupe, il était donc nécessaire et même impératif d'avancer d'une façon coordonnée et de réaliser une révision globale de la loi du 10 novembre 2006 relative aux heures d'ouverture dans le commerce, l'artisanat et les services. Les communes ont besoin d'être parfaitement outillées face à cette problématique. Six textes étaient sur la table concernant cette loi. En se limitant aux magasins de nuit, il y en avait trois. Nous aurions pu travailler en la matière; nous ne l'avons pas fait. La moitié des textes abordaient cette problématique. C'est une occasion ratée d'aider les communes dans lesquelles certains magasins de nuit occasionnent des troubles de voisinage. On aurait pu les aider à régler ce problème, à leur ouvrir la boîte à outils, et on ne le fait pas.

C'est aussi un manque de prise de responsabilités du gouvernement. En effet, le ministre Borsus avait précisé, lors du débat concernant sa note de politique générale, vouloir avancer en la matière par une révision en profondeur et il avait annoncé un projet de loi. Entre-temps, nous n'avons rien vu venir, et ce n'est pas une surprise. Il n'avait rien fait d'autre que de reprendre les déclarations de Mme Laruelle dans le précédent gouvernement. Elle avait dit: "Il est clair que pour lutter contre les incivilités, les mieux placées sont les communes et les zones de police." Elle proposait de doter les communes de davantage de possibilités d'action, comme on l'a fait pour les magasins de nuit en ce qui concernait notamment le tabac.

In the meantime, we did not see anything coming, and this is not a surprise. He did nothing other than take back the statements of Ms. Laruelle in the previous government. She had said: "It is clear that in order to fight incivilities, the best positions are the municipalities and the police areas." She proposed to provide the municipalities with more possibilities of action, as was done for night shops in particular with regard to tobacco.

Les débits de boissons, les méga-dancings faisaient aussi partie des problèmes que les propositions de loi essayaient de résoudre.

Par ailleurs, la divergence de jurisprudence entre le Conseil d'État et la Cour de cassation entraîne un flou juridique qu'il paraissait nécessaire de lever. En effet, lorsque les communes adoptent un règlement, elles ne peuvent savoir la décision qui sera prise à l'égard de la mesure et si le règlement sera cassé. Nous avions également un texte pour régler cela mais, malheureusement, il a été rejeté.

C'est donc une fuite du gouvernement, puisque le ministre n'a pas déposé son projet, et un manque d'ambition de la majorité, monsieur Klaps. On a préféré rejeter les textes de l'opposition et uniquement voir la situation des stations balnéaires et des centres touristiques. On a donc réduit le champ d'application de manière significative.

Cela a été rejeté, certes, mais en démontrant au sein de la majorité des positions bien différentes. Le président, ici présent, pourra nous le dire aussi. Je n'ai jamais vécu cela. Sur certains articles, on a recommencé le vote trois, quatre voire cinq fois pour essayer de savoir ce que chacun voulait. Monsieur le président, vous vous en souviendrez!

Monsieur Friart, je me permets de souligner le vote de votre parti – vous y étiez – qui est le grand défenseur des PME et qui ne s'est même pas positionné contre un autre texte en discussion prévoyant l'extension des heures d'ouverture, ce qui pourtant porterait fortement préjudice aux PME en favorisant la grande distribution. C'est ce qui se passe. Rappelons que cette proposition avait aussi été totalement rejetée par les partenaires sociaux.

Soit! Il y avait clairement les textes qui auraient pu améliorer la vie dans nos communes et régler une grande partie des nuisances. Mais non, nous n'y avons pas travaillé et je ne peux que regretter ce manque d'ambition de la majorité.

This was rejected, of course, but demonstrating within the majority of very different positions. The President, who is present here, will also be able to tell us. I have never experienced this. On some articles, we re-started the vote three, four or even five times to try to know what each wanted. You will remember it!

Mr. Friart, I allow myself to highlight the vote of your party – you were there – who is the great advocate of SMEs and who has not even positioned against another text in discussion that provides for the extension of opening hours, which, however, would be very harmful to SMEs by favouring large distribution. That is what happens. This proposal was also completely rejected by the social partners.

It is ! There were clearly the texts that could have improved life in our communes and settled much of the annoyances. But no, we did not work on it and I can only regret this lack of ambition of the majority.

                    Selon nous, le texte en discussion aujourd'hui n'est pas finalisé. Il s'agit d'un costume mal taillé, monsieur Friart.

Ce texte permet, il est vrai, aux communes, de réglementer les commerces des stations balnéaires et des communes ou parties de communes reconnues comme centres touristiques qui actuellement ne tombent pas sous les articles prévoyant les limitations d'horaires. Les communes pourront effectivement mieux contrôler car les agents communaux et divers fonctionnaires seront notamment compétents pour détecter les infractions. Mais ce texte ne permet pas de résoudre le problème des commerces qui utilisent la dérogation prévue à l'article 16, § 2 parce que plus de 50 % de leur chiffre d'affaires résulte de la vente de tabac, de journaux, etc. Cet aspect a encore été abordé, cet après-midi.

Les magasins de nuit qui souhaitaient donc déroger aux règlements communaux en s'inscrivant comme commerces classiques choisiront dorénavant de s'inscrire en tant que débits de tabac. La commune sera tout autant démunie face à ce statut. Ce problème aurait pu – je le rappelle – être résolu avec d'autres textes déposés notamment par notre groupe.

Pour ce qui concerne les sanctions – question qui a également été abordée, aujourd'hui –, le choix a été d'écrire une disposition précisant que les unités d'établissements exploités en violation du règlement communal sont uniquement punies conformément à la loi du 24 juin 2013 relative aux sanctions administratives communales.

"Uniquement". Cet adverbe qui nous a occupés durant une partie de la réunion de commission a été inséré pour résoudre le problème soulevé par les services légistiques de la Chambre qui ont mis en évidence qu'il existe des dispositions pénales légales et que, dans ce cas, on ne peut infliger des sanctions administratives communales.

Nous ne sommes pas convaincus que cela va résoudre le problème. Au regard de la loi SAC, il reste un traitement illégal entre les établissements qui sont situés ou non dans les stations balnéaires et les centres touristiques ou dans des communes reconnues comme telles.

L'Union des villes et des communes ne s'y est pas trompée. Elle a précisé qu'il aurait été plus opportun d'écrire une disposition finale précisant l'application de sanctions à tout règlement adopté en vertu de la présente loi et de ne pas renvoyer à la loi SAC.

Nous allons donc nous retrouver face à un conflit de sanctions. C'est pour cette raison que je ne donne pas cher de cette proposition de loi et qu'il faudra revenir sur le sujet lorsqu'elle aura été mise en œuvre.

The municipality will be equally vulnerable to this situation. This problem, I recall, could have been solved with other texts submitted, in particular by our group.

With regard to the sanctions – a matter that was also addressed today – the choice was to write a provision specifying that units of establishments operated in violation of the Municipal Regulations are only punishable in accordance with the Act of 24 June 2013 on Municipal Administrative Sanctions.

Onze fractie steunt dit wetsontwerp, in die zin dat het een eerste stap is die het mogelijk maakt om ook binnen Defensie aan telewerk te doen. We zijn het absoluut eens met de doelstellingen van het plan om werken op afstand mogelijk te maken. Het wetsontwerp heeft als doel werk en privéleven beter op elkaar af te stemmen. Voor een personeelslid dat op de gewone werkplek bij Defensie werkt geldt een bepaalde regeling inzake de arbeidstijd waarbinnen hij wordt geacht het gevraagde werk uit te voeren.

Bij telewerk is het eerder de bedoeling om projectmatig te werken. Hierbij moeten bepaalde taken tegen een bepaald tijdstip afgewerkt worden. De werker op afstand krijgt dan de vrijheid om binnen een ruimer tijdsbestek dan de klassieke kantooruren zijn taak uit te voeren. Zo moet het bijvoorbeeld mogelijk zijn dat een telewerker zijn of haar kinderen naar school brengt en terug gaat halen.

Dit ontwerp is volgens ons nog maar een start. In de toekomst zal dit, enerzijds, geëvalueerd worden en, anderzijds, mogelijks uitgebreid moeten worden om te voldoen aan de nieuwe noden die een efficiënte en duurzame werking van Defensie en het personeel vereist.

Uiteraard werkt het principe van telewerk via een vertrouwensband. Een evaluatie hiervan kan echter enkel verbeteringen meebrengen. Wij vragen om bij een toekomstige evaluatie ook de voorziene vergoedingen te evalueren. Het wetsontwerp voorziet in artikel 12, ten eerste enkel een forfaitaire vergoeding van 62 eurocent per dag voor de internetaansluiting van de telewerker. Bij een evaluatie en een eventuele uitbreiding naar satellietwerkplekken moet eventueel bekeken worden of de mogelijkheid bestaat eveneens een vergoeding toe te kennen voor verwarmings- en/of elektriciteitkosten zoals dat in de privésector het geval is.

We absolutely agree with the objectives of the plan to enable remote work. The draft law aims to better align work and private life. Cela étant dit, je prendrai brièvement la parole au nom du groupe PS.

Le projet de loi qui nous est soumis a pour but d'instaurer le travail à distance au sein du ministère de la Défense pour le personnel militaire. Si nous soutenons ce projet, c'est tout simplement parce que nous pouvons souscrire aux objectifs affichés par un tel projet. Il s'agit d'un moyen pour moderniser l'organisation du travail au sein de ce département, en offrant une possibilité additionnelle aux membres du personnel militaire de la Défense de mieux concilier travail et vie privée en disposant d'une plus grande autonomie dans l'exécution de leurs tâches.

Cependant, puisque nous parlons de l'armée, il s'agit bien évidemment de se rendre compte qu'un tel projet ne peut s'appliquer à toutes les tâches des militaires et implique également de l'accompagner des mesures matérielles et de sécurité qui s'imposent.

Il semble que ce projet ait été bien discuté dans une approche plus globale avec les syndicats et reprend les commentaires du Conseil d'État, ce que nous pouvons saluer.

Notre groupe rappelle également son souhait que M. le ministre veille à éviter qu'un tel projet se transforme en mesure potentiellement vexatoire, puisqu'il s'agira d'un pouvoir discrétionnaire du chef de corps et que des doubles standards peuvent donc être faits en la matière.

S'il faut effectivement enquêter sur les fautes éventuelles commises dans le passé, il faut surtout et avant tout œuvrer pour que le RER soit achevé aussi rapidement que possible. Cet audit ne doit donc pas nous détourner de l'objectif final, et ne doit surtout pas servir de prétexte au gouvernement pour lui éviter de prendre ses responsabilités.

Le spectacle qu'il nous a malheureusement été donné de voir cette semaine, au cours de laquelle le gouvernement a dit tout et son contraire concernant la mise à quatre voies des lignes 161 et 124, n'est évidemment pas pour nous rassurer. Ni le fait, d'ailleurs, que la ministre Galant n'ait pas fait de l'achèvement du RER une priorité absolue dans le cadre de l'ajustement budgétaire des prochains jours. Elle nous l'a confirmé hier en commission. Ceci nous fait évidemment craindre un report de ce projet aux calendes grecques.

C'est pourquoi nous voulions instaurer un monitoring bimestriel concernant l'état d'avancement des travaux et l'évolution du Fonds RER. Ce monitoring pourrait être réalisé conjointement par la cellule RER de la SNCB, par Infrabel et par le SPF Mobilité. Nous voulions également, par ce biais, que le parlement soit régulièrement informé par les représentants de ce comité de monitoring, afin qu'il puisse jouer un rôle efficace, un rôle de contrôle. Il aurait pu de cette façon s'assurer que le gouvernement s'en tenait effectivement à ses déclarations et à sa volonté claire de finaliser rapidement la mise à quatre voies des lignes 124 et 161.

La majorité a préféré accorder une confiance aveugle aux paroles de la ministre et elle a donc rejeté cet amendement.

Il est en outre raisonnable de se demander comment ces investissements ont pu subir de tels retards et de tels dépassements budgétaires. Un audit de la Cour des comptes est dès lors important pour faire la lumière sur ce dossier particulièrement complexe.

Le rapport de la Cour des comptes qui s'en suivra permettra, je l'espère très sincèrement, à tous les parlementaires, de la majorité comme de l'opposition, d'avoir une vision beaucoup plus nette et correcte de l'évolution de cet important projet qui, je vous le rappelle, caractérise notre vie politique depuis déjà de nombreuses années.

Je ne vais pas vous en refaire l'historique mais je soulignerai deux éléments: l'aberration de l'imbroglio institutionnel qui caractérise notre pays et une politique d'austérité assez récurrente. Je me souviens aussi de cette polémique avec la ministre Galant, qui avait parlé d'un RER à deux voies. En fait, c'est le MR qui a parlé à deux voix puisqu'il a contredit sa ministre.

Cette proposition me semble digne d'intérêt et mérite d'être soutenue. Nous proposons deux amendements. Le premier demande d'ajouter à la mission de la Cour des comptes l'examen de l'impact qu'a pu avoir la scission d'Infrabel et de la SNCB. Le second demande d'analyser l'influence de la clé de répartition 60/40 entre Flandre et Wallonie afin de savoir si celle-ci a influé sur le retard du RER.
